[01:09.520 --> 01:14.200]  In recent news, several Texas-based organizations filed a lawsuit today requesting that a federal
[01:14.200 --> 01:18.920]  court stop the state from flagging about 95,000 people as potentially illegally registered

[01:19.920 --> 01:25.280]  This was compiled after an 11-month long investigation by the Office of the Texas Secretary of State
[01:25.280 --> 01:29.960]  and the Texas Department of Public Safety, which sought to identify non-U.S. citizens
[01:29.960 --> 01:33.320]  who were registered to vote when obtaining age of arbitrage license.
[01:33.320 --> 01:37.000]  Over half of the 95,000 did indeed vote, it seems.
[01:37.000 --> 01:41.040]  However, further controversy was raised when it became clear that some of the names were
[01:41.040 --> 01:45.360]  not in fact belonging to those who were non-citizens and registered.
[01:45.360 --> 01:50.880]  Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote.
[01:50.880 --> 01:55.240]  Registered voters who receive letters querying their citizenship have 30 days to respond
[01:55.240 --> 01:57.080]  with proof of eligibility.
[01:57.080 --> 02:01.240]  Texas Attorney General Ken Paxton and David Whitley, the Texas Secretary of State, have
[02:01.240 --> 02:09.000]  yet to officially comment regarding this list and any updates pertaining to it.
[02:09.000 --> 02:14.400]  A Texas man of only 24 years old, William Brown, died from a severed artery in his neck after
[02:14.400 --> 02:16.920]  a vape pen exploded while he was using it.

[04:41.440 --> 04:47.440]  we're gonna do a partial launch, hold on just,

[05:07.440 --> 05:11.440]  he looked at this and the first comment he said about

[05:21.440 --> 05:25.440]  and I've known him for a long time and he said that a number of times,
[05:25.440 --> 05:32.440]  lots of moving parts, so for a launch as a proof of
[05:32.440 --> 05:38.440]  concept, we've been working for a while on a set of questionnaires
[05:38.440 --> 05:43.440]  just for the Securities Exchange Commission,
[05:43.440 --> 05:48.440]  it was an interesting project,
[05:48.440 --> 05:53.440]  as the people dealing with the Securities Exchange Commission
[05:53.440 --> 05:58.440]  seem to believe that the Code of Federal Regulations
[05:58.440 --> 06:03.440]  under Chapter 17 for the Securities Exchange Commission
[06:03.440 --> 06:11.440]  have been written such that the SEC can pretty well do what they want to
[06:11.440 --> 06:16.440]  and you can never be sure that you are in compliance
[06:16.440 --> 06:24.440]  and after going through the codes with bit by bit, piece by piece,
[06:24.440 --> 06:29.440]  I have determined they are absolutely correct,
[06:29.440 --> 06:35.440]  the Code has been carefully crafted to give absolute
[06:35.440 --> 06:39.440]  caprice to the regulators.
[06:39.440 --> 06:43.440]  You can follow all of their standards and they can say,
[06:43.440 --> 06:47.440]  yeah, you followed all the standards but we don't think it's good enough
[06:47.440 --> 06:54.440]  or shut you down anyway. They can do it with no requirements,
[06:54.440 --> 06:59.440]  they can just say we define this differently.
[06:59.440 --> 07:04.440]  The SEC is able to define things anyway they want to.
[07:04.440 --> 07:11.440]  We have the definition of securities in the statute
[07:11.440 --> 07:19.440]  and in the CFRs that contains four terms that are not defined
[07:19.440 --> 07:25.440]  anywhere on planet Earth. It's insane.
[07:25.440 --> 07:29.440]  They say security can be this, this, this, this, this
[07:29.440 --> 07:32.440]  and none of those things exist anywhere.
[07:32.440 --> 07:36.440]  So you can have something and you can say it's not a security,
[07:36.440 --> 07:39.440]  the SEC can come along and say, oh yeah, it's this thing here
[07:39.440 --> 07:43.440]  that we've never defined before and you screwed me.
[07:43.440 --> 07:48.440]  The SEC can simply institute an investigation
[07:48.440 --> 07:50.440]  and you are shut down.
[07:50.440 --> 07:53.440]  If you fight them, you'll be shut down for four to five years
[07:53.440 --> 07:58.440]  while you're fighting them so that even if you win, you lose.
[07:58.440 --> 08:03.440]  So we've crafted a remedy.
[08:03.440 --> 08:08.440]  We go through their codes piece by piece
[08:08.440 --> 08:13.440]  and on every piece and I mean every little piece.
[08:13.440 --> 08:17.440]  I've got paragraphs, I've got one paragraph I just finished
[08:17.440 --> 08:23.440]  that I have 14 questions that go to one paragraph.
[08:23.440 --> 08:28.440]  I've got a sentence that I've got nine questions that go to.
[08:28.440 --> 08:31.440]  Talk about multifarious.
[08:31.440 --> 08:34.440]  No human being on Earth can read those sentences
[08:34.440 --> 08:36.440]  and make sense of them.
[08:36.440 --> 08:39.440]  So I've broken every little condition.
[08:39.440 --> 08:43.440]  It says you must do this and this or this and that
[08:43.440 --> 08:45.440]  but you can do this and this or this
[08:45.440 --> 08:47.440]  and that over there and this over here.
[08:47.440 --> 08:49.440]  All this is one sentence.
[08:49.440 --> 08:52.440]  Nobody can hold in their brain
[08:52.440 --> 08:56.440]  that many pieces of disparate information at the same time.
[08:56.440 --> 09:01.440]  It is designed to be impossible to understand.
[09:01.440 --> 09:06.440]  So we break each little section down to a separate question.
[09:06.440 --> 09:08.440]  Did you comply with this?
[09:08.440 --> 09:09.440]  Yes, no.
[09:09.440 --> 09:12.440]  Did you comply with this part of this sentence?
[09:12.440 --> 09:18.440]  No, the whole thing we've broken it down into excruciating detail.

[11:18.440 --> 11:25.440]  and then you file that with your application to the FCC in the form of a verified affidavit
[11:25.440 --> 11:30.440]  alleging due diligence in an effort to comply with all the regulations
[11:30.440 --> 11:35.440]  that it throws a giant roadblock in front of the regulator
[11:35.440 --> 11:39.440]  Now he can't just accuse you of not meeting a standard
[11:39.440 --> 11:43.440]  He has to overcome your verified affidavit
[11:43.440 --> 11:49.440]  I don't think the FCC is as capricious as they could be
[11:49.440 --> 11:57.440]  I think they are in a spot right now where they're charged with protecting the consumer
[11:57.440 --> 12:01.440]  But with these new methodologies coming down
[12:01.440 --> 12:05.440]  they don't know how to protect the consumer because they don't have enough experience
[12:05.440 --> 12:08.440]  with the ICOs and the crypto side
[12:08.440 --> 12:11.440]  So they're struggling to try to find a middle ground
[12:11.440 --> 12:15.440]  And they've got the legislature on their case
[12:15.440 --> 12:17.440]  They've got everybody on their case
[12:17.440 --> 12:19.440]  So they're kind of stuck in the middle
[12:19.440 --> 12:24.440]  It is my belief that if we get this affidavit in their hands
[12:24.440 --> 12:28.440]  it will make their lives easier because it gives them plausible deniability
[12:28.440 --> 12:30.440]  They can go ahead and approve these things
[12:30.440 --> 12:34.440]  And then if somebody is actually cheating or a bad guy
[12:34.440 --> 12:37.440]  they will be able to overcome the affidavit
[12:37.440 --> 12:40.440]  but they'll also stabilize the space
[12:40.440 --> 12:41.440]  Okay, enough of that
[12:41.440 --> 12:45.440]  We've got the whole board full of callers so I won't spend any more time on that

[13:19.440 --> 13:23.440]  said he goes there every day to serve papers
[13:23.440 --> 13:26.440]  every day
[13:26.440 --> 13:30.440]  So I thought that was kind of interesting
[13:30.440 --> 13:34.440]  I got your copy but I didn't have time to read it
[13:34.440 --> 13:38.440]  I've had a few really, really hectic days
[13:38.440 --> 13:41.440]  So I apologize for that
[13:41.440 --> 13:43.440]  People, not to worry

