[01:13.200 --> 01:17.360] Houston, Austin, and San Antonio have been dropping marijuana possession charges and even
[01:17.360 --> 01:21.440] refusing to file new ones since they are stipulating that they do not have the time
[01:21.440 --> 01:26.720] or the laboratory equipment to test the herb for THC. Margaret Moore, the Travis County District
[01:26.720 --> 01:30.720] Attorney, announced earlier this month that she was dismissing 32 felony possession and
[01:30.720 --> 01:35.440] delivery of marijuana cases because of the law. Mr. Abbott and other state officials,
[01:35.440 --> 01:39.440] including the Attorney General, stipulated in a letter to county district attorneys back on
[01:39.440 --> 01:44.560] Thursday that marijuana has not been decriminalized in Texas and that these actions demonstrate a
[01:44.560 --> 01:51.040] misunderstanding of how HB 1325 works, as well as other cities too, like the District Attorney,
[01:51.040 --> 01:57.040] and El Paso, Cayma Esparza, a Democrat who also stated earlier this month that the law
[01:57.040 --> 02:02.800] quote will not have an effect on the prosecution of marijuana cases in El Paso. However, the issue
[02:02.800 --> 02:07.680] was succinctly summarized by Mr. Brandon Ball, an assistant public defender in Harris County who
[02:07.680 --> 02:12.160] stated that quote, the law is constantly changing on what makes something illegal based on its
[02:12.160 --> 02:17.200] chemical makeup. It's important that if someone is charged with something, the test matches what
[02:17.200 --> 02:26.320] they're charged with. A paper by Tulane University identified a five and a half inch American
[02:26.320 --> 02:32.080] pocket shark. As the first of its kind in the Gulf of Mexico, the specimen being only the second
[02:32.080 --> 02:37.760] pocket shark ever captured or recorded with the other one being found way back in 1979 in the
[02:37.760 --> 02:43.040] East Pacific Ocean. According to the university paper, the shark secretes a luminous fluid from
[02:43.040 --> 02:49.680] a gland near its front fins. For the purpose, it is hypothesized to lure and prey who may be drawn

