[01:14.880 --> 01:18.720]  have been dropping marijuana possession charges and even refusing to file new ones,
[01:18.720 --> 01:23.200]  since they are stipulating that they do not have the time or the laboratory equipment to test the
[01:23.200 --> 01:28.240]  Europe for THC. Margaret Moore, the Travis County District Attorney, announced earlier this month
[01:28.240 --> 01:33.440]  that she was dismissing 32 felony possession and delivery of marijuana cases because of the law.
[01:33.440 --> 01:37.840]  Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter to
[01:37.840 --> 01:42.800]  county district attorneys back on Thursday that marijuana has not been decriminalized in Texas
[01:42.800 --> 01:48.800]  and that these actions demonstrate a misunderstanding of how HB 1325 works, as well as other
[01:48.800 --> 01:55.600]  cities too, like the District Attorney in El Paso, Cayma Esparza, a Democrat who also stated earlier
[01:55.600 --> 02:00.720]  this month that the law, quote, will not have an effect on the prosecution of marijuana cases in
[02:00.720 --> 02:06.720]  El Paso. However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.720 --> 02:11.200]  in Harris County, who stated that, quote, the law is constantly changing on what makes something
[02:11.200 --> 02:15.920]  illegal based on its chemical makeup. It's important that if someone is charged with something,
[02:15.920 --> 02:24.960]  the test matches what they're charged with. A paper by Tulane University identified a five
[02:24.960 --> 02:30.640]  and a half inch American pocket shark as the first of its kind in the Gulf of Mexico, the specimen
[02:30.640 --> 02:36.160]  being only the second pocket shark ever captured or recorded with the other one being found way
[02:36.160 --> 02:41.760]  back in 1979 in the East Pacific Ocean. According to the university paper, the shark secretes a

[05:38.320 --> 05:43.880]  And then I saw him in the courthouse the next day and I said, hello, David, how are things

[05:44.880 --> 05:48.560]  He said, hello, Mr. Kelton, you're going to try to get me arrested again today?
[05:48.560 --> 05:52.640]  Oh, that, heck, I was just joshing, wasn't that a hoot?
[05:52.640 --> 05:59.440]  Funny thing is very funny and today I told him that I get to tell that story all the
[05:59.440 --> 06:03.720]  time on the radio and we laughed and we laughed.
[06:03.720 --> 06:11.200]  He still didn't think it was very funny, but I went down to see the grand jury, but I got

[06:15.680 --> 06:24.280]  So I had verified criminal affidavits for him and I had a copy for the prosecutor, but
[06:24.280 --> 06:27.760]  I wouldn't give it to him.
[06:27.760 --> 06:34.000]  And so I went, I had a copy that was addressed to some magistrate.
[06:34.000 --> 06:41.960]  These were all nice bound with covers and cover page and so the judge who's handling
[06:41.960 --> 06:45.160]  the grand jury was named Bosworth.
[06:45.160 --> 06:51.120]  So I went into his courtroom and went up and told him I had business with the court and
[06:51.120 --> 06:56.960]  they sent me up to the bailiff and I told him I had business with the court and he said,
[06:56.960 --> 06:58.520]  well, what's the nature of your business?
[06:58.520 --> 07:00.720]  I said, here, give the judge this.
[07:00.720 --> 07:08.960]  It's a bound tablet that on the front says to some magistrate.
[07:08.960 --> 07:15.040]  He says, just as some magistrate and he took it back to the judge and then brought it back
[07:15.040 --> 07:18.200]  out and said, the judge said he won't take anything that's not file stamped.
[07:18.200 --> 07:19.800]  I said, yes, he will.
[07:19.800 --> 07:22.320]  Well, we're not going to take this.
[07:22.320 --> 07:29.080]  Yeah, yeah, you will put it down in the corner.
[07:29.080 --> 07:31.400]  He said, I have to go down and file it with the clerk.