[14:12.440 --> 14:15.440]  and I'm not going to admit that I said that
[14:15.440 --> 14:17.440]  but nobody cares
[14:17.440 --> 14:19.440]  and I said well I care
[14:19.440 --> 14:22.440]  so I'll file with the Supreme Court
[14:22.440 --> 14:25.440]  So I did and you have to file ten copies
[14:25.440 --> 14:27.440]  then three to this agency
[14:27.440 --> 14:30.440]  two to the state bar, blah, blah
[14:30.440 --> 14:33.440]  filed it, served them all
[14:33.440 --> 14:36.440]  mailed them with
[14:36.440 --> 14:40.440]  what is it, priority mail with tracking
[14:40.440 --> 14:44.440]  They all got their documents on January the 7th
[14:44.440 --> 14:47.440]  and remember you said the other day when I hadn't heard
[14:47.440 --> 14:50.440]  yeah they take a long time to do this
[14:50.440 --> 14:53.440]  and another attorney had said yeah
[14:53.440 --> 14:55.440]  they take a long time
[14:55.440 --> 14:58.440]  but as I'm going out of the country for a couple of weeks
[14:58.440 --> 15:01.440]  I thought let me just find out what the status is
[15:01.440 --> 15:03.440]  so I called
[15:03.440 --> 15:06.440]  they say they never received it
[15:06.440 --> 15:11.440]  even though the tracking says it was delivered at 1.46pm
[15:11.440 --> 15:14.440]  on January the 7th
[15:14.440 --> 15:16.440]  that's why nothing was done
[15:16.440 --> 15:19.440]  they say they never got it into their hands
[15:19.440 --> 15:24.440]  so if anyone's listening and you file something like that
[15:24.440 --> 15:27.440]  it's best to call up and check
[15:27.440 --> 15:29.440]  make sure they got it
[15:29.440 --> 15:31.440]  now I've got to go through this whole rigmarole

[22:46.440 --> 22:49.440]  now they have public hearings like everybody else
[22:49.440 --> 22:53.440]  and take a folder with a criminal complaint

[22:55.440 --> 22:57.440]  put the complaint in the folder
[22:57.440 --> 22:59.440]  make sure it's verified
[22:59.440 --> 23:01.440]  give it to the bailiff
[23:01.440 --> 23:03.440]  tell them to instruct the justices
[23:03.440 --> 23:06.440]  you have business with the court
[23:06.440 --> 23:08.440]  and if he doesn't tell them
[23:08.440 --> 23:10.440]  when the court adjourns
[23:10.440 --> 23:12.440]  you stand up in the courtroom
[23:12.440 --> 23:15.440]  and tell the Supreme your name first

[23:27.440 --> 23:29.440]  I've never had the opportunity to do that

[23:33.440 --> 23:35.440]  waited all day for a judge
[23:35.440 --> 23:37.440]  in a supposed preliminary hearing
[23:37.440 --> 23:39.440]  to finish his business
[23:39.440 --> 23:42.440]  and when the last person was before him
[23:42.440 --> 23:43.440]  I went to the bailiff
[23:43.440 --> 23:45.440]  and I said Mr. Bailiff
[23:45.440 --> 23:47.440]  to your knowledge
[23:47.440 --> 23:49.440]  has the judge been noticed
[23:49.440 --> 23:51.440]  that I have business
[23:51.440 --> 23:52.440]  well first I told him my name
[23:52.440 --> 23:55.440]  that I have business with the court
[23:55.440 --> 23:57.440]  and he said well I don't know
[23:57.440 --> 23:59.440]  check
[23:59.440 --> 24:01.440]  and he did
[24:01.440 --> 24:02.440]  the bailiff turned around
[24:02.440 --> 24:03.440]  and he nodded at me
[24:03.440 --> 24:04.440]  so the judge is on the dime
[24:04.440 --> 24:06.440]  and he called me
[24:06.440 --> 24:09.440]  and it was an interesting interview
[24:09.440 --> 24:11.440]  I'll talk about that probably tomorrow night
[24:11.440 --> 24:13.440]  when we have more time
[24:13.440 --> 24:15.440]  but that was one of my most
[24:15.440 --> 24:17.440]  interesting interviews
[24:17.440 --> 24:19.440]  in front of a judge
[24:19.440 --> 24:22.440]  but I just barged right in

[24:24.440 --> 24:26.440]  they have to
[24:26.440 --> 24:28.440]  in most courts when they're finished
[24:28.440 --> 24:29.440]  they look out at the courtroom
[24:29.440 --> 24:31.440]  and they say does anyone have
[24:31.440 --> 24:33.440]  any further business with the court
[24:33.440 --> 24:35.440]  it's kind of a standard saying
[24:35.440 --> 24:37.440]  and if they don't say it
[24:37.440 --> 24:39.440]  you tell them you got business
[24:39.440 --> 24:41.440]  and the business you have
[24:41.440 --> 24:44.440]  is business with the
[24:44.440 --> 24:46.440]  supreme justices
[24:46.440 --> 24:50.440]  in their capacity as a magistrate
[24:50.440 --> 24:52.440]  and as a magistrate
[24:52.440 --> 24:55.440]  they have a duty
[24:55.440 --> 24:59.440]  and that should get interesting
[24:59.440 --> 25:02.440]  well I'll have to wait until I get back
[25:02.440 --> 25:06.440]  because the court is five and a half hours away from me
[25:06.440 --> 25:09.440]  it's okay you got time
[25:09.440 --> 25:12.440]  this will get everybody excited
[25:12.440 --> 25:14.440]  this is where you begin to find out
[25:14.440 --> 25:18.440]  how really powerful you can be
[25:18.440 --> 25:21.440]  this last week I had a
[25:21.440 --> 25:23.440]  sheriff deputy a captain
[25:23.440 --> 25:25.440]  down the sheriff's department
[25:25.440 --> 25:27.440]  put his hands on me
[25:27.440 --> 25:30.440]  to prevent me from entering a public court
[25:30.440 --> 25:33.440]  and he did so while prominently displaying
[25:33.440 --> 25:36.440]  a deadly weapon
[25:36.440 --> 25:39.440]  bad mistake bubba
[25:39.440 --> 25:42.440]  because I have dropped the sky on him
[25:42.440 --> 25:45.440]  and it's a long story
[25:45.440 --> 25:47.440]  so we will have more time
[25:47.440 --> 25:49.440]  but it turned out to be an interesting story
[25:49.440 --> 25:52.440]  and it's already got me to a state senator
[25:52.440 --> 25:56.440]  things are beginning to heat up here in Tennessee
[25:56.440 --> 26:01.440]  it's because I understand
[26:01.440 --> 26:04.440]  I'm the most powerful guy in the room
[26:04.440 --> 26:08.440]  you're the most powerful person in the room
[26:08.440 --> 26:12.440]  when you go into that supreme court
[26:12.440 --> 26:16.440]  hearing you are the most powerful person in the room
[26:16.440 --> 26:19.440]  the supreme's know that
[26:19.440 --> 26:23.440]  natives may not, most of the lawyers may not
[26:23.440 --> 26:26.440]  but the supreme's know that
[26:26.440 --> 26:31.440]  you're the only one in the room that can sting them good
[26:31.440 --> 26:35.440]  everybody else they can control
[26:35.440 --> 26:38.440]  it's just like when I was in the military
[26:38.440 --> 26:42.440]  and if a general come to the base
[26:42.440 --> 26:46.440]  we had to get out and cut every plate of grass
[26:46.440 --> 26:49.440]  just perfect
[26:49.440 --> 26:52.440]  we had to pick up every piece of trash on the street
[26:52.440 --> 26:56.440]  every cigarette but we had to make that base perfect
[26:56.440 --> 26:59.440]  there was only one person
[26:59.440 --> 27:02.440]  that the commander of the base
[27:02.440 --> 27:05.440]  feared more than a general coming
[27:05.440 --> 27:08.440]  and that was a civilian
[27:08.440 --> 27:11.440]  because the civilian
[27:11.440 --> 27:14.440]  was the one who could walk into the commander's office
[27:14.440 --> 27:17.440]  and crawl down his throat
[27:17.440 --> 27:20.440]  and all the commander could say was
[27:20.440 --> 27:23.440]  either yes sir or yes ma'am
[27:23.440 --> 27:26.440]  and keep his mouth shut
[27:26.440 --> 27:29.440]  because speaking up to a civilian
[27:29.440 --> 27:32.440]  was always incredibly dangerous
[27:32.440 --> 27:35.440]  because when the civilian gets done with the commander
[27:35.440 --> 27:38.440]  if you don't like what he did
[27:38.440 --> 27:42.440]  the civilian can do the same thing to the general
[27:42.440 --> 27:45.440]  once you get that
[27:45.440 --> 27:48.440]  you are in the same spot
[27:48.440 --> 27:53.440]  and you will find as you step up higher from the bottom
[27:53.440 --> 27:56.440]  those people in higher positions
[27:56.440 --> 28:01.440]  higher positions, higher level political positions
[28:01.440 --> 28:05.440]  very clearly understand the danger of a
[28:05.440 --> 28:08.440]  citizen confronting them
[28:08.440 --> 28:10.440]  calling them to task
[28:10.440 --> 28:13.440]  when you go to these senator hearings
[28:13.440 --> 28:16.440]  you need to go to the legislature when they are having
[28:16.440 --> 28:19.440]  these hearings, you will be amazed
[28:19.440 --> 28:22.440]  very few people show up
[28:22.440 --> 28:25.440]  and most of the people who show up are lawyers
[28:25.440 --> 28:28.440]  or people with vested interests
[28:28.440 --> 28:31.440]  in certain projects
[28:31.440 --> 28:34.440]  watch what happens when an irate citizen comes in there
[28:34.440 --> 28:37.440]  you should have seen Eddie Craig
[28:37.440 --> 28:41.440]  crawling down the throat of this legislative committee
[28:41.440 --> 28:44.440]  all of these guys are looking around
[28:44.440 --> 28:47.440]  wishing they could be somewhere else
[28:47.440 --> 28:50.440]  and they had Eddie Craig in there preaching the gospel
[28:50.440 --> 28:53.440]  according to Eddie and the penal code
[28:53.440 --> 28:56.440]  it was glorious
[28:56.440 --> 29:00.440]  and we got the legislation we were trying to get
[29:00.440 --> 29:04.440]  you can be very influential
[29:04.440 --> 29:08.440]  and you go in there and stick it to the magistrates
[29:08.440 --> 29:12.440]  the supreme court justices in their capacity
[29:12.440 --> 29:15.440]  as a magistrate
[29:15.440 --> 29:18.440]  you get their attention

