[01:14.040 --> 01:18.040]  and San Antonio, have been dropping marijuana possession charges and even refusing to file
[01:18.040 --> 01:22.280]  new ones since they are stipulating that they do not have the time or the laboratory
[01:22.280 --> 01:24.720]  equipment to test the herb for THC.
[01:24.720 --> 01:28.440]  Margaret Moore, the Travis County District Attorney, announced earlier this month that
[01:28.440 --> 01:33.000]  she was dismissing 32 felony possession and delivery of marijuana cases because of the
[01:33.000 --> 01:34.000]  law.
[01:34.000 --> 01:37.600]  Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter
[01:37.600 --> 01:42.120]  to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:42.120 --> 01:48.240]  in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works, as
[01:48.240 --> 01:54.480]  well as other cities, too, like the District Attorney in El Paso, Cayma Esparza, a Democrat
[01:54.480 --> 01:58.960]  who also stated earlier this month that the law, quote, will not have an effect on the
[01:58.960 --> 02:01.680]  prosecution of marijuana cases in El Paso.
[02:01.680 --> 02:06.760]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.760 --> 02:10.760]  in Harris County, who stated that, quote, the law is constantly changing on what makes
[02:10.760 --> 02:13.480]  something illegal based on its chemical makeup.
[02:13.480 --> 02:17.360]  It's important that if someone is charged with something, the test matches with their
[02:17.360 --> 02:22.600]  charge with it.
[02:22.600 --> 02:27.200]  A paper by Tulane University identified a five and a half inch American pocket shark
[02:27.200 --> 02:32.320]  as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket
[02:32.320 --> 02:38.000]  shark ever captured or recorded with the other one being found way back in 1979 in the East
[02:38.000 --> 02:39.000]  Pacific Ocean.

[05:06.840 --> 05:08.840]  We are live tonight
[05:08.840 --> 05:12.840]  Now, I want to go over a couple things
[05:12.840 --> 05:16.840]  That have occurred as of the last legislative session in 2019
[05:16.840 --> 05:21.840]  They finally repealed Chapter 708 of the Texas Transportation Code
[05:21.840 --> 05:25.840]  Which is why you will no longer find it available online
[05:25.840 --> 05:30.840]  The repeal was done by House Bill 2048
[05:30.840 --> 05:34.840]  In the 2019 legislation of the session
[05:34.840 --> 05:38.840]  It took effect in June of last year
[05:38.840 --> 05:43.840]  And it was repealed because it was unconstitutional
[05:43.840 --> 05:56.840]  And they were sued in a lawsuit over the issue of creating a poor man's loss of license situation
[05:56.840 --> 06:03.840]  Now, I have been telling you for years that 708 was unconstitutional
[06:03.840 --> 06:12.840]  Because that is the chapter that imposed the separate, unadjudicated, behind-the-scenes
[06:12.840 --> 06:20.840]  Additional fines and punishments that never went in front of a jury
[06:20.840 --> 06:26.840]  And charged you in excess fees and suspended your license if you did not pay them
[06:26.840 --> 06:33.840]  Now, like I say, those fines and fees were never mentioned at the time of your trial
[06:33.840 --> 06:36.840]  They were never decided upon by a jury
[06:36.840 --> 06:41.840]  The jury was never made aware that you were going to get hit with those additional punitive measures
[06:41.840 --> 06:46.840]  And neither were you at the time of your trial
[06:46.840 --> 06:52.840]  Now, there's tons of case law that you could not punish someone
[06:52.840 --> 06:59.840]  And find them for an offense if the fine itself is not a part of the prosecution
[06:59.840 --> 07:02.840]  Or the civil litigation
[07:02.840 --> 07:07.840]  You can't come behind the scenes after the fact and say, oh, on top of the judgment against you
[07:07.840 --> 07:11.840]  Either in a criminal fine or a civil fine
[07:11.840 --> 07:15.840]  We're going to go ahead and tack on all these additional fees and fines of our own
[07:15.840 --> 07:17.840]  And that's that
[07:17.840 --> 07:19.840]  Can't do that
[07:19.840 --> 07:21.840]  Can't do that anywhere
[07:21.840 --> 07:24.840]  But that's exactly what they were doing
[07:24.840 --> 07:28.840]  Now, the lawsuit was not based upon that premise
[07:28.840 --> 07:36.840]  I don't know why they decided to use the one they did, but they chose the poor people persuasive argument
[07:36.840 --> 07:42.840]  That only the poor couldn't pay these fees, and therefore they were the ones that were losing their licenses
[07:42.840 --> 07:48.840]  And therefore people with money had an advantage under these fines and fees over those who did not
[07:48.840 --> 07:53.840]  Who were just struggling to make ends meet for the fines that were levied against them just for the ticket itself
[07:53.840 --> 08:00.840]  Now, I can't imagine to begin why anyone considered that to be the best argument
[08:00.840 --> 08:05.840]  Considering the absolute due process violations involved in the one I'm talking about
[08:05.840 --> 08:10.840]  Because they're absolutely there. There's no if, ands, or buts about that
[08:10.840 --> 08:16.840]  But leave it to the attorneys to figure out the easiest way out
[08:16.840 --> 08:25.840]  Now, allegedly there had been several attempts prior to last year to repeal Section 708 by the legislator
[08:25.840 --> 08:28.840]  Or at least certain members of the legislature
[08:28.840 --> 08:34.840]  But they were met with resistance and it was unsuccessful
[08:34.840 --> 08:40.840]  Now, if that's true, let me try to explain to you why I think that is
[08:40.840 --> 08:51.840]  Another thing there is lots of case law on is that the police power cannot be used for the purpose of generating revenue
[08:51.840 --> 09:05.840]  Now understand this, the police power of the state cannot be used for the purpose of generating revenue
[09:05.840 --> 09:10.840]  There's tons of case law on that, says it cannot be used that way
[09:10.840 --> 09:15.840]  It is absolutely unconstitutional to use it that way
[09:15.840 --> 09:29.840]  So, if we actually look at the text of SB 2048 and see what it says about the repeal of Chapter 708
[09:29.840 --> 09:36.840]  And what it did was it repealed it and it replaced it with a new flat $50 fine
[09:36.840 --> 09:45.840]  But the $50 fine is non-waivable, the court can't set it aside, the court must collect it
[09:45.840 --> 09:49.840]  The moment you plead guilty or no contest
[09:49.840 --> 09:59.840]  Now the question is, is this $50 going to be brought up at the time of the prosecution?
[09:59.840 --> 10:09.840]  Because if it's not, we still have exactly the same problem that we had with the behind the scenes fees on the other program that's now history
[10:09.840 --> 10:19.840]  So the jury is not deciding whether or not this $50 should be assessed against you, the state is
[10:19.840 --> 10:28.840]  And they say that it is regardless of the outcome of the case if you plead guilty or no contest
[10:28.840 --> 10:33.840]  And if you go to trial and you get convicted, it's immediately payable
[10:33.840 --> 10:36.840]  Forget the process of appeal
[10:36.840 --> 10:44.840]  It says right here in the new bill that upon conviction the court shall collect this fee
[10:44.840 --> 10:49.840]  So you're going to have to pay before you can even appeal
[10:49.840 --> 11:01.840]  Which is the way they're doing it right now anyway by requiring only those with Class C offenses and fine only offenses of any nature
[11:01.840 --> 11:08.840]  They're requiring you to pay twice the amount to get your appeal
[11:08.840 --> 11:15.840]  Now that too is a denial of due process, it's purchasing justice
[11:15.840 --> 11:26.840]  If you can't file twice the amount of the fines levied against you in the judgment, then you don't have a right to appeal
[11:26.840 --> 11:29.840]  And thus you're stuck
[11:29.840 --> 11:41.840]  Now if people have a hard time paying the fine in the judgment, how are they going to pay double the fine up front to get an appeal
[11:41.840 --> 11:51.840]  The process is absolutely no less ornerous and egregious in violation of due process and penalization of the poor
[11:51.840 --> 11:57.840]  Than was the behind the scenes fines and fees of the driver responsibility program
[11:57.840 --> 12:02.840]  It is absolutely no less of a constitutional protections violation
[12:02.840 --> 12:05.840]  None
[12:05.840 --> 12:10.840]  But let's get back to that police power used for the generation revenue thing
[12:10.840 --> 12:18.840]  Now chapter 708 was predicated upon the public message from the legislature
[12:18.840 --> 12:28.840]  That the money that these fees were supposed to bring in was to be used for regional trauma centers
[12:28.840 --> 12:36.840]  And for medical staff and people to populate and run those trauma centers, right?
