[01:18.060 --> 01:22.740]  new ones since they are stipulating that they do not have the time or the laboratory equipment
[01:22.740 --> 01:24.820]  to test the herb for THC.
[01:24.820 --> 01:28.420]  Margaret Moore the Travis County District Attorney announced earlier this month that
[01:28.420 --> 01:33.140]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.140 --> 01:34.140]  law.
[01:34.140 --> 01:37.580]  Mr. Abbott and other state officials including the Attorney General stipulated in a letter
[01:37.580 --> 01:42.060]  to County District Attorneys back on Thursday that marijuana has not been decriminalized
[01:42.060 --> 01:48.220]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works as
[01:48.220 --> 01:54.460]  well as other cities too like the District Attorney in El Paso, Kaima Esparza a Democrat
[01:54.460 --> 01:59.660]  who also stated earlier this month that the law quote will not have an effect on the prosecution
[01:59.660 --> 02:01.740]  of marijuana cases in El Paso.
[02:01.740 --> 02:06.700]  However, the issue was succinctly summarized by Mr. Brandon Ball an assistant public defender
[02:06.700 --> 02:11.220]  in Harris County who stated that quote, the law is constantly changing on what makes something
[02:11.220 --> 02:13.460]  illegal based on its chemical makeup.
[02:13.460 --> 02:17.380]  It's important that if someone is charged with something, the test matches what they're
[02:17.380 --> 02:22.580]  charged with.
[02:22.580 --> 02:27.580]  A paper by Tulane University identified a five and a half inch American pocket shark as the
[02:27.580 --> 02:30.100]  first of its kind in the Gulf of Mexico.

[03:34.740 --> 03:40.260]  Eddie Craig. All right, let's talk a little bit about something else I happened to come across
[03:40.260 --> 03:49.780]  today on the Fascist Book. It would seem that the detractors that I have over what I do and what I
[03:49.780 --> 03:56.660]  know are still out there in droves, not that I actually care, but just so you folks out there
[03:56.660 --> 04:03.220]  listening know what's going on. There are people that say that I don't know what I'm talking about,
[04:03.220 --> 04:07.940]  that I'm being dishonest about my credentials on this stuff, and et cetera, et cetera, et cetera,
[04:07.940 --> 04:12.660]  just calling me all kinds of a fraud and hoax and everything else. Well, there's two problems
[04:12.660 --> 04:18.820]  with their theory. One, they obviously don't listen to this show and follow along with the
[04:18.820 --> 04:24.180]  stuff that I talk to you about, because I always tell you where to find it and verify it for yourself.
[04:25.060 --> 04:32.100]  And two, they rely upon the same bogus courts citing the same bogus case law that has failed
[04:32.100 --> 04:38.180]  to address the very issues that I raise on this show as to why they're doing it wrong.
[04:39.620 --> 04:45.620]  Now, their latest thing is harping on the fact that the Third Court of Appeals and the County
[04:45.620 --> 04:53.300]  Court of Law here in Austin ruled against the not-in-transportation argument in a series of
[04:53.300 --> 04:58.820]  cases, two or three different people they've ruled on this subject on, and they've ruled against
[04:58.820 --> 05:05.220]  the issue of arguing that you were not engaged in transportation. However, there's a problem,
[05:05.220 --> 05:13.460]  as usual, with what the court did. The court did not follow the rules of statutory construction
[05:13.460 --> 05:19.780]  or the rules for the construction and reading and interpretation of state law. It's blatantly so.
[05:20.500 --> 05:25.940]  What they cited in their opinion as the rule they were relying upon is written directly
[05:25.940 --> 05:31.060]  above the rule that they were required to comply with, which they never even touched on.
[05:32.100 --> 05:39.540]  And that rule is, is that when a term of art is used in statute, it's not given a common
[05:39.540 --> 05:47.460]  and ordinary meaning, it's given the meaning used by professionals or experts that are in that
[05:47.460 --> 05:56.500]  occupation, profession or art. Now, that definition of a term of art alone proves transportation
[05:56.500 --> 06:06.580]  is something other than everyday people. Occupation, profession or art, you get it?
[06:07.540 --> 06:12.340]  That's the definition of how to, or the meaning of how to interpret a
[06:12.340 --> 06:22.100]  term of art in law or a phrase of art in law, okay? They're required to read it that way.
