[01:14.340 --> 01:19.020]  San Antonio have been dropping marijuana possession charges and even refusing to file new ones
[01:19.020 --> 01:23.020]  since they are stipulating that they do not have the time or the laboratory equipment to
[01:23.020 --> 01:24.860]  test the year for THC.
[01:24.860 --> 01:28.620]  Margaret Moore, the Travis County District Attorney announced earlier this month that
[01:28.620 --> 01:33.180]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.180 --> 01:34.180]  law.
[01:34.180 --> 01:37.780]  Mr. Abbott and other state officials, including the Attorney General stipulated in a letter
[01:37.780 --> 01:42.300]  to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:42.300 --> 01:48.460]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as
[01:48.460 --> 01:54.660]  well as other cities too, like the District Attorney in El Paso, Cayma Esparza, a Democrat
[01:54.660 --> 01:59.140]  who also stated earlier this month that the law, quote, will not have an effect on the
[01:59.140 --> 02:01.900]  prosecution of marijuana cases in El Paso.
[02:01.900 --> 02:06.940]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.940 --> 02:10.940]  in Harris County who stated that, quote, the law is constantly changing on what makes
[02:10.940 --> 02:13.660]  something illegal based on its chemical makeup.
[02:13.660 --> 02:17.540]  It's important that if someone is charged with something, the test matches what they're
[02:17.540 --> 02:22.740]  charged with.
[02:22.740 --> 02:27.580]  A paper by Tulane University identified a five and a half inch American pocket shark.
[02:27.580 --> 02:32.500]  As the first of its kind in the Gulf of Mexico, the specimen being only the second pocket
[02:32.500 --> 02:38.180]  shark ever captured or recorded with the other one being found way back in 1979 in the East

[04:09.900 --> 04:16.020]  Now there is this woman out there who calls herself Snoop 4 Truth and she used the number
[04:16.020 --> 04:21.540]  4 in that center part there and she thinks that she knows what's going on in the world
[04:21.540 --> 04:25.540]  of law and what the court cases all say and blah, blah, blah.
[04:25.540 --> 04:27.260]  She doesn't.
[04:27.260 --> 04:34.340]  She runs this website called Project Avalon where she tries to debunk anyone that's talking
[04:34.340 --> 04:40.020]  against the status quo of things, myself included.
[04:40.020 --> 04:43.660]  She calls it the Eddie Craig Right to Travel hoax.
[04:43.660 --> 04:47.900]  Now anyone who's listened to this show or to me for any length of time knows that I
[04:47.900 --> 04:53.060]  have said time and time again that the right to travel is not the issue here.
[04:53.060 --> 04:56.780]  It has never been the issue here.
[04:56.780 --> 05:06.140]  No one and I repeat, no one is trying to charge you with a violation of the right to travel.
[05:06.140 --> 05:12.740]  Now as luck would have it, someone posted a recording of their appearance in court the
[05:12.740 --> 05:15.820]  other day doing some stupid patronut stuff.
[05:15.820 --> 05:20.020]  Don't get me wrong, it was a patronut doing it but they were recording the proceedings
[05:20.020 --> 05:23.780]  which at least was one thing they were doing intelligently.
[05:23.780 --> 05:31.860]  And in those proceedings, the judge herself says exactly those words.
[05:31.860 --> 05:35.900]  This guy is going on and on trying to cross-examine the cop.
[05:35.900 --> 05:40.540]  Do you agree that there's a right to travel and the prosecutor is objecting to it?
[05:40.540 --> 05:47.500]  Because it's irrelevant to the charges against you people, stop bringing it up.
[05:47.500 --> 05:55.180]  It's not the issue here and the judge herself, in my words, exactly repeated, no one is charging
[05:55.180 --> 05:59.100]  you with a violation of the right to travel.
[05:59.100 --> 06:05.820]  So how on the money have I been for years saying exactly that same thing?
[06:05.820 --> 06:10.820]  That's the only time that the courts and I have actually agreed on anything.
[06:10.820 --> 06:19.740]  Now what this woman snoop for truth thinks she's done is expose my efforts to get the
[06:19.740 --> 06:25.860]  transportation code overturned as being unconstitutional in its application and overturned as being
[06:25.860 --> 06:30.980]  unconstitutional because it was illegally enacted under our Constitution.
[06:30.980 --> 06:37.260]  This law, very clearly, if you know all the parts to put together, leaves no doubt that
[06:37.260 --> 06:40.980]  this is dealing with commerce and nothing else.
[06:40.980 --> 06:46.180]  It has no effect and no application to the private people of Texas never has.
[06:46.180 --> 06:48.060]  The law says that.
[06:48.060 --> 06:52.580]  However, the court opinions say something completely different.
[06:52.580 --> 06:58.860]  And the reason for that is and the thing that she is promoting by doing what she does is
[06:58.860 --> 07:04.700]  that the courts are playing word games using legal semantics.
[07:04.700 --> 07:10.900]  For lack of a better way to put it, it is fraud through terminology.
[07:10.900 --> 07:18.460]  They are using the terminology of the statutes and applying them to subject matter that is
[07:18.460 --> 07:25.980]  outside of the enacted legislative subject matter jurisdiction of the code itself as
[07:25.980 --> 07:32.180]  if they are one and the same and they are not.
