[00:13.400 --> 00:21.200] into the tides of the alternative.
[00:21.200 --> 00:27.400] Markets for Wednesday, the 6th of February, 2019, open with gold at $1,313.70 an ounce,
[00:27.400 --> 00:34.880] silver at $15.77 an ounce, copper at $2.83 an ounce, oil, Texas crude at $53.66 a barrel,
[00:34.880 --> 00:41.000] Brank crude at $61.98 a barrel, and crypto is in order of market capitalization, Bitcoin
[00:41.000 --> 00:54.200]  at $3,401.64, Ripple, XRP at $0.29, Ethereum at $103.10, and EOS at $2.32 a crypto coin.
[00:54.200 --> 00:59.560] Today in history, the year 1918, British women over the age of 30 who meet minimum property
[00:59.560 --> 01:04.480] qualifications get the right to vote when the Representation of the People Act of 1918
[01:04.480 --> 01:09.480]  was passed by Parliament.
[01:09.480 --> 01:14.120] In recent news, several Texas-based organizations filed a lawsuit today requesting that a federal
[01:14.120 --> 01:18.880] court stop the state from flagging about 95,000 people as potentially illegally registered
[01:18.880 --> 01:19.880]  to vote.
[01:19.880 --> 01:24.520] The list was compiled after an 11-month-long investigation by the Office of the Texas Secretary
[01:24.520 --> 01:29.840] of State and the Texas Department of Public Safety which sought to identify non-US citizens
[01:29.840 --> 01:33.240] who were registered to vote when obtaining a driver's license.
[01:33.240 --> 01:38.920] Over half of the 95,000 did indeed vote it seems, however, further controversy was raised
[01:38.920 --> 01:43.200] when it became clear that some of the names were not in fact belonging to those who were
[01:43.200 --> 01:45.280]  non-citizens and registered.
[01:45.280 --> 01:49.860] Apparently around 25% of all Latino immigrants become naturalized, gaining the right to vote
[01:49.860 --> 01:50.860]  in Texas.
[01:50.860 --> 01:55.120] Registered voters who receive letters querying their citizenship have 30 days to respond
[01:55.120 --> 01:56.880]  with proof of eligibility.
[01:56.880 --> 02:01.120] Texas Attorney General Ken Paxton and David Whitley, the Texas Secretary of State, have
[02:01.120 --> 02:08.920] yet to officially comment regarding this list and any updates pertaining to it.
[02:08.920 --> 02:13.960] A Texas man of only 24 years old, William Brown, died from a severed artery in his neck
[02:13.960 --> 02:16.880] after a vape pen exploded while he was using it.
[02:16.880 --> 02:20.600] It apparently happened in the parking lot of the vape shop where he got it.
[02:20.600 --> 02:24.200] An x-ray revealed that a piece of metal was embedded in his brain stem.
[02:24.200 --> 02:30.360] The vape store Smoke and Vape DZ has refused to comment.
[02:30.360 --> 02:35.120] First edition anchorwoman Kristin Diaz interviewed Aislinn Campbell, the executive director of
[02:35.120 --> 02:40.120] Grow Local South Texas concerning the upcoming Texas Organic Farmers and Gardeners Association
[02:40.120 --> 02:45.160] Conference which will be taking place at the Corpus Christi Omni Hotel from February 14th
[02:45.160 --> 02:47.440]  to the 16th, 6-9pm.
[02:47.440 --> 02:53.080] You can find the interview at KIIITV.com.
[02:53.080 --> 03:22.600] This is Rick Rode with your lowdown for February 6th, 2019.
[03:22.600 --> 03:42.040] This is Rick Rode with your lowdown for February 6th, 2019.
[03:42.040 --> 03:58.360] This is Rick Rode with your lowdown for February 6th, 2019.
[03:58.360 --> 04:11.240] This is Rick Rode with your lowdown for February 6th, 2019.
