[00:21.520 --> 00:29.800] $62.47 a barrel, and Crypto is an order of market cap, Bitcoin Core $10,566.52, Ethereum
[00:29.800 --> 00:41.440]  $227.26, XRP Ripple $0.33, Litecoin $100.31, and Bitcoin Cash is at $324.10 a Crypto Coin.
[00:41.440 --> 00:52.560] Jane History the year 1916 the preparedness day bombing a time suitcase bomb was detonated on
[00:52.560 --> 00:58.360] Market Street in San Francisco during the World War I Preparedness Day Parade killing 10 and
[00:58.360 --> 01:07.480] entering 40 today in history and recent news since the Governor Greg Abbott signed House Bill
[01:07.480 --> 01:13.200] 1325 legalizing Hepin attacks his law back in June County prosecutors around the state including
[01:13.200 --> 01:17.920] Houston, Austin and San Antonio have been dropping marijuana possession charges and even refusing
[01:17.920 --> 01:22.360] to file new ones since they are stipulating that they do not have the time or the laboratory
[01:22.360 --> 01:27.240] equipment to test the earth for THC Margaret Moore the Travis County District Attorney
[01:27.240 --> 01:31.280] announced earlier this month that she was dismissing 32 felony possession and delivery
[01:31.280 --> 01:35.960] of marijuana cases because of the law. Mr. Abbott and other state officials including
[01:35.960 --> 01:39.960] the Attorney General stipulated in a letter that County District attorneys back on Thursday
[01:39.960 --> 01:44.560] that marijuana has not been decriminalized in Texas and that these actions demonstrate
[01:44.560 --> 01:50.480] a misunderstanding of how HB 1325 works as well as other cities too like the District
[01:50.480 --> 01:56.680] Attorney in El Paso Kyma Esparza a Democrat who also stated earlier this month that the
[01:56.680 --> 02:02.560] law quote will not have an effect on the prosecution of marijuana cases in El Paso. However the
[02:02.560 --> 02:07.240] issue was succinctly summarized by Mr. Brandon Ball an assistant public defender in Harris
[02:07.240 --> 02:12.040] County who stated that quote the law is constantly changing on what makes something illegal based
[02:12.040 --> 02:16.560] on its chemical makeup. It's important that if someone is charged with something the test
[02:16.560 --> 02:25.240] matches what they're charged with. A paper by Tulane University identified a five and
[02:25.240 --> 02:30.720] a half inch American pocket shark as the first of its kind in the Gulf of Mexico the specimen
[02:30.720 --> 02:36.160] being only the second pocket shark ever captured or recorded with the other one being found
[02:36.160 --> 02:41.200] way back in 1979 in the East Pacific Ocean. According to the university paper the shark
[02:41.200 --> 02:47.640] secretes a luminous fluid from a gland near its front fins for the purposes hypothesized
[02:47.640 --> 02:58.160] to lure and prey who may be drawn into the glow. This is Ruff Rody with your lowdown
[02:58.160 --> 03:26.800] here. I received my remedy today came in the box just like they say I accepted for value
[03:26.800 --> 03:53.280] right away. Okay we are back Randy Kelton. We have a radio on this Friday the 31st day
[03:53.280 --> 04:00.280] of January 2020 and we're talking about beating up a judge. Now beating up a judge is stuff
[04:00.280 --> 04:08.160] I like to do and beating up prosecutors and public officials. However when we do so we
[04:08.160 --> 04:18.520] need to do so with care. We don't want to damage or ruin the reputation of a actual
[04:18.520 --> 04:26.960] honest person if we have one and there are actually some honest judges out there I think
[04:26.960 --> 04:32.240] maybe that's wishful thinking. But I'm not being difficult when you bring these things
[04:32.240 --> 04:41.160] up I'm just taking the devil's advocate I'm taking the defense's side. So where were
[04:41.160 --> 04:49.960] we on this judge when you went out? Well we were talking about a lot of things about
[04:49.960 --> 04:56.200] her different interests and the fact that she got her position potentially through her
[04:56.200 --> 05:02.360] husband being on the board of trustee who was then her boss and you know I'm looking
[05:02.360 --> 05:08.720] at the Illinois canons of judicial conduct and it says a judge like in California and
[05:08.720 --> 05:15.880] therefore should avoid improprietary and the appearance of improprietary in all of the
[05:15.880 --> 05:21.760] judges activities and from what this judge has been doing in the reports on us he's not
[05:21.760 --> 05:33.720] avoiding it at all. Well that we come across a lot and one of the problems we have is that
[05:33.720 --> 05:47.840] we're asking judges to prosecute judges. If we're to get an honest judiciary we're going
[05:47.840 --> 05:56.960] to have to get a separate body to enforce these provisions or these canons of judicial
[05:56.960 --> 06:06.400] ethics. Judges are not going to do it to themselves. If you are a plumber you don't have a bunch
[06:06.400 --> 06:15.720] of plumbers on the licensing board. You may have one or two but primarily it's other people.
[06:15.720 --> 06:23.240] If you're an electrician or a physician you don't have people that are there to protect
[06:23.240 --> 06:29.800] yourself like lawyers. If you're any of these other things you have lawyers. Lawyers and
[06:29.800 --> 06:38.840] judges they're all lawyers and they all protect each other and we have the Fox Garden in-house
[06:38.840 --> 06:44.200] issue here. So the only way we're going to get these judges is we're going to have
[06:44.200 --> 06:59.640] SUM. Does either of you have an issue with this particular judge? No but John knows this
[06:59.640 --> 07:08.520] person who does and a member of his family was found after all this has been seen. Well
[07:08.520 --> 07:17.880] we'll talk about that part another time. So make a long story short there was one person
[07:17.880 --> 07:24.440] that came up in the news and I was just curious because it had to do with the judge. Anyway
[07:24.440 --> 07:33.560] I do have just in general what do you think of that law? Just in general the New York
[07:33.560 --> 07:40.320] State Legislature has passed a law that the bank has approved legal standing before a
[07:40.320 --> 07:45.840] foreclosure could take place. I mean that's long overdue that should have been 200 years
[07:45.840 --> 07:53.440] ago they should have passed that. Yes it should have. They waited until this whole monstrous
[07:53.440 --> 08:02.280] mess was over until the banks had completely decimated a generation and then they passed
[08:02.280 --> 08:07.640] this law. Well what will happen is something similar to what happened in this case. After
[08:07.640 --> 08:17.040] the Depression in 1929 they passed the Glass-Steagall Act and the prohibition against the derivatives.
[08:17.040 --> 08:26.280] Yep and then something like in 1999 they removed those two provisions and allowed all this
[08:26.280 --> 08:37.680] stuff to happen. After everybody's been okay you can't talk when I'm talking. After this
[08:37.680 --> 08:45.400] crash after the banks stole everybody's property then they put these laws back in place. If
[08:45.400 --> 08:50.800] they ever removed these look at the provisions that are there to protect you if they're ever
[08:50.800 --> 08:58.400] removed then the banks are running the scam on you again. The banks are the greatest evil
[08:58.400 --> 09:08.880] out there. Jesus Christ went around the Holy Land preaching what the Pharisees construed
[09:08.880 --> 09:19.120] as heresy and Saul from Tarsus went to the Pharisees and asked them, I'm sorry it wasn't
[09:19.120 --> 09:23.840] Saul, someone else Saul was already, Jesus was dead when he came on. Oh Saul asked the
[09:23.840 --> 09:32.280] Pharisees to crucify Peter and John and James and they said we don't care what they're doing
[09:32.280 --> 09:38.120] they're not bothering anybody. Jesus was preaching all this heresy and they didn't care. He's
[09:38.120 --> 09:43.760] not bothering anybody. He didn't get in trouble until he went into the temple and kicked over
[09:43.760 --> 09:49.400] the tables the money changers. They're away from the bankers. They're the baddest guys
[09:49.400 --> 10:01.920] out there. Watch the bankers. I'm looking for distributed web and crypto technologies
[10:01.920 --> 10:11.480] and cryptocurrencies to essentially eliminate the dominance of the bank in currencies and
[10:11.480 --> 10:19.680] finances. Take it out of their hands. Until we do that they're going to do what they've
[10:19.680 --> 10:26.960] been doing since the Templars brought the treasure back from the Holy Land. This part
[10:26.960 --> 10:36.960] makes some people crazy and this is my position on the subject. It is rumored, it is legend
[10:36.960 --> 10:43.320] that the Templars found a treasure under the Temple Mount at the Holy Land and the Holy
[10:43.320 --> 10:51.600] Land in Jerusalem. I suggest they did no such thing. They found a treasure and they brought
[10:51.600 --> 10:56.320] a treasure back with them but they didn't dig it up under the Temple Mount. What they
[10:56.320 --> 11:02.280] brought back with them was the Jewish banking system. In the Jewish banking system and you
[11:02.280 --> 11:11.240] can't sell property. You can only lease it for 49 years and at the Jubilee all the property
[11:11.240 --> 11:17.080] goes back to the original owners and they start all over again. That's what the Templars
[11:17.080 --> 11:24.600] brought back. They brought back a banking system where they set up loans for people to purchase
[11:24.600 --> 11:32.280] property and in every 40, every 50 years they precipitate an economic crash and take all,
[11:32.280 --> 11:36.600] just before the properties are all paid off and they take it all back and sell it to the
[11:36.600 --> 11:43.840] grandkids. Look back through history. Since records were taken, there's been an economic
[11:43.840 --> 11:53.880] crash approximately every 50 years. Look at the crash of 29. It was carefully engineered
[11:53.880 --> 12:01.160] and done with naked short selling. Prohibitions were put in place to make it criminal to do
[12:01.160 --> 12:12.160] naked short selling. They removed that prohibition in 2007. In July, in August, they used naked
[12:12.160 --> 12:20.520] short selling to bankrupt Sherson Lehman and cause a crash in 2008. It was very carefully
[12:20.520 --> 12:30.080] crafted by the banks. They are the biggest scoundrels out there. That's my story and
[12:30.080 --> 12:41.160] I'm sticking to it. Thank you. The Templars, using that process, became the richest group
[12:41.160 --> 12:47.120] in Europe and they got too rich so the king and the pope needed their money so they killed
[12:47.120 --> 12:57.680] them all. Then the pope and the king re-instituted the same system through the banks. Now we
[12:57.680 --> 13:04.200] have all the large banks that grew out of that money that the Templars collected and
[13:04.200 --> 13:08.480] I forget what the king was that got together with the pope and stole it from them. They
[13:08.480 --> 13:14.240] started the whole routine and created a set of major banks and major money holders that
[13:14.240 --> 13:20.280] have been running the financial system in the background ever since the Bilderbergs,
[13:20.280 --> 13:28.600] the Rothschilds, what's the royal family in England? I forget their name. They've been
[13:28.600 --> 13:39.880] behind. Let's say that again. I am sorry John, you are breaking up so bad we can't understand
[13:39.880 --> 13:52.760] you at all. Are you talking about Windsor's? Windsor's? No. In England? The royal family?
[13:52.760 --> 14:01.800] No? I'm only getting every third of the syllable from you. Oh, okay. Anyway, who it is, it's
[14:01.800 --> 14:09.840] not important. It's not his time on but there is a group of big money interests that's
[14:09.840 --> 14:19.800] been behind everything. All of the governments are essentially in-hoc to all of these guys
[14:19.800 --> 14:26.760] and they control the economy and they precipitate these economic crashes on a regular basis
[14:26.760 --> 14:32.960] until we get the money out of their hands. This is not going to stop and I'm looking
[14:32.960 --> 14:42.640] at technology to help distribute funds around the world so that a few small groups don't
[14:42.640 --> 14:50.000] get to control them. But then again, if you broke up all the money and spread it out amongst
[14:50.000 --> 14:57.280] all the people, it would wind up in the same hands. So this is not a battle we're going
[14:57.280 --> 15:03.920] to win. It's not a war we're going to win, we'll just win some battles in the meantime.
[15:03.920 --> 15:11.360] It's a cycle we'll keep going through because it's the nature of the human animal. Randy?
[15:11.360 --> 15:20.000] Is that depressing enough? Yes. Oh, yes it is. Yes it is. Randy, can you hear me? Yes.
[15:20.000 --> 15:27.280] Cyber currency, what do you call it? Cryptocurrencies? Do you think that they'll do the same thing
[15:27.280 --> 15:37.200] with the crypto coins that they did with the Depression of 1929? That's a problem that
[15:37.200 --> 15:49.520] they have. Cryptocurrencies are being established by groups that are not part of the old guard.
[15:49.520 --> 15:55.680] Cryptocurrencies can be spread around and they cannot be controlled the way fiat currencies
[15:55.680 --> 16:05.480] can. So will these groups go away? Absolutely not. But there will be alternatives and a much
[16:05.480 --> 16:17.360] more pressure on them to mitigate their negative effect. That's my opinion. What? What I mean?
