[01:14.360 --> 01:18.920]  San Antonio, have been dropping marijuana possession charges and even refusing to file new ones
[01:18.920 --> 01:22.920]  since they are stipulating that they do not have the time or the laboratory equipment to
[01:22.920 --> 01:24.880]  test the herb for THC.
[01:24.880 --> 01:28.520]  Margaret Moore, the Travis County District Attorney, announced earlier this month that
[01:28.520 --> 01:33.080]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.080 --> 01:34.080]  law.
[01:34.080 --> 01:37.680]  Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter
[01:37.680 --> 01:42.200]  to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:42.200 --> 01:48.360]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as
[01:48.360 --> 01:54.600]  well as other cities, too, like the District Attorney in El Paso, Cayman Esparza, a Democrat
[01:54.600 --> 01:59.080]  who also stated earlier this month that the law, quote, will not have an effect on the
[01:59.080 --> 02:01.800]  prosecution of marijuana cases in El Paso.
[02:01.800 --> 02:06.840]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.840 --> 02:10.840]  in Harris County, who stated that, quote, the law is constantly changing on what makes
[02:10.840 --> 02:13.560]  something illegal based on its chemical makeup.
[02:13.560 --> 02:17.480]  It's important that if someone is charged with something, the test matches what they're
[02:17.480 --> 02:22.680]  charged with.
[02:22.680 --> 02:27.720]  A paper by Tulane University identified a five and a half inch American pocket shark as the
[02:27.720 --> 02:32.800]  first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark
[02:32.800 --> 02:38.440]  ever captured or recorded with the other one being found way back in 1979 in the East Pacific
[02:38.440 --> 02:39.440]  Ocean.
[02:39.440 --> 02:43.840]  According to the university paper, the shark secretes a luminous fluid from a gland near
[02:43.840 --> 02:50.840]  its front fins for the purpose it is hypothesized to lure and prey may be drawn into the glow.

[03:45.840 --> 03:51.320]  You were mentioning that maybe he should file a tort letter since he's got the motion to
[03:51.320 --> 03:56.080]  dismiss for no jurisdiction, and he ignored it and went ahead and proceeded anyway, followed
[03:56.080 --> 03:57.080]  tort letter.
[03:57.080 --> 03:59.680]  What about a dollar amount?
[03:59.680 --> 04:01.180]  Right question.
[04:01.180 --> 04:05.040]  I didn't get that in before the break.
[04:05.040 --> 04:14.480]  What I left out of there is I have been harmed in this amount to make me wholly be sued.
[04:14.480 --> 04:25.880]  Now the judge and prosecutors think they have absolute immunity, and they do, except in
[04:25.880 --> 04:32.960]  the singular instance where they do not have subject matter jurisdiction.
[04:32.960 --> 04:42.080]  The prosecutor asserted to the judge that subject matter jurisdiction was not appropriate
[04:42.080 --> 04:44.200]  to be heard at this time.
[04:44.200 --> 04:45.200]  Crazy.
[04:45.200 --> 04:53.480]  Well, bubba, listen to how that works out for you, because absolutely subject matter
[04:53.480 --> 04:57.000]  jurisdiction is threshold.
[04:57.000 --> 05:03.400]  You can't get to anything else until you have passed subject matter jurisdiction.
[05:03.400 --> 05:14.560]  When an accusation is made, subject matter jurisdiction is presumed until and unless

[05:17.240 --> 05:24.600]  Once challenged, subject matter jurisdiction is no longer presumed and therefore is lost,
[05:24.600 --> 05:34.480]  and subject matter jurisdiction is not regained until the judge proves up subject matter jurisdiction.
[05:34.480 --> 05:40.680]  For the prosecutor to tell the judge that it wasn't appropriate at this time should
[05:40.680 --> 05:43.200]  get a massive bar grievance.
[05:43.200 --> 05:52.080]  Both the judge and the prosecutor should get a tort letter, notifying them that you have
[05:52.080 --> 05:55.800]  been harmed and how much you've been harmed by.
[05:55.800 --> 06:01.440]  And maybe the judge should have a judicial conduct complaint for not calling the lawyer
[06:01.440 --> 06:05.240]  on that ridiculous assertion.
[06:05.240 --> 06:12.240]  Absolutely the judge had to know, even if the judge didn't know, the judge was responsible
[06:12.240 --> 06:23.600]  for knowing that once it's challenged, it's lost, and once it's lost, there is zero immunity.