[37:44.440 --> 37:49.440]  and the prosecution tried to charge me several thousand dollars for copies
[37:49.440 --> 37:54.440]  and I reminded the prosecution that I did not request copies

[37:58.440 --> 38:02.440]  in the medium in which it was stored
[38:02.440 --> 38:04.440]  I come down to look at it
[38:04.440 --> 38:10.440]  and she's got six thousand documents stacked up on her table
[38:10.440 --> 38:15.440]  it's about a little over a foot tall
[38:15.440 --> 38:18.440]  and they didn't charge me anything for them
[38:18.440 --> 38:20.440]  so I start going through them
[38:20.440 --> 38:24.440]  and it looks like somebody has shuffled them like a deck of cards
[38:24.440 --> 38:27.440]  because pages are not with pages
[38:27.440 --> 38:31.440]  dates are not with dates so just scatter all over
[38:31.440 --> 38:34.440]  and they had put a
[38:34.440 --> 38:36.440]  some guy in the room an older guy

[39:58.440 --> 40:01.440]  and they said can I tell him what it's about
[40:01.440 --> 40:04.440]  and I said yes, I wore an apology
[40:04.440 --> 40:06.440]  so she came out
[40:06.440 --> 40:09.440]  Mr. Kelton why do you owe me an apology
[40:09.440 --> 40:12.440]  I said well I put in that request for all your emails
[40:12.440 --> 40:15.440]  and she said yes Mr. Kelton you got them
[40:15.440 --> 40:17.440]  and you didn't find anything in there