[06:22.100 --> 06:29.540]  Not a single one of these opinions does that. Not only that, they fail to address what definition
[06:29.540 --> 06:36.340]  they're naysaying, and then they fail to provide a definition based upon some legal authority
[06:36.340 --> 06:44.260]  as to why they're saying that original definition used by the appellate is wrong. They just declare
[06:44.260 --> 06:53.060]  it wrong, we disagree. That's all they say. We disagree. For what legal authority basis do
[06:53.060 --> 07:00.900]  you disagree? The court is not allowed to disagree on principle. They have to have some legal authority
[07:00.900 --> 07:07.940]  upon which to base their argument as to why you're wrong. It has to be based upon the statute
[07:07.940 --> 07:15.140]  itself and its construction. It has to be based upon some other case on that exact subject that says
[07:15.140 --> 07:21.780]  this is what it is and what it means, or they have to provide you with something that gives them a
[07:21.780 --> 07:29.620]  reason to say this is what it means. They didn't do any of that, and they never have. They completely
[07:29.620 --> 07:36.100]  skate over it as if it doesn't exist as an argument. Then there is the third problem with the way
[07:36.100 --> 07:41.380]  they interpret it. Their opinions, both at the county court at law level and the third court of
[07:41.380 --> 07:47.060]  appeals level, assigns the common meaning and definition and declares that the word transportation
[07:47.060 --> 07:54.100]  in the title of the transportation code is just a word. It doesn't mean anything. It doesn't have
[07:54.100 --> 08:04.500]  any relevance to what's in the code. There's a problem. SB 971, the bill that enacted that code
[08:04.500 --> 08:14.740]  in its entirety specifically says that transportation is the single subject matter for all of those
[08:14.740 --> 08:22.020]  statutes involved in that code. Now, in case you forgot, the Texas Constitution requires
[08:22.020 --> 08:27.780]  every legislative bill to have a title. Basically, it's a paragraph describing the purpose and intent
[08:27.780 --> 08:33.700]  of the legislation that the bill contains. That title is supposed to state the single
[08:33.700 --> 08:40.500]  subject to which it relates so as to inform the public and the legislature as to the purpose
[08:40.500 --> 08:49.300]  of the legislation. The word transportation is specifically used in that title as the primary
[08:49.300 --> 08:58.900]  subject of the legislation. Hence, it is the single subject of the entire code. Therefore,
[08:58.900 --> 09:04.900]  it is not just some common usage word stuck in the title as a descriptor.
[09:08.900 --> 09:15.940]  That does not even consider the fourth problem, which is an in-depth examination of the various
[09:15.940 --> 09:21.620]  statutes across the various codes that comprise the transportation code and those who are legally
[09:21.620 --> 09:25.460]  authorized to enforce it, namely the Texas Department of Public Safety.
[09:28.340 --> 09:36.500]  Every chapter of the transportation code specifically has a definition for the term
[09:36.500 --> 09:44.340]  department. Now, each chapter's definition is different depending upon what the subject matter,
[09:44.340 --> 09:52.900]  the underlying sub-subject matter context of that particular chapter is. As I said before,
[09:53.700 --> 10:00.660]  anything dealing with design, building, maintenance, budgeting, signage, marking,
[10:01.220 --> 10:07.860]  all of those things are under the Department of Transportation. All of those things in every
[10:07.860 --> 10:15.380]  chapter of the transportation code defines department as the Department of Transportation. However,
[10:16.100 --> 10:23.220]  when it comes to public safety and enforcement and financial responsibility, the term department
[10:23.220 --> 10:29.460]  is always defined in the code as the Texas Department of Public Safety. They are the only
[10:29.460 --> 10:34.580]  agency defined in that entire code as having the authority to enforce it because the statutes
[10:34.580 --> 10:39.220]  constantly say the department shall, the department shall, the department shall. When
[10:39.220 --> 10:44.420]  department is defined as a Texas Department of Public Safety, that limits it to the people who
[10:44.420 --> 10:51.940]  are part of the Texas Department of Public Safety. This brings us to the definition of police officer
[10:51.940 --> 10:59.940]  in chapter 541 of the Texas Transportation Code, where it specifically says someone who is authorized
[10:59.940 --> 11:06.900]  to enforce the transportation laws. Okay, so that right there is a clear message that
[11:06.900 --> 11:12.900]  you must be an officer that has been authorized as a police officer to enforce this code.
