[01:10.120 --> 01:13.680]  The unfortunate circumstances were that he left the car running and unlocked.

[01:17.640 --> 01:22.360]  KABB reported that police later found DeVilla's car at nearby park, but baby J and the car

[01:24.000 --> 01:27.760]  Investigators believe that the occurrence wasn't a random kidnapping and suspect that
[01:27.760 --> 01:30.200]  DeVilla knew the woman in the video.

[03:00.080 --> 03:15.080]  All right, folks, good evening, I'm Rick Rode, and I'm going to talk to you about the
[03:15.080 --> 03:35.080]  Monday Night Rule of Law radio show with your host, Eddie Craig.
[03:35.080 --> 03:39.760]  Before we get to the call-in number and get the boards on and everything, there is something
[03:39.760 --> 03:41.320]  I want to go over.
[03:41.320 --> 03:46.560]  I have been working on the updated seminar material through this week, and part of what
[03:46.560 --> 03:52.200]  I've been working on is the accompanying book, not the actual transportation code book, but
[03:52.200 --> 03:57.600]  this one is the due process book that goes hand in hand with the court case side of transportation
[03:57.600 --> 03:59.600]  related offenses.
[03:59.600 --> 04:04.960]  And one of the things that I've been researching and writing up this week has to do with the
[04:04.960 --> 04:07.680]  entering of special appearances.
[04:07.680 --> 04:12.440]  Now the courts will try to tell you that special appearances are limited to civil cases, but
[04:12.440 --> 04:16.120]  the fact is there is nothing in law that says that.
[04:16.120 --> 04:22.040]  You have the right to challenge the jurisdiction of a court over the individual or the subject
[04:22.040 --> 04:28.400]  matter or the venue at any time regardless of what kind of court it is.
[04:28.400 --> 04:33.720]  If there's a question as to whether or not it has proper jurisdiction in one of those
[04:33.720 --> 04:38.320]  categories, then it absolutely is your right to challenge it.
[04:38.320 --> 04:42.440]  So for them to say that you can't use a special appearance in a criminal case like what they
[04:42.440 --> 04:47.200]  try to do with the transportation cases is an absolutely bogus statement.
[04:47.200 --> 04:53.240]  If a judge or prosecutor makes that statement, they are attempting to deny you a fundamental
[04:53.240 --> 04:58.400]  due process right, which is to challenge the court's jurisdiction.
[04:58.400 --> 05:05.160]  And here in Texas, you can only do that through a verified pleading, okay?
[05:05.160 --> 05:08.280]  You can't do it verbally alone.
[05:08.280 --> 05:13.320]  You have to do it in a verified pleading or they won't accept it.
[05:13.320 --> 05:17.680]  When you look at how the special appearance actually works, you have to understand what
[05:17.680 --> 05:20.320]  it is and how everything on it works.
[05:20.320 --> 05:25.240]  So what I did was I wrote up the part of the book that I'm working on for this and I want
[05:25.240 --> 05:30.640]  to read that to you so that you all get an idea of how this works and why they're necessary.
[05:30.640 --> 05:35.560]  But most importantly, what not to put in one, okay?
[05:35.560 --> 05:37.880]  So pay attention.
[05:37.880 --> 05:42.080]  The importance of entering a special appearance correctly.
[05:42.080 --> 05:47.600]  Texas Rules of Civil Procedure Rule 120A explains the proper legal process and elements of
[05:47.600 --> 05:51.480]  filing a special appearance to challenge a court's jurisdiction.
[05:51.480 --> 05:56.640]  The challenge can be based upon a lack of personal jurisdiction, which is impersonal.
[05:56.640 --> 06:01.560]  Subject matter, the court has no jurisdiction to hear the type of case being presented,
[06:01.560 --> 06:02.560]  and venue.
[06:02.560 --> 06:06.600]  The court lacks jurisdiction to hear matters originating from another city, county, state,
[06:06.600 --> 06:09.200]  territory, or country.
[06:09.200 --> 06:14.140]  It is also important to note that special appearance motions are most commonly used in civil court
[06:14.140 --> 06:16.200]  proceedings rather than criminal.
[06:16.200 --> 06:21.440]  However, there is nothing in law that denies their use in criminal cases for such a jurisdictional
[06:21.440 --> 06:24.080]  challenge is legally appropriate.
[06:24.080 --> 06:28.920]  Any criminal court judge telling you otherwise is either a liar, prejudicial, and biased
[06:28.920 --> 06:33.680]  against the accused, judicially incompetent, or some combination of all of these.
[06:33.680 --> 06:37.680]  And you should move to immediately disqualify such a judge on the legal grounds that she
[06:37.680 --> 06:43.200]  or he is incompetent in the law and proper judicial procedure while demonstrating prejudice
[06:43.200 --> 06:48.240]  and bias toward the accused in that they are denying equal application and protection
[06:48.240 --> 06:53.440]  of the law in relation to challenging personal and or subject matter jurisdiction.
[06:53.440 --> 07:01.280]  Now, here in Texas, we have a case called Dawson-Austin v. Austin, okay?
[07:01.280 --> 07:03.640]  It's a petition for divorce case.
[07:03.640 --> 07:09.400]  It's at 968, Southwest 2nd, 319, and 1998.
[07:09.400 --> 07:14.000]  As the lower courts both held an unsworn, and by the way, this was the Texas Supreme
[07:14.000 --> 07:16.240]  Court ruling on it.
[07:16.240 --> 07:23.120]  If the lower courts both held an unsworn special appearance does not comply with rule 120aL,
[07:23.120 --> 07:27.760]  okay, subsection L.