[16:17.360 --> 16:22.000] That's from somebody who doesn't know what he's talking about because this is not my
[16:22.000 --> 16:30.440] area. Well, you and I both know and Gina knows enough about the 29 crash that it was engineered.
[16:30.440 --> 16:37.760] We know that. Do you think that they can somehow engineer the cryptocurrency? Do the same thing
[16:37.760 --> 16:46.240] they did in 29. Everybody's riding high on the stock market. Of course, they did that
[16:46.240 --> 16:56.640] in 2017. The SEC did that. You know what I mean? Munchy. Munchy was the case that broke
[16:56.640 --> 17:08.440] the cryptocurrencies back. It's the 2019 Logos Radio Network annual fundraiser and gun giveaway

[18:09.040 --> 18:13.160] society, then we're going to have to stand and defend our own rights. Among those rights
[18:13.160 --> 18:16.360] are the right to travel freely from place to place, the right to act in our own private

[19:24.160 --> 19:31.160]  That's all I mean, my friend.
[19:55.160 --> 20:01.760] Okay, we are back. Randy Kelton, RuleofLawRadio. I really need to move out of this. I'm doing
[20:01.760 --> 20:07.720] a show on legal reform and I'm talking about stuff I don't know anything about. I'm just
[20:07.720 --> 20:15.600] giving my opinion and it has no support in facts or knowledge. I feel uncomfortable speaking
[20:15.600 --> 20:26.600] about things I know nothing about. We need to go back to law. Do you have something on
[20:26.600 --> 20:33.720] law and not the banking system? I think we all agree the banking system is corrupt.
[20:33.720 --> 20:37.760] How about this? Are you interested in this? I'll brief just one minute and I'll tell you
[20:37.760 --> 20:43.200] and then you tell me if you're interested. There was an update on a story that in Ten
[20:43.200 --> 20:49.200] Yan there's a boy. I'll start out. New York State Supreme Court judge Dan Doyle signed
[20:49.200 --> 20:58.200] an order ordering a boy named Soren Schwartz back to school at Monroe One Boses in Fairport,
[20:58.200 --> 21:05.040] New York. Schwartz lives in Ten Yan. The boy has severe autism and he was banned from
[21:05.040 --> 21:11.040] his school in September of 2019 because the school doctor denied his medical exemption
[21:11.040 --> 21:16.920] from vaccines under the emergency regulation set by the New York State Department of Health
[21:16.920 --> 21:22.720] in August of 2019. I guess there was a measles outbreak and the legislature in New York responded
[21:22.720 --> 21:31.960] to it and denied medical exemptions as a reason for not taking vaccines. Since then he had
[21:31.960 --> 21:36.520] been attending school for three years with a medical exemption and now the New York State
[21:36.520 --> 21:45.000] legislature no longer recognizes it and the judge, Dan Doyle, signed a paper that said
[21:45.000 --> 21:53.240] you better send the boy back to school as immediate as practical and now they're considering
[21:53.240 --> 22:00.200] whether or not that's going to have any weight with the rest of the number of students that
[22:00.200 --> 22:06.960] have been banned from schools because of their refusal to take vaccines based on medical
[22:06.960 --> 22:14.080] exemptions which now the state no longer honors. But Judge Doyle seems to be moving back in
[22:14.080 --> 22:21.760] the direction of individual rights for the individual, individual rights for the individual.
[22:21.760 --> 22:25.480] But anyway, it's redundant. But you know what I mean.
[22:25.480 --> 22:35.760] One of those issues that make me glad that I am not a judge, this is one of those issues
[22:35.760 --> 22:48.640] that make me glad I'm not a judge. How do we find a middle ground here? We have children
[22:48.640 --> 22:56.840] were sending to schools and schools are just filled with all sorts of contaminants. My
[22:56.840 --> 23:06.240] kids used to bring me presents home from school. The flu, head lice, all kind of cool stuff.
[23:06.240 --> 23:14.320] Now we're looking at a measles outbreak that could cause the death of your children. How
[23:14.320 --> 23:20.480] many children are we willing to sacrifice to make sure that this person who can't be
[23:20.480 --> 23:27.760] vaccinated doesn't catch the disease and spread it amongst our kids and kill some of them?
[23:27.760 --> 23:32.720]  Well there's several who's rights are more fundamental.
[23:32.720 --> 23:40.760] I could get into it from a medical standpoint but as far as measles, not enough of people
[23:40.760 --> 23:44.840] die from measles. In fact, more people die from measles.
[23:44.840 --> 23:50.000] Okay, not only one in six die from rushing relit.
[23:50.000 --> 23:57.760] Well, yeah, but one in six is not measles. Most of the diseases, I'm just going to say
[23:57.760 --> 24:01.320] one sentence and then we'll get off to subject.
[24:01.320 --> 24:08.280] How many chances are you willing to take with your children's life? How many chances are
[24:08.280 --> 24:11.000] you willing to take that could be prevented?
[24:11.000 --> 24:16.400] Well, that's the whole idea about not getting a vaccine because they've been proven not
[24:16.400 --> 24:17.400]  to be safe.
[24:17.400 --> 24:18.400]  The United Nations...
[24:18.400 --> 24:19.400]  Different arguments.
[24:19.400 --> 24:27.760] Different arguments. Let's not jump to relevant arguments as to this issue. We have a child
[24:27.760 --> 24:35.480] here who can't take this vaccine for whatever reason. And we have all of these children
[24:35.480 --> 24:40.800] in the school who've taken the vaccine and even if you have the vaccine it doesn't mean
[24:40.800 --> 24:49.400] you're protected. And they're reluctant to risk being contaminated even though the risk
[24:49.400 --> 24:59.800] is small. Who has rights here? If someone has tuberculosis, can we ban them from the
[24:59.800 --> 25:00.800]  school?
[25:00.800 --> 25:11.880] Granted, the person who has tuberculosis didn't do anything wrong. They didn't go out and
[25:11.880 --> 25:20.640] get tuberculosis. It's a role of the dice. But do we risk our children? How do we find
[25:20.640 --> 25:22.280]  this balance?
[25:22.280 --> 25:27.800] Well, number one, if the vaccine's really worked then you wouldn't be afraid of one
[25:27.800 --> 25:29.480] or two children that didn't get the vaccine.
[25:29.480 --> 25:34.280] Different argument. Different argument. Different argument. Don't do that. One argument at
[25:34.280 --> 25:39.240] a time. You can throw 10,000 arguments to me. One after the other after the other after
[25:39.240 --> 25:45.600] the other after the other. This is what I get a lot of these patriot mythologists. That's
[25:45.600 --> 25:52.040] what they do. They throw some crazy stuff at you. You argue that issue and they say,
[25:52.040 --> 25:56.720] well, what about this? And you argue that one. What about this? We're talking about one
[25:56.720 --> 26:05.760] issue here. How do we find a balance for those parents who are sending their kids to school
[26:05.760 --> 26:08.200]  and don't want them to die?
[26:08.200 --> 26:15.080] And this other parent who has a child with a disability and can't give them this vaccine,
[26:15.080 --> 26:21.280] but the child has a right to an education, has a right to a fair education and the irractured
[26:21.280 --> 26:27.000] other kids. Where do we strike a balance here?
[26:27.000 --> 26:31.720] Well, you said something about, yeah, I heard you say the word die. Now, die from what?
[26:31.720 --> 26:33.720]  Die from what?
[26:33.720 --> 26:35.720]  You're dodging the question.
[26:35.720 --> 26:38.520] No, no, no, no, no, no. But you said die.
[26:38.520 --> 26:47.840] You are dodging the question. It doesn't matter what you die from. If you die, you're dead.
[26:47.840 --> 26:59.800] Who cares? If someone brings a potential for death, how much risk do we have to take to
[26:59.800 --> 27:07.640] make sure that person's rights are protected when that person is not guilty of anything?
[27:07.640 --> 27:10.800] I'll answer the question if you tell me what they're dying from.
[27:10.800 --> 27:13.400] Oh, okay. We're not going to go.
[27:13.400 --> 27:14.600] We need to know what they're dying from.
[27:14.600 --> 27:20.000] You're dying from something. Then you're going to go off into some other
[27:20.000 --> 27:29.680] argument. We can't find an answer to an issue if you insist on changing the rules. Every
[27:29.680 --> 27:36.880] time something said, this is my biggest frustration when I'm dealing with these patriot mythologists.
[27:36.880 --> 27:44.120] No matter what you say, you can't propose a legal issue in order to, rather than address
[27:44.120 --> 27:48.600] a difficult issue, you want to change the issue into something else.
[27:48.600 --> 27:54.680] So which is worse, to die from a pistol or a shotgun?
[27:54.680 --> 28:11.880] I'm saying that the student can die from measles, hooping cough, diphtheria, cholera.
[28:11.880 --> 28:21.040] You are trying to force this into a separate issue, so you don't have to address the hard
[28:21.040 --> 28:32.840] question of when does someone have a right that may jeopardize the rights of someone
[28:32.840 --> 28:34.640]  else?
[28:34.640 --> 28:39.840] This has always been a really hard issue to address.
[28:39.840 --> 28:45.560] In a case like this, we have this child who has done nothing wrong, who's done nothing
[28:45.560 --> 28:53.320] to give the reason to lose their rights. The child has a right to go to a public school.
[28:53.320 --> 29:00.480] But I also have a right to protect my children.
[29:00.480 --> 29:07.680]  How do we find a balance?
[29:07.680 --> 29:14.160] Do we say, okay, the child has a right to go to school, but he does not necessarily
[29:14.160 --> 29:21.320] have a right to go to this particular school that would create an unreasonable risk.
[29:21.320 --> 29:31.520] He can exercise that right by going to a private school or a school geared toward this issue.
[29:31.520 --> 29:38.520] How do we find a solution that balances everybody's rights?
[29:38.520 --> 29:48.960] I could answer that, but I know it's a hard question. That was the whole point. It's
[29:48.960 --> 29:49.960]  difficult.
[29:49.960 --> 29:51.920] Hang on. Go into break.
[29:51.920 --> 29:55.360] Hold on. Go into break. Rain to kill him.
[29:55.360 --> 30:02.360] We have a lot of radio. We'll be right back.
[30:02.360 --> 30:08.960] Keep your voice down. The government now has Russian technology that matches identities
[30:08.960 --> 30:14.320] to voices so it can tell who's doing the talking. I'm Dr. Katherine Albrecht. Back to tell you
[30:14.320 --> 30:16.960] how it works after this.
[30:16.960 --> 30:21.480] Privacy is under attack. When you give up data about yourself, you'll never get it back
[30:21.480 --> 30:27.280] again. And once your privacy is gone, you'll find your freedoms will start to vanish too.
[30:27.280 --> 30:33.520] So protect your rights. Say no to surveillance and keep your information to yourself. Privacy,
[30:33.520 --> 30:38.840] it's worth hanging onto. This message is brought to you by StartPage.com, the private search
[30:38.840 --> 30:46.160] engine alternative to Google, Yahoo, and Bing. Start over with StartPage.
[30:46.160 --> 30:50.880] Since 2001, when the Patriot Act opened the doors to electronic surveillance, Big Brother
[30:50.880 --> 30:56.840] has gone crazy vacuuming up all of our data. Now it has a new tactic, courtesy of our former
[30:56.840 --> 31:02.920] Communist allies, the Russians. It's called voice grid nation, and it analyzes and identifies
[31:02.920 --> 31:08.400] voices courtesy of Russia's speech technology center. When authorities intercept a call,
[31:08.400 --> 31:13.000] the speaker's voice is compared to millions of others, like a fingerprint. How long does
[31:13.000 --> 31:15.800] it take for a match? Three seconds.
[31:15.800 --> 31:20.440] So watch what you say on the phone, comrades. Whether you say your name or not, Big Brother
[31:20.440 --> 31:25.720]  may know who's talking. I'm Dr. Catherine Albrecht for StartPage.com, the world's most
[31:25.720 --> 31:31.400]  private search engine.
[31:31.400 --> 31:36.800] I lost my son. My nephew. My uncle. My uncle. On September 11th, 2001. Most people don't
[31:36.800 --> 31:42.560]  know that a third tower fell on September 11th. World Trade Center 7, a 47-story skyscraper,
[31:42.560 --> 31:47.120] was not hit by a plane. Although the official explanation is that fire brought down building
[31:47.120 --> 31:52.080] 7, over 1,200 architects and engineers, has looked into the evidence, and believed there
[31:52.080 --> 31:57.420] is more to the story. Bring justice to my son. My uncle. My nephew. My son. Go to building
[31:57.420 --> 32:02.040] what.org. Why it fell, why it matters, as what you can do.