[11:13.860 --> 11:18.180]  Under the definition of department, that authority is vested solely in the Texas Department of
[11:18.180 --> 11:26.260]  Public Safety. Until you get to other provisions of the code that specifically say that the
[11:26.260 --> 11:31.460]  agents of the Sheriff's Department, they can have up to five traffic enforcement agents at the
[11:31.460 --> 11:39.300]  Sheriff's Department if they meet certain criteria. Where is this criteria found? It is found under
[11:39.300 --> 11:45.860]  Title 37 of the Texas Administrative Code. What is the subject of the Texas Administrative Code?
[11:45.860 --> 11:53.540]  What are Title 37 of the Texas Administrative Code? What state administrative agency is embodied
[11:53.540 --> 12:00.580]  and authorized under Title 37? The Texas Department of Public Safety.
[12:02.180 --> 12:08.260]  Under the Texas Department of Public Safety, there are numerous programs by which certain
[12:08.260 --> 12:15.940]  qualified officers at the local level may be authorized to enforce the transportation laws
[12:15.940 --> 12:24.500]  as an agent of the Texas Department of Public Safety, i.e. police officer as defined by Chapter
[12:24.500 --> 12:34.020]  541. Okay, now in order to do this, they must comply with training requirements under the
[12:34.020 --> 12:42.180]  supervision of the DPS, which TECLOS is not. By the way, that's not where that training is done.
[12:42.180 --> 12:50.260]  It's done outside of TECLOS. It's done outside of the Academy. It's done in separate training
[12:50.260 --> 12:57.220]  sessions with certified officers of the Department of Public Safety. Now, not only do they have to
[12:57.220 --> 13:05.300]  be certified, but before they can seek certification, two things must be in place. One, a memorandum
[13:05.300 --> 13:10.740]  of understanding with the Texas Department of Public Safety for the local entity to have
[13:10.740 --> 13:19.540]  officers authorized to act as their agent, and they must have all of the certification requirements.
[13:19.540 --> 13:26.820]  They must be in a specifically populated geographical region of Texas before they
[13:26.820 --> 13:32.980]  can seek such certification. It must meet specific geographic location requirements,
[13:32.980 --> 13:38.820]  and it must meet specific population requirements under the Texas Administrative Code. This is
[13:38.820 --> 13:48.500]  all in Rule 4.13 of the Administrative Code. Now, when you look at the Third Court of Appeals and
[13:48.500 --> 13:54.740]  the County Court of Law opinions, they touch on none of this. They address none of this.
[13:54.740 --> 14:01.780]  They do not connect the dots for any of this. They simply make a legal declaration without any
[14:01.780 --> 14:08.500]  foundation in law and declare it so, and then expect people like me that have actually done
[14:08.500 --> 14:13.220]  the research and connected those dots to just go, oh, well, then I must be wrong.
[14:15.700 --> 14:22.820]  Let me tell you something, folks. I know who I am. I know what I've done. I know where I've helped,
[14:22.820 --> 14:28.980]  and I know where I have not been able to help. When I can't help someone, it falls on one of
[14:28.980 --> 14:34.820]  several reasons. One, I can't go to court and speak for them and bring these issues up on their
[14:34.820 --> 14:43.380]  behalf. Thus, it falls to them to learn it and apply it and argue it. Two, the people that I try to
[14:43.380 --> 14:50.740]  help for the most part are not capable of doing number one, okay? They can't learn it. They don't
[14:50.740 --> 14:55.380]  have the time to learn it. They don't make the effort to learn it. Whatever reason, they don't
[14:55.380 --> 15:01.140]  learn it, and then when they don't learn it, they can't apply it. They can't argue it. They can't
[15:01.140 --> 15:05.700]  write it up. They can't make the case. They can't question the officer. They can't bring up the
[15:05.700 --> 15:13.860]  statute because they don't know, okay? That failure does not reflect upon the validity of my information.
[15:15.060 --> 15:24.580]  It does not reflect upon the fact that the dots are properly connected. That falls solely to the
[15:24.580 --> 15:31.460]  individual's inability to internalize and then utilize the information they were giving.
