[01:13.640 --> 01:18.480] that a federal court stop the state from flagging about 95,000 people as potentially illegally

[01:19.840 --> 01:24.640] The list was compiled after an 11-month-long investigation by the Office of the Texas Secretary
[01:24.640 --> 01:30.000] of State and the Texas Department of Public Safety which sought to identify non-U.S. citizens
[01:30.000 --> 01:33.360] who were registered to vote when obtaining age-arguage license.
[01:33.360 --> 01:37.040] Over half of the 95,000 didn't devote, it seems.
[01:37.040 --> 01:41.080] However, further controversy was raised when it became clear that some of the names were
[01:41.080 --> 01:45.360] not in fact belonging to those who were non-citizens and registered.
[01:45.360 --> 01:50.880] Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote.
[01:50.880 --> 01:55.240] Registered voters who receive letters querying their citizenship have 30 days to respond
[01:55.240 --> 01:57.040] with proof of eligibility.
[01:57.040 --> 02:01.240] Texas Attorney General Ken Paxton and David Whitley, the Texas Secretary of State, have
[02:01.240 --> 02:09.000] yet to officially comment regarding this list and any updates pertaining to it.
[02:09.000 --> 02:14.400] A Texas man of only 24 years old, William Brown, died from a severed artery in his neck after
[02:14.400 --> 02:16.920] an artery, vape pen, exploded while he was using it.

[02:20.640 --> 02:24.240] An X-ray revealed that a piece of metal was embedded in his brainstem.

[04:37.640 --> 04:46.320] without fear of encountering a cop who is going to kill you because you can't turn
[04:46.320 --> 04:52.680] on the news, you can't go anywhere without reading a headline or seeing a video or some
[04:52.680 --> 04:57.440] news conference or something where another cop has either attacked or killed another
[04:57.440 --> 05:01.240] individual without cause.
[05:01.240 --> 05:07.320] They always try to justify it but if you look at the rational facts of what is there, what
[05:07.320 --> 05:09.400] they did cannot be justified.
[05:09.400 --> 05:16.120] It would not be justifiable for you and I, therefore it is not justifiable for them.
[05:16.120 --> 05:21.680] The fact that they are on the job does not give them the indiscriminate right to kill
[05:21.680 --> 05:27.600] anybody they want to and then excuse it through any means they want to.
[05:27.600 --> 05:34.160] But they are doing it and the courts are helping them do it.
[05:34.160 --> 05:39.560] The courts have replaced the bill of rights with public policy.
[05:39.560 --> 05:47.680] More specific department policy as to what these officers can and cannot do.
[05:47.680 --> 05:53.080] If the department policy doesn't specifically prohibit them from murdering you then that
[05:53.080 --> 05:58.520] is law enough according to the courts to not hold the officer accountable because he didn't
[05:58.520 --> 06:04.000] actually break any policy.
[06:04.000 --> 06:08.840] That's getting a little far off the reservation from my liking as to what we created government
[06:08.840 --> 06:09.840] to do.
[06:09.840 --> 06:15.800] But then again, I'm just one guy.
[06:15.800 --> 06:19.440] Maybe I'm the one that's sitting there wrong for thinking what they're doing is wrong and
[06:19.440 --> 06:25.920] what those that are protecting them is doing is wrong or are doing is wrong.

