[01:14.080 --> 01:18.080]  and San Antonio, have been dropping marijuana possession charges and even refusing to file
[01:18.080 --> 01:22.280]  new ones, since they are stipulating that they do not have the time or the laboratory
[01:22.280 --> 01:24.760]  equipment to test the oath for THC.
[01:24.760 --> 01:28.440]  Margaret Moore, the Travis County District Attorney, announced earlier this month that
[01:28.440 --> 01:33.000]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.000 --> 01:34.000]  law.
[01:34.000 --> 01:37.640]  Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter
[01:37.640 --> 01:42.120]  that county district attorneys back on Thursday that marijuana has not been decriminalized
[01:42.120 --> 01:48.280]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as
[01:48.280 --> 01:51.240]  well as other cities too, like the District Attorney.
[01:51.240 --> 01:57.280]  In El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law quote
[01:57.280 --> 02:01.760]  will not have an effect on the prosecution of marijuana cases in El Paso.
[02:01.760 --> 02:06.760]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.760 --> 02:10.760]  in Harris County, who stated that quote, the law is constantly changing on what makes
[02:10.760 --> 02:13.480]  something illegal based on its chemical makeup.
[02:13.480 --> 02:17.360]  It's important that if someone is charged with something, the test matches what they're
[02:17.360 --> 02:22.600]  charged with.
[02:22.600 --> 02:27.440]  A paper by Tulane University identified a five and a half inch American pocket shark.
[02:27.440 --> 02:32.360]  As the first of its kind in the Gulf of Mexico, the specimen being only the second pocket
[02:32.360 --> 02:38.000]  shark ever captured or recorded with the other one being found way back in 1979 in the East
[02:38.000 --> 02:39.500]  Pacific Ocean.

[05:15.920 --> 05:19.960]  and how many people have actually been shown
[05:19.960 --> 05:21.600]  to have died from it?

[06:16.680 --> 06:19.360]  And the Democrats just jumped up and down
[06:19.360 --> 06:21.320]  and railed in righteous indignation,
[06:21.320 --> 06:25.120]  oh, this guy's falling in, everybody's going to die.
[06:25.120 --> 06:29.480]  Well, apparently a lot more people got tested.
[06:29.480 --> 06:32.600]  So, they had a lot more numbers that they could claim.
[06:32.600 --> 06:37.120]  And perhaps more people did contract COVID.
[06:37.120 --> 06:41.360]  But one telling number, even with all the fudging,
[06:41.360 --> 06:45.760]  is that the death rate did not increase.
[06:45.760 --> 06:49.760]  So, as we move toward November,
[06:49.760 --> 06:54.480]  I suspect that the Democrats will be,
[06:54.480 --> 06:59.720]  Democrats will be, they're either going to be,
[06:59.720 --> 07:03.160]  try to keep kicking this dead horse,
[07:03.160 --> 07:07.600]  or they're going to just shift gears to something else.
[07:07.600 --> 07:09.440]  And that's really what I suspect.
[07:09.440 --> 07:15.480]  What they have been saying is that if Biden gets in,
[07:15.480 --> 07:19.680]  he'll fix all these problems that Trump didn't fix.
[07:19.680 --> 07:23.360]  Now, he's not saying how he's going to fix these problems.
[07:23.360 --> 07:24.680]  He's just saying he's going to.
[07:24.680 --> 07:29.360]  So, I took that as a shift in the rhetoric.
[07:29.360 --> 07:32.880]  They weren't talking exclusively about COVID
[07:32.880 --> 07:36.520]  and Trump's poor handling of COVID
[07:36.520 --> 07:42.720]  because I suspect they're taking the temperature of the public
[07:42.720 --> 07:47.720]  and they're finding that the public has pretty well had it.

[07:51.680 --> 07:55.120]  that I experienced when I was overseas.
[07:55.120 --> 07:59.240]  We worked with really, really ugly stuff.

[08:01.960 --> 08:06.800]  I think the most dangerous thing we ever worked with was flares,
[08:06.800 --> 08:09.280]  these spotter flares.

[08:16.080 --> 08:18.080]  in diameter and 4 inches deep.

[10:37.640 --> 10:41.720]  But see, most people don't know anyone who's died of COVID.

[11:06.960 --> 11:11.240]  someone who died of COVID, other than people
[11:11.240 --> 11:15.680]  who were in for other reasons and life-threatening conditions.
[11:15.680 --> 11:18.920]  And then all of a sudden, they get COVID just before they
[11:18.920 --> 11:20.280]  pass away.
[11:20.280 --> 11:25.840]  So we're getting kind of contemptuous of it.
[11:25.840 --> 11:29.480]  If it's so horrible, why haven't I been sick yet?
[11:29.480 --> 11:33.040]  Why hasn't anybody I know been sick yet?

[12:20.120 --> 12:26.760]  And it's been an ongoing pandemic for about 100 years now.

[12:30.800 --> 12:36.200]  that if there was one microorganism that
[12:36.200 --> 12:40.160]  caused the depopulation of the planet,
[12:40.160 --> 12:42.640]  it will be tuberculosis.
[12:42.640 --> 12:44.840]  They consider that the most dangerous one out there.
[12:44.840 --> 12:48.320]  Because it didn't shut down the planet.
[12:48.320 --> 12:51.680]  With 30 million a year, they didn't shut the planet down.
[12:51.680 --> 12:55.680]  And the planet seemed to grind along
[12:55.680 --> 12:58.800]  even with all these problems, even before we

[13:17.000 --> 13:21.080]  And I suspect that by the time we get close to the election,

[13:22.360 --> 13:25.800]  to be frustrated with the Democrats.

