[01:23.040 --> 01:28.240] the herb for THC. Margaret Moore, the Travis County District Attorney, announced earlier this month
[01:28.240 --> 01:33.440] that she was dismissing 32 felony possession and delivery of marijuana cases because of the law.
[01:33.440 --> 01:37.600] Mr. Abbott and other state officials, including the Attorney General stipulated in a letter
[01:37.600 --> 01:42.800] to county district attorneys back on Thursday that marijuana has not been decriminalized in Texas,
[01:42.800 --> 01:48.000] and that these actions demonstrate a misunderstanding of how HB 1325 works,
[01:48.000 --> 01:54.400] as well as other cities, too, like the District Attorney in El Paso, Kaima Esparza, a Democrat
[01:54.400 --> 01:59.600] who also stated earlier this month that the law, quote, will not have an effect on the prosecution
[01:59.600 --> 02:05.040] of marijuana cases in El Paso. However, the issue was succinctly summarized by Mr. Brandon Ball,
[02:05.040 --> 02:08.640] an assistant public defender in Harris County, who stated that, quote,
[02:08.640 --> 02:13.200] the law is constantly changing on what makes something illegal based on its chemical makeup.
[02:13.200 --> 02:15.840] It's important that if someone is charged with something,
[02:15.840 --> 02:18.000] the test matches what they're charged with.

