[01:27.240 --> 01:31.280]  announced earlier this month that she was dismissing 32 felony possession and delivery
[01:31.280 --> 01:35.960]  of marijuana cases because of the law. Mr. Abbott and other state officials including
[01:35.960 --> 01:39.960]  the Attorney General stipulated in a letter that county district attorneys back on Thursday
[01:39.960 --> 01:44.560]  that marijuana has not been decriminalized in Texas and that these actions demonstrate
[01:44.560 --> 01:50.480]  a misunderstanding of how HB 1325 works as well as other cities too like the district
[01:50.480 --> 01:56.680]  attorney in El Paso, Cayma Esparza a Democrat who also stated earlier this month that the
[01:56.680 --> 02:02.560]  law quote will not have an effect on the prosecution of marijuana cases in El Paso. However the
[02:02.560 --> 02:07.240]  issue was succinctly summarized by Mr. Brandon Ball an assistant public defender in Harris
[02:07.240 --> 02:12.040]  County who stated that quote the law is constantly changing on what makes something illegal based
[02:12.040 --> 02:16.560]  on its chemical makeup. It's important that if someone is charged with something the test
[02:16.560 --> 02:25.240]  matches what they're charged with. A paper by Tulane University identified a five and
[02:25.240 --> 02:30.720]  a half inch American pocket shark as the first of its kind in the Gulf of Mexico. The specimen

[04:28.280 --> 04:34.200]  member of one of my legal discussion groups and he's never exhibited a real aptitude for
[04:34.200 --> 04:38.680]  understanding the things that you tell him when it comes to law and legal issues but
[04:38.680 --> 04:48.680]  he enrolled in law school anyway. And then yesterday out of the blue he makes the announcement
[04:48.680 --> 04:58.760]  that he's in law school and that I'm only right 5% of the time. Okay now granted he
[04:58.760 --> 05:04.800]  offered no evidence as to how he came up with that number or why he thinks that number is
[05:04.800 --> 05:12.720]  even remotely accurate and personally I don't care because I know better but the point being
[05:12.720 --> 05:19.920]  that if you listen to this show anytime at all and you've looked up the stuff that I've
[05:19.920 --> 05:28.560]  told you on this show at any point in that time then what I would like to know is how
[05:28.560 --> 05:38.320]  many of you have actually found where what I was telling you was incorrect. If I've got
[05:38.320 --> 05:47.400]  it wrong I want to know and if I don't and you're saying I do then I want you to be
[05:47.400 --> 05:53.560]  able to prove up your side of the argument because I don't tell people things that I
[05:53.560 --> 06:00.080]  can't substantially verify and almost always am in a position and on this show I do provide
[06:00.080 --> 06:06.480]  you with the source of the information I am using to tell you what I'm telling you and
[06:06.480 --> 06:17.240]  then I admonish you to always go look it up. Do not believe me go look it up. Now my best
[06:17.240 --> 06:25.720]  guess on why he's saying this is because he is comparing what I'm saying to court rulings
[06:25.720 --> 06:33.280]  on similar but not exactly the legally the same issues. See the one thing he doesn't
[06:33.280 --> 06:40.160]  appear to have picked up in law school yet is that lawyers like to make arguments that
[06:40.160 --> 06:45.160]  skew all the facts in their favor whether they actually belong on the side of the scale
[06:45.160 --> 06:53.200]  they're placing them or not and the courts being lawyers are no different. When they
[06:53.200 --> 06:58.080]  make an opinion they want to skew the facts in favor of how they're ruling to make it
[06:58.080 --> 07:03.800]  look like they know what they're talking about as much as possible. So let me clue you in
[07:03.800 --> 07:10.920]  on something really really quick here. If I'm arguing that a court case is invalid in
[07:10.920 --> 07:19.520]  its opinion because it failed to properly cite the law then you are not going to convince
[07:19.520 --> 07:25.520]  me I am wrong by trying to use that same court case to show me where the court said so and