[13:30.520 --> 13:32.880]  that the Democrats are just trying
[13:32.880 --> 13:38.040]  to preach doom and gloom and terrify everybody.

[22:24.120 --> 22:27.840]  1406, I think that's the one that
[22:27.840 --> 22:31.480]  directs them to take them to the nearest magistrate.

[22:35.080 --> 22:38.160]  But that is a peace officer who is charging a person.
[22:38.160 --> 22:40.880]  It doesn't say if you give a criminal charge to the peace

[22:45.400 --> 22:51.000]  But 2.13 tells a peace officer when he

[23:05.280 --> 23:08.840]  by verified criminal affidavit.

[23:11.440 --> 23:17.160]  So they have no power to make any determination.
[23:17.160 --> 23:22.640]  They have had it known to them by a credible person
[23:22.640 --> 23:24.360]  to be verified affidavit.
[23:24.360 --> 23:26.600]  They don't get to decide whether or not
[23:26.600 --> 23:29.880]  they believe that's a crime or not a crime.
[23:29.880 --> 23:31.800]  They're not lawyers.
[23:31.800 --> 23:35.520]  And if the complaint is against the public official,
[23:35.520 --> 23:38.000]  the prosecuting attorney has no power
[23:38.000 --> 23:42.840]  to decide if that's a crime or if that's not a crime.
[23:42.840 --> 23:46.160]  Only some magistrate.
[23:46.160 --> 23:48.040]  That's 2.03.
[23:48.040 --> 23:52.480]  If they give it to a prosecuting attorney,
[23:52.480 --> 23:56.760]  the prosecuting attorney under 2.03
[23:56.760 --> 24:01.840]  is they deny him any discretion in the matter.
[24:01.840 --> 24:04.880]  It requires that he give it to the grand jury.
[24:04.880 --> 24:09.840]  And 2.05 requires him to reduce it to an information
[24:09.840 --> 24:12.920]  and submit it to a magistrate.
[24:12.920 --> 24:15.760]  This is not may, might, or can if you want to.
[24:15.760 --> 24:17.440]  This is what the law commands.
[24:17.440 --> 24:21.080]  And when they don't do it, like these officers,
[24:21.080 --> 24:24.160]  they don't give that to some magistrate.
[24:24.160 --> 24:28.680]  Like Stephen, what I suggest is you
[24:28.680 --> 24:36.640]  prepare a information request to the head of the department.
[24:36.640 --> 24:40.440]  Was this county sheriff or municipal?
[24:40.440 --> 24:43.400]  This was municipal because I know the county will
[24:43.400 --> 24:46.200]  automatically say, well, it's within the city's jurisdiction,
[24:46.200 --> 24:49.840]  even though, regardless, they always play that.
[24:49.840 --> 24:55.680]  Well, that's the city's jurisdiction, a county deputy
[24:55.680 --> 24:59.240]  not enforcing statutes within the jurisdiction
[24:59.240 --> 25:05.560]  of a municipality is part of an agreement between the county
[25:05.560 --> 25:10.200]  and the city, a memorandum of understanding.
[25:10.200 --> 25:15.520]  Well, we don't care about memorandum of understanding.
[25:15.520 --> 25:20.160]  We don't care about mutual agreement.
[25:20.160 --> 25:23.800]  We care about code.
[25:23.800 --> 25:27.920]  And the code doesn't say anything about municipalities
[25:27.920 --> 25:31.280]  or counties.
[25:31.280 --> 25:34.600]  It says that when a peace officer hasn't
[25:34.600 --> 25:36.960]  made known to him that a crime has been committed,
[25:36.960 --> 25:42.800]  he shall submit a complaint to some magistrate.
[25:42.800 --> 25:44.760]  That's pretty clear.
[25:44.760 --> 25:48.040]  It's not hard to understand.
[25:48.040 --> 25:51.760]  And 3805, if they fail to perform that duty,
[25:51.760 --> 25:56.880]  that has the effect of shielding the accused from prosecution.
[25:56.880 --> 26:01.240]  And that is a felony in the state of Texas.
[26:01.240 --> 26:05.400]  So if it's a municipality, send an information
[26:05.400 --> 26:08.320]  request to the mayor.
[26:08.320 --> 26:10.440]  Because in the municipality, he is
[26:10.440 --> 26:15.200]  the custodian of the record, unless he has appointed someone
[26:15.200 --> 26:19.440]  and named them as a custodian of the record.
[26:19.440 --> 26:25.240]  And even then, you don't care, because under Texas law,
[26:25.240 --> 26:30.920]  if you give a public official a information request,
[26:30.920 --> 26:33.920]  and that public official is not the correct person
[26:33.920 --> 26:36.440]  to receive that information request,
[26:36.440 --> 26:40.200]  they are required to forward it to the person who
[26:40.200 --> 26:43.840]  is the correct person.
[26:43.840 --> 26:48.840]  If they refuse to take it, that always gets a 911 call.
[26:48.840 --> 26:51.440]  Yeah, that works for you.
[26:51.440 --> 26:54.360]  So you send it to the mayor and ask
[26:54.360 --> 27:01.440]  the mayor for the name of the magistrate to whom
[27:01.440 --> 27:04.560]  the complaints you filed with this certain officer
[27:04.560 --> 27:07.920]  on this certain day against this certain individual
[27:07.920 --> 27:11.640]  see copies of the complaints attached.
[27:11.640 --> 27:13.280]  You want to know the name of the magistrate
[27:13.280 --> 27:19.440]  to whom these complaints were forwarded under in accordance
[27:19.440 --> 27:25.240]  with Article 2.13, Texas Code of Grant Procedure.
[27:25.240 --> 27:28.440]  That should get interesting.
[27:28.440 --> 27:31.240]  And when you don't get a response from that one,
[27:31.240 --> 27:33.320]  you go back to these officers and give them
[27:33.320 --> 27:34.560]  a complaint against the mayor.
[27:34.560 --> 27:39.560]  The mayor is not going to be a happy camper.
[27:39.560 --> 27:44.240]  And you can take that complaint either to the prosecuting
[27:44.240 --> 27:49.880]  attorney if you want to bind him up a little bit,
[27:49.880 --> 27:54.960]  or you can take it to the foreman of the grand jury.
[27:54.960 --> 27:57.160]  And the way I do that is I find out
[27:57.160 --> 27:59.800]  when the grand jury is meeting, and that's
[27:59.800 --> 28:01.640]  public information.
[28:01.640 --> 28:10.480]  You go down to the officer to the district courthouse
[28:10.480 --> 28:12.840]  is where the grand jury meets.
[28:12.840 --> 28:17.560]  And go in there beforehand and find out where they meet.
[28:17.560 --> 28:23.320]  Tell them one of your kids is doing a paper for school
[28:23.320 --> 28:24.480]  about grand juries.
[28:24.480 --> 28:26.240]  And you want to see the grand jury in the room.
[28:26.240 --> 28:28.480]  You want to see where they meet.
[28:28.480 --> 28:31.840]  So they'll tell you where it's at.
[28:31.840 --> 28:34.360]  If there's no grand jury meeting, they don't care.
[28:34.360 --> 28:39.360]  And on the day they're scheduled to meet, you go down
[28:39.360 --> 28:42.400]  and there'll be a bailiff standing in front of the door.
[28:42.400 --> 28:46.000]  You tell the bailiff what your name is,
[28:46.000 --> 28:49.640]  and instruct him to tell the foreman that you have business
[28:49.640 --> 28:52.600]  with the grand jury.
[28:52.600 --> 28:55.280]  And every time I've done this, the bailiff said,
[28:55.280 --> 28:58.640]  may I tell him the nature of the business?
[28:58.640 --> 28:59.680]  Yes, you may.
[28:59.680 --> 29:01.240]  Give him this.
[29:01.240 --> 29:02.720]  And you hand him these documents.
[29:02.720 --> 29:05.640]  Without a lot of explanations and conversation,
[29:05.640 --> 29:07.440]  just hand it to him.
[29:07.440 --> 29:09.240]  Exactly.
[29:09.240 --> 29:12.680]  And if he doesn't give them to the grand jury,
[29:12.680 --> 29:17.040]  then you come back the next time they meet with criminal
[29:17.040 --> 29:20.920]  charges against him for shielding from prosecution
[29:20.920 --> 29:23.840]  and tampering with a government document.
[29:23.840 --> 29:30.160]  I would even throw in, in addition to the 3805 Penal Code,
[29:30.160 --> 29:32.880]  hindering the prosecution or shielding,
[29:32.880 --> 29:40.320]  I would also throw in Penal Code 7.02, which is responsibility
[29:40.320 --> 29:42.160]  for the crimes of another.
[29:42.160 --> 29:44.960]  7.02 is not, it's in the Penal Code,
[29:44.960 --> 29:52.240]  but it does not designate a criminal charge if you violate it.
[29:52.240 --> 29:55.120]  It's just a directive of, when you're culpable,
[29:55.120 --> 29:56.680]  then you can charge him something else.