[04:11.240 --> 04:35.400] This is Rick Rode with your lowdown for February 6th, 2019.
[04:35.400 --> 04:42.380] This is Rick Rode with your lowdown for February 6th, 2019.
[04:42.380 --> 05:01.600] This is Rick Rode with your lowdown for February 6th, 2019.
[05:01.600 --> 05:08.480] weeks rebuilding computers, hardware, software, OS's, I mean you name it. Right now I've got a
[05:09.760 --> 05:18.240] year-old Threadripper 1950X machine sitting here that I am trying to turn into the Linux server
[05:18.880 --> 05:25.280] to do everything from as far as the video streaming and all that stuff. And I have come
[05:25.280 --> 05:30.080] to realize that it does not matter what motherboard you have and what setup you're
[05:30.080 --> 05:38.880] trying to use, Linux in general does not like NVMe hard drives. Just flat doesn't like them.
[05:38.880 --> 05:45.360] I have gone through every BIOS update, every forum I can find, and not a single one of the
[05:45.360 --> 05:52.160] machines I have with any class of NVMe or M2 drive will let me install this Dabblane
[05:52.160 --> 05:59.120] Linux OS. It hangs up every single time during boot up at the wallpaper. It doesn't lock the
[05:59.120 --> 06:04.160] machine up, it just doesn't go any further. It just sits there at the wallpaper for the installation
[06:04.800 --> 06:11.760] of the Linux OS and goes no further. It's getting to be extremely frustrating. The Windows 10 loads
[06:11.760 --> 06:17.280] up on any one of the computers just fine, no big deal, and it's getting really frustrating because
[06:17.280 --> 06:24.240] I did not, I can't in fact, run the stuff I need to run from Windows. I need a Linux box to do it
[06:24.240 --> 06:30.000] and this is getting aggravating. But that's my problem, not yours. What we're going to talk about
[06:30.000 --> 06:34.960] tonight is the same thing we always talk about. People not paying attention to what they're doing
[06:34.960 --> 06:40.640] and learning how to do the things they need to do before they take themselves into a court
[06:40.640 --> 06:47.680] and get their butt kicked. And getting your butt kicked in these courts is not all that big a
[06:47.680 --> 06:58.080] problem. It's actually very easy to do. All you have to do is, you know, not prepare. Or listen
[06:58.080 --> 07:05.840] to the wrong people, which too many folks do too much of, believe me. Now case in point,
[07:06.880 --> 07:12.800] I'm having in my discussion group Tow of Law on Facebook. I've got a guy in here right now
[07:12.800 --> 07:17.120] complaining about how his trial went and all this kind of stuff and you could tell from the moment
[07:17.120 --> 07:25.360] he started talking, he had no clue what he was doing. He waited too long and did too little
[07:25.360 --> 07:29.680] and has studied absolutely nothing and is wondering why he got his butt kicked.
[07:31.200 --> 07:35.600] He's asking me questions. I'm asking him, did you do this? Well, yeah, I did that. Please explain
[07:35.600 --> 07:39.600] how you did that. And then it turns out when he explains what he did, he didn't do it at all.
[07:40.640 --> 07:43.760] As far as the thing that I asked him originally that he said he did.
[07:43.760 --> 07:54.240] People have absolutely no understanding slash comprehension of what the process is, what the
[07:54.240 --> 08:02.640] law governing that process is, how to use it, and even how to understand it for the most part.
[08:02.640 --> 08:05.920] Doesn't matter how much you talk to them. Doesn't matter how much you explain to them.
