[01:13.880 --> 01:17.880]  and San Antonio, have been dropping marijuana possession charges and even refusing to file
[01:17.880 --> 01:22.520]  new ones since they are stipulating that they do not have the time or the laboratory equipment
[01:22.520 --> 01:24.520]  to test the herb for THC.
[01:24.520 --> 01:28.240]  Margaret Moore, the Travis County District Attorney, announced earlier this month that
[01:28.240 --> 01:33.160]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.160 --> 01:34.160]  law.
[01:34.160 --> 01:37.400]  Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter
[01:37.400 --> 01:41.880]  to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:41.880 --> 01:48.040]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works.
[01:48.040 --> 01:51.000]  As well as other cities, too, like the District Attorney.
[01:51.000 --> 01:56.840]  In El Paso, Jaime Esparza, a Democrat, who also stated earlier this month that the law
[01:56.840 --> 02:01.440]  quote will not have an effect on the prosecution of marijuana cases in El Paso.
[02:01.440 --> 02:06.520]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.520 --> 02:10.900]  in Harris County, who stated that quote, the law is constantly changing on what makes something
[02:10.900 --> 02:13.240]  illegal based on its chemical makeup.
[02:13.240 --> 02:17.160]  It's important that if someone is charged with something, the test matches what they're
[02:17.160 --> 02:22.440]  charged with.
[02:22.440 --> 02:27.760]  A paper by Tulane University identified a 5.5 inch American pocket shark as the first
[02:27.760 --> 02:33.440]  of its kind in the Gulf of Mexico, the specimen being only the second pocket shark ever captured

[05:11.800 --> 05:18.140]  One of them is about criminal complaints that I filed against the governor of the state

[05:24.480 --> 05:30.320]  Now, if you think that filing criminal charges against the governor and possibly getting
[05:30.320 --> 05:38.000]  the governor removed from office is cool, just wait until you hear what Brett's up to.