[07:04.400 --> 07:10.040]  And you're going to argue that it's not outrageous, it's not unwarranted, blah, blah, blah.
[07:10.040 --> 07:15.680]  Well, a jury's going to sit there and they're going to hear both of these sides, but when
[07:15.680 --> 07:24.320]  they go into the jury room to decide who gets what, there's only one number they're going
[07:24.320 --> 07:30.640]  to remember, and that's the number you walked in the door with.
[07:30.640 --> 07:38.200]  And for the most part, everything they do will be based on what that number was.

[07:40.480 --> 07:42.760]  It should be cut in half.

[09:04.480 --> 09:15.040]  And you have a constitutional, I'm sorry, that's not really correct, a statutory right
[09:15.040 --> 09:19.320]  to an expectation of good faith and fair dealings.

[09:20.320 --> 09:26.800]  I'm not sure if we have a statutory right, but we certainly have a right that is established
[09:26.800 --> 09:36.040]  by the case law, that we have a right to a reasonable expectation of good faith and fair
[09:36.040 --> 09:39.840]  dealing from our public officials.
[09:39.840 --> 09:50.520]  A failure to provide good faith and fair dealing while acting with no subject matter jurisdiction
[09:50.520 --> 09:57.040]  leaves them vulnerable to a direct lawsuit, even the judge.
[09:57.040 --> 10:04.320]  And regardless of what happens, the judge is not going to be happy with a certain lawyer
[10:04.320 --> 10:08.800]  who told him that he and I have to hear this at this time.
[10:08.800 --> 10:11.400]  The best way to do it is...
[10:11.400 --> 10:16.000]  But he did use the fancy word juncture, so it probably is...
[10:16.000 --> 10:18.600]  Yeah, that could be believable, right?
[10:18.600 --> 10:23.160]  He didn't just say at this time, he said at this juncture, I mean, listen to how learned

[10:24.560 --> 10:35.560]  Yes, if you're absolutely brain dead, juncture might sound impressive, but I can't imagine
[10:35.560 --> 10:44.960]  any judge who's not aware that he can't act unless he has power to act.

[10:47.840 --> 10:55.760]  So the judge will be caught and it will be the lawyer who got him caught.
[10:55.760 --> 11:02.240]  And these judges, they're terrified that they're going to do something wrong and retribution

[11:05.680 --> 11:14.760]  So when you go right for their throats, this is a mark that will go on his record forever.
[11:14.760 --> 11:21.240]  The only way I've ever heard of of getting rid of federal judge is bond canceled.
[11:21.240 --> 11:26.080]  And you do that by getting enough judicial conduct complaints filed against him.
[11:26.080 --> 11:29.040]  Okay, maybe that's cheating.
[11:29.040 --> 11:33.080]  Heck, it might even be unfair.
[11:33.080 --> 11:40.040]  I had a lawyer tell me once this problem with the state bar, not caring if the bar grievance
[11:40.040 --> 11:44.840]  was valid or not, is patently unfair.
[11:44.840 --> 11:48.920]  And I stood there and grinned at him and said, yeah, it is, isn't it?
[11:48.920 --> 11:53.960]  And he looked at me and he said, oh, I shouldn't have told you that.
[11:53.960 --> 11:56.120]  And I said, you are right.

[12:02.400 --> 12:07.040]  It's unfair that our public officials don't follow our law, that they take advantage
[12:07.040 --> 12:12.640]  of their position and violate our rights for administrative convenience and adjudicative

[12:15.640 --> 12:20.920]  If we're going to beat this system, if we're going to get this system back under control,
[12:20.920 --> 12:26.520]  we have to use the tools we have available and most of them are not legal tools.
[12:26.520 --> 12:35.680]  Most of them are procedural tools, bar grievances, civil suits, procedural tools we get to use
[12:35.680 --> 12:38.680]  against these guys.
[12:38.680 --> 12:50.480]  And Josh, I'd like to do a mock court on a federal suit, 42 U.S. Code 1983 suit against
[12:50.480 --> 12:53.760]  the judge for lack of subject manager jurisdiction.
[12:53.760 --> 12:55.760]  That should be interesting.
[12:55.760 --> 13:01.720]  Well, I'm in for a penny, in for a pound, so to speak, so yeah, absolutely, anything
[13:01.720 --> 13:02.720]  you need.