[08:05.920 --> 08:13.200] They're just not getting it. So I have tried to get where I could get back online and start
[08:13.200 --> 08:18.080] teaching classes again on how to do that very thing. And I have done nothing but run into
[08:18.080 --> 08:24.160] brick walls at full steam ahead at every turn. I've got the computers rebuilt, but I can't get
[08:24.160 --> 08:31.760] any of them except for now get this. One of them that would not let me install Linux on the M2
[08:31.760 --> 08:40.800] drive that's in it would allow me to install Linux on a USB flash drive. So I installed Ubuntu
[08:40.800 --> 08:51.120] studio 1804 on 128 gigabyte USB drive. The computer that will not allow me to install it to the
[08:51.120 --> 09:02.160] ME drive, all of them in fact, will boot no problem into the full desktop. Let me use it in everything
[09:02.160 --> 09:11.840] as long as I boot from that USB. But if I attempt to access the installation by booting from an
[09:11.840 --> 09:21.760] install CD or USB drive in this case, it will boot up to the point where it says install the OS.
[09:22.640 --> 09:28.080] And I'm only bringing this up because in case any of you Linux experts out there have any
[09:28.080 --> 09:33.760] information about this, maybe you'll email me at eddie at rule of law radio and let's see if we
[09:33.760 --> 09:41.840] can't figure out why this isn't working. But get this thing going and it will just die right there
[09:41.840 --> 09:48.000] at the wallpaper for the installation after you choose to install it every single time. It is
[09:48.000 --> 09:54.000] frustrating as all get out. I can boot from an actual serial ATA hard drive that has a version
[09:54.000 --> 10:04.720] of Linux installed on it. No problem. But I cannot boot even into a clone Zilla bootable USB so that
[10:04.720 --> 10:12.960] I can try to clone that serial ATA drive to the NVMe and boot from that. Hopefully after I did
[10:12.960 --> 10:19.920] that, it won't even let me do that. So it's, it's frustrating to say the very least. I have run out
[10:19.920 --> 10:27.520] of things to try. Um, and the thing is, is the, the serial ATA drive was installed in a completely
[10:27.520 --> 10:33.440] different system and a completely different version of the OS. And I took it and stuck it
[10:33.440 --> 10:41.040] into the box I'm trying to build for a brand new Linux server for the media streaming. And it
[10:41.040 --> 10:48.640] booted up just fine. No problem. It sees the NVMe drive, but it won't let me do any of that.
[10:48.640 --> 10:55.760] But it won't let me do anything with it as far as installing to it. Now I can access it if I format
[10:55.760 --> 11:00.080] it and so on and so forth. I can put files on it. I can do everything else. I just can't get the
[11:00.080 --> 11:08.000] system to install to it if I boot to an installation. So I am working on whatever I can do to
[11:08.000 --> 11:13.920] change that. Now, all that said that delays me in getting online classes going again. And of course
[11:13.920 --> 11:19.280] it delays a lot of other things that I was hoping to do to help folks out, including myself here,
[11:20.000 --> 11:23.840] since I don't have any money coming in any other way, this was going to be the way that I was going
[11:23.840 --> 11:31.200] to have to do it was to go online with classes. And since I have potentially a wider audience,
[11:31.200 --> 11:36.640] try to do it for a cheaper rate than the live classes were here at $20 a weekend per person,
[11:36.640 --> 11:43.760] per class here in Austin is what the live classes were. So I was going to try to do it somewhat
[11:43.760 --> 11:49.520] cheaper online, as long as I was able to host everything here and didn't have extra fees and
[11:49.520 --> 11:54.800] everything to pay for the streaming service, the hosting service, well, anything I needed to make
[11:54.800 --> 12:02.240] this work, because one of the things I want to be able to do is to record these classes as we're
[12:02.240 --> 12:09.120] doing them and all the interaction and turn those into videos. I've got an elgato streaming card
[12:09.120 --> 12:16.000] installed in a small windows 10 based machine set up to take the video output from the Linux box,
[12:16.000 --> 12:22.240] if I can ever get it installed and working to actually do the recording for me and then stream
[12:22.240 --> 12:28.960] it out from that windows box or loop it back in and do whatever I want to send it out from the
[12:28.960 --> 12:34.960] Linux box. There's a thousand ways for me to do it if I can get the Linux box working, but it doesn't