[05:40.680 --> 05:46.480]  But anyway, everybody is, this should be immediate to everyone.
[05:46.480 --> 05:55.680]  Even if you're not in Texas, you have been affected by the coronavirus issue.
[05:55.680 --> 06:00.760]  And what Brett said yesterday, no one is in denial.
[06:00.760 --> 06:06.920]  We can deny that the traffic prosecution is a problem.
[06:06.920 --> 06:11.320]  Well, they wouldn't be writing you a ticket if you didn't do something.
[06:11.320 --> 06:12.320]  You know, we got that.
[06:12.320 --> 06:15.400]  If you got arrested, you probably did something wrong.
[06:15.400 --> 06:19.040]  You just may not like the way they're doing it and blah, blah, blah.
[06:19.040 --> 06:28.680]  Well, in this case, everybody is engaged because everybody has felt the sting of these restrictions
[06:28.680 --> 06:32.240]  that have been placed upon us.
[06:32.240 --> 06:35.140]  Therein lies my problem.
[06:35.140 --> 06:40.600]  In the complaint, I start out the complaint by stating that the people of the state of
[06:40.600 --> 06:48.560]  Texas are not frightened children quaking and quivering before the prospect of a pandemic.
[06:48.560 --> 06:55.120]  We are men and women of good conscience, buttressed by the wisdom of our predecessors and blessed
[06:55.120 --> 06:57.880]  with a binding constitution.
[06:57.880 --> 07:00.160]  We don't need a savior.
[07:00.160 --> 07:03.440]  We already got one.
[07:03.440 --> 07:10.720]  We don't need another one, no matter how benevolent, the aspiring dictator.
[07:10.720 --> 07:16.680]  And that goes to the vein in which I'm addressing this.
[07:16.680 --> 07:21.640]  I'm not filing criminal charges against the governor of the state of Texas because I think
[07:21.640 --> 07:24.240]  he's a bad guy.
[07:24.240 --> 07:29.200]  I'm filing criminal complaints against the governor of the state of Texas because he
[07:29.200 --> 07:31.960]  crawled a leash.
[07:31.960 --> 07:38.120]  I said this on Pastor Message Show, and he said he really likes Texas sayings.
[07:38.120 --> 07:43.100]  Governor crawled the leash, he turned on the masters.
[07:43.100 --> 07:47.240]  He forgot he was the servant and we were the master.
[07:47.240 --> 07:52.880]  And he came to the personal conclusion that the only person in the state of Texas with
[07:52.880 --> 07:58.200]  his moral center in the right place was him.
[07:58.200 --> 08:05.000]  And he could not ask good and righteous things of the public because he couldn't trust them
[08:05.000 --> 08:13.920]  to be good and righteous, that he had to order them and force them to do what was the right
[08:13.920 --> 08:16.080]  thing and what was the good thing.
[08:16.080 --> 08:22.720]  H.G. Wells in his outline of history on speaking to the corruption of the popes during the
[08:22.720 --> 08:31.540]  Dark Ages, very aptly observed, the giver of the law most owes the law allegiance.
[08:31.540 --> 08:36.080]  He of all beings should behave as though the law compels him.
[08:36.080 --> 08:43.160]  But it is the universal failing in mankind that what we are given to administer, we promptly
[08:43.160 --> 08:46.160]  presume we own.
[08:46.160 --> 08:49.080]  And this is what our governor did.
[08:49.080 --> 09:01.280]  Our governor issued orders directing individuals to do certain things that they otherwise might
[09:01.280 --> 09:04.880]  or might not do.
[09:04.880 --> 09:13.520]  Now I look at the Constitution and the laws of the state of Texas and I find absolutely
[09:13.520 --> 09:23.280]  nothing that authorizes a governor to tell me to do anything.
[09:23.280 --> 09:30.440]  Not even the president has the power to tell me to do anything.
[09:30.440 --> 09:41.080]  The president, he commands the military and he is the head executive officer of all federal
[09:41.080 --> 09:42.080]  agencies.
[09:42.080 --> 09:46.960]  You're not a federal agency.
[09:46.960 --> 09:50.960]  And the governor, he commands the state militia.
[09:50.960 --> 09:55.640]  Okay, we don't have one, but I'll get to that.
[09:55.640 --> 10:10.360]  And he also is executive officer for all state agencies and he can issue orders, change rules
[10:10.360 --> 10:11.360]  and regulations.
[10:11.360 --> 10:18.000]  Now, the governor claimed that he took this action under authority of the Texas Disaster
[10:18.000 --> 10:26.840]  Act of 1975 and in the Texas Disaster Act of 1975, it allowed him to abolish and create
[10:26.840 --> 10:27.840]  laws.
[10:27.840 --> 10:37.200]  Well, that's not what it said, 016, 017 is what he's speaking to and it allowed him to
[10:37.200 --> 10:49.840]  create or abolish rules and regulations of governmental agencies.
[10:49.840 --> 10:57.480]  He has no power to speak to me, he's the servant, I'm the master.
[10:57.480 --> 11:05.720]  The only branch of government that has the power to speak to me is my legislature.
[11:05.720 --> 11:13.240]  And through my legislature, myself as a citizen in this republic, not a sovereign citizen
[11:13.240 --> 11:17.300]  because sovereign citizen is an oxymoron.
[11:17.300 --> 11:22.000]  You can be sovereign or you can be a citizen, you can't be both.
[11:22.000 --> 11:30.760]  Now, the citizens as a group are sovereign over the rest of the branches of government,
[11:30.760 --> 11:34.160]  but the singular citizen is just a citizen.
[11:34.160 --> 11:37.640]  We are not a democracy.
[11:37.640 --> 11:43.280]  Democracy is mob rule, that's what Benjamin Franklin called it and he was right.
[11:43.280 --> 11:48.280]  If in a democracy, if the democracy, the people want your property, didn't take your property,
[11:48.280 --> 11:52.160]  if they want your life, they can take your life, they can do whatever they want to.
[11:52.160 --> 11:57.520]  This is not a democracy, this is a republic.
[11:57.520 --> 12:05.280]  It is a democratic republic, but first it is a republic and in a republic, all power
[12:05.280 --> 12:12.600]  flows from the individual, all rights are granted not to the people, but to the individual
[12:12.600 --> 12:13.600]  citizens.
[12:13.600 --> 12:24.320]  When you hear people say, I have rights, they should say, I have my rights, they belong
[12:24.320 --> 12:25.720]  to me.
[12:25.720 --> 12:33.360]  Nobody gets to step on them, not even the governor, not even when he's acting in the
[12:33.360 --> 12:39.400]  best of faith and that we've experienced.
[12:39.400 --> 12:44.360]  I'm not saying that the governor did not act in the best of faith.
[12:44.360 --> 12:52.280]  What I'm saying is the governor acted outside of law and you've heard stories about assisted
[12:52.280 --> 13:00.680]  suicide where someone has a loved one who is in horrible pain and can look at no respite
[13:00.680 --> 13:04.240]  from that pain until they die.
[13:04.240 --> 13:12.840]  And we've had people take whatever risk it took to help their loved one relieve themselves
[13:12.840 --> 13:13.840]  of that pain.
[13:13.840 --> 13:20.680]  But when they took that action, they were well aware that it had consequences.
[13:20.680 --> 13:27.640]  I had a twin brother once and he was the last man off the LZ when he stepped on a bouncing
[13:27.640 --> 13:28.640]  Betty.
[13:28.640 --> 13:31.680]  And he told me he knew what it was.
[13:31.680 --> 13:38.360]  He had the option of diving away from it because it shoots up a projectile and then blasts
[13:38.360 --> 13:39.360]  outward.
[13:39.360 --> 13:40.440]  It's anti-personnel.
[13:40.440 --> 13:45.960]  But if he did that, all of his friends would have been hurt by this and might've killed
[13:45.960 --> 13:47.440]  all of them.
[13:47.440 --> 13:54.200]  So he made the conscious choice to drop down on the projectile and capture it.
[13:54.200 --> 13:55.200]  And he did.
[13:55.200 --> 13:56.980]  Blue molded pieces.
[13:56.980 --> 13:59.520]  One other person got injured.
[13:59.520 --> 14:07.560]  Now he died of gangrene and he died hard.
[14:07.560 --> 14:11.680]  But never once did he indicate he regretted his decision.
[14:11.680 --> 14:15.880]  He understood there were consequences.
[14:15.880 --> 14:20.560]  What power is there in a decision if it doesn't have consequences?
[14:20.560 --> 14:29.080]  It is my position that the governor saw a looming pandemic and he was concerned that
[14:29.080 --> 14:39.300]  a lot of the people in Texas that he considered to be his charge were subject to potentially
[14:39.300 --> 14:43.200]  die from this pandemic and he needed to do something.
[14:43.200 --> 14:51.000]  He felt like we were little children out here looking up to Papa Abbott to save us from
[14:51.000 --> 14:54.260]  this horrible pandemic.
[14:54.260 --> 14:57.500]  And he took actions to do just that.
[14:57.500 --> 15:04.760]  But as I will show in this complaint, those actions were absolutely forbidden by constitution
[15:04.760 --> 15:05.760]  and law.
[15:05.760 --> 15:09.800]  But he took that risk.
[15:09.800 --> 15:19.120]  Now if there is to be any power in his decision, he must face the consequences of those decisions.
[15:19.120 --> 15:32.400]  Because the Texas Supreme Court, after this Shelly Luther opened her hair salon in violation
[15:32.400 --> 15:41.400]  of the governor's edicts, she was arrested and the judge told her, if you'll just apologize,
[15:41.400 --> 15:43.000]  I won't put you in jail.
[15:43.000 --> 15:47.480]  Well, she didn't apologize and he threw her in jail.
[15:47.480 --> 15:56.360]  The lawyer crafted, he probably already had it crafted, a document restraining order petition
[15:56.360 --> 16:03.560]  he filed with the Texas Supreme Court and before the end of the day, the Texas Supreme
[16:03.560 --> 16:09.840]  issued an order and they ordered that judge to get her out of that jail before the end
[16:09.840 --> 16:16.280]  of the business day, this day, that was Cinco de Mayo this year, 5th of May.
[16:16.280 --> 16:24.240]  And this is what they said, in part, the constitution is not suspended when the government declares
[16:24.240 --> 16:26.760]  a state of disaster.
[16:26.760 --> 16:32.800]  All government power in this country, no matter how well intentioned, derives only from the
[16:32.800 --> 16:35.520]  state and federal constitution.
[16:35.520 --> 16:43.680]  Government power cannot be exercised in conflict with these constitutions, even in a pandemic.