[33:58.160 --> 34:02.160]  So I went up to the court and told the court coordinator

[34:04.520 --> 34:09.120]  and I was doing a story about this particular case.
[34:09.120 --> 34:11.600]  And I wanted the judge to look over this document.
[34:11.600 --> 34:13.040]  She said, well, you can't file anything
[34:13.040 --> 34:14.320]  in the case it's closed.
[34:14.320 --> 34:16.080]  So yeah, I know that, but I just wanted
[34:16.080 --> 34:18.720]  to get the judge's opinion before I go on there.
[34:18.720 --> 34:21.600]  So the judge come out and he looked at it.
[34:21.600 --> 34:23.920]  And it's a challenge, it's a matter of jurisdiction.
[34:23.920 --> 34:28.160]  He said, well, you can't file this, this case is closed.
[34:28.160 --> 34:30.560]  I said, well, sure, okay, I already did.
[34:30.560 --> 34:32.640]  Well, no, you have to file this to the clerk.

[35:07.880 --> 35:10.680]  He went in the back and about 10 minutes,
[35:10.680 --> 35:12.720]  this big tall guy come out.
[35:12.720 --> 35:16.720]  He had to be six foot six beanpole type guy,
[35:16.720 --> 35:20.320]  but he looked, he had an elegant look about it.
[35:20.320 --> 35:22.160]  And he walked out holding my complaint.
[35:22.160 --> 35:24.280]  He said, are you Mr. Kelton?
[35:24.280 --> 35:25.120]  Yes, sir, I am.
[35:25.120 --> 35:27.000]  Are you the elected district attorney?
[35:27.000 --> 35:28.600]  He said, yes, I am.
[35:28.600 --> 35:31.280]  I think his name was Dixon.
[35:31.280 --> 35:35.440]  And I said, well, tell me, what are you
[35:35.440 --> 35:38.160]  going to do with that complaint?
[35:38.160 --> 35:41.160]  And he looked at me and he said, Mr. Kelton,
[35:41.160 --> 35:45.080]  you strike me as a man on a mission.
[35:45.080 --> 35:49.760]  And I make it a point never to interfere with a man on a mission.
[35:49.760 --> 35:51.720]  I'll give this to the grand jury.

