[01:14.080 --> 01:18.080]  and San Antonio have been dropping marijuana possession charges and even refusing to file
[01:18.080 --> 01:22.720]  new ones since they are stipulating that they do not have the time or the laboratory equipment
[01:22.720 --> 01:24.720]  to test the herb for THC.
[01:24.720 --> 01:28.440]  Margaret Moore, the Travis County District Attorney, announced earlier this month that
[01:28.440 --> 01:33.040]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.040 --> 01:34.040]  law.
[01:34.040 --> 01:37.600]  Mr. Abbott and other state officials, including the Attorney General stipulated in a letter
[01:37.600 --> 01:42.080]  to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:42.080 --> 01:48.240]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as
[01:48.240 --> 01:51.200]  well as other cities too like the District Attorney.
[01:51.200 --> 01:57.240]  In El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law quote
[01:57.240 --> 02:01.720]  will not have an effect on the prosecution of marijuana cases in El Paso.
[02:01.720 --> 02:06.680]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.680 --> 02:11.160]  in Harris County who stated that quote, the law is constantly changing on what makes something
[02:11.160 --> 02:13.440]  illegal based on its chemical makeup.
[02:13.440 --> 02:17.320]  It's important that if someone is charged with something, the test matches with their
[02:17.320 --> 02:22.560]  charge with it.
[02:22.560 --> 02:27.400]  A paper by Tulane University identified a five and a half inch American pocket shark.
[02:27.400 --> 02:32.320]  As the first of its kind in the Gulf of Mexico, the specimen being only the second pocket
[02:32.320 --> 02:38.000]  shark ever captured or recorded with the other one being found way back in 1979 in the East

