[01:37.080 --> 01:42.120]  in a letter to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:42.120 --> 01:48.360]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works as well
[01:48.360 --> 01:54.920]  as other cities too like the district attorney in El Paso, Kyma Esparza a Democrat who also
[01:54.920 --> 01:59.640]  stated earlier this month that the law quote will not have an effect on the prosecution
[01:59.640 --> 02:05.080]  of marijuana cases in El Paso. However the issue was succinctly summarized by Mr. Brandon Ball

[05:17.080 --> 05:26.280]  biggie. Okay I have a question. Josh why did you file a petition for rid of mandamus with
[05:26.280 --> 05:33.160]  the higher court? Why did you not just file an appeal? I mean I guess you couldn't have
[05:33.160 --> 05:38.680]  filed an appeal because are you saying the district court or the lower court had not
[05:38.680 --> 05:45.960]  made a ruling yet and you were just trying to move the case along? Yeah for a couple of reasons
[05:45.960 --> 05:54.040]  I agreed with Randy's ideas on it because this area has a history and they've done it to me
[05:54.040 --> 06:00.840]  where I beat them up with paperwork and then they just ignore it and it sits on my record

[06:31.720 --> 06:37.960]  stupid I tried to get ahead of it with the mandamus to put pressure on them and it obviously put
[06:37.960 --> 06:43.800]  pressure on them because the judge who wrote the order for the continuance recused themselves
[06:43.800 --> 06:48.440]  so I mean I got their attention they definitely don't want to deal with me but I'm looking for the
[06:48.440 --> 06:57.480]  next step and okay Debra you need to understand Josh was charged with DUI because he felt like he
[06:58.040 --> 07:00.520]  wasn't fit to drive so he went to sleep in his car
[07:00.520 --> 07:12.360]  and they woke him up and charged him with DUI. He was parked asleep and like anyway got it.
[07:12.360 --> 07:19.160]  Yeah so it was an outrageous case and they they've tried to pursue it anyway and they
[07:19.160 --> 07:24.360]  wound up with someone who would fight them back and now they're kind of stuck. Okay well I have a
[07:24.360 --> 07:33.880]  question was I've seen this kind of thing in Texas too where certain municipalities pass
[07:33.880 --> 07:43.080]  ordinances that you can't sleep in your car and stuff like that and so one question I have is
[07:43.720 --> 07:52.120]  was this a city ordinance violation charge or was this a charge that you violated the state
[07:52.120 --> 07:57.320]  penal code or the state transportation code or something like that. It was a transportation
[07:57.320 --> 08:03.080]  code offense. Okay so this is in state statute of Pennsylvania that you can't sleep in your car.
[08:03.800 --> 08:15.720]  No they charged him with DUI. He was while intoxicated. Yeah well he didn't feel comfortable
[08:15.720 --> 08:22.360]  driving so he got in the car didn't have a key and ignition went to sleep to sleep it off which
[08:22.360 --> 08:27.880]  was responsible. Yes okay that's responsible. So they charged him for DUI for doing what was
[08:27.880 --> 08:33.320]  responsible. It all gets down to if you're going to argue the merits of the case actual physical
[08:33.320 --> 08:38.760]  control and according to the Supreme Court they've already ruled on cases like mine in my favor.
[08:38.760 --> 08:44.280]  It's known case law it's been up and down the Supreme Court multiple times and refined that
[08:44.280 --> 08:51.640]  the totality of the circumstances I clearly fit in it's not guilty it doesn't apply.
[08:52.280 --> 08:56.200]  So now they're trying to do some song and dance and tried to wear him down.
[08:56.200 --> 09:03.000]  Okay but wait without getting into the merits of the case we're talking about procedure here

