[01:14.240 --> 01:19.000] court stop the state from flagging about 95,000 people as potentially illegally registered

[01:20.000 --> 01:25.280] This was compiled after an 11-month-long investigation by the Office of the Texas Secretary of State
[01:25.280 --> 01:30.040] and the Texas Department of Public Safety, which sought to identify non-U.S. citizens
[01:30.040 --> 01:33.360] who were registered to vote when obtaining major arbitrage license.
[01:33.360 --> 01:37.080] Over half of the 95,000 didn't indeed vote, it seems.
[01:37.080 --> 01:41.080] However, further controversy was raised when it became clear that some of the names were
[01:41.080 --> 01:45.280] not in fact belonging to those who were non-citizens and registered.
[01:45.280 --> 01:49.960] Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote
[01:49.960 --> 01:50.960] to vote.
[01:50.960 --> 01:55.200] Registered voters who receive letters querying their citizenship have 30 days to respond
[01:55.200 --> 01:57.040] with proof of eligibility.
[01:57.040 --> 02:01.200] Texas Attorney General Ken Paxton and David Whitley, the Texas Secretary of State, have
[02:01.200 --> 02:08.960] yet to officially comment regarding this list and any updates pertaining to it.

[04:02.600 --> 04:09.480] Alright, before I turn the phones on, something I want to get into here is there is a case
[04:09.480 --> 04:13.880] that is currently going up before the United States Supreme Court that originated here
[04:13.880 --> 04:23.080] in Texas, and that case is Scott Ogle, I guess is how you pronounce his name, it's O-G-L-E,
[04:23.080 --> 04:25.480] versus the state of Texas.
[04:25.480 --> 04:33.440] Now the premise of the case is this, Mr. Ogle is being charged with a Class A misdemeanor
[04:33.440 --> 04:41.600] under penal code section 42.07, which criminalizes speech.
[04:41.600 --> 04:49.920] On its very face it is unconstitutional, it has always been unconstitutional.
[04:49.920 --> 04:54.160] We have numerous cases in Texas that have been decided previously by the Court of Criminal
[04:54.160 --> 04:59.080] Appeals that says very clearly that these types of speech are absolutely protected and
[04:59.080 --> 05:07.160] no law can criminalize it, and at least up until this instance when it was used against
[05:07.160 --> 05:10.040] a sheriff's department.
[05:10.040 --> 05:18.880] Mr. Ogle emailed a sheriff's department and in two different emails criticized the sheriff
[05:18.880 --> 05:24.200] and one of his deputies for not doing their job.
[05:24.200 --> 05:29.360] Of course these government officials then turned around and attempted to press charges
[05:29.360 --> 05:35.920] against this man for his dissent of their perfect ability to be protected from any and
[05:35.920 --> 05:42.800] all harm to the public that they may engage in, including ignoring requests for assistance
[05:42.800 --> 05:51.680] that they are required to provide as the elected officials they are, but wouldn't do it.
[05:51.680 --> 05:55.120] Then this gentleman emailed them and criticized them for it.
[05:55.120 --> 06:02.080] So they turned around and pressed charges under 42.07, which is a Class A misdemeanor.
[06:02.080 --> 06:08.720] Now you would think common sense would be something courts would apply to cases.
[06:08.720 --> 06:10.000] It's not.
[06:10.000 --> 06:13.440] You would think that the courts would comply with the law.
[06:13.440 --> 06:14.920] They don't.
[06:14.920 --> 06:21.000] You would think that the courts would understand that there is not one but two constitutions
[06:21.000 --> 06:25.480] that play in these issues, but they don't.
[06:25.480 --> 06:33.800] The only argument anyone made in defense of Mr. Ogle relating to constitutionally acceptable
[06:33.800 --> 06:40.920] speech as protected speech was the United States Constitution.
[06:40.920 --> 06:48.320] They completely ignored the Texas Constitution in every aspect of this case as prohibiting
[06:48.320 --> 06:53.560] the state legislature from even making this law and enacting it.
[06:53.560 --> 06:55.400] You don't believe me?
[06:55.400 --> 06:56.400] Okay.
[06:56.400 --> 06:59.720] Well, let me show you exactly where to find proof of that.
[06:59.720 --> 07:07.120] The Bill of Rights, which is Article 1 of the Texas Constitution in Section 8, in pertinent
[07:07.120 --> 07:14.080] part, which happens to be the very first part of this section, reads as follows.
[07:14.080 --> 07:21.160] Section 8, freedom of speech and press and comma libel.
[07:21.160 --> 07:31.000] Every person shall be at liberty to speak, write, or publish his opinions on any subject.
[07:31.000 --> 07:39.040] Being responsible for the abuse of that privilege and no law shall ever be passed curtailing
[07:39.040 --> 07:47.040] the liberty of speech or of the press, period.
[07:47.040 --> 07:55.600] There is absolutely no way under the Texas Constitution a law that says a person commits
[07:55.600 --> 08:01.920] an offense if, with intent to harass, annoy, alarm, abuse, torment, or embarrass another,
[08:01.920 --> 08:06.360] they engage in speech that does any of these things.
[08:06.360 --> 08:15.200] And there is a constitutional mandate that prohibits them from ever creating a law that
[08:15.200 --> 08:20.640] curtail speech, period.
[08:20.640 --> 08:26.680] There is no way this statute was ever constitutional.
[08:26.680 --> 08:35.680] Yet every court in Texas, including our idiotic, moronic court of criminal appeals, which is
[08:35.680 --> 08:46.200] our criminal Supreme Court here in Texas, decided to use the very thing they refuse
[08:46.200 --> 08:52.040] to allow us to use to sway a court of opinion in our favor.
[08:52.040 --> 09:00.800] They used the dicta from court cases outside of Texas, not U.S. Supreme Court cases, either
[09:00.800 --> 09:09.760] state court cases, to avoid addressing the unconstitutionality of the Texas statute.
[09:09.760 --> 09:15.600] They just completely sidestepped it, okay?
[09:15.600 --> 09:21.200] That is how reliable your court system is in any state.
[09:21.200 --> 09:29.560] That is how criminal the elitist attorneys have become in denying the people the very
[09:29.560 --> 09:35.640] protections we wrote down for and reserved to ourselves in the documents that are supposed
[09:35.640 --> 09:47.600] to bind them in their acts and behavior, and which they continually refuse to comply.
[09:47.600 --> 09:52.040] They simply ignore it as if it does not exist.
[09:52.040 --> 09:57.760] And I am of the same opinion in relation to attorneys and the bar associations as I am