[12:36.840 --> 12:44.840]  But when you read the actual law of the subject, the answer to that is that's propaganda
[12:44.840 --> 12:46.840]  Because it's a lie
[12:46.840 --> 12:49.840]  And let me explain why that is
[12:49.840 --> 12:56.840]  The breakdown of those original behind the scenes fees is just like the breakdown on this $50
[12:56.840 --> 13:01.840]  Except this $50 comes in regardless
[13:01.840 --> 13:10.840]  Unlike those other fees, they may or may not get collected if the court decides to defer all this stuff
[13:10.840 --> 13:16.840]  Then they won't report you to the DPS, the DPS won't let me the behind the scenes fees, blah, blah, blah
[13:16.840 --> 13:19.840]  Although that hardly ever happened, they almost always did
[13:19.840 --> 13:22.840]  But the fact of the matter is the breakdown is essentially the same
[13:22.840 --> 13:30.840]  Municipalities and counties that prosecute you get 4% of the $50, which is $2
[13:30.840 --> 13:36.840]  The state gets the remainder, which is $48
[13:36.840 --> 13:42.840]  Now out of that $48, let me explain to you how the state breaks this down
[13:42.840 --> 13:46.840]  And let me read how this division takes place
[13:46.840 --> 13:55.840]  This is the new section that they put in, and this new section is, let's see
[13:55.840 --> 14:06.840]  A change to sub chapter C, chapter 542 of the transportation code, it's adding section 542.304, which reads as follows
[14:06.840 --> 14:11.840]  And you go all the way down to subsection F and you read this
[14:11.840 --> 14:20.840]  A municipality or county may retain 4% of the money collected under this section as a service fee for the collection
[14:20.840 --> 14:27.840]  If the municipality or county remits the funds to the comptroller within the period prescribed in subsection E
[14:27.840 --> 14:46.840]  The municipality or county may retain any interest accrued on the money if the custodian of the money deposited in the treasury keeps records of the amount of money collected under this section that is on deposit in the treasury and remits the funds to the comptroller within the period prescribed in subsection E
[14:46.840 --> 14:59.840]  Okay, so municipalities and counties are getting to keep part of the money, and they're getting to keep the interest that money accrues while they're holding it to turn it over to the state
[14:59.840 --> 15:12.840]  Okay, subsection G, of the money received by the comptroller under this section, the comptroller shall deposit. Now this is the remaining $48
[15:12.840 --> 15:23.840]  Subitem G1, 70% to the credit of the undedicated portion of the general revenue fund
[15:23.840 --> 15:32.840]  Okay, 70% to the credit of the undedicated portion in the general revenue fund
[15:32.840 --> 15:48.840]  Okay, and subsection G2, 30% to the credit of the designated trauma facility and emergency medical services account under section 780.003 Health and Safety Code
[15:48.840 --> 16:03.840]  So the state is putting 70% of these funds into the general fund of the state, which is their revenue bucket, and they're only allocating 30% of the money to the trauma centers
[16:03.840 --> 16:19.840]  Yet they say that these fines and fees are related to the police power, and the way they got this bill enacted in the first place was telling the public that it was to fund trauma centers
[16:19.840 --> 16:37.840]  But it wasn't, and it never was. It was about taxation. It was about revenue. And folks, here's the problem, and I said it before and I'll say it again
[16:37.840 --> 16:52.840]  This entire scheme is being applied to the public in order to tax us for the exercise of a right, which is our right to freely use and access our roads for our private business and pleasure

[21:00.840 --> 21:08.840]  The state is going to assess the $50 fine at the time of conviction or at the time of the pleading of guilty or no contest.
[21:08.840 --> 21:27.840]  Like all the other stuff, and like I said before, they create a poor people's violation when they make it where someone who is poor and barely getting by cannot afford to pay this stuff in order to get justice or to keep their license from being suspended.
[21:27.840 --> 21:45.840]  Which one is more important in your book, ladies and gentlemen? The fact that your due process rights are being violated on a daily basis because the state is taxing you on the exercise of a right by hidden fees that you're not being told about, that are not being adjudicated,
[21:45.840 --> 22:00.840]  and you're having to pay in order to even get your right to appeal when you're convicted of an offense that you have absolutely no legal ability to commit.
[22:00.840 --> 22:10.840]  Get that? If you're not engaged in the action of transportation, then you are not subject to the code.
[22:10.840 --> 22:19.840]  I don't care how they do this, there's only two ways that you can look at the Texas Transportation Code from a perspective of law.
[22:19.840 --> 22:41.840]  First and foremost, it is remedial. It is there to allow for obtaining remedy by those who are injured by the acts of someone who is subject to the rules and regulations that are in that statute or in that code.
[22:41.840 --> 22:57.840]  And that code is regulatory in nature. Now what can they regulate? They can't regulate everything like they want you to believe they can.
[22:57.840 --> 23:11.840]  They can only regulate certain things, and all of those things have to do with something that involves commerce.
[23:11.840 --> 23:28.840]  Yep, like it or not, that's what they can regulate. They can regulate businesses, occupations, things of that nature that present an imminent public health threat.
[23:28.840 --> 23:42.840]  That's why certain kinds of occupations require certain kinds of permits and licenses to engage in, or at least that's the story for most of them. It's not true for all of them, but it is true for some of them.
[23:42.840 --> 23:56.840]  The medical industry, for instance, policing for sure, and unfortunately that doesn't protect us from incompetence, idiocy, and broken parts because we have those in abundance.
[23:56.840 --> 24:06.840]  So all licensing schemes are not there for the purpose of the police power. They are there for the revenue.
[24:06.840 --> 24:18.840]  Okay, how does that work? Well, we've got Supreme Court rulings that say that a right cannot be taxed, nor can a right be licensed and sold back to you for a fee.
[24:18.840 --> 24:35.840]  So if you're exercising a right, they can't tax it by the means of a license. And the legal definition of a license, in general, is permission to do that which would otherwise be illegal without the license.
[24:35.840 --> 24:47.840]  It is not illegal for the people to use their roads and highways for their private business and pleasure. It's not illegal. Never has been.
[24:47.840 --> 24:55.840]  Never could be. It's our road. Therefore, it cannot be illegal for us to use it.
[24:55.840 --> 25:07.840]  Well, it's not illegal for you to use it, but you have to use it like this or like this because you can't use it like this without our permission.
[25:07.840 --> 25:22.840]  Okay? This is the same argument they've used to try to regulate and create gun control and all kinds of licensing and everything else for us to exercise our right to keep and bear arms.
[25:22.840 --> 25:42.840]  It is just another fraudulent argument by government to attempt a license of right and thus restrict access to that right and its free exercise by simply removing the permission to exercise it, i.e. the license any time they want.
[25:42.840 --> 26:00.840]  What should have happened, the very moment anyone attempted to pass legislation or a constitutional amendment that allowed them to violate a right through legislation,
[26:00.840 --> 26:18.840]  the people responsible for putting that into motion should have been removed from office. They should have been charged with sedition. They should have been tried by a jury and they should have been sentenced to jail or to be hung.
[26:18.840 --> 26:33.840]  But we didn't. We bit our lip and we let them do it and we keep letting them do it and they keep getting bigger and more broad and brazen about it.
