[01:13.640 --> 01:18.480]  that a federal court stop the state from flagging about 95,000 people as potentially illegally

[01:19.840 --> 01:24.640]  The list was compiled after an 11-month-long investigation by the Office of the Texas Secretary
[01:24.640 --> 01:30.000]  of State and the Texas Department of Public Safety which sought to identify non-U.S. citizens
[01:30.000 --> 01:32.320]  who were registered to vote when obtaining H.R.
[01:32.320 --> 01:33.320]  Arbridge license.
[01:33.320 --> 01:37.040]  Over half of the 95,000 did indeed vote, it seems.
[01:37.040 --> 01:41.080]  However, further controversy was raised when it became clear that some of the names were
[01:41.080 --> 01:45.360]  not in fact belonging to those who were non-citizens and registered.
[01:45.360 --> 01:50.880]  Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote.

[09:19.480 --> 09:28.560]  afford counsel before this the agency appoints them a public defender we're
[09:28.560 --> 09:35.000]  going to ask them to we're going to ask them to have them go through this
[09:35.000 --> 09:44.080]  questionnaire and what the questionnaire will do is is give them a better idea of
[09:44.080 --> 09:53.800]  what they're facing I sat in on a hearing this week and I was not at all
[09:53.800 --> 10:00.400]  happy with what I found this was supposedly a preliminary hearing at the
[10:00.400 --> 10:10.400]  jail by magistrate and went in the room and they brought people into the
[10:10.400 --> 10:15.160]  courtroom and the first thing they did was have them talk to a public defender
[10:15.160 --> 10:18.640]  and I talked to the public defender a while and then a public defender would
[10:18.640 --> 10:22.080]  call the prosecuting over prosecuting eternity over and they'd act back and
[10:22.080 --> 10:30.840]  forth a while and then they would come to the court with a deal this in Tennessee
[10:30.840 --> 10:40.800]  law the police in Tennessee law are specifically forbidden by statute to
[10:40.800 --> 10:49.840]  imprison someone without a preliminary hearing in most states they call an
[10:49.840 --> 10:57.480]  examining trial a preliminary hearing I didn't see any preliminary hearings at
[10:57.480 --> 11:02.880]  all they brought a whole lot of people through there not one preliminary
[11:02.880 --> 11:12.640]  hearing what I could not be certain of is whether or not this was your standard
[11:12.640 --> 11:18.200]  count cattle call where they people are just brought in whether they were
[11:18.200 --> 11:22.120]  arrested and brought before the magistrate's first time in the magistrate
[11:22.120 --> 11:25.200]  reason the rights and tells them what the charge was none of that happened in
[11:25.200 --> 11:30.800]  this hearing so I don't know if they had already been before a magistrate of
[11:30.800 --> 11:37.720]  some type already or if this was the first time coming to any kind of court
[11:37.720 --> 11:43.600]  and I it wasn't I talked to the judge and it wasn't clear from the judge what
[11:43.600 --> 11:50.040]  it actually went on the reason I talked to the judge is that I had went to the
[11:50.040 --> 11:58.400]  court to observe the court proceedings and they wouldn't let me enter the court
[11:58.400 --> 12:02.760]  room with a cell phone but I told them but I needed this cell phone to record
[12:02.760 --> 12:06.880]  the proceedings and they insisted that I could not record the proceedings so I
[12:06.880 --> 12:12.600]  took my cell phone put it on the car came back and had the the court doors
[12:12.600 --> 12:17.800]  locked and I told them I'm here to observe the proceedings and they told
[12:17.800 --> 12:26.240]  me I couldn't observe the proceedings so or a bailiff told me this real
[12:26.240 --> 12:30.720]  professional playlist pleasant everything I expected a professional
[12:30.720 --> 12:37.240]  public servant to be but he followed the instructions of the judge and he told