[07:27.760 --> 07:33.560]  And Texas rules a civil procedure and thus is ineffectual to challenge impersonal jurisdiction.
[07:33.560 --> 07:39.240]  The lower courts also held, however, that the lack of verification can be cured by amendment.
[07:39.240 --> 07:47.960]  That means that you can file an amended motion that is properly sworn and that will correct
[07:47.960 --> 07:52.280]  or cure the shortcoming of the original filing, all right?
[07:52.280 --> 07:55.480]  It does not waive the challenge to jurisdiction.
[07:55.480 --> 08:00.920]  It does not make it a general appearance because it was filed unsworn the first time, okay?
[08:00.920 --> 08:07.720]  You can correct that problem by simply filing an amended one and thus cure it.
[08:07.720 --> 08:12.280]  Austin's argument, Austin argues that an unsworn special appearance cannot be cured
[08:12.280 --> 08:15.080]  and is itself a general appearance.
[08:15.080 --> 08:20.200]  Austin's argument is contrary to the express provision of rule 120aL and that a special
[08:20.200 --> 08:23.120]  appearance may be amended to cure defects, okay?
[08:23.120 --> 08:29.240]  Now, I remember when they say Austin's argument is contrary, Austin isn't arguing this.
[08:29.240 --> 08:31.480]  His damned attorneys are.
[08:31.480 --> 08:36.600]  These are attorneys that are either ignorant of what the rule actually says or they're
[08:36.600 --> 08:43.120]  trying to make it say something it actually doesn't or means something it actually doesn't.
[08:43.120 --> 08:47.600]  And you wonder why when an attorney tells me that my argument is not valid?
[08:47.600 --> 08:53.960]  Why in the world would I listen to that individual try to convince me when I know better?
[08:53.960 --> 08:58.600]  Their whole job is to create conflict where none previously existed.
[08:58.600 --> 09:00.320]  It's the only way they can make a living.
[09:00.320 --> 09:05.160]  It's for there to be conflict and them to be at the heart of it, gathering money in
[09:05.160 --> 09:08.760]  as many handfuls as they possibly can.
[09:08.760 --> 09:12.600]  This is why I wouldn't take an attorney's word that it's raining if I'm standing in
[09:12.600 --> 09:15.880]  the middle of a downpour.
[09:15.880 --> 09:18.400]  Just wouldn't do it.
[09:18.400 --> 09:22.360]  By cure, the rule means to restore the special appearance.
[09:22.360 --> 09:26.360]  The rule does not limit the kinds of defects that can be cured.
[09:26.360 --> 09:31.680]  The absence of a verification is such a defect and an amendment that adds a verification
[09:31.680 --> 09:34.160]  cures the special appearance.
[09:34.160 --> 09:39.360]  Every court that is considered the issue agrees and it gives a whole long list of court cases.
[09:39.360 --> 09:43.920]  Now, what constitutes a special versus general appearance?
[09:43.920 --> 09:48.760]  In Dawson-Austin, I bid the court went on to explain how the courts generally view the
[09:48.760 --> 09:53.800]  distinction between a special and general appearance by stating, Austin's arguments
[09:53.800 --> 10:00.200]  are not only contradicted by both the language and silence of rule 120a, they misperceive
[10:00.200 --> 10:02.920]  what constitutes a general appearance.
[10:02.920 --> 10:08.480]  One court has explained, a party enters a general appearance whenever it invokes the
[10:08.480 --> 10:14.760]  judgment of the court on any question other than the court's jurisdiction.
[10:14.760 --> 10:21.760]  If a defendants act recognizes that an action is properly pending or seeks affirmative action
[10:21.760 --> 10:26.240]  from the court, that is a general appearance.
[10:26.240 --> 10:33.920]  More versus electromobile technique, 874 SW 2nd.
[10:33.920 --> 10:38.080]  Another court has stated the same proposition in the negative.
[10:38.080 --> 10:43.360]  Although an active defendant may have some relation to the cause, it does not constitute
[10:43.360 --> 10:49.360]  a general appearance if it in no way recognizes that the cause is properly pending or that
[10:49.360 --> 10:54.880]  the court has jurisdiction and no affirmative action is sought from the court.
[10:54.880 --> 11:00.200]  In other words, what that means is don't go arguing anything relative to the merits
[11:00.200 --> 11:04.120]  of the allegations or facts of the case in general.
[11:04.120 --> 11:06.920]  Don't even mention the charge.
[11:06.920 --> 11:12.320]  Don't even mention what you were or were not doing in relation to that charge.
[11:12.320 --> 11:13.320]  Shut up.
[11:13.320 --> 11:15.520]  This has nothing to do with that.
[11:15.520 --> 11:21.640]  This has to do with saying you people can't hear this case and here is why and you stick
[11:21.640 --> 11:24.920]  to that subject and solely to that subject.
[11:24.920 --> 11:31.200]  All right, these courts have accurately restated the principle underlying a general appearance.
[11:31.200 --> 11:37.080]  An unverified special appearance neither acknowledges the court's jurisdiction nor seeks affirmative
[11:37.080 --> 11:38.080]  action.
[11:38.080 --> 11:43.800]  While it cannot be used to disprove jurisdiction, it certainly does not concede it.
[11:43.800 --> 11:48.280]  All right, how to use a special appearance motion.
[11:48.280 --> 11:52.720]  The proper use of a special appearance is paramount to challenging a court's personal,
[11:52.720 --> 11:56.600]  impersonal jurisdiction over you as the accused.
[11:56.600 --> 12:01.320]  Proper in this case means establishing the correct legal status and limiting your arguments