[07:25.520 --> 07:33.520]  so. You get it? Why would I accept from you that the court ruled correctly when I'm sitting
[07:33.520 --> 07:39.000]  here arguing the case you're holding in my face was ruled upon incorrectly because it
[07:39.000 --> 07:47.880]  did not properly interpret and apply the law and the opinion itself is absolute proof that
[07:47.880 --> 07:55.400]  they did not interpret and properly apply the law because there is tons of relevant
[07:55.400 --> 08:05.360]  statutory facts that address other issues in the facts of that case as far as the law
[08:05.360 --> 08:12.160]  itself is concerned that shows the way the court is reading the law is to be completely
[08:12.160 --> 08:20.920]  incorrect but they never bring up those parts of the law they never look at those parts
[08:20.920 --> 08:31.320]  of the law they never rule on those parts of the law. In which case if I'm saying here's
[08:31.320 --> 08:37.200]  the one thing the court addressed and here's the nine things that prove the court did not
[08:37.200 --> 08:43.320]  properly interpret and apply the law why would I give weight to the one thing you're hanging
[08:43.320 --> 08:52.880]  on to for dear life to prove your point when I've got nine that says you're wrong. So to
[08:52.880 --> 08:58.040]  the gentleman who made that comment in my legal discussion group you know who you are
[08:58.040 --> 09:05.680]  if I'm wrong then use the law not the court opinions because I'm telling you the court
[09:05.680 --> 09:14.240]  opinions are every single last one dead wrong because not a single one of them has addressed
[09:14.240 --> 09:21.000]  the stuff I'm talking about that I talk about on this show that leaks it all together from
[09:21.000 --> 09:30.160]  top to bottom not just the cherry picking they use to make the rulings they make. In
[09:30.160 --> 09:38.120]  every single court ruling where that opinion has said the law is such and such they have
[09:38.120 --> 09:44.760]  treated the particular statute they're referring to as if that statute is the sole subject
[09:44.760 --> 09:59.720]  of the law and it is not. It is a subordinate component object of the overhead object the
[09:59.720 --> 10:07.840]  one that encloses it all and the one that must enclose it all because of the constitutional
[10:07.840 --> 10:16.320]  mandate that every legislative act must have a single subject which all the statutes in
[10:16.320 --> 10:23.880]  that statutory enactment must adhere to in their application and purpose and if they
[10:23.880 --> 10:32.560]  deviate from that they are unconstitutional on their face. Now the fact that you don't
[10:32.560 --> 10:41.160]  know this and the fact that law school will never ever teach you how to understand this
[10:41.160 --> 10:49.040]  does not qualify you in any way whatsoever to tell me that I'm 5% right when you cannot
[10:49.040 --> 11:01.800]  refute the stuff I've got in front of me. Attorneys don't know the law, judges don't
[11:01.800 --> 11:10.200]  know the law. They only know the opinions of the other judges. They only know the opinion
[11:10.200 --> 11:19.440]  they hold and want to argue but they don't know the law and I have proven that time and
[11:19.440 --> 11:26.960]  time and time and time and time and time and time again on this show. I have shown you
[11:26.960 --> 11:31.680]  a court ruling, I have shown you the statute and there was no question the court ruling
[11:31.680 --> 11:37.200]  did not properly address the statute and in relation to the transportation code side
[11:37.200 --> 11:45.000]  of things there are multiple codes and multiple dozens of statutes that link this stuff together
[11:45.000 --> 11:53.080]  that prove the exact opposite of everything the courts have ruled upon but none of those
[11:53.080 --> 11:58.920]  links are ever mentioned, they're never brought up, they're never used in an opinion despite
[11:58.920 --> 12:08.200]  the fact that they are controlling over the very decisions the courts are making. So you