[07:32.180 --> 07:40.220]  Me going to and from any place in my car is not an act of transportation, has nothing
[07:40.220 --> 07:49.700]  to do with transportation, never had anything to do with transportation.
[07:49.700 --> 07:55.860]  But by saying that I am in a motor vehicle without any evidence of transportation, the
[07:55.860 --> 08:00.500]  state is attempting to draw me within the confines and jurisdiction of the subject matter of
[08:00.500 --> 08:08.860]  the transportation code using nothing more than legal semantics, but no actual evidence.
[08:08.860 --> 08:15.020]  They have no evidence it was being used as a motor vehicle, none, because they lack any
[08:15.020 --> 08:17.500]  evidence of transportation.
[08:17.500 --> 08:25.260]  The single subject matter that controls the application of that code.
[08:25.260 --> 08:27.260]  Now this woman snooped for truth.
[08:27.260 --> 08:32.300]  She threw all kinds of court cases at me that I have seen a thousand times before from every
[08:32.300 --> 08:38.100]  state of the union and just like the right to travel argument in the court, her case
[08:38.100 --> 08:43.580]  law is absolutely irrelevant to what I discuss and why I discuss it.
[08:43.580 --> 08:44.580]  Absolutely irrelevant.
[08:44.580 --> 08:47.980]  Why, because it is doing exactly the same thing.
[08:47.980 --> 08:56.500]  It is using deception of terminology to insinuate an application that legally it cannot possibly
[08:56.500 --> 09:00.540]  have and remain constitutional.
[09:00.540 --> 09:02.860]  Can't do it.
[09:02.860 --> 09:07.020]  Article 3, section 35, Texas Constitution.
[09:07.020 --> 09:13.140]  No bill shall contain more than one subject and the subject of all bills shall be stated
[09:13.140 --> 09:19.300]  in its title to provide proper notice to the legislature and to the public what the bill
[09:19.300 --> 09:22.860]  is for.
[09:22.860 --> 09:31.300]  The title of SB 971 specifically says every statute in that code is relative to the subject
[09:31.300 --> 09:35.380]  matter of transportation.
[09:35.380 --> 09:40.780]  Hence the third court of appeals declaration that transportation is just a word in the
[09:40.780 --> 09:50.820]  title of the code is inaccurate, it is incorrect, it is judicial fraud because it is not the
[09:50.820 --> 09:53.060]  sole purpose of the term.
[09:53.060 --> 10:01.020]  It is the single subject matter that the code itself is limited to according to the actual
[10:01.020 --> 10:08.660]  enrolled bill which is the actual law not the statutes.
[10:08.660 --> 10:16.940]  When the statutes do not comport themselves with the enrolled bill, the statutes are invalid.
[10:16.940 --> 10:23.180]  End of discussion, the enrolled bill is the law.
[10:23.180 --> 10:31.740]  The law says the subject matter of the transportation code is limited to that of transportation.
[10:31.740 --> 10:40.380]  It does not provide us with one, a definition of transportation that is, but the government
[10:40.380 --> 10:48.500]  code does tell us in chapters 311 and 312 how such terms of art are to be read and interpreted
[10:48.500 --> 10:54.180]  by the courts, by the executive, and by the legislature.
[10:54.180 --> 11:03.060]  They are to be interpreted and read and construed in the same meaning as given to it by those
[11:03.060 --> 11:08.940]  in the art, profession, or occupation to which it applies.
[11:08.940 --> 11:14.580]  Art, profession, or occupation, get it?
[11:14.580 --> 11:18.260]  You're going to and from the grocery store is not an occupation.
[11:18.260 --> 11:25.300]  You're going to and from work, the travel itself is not a profession or an occupation.
[11:25.300 --> 11:30.140]  What you're doing once you get there is a different story, but on your way back and
[11:30.140 --> 11:34.140]  forth it's irrelevant.
[11:34.140 --> 11:39.420]  It is nor is it an art.
[11:39.420 --> 11:44.140]  So right there the rules of statutory construction and the writing of laws in chapters 311 and
[11:44.140 --> 11:49.220]  312 of the Texas government code makes it very clear the Third Court of Appeals went
[11:49.220 --> 11:56.820]  way off the reservation to make a declaration of law that they had no legal basis to make,
[11:56.820 --> 11:57.820]  none.
[11:57.820 --> 12:01.740]  But every court in Texas has done this for decades.
[12:01.740 --> 12:08.140]  They have applied the statutes in a way that makes the statute itself into an independent
[12:08.140 --> 12:14.120]  subject, separate and apart from the subject matter of the code.
[12:14.120 --> 12:18.900]  And that too is unconstitutional.
[12:18.900 --> 12:24.340]  So Ms. Snoop for truth, I don't know what you hope to accomplish other than just to
[12:24.340 --> 12:30.940]  maintain the status quo for the powers that be, but until you rebut my actual research
[12:30.940 --> 12:37.540]  on the actual law and the actual history of that law, rather than how the courts are misrepresenting
[12:37.540 --> 12:42.940]  what that law says and means, you don't have a leg to stand on in arguing with me and you
[12:42.940 --> 12:45.020]  never will.
[12:45.020 --> 12:50.460]  A face-to-face debate on this subject will see you burning in a heap on the ground before
[12:50.460 --> 12:54.060]  you can finish your last teardrop.
[12:54.060 --> 13:00.460]  I promise you it will because all you can throw at me are court opinions that are irrelevant
[13:00.460 --> 13:07.420]  to Texas law, period.