[12:34.960 --> 12:40.640] want to cooperate. So all that said, that's where I'm at and trying to get back into the swing of
[12:40.640 --> 12:46.240] things to give you all the benefit of what I've learned doing this over the years and be able to
[12:46.240 --> 12:52.000] do the live classes. And it is nothing but a stone wall at every turn, but I'm going to keep plugging
[12:52.000 --> 12:58.400] away at it till I either get through it or pass out from the brain damage. Okay, now going through
[12:58.400 --> 13:06.160] all of that, let's see. I haven't got a chance with all this going on to even bother to review
[13:07.200 --> 13:11.680] any of the ongoing current stories out there on what the police are doing wrong,
[13:11.680 --> 13:16.560] what prosecutors are doing wrong, et cetera, et cetera, et cetera, except that I did notice
[13:17.600 --> 13:25.120] some information saying that there is a huge increase in the number of no-knock warrants
[13:25.120 --> 13:34.240] that police are requesting and a huge number relating to that increase of those warrants
[13:35.040 --> 13:42.720] fail to have any proper probable cause statement for a judge to issue that warrant. And yet they're
[13:42.720 --> 13:50.240] issuing that warrant anyway. So folks, this is information that is proof positive
[13:50.240 --> 13:57.200] positive that your public servants are not willing to not only follow the
[13:57.200 --> 14:03.600] law that governs how they're to do their job, they're not willing to protect your rights
[14:03.600 --> 14:09.360] in the course of doing that job. Now, this of course is not new information to anybody
[14:09.360 --> 14:16.240] that's been listening to this show for any length of time, because the whole purpose of this show
[14:16.240 --> 14:22.880] is to point out to you in black and white law, where your public servants are lying to you,
[14:23.680 --> 14:31.760] defrauding you, cheating you, stealing from you, abusing you, and generally abusing everything
[14:31.760 --> 14:39.200] about the authority that we have invested in them. Okay. And to try to come up with ideas and
[14:39.200 --> 14:45.440] solutions on how to deal with it. That's the basis of this show. That's the basis of a lot of the
[14:45.440 --> 14:52.400] shows on this network. Now that also being said, don't forget to financially support the network
[14:52.400 --> 15:00.240] and us because the money we get is what keeps us running. And we don't get a lot of it. It's
[15:00.240 --> 15:08.720] getting more and more difficult all the time to be here on a regular basis because there's no
[15:08.720 --> 15:14.400] money coming in. There just isn't. It's getting to the point where we're living hand to mouth
[15:14.400 --> 15:19.200] around here and hoping that we've got enough nickels and dimes to scrape together to pay
[15:19.200 --> 15:24.000] this month's electric bill so that we can keep the power on long enough to do another show.
[15:24.560 --> 15:29.680] Same thing with being able to eat, you know, day to day, pick your one meal because it may be the
[15:29.680 --> 15:34.720] only one you get to eat that day because there's no money to go buy extra groceries. It's just that
[15:34.720 --> 15:42.560] way for us. We don't get paid to do what we're doing. Okay. We're here voluntarily trying to do
[15:42.560 --> 15:49.920] what's right for all of y'all. And without your support, we cannot do that. So keep that in mind.
[15:51.280 --> 15:56.640] Now we are going to have a break here in about a minute. The phone lines are open and on.
[15:56.640 --> 16:04.880] Call in number is 512-646-1984. If you want to call in and ask a question or tell us what's
[16:04.880 --> 16:13.440] going on with the case that you're fighting or whatever, as usual. But I want to say that
[16:16.000 --> 16:24.080]  it's been several years since I joined this show. And I mean, I think 2007, I was a caller,
[16:24.080 --> 16:30.240] a regular caller on here because of the stuff that was going on. And sometime in 2008, I actually
[16:30.240 --> 16:37.200] became a cohost on this network, uh, on the show with Deborah and Randy on Mondays, Thursdays,
[16:37.200 --> 16:43.680] and Fridays. And then after a few years of that, they gave me my own show on Monday nights and they
[16:43.680 --> 16:49.040] deal with Thursday and Friday nights. All right. I hear the music. So y'all hang on and we'll be
[16:49.040 --> 17:02.880] right back after this break and hopefully have some callers. Rule of law radio is proud to offer

[19:29.840 --> 19:59.520]  All right
[19:59.520 --> 20:06.800] folks we are back. This is Rule of Law Radio. The call in number 512-646-1984.