[36:21.000 --> 36:24.240]  Well, I don't necessarily want the judge indict it.
[36:24.240 --> 36:28.120]  I just want him to realize that he could be.
[36:28.120 --> 36:31.960]  And who here wants to play Russian roulette with their career?
[36:31.960 --> 36:36.680]  And the district attorney said, not me.

[50:07.240 --> 50:11.240]  and giving me a copy and I would have to drive to wherever that county is
[50:11.240 --> 50:14.240]  and go pick it up and they would charge me per page
[50:14.240 --> 50:19.240]  and I said no no no, you give it to me in the format that it came in
[50:19.240 --> 50:22.240]  It's a PDF, I want you to send it to me in a PDF

[01:01:00.240 --> 01:01:24.240]  In recent news, since Governor Greg Abbott signed House Bill 1325 legalizing hemp into taxes law back in June, county prosecutors around the state including Houston, Austin, and San Antonio have been dropping marijuana possession charges and even refusing to file new ones since they are stipulating that they do not have the time or the laboratory equipment to test the earth for THC.
[01:01:24.240 --> 01:01:33.240]  Margaret Moore, the Travis County District Attorney announced earlier this month that she was dismissing 32 felony possession and delivery of marijuana cases because of the law.
[01:01:33.240 --> 01:02:01.240]  Mr Abbott and other state officials including the Attorney General stipulated in a letter to county district attorneys back on Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works as well as other cities too like the district attorney in El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law quote will not have an effect on the prosecution of marijuana cases in El Paso.
[01:02:01.240 --> 01:02:13.240]  However, the issue was succinctly summarized by Mr Brandon Ball, an assistant public defender in Harris County who stated that quote, the law is constantly changing on what makes something illegal based on its chemical makeup.

[01:02:22.240 --> 01:02:39.240]  A paper by Tulane University identified a five and a half inch American pocket shark as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark ever captured or recorded with the other one being found way back in 1979 in the East Pacific Ocean.