[12:01.320 --> 12:07.240]  in such a motion to only those specific facts that deprive the court of that level of jurisdiction
[12:07.240 --> 12:12.680]  or moving the court to take any action other than adjudicating and ruling upon the question
[12:12.680 --> 12:14.520]  of jurisdiction.
[12:14.520 --> 12:19.840]  The phrase legal status in this context means that a motion challenging jurisdiction must
[12:19.840 --> 12:25.760]  cite the legal status of the defendant as impropriopersona and nothing else.
[12:25.760 --> 12:31.400]  It can't be sui juris, not prosa, not even defendant in error.
[12:31.400 --> 12:36.480]  If you fail to do this, then the motion is not going to pass muster as a challenge to
[12:36.480 --> 12:39.120]  personal jurisdiction.
[12:39.120 --> 12:45.960]  Proper in this context means the motion absolutely cannot contain any statements or arguments
[12:45.960 --> 12:49.320]  that address the merits of the charges against you.
[12:49.320 --> 12:54.220]  Merits means any specific facts relating to the specific civil or criminal allegations
[12:54.220 --> 12:59.360]  being made and the circumstances thereof that are not directly related to depriving the
[12:59.360 --> 13:02.440]  court of personal jurisdiction.
[13:02.440 --> 13:06.200]  When we appear especially to challenge the jurisdiction of the court, we appear in our
[13:06.200 --> 13:09.240]  own person, impropriopersona.
[13:09.240 --> 13:14.200]  Under black's law dictionary fifth edition, it defines the term impropriopersona and reveals
[13:14.200 --> 13:19.320]  the necessity to appear in this fashion on special appearance.
[13:19.320 --> 13:26.000]  Impropriopersona, in one's own proper person, it was formally a rule in pleading that pleased
[13:26.000 --> 13:32.200]  the jurisdiction of the court must be pled impropriopersona because if pleaded by an
[13:32.200 --> 13:37.160]  attorney, they admit the jurisdiction and as an attorney is an officer of the court
[13:37.160 --> 13:43.000]  and he is presumed to plead after obtaining leave, which admits jurisdiction.
[13:43.000 --> 13:49.400]  Laws page 1.91 and that's L-A-W-E-S.
[13:49.400 --> 13:54.880]  A plea to the jurisdiction asserts that the court before which the cause is brought is
[13:54.880 --> 13:59.000]  not the proper court to take cognizance of the matter.
[13:59.000 --> 14:07.120]  The psychopedia of law second edition 1922, title plea.
[14:07.120 --> 14:12.040]  Both black's law dictionary fifth edition and psychopedia of law second edition define
[14:12.040 --> 14:18.960]  prose as for himself in his own behalf in person.
[14:18.960 --> 14:24.720]  It should be noted that the definition does not read in his own proper person, but for
[14:24.720 --> 14:31.400]  himself, giving the connotation that while we act for ourselves, we are a separate person
[14:31.400 --> 14:34.800]  defending ourselves as a defendant.
[14:34.800 --> 14:40.760]  That would require the same leave of the court that the use of an attorney does, thus admitting
[14:40.760 --> 14:43.600]  to the jurisdiction of the court.
[14:43.600 --> 14:48.760]  The courts as well as the state continually refer to us as prose litigants, even when
[14:48.760 --> 14:53.560]  we make it clear that we appear specially an impropriopersona.
[14:53.560 --> 14:59.800]  If we do not object by our own omission, we admit the jurisdiction.
[14:59.800 --> 15:05.680]  By being a prose litigant, we may also subject ourselves to the same rules lawyers are required
[15:05.680 --> 15:11.800]  to follow, since the court considers us a lawyer acting for or in behalf of our own
[15:11.800 --> 15:13.680]  proper persons.
[15:13.680 --> 15:19.360]  Your court rules may very well reveal this as does the Texas Supreme Court in its approval
[15:19.360 --> 15:24.680]  of the various legal or local provisions propagated by the multitude of other Texas courts at
[15:24.680 --> 15:26.080]  every level.
[15:26.080 --> 15:33.880]  For example, the definition section of rule 15.2.1 subsection L on page 54, the local
[15:33.880 --> 15:40.080]  rules of court for Travis County court reads, party means a person appearing in any case
[15:40.080 --> 15:45.800]  or proceeding, whether represented or appearing prose say, or an attorney of record for a
[15:45.800 --> 15:48.680]  party in any case or proceeding.
[15:48.680 --> 15:53.480]  If you're a party to a case, then you've admitted that it is properly pending.
[15:53.480 --> 15:59.080]  If it's properly pending, then you have fallen within the court's jurisdiction.
[15:59.080 --> 16:04.320]  That simple special appearance won't work for you if you used prose say to identify
[16:04.320 --> 16:09.520]  your legal status under your name in the title portion of that motion.
[16:09.520 --> 16:11.360]  Just won't work.
[16:11.360 --> 16:22.040]  There's also rule 15.2.2 also on page 54 of those same local rules, which reads application
[16:22.040 --> 16:29.200]  to prose say litigants, the term council shall apply to an individual litigant in the event
[16:29.200 --> 16:32.360]  a party appears prose say.
[16:32.360 --> 16:35.360]  If you're a litigant, you've admitted that you're a party.
[16:35.360 --> 16:39.480]  If you've admitted you're a party, you are under the court's jurisdiction because an
[16:39.480 --> 16:44.760]  admission to being a party is an admission to the fact that there is a cause pending
[16:44.760 --> 16:49.360]  in the court and it's properly so.
[16:49.360 --> 16:50.360]  Get it?
[16:50.360 --> 16:55.600]  These are the little nuances of reading and researching this stuff that most people never