[12:37.240 --> 12:44.280]  me that the judge has instructed him this way so a week later I filed criminal
[12:44.280 --> 12:50.400]  charges with the district attorney against the bailiff I didn't file against
[12:50.400 --> 13:00.240]  the judge because I didn't know anything about the judge all I knew was the
[13:00.240 --> 13:06.160]  bailiff told me I couldn't observe the hearing he told me that the judge told
[13:06.160 --> 13:11.880]  him that but the judge didn't tell me that only thing I knew is the bailiff
[13:11.880 --> 13:17.120]  would not let me record the proceedings neither would he allow me into the
[13:17.120 --> 13:22.680]  courtroom so if the bailiff has an affirmative defense he can certainly
[13:22.680 --> 13:27.800]  claim that affirmative defense but I did tell the investigator for the
[13:27.800 --> 13:32.680]  prosecuting attorney because here the prosecutor would not talk to me as is
[13:32.680 --> 13:36.440]  the same in Texas prosecutors never talked to you they always send out their
[13:36.440 --> 13:41.960]  investigators and the investigator in this case was very professional very
[13:41.960 --> 13:48.960]  polite none of this knuckle dragging attitude stuff and I told him that I
[13:48.960 --> 13:54.680]  was not in any way upset with this bailiff that he conducted himself very
[13:54.680 --> 14:04.440]  well but that I was just here to use the prosecuting attorney as a crash dummy
[14:04.440 --> 14:11.080]  that there was another County that I really wanted to go after and they were
[14:11.080 --> 14:15.240]  real stinkers but before I went after that County since I'm not familiar with
[14:15.240 --> 14:23.360]  the processes in Tennessee I wanted to test the processes in weekly County so
[14:23.360 --> 14:27.800]  I find out all the shenanigans the prosecutors going to try to pull that
[14:27.800 --> 14:33.960]  way I'm ready for the prosecutor when I get to the County I'm really after I did
[14:33.960 --> 14:44.040]  that to kind of eliminate any ability to negotiate with me they since I'm not
[14:44.040 --> 14:48.680]  after them and I'm just using them to get to someone else they have no way of
[14:48.680 --> 14:58.080]  dealing with me so I went back to the court a week later or maybe three days
[14:58.080 --> 15:05.520]  I think it was the next week I went back to the court with criminal complaints I
[15:05.520 --> 15:16.920]  intended to file I intended to file with the magistrate but again they had the
[15:16.920 --> 15:25.480]  doors locked and I went to the bailiff and told them that yeah I went to the
[15:25.480 --> 15:30.520]  court to get a copy of the appearance doc they said the clerk had it and the
[15:30.520 --> 15:34.800]  clerk was in the court so I went to the court to get it and the bailiff wouldn't
[15:34.800 --> 15:40.440]  let me enter the court and he said that after they started the hearings they
[15:40.440 --> 15:45.680]  didn't let anybody in until they had a recess okay well I was horse manure but
[15:45.680 --> 15:50.320]  at least this one was smart enough and wait a minute I'm getting this out of
[15:50.320 --> 15:58.520]  place this time I just went to get I told the bailiff I needed this docket and
[15:58.520 --> 16:02.560]  he said well you can't get that right now and I told him well that's not your
[16:02.560 --> 16:06.680]  decision that's decision of the clerk the clerk is the one that's supposed to
[16:06.680 --> 16:10.760]  provide it and she's the one I'll hold responsible so why don't you go ask the
[16:10.760 --> 16:17.200]  clerk so he did he went inside and asked me to sit over here and wait so I
[16:17.200 --> 16:21.200]  should have sitting away don't went to the washroom when I come back the captain
[16:21.200 --> 16:26.680]  from the sheriff's department was waiting for me and I had already
[16:26.680 --> 16:34.120]  encountered him once before and he was kind of aggressive and mouthy at the
[16:34.120 --> 16:44.080]  time and we didn't have a pleasant interaction so as soon as we get back