[48:09.440 --> 48:11.440]  as a public information officer

[48:22.440 --> 48:26.440]  has jurisdiction to prosecute
[48:26.440 --> 48:30.440]  an allegation under the
[48:30.440 --> 48:33.440]  Open Government Act
[48:33.440 --> 48:35.440]  however
[48:35.440 --> 48:38.440]  there is nothing for the attorney general
[48:38.440 --> 48:40.440]  to prosecute
[48:40.440 --> 48:42.440]  until there is a determination
[48:42.440 --> 48:45.440]  of probable cause
[48:45.440 --> 48:47.440]  so filing with the attorney general
[48:47.440 --> 48:52.440]  may well be the wrong place
[48:52.440 --> 48:57.440]  filing with a magistrate is the place
[48:57.440 --> 48:59.440]  put the magistrate on the dime
[48:59.440 --> 49:02.440]  and you walk through the magistrates
[49:02.440 --> 49:07.440]  who refuse to perform their duty
[49:07.440 --> 49:09.440]  and walk all the way up to the spring
[49:09.440 --> 49:10.440]  if you need to
[49:10.440 --> 49:13.440]  if you get a determination of probable cause
[49:13.440 --> 49:15.440]  then the authority of the attorney general
[49:15.440 --> 49:17.440]  is invoked
[49:17.440 --> 49:20.440]  but he doesn't have a thing to say about it
[49:20.440 --> 49:24.440]  until there is a determination of probable cause
[49:24.440 --> 49:27.440]  So a written verified criminal complaint
[49:27.440 --> 49:28.440]  will not act on it
[49:28.440 --> 49:29.440]  or you don't believe it will act on it
[49:29.440 --> 49:31.440]  that's fair, huh?
[49:31.440 --> 49:35.440]  Yeah, I'm saying give it to a magistrate
[49:35.440 --> 49:38.440]  and when a magistrate refuses to act on it
[49:38.440 --> 49:40.440]  give a complaint against a magistrate
[49:40.440 --> 49:42.440]  and grand jury
[49:42.440 --> 49:44.440]  you can give it
[49:44.440 --> 49:46.440]  you can send it to the prosecutor
[49:46.440 --> 49:48.440]  or send it to the attorney general
[49:48.440 --> 49:50.440]  as a courtesy
[49:50.440 --> 49:54.440]  but also send the copy to the local grand jury
[49:54.440 --> 49:56.440]  this is my
[49:56.440 --> 49:59.440]  the argument I'm bringing here
[49:59.440 --> 50:03.440]  prosecutor has nothing to do with this
[50:03.440 --> 50:08.440]  because you merely have a criminal accusation
[50:08.440 --> 50:13.440]  there is no criminal prosecution
[50:13.440 --> 50:16.440]  in place for the prosecutor to come in
[50:16.440 --> 50:20.440]  and represent the interest of the state in
[50:20.440 --> 50:24.440]  so even at an examining trial
[50:24.440 --> 50:27.440]  I can't see any authority of a prosecutor
[50:27.440 --> 50:30.440]  to even be there
[50:30.440 --> 50:33.440]  it's none of his business
[50:33.440 --> 50:38.440]  Well, let's see if an officer arrests someone
[50:38.440 --> 50:40.440]  they're supposed to take him for a magistrate
[50:40.440 --> 50:42.440]  not for a prosecutor
[50:42.440 --> 50:44.440]  Exactly
[50:44.440 --> 50:47.440]  I just told a judge yesterday
[50:47.440 --> 50:49.440]  I'm in Tennessee but it's the same here
[50:49.440 --> 50:52.440]  I bushwhacked him in his courtroom
[50:52.440 --> 50:54.440]  with criminal complaints against some sheriff's deputies
[50:54.440 --> 50:56.440]  and he said, well, Mr. Kelton
[50:56.440 --> 50:58.440]  you really need to file these
[50:58.440 --> 51:01.440]  with the sheriff's department or the prosecutor
[51:01.440 --> 51:03.440]  but since he's against the sheriff's department
[51:03.440 --> 51:05.440]  individuals, the sheriff's department
[51:05.440 --> 51:07.440]  probably wouldn't be a good place
[51:07.440 --> 51:10.440]  you should file these with the prosecutor's attorney
[51:10.440 --> 51:14.440]  I said, well, as far as I can tell
[51:14.440 --> 51:18.440]  there is nothing in law that directs a complaint
[51:18.440 --> 51:20.440]  to a prosecutor's attorney
[51:20.440 --> 51:23.440]  or a police officer
[51:23.440 --> 51:26.440]  everything in law directs a complaint
[51:26.440 --> 51:30.440]  to some magistrate which you are
[51:30.440 --> 51:32.440]  and the prosecutor's attorney
[51:32.440 --> 51:35.440]  he doesn't have any jurisdiction at all
[51:35.440 --> 51:37.440]  if the prosecutor wanted to come in here
[51:37.440 --> 51:40.440]  to this preliminary hearing
[51:40.440 --> 51:45.440]  I would consider him to be here on his own
[51:45.440 --> 51:47.440]  outside his official capacity
[51:47.440 --> 51:50.440]  because he has no official capacity
[51:50.440 --> 51:52.440]  and therefore he would have no immunity
[51:52.440 --> 51:55.440]  for any action I might take against him
[51:55.440 --> 51:58.440]  and this guy was a lawyer
[51:58.440 --> 52:01.440]  and he sat back and kind of scratched his chin
[52:01.440 --> 52:04.440]  he's mulling this over
[52:04.440 --> 52:07.440]  and somehow he can feel
[52:07.440 --> 52:11.440]  the legal cogs falling into place
[52:11.440 --> 52:16.440]  he just hadn't had them stitched together this way before
[52:19.440 --> 52:22.440]  the sending complaints to the attorney general
[52:22.440 --> 52:27.440]  will simply give him the option of trashing him
[52:27.440 --> 52:30.440]  now he is required
[52:30.440 --> 52:33.440]  unless you want to set him up
[52:33.440 --> 52:36.440]  since he has original jurisdiction
[52:36.440 --> 52:40.440]  what the attorney general has been saying
[52:40.440 --> 52:42.440]  is that you have sent us a local prosecutor
[52:42.440 --> 52:44.440]  we don't have jurisdiction
[52:44.440 --> 52:46.440]  yes they do
[52:46.440 --> 52:50.440]  the 39.03 was changed
[52:50.440 --> 52:53.440]  to give the attorney general
[52:53.440 --> 52:55.440]  concurrent jurisdiction
[52:55.440 --> 52:57.440]  with a prosecuting attorney
[52:57.440 --> 53:02.440]  in the matter of a complaint against a public official
[53:02.440 --> 53:05.440]  so yes he does have jurisdiction
[53:05.440 --> 53:07.440]  however
[53:07.440 --> 53:09.440]  the point of that is
[53:09.440 --> 53:11.440]  he has jurisdiction
[53:11.440 --> 53:14.440]  that means when you give the complaint to him
[53:14.440 --> 53:19.440]  Article 2.03 applies to him
[53:19.440 --> 53:22.440]  when a prosecuting attorney is made known in any manner
[53:22.440 --> 53:25.440]  that a public official's violated a law relating to his office
[53:25.440 --> 53:27.440]  he shall reduce the complaint
[53:27.440 --> 53:29.440]  when the information is submitted to the grand jury
[53:29.440 --> 53:32.440]  and he would be a great one to hammer for not doing that
[53:32.440 --> 53:36.440]  charge him criminally
[53:36.440 --> 53:38.440]  for shielding from prosecution
[53:38.440 --> 53:40.440]  38.05
[53:40.440 --> 53:44.440]  for not sending your complaints to the grand jury
[53:44.440 --> 53:46.440]  I love the information
[53:46.440 --> 53:50.440]  but I can't quite keep up with you and everything
[53:50.440 --> 53:54.440]  okay I'm trying to feed this out so it makes sense
[53:54.440 --> 53:58.440]  we're operating from some presuppositions
[53:58.440 --> 54:03.440]  everybody gives complaints to the prosecutor
[54:03.440 --> 54:08.440]  well where in law does a prosecutor have authority
[54:08.440 --> 54:13.440]  to make a determination for all the costs
[54:13.440 --> 54:16.440]  nowhere
[54:16.440 --> 54:21.440]  just because I file a complaint against someone
[54:21.440 --> 54:26.440]  that doesn't mean anything is going to happen
[54:26.440 --> 54:29.440]  that's one of the good things about the way the law works
[54:29.440 --> 54:33.440]  is I can file a complaint and it harms no one
[54:33.440 --> 54:37.440]  so the person I filed against can't whine and cry
[54:37.440 --> 54:43.440]  and say he defamed me
[54:43.440 --> 54:45.440]  no I didn't
[54:45.440 --> 54:50.440]  I just stated that I had reason to believe and did believe
[54:50.440 --> 54:56.440]  you committed this criminal act and I gave that to a magistrate
[54:56.440 --> 55:00.440]  and it was the magistrate's duty to make a determination
[55:00.440 --> 55:02.440]  of probable cause
[55:02.440 --> 55:05.440]  if magistrate found probable cause
[55:05.440 --> 55:08.440]  then something would happen
[55:08.440 --> 55:11.440]  then a prosecution would be initiated
[55:11.440 --> 55:13.440]  but I didn't do it
[55:13.440 --> 55:15.440]  I just gave notice
[55:15.440 --> 55:18.440]  it was the magistrate that initiated the prosecution
[55:18.440 --> 55:23.440]  and that's the only way in Texas law a prosecution can be initiated
[55:23.440 --> 55:30.440]  and that's the only way to invoke the duty of a prosecution attorney
[55:30.440 --> 55:37.440]  other than giving him a complaint
[55:37.440 --> 55:40.440]  when he receives a complaint
[55:40.440 --> 55:45.440]  he is compelled to present that complaint to some magistrate
[55:45.440 --> 55:50.440]  reduce it to an information and submit it to some magistrate of the county
[55:50.440 --> 55:53.440]  or as a public official to the grand jury
[55:53.440 --> 55:56.440]  that's the only duty he has with one
[55:56.440 --> 55:59.440]  he has no possible authority yet
[55:59.440 --> 56:03.440]  until either the grand jury or some magistrate
[56:03.440 --> 56:07.440]  issues a determination of probable cause
[56:07.440 --> 56:10.440]  then his duty is invoked
[56:10.440 --> 56:12.440]  does that make sense?
[56:12.440 --> 56:16.440]  well it does but it leaves me with a couple of questions
[56:16.440 --> 56:19.440]  and this is one I was wanting to ask anyway
[56:19.440 --> 56:23.440]  it's different than the public information questions
[56:23.440 --> 56:24.440]  and it's this
[56:24.440 --> 56:29.440]  people are arresting regularly on failure to identify
[56:29.440 --> 56:32.440]  so I'll use my own case as an example
[56:32.440 --> 56:35.440]  the officer wrote down that I did not identify
[56:35.440 --> 56:38.440]  that he warned me if I didn't identify he was going to arrest me
[56:38.440 --> 56:40.440]  I didn't identify
[56:40.440 --> 56:44.440]  so then he arrested me for failure to identify
[56:44.440 --> 56:45.440]  okay?
[56:45.440 --> 56:48.440]  I think he committed perjury
[56:48.440 --> 56:52.440]  I think he committed aggravated assault
[56:52.440 --> 56:55.440]  first degree felony aggravated assault
[56:55.440 --> 56:58.440]  well yeah I think he committed perjury and aggravated perjury
[56:58.440 --> 57:02.440]  because aggravated perjury is anything that will be involved in the court
[57:02.440 --> 57:04.440]  perjury whenever you lie under oath
[57:04.440 --> 57:08.440]  if he stated that he had reason to believe and did believe
[57:08.440 --> 57:13.440]  that you violated the requirement to identify yourself
[57:13.440 --> 57:16.440]  when there was no such evidence
[57:16.440 --> 57:18.440]  that's aggravated perjury
[57:18.440 --> 57:22.440]  and he's not some ordinary chump off the street
[57:22.440 --> 57:25.440]  he is a professional
[57:25.440 --> 57:28.440]  and he is presumed to have knowledge of the law
[57:28.440 --> 57:32.440]  more so than just a private citizen
[57:32.440 --> 57:35.440]  so absolutely aggravated perjury
[57:35.440 --> 57:38.440]  I mean it is possible to perjure yourself
[57:38.440 --> 57:40.440]  when you do these verified criminal complaints
[57:40.440 --> 57:42.440]  but you really almost have to try
[57:42.440 --> 57:46.440]  which is what these officers are doing when they're arresting for failure to identify
[57:46.440 --> 57:48.440]  I don't have right in front of me
[57:48.440 --> 57:50.440]  but yeah what you just said
[57:50.440 --> 57:54.440]  that I violated the statute
[57:54.440 --> 57:56.440]  yes he said he believed I violated the statute
[57:56.440 --> 58:00.440]  so he's in trouble because I can't violate the statute
[58:00.440 --> 58:03.440]  such as to identify unless I've been arrested
[58:03.440 --> 58:09.440]  and if the allegation did not include
[58:09.440 --> 58:14.440]  the assertion that you had been arrested for some other reason
[58:14.440 --> 58:18.440]  then the complaint is insufficient on its face