[04:49.300 --> 04:59.300]  Nothing in particular, if you like. I can share about some bar grievances with this lady Patty that called in and some of the developments on that.
[04:59.300 --> 05:03.300]  Oh, over that hearing that we listened to.
[05:03.300 --> 05:04.300]  Right.
[05:04.300 --> 05:07.300]  Yeah, tell us what you did over that.
[05:07.300 --> 05:18.300]  Well, I sat down and started sketching out the different things that these people did wrong, and I came up with quite a list.
[05:18.300 --> 05:24.300]  So the fact that the judge kicked everybody out of the Zoom hearing.
[05:24.300 --> 05:37.300]  So just a tiny bit of background for anybody that probably most of the listeners would not have seen this. So there's a lady here that has, she's facing a wrongful foreclosure.
[05:37.300 --> 05:43.300]  And she doesn't know what to do about it. She doesn't understand these lawyers' letters or anything, and she's just beside herself.
[05:43.300 --> 05:47.300]  Why they're trying to take my home? It's already paid off. What do I do?
[05:47.300 --> 05:58.300]  I was planning on being in on that call. They were doing a Zoom hearing.
[05:58.300 --> 06:09.300]  The judge decided to kick everybody out of the Zoom call and tell people they needed to just go Google for, see if you can find a YouTube channel.
[06:09.300 --> 06:28.300]  So a lot of people did that. And as you so aptly noted, Randy, the judge did seem to be particularly interested in how many people are watching me now, and those numbers just kept going up.
[06:28.300 --> 06:42.300]  And the last time he asked, there were 19, and he was on his best behavior, being so nice to her. I saw that number climb up to 30, but he didn't ask again.
[06:42.300 --> 06:58.300]  Anyway, the fact that he kicked everybody out from that Zoom call, I took that as being kicked out of court, and all courts are open to the public.
[06:58.300 --> 07:20.300]  Yes, he did offer another alternative where we could get in there and watch. However, like you say sometimes, Randy, that bell's been rung. I didn't interpret that as being an acceptable alternative, because the YouTube feed was delayed.
[07:20.300 --> 07:35.300]  They call it live, and it's kind of live, but this lady was expecting me to be there with her and be her assistance of counsel, and he denied her in that when he kicked everybody out of court.
[07:35.300 --> 07:44.300]  So he didn't ask any questions. He didn't allow any conversation about any of that. He just decided that everybody's out.
[07:44.300 --> 07:56.300]  He even kicked her out, and then he realized it was just him and the aggressor lawyer, and he had to go get the court coordinated to find the homeowner and bring her back in.
[07:56.300 --> 08:02.300]  But he didn't let her have her assistance of counsel.
[08:02.300 --> 08:21.300]  He just expects her to suddenly fend for herself in that shark tent, and I consider that as a reason to bar grieve him, the judge, for denying her rights, such as the right to assistance of counsel. That's a due process right.
[08:21.300 --> 08:27.300]  It's certainly a good question that should be asked.
[08:27.300 --> 08:33.300]  So I started to bar grieve him, and I wrote it up, and then I said, well, you know what?
[08:33.300 --> 08:53.300]  This new lawyer coming in there, he was so arrogant and smug, and the judge actually made a showing, as you commented, that the judge made a showing of nicking a button off of the attorney's shirt because the attorney was making faces and rolling his eyes and acting kind of disrespectful.
[08:53.300 --> 09:00.300]  And the judge told him in no uncertain terms that he didn't want any of that.
[09:00.300 --> 09:11.300]  So I don't want your disrespectful body language and your nonverbals. If you have something to say, well, you just, you need to say it, but I don't want all that stuff.
[09:11.300 --> 09:29.300]  And I figured this attorney is the new guy. He hasn't gotten all the bar grievances that came in the last wave. The previous attorney that he's replacing had two easily bar grievances, and she disappeared.
[09:29.300 --> 09:47.300]  Well, all of the partners of her law firm, her supervisor, and all the partners, they've all been bar grieved, at least once each. And this guy's new to the party. He hasn't gotten to join in on all that stuff yet, so I think it's his turn.
[09:47.300 --> 10:06.300]  So when the judge denied Ms. Patty her due process right to assistance of counsel, I'm going to say that this attorney, Garcia, gets a bar grievance for that because he should have called out the judge right then.
[10:06.300 --> 10:12.300]  He should have told the judge, whoa, whoa, wait, can't kick everybody out of court. That's not right.
[10:12.300 --> 10:19.300]  And the fact that he just went along with that, I'm bar grieving for that. What do you say?
[10:19.300 --> 10:28.300]  I'm sitting here trying not to chuckle into the mic. So bar grieve well earned.
[10:28.300 --> 10:43.300]  And then Garcia's boss, who's already been bar grieved for the previous underling, is now getting bar grieved again because she didn't train her underling well enough to be able to call out the judge. That's obviously a rule.
[10:43.300 --> 10:51.300]  We have rules that the attorneys are required to follow, the rules of minimum ethics, some call it.
[10:51.300 --> 11:02.300]  And one of them says, you don't go along with judicial misconduct. If the judge is doing something wrong, he's violating his cannons, his code of judicial conduct, you have to call him out on it.
[11:02.300 --> 11:05.300]  You're an attorney, it's your job.
[11:05.300 --> 11:13.300]  Well, so now Garcia is in trouble for that and also Garcia's boss is in trouble for that.
[11:13.300 --> 11:34.300]  And there are two parts of responsibility on a supervisor. The supervisor or partner has a responsibility to train their underling properly and get them to so they're not permitting their underlings to run amok and commit crimes and rules violations.
[11:34.300 --> 11:40.300]  They also have another responsibility. That one is 501A, rule 5.01A.
[11:40.300 --> 12:00.300]  They also rule a subsection B. 501B says that after some kind of misconduct of the underling has happened, the supervisor has a responsibility to kick into gear and take some remedial action, some reasonable mitigating the harm kind of action.
[12:00.300 --> 12:29.300]  Well, she didn't do that either, so I got me for another bar grieve for that. Then there's another rule. It's 803 that says any attorney that knows about another attorney's misconduct, i.e. violating these rules, if the attorney knows about it, then the attorney has a responsibility to bar grieve that other attorney.
[12:29.300 --> 12:36.300]  So this supervisor failed or refused to bar grieve her underling.
[12:36.300 --> 13:03.300]  Now, it does give her a little escape clause there. It says if she suspects that he has a drug problem or an alcohol addiction problem, then she can, instead of bar grieving him, she could go to take him to some kind of substance abuse program and get him hooked up with that instead of the bar grievance.
[13:03.300 --> 13:14.300]  But she didn't do either one, so I bar grieved her for that. What do you think, Randy? Do you think there'll be happy campers this weekend?
[13:14.300 --> 13:25.300]  Sorry, somebody muted my mic again. It's odd how that happens. Well, I think it's perfect. Is this the same law firm?
[13:25.300 --> 13:38.300]  Yes. No, I don't think there'll be happy campers. I think they're going to be very busy trying to find a new errors and emissions policy.
[13:38.300 --> 13:53.300]  Is that many grievances? Or they will be in the process of putting together a new law firm because the current law firm can't get insured. We've had that happen before.
[13:53.300 --> 14:05.300]  So how do we find out about that? Is there some way that we can know at what point this particular law firm is no longer insured and would be a good time to bring a malpractice suit?
[14:05.300 --> 14:24.300]  I'm not sure. The way we found out the last time was that the law firm came into bankruptcy hearing and complained to the bankruptcy judge that they had to shut down their law firm and open a doing so they could get insured.
[14:24.300 --> 14:38.300]  That was the only way we found out. I don't know of any direct way because that's kind of their private personal business. It would be nice.
[14:38.300 --> 14:44.300]  I wonder if there's some kind of report that goes to a governmental agency that has to produce records.
[14:44.300 --> 15:03.300]  It would have to be the state bar. But if they got one, they're quasi, not judicial, but governmental. They're quasi-governmental. So they'd fall under the Open Records Act. We could check to see.
[15:03.300 --> 15:22.300]  quasi-governmental. What is that? Half plutonium? Well, that means they are mutants. They're like insurance companies or electric companies that have a government-controlled monopoly.
[15:22.300 --> 15:38.300]  In this case, the bar has a government-controlled monopoly and they're supported. They have special arrangements with the state government. So they're tied to them and that makes them, that brings them under Open Records.
[15:38.300 --> 15:58.300]  So insurance companies, power companies, all of these companies that are closely regulated all fall under Open Records. And if they receive government subsidies or if they're in some part supported by the government, then they also fall under.
[15:58.300 --> 16:03.300]  Do you think that would be the same in other places besides America?
[16:03.300 --> 16:14.300]  Yeah, I was thinking, somebody was asking me about a bar grievance in Canada and so I looked up some things and I saw some similarities, but they also have some differences and I was just wondering if you...