[32:02.040 --> 32:07.400] Logos Radio Network welcomes a new show to our lineup for the new year. Scripture Talk
[32:07.400 --> 32:13.520] with Nana will begin Wednesday, January 8th, from 8 to 10 p.m. Central Time. Our goal is
[32:13.520 --> 32:18.920] in accord with Matthew 516. Let your light so shine before men that they may see your
[32:18.920 --> 32:24.440] good works and glorify your Father which is in heaven. We wish to reflect God's light
[32:24.440 --> 32:29.680] and be a blessing to all those with a hearing ear. Join Nana and guests for both verse by
[32:29.680 --> 32:36.160] verse Bible studies and topical Bible studies designed to provoke unto love and good works.
[32:36.160 --> 32:40.560] Our verse by verse Bible studies will begin in the book of Matthew, where we will discuss
[32:40.560 --> 32:46.280] one chapter per week. Our topical Bible studies will vary each week and will explore sound
[32:46.280 --> 32:52.040] doctrine as well as Christian character development. So mark your calendar and join us live on
[32:52.040 --> 32:58.800]  LogosRadioNetwork.com Wednesdays from 8 to 10 p.m. starting January 8th for an inspiring
[32:58.800 --> 33:26.120] and motivating discussion on the Scriptures. Well, I didn't do that right. Okay, I hit
[33:26.120 --> 33:31.360] the button too soon. Okay, I think we are back. John, are you there?
[33:31.360 --> 33:37.640] Yep, I'm here. Now, I assume you really want to be answered a question, but it's a very
[33:37.640 --> 33:40.240] lengthy discussion, so I'm going to do the next best thing.
[33:40.240 --> 33:46.360] No, we're not going to go to a lengthy discussion. I'm going to explain why I was doing that.
[33:46.360 --> 34:00.520] This is a show about law, and I was just talking to Tim Pexver, and he started out not knowing
[34:00.520 --> 34:07.000] anything about law or how to argue legal issues. He's getting much better, but we had an issue
[34:07.000 --> 34:15.400] today where we're talking about a specific legal point, and in the middle of a sentence
[34:15.400 --> 34:22.200] he shifted to another legal point. In court, this will get you in a lot of trouble. It'll
[34:22.200 --> 34:31.800] get all your arguments tossed out. If you're speaking to one issue, speak clearly and specifically
[34:31.800 --> 34:39.040] to that issue. Do not introduce another issue until you have addressed the issue you're
[34:39.040 --> 34:47.840] speaking to. John, when I asked you about this particular issue, you asked about an
[34:47.840 --> 34:54.920] irrelevant fact that did not go to either one of the issues which would have pulled the
[34:54.920 --> 35:01.680] discussion away from what we were talking about, and you were absolutely insistent that
[35:01.680 --> 35:06.880] we had to go to some irrelevant issue. If you're going to argue any kind of legal issues,
[35:06.880 --> 35:15.160] you have to fix this. One issue at a time. Do not let your arguments stray to different
[35:15.160 --> 35:26.120] issues unless you say, in this case, we believe this is what we would do, and then we can
[35:26.120 --> 35:31.600] add a variable and say, in this other case, this is what we can do, but if you stitch
[35:31.600 --> 35:43.240] the two together, you lose them both. In my legal 101, where I have a dissertation on
[35:43.240 --> 35:50.640] how to write legal documents, I suggest that when you're writing a legal document, put
[35:50.640 --> 36:01.480] a heading on every paragraph. Then when you write to that paragraph, make sure you stay
[36:01.480 --> 36:08.880] true to the heading. If anyone here has read legal documents, you'll see this huge document
[36:08.880 --> 36:13.840] with paragraph after paragraph after paragraph after paragraph. Sometimes I've seen paragraphs
[36:13.840 --> 36:19.840] a half a page long. No human being can read that garbage, and in there, they go from one
[36:19.840 --> 36:27.160] subject to another to another to another, all in one paragraph. I have read documents
[36:27.160 --> 36:33.040] where I've read them four or five times and still could not get them sorted out. Tim's
[36:33.040 --> 36:38.120] reading these documents and he's saying that he has to read them over and over to make
[36:38.120 --> 36:44.560] sense of them, and that's because these lawyers do not exercise discipline in writing their
[36:44.560 --> 36:56.760] documents. If you read court opinions, you will find that they are very strict about
[36:56.760 --> 37:04.240] addressing a single issue at one time. They never let their issues drift from one point
[37:04.240 --> 37:10.520] to a different point. I suspect that when they write those documents, they put a heading
[37:10.520 --> 37:16.440] on every paragraph. Then when they're done, you can take those headings out, but put them
[37:16.440 --> 37:23.360] in there anyway to keep you focused. This whole thing with John was about how do we
[37:23.360 --> 37:29.080] focus on one issue without drifting away from it. That's why I spent so much time on it.
[37:29.080 --> 37:44.040] Okay, John, you asked the question, what right did this child have? I don't know. They were
[37:44.040 --> 37:56.760] afraid he would spread measles and start an epidemic. Was that a reasonable fear? On the
[37:56.760 --> 38:03.000] part of the... John, we're losing. Whose part though? Okay, you had to start over. We lost
[38:03.000 --> 38:13.960] everything. We just started again. What right does this child have? He can't take the measles
[38:13.960 --> 38:21.480] virus, so he could three, four or five months from now contract the measles virus and bring
[38:21.480 --> 38:29.520] it into school and put all the children's life at jeopardy. Maybe only one of the children
[38:29.520 --> 38:38.000] and the whole school might die from it. Is that an acceptable risk? No, because measles
[38:38.000 --> 38:43.240] very generally doesn't kill anybody. That happens in certain world countries. You have
[38:43.240 --> 38:47.240] to deal with the whole facts. You just can't throw something out there and say, well, these
[38:47.240 --> 38:53.120] other children could die. Well, if you look at the death rate for measles, not a lot of
[38:53.120 --> 39:00.120] people have died from it. This is not... See, you're doing that, John. You insist on bringing
[39:00.120 --> 39:06.360] in an irrelevant argument. That was not your original question. You changed it. It's not
[39:06.360 --> 39:12.120] irrelevant. And you absolutely refuse to go back to the original question. Okay, the original
[39:12.120 --> 39:21.720] question is, do not ever try to argue with court. You will lose. You can't stay on a
[39:21.720 --> 39:26.760] subject. You have to move it to a subject you're more comfortable with. It's easier
[39:26.760 --> 39:33.520] for you to argue. Well, you don't get it. That will cause you to lose. The whole point.
[39:33.520 --> 39:40.760] I get it that measles is not diphtheria. I got that, but that wasn't the question we were
[39:40.760 --> 39:47.240] asking. You insist on changing the question to something else. Well, you're implying that
[39:47.240 --> 39:58.040] measles... Your original question. John, your question was, what right does this child have?
[39:58.040 --> 40:04.160] I asked that question. That was the question. And now you've moved away from it. Okay, we're
[40:04.160 --> 40:13.040] going to stop here. I'm getting really annoyed. So am I. I don't care about measles. I do
[40:13.040 --> 40:22.120] not care about measles. Okay, I got that. I also don't want to say that because there's
[40:22.120 --> 40:27.440] things that... This isn't just a legal issue. There's things about it you don't understand.
[40:27.440 --> 40:33.240] Don't... You're not talking about science. We're not talking about all those issues.
[40:33.240 --> 40:42.520] I know how to argue properly. You asked the legal question and then you drew it to something
[40:42.520 --> 40:53.160] else and you won't come back. That frustrates me. There's no way we can have a succinct
[40:53.160 --> 40:58.200] discussion because we'll keep moving from one issue to the next, to the next, to the
[40:58.200 --> 41:03.200] next, to the next. No discipline here. That's okay. I understand. I get it. I get it. I
[41:03.200 --> 41:11.600] stopped. I get it. Okay. Okay, I'm going to move ahead. We've got more callers and you're
[41:11.600 --> 41:18.560] annoying me, John. Well, I'm sorry. If you want to hear the rest of it, I'll tell you
[41:18.560 --> 41:24.800] sometime, but I don't think you want to hear it. Okay, well, measles wasn't my issue and
[41:24.800 --> 41:30.160] we thought we'd got rid of measles, but it made a little comeback. And I agree. There
[41:30.160 --> 41:38.920] was a huge hullabaloo over measles. Actually, my twin and I nearly died of German measles
[41:38.920 --> 41:45.040] when I was five. I had German measles. I know. I had them. They're nasty. Yeah, they nearly
[41:45.040 --> 41:52.360] killed us. So it does have its... People are afraid of it with good reason. So let's not
[41:52.360 --> 41:59.160] go back to that. I need to move along. I know. I got more callers. I get it. Okay. We've
[41:59.160 --> 42:06.840] only got an hour left. Okay. Now I'm annoyed, John. We'll talk next week. Okay. Thank you,
[42:06.840 --> 42:19.760] John. Now I'm going to go to David in Texas. Hello, David. Hello, Randy. Hello. I am here.
[42:19.760 --> 42:30.640] What do you have for us today? Oh, yeah. I have this case. Hold on. Hold on. Hold on.
[42:30.640 --> 42:44.040] Are you on a Bluetooth or speakerphone? Either that or you have your head in the toilet. You've
[42:44.040 --> 42:50.040] got a real... When you're on a Bluetooth or speakerphone, it gives it a real hollow sound.
[42:50.040 --> 42:58.600] Can you hear me now? Yeah, you still sound like you got your head in the bucket.
[42:58.600 --> 43:05.280] Well, can I ask you this? I got a... Okay, go ahead.
[43:05.280 --> 43:14.400] Yeah, a photo lost it. They sent it back. They said that they didn't file a photo of rule 8,
[43:14.400 --> 43:20.600] and they're going to just miss it. Wait a minute. Wait. Hold on, David. I cannot
[43:20.600 --> 43:30.800] understand you. You wanted to... Are you on a regular phone? Oh, no. The other thing I have here
[43:30.800 --> 43:39.320] is something on the phone. Okay. Try hanging up and calling back. Maybe we'll get a better connection.
[43:39.320 --> 43:52.720] Okay. And now we're going to go to Tamara in Colorado. Hello, Tamara. Hello, Randy. How's it going?
[43:52.720 --> 44:02.560] Gotcha. Okay. And I can actually understand you. Are you being harassed by debt collectors with

[46:27.200 --> 46:32.160] Okay, we are back. Randy Kelton, rule of law radio, and kind of ran off the cliff there,
[46:33.120 --> 46:41.920] and we're talking to Tamara in Colorado. Okay, Tamara, what do you have for us tonight?
[46:43.200 --> 46:47.440] I went to the hearing, and the judge did not dismiss the case.
[46:47.440 --> 46:55.920] Okay, I thought about that later, and I had some questions. Did he deny your motion?
[46:57.360 --> 47:01.920] No, he did not deny my motion. He set the hearing.
[47:03.600 --> 47:07.920] Why did he deny your motion? Pardon?
[47:10.320 --> 47:13.040] Why did he say why he denied your motion?
[47:13.040 --> 47:18.720] He has not denied it. He just won't rule on it at all yet.
[47:19.920 --> 47:24.000] He wants me to get a public defender, which I do not want to do.
[47:24.000 --> 47:30.880] Oh, okay. So, okay, the reason I ask that is you just filed this motion this day.
[47:31.680 --> 47:36.240] Normally, a motion has to be filed at least seven days before a hearing,
[47:36.240 --> 47:46.080] and this hearing was not set to hear motions.
[47:48.240 --> 47:51.600] You gave no indication that there were any motions before the court.
[47:53.760 --> 47:59.040] So, there's a number of reasons to have hearings. One of them is for an arraignment.
[47:59.040 --> 48:04.640] Did they ask you how you please? No.
[48:07.040 --> 48:13.680] Okay, let me take a step back. Is this your first time? Great. Hold on, Tamara.
[48:18.640 --> 48:24.720] Wow, I missed my mute button. Sorry about that. Tamara, we have a suppressor on the system.
[48:24.720 --> 48:30.480] So, if I'm talking and you try to talk, it pushes you down under me,
[48:31.120 --> 48:36.080] and I can't necessarily hear you. I just, every once in a while, I might hear a word or two.
[48:36.080 --> 48:43.040] So, let's try to be careful not talking over each other. Okay, question. Was this
[48:44.640 --> 48:48.400] was this your first time before the court?
[48:48.400 --> 48:54.960]  Yes, technically. Okay.
[48:57.200 --> 49:00.160] And the court did not ask you for a plea?
[49:02.560 --> 49:10.720] No. The hearing that I first had on Tuesday was in a hearing. I just watched a video about our
[49:10.720 --> 49:18.160] rights. And then today would have been, and so on that day, Tuesday, is when I filed my motion to
[49:18.160 --> 49:27.040] dismiss. And today was the first hearing, and I just wanted to hear the court's ruling on that.