[20:46.560 --> 20:53.080]  They went on to say, those who object to these restrictions should remember they were imposed
[20:53.080 --> 21:02.720]  by duly elected officials, vested by statute with broad emergency powers who must make
[21:02.720 --> 21:06.280]  difficult decisions under difficult circumstances.
[21:06.280 --> 21:09.640]  Okay, we got that.
[21:09.640 --> 21:14.540]  At the same time, all of us, the judiciary, the other branches of government, and our
[21:14.540 --> 21:22.600]  fellow citizens must insist that every action our governments take complies with the constitution,

[21:24.800 --> 21:30.160]  If we tolerate unconstitutional government orders during an emergency, whether out of
[21:30.160 --> 21:40.760]  expediency or fear, we abandon the Constitution at the moment we need it most.

[21:43.160 --> 21:48.140]  And if you listen to my show a lot, you know that that's where I live.

[21:51.560 --> 22:00.440]  The only thing I expect from my public officials is that you follow my law.

[22:17.400 --> 22:21.880]  It's not the judges, it's not the prosecutors, the bailiffs, the clerks.
[22:21.880 --> 22:26.720]  All of those folks are public servants.

[22:31.080 --> 22:38.320]  And in this case, I am putting my behavior where my mouth is.
[22:38.320 --> 22:43.680]  I'm doing what I suggest everybody else do.

[22:46.040 --> 22:50.880]  So the governor issued these orders.
[22:50.880 --> 23:00.360]  One of the orders I was most struck with and surprised about is I think it was order 13.
[23:00.360 --> 23:11.240]  He ordered judges and sheriffs if someone was arrested and charged with a violent offense.
[23:11.240 --> 23:17.420]  Let's say a policeman's in a bad mood and he grabs you and spins you around and you
[23:17.420 --> 23:20.320]  accidentally bump into him.
[23:20.320 --> 23:23.840]  He's going to charge you with assault by contact.
[23:23.840 --> 23:28.720]  Williamson County, when I called the police to arrest a district judge and the district
[23:28.720 --> 23:36.200]  attorney, we were in a room and the policeman put his hand on my chest and I was in a chair
[23:36.200 --> 23:38.000]  pushing me over backwards.
[23:38.000 --> 23:42.240]  And when I was about to fall over backwards, I pushed his hand away.
[23:42.240 --> 23:46.580]  He charged me with assault by contact and arrested me.
[23:46.580 --> 23:52.080]  If that happens to you now, then you go to jail.
[23:52.080 --> 24:02.240]  And if you can't afford bail, the governor ordered the judges and sheriffs who have authority
[24:02.240 --> 24:08.120]  to release people for misdemeanor offenses on personal recognizance.
[24:08.120 --> 24:14.180]  And they were doing that in order to relieve the overcrowding in the jails in this time
[24:14.180 --> 24:15.180]  of pandemic.
[24:15.180 --> 24:18.160]  And that's something that's provided for in statute.
[24:18.160 --> 24:19.160]  That's already there.
[24:19.160 --> 24:20.160]  Yes.
[24:20.160 --> 24:21.800]  They've been there a long time.
[24:21.800 --> 24:27.760]  They prior to this, they didn't use it a lot, unless it was a special case, like it's one
[24:27.760 --> 24:29.760]  of their buddies or something.
[24:29.760 --> 24:36.400]  Or if a high school senior getting ready to go to the prom, he does something a little
[24:36.400 --> 24:40.400]  stupid, go, go to the prom, take care of business.