[09:01.080 --> 09:07.640] We filed an appeal on a seat belt that I sold you about a long time ago and with yours
[09:07.640 --> 09:17.680] and Randy's help, we did a pretty good job of writing it up and the main issue was I
[09:17.680 --> 09:21.560] could read you what they wrote as an answer in the appeal.
[09:21.560 --> 09:26.480] In other words, they didn't overturn the, they didn't dismiss the ticket.
[09:26.480 --> 09:32.920] They said, yeah, you're guilty and here's why and I could go through all that but the
[09:32.920 --> 09:39.040] real reason, there were several things that the defendant wrote himself and I wrote the
[09:39.040 --> 09:46.840] one that said something like this, the ticket says no seat belt.
[09:46.840 --> 09:55.040] This officer stands up in court and without giving proper notice, changes material facts
[09:55.040 --> 10:01.000] and says, well, it was later determined that he probably was, he may have been wearing
[10:01.000 --> 10:04.080] a seat belt but he was just wearing it wrong.
[10:04.080 --> 10:13.080] Well, now number one, they violated his rights because they didn't give him proper notice.
[10:13.080 --> 10:22.240] No time for discovery, they just, okay, that's neither a proper notice or discovery issue.
[10:22.240 --> 10:26.000] It's a time to impeach the witness issue.
[10:26.000 --> 10:29.840] May this is what's considered the evidentiary phase of the trial.
[10:29.840 --> 10:33.760] Any discovery that was done is irrelevant to what comes out of the evidentiary phase
[10:33.760 --> 10:35.560] of the trial.
[10:35.560 --> 10:40.280] You have to know what to ask for in discovery before the trial even begins.
[10:40.280 --> 10:46.680] So if you had prior information relating to what the officer was asserting to be fact
[10:46.680 --> 10:52.440] and the officer later changed that fact on the witness stand, then that's an impeachable
[10:52.440 --> 10:53.440] statement.
[10:53.440 --> 10:57.240] Well, officer, previously you stated he was not wearing the seat belt.
[10:57.240 --> 10:59.680] The citation says not wearing the seat belt.
[10:59.680 --> 11:02.280] The complaint says not wearing the seat belt.
[11:02.280 --> 11:07.360] Yet here you just testified that he was wearing the seat belt.
[11:07.360 --> 11:11.960] Nothing in the citation, nothing in the complaint, nothing in any of the evidence introduced by
[11:11.960 --> 11:16.400] you to this date has mentioned incorrect wearing of a seat belt.
[11:16.400 --> 11:21.080] Now suddenly you want to state that that is the basis for the citation after all this
[11:21.080 --> 11:27.240] time has passed and all these facts have been presented as the evidence in discovery.
[11:27.240 --> 11:34.080] So were you lying when you made the ticket out or are you lying on the stand today?
[11:34.080 --> 11:37.040] That's when he makes an impeachable statement.
[11:37.040 --> 11:42.560] When the witness gives conflicting testimony, that's when you can get the conviction overturned
[11:42.560 --> 11:49.680] because the witness falsified the evidence prior to the trial.
[11:49.680 --> 11:57.360] And then you were unable to obtain proper evidence because of the facts you were given in relation
[11:57.360 --> 12:00.040] to the charge.
[12:00.040 --> 12:01.040] See how that works?
[12:01.040 --> 12:09.280] Well, during the trial the defendant stood up and said, but your honor, the ticket, I
[12:09.280 --> 12:17.920] was ticketed for failure to wear a seat belt and now this is contradictory.
[12:17.920 --> 12:22.000] And he brought it up to the judge and the judge went right past it and so did the appeals
[12:22.000 --> 12:23.000] court.
[12:23.000 --> 12:30.640] Now at the scene, at the tragic scene itself, the cop did now, here it comes, the cop did
[12:30.640 --> 12:35.240] say, I stopped you because you weren't wearing your seat belt and the witness, one of the
[12:35.240 --> 12:40.440] witnesses, there was a witness in the car who got out and said, officer, I saw that
[12:40.440 --> 12:44.800] he was wearing his seat belt and I'll testify to that in court.
[12:44.800 --> 12:48.240] That's when the cop said, well, he probably just wasn't wearing it right.
[12:48.240 --> 12:51.120] Okay, that's at the same instance.
[12:51.120 --> 12:55.000] Then he didn't give false information on the stand.
[12:55.000 --> 13:00.040] It conflicts with what the actual allegation is, which means they didn't prove the charge
[13:00.040 --> 13:06.240] that they were making and that's what you should have objected to.
[13:06.240 --> 13:10.840] They're attempting to, they're charging him with this, but they're convicting him of that
[13:10.840 --> 13:13.440] and that is not a part of the original charge.
[13:13.440 --> 13:17.520] That's what he said, that's what the defendant said, exactly that.
[13:17.520 --> 13:22.240] He said, first you said one thing, now you're saying something else and it contradicts.
[13:22.240 --> 13:25.880] No, that's not the same thing.
[13:25.880 --> 13:30.520] The elemental fact pattern is wrong.
[13:30.520 --> 13:35.080] Not wearing a seat belt has a specific set of factual elements that must exist for the
[13:35.080 --> 13:37.120] charge to be true, right?
[13:37.120 --> 13:38.120] Yep.
[13:38.120 --> 13:39.120] Okay.
[13:39.120 --> 13:45.600] In order for an incorrect wearing of a seat belt to be a valid charge, that there must
[13:45.600 --> 13:51.160] be a statute that says it's an offense to incorrectly wear the seat belt.
[13:51.160 --> 13:58.280] Now, if they are not part of the same set of statutes or the same statute, in other
[13:58.280 --> 14:05.040] words, just different conditions thereof, then they did not prove the charge they made.
[14:05.040 --> 14:10.320] They proved of something different without the consent of the accused to being tried
[14:10.320 --> 14:16.560] in a different set of facts or on a different set of facts, okay?
[14:16.560 --> 14:18.720] And that's the issue that should have been raised.
[14:18.720 --> 14:26.320] It's not the same as what you're talking about.
[14:26.320 --> 14:27.320] So who's wrong?
[14:27.320 --> 14:29.600] Us or the cop?
[14:29.600 --> 14:37.080] Well without knowing exactly what was put in the appeal, I can't answer that.
[14:37.080 --> 14:41.560] If the only issue raised on the appeal was the fact that the officer was allegedly giving
[14:41.560 --> 14:48.120] conflicting testimony, then that's where you lost the issue right there.
[14:48.120 --> 14:52.560] Because the issue is the state failed to prove the charge.
[14:52.560 --> 14:57.360] They did not prove all the required elements of the actual offense.
[14:57.360 --> 15:04.200] They instead attempted to change offenses at trial, and now you can claim no notice to
[15:04.200 --> 15:05.200] the accused.
[15:05.200 --> 15:06.200] Okay?
[15:06.200 --> 15:07.760] Say that again.
[15:07.760 --> 15:14.120] I said they tried to change the offense at trial without notice to the accused.
[15:14.120 --> 15:20.280] That's something you could complain about, but the issue remains, is there such an offense

