[00:00.000 --> 00:06.900] The following news flash is brought to you by The Lone Star Lowdown.
[00:06.900 --> 00:13.320] Markets for Monday the 22nd of July 2019 open with precious metals, gold at $1,429 an ounce,
[00:13.320 --> 00:21.520] silver $16.45 an ounce, copper $2.75 an ounce, oil Texas crude $55.63 a barrel, Brent crude
[00:21.520 --> 00:29.840] $62.47 a barrel, and cryptos in order of market cap, Bitcoin Core $10,566.52, Ethereum
[00:29.840 --> 00:41.520] $227.26, XRP Ripple $0.33, Litecoin $100.31, and Bitcoin Cash is at $324.10 a crypto coin.
[00:41.520 --> 00:52.440] Today in history, the year 1916, the preparedness day bombing, a time suitcase bomb was detonated
[00:52.440 --> 00:57.920] on Market Street in San Francisco during the World War I preparedness day parade, killing
[00:57.920 --> 01:04.920] the 10 and entering 40.
[01:04.920 --> 01:05.920] And recent news.
[01:05.920 --> 01:10.760] Since Governor Greg Abbott signed House Bill 1325 legalizing hemp into taxes law back in
[01:10.760 --> 01:15.400] June, county prosecutors around the state including Houston, Austin and San Antonio have been
[01:15.400 --> 01:19.280] dropping marijuana possession charges and even refusing to file new ones since they
[01:19.280 --> 01:23.360] are stipulating that they do not have the time or the laboratory equipment to test the
[01:23.360 --> 01:28.520] or for THC. Margaret Moore, the Travis County District Attorney announced earlier this month
[01:28.520 --> 01:33.040] that she was dismissing 32 felony possession and delivery of marijuana cases because of
[01:33.040 --> 01:34.040] the law.
[01:34.040 --> 01:37.760] Mr. Abbott and other state officials including the Attorney General stipulated in a letter
[01:37.760 --> 01:42.240] to county district attorneys back on Thursday that marijuana has not been decriminalized
[01:42.240 --> 01:48.400] in Texas and that these actions demonstrate a misunderstanding of how HB 1325 works as
[01:48.400 --> 01:54.640] well as other cities too like the District Attorney in El Paso, Cayma Esparza, a Democrat
[01:54.640 --> 01:59.120] who also stated earlier this month that the law, quote, will not have an effect on the
[01:59.120 --> 02:01.840] prosecution of marijuana cases in El Paso.
[02:01.840 --> 02:06.920] However, the issue was succinctly summarized by Mr. Brandon Ball, an assistant public defender
[02:06.920 --> 02:11.400] in Harris County who stated that quote, the law is constantly changing on what makes something
[02:11.400 --> 02:13.640] illegal based on its chemical makeup.
[02:13.640 --> 02:17.560] It's important that if someone is charged with something, the test matches what they're
[02:17.560 --> 02:22.720] charged with.
[02:22.720 --> 02:27.800] A paper by Tulane University identified a five and a half inch American pocket shark as the
[02:27.800 --> 02:32.880] first of its kind in the Gulf of Mexico, the specimen being only the second pocket shark
[02:32.880 --> 02:38.520] ever captured or recorded with the other one being found way back in 1979 in the East Pacific
[02:38.520 --> 02:39.520] Ocean.
[02:39.520 --> 02:44.360] According to the university paper, the shark secretes a lumus fluid from a gland near its
[02:44.360 --> 02:51.360] front fins for the purposes hypothesized to lure and prey may be drawn into the glow.
[03:14.360 --> 03:26.360] Well, I received my remedy today, came in a box just like the state, I accepted it for
[03:26.360 --> 03:36.360] value right away, it's not true, not later, we are originators and a pathway seems to get
[03:36.360 --> 03:46.360] straighter every day, and I could take anything that belongs to me and put it to good use.
[03:46.360 --> 03:54.360] But I was good for the gander, I want to work for the goose.
[03:54.360 --> 04:05.360] I know some architects, I know some engineers, they see the evidence.
[04:05.360 --> 04:15.360] And what's up with the blatant deception of what is the nature of what you might gain?
[04:15.360 --> 04:21.360] I see something headed straight to you, I think it looks like it's right.
[04:21.360 --> 04:29.560] Okay, we are back, Randy Kelton, Randy Kelton, Brett Fountain, Rue La Radio on this Friday
[04:29.560 --> 04:37.680] the 13th day of December 2013, and I do want to remind everyone that we're running out
[04:37.680 --> 04:45.400] of time on our fundraisers this year and we're not doing well at all.
[04:45.400 --> 04:51.560] This is about the last opportunity to donate to the fundraiser.
[04:51.560 --> 04:55.560] With as little as we did this year, we'll really be struggling next year to keep this
[04:55.560 --> 04:56.560] thing on the air.
[04:56.560 --> 05:02.560] So if you have a couple extra dollars, we could sure use them to keep this show going.
[05:02.560 --> 05:06.560] Okay, we are going to Bill in Texas.
[05:06.560 --> 05:08.560] Oops, I think I unmuted Bill.
[05:08.560 --> 05:09.560] There we go.
[05:09.560 --> 05:14.560] Okay, Bill, are we about done here?
[05:14.560 --> 05:23.560] Yeah, there's just a couple short little points I wanted to bring up about the judicial
[05:23.560 --> 05:29.560] conduct complaints with this response the prosecutor had sent to me.
[05:29.560 --> 05:36.560] He says in this, he goes, as a subject of a judicial ethics complaint filed by the defendant,
[05:36.560 --> 05:43.560] the judge was obligated to recuse himself in order to negate any appearance of impropriety.
[05:43.560 --> 05:52.560] So I'm wondering is that with any judicial conduct complaint, do the judges have to recuse
[05:52.560 --> 05:53.560] themselves?
[05:53.560 --> 05:54.560] Are they obligated?
[05:54.560 --> 05:58.560] No, absolutely not.
[05:58.560 --> 06:00.560] The judge can deny a recusal.
[06:00.560 --> 06:10.560] The judge cannot deny a disqualification motion unless the disqualification motion does not
[06:10.560 --> 06:20.160] state a disqualification claim in which case it can be treated as a motion to recuse no
[06:20.160 --> 06:25.160] matter what the title is on it because a motion is what it is.
[06:25.160 --> 06:28.160] The title doesn't change what it is.
[06:28.160 --> 06:29.160] So there are...
[06:29.160 --> 06:31.160] Texas, I'll go ahead.
[06:31.160 --> 06:37.160] There are statutory grounds for disqualification.
[06:37.160 --> 06:43.160] If you haven't stated one of those, then they can treat it as a recusal.
[06:43.160 --> 06:44.160] Okay.
[06:44.160 --> 06:46.160] You were going to say...
[06:46.160 --> 06:52.160] In Texas, if you can show that the judge is interested, then that's what would go toward
[06:52.160 --> 06:53.160] disqualification.
[06:53.160 --> 06:54.160] Yes.
[06:54.160 --> 07:02.160] If he is related to one of the litigants within three degrees of co-sanguinity where he has
[07:02.160 --> 07:09.160] an interest in the case no matter how minor, then he can be disqualified.
[07:09.160 --> 07:15.160] If you don't state one of those, is it constitutional or statutory?
[07:15.160 --> 07:17.160] I think it's constitutional.
[07:17.160 --> 07:18.160] Both.
[07:18.160 --> 07:25.160] If you don't state a constitutional grounds for disqualification, even if you called it
[07:25.160 --> 07:33.160] disqualify, it's still a motion to recuse and he can deny a motion to recuse.
[07:33.160 --> 07:35.160] He cannot deny a motion to disqualify.
[07:35.160 --> 07:40.160] He has to send that to the head administrative judge at the district and the judge must hold
[07:40.160 --> 07:45.160] hearing on it and the judge make a determination.
[07:45.160 --> 07:48.160] Does that answer the question?
[07:48.160 --> 07:49.160] Yes.
[07:49.160 --> 07:51.160] That was one of the questions.
[07:51.160 --> 07:55.160] The next one was, I'm wondering if...
[07:55.160 --> 08:01.160] This is one thing Adam and I were talking about is whenever these visiting judges come, since
[08:01.160 --> 08:07.160] the judge, if recusing stuff and another one was assigned, it almost seemed like it was
[08:07.160 --> 08:10.160] damaged control.
[08:10.160 --> 08:20.160] I don't know how it works, but that visiting judge, you could kind of tell he didn't want
[08:20.160 --> 08:24.160] to touch any of this with a 10-foot pole.
[08:24.160 --> 08:32.160] All of these municipal judges are almost always lawyers in their day job.
[08:32.160 --> 08:38.160] They come down here to the city grubbing for dollars.
[08:38.160 --> 08:43.160] That's why you can tell the sharpest knife in the door, because if there were, they'd
[08:43.160 --> 08:46.160] be out making the big bucks.
[08:46.160 --> 08:52.160] When you file a judicial conduct complaint against him, it stings him big time, even better
[08:52.160 --> 08:55.160] if you file a bar grievance against him.
[08:55.160 --> 09:01.160] That will really make him unhappy because he feels like he's acting in the capacity of
[09:01.160 --> 09:06.160] the judge and not in the capacity of a lawyer.
[09:06.160 --> 09:10.160] And filing a bar grievance against him is cheating.
[09:10.160 --> 09:14.160] Yeah, life's tough, isn't it, Bubba?
[09:14.160 --> 09:19.160] The only reason he's in that position is because he's got that bar card.
[09:19.160 --> 09:22.160] So, bar grieving anyway.
[09:22.160 --> 09:24.160] Yeah.
[09:24.160 --> 09:26.160] That's the politics.
[09:26.160 --> 09:28.160] Thank y'all so much.
[09:28.160 --> 09:33.160] Okay, thank you, Bill, and keep up the good work.
[09:33.160 --> 09:37.160] Okay, now we're going to Ted in California.
[09:37.160 --> 09:39.160] Hello, Ted.
[09:39.160 --> 09:41.160] Hey, Randy, can you hear me okay?
[09:41.160 --> 09:44.160] Yes, I can.
[09:44.160 --> 09:47.160] Okay.
[09:47.160 --> 09:55.160] I want to back up a little bit on my plan and have a little discussion on it.
[09:55.160 --> 10:03.160] So, I went to hearing on Wednesday and the judge informed me that, in fact, the public defender is representing me.
[10:03.160 --> 10:09.160] And the judge also said, though, yes or no, do you want to represent yourself?
[10:09.160 --> 10:16.160] My response to that was, I cannot make a legal determination right here right now.
[10:16.160 --> 10:27.160] But wouldn't it be prudent for me to find a lawyer that would agree to protect all of my rights?
[10:27.160 --> 10:31.160] And he would not answer that.
[10:31.160 --> 10:38.160] So, I told him I couldn't answer his question until he answered mine besides the fact that I could not make a legal determination at that moment.
[10:38.160 --> 10:49.160] Now, what happened, and I think some of your folks heard this last night, my court monitors walked out with me.
[10:49.160 --> 10:58.160] The court appointed public pretender tried to talk to me and I gave him my Merry Christmas in the hallway.
[10:58.160 --> 11:05.160] I walked away and, sure enough, exactly what I wanted to have happen happened.
[11:05.160 --> 11:09.160] And I feel sorry for this guy.
[11:09.160 --> 11:11.160] He's new to the public defender's office.
[11:11.160 --> 11:13.160] He said that in the courtroom.
[11:13.160 --> 11:20.160] And he began talking about my case to a stranger in the hallway.
[11:20.160 --> 11:32.160] That stranger does know me and started to try to inform this public pretender that it's not a crime and so on.
[11:32.160 --> 11:48.160] And the public pretender proceeded to tell this stranger that, well, he'd done some things and, you know, I can help him.
[11:48.160 --> 11:50.160] You know, it's this and that.
[11:50.160 --> 11:52.160] There was quite a conversation.
[11:52.160 --> 11:53.160] I'll leave it at that.
[11:53.160 --> 11:56.160] The bottom line is they had a conversation.
[11:56.160 --> 12:01.160] And that's exactly what I wanted to have happen.
[12:01.160 --> 12:12.160] And then my acquaintance, my friend, came outside and said what I just told you and further.
[12:12.160 --> 12:15.160] And I said, great.
[12:15.160 --> 12:27.160] So he just breached his duty to me, attorney-client privilege, and further, I don't know if it's, I believe it's slander if it's verbal,
[12:27.160 --> 12:36.160] because he slandered me in telling this person in the hallway that I'm guilty.
[12:36.160 --> 12:48.160] So also, back up to the actual court appearance, during the court appearance, I reminded the judge he is recused for cause
[12:48.160 --> 13:01.160] and that he cannot rule on his own recusal and that he has committed crimes, including not reporting the bribes he's receiving from the county on his form 700.
[13:01.160 --> 13:03.160] And that is a criminal violation.
[13:03.160 --> 13:16.160] Furthermore, it is a federal crime for a state court judge to accept money from somebody other than their employer, which they are doing.
[13:16.160 --> 13:21.160] And these are not amounts to sneeze at.
[13:21.160 --> 13:25.160] It begins with an amount called a stipend.
[13:25.160 --> 13:29.160] I believe every judge, it's just under $10,000.
[13:29.160 --> 13:32.160] And none of the judges are getting the exact amount.
[13:32.160 --> 13:37.160] Some judges get 9600, some judges get 9400, 9500.
[13:37.160 --> 13:39.160] Why is that?
[13:39.160 --> 13:45.160] That to me, if you or I did that, that's money laundering.
[13:45.160 --> 13:46.160] Okay.
[13:46.160 --> 13:56.160] So the judge then proceeded to tell me, Mr. Scarlett, you're treading on 10 water.
[13:56.160 --> 13:58.160] And I let it pass.
[13:58.160 --> 14:02.160] And I noted that the judge just threatened me.