[27:18.320 --> 27:24.480]  Yes, I know, that's murder, and that's my jurisdiction, not yours, get out of here.

[27:31.600 --> 27:34.720]  so now they would have jurisdiction, but at the time they didn't.
[27:34.720 --> 27:42.960]  The sheriff is the primary law enforcement officer in a county, and that's why when we
[27:42.960 --> 27:51.920]  created a state police, they were only given authority to enforce the transportation code.
[27:51.920 --> 27:57.720]  Our legislature fully understood the danger of a state police.
[27:57.720 --> 28:04.880]  They knew what a police state was, and they had no intention of creating a police department
[28:04.880 --> 28:08.160]  with statewide jurisdiction.
[28:08.160 --> 28:18.160]  Our founders set up sheriffs very purposefully so that we don't have one overriding, pervading
[28:18.160 --> 28:22.160]  authority that can come into a state and take it over.
[28:22.160 --> 28:29.040]  They have to deal with every single sheriff individually, and getting all of those sheriffs
[28:29.040 --> 28:35.660]  to agree to some statewide takeover is not going to happen.
[28:35.660 --> 28:40.220]  You can't get two sheriffs to agree on anything, much less 254.
[28:40.220 --> 28:54.280]  That was a great idea, and it's worked for 170 years, actually almost 200 years now.