[21:29.300 --> 21:39.300]  So I gave him everything he wanted. I took the temperature. I gave him the fingerprints. I signed my name without prejudice, and then they let me go.
[21:39.300 --> 21:49.300]  So I since got my car out, and now I want to go after him and the system.
[21:49.300 --> 21:59.300]  Okay, all seven officers get their names, badge numbers. First, what state are you in?

[23:36.300 --> 23:49.300]  Okay. When they demanded that you, they charged you with the, I'm sorry, they threatened you with a felony if you didn't let them take your temperature.
[23:49.300 --> 23:59.300]  Yes. And I asked why and he said when you're in a correctional facility or a government facility, the charges get upgraded.
[23:59.300 --> 24:03.300]  What charge is that? Did he say?
[24:03.300 --> 24:05.300]  No.
[24:05.300 --> 24:08.300]  Is this a jailer?
[24:08.300 --> 24:14.300]  He took me to the correctional facility. No, this is a cop that pulled me over on the highway.
[24:14.300 --> 24:18.300]  It was the cop that took your temperature?
[24:18.300 --> 24:26.300]  He put my forehead up to a thermal, a temporal temperature.
[24:26.300 --> 24:32.300]  And he threatened you with a felony charge if you didn't do that?

[24:34.300 --> 24:37.300]  Listen for bothering you in the first place.
[24:37.300 --> 24:39.300]  What did he say?
[24:39.300 --> 24:41.300]  He said license plate.

[24:43.300 --> 24:50.300]  I said, may I ask what, you know, where you're pulling me over for? And he said, following too closely.
[24:50.300 --> 25:00.300]  Because there was a car ahead of me and then he was behind me and he was driving close to me and there was a car doing 45 in a 65 highway.
[25:00.300 --> 25:05.300]  So I was slowing down and slowing down and the car kept slowing down.
[25:05.300 --> 25:08.300]  So I was a little close to the car, maybe a car length away.
[25:08.300 --> 25:10.300]  That's what he pulled me over for.
[25:10.300 --> 25:12.300]  So then I said, I'm not giving you my license.
[25:12.300 --> 25:18.300]  And he said, I know you have a revoke license.
[25:18.300 --> 25:27.300]  And since he said that when I was in the patrol car on the way to jail, I said, did you record everything?
[25:27.300 --> 25:31.300]  And he goes, yeah, everything is recorded. And he goes, you see the video camera and I was like, no, the audio.
[25:31.300 --> 25:33.300]  And he said, yes, everything is recorded.
[25:33.300 --> 25:35.300]  I said, okay, thank you.
[25:35.300 --> 25:37.300]  Make sure you ask for those.
[25:37.300 --> 25:43.300]  But start out with professional conduct complaints. That'll make him really unhappy.
[25:43.300 --> 25:53.300]  And do a request for the videotapes. If they give you a problem, have somebody else do a request for the videotapes.
[25:53.300 --> 25:54.300]  Okay.
[25:54.300 --> 26:09.300]  Because sometimes if you're pro say like in Texas, your lawyer can get stuff that you don't for some reason, 39.14, the Michael Morton Act restricts certain information from a pro say litigant.
[26:09.300 --> 26:13.300]  That seems wrongful. I believe it needs to be fixed.
[26:13.300 --> 26:15.300]  But it is that way now.
[26:15.300 --> 26:23.300]  So if they claim that they don't have to give it to you, then have a third party requested.
[26:23.300 --> 26:25.300]  Okay.
[26:25.300 --> 26:33.300]  And then if they mess with him, then he can go after them. And they have no recourse on him.

[26:34.300 --> 26:40.300]  This is a way to start. Do you have a copy of the charges against you?

[26:42.300 --> 26:57.300]  The first one was obstructing administrative duty. That was for not giving my license. The second one was for following too closely. And the last one was driving near the median.

[27:01.300 --> 27:09.300]  We are driving on the median. It was the line on the left side of the highway because I was in the left side lane.

[28:31.300 --> 28:42.300]  So you said obstructing administrative duty. That was when he said you were not giving him the license. And then what was the second one?