[05:14.080 --> 05:25.440] that made me think about good things to share. Well, yeah, I thought maybe we might speak about it
[05:25.440 --> 05:37.040] before, but let's see. Brazos County, there's some down around Bryan, down east of Austin,
[05:37.040 --> 05:44.080] is Brazos County, and there's somebody of mine. He actually needs a defense lawyer right now, because
[05:46.640 --> 05:53.840] we kind of scared his defense lawyer off. This is the fellow that he got so upset that he might
[05:53.840 --> 05:58.560] have been grieved, and he wasn't sure whether it would happen or not, but he lied, and he told the
[05:58.560 --> 06:06.160] judge that he had been bar-grieved, and my buddy's wife heard him lying to the judge and decided he
[06:06.160 --> 06:22.720] deserved a bar grievance for that. A lawyer was crying to the judge, and just whining and making
[06:22.720 --> 06:29.040] a big stink about how terrible it was, and he can't work like that, but dagger to his neck and all of
[06:29.040 --> 06:36.800] that, going to his head, and he was begging the judge to allow him to withdraw. And it was beautiful.
[06:36.800 --> 06:41.920] My friend was standing in there. I went down there to Bryan, Texas, to stand just to go in the court
[06:41.920 --> 06:48.480] and kind of be moral support for him, and take notes of crimes that were happening around me.
[06:48.480 --> 06:56.880] I happened to notice a few. Well, my friend, he handled it so beautifully. He doesn't consider
[06:56.880 --> 07:04.640] himself to be a really high educated or anything. He just, he went in there and he handled himself
[07:04.640 --> 07:19.040] with a perfect, he was so solid in himself that when he was talking with the judge, he just came
[07:19.040 --> 07:26.240] across as someone to not be trifled with, and I really enjoyed watching that whole interaction.
[07:27.600 --> 07:33.440] And the lawyer was over there, stuttering and stammering and shaking everywhere, and his arms
[07:33.440 --> 07:39.760] flailing around and talking about how bad it was, and he couldn't work like this, and my friend was
[07:39.760 --> 07:48.000] just standing there, solid as a tree, and watching all of these antics going on, and he would say
[07:48.000 --> 07:54.320] to me, he's like, well, your honor, I don't want to see this court interfere with this private
[07:54.320 --> 08:02.960] contract. I want this man to do what he is contractually obligated to do. I just thought it was
[08:02.960 --> 08:10.000] beautiful, and the judge treated him really well. In Brazos County, that judge, I was impressed
[08:10.000 --> 08:16.800] with the judge. The judge talked to him with respect. He wasn't an arrogant bully throwing
[08:16.800 --> 08:24.480] his judicial weight around, and he talked with respect, and he said, let me be very clear with
[08:24.480 --> 08:28.080] you, maybe I should have, let me just back up here, maybe I should have said this already,
[08:28.080 --> 08:35.520] but this court has no intention of interfering in any way with your private contract.
[08:38.160 --> 08:45.280] This contract between you and the lawyer, that is exactly that. Now, this motion to withdraw over
[08:45.280 --> 08:51.040] here is to see whether or not he's going to continue to be representing you in this courtroom,
[08:51.680 --> 08:56.400] but it's between you and him, whether you're still going to be getting legal advice from him,
[08:56.400 --> 09:00.640] whether he's going to still somehow find a way to substitute somebody else to do anything else,
[09:00.640 --> 09:06.880] that's all between you guys. So it was very good of him to draw the line and say he's not going
[09:06.880 --> 09:14.480] to interfere. It sounds like he was talking to the lawyer and said, Bubba, you're going to have to fix
[09:14.480 --> 09:26.080] this. But in the end, the judge looked my friend in the face and he says, he says, I want to ask you,
[09:26.880 --> 09:35.520] do you have any confidence in this man being able to represent you? Do you think he's capable
[09:36.080 --> 09:41.840] if we were to go to court right now and call the jury in that door right there,
[09:41.840 --> 09:50.000] and he's going to stand up here and represent you? With these heavy charges that are being
[09:50.000 --> 09:57.120] brought against you, do you have confidence that this man can do you right? My friend looked over
[09:57.120 --> 10:02.480] at him or he didn't say confidence. He said, are you comfortable that this man could represent you?
[10:03.280 --> 10:11.120] My friend, he just looked and he shook his head like, oh my goodness. And he looked at the judge
[10:11.120 --> 10:16.640] and he said, well, judge, I've been experiencing a lot of things that are not comfortable. I've
[10:16.640 --> 10:22.480] been learning a lot about the law and it's not been comfortable, but this is not about my comfort.
[10:23.040 --> 10:28.320] And he looked over at the lawyer and he said, he's not comfortable. I don't care about his
[10:28.320 --> 10:32.480] comfort either. I want what's right to happen here. And what's right is for him to do what I
[10:32.480 --> 10:41.120] hate him to do. Oh, that is perfect. And the judge had to sit back and chew on that because
[10:41.120 --> 10:47.120] my friend wasn't budging. He had to sit back and he sat there. The judge, everything was quiet in
[10:47.120 --> 10:54.960] the courtroom for minutes while the judge just sat there. And he just rubbed on his chin and he
[10:54.960 --> 10:59.440] looked back and forth and he thought about everything for a little while. And finally,
[10:59.440 --> 11:05.680] he cut the lawyer loose. The lawyer had to give all of the money back that he had,
[11:05.680 --> 11:15.200] that my friend had paid to this defense lawyer. And the judge made it clear that if you want to
[11:15.200 --> 11:28.880] sue this guy, you still can. What he's doing is he's saying, sue this guy,
[11:28.880 --> 11:37.440] not me. I think he's right. I mean, the whole way it turned out is just beautiful. He said,
[11:37.440 --> 11:42.400] take that money, go get yourself another lawyer and come back and talk about it again.
[11:44.160 --> 11:49.120] The fact that he gave the money back is irrelevant. Yeah.
[11:50.400 --> 11:55.760] There was not part of the contract. So, yes, he still has claim against the lawyer.
[11:55.760 --> 12:05.600] So, has he grieved the lawyer yet? No, he has not. I have encouraged him to do that.
[12:07.040 --> 12:11.120] You know, I'm bar-grieving because I was out there watching all this go on. I'm like, hey,
[12:11.120 --> 12:15.280] this guy just did this. He's just like, and the prosecutor was over there actually,
[12:15.280 --> 12:19.520] trying to stand up for the defense lawyer at one point. The prosecutor was in the room.
[12:20.880 --> 12:25.120] I don't even know why she was there. She didn't have anything to do with this motion to withdraw,
[12:25.120 --> 12:30.800] but she was there. And she piped up on the defense lawyer's behalf at one point.
[12:33.120 --> 12:43.440] It was pretty comical. The prosecutor says, well, your honor, the defendant says he's making all
[12:43.440 --> 12:50.800] these comments about how he didn't get an itemized list of what he wanted. And my friend had asked
[12:50.800 --> 12:56.080] for an itemized list of what did this lawyer do for me? He asked the lawyer, what did you do for me?
[12:56.720 --> 13:01.040] You say you did all this work. I haven't seen any motions come from you. No pleadings.
[13:01.040 --> 13:04.720] The only thing that's happened is 16 months of nothing. And I want an itemized list of what
[13:04.720 --> 13:13.680] exists that you think you should be paid for. And the defense, the prosecutor, was interrupting all
[13:13.680 --> 13:18.800] of that to say, well, your honor, the defendant doesn't have a right to all of this discovery.
[13:18.800 --> 13:24.640] He's looking for discovery and he can't have it. The rules of procedure actually prohibit
[13:24.640 --> 13:28.880] him from having discovery because he's the defendant. It can only go to the lawyer and
[13:28.880 --> 13:34.880] cannot be shown to the defendant. I'm like, oh, I'll just make a little note of that. I'm going
[13:34.880 --> 13:45.680] to bar grieve that girl for lying to the court. Well, what did the judge, did the judge tell
[13:45.680 --> 13:52.320] the prosecutor to butt out? I don't think he said anything, but I think he just held up his hand,
[13:52.320 --> 14:00.320] like, palm out to her, like, shut up, go away, kind of a motion, you know, not like flicking
[14:00.320 --> 14:08.480] his hand at her, but just like, that's enough, be still. And so she didn't say anything else the
[14:08.480 --> 14:16.400] whole time. But since she said that, the defense lawyer, he started saying, oh, yes, that's right,
[14:16.400 --> 14:21.920] your honor, I was going to say that too. Yeah, he doesn't have any right. I can't show it to him.
[14:21.920 --> 14:29.760] That's right. It was just a clown of an experience.
[14:29.760 --> 14:41.040] Good. I'm glad, you know, it's good to see how much a bar grievance, just the idea
[14:41.040 --> 14:50.000] of a bar grievance affected this lawyer. We have Don Terry, he's a host on this network.
[14:50.000 --> 15:00.640] He just, he just bar grieved his lawyer in Alabama. And he sent me this letter he got
[15:00.640 --> 15:08.800] from the, this notice he got from the court, that the court appointed this lawyer, and he
[15:08.800 --> 15:14.240] absolutely refused to have this lawyer. Finally, I told him, accept the lawyer,
[15:14.240 --> 15:21.200] and use the lawyer against the court. So he accepted the lawyer and then bar grieved him.
[15:24.400 --> 15:32.720] He got a letter that the lawyer filed a motion to withdraw and the judge ruled on it that day.
[15:33.840 --> 15:42.320] And all he got was a notice of the result of the motion. And he said, I cried all night.
[15:42.320 --> 15:49.680] Oh, it was horrible. I lost my lawyer. He's not allowed to rule on the motion
[15:49.680 --> 15:55.120] without the hearing, right? Things that have a hearing on the motion to withdraw.
[15:55.680 --> 16:04.800] I gave him a whole list of complaints to file. Criminal and sue the judge, sue the
[16:04.800 --> 16:11.920] uh, malpractice against the lawyer, bar grieve the lawyer, judicial conduct against the judge,
[16:12.960 --> 16:18.720] and federal criminal against the judge and the lawyer because there is no official misconduct
[16:18.720 --> 16:25.920] statute in Alabama. So they denied him due process. The only remedy is in the Fed.
[16:25.920 --> 16:36.480] So he's got two pages of, you know, and I, you know, we talked about it. Don't go to anything
[16:36.480 --> 16:45.120] else here. Only go to this particular hearing by the court. Just hammer them with everything you
[16:45.120 --> 16:52.800] got. They are not going to believe what's coming at them. I've got a federal complaint