[14:02.160 --> 14:08.160] And I have filed criminal charges against the judge with the Fair Political Practice Commission.
[14:08.160 --> 14:13.160] I have filed criminal claims against the judge.
[14:13.160 --> 14:23.160] I have mailed those to the former of the grand jury and the district attorney has pirated those and secreted them from the grand jury.
[14:23.160 --> 14:28.160] I've documented all through the process that you described earlier today.
[14:28.160 --> 14:35.160] And don't forget, I'm the one that gave you the insurance thing.
[14:35.160 --> 14:46.160] So today, reluctantly, I started to write my lawsuit against this public pretender.
[14:46.160 --> 14:52.160] I'm going to sue him in civil court for malpractice and flander.
[14:52.160 --> 15:02.160] And when I go back to court on Wednesday, I'm going to serve him just prior to my case being called.
[15:02.160 --> 15:07.160] And I'm going to inform the judge that he's being sued by me.
[15:07.160 --> 15:21.160] And I'm going to sue the person that runs the public defender's office because I already have an open bar complaint against her.
[15:21.160 --> 15:33.160] And I'm going to sue her because she has put three of her public pretenders on my case over the last almost five years and every one of them have been incompetent.
[15:33.160 --> 15:46.160] Now, I feel bad for this new guy because it's clear he just joined the public pretenders office and he had no idea and they put him on this case.
[15:46.160 --> 15:53.160] So I feel bad for him. I really do. But I feel worse for myself.
[15:53.160 --> 16:11.160] And so Thursday morning, I sent an email to the court reporter with all the pertinent information requesting a copy of the transcript of Wednesday's hearing.
[16:11.160 --> 16:23.160] And I then further went to the court website where you can also make a submission and fill in all the blanks, which I did, requesting a copy of the transcript.
[16:23.160 --> 16:28.160] Nothing. No response.
[16:28.160 --> 16:42.160] Today, I started the morning by calling the presiding judge of the court, clerk. You call the clerks because you tell the clerks what you want them to know. The clerks turn around and tell the judge it.
[16:42.160 --> 16:47.160] I called. I hear your music.
[16:47.160 --> 17:03.160] I'm glad you did because I couldn't hear it. Hang on. Go on to break. Brandy Helton, Brett Fountain, real raw radio. We'll be right back.

[18:19.160 --> 18:25.160] Traffic courts afford us the least expensive opportunity to learn how to enforce and preserve our rights through due process.

[19:35.160 --> 19:41.160] And we're talking to Ted in California. Okay, Ted, go ahead.
[19:41.160 --> 20:00.160] Okay, so again, I spent the entire day, well, at least till 2pm, trying to get in communication with the court reporter that was at the hearing on Wednesday.
[20:00.160 --> 20:08.160] And she wasn't responding to my email. I have her email address because I requested from her before.
[20:08.160 --> 20:14.160] She hadn't responded to anything that I have done, and that included a phone call.
[20:14.160 --> 20:30.160] Again, and this is for your listeners. If you poke around, but in our case out here, the website for the court, if you poke around it, you can find phone numbers for the clerk of the court.
[20:30.160 --> 20:35.160] And in our case, the court reporter's phone numbers on there as well.
[20:35.160 --> 20:44.160] And you want to know who the presiding judge of the court is. You want to know who the presiding judge of the criminal court is in California, or at least in Santa Clara County.
[20:44.160 --> 20:57.160] They change that every January. Okay, these are all the things. Again, I'll real quickly say, please, I don't care if it's the $5 send it into the show, please do it today.
[20:57.160 --> 21:07.160] Okay, Randy, I got $50 coming in. And if I, a homeless person, can give you $50, okay?
[21:07.160 --> 21:19.160] Please, people, send something now. Anyway, so finally found the supervisor for this court reporter.
[21:19.160 --> 21:33.160] Left a message. She called me back. I said, look, I'm about ready to file a criminal complaint against this court reporter for obstruction of justice.
[21:33.160 --> 21:38.160] And tendering and delaying my case.
[21:38.160 --> 21:45.160] Randy, I had an email from that court reporter in less than five minutes. The transcript will cost $34.
[21:45.160 --> 21:50.160] Funny email. Funny how that works.
[21:50.160 --> 22:10.160] Yeah. And remember, don't ever ask any of these people to do something you want them to do. But my case is at a point where I don't want to go after everybody, but the little, I haven't given a full description here, but I'll say this and I think it's convincing enough with what I already said.
[22:10.160 --> 22:26.160] It's becoming very clear to me that Santa Clara County court are nothing more than a criminal organization that includes the clerks in the court's office, the court reporters are even involved.
[22:26.160 --> 22:29.160] And they're a separate entity to the court.
[22:29.160 --> 22:47.160] I've just learned today that the sheriff's department does not have jurisdiction within the court building, but yet the court deputies dressed in sheriff's deputy costume appear to be sheriff's deputies.
[22:47.160 --> 23:05.160] And so I will also be filing criminal complaints with the deputies in the courtroom for the judge threatening me. I'm a material witness against that judge for his crimes that I've already reported and he knows that.
[23:05.160 --> 23:08.160] And he threatened me.
[23:08.160 --> 23:16.160] And he threatened you because you reported that crime.
[23:16.160 --> 23:22.160] And he specifically said that he says you've already said this before.
[23:22.160 --> 23:33.160] You know, when I, when I detailed his crimes, and he says, and you're saying it again, and you're treading up thin water.
[23:33.160 --> 23:41.160] Okay, so he's threatening a material witness and he's a dummy because he's recused for cause.
[23:41.160 --> 23:59.160] And I want to digress for a moment. This motion to recuse versus motion to disqualify. That's very good information, but also always cite Haynes versus Kerner Haynes versus Kerner says that a pro se litigants.
[23:59.160 --> 24:11.160] Pleading must be liberally construed. It cannot be dismissed without direction from the court how to cure any defects.
[24:11.160 --> 24:15.160] They ignore this all the time, but cite it anyway.
[24:15.160 --> 24:30.160] So back to this public defender that they think they have put on me. He, the public defender actually called me today around 430pm. And frankly, it's just to antagonize me as far as I'm concerned.
[24:30.160 --> 24:49.160] Now, back in the very beginning, I was ordered to the public defenders while I was in chains in the courtroom. I was under duress. I abided by that order. And that's how the public defender got my case back in February of 2015.
[24:49.160 --> 25:02.160] It took me night, it took me 14 months to get them off. But in the time that they were on the case, they did absolutely nothing for me. They didn't return my calls. They never talked to me.
[25:02.160 --> 25:20.160] And after 14 months of going to hearing, I succumbed to a heart attack. I just realized that by the court putting the public defender back on to me, they've retraumatized me.
[25:20.160 --> 25:39.160] I'm having nightmares because the public defender did not protect my right. The public defender did not protect me from Thomas Hastings screaming and yelling at me for a plea and then entering the plea on his own.
[25:39.160 --> 25:57.160] And then he raided me when he asked me over and over again if I waived time. My statement was I see the public defender because I didn't even know the lawyer's name. I see the public defender nodding his head.
[25:57.160 --> 26:13.160] The judge slammed me down the time wave. I said, objection, objection, objection. And he said, you can't object. As far as I'm concerned, the case was over right then and there, three years ago.
[26:13.160 --> 26:32.160] So anyway, I am traumatized. I mean, you ever take yourself to the emergency room and you're in surgery 10 minutes later and they're operating inside your heart because you've been so traumatized by the whole system.
[26:32.160 --> 26:44.160] So now they've ripped those wounds off and I'm in full panic.
[26:44.160 --> 26:50.160] And it's all because of.
[26:50.160 --> 26:55.160] What is the deal with your federal suit you filed?
[26:55.160 --> 27:10.160] The federal suit is just a right of review for the lack of a Fourth Amendment arrest warrant. The right of review is basically a non-suit and it is to just get.
[27:10.160 --> 27:16.160] Can you, did you request a restraining order?
[27:16.160 --> 27:18.160] No.
[27:18.160 --> 27:26.160] You should look at filing a restraining order with the federal court.
[27:26.160 --> 27:28.160] One more time.
[27:28.160 --> 27:55.160] File a restraining order petition for restraining order with the federal court and make, you know, make these accusations that they're trying to kill you before the federal court can rule on your issue and ask the federal court to issue a restraining order to restrain the state court from moving ahead until there's a determination on your petition to the federal court to
[27:55.160 --> 27:58.160] rule on the.
[27:58.160 --> 28:02.160] That sounds like a petition to declare to our judgment.
[28:02.160 --> 28:19.160] Yes, that's exactly what it is. And because this judge Lucy Cole gave $1 million to the Obama campaign for reelection and then subsequently was appointed to this federal judgeship and her husband sits on the California Supreme Court.
[28:19.160 --> 28:27.160] You know where these people shut me down because I'm exposing everything out here.
[28:27.160 --> 28:34.160] You need to be filing that in the DC court.
[28:34.160 --> 28:43.160] But on second thought on in February, their clocks going to be run out.
[28:43.160 --> 28:48.160] So you don't want a restraining order, but it'll stop the clock.
[28:48.160 --> 28:56.160] I want to give a shout out to bill bill you man you've come a long way it was really nice to hear what you had to share tonight.
[28:56.160 --> 29:05.160] And I looked up sovereign citizen and I don't know I think we should go after these dictionaries because.
[29:05.160 --> 29:20.160] Robert says a member of a political movement or of people who have opposed taxation and question logistic government absolutely wrong. Sovereign citizen is an oxymoron.
[29:20.160 --> 29:22.160] I think we all know that.
[29:22.160 --> 29:28.160] And they're they're portraying to the public at large.
[29:28.160 --> 29:36.160] And it's just totally false. Yeah, the anyone who stands up for their rights is somehow an anarchist.
[29:36.160 --> 29:38.160] Right.
[29:38.160 --> 29:43.160] So Randy, it really boils down to this.
[29:43.160 --> 29:47.160] I want the public defender off my case.
[29:47.160 --> 30:03.160] And by the way, they're bouncing around the several judges the presiding judge three hearings ago under her breath told the district attorney.
[30:03.160 --> 30:05.160] Keep your voice down.
[30:05.160 --> 30:12.160] The government now has Russian technology that matches identities to voices so we can tell who's doing the talking.
[30:12.160 --> 30:16.160] Dr. Catherine Albright back to tell you how it works after this.
[30:16.160 --> 30:18.160] Privacy is under attack.
[30:18.160 --> 30:22.160] When you give up data about yourself, you'll never get it back again.
[30:22.160 --> 30:27.160] And once your privacy is gone, you'll find your freedoms will start to vanish too.
[30:27.160 --> 30:29.160] So protect your rights.
[30:29.160 --> 30:32.160] Say no to surveillance and keep your information to yourself.
[30:32.160 --> 30:33.160] Privacy.
[30:33.160 --> 30:38.160] It's worth hanging on to this message is brought to you by start page dot com.
[30:38.160 --> 30:45.160] The private search engine alternative to Google Yahoo and Ben start over with start page.
[30:45.160 --> 30:54.160] Since 2001, when the Patriot Act opened the doors to electronic surveillance, big brother has gone crazy vacuuming up all of our data.
[30:54.160 --> 30:59.160] Now it has a new tactic courtesy of our former communist allies, the Russians.
[30:59.160 --> 31:06.160] It's called voice grid nation and it analyzes and identifies voices courtesy of Russia's speech technology center.
[31:06.160 --> 31:12.160] When authorities intercept a call, the speaker's voice is compared to millions of others like a fingerprint.
[31:12.160 --> 31:15.160] How long does it take for a match? Three seconds.
[31:15.160 --> 31:18.160] So watch what you say on the phone, comrades.
[31:18.160 --> 31:22.160] Whether you say your name or not, big brother may know who's talking.
[31:22.160 --> 31:31.160] Dr. Catherine Albright for start page dot com, the world's most private search engine.
[31:31.160 --> 31:32.160] I lost my son.
[31:32.160 --> 31:33.160] My uncle.
[31:33.160 --> 31:34.160] My uncle.
[31:34.160 --> 31:35.160] On September 11, 2004.
[31:35.160 --> 31:39.160] Most people don't know that a third tower fell on September 11.
[31:39.160 --> 31:43.160] World Trade Center 7, a 47-story skyscraper was not hit by a plane.
[31:43.160 --> 31:47.160] Although the official explanation is that fire brought down building 7,
[31:47.160 --> 31:51.160] over 1,200 architects and engineers has looked into the evidence
[31:51.160 --> 31:53.160] and believed there is more to the story.
[31:53.160 --> 31:54.160] Bring justice to my son.
[31:54.160 --> 31:55.160] My uncle.
[31:55.160 --> 31:56.160] My nephew.
[31:56.160 --> 31:57.160] My son.
[31:57.160 --> 31:58.160] Go to building what.org.
[31:58.160 --> 31:59.160] Why it fell.
[31:59.160 --> 32:00.160] Why it matters.
[32:00.160 --> 32:01.160] As what you can do.

[33:01.160 --> 33:07.160] Live Free Speech Radio, LogosRadioNetwork.com
[33:31.160 --> 33:46.160] Okay, we are back.
[33:46.160 --> 33:49.160] This is Rule of Law Radio.
[33:49.160 --> 33:54.160] It is Friday the 13th of December, 2019.
[33:54.160 --> 33:57.160] And we're here talking with Ted in California.
[33:57.160 --> 34:02.160] You can go ahead as soon as I get you unmuted.
[34:02.160 --> 34:04.160] There you go Ted.
[34:04.160 --> 34:12.160] Okay, so in the previous segment I was kind of going through my frustration
[34:12.160 --> 34:17.160] of what my day went like and remember I've had two heart attacks.
[34:17.160 --> 34:21.160] The second one in the courtroom where the judge could care less
[34:21.160 --> 34:25.160] and continue to prosecute me while the paramedics were on the way.