[26:33.840 --> 26:48.840]  They keep expanding their reach into our life and our rights and scrubbing them off at the corners until they've gone from being perfectly squarely delineated to being nice and oval or nice and round,
[26:48.840 --> 27:03.840]  or whatever shape they want to carve them into to fit the niche they want them to go in instead of us keeping them the way they were by telling them no. That is beyond your power to touch.
[27:03.840 --> 27:15.840]  See this document right here called the Constitution? We told you you couldn't touch it. What do you think you're attempting to do here?
[27:15.840 --> 27:22.840]  We learned to put up with a lot and they have taken full advantage of it.
[27:22.840 --> 27:43.840]  So the question is, once again, what are we going to do about it? Well, one of the things I'm working on right now besides updating the seminar material is actually putting in a public remonstrance on the subject of the transportation code and its misapplication to the general public.
[27:43.840 --> 27:59.840]  This remonstrance is going to demand a public hearing, not simply some response from some legislator or some set of legislators, but it's going to demand an actual public hearing.
[27:59.840 --> 28:26.840]  Where the actual law, current and historical, can be brought to bear in the argument once and for all and that the courts themselves are ignoring the absolute relative fact and requirement of proving the existence of transportation before they can use a regulatory statute under that code to punish someone.
[28:26.840 --> 28:35.840]  Remember folks, transportation is not just a word in the title like the Third Court of Appeals morons want to claim it is.
[28:35.840 --> 28:47.840]  In SB 971 back in 1995, transportation is the single subject matter under which all the statutes of that code were enacted.
[28:47.840 --> 28:58.840]  As the single subject matter, another legal phrase for that term is subject matter jurisdiction.
[28:58.840 --> 29:19.840]  The subject matter jurisdiction of the transportation code is not the operation of a motor vehicle or the licensing of a driver or operator, it is to engage and participate in the privileged activity of transportation, all of which those things are a subordinate part.
[29:19.840 --> 29:30.840]  It is the subject matter. An absent proof of the existence of the subject matter, the offense cannot exist.
[29:30.840 --> 29:44.840]  Hence, there is no adjudicated matter before the court because there is no violation of law absent the subject matter.
[29:44.840 --> 29:54.840]  We'll get into that just a little bit more on the other side. In the meantime, 512-646-1984 is the calling number. We'll be right back after this break.

[33:34.840 --> 33:50.840]  Okay, now without the existence of transportation as the primary subject matter and the subject matter jurisdiction of the code in general, thus the subject matter relativity of all of the statutes in that code,
[33:50.840 --> 33:56.840]  absent proof of that subject matter, there is no proof of an offense.
[33:56.840 --> 33:59.840]  This is what the courts are intentionally ignoring.
[33:59.840 --> 34:05.840]  This is what the courts are refusing to allow you to bring to bear in the argument.
[34:05.840 --> 34:11.840]  Of course, I haven't seen anybody make it correctly yet so that they wouldn't have any choice but to look at it that way.
[34:11.840 --> 34:24.840]  But regardless, you have the third court of appeals simply saying we disagree with his definition without providing any legal basis for it whatsoever as to why they disagree,
[34:24.840 --> 34:35.840]  what alternative definition they're attempting to use and where they got it, all of which violates the Texas government code, both chapters 311 and 312.
[34:35.840 --> 34:46.840]  So the third court of appeals and the county courtship law and the court of criminal appeals are all guilty of the same violations of the Texas Rules of Criminal Procedure.
[34:46.840 --> 34:51.840]  They're guilty of the same violations of statutory interpretation and application.
[34:51.840 --> 34:55.840]  They're guilty of the same violations of due process.
[34:55.840 --> 35:09.840]  In fact, they are the key implementers of the due process violations because they ignore the law and just do what they want.
[35:09.840 --> 35:18.840]  You go to court and you have a prosecutor standing up there, well, anybody with half a brain would agree with how I'm saying this works.
[35:18.840 --> 35:24.840]  And then they get upset when you look at them and go, I absolutely agree with you.
[35:24.840 --> 35:33.840]  Judge, do you agree with what he just said?
[35:33.840 --> 35:43.840]  He just admitted it would take someone with half a brain to argue the way he's arguing.
[35:43.840 --> 35:45.840]  Let's look at the facts here, folks.
[35:45.840 --> 35:53.840]  Undeniable, historical, never to be altered facts.
[35:53.840 --> 36:12.840]  The people from the time we set foot on this continent have been able to move freely about the land using any means that we could make available to ourselves, whether we bought it, built it, stole it, whatever.
[36:12.840 --> 36:22.840]  We were free to move about this land and every other land using whatever modes of conveyance was available in the day.
[36:22.840 --> 36:24.840]  Nobody could license us to do it.
[36:24.840 --> 36:27.840]  No one did license us to do it.
[36:27.840 --> 36:36.840]  We didn't have to ask anyone's permission unless we were going on to land that belonged to them.
[36:36.840 --> 36:40.840]  So what changed?
[36:40.840 --> 36:44.840]  Nothing.
[36:44.840 --> 36:48.840]  At least not from a rights perspective.
[36:48.840 --> 36:58.840]  What did change was the mindsets of the people as to what rights meant and what they were and what the power of government either was or wasn't.
[36:58.840 --> 37:08.840]  And this, believe it or not, was brought up to bear and was happily arranged and controlled by the Bar Associations.
[37:08.840 --> 37:09.840]  Now, why do I say that?
[37:09.840 --> 37:11.840]  How can I prove that?
[37:11.840 --> 37:17.840]  Well, as the old saying goes, correlation is not proof of causation.
[37:17.840 --> 37:29.840]  But here we have some pretty amazing correlation that coincides with the series of events.
[37:29.840 --> 37:33.840]  First, the state bars get formed.
[37:33.840 --> 37:56.840]  The McCarthy Era Congress attempts to go after the state bars because they even have a full-fledged report on it you can find online where McCarthy flat-out details how the state and national bar associations are actually communist societies that are working toward taking over the American governmental system.
[37:56.840 --> 38:04.840]  And thus converting us from a republican form of government to a socialist or communist form of government.
[38:04.840 --> 38:09.840]  Now, let's check our historical evolution of this process.
[38:09.840 --> 38:16.840]  Government has increased its power a thousandfold from what it was in that day and age.
[38:16.840 --> 38:19.840]  Just think about it.
[38:19.840 --> 38:25.840]  They told the American people that they had the power to seize their gold when they did not.
[38:25.840 --> 38:34.840]  They told the American people that they had to use funny money rather than the constitutional means of currency, which they are not required to do.
[38:34.840 --> 38:40.840]  They were not allowed to allow them to do it, at least not for the payment of any public debt.
[38:40.840 --> 38:49.840]  Now, they can use, according to the Constitution, they can use funny money internally within the government any way they want to.
[38:49.840 --> 38:55.840]  But once they brought it into the mainstream as payment for a debt, they violated the Constitution.
[38:55.840 --> 39:01.840]  Period. No yes, no ands, no buts.
[39:01.840 --> 39:14.840]  Then the state bars started creating the codified systems and each year, legislative year that is, that system of law changes.
[39:14.840 --> 39:29.840]  The people cannot be expected to base their rights and tie them to an ever-shifting bed of quicksand of statutory law.
[39:29.840 --> 39:34.840]  Our rights are not tethered to statutory law for exactly that reason.
[39:34.840 --> 39:39.840]  They don't change just because legislation changes.
[39:39.840 --> 39:46.840]  Hence, another reason why a regulatory code cannot be applied to a right.
[39:46.840 --> 39:57.840]  But as time has gone on, we have moved from a constitutional republic to an oligarchy, which is run by the bar associations.
[39:57.840 --> 40:00.840]  We can prove this.
[40:00.840 --> 40:04.840]  The majority of your legislative members are bar members.
[40:04.840 --> 40:15.840]  The majority, and that's in both houses, by the way, your entire judicial department of government is populated by bar members.
[40:15.840 --> 40:18.840]  No yes, no ands, no buts.
[40:18.840 --> 40:24.840]  The people have no voice and no power within an entire branch of their own government.
[40:24.840 --> 40:26.840]  You get that?