[20:43.920 --> 20:53.920] in Alabama. They arrested him and held him in jail for 11 months for the stated reason that he
[20:53.920 --> 21:01.360] filed a federal lawsuit against the officers. The officers called that simulating a legal process
[21:03.600 --> 21:12.320] and was intimidating the public official. This was relatively new law. These are these laws that
[21:12.320 --> 21:20.640] were passed to stop the practices that the Republic of Texas was using in filing leans
[21:20.640 --> 21:29.760] against public officials. Wait so Alabama made a law against intimidation or of a fed
[21:29.760 --> 21:39.680] against simulating a legal process. Then they also charged him with intimidation of a public
[21:39.680 --> 21:45.840] official. Well they claim that he simulated this process for the purpose of intimidating these
[21:45.840 --> 21:53.280] lawyers. I don't remember exactly what the code is but those filed it. He raised these federal
[21:53.280 --> 22:05.440] issues with the city and the city ignored them. So he gave them notice of the exact issues he
[22:05.440 --> 22:11.120] was complaining about and they ignored them. So when they ruled against him he filed a federal
[22:11.120 --> 22:17.680] lawsuit against him. He didn't say anything about the policeman other than that they followed
[22:17.680 --> 22:26.320] this practice and his challenge was against the practice. Then they filed criminally against
[22:26.320 --> 22:34.560] him for filing the lawsuit. I don't know how he wound up in jail for 11 months but he didn't
[22:34.560 --> 22:42.560] have the tools. So now he's getting the tools. He's out of jail and they haven't dropped their
[22:43.360 --> 22:48.000] suit against him yet. They're trying to figure out a way to keep from being sued.
[22:50.000 --> 22:54.880] That's not going to happen. So they forced this lawyer for him and he objected,
[22:54.880 --> 22:59.280] objected, refused to have anything to do with the lawyer, refused to allow that lawyer to
[22:59.280 --> 23:04.400] represent him and then after I talked to him I said accept the lawyer, accept the lawyer and you can
[23:04.400 --> 23:09.680] use the lawyer against the courts. So he accepted the lawyer, told the lawyer all the stuff he
[23:09.680 --> 23:20.240] wanted him to do. The lawyer refused. He barred, grieved him. Now the lawyer ran down and filed
[23:20.240 --> 23:25.040] a motion. The judge got the motion signed to withdraw him. The judge signed it immediately.
[23:25.040 --> 23:32.960] Don didn't get any notice of anything other than the ruling. He didn't get a notice of the motion
[23:32.960 --> 23:43.280] and notice of the hearing, none of that stuff. So for the moment we forget about everything else
[23:44.640 --> 23:52.640] and we only focus on this hearing and what happened with this hearing that has nothing to do
[23:52.640 --> 23:59.840] with what only indirectly has to do with the case against Don. This has to do with what the
[23:59.840 --> 24:08.320] lawyer and the judge did and don't bring anything else into it. I sent him a page and a half of
[24:08.320 --> 24:15.760] criminal complaints and lawsuits, causes of action, barred grievances, judicial conduct complaints.
[24:15.760 --> 24:23.520] They will not believe the onslaught that's coming at him and strictly focused on this issue.
[24:25.840 --> 24:34.080] So it says to him, guys, what do you want to do next? I'm kind of loaded for bear.

[26:50.960 --> 26:58.400] suspect in your... Correct. Oh my goodness. He's my prime suspect. The deputy who
[27:00.560 --> 27:06.240] introduced me to him, introduced himself to me, walked up to me in the courthouse when I was
[27:06.240 --> 27:13.520] there to see the magistrate, walked up to me and introduced himself as a word that I'm not

[27:22.800 --> 27:30.880] proceeded to mistreat me and dragged me out of the courtroom and the courthouse and outside into his
[27:32.640 --> 27:41.200] SUV there and throw me in jail. And he would not and could not demonstrate that he had a warrant
[27:41.200 --> 27:48.960] and when my wife realized that they had just done this to me, she was outside in the parking lot
[27:48.960 --> 27:54.720] waiting. And when she realized she came inside to see, you know, what's going on and they said
[27:54.720 --> 28:01.840] they had taken me to jail and she said she wants to see the warrant and they threatened her in front
[28:01.840 --> 28:09.200] of my young child threatened her to throw her in jail if she doesn't leave the courthouse immediately.