[15:57.160 --> 16:03.720] constitutes the same as not wearing, and as long as it's a factual match of the pattern

[20:19.400 --> 20:25.920] I didn't see any place where it said that wearing it wrong is akin to not wearing it
[20:25.920 --> 20:26.920] at all.
[20:26.920 --> 20:33.520] And I did find other case law that we used and one was in Watertown, New York and I know
[20:33.520 --> 20:40.120] it was only a village court or a city court and then I'm not sure if we had one from an
[20:40.120 --> 20:46.560] appeals court, but the other courts said the same thing that we did, that the law is vague
[20:46.560 --> 20:56.880] and the way it's written, the average person does not know from how it's written to deduce
[20:56.880 --> 21:03.880] that they're doing something wrong by not wearing it a certain way and the judge actually
[21:03.880 --> 21:05.400] came out and said that.
[21:05.400 --> 21:11.240] Yeah, but unfortunately if you're citing a municipal court, that's not a court of precedent
[21:11.240 --> 21:12.240] setting record.
[21:12.240 --> 21:13.240] Right.
[21:13.240 --> 21:14.240] I understand.
[21:14.240 --> 21:15.240] I understand.
[21:15.240 --> 21:21.560] So what all I'm saying is that what am I saying?
[21:21.560 --> 21:24.840] Just give me a minute before I start screaming.
[21:24.840 --> 21:30.880] I am so sick of this and I am so sick and tired of these came from court and what they
[21:30.880 --> 21:31.880] do to people.
[21:31.880 --> 21:38.920] What I'm saying is if that judge said the same thing, chances are I am correct and the
[21:38.920 --> 21:44.680] law does not say anything about wearing it wrong is akin to not wearing it at all.
[21:44.680 --> 21:49.440] Well you can't presume that because of what every year the case may have been versus the
[21:49.440 --> 21:52.240] time and date of the event in question.
[21:52.240 --> 21:54.080] You can't presume that.
[21:54.080 --> 21:55.080] Right.
[21:55.080 --> 22:06.280] But that's a pretty, it's a fair indication that for me to read the law and not find that
[22:06.280 --> 22:12.760] in there and then the judge to have said that, that they probably, in other words, what I