[03:38.400 --> 03:42.320] at will. Code of silence means that the pigs will never let out a squeal. And if they go to court,
[03:42.320 --> 03:46.400] they know the judge will make them a deal for real. That's why they're stopping me, locking me up,
[03:46.400 --> 03:50.640] stopping me, complicating my property, talking to my demographers, making the proof of my
[03:50.640 --> 03:54.080] identity. All right folks, good evening. This is the Monday Night Rule of Law radio show with your
[03:54.080 --> 04:04.640] host Eddie Craig. It is November 18, 2019. And this year is just rolling right on by it. Okay,
[04:05.440 --> 04:11.920] couple things. In case you hadn't heard about him, there is a sheriff's deputy in the state of
[04:11.920 --> 04:19.600] Florida who was recently called planting drugs on people whenever he pulled them over for a traffic
[04:19.600 --> 04:30.480] stop. And because of the number of times this cop has done this, over 100 cases have been thrown
[04:30.480 --> 04:42.880] out because this was the arresting officer. Out of all of these cases, supposedly if he gets convicted,
[04:42.880 --> 04:50.080] this cop can face up to 100 years in prison. I would like to go on the record right now
[04:50.080 --> 05:01.680] as predicting that he will not serve more than 10 years total for anything he's done,
[05:03.600 --> 05:12.560] if even that much. I would like to go on record saying before this plays out, that's how that's
[05:12.560 --> 05:20.880] going to play out if he even gets convicted at all. He should, but then again, that all depends on
[05:20.880 --> 05:27.280] how many people on his jury want to chiss up and rub their noses in that thin blue line flag, right?
[05:29.040 --> 05:37.520] Now, we also have this week instances of cops stopping cars that are leaving,
[05:37.520 --> 05:44.480] you know, sporting events and things of that nature just to harass the occupants. There's no
[05:44.480 --> 05:49.680] valid reason to detain the individuals in the car to stop the car. They're leaving an event,
[05:49.680 --> 05:56.160] they've done absolutely nothing wrong, but they're getting stopped and inspected by hordes of police
[05:56.160 --> 06:01.760] officers at the exits. And these police officers are stopping everybody and demanding that they
[06:01.760 --> 06:08.400] produce identification, which on its face is blatantly illegal and unconstitutional.
[06:09.040 --> 06:15.520] And then you have the idiot officers saying that they have every legal right to stop anyone they
[06:15.520 --> 06:25.120] want to and demand their ID, which we know to be a complete and total lie. Now, we also know the
[06:25.120 --> 06:35.440] Supreme Court ruled that cops are allowed to lie to the public. However, when that lie is used to
[06:35.440 --> 06:43.200] facilitate a deprivation of a right under the premise of an authority that the officer does
[06:43.200 --> 06:55.040] not legally have, that makes it a whole other ballgame. And this is why knowing what these cops
[06:55.040 --> 07:03.840] can and cannot legitimately do becomes so important. Okay? Now, cops are not the only ones that do this.
[07:04.720 --> 07:10.560] Prosecutors do it, defense attorneys do it. If you think your defense attorney is defending you,
[07:10.560 --> 07:18.000] think again, unless you have lined their pockets with more cash than anyone else,
[07:18.000 --> 07:23.280] they're not defending you, they're defending the system. And you will become whatever
[07:24.480 --> 07:31.680] cannon fodder you need to to facilitate the protection of the system. Okay? If and when
[07:31.680 --> 07:41.440] that is the necessary outcome to your particular case. Now, on top of this, you have judges who do
[07:41.440 --> 07:50.000] it, and they do it repeatedly. But I want to back up and go to private law firms who do it,
[07:50.800 --> 07:57.360] not private law firms who are acting as prosecutors or as defense attorneys, but who are doing it
[07:57.360 --> 08:04.800] in these debt collection letters they're sending out to people saying you owe for fines and fees
[08:04.800 --> 08:10.000] out of this court this amount of money. When in fact you don't owe anything because one,
[08:10.000 --> 08:16.400] your case has never gone to trial and it's never been adjudicated. And you've never entered a plea
[08:16.400 --> 08:22.240] of guilty or null or contender and filed that with the court so as to allow the court to proceed
[08:22.240 --> 08:27.680] in absentia to issue the conviction order and set the fine and the judgment and all that good
[08:27.680 --> 08:34.400] stuff. All of which requires that that court generate specific paperwork as part of the final
[08:34.960 --> 08:46.160] judgment process. Okay? Now, given that, what then is the legitimate authority for these law firms
[08:46.160 --> 08:53.440] to be contacted by these municipalities and justices of the peace and say I want you to collect on
[08:53.440 --> 09:05.440] this set of fines, but they don't tell the attorneys that the case has never been adjudicated.
[09:06.880 --> 09:12.720] They just say send them a notice, tell them they owe it and see if they pay it. How is this not
[09:12.720 --> 09:26.480] fraud? How is it not male fraud? How is it not simulation of legal process? How is it not numerous
[09:26.480 --> 09:34.480] felonies? How is it not a violation of the Code of Judicial and Professional Ethics
[09:35.680 --> 09:41.360] for attorneys and judges to engage in this particular type of activity and to collude