[34:10.520 --> 34:16.360]  So I had to back up to our constitutional, our federal constitutional founders, and they
[34:16.360 --> 34:19.640]  had a lot to say on this subject.
[34:19.640 --> 34:30.760]  In looking at the Federalist and other papers by Franklin, Madison, Jefferson, and others,
[34:30.760 --> 34:36.520]  it is clear what their primary fear was.
[34:36.520 --> 34:39.300]  It was the president.
[34:39.300 --> 34:47.840]  They had to have one, but they clearly understood that the most dangerous person in the republic
[34:47.840 --> 34:54.040]  is the president, the one most likely to attempt to extend his power.
[34:54.040 --> 35:02.480]  They understood we needed a single focus of power in the state, but they also needed effective
[35:02.480 --> 35:04.760]  ways of restraining that power.
[35:04.760 --> 35:12.100]  James Madison in Federalist 48 said, it will not be denied that power is of an encroaching
[35:12.100 --> 35:21.440]  nature and that it ought to be effectually restrained from passing the limits assigned
[35:21.440 --> 35:25.400]  to it.
[35:25.400 --> 35:34.160]  Also in Federalist 84, he spoke to this issue and elective despotism was not the government
[35:34.160 --> 35:40.380]  we fought for, but one in which the powers of government should be so divided and balanced
[35:40.380 --> 35:48.160]  among the several bodies of magistry as that no one could transcend their legal limits
[35:48.160 --> 35:55.040]  without being effectually checked and restrained by the others.
[35:55.040 --> 36:06.720]  Continually in their quotations, they address their concern that in whomever we place power,
[36:06.720 --> 36:12.280]  we have to be careful that they don't extend that power.
[36:12.280 --> 36:19.360]  He goes all the way back, we have a quotation from the European Charters of Liberty back
[36:19.360 --> 36:22.280]  in the 1600s.
[36:22.280 --> 36:27.700]  It says, in Europe, charters of liberty have been granted by power.
[36:27.700 --> 36:33.700]  America has set the example of charters of power granted by liberty.
[36:33.700 --> 36:39.640]  This revolution in the practice of the world may with an honest praise be pronounced the
[36:39.640 --> 36:46.760]  most triumphant epoch of its history and the most consoling passage of its happiness.
[36:46.760 --> 36:52.200]  They did their job well, we're 200 years down the road and it held together.
[36:52.200 --> 37:00.520]  Texas, when our founders put together the Texas Constitution, they clearly studied our
[37:00.520 --> 37:05.840]  federal constitutional founders and they went even further.
[37:05.840 --> 37:12.000]  We have provisions in the Texas Constitution that we don't have in the federal.
[37:12.000 --> 37:20.560]  The federal constitution alludes to these issues, but they don't address them specifically.
[37:20.560 --> 37:21.560]  Texas does.
[37:21.560 --> 37:26.920]  The Texas Constitution Article I, Article I is the Bill of Rights.
[37:26.920 --> 37:37.840]  In 1828, it's titled Suspension of Laws and it says, no power of suspending laws in this
[37:37.840 --> 37:45.400]  state shall be exercised except by the legislature.
[37:45.400 --> 37:51.400]  Now what part of that is hard to understand?
[37:51.400 --> 38:01.000]  Our founders did not mince words and it is very clear by the next section of who they
[38:01.000 --> 38:06.800]  were speaking to when they spoke to no power of suspending laws.
[38:06.800 --> 38:12.780]  Section 29 of the Bill of Rights is titled Bill of Rights accepted from the powers of
[38:12.780 --> 38:22.160]  government and in violet, to guard against transgressions of the high powers herein delegated.
[38:22.160 --> 38:26.740]  That is clearly a reference to the governor.
[38:26.740 --> 38:32.180]  We declare that everything in this Bill of Rights is accepted out of the general powers
[38:32.180 --> 38:37.860]  of government and shall forever remain in violet.
[38:37.860 --> 38:45.180]  That all laws contrary thereto or to the following provisions shall be void.
[38:45.180 --> 38:51.680]  Following provisions refer to provisions included in Article I that came after this one.
[38:51.680 --> 38:52.680]  That's not the last one.
[38:52.680 --> 38:56.200]  I think there's 31 or 32.
[38:56.200 --> 39:01.760]  The legislature, I mean our founders did not mince words here.
[39:01.760 --> 39:11.080]  They absolutely intended that the governor stay firmly within his bounds when dealing
[39:11.080 --> 39:14.660]  with the general public.
[39:14.660 --> 39:18.640]  He should have read these very carefully.
[39:18.640 --> 39:29.760]  That the governor would issue a ruling that would bind the sheriffs and the judges and
[39:29.760 --> 39:35.600]  created conditions from which people could die.
[39:35.600 --> 39:38.400]  What was he thinking?
[39:38.400 --> 39:46.680]  And then he issued this ruling that said that you and I, we can't go seek medical attention.
[39:46.680 --> 39:54.600]  Even if we have a contract, even if we have medical insurance, we can't go use that medical
[39:54.600 --> 40:02.920]  insurance because he forbade the medical community from providing services to anyone who did
[40:02.920 --> 40:09.520]  not have a known life-threatening issue.
[40:09.520 --> 40:16.200]  We just read a statistic today that from the medical community that said 50% of all the
[40:16.200 --> 40:24.040]  people on chemotherapy missed their chemotherapy sessions because of these restrictions.
[40:24.040 --> 40:31.160]  They were afraid that being already being ill, that with the government's restrictions,
[40:31.160 --> 40:36.320]  since this wasn't life-threatening immediately, they didn't go.
[40:36.320 --> 40:43.520]  And I heard other specifics, mostly about people with diabetes who, one statistic said
[40:43.520 --> 40:49.560]  in the United States, 10,000 people have died of diabetes who did not know they had a life-threatening
[40:49.560 --> 40:55.320]  condition but didn't go seek medical condition because of restrictions.
[40:55.320 --> 41:01.040]  Now that's not all in Texas, but I'm sure we have some in Texas.
[41:01.040 --> 41:08.680]  If we have one person in Texas who had a medical condition but didn't know that medical condition
[41:08.680 --> 41:18.880]  was life-threatening and because of the threats by the governor of imprisonment and fine,
[41:18.880 --> 41:25.360]  they didn't go to a medical profession and wound up dying of this condition.
[41:25.360 --> 41:28.160]  That's the prairie tart murder.
[41:28.160 --> 41:39.080]  And what is the likelihood in a population of 25 million that this happened to someone?
[41:39.080 --> 41:49.880]  And the governor ordered the medical community to set aside 75% of their bed space for use
[41:49.880 --> 41:59.880]  by COVID patients when 5% of their bed space is being used by COVID patients.
[41:59.880 --> 42:03.520]  And that 5% has not increased.
[42:03.520 --> 42:07.460]  And medical professionals all over the state were being laid off because they had nothing
[42:07.460 --> 42:13.060]  to do while people are dying of treatable conditions because of these orders not to
[42:13.060 --> 42:14.560]  seek treatment.
[42:14.560 --> 42:18.180]  And that's not all.
[42:18.180 --> 42:20.280]  He ordered the schools closed.
[42:20.280 --> 42:22.280]  Now, you know, you hear that.
[42:22.280 --> 42:25.280]  That don't sound so horrible.
[42:25.280 --> 42:29.980]  And especially if you're a student, yeah, especially if you're a student, you know,
[42:29.980 --> 42:33.640]  we think of all of these kids put together.
[42:33.640 --> 42:39.600]  That would be a COVID incubator, and I get that.
[42:39.600 --> 42:44.320]  I'm not saying that was a bad idea.
[42:44.320 --> 42:51.640]  What I'm saying is the governor had zero power to issue that order.
[42:51.640 --> 42:53.880]  Think about it.
[42:53.880 --> 42:57.800]  What tax pays for the schools?
[42:57.800 --> 42:59.940]  We don't have a state income tax.
[42:59.940 --> 43:02.520]  So where do the schools get their money?
[43:02.520 --> 43:08.920]  They get it from the county property taxes and county school taxes.
[43:08.920 --> 43:14.720]  That school belongs to the county, not to the governor, not to the state.
[43:14.720 --> 43:20.920]  The governor has no power to tell the county what to do with their schools.
[43:20.920 --> 43:26.200]  He has grossly extended his power, and it's not because I'm saying it's a bad idea.
[43:26.200 --> 43:31.720]  He could go to the county commissioner's court and say, guys, I think it'd be a great idea
[43:31.720 --> 43:34.240]  to close the schools.
[43:34.240 --> 43:40.720]  County commissioners could have constitutionally closed the schools, but that's not what the
[43:40.720 --> 43:41.720]  governor did.
[43:41.720 --> 43:44.160]  He didn't trust us.

[53:09.480 --> 53:13.220]  a second degree felony in the state of Texas.