[01:04:09.440 --> 01:04:19.440]  and police giving him complaints allows him to do that even though he doesn't have that authority
[01:04:19.440 --> 01:04:26.440]  We want to step around that. When you give a complaint to the Attorney General
[01:04:26.440 --> 01:04:31.440]  he wants to act like prosecutors do when they get a complaint from a policeman
[01:04:31.440 --> 01:04:37.440]  Now the policeman may go along with that nonsense, but you don't have to
[01:04:37.440 --> 01:04:46.440]  because he has concurrent jurisdiction, he becomes the prosecuting attorney
[01:04:46.440 --> 01:04:57.440]  and 203 directs a prosecuting attorney, so this puts him on the hook for Article 203, 2.03
[01:04:57.440 --> 01:04:59.440]  Does that make sense?
[01:04:59.440 --> 01:05:08.440]  Yeah, okay, but I'm not going to do that because I'm going to work up to that. I'd rather go the J.P. route, take criminal complaints to the J.P.

[01:05:13.440 --> 01:05:19.440]  but something about if the J.P. will not take it as a criminal complaint, they don't find probable cause

[01:05:22.440 --> 01:05:33.440]  Absolutely, that was my whole point in walking up to chain. You never ask a public official to do anything you actually want them to do
[01:05:33.440 --> 01:05:41.440]  because you never ask a public official to do anything that the law does not compel them to do
[01:05:41.440 --> 01:05:49.440]  So you ask the J.P. to perform his duty as a magistrate and hold an examining trial when they don't
[01:05:49.440 --> 01:05:57.440]  Gotcha, they touched your tar babies. So absolutely, I was offering these others, depending on your preference
[01:05:57.440 --> 01:06:10.440]  on how quickly you want to get this done, at some point a magistrate will refer you to the prosecuting attorney
[01:06:10.440 --> 01:06:21.440]  and I suggest what you can do is manipulate the magistrate and say, well, as I understand, the attorney general of the state of Texas
[01:06:21.440 --> 01:06:31.440]  has concurrent jurisdiction in matters of complaints against a public official, so should I take this to the attorney general?
[01:06:31.440 --> 01:06:36.440]  And if the magistrate says, oh yeah, oh yeah, take it to the attorney general, take it anywhere, get it out of my court
[01:06:36.440 --> 01:06:45.440]  Then you go to the attorney general with a reference from the magistrate that you were sent to the attorney general by the magistrate
[01:06:45.440 --> 01:06:50.440]  but he didn't send you to file criminal complaints against himself, but you do that anyway
[01:06:50.440 --> 01:06:57.440]  and then you keep going to magistrates. You're giving it to the attorney general just as notice
[01:06:57.440 --> 01:07:12.440]  and you don't have to tell him about article 2.03. 2.03 is operative whether you give notice to the prosecutor about it or not
[01:07:12.440 --> 01:07:18.440]  You know, I tell the story about the hearing aid and he asked me why didn't I tell the judge about the Americans Disabilities Act
[01:07:18.440 --> 01:07:33.440]  Americans Disabilities Act applies whether I tell him or not. So when you send to the attorney general, he doesn't give it to the grand jury
[01:07:33.440 --> 01:07:42.440]  you know, your standard cover letter and such. Then the next magistrate you go, you take an accusation against the attorney general
[01:07:42.440 --> 01:07:50.440]  Now, as you're moving up the chain, you know, you get to the bigger fishes, they're definitely going to send you somewhere else
[01:07:50.440 --> 01:07:55.440]  and the only place they can send you is the prosecutor attorney or attorney general
[01:07:55.440 --> 01:08:02.440]  and if you have already filed these with a prosecutor and the attorney general
[01:08:02.440 --> 01:08:13.440]  then you would ask the judge to please notice that I have criminal complaints against those two in here as well for failing to act
[01:08:13.440 --> 01:08:23.440]  in accordance with article 2.03. So Bubba, what are you going to do now? Did that make sense?
[01:08:23.440 --> 01:08:33.440]  Well, no, not yet, but I think it will when you can answer this for me. So if I ask the magistrate, which I think will be a JP
[01:08:33.440 --> 01:08:40.440]  I'm asking them for an examining trial. They don't give me an examining trial. Well, then they've denied my due process, right?
[01:08:40.440 --> 01:08:45.440]  They ask for an examining trial to make a criminal complaint as far as I understand it.
[01:08:45.440 --> 01:08:53.440]  Well, what happens if they give me a criminal examining trial for my criminal complaint and then they say, okay, there's no probable cause?
[01:08:53.440 --> 01:09:00.440]  Okay, you just don't file charges against him and take it to another magistrate.
[01:09:00.440 --> 01:09:01.440]  Okay.
[01:09:01.440 --> 01:09:05.440]  There's nothing I can find in law that prohibits that.
[01:09:05.440 --> 01:09:17.440]  A prosecutor can bring an accusation either to a magistrate or grand jury and the judge can look at it and say, man, you don't have enough here.
[01:09:17.440 --> 01:09:21.440]  So I'm going to pass this and that happens on occasion.
[01:09:21.440 --> 01:09:28.440]  The prosecutor can then go out and get more information and come back again. He can come back as many times as he wants to.
[01:09:28.440 --> 01:09:30.440]  So can you.
[01:09:30.440 --> 01:09:36.440]  And Attorney General Opinion H 500, you might want to write this down.
[01:09:36.440 --> 01:09:50.440]  H 500 says any magistrate may take any complaint, felony or misdemeanor, state or federal.
[01:09:50.440 --> 01:09:56.440]  There is no jurisdictional limitations on a magistrate.
[01:09:56.440 --> 01:10:00.440]  A magistrate is a statewide magistrate.
[01:10:00.440 --> 01:10:06.440]  They can take a complaint from anywhere in the state.
[01:10:06.440 --> 01:10:09.440]  I give you some ideas.
[01:10:09.440 --> 01:10:10.440]  Okay.
[01:10:10.440 --> 01:10:14.440]  You start taking it to other counties.
[01:10:14.440 --> 01:10:15.440]  Right.
[01:10:15.440 --> 01:10:26.440]  And magistrates in those counties, you start tying them up in the mess that the other county made. The magistrate is not going to be ahead of the tamper.

[01:10:30.440 --> 01:10:32.440]  It keeps getting bigger and bigger.

[01:10:33.440 --> 01:10:43.440]  I'm thinking by the time I attach a politician to every branch of that tree, like a Christmas tree, I know I'll be able to cut it down.

[01:10:50.440 --> 01:11:00.440]  But when you go to the a politician and say, here's a problem we have, we need this fixed.