[34:21.440 --> 34:26.160] you need to leave. She said it's business hours I'm on the phone with her she's upstairs you need
[34:26.160 --> 34:36.640] to leave now or go to jail. Oh this is beautiful. So they did not allow her to have the evidence
[34:36.640 --> 34:41.360] in hand she could have gone upstairs and got a certified statement from the records lady that
[34:41.360 --> 34:50.560] would tell her there's no warrant but instead that creates the adverse inference that there was no
[34:50.560 --> 34:57.040] warrant. Well sure well they couldn't show it to me and they couldn't show it that hard. They would
[34:57.040 --> 35:05.360] commit first degree felony aggravated assault to prevent her from finding out that there was no
[35:05.360 --> 35:16.800] warrant. Oh right that's good. Have you attempted to get to a grand jury yet? No not yet you think
[35:16.800 --> 35:21.600] that's a good thing to go ahead and do now? Oh yeah let me tell you where it is right now it's
[35:21.600 --> 35:28.240] gone I disqualified the judge who at the lower end of it this is a county court so it was the county
[35:28.240 --> 35:36.640] judge disqualified her right away because she committed crimes and nobody could reasonably
[35:36.640 --> 35:43.360] think that she's going to be impartial and fair that she's obviously has an interest if she's
[35:43.360 --> 35:51.120] going to start out as a criminal. So I'm put in a motion for disqualification same day and
[35:51.120 --> 36:03.280] the motion for disqualification first she just ignored it for a while and then I was yanking
[36:03.280 --> 36:13.440] on the the presiding regional judge of the admin district or admin region and saying hey I'm not
[36:13.440 --> 36:19.280] heard anything about this disqualification you need to rule on it. What turns out that person is a
[36:19.280 --> 36:25.520] judge who has already committed crimes that I have had to report so he was in a position to not be
[36:25.520 --> 36:33.360] able to so I had to disqualify him too and on up the chain it went they assigned the the Texas
[36:33.360 --> 36:39.920] Supreme Court Chief Justice Hett assigned a new district judge from some other region and they
[36:39.920 --> 36:46.720] came in there well guess what I've already had to report his crimes unfortunately he has committed
[36:46.720 --> 36:53.200] felonies and high crimes and I'm I told the Chief Justice Hett I'm sorry I know it must be
[36:53.200 --> 36:57.680] embarrassing or difficult that you can't find somebody whose crimes I have not I had the
[36:57.680 --> 37:05.840] misfortune of of of encountering however I need somebody who is not interested to preside over
[37:05.840 --> 37:13.600] this situation and on and on it went finally they didn't care if I found somebody interested
[37:13.600 --> 37:19.360] or not they put a new one in there and I had already brought her crimes to the forefront and
[37:19.360 --> 37:24.320] reported but that didn't matter she went ahead and denied everything and just started slashing
[37:24.320 --> 37:32.880] from the beginning I ripped her order to shreds using the law I just looked at what it said and
[37:32.880 --> 37:39.360] I looked at what the law said and I wrote up a scathing report and threw it back at the at
[37:39.360 --> 37:45.760] the Texas Supreme Court Chief Justice Hett and I said this is not going to fly well I first
[37:45.760 --> 37:50.160] I sent her a motion to reconsider and I showed her all the same reasons I was about to show Hett
[37:50.800 --> 37:59.760] but her choice was to let the original order stand unchanged so I gave all of that same
[37:59.760 --> 38:05.280] information to the Chief Justice for him to try to sort it out that's where it stands right now
[38:05.280 --> 38:12.000] and it has been let's see that was July so we're looking at almost six months now
[38:12.720 --> 38:16.720] that they've been running around like chickens with their heads cut off trying to point fingers
[38:16.720 --> 38:24.960] at each other this has gone to the Senate it's gone to the governor it's gone to because the
[38:24.960 --> 38:29.200] governor is the reason why the governor in the Senate but not normally involved in this kind
[38:29.200 --> 38:37.760] of thing but in this particular case the prosecutor who tried to stir up trouble which was literally
[38:37.760 --> 38:42.800] based on nothing it was on the traffic thing that had already been dismissed and she's trying to
[38:42.800 --> 38:49.600] stir it up and make trouble out of it again and it turns out she's not even authorized to present
[38:49.600 --> 39:00.640] the proper paperwork to the court she's just a hired office assistant well so you look to her
[39:00.640 --> 39:07.520] boss her boss is the one who would be authorized to bring the proper paperwork and in that position
[39:07.520 --> 39:12.400] the previous person had just been run out of office by the Texas Rangers for official oppression
[39:13.200 --> 39:17.520] and now this one is sitting in there in a temporary sort of appointment state waiting
[39:17.520 --> 39:22.640] for Senate confirmation so she was appointed by the governor governor Abbott appointed her to
[39:23.360 --> 39:29.360] fill in temporarily and she's waiting for the Senate to confirm her so I wrote to all the
[39:29.360 --> 39:35.840] senators wrote to Abbott and I made sure that they know what she's doing is official oppression
[39:37.200 --> 39:45.040] but that they'll ring loud and clear because the person she's replacing was doing the same thing
[39:45.040 --> 39:50.480] and the person who is working for her now is the same one who was doing the official oppression
[39:50.480 --> 39:57.680] working for the other guy there's no change here we need somebody who's do not confirm this this
[39:57.680 --> 40:05.200] lady the crimes are continuing you need to get her out of there and have a real election so that's