[49:27.040 --> 49:33.760] Stop, stop, stop, stop, stop, stop. I'm trying to get some specific details on point of law.
[49:33.760 --> 49:42.960] Generally, I'm not intimately familiar with Colorado law, but from the times I spent in Colorado
[49:42.960 --> 49:50.880] and looked at it, it's essentially the same. When someone is accused, and in this case,
[49:50.880 --> 49:58.480] where you were indicted, is that correct? I don't know if that's what you call it or not.
[49:58.480 --> 50:09.920] Just charges us. Okay, you have a basic problem here. You're trying to represent your stuff.
[50:12.240 --> 50:17.280] And you don't know anything. Were you actually charged with anything?
[50:19.840 --> 50:24.720] Well, Randy, you've got all the documents. You've seen them all. So, yeah.
[50:24.720 --> 50:34.560] Yeah, I did not. I didn't go through all of them. Oh, you have to know the answers to the questions
[50:34.560 --> 50:44.400] I'm asking you. Were you indicted? Is there an indictment? If you're talking about your charge,
[50:44.400 --> 51:02.080] I'm talking about an indictment before a grand jury. Grand jury? No? Yes. Do you have grand
[51:02.080 --> 51:14.160] juries in Colorado? Okay. I'm pretty sure you have grand juries in Colorado. In order for
[51:14.160 --> 51:29.040] there to be a case, let's see, Colorado. Let's see, what is a grand jury in Colorado? You have
[51:29.040 --> 51:37.280] grand juries, grand juries and indictments. Generally, in the case of misdemeanors, the
[51:37.280 --> 51:48.560] misdemeanor can be prosecuted on the complaint itself. But generally, a felony must be presented
[51:48.560 --> 51:55.120] to a grand jury and a grand jury must bring an indictment. There must be a criminal complaint.
[51:56.720 --> 52:04.240] A criminal complaint can be filed and based on the criminal complaint, a magistrate can issue
[52:04.240 --> 52:15.040] a warrant for your arrest. And then, were you arrested on this issue? Yes, sir. January 7th.
[52:15.040 --> 52:25.200] Okay. Okay. So, you were arrested based on a warrant? Was the warrant issued subsequent to
[52:25.200 --> 52:37.840] an indictment? No. Okay. Is there a criminal affidavit in the record that states facts in
[52:37.840 --> 52:51.840] support of a claim against you? Yes. What does it say? It reiterates the owner of the vehicle
[52:51.840 --> 53:00.320] affidavit or police statement stating that I did not return his vehicle when he told me to.
[53:04.080 --> 53:18.000] It says that? Oh. That's what they're saying. Crazy. Oh. Okay. Then, unless the law is incredibly
[53:18.000 --> 53:34.000] different in Colorado, that's a civil issue then. What statute did they allegedly violate it?
[53:34.000 --> 53:45.920] Aggravated motor vehicle theft. Give me a number. That's just a bunch of words.
[53:45.920 --> 54:03.920] Well, hold on here. Pulling it out. All right. And I'm wondering why it's aggravated.
[54:03.920 --> 54:21.600]  I'm sorry. I'm sitting in a vehicle. I'm doing the best I can, yes. 18-4-409.
[54:23.440 --> 54:32.800] Yep. 18-4-9. Okay. You committed, you commit, okay. You commit aggravated motor vehicle theft
[54:32.800 --> 54:42.000] in Colorado when you knowingly obtain or exercise control over someone else's car, truck, motorcycle,
[54:42.000 --> 54:55.280] or the vehicle without authorization or by threat. You knowingly obtain or exercise control.
[54:55.280 --> 55:00.480] That sounds like it fits. Colorado Aggravated Motor Vehicle theft is almost always a felony.
[55:00.480 --> 55:10.000] Boy, that's not very clear. You commit an aggravated. I wonder if that's actually the code
[55:10.880 --> 55:17.040] because that doesn't read like a code. That reads like an explanation of a code.
[55:18.640 --> 55:26.000] Try a second link and see if I can actually. Here it is. Colorado Aggravated Motor Vehicle theft.
[55:26.000 --> 55:34.240] Okay. As used in this section, unless otherwise required, I'm going to describe motor vehicle.
[55:34.240 --> 55:43.840] Let's go down past definitions. Okay. That's one vehicle. Vehicle identification person commits
[55:43.840 --> 55:50.880] aggravated motor vehicle theft. In the first degree, if you or she knowingly obtains or
[55:50.880 --> 55:58.640] exercises control over the motor vehicle of another without authorization or by threat or deception,
[56:00.000 --> 56:14.000] obtains is the key word and it goes to similar laws elsewhere. If you take control of my vehicle
[56:14.000 --> 56:25.120] without my permission, that's theft. Yes. And that's what this says. Obtain without, okay.
[56:26.080 --> 56:32.400] Person commits an aggravated motor vehicle theft in the first degree. If he or she knowingly obtains,
[56:33.040 --> 56:38.960] but here we got or exercises control over the motor vehicle of another without authorization by
[56:38.960 --> 56:50.560] or by threat or deception. Did the owner of the vehicle demand that you return the vehicle?
[56:53.520 --> 56:56.960] Yeah. On May 9th of last year.
[57:01.600 --> 57:07.440] You may have a problem. I was told by the officer after he listened to the audio file between
[57:07.440 --> 57:14.000] the owner of the vehicle and myself that it was a civil matter and that I needed to speak to the
[57:14.000 --> 57:20.320] court for the title to the vehicle in accordance with the agreement he and I had made.
[57:25.120 --> 57:33.120] If you obtained the vehicle in accordance with an agreement, whether it was written agreement
[57:33.120 --> 57:42.240] or verbal agreement. Yeah. Did he, did he violate a tenet of the agreement? Completely.
[57:43.360 --> 57:50.240] Yeah. You really need. How did he? Well, how did he violated the tenet of the agreement?
[57:51.760 --> 57:55.680] Well, the agreement was he was supposed to sign over the title to the vehicle
[57:55.680 --> 58:05.200] by the end of the first, that first six months of insurance on his pickup truck and he needed it
[58:05.200 --> 58:10.400] on that so he could get the interlocked system on it so he could use. Oh, okay. Okay. So.
[58:10.400 --> 58:19.280] Get out of jail and work really. So he was, he was giving you one vehicle in order and you were
[58:19.280 --> 58:28.320] insuring two vehicles and this vehicle was payment for your insuring the two. Did you insure the
[58:28.320 --> 58:42.960] two vehicles? Yeah. So, okay. This is civil and you will beat this in court. Hang on.
[58:42.960 --> 58:49.520] Hang on. Go into break. Randy Kelton. Randy Kelton, move on radio. We'll be right back.

[01:00:00.640 --> 01:00:04.480] The following news flash is brought to you by the Low Star Lowdown.
[01:00:04.480 --> 01:00:12.480] Markets for Monday the 22nd of July 2019, open with precious metals, gold $1,429
[01:00:12.480 --> 01:00:20.880] an ounce, silver $16.45 an ounce, copper $2.75 an ounce, oil Texas crude $55.63 a barrel,
[01:00:20.880 --> 01:00:35.280]  Brent crude $62.47 a barrel, Bitcoin Core $10,566.52, Ethereum $227.26, XRP Ripple $0.33,
[01:00:36.400 --> 01:00:40.880]  and Bitcoin Cash is at $324.10 a crypto coin.
[01:00:40.880 --> 01:00:51.840] Today in history, the year 1916, the preparedness day bombing, a time suitcase bomb was detonated
[01:00:51.840 --> 01:00:56.800] on Market Street in San Francisco during the World War I preparedness day parade,
[01:00:56.800 --> 01:00:59.680]  killing 10 and injuring 40. Today in history.
[01:01:03.920 --> 01:01:07.920] And recent news, since Governor Greg Abbott signed House Bill 1325,
[01:01:07.920 --> 01:01:12.080] legalizing heaven attacks as long back in June, county prosecutors around the state,
[01:01:12.080 --> 01:01:16.560] including Houston, Austin, and San Antonio, have been dropping marijuana possession charges,
[01:01:16.560 --> 01:01:20.880] even refusing to file new ones, since they are stipulating that they do not have the time
[01:01:20.880 --> 01:01:25.840] or the laboratory equipment to test the year for GAC. Margaret Moore, the Travis County
[01:01:25.840 --> 01:01:30.000] District Attorney announced earlier this month that she was dismissing 32 felony possession
[01:01:30.000 --> 01:01:34.880] and delivery of marijuana cases because of the law. Mr. Abbott and other state officials,
[01:01:34.880 --> 01:01:38.800] including the Attorney General, stipulated in a letter that county district attorneys back on
[01:01:38.800 --> 01:01:43.840] Thursday that marijuana has not been decriminalized in Texas, and that these actions demonstrate
[01:01:43.840 --> 01:01:50.480] a misunderstanding of how HV 1325 works, as well as other cities, too, like the district attorney
[01:01:50.480 --> 01:01:56.400] in El Paso, Pima Esparza, a Democrat who also stated earlier this month that the law,
[01:01:56.400 --> 01:02:01.200] quote, will not have an effect on the prosecution of marijuana cases in El Paso.
[01:02:01.200 --> 01:02:06.160] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[01:02:06.160 --> 01:02:10.640] in Harris County, who stated that, quote, the law is constantly changing on what makes something
[01:02:10.640 --> 01:02:15.360] illegal based on its chemical makeup. It's important that if someone is charged with something,
[01:02:15.360 --> 01:02:24.400] the test matches what they're charged with. A paper by Tulane University identified a five
[01:02:24.400 --> 01:02:29.360] and a half inch American pocket shark. As the first of its kind in the global Mexico,
[01:02:29.360 --> 01:02:34.080] the specimen being only the second pocket shark ever captured or recorded,
[01:02:34.080 --> 01:02:39.520] with the other one being found way back in 1979 in the Pacific Ocean. According to the university
[01:02:39.520 --> 01:02:45.920] paper, the shark secretes a luminous fluid from a gland near its front fins for the purposes
[01:02:45.920 --> 01:03:00.240] of hypothesize to learn and pray, and may be drawn into the globe. This is Book Roadie with a lowdown for July 22, 2019.
[01:03:46.880 --> 01:03:52.160] Okay, we are back. Randy Kelton, Brett Fountain, root of law radio,
[01:03:53.120 --> 01:04:00.800] and we're talking to Tate. Oh, let's see, who am I talking to? I'm talking to Danny. Danny,
[01:04:01.360 --> 01:04:08.960] okay, so it kind of bushwhacked you there. You didn't have the information we needed.
[01:04:09.520 --> 01:04:11.280] Do you have anything else you want to talk about?
[01:04:11.280 --> 01:04:16.320] No, not really. I just heard you asked me to call in, so I did.
[01:04:17.440 --> 01:04:20.240] Okay, so you heard us making jokes about you.
[01:04:22.560 --> 01:04:30.960] Did Danny Murphy jokes? Okay. Okay, thank you, Danny. Okay, now we're going to go to Taylor
[01:04:30.960 --> 01:04:39.440] in Texas. Hello, Taylor. Hey, how's it going, Randy? It's going good. I went by DPS today
[01:04:39.440 --> 01:04:44.880] and tell you what, they refused to accept my paperwork for Open Records.
[01:04:46.480 --> 01:04:56.240] Whoa, did you call 911? No, I thought about that, but no. Oh, that is a great time to do that.
[01:04:57.680 --> 01:05:04.720] When I do Open Records, I just hope they'll say, well, why do you want to see this 911?
[01:05:04.720 --> 01:05:14.160] No warning, no fair warning, no opportunity to fix it. So, okay, tell us what happened.
[01:05:15.200 --> 01:05:24.240] All right. I went down there. I armed with my scope of content and my Open Records,
[01:05:24.240 --> 01:05:32.000] just my information request off your site, and I got escorted to the back there where I talked
[01:05:32.000 --> 01:05:38.880] with one of the ladies who administered the test. She told me to refer to the CDL handbook. I said,
[01:05:38.880 --> 01:05:43.040] that's just the information I want to know, the testing guidelines. She said it's against policy,
[01:05:43.040 --> 01:05:47.760] they give that out, and I asked her if that was confidential or classified information,
[01:05:48.480 --> 01:05:55.040] and she said yes. I don't think she knows what I meant by that, but I said, so I'm going to give
[01:05:55.040 --> 01:06:00.800] you this form, which is scope of content, because she couldn't tell me exactly what I was looking for.
[01:06:00.800 --> 01:06:06.720] And she went and talked to her supervisor. Supervisor came back and said, we can't accept forms.
[01:06:07.680 --> 01:06:12.640] You'll have to leave your information and we'll get back to you. So, we hemmed in hot for a bit.
[01:06:12.640 --> 01:06:17.280] I left my email and decided I'd figure out a different plan of action.