[01:11:01.440 --> 01:11:02.440]  Well, we did that.
[01:11:02.440 --> 01:11:03.440]  We need to do this.
[01:11:03.440 --> 01:11:04.440]  We did that.
[01:11:04.440 --> 01:11:12.440]  Demonstrate that everyone in the chain is in equal violation of law.

[01:11:22.440 --> 01:11:37.440]  When you engage a politician, and if you use those really subtly, if say you go to a, once you work up, say to a district judge or county judge,

[01:11:45.440 --> 01:11:55.440]  Then you go to the local state rep or state senator and bring this issue to the senator and say, these guys are violating law.
[01:11:55.440 --> 01:11:58.440]  I can't get any of them to follow law.
[01:11:58.440 --> 01:12:08.440]  And what's going to happen is that state senator or that state representative is going to contact this judge and say, what the heck's going on here?
[01:12:08.440 --> 01:12:12.440]  Why are these guys accusing you guys of not following law?
[01:12:12.440 --> 01:12:14.440]  You want to explain this?
[01:12:14.440 --> 01:12:17.440]  It doesn't matter what the judge says.
[01:12:17.440 --> 01:12:22.440]  This is going to terrify the judge because he's very political.
[01:12:22.440 --> 01:12:33.440]  And these judges, they network with politicians because everything they're doing is political.
[01:12:33.440 --> 01:12:44.440]  And when you start giving them political black eyes, well, they have to explain to the state senator or state rep their behavior down here in court.
[01:12:44.440 --> 01:12:46.440]  It doesn't matter what they tell them.
[01:12:46.440 --> 01:12:54.440]  They're going to be really, really unhappy at having to answer these questions.
[01:12:54.440 --> 01:12:58.440]  And you put the politicians on the top.
[01:12:58.440 --> 01:12:59.440]  Okay.
[01:12:59.440 --> 01:13:03.440]  Well, look, I got two more little things here, I think.

[01:13:05.440 --> 01:13:11.440]  I'm asking for certified copies because I got that from Max and I thought I knew what certified was.
[01:13:11.440 --> 01:13:21.440]  Certified really just means that the post office will keep, will track your mail.
[01:13:21.440 --> 01:13:27.440]  And they will keep a record of everywhere that document went.
[01:13:27.440 --> 01:13:32.440]  They can tell you who got it, who delivered it, where and when.
[01:13:32.440 --> 01:13:39.440]  If you get return receipt, then when they deliver it, they get somebody to sign it and they can tell you who they gave it to.
[01:13:39.440 --> 01:13:45.440]  If it's just certified, they can tell you it absolutely was delivered to this location.
[01:13:45.440 --> 01:13:50.440]  If you get a return receipt, then they can tell you who signed for it.
[01:13:50.440 --> 01:14:08.440]  And that's often pretty valuable because if you send a doc, a set of docs to the grand jury, they will always go to the district attorney's office and some clerk in the mailroom will sign for them.
[01:14:08.440 --> 01:14:19.440]  So that when they don't get to the grand jury, you file criminal charges against whoever signed for that document, accuse him of tampering the U.S. mail, tampering the government document.
[01:14:19.440 --> 01:14:34.440]  And that clerk is going to get apoplexy when you come after the clerk and the prosecutor is going to want to find a way to run interference for the clerk.
[01:14:34.440 --> 01:14:38.440]  Raise the stakes.
[01:14:38.440 --> 01:14:43.440]  Well, actually, I was talking about the other certified.
[01:14:43.440 --> 01:14:47.440]  Certificate of service or?

[01:22:05.440 --> 01:22:10.440]  Well, it was, but she was up in the years, so I'm going to let her slide on it.
[01:22:10.440 --> 01:22:13.440]  She's a nice lady. I'm glad I got to have met her.
[01:22:13.440 --> 01:22:18.440]  So I took the document, I fixed the county for the notary.
[01:22:18.440 --> 01:22:22.440]  I went back to the clerk and she said, no, I'm not going to sign it this time
[01:22:22.440 --> 01:22:27.440]  because it would be a conflict of interest since you have a case in this court.
[01:22:27.440 --> 01:22:33.440]  So I went and got it notarized somewhere else and I got a receipt for it
[01:22:33.440 --> 01:22:37.440]  and I sent the paper that got notarized.
[01:22:37.440 --> 01:22:44.440]  I sent it to the clerk and I sent the $10 receipt to the clerk.
[01:22:44.440 --> 01:22:48.440]  So let them know, I will be asking for that money.
[01:22:48.440 --> 01:22:53.440]  I'm going to send most of them back to me.
[01:22:53.440 --> 01:22:57.440]  Okay, so got that one handled.
[01:22:57.440 --> 01:23:00.440]  Episteel's easy enough.

[01:23:56.440 --> 01:24:00.440]  You've been with them all the time. It's been behind the curtain so to speak.
[01:24:00.440 --> 01:24:05.440]  I've been working behind the curtain or you have. I'm working on them all the time
[01:24:05.440 --> 01:24:10.440]  they don't know it but then they find out like I'm sure the judge kind of was like
[01:24:10.440 --> 01:24:16.440]  oh criminal complaint. The judge took my order, my proposed order.
[01:24:16.440 --> 01:24:23.440]  This is a traffic citation and I did Eddie's motion to quash
[01:24:23.440 --> 01:24:31.440]  and I filed it. It's 21 pages and she says well I'm going to let you file this
[01:24:31.440 --> 01:24:33.440]  but I'm not going to let you file that order.
[01:24:33.440 --> 01:24:38.440]  And she took it out and I said the judge I can't make you take it.
[01:24:38.440 --> 01:24:42.440]  You don't want to take it but I do need something saying I was here
[01:24:42.440 --> 01:24:45.440]  and so she filed stamp the rest of the pages or the top of the rest of the pages.
[01:24:45.440 --> 01:24:51.440]  I got home she took the order the proposed order that was out of my pocket.
[01:24:51.440 --> 01:24:55.440]  That's them.
[01:24:55.440 --> 01:25:04.440]  I would, yeah but that's going to be no harm no foul.
[01:25:04.440 --> 01:25:07.440]  Well you can file criminal charges on her.
[01:25:07.440 --> 01:25:12.440]  She can say well you know whoops but you know if he has these documentation
[01:25:12.440 --> 01:25:15.440]  then it's not like I took anything of value from him.

[01:25:18.440 --> 01:25:24.440]  There are things we can, you know you'll get more potential allegations than you can get to.

[01:25:49.440 --> 01:25:55.440]  There were three more bailiffs there and they did not.
[01:25:55.440 --> 01:26:01.440]  The fact that I was attempting to enter a public court was a federal constitutional right
[01:26:01.440 --> 01:26:08.440]  that made the aggravated assault federal and under 18 US code 4.
[01:26:08.440 --> 01:26:13.440]  Right up there at the front, this prison of felony in the state of Tennessee
[01:26:13.440 --> 01:26:18.440]  there is no specific duty to give notice of crime.
[01:26:18.440 --> 01:26:21.440]  But there is in the Fed.
[01:26:21.440 --> 01:26:28.440]  So I can charge all three of these bailiffs with official misconduct
[01:26:28.440 --> 01:26:34.440]  for criminal violation of 18 US code 4.
[01:26:34.440 --> 01:26:38.440]  There are so many complaints you can find.
[01:26:38.440 --> 01:26:41.440]  Just stack them up.
[01:26:41.440 --> 01:26:43.440]  You stack them all up.
[01:26:43.440 --> 01:26:46.440]  What did the other bailiffs do?