[53:29.360 --> 53:35.040] to plead and i said well i'm not real sure uh what you're charging me with because the vehicle
[53:35.040 --> 53:42.800] that you cited was licensed and insured and uh she was getting flustered and i was asking her show
[53:42.800 --> 53:49.920] me the paperwork it took about eight minutes probably for us to get through and when i turned
[53:49.920 --> 53:54.960] around and go back there was a sheriff deputy that inched his way up to where he was about a foot away
[53:54.960 --> 54:00.640] from my wife but then we were sitting on the front row and he gave me this look like he was
[54:00.640 --> 54:06.480] sticking a pounce on me if i didn't behave and i sat down had a pen and a paper in my hand so

[54:12.160 --> 54:18.480] i ain't done nothing so i got up and i went to him i said what's your name and uh wrote his name

[54:24.720 --> 54:32.160] tea close complaint against him and we sent a certified copy to the sheriff and apparently he
[54:32.160 --> 54:39.840] didn't get it well this week about a week and a half ago there's someone called me and said there's
[54:39.840 --> 54:46.160] a bunch of the fire trucks up at your shop it's an ambulance is what it was been there for about an
[54:46.160 --> 54:52.960] hour so i went up there and there was the uh sheriff's deputy and ambulance and so i went
[54:52.960 --> 54:58.160] around and asked him is everything okay and i've seen a couple of other cars they're two parked
[54:58.160 --> 55:07.040] kind of weird and um they had a lady inside there the ambulance driver told me we got it handled
[55:07.040 --> 55:12.560] and when i looked inside i guess it was the cop he looked at me and said something i couldn't hear
[55:12.560 --> 55:20.480] him because noise outside and finally he i said well my neighbor told me that uh you know there
[55:20.480 --> 55:25.760] was a problem up here he said well she should have mined her own business i thought well i'm
[55:25.760 --> 55:33.680] kind of sharp you know so i decided to wait and when they came out uh uh the ambulance about five
[55:33.680 --> 55:39.360] minutes later he came over to me and he was just you know i was asking him you know why on private
[55:39.360 --> 55:44.640] property would you not talk to the the manager of the property and you know why would you be rude
[55:44.640 --> 55:49.680] like that and say things like that and didn't think that he had a camera on him but you know i
[55:49.680 --> 55:56.720] think they all do and um anyway after talking to him about five minutes i realized who he was
[55:57.360 --> 56:02.480] and i said oh you're the one that he goes yeah you're the one that filed the little warning
[56:02.480 --> 56:09.120] against me and um i said okay well i guess i'll have to talk to sheriff agon i didn't have my

[01:21:42.600 --> 01:21:56.640] to enforce it and how the code applies to drivers or travelers, have you done that research
[01:21:56.640 --> 01:22:03.240] in Michigan, somewhat I mean it's a little bit of an ambiguity as to how they get away
[01:22:03.240 --> 01:22:12.520] with arresting people for not having a suspended driving license, to restrain somebody at their
[01:22:12.520 --> 01:22:21.080] liberty for something like that that is not, generally that particular crime is not in
[01:22:21.080 --> 01:22:29.280] the transportation code, it is generally a class B misdemeanor in the people code.
[01:22:29.280 --> 01:22:37.120] So that would be, you wouldn't have those traffic issues to throw at them, but denial
[01:22:37.120 --> 01:22:46.680] of due process, if they committed acts that amount to criminal acts, that should disqualify
[01:22:46.680 --> 01:22:57.320] the actors under trespass ab initio, you might do some research in Michigan on trespass
[01:22:57.320 --> 01:23:06.760] ab initio, ab initio from the initial initiation from the beginning.
[01:23:06.760 --> 01:23:16.080] So if someone initiates a legal and proper stop and subsequently commits an act that
[01:23:16.080 --> 01:23:24.720] is criminal or denial of due process, all of their acts can be defeated.

[01:24:24.600 --> 01:24:32.600] and others following their lead in filing liens against public officials.
[01:24:32.600 --> 01:24:38.280] Robert Fox called me when I was in North Carolina, and he had these two guys that the
[01:24:38.280 --> 01:24:43.440] feds were coming after, and I said, well, what is the issues?
[01:24:43.440 --> 01:24:45.640] Well, we filed some liens.
[01:24:45.640 --> 01:24:52.080] Well, who did you file the liens against, a justice of the peace?
[01:24:52.080 --> 01:24:54.760] How much were their liens?
[01:24:54.760 --> 01:24:56.760] 11 trillion.
[01:24:56.760 --> 01:25:03.200] Oh, guys, what were you thinking?
[01:25:03.200 --> 01:25:07.600] Well, at the time, that was legal.
[01:25:07.600 --> 01:25:13.760] There was nothing to prevent you from doing that, and they asked, you know, asked what

[01:25:14.760 --> 01:25:16.000] I said, oh, you guys are going to win.