[13:07.420 --> 13:12.180]  Anyone that listens to this show knows that when I tell you to go look at something, I
[13:12.180 --> 13:15.700]  tell you exactly where to find it.
[13:15.700 --> 13:20.740]  And when I tell you where to find it, my expectation is is you will do your own due diligence and
[13:20.740 --> 13:26.860]  go look it up for yourself and verify that I was right.
[13:26.860 --> 13:33.460]  When you connect all of the dots in the various places they exist within the Texas codes,
[13:33.460 --> 13:40.220]  there is no way to come to the conclusion that the private citizen is subject to the
[13:40.220 --> 13:43.020]  transportation code and the statutes in it.
[13:43.020 --> 13:46.020]  There is no way whatsoever.
[13:46.020 --> 13:50.620]  But in order to come to that conclusion, there are some things that you must understand.
[13:50.620 --> 13:55.180]  You must understand how to read and interpret statutes, which chapters 311 and 312 tell
[13:55.180 --> 13:56.420]  us how to do.
[13:56.420 --> 14:00.740]  You must understand how the legislature is required to write law, which chapters 311
[14:00.740 --> 14:03.420]  and 312 tell us how they're supposed to do that.
[14:03.420 --> 14:07.780]  The legislative drafting manual also tells us how they're supposed to do that.
[14:07.780 --> 14:11.980]  The legislative drafting manual brings to clarification, for instance, that the term
[14:11.980 --> 14:18.220]  person by default, as does chapter 311 definition of person, by the way, which is generally
[14:18.220 --> 14:25.700]  applicable to every code unless that code has its own local definition, means a fictional
[14:25.700 --> 14:27.340]  legal entity.
[14:27.340 --> 14:33.700]  Does not mean an individual person, living person, that is.
[14:33.700 --> 14:37.740]  Doesn't mean one at all, never has.
[14:37.740 --> 14:43.940]  When it goes to the use of the term individual in those statutes, an individual can engage
[14:43.940 --> 14:47.420]  in transportation just like a corporation can.
[14:47.420 --> 14:54.940]  In fact, an individual is required to be acting when a corporation engages in such activities
[14:54.940 --> 14:59.820]  because the corporation can't drive a truck, it can't press a gas pedal, it can't step
[14:59.820 --> 15:01.700]  on a brake.
[15:01.700 --> 15:06.140]  That takes someone that breathes air, okay?
[15:06.140 --> 15:09.940]  Yes, of course, it's a remote-controlled car, and then there's still going to be somebody
[15:09.940 --> 15:14.300]  somewhere monitoring something about it.
[15:14.300 --> 15:21.420]  The point is, is that the legal terminology is what is being used to deceive the public,
[15:21.420 --> 15:26.860]  and that terminology is what comprises the court opinions she is relying on.
[15:26.860 --> 15:36.620]  Hence, they are wrong because the terminology is being applied to subjects outside of the
[15:36.620 --> 15:41.660]  actual legislative subject matter, okay?
[15:41.660 --> 15:49.780]  My automobile is not a motor vehicle until I am using it to engage in transportation.
[15:49.780 --> 15:56.380]  At which point, I better have a license and my automobile must be registered and licensed
[15:56.380 --> 16:00.620]  as a motor vehicle to engage in that activity.
[16:00.620 --> 16:06.460]  But until I do that, those licenses are irrelevant to me.
[16:06.460 --> 16:14.100]  They have nothing to do with me and what I'm doing, never had, never will.
[16:14.100 --> 16:17.740]  This is fraud.
[16:17.740 --> 16:20.780]  It's judicial fraud.
[16:20.780 --> 16:29.420]  It is the way the game has been rigged to use similar terms to common terms, but with different
[16:29.420 --> 16:36.860]  meanings, and with a different subject matter context to which those meanings must be limited.
[16:36.860 --> 16:42.020]  Something that the courts are ignoring in every single case they decide.
[16:42.020 --> 16:48.980]  They are throwing the subject matter requirement of the code out of the window, and just going
[16:48.980 --> 16:53.540]  with the statute's individual is if they are subjects under themselves.

[21:54.800 --> 22:01.600]  had stopped me about two months prior for it was irrelevant of a traffic stop.
[22:01.600 --> 22:06.000]  They were doing an investigation on something else but they noticed that I
[22:06.000 --> 22:11.800]  didn't have a... I just bought an automobile, private automobile and had the
[22:11.800 --> 22:18.680]  bill say on the window but he asked you know for my license and registration.
[22:18.680 --> 22:25.240]  Sheriff's office did the other day and I said well I'm not in transportation.
[22:25.240 --> 22:31.120]  That's the first thing I told him and he just acted like I didn't say anything. He
[22:31.120 --> 22:35.960]  goes sir I need a driver's license from you. I said I'm just honest with him. I
[22:35.960 --> 22:40.600]  said I'm not driving and he goes what do you mean you're not driving? He goes aren't you behind the wheel of vehicles?