[20:39.480 --> 20:47.480]  anything other than impropriopersona, you are admitting to the jurisdiction of the court.
[20:47.480 --> 20:49.480]  Now I've made this mistake myself.
[20:49.480 --> 20:54.480]  It took a lot of digging to find this and find how it was all actually relevant one way or the other.
[20:54.480 --> 21:01.480]  And I'm going to be redoing all the motions and everything else to correct this in the new version just as much as I can.
[21:01.480 --> 21:05.480]  But especially when it comes to the special appearance motions.
[21:05.480 --> 21:13.480]  It does, however, leave us in kind of a sticky wicket on how to establish a fact pattern for trial.
[21:13.480 --> 21:19.480]  But we won't be able to do that until after the court rules on the jurisdictional challenge.
[21:19.480 --> 21:21.480]  Okay.
[21:21.480 --> 21:24.480]  And that's just the way it works.
[21:24.480 --> 21:31.480]  Now, even so, we're going to see something a little later on that or there is some information that could be found.
[21:31.480 --> 21:40.480]  I should say I don't know if I included in this or not where when a court does rule on emotion, it doesn't necessarily mean it's a set deal.
[21:40.480 --> 21:48.480]  You can still challenge the jurisdiction of the court even though the court has already ruled on it based upon certain other criteria, which I'll get into at a different time.
[21:48.480 --> 21:51.480]  But for the moment, let's finish this up.
[21:51.480 --> 22:00.480]  So as a pro se litigant in any Texas court, the party is considered to have the same knowledge and duty as a member of the bar requiring leave of the court to prosecute the case,
[22:00.480 --> 22:06.480]  which would admit the jurisdiction of the court and cause a pro se litigant to be treated as a franchise officer of the court.
[22:06.480 --> 22:19.480]  Many have appeared in for prior persona and argued the right of counsel of choice demanding that the court allow them to use whatever counsel they prefer, whether a member of the bar or not to argue their case.
[22:19.480 --> 22:24.480]  This type of argument is wholly inconsistent with a special appearance in for prior persona.
[22:24.480 --> 22:29.480]  In fact, it is in complete contradiction to the nature of the party's appearance.
[22:29.480 --> 22:39.480]  If you are appearing in your own proper person, how could you at the same time demand to be represented by counsel without retreating from your original position?
[22:39.480 --> 22:47.480]  While we do not waive our right to counsel, we also make it clear that we are not using counsel in the special appearance.
[22:47.480 --> 22:55.480]  The cold hard truth is we have to be prepared to stand alone before these courts without the benefit of any legal counsel other than our creator.
[22:55.480 --> 23:01.480]  If we depend upon another man to handle our case before the court, we are only trading one master for another.
[23:01.480 --> 23:11.480]  We must know the issues and the procedures and how to apply and use them for ourselves because who else would hold our best interest closest to their hearts?
[23:11.480 --> 23:17.480]  In the case of transportation code related offenses, the argument is rather straightforward and simple.
[23:17.480 --> 23:25.480]  You are not a person that falls within the specific class of legal persons to whom the transportation code and its regulatory statute and offenses legally apply.
[23:25.480 --> 23:31.480]  Since the primary single subject matter jurisdiction in context of the transportation code is specific to transportation,
[23:31.480 --> 23:41.480]  the state must show that you are acting in the legal capacity of a driver or operator who is in control of a commercial or motor or vehicle or vehicle
[23:41.480 --> 23:51.480]  that was being used to transport persons or property upon the highway specifically for the single subject matter purpose of transportation.
[23:51.480 --> 24:00.480]  The statute within the transportation code and the contextually limiting legislatively declared single subject matter transportation cannot be legally ignored by the courts.
[24:00.480 --> 24:14.480]  But that is precisely what they are doing by refusing to acknowledge what the Texas Constitution and the actual enrolled legislative bill SB 971 1995 actually says and means.
[24:14.480 --> 24:17.480]  This leaves us with only one realistic conclusion.
[24:17.480 --> 24:27.480]  The courts are intentionally feigning ignorance and rewriting the subject matter context of the law to suit their own preferred judicial and financial outcomes to such cases.
[24:27.480 --> 24:39.480]  This particular fraud is best summed up in a quote from Upton Sinclair.
[24:39.480 --> 24:45.480]  It is difficult to get a man to understand something when his salary depends on his not understanding it.
[24:45.480 --> 24:58.480]  This quote embodies the exact mindset you will find at every level of government starting from the accusatory police officer or bureaucratic agent and rising all the way to the very top echelons of government in the courts.