[01:04:23.240 --> 01:04:32.240]  So I was pretty heavy into all this right from the first week when they announced the, you know, the lockdown, I started asking everywhere if you knew anybody was sick.
[01:04:32.240 --> 01:04:38.240]  I was down in Corpus Christi at that time. Nobody knew who I was sick. So within the first week, I knew this was pretty much fraudulent.
[01:04:38.240 --> 01:04:44.240]  And you guys put the pieces together over the weeks after that. And I think we talked about that in fact then.
[01:04:44.240 --> 01:04:57.240]  I also did another thing. I drove up into Illinois and started seeing some articles out from sheriffs in different counties across the country and they were basically saying, we're not going to enforce any of the governor's mandates.
[01:04:57.240 --> 01:05:08.240]  So I called a few of those just to see what they, what that meant where they were at with it. And then I even called the Illinois Sheriff's Association and they said, the governor has never even called us.
[01:05:08.240 --> 01:05:14.240]  I've never asked for our assistance to enforce anything. So I found that extremely interesting.
[01:05:14.240 --> 01:05:21.240]  So anyway, I've talked to several different sheriffs and a few different police from different states. And the gist of it is that there's nothing to enforce.
[01:05:21.240 --> 01:05:25.240]  That's why they won't show up for any mask calls.
[01:05:25.240 --> 01:05:32.240]  There's just no law. One police officer just straight up told me I even if somebody has nothing to enforce, I can't do anything about it.
[01:05:32.240 --> 01:05:45.240]  So there's no reason to answer or call. If somebody's in a public park and they're just dividing, I can ask them to leave, but they don't have to leave because there's no law saying they can't be there even under a mandate.
[01:05:45.240 --> 01:05:59.240]  So after I was armed with that ammunition, I started pushing back really hard on the mask and just refusing it everywhere, even going as far as I call the police on the post office for refusing to give me service for a package.
[01:05:59.240 --> 01:06:10.240]  Police showed up, educated them, said, you can't deny them service. If he says he can't wear a mask or doesn't want to wear a mask, there's guidelines that justify that position.
[01:06:10.240 --> 01:06:16.240]  So that post office back down and I've threatened it a few other times and usually they always back down.
[01:06:16.240 --> 01:06:28.240]  But now I'm into this new thing is that we have a big wall here. It's no longer police against people, which you guys have addressed a lot that or just confused officials against people.
[01:06:28.240 --> 01:06:38.240]  Now we have a new beast and it's the corporation thinking they can make up their own policies for the public and the private public and how they address them.
[01:06:38.240 --> 01:06:48.240]  And so they're trying to do no shirt, no shoes, no service, no mask, no service, trying to add that in. That's actually a slang in Colorado from the governor himself.
[01:06:48.240 --> 01:06:58.240]  And it's all over the place. You go into one grocery store and they don't do it. You go to another grocery store and they have somebody standing there like a security.
[01:06:58.240 --> 01:07:12.240]  So what I'm looking for is how to start without filing lawsuits, how to really start using the system against those people who are claiming that they're going to be fined $10,000 if they don't force me to do something against my will.
[01:07:12.240 --> 01:07:19.240]  And, you know, there's a lot of people who want to start to push back, but they're afraid. They don't know the police aren't going to show up.
[01:07:19.240 --> 01:07:28.240]  They just think the police might show up and that's what makes them afraid. I'm trying to tell people, no, I've called the police. They're not. They're on our side most of the time.
[01:07:28.240 --> 01:07:35.240]  And this particular matter. And I'm trying to look for some ways to use the system against the business system.
[01:07:35.240 --> 01:07:46.240]  So now we put the burden back on them to push it, you know, to start fighting the Public Health Department, who is now putting Public Health Department back in like they're the police now.
[01:07:46.240 --> 01:07:55.240]  So I'm a little confused how this all works. And then we have this thing called a mandate, which isn't a law, but they're trying to make it law.
[01:07:55.240 --> 01:08:00.240]  And they're hiding behind the guise of a national emergency. And that's not how this works. I'm pretty sure.
[01:08:00.240 --> 01:08:09.240]  So anyway, that's what I'm looking for. A little assistance on how to help people, help businesses start to put the pressure back upstairs instead of putting it on us.
[01:08:09.240 --> 01:08:17.240]  Right. I think that's a great angle to be addressing. It seems like it really needs to happen.
[01:08:17.240 --> 01:08:36.240]  The officials that have put out these mandates and executive orders, it seems like they have, for the most part, been careful to, in the way they say things, they address, here's what is required, but they require it of businesses.
[01:08:36.240 --> 01:08:49.240]  And they put the regulation on businesses. And then when they speak to we the people, they say things like should and guidelines and ought to and things like that.
[01:08:49.240 --> 01:08:57.240]  And then when they do step over the line and they word it too strongly, they go back and change that because we push on them.
[01:08:57.240 --> 01:09:12.240]  They go back and they amend their orders. But then what you're talking about now is they've put the law enforcement into the hands of store managers who don't know anything about that.
[01:09:12.240 --> 01:09:17.240]  They don't know how to draw the line between corporations and people.
[01:09:17.240 --> 01:09:22.240]  Scott, I was digging around for lawsuits that had been filed.
[01:09:22.240 --> 01:09:31.240]  Oh, I keep thinking everybody's Scott today. Chris. Okay, Chris.
[01:09:31.240 --> 01:09:43.240]  I've been spent some time looking for lawsuits on the shelter in place and the mask orders.
[01:09:43.240 --> 01:10:02.240]  I came across a spreadsheet that if you want, I will send it to you. It has 765 entries of lawsuits that have been filed on these subjects.
[01:10:02.240 --> 01:10:03.240]  Wow.
[01:10:03.240 --> 01:10:13.240]  The problem with it is, is it tells me the state, but it doesn't tell me essentially the subject matter. So I have to go through them.
[01:10:13.240 --> 01:10:25.240]  But what we can do with the spreadsheet is organize it by state and then go through and put the shelter in place or mask or what it is.
[01:10:25.240 --> 01:10:32.240]  And then we look through these lawsuits. They've already done the research for us.