[22:40.600 --> 22:47.800]  I said no. I said it's not a vehicle and at this point he started getting I rate
[22:47.800 --> 22:53.320]  started yelling at me and I was going to ask you actually he's getting really
[22:53.320 --> 22:59.760]  intimidating and yelling and I thought he was going to insinuate or commit an
[22:59.760 --> 23:02.880]  act of violence. I didn't know what he was doing by his actions but he was
[23:02.880 --> 23:07.920]  intimidating me and he asked for the key. I asked him why he needed the key and he
[23:07.920 --> 23:12.640]  didn't tell him. He just said give me the key. So I did. I complied just out of fear
[23:12.640 --> 23:17.840]  and gave him the key. I wasn't going to take off or anything on him of course and
[23:17.840 --> 23:25.120]  then he took my key and he went back apparently called for backup and then he
[23:25.120 --> 23:29.920]  came back to the window and he started his same thing. He says you don't have a
[23:29.920 --> 23:34.120]  plate either. You don't have a date on the bill of sale. You don't have anything.
[23:34.120 --> 23:38.800]  I said well officer I said I explained again. I'm not I'm not any any form of
[23:38.800 --> 23:43.480]  transportation. He goes what are you doing then? He goes on my roads. It's kind of
[23:43.480 --> 23:50.200]  like that. I said well I'm just I'm just traveling. I'm just a mere traveler and
[23:50.200 --> 23:55.400]  at that point backup arrived and he he wasn't listening to anything I was saying
[23:55.400 --> 24:00.480]  just getting a rate and I was actually glad to see the backup because he was the
[24:00.480 --> 24:07.360]  guy just that never been so intimidated by a public official before. But when they
[24:07.360 --> 24:12.080]  arrived I just tried to explain. One gal asked me she's like what what's the
[24:12.080 --> 24:15.000]  difference? What are you trying to explain here? She's like what what do you mean
[24:15.000 --> 24:19.840]  you're just traveling? Aren't you driving? So I try I know you're not supposed to
[24:19.840 --> 24:23.520]  educate them. It ain't gonna do any good but I just briefly went through it. It's one thing if
[24:23.520 --> 24:27.240]  they're asking you to educate them. It's another thing when they're doing what the
[24:27.240 --> 24:31.400]  first cop is doing and you're still trying to educate them. That's the
[24:31.400 --> 24:37.520]  distinction here. All right well what I was going to ask is because of his

[26:13.800 --> 26:16.800]  said officer I already told you it's not a vehicle and the public has a right to
[26:16.800 --> 26:21.120]  travel I said I have a right to be out on the roads if I'm not I'm not in
[26:21.120 --> 26:25.120]  transportation he goes he goes I'm telling you again he goes you are not
[26:25.120 --> 26:30.200]  taking that automobile vehicle whatever you want to call it out on my roads and
[26:30.200 --> 26:36.360]  it's just how he worded it so I'm like well I said then this is an arrest in I
[26:36.360 --> 26:41.240]  said you realize that he goes no it isn't he said you're free to go you can
[26:41.240 --> 26:47.920]  walk you could do whatever it's an illegal seizure right he cannot articulate

[36:09.000 --> 36:15.560]  required to know that law they didn't thus they committed fraud repeatedly
[36:15.560 --> 36:21.560]  against millions and millions of people literally over howling how long of a
[36:21.560 --> 36:37.760]  period of time mm-hmm okay so it'd be against the individual officers no it's
[36:37.760 --> 36:44.040]  not against the individual officers and it's not for money okay the only way
[36:44.040 --> 36:49.040]  you're going to get this is to force them to stop enforcing the law and
[36:49.040 --> 36:54.440]  correctly correct okay but you're not going to get any money out of it you
[36:54.440 --> 36:59.920]  bet on it you're talking about suing the departments like the sheriff's
[36:59.920 --> 37:08.480]  department or the city PD here in Texas the first agency you would sue will be
[37:08.480 --> 37:19.160]  the Texas Department of Public Safety and its director McCraw okay okay because
[37:19.160 --> 37:24.880]  they are the agency that code itself says is responsible for every chapter in
[37:24.880 --> 37:29.960]  it on enforcement oh I see you saying okay in this case in Wyoming that would
[37:29.960 --> 37:36.880]  be the DOT well no look the transportation code in Texas has three
[37:36.880 --> 37:43.480]  or it where it matters it has two distinct agencies the Department of
[37:43.480 --> 37:47.440]  Motor Vehicles the department which is the Department of Transportation and it
[37:47.440 --> 37:52.720]  has a Department of Public Safety the Department of Public Safety deals with
[37:52.720 --> 37:58.480]  enforcement of certain public safety provisions of the code and the programs
[37:58.480 --> 38:06.040]  associated with public safety okay mm-hmm the DOT does everything else
[38:06.040 --> 38:12.440]  including okay the part the DMV part of it which does vehicle registration i.e.