[07:34.160 --> 07:39.600]  It gets filed with some magistrate and he is one of those magistrates.
[07:39.600 --> 07:43.920]  Well, he's not going to accept it and said, you're going to have to find another way to

[07:45.920 --> 07:50.560]  I took out my phone down 9-1-1 and they couldn't hear me.

[07:55.160 --> 07:58.280]  I went outside and they couldn't hear me on the 9-1-1.

[08:09.600 --> 08:16.520]  The female clerk I talked to a few days before, the last time I was down there, they were

[08:24.800 --> 08:31.880]  I need to use your phone and she thinks I'm joking because I was laughing and joking with

[08:32.880 --> 08:37.560]  She said, well, I don't have a phone, not your phone, I need to use the clerk's phone.
[08:37.560 --> 08:45.240]  I need you to pick up that phone over there and dial 9-1-1 and she still thinks I'm joking.
[08:45.240 --> 08:49.560]  And I said, ma'am, I believe you think I'm joking, well, aren't you?

[08:51.440 --> 08:55.240]  I need you to dial 9-1-1 and give me the phone.

[08:59.440 --> 09:06.080]  She did and the guy come out and said, well, you really ought to ask the bailiffs out there

[09:08.080 --> 09:10.200]  And I said, that's a reasonable request.
[09:10.200 --> 09:13.200]  After I asked you, it occurred to me I should have asked the bailiffs.
[09:13.200 --> 09:14.200]  So, okay, I'll go do that.
[09:14.200 --> 09:19.800]  And I went, told the bailiffs, these two bailiffs are standing there and I said, well, how things
[09:19.800 --> 09:20.800]  going?
[09:20.800 --> 09:21.800]  They said, pretty good.
[09:21.800 --> 09:23.800]  I said, well, it's about to go downhill.
[09:23.800 --> 09:26.080]  Well, why is that?
[09:26.080 --> 09:28.600]  You know, they kind of looked tense.
[09:28.600 --> 09:34.520]  Well, I need you to call 9-1-1 and get me an officer out here to arrest the district
[09:34.520 --> 09:35.520]  judge.
[09:35.520 --> 09:40.320]  Well, their day went downhill.
[09:40.320 --> 09:45.440]  They looked at me like I had just pulled the pin on a hand grenade.
[09:45.440 --> 09:53.240]  And the one who said, kind of, sort of, the one said, well, if this is not an emergency,
[09:53.240 --> 09:54.240]  I'm not going to call 9-1-1.
[09:54.240 --> 09:55.240]  Well, that'll work.
[09:55.240 --> 10:00.720]  They called the sheriff's department, their non-emergency number, and get me an officer
[10:00.720 --> 10:05.800]  out here to take my criminal complaint against the judge.
[10:05.800 --> 10:12.080]  And they got their sergeant instead and her sergeant, oh, I thought I had her name in
[10:12.080 --> 10:16.320]  front of me, but I'll think of it in a minute.
[10:16.320 --> 10:27.800]  I had seen her in there before and she looked professional but was very polite and she smiled
[10:27.800 --> 10:30.040]  and joked and talked with everybody.
[10:30.040 --> 10:31.680]  I liked what I saw.
[10:31.680 --> 10:35.480]  Well, she came up and said, what can I do for you, I need you to arrest the district
[10:35.480 --> 10:36.480]  judge.
[10:36.480 --> 10:40.600]  Oh, well, oh, I can't do that.
[10:40.600 --> 10:41.600]  You can.
[10:41.600 --> 10:45.440]  Just go in there and throw the cuffs on him and drag him off to jail.
[10:45.440 --> 10:50.720]  Well, why would I arrest the district judge, class A, misdemeanor, freshman, question,
[10:50.720 --> 10:55.800]  criminal violation, 3903 penal code, in that he failed to perform a duty he was required
[10:55.800 --> 11:00.680]  to perform it in the process, denied me the full free access to her enjoyment of a right.
[11:01.960 --> 11:08.280]  And she said, well, I don't know about all that legal research. All I deal in is the elements.
[11:09.480 --> 11:17.560]  That's what I just gave you. She obviously didn't know what the elements were. She was
[11:17.560 --> 11:25.240]  wanting me to tell her a story. And I wasn't wanting to tell her a story. I was wanting someone to take
[11:25.240 --> 11:32.360]  my criminal affidavit. And she wasn't wanting to do that. So I told her, I need you. I lifted
[11:32.360 --> 11:38.600]  a hurry. I was late and I forgot my folder with all my forms in it. So I need you to go get me
[11:38.600 --> 11:46.360]  a volunteer statement so you can take my complaint. She said, well, we don't take complaints. That's
[11:46.360 --> 11:51.800]  not what we do. I said, you're a certified peace officer in the state of Texas. Aren't you? She
[11:51.800 --> 11:57.320]  just said, I'm well under 2.13. Text code, code and procedure. You take complaints.
[11:58.760 --> 12:04.600]  It seems you're really wanting to get annoyed with me. And she's trying hard not to get annoyed