[09:57.760 --> 10:00.920] referring to police departments and police officers.
[10:00.920 --> 10:06.160] There is no such thing as a good cop and no such thing as a good attorney.
[10:06.160 --> 10:07.600] Why?
[10:07.600 --> 10:17.880] Because you cannot remain one of those things without looking the other way, participating
[10:17.880 --> 10:28.400] in and refusing to reveal or act in contradiction to the conduct of your brothers in blue or
[10:28.400 --> 10:36.920] your brothers in bar when they misbehave or commit outright crimes against the public
[10:36.920 --> 10:42.400] or any individual member of the public.
[10:42.400 --> 10:49.440] You can't be good and stay one of those, period.
[10:49.440 --> 10:57.400] They will either drum you out if you try or you will be forced out on your own if you
[10:57.400 --> 11:00.960] try.
[11:00.960 --> 11:02.800] There is no in between.
[11:02.800 --> 11:07.520] The only way to stay is to play the game their way and look the other way, keep your
[11:07.520 --> 11:14.880] mouth shut and only bring up an issue when it is so egregious that even they cannot risk
[11:14.880 --> 11:24.000] turning a blind eye without the public turning on every damned one of them and hanging them.
[11:24.000 --> 11:25.720] I used to not think that way.
[11:25.720 --> 11:31.600] I used to not have that sense of logic about the situation because when I went in, I honestly
[11:31.600 --> 11:36.280] believed I was there to try to do something good and that was my job.
[11:36.280 --> 11:41.280] But then when I did try to do something good and told the truth and was honest about it,
[11:41.280 --> 11:46.680] I was the one that was made to leave, not the one who had committed the wrongs who had
[11:46.680 --> 11:53.440] embezzled from the county and the people of the county, me, the guy who tried to report
[11:53.440 --> 11:56.240] it.
[11:56.240 --> 12:00.120] So there are no good attorneys.
[12:00.120 --> 12:05.920] There are no good cops because they are all willing to play by a set of rules that are
[12:05.920 --> 12:15.240] designed to violate everything that we hold dear in one way or another.
[12:15.240 --> 12:25.560] It's not any more difficult to conceive of than that as to why that logic is true, okay?
[12:25.560 --> 12:32.840] Now out of all the judges on the court that I would have never believed had I not read
[12:32.840 --> 12:42.560] it in the opinion that would have sided with Ogil on his case was presiding judge Sharon
[12:42.560 --> 12:43.560] Keller.
[12:43.560 --> 12:47.640] Now I've talked about Sharon Keller before.
[12:47.640 --> 12:55.920] She is the judge who allowed a death row inmate to be executed because she refused to keep
[12:55.920 --> 13:05.000] the court open past 5 p.m. knowing full well there was an effort being made via the governor
[13:05.000 --> 13:10.840] to get a stay of execution for the individual in question.
[13:10.840 --> 13:15.800] And she refused to keep the court open so that that process could be completed.
[13:15.800 --> 13:25.680] Thus, the person was executed despite having gotten a stay of execution.
[13:25.680 --> 13:33.960] But there was nowhere for them to go to file the stay to get an order to send to the prison
[13:33.960 --> 13:37.360] to not execute the guy.
[13:37.360 --> 13:39.920] Yeah, that's her.
[13:39.920 --> 13:46.360] And right here, she is actually taking the correct side in arguing that the entire court
[13:46.360 --> 13:52.160] of criminal appeals is wrong in trying to protect this statute.
[13:52.160 --> 13:54.680] This is something she said in her dissent.
[13:54.680 --> 13:59.480] Her decisions in Long v. State and May v. State and the Fifth Circuit's decision in
[13:59.480 --> 14:04.280] Kramer v. Price set the backdrop for the claim we now face.
[14:04.280 --> 14:09.800] These decisions invalidated statutes that contain the terms annoy and alarm as implicating
[14:09.800 --> 14:12.400] First Amendment freedoms and being unduly vague.
[14:12.400 --> 14:17.480] In its opinion today, the court's only attempt to distinguish these cases is to say that
[14:17.480 --> 14:22.880] they involve different versions of the harassment statute than the one that is currently before
[14:22.880 --> 14:25.800] us, okay?
[14:25.800 --> 14:30.560] Now, this is ridiculous.
[14:30.560 --> 14:36.240] She goes on to say, now we have a case in which the electronic communications harassment
[14:36.240 --> 14:42.840] statute has been invoked to punish communications made to police officers.
[14:42.840 --> 14:47.960] If this court believed that the prosecuting authorities would never use this statute to
[14:47.960 --> 14:53.680] punish criticism of agents of the government, it ought to now recognize that such a belief
[14:53.680 --> 14:56.040] was overly optimistic.
[14:56.040 --> 15:00.440] Given the breadth of the electronic communications harassment statute and the potential to use
[15:00.440 --> 15:04.880] it to suppress criticism of the government, we should grant review to address whether
[15:04.880 --> 15:09.880] the statute is facially unconstitutional in violation of the First Amendment because
[15:09.880 --> 15:15.040] the court does not irrespectfully dissent, okay?
[15:15.040 --> 15:19.760] Now, why is this statute a problem?
[15:19.760 --> 15:26.520] Well, let me tell you, because the way it is worded and written, this statute can be
[15:26.520 --> 15:35.200] used to prosecute you for an arrestable, imprisonable offense for up to a year just because someone
[15:35.200 --> 15:38.280] reported one of your Facebook or Twitter posts.
[15:38.280 --> 15:41.680] How you like dim apples?
[15:41.680 --> 15:46.760] Everybody felt alarmed that you called them a name or that you said, I'll meet you anywhere
[15:46.760 --> 15:50.960] in any time and kick your little butt if you think you can kick mine, blah, blah, blah,
[15:50.960 --> 16:00.160] blah, blah, blah, and now you are a class A misdemeanor, try to convict an individual.
[16:00.160 --> 16:02.640] Get it?
[16:02.640 --> 16:07.760] You can call up any of your public service to say, what the hell are you people doing?
[16:07.760 --> 16:10.400] Why can't you do your job correctly?
[16:10.400 --> 16:14.720] Why aren't you sending anyone out here or doing this or doing that when the law says
[16:14.720 --> 16:16.960] very clearly that is your duty?
[16:16.960 --> 16:22.040] I am very upset and unhappy with the way that you perform in these duties and the next time
[16:22.040 --> 16:27.240] the vote comes up, I will not vote for you and I will do my best to see that no one else
[16:27.240 --> 16:28.240] does either.