[12:08.200 --> 12:15.040]  want to tell me I'm wrong? Prove it. Until you can do that without a court opinion using
[12:15.040 --> 12:22.880]  only the law that they are ignoring then you have no qualification whatsoever to sit here
[12:22.880 --> 12:28.520]  and tell me that I'm only this amount right or that amount right. I'm not trying to say
[12:28.520 --> 12:35.160]  I'm always right, I'm not trying to say I'm 100% right in any way shape or form. It is

[14:32.400 --> 14:39.920]  that apparently. Not in criminal cases they don't. Excuse me. Not in criminal cases they
[14:39.920 --> 14:53.840]  don't. Right and then I was basically shut down by the judge immediately and I felt previously
[14:53.840 --> 15:02.560]  known that a person has a right to access the court and counsel and I'd never met the
[15:02.560 --> 15:09.080]  state public defender before or anything and I wanted to talk to him and tell him I wanted
[15:09.080 --> 15:16.680]  to file a complaint and they wouldn't you basically for fear of being immediately you
[15:16.680 --> 15:27.880]  know in contempt of court I was stifled in my speech and basically in the statute I read
[15:27.880 --> 15:37.920]  it's a defender has a right to counsel through all phases of the criminal trial and even
[15:37.920 --> 15:45.160]  upon interrogation so I would think that an arraignment hearing would be within all phases
[15:45.160 --> 15:50.280]  of a criminal trial and then when I brought it to the attention of the SBD afterwards
[15:50.280 --> 15:56.320]  he said no nothing you can't do just nothing I could have done or understood it because
[15:56.320 --> 16:04.040]  I said why didn't you object and I probably agreed them for that. For not objecting and
[16:04.040 --> 16:14.000]  of course. Who is the person you're talking about? As far as the person being the state
[16:14.000 --> 16:23.320]  public defender. Okay so the state public defender was present? Yes it was the prosecutor
[16:23.320 --> 16:27.440]  the judge and the state public defender of which I've never spoke to before or matter
[16:27.440 --> 16:32.640]  or even known or anything. Okay and this is somebody that was helping you with your case
[16:32.640 --> 16:39.880]  that day? Yes. Alright then the first thing I've got to ask you before we get much further
[16:39.880 --> 16:46.680]  is what is your point then when it comes to assistance of counsel? Because it certainly
[16:46.680 --> 16:54.960]  sounds like counsel was provided. Well yeah that's part of their argument was counsel

[20:42.680 --> 20:47.680]  human presence. The fact that he didn't do things the way you may have liked is a totally
[20:47.680 --> 20:55.680]  different issue. Okay, but I had never met him before or spoke with him or anything.

[21:07.680 --> 21:14.680]  front of Harry there in the courtroom. The attorney is there to address the facts to
[21:14.680 --> 21:19.680]  the court, the facts as they appear in the record. If there's more than what is in the
[21:19.680 --> 21:23.680]  record that the attorney needs to make the court aware of, then you need to make sure
[21:23.680 --> 21:28.680]  they know that, which means talk to them, which means you need to ask the court for
[21:28.680 --> 21:33.680]  time to talk with the attorney about the facts of the case because there's something the
[21:33.680 --> 21:37.680]  attorney may not be aware of because it's not in the record. Did you do that?
[21:37.680 --> 21:44.680]  Yes, that's exactly what I tried to do. What do you mean tried to do?
[21:44.680 --> 21:49.680]  Well, I said excuse me and I was stifled immediately by the judge. He wouldn't allow
[21:49.680 --> 21:56.680]  me to speak, so I heard that as being denied access to the court as a civil rights
[21:56.680 --> 22:00.680]  violation... Well, it's not denial of access to the court because you have counsel.
[22:00.680 --> 22:05.680]  The problem is whether or not counsel can be shown to be factually knowledgeable of
[22:05.680 --> 22:11.680]  your case before appearing in court on your behalf. Normally, that's why the charges
[22:11.680 --> 22:21.680]  have to be read and before anybody goes into any discussion.