[51:50.840 --> 52:04.840] You better know the law front to back, sideways, upside down, backwards, forwards, and you be able to connect any part of it to any other part of it via the statutory structure that created it.

[53:27.840 --> 53:38.840] Now, should you, should we just kind of play it safe and just go after those two citations or those things they'd write you under the main ones?

[53:49.840 --> 53:54.840] They're not going to say, well, yeah, we can't enforce seatbelts against you, but we can enforce licenses.

[53:58.840 --> 54:10.840] I think our main pushback is kind of, and I'm sure you're going to have, I don't know if it would be the attorney general or who would defend that, but what do we do when they bring the issue of safety yet?

[54:22.840 --> 54:32.840] Plus, they haven't done anything to prove that the possession of a license increases public safety.
[54:32.840 --> 54:39.840] Now, Randy said I was creating a false dichotomy when I said this before, but I want to say it again because I don't see how that's possible.
[54:39.840 --> 54:54.840] You have all these license drivers that are getting into accidents, causing damage to property in persons, killing people, driving drunk, driving impaired, or just driving like idiots to begin with, and they have a license, right?

[54:55.840 --> 55:05.840] And yet the person without one is being extra careful, extra diligent, and very rarely do you hear of an accident involving somebody that didn't have one.

[55:08.840 --> 55:15.840] The people who got the license and still killed other people or did stupid things with their cars?

[55:21.840 --> 55:37.840] So the fact here is when they say public safety, there is no demonstrable statistical facts to show that the possession of a license has a damn thing to do with public safety because a license is not issued for the purpose of safety.

[55:45.840 --> 55:51.840] That is a completely different argument from public safety.

[55:52.840 --> 56:08.840] And since the public has the right to move about the states freely, unencumbered by government interference, then they cannot convert that right into a privilege, license it, and sell it back to you.

[56:12.840 --> 56:22.840] And that's where the big scam is, is where they claim the element that you're automatically a driver or an operator of a motor vehicle.

[56:33.840 --> 56:51.840] They've even done a research or study on the word privilege and license as well, and correct me if I'm wrong, but those words are all connected with, constitutionally, they can only use those in statutes when they apply to businesses or occupations.

[56:53.840 --> 57:03.840] I don't know how you came to that determination, how you attached the facts together to come to that, so I can't answer that for you as far as how you're posing the question.

[01:23:43.840 --> 01:23:52.840] It doesn't matter if they know it. The fact is that the system had a duty to tell them and it didn't and it hit it on purpose.

[01:25:09.840 --> 01:25:19.840] And one of the problems that we've noticed when we make some of these fights, though, is what they'll do. The opposition, they'll take the facts, the law and the baseball.

[01:25:22.840 --> 01:25:29.840] And then they'll just go back. Oh, you have your driver operator motor vehicle. They'll just kind of ignore your whole argument.
[01:25:29.840 --> 01:25:41.840] Well, but that's what I'm saying is that they're trying to apply the object of a code outside of the subject of the code. And that's one of the things they cannot do.

[01:25:45.840 --> 01:26:06.840] When they do it that way, they are converting statutory objects into statutory subjects, which violates the legislation from the get go because the bill that created those objects is limited to only one subject.