[01:06:21.920 --> 01:06:27.920] So, you could also ask, when they're being ornery and obstinate and coming up with ignorant
[01:06:27.920 --> 01:06:33.600] answers like that, you could also ask them, oh, that's your policy. I would like for you to produce
[01:06:33.600 --> 01:06:39.280] for me all the records and internal communications that you have about this policy. I need to know
[01:06:39.280 --> 01:06:47.040] about this policy of yours and make them produce it when they can't. They're going to stumble over
[01:06:47.040 --> 01:06:55.680] their response about that. Well, if they said there was a policy and then you asked for it
[01:06:55.680 --> 01:07:05.600] and they failed to produce the policy, 9-1-1. You charge them with violating the act,
[01:07:06.480 --> 01:07:12.800] even if the records didn't exist. Can I file a criminal complaint at this point?
[01:07:13.760 --> 01:07:23.040] Oh, absolutely. The open records, the open government act is not a civil statute.
[01:07:23.040 --> 01:07:29.360]  It is a criminal statute. 552, what is it, 552-353?
[01:07:29.360 --> 01:07:32.240]  We're at a 1-353. That's it.
[01:07:32.240 --> 01:07:39.680] It says that a violation of this act is an act of official misconduct to class A misdemeanor.
[01:07:40.960 --> 01:07:48.880] Okay. So, I filed a, so even though, so they did say, you know, you've got to contact
[01:07:48.880 --> 01:07:56.880] Austin to get that information, but it's against our policy to give it out. So, there's two different
[01:07:57.600 --> 01:08:02.000] two conflicts. That is not true. Okay.
[01:08:02.000 --> 01:08:08.640] You do not have to contact Austin. Right. You can contact Austin also, but
[01:08:09.200 --> 01:08:15.280] see if they'll go trip over themselves as well. But this was already official misconduct. It
[01:08:15.280 --> 01:08:19.120] doesn't have to be the ones that created the records. They can be the ones who maintain the
[01:08:19.120 --> 01:08:23.760] records as well. They have a copy of it that was given to them by Austin. And if they're saying
[01:08:23.760 --> 01:08:29.840] that they have it there, but they're not going to show it to you, they've just violated the law.
[01:08:30.880 --> 01:08:38.560] And, well, there's another thing. The act says that if a public official receives an information
[01:08:38.560 --> 01:08:45.680] request and that official is not the custodian of the records for the records that are requested,
[01:08:46.640 --> 01:08:54.080] they are to forward the request to the custodian. They don't get to send you to somebody else,
[01:08:54.720 --> 01:08:56.960] they're required to forward the records to them.
[01:08:58.560 --> 01:09:01.120] I would be interested to see that. I haven't seen that one.
[01:09:02.000 --> 01:09:05.680] Yeah, I'll have, I don't remember where it's at, but I have to go back and look for it, but
[01:09:05.680 --> 01:09:11.360] it's in there. They just said you can't, they can't just jerk you around and send you from
[01:09:11.360 --> 01:09:19.520] office to office. Okay, so the next step at this point is file a criminal complaint against whom?
[01:09:21.600 --> 01:09:26.800] Whoever you spoke to. Okay, so that would be pretty much the lowest level
[01:09:26.800 --> 01:09:35.920] maybe there, or words as well. All right. You need to take criminal complaints down there.
[01:09:35.920 --> 01:09:44.560] What I like to do is, especially when I'm, you know, I have a 1730 information request,
[01:09:44.560 --> 01:09:50.160] I have a scope and content information request, is make up a criminal complaint accusing them
[01:09:50.160 --> 01:09:58.720] of violating that particular request, whatever requests you're going to make. You ask for this
[01:09:58.720 --> 01:10:05.600] information, they denied it, you file this complaint. So then you go down there and hand them the
[01:10:05.600 --> 01:10:12.000] request, and when they deny the records, then you call 911 or call if there's a bailiff around,
[01:10:12.000 --> 01:10:21.520] call him over, and hand him the complaint that's already made out. They'll feel like you set them
[01:10:21.520 --> 01:10:31.520] up. Okay. And they'll be right, you did. All right, so yeah, the thing that kind of stumbled
[01:10:31.520 --> 01:10:36.320] me up was just they refused to accept the paperwork. I had it all made out and everything that said,
[01:10:36.320 --> 01:10:42.960] we cannot accept, we can't accept the documents from you. Nice and outrageous.
[01:10:47.120 --> 01:10:53.200] So now you, how far away from you is that? Is it a long trip to get there?
[01:10:54.720 --> 01:11:03.360] Five minutes. Then go over there and ask for a bailiff. Tell the bailiff that you were in here
[01:11:03.360 --> 01:11:10.880] the other day, and you attempted to file an information request, and they refused to accept it.
[01:11:10.880 --> 01:11:19.440] I had that happen to me in Fort Worth across from City Hall in the property tax section,
[01:11:21.200 --> 01:11:26.160] and he said that he couldn't accept that I had to file it somewhere else. No,
[01:11:27.200 --> 01:11:33.280] that's not how this is going to work, and the guy was really smart about it. So I turned around
[01:11:33.280 --> 01:11:41.600] to the guards of the door. Hey, you, come here. He comes over all huffy, puffy. What can I do for
[01:11:41.600 --> 01:11:50.160] you? Arrest that man. Oh, that was so much fun. Next time I came in there, this bad could not
[01:11:50.160 --> 01:11:58.400] have been nicer to me. When you start putting it, you put the bailiff on the dime, and the
[01:11:58.400 --> 01:12:06.080] bailiff's going to be real unhappy with the guy who got you to do that. He's not going to like
[01:12:06.080 --> 01:12:13.040] being put on this dime, so it'll create lots of nice politics. And when you ask the bailiff to
[01:12:13.040 --> 01:12:18.960] arrest someone, you become a protected class. Now all of a sudden they have a problem.
[01:12:20.160 --> 01:12:25.440] They just frown at you the wrong way. Then you file against them for retaliation, and they know that.
[01:12:25.440 --> 01:12:34.960] So have fun with it. Well, so I have a question about the nine. Also, let's say we do go the
[01:12:34.960 --> 01:12:46.400] 9-1-1 route. They refuse to accept the paperwork. Call them. Tell them where you're at, and you
[01:12:46.400 --> 01:12:53.760] need them to dispatch an officer to take your criminal affidavit of class A misdemeanor
[01:12:53.760 --> 01:13:01.200] official misconduct against this person. And sometimes you'll get some blowback from the
[01:13:01.200 --> 01:13:08.000] dispatcher. When the dispatcher asks, well, what all happened, you ask the dispatcher,
[01:13:08.000 --> 01:13:14.960] are you the responding officer? And they'll say, no, I'm the dispatcher. Well, then dispatch.
[01:13:15.760 --> 01:13:21.680] I'll give a full statement to the responding officer. Excuse me. That's the only good
[01:13:21.680 --> 01:13:26.240] dispatch out of the way. And then when the officer gets there, the first thing he
[01:13:26.240 --> 01:13:33.360] asks them to do is arrest this person. Well, they can't arrest this person because they
[01:13:33.360 --> 01:13:41.920] didn't see it occur. So if I have a bailiff in the building, and if he could have seen them,
[01:13:41.920 --> 01:13:49.280] he saw them. You order him to arrest them because it happened within your site. The code says within
[01:13:49.280 --> 01:13:54.480] your site or within your hearing. It does not say that you have to see it.
[01:13:56.880 --> 01:14:01.680] You just have to stay within your site. You might not have been paid attention,
[01:14:01.680 --> 01:14:09.600] makes no difference. Let them argue that in court. And then when the bailiff refuses to arrest,
[01:14:09.600 --> 01:14:16.240] then you file against the bailiff. When the 911 officer refuses to arrest,
[01:14:16.240 --> 01:14:22.480] you can't charge him criminally for that. But if he refuses to take your complaint,
[01:14:22.480 --> 01:14:28.800] then you can charge him for shielding for 3805, shielding for prosecution. And that's a felony.
[01:14:32.640 --> 01:14:39.280] It gets really ugly, really fast. Taylor, another thing that you can do when those people are
[01:14:39.280 --> 01:14:46.560] acting ignorant like that, you can say, well, sure, sure looks like somebody didn't have their mandatory
[01:14:46.560 --> 01:14:51.840] training. I want to see, and here you go with a new records request, I want to see all the records.
[01:14:51.840 --> 01:14:59.040] I will show me the certificates that you and all of your staff are keeping up in current on the
[01:14:59.040 --> 01:15:07.840] mandatory training per 552.012. The Attorney General mandates that you all have good training on this
[01:15:07.840 --> 01:15:13.840] open records stuff, and it looks like y'all are lacking in that area. I need to see the certificates.
[01:15:13.840 --> 01:15:23.520] Will you send me a copy of that request? Today, I updated Jurisimprudence.website.
[01:15:24.720 --> 01:15:29.600] Yeah, I uploaded a whole bunch of stuff. And it's all your fault, Taylor.
[01:15:29.600 --> 01:15:37.520] I went to that, he couldn't find, he could get a document open. And I went to the site,
[01:15:37.520 --> 01:15:43.520] and I had all these documents all scrambled together in one folder. So I went in there and
[01:15:43.520 --> 01:15:51.280] sorted them out in separate folders. And then I knew I had some document forms that I had been
[01:15:51.280 --> 01:15:58.320] developing over the years. I went and found all of those and loaded them up. So I got lots of
[01:15:58.320 --> 01:16:06.000] stuff, I've just loaded up on Jurisimprudence.website. Lots of suits, different types of suits that I
[01:16:06.000 --> 01:16:12.240] filed, all kinds of motions that I filed, a whole bunch of stuff in there. So if you haven't looked
[01:16:12.240 --> 01:16:19.360] at it in a while, there's a whole bunch of new stuff up there. But the requests that you have
[01:16:19.360 --> 01:16:26.640] filed with, if you'll send those to me, I will rework those in generic format with, you know,
[01:16:26.640 --> 01:16:32.880] fill in the blanks and load them up on the website so everybody can have access to them.
[01:16:32.880 --> 01:16:35.920] There's one other that stands out to me that might be interesting, because Taylor,
[01:16:35.920 --> 01:16:40.640] you went down there physically. Not everybody does that. Some people mail them in or whatever,
[01:16:40.640 --> 01:16:47.280] email, fax. Okay, do they, do they, wait a minute, wait a minute, they also physically fall off the
[01:16:47.280 --> 01:16:59.120]  cliff. We'll be right back.
[01:17:03.040 --> 01:17:09.200] It's the 2019 Logos Radio Network annual fundraiser and gun giveaway sponsored by Central Texas

[01:17:59.760 --> 01:18:04.640] I love Logos. Without the shows on this network, I'd be almost as ignorant as my friends. I'm so
[01:18:04.640 --> 01:18:10.000] addicted to the truth now that there's no going back. I need my truth fake. I'd be lost without Logos.
[01:18:10.000 --> 01:18:14.560] And I really want to help keep this network on the air. I'd love to volunteer as a show producer,
[01:18:14.560 --> 01:18:18.960] but I'm a bit of a Luddite and I really don't have any money to give because I spent it all
[01:18:18.960 --> 01:18:24.720] on supplements. How can I help Logos? Well, I'm glad you asked. Whenever you order anything from
[01:18:24.720 --> 01:18:29.840] Amazon, you can help Logos. You can order your supplies or holiday gifts. First thing you do
[01:18:29.840 --> 01:18:37.360] is clear your cookies. Now, go to LogosRadioNetwork.com. Click on the Amazon logo and book market.
[01:18:37.360 --> 01:18:42.960] Now, when you order anything from Amazon, you use that link and Logos gets a few pesos.
[01:18:42.960 --> 01:18:47.280] Do I pay extra? No. Do you have to do anything different when I order? No.
[01:18:47.280 --> 01:18:53.520] Can I use my Amazon Prime? No. I mean, yes. Wow. Giving without doing anything or spending any
[01:18:53.520 --> 01:18:59.680] money. This is perfect. Thank you so much. We are Logos. Happy holidays, Logos.
[01:18:59.680 --> 01:19:07.440] Logos? This is the Logos for Logos RadioNetwork.com.
[01:19:29.680 --> 01:19:52.800] Okay. We are back. The rule of all radio. Randy Kelton. I'm Brett Fountain and we're speaking
[01:19:52.800 --> 01:19:58.160] with Taylor in Texas. Taylor, there's one other thing that's interesting. If you physically went
[01:19:58.160 --> 01:20:04.640] down there, did you happen to see any signage prominently displayed over there talking about
[01:20:04.640 --> 01:20:09.360] the rights of the requester and the duties and responsibilities of the respondents?
[01:20:11.840 --> 01:20:18.320] Did they prominently display that sign? I can just give you a hint. They didn't.