[24:58.480 --> 25:05.480]  What could possibly be their motivations for committing this kind and level of fraud you may ask?
[25:05.480 --> 25:27.480]  Well, there are several possible answers to that question, not the least of which is related to the hundreds of millions of dollars stolen annually by every state of the union willfully and fraudulently misapplying administrative regulatory law to everyday people that are not and never have been legally subject to that law's regulatory scheme or jurisdiction.
[25:27.480 --> 25:35.480]  Nationally, these hundreds of millions rapidly total up to tens of billions annually. Yeah, billions with a capital B.
[25:35.480 --> 25:58.480]  This fact alone kicks the it's all for public safety narrative writing and just lying, you know what, as being even remotely truthful, especially when you consider that these ill gotten gains are divided up amongst the very same governmental entities and agencies that benefit from both accusing you and convicting you of these bogus regulatory offenses.
[25:58.480 --> 26:26.480]  There is also the irrefutable fact that such laws allow each state to establish and maintain a de facto individual tracking and monitoring system containing the personal and biological identifying information of every single individual who is misled in the thinking and believing that they must register and get state permission for themselves and the use of their private personal property before engaging in a fundamental right rather than a qualified privilege.
[26:26.480 --> 26:50.480]  This distinction is the difference between engaging in a state granted privilege designed to regulate certain areas of commerce and public safety and that of the everyday individual exercising and enjoying their fundamental and inherent right to liberty by locomotion in order to move freely within and between the several states of the union whenever and however they please for conducting their own private business and pleasure.
[26:50.480 --> 27:02.480]  This type of regulatory authority simply is not something even remotely provided for in any form of perceived police power that out of the federal or state governments can legitimately claim to have been granted.
[27:02.480 --> 27:12.480]  Nor is it valid for the courts to doctrinally prefer such authority upon the federal or state governments or the officers and agents of their individual bureaucracies.
[27:12.480 --> 27:24.480]  This scheme is precisely what is behind in driving the Real ID Act and its other related programs intended to provide even more monitoring and control of every member of the population.
[27:24.480 --> 27:30.480]  These kinds of problematic programs stem from the problem of allowing judicial activism in the courts to flourish.
[27:30.480 --> 27:49.480]  The law is supplanted with an activist judges personal perspectives and agenda so as to reorder and reconstruct our laws and society into forms that are more harmonious with those they envision and are acting to construct by judicial fiat via historically and constitutionally unsupported doctrine.
[27:49.480 --> 27:56.480]  The specificity or limitations of the law is entirely secondary to their individual activist vision.
[27:56.480 --> 28:02.480]  This needs to stop but it won't unless people start to recognize it for what it is.
[28:02.480 --> 28:18.480]  An attempted usurpation of governmental authority to create an elitist judicial oligarchy in control of everything and everyone in all branches of government and every individual's private life and property including their children.
[28:18.480 --> 28:30.480]  So that's where we are in that particular aspect of it. Yes, I know I went off the due process stuff to go into a little other things but it's important to understand how far reaching things like this become.
[28:30.480 --> 28:40.480]  It's not simply a matter of you got nothing to hide, you got nothing to worry about. This is a way for them to monitor and control everything we do.
[28:40.480 --> 28:55.480]  I mean think about it. You can't watch a TV show involving any kind of police activity, governmental activity, anything where they can't simply look up somebody's name in some database and find out everything you've ever done in your life.
[28:55.480 --> 29:06.480]  Every place you've ever lived, including where you currently live, all through driver's licensing, vehicle registrations, hunting license, you name it.
[29:06.480 --> 29:16.480]  And yet none of the laws that they're using to compel us to acquire these things legally have anything at all to do with us.
[29:16.480 --> 29:29.480]  They simply cannot mandate the things upon the people that they're doing right now, but the people are too damn diggerent, ignorant to know any better because they've been indoctrinated by the government-run schools for so long.
[29:29.480 --> 29:40.480]  They think this is normal. It's not. It was never supposed to be.
[29:40.480 --> 29:52.480]  That's the whole reason for the separation of powers and why we're supposed to have government that isn't working hand in hand against the people.