[40:26.840 --> 40:37.840]  That entire branch has been reserved by the attorneys in the legislature to the attorneys in the judiciary via legislative acts.
[40:37.840 --> 40:43.840]  If you don't believe me, check Chapter 82 of the government code.
[40:43.840 --> 40:58.840]  Check the 1939 enactment of the State Bar Act, which is what's codified in Chapter 82 of the government code.
[40:58.840 --> 41:00.840]  The attorneys take over the legislature.
[41:00.840 --> 41:08.840]  They then use the legislature to create law that gives them complete control of an entire department of government.
[41:08.840 --> 41:20.840]  They set themselves up as government officials when acting in the capacity of an attorney because Chapter 82 specifically says that the State Bar is an administrative office of the judicial department of government.
[41:20.840 --> 41:23.840]  Therefore, the bar is a government office.
[41:23.840 --> 41:29.840]  If the bar is a government office, then anyone with a bar card is a member of that office.
[41:29.840 --> 41:40.840]  As a member of that government office, why are they operating a for-profit private business using the power of that office to make that money?
[41:40.840 --> 41:45.840]  That is using a public office for personal gain.
[41:45.840 --> 41:47.840]  You see the problem here?
[41:47.840 --> 41:58.840]  Yet they in the courts have declared it constitutional and legal when in fact it is absolutely nothing of the kind.
[41:58.840 --> 42:01.840]  Do you see the problem here yet?
[42:01.840 --> 42:17.840]  Now not only do they control the legislature to create laws favorable to their control of the judicial department, they have also created laws that now allow them to violate the Constitution further by holding two offices of public emolument.
[42:17.840 --> 42:33.840]  They use their office as governmental attorneys to enrich themselves and they also get to hold office in the executive branch and the legislative branch and draw funds there.
[42:33.840 --> 42:35.840]  Think about that.
[42:35.840 --> 42:40.840]  Our governor is an attorney.
[42:40.840 --> 42:54.840]  Most of our public officials in control of a given elected office in the executive department are attorneys.
[42:54.840 --> 43:02.840]  Why am I the only one that seems to think this is a problem?
[43:02.840 --> 43:10.840]  I know I've been over this many times before, but obviously it hadn't sunk into a lot of people yet.
[43:10.840 --> 43:29.840]  But the fact is that we have lost control of our government and it's now in the hands of a very finite group of people who use it for self-serving means and ends.
[43:29.840 --> 43:49.840]  So this remonstrance is going to attack at least one portion of how these different entities within government have created a set of laws that appear to affect everyone when in fact they legally and constitutionally cannot do so.

[47:20.840 --> 47:25.840]  the term driver's license did not appear in Texas law until 1983.
[47:25.840 --> 47:30.840]  When it was originally added in 1983, this is how it was defined by Texas law.
[47:30.840 --> 47:40.840]  And this was under article 6687B, words and phrases defined.
[47:40.840 --> 47:48.840]  Sub-item 2, driver's license means a license or permit issued by the department that authorizes the operation of a motor vehicle.
[47:48.840 --> 47:59.840]  Sub-item 3, license or license to operate a motor vehicle means a driver's license or other license or permit
[47:59.840 --> 48:07.840]  to operate a motor vehicle issued under or granted by the laws of this state including a temporary license or instruction permit,
[48:07.840 --> 48:12.840]  the privilege of a person to drive a motor vehicle whether or not the person holds a valid license,
[48:12.840 --> 48:17.840]  a non-residence operating privilege, and an occupational license.
[48:17.840 --> 48:22.840]  Now that is pretty much the same thing that is in the code today.
[48:22.840 --> 48:27.840]  All right. It's not exactly the same, but it's pretty much the same.
[48:27.840 --> 48:35.840]  Now this includes these things. However, I haven't got to go back through this yet,
[48:35.840 --> 48:41.840]  these older statutes to verify that they're actually defined in there correctly.
[48:41.840 --> 48:48.840]  But the original licenses according to the way they were enacted in 1941,
[48:48.840 --> 48:52.840]  which is when a license was first required in Texas,
[48:52.840 --> 49:03.840]  and the license was specifically defined as either an operator, a commercial operator, or a chauffeur.
[49:03.840 --> 49:12.840]  Okay. Now let me explain what each of those licenses actually meant in relation to their name.
[49:12.840 --> 49:21.840]  As we both, as we all know, commercial operator and chauffeur was someone who was getting paid to drive, right?
[49:21.840 --> 49:28.840]  Because right down here it defines chauffeur as every person who is the driver for wages, compensation,
[49:28.840 --> 49:33.840]  or hire, or for fare of a motor vehicle transporting passengers.
[49:33.840 --> 49:36.840]  That's how chauffeur was defined.
[49:36.840 --> 49:40.840]  Now driver and operator are defined pretty much like they are today.
[49:40.840 --> 49:46.840]  Driver, every person who drives or is in actual physical control of a vehicle,
[49:46.840 --> 49:55.840]  operator, every person other than a chauffeur or commercial operator who is in actual physical control of a motor vehicle upon a highway.
[49:55.840 --> 49:58.840]  Okay. Now consider this.
[49:58.840 --> 50:01.840]  There's a distinctive difference between driver and operator.
[50:01.840 --> 50:11.840]  Driver is defined as someone in control of a vehicle, and operator is defined as someone in control of a motor vehicle.
[50:11.840 --> 50:14.840]  And those are two separately defined terms here as well.
[50:14.840 --> 50:18.840]  Motor vehicle is defined as every vehicle which is self-propelled,
[50:18.840 --> 50:27.840]  and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails.
[50:27.840 --> 50:37.840]  And then vehicle is every device upon or by which any person or property is or may be transported or drawn upon a highway,
[50:37.840 --> 50:45.840]  accepting devices moved by human power or used exclusively upon stationary rails or tracks.
[50:45.840 --> 50:53.840]  All right. So that's vehicle, motor vehicle, driver, operator, and driver's license.
[50:53.840 --> 50:55.840]  Okay.
[50:55.840 --> 51:00.840]  Now it does not actually define the term driver's license.
[51:00.840 --> 51:03.840]  It simply mentioned in the 1941 version of the statute.
[51:03.840 --> 51:05.840]  It doesn't define driver's license.
[51:05.840 --> 51:10.840]  It only says the licenses are operators, commercial operators, and chauffeurs.
[51:10.840 --> 51:19.840]  So we know that commercial operator is someone who's operating a commercial weight class motor vehicle.
[51:19.840 --> 51:22.840]  Okay. You get that?
[51:22.840 --> 51:30.840]  A commercial weight class motor vehicle most commonly used for the purpose of engaging in commerce, transportation.
[51:30.840 --> 51:32.840]  Same thing with a chauffer.
[51:32.840 --> 51:39.840]  That is someone who is engaged in transportation because they are being compensated for their act of driving.
[51:39.840 --> 51:42.840]  But what about operator?
[51:42.840 --> 51:49.840]  Operator, according to how the courts are doing things, simply means anyone in a car.
[51:49.840 --> 51:51.840]  Wrong.
[51:51.840 --> 51:55.840]  And let me explain why.
[51:55.840 --> 52:06.840]  If you read a little further, it says down here that the state or that no political subdivision of the state
[52:06.840 --> 52:15.840]  may not require any person who has a commercial operator's or chauffer's license to get an operator's license.
[52:15.840 --> 52:17.840]  Okay.
[52:17.840 --> 52:23.840]  And a person with an operator's license is not required to get a chauffer's license.
[52:23.840 --> 52:25.840]  Why?
[52:25.840 --> 52:33.840]  Because a chauffer and an operator operate essentially the same weight class of motor vehicles.
[52:33.840 --> 52:37.840]  Okay. Or vehicle, I should say.
[52:37.840 --> 52:42.840]  They operate essentially the same weight class, but they still perform the same type of function.
[52:42.840 --> 52:46.840]  They are carrying passengers.
[52:46.840 --> 52:53.840]  For example, an operator is someone driving a taxi cab.