[15:32.740 --> 15:38.260]  That's why attorneys go to school and get all this training to do these things so they can do what most
[15:38.260 --> 15:43.860]  people don't have time to learn to do. The problem is, is they won't do their job. They won't make
[15:43.860 --> 15:48.980]  these arguments. They won't make this effort. There's not enough money in it for them. Plus,
[15:48.980 --> 15:55.140]  it's biting the hand that feeds them, and they're not very likely to do that, no matter how right you
[15:55.140 --> 16:09.540]  are. So people can talk about me till they're blue in the face. I don't care. You don't know what you
[16:09.540 --> 16:16.500]  are talking about, folks, and I'll tell you that to your face any day of the week, and you're not
[16:16.500 --> 16:22.580]  very likely to come tell me to mind more than once, and then you're going to stand far away when you
[16:22.580 --> 16:28.740]  do it. I guarantee you because you ain't got the guts to do it face to face, and you don't have
[16:28.740 --> 16:35.300]  the knowledge to stand toe to toe and argue with me about it because you haven't done the research.
[16:35.300 --> 16:42.100]  You just follow along like a good little sheep and say the courts disagree. When my whole argument is
[16:42.100 --> 16:47.940]  the courts are already dead wrong, and they know it. They're just not going to admit it.

[21:54.500 --> 22:01.060]  That happens too. But the fact of the matter is you can't go into a courtroom because you
[22:01.060 --> 22:06.340]  don't know the information well enough to stand up, know what questions to ask,
[22:06.980 --> 22:13.140]  what testimony to give, what statutes to bring up, which ones to ask the officer about,
[22:13.140 --> 22:19.540]  provided you're even allowed to ask the officer about them, or how to write them out in the
[22:19.540 --> 22:26.260]  legal pleadings that you have to file beforehand. See, there's a problem with how they deal with
[22:26.260 --> 22:31.700]  these Class C fine only cases in Texas and probably pretty much everywhere else it's the exact same
[22:31.700 --> 22:41.700]  way. But the system is designed to not tell you everything. Okay? There's an entire chapter that
[22:41.700 --> 22:47.380]  is the prevailing chapter in the Code of Criminal Procedure as to how these cases are supposed
[22:47.380 --> 22:56.100]  to be prosecuted, but it only touches on certain aspects of the case and how it works. It does not
[22:56.100 --> 23:02.100]  describe everything about how the case progresses, what they're required to do, and how they're
[23:02.100 --> 23:08.100]  required to do it. You have to learn to look outside of Chapter 45 to other parts of the
[23:08.100 --> 23:14.660]  Code for where that is. But where Chapter 45 does talk about it, Chapter 45 is controlling on the
[23:14.660 --> 23:23.460]  issue. The problem is the courts don't comply with Chapter 45. They very rarely comply with any part
[23:23.460 --> 23:28.660]  of the Code of Criminal Procedure, which we've talked about on this show for years, which we have
[23:28.660 --> 23:34.660]  proven case after case after case for years. Hence the reason why you people say, and I don't know
[23:34.660 --> 23:39.860]  what I'm talking about, you can blow it out your backside. You're the one that doesn't know what
[23:39.860 --> 23:46.900]  you're talking about because you can't show me where I'm wrong. You can't show me where a court
[23:46.900 --> 23:54.180]  has ever directly addressed the issue I'm raising using the relevant law. You just can't do it
[23:54.180 --> 24:04.260]  because it doesn't exist. It doesn't exist intentionally. They do not go into these facts
[24:04.260 --> 24:11.940]  and issues because it would destroy the status quo as they have established it. And they know it.
[24:11.940 --> 24:19.460]  It would prove the fraud beyond any reasonable doubt, even to morons like those of you that
[24:19.460 --> 24:27.220]  are saying, we don't know what we're talking about here. You're right, people. We are not attorneys.
[24:27.220 --> 24:34.660]  But guess what? We are damn proud of that fact. I would not want to be an attorney. I don't want
[24:34.660 --> 24:46.580]  my IQ to have to be cut that low to be an attorney. You see, they may know more general knowledge
[24:46.580 --> 24:53.380]  overall because of their university education, but you will be hard pressed to find one that has
[24:53.380 --> 25:02.260]  spent as much time as I have focusing on one specific area of law to understand it really,
[25:02.260 --> 25:08.420]  really well. Not to work in it well enough to make people think I understand it really,
[25:08.420 --> 25:16.020]  really well, but to actually internalize it to such a degree, I can quote the damn statutes
[25:16.020 --> 25:26.180]  to you from memory. Hundreds of them, thousands of them, what chapter they're in, what number they are.