[12:04.600 --> 12:14.280]  with me. But finally, I said to her, ma'am, is it not clear to you that this is not my first rodeo?
[12:14.280 --> 12:19.960]  And she said, well, I kind of got that idea. I said, good, so we're not going to have a problem,
[12:19.960 --> 12:25.240]  are we? Just go get me that voluntary statement and I'll give it to you. She said, well, I don't
[12:25.240 --> 12:33.800]  know what I'll do with it. I'm sure the sheriff will instruct you. So she went and got it and gave
[12:33.800 --> 12:39.400]  it to me and said, Mr. Kelton, if you would just fill this out, I would prefer it if you would take
[12:39.400 --> 12:47.240]  this and give it to the sheriff's department. I can do that. That's fair enough. Because she was
[12:47.240 --> 12:57.640]  so nice about it. Well, she didn't give me anything that I couldn't use against her. She was polite.
[12:57.640 --> 13:02.920]  She was professional. She was very unhappy. She was embarrassed in front of all of her people
[13:02.920 --> 13:08.520]  there because I obviously knew her code better than she did, knew her job better than she did.
[13:08.520 --> 13:20.200]  But she never let that get to her professional conduct. I was real pleased with her. I like it
[13:20.200 --> 13:28.120]  when a policeman handles me well and she handled me very well. She did not let things go south.
[13:30.120 --> 13:38.280]  She could have very quickly, but I think she already got that because I had dialed 911 twice
[13:38.280 --> 13:43.880]  already and couldn't get through. So I don't think she wanted me doing that again.
[13:44.920 --> 13:49.000]  But when I told the original deputies that I need them to call 911 and get an officer out
[13:49.000 --> 13:54.200]  here to take my complaint. And when you do, you'll get to see him do this little chicken dance.
[13:54.200 --> 14:01.320]  You'll love it. It's great fun. So they're not sure if I'm joking or not, but one thing they
[14:01.320 --> 14:13.320]  can't do is accuse me of being agitated. That's primarily why I do that. Well, I did get to talk
[14:13.320 --> 14:20.040]  to David Lloyd, the district clerk. And as usual with district clerks, they're very helpful, very
[14:20.040 --> 14:26.200]  accommodating. I explained to him what I'm doing and told him I will be back and I'll be coming after
[14:26.200 --> 14:36.280]  you. Me? What do I do? I said, well, you create criminal cause numbers and I can't figure out
[14:36.280 --> 14:44.200]  how you can do that. Well, we just get the paperwork from them, the indictments and we
[14:44.200 --> 14:51.240]  create a cause number. Yeah, but there is no probable cause finding. Well, the grand jury
[14:51.240 --> 14:56.760]  does that. I said, I understand that, but that doesn't take the place of an examining trial.
[14:58.440 --> 15:05.240]  In the record, there must be a 16.17 order or a accused has a right to discharge.
[15:06.520 --> 15:12.200]  What I can't figure out is how you can initiate a criminal prosecution with no
[15:12.200 --> 15:22.040]  determination of probable cause by magistrate. He looks like Colombo. He insisted that the
[15:24.440 --> 15:31.160]  grand jury did the probable cause. I said, no, you can't even, you can't put the
[15:33.160 --> 15:39.240]  notice of the true bill in the court record until you've issued a capious or the person's
[15:39.240 --> 15:44.040]  been arrested. Once the person has been arrested either for the original arrest
[15:45.320 --> 15:52.840]  or on your capious, it is a statutory requirement that they be taken before
[15:52.840 --> 15:58.920]  a magistrate for an examining trial. And that would get that 16.17 order sealed in an omelette
[15:58.920 --> 16:07.960]  and forwarded to you, but you don't have it. The way I see it, that means you cannot have
[16:07.960 --> 16:15.400]  subject matter jurisdiction in all your cases, a subject to be overturned. And we got to fix that.
[16:16.600 --> 16:23.480]  And he's doing this little tippy toe thing, but he was also very professional. But then again,
[16:23.480 --> 16:29.320]  he had been there with me before and he didn't want to go down that road again. And after I talked
[16:29.320 --> 16:34.440]  to him, I went to the sheriff's department and talked to them a little while. And I got there,
[16:34.440 --> 16:43.400]  one of the officers card, so I will send him a full brief along with complaints against the
[16:43.400 --> 16:48.840]  district judge. And I asked him, don't give me the prosecutor. You don't want to put this prosecutor
[16:48.840 --> 16:55.320]  among this dime. And he didn't quite understand that. And I'll explain it better when we come back.