[09:41.360 --> 09:47.600] with each other to do it? That's criminal conspiracy and criminal conspiracy to commit
[09:47.600 --> 09:55.360] male fraud. The criminal conspiracy comes into the play because absent an adjudication of this case
[09:55.360 --> 10:02.320] there is no legally valid judgment therefore there can be no debt related to a judgment.
[10:04.160 --> 10:10.320] So they are depriving the individual who they are trying to get money out of their pocket
[10:10.320 --> 10:14.000] via this notice from these attorneys that they owe this alleged debt.
[10:16.400 --> 10:23.760] They're depriving them of their right of due process in a criminal case. They're trying to punish them
[10:23.760 --> 10:29.200] without a trial and they're using fraudulent communications to do it.
[10:31.920 --> 10:39.600] This is criminal folks. There's no if ands or buts about this. This entire process
[10:39.600 --> 10:50.640] is downright criminal. So the question is what do we do about it? Well as is always the question
[10:51.200 --> 10:56.000] you're only going to go as far as you're willing to go to do something about it and most people
[10:56.000 --> 11:00.000] would rather they just go away and leave them alone than actually do something about it.
[11:00.000 --> 11:08.560] The fact remains however that when you receive one of these letters from these law firms
[11:09.760 --> 11:14.240] they're not as protected in that letter as they think they are and want you to believe
[11:14.240 --> 11:23.840] they are and as they used to be. Why? Because in 1986 the United States Congress took away
[11:23.840 --> 11:31.280] their protection under the FDCPA the Fair Debt Collection Practices Act. Attorneys are no longer
[11:31.280 --> 11:38.720] blanket exempted from the requirements of the FDCPA when it comes to collection of a debt.
[11:40.720 --> 11:48.800] Specifically the case that set this precedent was Heinz, H-E-I-N-T-Z versus Jenkins,
[11:48.800 --> 12:03.040] 514 U.S. 291 in 1995. Now that was the case that set the precedent but the Congress actually
[12:03.040 --> 12:13.680] repealed it nine years earlier in 1986 and this was the first time anybody took it to court and
[12:13.680 --> 12:18.720] challenged it apparently at least all the way to the United States Supreme Court.
[12:21.520 --> 12:30.560] And in this precedent it says very clearly that the FDCPA now directly applies to attorneys who
[12:30.560 --> 12:36.240] regularly engage in consumer debt collection activity even when that activity consists of
[12:36.240 --> 12:44.800] litigation. Well there's the caveat there. First off there is no valid debt because there is no
[12:44.800 --> 12:52.320] valid judgment, there is no valid conviction, there was no valid trial, there was no valid plea
[12:52.320 --> 13:05.040] of guilty or no low contender or no contest. So there cannot be a legitimate debt. So if they're
[13:05.040 --> 13:12.560] engaging in regular debt collection even when the debt involves litigation what happens when
[13:12.560 --> 13:18.400] they're attempting to collect the debt for which there's never been any litigation because it's a
[13:18.400 --> 13:28.240] criminally induced debt that is the result of a criminal conviction that has never been done.
[13:28.240 --> 13:39.760] You get this? So there cannot possibly be any way no matter how they want to argue this
[13:40.640 --> 13:48.480] that they are protected by the FDCPA for attempting to collect a debt because there is
[13:48.480 --> 13:59.680] no debt if there is no conviction judgment order if there is no inter plea of guilty or no contest
[13:59.680 --> 14:09.680] and the fines already been paid. There's none of that. Even if you file paperwork saying I'm
[14:09.680 --> 14:15.120] going to challenge this, I'm going to fight this, if they've never gone to trial they don't have a
[14:15.120 --> 14:21.680] conviction, they can't have a judgment without the conviction, they can't have fines and fees
[14:21.680 --> 14:29.040] without a judgment. The fines and fees are what comprise the alleged debt which cannot exist
[14:29.040 --> 14:34.960] without the judgment, which cannot exist without the conviction, which cannot exist without due
[14:34.960 --> 14:47.600] process which requires having a trial or entering a plea of guilty or no contest. Get it? So everything
[14:47.600 --> 14:53.920] these attorneys firms are doing in relation to collection of these kinds of debts is patent fraud.
[14:55.920 --> 15:04.080] It is fraud perpetrated via the United States mail. It is conspiracy to commit fraud because
[15:04.080 --> 15:10.960] guaranteed this law firm employs at least two people. Then there is the aspect of the court
[15:10.960 --> 15:19.680] itself sending the information to the law firm to collect a debt that the court originally knows
[15:19.680 --> 15:29.760] is invalid. And the court will get a portion of the money that law firm collects.
[15:29.760 --> 15:41.280] Folks, that's the very definition of RICO. Get it?
[15:45.840 --> 15:51.200] If one of them is committing a felony and the others are assisting them in the commission
[15:51.200 --> 16:03.040] of that felony, which mail fraud is a felony, abuse of process in the state of Texas is a felony.
[16:08.800 --> 16:16.720] Why are we pursuing this? Now along those lines, I sat down and I wrote up a reply letter to these
[16:16.720 --> 16:24.400] law firms who send out these, and this reply letter I posted up on Facebook. I give it out