[01:25:57.600 --> 01:26:06.680] do everything right, he potentially falls under that statute.
[01:26:06.680 --> 01:26:15.480] If he finds his own procedure, his own policy, but he still manages to trespass on your rights,
[01:26:15.480 --> 01:26:16.880] then that would work, right?
[01:26:16.880 --> 01:26:24.400] Yeah, once he violates a due process right, then he becomes a trespasser, and he no longer
[01:26:24.400 --> 01:26:30.680] has the authority to issue this government document.
[01:26:30.680 --> 01:26:36.760] So he's issuing or securing or issuing a document by deception.

[01:28:38.080 --> 01:28:39.640] What's that got to do with anything?
[01:28:39.640 --> 01:28:42.040] Well, if you don't have a right to it, I can't give it to you.
[01:28:42.040 --> 01:28:51.040] I said, oh, wait a minute, the statute says you must do this thing and the statute commanding
[01:28:51.040 --> 01:28:58.160] you to do something goes to due process and due process is something I have a right to.
[01:28:58.160 --> 01:29:03.920] He told me after the case, I think Brett was there that day, that he could use that.
[01:29:03.920 --> 01:29:10.280] He represented people in his day job in criminal cases and they'd been trying to get examining
[01:29:10.280 --> 01:29:11.280] trials for their clients.

[01:35:57.680 --> 01:36:04.680] But anyway, I had my status conference hearing today, and she had refused to respond,
[01:36:04.680 --> 01:36:06.680] and you have to file a joint one.
[01:36:06.680 --> 01:36:16.680] Well, it turns out that I had not served her correctly because you have to have some kind of extraordinary service.
[01:36:16.680 --> 01:36:25.680] I forget what the judge said, but I did very pretty good because I had actually filed everything.
[01:36:25.680 --> 01:36:31.680] I had met my obligation to the court to file the unilateral status conference,
[01:36:31.680 --> 01:36:39.680] and she did not turn up. Her new attorney was there, but he's not on this particular case.
[01:36:39.680 --> 01:36:44.680] He's on her actual bankruptcy, and he was there for other people's bankruptcy,
[01:36:44.680 --> 01:36:49.680] but he sat and listened to what obviously I was saying.
[01:36:49.680 --> 01:36:58.680] And, you know, she should have been there because she filed an answer to me, but she did not file it with the court.
[01:36:58.680 --> 01:37:07.680] And the judge for everybody's education, if you can file for a default judgment,
[01:37:07.680 --> 01:37:19.680] but because technically, although she received my complaint, she wasn't served the way the bankruptcy court requires it.
[01:37:19.680 --> 01:37:23.680] Did she raise an opposition to service?
[01:37:23.680 --> 01:37:27.680] She was not there, and she has not raised an opposition.
[01:37:27.680 --> 01:37:35.680] The judge, service is only an issue if the opposing counts the party brings it as an issue.
[01:37:35.680 --> 01:37:39.680] It's an affirmative defense. It's not a bar.
[01:37:39.680 --> 01:37:43.680] That's interesting.
[01:37:43.680 --> 01:37:49.680] Well, she did. She was very nice. She said to me, you filed this without attorney's help,
[01:37:49.680 --> 01:37:58.680] and a counselor said, that's correct, Your Honor. And she said, do you think you can get, you know, hire an attorney?
[01:37:58.680 --> 01:38:02.680] I said, that would be financially impossible, Your Honor.
[01:38:02.680 --> 01:38:08.680] Okay. And she said, well, it kind of looks to me like you could settle this with this party yourself.
[01:38:08.680 --> 01:38:12.680] I said, well, that would be good if she'd responded, but she refuses to respond.
[01:38:12.680 --> 01:38:21.680] And she said, that figures. And the head trustee was there, not the trustee on the case, but the one above him.
[01:38:21.680 --> 01:38:27.680] And when our last conference meeting was postponed and we didn't know it,
[01:38:27.680 --> 01:38:34.680] I went down there with another party to the case who didn't know his rights to file for this stuff,
[01:38:34.680 --> 01:38:40.680] but they're world fighting to put her in jail because she's done this twice before in Northern California.
[01:38:40.680 --> 01:38:43.680] She came down here and did it here and she'll do it again.
[01:38:43.680 --> 01:38:49.680] But, you know, we met with the head trustee was there, so we went in and met with him and told him the story,
[01:38:49.680 --> 01:39:00.680] showed him the TV story on it, and he said he would request the minutes from the 341 hearing, the recording.
[01:39:00.680 --> 01:39:04.680] I didn't go to that one because I wasn't informed.
[01:39:04.680 --> 01:39:12.680] So only two guys went and they grilled her for an hour. But the actual trustee doesn't want to do anything
[01:39:12.680 --> 01:39:18.680] and will not correspond with the parties because there's no money in it for them.
[01:39:18.680 --> 01:39:22.680] And he just wants to wash his hands of it and we're not allowing him to do that.
[01:39:22.680 --> 01:39:24.680] So we've gone above his head.
[01:39:24.680 --> 01:39:30.680] And after the head trustee was in the courtroom today responding to other cases,
[01:39:30.680 --> 01:39:36.680] he knew who I was because I'd met with him last week. And after I left, the judge said,
[01:39:36.680 --> 01:39:42.680] well, how about if I give you 60 days and we'll have another status-compensating
[01:39:42.680 --> 01:39:46.680] that will give you time to get some legal help?
[01:39:46.680 --> 01:39:50.680] And this is what all of us are kind of wondering.
[01:39:50.680 --> 01:39:53.680] She said, I can't give you legal advice.
[01:39:53.680 --> 01:39:57.680] Well, you're a judge for God's sake. Why can't you give legal advice?
[01:39:57.680 --> 01:40:01.680] She said, I mean, if you can't give legal advice, who can?
[01:40:01.680 --> 01:40:03.680] They all hide behind it.
[01:40:03.680 --> 01:40:07.680] The judge definitely can give you legal advice.
[01:40:07.680 --> 01:40:09.680] Oh, but she said she couldn't.
[01:40:09.680 --> 01:40:13.680] That's not true. She absolutely can.
[01:40:13.680 --> 01:40:17.680] They regularly give legal advice to both sides.
[01:40:17.680 --> 01:40:22.680] Well, she said, could I ask her if I could add other parties now?
[01:40:22.680 --> 01:40:29.680] And she said, well, you can check the rules. I can't give you legal advice, but we do have this, you know,
[01:40:29.680 --> 01:40:34.680] attorney's pro bono that help people on every Friday.
[01:40:34.680 --> 01:40:36.680] But that's usually for debtors.
[01:40:36.680 --> 01:40:40.680] But I'm sure you might be able to find a way to fit in.
[01:40:40.680 --> 01:40:44.680] And I said, well, she said, I'll give you 60 days.
[01:40:44.680 --> 01:40:47.680] Would that be fine with you? And I said, that would be fine.
[01:40:47.680 --> 01:40:51.680] She said, you know, you have to read the rules and complete the correct service.
[01:40:51.680 --> 01:40:57.680] But it now means she said, because this lady answered me and she said, I don't need to see it.
[01:40:57.680 --> 01:41:06.680] The fact that she answered you is not relevant to the fact that she didn't file with the court and you didn't do the proper service.
[01:41:06.680 --> 01:41:09.680] So, but she was, she was very calm.
[01:41:09.680 --> 01:41:11.680] She was not arrogant.
[01:41:11.680 --> 01:41:18.680] She was very professional, treated me with courtesy.
[01:41:18.680 --> 01:41:25.680] And she said, you know, you probably can do that, but check the rules.
[01:41:25.680 --> 01:41:32.680] And so basically I'm getting a clean start and I can if anyone else wants to add in.