[24:15.000 --> 24:25.480]  She was stopped by a police officer and pulled over to the side, wasn't told what she was being
[24:25.480 --> 24:33.240]  arrested for. She asked a couple times, why am I being stopped? And he wouldn't answer. He kept
[24:33.240 --> 24:39.800]  asking for the registration and insurance and she's saying, okay, but can you just tell me why I'm
[24:39.800 --> 24:47.960]  being stopped? And he wouldn't say anything. So then the asked her, well, have you had anything
[24:47.960 --> 24:56.520]  to drink tonight? And she said, well, I had something with dinner earlier. And after that,
[24:56.520 --> 25:04.040]  they asked her to step out of the car. She stepped out of the car. And while she was out of the car,
[25:04.040 --> 25:09.560]  the other two officers went through all of her personal belongings, opened her purse, her wallet,
[25:09.560 --> 25:16.040]  got her ID out of her wallet, searched the vehicle and she kept saying, I do not consent. I'm not
[25:16.040 --> 25:23.720]  driving under the commercial license. And I'm just traveling. And they said, oh, you're one of those
[25:23.720 --> 25:31.160]  sovereign citizens. And she said, well, you need to give me your, well, I don't know why he kept
[25:31.160 --> 25:36.680]  asking for information because they were going through her car, but she wouldn't answer his
[25:36.680 --> 25:45.160]  questions fast enough. And so they ended up arresting her. So they put her in the back of the car
[25:45.160 --> 25:51.640]  and she kept saying, I don't consent to you doing this to me. I don't consent to going to all my
[25:51.640 --> 25:57.720]  personal belongings in my vehicle. And while she was waiting back there, they called the tow company,
[25:57.720 --> 26:05.080]  they towed her vehicle away. And they took her to jail. And when they booked her at jail,
[26:05.960 --> 26:13.320]  they actually took her and strapped her to the chair. They handcuffed her while one officer held
[26:13.320 --> 26:21.640]  her down on one side. The other one held her arm. A woman administered a blood test and the
[26:21.640 --> 26:26.920]  supervisor came out and was just watching the whole thing, didn't say anything, didn't stop anything.
[26:28.280 --> 26:33.800]  And they booked her and she spent the night in jail, got released the following morning.
[26:34.760 --> 26:41.800]  To the moment, they hadn't told her why she had been detained, why she had been arrested, why
[26:41.800 --> 26:48.360]  they had even pulled her to the side. And she kept saying throughout the blood work,
[26:48.360 --> 26:54.840]  I don't consent to this. So that's basically in a nutshell what happened. And I'm calling to find
[26:54.840 --> 27:02.360]  out, I know they committed crimes and the procedures are probably not to proper. I should also add
[27:02.360 --> 27:10.200]  that they gave us a very difficult time releasing records. We went down the day that she was released
[27:10.200 --> 27:17.480]  to request information. They said it wasn't ready, so we came back the next day. And they
[27:18.120 --> 27:23.720]  told us, oh, you have to fill it out online. So then we filled out a records request online.
[27:23.720 --> 27:28.600]  We waited a few days, didn't hear anything, so we called. And then they said, oh,
[27:30.520 --> 27:35.480]  we're not releasing the information to you. It's all been released to the District Attorney's
[27:35.480 --> 27:43.720]  office. You'll have to deal with them. So then we looked up the record in California that,
[27:44.840 --> 27:50.760]  per the California Records Act, I believe, and we requested the information again. And this time
[27:50.760 --> 27:57.240]  they did release part of the information just today. And they said that they only gave us the
[27:57.240 --> 28:05.160]  names of the officers and their badge numbers and some CAD report that wasn't downloading. So we
[28:05.160 --> 28:13.480]  weren't able to download it. And everything else, they said they couldn't release the arrest report
[28:13.480 --> 28:19.320]  because there was no charging instrument. So I forgot to tell you the day before we went in
[28:19.320 --> 28:29.000]  person. They shouldn't have said that. Yeah, exactly. We went in person and we requested
[28:29.000 --> 28:36.360]  a copy. Well, we requested to see what the blood work was and what the supposed blood alcohol
[28:36.360 --> 28:42.920]  level was that they were saying she had. We still don't know to this moment, but they did stamp
[28:42.920 --> 28:49.960]  the letter request that I took after hesitation. I had to speak to the supervisor. They gave me
[28:49.960 --> 28:58.040]  a really hard time. And so they did stamp the paper and they told us, okay, here's your paper,
[28:58.040 --> 29:03.240]  but we don't have the blood work. We have anything to charge her with as of right now.
[29:03.240 --> 29:08.760]  So that's why we can't release it to you. And now today they're saying that we have to wait until
[29:08.760 --> 29:13.880]  the hearing during discovery for them to release the records for the remaining arrest record.
[29:13.880 --> 29:26.840]  Okay. Wow. A lot of facts. Long list. Before we can start saying do this, do that, or do the other,