[28:45.300 --> 28:54.300]  Okay. Here's what happens here. You make the claim that you were exercising your Fifth Amendment right.
[28:54.300 --> 29:01.300]  He made the charge against you and you will have to provide an affirmative defense.
[29:01.300 --> 29:09.300]  So he made a claim against you for driving too close to the line.
[29:09.300 --> 29:15.300]  You make a claim against him for aggravated perjury and tampering with the government document.
[29:15.300 --> 29:27.300]  And then he has to show that he didn't obstruct justice or tamper with a government document or aggravated perjury and or aggravated perjury.

[34:43.300 --> 34:46.300]  We got a whole routine.
[34:46.300 --> 34:53.300]  If a cop wants to stop you, we'll give them a romp through the legal system. They won't believe.
[34:53.300 --> 34:58.300]  I have trafficticket.website up and working.
[34:58.300 --> 35:11.300]  I don't remember if I have a New York state spot on there yet. I'll have to check it.
[35:11.300 --> 35:20.300]  But on that, you can go on and put in your ticket information and it'll download you a whole bunch of documents to file.
[35:20.300 --> 35:28.300]  And for state and primarily I've written it for Texas because that's where I'm at and that's the major research I've done on traffic.
[35:28.300 --> 35:40.300]  Traffic is not my area of interest and expertise, but I put this site together as a proof of concept for a much bigger project.
[35:40.300 --> 35:49.300]  And we want to use it to shut down traffic enforcement because they write you a ticket and you go to this site.
[35:49.300 --> 35:56.300]  Ticket information. If you're in Texas, it'll spit you out 150 pages of documents.
[35:56.300 --> 36:07.300]  If you're in another state, it'll correctly adjust them for whatever state you're in, but it'll give you a motion in limity,
[36:07.300 --> 36:15.300]  a request for a demand for speedy trial, a request for a preliminary hearing,
[36:15.300 --> 36:21.300]  a preservation of rights, we call that a mother-herbert motion,
[36:21.300 --> 36:27.300]  all of the standard motions that you would file in any criminal case to protect all your rights.
[36:27.300 --> 36:33.300]  Well, for traffic, you know, they like to just crank you through there.
[36:33.300 --> 36:40.300]  I'm not sure what the numbers are for New York, but in Texas in 2017, this last year, I have good numbers,
[36:40.300 --> 36:45.300]  there were 9 million criminal cases filed.
[36:45.300 --> 36:51.300]  Well, 7 million were traffic.
[36:51.300 --> 36:59.300]  Oh, it's a traffic. If we can start closing down the traffic courts, like, you file all these motions,
[36:59.300 --> 37:06.300]  and in your case, you'll be filed criminal complaints and professional conduct complaints,
[37:06.300 --> 37:13.300]  and you'll go to the first hearing and they'll send you to talk to this lawyer.
[37:13.300 --> 37:17.300]  What's the problem with that?
[37:17.300 --> 37:30.300]  No state that I know of allows a judge to summon you to court for the purpose of meeting with opposing counsel.
[37:30.300 --> 37:38.300]  Now, he can order the two counsels to meet with one another, but they have to figure out a time that is convenient for them.
[37:38.300 --> 37:45.300]  If the judge subpoenas you to court, it has to be for an official purpose.
[37:45.300 --> 37:54.300]  And like in Texas, we have 2801 penal code and it listens, I'm sorry, 2801 Texas Code of Criminal Procedure.
[37:54.300 --> 37:59.300]  And it lists all of the things that a judge can order someone to come to court for.
[37:59.300 --> 38:04.300]  One is for a arraignment hearing.
[38:04.300 --> 38:11.300]  An arraignment hearing is a hearing for the purpose of determining the identity of the accused and taking a plea.
[38:11.300 --> 38:15.300]  All the rest go to motions and pleadings.
[38:15.300 --> 38:16.300]  Right.
[38:16.300 --> 38:18.300]  So there's no motions and pleadings.
[38:18.300 --> 38:27.300]  If you've signed an agreement to appear, the only thing they can do is a preliminary hearing.
[38:27.300 --> 38:31.300]  And what they're going to want to do is send you to talk to a lawyer.
[38:31.300 --> 38:33.300]  I went in with a guy in Southwest Texas.
[38:33.300 --> 38:44.300]  Southwest Texas has the highest number of traffic citations per capita in the state of Texas by 20%.
[38:44.300 --> 38:45.300]  Wow.
[38:45.300 --> 38:47.300]  They're like 73%.
[38:47.300 --> 38:51.300]  The next highest is 41.
[38:51.300 --> 38:52.300]  Wow.
[38:52.300 --> 38:58.300]  So I went in there and I'm with another guy. I didn't have the ticket and I'm his paralegal.
[38:58.300 --> 39:03.300]  So they called him up and they told him to go in this back room.
[39:03.300 --> 39:04.300]  And I'm going with him.
[39:04.300 --> 39:05.300]  He said, wait, wait, Mr. Calhom.