[22:21.680 --> 22:31.680]  I interrupted during the charges being read. That's true. The problem was I didn't
[22:31.680 --> 22:39.680]  use the word objection, apparently, and I said excuse me, but I'm not a lost graduate
[22:39.680 --> 22:47.680]  student. It was the first case of this attorney. He just got out of law school.
[22:47.680 --> 22:54.680]  I just really holy about that. I had a criminal complaint which would have been
[22:54.680 --> 23:03.680]  appearing completely on the whole rest of the case more or less due to using a wrong
[23:03.680 --> 23:17.680]  verbage or something like the word objection versus excuse me, your honor. As I was
[23:17.680 --> 23:23.680]  led to know that you could file a criminal complaint with the prosecutor or a judge,
[23:23.680 --> 23:27.680]  so I was to take the opportunity to do this.
[23:27.680 --> 23:34.680]  It's not something that's normally done in the middle of your own prosecution.
[23:34.680 --> 23:37.680]  I didn't get that.
[23:37.680 --> 23:43.680]  It's not something that's usually done in the middle of your own prosecution.
[23:43.680 --> 23:49.680]  Right. Like I said, I'm not a lost school graduate. I'm a graduate of a technical

[23:52.680 --> 23:58.680]  Think of it kind of like this, not trying to compare you to it, but just as an
[23:58.680 --> 24:05.680]  aside, a burglar caught by the police in the middle of a burglary is not going to
[24:05.680 --> 24:09.680]  be given much of an opportunity to report another burglary.
[24:09.680 --> 24:21.680]  Yes, I can understand that. It's just based on working with an attorney as a
[24:21.680 --> 24:28.680]  mechanic, rather. I've learned one thing, the Nippon and Nippon scenario.
[24:28.680 --> 24:37.680]  I was searching drastically to find... Since he wasn't around, he had died a
[24:37.680 --> 24:44.680]  couple years prior. I was drastically searching for this Nippon and Nippon
[24:44.680 --> 24:50.680]  type of a thing, and I've even heard you guys mention something to the effect so
[24:50.680 --> 24:55.680]  it doesn't get too out of hand, which it ended up doing.
[24:55.680 --> 25:02.680]  But I guess you kind of answered the question.
[25:02.680 --> 25:09.680]  I do have another statement about traffic with those traffic lightcams.
[25:09.680 --> 25:11.680]  Which is?
[25:11.680 --> 25:21.680]  Well, I had gotten a letter in the mail at a stop sign or whatever.
[25:21.680 --> 25:30.680]  It wasn't a light along O'Haraport, and what had happened was I looked at my rear
[25:30.680 --> 25:35.680]  rear view mirror and another car behind me at a high rate of speed was coming up
[25:35.680 --> 25:41.680]  and the ground was wet. It wasn't snow or ice, but it did rain.
[25:41.680 --> 25:51.680]  I actually had stopped momentarily before the stop line, and I actually had to get
[25:51.680 --> 25:56.680]  out of the way to avoid a rear-end collision, and I stated it in my appeal.
[25:56.680 --> 26:06.680]  They gave me a chance to appeal, and they reviewed the CCV cam, and they said,
[26:06.680 --> 26:12.680]  no, but the other guy behind you stopped, and I'm like, well, I really think that
[26:12.680 --> 26:18.680]  they should have, first of all, an approach speed like they have a radar gun
[26:18.680 --> 26:24.680]  that they could compare to, and secondly, have another camera to monitor the traffic
[26:24.680 --> 26:31.680]  behind people that are coming to those stops in order to understand that some
[26:31.680 --> 26:42.680]  people have to take evasive driving reactions to avoid a catastrophic rear-end
[26:42.680 --> 26:52.680]  collision. I ended up paying, and some people commented and said that all the
[26:52.680 --> 27:00.680]  proceeds go to the country of Israel like they sell the concessions or the parking
[27:00.680 --> 27:09.680]  meters to different countries like France or something in Chicago and stuff like that.