[34:25.160 --> 34:33.160] So you see, you know, they kind of like to giggle and say,
[34:33.160 --> 34:35.160] well, you're not a lawyer, that's why.
[34:35.160 --> 34:38.160] No, they're disrespecting me.
[34:38.160 --> 34:43.160] If they gave me the same respect as a lawyer, I'd have that transcript this morning.
[34:43.160 --> 34:50.160] Okay, so what they caused me was to have chest pain,
[34:50.160 --> 34:52.160] my blood pressure to go through the roof.
[34:52.160 --> 34:56.160] That's not me, I get that. I'm responsible for myself.
[34:56.160 --> 35:02.160] But after six, seven hours of phone calls and emails and so on,
[35:02.160 --> 35:06.160] just to get a transcript that I'm entitled to?
[35:06.160 --> 35:13.160] Okay, and remember that the presiding judge conspired with the court clerk's office
[35:13.160 --> 35:18.160] to not give me a copy of the court case file.
[35:18.160 --> 35:29.160] And anyway, she's also sitting on four requests for ancillary expenses
[35:29.160 --> 35:36.160] and I'm asking for an expert witness, funding for transcripts and some other things,
[35:36.160 --> 35:42.160] which it's just absolute obvious things necessary to mount a defense
[35:42.160 --> 35:48.160] and she's now sitting on a five weeks, hasn't denied it, hasn't approved it,
[35:48.160 --> 35:55.160] but in the past, she denied my request for a copy of the court case file.
[35:55.160 --> 35:56.160] Wow.
[35:56.160 --> 36:05.160] And so, and by the way, that caused a prominent defense attorney to run.
[36:05.160 --> 36:09.160] He was going to represent me because I saved it from one of his clients
[36:09.160 --> 36:13.160] who was mentally unstable that was about to attack him.
[36:13.160 --> 36:19.160] And as a reciprocity, about two months later, he said,
[36:19.160 --> 36:23.160] hey, you have my back, I'd like to try to help you.
[36:23.160 --> 36:25.160] And this guy knows the governor.
[36:25.160 --> 36:30.160] The governor comes to his house for dinner, so he's a prominent lawyer.
[36:30.160 --> 36:35.160] And he ran because this presiding judge of the criminal court refused to give me
[36:35.160 --> 36:40.160] a copy of the court case file because he wanted to review the case
[36:40.160 --> 36:44.160] and see the defenses and such, and so he ran.
[36:44.160 --> 36:49.160] So that's why I'm telling them I'm out without a lawyer because of the court.
[36:49.160 --> 36:59.160] But anyway, what I'm really, I wanted to advise that it's, I know it's tough all over the U.S.,
[36:59.160 --> 37:06.160] but here in Santa Clara County, we're dealing with something beyond.
[37:06.160 --> 37:07.160] Okay.
[37:07.160 --> 37:14.160] And what I'm seeing is even the court reporters are willing to obstruct you.
[37:14.160 --> 37:22.160] And did you, did you file a professional conduct complaint against the court reporter?
[37:22.160 --> 37:25.160] Well, it just happened today, so no.
[37:25.160 --> 37:35.160] Look at that because here in Texas, the state, what is he, secretary of state,
[37:35.160 --> 37:39.160] man, they really work over these court reporters.
[37:39.160 --> 37:45.160] They protect the judges and the prosecutors and lawyers, but everybody else,
[37:45.160 --> 37:48.160] they don't have any protection at all.
[37:48.160 --> 37:53.160] Oh, and the police, the police has their own people that you file with,
[37:53.160 --> 37:55.160] and they protect them.
[37:55.160 --> 37:59.160] But the police, prosecutors and judges, they protect one another.
[37:59.160 --> 38:03.160] But everybody else, they will crucify a court reporter.
[38:03.160 --> 38:10.160] We, and for worse, we had the court reporter and the prosecutor throwing each other under the bus.
[38:10.160 --> 38:18.160] The complaint against the court reporter, the secretary of state would issue a ruling,
[38:18.160 --> 38:26.160] and if the court reporter didn't like the ruling, then they'd have to go to Austin and stand criminal trial.
[38:26.160 --> 38:28.160] So they really hammer these guys.
[38:28.160 --> 38:37.160] So you might consider a professional conduct complaint, especially if you find something missing from the transcript.
[38:37.160 --> 38:48.160] Okay, and I'll use that also on the other court reporter that did not correctly do the transcription of my arraignment.
[38:48.160 --> 39:01.160] Now, Randy, what I'm really calling about is my filing a malpractice lawsuit against this public defender
[39:01.160 --> 39:07.160] and Molly O'Neill, who runs the public defender's office.
[39:07.160 --> 39:11.160] Is that going to get them off my case?
[39:11.160 --> 39:16.160] That will disqualify the office.
[39:16.160 --> 39:21.160] If one lawyer in the firm, the whole public defender's office is one firm.
[39:21.160 --> 39:28.160] If one lawyer is disqualified, the whole firm is disqualified.
[39:28.160 --> 39:38.160] Okay, so I'll be writing that if you can give me any sources or any examples.
[39:38.160 --> 39:51.160] It's going to be trespassing, malpractice, and violating judicial, while the lawyers, whatever their candidates are.
[39:51.160 --> 39:53.160] Okay, you can't claim that.
[39:53.160 --> 39:58.160] You can't claim a bar grievance, but don't claim that in the lawsuit.
[39:58.160 --> 40:06.160] In the lawsuit, you claim the behavior that amounted to a judicial conduct violation.
[40:06.160 --> 40:17.160] But the codes say that the bar grievance standards do not create a cause of action.
[40:17.160 --> 40:24.160] So you can't claim those as a cause of action. You can claim the underlying behavior as a cause of action,
[40:24.160 --> 40:29.160] but you can't use the bar grievance standards to support it.
[40:29.160 --> 40:36.160] Well, you briefed the attorney-client privilege by discussing my case with a stranger.
[40:36.160 --> 40:42.160] That's different. That's not bar grievance standards.
[40:42.160 --> 40:48.160] That comes under almost criminal. That's clearly a tort.
[40:48.160 --> 40:55.160] I'm sorry, that's not a tort. That's a contract-contractual violation.
[40:55.160 --> 41:03.160] It's implicit in the contract, non-disclosures implicit in the contract.
[41:03.160 --> 41:07.160] So that's doable because it's a contractual violation.
[41:07.160 --> 41:10.160] Well, we really don't have a contract.
[41:10.160 --> 41:14.160] Yes, you do.
[41:14.160 --> 41:16.160] Yeah, you do. The court gave you one.
[41:16.160 --> 41:24.160] I'm going to use it. Their defense out of there is the judge appointed them. They don't have a contract with them.
[41:24.160 --> 41:28.160] Yes, they do.
[41:28.160 --> 41:32.160] Even if they don't have a written, they have a verbal.
[41:32.160 --> 41:40.160] If the court appointed them, that established a contract and you are the intended third-party beneficiary.
[41:40.160 --> 41:46.160] So you have standing under the contract. So absolutely there's a contract.
[41:46.160 --> 41:52.160] You know, I don't want to kill myself writing this pleading. It could always be amended.
[41:52.160 --> 41:56.160] The point is to get it filed on Monday and then on Wednesday.
[41:56.160 --> 42:02.160] Just get it filed. Doesn't matter if it's a mess. Doesn't matter if it's not complete.
[42:02.160 --> 42:06.160] You don't have to try the case in the pleading.
[42:06.160 --> 42:24.160] All you have to do is accuse him of having an improper discussion with a third party about your case and accusing you of being guilty when it's his duty to prove you innocent.
[42:24.160 --> 42:36.160] That's enough. He's going to argue that it's insufficient. Let him then let him tell you what he thinks is wrong with it and then just file an amendment.
[42:36.160 --> 42:44.160] Okay, yeah, because he did. He told my friend that I'm guilty and he's never talked to me.
[42:44.160 --> 42:58.160] He doesn't even know about my affirmative defenses and he doesn't apparently know that this is not even a crime according to the 50 defense lawyers that I've talked to.
[42:58.160 --> 43:20.160] He's clearly not read the filings. He's making a determination without reading the facts and law of the case so sue him for it because you can claim that he is attempting to leave you without adequate counsel intentionally.
[43:20.160 --> 43:29.160] Well, he's terrorizing me because he's saying I'm guilty to my friend. And so what is that? How the hell is he going to represent me?
[43:29.160 --> 43:43.160] And then he made that phone call to me today at 4.30. That's when his court reporter, the freaking games they play, she waited till 3.08 p.m. to send me the email of how much it was going to cost.
[43:43.160 --> 43:54.160] Okay, wait, Ted, we're about to go to break. I do need to move along. I've got a whole board full of callers. Send me an email and we'll talk about how to prepare that suit.

[46:22.160 --> 46:34.160] Yeah, always I must be careful of what I'm wishing for. When I'm hungry, I like to know just what I'm fishing for.
[46:34.160 --> 46:40.160] I ain't asking for much, I ain't trying to be no glutton
[46:40.160 --> 46:45.160] I'm just here makin' my livin' pushin' button
[46:45.160 --> 46:52.160] I get my message out, do anyone in the shoutin' distance
[46:52.160 --> 46:58.160] I vote for bravery and against slavery, showin' resistance
[46:58.160 --> 47:03.160] First I'm rollin' and then I'm walkin' and then I start to strut
[47:03.160 --> 47:07.160] Okay, we are back, Randy Kelton, Brett Fountain, Louis Valradio
[47:07.160 --> 47:11.160] and we're going to Tina in California
[47:11.160 --> 47:15.160] Tina, what do you have for us today?
[47:15.160 --> 47:21.160] Hey, Randy, could you put me on the next one because I just sat down to dinner
[47:21.160 --> 47:24.160] I will put you in the next one
[47:24.160 --> 47:30.160] Okay, John from New York, John, where have you been?
[47:30.160 --> 47:35.160] I don't know, I don't know where I am and where I've been, how are you, Randy?
[47:35.160 --> 47:40.160] I am good, I don't care what everybody says
[47:40.160 --> 47:44.160] No, you are good, you are good, yes you are
[47:44.160 --> 47:47.160] and you help a lot of people, let me tell ya
[47:47.160 --> 47:51.160] that judge has not been thrown out yet, so I don't know
[47:51.160 --> 47:55.160] not to be disrespected, but the fat lady ain't sangin'
[47:55.160 --> 47:58.160] so I don't know what's gonna happen
[47:58.160 --> 48:02.160] but they've had people bleedin' down his neck in the court like they said
[48:02.160 --> 48:06.160] and there are several complaints against him
[48:06.160 --> 48:11.160] and several complaints about violating the election laws
[48:11.160 --> 48:15.160] for judges, so anyway, here we go
[48:15.160 --> 48:20.160] this will take exactly one minute and 42 seconds I believe
[48:20.160 --> 48:23.160] there's a house with two apartments in it
[48:23.160 --> 48:26.160] and both apartments are subsidized by HUD
[48:26.160 --> 48:29.160] HUD pays their rent
[48:29.160 --> 48:32.160] I don't know, do you have HUD in Texas?