[09:32.120 --> 09:41.400]  habeas corpus hey you just got to sit there and wait for your trial and after the trial if you
[09:41.400 --> 09:48.520]  want to appeal well you may you may sit in jail for a while waiting on your appeal and and to
[09:49.720 --> 09:55.240]  let me finish. You're missing something. No I'm not I'm talking about procedure to file a petition
[09:55.240 --> 10:05.400]  for mandamus just because you want to move along the case of your defense. He filed a habeas I mean
[10:05.400 --> 10:12.120]  a subject matter jurisdiction challenge. Okay okay well then I didn't get that I thought he I
[10:12.120 --> 10:18.040]  thought Josh was saying that he filed a petition for writ of mandamus because he was trying to move
[10:18.040 --> 10:24.600]  his defense along. No he he filed that because they would not rule on his subject matter jurisdiction
[10:24.600 --> 10:33.080]  challenge. Too bad. Do you have to wait for them to rule? No subject matter jurisdiction is is is
[10:33.080 --> 10:39.240]  of course the term. It's a pressure issue. It's a threshold. If he gets a ruling in his favor the
[10:39.240 --> 10:47.400]  case is gone and that makes it right for mandamus. Okay well then then if you're going to go there
[10:47.400 --> 10:53.720]  Randy whatever state or in the feds you better have the case law on your side to back up your
[10:53.720 --> 11:01.640]  mandamus for a specific time frame that if the lower court does not rule on your petition for
[11:02.200 --> 11:10.120]  habeas within a certain length of time because I know mandamus but because the subject matter
[11:10.120 --> 11:17.240]  jurisdiction is connected to the mandamus it's kind of falls under the habeas. Okay if there's
[11:17.240 --> 11:24.440]  passive case law on this when a subject matter jurisdiction challenge is filed the court loses
[11:24.440 --> 11:30.440]  jurisdiction until they prove it. Okay well then what's the time frame? What's the time frame?
[11:30.440 --> 11:38.360]  They cannot. Time frame is an issue. What's the time frame? The time frame let me explain time frame
[11:38.360 --> 11:45.720]  once the subject matter jurisdiction motion is filed challenge is filed the court can do nothing
[11:45.720 --> 11:53.240]  else until it proves jurisdiction. The court's time to move along and ignore that. It has no
[11:53.240 --> 11:59.880]  jurisdiction to do anything until it proves up jurisdiction and he's saying he's asking the court
[11:59.880 --> 12:08.760]  to order them to prove jurisdiction so that they have standing to move ahead. Did the court move
[12:08.760 --> 12:20.200]  ahead after his challenge without responding to his challenge? My challenge when there's a 30-day
[12:20.200 --> 12:24.520]  window for I get what they call those they're like pre-trial motions that you have to get in
[12:24.520 --> 12:31.240]  there's a window for those and I got that in right away after my argument and then they just started
[12:31.240 --> 12:37.080]  setting calendar dates I show up to them and they were like conferences you know like status
[12:37.080 --> 12:41.480]  conference I'd show up to them they're trying to get me to take a deal then the last one was a
[12:41.480 --> 12:50.360]  pre-trial conference and that's when they gave me this sweetheart deal and I was blindsided by it
[12:50.360 --> 12:56.120]  I honestly had to think about it so instead of giving me a continuance for a week they kicked
[12:56.120 --> 13:02.760]  it three months and I'm still not even there yet but since the mandamus the judge recused
[13:02.760 --> 13:12.360]  himself and now I don't have a court date at all I just really think they have a way of once you
[13:12.360 --> 13:18.600]  get a box into a corner they just ignore you listen listen listen you're saying that they
[13:18.600 --> 13:26.600]  basically they're just ignoring the situation but they are the ones that brought the case against
[13:26.600 --> 13:35.880]  you correct okay you know what just just let it let it right okay they they have a little fun in
[13:35.880 --> 13:42.200]  the meantime yeah well of course have a little fun but remember they've got a statute of limitations
[13:42.200 --> 13:51.160]  and it you know that I have seen cases dismissed for what's called wants of prosecution and that
[13:51.160 --> 13:59.960]  applies to civil as well it's like let them let them wallow and the time frame runs out
[13:59.960 --> 14:06.840]  well then you just walk away I mean don't there's no need to you know go to the higher
[14:06.840 --> 14:12.040]  I'm not saying you did anything wrong but I mean I'm just saying in some and some instances just
[14:12.040 --> 14:21.000]  consider let them you know screw up and just watch them flail around and you know just walk away

[41:12.520 --> 41:21.920]  My son-in-law is a JP and fortunately if anybody comes after him, if he'll let me know, I'm
[41:21.920 --> 41:24.600]  in a position that I can help there.

[41:27.560 --> 41:33.160]  I'm in a county where everybody knows me and the district judge hates me.

[47:05.440 --> 47:11.080]  of guys that want to be good guys, but they're stuck with the bad guys.