[01:26:48.440 --> 01:26:51.440]  They were clearly embarrassed by this captain.
[01:26:51.440 --> 01:26:56.440]  I was playing him and there was one guy there in Cackies.
[01:26:56.440 --> 01:27:03.440]  He had stepped back and had his arms crossed and had this frown on his face
[01:27:03.440 --> 01:27:06.440]  but he was staring at the captain.
[01:27:06.440 --> 01:27:10.440]  The bailiff saw me playing the captain.
[01:27:10.440 --> 01:27:15.440]  The captain told me that the first guy I charged, I filed criminal charges against
[01:27:15.440 --> 01:27:19.440]  that he said I told him I hated him.
[01:27:19.440 --> 01:27:20.440]  So I didn't say anything.
[01:27:20.440 --> 01:27:21.440]  This guy was great.
[01:27:21.440 --> 01:27:22.440]  He was a pro.
[01:27:22.440 --> 01:27:24.440]  He was smart.
[01:27:24.440 --> 01:27:25.440]  He was articulate.
[01:27:25.440 --> 01:27:27.440]  He was polite.
[01:27:27.440 --> 01:27:29.440]  He was everything I wanted to be.
[01:27:29.440 --> 01:27:33.440]  He wasn't a jackbooty thug like you are.
[01:27:33.440 --> 01:27:37.440]  He had a wayward word.
[01:27:37.440 --> 01:27:42.440]  This captain just kind of stopped in his tracks like he was thinking,
[01:27:42.440 --> 01:27:47.440]  I don't believe he just said that to me and just said it in passing like it meant nothing.
[01:27:47.440 --> 01:27:53.440]  Then he started winding things up and when he said,
[01:27:53.440 --> 01:27:55.440]  go ahead, get loud.
[01:27:55.440 --> 01:27:56.440]  I want to hear you get loud.
[01:27:56.440 --> 01:27:59.440]  I just turned my back on him and stepped away.
[01:27:59.440 --> 01:28:04.440]  When I turned my back on him, he lost it and grabbed me.
[01:28:04.440 --> 01:28:07.440]  These other bailiffs, they were all backing up.
[01:28:07.440 --> 01:28:10.440]  They wouldn't have anything to do with this.
[01:28:10.440 --> 01:28:12.440]  I was playing him.
[01:28:12.440 --> 01:28:14.440]  They could see I was playing him.
[01:28:14.440 --> 01:28:19.440]  They could see him dancing with me and they were all embarrassed.
[01:28:19.440 --> 01:28:24.440]  But not one of them gave notice of a federal crime.
[01:28:24.440 --> 01:28:30.440]  So I will be bringing them up and they will be furious at this captain for putting them in that position.
[01:28:30.440 --> 01:28:33.440]  First thing the captain told me, I know who you are.
[01:28:33.440 --> 01:28:37.440]  I looked you up in Texas and I know what you've been doing in Texas.
[01:28:37.440 --> 01:28:44.440]  And I said, well then you should know better than to screw with me.
[01:28:44.440 --> 01:28:48.440]  That just made him angrier.
[01:28:48.440 --> 01:28:52.440]  So these other guys knew I was playing him and they knew he was acting ignorant.
[01:28:52.440 --> 01:28:55.440]  And he's the captain.
[01:28:55.440 --> 01:29:00.440]  He's the head guy of all people and he's acting ignorant this way.

[01:34:20.440 --> 01:34:26.440]  I also was never taken to a magistrate and we're in the federal court now
[01:34:26.440 --> 01:34:33.440]  and I'm filing a response to summary judgment.
[01:34:33.440 --> 01:34:42.440]  And it just dawned on me the other day there has never been a probable cause determination in my case.
[01:34:42.440 --> 01:34:52.440]  But when I filed on the Title 42, 1983 suit, a couple of my claims were dismissed
[01:34:52.440 --> 01:34:59.440]  but the judge said there was probable cause because I was driving a motor vehicle
[01:34:59.440 --> 01:35:03.440]  and I didn't have a license plate on my motor vehicle.
[01:35:03.440 --> 01:35:12.440]  Is there a rule of 16.17 order in the record?
[01:35:12.440 --> 01:35:15.440]  I don't even know what that is.
[01:35:15.440 --> 01:35:19.440]  Okay, go to Chapter 16. Oh, you're in Arizona.
[01:35:19.440 --> 01:35:22.440]  Oh, that may be different.
[01:35:22.440 --> 01:35:33.440]  Once a judge makes a determination of problem cause, he has to file an order stating what he found.
[01:35:33.440 --> 01:35:40.440]  What are the rules on a preliminary hearing in Arizona?

[01:36:07.440 --> 01:36:12.440]  It matters if there was a determination of probable cause.

[01:36:16.440 --> 01:36:25.440]  That's the question that should be asked to the federal court that should be in the form of a subject matter jurisdiction challenge.
[01:36:25.440 --> 01:36:30.440]  The court never made a ruling on probable cause.
[01:36:30.440 --> 01:36:38.440]  And since it didn't, it never accrued subject matter jurisdiction.

[01:37:13.440 --> 01:37:21.440]  It is the judge that's ordering you to stand and answer and that's the one that has to prove subject matter jurisdiction.
[01:37:21.440 --> 01:37:23.440]  This is a civil case.
[01:37:23.440 --> 01:37:25.440]  I'm suing the officer.
[01:37:25.440 --> 01:37:29.440]  Oh, okay.
[01:37:29.440 --> 01:37:30.440]  This is a civil case.
[01:37:30.440 --> 01:37:34.440]  What's the claim against the officer?

[01:37:55.440 --> 01:38:02.440]  So this is not based on asking a judge to prove a subject matter jurisdiction.

[01:38:03.440 --> 01:38:14.440]  And the only claim of mine that stuck was the fact that the officer did an illegal search of my vehicle while I was handcuffed.

[01:38:16.440 --> 01:38:22.440]  You know, if he would have, you know, he never had probable cause to even stop me.
[01:38:22.440 --> 01:38:34.440]  What does Arizona law say about a duty to identify?
[01:38:34.440 --> 01:38:44.440]  I had no, he cited me under the motor vehicle code for failing to identify.
[01:38:44.440 --> 01:38:49.440]  But by duty to identify, I only have to give a name until I'm under arrest in Arizona.
[01:38:49.440 --> 01:38:55.440]  So wait a minute, hold on, you may, did you have a driver's license?
[01:38:55.440 --> 01:38:57.440]  Yes, I did.

[01:38:59.440 --> 01:39:11.440]  When you apply for a driver's license, one of the standard agreements is that you will display it on demand.

[01:39:19.440 --> 01:39:24.440]  It doesn't say you'll display it if you're operating under the authority of it.
[01:39:24.440 --> 01:39:35.440]  The contract says if you have a commercial license, you agree to display it on demand.
[01:39:35.440 --> 01:39:36.440]  Really?
[01:39:36.440 --> 01:39:39.440]  Where would you say that, in the statute?
[01:39:39.440 --> 01:39:44.440]  Look, it's in the application and it's in the code.
[01:39:44.440 --> 01:39:49.440]  This is always in transportation code.
[01:39:49.440 --> 01:40:03.440]  So if a DOT officer stops a truck driver, then the first thing he wants to see is his authority to operate a commercial vehicle in the form of a license.
[01:40:03.440 --> 01:40:11.440]  And when they filed for the license, they agreed to display it.
[01:40:11.440 --> 01:40:14.440]  There's a way past it, though.
[01:40:14.440 --> 01:40:16.440]  What's that?
[01:40:16.440 --> 01:40:17.440]  I don't know.
[01:40:17.440 --> 01:40:20.440]  Did you have plates on your vehicle?
[01:40:20.440 --> 01:40:22.440]  No, I did not.
[01:40:22.440 --> 01:40:34.440]  Okay, then the officer had no probable cause to believe that you were in commerce if you had commercial plates on your vehicle.
[01:40:34.440 --> 01:40:46.440]  Then he could look at your vehicle and say, this vehicle has been deliberately licensed for the purpose of operating in commerce.
[01:40:46.440 --> 01:40:54.440]  It doesn't mean that it is operated in commerce, but it can be and that gives me reasonable probable cause to believe that it is.
[01:40:54.440 --> 01:40:57.440]  So I have authority to stop based on that.
[01:40:57.440 --> 01:41:07.440]  Then the first thing he has to determine is, is the vehicle currently being operated in commerce?
[01:41:07.440 --> 01:41:11.440]  They don't do that, of course, but this is how the law is structured.
[01:41:11.440 --> 01:41:24.440]  So if you didn't have plates, what was the nature of the probable cause to believe that you were operating within the scope of the statutory scheme?
[01:41:24.440 --> 01:41:26.440]  No, wait a minute, Randy.
[01:41:26.440 --> 01:41:31.440]  I had a sign that said private, not for hire on the back of my truck.
[01:41:31.440 --> 01:41:37.440]  So he had noticed that you were not operating in commerce.
[01:41:37.440 --> 01:41:42.440]  Did you raise that issue with court?
[01:41:42.440 --> 01:41:49.440]  Well, yes, I mean that's been discussed in the pleadings and things in the federal court.