[01:20:18.320 --> 01:20:27.520] 552. I'm sorry. Go ahead. During my conversation with one of the ladies,
[01:20:27.520 --> 01:20:36.480] another one came by and handed me a form of information that basically informed me
[01:20:36.480 --> 01:20:47.680] where I could request these documents. So, 552.205 specifically says that they need to
[01:20:47.680 --> 01:20:55.360] prominently display a sign and the form is prescribed by the attorney general. It has to be,
[01:20:55.920 --> 01:21:01.440] it has to face a certain way, has to have certain size and shape and fonts and everything that's,
[01:21:02.160 --> 01:21:08.480] it has to face the public. So, the public can clearly see what are their basic rights and has
[01:21:08.480 --> 01:21:14.880] to also face the employees of the governmental body who have a duty to respond to those requests.
[01:21:14.880 --> 01:21:22.640] I have never seen anybody put up these signs. So, I complain to the attorney general about this.
[01:21:22.640 --> 01:21:27.440] I make a big stink about it. Oh my goodness, your signs are missing and I send a report to the
[01:21:27.440 --> 01:21:39.280] attorney general. Send me a copy of that report. Okay. We'll load it up on the website. No problem.
[01:21:39.280 --> 01:21:48.720] Just a couple things for you to think about Taylor. Do you mind if I recap real quick? So,
[01:21:49.600 --> 01:21:55.200] bring my two documents down there, the information that I want, scope the content,
[01:21:55.200 --> 01:22:04.880] when that's denied, 9-1-1, report official misconduct and move on from there. Is that
[01:22:04.880 --> 01:22:11.360] the general scheme of things? Okay. You filed the scope and content?
[01:22:12.640 --> 01:22:15.920]  I attempted to. They said they couldn't take that.
[01:22:18.880 --> 01:22:23.600] Okay. How many forms did you have?
[01:22:24.960 --> 01:22:29.920] Just two. I had an information request for the policy and scope of content.
[01:22:29.920 --> 01:22:35.680] Then, who is, okay, what office was this again?
[01:22:38.240 --> 01:22:38.880]  DPS.
[01:22:44.960 --> 01:22:47.600] File against the director of the DPS.
[01:22:49.280 --> 01:22:49.840]  Primarily?
[01:22:51.200 --> 01:22:54.800] As the carnal, as respondee at superior.
[01:22:54.800 --> 01:23:05.280] Since you were at the DPS and the DPS, file against whoever it was that actually
[01:23:05.920 --> 01:23:11.920] refused to take your request and file against the director of the DPS as respondee at superior.
[01:23:13.200 --> 01:23:20.720] So, just a point of clarity. There are two pieces to this filing against. One of them is
[01:23:20.720 --> 01:23:28.960] 552.353 calling it official misconduct and that goes to the attorney general of Texas.
[01:23:30.160 --> 01:23:36.720] That's for that criminal complaint goes. Then, you've got also a penal code violation,
[01:23:36.720 --> 01:23:48.240] 3903. Sorry? Hold on. But let's have changed. When I read it, the attorney general had original
[01:23:48.240 --> 01:23:58.320] jurisdiction. Exactly. In one instance. They changed the law to give him original jurisdiction
[01:23:58.320 --> 01:24:08.720] in a complaint against a public official under 3903. That's been added. But before that, one
[01:24:08.720 --> 01:24:17.120] instance, and that was a allegation of a violation of the Freedom of Information Act against a
[01:24:17.120 --> 01:24:26.560] district attorney. So, you want to look and see if that specification is still in there.
[01:24:30.000 --> 01:24:35.920] The specification of the district attorney? Yeah, it gave the attorney general original
[01:24:35.920 --> 01:24:43.520] jurisdiction only in the case of a violation of the Open Records Act by a district attorney.
[01:24:43.520 --> 01:24:49.920] Hmm. Well, they have definitely been acting on it. When I send to them something, I send to
[01:24:49.920 --> 01:24:54.640] the attorney general, and it's not just been district clerks, it's been different county
[01:24:54.640 --> 01:25:02.000] clerks, and whoever's doing these violations of the act, I report to the attorney general,
[01:25:02.000 --> 01:25:08.560] and he is pretty quick. His office responds, and they say, you know, we need one more piece
[01:25:08.560 --> 01:25:14.240] of information. We're missing this. I just see where your records are. Question number three
[01:25:14.240 --> 01:25:18.640] was, and five, but I don't see number four here. They come back, and they're quick.
[01:25:18.640 --> 01:25:22.160] Could they copy me on a letter that they send to slap their hand?
[01:25:25.920 --> 01:25:31.680] That is good to hear. Yeah. We need to give some kudos to our current attorney general
[01:25:31.680 --> 01:25:41.360] for actually doing his job. I think so as well. Then if Paxton's doing his job, he's one of the
[01:25:41.360 --> 01:25:49.600] first ones. Is everybody else who wrote an interference for the public official? So that
[01:25:49.600 --> 01:25:56.640] is really good to hear. Yeah, I don't know about the district attorney part. I haven't seen that
[01:25:56.640 --> 01:26:03.120] myself. Okay, so look at the, see, check that part. They may have changed it,
[01:26:04.320 --> 01:26:08.960] but you know, I was surprised when I read that part, but then it made sense because
[01:26:10.560 --> 01:26:16.000] everybody else who violates the act is committed in a class A misdemeanor, and that would be
[01:26:16.000 --> 01:26:24.480] filed with a district attorney because it's a public official. So if it is the district
[01:26:24.480 --> 01:26:32.800] attorney who's committed the act, he would be the one to prosecute the case, and he's the one
[01:26:32.800 --> 01:26:40.640] accused, so he would be disqualified. So they sent that to the attorney general. Before that,
[01:26:41.680 --> 01:26:47.680] at that time, that was the only prosecutorial authority an attorney general had.
[01:26:47.680 --> 01:26:58.960] And then recently, they've added concurrent jurisdiction with the district attorney in the
[01:26:58.960 --> 01:27:07.760] matter of a complaint against a public official for official oppression.
[01:27:07.760 --> 01:27:17.440] And I think that was because of this situation in Houston where the cops chased down this
[01:27:18.240 --> 01:27:24.240]  120-pound, 12-year-old and kicked him and stomped him for a minute and a half.
[01:27:25.760 --> 01:27:35.520] Six cops. I'm surprised they didn't kill him, but the population come unglued,
[01:27:35.520 --> 01:27:40.880] and they made it a felony to commit official oppression with bodily injury.
[01:27:42.960 --> 01:27:49.840] And that was also the time they gave the prosecuting the attorney general concurrent
[01:27:49.840 --> 01:27:59.760] jurisdiction. Okay. Where were we, Taylor? You're getting to the fun part, Taylor.
[01:27:59.760 --> 01:28:06.960] This is where it starts to get interesting. And, you know, if they're coming after you and, okay,
[01:28:06.960 --> 01:28:13.760] users just a traffic ticket anyway, so there's not much they can do. There's not much of anything
[01:28:13.760 --> 01:28:18.080] you need from them. Now you can just beat them up with impunity.
[01:28:20.240 --> 01:28:25.280] So all I'm trying to get my target here is the guidelines for testing.
[01:28:25.280 --> 01:28:32.320] And so that's the overall goal here. Yeah. For what testing?
[01:28:33.760 --> 01:28:39.440] I'm working on the driver's license. Okay. He's going to take a test to drive a bus.
[01:28:40.400 --> 01:28:49.280] This is the CDL test? Correct. Okay. And okay, what he was saying was is that apparently someone
[01:28:49.280 --> 01:28:57.120] got a wreck and got sued, and the DPS got sued for not doing proper testing. So once that happened,
[01:28:57.120 --> 01:29:07.680] they got the instituted a draconian fix to where they got excessively difficult to deal with.
[01:29:09.520 --> 01:29:15.840] And now he's looking for the requirements to make sure that they're not overdoing the requirements,
[01:29:15.840 --> 01:29:23.520] and now they're hiding from it. Exactly. Listen, by the time you get to that test,
[01:29:24.480 --> 01:29:30.720] they're probably going to want you passed and out of there so you don't give them any more grief.
[01:29:31.440 --> 01:29:38.720] Okay, hang on. Do you have anything else for us, Taylor? That should do it. I got my steps
[01:29:38.720 --> 01:29:43.440] from here now. I'll call back next time when I have something for you. Thank you. Thanks,
[01:29:43.440 --> 01:29:48.720] Brett. Okay. Thank you, Taylor. This is Randy Kelton, Brett Fountain, Roodlebar Radio.
[01:29:51.120 --> 01:29:56.160] We're going to it. We've got one caller and two segments. So if you have a question or comment,
[01:29:56.160 --> 01:29:58.880] give us a call. We'll probably have time for one more. We'll be...
[01:30:01.120 --> 01:30:05.440] Could your pharmacy release your prescription information to marketers? Believe it or not,
[01:30:05.440 --> 01:30:09.920] it's not only possible. It's probably been done. I'm Dr. Katherine Albrecht, and I'll be back with
[01:30:09.920 --> 01:30:14.800] loopholes that make it legal for companies like CVS to share your personal health information.
[01:30:40.320 --> 01:30:46.800] And then start over with Start Page. Your pharmacy may be sharing your medical
[01:30:46.800 --> 01:30:52.080] information without your knowledge or consent. For example, CVS pharmacies are likely to disclose
[01:30:52.080 --> 01:30:56.640] your personal health information to business associates. A loophole in the law allows it if
[01:30:56.640 --> 01:31:01.520] parties agree to execute a contract to, quote, safeguard the data. Business associates could
[01:31:01.520 --> 01:31:05.760] range from marketers to insurance companies, and while they might give information locked up,
[01:31:05.760 --> 01:31:10.160] there's no telling how it might come back to bite you. Ask your pharmacy to disclose how it
[01:31:10.160 --> 01:31:15.120] shared your previous data and request in writing that it not be sold, rented, or shared. And most
[01:31:15.120 --> 01:31:20.160] importantly, take your future prescriptions to establishments that guarantee real privacy.
[01:31:20.160 --> 01:31:24.240] I'm Dr. Katherine Albrecht. More news and information at KatherineAlbrecht.com.
[01:31:29.680 --> 01:31:35.200] This is Building 7, a 47-story skyscraper that fell on the afternoon of September 11th.
[01:31:35.200 --> 01:31:40.720] The government says that fire brought it down. However, 1,500 architects and engineers concluded
[01:31:40.720 --> 01:31:45.040] it was a controlled demolition. Over 6,000 of my fellow service members have given their lives.
[01:31:45.040 --> 01:31:49.840]  1,000 of my fellow force responders are dying. I'm not a conspiracy theorist. I'm a structural

[01:33:57.760 --> 01:34:14.400] Okay, we are back. Randy Kelton, Brett Fountain, rule law radio. And we're going to Shane,
[01:34:14.400 --> 01:34:21.600] but as soon as we're done with Shane, Brett's got a story to tell. He's getting worse than me.
[01:34:21.600 --> 01:34:29.920] He's out there causing trouble. Shane, what do you have for us today? And I apologize. I did not
[01:34:29.920 --> 01:34:41.200] get to the motion you wanted me to read. That's okay, Randy. It's been a busy day.
[01:34:41.200 --> 01:34:51.120] Give us the synopsis of what that motion was. There's change in the bankruptcy. He found a
[01:34:51.120 --> 01:35:01.280] bankruptcy to stop foreclosure on his mother's house. Did she do a quick claim to you or how did
[01:35:01.280 --> 01:35:10.320] she get you? She did a quick claim with $1,000 consideration back on August 17, 2017. And not
[01:35:10.320 --> 01:35:15.520] knowing the future, we had no idea how things were going to move forward. Leaving aside that the
[01:35:15.520 --> 01:35:22.720] whole case was sitting at the state court in New York, and the motions were absolutely fantastic.
[01:35:23.120 --> 01:35:30.000] They admitted to a lot of things, which I'm not going to get into right now, because at the end
[01:35:30.000 --> 01:35:35.920] of the day, the judges say, okay, they have no standing. There's no obligation to pay. But guess
[01:35:35.920 --> 01:35:42.000] what? Deny all that, grant summary judgment in the favor of the non-party HSDT, sell the property
[01:35:42.000 --> 01:35:47.120] next month. And then we didn't know the future, but the bankruptcy really helped out tremendously
[01:35:47.120 --> 01:35:53.840]  because we're in front of a semi-honest federal bankruptcy judge. He's 100 times better than
[01:35:53.840 --> 01:35:58.800] these lower court judges. These lower court judges, they smile, drink coffee. Well, you're doing a
[01:35:58.800 --> 01:36:03.440] great job, but I can't grant any of this. Denied. And they do it with a smile, Randy. They do it
[01:36:03.440 --> 01:36:10.960] with a beautiful, you know, Joker smile, you know, like the movie Joker. It's absolutely incredible,
[01:36:10.960 --> 01:36:17.200] how corrupt this area is. Actually, everybody wants to stay more corrupt than the others,
[01:36:17.200 --> 01:36:22.560] and everybody's, you know, everybody's trying to be first place in it, but, you know, Buffalo is
[01:36:22.560 --> 01:36:29.120] a horrible town, and very corrupt judges in the county. But that's a pretty amazing story. But
[01:36:29.120 --> 01:36:34.320] then we went to bankruptcy court, and then at the last minute, they're going to sell the property
[01:36:34.320 --> 01:36:39.680] July 24, 2019, and that's when I found bankruptcy the day before the sale, and that's not that.