[34:37.240 --> 34:44.600]  action for a lawsuit I'm filing over them arresting me and if you're going to sue them for false
[34:44.600 --> 34:56.760]  imprisonment or false arrest, one of the elements is lack of consent and by saying I do not consent
[34:56.760 --> 35:03.560]  you have established that element. Okay, but there's a lot of patriot mythology out there that says
[35:03.560 --> 35:09.640]  because you don't consent then they're not able to do something. That's not true. It only goes to
[35:09.640 --> 35:15.560]  the element of whether or not you participated in whatever they're doing and by saying I do not
[35:15.560 --> 35:19.000]  consent you didn't participate in any of it. If she didn't your daughter didn't.
[35:21.320 --> 35:24.200]  Has your daughter ever been charged with DUI before?
[35:24.200 --> 35:36.440]  Once they tried to do a DUI on her and I think it came below the blood alcohol level because
[35:36.440 --> 35:42.200]  in California it's 0.08. That's pretty standard around the country.

[35:51.080 --> 35:59.640]  and it was below the 0.08. Okay, well if she'd had a DUI and they run her license
[36:00.440 --> 36:05.640]  they can find that DUI and they'll say oh she's had one before let's go stop her but if she hasn't
[36:05.640 --> 36:12.920]  had one if she's been stopped and tested above the limit then that's not it.
[36:12.920 --> 36:21.640]  When she ate how many did she have like wine or beer?
[36:23.640 --> 36:28.360]  I'm not really sure. I don't think it was wine because she's not a wine drinker.