[01:48:21.440 --> 01:48:36.440]  I've been sentenced to 24 months, and after I filed a couple of motions, I have not heard a peep from them until today.
[01:48:36.440 --> 01:48:51.440]  And now they want, I've got this order for a status conference, and I really don't know what the status conference is.
[01:48:51.440 --> 01:48:54.440]  I don't know what in the world I might expect.
[01:48:54.440 --> 01:49:09.440]  But would they try to make a deal? Would they try to? Because my motion was they wanted to charge me, I don't know, it was over $1,000 to file my appeal.
[01:49:09.440 --> 01:49:28.440]  I filed a motion, or it was a demand for them to waive all the costs based on that there's no constitutional money.
[01:49:28.440 --> 01:49:49.440]  And so I've got a 10-page brief, and anyway, the only thing that I can ascribe to this 11 months of not hearing anything from them is they just don't know what to do with it.
[01:49:49.440 --> 01:50:08.440]  And I also invoke their fiduciary duty under, I think it was United States v. McNally v. U.S., where it says a public official is a fiduciary toward the public,
[01:50:08.440 --> 01:50:21.440]  including in the case of a judge, the litigants who appear before him, and if he deliberately conceals material information from them, he is guilty of fraud.
[01:50:21.440 --> 01:50:24.440]  Sounds pretty good to me.
[01:50:24.440 --> 01:50:36.440]  Okay, McNally v. U.S., say that again, if he, who was he? I kind of missed on the pronouns.
[01:50:36.440 --> 01:50:41.440]  It should refer to the judge or the public official.
[01:50:41.440 --> 01:50:54.440]  It says that a public official is a fiduciary toward the public, including in the case of a judge, the litigants who appear before him.
[01:50:54.440 --> 01:51:08.440]  And if he, meaning the judge, deliberately conceals material information from them, which would be the litigants before him, which that would include me, he is guilty of fraud.
[01:51:08.440 --> 01:51:17.440]  So the judge has a fiduciary duty to disclose information to me.
[01:51:17.440 --> 01:51:26.440]  Okay, what information is the judge required to disclose?
[01:51:26.440 --> 01:51:36.440]  Both of office? Anything that would disqualify him? Any undue influences?
[01:51:36.440 --> 01:51:50.440]  I'm not sure what he has a duty to disclose. Do you have the case law, the statute that specifies what the judge must disclose?
[01:51:50.440 --> 01:52:17.440]  Well, he's in my motion to disqualify. I go into more detail into his duty of loyalty and his duty to dialogue.
[01:52:17.440 --> 01:52:44.440]  I quote from legal books, and this, for example, the duty to loyalty says that the keystone of the duty of loyalty is the legal obligation that the fiduciary
[01:52:44.440 --> 01:52:52.440]  use her powers not for her own benefit, but for the exclusive benefit of her beneficiary.
[01:52:52.440 --> 01:53:03.440]  The fiduciary is prohibited from engaging in self-interested transactions and is required to pursue the interest of her beneficiary above her own.
[01:53:03.440 --> 01:53:14.440]  So inflexible is the duty of loyalty that it requires a fiduciary to be undivided and undiluted in her faithfulness.
[01:53:14.440 --> 01:53:25.440]  And that's from a fiduciary theology of judging by Ethan Leib, David Honay, and Michael Serrata.
[01:53:25.440 --> 01:53:27.440]  So it's a book about...

[01:53:46.440 --> 01:53:59.440]  And I'm going to maintain that his refusal to do so amounted to a denial of due process and equal protection of laws to me.
[01:53:59.440 --> 01:54:09.440]  With this, I can say he had a fiduciary duty to me because I had planned on going to, in Tennessee, to have county mayors.
[01:54:09.440 --> 01:54:23.440]  I was going to go to the county mayor and get evidence of their bonds and their insurance policies.
[01:54:23.440 --> 01:54:29.440]  All of them have to have a bond and a $75,000 bond on police officers.
[01:54:29.440 --> 01:54:34.440]  So I've got five police officers at $75,000 apiece. I get to go after them four.
[01:54:34.440 --> 01:54:36.440]  Now I want to see what the judges is.
[01:54:36.440 --> 01:54:47.440]  And this would give me a good shot at the judges accusing the judge of failing to act in his fiduciary duty.
[01:54:47.440 --> 01:54:49.440]  This would be great.
[01:54:49.440 --> 01:54:54.440]  Yeah, that's one of the things that the judge did in my case when I asked for his bond information.
[01:54:54.440 --> 01:54:56.440]  He refused to give it to me.
[01:54:56.440 --> 01:54:59.440]  So that was before I had found this.
[01:54:59.440 --> 01:55:10.440]  But after putting this in these two motions, I had not heard a peep from them in 11 months.
[01:55:10.440 --> 01:55:12.440]  This is post-judgment.
[01:55:12.440 --> 01:55:24.440]  And so now they want a status conference, and I don't trust them any more than I trust the devil himself.
[01:55:24.440 --> 01:55:28.440]  And so I just don't know what to expect going into a status conference.
[01:55:28.440 --> 01:55:33.440]  Is this something they would seek a resolution to say, hey, how can we make this go away?
[01:55:33.440 --> 01:55:38.440]  Or do you think this is something where they would try to coerce me into...
[01:55:38.440 --> 01:55:44.440]  What happened in my case when the railroaded me in Cherokee County,
[01:55:44.440 --> 01:55:49.440]  and then I filed 35 criminal complaints against them with the Court of Appeals.
[01:55:49.440 --> 01:55:54.440]  Two days later, I was out.
[01:55:54.440 --> 01:56:03.440]  After getting a conviction and the jury throwing the book at me, based on the garbage the judge pulled,
[01:56:03.440 --> 01:56:09.440]  I filed criminal charges against all of them, the prosecutor had him come down and make me a deal.
[01:56:09.440 --> 01:56:23.440]  And the deal was, took a little negotiation, time served, no probation and $500 fine.
[01:56:23.440 --> 01:56:29.440]  I never paid the $500, they never asked for it.
[01:56:29.440 --> 01:56:40.440]  So even after conviction, they got things they can do if you're on their case.
[01:56:40.440 --> 01:56:47.440]  Yeah, I think that the only thing I would settle for is that if they just set aside the judgment completely,
[01:56:47.440 --> 01:56:56.440]  because they never had probable cause, the judge used the wrong law to prosecute the case.
[01:56:56.440 --> 01:57:01.440]  Well, the one thing to understand, you never expect to win your case in the trial court.
[01:57:01.440 --> 01:57:04.440]  The appellate court is where you always win it.
[01:57:04.440 --> 01:57:14.440]  And their problem is, is you made it to the appellate court, you got the record, that now they have to deal with the record.
[01:57:14.440 --> 01:57:19.440]  And they may not want to.
[01:57:19.440 --> 01:57:28.440]  So you may be right, they may be ready to make a deal to get you to go away and leave them alone.
[01:57:28.440 --> 01:57:39.440]  Maybe I should file a few more complaints walking into this thing, so...
[01:57:39.440 --> 01:57:45.440]  Have you already filed criminal charges against them?
[01:57:45.440 --> 01:57:49.440]  Not really, no.
[01:57:49.440 --> 01:57:52.440]  Well, why not?
[01:57:52.440 --> 01:57:59.440]  Well, life has a way of readjusting authority sometimes.
[01:57:59.440 --> 01:58:08.440]  Well, you still do it now, that's what I did after conviction, I filed criminal charges.

[01:58:14.440 --> 01:58:20.440]  So that sounds like a really good course of action.