[48:32.160 --> 48:35.160] No, not that I know of
[48:35.160 --> 48:37.160] Okay, but HUD pays the rent
[48:37.160 --> 48:40.160] there's three people, about three people living in apartment number one
[48:40.160 --> 48:43.160] and about three people living in apartment number two
[48:43.160 --> 48:47.160] receiving HUD subsidy perfectly legal
[48:47.160 --> 48:50.160] now these people are very disruptive, everybody in the house
[48:50.160 --> 48:52.160] they punched a neighbor for no reason
[48:52.160 --> 48:55.160] they pulled a knife on her daughters for no reason
[48:55.160 --> 48:57.160] threatened to beat up the same neighbor
[48:57.160 --> 49:00.160] stalked the same neighbor stalking
[49:00.160 --> 49:04.160] party at 4 a.m., gun vengeance, make noises day and night
[49:04.160 --> 49:06.160] you get the picture, anyway
[49:06.160 --> 49:09.160] four more people also have been living in the house
[49:09.160 --> 49:13.160] for years now who are not on HUD
[49:13.160 --> 49:16.160] but are living there illegally
[49:16.160 --> 49:19.160] those four people pay money under the table
[49:19.160 --> 49:21.160] to the actual HUD recipient
[49:21.160 --> 49:23.160] and get to live there illegally
[49:23.160 --> 49:25.160] now in September of 2018
[49:25.160 --> 49:27.160] these people are so disruptive
[49:27.160 --> 49:28.160] the police have been there
[49:28.160 --> 49:30.160] we just want to get rid of them
[49:30.160 --> 49:32.160] because it's really bad stuff
[49:32.160 --> 49:34.160] September 2018 I reported them
[49:34.160 --> 49:37.160] and called three more times to HUD
[49:37.160 --> 49:40.160] additionally, so four times I called HUD
[49:40.160 --> 49:43.160] and a neighbor also called HUD two or three times
[49:43.160 --> 49:46.160] and all we got were excuses, well you'd be surprised
[49:46.160 --> 49:48.160] how long it takes to throw people out
[49:48.160 --> 49:50.160] it takes a long time
[49:50.160 --> 49:52.160] we don't know if they're really living there
[49:52.160 --> 49:53.160] yada yada yada
[49:53.160 --> 49:55.160] now they went to investigate persons
[49:55.160 --> 49:58.160] and they must have spoken to the people
[49:58.160 --> 50:00.160] because then the landlord came
[50:00.160 --> 50:03.160] and must have reamed them out
[50:03.160 --> 50:05.160] because the landlord
[50:05.160 --> 50:07.160] we saw the landlord standing there
[50:07.160 --> 50:10.160] talking to the bad people that are not supposed to be there
[50:10.160 --> 50:13.160] HUD ended up chastising the neighbor
[50:13.160 --> 50:15.160] who reported them
[50:15.160 --> 50:17.160] and told her to mind her own business
[50:17.160 --> 50:19.160] that's what HUD said to the neighbor
[50:19.160 --> 50:21.160] who reported to HUD
[50:21.160 --> 50:22.160] that's going on
[50:22.160 --> 50:24.160] told her to mind her own business
[50:24.160 --> 50:26.160] September 2018 and December now
[50:26.160 --> 50:28.160] 2019, that's over a year
[50:28.160 --> 50:30.160] how long does it take
[50:30.160 --> 50:32.160] one person has lived there illegally
[50:32.160 --> 50:33.160] for four years
[50:33.160 --> 50:35.160] the rest have lived there two and three years
[50:35.160 --> 50:37.160] HUD is just as guilty as they are
[50:37.160 --> 50:39.160] HUD needs to be sent to jail
[50:39.160 --> 50:42.160] along with the HUD defrauders
[50:42.160 --> 50:43.160] how do we get rid of the undesirable
[50:43.160 --> 50:44.160] hold on
[50:44.160 --> 50:47.160] have you filed professional conduct complaints
[50:47.160 --> 50:49.160] against the HUD employees
[50:49.160 --> 50:52.160] no I didn't know you could do that
[50:52.160 --> 50:53.160] oh yeah
[50:53.160 --> 50:54.160] anybody who's a
[50:54.160 --> 50:56.160] a professional employee of the government
[50:56.160 --> 50:59.160] you can file a professional conduct complaint against them
[50:59.160 --> 51:02.160] have you accused them of taking bribes
[51:02.160 --> 51:05.160] from these bad guys
[51:05.160 --> 51:06.160] no
[51:06.160 --> 51:07.160] no
[51:07.160 --> 51:09.160] why not
[51:09.160 --> 51:11.160] well I
[51:11.160 --> 51:12.160] I don't know
[51:12.160 --> 51:15.160] I didn't know you could do that
[51:15.160 --> 51:16.160] of course you can
[51:16.160 --> 51:20.160] that's why I'm calling you
[51:20.160 --> 51:22.160] well what other reason
[51:22.160 --> 51:24.160] would these people have
[51:24.160 --> 51:26.160] for
[51:26.160 --> 51:30.160] misappropriation of public funds
[51:30.160 --> 51:31.160] I don't know
[51:31.160 --> 51:32.160] I don't know that's a good question
[51:32.160 --> 51:34.160] is it possible
[51:34.160 --> 51:36.160] is it possible
[51:36.160 --> 51:39.160] that after investigating as long as they did
[51:39.160 --> 51:40.160] they couldn't determine
[51:40.160 --> 51:42.160] that these people were really living there
[51:42.160 --> 51:44.160] I mean their cars were there
[51:44.160 --> 51:45.160] they have cars there
[51:45.160 --> 51:46.160] these people by the way
[51:46.160 --> 51:47.160] I don't have a car
[51:47.160 --> 51:49.160] I can't afford them
[51:49.160 --> 51:51.160] but these people could afford a car
[51:51.160 --> 51:53.160] and they're really they're really living off
[51:53.160 --> 51:55.160] the system
[51:55.160 --> 51:56.160] real good
[51:56.160 --> 51:57.160] and
[51:57.160 --> 51:58.160] okay if you want to go after
[51:58.160 --> 52:00.160] stop going after the bad people
[52:00.160 --> 52:01.160] go after the
[52:01.160 --> 52:05.160] government functionaries who failed to do their duty
[52:05.160 --> 52:08.160] okay now supposing
[52:08.160 --> 52:09.160] I'm just wondering
[52:09.160 --> 52:12.160] what possibly good reason would have
[52:12.160 --> 52:14.160] in not throwing them out
[52:14.160 --> 52:16.160] I mean could they possibly
[52:16.160 --> 52:18.160] here I will choose them
[52:18.160 --> 52:20.160] what is HUD's duty
[52:20.160 --> 52:23.160] HUD is providing funding
[52:23.160 --> 52:25.160] if they're providing funding
[52:25.160 --> 52:27.160] for people to live in an apartment
[52:27.160 --> 52:30.160] and then know those people are then
[52:30.160 --> 52:32.160] sub leasing that apartment to someone else
[52:32.160 --> 52:34.160] and collecting money for it
[52:34.160 --> 52:39.160] then HUD itself is misappropriating public funds
[52:39.160 --> 52:41.160] but supposing
[52:41.160 --> 52:44.160] and
[52:44.160 --> 52:48.160] ask HUD to recover from their employees
[52:48.160 --> 52:50.160] who failed to perform their duty
[52:50.160 --> 52:55.160] the funds that are being paid for this housing
[52:55.160 --> 52:57.160] these guys are not going to do anything
[52:57.160 --> 53:00.160] unless they feel like they have something to lose
[53:00.160 --> 53:04.160] I'll say that again
[53:04.160 --> 53:06.160] go after the agents
[53:06.160 --> 53:09.160] who failed to perform their duty
[53:09.160 --> 53:11.160] okay supposing they have a good excuse
[53:11.160 --> 53:12.160] is there a good excuse
[53:12.160 --> 53:15.160] why they didn't perform their duty
[53:15.160 --> 53:18.160] make them come up with it
[53:18.160 --> 53:19.160] and then
[53:19.160 --> 53:21.160] I don't know
[53:21.160 --> 53:23.160] they say anything
[53:23.160 --> 53:24.160] but file against them anyway
[53:24.160 --> 53:26.160] you make them a liability
[53:26.160 --> 53:27.160] file against their boss
[53:27.160 --> 53:30.160] for failing to properly
[53:30.160 --> 53:34.160] train and manage his people
[53:34.160 --> 53:36.160] okay there's three
[53:36.160 --> 53:37.160] now who do I file with
[53:37.160 --> 53:40.160] the boss is probably innocent
[53:40.160 --> 53:41.160] don't know this is going on
[53:41.160 --> 53:43.160] when you file against the boss
[53:43.160 --> 53:44.160] for what his people did
[53:44.160 --> 53:48.160] he is not going to be a half camper
[53:48.160 --> 53:49.160] now who do you file against
[53:49.160 --> 53:52.160] I mean who do you file with
[53:52.160 --> 53:53.160] I don't know
[53:53.160 --> 53:57.160] who do these people work for
[53:57.160 --> 53:58.160] well HUD
[53:58.160 --> 54:01.160] they work for the local HUD office
[54:01.160 --> 54:03.160] okay who manages
[54:03.160 --> 54:06.160] who's responsible for that local HUD office
[54:06.160 --> 54:07.160] oh I don't know
[54:07.160 --> 54:08.160] I don't know who the manager is
[54:08.160 --> 54:10.160] I can find out
[54:10.160 --> 54:11.160] okay find out
[54:11.160 --> 54:12.160] and then find out
[54:12.160 --> 54:16.160] who that manager's boss is
[54:16.160 --> 54:18.160] and file with the manager's boss
[54:18.160 --> 54:20.160] go up as high as you can
[54:20.160 --> 54:22.160] all right
[54:22.160 --> 54:24.160] we once filed criminal charges
[54:24.160 --> 54:26.160] against
[54:26.160 --> 54:30.160] a IRS agent
[54:30.160 --> 54:31.160] not exactly an agent
[54:31.160 --> 54:35.160] the agent perpetrated an improper
[54:35.160 --> 54:38.160] raid on a chiropractor's office
[54:38.160 --> 54:39.160] where they came in with guns
[54:39.160 --> 54:40.160] in their hands
[54:40.160 --> 54:42.160] and under the manual
[54:42.160 --> 54:43.160] they're only allowed to draw
[54:43.160 --> 54:44.160] their weapon if they have
[54:44.160 --> 54:46.160] cost to draw on fire
[54:46.160 --> 54:48.160] so we looked up who was the
[54:48.160 --> 54:50.160] highest level guy who had to
[54:50.160 --> 54:52.160] approve this raid
[54:52.160 --> 54:54.160] and we filed criminal charges
[54:54.160 --> 54:55.160] against him
[54:55.160 --> 54:57.160] now what form
[54:57.160 --> 54:59.160] they fired the IRS agent
[54:59.160 --> 55:01.160] the next day
[55:01.160 --> 55:04.160] but that was quick
[55:04.160 --> 55:06.160] oh when you start going after
[55:06.160 --> 55:08.160] the boss's boss's boss
[55:08.160 --> 55:10.160] and file against them
[55:10.160 --> 55:13.160] for misappropriation public funds
[55:13.160 --> 55:15.160] he is not going to be
[55:15.160 --> 55:16.160] a happy camper
[55:16.160 --> 55:18.160] and sometimes it can come in handy
[55:18.160 --> 55:21.160] to have an information request
[55:21.160 --> 55:24.160] for something like an org chart
[55:24.160 --> 55:26.160] you want to see the chain of command
[55:26.160 --> 55:28.160] and it's an innocuous request
[55:28.160 --> 55:30.160] it can come from anyone
[55:30.160 --> 55:32.160] and they have a duty
[55:32.160 --> 55:34.160] to inform the public about that
[55:34.160 --> 55:36.160] so you've asked for an org chart
[55:36.160 --> 55:37.160] now you see the titles
[55:37.160 --> 55:38.160] who's responsible
[55:38.160 --> 55:40.160] you can go up as high as you
[55:40.160 --> 55:43.160] feel is appropriate there
[55:43.160 --> 55:45.160] okay you filed charges
[55:45.160 --> 55:46.160] against one of these guys
[55:46.160 --> 55:48.160] who are innocent
[55:48.160 --> 55:50.160] they're going to develop
[55:50.160 --> 55:51.160] what we call
[55:51.160 --> 55:53.160] righteous indignation
[55:56.160 --> 55:58.160] and everybody down below
[55:58.160 --> 56:00.160] and finds out about this
[56:00.160 --> 56:03.160] fecal occurrence rule
[56:03.160 --> 56:07.160] where feces rolls down the hill
[56:07.160 --> 56:09.160] I didn't say poop
[56:09.160 --> 56:11.160] it would be improper to say poop
[56:11.160 --> 56:13.160] on the radio so I wouldn't say that
[56:13.160 --> 56:15.160] right
[56:15.160 --> 56:17.160] what kind of a form do you use
[56:17.160 --> 56:19.160] to file the charges
[56:19.160 --> 56:21.160] how do you write it up?
[56:23.160 --> 56:25.160] I don't know
[56:25.160 --> 56:27.160] figure it out
[56:27.160 --> 56:28.160] look at what's going on
[56:28.160 --> 56:30.160] you filed a complaint
[56:30.160 --> 56:32.160] with the highest level guy
[56:32.160 --> 56:33.160] you can find
[56:33.160 --> 56:35.160] with the guy below him
[56:35.160 --> 56:37.160] and say this guy is responsible
[56:37.160 --> 56:39.160] for managing all these people
[56:39.160 --> 56:41.160] and he's not managing these people
[56:41.160 --> 56:43.160] and because he's not managing these people
[56:43.160 --> 56:46.160] he's wasting my government tax money
[56:48.160 --> 56:49.160] okay just write a letter
[56:49.160 --> 56:51.160] and sign it and date it
[56:51.160 --> 56:53.160] try that first
[56:53.160 --> 56:55.160] if you don't get a response
[56:55.160 --> 56:57.160] then find out who this guy is
[56:57.160 --> 56:59.160] who the highest guy you can is
[56:59.160 --> 57:01.160] and go to the sheriff's department
[57:01.160 --> 57:03.160] or the police department
[57:03.160 --> 57:05.160] and file a criminal complaint against him
[57:05.160 --> 57:08.160] for misappropriating public funds
[57:08.160 --> 57:09.160] and in the process
[57:09.160 --> 57:11.160] causing you to be
[57:11.160 --> 57:13.160] subjected
[57:13.160 --> 57:15.160] to harassment by these people
[57:15.160 --> 57:17.160] who are legally in the apartment
[57:19.160 --> 57:21.160] you might look and see
[57:21.160 --> 57:23.160] if that person is a lawyer
[57:23.160 --> 57:25.160] some of these people that get into
[57:25.160 --> 57:26.160] government positions
[57:26.160 --> 57:27.160] especially the higher you go
[57:27.160 --> 57:29.160] some of them are lawyers
[57:29.160 --> 57:31.160] so they're subject to a bar
[57:31.160 --> 57:33.160] complaint or bar grievance
[57:33.160 --> 57:35.160] as they're called
[57:35.160 --> 57:37.160] okay now
[57:37.160 --> 57:39.160] go back and summarize
[57:39.160 --> 57:41.160] how many charges can we file against them
[57:41.160 --> 57:43.160] and what do you call the charges?