[34:56.480 --> 35:11.480]  knows as a state of state that postings under corporate private law in international jurisdiction doesn't have the scanning to enter original jurisdiction.

[41:43.480 --> 41:52.480]  So when this thing came up, I thought, well, you know, being here from Texas, you know, I've been to Texas a lot.
[41:52.480 --> 42:01.480]  I thought I'd give you a call on it and maybe, you know, get some more information to see how I could go about this stuff.

[42:03.480 --> 42:10.480]  Standing in original jurisdiction, that's what I would have to have, right?
[42:10.480 --> 42:16.480]  You have to have standing in order to bring the case and the court that you're bringing it in.
[42:16.480 --> 42:22.480]  Original jurisdiction refers to the trial level court.
[42:22.480 --> 42:23.480]  Okay.
[42:23.480 --> 42:30.480]  So if you filed it in your federal district court and you're suing a local government entity,
[42:30.480 --> 42:38.480]  the question is whether or not the federal court has jurisdiction to hear that case when it's against a local government entity or a state court.
[42:38.480 --> 42:42.480]  If you're claiming that there's a federal violation, then it should.
[42:42.480 --> 42:46.480]  Whether or not they'll agree with you, that's a whole other issue.
[42:46.480 --> 42:55.480]  But if you can cast it as a federal violation of a protected right, federal, I'm sorry, a violation under a federally protected right,
[42:55.480 --> 42:58.480]  then they should accept jurisdiction and go from there.
[42:58.480 --> 43:05.480]  I can't say they'll decide in your favor, but they would have jurisdiction to hear the case in that instance.
[43:05.480 --> 43:10.480]  Well, that's what I'm trying to do is just get it in there if they accept it and then, you know,
[43:10.480 --> 43:15.480]  what the heck if you use one way or the other and give it a shot.
[43:15.480 --> 43:23.480]  Well, do yourself a favor and just wipe that link to the Annavon fraud information because that's all it is.

[01:13:45.340 --> 01:13:47.340]  and they contributed to it.

[01:13:54.340 --> 01:14:00.340]  But those kind of people are few and far between and usually only the rich boys can play that

[01:15:46.340 --> 01:15:50.340]  And so they're raking in millions but they're paying out thousands.

[01:21:14.340 --> 01:21:19.340]  In court, they did not allow, here in Texas, you are not allowed to mention the existence

[01:21:20.340 --> 01:21:22.340]  You're not allowed to sue the insurance company.
[01:21:22.340 --> 01:21:25.340]  You can only sue the individual who holds the policy.
[01:21:25.340 --> 01:21:31.340]  Okay, however, the insurance company is the one that supplies her attorney and the entire
[01:21:31.340 --> 01:21:38.340]  reason they do it that way is because in Texas, with those limitations, they know that they
[01:21:38.340 --> 01:21:43.340]  can generally have to pay less money if a jury decides the case than if they had to pay
[01:21:43.340 --> 01:21:47.340]  it straight out of pocket for the actual damages caused.
[01:21:47.340 --> 01:21:49.340]  And that's what they do.
[01:21:49.340 --> 01:21:54.340]  They take you to court so they actually wind up paying less money because the jury is not
[01:21:54.340 --> 01:22:00.340]  allowed to hear all of the relevant facts, all of the things that are going on, and the
[01:22:00.340 --> 01:22:05.340]  entire setup is to make it look like I was suing this little old decrepit old woman whose
[01:22:05.340 --> 01:22:10.340]  husband had died two months earlier despite we were in year number four since the accident
[01:22:10.340 --> 01:22:13.340]  before we ever got in the courtroom.
[01:22:13.340 --> 01:22:17.340]  But I was suing this decrepit little old lady whose husband had just died of cancer.
[01:22:17.340 --> 01:22:20.340]  I'm a monster.
[01:22:20.340 --> 01:22:22.340]  You see how that works?
[01:22:22.340 --> 01:22:23.340]  Yeah, I do.
[01:22:23.340 --> 01:22:28.340]  Especially when my attorney's announced for the very first time that day within my earshot

[01:22:47.340 --> 01:22:51.340]  They get in the court on that day and the jury looks at them and goes, this guy wants a million

[01:22:53.340 --> 01:22:56.340]  We're not going to give this guy a million dollars.
[01:22:56.340 --> 01:22:59.340]  How did you expect that case to turn out?

[01:28:40.340 --> 01:28:42.340]  Now, what charges is that going to be?

[01:38:05.340 --> 01:38:11.340]  There is subject matter, personal, impersonal, and venue, the place, the location,
[01:38:11.340 --> 01:38:13.340]  the territory, whatever you want to call it.