[16:30.240 --> 16:38.960] the matter is that these law firms are knowingly and willfully engaging in criminal conduct by
[16:38.960 --> 16:47.200] sending out the debt collection notice in violation of the FDCPA, the requirement that they comply
[16:47.200 --> 16:51.280] with the laws of the United States and of the state in which they operate, and that they don't

[20:09.680 --> 20:15.600] Facebook about getting one of these very notices from such a law firm here in Texas.
[20:15.600 --> 20:23.840] So here's the way you write the body of this response to them.
[20:24.480 --> 20:29.920] Dear sir or madam, in response to your debt collection communication letter sent via the
[20:29.920 --> 20:35.360] United States Postal Mail Service dated on this month, day, and year, under the terms and conditions
[20:35.360 --> 20:41.520] of the Federal Fair Debt Collection Practices Act, FDCPA, I have good reason to believe and do
[20:41.520 --> 20:48.640] believe that your firm is acting as a debt collector for the city of whomever and that your
[20:48.640 --> 20:53.680] letter is a communication made exclusively for the collection of an alleged debt.
[20:54.960 --> 20:58.560] Okay, so that's how we start this off and set the tone.
[21:01.520 --> 21:08.400] The United States Supreme Court has previously held that the United States Congress amended
[21:08.400 --> 21:17.280] the FDCPA in 1986 to remove the blanket exception for attorneys. Thus, the FDCPA now directly
[21:17.280 --> 21:21.840] applies to attorneys who regularly engage in consumer debt collection activity,
[21:21.840 --> 21:27.840] even when that activity consists of litigation, Heinz versus Jenkins. An attorney who is regularly
[21:27.840 --> 21:33.360] engaged directly and indirectly in the collection of debts is a debt collector under the FDCPA,
[21:33.360 --> 21:41.200] Kistner versus Law Offices of Michael P. Marjoleski, LLC, and Gathering versus Murders Incorporated.
[21:41.840 --> 21:48.080] Therefore, I must presume that all FDCPA debt collection requirements apply to your firm
[21:48.080 --> 21:54.720] and your firm's debt collection letter as a matter of law. Therefore, as your communication
[21:54.720 --> 22:00.400] clearly violates numerous mandatory requirements for such debt collection communications under
[22:00.400 --> 22:07.600] the FDCPA on its face, I must presume that your intentions are to knowingly and willfully act
[22:07.600 --> 22:14.480] in violation of said act, existing Texas law, and both the due process and consumer rights
[22:14.480 --> 22:21.280] of the individual to whom it is addressed. As no due process via any sort of fair and impartial
[22:21.280 --> 22:26.240] trial has been afforded the individual to whom your unlawful communication is directed,
[22:26.240 --> 22:32.880] and no adjudication has been had, nor any signed order of conviction and judgment having been
[22:32.880 --> 22:40.160] subsequently issued, no valid judgment, much less any kind of judgment related debt, can possibly
[22:40.160 --> 22:46.880] legally exist. These are simply the facts. As attorneys practicing law within the state of
[22:46.880 --> 22:52.640] Texas, you both could have known and should have known that Texas law requires the existence of
[22:52.640 --> 22:59.760] a post-conviction order signed by the judge of the court, even for Class C fine only convictions,
[22:59.760 --> 23:05.920] which I am absolutely certain your records do not contain as no such order could have been
[23:05.920 --> 23:11.680] lawfully issued without a guilty plea or conviction at trial, neither of which has occurred.
[23:12.960 --> 23:17.600] As attorneys, these are things you are required to know and account for in the course of your
[23:17.600 --> 23:22.400] actions. The most important of which is that you act in full compliance with the law and the
[23:22.400 --> 23:28.160] individual rights of the public. However, it would appear that your firm would rather engage in
[23:28.160 --> 23:34.000] perpetrating fraud upon the public by knowingly and willingly demanding payment of a non-existent
[23:34.000 --> 23:40.560] and legally invalid debt. Therefore, I hereby demand that you immediately provide me with
[23:40.560 --> 23:46.960] certified copies of all documentary proof of the alleged final judgment and its associated debt
[23:46.960 --> 23:54.560] that you are claiming exists and are attempting to collect. Be further advised absent your firm
[23:54.560 --> 24:00.080] making every possible effort to provide me the requested certified records and other documents
[24:00.080 --> 24:09.280] required by and pursuant to Texas Code of Criminal Procedure Articles 45.041d and 45.047
[24:09.280 --> 24:18.160] as and the FDCPA as expeditiously as possible and these records proving the existence of
[24:18.160 --> 24:23.840] a legally proper criminal conviction and signed judgment order necessary for the creation of
[24:23.840 --> 24:29.840] the alleged judgment debt. Your unlawful communication must and will be viewed as a
[24:29.840 --> 24:35.280] knowing and willful act of attempted mail fraud and conspiracy to commit mail fraud
[24:35.280 --> 24:41.520] by use of the United States Postal Mail, a federal offense, as well as being sufficient
[24:41.520 --> 24:46.560] grounds to pursue the filing of an FDCPA lawsuit against your firm and its officers.
[24:47.440 --> 24:52.240] Should you fail to provide the requested verifiable documentary evidence proving the
[24:52.240 --> 24:57.520] existence of the alleged debt you claim to have been contracted to collect within 10 business
[24:57.520 --> 25:02.480] days from the receipt of this written demand for validation, a copy of your communication will
[25:02.480 --> 25:07.840] be forwarded to the United States Department of Justice and the Office of the Postmaster General
[25:07.840 --> 25:13.040] accompanied by a sworn criminal complaint, wherein the allegation will be made that your
[25:13.040 --> 25:19.120] law firm is believed to be engaging in deceptive trade practices, mail fraud, conspiracy to
[25:19.120 --> 25:25.360] commit mail fraud, and knowing and willful violations of not only the FDCPA but also the
[25:25.360 --> 25:30.080] due process rights of the individual to whom you have directed the communication regarding the
[25:30.080 --> 25:36.400] alleged debt as well as the rules of professional ethics and conduct. Again, you have 10 business
[25:36.400 --> 25:40.800] days from the date of receipt of this reply to provide the requested records and documents
[25:40.800 --> 25:46.320] validating the existence of the alleged debt. No further communication from your firm or any
[25:46.320 --> 25:52.640] agent thereof shall be accepted by any means other than certified mail service via the United
[25:52.640 --> 25:58.160] States Postal Mail Service. Then you sign this letter using a formal business form and be sure
[25:58.160 --> 26:06.480] it is mailed back to the law firm certified mail return receipt requested. This is how we should
[26:06.480 --> 26:17.920] be responding. Of course, people aren't doing it. No one's doing it even though that's what we
[26:17.920 --> 26:27.600] should be doing. But folks, if you're not paying attention to what's going on around you in relation
[26:27.600 --> 26:35.440] to these kinds of activities and those that are occurring everywhere in every state by the powers
[26:35.440 --> 26:43.040] that be, how in the world do you ever expect to remain free? How do you expect to even understand
[26:43.040 --> 26:50.400] what freedom and liberty are supposed to mean in relation to Americans as a whole and as individuals?
[26:50.400 --> 27:01.040] Right now, there has been so much indoctrination that you will literally get torn to pieces in a
[27:01.040 --> 27:07.680] crowd of people by saying that the cops are doing something wrong if the crowd you're in happens to
[27:07.680 --> 27:15.760] be full of cop lovers. To those kinds of people, worship cops. They can do no wrong. And I'm telling
[27:15.760 --> 27:21.600] you, they're dangerous and they're dangerous because of that mindset. They're as dangerous as
[27:21.600 --> 27:27.920] liberals when it comes to your rights and freedoms. They can say they're patriotic and support
[27:27.920 --> 27:35.680] freedom and liberty all they want. But when they are willing to hold up cops as inexcusably perfect,
[27:36.320 --> 27:40.960] no matter what they do wrong and how they do it and make excuses for them, say,