[57:43.160 --> 57:45.160] as many as you can think of
[57:45.160 --> 57:47.160] you have to be a little bit creative
[57:47.160 --> 57:49.160] we're not in your circumstance
[57:49.160 --> 57:51.160] I don't know what all these people have done
[57:51.160 --> 57:53.160] write up a big story
[57:53.160 --> 57:55.160] document
[57:55.160 --> 57:57.160] bad behavior
[57:57.160 --> 57:59.160] document your
[57:59.160 --> 58:01.160] the context with these officials
[58:01.160 --> 58:03.160] who are responsible
[58:03.160 --> 58:05.160] for
[58:05.160 --> 58:07.160] dispersing the funds
[58:07.160 --> 58:09.160] and accuse them
[58:09.160 --> 58:11.160] of
[58:11.160 --> 58:13.160] whatever you can think of
[58:13.160 --> 58:15.160] you know if
[58:15.160 --> 58:17.160] I'm thinking I got this
[58:17.160 --> 58:19.160] public official
[58:19.160 --> 58:21.160] and he's responsible
[58:21.160 --> 58:23.160] for dispersing funds for
[58:23.160 --> 58:25.160] for government housing
[58:25.160 --> 58:27.160] and he's making a deal
[58:27.160 --> 58:29.160] with these people so that they can
[58:29.160 --> 58:31.160] get rent free
[58:31.160 --> 58:33.160] in the first instance
[58:33.160 --> 58:35.160] and then some let their
[58:35.160 --> 58:37.160] apartment to other people
[58:37.160 --> 58:39.160] so they can not only get rent free
[58:39.160 --> 58:41.160] but also collect extra money
[58:41.160 --> 58:43.160] so they're embezzling
[58:43.160 --> 58:45.160] money from the government
[58:45.160 --> 58:47.160] using this
[58:47.160 --> 58:49.160] public employee
[58:49.160 --> 59:11.160] to help
[59:11.160 --> 59:13.160] the free books

[01:00:06.920 --> 01:00:13.280] Markets for Monday the 22nd of July 2019 open with precious metals, gold at $1,429 an ounce,
[01:00:13.280 --> 01:00:21.520] silver $16.45 an ounce, copper $2.75 an ounce, oil Texas crude $55.63 a barrel, Brent crude
[01:00:21.520 --> 01:00:31.800] $62.47 a barrel, and cryptos in order of market cap, Bitcoin Core $10,566.52, Ethereum $227.26,
[01:00:31.800 --> 01:00:41.520] XRP Ripple $0.33, Litecoin $100.31, and Bitcoin Cash is at $324.10 a crypto coin.
[01:00:41.520 --> 01:00:52.560] Today in History, the year 1916, the Preparedness Day bombing, a Thai suitcase bomb, was detonated
[01:00:52.560 --> 01:00:57.920] on Market Street in San Francisco during the World War I Preparedness Day Parade, killing
[01:00:57.920 --> 01:01:07.080] 10 and entering 40. Today in History, and recent news, since Governor Greg Abbott signed
[01:01:07.080 --> 01:01:12.400] a House Bill 1325 legalizing hemp into Texas law back in June, county prosecutors around
[01:01:12.400 --> 01:01:16.680] the state, including Houston, Austin, and San Antonio, have been dropping marijuana possession
[01:01:16.680 --> 01:01:20.560] charges and even refusing to file new ones, since they are stipulating that they do not
[01:01:20.560 --> 01:01:25.680] have the time or the laboratory equipment to test the herb for THC. Margaret Moore,
[01:01:25.680 --> 01:01:29.360] the Travis County District Attorney, announced earlier this month that she was dismissing
[01:01:29.360 --> 01:01:34.600] 32 felony possession and delivery of marijuana cases because of the law. Mr. Abbott and other
[01:01:34.600 --> 01:01:38.680] state officials, including the Attorney General, stipulated in a letter to county district
[01:01:38.680 --> 01:01:43.200] attorneys back on Thursday that marijuana has not been decriminalized in Texas and
[01:01:43.200 --> 01:01:49.320] that these actions demonstrate a misunderstanding of how HP 1325 works, as well as other cities
[01:01:49.320 --> 01:01:55.480] too, like the District Attorney in El Paso, Taima Esparza, a Democrat who also stated
[01:01:55.480 --> 01:01:59.920] earlier this month that the law, quote, will not have an effect on the prosecution of
[01:01:59.920 --> 01:02:04.880] marijuana cases in El Paso. However, the issue was succinctly summarized by Mr. Brandon
[01:02:04.880 --> 01:02:09.320] Ball, an assistant public defender in Harris County, who stated that, quote, the law is
[01:02:09.320 --> 01:02:13.640] constantly changing on what makes something illegal based on its chemical makeup. It's
[01:02:13.640 --> 01:02:18.000] important that if someone is charged with something, the test matches what they're charged
[01:02:18.000 --> 01:02:27.400] with. A paper by Tulane University identified a five and a half inch American pocket shark
[01:02:27.400 --> 01:02:32.520] as the first of its kind in the Gulf of Mexico, the specimen being only the second pocket
[01:02:32.520 --> 01:02:38.160] shark ever captured or recorded with the other one being found way back in 1979 in the East
[01:02:38.160 --> 01:02:43.160] Pacific Ocean. According to the university paper, the shark secretes a lumus fluid from
[01:02:43.160 --> 01:02:49.800] a gland near its front fins for the purposes hypothesized to lure and prey who may be drawn
[01:02:49.800 --> 01:02:59.800] into the glow.
[01:02:59.800 --> 01:03:25.800] Yeah, story for everyone to hear, but how we're not going to give in to the fear. Yeah, story.
[01:03:25.800 --> 01:03:50.400] Okay, we are back. This is the rule of law radio, Randy Kelton. I'm Brett Fountain on
[01:03:50.400 --> 01:04:00.040] this Friday, the 13th of December. And we are talking with John in New York, John. I
[01:04:00.040 --> 01:04:10.840] forgot the best part. Here's the best part. The HUD inspector who told the person who
[01:04:10.840 --> 01:04:17.640] reported the fraud. This is the other person that reported the fraud. Not only mind your
[01:04:17.640 --> 01:04:24.800] own business, but if I remember correctly, she threatened the HUD inspector threatened
[01:04:24.800 --> 01:04:32.320] the other HUD recipient that a one HUD recipient reported. I'm not a HUD recipient, but I reported.
[01:04:32.320 --> 01:04:39.400] Well, this other person is a HUD recipient, and that person reported the fraud. So once
[01:04:39.400 --> 01:04:44.320] again, the HUD inspector who told the person who reported the fraud, not only mind your
[01:04:44.320 --> 01:04:48.680] own business, but she threatened her. And if I remember right, she said, you don't want
[01:04:48.680 --> 01:04:53.480] to do anything to jeopardize your own HUD benefits.
[01:04:53.480 --> 01:05:05.720] Well, that certainly sounds like a threat. Yeah, doesn't sound like maybe I never considered
[01:05:05.720 --> 01:05:13.520] what Randy said, that maybe everybody's getting money under the table, including HUD. No, the
[01:05:13.520 --> 01:05:22.640] HUD inspector. Exactly. Why would you tell somebody reporting fraud to mind your own
[01:05:22.640 --> 01:05:33.800] business? Yeah. And then, as far as I know, she threatened her by saying, you don't want
[01:05:33.800 --> 01:05:41.080] to do anything to hurt your own benefits. That sounds to me like Randy is correct. As
[01:05:41.080 --> 01:05:48.560] usual, Randy figures things out that go over my head in terms of law. So that's why I
[01:05:48.560 --> 01:05:55.120] apologize. You don't have to understand, John. That's because I am a fart snower and a deep
[01:05:55.120 --> 01:06:08.080] stinker. Everybody says so. Okay. Say that again. Just go after them. Go after the highest
[01:06:08.080 --> 01:06:15.400] guy you can. Aggravate them. They'll fix the problem. Now, could I call the Attorney General
[01:06:15.400 --> 01:06:22.320] and report it to them? No, it weighs your time. Too high up. You want to call about three
[01:06:22.320 --> 01:06:28.840] levels up from these guys. Okay. So you find the chain of command and you just go after
[01:06:28.840 --> 01:06:36.960] the highest one? Yeah. Okay. Anything else? Is there anything else? No, I can't tell you.
[01:06:36.960 --> 01:06:42.760] I can't decipher every minute, little detail. You got to kind of figure this out. The main
[01:06:42.760 --> 01:06:48.520] thing is find the highest guy. You can't get the head of the department. You can't get
[01:06:48.520 --> 01:06:53.000] to him. Find the highest guy you can actually get to. Three or four levels up from this guy
[01:06:53.000 --> 01:07:00.080] down here on the street. You go in there and start kicking him for not managing his people.
[01:07:00.080 --> 01:07:07.520] Just make whatever claim you can. Okay. How about calling the Washington office? No, no,
[01:07:07.520 --> 01:07:13.160] no. Don't ask us to give you every single teensy, timesy, minute, little detail. We'll
[01:07:13.160 --> 01:07:19.160] be here all day. This is not hard. Go find his bosses, bosses, bosses. Chew out at him
[01:07:19.160 --> 01:07:24.400] and let it roll downhill. Okay. We need to move on. I got Tina waiting and she's been
[01:07:24.400 --> 01:07:33.120] waiting a long time. Okay. Got it. Thanks a lot guys. Okay. Thank you, John. Okay. Now
[01:07:33.120 --> 01:07:41.040] we're going back to Tina. Are you there, Tina? I am here, Randy. How are you? I am
[01:07:41.040 --> 01:07:55.160] good. Can you hear me well enough? I have a couple quick questions. Go ahead. And then
[01:07:55.160 --> 01:08:06.320] some comments. In terms of writing a criminal complaint or a bar complaint, when I was fighting
[01:08:06.320 --> 01:08:20.200] my foreclosure, I had a law firm submit a document into the bankruptcy court that gave a figure
[01:08:20.200 --> 01:08:29.400] that was, it was a real property declaration by Victoria Fausto. And it signed under penalty
[01:08:29.400 --> 01:08:38.720] of perjury. And it's a completely different amount, actually less than what was filed in
[01:08:38.720 --> 01:08:47.800] the proof of claim by the bank three months earlier. So she files and signs this under
[01:08:47.800 --> 01:08:55.600] penalty of perjury that the foregoing is true and correct. Well, how can you have a proof
[01:08:55.600 --> 01:09:03.280] of claim that says you owe $570,000 in change? And then she files form and plate of it, I
[01:09:03.280 --> 01:09:14.000] owe $495,165. She's not an attorney. I assume she works obviously for an attorney's firm.
[01:09:14.000 --> 01:09:22.560] But who do I file the complaint against? Is it the head of the attorney's firm? Who signed
[01:09:22.560 --> 01:09:30.160] the document? Wait a minute, wait a minute. Who signed the document? She signed the declaration
[01:09:30.160 --> 01:09:34.920] that was within the document. And I don't have the name of the person who signed the
[01:09:34.920 --> 01:09:41.280] declaration right in front of me as a whole document. Okay. Whoever signed the document
[01:09:41.280 --> 01:09:51.080] is the one that's guilty of perjury. If you have two conflicting documents, one of which
[01:09:51.080 --> 01:09:59.160] must be perjurious if one of them is true. Both can be perjurious. But if you have two
[01:09:59.160 --> 01:10:06.480] documents and they have conflicting information on them and they're both signed under penalty
[01:10:06.480 --> 01:10:15.680] of perjury, one of them must necessarily be perjury. You don't have to prove which one.
[01:10:15.680 --> 01:10:22.320] You just have to show that one of them has to be and that's sufficient and you filed
[01:10:22.320 --> 01:10:31.840] against whoever signed it. But if they're not an attorney, where do I file it? You file
[01:10:31.840 --> 01:10:41.600] it with a magistrate. That's criminal. Okay. And she is, I believe in, I want to think
[01:10:41.600 --> 01:10:47.920] she's in Texas, but I have to check. Ooh, good. If she's in Texas, you can file it
[01:10:47.920 --> 01:10:57.880] with any magistrate. Okay. And the magistrate has a duty to hold a preliminary hearing.
[01:10:57.880 --> 01:11:09.720] Now, if I do this, this is the third different amount that in November they said in the notice
[01:11:09.720 --> 01:11:18.480] of trustee sale that I owed $365,740. The notice of trustee sale is a publicly recorded
[01:11:18.480 --> 01:11:23.200] document, but I don't recall if it's signed under penalty of perjury.
[01:11:23.200 --> 01:11:28.480] If it's publicly recorded and it's signed, if she put a false statement on a government
[01:11:28.480 --> 01:11:34.720] document, then that's tampering with a government document. So it doesn't matter, perjury or
[01:11:34.720 --> 01:11:44.720] tampering. Okay. So in Texas, we need things to file.
[01:11:44.720 --> 01:11:51.520] Wait, say that, you're going to say something, Brett?
[01:11:51.520 --> 01:11:58.320] Just to offer that in Texas, the Texas Penal Code is 3706, inconsistent statements. That
[01:11:58.320 --> 01:12:05.320] would be the one that's useful to bring up to a magistrate if it's Texas. 3706.
[01:12:05.320 --> 01:12:20.000] Inconsistent statements. And is there a statute of limitations on filing these complaints?
[01:12:20.000 --> 01:12:28.880] I believe it will be two years. In Texas, it's a 12.02, describes the statute of limitations
[01:12:28.880 --> 01:12:36.800] there, 12.01 and 12.02. And I believe this would be a two-year issue.
[01:12:36.800 --> 01:12:42.880] It's a tampering with a government document, I think, is a felony, third-degree felony,
[01:12:42.880 --> 01:12:48.160] and it's almost certainly going to be two years. But we don't care.
[01:12:48.160 --> 01:12:55.920] Pilot anyway, statute of limitations is not a bar. Statute of limitations is an affirmative
[01:12:55.920 --> 01:13:03.280] defense that must be pledged. Also, you want to go ahead and complain about
[01:13:03.280 --> 01:13:09.360] the inconsistent statements, regardless of whether they get charged with the perjury,
[01:13:09.360 --> 01:13:13.840] because then they can't retract their statements and fix it and say, oh, well, this one was
[01:13:13.840 --> 01:13:19.040] messed up. But what we really meant to say, once you respond to it, they're locked into
[01:13:19.040 --> 01:13:30.400] the fact that they've perjured themselves. Perjury can be recanted. If you recant the
[01:13:30.400 --> 01:13:40.000] perjury before the perjurious nature of the statement becomes evident. So by filing the
[01:13:40.000 --> 01:13:45.680] complaint, the perjurious nature becomes evident and they can no longer retract.
[01:13:48.640 --> 01:13:51.520] Okay. Wow.
[01:13:51.520 --> 01:13:52.720] That's 3705.
[01:13:55.360 --> 01:14:02.320] 3705, again, text, okay. So I need to file, because these are handcrafted cases, which
[01:14:02.320 --> 01:14:09.600] is a violation, I think, of Rule 11. But how does people know if you don't have an attorney
[01:14:09.600 --> 01:14:14.640] who ate with their salt, which most of them owned? You don't know these things until you
[01:14:14.640 --> 01:14:16.000] get on the show and find out.