[25:36.000 --> 25:40.000] So I asked for the report, I read the report and that officer wrote the report
[25:40.000 --> 25:45.000] And he made it sound like as if I attacked a policeman or born the deputy
[25:45.000 --> 25:52.000] And then he made her statement, the neighbor's statement, sound kind of benign
[25:52.000 --> 25:58.000] I mean, you know, it's just so insane, so I called, I looked at the report for two days
[25:58.000 --> 26:02.000] And I said, you know what, I've just not been assessed for that because other officers are going to read that
[26:02.000 --> 26:06.000] And they're going to say that I'm hostile towards law enforcement
[26:06.000 --> 26:12.000] Yeah, and the next time you have to call somebody, you're going to get a hostile reception from them when they show up
[26:12.000 --> 26:17.000] Because they're going to go back and review everything they've got on you before they get there, guaranteed

[26:21.000 --> 26:27.000] Now, just one other thing, Ralph, I don't mean to keep interrupting you, but there's one other thing I'd look at because of that

[27:42.000 --> 27:49.000] So here I am listening to you, and I'm thinking, man, the letter I was going to write is kind of hot

[27:53.000 --> 28:03.000] That's just it, there's nothing, there's nothing in the law that I was reading that makes any indication as to whether or not it has to be insulting

[28:07.000 --> 28:17.000] And they can still prosecute you under it just by stating I felt threatened, harassed, or embarrassed by what the language meant

[35:06.000 --> 35:08.000] I don't think I'd like to meet him
[35:08.000 --> 35:11.000] Whereas three other deputies I talked to didn't have any problem with it at all

[35:13.000 --> 35:18.000] But what you're talking about, it looks to me like
[35:18.000 --> 35:21.000] They're going to push, and I say they, we know who they are
[35:21.000 --> 35:24.000] They're going to push and push and push because they don't care

[35:27.000 --> 35:31.000] Then they're going to act like that we fired the first shot
[35:31.000 --> 35:34.000] So it's a catch point too, you know

[35:38.000 --> 35:43.000] Most of us are trying to go out there and do something via paperwork