[38:12.440 --> 38:16.600]  the licensing of the cars versus the licensing of the people which is under
[38:16.600 --> 38:28.640]  DPS okay okay now you would have to sue both of those and before that it was in
[38:28.640 --> 38:33.600]  the county level but either way you would have to sue both of those agencies
[38:33.600 --> 38:38.600]  jointly for fraud and the fraud is that they are misrepresenting to the public
[38:38.600 --> 38:43.680]  the subject matter of the code they're collecting fees and charging fines
[38:43.680 --> 38:51.000]  illegally against people who do not owe them thus they are committing fraud okay
[38:51.000 --> 38:56.440]  so you're going to have to sue for injunctive relief then you can sue
[38:56.440 --> 39:01.840]  separately in the case of fraud if you can prove money damages through the
[39:01.840 --> 39:15.280]  fraud yeah but basically you would have to figure out a way to retroactively
[39:15.280 --> 39:18.840]  claim that they were committing fraud against you the whole time and that you
[39:18.840 --> 39:22.520]  were never in a motor vehicle because you went through all it's just like the
[39:22.520 --> 39:29.080]  income tax stuff you file the W4 and the W9 and the W2 you're in the income tax
[39:29.080 --> 39:37.360]  whether you wanted to be or not end of story right right well here in Wyoming
[39:37.360 --> 39:41.400]  see the way that code is written it's not as clear as Texas and they ought to
[39:41.400 --> 39:49.840]  be sued for avoid for fake well and but go ahead you say that until you figure
[39:49.840 --> 39:54.440]  out that you're not looking in all the right places because I did exactly the
[39:54.440 --> 39:59.320]  same thing when I first started in this I concentrated on one code because I
[39:59.320 --> 40:05.200]  thought everything should be in that one code it isn't not by a long shot is it
[40:05.200 --> 40:14.120]  all in one code okay for every agency that's in a code there is more than
[40:14.120 --> 40:20.080]  likely a section in the occupations code a section in the administrative code a
[40:20.080 --> 40:25.600]  section in the government code or the local government code and possibly a
[40:25.600 --> 40:36.920]  couple of others such as let's see our water code okay there's actually an
[40:36.920 --> 40:43.720]  entity that's in all of those places now go through that again it's occupations
[40:43.720 --> 40:47.320]  code government code what were you other two local government code
[40:47.320 --> 40:56.480]  administrative code as well as the specific code okay for instance DPS is
[40:56.480 --> 40:59.880]  in all of the enforcement chapters of the transportation code it is also
[40:59.880 --> 41:06.600]  entitled 37 of the administrative code it is also relative to occupations for
[41:06.600 --> 41:12.480]  law enforcement under the occupations code it is also relevant to the meaning
[41:12.480 --> 41:20.080]  and interpretation of law under chapter 311 and 312 of the government code okay
[41:20.080 --> 41:25.080]  and then when it comes to local cops there's this chapter or the local
[41:25.080 --> 41:31.160]  government code in addition to the government code okay I think in Wyoming
[41:31.160 --> 41:34.640]  here and I got a research just a little more I think the division that handles
[41:34.640 --> 41:40.400]  the DOT administers and their forces all code but it's certain divisions in the
[41:40.400 --> 41:44.520]  chapters I think it is the department I'm willing to bet you find out that the
[41:44.520 --> 41:49.680]  deep the Department of Public Safety your state police agency does not answer to
[41:49.680 --> 41:59.560]  the Department of Transportation okay so they will be completely separate and
[41:59.560 --> 42:04.520]  independent therefore the code if it gives them authority would have to give
[42:04.520 --> 42:08.160]  it to them directly it wouldn't put them under the Department of Transportation
[42:08.160 --> 42:13.760]  as being answerable to them for that section of that code I've bet money on
[42:13.760 --> 42:21.600]  it okay so you're saying there there's got to be a Department of Public Safety
[42:21.600 --> 42:25.960]  or something else look at the definitions in each chapter for instance go to the
[42:25.960 --> 42:33.440]  chapter on insurance motor vehicle insurance okay find who is defined as
[42:33.440 --> 42:42.040]  department what agency of the state is defined as department same thing with
[42:42.040 --> 42:51.680]  licensing same thing with registration same thing with any chapter
[42:51.680 --> 43:02.320]  mm-hmm okay and all you're looking for is department means or department includes
[43:02.320 --> 43:07.760]  and then in the statute you'll see the department shall the department shall an
[43:07.760 --> 43:12.760]  officer of the department shall blah blah blah a person associated with the
[43:12.760 --> 43:19.320]  department shall it always goes back to the department and it never mentions the
[43:19.320 --> 43:26.280]  specific department Matt it does in the definition that's why you need to know
[43:26.280 --> 43:32.040]  what it is so you know who it's talking about what it says department right

[47:00.720 --> 47:08.840]  that govern for example the whole title 31 of the motor vehicle code can only
[47:08.840 --> 47:14.560]  regulate the only have the constitutional authority regulate carriers for
[47:14.560 --> 47:19.320]  example the the department that created the division of motor vehicles was put