[01:22:27.920 --> 01:22:32.920]  Okay, read the definition of a criminal street gang
[01:22:32.920 --> 01:22:34.920]  I think it's the next statute
[01:22:34.920 --> 01:22:38.920]  Yeah, I think that's 71.023, I had that in there
[01:22:38.920 --> 01:22:50.920]  It says, let's see, Mnuchin used armed thugs, sheriffs, cops, law enforcement to forcibly evict people from their homes regularly in multiple states
[01:22:50.920 --> 01:22:55.920]  No, I'm talking about the definition in the statute
[01:22:55.920 --> 01:22:57.920]  Ah, let me go pull that up
[01:22:57.920 --> 01:23:02.920]  It describes what a street gang is
[01:23:02.920 --> 01:23:09.920]  And when I read it, I said, you know, that really doesn't describe just a street gang
[01:23:09.920 --> 01:23:15.920]  That describes any group that operates together
[01:23:15.920 --> 01:23:18.920]  Did you find it, Brett?

[01:23:48.920 --> 01:23:54.920]  Criminal street gang means three or more persons having a common identifying sign or symbol
[01:23:54.920 --> 01:24:03.920]  On an identifiable, or an identifiable leadership who continuously or regularly associate in the commission or criminal activities
[01:24:03.920 --> 01:24:07.920]  So that covers them very easily
[01:24:07.920 --> 01:24:12.920]  So, now we have them in organized crime
[01:24:12.920 --> 01:24:19.920]  If any crime was committed within the statute of limitations
[01:24:19.920 --> 01:24:24.920]  That was part of this ongoing criminal conspiracy
[01:24:24.920 --> 01:24:27.920]  You can drag them all in under 71
[01:24:27.920 --> 01:24:32.920]  What do you think about that, Tina?

[01:25:01.920 --> 01:25:05.920]  So the criminal fraud that was committed

[01:25:09.920 --> 01:25:13.920]  Because you're still being affected by the criminal behavior
[01:25:13.920 --> 01:25:17.920]  So the clock hasn't even started to run yet
[01:25:17.920 --> 01:25:27.920]  And the criminal behavior went on all through and leading up to the foreclosure
[01:25:27.920 --> 01:25:36.920]  And they have submitted these forged and fraudulent documents into court cases as late as this year
[01:25:36.920 --> 01:25:51.920]  Okay, so from a political perspective, you have 12 citizens drawn out from the population into a grand jury
[01:25:51.920 --> 01:25:58.920]  And after talking to prosecutors, I was going after a grand jury foreman once
[01:25:58.920 --> 01:26:03.920]  Because he refused to examine into one of my accusations
[01:26:03.920 --> 01:26:10.920]  And the prosecutor said, oh, please, Mr. Kelton, don't mess with my grand jury
[01:26:10.920 --> 01:26:14.920]  They're hard enough to see it as it is
[01:26:14.920 --> 01:26:17.920]  And it is hard to see the grand jury
[01:26:17.920 --> 01:26:24.920]  Because you have people here like in Austin, they meet for three months, twice a week, all day long
[01:26:24.920 --> 01:26:27.920]  Where are you going to find people that have that much time?
[01:26:27.920 --> 01:26:33.920]  So these guys that say, oh, they packed the grand jury, good luck with that
[01:26:33.920 --> 01:26:35.920]  They don't pack the grand jury
[01:26:35.920 --> 01:26:37.920]  They got ordinary people on there
[01:26:37.920 --> 01:26:45.920]  So you ask an ordinary person to indict the director of the US Treasury
[01:26:45.920 --> 01:26:49.920]  They're going to say, whoa, hold on here
[01:26:49.920 --> 01:26:57.920]  So how are you going to get them to see that this is serious enough that it should happen?
[01:26:57.920 --> 01:27:04.920]  We track on all of these other accusations against all of these other associated players
[01:27:04.920 --> 01:27:12.920]  And you will not be able to find a grand jury member that is not fully aware of what happened after 2008
[01:27:12.920 --> 01:27:16.920]  And how people were stripped of their homes and thrown out in the street
[01:27:16.920 --> 01:27:18.920]  And if you give them
[01:27:18.920 --> 01:27:20.920]  They are one and they have one in the family

[01:34:31.920 --> 01:34:36.920]  The prosecutor telling her that all the doors were closed
[01:34:36.920 --> 01:34:39.920]  I think we already knew that
[01:34:39.920 --> 01:34:41.920]  And that's what we're doing
[01:34:41.920 --> 01:34:44.920]  Brett, you have been opening doors that were otherwise closed
[01:34:44.920 --> 01:34:51.920]  What do you suggest to Tina about what the prosecutor said to her?