[35:48.000 --> 35:52.000] But it looks to me like they're just going to just ride right over us
[35:52.000 --> 35:56.000] And eventually, you know, maybe six months, maybe six years
[35:56.000 --> 36:00.000] They're just going to walk up to you and, you know, put a chip in you
[36:00.000 --> 36:01.000] And say, so what?
[36:01.000 --> 36:02.000] What are you going to do about it?
[36:02.000 --> 36:04.000] Because we're not doing anything about anything
[36:04.000 --> 36:07.000] When I try to talk to people, they just ignore me
[36:07.000 --> 36:10.000] I told somebody I can explain what's wrong with the country in 90 seconds
[36:10.000 --> 36:13.000] And they just wouldn't even ask me what's wrong with the country

[36:16.000 --> 36:22.000] Legislature writes laws and then local prosecutors interpret those laws to apply to people they don't apply to
[36:22.000 --> 36:26.000] That's a big part of it right there, that's it in 10 seconds
[36:26.000 --> 36:30.000] You know, if we don't stand up and tell the prosecutors, hey, do you not have that right?
[36:30.000 --> 36:31.000] You know?
[36:31.000 --> 36:35.000] Well, I'm going to start to rant here and that's not my place
[36:35.000 --> 36:39.000] I was going to ask you, I don't know what I was going to ask you
[36:39.000 --> 36:44.000] I guess I'll just tell you, I used your motion to quash and it hasn't quashed it
[36:44.000 --> 36:46.000] But I haven't heard anything from the court
[36:46.000 --> 36:52.000] So I went to talk to the court and the court said, oh, your papers aren't here
[36:52.000 --> 36:54.000] They said, your files aren't here
[36:54.000 --> 36:55.000] So what were they?
[36:55.000 --> 36:58.000] They said, oh, it's all at the prosecutor's office
[36:58.000 --> 37:04.000] They're studying it and they're going to have a hearing on your motion to quash
[37:04.000 --> 37:10.000] And I said, okay, so I went off to the prosecutor's office
[37:10.000 --> 37:13.000] And I said, I'd like to see my file
[37:13.000 --> 37:16.000] And so the lady asked my information and gave it to her
[37:16.000 --> 37:20.000] And it took her quite a while and she quickly trips inside the prosecutor's office
[37:20.000 --> 37:23.000] Which was what I never saw, but I could hear him in there talking
[37:23.000 --> 37:27.000] So finally she comes out with a copy of the citation
[37:27.000 --> 37:30.000] And she wants me to sign a paper saying I got it
[37:30.000 --> 37:32.000] And I said, okay, where's the rest of it?
[37:32.000 --> 37:36.000] She said, this is all at the JP Court Senate
[37:36.000 --> 37:38.000] They sent him only the citation
[37:38.000 --> 37:43.000] And then told you there was nothing that they didn't have your filed prosecutor did
[37:43.000 --> 37:44.000] Correct
[37:44.000 --> 37:51.000] Okay, I filed a criminal complaint against both the court clerk and the prosecuting attorney's office
[37:51.000 --> 37:56.000] With the state attorney general's office for denying access to a public record
[37:56.000 --> 38:00.000] And secreting public records from a member of the public
[38:00.000 --> 38:06.000] While refusing to disclose said records under the Public Information Act
[38:06.000 --> 38:11.000] 552.353
[38:11.000 --> 38:12.000] Okay
[38:12.000 --> 38:18.000] File criminal charges against both of them
[38:18.000 --> 38:21.000] The prosecutor and the court clerk
[38:21.000 --> 38:24.000] Now it was the actual judge that told me the court clerk wasn't there

[39:50.000 --> 39:58.000] But the Public Information Act specifically names the state attorney general as the responsible party

[40:04.000 --> 40:15.000] He is the one that is responsible for prosecuting a public official for violations of state law relative to administrative procedures

[41:15.000 --> 41:26.000] Well, you need to file charges with the grand jury then against that judge for interfering with your ability to report a crime of which you became aware

[42:12.000 --> 42:16.000] She said, well, I'm gonna have to study this and take a look at it
[42:16.000 --> 42:22.000] That's mean that she's more to talk to the prosecutor, she said, and I said, well, I'm here for an examining file
[42:22.000 --> 42:26.000] Would you like to set a date for an examining file?
[42:26.000 --> 42:30.000] Two determined to get a sufficient fee of my criminal complaint
[42:30.000 --> 42:35.000] She said, yeah, but I want to study them first then we'll set a date

[42:58.000 --> 43:03.000] So I don't have the rule right in front of me, but it's somewhere in the government

[47:55.000 --> 48:09.000] and I told them why I was incapable of pleading at the moment because I didn't have anything except for the citation to go off of as to, you know, my accusers and things like that
[48:09.000 --> 48:18.000] So, they sent me, I guess the prosecutor entered a plea of not guilty and sent it for me

[51:53.000 --> 52:08.000] The entire deal there like separating the chickens from their feathers and their skin and their other parts is to separate you from the law, your rights, your protection, your money for their benefit
[52:08.000 --> 52:17.000] And when you fail to know in advance that that is the entire objective, you cease to make the effort to protect any part of it

[52:21.000 --> 52:31.000] So, when the prosecutor does something the law does not authorize and the court does nothing to prevent it
[52:31.000 --> 52:42.000] In fact, insists on allowing it to happen, that's when you've got a conspiracy against rights situation that you need to be addressing for the record
[52:42.000 --> 52:51.000] So, you need to be filing a written objection about the prosecutor determining what your plea was going to be and entering it
[52:51.000 --> 53:04.000] Using a power specifically reserved to the judge of the court and the plea was not entered in open court or voluntarily by you to anyone