[37:39.480 --> 37:45.400]  post complaints against the peace officers. That's professional conduct complaints.
[37:46.760 --> 37:53.240]  Post in most states, it's called something else in Texas, but post means police officer
[37:53.240 --> 38:01.240]  certification and training. Okay, standards and training. I started to say certification
[38:01.240 --> 38:05.640]  starts with a C so I thought maybe they just shifted. Okay, standards and training. Okay,
[38:05.640 --> 38:12.920]  that's easier. Okay, what they are responsible for is they run the police academies and such
[38:12.920 --> 38:18.920]  and they're responsible for the curriculum and training the officers. So if you feel like the
[38:18.920 --> 38:26.520]  officers weren't trained well enough, for instance, they searched her car without the
[38:26.520 --> 38:33.640]  problem of cause. They didn't have reason to believe that there were open containers, guns,
[38:33.640 --> 38:39.720]  drugs, all this other stuff. I didn't chase her from a bank that was just robbed.
[38:39.720 --> 38:47.320]  Yeah, they don't hold a search warrant. And this one was a young cop too. Oh good.
[38:49.320 --> 38:54.760]  It probably made some boobies. Okay, I'm going to tell you, this show is called Rule of Law
[38:54.760 --> 39:03.800]  Radio and that indicates that we are creatures of statute here. We don't do any patriot mythology.
[39:03.800 --> 39:09.240]  If someone comes on our show and starts telling us about all these things you can do,
[39:10.760 --> 39:15.480]  first thing I tell them is never make a proactive statement of law out of your own mouth.
[39:16.360 --> 39:23.080]  Don't tell me what I can do. Tell me what the law specifically says I can or cannot do.
[39:24.360 --> 39:29.560]  Because if you can't show it to me in law, you haven't shown me anything. There's a lot of
[39:29.560 --> 39:35.320]  patriot mythologies out there. So while we are creatures of statute, there's something else we
[39:35.320 --> 39:44.360]  understand. You can never expect to win your case simply because you have the law and the facts on
[39:44.360 --> 39:54.520]  your side. Just think so is naive. It is not that way now. Never has been that way so long as we
[39:54.520 --> 40:01.000]  have had human beings as judges. You can expect to win your case if you have the politics on your
[40:01.000 --> 40:11.720]  side and all politics is local. Now on the surface that sounds like a problem, but it is only a
[40:11.720 --> 40:19.720]  problem if you don't understand that everything is political. Once you understand that everything is
[40:19.720 --> 40:27.960]  political, then you'll begin to understand why I say that when you as a private citizen walk into
[40:27.960 --> 40:37.720]  a courthouse, you are the baddest motor scooter in the building. The reason is you're not a judge,
[40:37.720 --> 40:47.480]  a prosecutor, a bailiff, a clerk. They're all public servants. You are the master of those
[40:47.480 --> 40:56.440]  servants and they forget that at their professional peril. And the best way to bring them to task
[40:57.320 --> 41:03.320]  is to file professional conduct complaints against them. If you file a professional
[41:03.320 --> 41:12.360]  conduct complaint against a peace officer, the agency responsible for training is generally
[41:12.360 --> 41:20.120]  called post. We'll get that grievance and they will throw it in the trash and that's a good thing.
[41:21.880 --> 41:28.680]  The reason it's a good thing is all of these officers are bonded through the agencies they
[41:28.680 --> 41:39.720]  work for. Bonding is insurance and their agency has a bonding agent and it is his job to charge
[41:39.720 --> 41:50.200]  his client as much as possible and avoid any claims. So he won't throw that complaint in the trash
[41:50.200 --> 41:58.200]  and when they get one, they're required to notice him. If they don't, then if the officer gets sued
[41:58.200 --> 42:04.920]  they're not insured. So they have to tell them themselves. We'll get the bar grievances in a
[42:04.920 --> 42:14.040]  minute. If a peace officer gets six professional conduct complaints, more or less depending on the
[42:14.760 --> 42:20.440]  nature of the complaint, not whether it can be proved or not just by the nature, like if they
[42:20.440 --> 42:28.600]  get four complaints that an officer used extreme excessive force. Now that's going to make the
[42:28.600 --> 42:35.960]  insurance guy really, really uncomfortable or it'll vary depending on the complaints, but the
[42:35.960 --> 42:41.960]  bonding agent will come to the agency and say, look guys, you got this guy here and he is an
[42:41.960 --> 42:50.120]  unacceptable risk. If you keep him, we will raise your bond rating for the entire department.
[42:50.120 --> 42:56.920]  So what do you think is going to happen to Joe Jackboot?
[42:56.920 --> 43:04.360]  Adios Bubba. And once his contract is not renewed from an agency because of too many
[43:04.360 --> 43:12.920]  professional conduct complaints, no one else will hire him. Now the officer will say, well
[43:12.920 --> 43:23.720]  that's patently unfair. Yeah, well life is tough Bubba. Deal with it. That's one of their primary
[43:23.720 --> 43:31.080]  weaknesses. When we come back on the other side, we'll talk about the other primary weakness is