[27:09.680 --> 27:14.680]  Okay, so is that what you got?

[28:00.680 --> 28:10.680]  I don't need a license to travel on the road, so what are you going to suspend?

[28:13.680 --> 28:19.680]  You can avoid being pulled over and handcuffed and brought to jail and then
[28:19.680 --> 28:24.680]  posed a bond, you know, go through that procedure, I guess.
[28:24.680 --> 28:28.680]  That's, it's, you're not, okay, let me, let me be very clear.
[28:28.680 --> 28:33.680]  You're not going to avoid being pulled over short of evading the cops to begin with,
[28:33.680 --> 28:38.680]  which if you're in your own car with a license plate would be very stupid to do

[29:19.680 --> 29:26.680]  And the way that I feel that their mentality is, is, okay,
[29:26.680 --> 29:31.680]  don't pay the fine, most suspend your license, and you'll just get pulled over

[34:26.920 --> 34:33.960]  your honor, my client isn't a commercial driver or whatever and they basically don't
[34:33.960 --> 34:40.520]  have jurisdiction or subject matter jurisdiction, is it?
[34:40.520 --> 34:49.880]  And to that effect, you know, basically he's falling under that USC code. So in a lot of
[34:49.880 --> 34:54.600]  these attorneys, it's almost like a secret to them and that's where they make their big
[34:54.600 --> 35:01.560]  money is to be able to get traffic tickets off or passenger privately owned passenger
[35:01.560 --> 35:10.440]  vehicles because they cite that law and it's kind of like an inner secret to the lawyer
[35:10.440 --> 35:16.080]  industry or something. Am I correct possibly?
[35:16.080 --> 35:21.040]  I don't know. I don't know what law you're referring to and or anything like that. So
[35:21.040 --> 35:24.680]  I don't know what it is you're wanting me to say to that.
[35:24.680 --> 35:34.720]  Right. Yeah, just like kind of generally, you know, that's what the attorneys have done
[35:34.720 --> 35:40.320]  the research, the attorneys are going to realize that most state laws are either directly based
[35:40.320 --> 35:47.080]  on the federal statutes under Title 49 under the Federal Motor Carrier Safety Act or they
[35:47.080 --> 35:52.160]  were enacted by the state at the behest of the federal government saying, we're going
[35:52.160 --> 35:57.000]  to blackmail you into enforcing our rules and regulations within your state by withholding
[35:57.000 --> 36:03.720]  highway funds if you won't do what we want done, which is itself unconstitutional on
[36:03.720 --> 36:08.320]  multiple grounds. One, the federal government is not supposed to be divvying out money to
[36:08.320 --> 36:15.600]  the states for highway funds. Nowhere is that an enumerated power. Second, the federal government
[36:15.600 --> 36:19.880]  is not allowed to blackmail the states and to comply with anything it wants because the
[36:19.880 --> 36:28.360]  states don't work for it. And third, it violates the rights of the individual to move freely
[36:28.360 --> 36:36.400]  about the several states of the union without government permission to do so. And that doesn't
[36:36.400 --> 36:40.200]  even begin to touch on all the other things I was talking about that are detrimental to
[36:40.200 --> 36:49.240]  us because of programs exactly like this. My second motion. Okay, so as far as what
[36:49.240 --> 36:54.160]  you're asking, I don't know exactly what it is you're asking. As far as the position
[36:54.160 --> 37:03.160]  I hold on it, well, there you go. Yes, it was just a general kind of a thought feeling
[37:03.160 --> 37:09.840]  that I had with concern to how these attorneys, they grant a lot of... The attorney is most
[37:09.840 --> 37:15.760]  likely citing law that they know for a fact is controlling in that state from the federal
[37:15.760 --> 37:20.480]  government and therefore eliminates the state's ability to enforce against someone that doesn't
[37:20.480 --> 37:25.960]  fall under federal law, which is exactly the same thing that I'm doing with the state law
[37:25.960 --> 37:31.840]  because the state law here in Texas is very clear it doesn't apply to the general public.