[53:12.000 --> 53:30.000] And the judge allowed his power to be usurped or directly delegated it to the prosecuting attorney and thus is guilty of bias and prejudice against the defense

[53:34.000 --> 53:44.000] You're going to file a written objection in your case naming both the prosecutor and the judge as criminally conspiring to deprive you of your right of due process

[54:55.000 --> 55:11.000] And then you're going to cite your criminal complaint against that judge, your judicial conduct complaint against that judge and his prejudice and bias as grounds for disqualification
[55:11.000 --> 55:22.000] Okay, I have a complaint for judicial misconduct and against the bar prosecutor, I think there was one that I missed
[55:22.000 --> 55:30.000] No, that's correct, you're going to file one with the bar association against the prosecutor
[55:30.000 --> 55:34.000] You're going to file one with the judicial conduct complaint against the judge
[55:34.000 --> 55:47.000] And then you're going to send a copy of the judicial conduct complaint and a motion to disqualify along with your written objection to the head administrative judge of the district who oversees the judges that operate within that district
[55:47.000 --> 56:02.000] And the motion to disqualify is going to ask the judge in your case to be disqualified and not allowed to sit in any other pending cases because he repeated that process the entire day that you were there
[56:02.000 --> 56:08.000] And most likely does it every day that they have a session in that court for this purpose
[56:08.000 --> 56:20.000] Thus, there are hundreds of tainted cases that that judge oversaw or failed to oversee properly and allowed the prosecutor to steamroll everyone with
[56:20.000 --> 56:37.000] Okay, now I have a question also Eddie, after I got these four citations, I was pulled over again and issued two more, but this time just for the failure to present ID and the registration
[56:37.000 --> 56:42.000] So I guess I just follow that same process once those come in as well
[56:42.000 --> 56:56.000] Yes, the problem with failure to present ID is there is nothing in Texas that requires you to physically present any form of ID because there's nothing in law that can compel you to get a physical form of ID
[56:56.000 --> 57:09.000] Now with that time, with the second stop, I didn't present him the ID, but I did as your advice and the law give him my name as his opponent
[57:09.000 --> 57:20.000] Okay, so did he charge you with failure to ID, did he charge you with failure to present an ID or failure to present a driver's license?

[01:34:42.120 --> 01:34:55.120] I referred this one victim to your show and some guy with a smiley face and no, you know, whatever, come up and say,
[01:34:55.120 --> 01:35:02.120] No, you can't go to this grand jury because the district attorney takes care of that.
[01:35:02.120 --> 01:35:06.120] And I said, you know what? I'll give you $1,000, which I don't have.
[01:35:06.120 --> 01:35:14.120] If you could show me a law that says that a district attorney has the right to find probable cause.
[01:35:14.120 --> 01:35:17.120] Now, am I right or wrong?
[01:35:17.120 --> 01:35:19.120] You're right. They don't.
[01:35:19.120 --> 01:35:21.120] Okay, okay, so...
[01:35:21.120 --> 01:35:28.120] Nor do they have any authority whatsoever to prevent the public from accessing the grand jury and filing complaints directly with them.

[01:35:35.120 --> 01:35:42.120] Well, I don't know that I've ever done an article on that specifically on my blog, but Texas law is very clear about it.

[01:35:45.120 --> 01:35:53.120] The district attorney is the only one that can make a presentment of a case to the grand jury,
[01:35:53.120 --> 01:36:02.120] but he is not the only one who can inform the grand jury of criminal conduct by another individual.
[01:36:02.120 --> 01:36:08.120] Any credible person is how the law writes it up.
[01:36:08.120 --> 01:36:12.120] Right, so if you're a felon, forget about it. You're going to need a lawyer.
[01:36:12.120 --> 01:36:25.120] Yeah, and for that matter, in accordance with that, that's exactly why prosecutors are not allowed to be the ones that initiate prosecutions via the grand jury.
[01:36:25.120 --> 01:36:31.120] The prosecutor cannot sign the complaint and file it with the grand jury to get an indictment.
[01:36:31.120 --> 01:36:42.120] That right there is prohibited. Why? Because under the auspices of Supreme Court rulings, the prosecutor is not a credible person.
[01:36:42.120 --> 01:36:50.120] I know. I've heard this like four or five times over the years. I've been listening and participating.
[01:36:50.120 --> 01:37:08.120] Okay, so then I'm correct. I don't have to worry about it. Okay, so I've referred, like I said, I've been planting the calling number, the times and everything to people who aren't going to cause trouble, you know,
[01:37:08.120 --> 01:37:20.120] and maybe contribute to the network because I can't. I'm on fixed income and I'm trying. I have stuff, but I can't get rid of it.
[01:37:20.120 --> 01:37:27.120] I can have cars and stuff. Do you need a Lexus?