[01:47:35.680 --> 01:47:42.680] You've got to be kidding me. They mixed up people sent different accounts.
[01:47:42.680 --> 01:47:55.680] Yes. Yes. He got his account, and then he got three accounts for another guy, and one account for two accounts for another guy.
[01:47:55.680 --> 01:48:05.680] But what Michael's telling me, because I asked him, I emailed him and said, hey, how do I use this against them? And he was telling me, then he said, you know, did he sign for these?
[01:48:05.680 --> 01:48:10.680] And I said, I didn't know, I'd asked him. He apparently didn't sign for them.
[01:48:10.680 --> 01:48:19.680] And what Michael said, if they don't send it certified, they haven't done the verification, because they can't prove you got it.
[01:48:19.680 --> 01:48:25.680] He was telling me what to do about this. And I said, well, maybe we shouldn't tell them because then they'll know we've got it.
[01:48:25.680 --> 01:48:38.680] We'll maybe call the other people up or write them and say, hey, your account was sent to my, you know, client and you might want to contact your debt collectors and say they screwed up and, you know, sue them for it.
[01:48:38.680 --> 01:48:50.680] But I didn't know that if they don't send it by certified mail, it's another $1,000 because they haven't actually answered you. I did not know that.
[01:48:50.680 --> 01:48:51.680] Wonderful.
[01:48:51.680 --> 01:48:53.680] Really good question.

[01:49:19.680 --> 01:49:31.680] Well, I have a comment and I have my little problem with Medicare and verification as to whether I had credible coverage or not.
[01:49:31.680 --> 01:49:45.680] The question is from the beginning of the show, do you know of anybody that's ever succeeded in getting a court order of protection against the police or the court system?
[01:49:45.680 --> 01:49:47.680] No.
[01:49:47.680 --> 01:49:51.680] I don't know if I've had that issue before.
[01:49:51.680 --> 01:49:56.680] It was just a thought that crossed my mind, you know, one of those.
[01:49:56.680 --> 01:50:18.680] So I had a friend of mine went and he asked a judge for temporary emergency restraining order because he felt his life was in danger after having been threatened and the officers had actually pulled their weapons on him and said they were coming back to get him.
[01:50:18.680 --> 01:50:26.680] And he went in there and asked the judge, he told the judge this and asked for restraining order and the judge said no.
[01:50:26.680 --> 01:50:46.680] And right behind my friend was the sheriff asking whose deputies had been involved in that very incident, listening to him tell the story, and the sheriff ended up getting a warrant from that judge to go out and arrest my friend.
[01:50:46.680 --> 01:50:54.680] So it didn't turn out well for him, asking for restraining order against the officers, even though he should have gotten it.
[01:50:54.680 --> 01:50:55.680] He needed it.
[01:50:55.680 --> 01:51:00.680] It should definitely have happened, but that's how it went for him.
[01:51:00.680 --> 01:51:05.680] He could have filed a criminal complaint against the judge for endangering his life.
[01:51:05.680 --> 01:51:07.680] He jumped there, right?
[01:51:07.680 --> 01:51:11.680] A depraved heart assault.
[01:51:11.680 --> 01:51:13.680] Oh, boy.
[01:51:13.680 --> 01:51:16.680] Does that sound horrible or what?