[47:12.080 --> 47:18.880]  I granted they should man up and out the bad guys, but they feel stuck.

[01:04:06.360 --> 01:04:15.640]  those masks out of hand. How dare they tell me to do that? Well, I don't know. Am I being
[01:04:15.640 --> 01:04:21.040]  self-serving and arrogant? And how can I tell when I'm not?
[01:04:21.040 --> 01:04:28.360]  It's a difficult decision for all of us and I think we all have to take our own situations
[01:04:28.360 --> 01:04:36.720]  into account, you know, who we live with, everything and which is the best fight to
[01:04:36.720 --> 01:04:37.720]  pick.

[01:05:53.160 --> 01:06:02.400]  something prepared on that, but the real question is, it's not about should we or should we
[01:06:02.400 --> 01:06:13.000]  not? Or is it a good idea? Or is it thoughtful or considerate of other people's feelings?
[01:06:13.000 --> 01:06:21.560]  That's not the issue. The issue is, it's not even an issue of, well, some doctors think
[01:06:21.560 --> 01:06:29.000]  it might be a good idea. That's not even the issue either. The issue is, do our public
[01:06:29.000 --> 01:06:40.680]  servants have the authority to forcefully impose this on us even if there's unspoken
[01:06:40.680 --> 01:06:53.160]  or written penalties? That's the issue. And if they're mandating that on businesses, then
[01:06:53.160 --> 01:07:02.080]  how does that translate to us? Because, Randy, you said a couple weeks ago when we were talking
[01:07:02.080 --> 01:07:11.360]  about this, that if by their actions, it infringes on the liberties of the individual, then it
[01:07:11.360 --> 01:07:18.800]  amounts to the same thing as if they're directly issuing a mandate that infringes on the liberty
[01:07:18.800 --> 01:07:21.400]  of the individual. Because they're going to impose...
[01:07:21.400 --> 01:07:22.400]  Businesses into law enforcement.
[01:07:22.400 --> 01:07:25.800]  Yes. If they're going to impose this upon the business...

[01:10:48.200 --> 01:10:55.200]  people this whole thing goes back to the hospitals. The hospitals are going to be overwhelmed.
[01:10:55.200 --> 01:11:00.320]  Oh, the horror. The hospitals. We have to protect the hospitals. Okay. We know what
[01:11:00.320 --> 01:11:06.480]  in the Texas health and safety code, at least here in this state, hospitals are designated
[01:11:06.480 --> 01:11:12.680]  as critical infrastructure. And so if there's a disaster declared, an emergency, something
[01:11:12.680 --> 01:11:21.200]  like that at the county, state, local, jurisdictional level, then that invokes all of this authority,
[01:11:21.200 --> 01:11:27.160]  of all of the bureaucracy to come in and do all these things to protect critical infrastructure
[01:11:27.160 --> 01:11:35.440]  of natural gas, water, electricity, hospitals, on and on and on. Okay. Well, the thing is
[01:11:35.440 --> 01:11:44.560]  if they're going to impose something to take away some people's rights on a mass scale,
[01:11:44.560 --> 01:11:51.120]  they have to pass jurisdictional, I'm sorry, they have to pass jurisprudence muster of
[01:11:51.120 --> 01:11:59.400]  three things. They have to prove that there is a compelling governmental interest. They
[01:11:59.400 --> 01:12:06.160]  have to prove that it is narrowly tailored. And they also have to prove that it is the
[01:12:06.160 --> 01:12:13.120]  least restrictive means to accomplish the goal. So what is the goal? To spread out the
[01:12:13.120 --> 01:12:19.600]  infectious rates so that the critical infrastructure of the hospitals don't get overwhelmed. That's
[01:12:19.600 --> 01:12:25.760]  what it, that's the story that it all boils down to. Everyone who's going to get it is
[01:12:25.760 --> 01:12:30.600]  going to get it. Period. It's just a matter of time. Everyone who's going to live or die
[01:12:30.600 --> 01:12:37.680]  as a result, it's going to be the same thing. The whole thing is about making sure that
[01:12:37.680 --> 01:12:43.040]  the critical infrastructure of the hospitals don't get overwhelmed. Okay. And so if they're
[01:12:43.040 --> 01:12:49.560]  going to make everyone wear masks, then they have to prove how does that relate to a compelling
[01:12:49.560 --> 01:12:56.120]  governmental interest of protecting the critical infrastructure of the hospitals? When this
[01:12:56.120 --> 01:13:04.040]  ridiculous hoax went on for six, seven months with no masks and the hospitals are not overwhelmed
[01:13:04.040 --> 01:13:08.920]  and now they wanted to make us wear masks. So I challenge that there is even a compelling
[01:13:08.920 --> 01:13:16.480]  governmental interest in the first place regarding this issue. And number two, you want to talk
[01:13:16.480 --> 01:13:25.160]  about narrowly tailored. Well, that means that if they're, Oh, no, no, this is, this
[01:13:25.160 --> 01:13:33.720]  is called the triad test, which is called the strict scrutiny of the US Supreme Court
[01:13:33.720 --> 01:13:41.080]  when they look at either federal, state, local, whatever of infringing on people's rights
[01:13:41.080 --> 01:13:49.240]  for the sake or the cause of an emergency or disaster. This is well adjudicated. And
[01:13:49.240 --> 01:13:57.200]  so we have to pass the next test of what's called the narrowly tailored. That means it
[01:13:57.200 --> 01:14:04.320]  can't be overbroad. So in other words, they can't make everyone wear, you know, a bubble
[01:14:04.320 --> 01:14:09.400]  if what they really are trying to accomplish is to keep people from coughing on each other.
[01:14:09.400 --> 01:14:17.400]  Right. So, but the narrowly tailored rule also says that it has to accomplish a goal.
[01:14:17.400 --> 01:14:25.920]  Well, guess what? There's a 10% preventative rate of people wearing masks. As far as if
[01:14:25.920 --> 01:14:32.600]  I have the virus, am I going to pass it to you if I wear some ridiculous piece of cloth
[01:14:32.600 --> 01:14:40.640]  in my face? All right. So I'm sorry. It doesn't pass the narrowly tailored rule because it
[01:14:40.640 --> 01:14:47.360]  doesn't do anything. It doesn't accomplish a goal. And I'll talk about the third test