[25:26.180 --> 25:39.060]  And you cannot find a handful of attorneys on this earth that can do that. I'm glad I'm not an attorney.

[27:24.580 --> 27:29.780]  me to sign the ticket. And I said, you know, I don't want to sign anything. That's just like
[27:29.780 --> 27:37.940]  signing a contract and I don't want to contract. And I can take you to jail. But anyway, he said,
[27:37.940 --> 27:48.260]  but I'm not though. But anyway, so, oh, and right at the very last part, you said to that gentleman
[27:48.260 --> 27:56.100]  that called in, you said, don't use the right to travel because you'll lose. And then right before
[27:56.100 --> 28:02.260]  it come off, you said, email me and something like that. And that was it. And I was just wondering

[28:08.580 --> 28:17.860]  of violating a law relating to the right to travel, are they? I guess not. No, the answer is no,

[28:25.300 --> 28:30.660]  not written to regulate the right to travel. They have nothing to do with the right to travel.

[34:41.780 --> 34:46.420]  that exact name. It's called no distance, no crime, court procedure, and I don't mean that.
[34:46.420 --> 34:58.740]  Okay, listen closely. There are different types of law. Okay, there's criminal law,
[34:59.780 --> 35:08.980]  there's civil law, and there's administrative law. 99.9% of the statutes you are being charged under
[35:08.980 --> 35:15.380]  in many states are administrative law, not criminal, not civil, but administrative,
[35:15.380 --> 35:19.700]  which is a different form of civil, but the rules are different as far as the rules of
[35:19.700 --> 35:25.060]  evidence and the requirements to prove the case. Okay, so they're not exactly the same.
[35:26.500 --> 35:37.380]  You follow so far? Yeah. Okay, because administrative law is based upon the legal presumption of
[35:37.380 --> 35:42.740]  applicability to those to whom have made application to be party to that law,
[35:42.740 --> 35:49.860]  they don't have to prove it applies. They can simply assume it if they are allowed to maintain
[35:49.860 --> 35:55.940]  the presumption that you were acting under its authority. And that's what they are doing when
[35:55.940 --> 36:03.460]  they say you are a driver of a motor vehicle who was operating a motor vehicle. They are using
[36:03.460 --> 36:10.660]  the terminology of the administrative law to link your actions to that law for to create the
[36:10.660 --> 36:22.100]  presumption of applicability. Okay? Yeah. Now, it works the same way that a computer operand works.
[36:24.100 --> 36:33.620]  And rather than saying that isn't true, you have to say that is not true. I was not doing that.
[36:33.620 --> 36:39.300]  I am not this thing or that thing. In other words, you have to directly address the presumption
[36:39.300 --> 36:48.740]  being made and rebutted line by line item. You can't do a blanket statement. You can't do any of that.