[01:37:34.120 --> 01:37:56.120] So anyways, I love you guys and I really, really feel for you. There's a lot of ignorance out there and there's a lot of misinformation and people, I'm suspecting there are people that are actually trying to upset our movement.
[01:37:56.120 --> 01:38:11.120] So, because it can't be that quick for that. Oh, yeah, there definitely are people out there that are trying to spread disinformation and prevent people from getting actual factual information about these things.

[01:38:16.120 --> 01:38:27.120] Yeah, I'm sad that a lot of people don't understand how they got to keep their body clean because the stress levels of this stuff are so high that you just give up.

[01:38:57.120 --> 01:39:11.120] Well, along the same lines, sir. The grand jury is what I'm doing with a little bit here of what's been going on. I don't know how to refresh your memory a little bit.
[01:39:11.120 --> 01:39:24.120] It's Constable that's been having a few bits for about 14 years. He's only freshly been elected Constable, and I put on the radio this morning that he actually officially resigned today.
[01:39:24.120 --> 01:39:28.120] Anyway, he's under indictment for official oppression, official...
[01:39:28.120 --> 01:39:31.120] Well, gee, that sounds like a shocker.
[01:39:31.120 --> 01:39:45.120] Yeah, and well, those weren't my charges. I was trying to get him indicted for aggravated falcon harassment and vandalism.
[01:39:45.120 --> 01:39:47.120] They didn't charge him with any of that.
[01:39:47.120 --> 01:39:57.120] They used one of my aggravated falcon charges, a charge where he pulled me over for no reason.
[01:39:57.120 --> 01:40:03.120] He actually had his blue light on before I got out on the roadway. He was still going up and waiting on me.
[01:40:03.120 --> 01:40:07.120] And every time I come down to my house to work on it, I try to get ready to fail.
[01:40:07.120 --> 01:40:18.120] I've been in the neighborhood for 30-some years and been in the community for 14 years. So anyway, I knew what he was going to do, and I had my other neighbor on the other side to watch.
[01:40:18.120 --> 01:40:21.120] He didn't exactly what I said he was going to do.
[01:40:21.120 --> 01:40:27.120] That's what they charged him. I got affidavits from him and all of that.
[01:40:27.120 --> 01:40:34.120] So that's what they charged. That's what they actually... I kept pressing it, so they had to actually charge it.
[01:40:34.120 --> 01:40:39.120] It was just somewhere where I just let it go, and nothing would ever happen. But I wouldn't let it go.
[01:40:39.120 --> 01:40:47.120] So they finally charged him with official oppression and official misconduct, and then died into a grand jury.
[01:40:47.120 --> 01:40:53.120] And so his court date was supposed to be on the 26th, and nobody showed up.
[01:40:53.120 --> 01:40:58.120] We was there. They said that there was a plea agreement in the file.
[01:40:58.120 --> 01:41:09.120] When the judge told his man, they said there was a plea agreement in the file, and he would be there for trial on the 3rd of June.
[01:41:09.120 --> 01:41:11.120] So anyway, I sat down.
[01:41:11.120 --> 01:41:18.120] So anyway, on the last grand jury session was April 15th, and this is what my question is.
[01:41:18.120 --> 01:41:25.120] I went down there and asked if it's odd in Tennessee that they don't do the way they do in Texas,
[01:41:25.120 --> 01:41:31.120] because I was going by the brandy staff piece about how it works.
[01:41:31.120 --> 01:41:38.120] Here, I don't know if it's always the case, but on this last one, on the April 15th, there was no court going on.
[01:41:38.120 --> 01:41:43.120] The grand jury was there, and the judge, and all the bailiffs and all of that.
[01:41:43.120 --> 01:41:47.120] They were all in there doing that thing, but it was all sort of private.
[01:41:47.120 --> 01:41:53.120] I mean, you could go in there. I went in there to start with, and I didn't know I was kind of out of my element, so this is the first time I've done it.
[01:41:53.120 --> 01:41:59.120] So anyway, the guy at the mental inspector came in there and told me I didn't be in there.
[01:41:59.120 --> 01:42:07.120] And then finally, a little about an hour later after I got up a nerve, I walked back in there, and I just went up to the front and said,
[01:42:07.120 --> 01:42:16.120] is there a bailiff in here, and he came over there, and I said, I need you to inform the foreman that I got business with the grand jury.
[01:42:16.120 --> 01:42:20.120] So I was in at that point, but they let me step out all day.
[01:42:20.120 --> 01:42:27.120] And that was from 11 o'clock to about 3.30, making me think I was going to be all the officers and detectives,
[01:42:27.120 --> 01:42:30.120] and everybody went in and done their business, but I would just go.
[01:42:30.120 --> 01:42:43.120] But at the end of it all, the clerk came and gave me a copy of some laws that said that I had to have to present to the grand jury
[01:42:43.120 --> 01:42:52.120] that I had to have a written request, and I had it found so that they could have my name on the thing.
[01:42:52.120 --> 01:42:56.120] Which, you know, I was thinking, well, why would you let me be here all day?
[01:42:56.120 --> 01:43:05.120] But anyway, here, finally, to the question, it's a request.
[01:43:05.120 --> 01:43:14.120] Now, the clerk told me that it didn't be refused. It was the request. A request can be refused.
[01:43:14.120 --> 01:43:19.120] And he said, well, no, it can't be refused. But I went and talked to the DA after that.
[01:43:19.120 --> 01:43:26.120] After I left, they went down to the other office. It's kind of a small county, and there ain't a lot, but all of it's real close together.
[01:43:26.120 --> 01:43:32.120] So he told me that it can absolutely be refused.
[01:43:32.120 --> 01:43:42.120] Right. So what you should do is complain about the clerk giving legal advice without any knowledge and authority allowing them to do so.
[01:43:42.120 --> 01:43:47.120] So that's exactly what that clerk was doing when they told you what the law would or would not do in that case.
[01:43:47.120 --> 01:43:50.120] He had the copy. What happened, Rose?