[33:41.600 --> 33:50.000] is out of Tucson, Arizona, the Pima County Sheriff's Department. You have what appears to be a fat
[33:50.000 --> 33:59.120] slob of a deputy pumbling and laying on top of a 15-year-old quadriplegic in the hallway of a
[33:59.120 --> 34:10.480] group home. Now, he has no reason to assault this kid, which the video of the event clearly shows.
[34:10.480 --> 34:15.440] There's no way for this kid to be attacking him, to run away from him, to do anything other than
[34:15.440 --> 34:22.880] raise his voice at this deputy. Who, of course, takes a personal affront to having a 15-year-old
[34:22.880 --> 34:28.800] raise his voice to him because he is such a professional that he is so far above all that
[34:28.800 --> 34:38.080] that his wrath should be allowed to take precedent over anything else in the situation when he feels
[34:38.080 --> 34:45.200] disrespected as a police officer. So what does he do? He physically assaults the 15-year-old
[34:45.200 --> 34:56.000] quadriplegic in the hallway for eight minutes. Curses at him, shoves him, screams in his face.
[34:56.000 --> 35:02.800] Now, remember, this is a group home. The kids here are already under a lot of stress and strain
[35:02.800 --> 35:07.440] to even be there. Yes, some of them are there because they did things wrong. Some of them,
[35:07.440 --> 35:13.200] however, are not, and yet this deputy is treating everybody in here as if they're a hard case criminal,
[35:15.520 --> 35:23.360] including the quadriplegic. Now, fortunately, the only video that exists of this assault
[35:24.880 --> 35:33.280] is by another kid who was also in the group home who began secretly recording this encounter when
[35:33.280 --> 35:37.840] this cop was doing this, and there was two cops there. And like I was saying before we went to
[35:37.840 --> 35:44.080] break, I don't care if you're a direct participant. When you are doing nothing to stop it, nothing to
[35:44.080 --> 35:50.720] report it, and nothing to make the individual doing it stop, you are every bit as guilty and
[35:50.720 --> 35:58.240] culpable as they are. And that's exactly what happened in this case. Now, the second cop knows
[35:58.240 --> 36:04.240] that the kid recording, after they find out he is recording, has done absolutely nothing wrong,
[36:04.240 --> 36:08.960] other than when the cop screams in the face of the quadriplegic to shut the F up,
[36:11.120 --> 36:19.280] he'll scream in his face if he wants to, and the kid recording while he was standing in the hallway
[36:19.280 --> 36:22.880] eating his cereal because they're not allowed apparently according to what he tells his cop
[36:22.880 --> 36:35.120] to eat food in their rooms, that the quadriplegic kid was asked a question by the cop, and the kid
[36:35.120 --> 36:39.680] responded to the cop, and then the cop got in his face and screamed at him and told him to shut up.
[36:40.800 --> 36:45.440] And this kid said all he did was answer your question. So the cop turns on the kid recording
[36:45.440 --> 36:49.840] and starts screaming at him to go to his room and leave and all this kind of stuff, which he has no
[36:49.840 --> 37:00.320] legitimate authority to do. And the kid says he's eating, he can't go to his room. So the cop then
[37:00.320 --> 37:07.680] gets up and tells this kid that he's arresting him as well as the quadriplegic kid. He's going to
[37:07.680 --> 37:12.160] charge them both with disturbing the peace, a complete and total falsehood from the word go,
[37:12.160 --> 37:15.040] but he's going to get away with it at least for the time being.
[37:15.040 --> 37:24.560] So when he turns the kid around and the second officer is helping him to handcuff a kid,
[37:24.560 --> 37:33.440] he knows has done absolutely nothing wrong. The first deputy grabs the kid by the head
[37:33.440 --> 37:48.640] and slams it into the wall, which is also recorded. No provocation, no warning, no need to do so,
[37:48.640 --> 37:54.480] no resistance from the kid. The deputy just grabs him and slams his head as hard as he can into the
[37:54.480 --> 38:02.880] wall. And the other deputy stands there and lets it happen. And then takes the kid that just got
[38:02.880 --> 38:12.000] his head slammed into the wall, out into a patrol car and locks him in it. Like I said,
[38:12.800 --> 38:18.640] you're either a knowing and willing participant or you're covering for those who are.
[38:22.240 --> 38:28.000] There is no in between, there is no if and so but you cannot keep your nose clean
[38:28.000 --> 38:33.040] when these are the things that you do. You can't be a good cop.
[38:38.720 --> 38:44.160] All these patriots out here that are saying it's an oxymoron to say sovereign citizen.
[38:44.160 --> 38:48.240] Let me tell you what's a bigger oxymoron, the phrase good cop.