[01:35:33.920 --> 01:35:38.920]  For no apparent reason, they want to obstacle the records requests
[01:35:38.920 --> 01:35:42.920]  Just as a matter of habit or something
[01:35:42.920 --> 01:35:50.920]  And we pretty much have to hold our instruments that we created accountable
[01:35:50.920 --> 01:35:53.920]  To be open in transparentness
[01:35:53.920 --> 01:35:56.920]  It's not an easy job
[01:35:56.920 --> 01:36:06.920]  And what have you found as to what your options are to open those doors?
[01:36:06.920 --> 01:36:09.920]  Criminal complaints
[01:36:09.920 --> 01:36:12.920]  That's the main thing
[01:36:12.920 --> 01:36:17.920]  If it's an attorney involved, like if the county clerk for instance says
[01:36:17.920 --> 01:36:21.920]  Oh, I can't give you that information
[01:36:21.920 --> 01:36:24.920]  The county attorney told me I can't
[01:36:24.920 --> 01:36:26.920]  Oh, thank you very much
[01:36:26.920 --> 01:36:32.920]  Then the county attorney gets a bar grievance and they both get a criminal complaint
[01:36:32.920 --> 01:36:40.920]  And probably a conspiracy allegation just for good measure
[01:36:40.920 --> 01:36:46.920]  And Tina, you start filing criminal charges in California
[01:36:46.920 --> 01:36:56.920]  They're going to do everything they can to make you think that they don't care about that
[01:36:56.920 --> 01:37:03.920]  You know, if we're about to get in a fight, and I had one yesterday and my shoulder's all bruised up
[01:37:03.920 --> 01:37:07.920]  I'm not going to point at that shoulder and say, see this spot right here?
[01:37:07.920 --> 01:37:10.920]  Don't hit me there
[01:37:10.920 --> 01:37:15.920]  What I'm going to do is stick that shoulder out in front
[01:37:15.920 --> 01:37:19.920]  So that you'll try to go around it
[01:37:19.920 --> 01:37:27.920]  The last thing these guys are going to do is tell you how effective what you're doing is
[01:37:27.920 --> 01:37:35.920]  The way I find out when I'm effective is the next time I come there
[01:37:35.920 --> 01:37:45.920]  Yesterday I went to the sheriff's department to talk to them about records of inmates who caught coronavirus
[01:37:45.920 --> 01:37:49.920]  Or medical records of inmates, what kind of records they kept and such
[01:37:49.920 --> 01:37:54.920]  Because in our jail, they had no incident of coronavirus
[01:37:54.920 --> 01:38:00.920]  So I want to find out what records they have, so when I go to the Tarrant County Sheriff, I know what to ask for
[01:38:00.920 --> 01:38:07.920]  When I went in there, the person I talked to at the desk is a captain
[01:38:07.920 --> 01:38:11.920]  He's in a wheelchair, he was shot, so he's in a wheelchair for now
[01:38:11.920 --> 01:38:21.920]  He knew me real well, he came out with two complaint forms to file against these two officers that I filed criminal complaints against
[01:38:21.920 --> 01:38:25.920]  And I had to tell him, oh no, no, no, I'm not here for that
[01:38:25.920 --> 01:38:34.920]  Because that I told him what I intend to do, I called 911 and asked the sergeant for a voluntary statement
[01:38:34.920 --> 01:38:36.920]  And he didn't have one with him
[01:38:36.920 --> 01:38:43.920]  So I go in and I talk to this other guy who had nothing to do with him and he comes out with voluntary statements
[01:38:43.920 --> 01:38:48.920]  That means everybody's talking to everybody about what's going on here
[01:38:48.920 --> 01:38:52.920]  This is bouncing through the whole jurisdiction
[01:38:52.920 --> 01:38:58.920]  And now they'll find out I filed criminal charges against him with the county judge
[01:38:58.920 --> 01:39:00.920]  And oh, he was unhappy
[01:39:00.920 --> 01:39:10.920]  But everything you do, they're not going to tell me that this is creating an uproar in the sheriff's department
[01:39:10.920 --> 01:39:13.920]  That's the last thing they're going to do
[01:39:13.920 --> 01:39:23.920]  But by him bringing those two complaint forms out, assuming I was there to file against these guys because I told him I would
[01:39:23.920 --> 01:39:26.920]  That means everybody knows
[01:39:26.920 --> 01:39:36.920]  So trust they're not going to tell you, but you put something out there that could end their career and put them in jail
[01:39:36.920 --> 01:39:39.920]  You got their attention
[01:39:39.920 --> 01:39:47.920]  Every one of those guys watches people come into the court system and get screwed royal
[01:39:47.920 --> 01:40:00.920]  And all of them expect that they will get screwed worse than anybody else because somewhere in this system I have a political enemy
[01:40:00.920 --> 01:40:10.920]  And they're going to use this complaint to screw me royal just like the district attorney in Travis County is doing right now
[01:40:10.920 --> 01:40:17.920]  This confirms that we have the power to make things change
[01:40:17.920 --> 01:40:23.920]  Just don't expect them to pat you on the back and tell you what a good job you do
[01:40:23.920 --> 01:40:26.920]  Does that work for you, Tina?
[01:40:26.920 --> 01:40:41.920]  Yep, I obviously need to get some really good criminal complaints written to submit to LA about the same person about the attorneys
[01:40:41.920 --> 01:40:51.920]  Because as you know I did file a complaint about the judge who the attorney for the bank hired his daughter to babysit for his young son
[01:40:51.920 --> 01:40:58.920]  And when I filed a complaint the state boss said he didn't do anything wrong in a city of 4 million people
[01:40:58.920 --> 01:41:05.920]  And a firm of 250 he couldn't find anyone else but the judge's daughter to babysit for his son
[01:41:05.920 --> 01:41:14.920]  And they said you're going to wind up with your picture in the courthouse
[01:41:14.920 --> 01:41:29.920]  I have a friend whose son-in-law was a sheriff's deputy in Tarrant County and he got the grand jury duty
[01:41:29.920 --> 01:41:45.920]  And Jim said that David came to him and asked him what is Randy Kelton's picture doing hanging up in the grand jury room with a note that says if you see this person call security
[01:41:45.920 --> 01:41:48.920]  Yes! Yes!
[01:41:48.920 --> 01:41:53.920]  That's okay, I'll take it. But you know that judge
[01:41:53.920 --> 01:42:00.920]  That was the feedback I got. I got no feedback from prosecutors or anybody else. They all acted like it was no big deal
[01:42:00.920 --> 01:42:07.920]  It's a big deal. Brett, I bet your picture is all over
[01:42:07.920 --> 01:42:10.920]  But before, it's like, come on
[01:42:10.920 --> 01:42:30.920]  Well, I don't know. Even my name hasn't been out there except for the people that have been committing offenses and they see my complaints or my motion for judicial removal or different things that put my name on an affidavit
[01:42:30.920 --> 01:42:33.920]  Other than that, I mean, I'm not really on the internet
[01:42:33.920 --> 01:42:41.920]  Every month, all of these judges, they all have meetings and talk about the things that's happened to them
[01:42:41.920 --> 01:42:49.920]  I'm going to bet you, Brett, that every judge in the state of Texas knows about what you're doing in these counties
[01:42:49.920 --> 01:42:54.920]  They've been warned. These are the kind of things that's been happening to me
[01:42:54.920 --> 01:43:01.920]  They hear your name, it's going to be worse than hearing my name because I hadn't bothered them in a long time
[01:43:01.920 --> 01:43:14.920]  And Tina, the way you'll find out that this works is the next time you come in with a case, these people will bend over backwards
[01:43:14.920 --> 01:43:24.920]  to get your case out of their court so they don't wind up with the kinds of things happening to them that happened to these other guys
[01:43:24.920 --> 01:43:29.920]  But they're never going to admit it and that's okay
[01:43:29.920 --> 01:43:35.920]  I've seen some of that, I've seen some of the change from where they start bending over backwards
[01:43:35.920 --> 01:43:41.920]  and acting super nice and super helpful and, oh, can I get you anything else, Mr. Fountain, is that all you need?