[01:36:40.560 --> 01:36:46.000] And now we're moving progressively forward, and the nation started Mr. Cooper, which is located
[01:36:46.000 --> 01:36:51.280] right near Neck of the Woods at the service, sir. And they filed their motion to let this
[01:36:51.280 --> 01:36:56.320] stay back in October. That was granted. And based on all the stuff I put on the record,
[01:36:56.320 --> 01:37:01.040] they did not move forward and sell the property. So they handed it off to Keybank. Keybank filed
[01:37:02.720 --> 01:37:07.840] a motion to let this stay one day before Thanksgiving. And I didn't find out about it
[01:37:07.840 --> 01:37:11.680] until like a week later, because somebody called me and they were checking my mail because I drove
[01:37:11.680 --> 01:37:18.560] down to Dallas to visit family, I got a family in Dallas. And so we had very, very little time
[01:37:18.560 --> 01:37:23.920] to respond. So we did, we filed a motion to reschedule based on the circumstances. And then
[01:37:23.920 --> 01:37:29.600] David P. K. is the attorney in Rochester, oppose it. So you're not getting no extension of time.
[01:37:29.600 --> 01:37:34.560] We're moving forward with the hearing. So the judge is law clerk called me up and says,
[01:37:34.560 --> 01:37:38.880] look, we need you to show up, but can you show up by telephone? And I said, no problem. So
[01:37:38.880 --> 01:37:44.400] that hearing went on for a good hour and 25 minutes and the attorney representing Keybank,
[01:37:44.960 --> 01:37:50.240] which is the second lean holder, the key lock, which was, which has been charged off
[01:37:50.240 --> 01:37:54.480] about almost six years ago, Randy, that's where you've been charged off and even
[01:37:54.480 --> 01:38:00.160] admitted when charged off, but they're still moving forward. But this attorney admitted on the record.
[01:38:01.360 --> 01:38:04.720] He got really upset at the end of the hearings. And this is ridiculous. This is going on for this
[01:38:04.720 --> 01:38:08.960] long. You know, he was yelling, almost yelling at the bankruptcy judge saying that this hearing
[01:38:08.960 --> 01:38:14.880] is going on this long. And he goes, our attorney fees have superseded the amount owed on this
[01:38:14.880 --> 01:38:20.640] property. And he goes, this is ridiculous. Meanwhile, I'm moving forward to try to have the
[01:38:20.640 --> 01:38:25.680] whole hearing postponed. It's like to back off the bus flow, which, you know, which,
[01:38:25.680 --> 01:38:31.200] which that was denied. But make a long story short, he granted the motion to list this day,
[01:38:31.200 --> 01:38:37.120] but denied the motion to dismiss the bankruptcy case. And the attorney representing Keybank
[01:38:37.120 --> 01:38:42.880] literally flipped out. And so I got right back up here, Randy, and found the motion for rehearing,
[01:38:42.880 --> 01:38:47.040] which is going to be heard on Monday. And I already filed a notice of appeal.
[01:38:48.080 --> 01:38:51.600] And I've already been working on the brief. So we're already ready to go because we know
[01:38:51.600 --> 01:38:54.720] he's going to deny the re-hearing, but I want to put some more stuff on the record because
[01:38:55.680 --> 01:39:01.280] the bankruptcy judge signed an order stating, which was made for David P. K. C., the attorney
[01:39:01.280 --> 01:39:05.920] representing Keybank, signed an opportunity to do the proposed orders. I don't even think
[01:39:05.920 --> 01:39:09.760] you read the proposed order, but in that order, he says, I'm doing this bankruptcy in bad faith.
[01:39:09.760 --> 01:39:16.080] So that's where we're at there. I filed a notice of appeal. I filed in for poppers because of the
[01:39:16.080 --> 01:39:21.520] filing fees are super high here in New York, you know, the federal. It's like 513, what's 505,
[01:39:21.520 --> 01:39:27.920] I think, filing fee. So I filed in for poppers to have the filing fees raised based on my income.
[01:39:28.800 --> 01:39:33.040] And he filed the attorney objected to my informal poppers to say, wait a second,
[01:39:33.040 --> 01:39:38.720] he's got money to travel down to Dallas. And he said, if this many miles he had to stay at
[01:39:38.720 --> 01:39:44.720] this hotel and he made two pages long about all the money I possibly spent going from
[01:39:44.720 --> 01:39:48.640] Buffalo to Dallas, can you imagine that? And I was, I drove my parents' daughter in a family.
[01:39:49.280 --> 01:39:54.640] So he made a big thing about that. He objected to my informal poppers. He filed an objection to
[01:39:54.640 --> 01:40:00.400] the motion for re-hearing. And all he did was cry and cry and cried. And I filed four bar
[01:40:00.400 --> 01:40:05.200] grievances against him. I filed complaints with the attorney general, the consumer protection
[01:40:05.200 --> 01:40:10.160] bureau. And he says, I'm harassing law firms and calling people up and harassing people and
[01:40:10.160 --> 01:40:15.520] threatening people. And it was like three or four pages long. Most of it is filled with lies.
[01:40:16.160 --> 01:40:19.920] Very similar with Trump's going through, they take one little thing and twist it and blow
[01:40:19.920 --> 01:40:28.000] right up to a huge thing. So that's what we're at as of right now. So file a motion for sanctions.
[01:40:28.000 --> 01:40:42.800] The lawyer filed a motion to deny you informal poppers. The lawyer has no standing. The only
[01:40:42.800 --> 01:40:50.240] one that has standing is the court clerk. Because the court clerk is the one that doesn't get paid,
[01:40:50.240 --> 01:40:59.440] not the lawyer. He has no standing in that issue. It's a frivolous filing. And that should get
[01:40:59.440 --> 01:41:07.920] sanctions. We have to do that on our own. We have to actually file a motion for sanctions.
[01:41:10.320 --> 01:41:13.840] I believe that was the file of the district court because he filed the objection.
[01:41:13.840 --> 01:41:19.920] No, no, no. Does that be filed in whatever court he filed the objection to?
[01:41:21.680 --> 01:41:26.640] Well, I forgot to tell you one part of the story. He filed the objection in the bankruptcy court.
[01:41:26.640 --> 01:41:32.240] Bankruptcy court issued a deficiency notice today that he needs to file in the proper court.
[01:41:32.880 --> 01:41:36.000] They asked to go to the United States District Court, which is the Apollo court above the
[01:41:36.000 --> 01:41:44.720] bankruptcy court. Then file, ask for sanctions against him. He's a lawyer. He knew better.
[01:41:44.720 --> 01:41:48.240] Accus him of doing that just to harass you.
[01:41:52.240 --> 01:41:56.800] I will say one thing that telephone hearing, I've never done that before. I didn't even know it
[01:41:57.520 --> 01:42:01.120] didn't even exist. And so the law clerk for the bankruptcy court called me and says,
[01:42:01.120 --> 01:42:06.640] we need you to call it in at this number, hit the code, and here's a security code. So I thought
[01:42:06.640 --> 01:42:13.040] that was kind of thoughtful. At least they let me do that part. Okay. How did that work out for you?
[01:42:14.240 --> 01:42:18.400] Actually, pretty good. I had a nice little script. The court was very quiet.
[01:42:19.280 --> 01:42:23.920] And there was one moment where he says, look, I need some time. I need to review some of these
[01:42:23.920 --> 01:42:27.680] things. And I think we waited about seven minutes, maybe 10 minutes, but he had to review
[01:42:27.680 --> 01:42:32.080] what I was saying was true. And I'm not going to sit here and give you a whole
[01:42:32.080 --> 01:42:36.640] hearing over the phone here, but he was getting mad as the hearing was going on.
[01:42:36.640 --> 01:42:41.200] He couldn't believe how long it was going on. The attorney that's allegedly representing
[01:42:41.200 --> 01:42:46.400] Keybank. I don't even think Keybank knows the attorney fees have superseded the amount owed.
[01:42:46.400 --> 01:42:49.360] I don't think they even know what's going on because they make, you know, Keybank's worth.
[01:42:49.360 --> 01:42:58.720] Okay. Objection, relevance. Right. So what? Your attorney fees exceeded the amount
[01:42:58.720 --> 01:43:04.000] owed. Your problem, not my problem. Certainly not the court's problem.
[01:43:07.600 --> 01:43:12.720] But what was interesting about it is he was telling me that, or not telling me, but telling
[01:43:12.720 --> 01:43:18.240] the court in his motion to lift the state, he spent three pages about all the complaints I
[01:43:18.240 --> 01:43:23.840] filed over the last five years, filed complaints with the consumer protection bill several times,
[01:43:23.840 --> 01:43:30.160] barred grievances, attorney generals, he listened. I mean, he was very notate. Then he made some
[01:43:30.160 --> 01:43:36.320] false statements. But what was interesting about it is that I heard the music in the background.
[01:43:37.360 --> 01:43:43.520] Yeah, I was just, I was actually looking at the clock this time. It's Randy Kelton, Brett
[01:43:43.520 --> 01:43:48.480] Fountain, rule of law radio. I'm not going to give out the call in number. We'll go into our last
[01:43:48.480 --> 01:44:02.640] segment. So hang on, we'll be right back. Through advances in technology, our lives have greatly
[01:44:02.640 --> 01:44:08.400] improved, except in the area of nutrition. People feed their pets better than they feed themselves.
[01:44:08.400 --> 01:44:14.240] And it's time we changed all that. Our primary defense against aging and disease in this toxic
[01:44:14.240 --> 01:44:19.440] environment is good nutrition. In a world where natural foods have been irradiated,
[01:44:19.440 --> 01:44:25.600] adulterated, and mutilated, young Jevity can provide the nutrients you need. Logo's radio
[01:44:25.600 --> 01:44:31.280] network gets many requests to endorse all sorts of products, most of which we reject. We have come
[01:44:31.280 --> 01:44:37.600] to trust young Jevity so much. We became a marketing distributor along with Alex Jones, Ben
[01:44:37.600 --> 01:44:44.000] Fuchs, and many others. When you order from LogosRadioNetwork.com, your health will improve
[01:44:44.000 --> 01:44:49.360] as you help support quality radio. As you realize the benefits of young Jevity,

[01:46:03.040 --> 01:46:29.280] Okay, we are back. Randy Kelton, Ralph Fountain, rule of law radio, and we're talking to Sean
[01:46:29.280 --> 01:46:39.600] in New York. Sean, we're talking to Shane in New York. I didn't say Shane. Anyway, okay.
[01:46:40.960 --> 01:46:50.800] So, the lawyer has filed a totally frivolous pleading, and now you're forced to have to
[01:46:50.800 --> 01:46:59.200] answer this for your frivolous pleading. You should ask for sanctions. Did the lawyer mention
[01:46:59.200 --> 01:47:08.320] the fact that you bore greed to him? Oh, of course. Wait, I couldn't hear that. Yes,
[01:47:08.320 --> 01:47:15.680] he did, of course. Oh, good, because he's required not to say anything about that. That was an
[01:47:15.680 --> 01:47:21.280] improper attempt to, is his attempt to improperly influence the court. So, you should grieve him
[01:47:21.280 --> 01:47:28.960] for that. Well, it's all in here. It says here that he has personal knowledge of the harassing
[01:47:28.960 --> 01:47:37.280] mailings to the CFPB complaints, grievances that are in other cohorts sent to counsel or against
[01:47:37.280 --> 01:47:42.240] counsel, and then he goes on and he has personal knowledge of the state court actions. By the way,
[01:47:42.240 --> 01:47:46.480] he's never showed up to one damn court date in the state court. He sends some other attorney in,
[01:47:46.480 --> 01:47:51.280] and then they hire somebody else, and they take somebody else in. So, it's absolutely, but here's
[01:47:51.280 --> 01:47:55.760] one, you know, I want to read this one little section here. It says, that or continues to try
[01:47:55.760 --> 01:47:59.520] to attack the validity of the court creditor's mortgage and the rights of the court of state,
[01:48:00.240 --> 01:48:05.280] which was confirmed by the court order from state foreclosure actions in Erie County.