[20:07.440 --> 20:12.880] And like our sample we went to break. I joined this show. I am very thankful for the opportunity
[20:12.880 --> 20:20.480] to to get on here and to bring the information to you that I do to help you where I can. I know
[20:20.480 --> 20:25.680] I'm not always nice about it. I know I'm not always the friendliest about it. But the thing
[20:25.680 --> 20:33.040] about that is when when you're doing what we're doing here we have to be tough about making you
[20:33.040 --> 20:38.000] understand the information. And the reason for that is is the people you're going up against
[20:38.720 --> 20:45.440] they deal under the table. They will work together against you despite the requirement to give you
[20:45.440 --> 20:51.360] proper due process and to be fair and impartial. You are not entering an environment where any of
[20:51.360 --> 20:57.840] that is taken into consideration much less supplied. It is you against the system and
[20:57.840 --> 21:05.440] there is no ifs ands or buts about that. The system is engineered to do one thing. Get money
[21:05.440 --> 21:12.400] from you. Not to supply you with justice and due process. Not to do what's right. Not even to
[21:12.400 --> 21:18.640] follow the law because most of them have no clue what the law actually says or means. I have proven
[21:18.640 --> 21:28.240] that over and over and over again. Okay it is to separate you from your money in the most expedient
[21:28.240 --> 21:36.480] and inexpensive manner possible. So when I yell at you I scream at you and I tell you think before
[21:36.480 --> 21:43.840] you speak or act there's a method to the madness on doing it that way. I'm trying to make you
[21:43.840 --> 21:49.920] understand and to accept the fact that they are not going to be nice to you. You are going to
[21:49.920 --> 21:55.840] have to think on your feet and you're going to have to do it under fire brutal fire if they can
[21:55.840 --> 22:02.880] get away with it. So you need to be able to deal with it when it comes. All right so by my doing
[22:02.880 --> 22:08.480] it here it's a much more friendly environment and outcome when you're trying to learn it than it is
[22:08.480 --> 22:14.880] from having to go in there and do it and do it wrong so that you have no way to make an appeal
[22:14.880 --> 22:23.360] for it. Okay so the consequences of doing it with us is you get the benefit of what we can tell you.