[01:47:00.120 --> 01:47:23.120] I'm going to go ahead and I just put in my request to address the jury in June 3rd, and I've also got criminal charges in my folder for an assistant district attorney and a clerk.
[01:47:23.120 --> 01:47:33.120] The main clerk, he had gave me the district attorney, like I said, he told me about this. He didn't even know this, I don't think.
[01:47:33.120 --> 01:47:44.120] They don't even know how the wall works, but the district attorney had given papers. He had printed the level off about it and took it to the form, and he was up to the form of whether he was seeing it or not.
[01:47:44.120 --> 01:48:02.120] He's going to turn me down, basically, what I'm saying. When I'm giving my request, and after he sees the first charges against these other officials, they're going to turn me down and I'll let me go, I guess.
[01:48:02.120 --> 01:48:18.120] They'd send them in to the grand jury foreman and each grand jury member individually via certified mail naming each grand juror and using whatever place they are congregated in by the court as the place of service that you address it to.
[01:48:18.120 --> 01:48:21.120] And make sure that you send it.
[01:48:21.120 --> 01:48:24.120] How are you going to get their name?
[01:48:24.120 --> 01:48:34.120] You don't need their name. Foreman of the grand jury. Grand juror number one. Grand juror number two.
[01:48:34.120 --> 01:48:39.120] But they have, they have panel, different panel, the one that was in there last time.
[01:48:39.120 --> 01:48:58.120] Then just go down to the court and ask them what grand jury panel is in session or which one, does it matter which one you report it to? I don't think so. If they got 10 in panel at one time, what difference does it make? Send a copy to all 10.
[01:48:58.120 --> 01:49:17.120] All right. Well, here's, here's what I was thinking. I want to see what you think about it. I was thinking they're going to turn down my request and then I should, I was thinking probably what I need to do is change it up a little bit and just call a deputy to arrest the clerk.
[01:49:17.120 --> 01:49:22.120] What good is that going to do? What does the clerk have to do with you accessing the grand jury?
[01:49:22.120 --> 01:49:29.120] He's, he's, uh, carrying my request balance and put me in the prison.
[01:49:29.120 --> 01:49:31.120] The clerk doesn't have any authority to turn down a request.
[01:49:31.120 --> 01:49:32.120] Well then.
[01:49:32.120 --> 01:49:40.120] Look, if you want to avoid the issue altogether, do what I just said. Send it via the mail.
[01:49:40.120 --> 01:49:54.120] As long as you name the grand juror specifically as the foreman of the grand jury or grand jury number one, blah, blah, blah, nobody else can intercept that mail and not commit a federal offense.
[01:49:54.120 --> 01:50:04.120] All right. Here, the grand jury also worked a different way too, but it is, according to those procedures that he gave me copies of.
[01:50:04.120 --> 01:50:12.120] You have what you do as you present to, you can take two grand jury, uh, grand jury members and the foreman.
[01:50:12.120 --> 01:50:25.120] Okay. We're talking about two different things. A presentment of information means you're going to stand there and try to convince them of the facts of the information you're giving them.
[01:50:25.120 --> 01:50:29.120] Okay. That's a presentment. Hold on.
[01:50:29.120 --> 01:50:45.120] What I'm talking about is simply making them aware of a potential crime by a public official. You are not limited in how you can report that to a grand jury and no law can do so.
[01:50:45.120 --> 01:51:00.120] All right. So they just ignored. Here's another problem. On the vandalism charge, especially the limit runs out in July and also in August.
[01:51:00.120 --> 01:51:07.120] Did you go down and file individual charges with the police agency, the sheriff's department or anything like that if it was out in the county somewhere?
[01:51:07.120 --> 01:51:15.120] Did you go to the sheriff's office and say I want to file criminal charges against this individual for vandalizing private property?
[01:51:15.120 --> 01:51:24.120] Yes, I did. And I think I'm the whole package. I did that while I was down there on April 15th. Yeah, I did that.
[01:51:24.120 --> 01:51:42.120] The officer, he was a detective for the sheriff's department. He told me that I told him, I called a few laws to him and he told me that the district attorney was the end of, you know,
[01:51:42.120 --> 01:51:54.120] it doesn't matter what the law reads. I ain't doing anything that the district attorney don't. He said that he would get with him. He said two or three times, he would get with him and talk to him and see what he could do.
[01:51:54.120 --> 01:52:01.120] And he could do, you know, he has to do what the district attorney tells him. He's the bottom line of it. But that's not the case.
[01:52:01.120 --> 01:52:11.120] I know that. But when I went and talked to the district attorney, he told me that he had judicial discretion completely. He told me that it's the grand jury.
[01:52:11.120 --> 01:52:24.120] No, he has prosecutorial discretion as to what he prosecutes, but that too has limits. He can't do it just to protect a criminal that's wearing an official uniform.
[01:52:24.120 --> 01:52:26.120] Well, he said he can.
[01:52:26.120 --> 01:52:34.120] Okay, but you're still missing my point. Why are we even talking about these guys? It's irrelevant. What I told you about the grand jury still stands.
[01:52:34.120 --> 01:52:50.120] Now, as far as presenting information, in addition to making them aware, after you send a copy of it to make all of them aware, then simply pick two of them and do an actual presentment of the same information.
[01:52:50.120 --> 01:52:51.120] How hard is that?
[01:52:51.120 --> 01:52:54.120] Okay. I think what you're saying, I didn't do both.
[01:52:54.120 --> 01:52:56.120] Exactly.
[01:52:56.120 --> 01:52:59.120] Yeah, okay. And you said to...
[01:52:59.120 --> 01:53:09.120] And you're not limited to just one grand jury. You can go to any grand jury in the entire state. You can go to all of them.
[01:53:09.120 --> 01:53:13.120] Well, this is a huge pack of mail, I'll tell you.
[01:53:13.120 --> 01:53:18.120] I'm not saying you could afford it. I'm just saying you can do it.
[01:53:18.120 --> 01:53:32.120] No, yeah, I will do it. I don't have a problem. I've already got the copies made. I've just spent $23 just making the copies. It's like 15 pages, not 12.
[01:53:32.120 --> 01:53:37.120] Well, yeah, but your first set of copies are certified copies, right?
[01:53:37.120 --> 01:53:43.120] I've got my originals. Everything that I've got is certified and still authenticating.
[01:53:43.120 --> 01:53:50.120] Right. And the certifications, what caused the price to go up? Just running copies, is it going to cost you that much? I wouldn't think.
[01:53:50.120 --> 01:53:54.120] Well, yeah, it was $23 to run the copies.
[01:53:54.120 --> 01:53:56.120] Okay.
[01:53:56.120 --> 01:54:01.120] They're just copies of the newly-rised document.
[01:54:01.120 --> 01:54:12.120] I've got a copy for each jury. I'll have to send them certified mail that you're saying, and I'll send them to the courthouse where they meet, is what you're saying, right?
[01:54:12.120 --> 01:54:17.120] Yeah. Addressed to the grand jury form and to the individual grand jurors, yes.
[01:54:17.120 --> 01:54:28.120] Right. Okay. I got you. That's simple enough. I don't know how much that would cost, but I don't get it. It really matters how much. It probably costs $23 to mail that.