[01:48:05.280 --> 01:48:09.840] However, such attack on mortgage and state court foreclosure actions, right, ready for this one,
[01:48:09.840 --> 01:48:14.880] is barred worker-felman doctrine, since the court creditor has a final state court judgment
[01:48:14.880 --> 01:48:19.520] of sale. Well, I've never been served. I've filed three motions to get into this case,
[01:48:19.520 --> 01:48:25.360] all been denied, and they're moving forward when my mom is not on the property anymore,
[01:48:25.360 --> 01:48:29.520] and I have tried like hell to get into this case, and any time I file anything, it's stricken.
[01:48:30.720 --> 01:48:34.320] So, he's trying to, I said, well, how can worker-felman apply to me
[01:48:34.320 --> 01:48:38.240] when you guys haven't even served me? Now, finally, somebody's recognized me,
[01:48:38.240 --> 01:48:42.000] the bankruptcy court has recognized me as a real party of interest, and that's why the
[01:48:42.000 --> 01:48:47.040] sale stopped. This is the first time a court has recognized me. So, Randy, the question is,
[01:48:48.880 --> 01:48:54.640] and I asked you this before, can they move forward on an old state judgment
[01:48:55.440 --> 01:49:02.480] from what year, year and a half ago, and use a party that no longer owns the property anymore,
[01:49:02.480 --> 01:49:05.840] and I have never been served, and I have did everything I could to get added into the case,
[01:49:05.840 --> 01:49:10.800] and they denied me to be joined into the case. I am good to be asked.
[01:49:10.800 --> 01:49:16.160] Well, if you were at the time of party and interest, and you were not included in the suit,
[01:49:16.160 --> 01:49:20.720] then you need to file a challenge subject-managed jurisdiction to the original suit.
[01:49:21.920 --> 01:49:25.200] I can't do that. It gets stricken and removed from the record.
[01:49:27.040 --> 01:49:30.240] I'm not a party of interest, but the bankruptcy court is actually, you know,
[01:49:31.360 --> 01:49:33.440] finally acknowledging that I own the property.
[01:49:34.000 --> 01:49:38.160] Okay, the bank, the federal court has acknowledged that you own the property.
[01:49:38.160 --> 01:49:45.920] Right. Your name is not on it on the original suit, and that's the reason you file.
[01:49:47.760 --> 01:49:54.000] Talk to Leslie. Send me an email. I'll send it to Leslie. That's exactly what happened in her case.
[01:49:55.680 --> 01:50:02.640] Her case was dismissed for lack of subject-managed jurisdiction for failure to name a necessary
[01:50:02.640 --> 01:50:11.760] party. They didn't name her husband, and he was an interested party. You're an interested party.
[01:50:11.760 --> 01:50:16.240] They didn't name you, therefore, or the court lack subject-managed jurisdiction.
[01:50:17.520 --> 01:50:20.640] Well, that's the reason why I brought up the Rooker Feldman Doctrine. They keep on bringing
[01:50:20.640 --> 01:50:28.720] that up, which is complete nonsense. Okay. Talk to Leslie. She'll share her briefs and pleadings
[01:50:28.720 --> 01:50:33.520] with you, and hers are great. She does really good work.
[01:50:35.680 --> 01:50:39.760] In the meantime, as the notice of appeal is moving forward, because I already filed it,
[01:50:39.760 --> 01:50:43.920] I'm going back in for re-hearing on Monday, because I already know they're going to deny it.
[01:50:43.920 --> 01:50:47.760] So we're going to have to go to the district court. So I'm getting ready for it. Hopefully,
[01:50:47.760 --> 01:50:52.720] I didn't mess myself up, but I already filed a notice of appeal, because I didn't want to miss the
[01:50:52.720 --> 01:51:03.920] time. An early filed notice of appeal sits in the record till it's ripe. Okay. So it doesn't hurt
[01:51:03.920 --> 01:51:10.480] anything. Okay, good. So your notice of appeal is automatically filed. When they say rule against
[01:51:10.480 --> 01:51:17.760] you, it's automatically filed. Okay, good, because it's already in there. But the, well,
[01:51:17.760 --> 01:51:20.320] you don't have much time to talk about that. There's something I also want to say, but we're
[01:51:20.320 --> 01:51:27.600] running out of time, but this guy, his name is David P. Case. Look him up. He's in Rochester.
[01:51:27.600 --> 01:51:32.880]  He's stolen thousands of properties as an attorney, and there's a profile that he's a big
[01:51:34.160 --> 01:51:38.240] church person's family and all this stuff. You know, I was robbing people all left and right,
[01:51:38.240 --> 01:51:41.920] and they make these fraudulent amounts of David today, file them into cases, and they steal,
[01:51:41.920 --> 01:51:45.360] because most people don't know what's going on. They lose their property and you're out.
[01:51:45.360 --> 01:51:54.960] He's a real shikester. Okay. And the things that he's done to my mom over the last five years is
[01:51:54.960 --> 01:51:59.360] incredible. Every time we filed stuff in the county court, state court, he would just mail
[01:51:59.360 --> 01:52:03.440] everything backstage. Your motion is hereby rejected. We're not going to acknowledge it.
[01:52:03.440 --> 01:52:06.240] We're not going to answer it. He just mailed everything back. I think he's done it probably
[01:52:06.240 --> 01:52:14.320] like over 10 times in the last five years. Quick. Say that last part again. He's did what?
[01:52:14.320 --> 01:52:20.240] 10 times. He mails everything back. You file a notice and a motion of thisness for whatever
[01:52:20.240 --> 01:52:25.200] reasons, like for example, you can't have two foreclosures going on at the same time, or
[01:52:25.840 --> 01:52:29.840] you guys are missing the original note, and the record shows you don't even have it,
[01:52:29.840 --> 01:52:34.400] or whatever the case might be. He takes the whole thing back up with the envelope, with a rubber
[01:52:34.400 --> 01:52:39.840] band, and mails it back to us and say, we reject your motion. You didn't file the proper procedures.
[01:52:39.840 --> 01:52:46.480] He mails everything back. The lawyer does? You don't care what the lawyer does. You care what
[01:52:46.480 --> 01:52:52.480] the court does. I understand that. But see, most people wouldn't know what to do. They get
[01:52:52.480 --> 01:52:55.920] intimidated and say, oh, it's been denied, but they don't know that the judge makes the final
[01:52:55.920 --> 01:53:02.640] decision. Not him. That's what he does to people. Yeah. Okay. So did you bar grieve him each time
[01:53:02.640 --> 01:53:09.040] he did that? I already have. In fact, when the court came back and said, it looks like you're
[01:53:09.040 --> 01:53:18.400] looking for legal advice, therefore, we can't do anything about that. So wait a minute. Hold on,
[01:53:18.400 --> 01:53:22.400] Shane. Move the mic a little away from you, but down by your chin, because you're
[01:53:23.600 --> 01:53:30.080] booming into the mic and distorting. I said that we've already barred grievance. The barred
[01:53:30.080 --> 01:53:36.320] grievance came back and said we're looking for legal advice. That's what the letter has. But
[01:53:36.320 --> 01:53:43.840] I'll keep on filing bar grievances as the time goes further into the future. Good. Good. File
[01:53:43.840 --> 01:53:53.680] quick, file often. Right. Especially these real estate shysters. They've worked a horrible
[01:53:57.520 --> 01:54:04.320] mid-treatment of the public. This is the worst ever. And this happens every 50 years.
[01:54:04.320 --> 01:54:14.160] And it has, it was the Templars who started this. They loaned money for people to buy a property.
[01:54:14.160 --> 01:54:20.000] And about the time they almost get it paid off, they crashed the system, bankrupt everybody,
[01:54:20.000 --> 01:54:25.520] take back all the property, and sell it to the grandkids. They've been doing that for 600 years.
[01:54:25.520 --> 01:54:32.240] Right. Same thing that just happened. Except this is the worst travesty of them all.
[01:54:36.240 --> 01:54:39.520] Okay. I just want to give you, I just want to give you a quick update on this case.
[01:54:40.240 --> 01:54:44.240] But my last question to you is that since the notice of appeals in there,
[01:54:45.760 --> 01:54:48.320] I don't think they can sell the, well, they could do whatever they want to do,
[01:54:48.320 --> 01:54:52.720] but I don't think they can sell the property until the appeals and fully adjudicate it for her.
[01:54:52.720 --> 01:54:58.720] Okay. Hold on. Hold on. Have you requested findings of fact and conclusions at law?
[01:55:00.000 --> 01:55:04.240] Well, that's, oh, this is, this is in the Fed. So you get a judgment with the ruling.
[01:55:05.040 --> 01:55:13.200] Have you, yeah. Have you requested, where you got rulings against you,
[01:55:13.200 --> 01:55:19.680] did you file a request for reconsideration? That's what we're walking into on Monday.
[01:55:19.680 --> 01:55:26.960] Oh, okay. Good. Good. Good. I'm saying that because you need that to protect, perfect your appeal.
[01:55:28.160 --> 01:55:34.480] Yeah. He responded back. Now, when I just read it, my blood starts to boil. He keeps
[01:55:34.480 --> 01:55:39.920] on claiming he's a secured creditor than they have. I mean, oh, God, I get so mad. You know how
[01:55:39.920 --> 01:55:43.760] like, you get so mad, you can't get it over the phone, can't get it onto the show here,
[01:55:43.760 --> 01:55:48.240] because it's like unbelievable. It's like, they commit the crimes, right? They smash your house,
[01:55:48.240 --> 01:55:50.880] steal all your stuff, and then they charge you for the crimes. They just commit it.
[01:55:54.720 --> 01:56:00.240] Yeah. It's, I'm working on something to, to hamstring these guys.
[01:56:02.320 --> 01:56:06.720] And I'm getting close to getting it launched. So if I get this thing launched, it will
[01:56:08.160 --> 01:56:14.480] change the underlying structure completely. And we're hoping we'll eliminate a lot of this,
[01:56:14.480 --> 01:56:20.400] but you're not going to eliminate all the shysters. If God made man,
[01:56:21.200 --> 01:56:27.040] he made us horribly flawed. And that's not something we're going to be able to fix.
[01:56:28.400 --> 01:56:31.280] So there's always going to be guys like this out there.
[01:56:33.840 --> 01:56:38.960] Brady, let me ask you a last question here, because I just, I don't know if this is
[01:56:38.960 --> 01:56:44.080] something that you can answer, but I'm going to ask you. Has anybody ever filed, or have you ever
[01:56:44.080 --> 01:56:48.000] heard of anybody filed a complaint with the Internal Revenue Service, CID Department,
[01:56:48.000 --> 01:56:52.640] the Criminal Investigation regarding a foreclosure, or is that something that's outside their scope?
[01:56:53.360 --> 01:56:59.520] It has nothing to do with the IRS, unless you can show these guys who are receiving income
[01:56:59.520 --> 01:57:05.520] through the foreclosure that they're not reporting. Yeah, that's impossible.
[01:57:05.520 --> 01:57:09.680] Yeah, that's impossible. And that's another thing I'm going into on Monday,
[01:57:09.680 --> 01:57:14.560] because I asked the court, I desperately asked the court, can I please have my evidentiary hearing?
[01:57:14.560 --> 01:57:21.040] You know, I filed a response back to reschedule the emotional estate, but I also filed a motion for
[01:57:21.040 --> 01:57:25.360] an evidentiary hearing to have them prove that they own this, that, where is it?
[01:57:26.720 --> 01:57:29.040] And they know they can't produce any of the original documents.
[01:57:29.840 --> 01:57:33.600] So that's what we're going back to on Monday. That's a due process, right? You should have that
[01:57:33.600 --> 01:57:40.320] written on the evidentiary hearing. If they don't bring original documents, then, you know,
[01:57:40.320 --> 01:57:47.040] like the note and the data trust, the primary, the note, if they don't bring the original note,
[01:57:47.680 --> 01:57:51.040] whatever they bring you objective, you've never seen that, you did not sign that.
[01:57:52.640 --> 01:57:58.080] Right. Well, it was in the mom's name originally, but they're trying to convert the debt over to me
[01:57:58.080 --> 01:58:03.600] now. But if they do that, I have a right to see the original documents before I can pay them.
[01:58:04.400 --> 01:58:14.560] Yes. And that's, I think Tina, that's an issue. Tina's is working through the courts in California
[01:58:14.560 --> 01:58:21.680] right now is exactly that issue, that they won't produce your original note. Okay, we are out of
[01:58:21.680 --> 01:58:29.040] time. This is Randy Kelton, Brett Fountain, Rural Law Radio. We'll be back next week, next Thursday
[01:58:30.320 --> 01:58:37.200] for Thursday night, two hours show Friday for our four hour info marathon. And check out Eddie
[01:58:37.200 --> 01:58:43.200] Craig on Monday nights at eight o'clock central for his traffic show. Thank you all for listening