[47:19.320 --> 47:24.480]  under the jurisdiction of the board of equalization and the board of
[47:24.480 --> 47:30.040]  equalization constitutionally can only regulate any kind of common carrier
[47:30.040 --> 47:38.240]  including rail and air so with that being said that proves the subject matter
[47:38.240 --> 47:43.360]  jurisdiction basically of the Department of Motor Vehicles but I haven't got a
[47:43.360 --> 47:48.560]  response back from any of those documents or anything that I filed and I
[47:48.560 --> 47:53.400]  think they're just kind of sitting on them and under protest they still wanted
[47:53.400 --> 47:56.920]  me to come into a hearing and I said well I don't want them I'm not going to
[47:56.920 --> 48:01.520]  make a plea I filed a motion of special appearance and non plea of course
[48:01.520 --> 48:05.360]  challenging the jurisdiction they got all that and the judge was respectfully
[48:05.360 --> 48:10.320]  interested in what he said was we either have jurisdiction we don't and of
[48:10.320 --> 48:14.720]  course he doesn't but then I thought he was going to set things for motion
[48:14.720 --> 48:19.400]  hearings and I got out of the courtroom and when I got to the window that the
[48:19.400 --> 48:25.160]  clerk handed me a notice and order of trial setting so I filed another
[48:25.160 --> 48:29.560]  document to vacate that trial because I said number one I didn't have counsel
[48:29.560 --> 48:33.320]  present and I put them on notice I didn't want any procedural things done or
[48:33.320 --> 48:37.920]  especially trials that without counsel present they still did then I listed in
[48:37.920 --> 48:41.800]  the Supreme Court case where they prejudiced my rights so I think he'll
[48:41.800 --> 48:46.040]  probably answer that and he'll vacate it but the point is we can't get into
[48:46.040 --> 48:49.720]  trials on these things because that'll just discuss merits and they'll rubber
[48:49.720 --> 48:54.640]  stamp it so I want to try to win this out of court since I'm already in it I
[48:54.640 --> 49:00.520]  understand I have to go to further courts to get relieved but how do I stay out of
[49:00.520 --> 49:05.000]  court and get this thing dismissed again you're not going to stop them from
[49:05.000 --> 49:08.600]  going ahead and doing what they're going to do when they won't follow their own
[49:08.600 --> 49:14.920]  rules well all you need to make sure you do is object to any attempt to couch
[49:14.920 --> 49:20.760]  what you were doing as relative to that code by objecting to it make sure you
[49:20.760 --> 49:25.120]  file the be prepared for those objections to know that in advance that
[49:25.120 --> 49:30.560]  they're going to do it prepare a written objection for every single term or phrase
[49:30.560 --> 49:36.280]  in that code they can throw at you operated a motor vehicle objection I
[49:36.280 --> 49:41.960]  was neither an operator nor more nor operating a motor vehicle under the
[49:41.960 --> 49:49.240]  statutes according to the requirements blah blah blah okay right and so you
[49:49.240 --> 49:53.160]  write a written objection the state has introduced no evidence of applicability
[49:53.160 --> 49:57.400]  of this code or this statute by proving I was operating a motor vehicle they
[49:57.400 --> 50:02.920]  simply presume it and they cannot do that in a criminal case they cannot
[50:02.920 --> 50:10.080]  presume any element of the offense to be true it violates your right to be

[01:34:23.560 --> 01:34:30.880]  his accountant to to claim that they would also file you know grievance I
[01:34:30.880 --> 01:34:38.360]  also have phone recordings made of his conversations is there anything that you
[01:34:38.360 --> 01:34:42.840]  would tell me well first thing is make sure you know what the law is in your
[01:34:42.840 --> 01:34:49.080]  state about recording like that because again here in Texas it's a one-party
[01:34:49.080 --> 01:34:53.720]  state requirement only one party to the conversation has to know it's being
[01:34:53.720 --> 01:34:57.720]  recorded they don't have to tell the other party they don't have to they're
[01:34:57.720 --> 01:35:01.840]  not limited to any means of recording but if they're involved in the
[01:35:01.840 --> 01:35:06.080]  conversation only that person has to know about it so make sure that you're
[01:35:06.080 --> 01:35:10.800]  in a one-party state before you ever mentioned anything in writing that you
[01:35:10.800 --> 01:35:16.360]  got recordings okay and then in terms of him being the attorney there's also
[01:35:16.360 --> 01:35:22.440]  attorney client right that with that cross a line well again he's not your
[01:35:22.440 --> 01:35:26.600]  attorney so attorney client doesn't apply to you it applies to whatever client
[01:35:26.600 --> 01:35:30.600]  he's got if you're going after one of his clients if he's who you're going
[01:35:30.600 --> 01:35:42.240]  after who's the client nobody right so yeah so that's what I'm looking at
[01:35:42.240 --> 01:35:50.720]  before I dive into actually creating a an actual complaint lawsuit is to tell him
[01:35:50.720 --> 01:35:56.280]  luckily you know we're gonna you know be doing multiple grievances we're gonna
[01:35:56.280 --> 01:36:00.200]  have multiple people doing multiple grievances yeah just make sure that you
[01:36:00.200 --> 01:36:04.360]  have a sound basis for each grievance and it will become harder and harder to