[01:14:18.160 --> 01:14:20.560] Exactly. That's what they show us here for.
[01:14:23.040 --> 01:14:27.280] To give me these juicy little tidbits you can use to beat them up with.
[01:14:30.160 --> 01:14:34.800] Well, we'll have to do that. Now, the second question.
[01:14:34.800 --> 01:14:41.840] Brett, Brett has been working with me for quite a while and he is becoming a Fortsmower too,
[01:14:43.200 --> 01:14:45.040] and a deep, deep stinker.
[01:14:47.440 --> 01:14:49.760] Well, you're both deep stinkers. I know that.
[01:14:52.160 --> 01:14:52.880] But it's good.
[01:14:54.800 --> 01:15:00.320] The second thing is, if you're filing a deep bar complaint on an attorney,
[01:15:00.320 --> 01:15:13.440] you just file, how long should I wait to file the second complaint against the same attorney
[01:15:14.240 --> 01:15:16.560] so they don't combine them, which they have before?
[01:15:17.840 --> 01:15:21.440] Okay. You say I'm having a little trouble understanding. You're saying consecutive
[01:15:21.440 --> 01:15:24.400] complaints instead of all at once?
[01:15:26.240 --> 01:15:29.040] Yes. How long do you wait between the complaints?
[01:15:29.040 --> 01:15:30.720] I would wait.
[01:15:31.760 --> 01:15:34.960] Brett, what, five, six days, maybe a week between each one?
[01:15:35.920 --> 01:15:38.480] Yes. That's what you told me and I've been doing that ever since.
[01:15:39.600 --> 01:15:45.840] Yes. This way, you get them spread out. If you file one every couple of days,
[01:15:45.840 --> 01:15:50.400] they're likely to get slowed up or they'll begin to stack them up.
[01:15:51.040 --> 01:15:57.200] But if you file one once a week, then within a week something has to be done with that
[01:15:57.200 --> 01:16:02.560] grievance. It can't sit there for a week. So they'll do something with that one,
[01:16:02.560 --> 01:16:06.080] then another one come in and do something with that one so they don't stack them up
[01:16:06.080 --> 01:16:07.600] and call them all one grievance.
[01:16:10.160 --> 01:16:14.320] Well, in California, they did that with me and I filed them a month or so apart.
[01:16:15.840 --> 01:16:18.240] And they combine them and close the case.
[01:16:19.840 --> 01:16:26.480] Well, it's not. It depends on what you want to do with them. If you want to use this
[01:16:26.480 --> 01:16:32.400] as setting the record for your case to show you've exercised due diligence,
[01:16:32.400 --> 01:16:38.320] it doesn't matter what the bar does. If you sent them a week apart and then the bar calls them
[01:16:38.320 --> 01:16:47.920] all one complaint, this goes to the reasonable person of ordinary prudence standard.
[01:16:47.920 --> 01:16:57.520] I'm losing my words dropping out in the middle. A reasonable person assuming a grand jury member
[01:16:57.520 --> 01:16:59.520] or a petted jury member. How?
[01:17:03.760 --> 01:17:09.920] It's the 2019 Logos Radio Network annual fundraiser and gun giveaway sponsored by Central Texas

[01:18:04.480 --> 01:18:08.880] friends. I'm so addicted to the truth now that there's no going back. I need my truth fit.
[01:18:08.880 --> 01:18:14.080] I'd be lost without Logos. And I really want to help keep this network on the air. I'd love to
[01:18:14.080 --> 01:18:18.480] volunteer as a show producer, but I'm a bit of a Luddite and I really don't have any money to give
[01:18:18.480 --> 01:18:24.480] because I spent it all on supplement. How can I help Logos? Well, I'm glad you asked. Whenever
[01:18:24.480 --> 01:18:29.520] you order anything from Amazon, you can help Logos with ordering your supplies or holiday gifts.
[01:18:29.520 --> 01:18:35.040] First thing you do is clear your cookies. Now, go to LogosRadioNetwork.com.
[01:18:35.040 --> 01:18:40.160] Click on the Amazon logo and bookmark it. Now, when you order anything from Amazon,
[01:18:40.160 --> 01:18:46.160] you use that link and Logos gets a few pesos. Do I pay extra? No. Do you have to do anything
[01:18:46.160 --> 01:18:52.960] different when I order? No. Can I use my Amazon Prime? No. I mean, yes. Wow. Giving without doing
[01:18:52.960 --> 01:18:59.760] anything or spending any money. This is perfect. Thank you so much for your Logos. Happy holidays,
[01:18:59.760 --> 01:19:09.760] Logos. Logos. Logos. Logos. Radio. Networks. Networks. Networks. Networks. Networks. Networks.
[01:19:09.760 --> 01:19:35.760] Oh, come on.
[01:19:35.760 --> 01:19:57.440] Okay. We are back. Randy Kelton, Brett Fountain, RealVar Radio, and we're talking to Tina in
[01:19:57.440 --> 01:20:06.800] California. Okay, go ahead, Tina. I kind of run off the cliff there. You sure did. Yeah, we were
[01:20:06.800 --> 01:20:15.120] talking about, you know, filing of the year, complaints when my state bar just combined them.
[01:20:15.120 --> 01:20:20.960] Okay. I'm sorry. Yeah. I was talking about the reasonable person of ordinary prudent standard.
[01:20:20.960 --> 01:20:31.520] The whole idea, everything we do will always do it from the perspective of how will a grand jury
[01:20:31.520 --> 01:20:38.640] of my peers respond to what I'm doing, what I'm writing, or the arguments that I'm making,
[01:20:39.680 --> 01:20:46.400] or what the other party's doing. So if you send them in once a week and the other party takes
[01:20:46.400 --> 01:20:53.040] them all and combines them together as if they're one filing, that has the appearance of a fraudulent
[01:20:53.040 --> 01:21:00.800] act on its face. Reasonable person of ordinary prudent. So that's why I suggest we do that.
[01:21:00.800 --> 01:21:07.120] We know that the bar is going to trash them all anyway. But since they come a week apart,
[01:21:07.120 --> 01:21:18.720] and if the lawyer gets sued for one of them, and he did not notify the bar individually
[01:21:18.720 --> 01:21:24.800] for each one of them, then he's going to say, well, I notified you because they were all one.
[01:21:25.760 --> 01:21:32.400] The interest companies are going to say, no, they weren't all one. They were filed a week
[01:21:32.400 --> 01:21:39.680] apart. They're all separate. So we don't have to pay your claim because you didn't follow our rules.
[01:21:41.200 --> 01:21:44.160] That's what we're really looking at. We don't care what the bar does.
[01:21:46.800 --> 01:21:47.600] Does that make sense?
[01:21:49.760 --> 01:21:55.600] That makes sense. I just have to keep going and keep fighting. So that's good. Now, my last
[01:21:55.600 --> 01:22:02.800] question for today, and I'll come back and ask one later if this time. But if a judge
[01:22:03.680 --> 01:22:10.880] orders the clerk to reject all filings, for the filings from the party, this is a friend of mine
[01:22:10.880 --> 01:22:18.880] who you can speak to tomorrow, can a judge reject any more filings and what can they do?
[01:22:18.880 --> 01:22:28.080] They've denied him access to e-filing. Okay, hold on. So every group. Okay, wait a minute. The judge
[01:22:30.160 --> 01:22:38.320] did not deny the reject all filings. Litigant the right to file, just denied him the right to
[01:22:38.320 --> 01:22:41.920] e-file. Is that correct? I have a little trouble understanding this why I'm asking.
[01:22:41.920 --> 01:22:50.480] He ordered them that in the appeal court, they refused to give him the ability to e-file,
[01:22:50.480 --> 01:22:58.400] causing him to have to spend hundreds of dollars on printed material because they require eons of
[01:22:58.400 --> 01:23:07.120] a copy. Then in this other case, which is kind of the mirror case, the judge ordered the clerk
[01:23:07.120 --> 01:23:15.840] to reject all filings, family, all filings. That's correct. Wow. And that's the same way
[01:23:15.840 --> 01:23:22.080] as the judge, the bankruptcy court, with me. And this goes back to my case with when they
[01:23:23.200 --> 01:23:30.480] got the ER order by fraud and not serving me, I filed an appeal and everything. And then the
[01:23:30.480 --> 01:23:39.200] judges in the bankruptcy appellate court here said they will not allow any more filings from me.
[01:23:39.200 --> 01:23:45.920] I didn't know they could do it. Okay, that's when I like to call 911.
[01:23:49.600 --> 01:23:56.160] Yeah, no need to dance with them. They forget. They think they have all this power. They don't.
[01:23:56.160 --> 01:24:06.400] You do. Call 911. Well, it's, you know, you only get this by mail. You don't get to do it at the
[01:24:06.400 --> 01:24:12.480] time. Then call the non-emergency number of the sheriff's department or police department,
[01:24:12.480 --> 01:24:18.240] ask them to send somebody out, take your criminal affidavit against us, whoever this is.
[01:24:18.240 --> 01:24:26.160] File on them. But when they commit a crime, you don't deal with them civilly.
[01:24:27.920 --> 01:24:32.880] You stop being civil and start filing criminal charges against them and then go back,
[01:24:32.880 --> 01:24:38.320] keep doing your regular civil or administrative procedures. But when they violate a law,
[01:24:38.320 --> 01:24:41.760] just go file criminal charges on them and then come back and keep doing what you're doing.
[01:24:41.760 --> 01:24:48.880] So what is criminal? Criminal is different. Criminal is not part of the standard process.
[01:24:52.160 --> 01:24:56.640] When I go in and talk to them, I have these things I want to do and I have these things
[01:24:56.640 --> 01:25:02.240] that the law allows me to do. If somebody fails to perform duty, they're required to perform.
[01:25:03.840 --> 01:25:10.560] That's a whole separate issue from whatever I'm trying to do there. That's a separate criminal
[01:25:10.560 --> 01:25:16.080] act. It's a detour that they caused, but you still have to deal with your original thing you went for.
[01:25:17.360 --> 01:25:22.640] When I go in and ask the clerk to see these records and she says that since I'm not a
[01:25:22.640 --> 01:25:27.680] lawyer or the accused, I can't look at them, well, I still try to get my records.
[01:25:29.120 --> 01:25:35.600] But first off, I stop right there, call 911, ask somebody to ask them to send somebody out to arrest
[01:25:35.600 --> 01:25:42.080] this person. Now, I'm trying to get this person arrested so they're kind of disqualified. Okay,
[01:25:42.080 --> 01:25:47.840] next. Give me the next guy. What do you want to tell me?
[01:25:51.040 --> 01:25:58.960] Does that make sense, Tina? So it makes sense, but what is the actual law that you can file against
[01:25:58.960 --> 01:26:06.640] and for refusing? Oh, wait, okay. That's a good point. You've been sent a letter and you don't
[01:26:06.640 --> 01:26:14.240] know actually who sent it and a lot of times they're not signed. Whoever the director of the
[01:26:14.240 --> 01:26:22.080] office is that's on the letterhead, that's who you file against. And if it's the judge?
[01:26:22.080 --> 01:26:29.360] Yeah, now you know the director didn't do that, but you're holding the director responsible as
[01:26:29.360 --> 01:26:42.240] respondent superior. You assume that the director's public officials, that the director's subordinates
[01:26:42.800 --> 01:26:46.240] are acting under the direction of the director.
[01:26:46.240 --> 01:26:55.280] So hammer him. If they're not acting under his direction, then he's not doing a good enough
[01:26:55.280 --> 01:27:02.480] job and he will have to bring that as an affirmative defense but force him to bring it
[01:27:05.120 --> 01:27:07.760] and then force him to throw somebody else under the bus.
[01:27:07.760 --> 01:27:17.520] So if you're filing against the judge that's refused to allow you, who is their superior?
[01:27:18.560 --> 01:27:27.360] That I would file against him immediately. I told you about filing the habeas in Conroe,
[01:27:28.400 --> 01:27:35.600] Montgomery County. The judge said, Mr. Kelton, are you an attorney? Oh, no judge.
[01:27:35.600 --> 01:27:39.920] I sleep well at night and keep my hands in my own pockets. Thank you very much.
[01:27:40.960 --> 01:27:44.400] Well, since you're not an attorney, I'm not going to accept this habeas.
[01:27:46.000 --> 01:27:52.560] Oops, I turned to the bailiff. Mr. Bailiff, do you hear that? Yes, Mr. Kelton, I did arrest
[01:27:52.560 --> 01:28:00.480] that judge. The judge is out of the picture right now. Now it's between me and the bailiff
[01:28:00.480 --> 01:28:06.080] on the criminal side. When I get done with the bailiff, I'll come back to the judge. But in the
[01:28:06.080 --> 01:28:12.960] meantime, the judge has committed a crime and I won't even arrest it. That's how you handle it.
[01:28:16.880 --> 01:28:20.320] Boy, I could be here till she didn't even come writing these complaints.
[01:28:21.680 --> 01:28:28.480] This is good, but I need a secretary. It sounds scary the first time you do it.
[01:28:28.480 --> 01:28:35.280] But people think filing a criminal complaint, they're used to having criminal complaints filed
[01:28:35.280 --> 01:28:41.920] against them and they know how traumatic that can be. It's a whole different animal when you're
[01:28:41.920 --> 01:28:54.240] filing against them. It's not traumatic at all. And then like, which one was it that the judge
[01:28:54.240 --> 01:29:00.720] told him? Oh, Ted, the judge told him he was on thin water. Man, if a judge said something like
[01:29:00.720 --> 01:29:09.280] that to me, Mr. Bailiff, did you hear that? Arrest that judge right now. We don't wait,
[01:29:09.920 --> 01:29:16.880] we don't contemplate it. He committed a crime in the site and in the hearing of the bailiff. Arrest
[01:29:16.880 --> 01:29:26.000] him. I've done that seven times in court. Every time the judge stood there and kept his mouth shut
[01:29:28.320 --> 01:29:33.520] because he knew I just opened the door that he did not want to walk through.