[01:10:32.240 --> 01:10:44.240]  So, you know, I'm thinking how do I get a claim of harm to me for being ordered to wear a mask?
[01:10:44.240 --> 01:11:01.240]  Now, there's implication that a mask could possibly be detrimental to certain demographics, people with certain conditions, but I have no real evidence of that.
[01:11:01.240 --> 01:11:12.240]  I find it annoying. So that's not enough for me to be able to file and support a lawsuit.
[01:11:12.240 --> 01:11:22.240]  So I need to go through some of these court cases. I'm sure these guys have come up with ideas of how this infringes on my rights.
[01:11:22.240 --> 01:11:32.240]  One of the problems I had was that the governor cannot say to you, you must do this thing.
[01:11:32.240 --> 01:11:45.240]  So he says to these companies, you must make them do these things. And it seems like what the governors are trying to do is avoid responsibility.
[01:11:45.240 --> 01:11:57.240]  And I'm going to say if you have violated one of my constitutional rights, it doesn't matter if you violated that right through a third party.
[01:11:57.240 --> 01:12:03.240]  You still violated my rights. You are equally culpable.
[01:12:03.240 --> 01:12:27.240]  Like Brett referenced earlier, 7.02, culpability. If you assist, or what's the term, Brett, if you, not foment, but if you assist someone in the commission of an act that is a crime or a violation of a right, then you're equally culpable for the violation.
[01:12:27.240 --> 01:12:38.240]  So the governor is trying to sidestep his responsibility by going after licensed businesses and using his power under the license.
[01:12:38.240 --> 01:12:54.240]  But unless that power is specified under the license, and even if it is, if the exercise of the power has the effect of denying the citizen full pre-access to a joint right,
[01:12:54.240 --> 01:13:02.240]  that is not a power the legislature has the authority to convey to the governor.
[01:13:02.240 --> 01:13:17.240]  No matter what the legislature says, you know, they have statutes for emergencies that allow public officials to take action that normally would not be within the scope of their authority.
[01:13:17.240 --> 01:13:26.240]  Well, they can do that, but those actions have to be within the scope of law. The legislature cannot crime.
[01:13:26.240 --> 01:13:40.240]  Exactly. The legislature cannot authorize a public official to violate a constitutional right, period. The legislature has no such power.
[01:13:40.240 --> 01:13:48.240]  And if they want that power, they're going to have to get a constitutional amendment to give them that power until they do. They don't have it.
[01:13:48.240 --> 01:13:56.240]  So, Chris, if you would like that document to send me an email, and I will send it to you.
[01:13:56.240 --> 01:14:01.240]  Okay. There's, you know, Randy, there actually is a lot of evidence now out there.
[01:14:01.240 --> 01:14:07.240]  A lot of doctors have been silent talking about the mask, talking about the long-term effects of children wearing a mask for eight hours.
[01:14:07.240 --> 01:14:16.240]  They're not designed to be wearing eight hours a day. I mean, when you're standing some tabletop, you're standing it for an hour or two, and you stop doing it because you're sick of not being able to breathe.
[01:14:16.240 --> 01:14:24.240]  And so there's a lot of people that have the evidence out, even Fauci and the, you know, the Surgeon General in the beginning said masks are actually helpless.
[01:14:24.240 --> 01:14:30.240]  One of the heads of the East Coast in Canada, one of the head of the government official doctors said, yeah, don't wear it. It'll be harmful to your health.
[01:14:30.240 --> 01:14:32.240]  And now they all switch.
[01:14:32.240 --> 01:14:40.240]  So, they were all talking nonsense in the beginning, and now they're talking that it's actually, now they're talking it's a sign of respect and submission.
[01:14:40.240 --> 01:14:46.240]  So, if they're going to play that game, then fine. I want to play the game too, but I want to play it on a different set of rules.
[01:14:46.240 --> 01:14:52.240]  The thing about businesses, and this is where I think we have a slight advantage, is they're not government officials.
[01:14:52.240 --> 01:14:58.240]  They play a lot quicker. They respond a lot quicker, and they play by a little bit less different rules.
[01:14:58.240 --> 01:15:08.240]  They just don't know all those angles. But basically, when you call somebody's manager, or you call the head CEO, you can get to them pretty quickly.
[01:15:08.240 --> 01:15:14.240]  It's not like getting to a judge and having to find a number. It's pretty easy to get to a few levels higher in management.
[01:15:14.240 --> 01:15:19.240]  Once you get to those people, they want the problem to go away and they want to fix the problem.
[01:15:19.240 --> 01:15:28.240]  And that's what I've found, is that very quickly, this isn't like a week long, like literally within the same day, I get turn around, respond, they are moving.
[01:15:28.240 --> 01:15:35.240]  And so, what I want to do is be able to get something, I wanted to put some paper together. That's one of the things.
[01:15:35.240 --> 01:15:42.240]  Maybe you can direct me better if there's a better option. If the first employee in the first level, you know, I usually ignore them.
[01:15:42.240 --> 01:15:51.240]  And then I might have a manager come up and say something to me, and then that's the one I want to get the name, hand or a piece of paper, and say, OK, this is going to be the game from here and out.
[01:15:51.240 --> 01:15:57.240]  And it's going to go as far as a lawsuit. But just to let you know, this is going up the chain very fast.
[01:15:57.240 --> 01:16:05.240]  But I need to have some ammunition behind it that probably if it's hidden in those documents you're talking about that says, this is against the law.
[01:16:05.240 --> 01:16:11.240]  You don't even realize you're breaking the law by trying to do this. But they're always trying to hide behind what we're a private business.
[01:16:11.240 --> 01:16:20.240]  And so, I'm trying to flip the burden back on them, you know, just to quickly stop this. And it is happening.
[01:16:20.240 --> 01:16:27.240]  Like I told you, the Home Depots and the Walmart, they all stop based on not wanting their employees to get into fist fights with customers.
[01:16:27.240 --> 01:16:30.240]  So they don't spend any more money.
[01:16:30.240 --> 01:16:34.240]  Their greatest fear is being sued.
[01:16:34.240 --> 01:16:35.240]  OK.
[01:16:35.240 --> 01:16:47.240]  So what we need to do is give them plausible deniability. And the way we do that is to give them a good swift legal kick in the bushes.