[01:36:04.360 --> 01:36:11.160]  ignore them when that's the case and then separate them out put language in
[01:36:11.160 --> 01:36:18.560]  there saying that these are not the same etc etc I guess well the language is
[01:36:18.560 --> 01:36:25.320]  going to be relevant to dates times places and events so why would they all
[01:36:25.320 --> 01:36:29.520]  be the same in the first place you can't complain about the same thing 15 times
[01:36:29.520 --> 01:36:33.920]  you only need to complain about one thing once this is the tactic that the
[01:36:33.920 --> 01:36:37.880]  California bar apparently is using is just lumping them all into one complaint
[01:36:37.880 --> 01:36:43.640]  well file them separately and they can't do that well apparently they're doing it
[01:36:43.640 --> 01:36:48.200]  according to well they may they may lump them into one file of complaints
[01:36:48.200 --> 01:36:57.440]  relative to that attorney they may they may even take the the individual items
[01:36:57.440 --> 01:37:01.440]  in your complaint say okay here's the entire body how many of them are the
[01:37:01.440 --> 01:37:04.520]  same how many of them are different if they're all about the same stuff if

[01:37:41.640 --> 01:37:46.680]  legislators or legislators they're the most numerous person in the state
[01:37:46.680 --> 01:37:51.440]  legislature therefore they control it they control the judiciary they have
[01:37:51.440 --> 01:37:56.000]  the major offices in the executive they control the government so I'm betting
[01:37:56.000 --> 01:38:00.800]  there is no black-letter law that would allow you to lock them into such
[01:38:00.800 --> 01:38:07.880]  situations in the first place there may be but you need to look for and find out
[01:38:07.880 --> 01:38:15.920]  then you would still recommend grieving absolutely a record's a record so all I
[01:38:15.920 --> 01:38:19.640]  need to figure out and I guess the only way to get there is to do it is how he's
[01:38:19.640 --> 01:38:24.680]  gonna respond if he you don't care how he responds to a bar grievance there's
[01:38:24.680 --> 01:38:29.040]  nothing he can sue you for in a bar grievance I mean it's the threat of it
[01:38:29.040 --> 01:38:38.120]  because remember we're trying to not okay rule one never threaten just do never

[01:48:20.340 --> 01:48:23.340]  And go to a library and trace it back
[01:48:23.340 --> 01:48:25.340]  To the initial legislative enactment
[01:48:25.340 --> 01:48:27.340]  So I can get a clearer picture
[01:48:27.340 --> 01:48:29.340]  Of what they're actually
[01:48:29.340 --> 01:48:32.340]  Well, remember, the enactment has a history
[01:48:32.340 --> 01:48:36.340]  It's not just the last revision of it, it's got a history
[01:48:36.340 --> 01:48:38.340]  If you really want to truly understand
[01:48:38.340 --> 01:48:42.340]  The purpose of the legislation through its history
[01:48:42.340 --> 01:48:46.340]  You need to see the very first time it was enacted as well
[01:48:46.340 --> 01:48:52.340]  And read what the subject matter of it was intended to be
[01:48:52.340 --> 01:48:54.340]  And how that should have carried forward and everything
[01:48:54.340 --> 01:48:58.340]  Because every state that I'm aware of
[01:48:58.340 --> 01:49:01.340]  Has a provision in their constitution that says
[01:49:01.340 --> 01:49:03.340]  You cannot, it basically says
[01:49:03.340 --> 01:49:07.340]  You cannot amend the law by amending the statute
[01:49:07.340 --> 01:49:11.340]  If you want to change the law to a different subject
[01:49:11.340 --> 01:49:14.340]  Or to encompass something else
[01:49:14.340 --> 01:49:17.340]  Then you have to repeal the existing law
[01:49:17.340 --> 01:49:21.340]  And reenact it with the new subject matter in place
[01:49:21.340 --> 01:49:24.340]  So you need to look and see if that's ever been done
[01:49:24.340 --> 01:49:26.340]  If it's ever changed subject matter
[01:49:26.340 --> 01:49:28.340]  Because if that hasn't happened
[01:49:28.340 --> 01:49:31.340]  Then what it was the very first time it was done
[01:49:31.340 --> 01:49:34.340]  Is what it applies to today
[01:49:34.340 --> 01:49:40.340]  And it cannot change through statutory revision history
[01:49:40.340 --> 01:49:42.340]  For instance, here in Texas
[01:49:42.340 --> 01:49:44.340]  All current revisions of statutes
[01:49:44.340 --> 01:49:50.340]  Are still based upon the same 1925 legislative acts
[01:49:50.340 --> 01:49:54.340]  They just keep expanding them through statutory language
[01:49:54.340 --> 01:49:56.340]  But what they cannot do
[01:49:56.340 --> 01:50:00.340]  Is expand the subject matter reach to go beyond
[01:50:00.340 --> 01:50:05.340]  What the 1925 statutes originally set it up to be
[01:50:05.340 --> 01:50:10.340]  Okay
[01:50:10.340 --> 01:50:13.340]  So with that being said
[01:50:13.340 --> 01:50:17.340]  My first step I would guess is getting down to the law library
[01:50:17.340 --> 01:50:19.340]  Right, the law library will have the actual books
[01:50:19.340 --> 01:50:22.340]  The actual books will have the history keys
[01:50:22.340 --> 01:50:24.340]  The history keys will be what leads you back
[01:50:24.340 --> 01:50:28.340]  Through each successive revision of the book
[01:50:28.340 --> 01:50:31.340]  Which contains the previous version of the law
[01:50:31.340 --> 01:50:34.340]  Which in turn will track you all the way back
[01:50:34.340 --> 01:50:38.340]  To the beginning of that law