[39:08.280 --> 39:13.920]  your arguments, you know, with all the backup information you had and all that stuff. So
[39:13.920 --> 39:22.320]  it turns out that that motion has worked for me very, very, very well.
[39:22.320 --> 39:31.760]  Last year in September, I was stopped on a traffic violation on Highway 10, going towards
[39:31.760 --> 39:39.280]  Houston, and I wasn't speeding. I wasn't doing anything. I was just on the left lane
[39:39.280 --> 39:47.880]  going about a mile or two faster than the speed limit. And this guy, one state trooper,
[39:47.880 --> 39:54.520]  you know, he's, you know, checking for, I don't know what he's checking for. And anyway,
[39:54.520 --> 39:59.240]  I think I smelled good for him. He just came behind me and put his lights on, whatever
[39:59.240 --> 40:03.600]  stopped me. Then he, you know, he stopped me because I was on the left lane for too
[40:03.600 --> 40:13.240]  long to explain that, hey, man, I'm not in transportation. I'm just a traveler in my
[40:13.240 --> 40:20.280]  private car, and I'm just heading to work. And, you know, he kept on his stuff, blah,
[40:20.280 --> 40:29.960]  blah, blah. Anyway, the whole thing turned out that he was a canine unit.
[40:29.960 --> 40:33.720]  He wanted to do it. He just wanted somebody to direct sniff on.
[40:33.720 --> 40:44.200]  Yes. He did that. And a long story short, they made out, they fabricated evidence, and
[40:44.200 --> 40:48.640]  they took me to jail that day, you know, even though I asked to be taken to the magistrate
[40:48.640 --> 40:56.520]  and all that stuff. They had me in jail for 24 hours, and they impounded my car. And anyway,
[40:56.520 --> 41:01.800]  I had to borrow money to, you know, to get my car out.
[41:01.800 --> 41:11.400]  What did they arrest you for? They said a possession of marijuana, two ounces or less,
[41:11.400 --> 41:18.040]  which I didn't have. I didn't have. I didn't even smell like marijuana. I hadn't even smoked
[41:18.040 --> 41:23.480]  marijuana that day. I was just heading to work. I had my uniform. I had just picked up
[41:23.480 --> 41:29.000]  some parts from the parts stores because I'm a mechanic to take to the shop and stuff.
[41:29.000 --> 41:34.840]  But, you know, I was just in my regular day. And this guy made up, you know, I mean, it's
[41:34.840 --> 41:44.800]  all on video. It's all recorded, at least on their cameras. And anyways, they bailed
[41:44.800 --> 41:55.880]  myself out. They sent me for court in October. And then they postponed it again in January.
[41:55.880 --> 42:04.040]  And when I went in January, the 7th, they just called me and they said the prosecution
[42:04.040 --> 42:10.280]  has declined to prosecute. The state has declined to prosecute. They dropped all your charges.
[42:10.280 --> 42:15.680]  Yeah. Now what you have to do is file a written petition to the prosecutor demanding that
[42:15.680 --> 42:21.080]  they expunge that arrest from your record. Otherwise, it'll be there every time somebody
[42:21.080 --> 42:27.720]  ever looks you up. Okay. But I also like to, you know, pursue
[42:27.720 --> 42:34.760]  a lawsuit, you know, because if the circumstances had been different, they couldn't have ruined
[42:34.760 --> 42:40.600]  my day. I mean, you know, if I had been a little bit more upset that they could even
[42:40.600 --> 42:45.640]  gotten shot or something. Okay. What do you have in your favor to prove
[42:45.640 --> 42:53.160]  that they set you up and falsified evidence? Well, first of all, they dismissed the case.