[52:53.840 --> 52:55.840]  He doesn't have a chauffer's license.
[52:55.840 --> 52:58.840]  He has an operator's license.
[52:58.840 --> 53:06.840]  It is someone driving a shuttle bus that holds 16 passengers or less, including the driver.
[53:06.840 --> 53:09.840]  Okay. He's an operator.
[53:09.840 --> 53:17.840]  It is someone who is operating a motor vehicle for the purpose of transportation that is not in the weight class
[53:17.840 --> 53:26.840]  or burying a hazardous materials placard consistent with the weight class or labeling of a commercial motor vehicle.
[53:26.840 --> 53:31.840]  I.e. the commercial operator's license requirement.
[53:31.840 --> 53:34.840]  All of them are commercial.
[53:34.840 --> 53:40.840]  They're just for different categories of commercial use.
[53:40.840 --> 53:46.840]  The chauffer is dedicated to one passenger and that passenger's immediate family, friends, whatever,
[53:46.840 --> 53:52.840]  but they are not paying a fare to the chauffer to be driven around.
[53:52.840 --> 54:00.840]  The chauffer is given a salary and compensated according to whatever his contractual employment agreement is for driving.
[54:00.840 --> 54:04.840]  Okay. But he doesn't take fares.
[54:04.840 --> 54:11.840]  Only someone with an operator's license can take a fare.
[54:11.840 --> 54:21.840]  Taxi drivers, shuttle buses, any type of transportation service for passengers where they charge a fee of each individual that they're taking.
[54:21.840 --> 54:28.840]  And it numbers 16 or fewer at a time.
[54:28.840 --> 54:31.840]  Get it? It's not difficult.
[54:31.840 --> 54:37.840]  Even that attorney with half a brain should be able to understand that.
[54:37.840 --> 54:44.840]  Operator, just like commercial operator and chauffer, is still an occupation.
[54:44.840 --> 54:47.840]  It's a profession.
[54:47.840 --> 54:50.840]  Okay.
[54:50.840 --> 54:52.840]  Always has been.
[54:52.840 --> 55:05.840]  This is exactly why the licensing of the people to travel the roads on their own for their own private business and pleasure is absolutely illegal and unconstitutional.
[55:05.840 --> 55:09.840]  Because we are not operating a motor vehicle.
[55:09.840 --> 55:11.840]  We are not acting as a chauffer.
[55:11.840 --> 55:19.840]  We are not driving a commercial motor vehicle.
[55:19.840 --> 55:25.840]  But we're being taxed the same as those who engage in those occupations.
[55:25.840 --> 55:37.840]  And we're having to obtain permission to engage in private activities the same as those who are engaging in professions and occupations.
[55:37.840 --> 55:42.840]  And we're doing it so the state can generate revenue.
[55:42.840 --> 55:46.840]  Has nothing to do with the police power.
[55:46.840 --> 55:59.840]  This, ladies and gentlemen, is where the public school system has been so efficient in removing the public's ability to reason.
[55:59.840 --> 56:13.840]  The public's ability to critically think and analyze facts, words, and actions that are ongoing right in front of them.
[56:13.840 --> 56:25.840]  When I was in high school, when I wanted it to be anyway, when I liked my teachers and I was interested in the class because I liked the teachers and I liked the subjects we were learning.
[56:25.840 --> 56:30.840]  If I was interested in a subject and I liked how it was being taught, I excelled at it.
[56:30.840 --> 56:35.840]  If I didn't like the subject or the teacher who was teaching it, I did poorly at it.
[56:35.840 --> 56:38.840]  I didn't put myself into it, didn't see the point.
[56:38.840 --> 56:43.840]  The teacher wasn't teaching me, the teacher was just trying to force me to regurgitate.
[56:43.840 --> 56:47.840]  They weren't teaching me how to think, they were just teaching me how to repeat.
[56:47.840 --> 56:49.840]  And I didn't like things like that.
[56:49.840 --> 56:55.840]  But when I wanted it to be, English was one of my best subjects.
[56:55.840 --> 57:07.840]  When I tested for the military, my reading comprehension, I numbered in one of the highest percentages in the entire country for reading comprehension skills.
[57:07.840 --> 57:20.840]  I could read almost anything you put in front of me and tell you exactly what the purpose of what was written was intended to convey.
[57:20.840 --> 57:22.840]  And I was good at it because I enjoyed it.
[57:22.840 --> 57:23.840]  I liked words.
[57:23.840 --> 57:25.840]  And I still like words.
[57:25.840 --> 57:29.840]  I don't always like how they're used, though.
[57:29.840 --> 57:33.840]  And attorneys are one of the biggest reasons why that is.
[57:33.840 --> 57:40.840]  Because they have completely bastardized our English language.
[57:40.840 --> 57:58.840]  And you served it for a purpose intended to use that same language to defile a constitutional republic and enrich themselves in the process.
[57:58.840 --> 58:09.840]  And they've gotten very good at it and we have allowed them to remain very good at it because we are not doing anything to challenge what they do and how they do it.
[58:09.840 --> 58:11.840]  That's got to change.
[58:11.840 --> 58:14.840]  That's the whole reason for this remonstrance I'm working on.
[58:14.840 --> 58:17.840]  And I've been working on it for quite a while, in fact.
[58:17.840 --> 58:27.840]  But it's trying to write it in a way that even a legislator would understand it and take an interest in it that is the problem.
[58:27.840 --> 58:37.840]  Because if they know we're about to yank their financial cat out of the bag and throw it in the river with a rock tied around his neck, they're going to want to save the cat, of course.
[58:37.840 --> 58:41.840]  Despite the fact that the cat seriously needs to be drowned.
[58:41.840 --> 58:49.840]  All right, folks, y'all hang on and we will be right back.

[01:01:18.840 --> 01:01:24.840]  since they are stipulating that they do not have the time or the laboratory equipment to test the earth for THC.
[01:01:24.840 --> 01:01:33.840]  Margaret Moore, the Travis County District Attorney, announced earlier this month that she was dismissing 32 felony possession and delivery of marijuana cases because of the law.
[01:01:33.840 --> 01:01:47.840]  Mr. Abbott and other state officials, including the Attorney General, stipulated in a letter to county district attorneys back on Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works,
[01:01:47.840 --> 01:02:01.840]  as well as other cities, too, like the district attorney in El Paso, Kyma Esparza, a Democrat who also stated earlier this month that the law, quote, will not have an effect on the prosecution of marijuana cases in El Paso.
[01:02:01.840 --> 01:02:12.840]  However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County, who stated that, quote, the law is constantly changing on what makes something illegal based on its chemical makeup.

[01:02:22.840 --> 01:02:38.840]  A paper by Tulane University identified a five and a half inch American pocket shark as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark ever captured or recorded with the other one being found way back in 1979 in the East Pacific Ocean.

[01:03:36.840 --> 01:03:54.840]  Now, why is all of this such a big deal about how they've gotten everyone involved in this licensing scheme, besides the fact that they used to generate millions and millions and millions of dollars in illegal revenue off the backs of the people in the form of illegal taxation of a right?
[01:03:54.840 --> 01:04:11.840]  Well, the other rights that programs such as driver's licensing violates is your right to privacy, your right to be left alone, your right to be free of illegal searches and seizures, okay, without a warrant.
[01:04:11.840 --> 01:04:23.840]  The motor vehicle laws have been used to circumvent virtually every single one of those rights. Let me explain exactly how that works.
[01:04:23.840 --> 01:04:40.840]  The courts have declared that in a motor vehicle, you're operating in the public, and therefore you have a lesser expectation of privacy, and therefore an officer, when he pulls you over, is free to do all the things associated with the enforcement of that code against you as if you were someone subject to that code.
[01:04:40.840 --> 01:04:46.840]  In the course of that, he can search your car, he can search you, blah, blah, blah, blah, blah.
[01:04:46.840 --> 01:04:54.840]  If he makes a mistake about the law that he pulls you over for, he's not the one on the hook for what he finds, you are.