[39:10.240 --> 39:16.240] leave months after this happened and somebody finally brought the video in which was some public
[39:16.240 --> 39:22.560] defenders. They finally put this cop on administrative leave, which means he's going to get a paid
[39:22.560 --> 39:33.040] vacation. But what do you think is going to actually happen to him? Something is very, very wrong
[39:34.640 --> 39:43.280] in these United States of America when we the people must endure these kinds of actions
[39:43.280 --> 39:48.960] by those who are supposed to serve and protect us and those who are supposed to serve us in
[39:48.960 --> 40:01.760] general as their bosses. When their policy can be written in a way that allows actions like this to
[40:01.760 --> 40:11.280] occur in violation of our individual rights rather than the courts upholding the Bill of Rights over
[40:11.280 --> 40:22.720] any sort of policy. This is the government legitimizing its own criminal conduct to gain
[40:22.720 --> 40:29.120] the upper hand over the people it was put in place to serve. And this has been going on
[40:29.120 --> 40:38.560] since day one. Since day one, the metamorphosis has been ongoing to convert us back into something
[40:38.560 --> 40:44.480] we're not supposed to be and that the initial revolution set us free from being.
[40:50.080 --> 40:55.200] But it's like trying to climb up a grease lag pole apparently because we're sliding right back to
[40:55.200 --> 41:03.760] the bottom and starting right back over from ground zero except now it is a thousand times worse.
[41:03.760 --> 41:18.240] Because there's more of them and there's less of us that know it's wrong. And now not only would we
[41:18.240 --> 41:25.280] have to fight those in power, we would have to fight those that support those in power. Something

[41:31.200 --> 41:35.840] were willing to just stay at home and out of the way and not take sides if they thought they could
[41:35.840 --> 41:41.840] get away with it. Then there are those that are willing to jump in on the wrong side
[41:44.320 --> 41:47.360] to stop what is most assuredly coming.

[47:19.040 --> 47:26.800] are trying to tax my federally patented property. Can I use any of that material that you were
[47:26.800 --> 47:35.280] telling us today against a county tax collector? I don't know. I don't know specifically what
[47:35.280 --> 47:39.840] all you're referring to and what I said. You got to remember when I do these shows or I do
[47:39.840 --> 47:46.480] presentations, I very, very, very rarely ever prepare this stuff in advance and everything I
[47:46.480 --> 47:52.400] say and do is completely off the top of my head in the moment. I react to what comes out of my
[47:52.400 --> 47:58.880] mouth and what comes out of the audience and that's it. I cannot for the life of me tell you

[49:06.400 --> 49:12.560] and foremost issue is breach of contract. That land patent is a binding contract upon the state
[49:12.560 --> 49:17.120] and or the federal government and any subsequent errors in the signs of that federal government,
[49:17.120 --> 49:25.600] which is the state of Arizona, when it comes to that property. Okay. So if it says that the person
[49:25.600 --> 49:34.640] under whose control it originally was relinquishes all claims and titles forever to the person named
[49:34.640 --> 49:42.160] in the patent, then there is no question that that binding contract prohibits them from ever
[49:42.160 --> 49:49.760] having any control over that land again. Okay. Okay. Wait, wait. Back up a little bit here.
[49:49.760 --> 49:58.480] Let's clarify this. Okay. Arizona was not a state. I know that all the land grants under patent in
[49:58.480 --> 50:06.000] Arizona were federal. I know that. Oh, okay. Okay. So if the federal government gave it away
[50:06.000 --> 50:14.000] via patent before Arizona became a state, even if it that territory now lies within the territorial
[50:14.000 --> 50:21.120] boundaries of Arizona, it's the rights and privileges afforded the owner passed to the state of Arizona.
[50:21.120 --> 50:30.880] How? It should have never passed to them. It didn't with the pain of title. How could it? How could it
[50:30.880 --> 50:41.920] have? The government waived the federal government waived all rights to the land when they gave away
[50:41.920 --> 50:47.840] the patent. True? Okay. That was another question. No. Wait a minute. Answer the question. Follow
[50:47.840 --> 50:57.360] along. Play the game. True? Okay. When they gave the land via patent to the heirs and assigns
[50:58.160 --> 51:04.320] and the person named in the patent, they relinquish all claims and titles to that land forever,
[51:04.320 --> 51:12.400] then all rights to that land in every form and fashion passed to the person named in the patent.
[51:12.400 --> 51:23.760] True? Yes. Okay. So if the federal government then authorizes the creation of a new state called
[51:23.760 --> 51:29.120] Arizona and says these are your territorial boundaries,
[51:29.120 --> 51:40.560] how then can they take land that they've already relinquished claim to and say we are also giving
[51:40.560 --> 51:54.320] you this so you can tax it? Okay. I'll follow that. And considering that they have no rights to the
[51:54.320 --> 52:00.880] state of Arizona for the purpose of taxation, how then did Arizona get it? The only way they could
[52:00.880 --> 52:09.440] have gotten it was either by a law that allowed someone to put their land up for taxing purposes
[52:09.440 --> 52:16.480] for the course of drawing out money to finance a particular piece of legislation,
[52:17.520 --> 52:22.320] okay, which is what the property taxes are supposed to be when it comes from private
[52:22.320 --> 52:28.960] landowners. If they want to vote yes on some financial item that the government wants and
[52:28.960 --> 52:36.160] needs money for, they offer up a parcel of their land of X value and they agree to pay X value in
[52:36.160 --> 52:43.200] taxes or surrender the land for the purposes of sale to pay those taxes. It's a pledge.
[52:45.600 --> 52:50.640] But if they don't make that pledge and they don't make an agreement to make that pledge,
[52:50.640 --> 52:58.400] then the state of Arizona has no legitimate claim to the land on which they live and hold
[52:58.400 --> 53:03.120] title under the patent to do anything any more than the federal government does.
[53:05.920 --> 53:17.440] Okay. So since that is a contract between the original patent holder and all their
[53:17.440 --> 53:27.840] heirs and assigns forever, then they can sue for breach of contract when the government attempts
[53:27.840 --> 53:33.600] to do something. See, the state of Arizona is not even a party to that agreement. They have no standing
[53:33.600 --> 53:45.280] to be a party to that agreement. Okay. Okay, but no one is suing the state of Arizona for an
[53:45.280 --> 53:51.360] attempted breach of contract or a conversion. That's an even better. It's a form of fraud.
[53:52.000 --> 53:57.520] They're attempting to convert privately held land under a patent from the federal government
[53:57.520 --> 54:05.920] into state owned and taxable land. That's conversion. That's fraud.
[54:05.920 --> 54:20.480] Okay. Okay. Now, in the archive, you had mentioned that it also violates a provision
[54:20.480 --> 54:27.200] of the Interstate Commerce Clause. Wait, say that again?
[54:28.960 --> 54:34.240] You had said that it violates a provision of the Interstate Commerce Clause.