[01:29:35.200 --> 01:29:40.960] So the first time you do it, it changes everything.
[01:29:40.960 --> 01:29:51.520] But then you realize how much fun it is and you realize that's what they've been trying to hide
[01:29:51.520 --> 01:29:59.440] from you. The real power you have because once you have asked the bailiff to arrest the judge or
[01:30:01.840 --> 01:30:05.520] Could your pharmacy release your prescription information to marketers?
[01:30:05.520 --> 01:30:09.920] Believe it or not, it's not only possible, it's probably been done. I'm Dr. Catherine Albrecht
[01:30:09.920 --> 01:30:14.640] and I'll be back with loopholes that make it legal for companies like CVS to share your personal
[01:30:14.640 --> 01:30:20.640] health information. Privacy is under attack. When you give up data about yourself, you'll never
[01:30:20.640 --> 01:30:26.640] get it back again. And once your privacy is gone, you'll find your freedoms will start to vanish too.
[01:30:26.640 --> 01:30:32.720] So protect your rights. Say no to surveillance and keep your information to yourself. Privacy,
[01:30:32.720 --> 01:30:37.920] it's worth hanging on to. This public service announcement is brought to you by startpage.com,
[01:30:37.920 --> 01:30:43.920] the private search engine alternative to Google, Yahoo, and VIN. Start over with start page.
[01:30:45.440 --> 01:30:50.080] Your pharmacy may be sharing your medical information without your knowledge or consent.
[01:30:50.080 --> 01:30:54.800] For example, CVS pharmacies are likely to disclose your personal health information to business
[01:30:54.800 --> 01:30:59.920] associates. A loophole in the law allows it if parties agree to execute a contract to quote
[01:30:59.920 --> 01:31:04.560] safeguard the data. Business associates could range from marketers to insurance companies,

[01:31:34.400 --> 01:31:39.440] the afternoon of September 11. The government says the fire brought it down. However, 1,500
[01:31:39.440 --> 01:31:44.160] architects and engineers concluded it was a controlled demolition. Over 6,000 of my fellow
[01:31:44.160 --> 01:31:48.080] service members have given their lives, and thousands of my fellow first responders have

[01:32:04.560 --> 01:32:08.400] seminar. In today's America, we live in an us against them society. If we, the people, are
[01:32:08.400 --> 01:32:12.640] ever going to have a free society, then we're going to have to stand and defend our own rights.
[01:32:12.640 --> 01:32:16.320] Among those rights are the right to travel freely from place to place, the right to act in our own
[01:32:16.320 --> 01:32:20.320] private capacity, and most importantly, the right to due process of law. The traffic courts
[01:32:20.320 --> 01:32:24.320] afford us the least expensive opportunity to learn how to enforce and preserve our rights

[01:33:26.880 --> 01:33:32.080] This is the Rule of Law Radio, Randy Kelton. I'm Brett Fountain, and we are talking with Tina
[01:33:32.080 --> 01:33:41.120] in California. Well, Tina, just as we were going to the sponsors, Randy took us all the way to
[01:33:41.120 --> 01:33:50.080] yesterday. Go right ahead. Well, you've helped me a great deal. I just asked if, Randy, you were
[01:33:50.080 --> 01:33:57.040] going to send me a copy of a criminal complaint that you have done so I could plagiarize it. If you
[01:33:57.040 --> 01:34:04.320] could do that. And I know Scott in New York is waiting for the same thing too. And please, John,
[01:34:04.320 --> 01:34:09.200] if you're still listening, contact me regarding your Section 8. I have some information that
[01:34:09.200 --> 01:34:13.280] might help you because I don't have Section 8 for many, many, many years.
[01:34:13.280 --> 01:34:21.520] Did you send me an email asking for that? Because if you don't, I'll forget.
[01:34:22.960 --> 01:34:27.920] I did, but I'll do it again just to make sure. Good. Yeah, do it again so I'll see it in the
[01:34:27.920 --> 01:34:35.600] morning when I get up and I'll pull it down. I will see if I have one that's a fill-in-the-blank
[01:34:35.600 --> 01:34:40.160] PDF. If I don't, I'll create it. I'll turn it into one and get it to you. Wonderful.
[01:34:40.160 --> 01:34:47.120] Okay, sounds good. Thank you guys. I appreciate it very much. And John, contact me. I know you've
[01:34:47.120 --> 01:34:52.480] got my email from before and I'll see if I can help you with the Section 8 thing. I have an idea for
[01:34:52.480 --> 01:35:05.040] you. And Ted, he's great job. You're doing awesome. Okay, thank you. Now we're going to go to...
[01:35:05.040 --> 01:35:13.040] Who am I going to go to? Oh, there we go. To Ken in New York. Hello, Ken.
[01:35:14.960 --> 01:35:24.080] Hi, Randy. You mentioned a couple other qualities to which one could attribute to a bloodhound
[01:35:24.800 --> 01:35:30.000] or a police dog. And I just wanted you to know that I wouldn't touch them with a tournament land.
[01:35:30.000 --> 01:35:36.160] Wait, I'm not sure what you're referring to.
[01:35:38.720 --> 01:35:48.160] I don't want to... Something about the fart smell on the stinker. Oh, deep stinker?
[01:35:49.520 --> 01:35:57.760] Yeah, the detective qualities. I did talk to Scott Richardson and we went through an entire
[01:35:57.760 --> 01:36:05.520] interview. He's very kind. So he basically... I won't have to dwell on it anymore. He said,
[01:36:05.520 --> 01:36:12.800] if I had coverage that was group coverage especially, there's no way they could hit me
[01:36:12.800 --> 01:36:18.960] with a penalty as long as I applied for a prescription plan within the 63-day limit.
[01:36:18.960 --> 01:36:22.240] This has to do with Medicare Part A, Part B, and Part D.
[01:36:22.240 --> 01:36:30.080] Good. So he's pretty well got that sorted out for you.
[01:36:30.080 --> 01:36:41.440] Yeah, he's the same kind of licensed insurance. I guess what you call a navigator or something
[01:36:41.440 --> 01:36:47.040] of that nature, which, you know, he just went through the entire interview to see if I qualified
[01:36:47.040 --> 01:36:53.520] for an A. I told him why I didn't want a Part C plan and that I was disciplined enough to
[01:36:54.800 --> 01:36:59.840] save the $100 a month that my insurance company would be paying me not to have
[01:37:00.800 --> 01:37:07.600] part of the group coverage, which I determined was useful to me because then it's such a high
[01:37:07.600 --> 01:37:18.880] deductible. Oh, good. He's pretty good. I had my sister call tell him about my mom's Medicare
[01:37:18.880 --> 01:37:26.640] and he saved her $150 a month and got the plan she had. She was on a group plan from the
[01:37:26.640 --> 01:37:35.440] University of Illinois and it had copay on it. He got rid of all the copay and got her next to
[01:37:35.440 --> 01:37:41.120] $150 a month. But you got to watch Scott. He was talking to my sister and my sister said,
[01:37:41.840 --> 01:37:48.160] Scott wants you to set up a three-way between me and Robbie Jean, my other sister.
[01:37:50.080 --> 01:37:52.720] Scott, you're trying to get a three-way with my sisters?
[01:37:54.480 --> 01:38:00.320] You know, 175, 179? And he tried to argue his way out of that one.
[01:38:00.320 --> 01:38:09.200] He's, you know, so no matter what they do or what they threaten to do,
[01:38:09.760 --> 01:38:14.080] there's really no way they can love me any kind of a fine, you know, the problem
[01:38:14.720 --> 01:38:20.720] of fine against me. The problem with these penalties is that they grow year after year.
[01:38:20.720 --> 01:38:29.680] Okay, this is the one where they were threatening to file a penalty against you.
[01:38:30.800 --> 01:38:37.280] Right, because I wouldn't sign, they sent me, they said I didn't send them proof of coverage,
[01:38:37.280 --> 01:38:43.920] which I did. I had a facts report and I've since lost it. But I went and filed a complaint
[01:38:43.920 --> 01:38:53.840] against them with Medicare for harassment because they kept insisting that I sign an affidavit.
[01:38:53.840 --> 01:38:58.400] And I said, you're not a court. I'm not going to sign an affidavit on the perjury deal.
[01:38:59.440 --> 01:39:07.120] And then they, they tried to get me to, I don't know, agree to something else, arbitration or
[01:39:07.120 --> 01:39:11.840] something. I said, what for? There's nothing to arbitrate. I didn't like that either.
[01:39:11.840 --> 01:39:17.280] So I think I had them tied up in a knot. And this month, they haven't bothered me. So I guess
[01:39:17.280 --> 01:39:24.400] maybe they're going to have to get used to the idea. And so you don't, don't cooperate with
[01:39:24.400 --> 01:39:30.000] these people. They have no right to demand that you sign an affidavit today. They're not a court.
[01:39:31.040 --> 01:39:36.560] I don't care whether they're representing the government or not. I've heard stories about
[01:39:36.560 --> 01:39:45.200] that too. While they're acting as an agent, no, I don't buy it. And by the way, if you, if you,
[01:39:45.200 --> 01:39:48.800] if you do do it, then I think you're putting yourself into some kind of danger.
[01:39:51.280 --> 01:39:57.840] Well, anytime you sign an affidavit, they want that affidavit because they can use it against you.
[01:39:57.840 --> 01:40:07.840] Of course. The whole purpose of form. It's interesting. What you're doing, Ken, is interesting.
[01:40:09.120 --> 01:40:17.600] For the most part, anytime people deal with public officials, they trust the public official.
[01:40:18.720 --> 01:40:23.920] So when a public official tells them that they need to do something, people can not question it.
[01:40:23.920 --> 01:40:31.680] You question. Yeah. Which is great. But these are not, these are not public officials.
[01:40:32.880 --> 01:40:38.880] This is a, this is a contract in Medicare. Oh, it's just an insurance company.
[01:40:40.000 --> 01:40:46.160] Yeah. Yeah. The point is the, uh, it's still a company. It's still kind of in our nature
[01:40:46.160 --> 01:40:55.040] to do what people tell us to do. Oh, this is required, is it? Oh, required. Mandatory. Did
[01:40:55.040 --> 01:41:01.200] you say mandatory? Oh, wow. I must be able to, uh, I guess I have to do it. How about it? It takes
[01:41:01.200 --> 01:41:07.920] us getting older and being bumped around a bit before we figure out that you don't necessarily
[01:41:07.920 --> 01:41:15.840] have to do something just because somebody said you did. And I'm so lazy. I'd never get around
[01:41:15.840 --> 01:41:21.360] to it anyway. Yeah. And I was, I wasn't implying that you were getting older, Kent.
[01:41:22.960 --> 01:41:31.600] Oh, okay. Well, but getting older has its upside. You learn and stuff like this,
[01:41:31.600 --> 01:41:37.840] you're not as easy, easily manipulated as we once were. And I'm hoping everybody on the show
[01:41:37.840 --> 01:41:45.040] gets it that just because somebody says you need to do something or you got to have to do something,
[01:41:46.000 --> 01:41:52.400] that doesn't necessarily mean that anything that we need to think about our behavior and act
[01:41:52.400 --> 01:42:00.480] deliberately and not let people with vested interests manipulate us. And, Kent, you're a
[01:42:00.480 --> 01:42:10.720] good example. Just exactly that. Did you ever wonder that whenever something applies, whenever
[01:42:10.720 --> 01:42:15.920] you're put under the threat of perjury, it could actually happen to you. But when you try to put
[01:42:15.920 --> 01:42:21.840] a public official under perjury, it's likely not going to, it's not likely to happen.
[01:42:21.840 --> 01:42:32.000] I definitely noticed that. And I have filed more than one aggravated perjury charge. Brett,
[01:42:32.880 --> 01:42:37.760] I suspect you filed a bunch of them yourself. Yes, aggravated perjury, yes.
[01:42:39.360 --> 01:42:50.400] It doesn't always get them prosecuted, almost never does. But it raises the specter that they
[01:42:50.400 --> 01:42:54.880] could be. And you know it's got to be embarrassing around the office.
[01:42:56.560 --> 01:42:59.040] Yeah, well, somebody's trying to get you arrested.
[01:43:00.560 --> 01:43:07.440] But not just arrested. Arrested for aggravated perjury. That just doesn't look good on a lawyer
[01:43:07.440 --> 01:43:12.000] or a judge. Those kinds of words being thrown around the office that just...
[01:43:12.000 --> 01:43:22.560] Yes, kind of like with Ted, I really like to claim depraved heart. That sounds so juicy.
[01:43:24.560 --> 01:43:29.360] Okay. Do you have anything else for us, Kent? We're about to go to our sponsors.
[01:43:31.360 --> 01:43:35.840] Yes, I do. I got a couple of short comments and I think just a lot of 15 minutes plus.
[01:43:35.840 --> 01:43:42.560] Okay. All right. Can I wait? We're about to go to break. We'll pick this up on the other side.
[01:43:43.280 --> 01:43:50.080] This is Brett Fountain, Randy Kelton, Rural Radio. And we're about the end of our fundraiser. So if
[01:43:50.080 --> 01:43:55.760] you got a few extra bucks around Christmas, which you probably don't, nobody does. I shouldn't have
[01:43:55.760 --> 01:44:02.320] said that. Anyway, throw it at us anyway. We'll be right back. Through advances in technology,
[01:44:02.320 --> 01:44:07.920] our lives have greatly improved, except in the area of nutrition. People feed their pets better
[01:44:07.920 --> 01:44:13.680] than they feed themselves. And it's time we changed all that. Our primary defense against aging and
[01:44:13.680 --> 01:44:20.400] disease in this toxic environment is good nutrition. In a world where natural foods have been irradiated,
[01:44:20.400 --> 01:44:25.680] adulterated, and mutilated, young jevity can provide the nutrients you need.