[20:33.080 --> 20:40.400]  captain didn't take that too well and at the time there were three other bailiffs
[20:40.400 --> 20:46.360]  and all of these bailiffs were kind of cringing and backing away there was one
[20:46.360 --> 20:52.000]  guy there in khakis I don't know who he was the bailiffs were in what looked
[20:52.000 --> 20:58.200]  like fatigued green military uniforms but this one guy was in khakis and when I
[20:58.200 --> 21:04.800]  looked at him I said to myself self don't screw with this guy this guy's no
[21:04.800 --> 21:09.600]  chump and he's not the least bit afraid of you and if you've been around these
[21:09.600 --> 21:15.480]  guys you can tell the ones that have attitude the ones that really don't know
[21:15.480 --> 21:18.560]  what they're doing and the ones that are not impressed and this guy was not
[21:18.560 --> 21:27.320]  impressed but he was clearly not happy he was off to my left and standing with
[21:27.320 --> 21:32.240]  his hands folded across his the arms folded across his chest and he's
[21:32.240 --> 21:38.720]  staring at captain mcdade he's not looking at me he's looking at the captain
[21:38.720 --> 21:44.200]  it was clear to him that I was playing the captain and the captain was dancing
[21:44.200 --> 21:53.040]  for me and he was not happy with it so the captain just kept getting
[21:53.040 --> 21:56.640]  escalating more and finally he told me raise your voice go ahead just raise your
[21:56.640 --> 22:04.120]  voice so I turned my back on him and step toward the court door and mcdade
[22:04.120 --> 22:09.320]  reached up and grabbed both my arms pulled me back turned me around the
[22:09.320 --> 22:17.400]  opposite direction and showed me he wasn't unreasonably aggressive when he
[22:17.400 --> 22:21.000]  grabbed me he didn't grab me very hard I guess he wanted me to be able to
[22:21.000 --> 22:27.600]  be your exclusive I wanted to and essentially turned me rather gently I
[22:27.600 --> 22:32.720]  was kind of surprised about that and then give me a light push in the other
[22:32.720 --> 22:35.240]  direction told me that you don't have any business in the court and you're not
[22:35.240 --> 22:45.400]  going in there okay that didn't go so well so I went down to my car got my
[22:45.400 --> 22:50.680]  phone call 911 and asked the 911 operator to send an officer down to
[22:50.680 --> 23:00.360]  arrest mcdade for aggravated assault well waited about an hour and deputy
[23:00.360 --> 23:05.000]  didn't show up but the high sheriff of the county did and I talked to the high
[23:05.000 --> 23:14.600]  sheriff of the counties it's Sheriff Wilson very professional very polite
[23:14.600 --> 23:22.640]  exactly what I expected to see from a experienced sheriff he treated me with
[23:22.640 --> 23:29.560]  dignity and deference if he had an attitude he left it at the house he
[23:29.560 --> 23:35.520]  did exactly what I expected an officer to do he said well Mr. Heldon what do you
[23:35.520 --> 23:39.800]  want me to do I want you to take my criminal complaint against officer
[23:39.800 --> 23:45.600]  mcdade he's well he's my officer I I can't take a complaint against him so
[23:45.600 --> 23:50.120]  well you are a service fight you know you're the sheriff but you're also
[23:50.120 --> 23:53.520]  certified peace officer in stage 10c aren't you we have Sam well it's your
[23:53.520 --> 23:58.240]  duty to keep peace doesn't make the indifference who breached it like I'm
[23:58.240 --> 24:02.640]  like arrest my own officer he said Mr. Compton just what do you expect from me
[24:02.640 --> 24:09.440]  I said well I need you to either take my complaint against officer mcdade or
[24:09.440 --> 24:17.920]  refused to and send me to someone else so he directed me to the prosecuting
[24:17.920 --> 24:27.960]  attorney and I thanked him and I left I went to back up to the courtroom and
[24:27.960 --> 24:32.160]  talked to the bailiff and asked him when he was going to have the next I'm
[24:32.160 --> 24:39.400]  sorry I left and two days later that was a Monday two days later on Wednesday
[24:39.400 --> 24:44.720]  I came back and wanted to go in the court because I had criminal complaints
[24:44.720 --> 24:52.040]  against mcdade to give to the magistrate and had the doors locked again and the
[24:52.040 --> 24:58.200]  this time just when the bailiff told me well Mr. Heldon now after the court
[24:58.200 --> 25:05.600]  commences we don't allow anyone until there's a recess well that wasn't a
[25:05.600 --> 25:14.040]  good excuse but at least he had one so I didn't want to have a fight with him so
[25:14.040 --> 25:21.680]  I waited got 10 30 and he said they would probably break at 10 30 and they
[25:21.680 --> 25:24.720]  weren't broke they didn't break and I went back to him he said well they will
[25:24.720 --> 25:31.960]  be convening be recessing the court here and they'll reconvene at the jail so I
[25:31.960 --> 25:36.000]  went to the jail and waited and when they convened at the jail I was there and
[25:36.000 --> 25:41.040]  while I was waiting I asked for a appearance docket for this hearing and
[25:41.040 --> 25:46.840]  told one of the deputies and he went to back and the high sheriff came out and
[25:46.840 --> 25:52.680]  he said well we don't have this docket the court has that you have to get it
[25:52.680 --> 25:58.120]  from them I said okay well thank you and he started to leave but he I could hear
[25:58.120 --> 26:07.000]  the tension in his voice he was trying not to be angry so I said sheriff you
[26:07.000 --> 26:12.800]  know I talked a lot of people around the county about you oh you have yes I have
[26:12.800 --> 26:19.400]  and I heard a lot of stuff about you oh you did I said yes I did and all of it
[26:19.400 --> 26:26.880]  good what is going on with that and the sheriff said kind of smiled and he said
[26:26.880 --> 26:32.000]  well you can't believe everything you hear I kind of pulled his fangs a little
[26:32.000 --> 26:38.640]  so he kind of calmed down a little bit after that and then when this court was
[26:38.640 --> 26:44.160]  beginning to open I went up to the guys in green uniforms and asked one of them