[01:51:20.680 --> 01:51:31.680] It doesn't matter if you can get it proved or not, but to charge the judge with a depraved heart claim.

[01:51:37.680 --> 01:51:46.680] It's more ugly than anything else, especially if you were to spread it around to the local newspapers at the same time.
[01:51:46.680 --> 01:51:53.680] At the end of the day, you'll never win your case simply because you have the law and the facts on your side.
[01:51:53.680 --> 01:51:59.680] You win your case if you have the politics on your side and all politics is local.
[01:51:59.680 --> 01:52:05.680] You put out a depraved heart claim against the judge.
[01:52:05.680 --> 01:52:08.680] That's going to stick.
[01:52:08.680 --> 01:52:12.680] There are some things people might forget, but depraved heart?
[01:52:12.680 --> 01:52:17.680] No, they won't forget that one.
[01:52:17.680 --> 01:52:23.680] We could call that pulling a brandy on them.

[01:52:25.680 --> 01:52:44.680] If I can get to the situation that I had and we talked about a couple of weeks ago, it had to do with a question of whether I decided to take Medicare, A and B, and just the drug plan.
[01:52:44.680 --> 01:53:00.680] And because I came to the conclusion that because of the cost of the health care plans, it would be easier, actually easier for me to handle the 20% and as opposed to having a health care plan do it.
[01:53:00.680 --> 01:53:10.680] Of course, this would go sour if I went into the hospital, but New York State has something called hospital finance aid, which is not entirely limited to income.
[01:53:10.680 --> 01:53:21.680] So having said that, they kept accusing me of not having credible coverage and I'm thinking of the word credible saying that well, credible means believable.
[01:53:21.680 --> 01:53:23.680] I said, what kind of a standard is that?
[01:53:23.680 --> 01:53:34.680] Well, I found out later on after I called Medicare and I said, these people are insisting that I owe them a fine and I refuse to pay the fine.
[01:53:34.680 --> 01:53:44.680] They offered me a affidavit to sign on the perjury and I said, you're not a court, I'm not going to sign an affidavit to you.
[01:53:44.680 --> 01:53:55.680] And as it turns out, I was not looking at the English definition of the word credible.
[01:53:55.680 --> 01:54:11.680] It turned out it was a definition, you know, legal definition, which means care as good or better than Medicare, which they never explained that and they should have put that in quotes if it was a term definition.
[01:54:11.680 --> 01:54:18.680] So as I said, they asked it to an undefined term of art.
[01:54:18.680 --> 01:54:37.680] Yeah, right. And you were speaking to that a couple weeks ago about something about trying to give, I don't know, somehow get Trump's attention about this sort of thing, where they don't, they're not clear about what they mean.
[01:54:37.680 --> 01:54:50.680] I was speaking to the executive order 13891 and 992.
[01:54:50.680 --> 01:55:04.680] These direct all government agencies to clearly explain their enforcement policies.
[01:55:04.680 --> 01:55:09.680] You should you should read those are not very big.
[01:55:09.680 --> 01:55:18.680] And he stuck it to all of them, especially the SEC, but he essentially stuck it to all of these agencies.
[01:55:18.680 --> 01:55:25.680] They can't just make up a set of rules and then go out and enforce those rules anyway they want to.
[01:55:25.680 --> 01:55:45.680] They claim that you violated one of their rules and it's not clear from the the verbiage of the ruling that they cannot enforce it unless they have explained it before you allegedly violated it.
[01:55:45.680 --> 01:55:59.680] So here you have them giving you an explanation using a term of art that has a definition in the natural language.
[01:55:59.680 --> 01:56:04.680] But they did not define the term as a term of art.
[01:56:04.680 --> 01:56:15.680] So you use the natural language term and it caused the the claim they made not to be clear.
[01:56:15.680 --> 01:56:25.680] Okay, as it stands right now they're still accepting my 1550 a month and they're not as of right now they're not doing anything.
[01:56:25.680 --> 01:56:37.680] But I didn't have them credible proof of coverage which is impossible because they verbally gave them access through verbal signature.
[01:56:37.680 --> 01:56:44.680] I mean the process of signing up for one of these plans takes about an hour and they're constantly asking you questions.

[01:56:55.680 --> 01:57:04.680] That's what he does. He's an insurance guy and Medicare medicaid what he does.

[01:57:43.680 --> 01:57:50.680] So now they're calling me and they're asking me to send them incredible proof again which I thought I already sent to you.
[01:57:50.680 --> 01:57:56.680] And I said I have a company plan. How could that not be credible coverage.
[01:57:56.680 --> 01:57:59.680] I mean it's just the whole thing is crazy but right now.