[01:44:25.680 --> 01:44:31.600] Logo's radio network gets many requests to endorse all sorts of products, most of which we reject.
[01:44:31.600 --> 01:44:38.240] We have come to trust young jevity so much. We became a marketing distributor along with Alex Jones,
[01:44:38.240 --> 01:44:44.960] Ben Fuchs, and many others. When you order from LogosRadioNetwork.com, your health will improve
[01:44:44.960 --> 01:44:50.960] as you help support quality radio. As you realize the benefits of young jevity, you may want to
[01:44:50.960 --> 01:44:57.040] join us. As a distributor, you can experience improved health, help your friends and family,
[01:44:57.040 --> 01:45:05.840] and increase your income. Order now. Are you the plaintiff or defendant in a lawsuit?
[01:45:06.400 --> 01:45:12.720] Win your case without an attorney with Jurisdictionary, the affordable, easy-to-understand four-CD
[01:45:12.720 --> 01:45:19.200] course that will show you how, in 24 hours, you step by step. If you have a lawyer,
[01:45:19.200 --> 01:45:23.520] know what your lawyer should be doing. If you don't have a lawyer, know what you
[01:45:23.520 --> 01:45:30.240] should do for yourself. Thousands have won with our step-by-step course, and now you can too.
[01:45:30.240 --> 01:45:36.080] Jurisdictionary was created by a licensed attorney with 22 years of case-winning experience.
[01:45:36.720 --> 01:45:41.600] Even if you're not in a lawsuit, you can learn what everyone should understand about the
[01:45:41.600 --> 01:45:47.760] principles and practices that control our American courts. You'll receive our audio classroom,
[01:45:47.760 --> 01:45:54.480] video seminar, tutorials, forms for civil cases, pro-say tactics, and much more.
[01:45:54.480 --> 01:46:24.320] Please visit ruleoflawradio.com and click on the banner or call toll-free 866-LAW-EZ.
[01:46:24.480 --> 01:46:54.080] Okay, we are back. Randy Colton,
[01:46:54.080 --> 01:47:00.000] Brett Fountain, rule of law radio, and we'll talk to Ken in New York. Okay, you had another question
[01:47:00.000 --> 01:47:10.000] and comments? Yes. While I was waiting, I just put in New York HUD fraud, and they have a number
[01:47:10.000 --> 01:47:30.400] 1-800-669-9777. Was that 669? Yes, that's 1-800-669-9777, and jail terms can run 25 to 35 years
[01:47:31.520 --> 01:47:37.920] in prison, and they are federal. They're in Texas. They're everywhere, and they administer section 8
[01:47:37.920 --> 01:47:46.560] housing. And yes, the inspectors are corrupt, local inspectors are, and there's probably
[01:47:46.560 --> 01:47:52.640] one good reason for not them dragging their feet is that they're probably dealing with a protected
[01:47:52.640 --> 01:48:04.560] class. And we know what that's all about. Yeah. Okay, John is probably listening.
[01:48:04.560 --> 01:48:10.880] And I have one more question about a declaratory judgment. Has one ever been done or could have
[01:48:10.880 --> 01:48:16.160] been done on the rubber stamp question, the thing that you bring up about the jury all the time?
[01:48:16.960 --> 01:48:27.360] I mean, isn't this the kind of fraud if the person? Yes, absolutely. If I attempt to file with a
[01:48:27.360 --> 01:48:36.240] grand jury and the prosecutor interferes with it, absolutely that would be grounds for declaratory
[01:48:36.240 --> 01:48:44.880] adjustment, because I definitely, that there is an issue involved. I'm exercising a right,
[01:48:46.320 --> 01:48:50.720] and I alleged the prosecuting attorney is improperly interfering with that right,
[01:48:50.720 --> 01:48:56.640] and the prosecutors are going to say I don't have that right, and I'm going to say absolutely I do,
[01:48:57.680 --> 01:49:03.600] unless I have been specifically forbidden. And the prosecutors are going to say that he's the
[01:49:03.600 --> 01:49:08.880] only one allowed to petition the grand jury. I'm going to say no, that's not the case.
[01:49:10.400 --> 01:49:17.600] He's the only one who can petition a grand jury as a matter of right, but anyone can petition
[01:49:17.600 --> 01:49:25.120] a grand jury at the grand jury's request, and anyone can give notice to a grand jury.
[01:49:26.160 --> 01:49:31.440] And then the other issue about grand jury, about grand jury's jurisdiction,
[01:49:32.800 --> 01:49:39.360] that is a first-bush issue. Never seen that addressed before, and it's a perfect kind of
[01:49:39.360 --> 01:49:45.280] thing for declaratory judgment. You're not asking for money, you're not asking for any damages,
[01:49:45.280 --> 01:49:53.200] you're asking the court to rule on the fact that a grand jury is a state grand jury,
[01:49:53.760 --> 01:49:56.960] and they're not limited by a venue. So yeah, I think that would be perfect for
[01:49:57.680 --> 01:50:00.480] declaratory judgment, and I'm glad you brought it up that way.
[01:50:01.760 --> 01:50:08.960] But would it only apply to, for example, if I did it, would it only apply to me or would it apply
[01:50:08.960 --> 01:50:16.000] to anybody? Oh no, the ruling would apply to everybody. Everybody. Oh, okay. Yeah,
[01:50:16.000 --> 01:50:21.760] because that's a question sometimes, isn't it? Yeah, that is exactly the point,
[01:50:23.280 --> 01:50:32.240] is you ask the court to render a ruling on this issue so that everybody else can use that ruling,
[01:50:32.240 --> 01:50:40.240] they don't have to come back and get it redone. So that's a great idea. I finally
[01:50:40.240 --> 01:50:46.560] complained with the grand jury. I have no evidence that the grand jury received it,
[01:50:46.560 --> 01:50:53.840] but I followed it through the prosecutor. So that creates the inference that the prosecutor
[01:50:53.840 --> 01:51:03.360] secreted it from the grand jury, and I go to the district court and ask the district court to rule
[01:51:03.360 --> 01:51:10.480] that a prosecutor has no discretion in the matter of a complaint against a public official.
[01:51:11.040 --> 01:51:18.080] He must give it to the grand jury and ask the court to rule on what that statute means.
[01:51:18.080 --> 01:51:24.880] That's perfect. That gives me a way to jerk them into court really quick.
[01:51:28.160 --> 01:51:33.680] I'll talk to you next week. Good night. Ken, you're not bad for an old guy. Thank you.
[01:51:34.880 --> 01:51:43.280] I don't know. You call me Krusty. Did I call you Krusty? Okay, you're not bad for a Krusty,
[01:51:43.280 --> 01:51:52.240] old guy. Good night, brother. Good night. Okay, now we're going to Shane in New York. Shane,
[01:51:52.240 --> 01:52:00.480] what have you been up to? Randy, Merry Christmas again. Happy New Year. I don't get to see it all.
[01:52:00.480 --> 01:52:08.480] I'm here in Dallas. Well, the day before Thanksgiving, I found out that the second
[01:52:08.480 --> 01:52:14.960] lean holder regarding this bankruptcy case, it's a bank called Key Bank, filed a motion to lift the
[01:52:14.960 --> 01:52:20.400] stay. I do want to remind you that the stay was already lifted by a nation star, Mr. Cooper,
[01:52:20.960 --> 01:52:28.400] a servicer located right in Dallas. They snuck it in the day before Thanksgiving so they can
[01:52:28.400 --> 01:52:33.040] burn out the time so I couldn't object. So I went ahead and filed a, because I can't make it
[01:52:33.040 --> 01:52:40.720] but look as we're heading home next week. So I filed a motion, a notice of motion and motion in
[01:52:40.720 --> 01:52:47.760] the bankruptcy court to reschedule that because I'm not out of town. I overnighted it. It made
[01:52:47.760 --> 01:52:55.280] pastures on Tuesday. The very next day, the attorney in Rochester, New York, opposed and
[01:52:55.280 --> 01:53:02.640] objected to my motion of the evidentiary request and the motion to reschedule the hearing and is
[01:53:02.640 --> 01:53:10.160] going to have it on this Monday, December 16th. I got a phone call from the law clerk, the judge's
[01:53:10.160 --> 01:53:15.280] law clerk and said the judge would like you to attend the hearing by telephone and they gave
[01:53:15.280 --> 01:53:22.000] me the proper phone numbers to call in on Monday afternoon and he said, you want you to be there?
[01:53:22.880 --> 01:53:29.120] You want you to make your side of the story? But I had no idea this was coming down a pipeline.
[01:53:29.120 --> 01:53:33.440] The reason why I'm explaining all this to you is because it looks like nation star Mr. Cooper is
[01:53:33.440 --> 01:53:39.840] not moving forward with the sale of the property and the second, the key bank, which is not in my
[01:53:39.840 --> 01:53:48.240] name, is moving forward now. My question to you is don't generally attorneys, they always give you
[01:53:48.240 --> 01:53:52.400] that first extension or that rescheduling if you can't make it based on the holidays. Isn't that
[01:53:52.400 --> 01:53:58.240] like a courtesy or is it not a courtesy? Because I've never asked for an extension or rescheduling
[01:53:58.240 --> 01:54:04.560] ever before in this case. Okay, it's not a requirement but I wish you're bar-grieving for it.
[01:54:07.760 --> 01:54:15.600] I already have. Oh, okay. No, as far as I know they are not required
[01:54:16.800 --> 01:54:24.320] and yes it is generally a courtesy but lawyers do not ever give courtesy to non-lawyers.
[01:54:24.320 --> 01:54:32.640] Right. And you should remember that and return the favor at any opportunity.
[01:54:33.760 --> 01:54:41.600] Well, I did that in my response back in my evidentiary hearing and opposing, opposing or
[01:54:41.600 --> 01:54:46.720] you know having hearing on December 16th but I was kind of, you know, semi happy that the
[01:54:46.720 --> 01:54:50.480] charges let me show up by telephone. That's unusual, isn't it?
[01:54:50.480 --> 01:54:57.920] No, no, that's real common. Okay. Yeah, they do as lawyers all the time.
[01:54:59.120 --> 01:55:04.080] What you might want to do is come up with some kind of motion and file it on December 24th.
[01:55:06.800 --> 01:55:15.040] Okay. Turnabout's fair play. Okay. I got something in mind but I won't talk about it over the phone
[01:55:15.040 --> 01:55:21.680] but I just want to let you know one more thing before the show ends here. He's been pursuing
[01:55:21.680 --> 01:55:27.040] this now for five and a half years starting back in 2014 and the case started at the county level
[01:55:27.840 --> 01:55:33.600] and in his motion to lift the state he's spent three pages. I'm talking about all the complaints
[01:55:33.600 --> 01:55:40.480] I filed against him, consumer financial protection bureau, contact and all these different
[01:55:40.480 --> 01:55:47.520] departments in the state. You should ask for sanctions. He literally cried and he also said
[01:55:47.520 --> 01:55:55.120] that I made fun of him by calling him the Three Stooges, you know? Okay, okay, we got to do this.
[01:55:55.120 --> 01:56:05.280] Brett, tell him how you really make fun of lawyers. Well, my friend, he was in the courtroom and he
[01:56:05.280 --> 01:56:13.760] mentioned that he's not really sure about the adequacy. This lawyer, he mentioned adequacy
[01:56:14.560 --> 01:56:19.040] and boy, that lawyer picked up and started saying this has nothing to do with inadequacy.
[01:56:19.040 --> 01:56:28.240] I'm not inadequate. I'm not. I can do this. I was thinking more of the bull excrement.
[01:56:28.240 --> 01:56:36.400] Oh, well, when someone sends me something, I got something from a lawyer that
[01:56:38.080 --> 01:56:45.200] it was just lies, smokescreen, wildly distracting nonsense and everything in
[01:56:45.200 --> 01:56:50.720] you wants to respond point by point to tear him apart. But this time I just, I said,
[01:56:50.720 --> 01:56:59.120] what was that? Oh, I've got another phone here and it came on. I had to shut it off.
[01:56:59.920 --> 01:57:05.120] So this time I just responded to that lawyer with a one page with two giant icons on there
[01:57:05.760 --> 01:57:10.560] that we've received your communication. Thank you for that. And the icon for the bull
[01:57:11.200 --> 01:57:15.280] and the icon for the excrement and just left it at that.
[01:57:15.280 --> 01:57:22.000] And the one about flies with honey and vinegar.
[01:57:22.720 --> 01:57:28.160] Oh, well, yeah, I told him that nobody cares what a pesky fly.
[01:57:30.080 --> 01:57:34.240] The lawyer told him that you could catch more flies with honey than vinegar.
[01:57:34.240 --> 01:57:45.200] Whoa, what is that noise?
[01:57:52.880 --> 01:57:57.120] I think somebody's got some feedback. That was Shane. That was Shane. I muted him.
[01:57:57.120 --> 01:58:05.840] Yeah, so the lawyer did made a comment about you could catch more flies with honey than with
[01:58:05.840 --> 01:58:12.000] vinegar. And I think he made an incorrect assumption about whether I care what those
[01:58:12.000 --> 01:58:21.120] pesky flies want. So I told him that you can keep your flies. I'll just have the records.
[01:58:21.120 --> 01:58:30.720] Okay, Shane. I'm still here, Randy. That's how you handle lawyers.
[01:58:32.560 --> 01:58:38.480] Okay, we are out of time. Randy Kelton, Brett Fountain. Thank you all for listening.
[01:58:39.920 --> 01:58:44.880] Don't think we'll be back next. Yeah, we should be back next week and be the week after we want.
[01:58:44.880 --> 01:58:51.440] So we'll be back. See you next week. Good night.