[13:17.040 --> 13:26.680]  And everything that occurs that appears improper or in any way wrongful, mark it in the timeline,
[13:26.680 --> 13:33.920]  because what I'm going to want to do is go over these, we want to find the tricks and
[13:33.920 --> 13:37.000]  the traps that they use.
[13:37.000 --> 13:41.440]  So far, I only find about half a dozen things they do.
[13:41.440 --> 13:46.920]  For the most part, a judge will refuse to rule on your issues.
[13:46.920 --> 13:50.800]  Well, I've got a remedy for that.
[13:50.800 --> 13:56.680]  If I file a motion or a pleading with the court, and there is an issue in the pleading
[13:56.680 --> 14:04.760]  that the judge did not rule on, I'm going to charge him with official oppression for
[14:04.760 --> 14:10.240]  denying me the right to petition the court for redress of grievance.
[14:10.240 --> 14:16.520]  And let him explain to a grand jury why he doesn't have to rule on all of my issues.
[14:16.520 --> 14:19.200]  Okay, maybe they're ruling his favor.
[14:19.200 --> 14:26.640]  But he's going to have to, because the system I'm building will create the lawsuit as a
[14:26.640 --> 14:30.040]  matter of course.
[14:30.040 --> 14:32.360]  You just answer the questions.
[14:32.360 --> 14:38.080]  The system will produce the judicial conduct complaint, bar grievance, professional conduct
[14:38.080 --> 14:44.120]  complaint for police officers, criminal charges against anyone or all of them, and the lawsuit,
[14:44.120 --> 14:50.200]  tort letter, everything they need, all they've got to do is sign and send.

[36:06.000 --> 36:18.880]  there and my stomach was just like energized and so I started thinking and so what I'm
[36:18.880 --> 36:24.200]  trying to explain here is she was setting it up, she was going to say all those pro
[36:24.200 --> 36:29.960]  se, they don't understand procedure, if he was a lawyer he would have known I was just
[36:29.960 --> 36:39.480]  continuing the next case management conference to December, you see but she straight up lied.
[36:39.480 --> 36:45.880]  Randy to answer your question to the point though, it's from all my time in the court
[36:45.880 --> 36:48.960]  and knowing about procedures.
[36:48.960 --> 37:04.480]  Exactly, so Ted, how do we capture your experience so that we look at a set of facts from someone
[37:04.480 --> 37:14.720]  else and we say hey, hey, hey, right here you need to watch out, it's been my experience

[37:21.200 --> 37:27.960]  What I'm trying to get across here is we have guys like you and Josh and Jeff who have been
[37:27.960 --> 37:34.800]  in these trenches, who have had these experiences and what I want to do is let's figure out

[38:22.800 --> 38:29.680]  The law, it's complicated enough but we can see it, we can look at it, it's hard, we can
[38:29.680 --> 38:36.080]  go back to it and study it but what we can't do is study the tricks and traps and the dirty
[38:36.080 --> 38:41.520]  rotten low down garbage they pull on you.
[38:41.520 --> 38:54.480]  So guys like you who have been in the trenches, I'm trying to build a tool that will ask questions.
[38:54.480 --> 39:03.600]  So effectively you're wanting to put in store and document what their sneaky tricks are
[39:03.600 --> 39:05.840]  that they refuse to document.
[39:05.840 --> 39:09.640]  They only tell each other about these things verbally and oh well yeah, you want to get
[39:09.640 --> 39:15.840]  rid of him, you need to just say that you're going to continue, just do like this, that

[39:24.160 --> 39:29.720]  The first guy I helped with the foreclosure issues was Steve Skinner.
[39:29.720 --> 39:35.480]  He came to me two days before an eviction hearing and we got that stopped.
[39:35.480 --> 39:41.760]  Seven years later they beat him on a procedural issue.
[39:41.760 --> 39:50.800]  He had, it was something he had asked for and they got him to waive that and he didn't
[39:50.800 --> 39:57.240]  realize that if he waived that it would cause a different problem that cost him the whole
[39:57.240 --> 39:59.440]  case.
[39:59.440 --> 40:06.560]  Now I can talk to Steve and he can set up that circumstance and he can set up a set
[40:06.560 --> 40:15.440]  of questions or he can look at a situation and say okay, when you start down this road
[40:15.440 --> 40:21.560]  and get to this point, now you're vulnerable, they're likely to ask you to do this, whatever
[40:21.560 --> 40:25.600]  you do, don't do that, do this other.
[40:25.600 --> 40:32.040]  Tricks and traps, there aren't that many of them.
[40:32.040 --> 40:41.040]  If we can all accumulate our experience, the law is not the problem, people can study the
[40:41.040 --> 40:46.520]  law and follow that down, but what is the problem is what do you do when a judge ignores
[40:46.520 --> 40:47.520]  the law?
[40:47.520 --> 40:53.240]  When the law says this and the judge does that, what do you do?
[40:53.240 --> 40:56.960]  Well you prepare a criminal charge against him and charge him for misfishing misconduct
[40:56.960 --> 41:01.840]  for failing to properly apply the law to the facts.
[41:01.840 --> 41:05.560]  That's a remedy that we have and there are a lot of those.
[41:05.560 --> 41:14.840]  I say there's a lot, there really aren't many categories of tricks and traps.
[41:14.840 --> 41:24.560]  There are a number of variations on the tricks and traps, but once you recognize the character
[41:24.560 --> 41:32.200]  of what they're doing, it's easier to figure out when they're trying to lead you down the
[41:32.200 --> 41:39.720]  garden path, I have a book on language and the use and misuse of language and they talk
[41:39.720 --> 41:48.040]  about red herrings and strawman issues and please to the gallery, please to all kinds
[41:48.040 --> 41:55.920]  of different linguistic maneuvers.