[01:04:54.840 --> 01:05:05.840]  So even when he screws up, he's right. Even when he's ignorant of the law, he's right. You're never right, okay?
[01:05:05.840 --> 01:05:12.840]  It allows them to track your whereabouts constantly, okay?
[01:05:12.840 --> 01:05:31.840]  Not only do they always have your current address on file via your license and your motor vehicle registration and all that other stuff, now with the license plate scanners, they know your constant whereabouts, or at least that of your car, which they're pretty sure that you're usually the one that's in, right?
[01:05:31.840 --> 01:05:52.840]  So just with that license plate scanner, they can track your every movement, and as those become more prolific, so will the invasion in your privacy and ability to move about without government knowing everything about where you've been, how long you were there, et cetera, et cetera, et cetera.
[01:05:52.840 --> 01:06:15.840]  How long before they make motor vehicle manufacturers put little RFID chip readers into their cars that saves that information to the car's computer, and so when you go shopping somewhere and you come out with those micro dot RFID chips still active on the items that you purchased,
[01:06:15.840 --> 01:06:37.840]  you can get into your car, your vehicle downloads all of that information directly to the car's computer, and any time they want, the police can find out everything you've ever bought, when you bought it, where you bought it, all of it, because your car is being used to spy on you.
[01:06:37.840 --> 01:06:54.840]  And that's just a greater level of spying than what it's currently doing, because it is spying on you, and they're using these laws to make it possible by subjecting you to a law that has nothing to do with you.
[01:06:54.840 --> 01:07:02.840]  They have put you under the umbrella of rights violations that the courts have said are perfectly fine.
[01:07:02.840 --> 01:07:21.840]  What in fact they're not? Once again, who do we have to thank for that? Judges, prosecutors, defense attorneys, those are the people who have acted to create the law that makes this a commonplace rights violation, especially on the higher courts.
[01:07:21.840 --> 01:07:28.840]  And then of course you have the higher courts that are populated with complete and utter morons like our third court of appeals.
[01:07:28.840 --> 01:07:39.840]  I don't know what it is about the third court of appeals. The third court of appeals is the state level version of the ninth court of district appeals at the federal level.
[01:07:39.840 --> 01:07:55.840]  They are such a group of idiotic, unbelievably dense and obtuse individuals when it comes to the subjects of rights and law, it's amazing that they could have ever passed a class on constitutional law.
[01:07:55.840 --> 01:08:06.840]  But then again, that would depend upon who taught that class and how they treated constitutional law and individual rights relative to those teachings.
[01:08:06.840 --> 01:08:18.840]  That's the other problem we have in liberals running your colleges. Socialist liberals even worse running your colleges, because their material is meant to indoctrinate.
[01:08:18.840 --> 01:08:27.840]  And it's not just colleges, but it's grade schools all the way down to kindergarten. They're doing exactly the same thing.
[01:08:27.840 --> 01:08:40.840]  But the fact of the matter is, government has used laws just like this to invade every aspect of our lives to such a degree that we cannot even move around without being tracked.
[01:08:40.840 --> 01:08:53.840]  And we don't even realize it for the most part, because it's just something that we've accepted as being normal and part of everyday life, when in fact it is a great, big, fraudulent lie.
[01:08:53.840 --> 01:09:00.840]  And it has been from day one.
[01:09:00.840 --> 01:09:12.840]  The design of the three types of licenses into their commercial categories should be just one aspect of proving that we are viewing this correctly.
[01:09:12.840 --> 01:09:24.840]  The other aspect being how the administrative code defines the duties of the Texas Department of Public Safety officers in relation to the transportation code.
[01:09:24.840 --> 01:09:39.840]  Because when you look at every chapter of the transportation code that deals with any kind of enforcement other than the actual registration part of it, that's done by the Department of Motor Vehicles now, but it's still the same thing.
[01:09:39.840 --> 01:09:48.840]  The vehicle, just like the person behind the wheel, only has to be licensed when it is going to be used as a vehicle.
[01:09:48.840 --> 01:09:55.840]  Okay, if it's not being used as a vehicle for the purpose of engaging in transportation, it doesn't have to be registered.
[01:09:55.840 --> 01:09:56.840]  Why?
[01:09:56.840 --> 01:10:09.840]  Because registration is a license for that car to be used to engage in that privileged occupation or business.
[01:10:09.840 --> 01:10:25.840]  Otherwise, you are having to get the state's permission to do that, which are the basis being you would have to be getting the state's permission to do that, which would otherwise be illegal without the license, which is engaging in this occupation by using this car as a vehicle.
[01:10:25.840 --> 01:10:29.840]  That's what you're getting permission to do.
[01:10:29.840 --> 01:10:40.840]  But for a private individual to use their car to travel wherever they want to go for their own private business in pleasure cannot be, by default, illegal without a license.
[01:10:40.840 --> 01:10:43.840]  Hence, the definition of license would not apply.
[01:10:43.840 --> 01:10:49.840]  That which would be otherwise illegal to do without the license, okay?
[01:10:49.840 --> 01:10:51.840]  We have a right to use the roads.
[01:10:51.840 --> 01:10:55.840]  We have a right to use to acquire and use our property.
[01:10:55.840 --> 01:10:59.840]  We do not have the right to use the roads as a place of business.
[01:10:59.840 --> 01:11:20.840]  We do not have the right to use our property on our public roads to facilitate that business, because that business is making use of something that belongs to everybody for private gain, and that is not right.
[01:11:20.840 --> 01:11:34.840]  You would think that these distinctions would be easy enough to understand for someone who believes in a constitutional republic and individual rights to person, property, pursuit of happiness, and all that other good stuff.
[01:11:34.840 --> 01:11:46.840]  Bring this up to any lawyer or any judge, and they will never, ever agree with you unless they're getting ready to retire.
[01:11:46.840 --> 01:11:49.840]  Then and only then may they turn around and go, you know what, you've always been right.
[01:11:49.840 --> 01:11:57.840]  I just couldn't tell you that because it would endanger my pension.
[01:11:57.840 --> 01:12:01.840]  This entire system is built on fraud and corruption.
[01:12:01.840 --> 01:12:03.840]  That's not hard to prove.
[01:12:03.840 --> 01:12:12.840]  All it takes is a little bit of looking and a little bit of reading, a little bit of comparing.
[01:12:12.840 --> 01:12:16.840]  It is self-evident that it's based upon fraud and corruption.
[01:12:16.840 --> 01:12:31.840]  It is self-evident who is responsible for that fraud and corruption, because they're the only ones in a position to do it, and their own opinions are the evidence against them.
[01:12:31.840 --> 01:12:39.840]  An opinion of a court that violates the Second Amendment is proof the court violated their oath.
[01:12:39.840 --> 01:12:46.840]  It is proof the court committed a sedition by undermining the people's rights protected by the Constitution.
[01:12:46.840 --> 01:12:50.840]  It is flat-out evidence of that.
[01:12:50.840 --> 01:12:52.840]  There is no way around it.
[01:12:52.840 --> 01:13:08.840]  You could not ask for a better documentation of paper trail proving criminal conduct by a government official than a court opinion that violates everything in their oath of office and the constitutional provisions they ruled upon.
[01:13:08.840 --> 01:13:17.840]  Incorrectly in that opinion.
[01:13:17.840 --> 01:13:24.840]  Like I say, folks, they are shaping our rights to fit the niche they want our rights to fit in.
[01:13:24.840 --> 01:13:33.840]  Not where they belong, which is squarely right out here in the open for everyone to see and no one to violate.
[01:13:33.840 --> 01:13:51.840]  And anyone who does has to pay the consequences, which was the only purpose we put together governments and societies for in the first place, was to protect those rights as they were and are.
[01:13:51.840 --> 01:14:11.840]  And when the government acts outside of that, as the founding fathers said, then we have the right to alter or abolish it by any means that we deem necessary and expedient.
[01:14:11.840 --> 01:14:13.840]  So when are we going to do that?