[34:22.120 --> 34:26.620]  examining trial based on these criminal charges I have filed against these
[34:26.620 --> 34:33.320]  officers he said well Mr. Kelton I don't think I'm the right place to file
[34:33.320 --> 34:45.040]  these said well I do according to Tennessee law you are a magistrate and
[34:45.040 --> 34:51.200]  it is your duty to hold a preliminary hearing and I'm here to engage that

[36:57.680 --> 37:07.600]  back this was a high school kid he struggled until he died he was
[37:07.600 --> 37:14.000]  struggling because they were suffocating him and the more he struggled the
[37:14.000 --> 37:21.760]  harder they pressed with their knees until they killed him once he passed out

[38:06.520 --> 38:13.160]  playable he's a captain he's prominently displaying a deadly weapon he put his

[42:29.260 --> 42:36.600]  fear that the police could arrest it in prison they won't knew the police could
[42:36.600 --> 42:41.440]  arrest but it was the magistrate who held the key to the jailhouse door not
[42:41.440 --> 42:48.720]  the police in 19 that stood us well for 800 years and then in 1965 all of this
[42:48.720 --> 42:55.800]  changed with this war on drugs they all the states stopped following due
[42:55.800 --> 43:02.800]  process and they started this routine where no matter what someone is accused
[43:02.800 --> 43:10.920]  of the police in the prosecutor bring the highest level charges they could
[43:10.920 --> 43:16.680]  possibly dream up and threaten the individual with horrible consequences if
[43:16.680 --> 43:23.160]  they don't take this perfectly reasonable deal and they streamlined
[43:23.160 --> 43:29.520]  the jurisprudence say the prosecutor was able to clear his docking all these
[43:29.520 --> 43:34.680]  stacks of cases he had no time to prosecute all those this streamlined
[43:34.680 --> 43:39.960]  the system where they could move these cases through the system works really
[43:39.960 --> 43:43.760]  good except for one problem that I'll speak to when we come back on the other