[22:23.360 --> 22:27.440] You get the experience of what it's like to have somebody screaming at you and hollering at you
[22:27.440 --> 22:33.760] and telling you why you're wrong and what you're doing wrong but just teaching you hopefully to
[22:33.760 --> 22:41.920] react and think on your feet in a way that benefits you instead of hurts you. Okay so
[22:41.920 --> 22:48.320] please don't ever take anything I'm doing on this show personally it's not intended that way it's
[22:48.320 --> 22:55.120] just the way I've got to convey the information I feel that I have to convey the information to
[22:55.120 --> 23:01.200] make that point clear and to make you understand how important it is that you know what you're
[23:01.200 --> 23:07.680] doing before you set foot through that door. When you don't that's when they have you before the
[23:07.680 --> 23:15.680] battles even started. Okay I believe I don't know who said it but there's a quote that the wise man
[23:16.320 --> 23:27.120] only seeks battle after he is assured the victory is already won. Okay and that is what the courts
[23:27.120 --> 23:35.200] are doing they seek battle because they're assured that they've already won and they know this based
[23:35.200 --> 23:42.240] on a couple of things. One they do this every day are well versed and well practiced at working
[23:42.240 --> 23:51.760] together against the people that they pull into their little rooms and extort okay whereas they
[23:51.760 --> 23:58.560] know that the majority of those people are inexperienced, unknowledgeable and lack the
[23:58.560 --> 24:07.200] capability to put those two things together in a way that prevents them from winning. They know
[24:07.200 --> 24:18.160] this okay it is David against Goliath literally because the system doesn't like you it likes your
[24:18.160 --> 24:25.760] money. You got to understand that going in and the moment you go in there faltering, fumbling and
[24:25.760 --> 24:31.200] without any information about what they're doing wrong and how they're doing it wrong and the
[24:31.200 --> 24:38.160] ability to say that on the record or file it in written form to make a record you've already lost
[24:38.160 --> 24:46.160] the battle and they were right. Victory was assured before the battle had even begun okay
[24:46.160 --> 24:53.520] so please folks keep that in mind. That being said let's take our first caller who is Daniel
[24:53.520 --> 24:59.680] in Texas. Daniel what can we do for you? Eddie got a few questions for you in regards to the
[25:00.560 --> 25:08.800] cases that you lay out in the Dow of the law. The cases that you can. In which article on what
[25:08.800 --> 25:18.960] subject? In regards to the respondents special appearance motion, quash unlawful citation and
[25:18.960 --> 25:27.600] complaint. I just have a couple questions in regards to utilization of this. For example what
[25:27.600 --> 25:34.640] if you don't know the judge's name. Some of these municipalities these small little towns even in
[25:34.640 --> 25:47.040] Travis County they have a rotating cycle of judges and within this paperwork you. You can
[25:47.040 --> 25:52.880] call down there and ask them who is the judge assigned to the case. Who is going to hear it.
[25:52.880 --> 26:04.320] Okay sounds good and do you
[26:07.440 --> 26:13.440] in regards to the citation I know I understand it's not a correct charging instrument.
[26:15.360 --> 26:22.240] What if you only have a citation so they haven't sent a warrant for your arrest there's no other
[26:22.240 --> 26:31.040] paperwork sent in the mail. Then stay home that day. They rewrote the statute they cannot issue
[26:31.040 --> 26:37.360] a warrant for your arrest for failure to appear if they did not first send you an actual notice
[26:37.360 --> 26:42.880] or call you by telephone to inform you that you are required to appear in court on such and such
[26:42.880 --> 26:51.360] date at such and such time at such and such place. If they fail to do that and they issue a warrant
[26:51.360 --> 26:58.320] then you've got a violation of law issue against that judge and that prosecutor because the code
[26:58.320 --> 27:04.880] of criminal procedure is very clear that a capious warrant cannot be issued except at the request of
[27:04.880 --> 27:13.280] the prosecuting attorney. So if the prosecuting attorney requests it and the judge issues it and
[27:13.280 --> 27:21.680] they failed to send you a proper notice either via telephone or by mail then they have violated
[27:21.680 --> 27:25.520] that aspect of your due process rights and the code of criminal procedure.
[27:27.760 --> 27:34.880] Okay let me perhaps let me back up what if essentially when you receive a citation
[27:34.880 --> 27:44.000] and you have 10 days I believe 10 days to respond is this at what point do you...
[27:44.000 --> 27:50.240] No you have no less than 10 days prior to your first appearance in that court to respond not
[27:50.240 --> 27:56.560] this to the citation. They tell you that you have to appear at such and such time at such and such
[27:56.560 --> 28:03.200] place but I just told you that is not what the statute ever said and that is not what the statute
[28:03.200 --> 28:09.120] currently reads. The statute they can tell you that all they want to on the side of the road
[28:09.760 --> 28:15.680] but the cop is not the law despite how what he thinks he is or isn't. The statutes in the code
[28:15.680 --> 28:23.600] of criminal procedure were changed in 2017 to now say that they are specifically prohibited
[28:23.600 --> 28:33.840] from issuing warrants for failure to appear without that written notice or telephonic notice.