[39:05.300 --> 39:07.300]  He knew how I was.
[39:07.300 --> 39:09.300]  I've been there before.
[39:09.300 --> 39:12.300]  The first time I was ever there, they arrested me.
[39:12.300 --> 39:15.300]  Oh, this is back in the 70s.
[39:15.300 --> 39:24.300]  And they wanted me to sign this document. I got bail posted and they wanted me to sign this document to let me out.
[39:24.300 --> 39:30.300]  And it said that I did not dispute any of the charges.
[39:30.300 --> 39:36.300]  I told him, Jaylor, to tell the chief to cram this document.
[39:36.300 --> 39:48.300]  Jaylor took it to him and I could hear the chief holler out, get that SOB out of my jail.
[39:48.300 --> 39:49.300]  That was a long time ago.
[39:49.300 --> 39:53.300]  So more recently, they had a little more difficulty with me.
[39:53.300 --> 39:57.300]  And in this case, the bailiff said I couldn't go back there.
[39:57.300 --> 39:59.300]  I said, yeah, I'm his paralegal.
[39:59.300 --> 40:02.300]  He said, oh, no, only the accused can go back there.
[40:02.300 --> 40:06.300]  I said, is the judge back there? And he said, well, no.
[40:06.300 --> 40:08.300]  Is the judge in the building?
[40:08.300 --> 40:10.300]  He said, no.
[40:10.300 --> 40:13.300]  Well, who sent out this summons?
[40:13.300 --> 40:15.300]  He said, well, the court did.
[40:15.300 --> 40:19.300]  And I need to arrest the judge.
[40:19.300 --> 40:22.300]  I need to get my sergeant.
[40:22.300 --> 40:26.300]  Good idea.
[40:26.300 --> 40:34.300]  But the next day, I filed some charges against the lawyer.
[40:34.300 --> 40:37.300]  I charged her with impersonating a judicial officer.
[40:37.300 --> 40:44.300]  She was 26 years old, just got her bar card, just got hired.
[40:44.300 --> 40:50.300]  It was her first day holding these hearings by herself.
[40:50.300 --> 40:55.300]  And I charged her with 58 felony counts.
[40:55.300 --> 40:58.300]  Her days are off the job. She's gone.
[40:58.300 --> 41:01.300]  So this is what we do.
[41:01.300 --> 41:03.300]  I have these rules.
[41:03.300 --> 41:13.300]  And the first rule is never ask a public official to do anything that you actually want them to do.
[41:13.300 --> 41:21.300]  Because you never ask the public official to do anything that the law does not compel them to do.
[41:21.300 --> 41:25.300]  So before you ask a public official to do something, check the law.
[41:25.300 --> 41:29.300]  Make sure they're authorized and have a duty to do it.
[41:29.300 --> 41:37.300]  So that when they don't, if it's a traffic court, you turn to the bailiff and say, Mr. Bailiff, do you hear that?
[41:37.300 --> 41:43.300]  Yes, I did. Arrest that man, even if it's the judge.
[41:43.300 --> 41:47.300]  Oh, and that is great fun, especially in traffic court.
[41:47.300 --> 41:56.300]  The judge is generally a lawyer and he's generally a lawyer who is not the sharpest knife in the drawer.
[41:56.300 --> 42:05.300]  Because if he was, he'd be out making the big bucks instead of down here in a local municipal court, growing for dollars.
[42:05.300 --> 42:09.300]  So you bar grieve him.
[42:09.300 --> 42:19.300]  Now, he's in court, so he's not in court under the authority of his bar card.
[42:19.300 --> 42:28.300]  Because the municipal court, in most states, can be presided over by a non-judge, I mean a non-lawyer.
[42:28.300 --> 42:33.300]  But don't make any difference. If he is a lawyer, he's got a bar card, but I bar grieve him.
[42:33.300 --> 42:37.300]  You know what happens when you bar grieve a lawyer?
[42:37.300 --> 42:40.300]  It goes to their insurance.
[42:40.300 --> 42:48.300]  Exactly. The bar will get it and throw it in the trash, but the insurance carrier won't.
[42:48.300 --> 43:01.300]  The insurance carrier will double his malpractice insurance, unless it's his first year in practice, which is not likely to judge his first year, but good chance to prosecute her is.
[43:01.300 --> 43:09.300]  If it's his first year, they'll cancel. Because two in one year, they cancel. If you get three, they cancel the law for malpractice insurance.
[43:09.300 --> 43:16.300]  So the problem is, if you send it to the state bar, the state bar won't get the grievance and throw it in the trash.
[43:16.300 --> 43:17.300]  Right.
[43:17.300 --> 43:32.300]  And tell you that reexamined into your accusation fine does not rise to the level of conduct. And that's a good thing, because of what the insurance company knows that. And I'm not just speaking to you. You already know this, Jason. I'm speaking to everybody else.
[43:32.300 --> 43:36.300]  You want to bar grieve him at every opportunity.
[43:36.300 --> 43:51.300]  And then when the lawyer on the other side doesn't correct the judge when he does something wrong, why you bar grieve him, too? Just for yucks. Hang on. Randy Kelton, Wreck Fountain, rule of law radio.