[01:21:20.240 --> 01:21:24.240]  So basically they have a form in their pocket, because I am running into a lot of people every day

[01:21:28.240 --> 01:21:30.240]  Or I'll always ask them the question, okay, do you have a pandemic story?
[01:21:30.240 --> 01:21:37.240]  Just to get them to jolt their mind to go, you know what, we're five months in and I have never seen anything that can even justify a pandemic

[01:21:41.240 --> 01:21:48.240]  But when the people get into a little deeper conversation, I want to hand them something
[01:21:49.240 --> 01:21:54.240]  because I'm giving them documentaries and things to watch, but I have no idea how that turns out for them, you know
[01:21:54.240 --> 01:22:03.240]  So any state, Randy, I really want this to be widespread where we can start to put out a paper that starts the paper trail
[01:22:04.240 --> 01:22:12.240]  and what you cut off when you fell off the cliff was awesome is basically that you're acting under the guise of the governor as a business
[01:22:13.240 --> 01:22:14.240]  That is an amazing statement
[01:22:14.240 --> 01:22:24.240]  So, yeah, and it took a while, I'm trying to figure out how can I come up with a claim? It doesn't matter if it's a good claim
[01:22:25.240 --> 01:22:35.240]  It only has to be a claim, because these corporations, they are terrified of lawsuits, lawsuits cost them a fortune
[01:22:35.240 --> 01:22:50.240]  Lawsuits cost them bad publicity, so they avoid those like the plague, so I'm just looking for some claims that I can make
[01:22:51.240 --> 01:22:56.240]  and I will sort these by state and that way it will be easier for you to pick out
[01:22:56.240 --> 01:23:05.240]  The first one I read was about shelter in place and that one is easy to get constitutional violation
[01:23:06.240 --> 01:23:10.240]  Mask is not quite so easy, so I'm going to work on that
[01:23:11.240 --> 01:23:22.240]  I am what I'm putting together a process where I'm going after mortgages, I'm going to help people with mortgages
[01:23:22.240 --> 01:23:29.240]  I expect very soon we're going to have a tsunami of foreclosures
[01:23:30.240 --> 01:23:36.240]  and one of the tools I want to build is a lawsuit against the governor
[01:23:37.240 --> 01:23:42.240]  that you put these restrictions in place
[01:23:43.240 --> 01:23:50.240]  and those restrictions were an approximate cause to my inability to earn an income
[01:23:50.240 --> 01:23:57.240]  and those restrictions were in excess of your constitutional authority
[01:23:58.240 --> 01:24:06.240]  and then we filed against the governor and then we asked the court to order mediation
[01:24:07.240 --> 01:24:12.240]  and we look at a property, I got a property here, I paid $350,000 for this property
[01:24:13.240 --> 01:24:17.240]  and because of your garbage orders now I can't pay for it
[01:24:17.240 --> 01:24:25.240]  and since your orders were illegal then the claim against you should fall under punitive
[01:24:26.240 --> 01:24:40.240]  so I want a million fifty, $350,000, $369,000, $1,050,000 in harm to recoup me from my harm
[01:24:40.240 --> 01:24:46.240]  and sue them and then ask the court to order mediation and say okay let's make a deal
[01:24:47.240 --> 01:24:54.240]  how much are you going to pay out to lawyers to fight this suit
[01:24:55.240 --> 01:25:00.240]  I can keep you in court for at least five years easy on the suit itself
[01:25:00.240 --> 01:25:09.240]  the appeal and the petition for a cert that'll get you another two or three years easy
[01:25:10.240 --> 01:25:17.240]  so make me a deal, write me a check for $50,000 and I'll write you out of my suit
[01:25:18.240 --> 01:25:22.240]  and go on with all the other guys I'm going after, that's what I'm looking for
[01:25:23.240 --> 01:25:28.240]  if the governor starts getting one lawsuit after the other after the other after the other after the other
[01:25:28.240 --> 01:25:32.240]  that's how we get this changed
[01:25:33.240 --> 01:25:37.240]  give me the day it's all about the money
[01:25:38.240 --> 01:25:46.240]  is there a way to obviously point two pistols at once so obviously I'm going to spread this through the corporation
[01:25:47.240 --> 01:25:51.240]  but also assist them or hint that they need to sue the governor
[01:25:51.240 --> 01:25:57.240]  oh yes well they can't sue the governor until they've been harmed
[01:25:58.240 --> 01:26:02.240]  once that Walgreens gets popped for $10,000 they can
[01:26:03.240 --> 01:26:11.240]  now they're harmed now they can go to the governor or if they can show a decreasing business
[01:26:12.240 --> 01:26:17.240]  that's enough but most of these guys are not going to want to sue the government
[01:26:17.240 --> 01:26:23.240]  because the government holds the string to their license
[01:26:24.240 --> 01:26:26.240]  and they're not going to want the government mad at them
[01:26:27.240 --> 01:26:33.240]  and they're not going to do anything until you become more dangerous to them than the government is
[01:26:34.240 --> 01:26:39.240]  now they have plausible liability and what you said earlier was exactly right
[01:26:40.240 --> 01:26:44.240]  you sue the governor and you sue the entity
[01:26:44.240 --> 01:26:52.240]  and you tell the entity you know this harm was inflicted on me through you
[01:26:53.240 --> 01:26:57.240]  and I understand that you were in a difficult position
[01:26:58.240 --> 01:27:07.240]  so what I'm going to suggest to you is you sue the governor for any loss anything you will have to give me
[01:27:07.240 --> 01:27:13.240]  so you get yours back
[01:27:14.240 --> 01:27:18.240]  get them on your side we in foreclosure issues I do this
[01:27:19.240 --> 01:27:24.240]  where say a guy has bought a property on contract
[01:27:25.240 --> 01:27:27.240]  or took over another guy's mortgage
[01:27:28.240 --> 01:27:31.240]  or he's got a second mortgage
[01:27:32.240 --> 01:27:34.240]  he's got a second lien on the property
[01:27:34.240 --> 01:27:36.240]  and we sue him
[01:27:37.240 --> 01:27:42.240]  we sue the bank for fraud and we sue him as well for acting in concert inclusion
[01:27:43.240 --> 01:27:49.240]  and then go to him and say you know if you pay me a hundred bucks I'll drop my claim against you
[01:27:50.240 --> 01:27:51.240]  if you sue the bank as well
[01:27:52.240 --> 01:27:54.240]  and you get him to come in on your side
[01:27:55.240 --> 01:27:57.240]  and then we force the bank into writing us a deal
[01:27:58.240 --> 01:28:02.240]  the end of the day is all about the money when they start to have to pay out money
[01:28:02.240 --> 01:28:05.240]  that's when they get their act straight

[01:29:11.240 --> 01:29:18.240]  the angle here is to get the big corporations to start realizing that they shouldn't mess with the consumer

[01:29:22.240 --> 01:29:24.240]  but the little guys who will bark and that's fine
[01:29:25.240 --> 01:29:29.240]  I don't want to hurt them bad, what I want to do is let them know that I'm going to bark as hard or worse