[01:50:38.340 --> 01:50:41.340]  And all of that's in code keys
[01:50:41.340 --> 01:50:45.340]  Either in columns in the book next to the statutes
[01:50:45.340 --> 01:50:47.340]  Or underneath the statutes
[01:50:47.340 --> 01:50:50.340]  In a reference section
[01:50:50.340 --> 01:50:53.340]  And so the librarian can explain how it all works
[01:50:53.340 --> 01:50:56.340]  Because they revised that system as well
[01:50:56.340 --> 01:50:58.340]  On how they organized these things
[01:50:58.340 --> 01:51:02.340]  And one code will have it this way during this period of years
[01:51:02.340 --> 01:51:05.340]  And then it'll go and it had it this way
[01:51:05.340 --> 01:51:07.340]  In the previous period of years
[01:51:07.340 --> 01:51:10.340]  So you gotta know how to make those transitions as well
[01:51:10.340 --> 01:51:12.340]  So you can keep following it backwards
[01:51:12.340 --> 01:51:16.340]  But the law library folks here are extremely helpful
[01:51:16.340 --> 01:51:19.340]  In explaining how all that works and showing you
[01:51:19.340 --> 01:51:22.340]  And even actually doing research for you over the phone
[01:51:22.340 --> 01:51:24.340]  And by email
[01:51:24.340 --> 01:51:26.340]  You can send them an email or a phone request
[01:51:26.340 --> 01:51:29.340]  For information about what you need looked up
[01:51:29.340 --> 01:51:31.340]  Or back tracked
[01:51:31.340 --> 01:51:34.340]  And they will usually do it for free
[01:51:34.340 --> 01:51:37.340]  And send you the stuff in an email
[01:51:37.340 --> 01:51:39.340]  Okay
[01:51:39.340 --> 01:51:42.340]  In your experience
[01:51:42.340 --> 01:51:44.340]  Because I have two I can choose from
[01:51:44.340 --> 01:51:46.340]  There's the state and then there's the
[01:51:46.340 --> 01:51:49.340]  I guess the state college that has a law school
[01:51:49.340 --> 01:51:51.340]  What one is usually a better
[01:51:51.340 --> 01:51:54.340]  Well again a law school is not necessary
[01:51:54.340 --> 01:51:57.340]  A fully equipped law library
[01:51:57.340 --> 01:52:00.340]  A state law library will have every legal publication
[01:52:00.340 --> 01:52:02.340]  That's ever been done in the state
[01:52:02.340 --> 01:52:06.340]  A law school may only have a certain subset of that information
[01:52:06.340 --> 01:52:09.340]  But there are no way or unless they are
[01:52:09.340 --> 01:52:11.340]  The law library for the state
[01:52:11.340 --> 01:52:14.340]  Or a federal book repository like SFA
[01:52:14.340 --> 01:52:17.340]  Is in Nacogdoches where I'm from
[01:52:17.340 --> 01:52:20.340]  They are not going to have the entire set of laws
[01:52:20.340 --> 01:52:22.340]  They're only going to have a subset of them
[01:52:22.340 --> 01:52:25.340]  And usually it's going to be the most current
[01:52:25.340 --> 01:52:27.340]  Okay
[01:52:27.340 --> 01:52:30.340]  So you can check with them and see what they have
[01:52:30.340 --> 01:52:32.340]  But most likely you're going to want to find
[01:52:32.340 --> 01:52:34.340]  Your state law library and use them
[01:52:34.340 --> 01:52:36.340]  Because they will be the largest resource base
[01:52:36.340 --> 01:52:39.340]  For all the original books
[01:52:39.340 --> 01:52:41.340]  Okay
[01:52:41.340 --> 01:52:43.340]  And since for example
[01:52:43.340 --> 01:52:46.340]  The title 28 of the Arizona revised statute
[01:52:46.340 --> 01:52:48.340]  You know it's got like 30 chapters
[01:52:48.340 --> 01:52:50.340]  Some of which aren't like
[01:52:50.340 --> 01:52:53.340]  Bonding issues for construction of bridges
[01:52:53.340 --> 01:52:55.340]  And so forth
[01:52:55.340 --> 01:52:58.340]  I should probably focus on the ones that are
[01:52:58.340 --> 01:53:01.340]  Ideally related to motor vehicles and things
[01:53:01.340 --> 01:53:04.340]  But I also know like for example the income tax
[01:53:04.340 --> 01:53:07.340]  Things aren't necessarily categorized
[01:53:07.340 --> 01:53:10.340]  In the way you think they would be
[01:53:10.340 --> 01:53:12.340]  So there could be relevance
[01:53:12.340 --> 01:53:15.340]  Well federal statute is a lot different
[01:53:15.340 --> 01:53:17.340]  Than state statute and how they write it
[01:53:17.340 --> 01:53:19.340]  For instance federal statutes
[01:53:19.340 --> 01:53:22.340]  Intentionally try to hide a lot of stuff
[01:53:22.340 --> 01:53:24.340]  That's why most federal codes
[01:53:24.340 --> 01:53:26.340]  You start reading the code
[01:53:26.340 --> 01:53:28.340]  And there's no definition for the word you're reading
[01:53:28.340 --> 01:53:30.340]  Why?
[01:53:30.340 --> 01:53:32.340]  Because they put the definition somewhere else
[01:53:32.340 --> 01:53:35.340]  Not in the code in the same chapter necessarily
[01:53:35.340 --> 01:53:38.340]  But if they do they almost always put them
[01:53:38.340 --> 01:53:40.340]  At the bottom of the statutory scheme
[01:53:40.340 --> 01:53:42.340]  Rather than at the top
[01:53:42.340 --> 01:53:44.340]  Here in Texas they're all at the top
[01:53:44.340 --> 01:53:46.340]  So you know what the words mean
[01:53:46.340 --> 01:53:48.340]  Before you actually get to the statutes
[01:53:48.340 --> 01:53:50.340]  To start reading them
[01:53:50.340 --> 01:53:52.340]  Now that's not to say that those are the only
[01:53:52.340 --> 01:53:54.340]  Words you need to know
[01:53:54.340 --> 01:53:56.340]  It also doesn't mean that those statutes
[01:53:56.340 --> 01:53:58.340]  Are the only subject