[42:53.160 --> 43:01.960]  That's not proof they falsified the evidence. Oh, well, the charge they made, you know,
[43:01.960 --> 43:05.960]  the video. Okay. The charge itself is not proof they falsified
[43:05.960 --> 43:11.200]  the evidence supporting the charge. You said they had two ounces of, they charged you with
[43:11.200 --> 43:18.440]  two ounces of marijuana or less. What did they use to say this is marijuana?
[43:18.440 --> 43:26.520]  I had a small container with just a little bit, not even the gram or less, not even,
[43:26.520 --> 43:30.680]  I mean, I have forgotten the stuff was there and I didn't give them any permission to search
[43:30.680 --> 43:36.360]  my car. Okay. So how is that falsified evidence since that is two grams or less?
[43:38.040 --> 43:41.800]  No, no, it's not even a gram or less. It doesn't, you've not listened to me.

[46:59.160 --> 47:06.200]  and you did have that, which you are admitting that you had. However, they dismissed the case.
[47:06.200 --> 47:15.320]  Now when did this occur? This January on the 7th. That's when they dismissed it.
[47:15.320 --> 47:21.960]  Right. Right after the state enacted laws making possession of certain types of hemp
[47:21.960 --> 47:29.000]  and certain amounts of marijuana less than a certain weight, absolutely legal. What would
[47:29.000 --> 47:38.280]  they prosecute you for? The question is, was that law active when you were originally arrested?
[47:38.280 --> 47:47.080]  If the answer is no. By the way, did they test this and have it come up positive with a drug test
[47:47.080 --> 47:55.480]  kit? No, no, no, no. Then they have no way of proving what it was. They have no way of proving
[47:55.480 --> 48:00.760]  what it was. And if the only thing they had to rely on was a drug test kit, you could have challenged
[48:00.760 --> 48:06.200]  that very easily as being highly unreliable. And if the amount is as small as what you say,
[48:06.200 --> 48:09.000]  the possibility is they wouldn't have had enough to test it again.
[48:10.840 --> 48:17.080]  Well, what I was relying on is on the subject matter jurisdiction because from the beginning,
[48:17.080 --> 48:26.040]  you see, I have a prior conviction. So to me, when, you know, a police officer, whatever,
[48:26.040 --> 48:33.000]  you know, they approach me. So I identify myself so that I don't, you know, so they know I'm not,
[48:33.000 --> 48:38.600]  you know, in any threat or anything like that. So when they stopped me and they asked me for
[48:38.600 --> 48:44.600]  driver license, I said, I showed my driver license and they asked me for insurance.
[48:45.800 --> 48:48.120]  What did they say they originally stopped you for?
[48:49.560 --> 48:55.000]  I said, traffic, for traffic, because I was going on the left lane and I was on the left
[48:55.000 --> 49:00.440]  lane for too long. That made up excuse. But I told the guy, I told the cop, I'm showing my
[49:00.440 --> 49:06.760]  driver license for the purpose of identification only, not because I'm engaged
[49:06.760 --> 49:13.080]  on the regulated activity of driving. I'm not driving, I'm traveling in my private car.
[49:13.640 --> 49:19.080]  So these driving staff, transportation staff, I'm not under jurisdiction.
[49:19.720 --> 49:26.360]  So that's what I told, that's all on camera, you know, on the camera and all the conversations,
[49:26.360 --> 49:31.320]  you know, when they went into my car, I said, you don't have concession or permission to go
[49:31.320 --> 49:36.840]  into my car. You cannot search my car unless you present me a warrant stating the cost,
[49:37.640 --> 49:44.360]  the probable cost of such search, which they didn't and they refused to.
[49:45.240 --> 49:50.040]  They refused to read the Mami Rondo rights, even though I asked, I mean, these guys, I mean,
[49:50.040 --> 49:54.040]  they broke everything. I mean, all I did was asking questions, you know, too.