[01:49:16.920 --> 01:49:18.920]  Terrified the woman
[01:49:18.920 --> 01:49:23.920]  And then I sent you another one on someone who is very dear to your heart
[01:49:23.920 --> 01:49:28.920]  Who, him and his wife were falsely accused, trying to help people
[01:49:28.920 --> 01:49:35.920]  You've got to watch these so that you can bring that up at next week's calls

[01:51:47.920 --> 01:51:55.920]  If that conspiracy theory is accurate, this was exactly what they intended
[01:51:55.920 --> 01:52:06.920]  But what you have done, Tina, and what I'm doing with the governor, could dismantle their whole project
[01:52:06.920 --> 01:52:16.920]  They used the pandemic to get all of these governors to take power that they did not have
[01:52:16.920 --> 01:52:22.920]  And you'd ask the question, how on earth would they think they could get away with such a thing
[01:52:22.920 --> 01:52:28.920]  Well, I live in a state of 25 million people
[01:52:28.920 --> 01:52:35.920]  And 24,999,999 people said nothing
[01:52:35.920 --> 01:52:44.920]  While the government just exercised outrageous powers, everybody stood back and said
[01:52:44.920 --> 01:52:48.920]  Well, he went too far, or he didn't go far enough
[01:52:48.920 --> 01:52:56.920]  Even the Supreme Court, they spoke to what he was doing as not necessary or not being effective
[01:52:56.920 --> 01:53:05.920]  And I wanted to say, whoa, stop! It doesn't matter if it's necessary or effective, wrong argument
[01:53:05.920 --> 01:53:07.920]  He had no power to do that
[01:53:07.920 --> 01:53:18.920]  Yeah, everybody else in the state of Texas just accepted it, and they had reason to believe everybody would
[01:53:18.920 --> 01:53:24.920]  The problem was, it only takes one or two
[01:53:24.920 --> 01:53:36.920]  If you take down the director of the treasury and we take down the governor, this will send reverberations through the entire system
[01:53:36.920 --> 01:53:43.920]  And this idea that they can get governors to take over the states individually
[01:53:43.920 --> 01:53:55.920]  Had the Democrats got Hillary Clinton in, she would have been issuing orders, ordering us to do what the governors are doing
[01:53:55.920 --> 01:54:03.920]  The problem was, they didn't have a president in their pocket, so they had to do it all through the governors
[01:54:03.920 --> 01:54:15.920]  If we now start hammering the governors, because the governor's problem is, they've already rung this bell, and they can't unring it
[01:54:15.920 --> 01:54:25.920]  If these complaints take these guys out, that's going to say to everybody else, you and your state can do the same thing
[01:54:25.920 --> 01:54:34.920]  It's not like some powerful government agent or agency took out the governor
[01:54:34.920 --> 01:54:42.920]  But some two-bit redneck chunk from Hillbilly, Texas, comes down and takes out the governor
[01:54:42.920 --> 01:54:50.920]  That tells every redneck Hillbilly in the country, potentially you can do the same thing

[01:57:24.920 --> 01:57:29.920]  Because most of these public officials feel like they're cannon fodder anyway