[47:25.300 --> 47:40.300]  Not much. I've been recently fighting the bank because my house is in poor closure. So I filed some paperwork with that and I've held them off for two years so far.
[47:40.300 --> 47:47.300]  Five to seven years is pretty easy.
[47:47.300 --> 47:48.300]  Yeah.
[47:48.300 --> 47:51.300]  What state are you in? Okay, you're in New York.
[47:51.300 --> 48:02.300]  Yeah, last one I helped somebody with in New York who held them off seven years until the Supreme denied our cert, the Federal Supreme.
[48:02.300 --> 48:07.300]  And then I was going back for the second suit and he just got tired of fighting.
[48:07.300 --> 48:22.300]  Anyway, okay, the, if you use the traffic tickets, I just gave you a bunch of documents filed, no matter what they are, because the courts just going to ignore all of them.
[48:22.300 --> 48:26.300]  And that's what we want them to do.
[48:26.300 --> 48:39.300]  Because if the judge fails to rule on every issue that you put before the court, then he's denied you due process. He's denied you in your 14th Amendment right.
[48:39.300 --> 48:43.300]  And he's committed a crime.
[48:43.300 --> 48:57.300]  Denying due process and violation of 18 U.S. Code 242 and New York has an official misconduct statute. I don't remember what it is, but that is a reflection of 18 U.S. Code 242.
[48:57.300 --> 49:09.300]  Public official fast-form duty is required to form or exerts or purports to exert an authority he does not expressly have and denies a citizen's full and pretty access to or enjoyment of right.
[49:09.300 --> 49:11.300]  That's crime in every state.
[49:11.300 --> 49:12.300]  Right.
[49:12.300 --> 49:15.300]  Judges are used to appeals.
[49:15.300 --> 49:19.300]  They're not used to people filing criminally against them.
[49:19.300 --> 49:20.300]  Yeah.
[49:20.300 --> 49:26.300]  And if he's a lawyer, you bar grieve him and file criminal charges against him.
[49:26.300 --> 49:29.300]  He is not going to be a head camper.
[49:29.300 --> 49:38.300]  Now he kind of pray well feels like everybody in the system will protect him from those criminal charges.
[49:38.300 --> 49:45.300]  But when you start filing criminal charges against the ones protecting him from the criminal charges.
[49:45.300 --> 49:47.300]  Do they got a problem?
[49:47.300 --> 49:52.300]  Yeah, see, never ask a public official to do anything you actually want them to do.
[49:52.300 --> 49:58.300]  My favorite one was I bushwhacked the head criminal district judge in Travis County.
[49:58.300 --> 50:00.300]  His name was Bob Perkins.
[50:00.300 --> 50:01.300]  Really nice guy.
[50:01.300 --> 50:06.300]  Holding motion hearings and laughing and joking with these lawyers.
[50:06.300 --> 50:09.300]  I called and walked it up to the bar called the bailiff over.
[50:09.300 --> 50:10.300]  I pointed at him.
[50:10.300 --> 50:11.300]  You come here.
[50:11.300 --> 50:12.300]  They hate that.
[50:12.300 --> 50:15.300]  These lawyers come in there like meat little lambies.
[50:15.300 --> 50:19.300]  And I come in and summon the bailiff.
[50:19.300 --> 50:21.300]  He come over and said, may I help you?
[50:21.300 --> 50:25.300]  My name is Randall Kelpin strutty judge that I have business with the court.
[50:25.300 --> 50:27.300]  He said, may I tell him the nature of the business?
[50:27.300 --> 50:28.300]  No, you may not.
[50:28.300 --> 50:30.300]  I have business with the court and it's none of yours.
[50:30.300 --> 50:32.300]  I didn't want him running interference.
[50:32.300 --> 50:36.300]  And besides, you know, I told him you're dismissed and I put my fingers at him.
[50:36.300 --> 50:38.300]  So he's pretty ticked.
[50:38.300 --> 50:40.300]  He run up to the judge.
[50:40.300 --> 50:45.300]  He looked out at me and said something to the bailiff.
[50:45.300 --> 50:50.300]  And when the judge finishes hearings, I'm sitting here holding this red folder.
[50:50.300 --> 50:53.300]  And the judge just can't help himself.
[50:53.300 --> 50:57.300]  Who is this guy coming in here annoying my bailiff?
[50:57.300 --> 51:00.300]  And what's he got in that red folder?
[51:00.300 --> 51:06.300]  And he says, when he finished his hearings with the lawyers, he said, Mr. Carlton.
[51:06.300 --> 51:08.300]  I said, are you Mr. Carlton?
[51:08.300 --> 51:09.300]  I said, yes, your honor, I am.
[51:09.300 --> 51:10.300]  May I approach?
[51:10.300 --> 51:12.300]  And I held up this folder.
[51:12.300 --> 51:14.300]  That means kind of give it to you.
[51:14.300 --> 51:15.300]  Joey, they send the bailiff to get it.
[51:15.300 --> 51:16.300]  He said, well, come on up.
[51:16.300 --> 51:20.300]  He was holding hearings right at the bench.
[51:20.300 --> 51:24.300]  Walked up, laid the folder on the bench and he opened it up.
[51:24.300 --> 51:34.300]  He's looking at criminal charges against the district clerk for secreting criminal complaints from the grand jury.
[51:34.300 --> 51:44.300]  And the criminal complaints are against the district attorney for secreting criminal complaints against all the highest judges in Texas from the grand jury.
[51:44.300 --> 51:54.300]  He looked up at me with this look that said he could see his whole career flashing before his eyes.
[51:54.300 --> 52:01.300]  And then he said, well, Mr. Carlton, I'm a district judge and district judges in Travis County don't take criminal complaints.
[52:01.300 --> 52:03.300]  I said, that's okay, judge.
[52:03.300 --> 52:06.300]  I'm not here to invoke your duty as a district judge.
[52:06.300 --> 52:12.300]  I'm here to invoke your duty as a magistrate and that's a duty from which you may not shield yourself.
[52:12.300 --> 52:19.300]  And he cut his eyes over at the bailiff and they look back at me and I know what he was thinking.
[52:19.300 --> 52:25.300]  If I have my bailiff shoot this guy, can I get away with it?
[52:25.300 --> 52:30.300]  Well, these are the things you can do.
[52:30.300 --> 52:38.300]  The police and the prosecutors and the judges, they think they're important when they get into court.
[52:38.300 --> 52:40.300]  They are not.
[52:40.300 --> 52:45.300]  When you walk into that courthouse, you're the baddest motorist guru in the building.
[52:45.300 --> 52:47.300]  There's only one reason.