[55:38.160 --> 55:43.040] It's the Brooklyn Bridge argument. Now, I got a bridge for you. Is there, I mean,

[01:06:44.560 --> 01:06:52.240] the greatest stand of redwoods in the world. And these guys are kind of that crazy trying to
[01:06:53.120 --> 01:06:59.600] keep people from using their old historic trails and their old, you know, infrastructure trails
[01:06:59.600 --> 01:07:07.520] that went to like power lines and things. And their solution is on public land. Yeah, it's a
[01:07:07.520 --> 01:07:12.960] big system of regional parks throughout this state and apparently it's the biggest in the country.
[01:07:15.520 --> 01:07:23.280] So, these guys, and I think it has to do with just the number of people coming into these areas that
[01:07:23.280 --> 01:07:28.480] are undesignated trails, these guys are, because I think they understand the liability issues,
[01:07:28.480 --> 01:07:33.920] they're getting volunteers to come in and they're just handing them chains. I was saying, look,
[01:07:33.920 --> 01:07:37.920] you got to close this stuff down. We don't want anyone going through there. And literally, they're
[01:07:38.880 --> 01:07:44.000] cutting down to try to close these trails with the chains. They're just wiping out the forest in
[01:07:44.000 --> 01:07:54.240] certain areas. And of course, the issue now with our fire situation is it's created this fuel load
[01:07:54.240 --> 01:07:59.680] that they've taken a couple fire department friends out there and their jaws hit the table.
[01:07:59.680 --> 01:08:06.080] They're like, oh my God, but everybody's too afraid because of the implications, the legal and
[01:08:06.080 --> 01:08:11.600] the insurance and all that to say anything about it. I've talked to Cal Fire, they're too afraid.
[01:08:11.600 --> 01:08:15.200] They said, oh my God, and you could hear them rustling the background saying, hey,
[01:08:17.040 --> 01:08:21.040] you're going to have to go to the press with this. They don't want to touch it with a 20 foot pole.
[01:08:21.040 --> 01:08:30.400] And just to give you some contrast, the city, because they have their set of parks here,
[01:08:30.400 --> 01:08:35.520] nowhere near as big as the regional guys, they come out there with their goats and they
[01:08:35.520 --> 01:08:39.680] clean everything up. And if their tree falls down, they'll clean it up and everything. But the big
[01:08:39.680 --> 01:08:45.520] boss hogs, the regional guys, they don't care. There's fire or fuel loads coming right up to the
[01:08:45.520 --> 01:08:51.040] road where their property, the budget, public, their affairs. So I don't know. I imagine it's
[01:08:51.040 --> 01:08:54.880] not a heck of a lot you could do as a citizen, but I thought I'd run that by you.

[01:21:21.520 --> 01:21:27.520] sheriff's deputy, he looks at me and says something. I can't, I mean, those, those ambulances,
[01:21:27.520 --> 01:21:35.680] those decals, they're loud, man. And anyway, he says later on that he told me three times,
[01:21:35.680 --> 01:21:40.880] but I swear I couldn't hear him. But what he was telling me was that there's a medical
[01:21:40.880 --> 01:21:47.120] emergency and we've got it handled. And so I said, well, someone called me
[01:21:48.240 --> 01:21:52.960] and told me that you guys were here. I said, so I came up to check. He said, well,
[01:21:52.960 --> 01:21:59.760] they should mind their own business. We got it handled. So I'm like, okay,
[01:22:00.960 --> 01:22:08.320] we got it handled. I said, so I waited for him. And they came back out. And when the cop came out,
[01:22:08.320 --> 01:22:14.160] he's talking to me. And he's going, he says, first of all, I told you three times. I said,
[01:22:14.160 --> 01:22:19.040] well, I can't hear you. It's loud. He said, but he said, I could hear you. I said, yeah,
[01:22:19.040 --> 01:22:24.400] but you're inside an ambulance. I'm outside next to the engine. And I can't hardly hear you, you
[01:22:24.400 --> 01:22:33.120] know. So we were having that little discussion. And then he says, then he keeps telling me,
[01:22:33.120 --> 01:22:38.400] I asked first to ask him for a card. He said he didn't have a card. And I thought they always
[01:22:38.400 --> 01:22:46.080] carried cards, but I guess not. And he told me his name, Fitzgerald. And I didn't recognize him
[01:22:46.640 --> 01:22:51.040] because he looks like he put on about 30 pounds. Wouldn't Benny Fitzgerald, was it?