[47:13.480 --> 47:21.720]  became a policeman so he could be a jackbooted thug. They want to be the good guys, but they're put
[47:21.720 --> 47:28.520]  into a system they didn't create and they can't change it. We're the ones who have to change it.
[47:29.880 --> 47:38.280]  The problem the police have is they are the ones on the point of the spear. If we're going to get
[47:38.280 --> 47:43.720]  this changed, the most effective place to change it is at the point of the spear.
[47:45.320 --> 47:51.320]  So while I have no animosity toward the police and I understand they're in an untenable position,
[47:53.240 --> 48:00.840]  I think of them like I do my grandkids. I love them dearly. But if one of them runs out in the road,
[48:00.840 --> 48:08.200]  I'm fixing to tan his hide. And if I have to tan a policeman's hide in order to get the police
[48:08.200 --> 48:16.280]  man to go back to his boss and say, hey, you want me to do this crapola? I'm getting professional
[48:16.280 --> 48:20.840]  conduct complaints. They're going to ruin my career. You want that done? You go out and do it.
[48:21.640 --> 48:27.880]  This is how we get things changed. So I turned over to go after a public official because I'm
[48:27.880 --> 48:34.200]  angry. I had a bailiff shove me out the door one day and knocked me down and broke my elbow.
[48:34.200 --> 48:43.000]  That really hurt. But I didn't go after the bailiff for that. Well, first off,
[48:43.000 --> 48:51.240]  you didn't mean to. He shouldn't have put his hand on me. He touched me at exactly the perfect
[48:51.240 --> 48:57.720]  moment as my foot hit a carpet to cause that carpet to come out from under me. It was just a
[48:57.720 --> 49:06.760]  confluence of circumstances. And I wasn't about to ruin a 20, 30 year career over that
[49:07.480 --> 49:13.640]  light mishap. And besides, I had pushed him over the edge anyway. I have a way of doing them.
[49:14.680 --> 49:22.360]  I only go after public officials. When going after those public officials will lead me toward
[49:22.360 --> 49:31.240]  a positive outcome. And you always want to know what that outcome is. So with your daughter,
[49:31.240 --> 49:37.160]  and this is not an outcome you can have. It's an outcome she must have.
[49:39.560 --> 49:47.880]  Need to know what her outcome is. What would she want at the end of the day? The fact that she
[49:47.880 --> 49:55.640]  that she knew enough to tell these officers that she doesn't consent. Tells me she's done some homework.
[49:57.320 --> 50:03.320]  That she has an interest in her rights and her liberties and doesn't want them trampled on.
[50:04.040 --> 50:08.440]  I suspect that will change the nature of her intended outcome. You know, most people I talk
[50:08.440 --> 50:14.600]  to, they're busy. They got a lot going on. Their lives are full. They don't have time
[50:14.600 --> 50:24.040]  or the luxury to try to change the system or make things better. It sounds like your daughter may
[50:26.120 --> 50:30.680]  want to do more than just get this ticket to go away. Because that's what most people have.
[50:30.680 --> 50:36.280]  That's what the ticket to go away. Yes, these officers were beyond abusive when she tried
[50:36.280 --> 50:41.400]  to assert her Fifth Amendment or Fourth Amendment. All they could say is mockingly,
[50:41.400 --> 50:48.360]  you have the right to shut up. Wonderful. They just think things like that and they were not
[50:48.360 --> 50:57.400]  interested in due process or being lawful or helpful in any way. Okay. Well, what I'm really
[50:57.400 --> 51:03.960]  looking for is what your daughter's interested in. She wants to go get them. She wants to file
[51:03.960 --> 51:13.960]  criminal complaints against them. Okay. Now, first thing she needs to do is sit down and write down
[51:14.920 --> 51:24.360]  what for her would be a win in this case. Now, I'm not asking what she would absolutely like
[51:24.360 --> 51:30.440]  to be a perfect outcome. If you're taking on a fight like this, you need to know when you're
[51:30.440 --> 51:36.440]  winning. She needs an outcome. I have an outcome in everything I do before the courts.
[51:37.320 --> 51:45.240]  I have one primary outcome. It is my purpose to put every judge in the country in a position
[51:45.240 --> 51:50.680]  such that when he steps up behind the bench and looks out across the bar at the gallery,
[51:50.680 --> 51:55.640]  I want him wondering which one, which one of those scoundrels sitting out there waiting for
[51:55.640 --> 52:00.600]  me to render ruling so that he can run down the grand jury and try to get me indicted.