[36:51.220 --> 36:57.380]  Most of these states, they have titled their codes either a transportation like Texas has or
[36:57.380 --> 37:04.740]  be motor vehicle code. If you do the research, you will find that every single one of these codes
[37:04.740 --> 37:14.660]  finds its genesis in the federal laws dealing with commercial use of the highways, which is mostly
[37:14.660 --> 37:25.380]  Title 49 or 49 USC. Okay? It's not all 49 USC, but it's mostly 49 USC. Okay? Federal Motor Carrier
[37:25.380 --> 37:33.060]  Safety Act. Now, when you look at the definition of what transportation is under the eyes of the law,
[37:33.060 --> 37:42.820]  it is the movements of persons, goods or property by a carrier. Hence, the federal law, commercial
[37:42.820 --> 37:55.060]  motor carriers act. Right? You with me so far? Yes. So part of what you have to be able to research
[37:55.060 --> 38:02.660]  and prove out both in legal brief and argument is that they are misapplying a law to you,
[38:02.660 --> 38:11.300]  that has nothing to do with you. This is why Mark Stevens approach does not work specifically in
[38:11.300 --> 38:17.780]  this case because there is a presumption that the law does. And you can't just say it doesn't. You
[38:17.780 --> 38:23.460]  have to be able to show yourself how it doesn't because under administrative law, the burden
[38:23.460 --> 38:34.100]  falls on the accused, not the accuser. You follow? Right here. Okay. That's exactly why his method
[38:34.100 --> 38:41.140]  won't work in cases where this is administrative. It won't work in cases where these are what are
[38:41.140 --> 38:50.820]  called civil infractions because it's entirely administrative. Now, in cases where the law is
[38:50.820 --> 38:58.100]  criminal in its nature for the offense, that's a different story, but it still won't work the way
[38:58.100 --> 39:04.900]  Mark Stevens says it works. Because again, they broadly interpret these statutes as being applicable
[39:04.900 --> 39:09.300]  and they have shifted the burden to the accused and the courts have appealed they're doing so,
[39:09.300 --> 39:15.220]  which is unconstitutional, but they've done it. So now they're able to charge you with these fine
[39:15.220 --> 39:22.660]  only crimes or these low level crimes without having to actually have a presumption of innocence
[39:24.420 --> 39:31.540]  and the presumption that they have to prove the applicability of the law. Now, they try to say
[39:31.540 --> 39:37.380]  they do that at trial, but they don't. They just keep using the terminology as if it does apply,
[39:37.380 --> 39:43.780]  but they have introduced zero evidence to support the applicability, the link between your actions
[39:43.780 --> 39:51.540]  and that law. They never do. They just simply say you were operating a motor vehicle. No, I was not.
[39:52.100 --> 39:58.020]  Prove it was a motor vehicle. Prove I was operating it. So they pull out the same statute that contains
[39:58.020 --> 40:04.580]  the same term and read the description of what operating means, but they still have the key
[40:04.580 --> 40:11.620]  element of the statute missing, which is the subject matter to which it applies. Transportation.
[40:11.620 --> 40:19.540]  They never prove transportation, which is the threshold requirement to any offense within
[40:19.540 --> 40:25.540]  that code. Now, I'm speaking of how it works in Texas. Colorado is a little different because
[40:25.540 --> 40:31.540]  theirs is a motor vehicle code and their language and their statute is specifically obfuscated
[40:31.540 --> 40:37.380]  to make it appear to apply to everything. When in fact, if you can find the genesis of that
[40:37.380 --> 40:42.900]  state law from the federal law, you can prove it cannot apply to everything because the federal
[40:42.900 --> 40:48.420]  law does not apply to everything. It applies only to commercial activities. That's all it could apply
[40:48.420 --> 40:55.700]  to, but that takes time, effort and real work. It's not going to happen overnight and you're not
[40:55.700 --> 41:03.860]  going to do it easily. Well, my court date isn't until like about almost a month. It looks like
[41:03.860 --> 41:09.780]  over three weeks before I have to go to court. Well, let me put it this way. I've been at this for
[41:11.060 --> 41:21.060]  15, 20 years and laws change constantly, so you have to keep up with that. Based upon what
[41:21.060 --> 41:25.700]  you've already learned, you have to see if any of it's changed before you ever appear in court
[41:25.700 --> 41:30.420]  with it because you'll be arguing something old while they're arguing something new and guess
[41:30.420 --> 41:40.420]  what, you lose. Well, you said before that last guy got off last week, you said don't use the
[41:40.420 --> 41:44.340]  right to travel because you'll lose, so how should I go about this here in Colorado?
[41:45.540 --> 41:49.780]  What did I just tell you? I just spent the last, this entire segment telling you what to do with
[41:49.780 --> 41:56.980]  it. You want me to look up the federal? No. You have to find where the state law
[41:56.980 --> 42:04.180]  law is founded upon the federal law. That you've got to find first. You've got to prove a nexus
[42:04.180 --> 42:12.020]  between the state law and the federal law as to what it applies to. Otherwise, the state is going
[42:12.020 --> 42:19.220]  to say that that's not what the law is. That's not how it works because they're going to deny
[42:19.220 --> 42:25.060]  such a link exists when in fact it does. It always has. They just don't want you to know it.
[42:25.060 --> 42:32.340]  There's too much money for them to steal by keeping everybody under their thumb and paying.
[42:32.340 --> 42:39.060]  You get it? Yeah, oh yeah. So they're going to fight you tooth and nail. You better be able
[42:39.060 --> 42:45.940]  to fight back the same way. Now you think you can get that down in three weeks? More power to you.