[01:38:14.340 --> 01:38:16.340]  Those are the three primaries.
[01:38:16.340 --> 01:38:19.340]  Everything else is a subset of one of those three,
[01:38:19.340 --> 01:38:24.340]  but they must come to a total of seven specific things that have to exist
[01:38:24.340 --> 01:38:31.340]  before a court actually has proper jurisdiction of everything in order to proceed.
[01:38:31.340 --> 01:38:35.340]  So, that said, these are the things you need to know.
[01:38:35.340 --> 01:38:39.340]  There are actually seven primary elements that are required for a court
[01:38:39.340 --> 01:38:45.340]  to have proper legal jurisdiction over an individual and a case presumed to be before the court.
[01:38:45.340 --> 01:38:50.340]  Read these carefully because they could mean the difference between an upheld conviction
[01:38:50.340 --> 01:38:53.340]  or one that gets overturned at the appellate level.
[01:38:53.340 --> 01:38:58.340]  Number one, the accused must be properly identified.
[01:38:58.340 --> 01:39:03.340]  Identified in such a fashion, there is no room for mistaken identity.
[01:39:03.340 --> 01:39:06.340]  The individual must be singled out from all others.
[01:39:06.340 --> 01:39:12.340]  Otherwise, anyone could be subject to arrest and trial without benefit of wrong party defense.
[01:39:12.340 --> 01:39:17.340]  Almost always, the means of identification is a person's proper name,
[01:39:17.340 --> 01:39:24.340]  but any means of identification is equally valid if said means differentiates the accused without doubt.
[01:39:24.340 --> 01:39:28.340]  By the way, there is no constitutionally valid requirement
[01:39:28.340 --> 01:39:32.340]  that you must identify yourself to the judge or to anyone.
[01:39:32.340 --> 01:39:35.340]  For stop and identify issues, under the Fourth Amendment,
[01:39:35.340 --> 01:39:44.340]  see Brown v. Texas 433 U.S. 47 and Collander v. Lawson 461 U.S. 352.
[01:39:44.340 --> 01:39:50.340]  Number two, the statute of offense must be identified by its proper or common name.
[01:39:50.340 --> 01:39:52.340]  A number is insufficient.
[01:39:52.340 --> 01:39:56.340]  Today, a citizen may stand in jeopardy of criminal sanctions
[01:39:56.340 --> 01:40:01.340]  for alleged violation of statutes, regulations, or even low-level bureaucratic orders.
[01:40:01.340 --> 01:40:06.340]  Example, Colorado National Monument Superintendent's orders regarding an unleashed dog
[01:40:06.340 --> 01:40:08.340]  or a dog defecating on a trail.
[01:40:08.340 --> 01:40:16.340]  If a number were to be deemed sufficient, government could bring new and different charges at any time by alleging clerical error.
[01:40:16.340 --> 01:40:21.340]  I'm sorry, Your Honor, I assumed the regulation indicated by that number was a legitimate statute.
[01:40:21.340 --> 01:40:23.340]  My secretary must have made an error.
[01:40:23.340 --> 01:40:29.340]  For any act to be tribal as an offense, it must be declared to be a crime.
[01:40:29.340 --> 01:40:35.340]  Charges must negate any exception forming part of the statutory definition of an offense
[01:40:35.340 --> 01:40:38.340]  by affirmative non-applicability.
[01:40:38.340 --> 01:40:44.340]  In other words, any charge must affirmatively negate any exception found in the law.
[01:40:44.340 --> 01:40:52.340]  Example of accession from a case where someone was on trial for Section 7203 will fulfill your file in Form 1040.
[01:40:52.340 --> 01:40:58.340]  Therefore, thereof to make a return other than a return required under authority of 6015,
[01:40:58.340 --> 01:41:04.340]  indictment or information is defective unless every fact which is an element in a prima facie case of guilt is stated.
[01:41:04.340 --> 01:41:07.340]  The assumption of an element is not lawful.
[01:41:07.340 --> 01:41:11.340]  Otherwise, the accused will not be thoroughly informed.
[01:41:11.340 --> 01:41:16.340]  26 USC 6012 is a necessary element of the offense.
[01:41:16.340 --> 01:41:20.340]  Since 6012 is incited, the information is fatally defective.
[01:41:20.340 --> 01:41:28.340]  Additionally, the information did not negate the exception other than required under authority of Section 6015.
[01:41:28.340 --> 01:41:35.340]  After reading 6012 and 6015 and knowing that the essential section 7203 elements are A,