[53:32.520 --> 53:38.520]  it was addressed to some magistrate. He took it back, showed it to the judge. It came out and he
[53:38.520 --> 53:44.680]  said, the judge said he's not going to accept anything that's not file stamped. Oh, yes, he is.
[53:44.680 --> 53:50.120]  I said, no, you don't have to take it to the clerk. No, this doesn't go to the clerk. I'm not here
[53:50.120 --> 53:56.600]  to invoke the judge's duty as a district judge. I'm here to invoke his duty as a magistrate.
[53:56.600 --> 54:02.520]  And that's a duty from which he may not shield himself. Well, he's not going to accept this
[54:02.520 --> 54:07.240]  pleading. He handed it back to me. You got it. I'm not taking it. He took it laid down in the

[55:53.320 --> 55:58.680]  fights, get out the Code of Criminal Procedure and read through it and what you indicated,

[56:04.200 --> 56:10.120]  that's the criminal procedure stuff. Once you get past the first half, it gets into odd ball stuff
[56:10.120 --> 56:17.320]  that you probably don't care about. Then go back and read it again. The second time you read it,
[56:17.320 --> 56:24.120]  it's not as much as it appears because it's all set in like a table of contents all outlined.
[56:24.680 --> 56:32.200]  So there's lots of white space. What's problematic is, is laws are not passed in order.
[56:33.400 --> 56:40.680]  So when something occurs, the legislature passed some laws to handle what's occurred.

[56:45.640 --> 56:52.040]  So when you read through it the first time, it won't make sense to you. You go back and read
[56:52.040 --> 56:58.360]  through the second time and all of a sudden the pieces will start fitting together. In Texas,
[56:58.360 --> 57:07.320]  if you read Article 209-1011, it says that what judges are who are magistrates and it's a magistrate's
[57:07.320 --> 57:12.120]  duty to keep the peace in the county and when the magistrate sits to examine into criminal
[57:12.120 --> 57:16.440]  accusation as an examining court, it won't really make so much sense to you until you read it the
[57:16.440 --> 57:24.040]  second time. The second time you read it, you'll say, oh, that's what Chapter 16 was all about.
[57:24.760 --> 57:31.400]  And you'll start stitching these pieces together. You will know the codes better than the lawyers do.