[01:54:31.120 --> 01:54:42.120] Well, that's not a problem. I can do that, and then still go ahead and send my request to present, just like I was going to do anyway, and see how that goes.

[01:54:46.120 --> 01:54:56.120] I've been trying since last November to get somebody to file thanks to my charges. I've sent to a district judge.
[01:54:56.120 --> 01:55:01.120] I can't find where the district judge has a duty. I sent you that thing, you know what I mean?
[01:55:01.120 --> 01:55:11.120] There's that little empty thing that says he don't have, that if it's one of the law's police officer, he don't have a duty to do a warrant for a sentence.
[01:55:11.120 --> 01:55:23.120] The only caprice that I can find in the law that the district attorney has is whether to send, which one to send a sentence or a warrant.
[01:55:23.120 --> 01:55:32.120] If he shall prosecute you in a timely manner, I mean, there's laws that he does have a duty to prosecute when he knows the law.
[01:55:32.120 --> 01:55:38.120] I mean, of course, he has to, you know, investigate and make sure that there's evidence. He has that.
[01:55:38.120 --> 01:55:52.120] But I've got self-indicating transcriptions and everything. I've got, like, 11 pages, 14 pictures. There's no doubt with plenty of evidence for it. I mean, for a probable cause.
[01:55:52.120 --> 01:55:54.120] That's really...

[01:56:35.120 --> 01:56:44.120] And I want to know what your thoughts were on how he should go about researching this or fighting it.
[01:56:44.120 --> 01:56:55.120] Well, normally they're not allowed to charge a tax on a major purchase of that type. Where does the state of Washington get the authority to charge an ex-size tax?
[01:56:55.120 --> 01:57:00.120] Where's the privilege he is exercising for it to be an ex-size tax?
[01:57:00.120 --> 01:57:02.120] Nothing. That's what I had asked.
[01:57:02.120 --> 01:57:12.120] Well, that's what he needs to look at. Case law dealing with privileged activity, which selling your home is not.
[01:57:12.120 --> 01:57:16.120] Yeah, that's what I told him. That's going to accept the money.
[01:57:16.120 --> 01:57:27.120] As a realtor selling someone else's, he may have to pay out of his commission, but to sell your own property, there is no privilege being associated with that.
[01:57:27.120 --> 01:57:34.120] That's being exercised. That would authorize the levying and collection of an ex-size tax.