[01:34:48.240 --> 01:34:57.240]  Okay, so the one story I heard just recently, I was actually speaking to my all safe claims representative for some damage
[01:34:58.240 --> 01:35:01.240]  I was stuck in Cedar Rapids through that hurricane forest. It was crazy.
[01:35:02.240 --> 01:35:06.240]  And we got talking for almost two hours.
[01:35:07.240 --> 01:35:15.240]  So, he told me about a friend of his that owns a bowling alley in Barr in Lincoln, Nebraska
[01:35:15.240 --> 01:35:24.240]  and his friend refused to enforce the mask and they shut him down, both business.
[01:35:25.240 --> 01:35:34.240]  And so, he fought us, he went to court and what the judge said is that I'm not going to rule on it because
[01:35:35.240 --> 01:35:40.240]  the Peace of the House Department, he was talking to the Health Department, you already have the authority.
[01:35:40.240 --> 01:35:44.240]  So, I have no reason to get involved, basically.
[01:35:45.240 --> 01:35:56.240]  So, what he said is because, and I don't know if this is law or how it works or the rules, what he used as a thing to hide behind
[01:35:57.240 --> 01:36:04.240]  is that it's kind of like if you go eat at a restaurant and they have food that's painted with some kind of deadly bacteria.
[01:36:04.240 --> 01:36:09.240]  They have the right to come in and shut down the business and that makes a lot of sense.
[01:36:10.240 --> 01:36:19.240]  But that, in my mind, only after they've proved that that's there or they've got a justification or relative testing that it's actually there.
[01:36:20.240 --> 01:36:23.240]  How can they use that when nobody's complained about getting sick?
[01:36:24.240 --> 01:36:29.240]  They don't even have an actual purified form of the virus to test that it's in that facility.
[01:36:29.240 --> 01:36:34.240]  And so, the judge, in my opinion, is highly misplying that law or that rule.
[01:36:36.240 --> 01:36:38.240]  That's the way I would read it.
[01:36:39.240 --> 01:36:43.240]  The building codes are generally pretty specific.
[01:36:44.240 --> 01:36:54.240]  If someone calls the Health Department and tells them that a particular store is infested with cockroaches,
[01:36:54.240 --> 01:37:01.240]  they can't shut that place down unless they go there and personally observe an infestation of cockroaches.
[01:37:02.240 --> 01:37:03.240]  Right.
[01:37:04.240 --> 01:37:09.240]  So, in order to declare a business a public hazard or a public nuisance,
[01:37:10.240 --> 01:37:15.240]  they would have to have evidence that it is, in fact, a public nuisance.
[01:37:15.240 --> 01:37:23.240]  The fact that someone is not wearing a mask, this is one of the information requests I'm preparing for the governor.
[01:37:24.240 --> 01:37:43.240]  I want to see the science, the evidence that the governor relied on in making a determination that wearing a mask was a viable method of avoiding contracting coronavirus.
[01:37:43.240 --> 01:37:46.240]  I want to see the math. I'm going to see the science.
[01:37:47.240 --> 01:37:49.240]  And he won't be not righted.
[01:37:50.240 --> 01:37:53.240]  Yeah, we can have all the suppositions we want to.
[01:37:54.240 --> 01:38:05.240]  But before he, the governor, issues a ruling that affects my ability to make a living and affects my rights.
[01:38:05.240 --> 01:38:15.240]  The first thing he's going to have to have is some good hard science showing that this ruling he's making is reasonable.

[01:38:18.240 --> 01:38:20.240]  There's four conditions it has to meet.
[01:38:20.240 --> 01:38:36.240]  And one that is reasonable that really will affect the intent of the ruling and there's two more that is required to meet a constitutional challenge.
[01:38:37.240 --> 01:38:43.240]  I want to see the science, not speculation.
[01:38:44.240 --> 01:38:47.240]  And I don't want to see any anecdotal evidence.
[01:38:47.240 --> 01:38:49.240]  I want to see science.
[01:38:50.240 --> 01:38:59.240]  That's what Fauci said when the president said that hydroxychloroquine will protect you from coronavirus.
[01:39:00.240 --> 01:39:02.240]  Oh, that's just anecdotal evidence.
[01:39:05.240 --> 01:39:10.240]  Yeah, if I point a gun at you and pull the trigger, it will hurt you.
[01:39:11.240 --> 01:39:13.240]  Oh, that's just anecdotal evidence.
[01:39:13.240 --> 01:39:22.240]  Until I bring in evidence of people pointing a gun at me, at other people and pulling the trigger and showing that they were injured by that act.
[01:39:23.240 --> 01:39:24.240]  That's not anecdotal evidence of science.
[01:39:25.240 --> 01:39:26.240]  We don't have any science.
[01:39:27.240 --> 01:39:29.240]  I know the science is out there.
[01:39:30.240 --> 01:39:31.240]  But I'm not finding it.
[01:39:32.240 --> 01:39:33.240]  I'm not hearing it.
[01:39:34.240 --> 01:39:35.240]  All I'm hearing is anecdotal.
[01:39:36.240 --> 01:39:38.240]  Oh my goodness, the sky's falling in.
[01:39:39.240 --> 01:39:40.240]  We're all going to die.
[01:39:40.240 --> 01:39:45.240]  If you don't stand on your head and squawk like a chicken, we're all going to die.
[01:39:46.240 --> 01:39:53.240]  As far as I can tell about the mask, standing on your head and squawking like a chicken is just as effective.

[01:39:58.240 --> 01:40:06.240]  So in the beginning, I think they're allowed to play this game under the willingness, again, a complete willingness to participation amongst the citizens.

[01:40:30.240 --> 01:40:39.240]  So how are they, you know, they got to be breaking the law in so many ways right there by backing into something that doesn't even exist and they have no verification that exists.

[01:52:38.240 --> 01:52:47.240]  And I think we have to, in fact, one of them was talking to me today about going after the judge here on really not having standing.

[01:52:49.240 --> 01:52:54.240]  He said, I don't even let the other side know because everything was void anyway.
[01:52:54.240 --> 01:52:56.240]  So if it's void, there's nothing there.
[01:52:56.240 --> 01:53:04.240]  So you go after the judges and you keep going after them like you all have been saying pretty soon, somebody's going to capitulate.