[42:45.940 --> 42:51.140]  I'll be your biggest cheerleader and I wish you the best in the world at getting that done.
[42:51.140 --> 42:55.540]  But I wouldn't hang my hopes on one case, especially if this is my first one trying

[47:12.660 --> 47:17.380]  I don't know. I mean, if it's, I guess, yeah, you could say that. I mean, maybe you have to

[47:22.820 --> 47:28.820]  is someone throwing a cinder block at a moving car passing under the overpass they're standing on,
[47:28.820 --> 47:37.620]  committing a crime? Yes. Okay. Now, are they committing a crime even if they miss the car?

[48:23.540 --> 48:34.420]  life or property to another. So the statement, no victim, no crime is a legal fallacy. It's
[48:34.420 --> 48:42.420]  idiotic. And that's the reason why if you fired a gun into a crowd of people, but managed to not
[48:42.420 --> 48:47.380]  hit anyone, would you expect to just say, Oh, well, hell, you can't charge them with anything. I
[48:47.380 --> 48:55.380]  didn't hurt anybody. Would you expect that to be the result? I'd say if the intent was there,
[48:55.380 --> 48:59.460]  but if the intent wasn't, well, what do you mean if the intent was there? You fired a gun into a
[48:59.460 --> 49:05.220]  crowd of people, but fortunately you didn't hit anyone, but you fired it into a crowd of people.
[49:08.500 --> 49:12.740]  Well, I guess what I'm trying to say is if you accidentally fired it into a crowd of people,
[49:12.740 --> 49:17.220]  I'd say you're, you're putting it into your waistband or, and just went off or, you know,
[49:17.220 --> 49:20.820]  your, you still don't think you could be charged with negligence?
[49:22.260 --> 49:26.420]  Well, yeah, you can be charged with that. But if you really didn't mean it, then I think that's
[49:26.420 --> 49:32.740]  the issue. You don't have to mean for someone to be harmed for it to be a crime. There does not
[49:32.740 --> 49:41.140]  have to be an actual victim for certain actions to be a crime. There only has to be the action
[49:41.140 --> 49:46.740]  itself for the crime to have been committed. And both of those are examples of the kind to which
[49:46.740 --> 49:53.220]  that applies. Here's the other thing. I don't want to lose my car trying to stand up for my
[49:53.220 --> 49:58.500]  right to travel. Well, they can't just take your car. They can't make you forfeit your car.
[49:59.300 --> 50:06.580]  Even in Colorado, these are fine only offenses, possibly in some cases with jail, if it's the,
[50:06.580 --> 50:10.660]  if it's a certain number of that offense or a certain level of offense. But if that's the case,
[50:10.660 --> 50:15.380]  they've got to provide you with an attorney if you can't afford one. But as long as they're fine
[50:15.380 --> 50:22.420]  only, they can't just up and take your car. Now, if you go and you get charged two or three more
[50:22.420 --> 50:28.260]  times and they can elevate the offense from there, then they can certainly try. They can certainly
[50:28.260 --> 50:34.500]  impound it and they can certainly make you pay to get it back. How can I accept the court for
[50:34.500 --> 50:41.460]  appeal? Well, you have to make the case just like, okay, everything I've been telling you is about
[50:41.460 --> 50:46.340]  making the appeal because the trial court could care less what the law is. The trial court's not
[50:46.340 --> 50:51.140]  there to decide whether you're right or wrong or whether or not there's a law to be obeyed and
[50:51.140 --> 50:56.340]  they're not. The trial court is only there to make it appear like you're getting due process.
[50:57.700 --> 51:04.980]  Right, right. Okay? So everything you do is always directed at preparing the appeal. And
[51:04.980 --> 51:10.340]  everything I've told you so far on this show is to make the case that goes to appeal for that purpose.
[51:11.300 --> 51:16.020]  But in order to do that, you've got to know what to file, what to write, how to write it,
[51:16.020 --> 51:20.580]  how to argue it, and what it all means and how to prove it's all linked together and they can't
[51:20.580 --> 51:29.220]  just ignore it. If you can't do that, then you're going to lose. It's that simple because the gain
[51:29.220 --> 51:36.740]  is most assuredly rigged against you and it always has been. But I will tell you this,