[01:23:21.920 --> 01:23:27.280] goes, yeah, I know who you are. He says, yeah, you're the one that filed the little warning against
[01:23:27.280 --> 01:23:35.360] me. I'm the one that Randy had me file a T-close complaint against him because when they were
[01:23:35.360 --> 01:23:43.520] taking me to civil court, they then were harassing me again. They wrote me up for another vehicle
[01:23:43.520 --> 01:23:49.040] out on my property. And so I had to go to court for that. And I was trying to keep from entering
[01:23:49.040 --> 01:23:54.960] a plea. So I was talking to the prosecutor when they called me up. And I recorded the entire
[01:23:55.520 --> 01:24:02.960] scenario. And she was getting flustered, but I was not. It's all in the recording. So when I
[01:24:02.960 --> 01:24:10.320] turn around finally to go back to my seat, he's already made his way up behind my wife. And when
[01:24:10.320 --> 01:24:19.440] me and him meet eye to eye, he gives me this threatening look. And so I sit down, I'm like, what?
[01:24:19.440 --> 01:24:25.120] It's just got looking at me like that. And my wife said, sit down before you go to jail, you know.
[01:24:26.240 --> 01:24:30.560] And I sit there with a pen and a paper. So I just walk up to him and I said, what is your name?

[01:34:23.760 --> 01:34:30.160] that I requested the administrative hearing, I think you know the story, the writ of mandamus
[01:34:31.520 --> 01:34:36.640] by the Second Court of Appeals overruled the administrative hearing because it was never
[01:34:36.640 --> 01:34:45.040] adopted into the municipal ordinances as required by statute. So the main thing that
[01:34:45.040 --> 01:34:54.800] they took me to court for and got a restraining order was because of irreparable damage and so
[01:34:55.440 --> 01:35:01.920] I never could really figure out what they meant by irreparable damage. Something irreparable
[01:35:01.920 --> 01:35:08.640] means that it can't be replaced monetarily so maybe they were talking about loss of life
[01:35:08.640 --> 01:35:16.240] or something but I mean I'm an auto repair facility you know. So when it comes down to the
[01:35:16.240 --> 01:35:28.080] non-conforming use issue, if I am a shop that was taken over from another shop that was taken
[01:35:28.080 --> 01:35:33.200] over from another shop all the way back to its inception right after the incorporation of the
[01:35:33.200 --> 01:35:44.640] city, what I found out was that the zoning of our town I don't think was started until
[01:35:45.440 --> 01:35:54.000] year 2000. It was dissected up into the commercial residential mobile homes and things like that
[01:35:54.000 --> 01:36:04.240] in industrial and if that's the case then unless they can actually prove through a trial
[01:36:05.120 --> 01:36:10.400] that I had junked vehicles then they can't really get a restraining order against me
[01:36:11.200 --> 01:36:18.800] for that. Is that correct? Am I thinking straight? Well the seeking of a restraining order doesn't
[01:36:18.800 --> 01:36:28.960] require a trial. Right. It may require a hearing but not a trial. Yeah well they it was a I can't
[01:36:28.960 --> 01:36:34.480] remember what they call it but where only one side is heard for the restraining order yeah

[01:36:41.200 --> 01:36:49.360] two weeks later and so I went and of course all I did was challenge subject matter jurisdiction and

[01:37:13.040 --> 01:37:23.040] know exactly what I need to do but there's parking ordinances where I park on my property

[01:37:29.600 --> 01:37:40.480] permit but those are ordinances that were not uh written up until 2009 and so I've been there since
[01:37:40.480 --> 01:37:50.320] 95 and if that's the case then what is it you're wanting to park next door there's a church next
[01:37:50.320 --> 01:37:55.840] door has no I know what's next door what are you wanting to park there I parked vehicles

[01:42:08.000 --> 01:42:12.000] you're going to have to go through the city to get it you're going to have to sue the city and the
[01:42:12.000 --> 01:42:16.640] city attorney because they're the ones that did it and they did it at the behest of the city which
[01:42:16.640 --> 01:42:26.080] makes the city respond to superior you can't just go after the attorney right okay see that's the part
[01:42:26.080 --> 01:42:32.240] that is thrown me because uh that's one of the things that they threw my countersuit out was
[01:42:32.240 --> 01:42:42.560] because I had sued the employees and the uh city both at the same time so because I sued the city