[42:03.440 --> 42:12.120]  If you can't define it, there are a set of steps that a person takes when he's using
[42:12.120 --> 42:20.120]  a strawman issue and you can recognize the steps, but if you don't have a name for it,
[42:20.120 --> 42:24.600]  then it's hard to recognize it in the heat of the moment.
[42:24.600 --> 42:32.520]  I was watching a debate several years ago from political debate and it was about parody
[42:32.520 --> 42:42.600]  for farmers and someone asked this governor, this legislator a question and he said, oh,
[42:42.600 --> 42:47.720]  oh, oh, that's a red herring, what?
[42:47.720 --> 42:53.520]  I know what a red herring is, but I didn't catch it.
[42:53.520 --> 43:01.680]  I didn't have my definition of a red herring well enough structured in my mind so that
[43:01.680 --> 43:07.360]  when this guy walks through the steps of a red herring, my spidey sense didn't go off
[43:07.360 --> 43:11.720]  and say, he's using this tool.
[43:11.720 --> 43:19.360]  The red herring is where you, everybody knows what it is, is where you amplify an irrelevant
[43:19.360 --> 43:25.600]  issue and lead the person or group off topic.
[43:25.600 --> 43:34.600]  A strawman issue is where you exaggerate a minor point and then attack the exaggeration.
[43:34.600 --> 43:40.680]  Once you understand how a strawman issue works, somebody tries to use one, you'll catch them
[43:40.680 --> 43:49.200]  every time, so what we want to do is define these techniques they use, give them names
[43:49.200 --> 43:50.520]  so we can interrupt them.

[49:13.040 --> 49:20.880]  at my wife and licked his lips, all three of those would cause a response in me that
[49:20.880 --> 49:25.720]  a normal speaker of the language would call mad.
[49:25.720 --> 49:37.440]  So let's see if we can look at what these public officials are doing and define terms
[49:37.440 --> 49:46.480]  to describe a set of behaviors so that we can say to people, okay, when the prosecutor
[49:46.480 --> 49:54.920]  acts this way, it's this over here, so when you're in court and your inner mind starts
[49:54.920 --> 50:05.400]  detecting these pieces of this description, then boom, a light comes on inside, now you're
[50:05.400 --> 50:18.880]  able to step out of your standard responses and look at this from a more structured perspective.
[50:18.880 --> 50:26.160]  This guy's being angry, instead of responding with anger, you respond with, why is this

[01:06:35.240 --> 01:06:42.440]  If the other side makes a statement of law and they don't cite statute chapter and verse,
[01:06:42.440 --> 01:06:50.440]  big time red flags should come up, an objection, prosecutors making statements of law out of
[01:06:50.440 --> 01:06:56.160]  their own mouth, ask them for the law to support what they're saying, or they're making it

[01:08:57.080 --> 01:09:07.200]  Well, I have been in court and watched a county lawyer, for example, come in to oppose letting
[01:09:07.200 --> 01:09:16.280]  a prisoner out that was pre-trial for his father's funeral, and he just came in and
[01:09:16.280 --> 01:09:28.600]  he gave it statue, bang, bang, bang, and I said, I want to learn what that guy has.

[01:09:32.880 --> 01:09:40.840]  So I've seen both, and let's face it, I mean, most of the time these lawyers are BSing,

[01:11:43.800 --> 01:11:47.880]  He said darn right, I like this guy.
[01:11:47.880 --> 01:11:53.560]  So he got his boss to come out and I give the complaints to his boss and he looks at

[01:13:00.680 --> 01:13:05.960]  Well, that wasn't what he expected to hear so I'm picking up the papers and he said,

[01:13:07.960 --> 01:13:13.880]  So I took them over to the clerk and I said, ma'am, do you have an attorney who's literate?

[01:40:49.560 --> 01:41:02.040]  was dismissed. I was dismissed in the interest of justice. And the woman on the other side said,