[01:47:09.340 --> 01:47:28.340]  Four, the accuser must be named. He may be an officer or a third party. Some positively identifiable person, human being must accuse. Some certain person must take responsibility for the making of the accusation, not an agency or an institution.
[01:47:28.340 --> 01:47:41.340]  This is the only valid means by which a citizen may begin to face his accuser. Also, the injured party, corpus delectae, must make the accusation. Here say evidence may not be provided.
[01:47:41.340 --> 01:47:54.340]  Anyone else testifying that he heard that another party was injured does not qualify as direct evidence. This again goes to the heart of every single transportation code related case in Texas.
[01:47:54.340 --> 01:48:03.340]  Nowhere does the criminal complaint list officers such and such as the one making the complaint. It's always the court clerk.
[01:48:03.340 --> 01:48:14.340]  And if the officer is the one who signed it, this right here says he must be the injured party. He is not. Neither is the court clerk.
[01:48:14.340 --> 01:48:27.340]  So how are they able to maintain the appearance of jurisdiction when right here under the very tenets of jurisdiction it says it is defective?
[01:48:27.340 --> 01:48:34.340]  Number five, the accusation must be made under penalty of perjury. But it's not.
[01:48:34.340 --> 01:48:47.340]  Nowhere on the criminal complaint in the state of Texas used for these cases is anything sworn to under penalty of perjury. Criminal complaints in Texas are not required to be sworn under penalty of perjury.
[01:48:47.340 --> 01:48:56.340]  In which case, how can they have jurisdiction on a criminal complaint alone? They can't.
[01:48:56.340 --> 01:49:13.340]  That's exactly why information was required to be provided. That's exactly why a sworn statement by someone who could prove the facts of the case is required in addition to the criminal complaint.
[01:49:13.340 --> 01:49:19.340]  Everything they're doing in Texas is complete BS.
[01:49:19.340 --> 01:49:37.340]  And it always has been. If perjury cannot reach the accuser, there is no accusation. Otherwise, anyone may accuse another falsely without risk. And they do it all the time.
[01:49:37.340 --> 01:49:51.340]  To comply with the five elements above, that is for the accusation to be valid. The accused must be accorded due process. Accuser must have complied with law, procedure, and form in bringing the charge.
[01:49:51.340 --> 01:50:05.340]  This includes court-determined probable cause, summons, and notice procedure. If lawful process may be abrogated in placing a citizen in jeopardy, then any means may be utilized to deprive a man of his freedom.
[01:50:05.340 --> 01:50:13.340]  All political dissent may be stifled by utilization of defective process. Another thing they do constantly.
[01:50:13.340 --> 01:50:22.340]  Texas has a statute on the books. We don't have to prove you got served. Like hell you don't.
[01:50:22.340 --> 01:50:42.340]  Yes, you do. And you can't write a statute that says you don't have to. Why? Because it violates a fundamental tenet of jurisdiction and the right of due process, the right of notice. Your statute is unconstitutional on that fact alone.
[01:50:42.340 --> 01:50:58.340]  Number seven, the court must be one of competent jurisdiction to have valid process. The tribunal must be a creature of its constitution in accord with the law of its creation, i.e. an Article III judge.
[01:50:58.340 --> 01:51:03.340]  Nope.
[01:51:03.340 --> 01:51:20.340]  Number eight, there's a multitude of problems with how the Texas courts and the legislature have set things up. But that's not surprising considering that the very people who control the Texas courts, the Bar Association, also control the legislature.
[01:51:20.340 --> 01:51:39.340]  They also control the governor's office. Why? Because 99% of them are attorneys. The governor is an attorney. The AG is an attorney. The attorneys control every branch of our government. That on its face is unconstitutional.
[01:51:39.340 --> 01:51:55.340]  And the legislature is the one who made it that way in addition to the Constitution. They did that the moment they made the State Bar Act a actual subdivision of the judicial department of government.
[01:51:55.340 --> 01:52:14.340]  When they made the State Bar an office under the judicial department, that means every bar card carrying member is a de facto judicial officer and as such is forbidden to participate in any other area of our government.
[01:52:14.340 --> 01:52:33.340]  Doesn't matter whether or not they're practicing, that's irrelevant. You see the problem here? Every problem we have can be laid at the feet of the attorneys and the bar associations.
[01:52:33.340 --> 01:52:55.340]  And the fact that 99% of them believe that they know better than the rest of us everything. When they don't. They go so far in bending the rules in their own favor and breaking them over our heads that there's no way for us to win without fighting tooth and nail to get there.
[01:52:55.340 --> 01:53:08.340]  What should be as simple, you don't have jurisdiction to hear this and here's all the reasons why, and they just ignore them. It shouldn't be more difficult than that, but they're the ones that make it so.
[01:53:08.340 --> 01:53:15.340]  And they do it by violating their own damn rules. Constantly.
[01:53:15.340 --> 01:53:25.340]  I'm here to challenge jurisdiction. Well, I'm not going to hear a challenge to jurisdiction. I've got it. And that's all that matters. The judge can't declare the existence of jurisdiction.
[01:53:25.340 --> 01:53:39.340]  Why? Because the party responsible for proving the jurisdiction is properly invoked is the prosecution or the original moving party. It's not the court.
[01:53:39.340 --> 01:53:51.340]  So when a judge says I rule, I've got jurisdiction, you need to immediately object and move to disqualify that judge for incompetence because it is not the judge's place to declare the existence of jurisdiction.
[01:53:51.340 --> 01:53:59.340]  It is the prosecution's place to prove it exists and it has been properly invoked.
[01:53:59.340 --> 01:54:03.340]  They never do.
[01:54:03.340 --> 01:54:22.340]  More than half of these seven tenants are violated in every single transportation code related case in this state. Hell, if not every single AB and B and A misdemeanor and probably most of the felonies.
[01:54:22.340 --> 01:54:26.340]  That's a problem, folks. It's a big problem.
[01:54:26.340 --> 01:54:29.340]  And it's not going to go away.
[01:54:29.340 --> 01:54:40.340]  We don't need to just secede from the union. We need to wipe out the government we have. We need to stand up and say, you're all done. You're out of here. You don't work for us.
[01:54:40.340 --> 01:54:51.340]  So we don't need you. You're gone. Get out. We will rewrite a constitution that will make sure people like you never get power in this state again.
[01:54:51.340 --> 01:54:58.340]  Well, I guess I should say in that case, in this republic again.

[01:55:02.340 --> 01:55:09.340]  Too many imported idiots. Too many natural born idiots now that they've been raised in government schools for so long.
[01:55:09.340 --> 01:55:25.340]  And they've been taught by these out of state idiots and these other undermined brain dead idiots who think individual liberty is something that no one ought to have if there's somebody else that thinks they know better and can tell them what to do.
[01:55:25.340 --> 01:55:39.340]  It is ridiculous, people. And every day we loom closer and closer to that being exactly where we are all forced to go.