[01:45:38.320 --> 01:45:43.720]  But the court's hands were tied because the plaintiffs did not invoke the subject matter
[01:45:43.720 --> 01:45:47.240]  of jurisdiction of the court, because they approached them with an original petition
[01:45:47.240 --> 01:45:53.760]  for writ of mandamus, they should have gone through the standard appellate procedure.
[01:45:53.760 --> 01:46:00.840]  So anyway, I just wanted to wrap up with that, that we are well within our rights.
[01:46:00.840 --> 01:46:08.480]  Look up strict scrutiny regarding Supreme Court issues, look up rational relation when it
[01:46:08.480 --> 01:46:17.560]  comes to Supreme Court issues as far as testing, what kind of tests they impose, as far as

[01:46:24.480 --> 01:46:33.000]  scrutiny, and it's all about invoking a right, and it's all about approaching the court
[01:46:33.000 --> 01:46:38.480]  via the proper procedure, because we have a right to do this.
[01:46:38.480 --> 01:46:44.760]  And if y'all want to take care of people's feelings in your own personal lives, that's
[01:46:44.760 --> 01:46:47.800]  a different story.
[01:46:47.800 --> 01:46:53.520]  The question is, what does the government have the authority to impose upon us?

[01:46:57.920 --> 01:47:07.880]  The government code apparently gives the governor authority to issue extraordinary orders in

[01:47:16.280 --> 01:47:18.720]  a federal constitutional prohibition.
[01:47:18.720 --> 01:47:24.880]  Well actually, Randy, the Texas Supreme Court sided with the plaintiff on the merits of this
[01:47:24.880 --> 01:47:30.880]  particular case regarding shutting down businesses here in Texas.
[01:47:30.880 --> 01:47:37.040]  There was a constitutional challenge of the statute of section 14 of the government code
[01:47:37.040 --> 01:47:44.480]  saying that it was unconstitutional that only Congress can legislate this and that, and
[01:47:44.480 --> 01:47:47.320]  the Supreme Court actually agreed with the plaintiff.
[01:47:47.320 --> 01:47:48.320]  It was shocking.
[01:47:48.320 --> 01:47:52.360]  Go and read the case, we'll talk about it next week.