[01:14:13.840 --> 01:14:29.840]  Because if we're way beyond necessary, we are way beyond necessary.
[01:14:29.840 --> 01:14:41.840]  So since I can't fight a war by myself in this regard, I've decided to do it with paper instead and I'm trying to write this for monstrance and we'll go from there and see what happens.
[01:14:41.840 --> 01:15:06.840]  Folks, as usual, I'm sitting up here doing all this stuff and trying really hard to teach people about it and to make sure that I keep up with the changes in it so that I'm not talking out of one side of my face and having to throw it back up in a different way on the other side because I have it wrong because they changed it or got rid of it or something else.
[01:15:06.840 --> 01:15:10.840]  That's the hardest part about this is it is a huge expanse of writing.
[01:15:10.840 --> 01:15:14.840]  Because it's not just one code, it's many codes.

[01:15:29.840 --> 01:15:47.840]  And that does not even include the various court opinions, AG opinions and everything else that go into that evidence pile.
[01:15:47.840 --> 01:15:56.840]  There is just so much wrong with this and I'm here all alone trying to do something about it.
[01:15:56.840 --> 01:16:01.840]  I know there are people out there fighting their court cases and that's great.
[01:16:01.840 --> 01:16:04.840]  We need to, we must.
[01:16:04.840 --> 01:16:13.840]  But when you have the Third Court of Appeals undermining the rule of law to make even that fight pointless, what do we have left of us?
[01:16:13.840 --> 01:16:21.840]  Because make no mistake, the Third Court of Appeals ruling in every single case involving Perkins was dead wrong.
[01:16:21.840 --> 01:16:31.840]  It was a violation of law, it was a violation of due process, it was completely biased and prejudicial by the appellate court.
[01:16:31.840 --> 01:16:36.840]  It was absolutely wrong.
[01:16:36.840 --> 01:16:40.840]  And we need to do something about it.
[01:16:40.840 --> 01:16:47.840]  But that said, that requires me to do this instead of everything else, which means I need your help.

[01:20:12.840 --> 01:20:28.840]  And this is an article that shows pictures of three West Virginia deputies who vandalized the outside security cameras on a home
[01:20:28.840 --> 01:20:36.840]  by cutting the wires, powering the cameras, and breaking into the home through a window.
[01:20:36.840 --> 01:20:42.840]  Now this was someone that they were there to serve a civil lawsuit warrant on.
[01:20:42.840 --> 01:20:53.840]  Didn't require them to enter the house. The person was not home, but they cut the wires to their cameras and then break into the house through a window.
[01:20:53.840 --> 01:21:12.840]  Then they spent 25 minutes rummaging through the house, taking photographs, testing some ashes they found in a jar, which turned out to be an urn that had cremations from this guy's friend in it.
[01:21:12.840 --> 01:21:24.840]  They rifled through his closets and got all of his guns, laid them out on the counters and the stove, and took pictures of all of his guns, recorded the serial numbers.
[01:21:24.840 --> 01:21:30.840]  And yet they had no warrant. They made no report of having entered the home.
[01:21:30.840 --> 01:21:35.840]  They made no report of all the things that they did while they were there.
[01:21:35.840 --> 01:21:44.840]  Now this is a drug task force or fugitive task force that's working in conjunction with the U.S. Marshals Service from out of the Sheriff's Department in this county.
[01:21:44.840 --> 01:21:48.840]  And these are three deputies with that Sheriff's Office.
[01:21:48.840 --> 01:22:04.840]  And neither the Sheriff's Office nor the federal marshals or any other state agency has any record that these deputies ever entered that home, ever obtained a warrant to enter that home,
[01:22:04.840 --> 01:22:19.840]  ever put any of the things they collected into any kind of evidence repository or wrote a report that they had done the things they'd done.
[01:22:19.840 --> 01:22:31.840]  This is the kind of activity that is being protected by prosecutors and judges across this country.
[01:22:31.840 --> 01:22:40.840]  Someone is going to try to find some way to justify the actions of these officers, guaranteed, even if it's just their defense attorney.
[01:22:40.840 --> 01:22:50.840]  But someone is going to try to justify this and say, it's okay. They were well within their power to do this.
[01:22:50.840 --> 01:22:57.840]  You wait and see. Mark my words if that is not something that happens.
[01:22:57.840 --> 01:23:10.840]  We know it's not right. We know it was a crime and it should not matter what the occupation is of the person who committed it, as to whether or not they're held accountable for it.
[01:23:10.840 --> 01:23:26.840]  But that's exactly how this will play out because this profession is protected by the system that is attempting to alter our form of government into one that serves it instead of us.
[01:23:26.840 --> 01:23:38.840]  And who is holding the reins? Well, right back to the Bar Associations, the prosecutors, the judges, the defense attorneys.
[01:23:38.840 --> 01:23:46.840]  They're the ones that protect people just like this.
[01:23:46.840 --> 01:23:55.840]  They're the ones that find a way to minimize any punishment they get if they are ever punished.
[01:23:55.840 --> 01:24:09.840]  If you or I steal a $10 pair of sunglasses from a car, and this is a real example, by the way, we get sentenced to 99 years to life in the state penitentiary.
[01:24:09.840 --> 01:24:16.840]  99 years to life for stealing a $10 pair of sunglasses from a car.
[01:24:16.840 --> 01:24:27.840]  Yes, there was someone in Texas convicted of exactly that offense and sentenced to exactly that time frame in prison by a judge.
[01:24:27.840 --> 01:24:40.840]  But a cop can assault you, shoot you, cripple you, murder you.
[01:24:40.840 --> 01:24:54.840]  And all he has to do is resign and not try to be a cop anywhere else, and he gets away with it.
[01:24:54.840 --> 01:25:06.840]  He can lie, he can cheat, he can steal, and he will be protected in all of it.
[01:25:06.840 --> 01:25:11.840]  I mean, when are we going to do something about this, folks?
[01:25:11.840 --> 01:25:21.840]  When are we going to say enough is enough and put our foot down and abolish how this system functions and those responsible for it?
[01:25:21.840 --> 01:25:32.840]  How did we allow ourselves to be completely alienated from an entire department of our own government so that we would have a voice in how this stuff is done?
[01:25:32.840 --> 01:25:49.840]  How different would things be if the people had a voice on the Criminal Court of Appeals, if the people had a voice on the Supreme Court of Texas, who were not beholding to the bar for what they did,
[01:25:49.840 --> 01:25:59.840]  who acted in accordance with the Constitution first and everything else second, which is how they're supposed to do it.
[01:25:59.840 --> 01:26:04.840]  How different would things be?
[01:26:04.840 --> 01:26:21.840]  That depends on whether or not they were the only one of their kind in any of those places or whether or not it was a majority of those kind in any one of those places.
[01:26:21.840 --> 01:26:31.840]  We have a real problem, a very, very real problem with our government.
[01:26:31.840 --> 01:26:34.840]  It is being corrupted from the inside.
[01:26:34.840 --> 01:26:43.840]  It is being used to line the pockets of many of them on the inside.
[01:26:43.840 --> 01:26:55.840]  And it is using us to provide the means for that to happen.
[01:26:55.840 --> 01:27:00.840]  And I'm just really tired of it myself.
[01:27:00.840 --> 01:27:10.840]  I was so tired of it so long ago that I jumped at the chance when I was offered an opportunity to become a host on this network.
[01:27:10.840 --> 01:27:20.840]  Because I had experienced enough personally and seen enough in between the time frame of my experiences and all the other ones I had seen through my life
[01:27:20.840 --> 01:27:31.840]  and all the new ones I was seeing emerge as time progressed against other people as well to understand something is really, really off here.
[01:27:31.840 --> 01:27:35.840]  Something is no longer as it should be.

[01:27:44.840 --> 01:27:58.840]  And I have driven myself ever since to identify, define, and educate anyone and everyone who would listen on what it is I have found.

[01:28:13.840 --> 01:28:16.840]  The law can be a lot of fun to learn.