[01:12:40.300 --> 01:12:54.300]  This is not a felony in any case, but apparently the prosecutor was in cahoots with the guy wanting to buy the property and tried to use his position to get this done.
[01:12:54.300 --> 01:13:04.300]  And they came after Ted. Well, they got the wrong guy. Ted went back after when you've been in court for six or seven years, Ted.
[01:13:04.300 --> 01:13:05.300]  Six years.
[01:13:05.300 --> 01:13:10.300]  Well, I was arrested for February 11 of 2015.
[01:13:10.300 --> 01:13:13.300]  So six years and a couple of months.
[01:13:13.300 --> 01:13:15.300]  And there's more.
[01:13:15.300 --> 01:13:20.300]  You did a good job summarizing, but I will add a couple of things.
[01:13:20.300 --> 01:13:26.300]  I've been active locally here in Silicon Valley in both City Council and County Supervisor.

[01:13:33.300 --> 01:13:48.300]  The big thing where I probably popped up on the radar was when the county stole this elderly man's antique Boeing PT 17 Stearman, only one of two in existence.
[01:13:48.300 --> 01:13:54.300]  And so I got him $50,000 and five years free rent at the airport.
[01:13:54.300 --> 01:13:58.300]  And that was 20 years ago, but I don't think they've ever forgotten it.

[01:14:07.300 --> 01:14:09.300]  I ended up in foreclosure.
[01:14:09.300 --> 01:14:12.300]  I was fighting the foreclosure.

[01:14:14.300 --> 01:14:25.300]  And and then because of this, this, the home bounce back into my name and I won't get into that.

[01:14:27.300 --> 01:14:34.300]  But that's when it's alleged that the recording of a quick claim deed from my name to my trust.
[01:14:34.300 --> 01:14:37.300]  And that's what I'm charged with.
[01:14:37.300 --> 01:14:50.300]  But keep in mind the the the buyer, the straw buyer, posing as a buyer from the bank.
[01:14:50.300 --> 01:14:59.300]  He first filed a quiet title lawsuit against me and we were litigating for nine months and he wasn't he wasn't winning.
[01:14:59.300 --> 01:15:07.300]  And that's when they got judge, Dr. T's Peter Manukian into the act.
[01:15:07.300 --> 01:15:17.300]  I had removed these things to federal court and he went ahead and gave another rid of possession to get me out of the house.
[01:15:17.300 --> 01:15:19.300]  And so I didn't know what to do.
[01:15:19.300 --> 01:15:25.300]  And I just added his name to the to the federal suit.
[01:15:25.300 --> 01:15:31.300]  And a new magistrate in the federal court probably didn't know any better.
[01:15:31.300 --> 01:15:41.300]  And because of my financial situation, I was entitled to various things, including the US Marshals serving this judge.
[01:15:41.300 --> 01:15:43.300]  So what happened?
[01:15:43.300 --> 01:15:45.300]  So I want to be clear.
[01:15:45.300 --> 01:15:50.300]  I didn't have him served by US Marshals, but magistrate in the federal court did.
[01:15:50.300 --> 01:15:52.300]  Well, he didn't like that too much.
[01:15:52.300 --> 01:16:09.300]  And the next thing you know, I got SWAT team, San Jose Police, Sheriff's Department, armored vehicles, and over 30 people with machine guns and and refrigerator size shields.
[01:16:09.300 --> 01:16:17.300]  Out in front of my house to extricate me and throw me in jail for three days with no phone call.
[01:16:17.300 --> 01:16:22.300]  That's where we started on February 11, 2015.