[49:54.040 --> 49:59.560]  And since I knew the cameras were rolling, there's three or four, five of them according to them,
[49:59.560 --> 50:04.280]  and every single one of them, they broke, you know, they did not follow procedures,
[50:04.280 --> 50:09.320]  they took me directly to jail and all that stuff. I said, like, when you're violating the law,
[50:09.320 --> 50:14.760]  we hear, and this is not correct, and they're still not, not, not, not listened. And,
[50:16.520 --> 50:21.960]  and then they made up this charge, you know, that they found that they had two answers for
[50:21.960 --> 50:29.720]  less. Dude, I didn't have it. I'm very sure I didn't have it. You know, whatever container
[50:29.720 --> 50:35.560]  they found it, there wasn't a container in my backpack that could hold any, any, that amount.
[50:35.560 --> 50:41.320]  So, you know, they made that up to legitimize their, their, their search, their, you know, their
[50:41.320 --> 50:48.040]  charges. And then when it came to the bail, you know, I said, I'm bailing myself out.
[50:48.040 --> 50:54.840]  I'm not going to sign for myself. I'm not going to pay bail. And so I signed myself out. And
[50:54.840 --> 51:00.280]  the later, you know, the second time I went to court, that's when they, they said, I have the
[51:00.280 --> 51:13.000]  paper here where it says the, the, it says the county attorney's office has declined to prosecute
[51:13.000 --> 51:20.120]  in your caviar for the charges listed above that occurred under about 10 to, or, you know,
[51:20.120 --> 51:27.000]  about the 10, 10, 16, 2019. Okay. Well, that's all well and good. And I'm glad for you as far as
[51:27.000 --> 51:33.480]  that working out in your favor, but I'm still trying to figure out where you're going to make
[51:33.480 --> 51:41.480]  the claim that they fabricated the evidence. I don't know how you're going to prove that when
[51:41.480 --> 51:46.760]  you admitted that there was something in the car for them to find, regardless of the amount of it.
[51:47.880 --> 51:52.280]  No, I didn't admit to, I didn't admit to anything. I didn't, when they said it'll
[51:52.280 --> 51:58.360]  fund this on them. No, I'm just saying, you just did to me, whether you did to them or not,
[51:58.360 --> 52:05.000]  is not the issue. You told me that the fact is that they, that I had this and I forgot it was
[52:05.000 --> 52:13.720]  in there. That's an admission that it was in there. Is it not? Yes. Oh, yes. Okay. So
[52:17.720 --> 52:23.240]  wait a minute. How did they fabricate the amount when they said two grams or less?
[52:24.520 --> 52:32.280]  Two ounces or less. Okay. Regardless, where is the or less not going to cover whatever amount
[52:32.280 --> 52:46.120]  you had? Well, okay. Then I might have misinstated that they fabricated a probable cause maybe?
[52:46.120 --> 52:50.840]  I don't know, but the fabrication of probable cause would have had to have come at the time of the
[52:50.840 --> 52:58.120]  stop. Yeah, they did that. Okay. When you said you were in the left lane too long, what does that
[52:58.120 --> 53:05.800]  even mean? Was this a four lane highway? Two lane highway. It's on 10 on Seguin, you know. Okay. So
[53:05.800 --> 53:12.760]  how were you, left lanes oncoming traffic then? No, I was on the highway, left lane passing lane.
[53:12.760 --> 53:19.320]  We know it's the passing lane, slower traffic on the right, faster traffic on the left. Okay.
[53:19.320 --> 53:26.840]  It says, the sign says, left lane for passing traffic only, which I was. It's a four lane
[53:26.840 --> 53:34.760]  divided highway, right? There's two on the other side, two on this side, right? Okay. Yeah,
[53:34.760 --> 53:39.720]  no, he made that up, man. He made that up because what happened was that I looked at him when I
[53:39.720 --> 53:45.720]  was passing him by, I looked at him and I just kept going. And then he came behind me and he
[53:45.720 --> 53:52.360]  followed me for at least two miles. For at least a mile, I mean, he was checking my place. From
[53:52.360 --> 53:58.120]  the beginning, he was already breaking the law, right? Without searching features, you know,