[01:28:27.840 --> 01:28:37.840]  And no matter what anyone tries to tell you, there are no patently black and white areas.
[01:28:37.840 --> 01:28:41.840]  When it comes to the written word, there's always some shade of gray.
[01:28:41.840 --> 01:28:44.840]  Now there's more in some cases than there are in others.

[01:34:58.840 --> 01:35:05.840]  Well, 70, 80 years ago, long before you and I were born, Eddie, we put lawyers on pedestal.
[01:35:05.840 --> 01:35:10.840]  No, no, no, no, no. That's actually incorrect.
[01:35:10.840 --> 01:35:15.840]  Lawyers used to be the refuse of society.
[01:35:15.840 --> 01:35:24.840]  In the days of the founding fathers, anyone who admitted to being a lawyer was usually shunned, including some of the founding fathers themselves who were lawyers.
[01:35:24.840 --> 01:35:28.840]  They didn't like lawyers, and almost no one did.
[01:35:28.840 --> 01:35:36.840]  They saw them as a necessary evil even 70 years ago, unless you were a corporate lawyer.
[01:35:36.840 --> 01:35:42.840]  Then you were loved and revered, at least by the corporations and those around you.
[01:35:42.840 --> 01:35:45.840]  Yeah, that may be what it's based upon, something like that.
[01:35:45.840 --> 01:35:49.840]  It holds that type of a title as an esquire, something like that.
[01:35:49.840 --> 01:35:53.840]  Somebody who's at high command in the field of law.
[01:35:53.840 --> 01:35:57.840]  But what occurred was that they betrayed that trust.
[01:35:57.840 --> 01:36:00.840]  They bought in the federal reserve system over a hundred years ago.
[01:36:00.840 --> 01:36:04.840]  That started the whole thing, and we gave them all the power.
[01:36:04.840 --> 01:36:07.840]  So we're using their financial instruments.
[01:36:07.840 --> 01:36:14.840]  That far ends are the financial instruments of this bureaucratic, bureaucratic, as you say, socialist system.
[01:36:14.840 --> 01:36:16.840]  We definitely are in socialism.
[01:36:16.840 --> 01:36:18.840]  There's no question about that.
[01:36:18.840 --> 01:36:19.840]  That's how this is being done.
[01:36:19.840 --> 01:36:30.840]  But as I said, you know, I'd like to ask you, it's just that we, as far as I remember going through my childhood, going through the school system,
[01:36:30.840 --> 01:36:34.840]  the way you were told that being a lawyer was an honorable profession.
[01:36:34.840 --> 01:36:38.840]  Doctor, you know, you heard the terms, doctors, lawyers, scientists.
[01:36:38.840 --> 01:36:39.840]  Oh, be a astronaut.
[01:36:39.840 --> 01:36:43.840]  You'd have to be somebody, be a politician, president of the United States.
[01:36:43.840 --> 01:36:44.840]  You could possibly go that far.
[01:36:44.840 --> 01:36:45.840]  We were all told that.
[01:36:45.840 --> 01:36:49.840]  We were getting that line when we were in anywhere between Cape 12.
[01:36:49.840 --> 01:36:50.840]  We were told that.
[01:36:50.840 --> 01:36:58.840]  So that's our thing of what a lot of people, you know, forgot about the integrity,
[01:36:58.840 --> 01:37:01.840]  the original integrity of the lawyers that were shady.
[01:37:01.840 --> 01:37:12.840]  They were supposed to be looked up to as individuals who had caring and custody and serenaded and courted our Constitution.
[01:37:12.840 --> 01:37:14.840]  We entrusted them to do that.
[01:37:14.840 --> 01:37:34.840]  White laws, free states using the temperament of the Constitution in each state, trying to craft laws for each state, but it has to be compatible with the Constitution of that state and the Constitution of the United States of America, period.
[01:37:34.840 --> 01:37:36.840]  Okay.
[01:37:36.840 --> 01:37:37.840]  And?
[01:37:37.840 --> 01:37:38.840]  And.
[01:37:38.840 --> 01:37:39.840]  Okay.
[01:37:39.840 --> 01:37:41.840]  Well, that's, that's just my ripple.
[01:37:41.840 --> 01:37:42.840]  That's my two cents on that.
[01:37:42.840 --> 01:37:49.840]  I have a, I have an idea that you probably will disagree with, but I'll give it a shot anyway.
[01:37:49.840 --> 01:38:01.840]  Instead of the driver's license for the private individual, why don't we have a system that we can negotiate with the, with the system as they'll call government?
[01:38:01.840 --> 01:38:09.840]  Have a certificate of competency test and certification, maybe eight to 10 years in between periods of time.
[01:38:09.840 --> 01:38:12.840]  Whoa, whoa, whoa, whoa, whoa, whoa.
[01:38:12.840 --> 01:38:18.840]  Why would I need a competency test to exercise a right?
[01:38:18.840 --> 01:38:23.840]  Because things can change in our, in our condition as individuals.
[01:38:23.840 --> 01:38:25.840]  That's not my question.
[01:38:25.840 --> 01:38:26.840]  That's not my question.
[01:38:26.840 --> 01:38:27.840]  That's not my question.
[01:38:27.840 --> 01:38:31.840]  For example, that's still not something to negotiate with the state.
[01:38:31.840 --> 01:38:39.840]  If you wish to declare me incompetent to exercise some right, then you need to haul me into court and prove that I'm not competent to do it.
[01:38:39.840 --> 01:38:48.840]  But I don't get to, you don't get to sit down and negotiate with me to give them up unless I will need to do so voluntarily and I'm not.
[01:38:48.840 --> 01:38:57.840]  Yeah, well, that's what, what I'm saying is as long as we have our faculties and our abilities and then nothing's changed, we don't have a criminal record.
[01:38:57.840 --> 01:39:05.840]  And anything associated with the use of an automobile on a roadway, as long as we are in good, good standing, let's put it that way.
[01:39:05.840 --> 01:39:10.840]  Every eight to 10 years, they just check that out and say, okay, you're fine for another, you know, maybe eight to 10 years down the road.
[01:39:10.840 --> 01:39:11.840]  That's it.
[01:39:11.840 --> 01:39:13.840]  A supplement to that.
[01:39:13.840 --> 01:39:26.840]  Yeah, but I do recommend and I would say that it's a good idea to have some type of a casualty bond, something that you can use in the event in case are you getting into a collision or an accident.
[01:39:26.840 --> 01:39:42.840]  That I would agree upon, but forced compulsory insurance from the, from the mega corporations, both a trillion dollar corporations, I'm not for.
[01:39:42.840 --> 01:39:47.840]  Well, again, for that.
[01:39:47.840 --> 01:39:51.840]  What we've done is get to complacent.
[01:39:51.840 --> 01:39:52.840]  Yeah.
[01:39:52.840 --> 01:39:58.840]  How we fix it is stop being complacent and most of all so gullible.
[01:39:58.840 --> 01:40:02.840]  The government does not operate for our benefit.
[01:40:02.840 --> 01:40:06.840]  It has not for a very, very long time.
[01:40:06.840 --> 01:40:10.840]  And because it has not, it needs to be altered.
[01:40:10.840 --> 01:40:18.840]  People, we can't get it through their heads that they're not there for our best interest.
[01:40:18.840 --> 01:40:23.840]  Well, that's the problem with the indoctrination part of it, of the program.
[01:40:23.840 --> 01:40:24.840]  Exactly.
[01:40:24.840 --> 01:40:33.840]  That's what we've been and we even became from the indoctrination centers from the time we were children.
[01:40:33.840 --> 01:40:36.840]  So, you know, that's, that's what I would suggest as an alternative.
[01:40:36.840 --> 01:40:39.840]  But, you know, if you don't think that that's perfect, that's fine.
[01:40:39.840 --> 01:40:44.840]  I'm not going to negotiate with a public servant about whether or not I get to exercise my rights.
[01:40:44.840 --> 01:40:47.840]  That's just not on the table ever.
[01:40:47.840 --> 01:40:48.840]  Yeah.