[46:45.040 --> 46:50.560]  instituted this process where they forced everybody to take a deal it was in
[46:50.560 --> 46:54.760]  court appointed counsel's best interest to work in concert inclusion was
[46:54.760 --> 47:01.360]  prosecuted toward this purpose so it turns out that everybody in the system
[47:01.360 --> 47:06.760]  is we're working together to force someone to take a deal well this
[47:06.760 --> 47:12.520]  streamlined the system really nice but according to the 2003 Commission
[47:12.520 --> 47:21.080]  Governor's Commission on law enforcement they complain that this process of
[47:21.080 --> 47:25.640]  forcing everybody to take a deal put people on the probation who never
[47:25.640 --> 47:31.000]  should have been prosecuted in the first place and then if they wind up
[47:31.000 --> 47:35.880]  violating probation they get mandatory jail time and this was what was causing
[47:35.880 --> 47:39.840]  this mass incarceration not because there's more crime crime has been
[47:39.840 --> 47:44.600]  statistically down across the board in all categories for the last 30 years
[47:44.600 --> 47:55.120]  according to the FBI but incarceration rates are going up logarithmically this
[47:55.120 --> 48:03.680]  is the reason we need to go back to the procedure that served us well for 800
[48:03.680 --> 48:08.600]  years I am here to put you as a magistrate back in the position you're
[48:08.600 --> 48:18.520]  supposed to be in as to go between between the police and the jailhouse and by
[48:18.520 --> 48:26.240]  this method interrupt this process that forces everybody to go on probation and
[48:26.240 --> 48:29.240]  the way I'm doing that is in developing this questionnaire that a person
[48:29.240 --> 48:34.640]  accused when he asked for court appointed counsel before he gets court
[48:34.640 --> 48:39.120]  appointed counsel yes can fill out this questionnaire and it will go through all
[48:39.120 --> 48:42.920]  of the issues in his case and tell him whether or not the prosecutor has a
[48:42.920 --> 48:47.120]  good case if it tells him the prosecutor has a good case and the best thing he
[48:47.120 --> 48:52.240]  can do is make a deal but if it tells him the prosecutor doesn't it gives him
[48:52.240 --> 48:58.720]  grounds to object and either push for a much better deal or push to get the whole
[48:58.720 --> 49:05.560]  thing dismissed if by this process we can lower the bed rate in the prisons by
[49:05.560 --> 49:13.080]  1% will save the state of Tennessee $700,000 a year we will be pushing this
[49:13.080 --> 49:19.600]  in the Fed and in the Fed we would save the prison system in the Fed if we can
[49:19.600 --> 49:29.120]  decrease the bed rate by 1% we'll save them 800 million dollars it's a very
[49:29.120 --> 49:37.600]  inexpensive intervention that could have dramatic results so this is my purpose
[49:37.600 --> 49:49.720]  and I'm merely using you and these courts as a track up to the Court of Appeals
[49:49.720 --> 49:54.960]  and Supreme and Nashville so I can bring this before my legislators and the judge
[49:54.960 --> 50:01.040]  commented that right now that's probably a good time because this mass
[50:01.040 --> 50:12.080]  operation problem has become is a very hot issue in Nashville his demeanor
[50:12.080 --> 50:20.960]  never changed he he listened closely he paid attention to what I said he never
[50:20.960 --> 50:29.400]  got himself an attitude he treated me with a level of deference that I expect
[50:29.400 --> 50:33.560]  from my public officials you know I was polite and I was professional and so was
[50:33.560 --> 50:40.080]  he he was very professional I could not have been more pleased if this is an
[50:40.080 --> 50:46.200]  example of I'm sure not all the courts in this way but if this is an example of

[52:15.760 --> 52:23.640]  into a careful considerate professional police officer if not good chance he will

[52:32.040 --> 52:39.080]  well as you what you might if you look at what went on it is very unlikely at this
[52:39.080 --> 52:44.880]  point that you could tie up a what weekly county sheriff's deputy and throw him at
[52:44.880 --> 52:58.280]  me we need someone to do this in every county we need someone that introduces
[52:58.280 --> 53:04.000]  the possibility of the sky falling in on somebody when they do something they
[53:04.000 --> 53:13.600]  don't consider terribly important when they step across a legal line seems
[53:13.600 --> 53:20.560]  minor to them they need the sky to fall in on so that they never know which one
[53:20.560 --> 53:27.200]  which is the next guy that's going to stand in front of a local judge and tell

[01:51:45.640 --> 01:51:51.440]  judge in spite of that the judge went ahead and striked it so during the
[01:51:51.440 --> 01:51:58.160]  hearing I think I had something like 14 motion on April the 8th I told the judge
[01:51:58.160 --> 01:52:03.880]  judge you can't do that we cannot continue because first of all I have a crime
[01:52:03.880 --> 01:52:13.040]  report against your misconduct because you have impersonated a judge then you
[01:52:13.040 --> 01:52:17.240]  had no jurisdiction to do so and he continued and he said well you know I
[01:52:17.240 --> 01:52:23.560]  disagree we can hear the rest of the motion gonna he said no judge I think