[01:20:22.300 --> 01:20:26.300]  I've been to court every month at least once.
[01:20:26.300 --> 01:20:32.300]  I had this heart attack and a cardiologist wrote a letter for the court because I had
[01:20:32.300 --> 01:20:33.300]  a court date.
[01:20:33.300 --> 01:20:40.300]  I had a friend take that cardiologist letter to the court hearing and present it to the
[01:20:40.300 --> 01:20:41.300]  judge.
[01:20:41.300 --> 01:20:47.800]  It basically said that I just had emergency surgery and that I was in very bad shape and
[01:20:47.800 --> 01:20:53.300]  that I could not have any stress at all and that I certainly couldn't participate in any
[01:20:53.300 --> 01:20:54.300]  hearings.
[01:20:54.300 --> 01:20:57.300]  And that I was subject to sudden death.
[01:20:57.300 --> 01:21:04.300]  That was in the letter and the judge said it was vague and if I didn't get down there
[01:21:04.300 --> 01:21:08.300]  or if I didn't come down that they would issue a bench warrant.
[01:21:08.300 --> 01:21:12.300]  So my friend called me and said you better find a way to get down here.
[01:21:12.300 --> 01:21:20.900]  So I went down there and they called the case and the judge had to take a recess to check
[01:21:20.900 --> 01:21:25.300]  the law or something and during the recess I started having a second heart attack.
[01:21:25.300 --> 01:21:31.000]  The bailiff told the judge, the judge re-entered the courtroom, took the bench and knowing
[01:21:31.000 --> 01:21:36.800]  that the paramedics were on the way and that I was in distress, she continued to prosecute
[01:21:36.800 --> 01:21:37.800]  me.
[01:21:37.800 --> 01:21:44.200]  She did so until the paramedics, she was told that the paramedics were in the elevator.
[01:21:44.200 --> 01:21:46.300]  She abruptly left the courtroom.
[01:21:46.300 --> 01:21:52.540]  The paramedics found me with a blood pressure of 200 over 136.
[01:21:52.540 --> 01:22:01.300]  And that's brave heart assault or something along those lines as Randy has said in the
[01:22:01.300 --> 01:22:02.300]  past.
[01:22:02.300 --> 01:22:08.540]  Okay, so then after that we've gone along hearing after hearing and so now we've progressed
[01:22:08.540 --> 01:22:11.820]  six years down the road.
[01:22:11.820 --> 01:22:14.260]  They forced a public defender on me in the beginning.
[01:22:14.260 --> 01:22:16.420]  I got him off of me.
[01:22:16.420 --> 01:22:24.420]  The only way by hiring a private attorney, that attorney kept on the case until the preliminary
[01:22:24.420 --> 01:22:31.260]  hearing stage and then he was free to go and I took it up myself ever since then.
[01:22:31.260 --> 01:22:36.380]  That was like four years ago and then so I went along for about three and a half years
[01:22:36.380 --> 01:22:38.700]  or so.
[01:22:38.700 --> 01:22:50.060]  And we're now up at over 115 hearings that I've appeared at, 115 hearings and they couldn't
[01:22:50.060 --> 01:23:03.140]  get anywhere with me so December of 2020, 2019, December of 2019, despite the pandemic,
[01:23:03.140 --> 01:23:05.980]  they forced a public defender on me.
[01:23:05.980 --> 01:23:16.140]  I immediately filed a lawsuit against him in civil court for interfering with my case.
[01:23:16.140 --> 01:23:19.300]  I'm sure he loved that.
[01:23:19.300 --> 01:23:25.700]  Well, I named the public defender and I named this deputy public defender and as I've told
[01:23:25.700 --> 01:23:30.900]  this guy, Mr. Goldman, he just got hired from the public defender's office and I was his
[01:23:30.900 --> 01:23:34.500]  first case and I said, look, they did this to you.
[01:23:34.500 --> 01:23:38.860]  You might want to read, nobody in that office would have taken this case and you didn't know
[01:23:38.860 --> 01:23:40.860]  any better and they did this to you.
[01:23:40.860 --> 01:23:45.540]  You may want to rethink working for the public defender's office.
[01:23:45.540 --> 01:23:52.140]  But I also named Molly O'Neill who is the public defender and just named those two defendants
[01:23:52.140 --> 01:23:53.140]  in the civil lawsuit.

[01:27:02.980 --> 01:27:09.620]  supposed to list any monies you receive, they list lunches they have for, that they value
[01:27:09.620 --> 01:27:15.900]  at $50, but they're not telling anybody about the $40,000 to $60,000 a year, they're getting