[28:33.840 --> 28:39.600] How do you get a written notice or a telephone? Well they mail it to you or they call you that's
[28:39.600 --> 28:45.520] what do you mean how do you get it? What if I haven't received either one? Well then that's
[28:45.520 --> 28:55.120] why I said sleep in and then wait for them to send notice. Yeah because there's nothing there's
[28:55.120 --> 29:02.960] nothing that can be done to you because you didn't show up on the citation. This goes to exactly what
[29:02.960 --> 29:10.480] I have been saying ever since I've been on this show and before the citation is an illegal summons
[29:10.480 --> 29:18.080] to tell you that that citation is your summons to appear in court is a criminal act by any
[29:18.080 --> 29:23.760] government official that says so whether it's the cop the clerk or the judge. Why? Because it
[29:23.760 --> 29:34.800] constitutes the crime of simulation of legal process and it's illegal because Texas law
[29:34.800 --> 29:43.120] Texas law specifically says what a valid summons or a subpoena must look like and what it must
[29:43.120 --> 29:50.640] contain and the citation has none of that not only that an officer can't issue either of those
[29:50.640 --> 29:57.440] instruments only a court can. Okay so hang on just a second let us take this break and we'll pick
[29:57.440 --> 30:05.840] this up on the other side okay. Have you had your hug today? If not you're missing out on some of

[30:51.600 --> 30:56.480] beyond that warm and fuzzy feeling they measure the levels of the stress hormone cortisol and
[30:56.480 --> 31:02.560] the bonding hormone oxytocin both before and after volunteer couples held hands talked and hugged
[31:02.560 --> 31:08.560] following the 20-second hug oxytocin increased and cortisol decreased in both men and women
[31:08.560 --> 31:13.760] as a result their blood pressure also went down lowering their risk of cardiovascular disease

[33:30.240 --> 33:52.800] all right folks we are back this is rule of law radio call in number 512-646-1984
[33:52.800 --> 33:59.920] and we are speaking with daniel in texas all right daniel continue uh perhaps i could
[34:00.480 --> 34:05.520] backtrack a little bit just to ask a few questions if i need to get out my
[34:05.520 --> 34:11.840] checkbook now as you would say for handling uh so when i receive the citation they say you have
[34:11.840 --> 34:18.320] 10 days on and then you're required to go into the clerk's office where they make you think they're
[34:18.320 --> 34:25.440] required to go in the clerk's office and and uh and plea not guilty no contest i i let them know
[34:25.440 --> 34:31.520]  that i wasn't um i didn't understand the charges they didn't have a correct charging instrument
[34:32.480 --> 34:39.040] and i wanted to see how i could get paperwork sent to me by ml so that i could have the correct
[34:39.040 --> 34:47.440] uh uh information to to uh file this uh this paperwork that that is to quash unlawful citation
[34:47.440 --> 34:54.800] income in uh complaint uh so then i gave him my passport and give him my information and they
[34:54.800 --> 35:00.640] simply said well you need to just show up when the judge is in uh in the next hearing which would
[35:00.640 --> 35:06.080] have been the next day or there's several days within the next month that the judge will be there
[35:06.080 --> 35:12.320] um and i asked her if i could how would i receive information in the mail and she said if you haven't
[35:12.320 --> 35:23.120] been there within 30 days then they would send notice so um do i need to wait those 30 days to
[35:23.120 --> 35:31.040] have that notice sent to me before then i could process with the uh quash unlawful citation and
[35:31.040 --> 35:38.720] complete well what information are you expecting to get from them that changes the the fact that
[35:39.520 --> 35:45.600] all of that stuff is unlawful for instance if you're not engaged in transportation charging
[35:45.600 --> 35:50.320] you with a transportation offense and issuing a citation alleging such an offense is unlawful
[35:51.520 --> 35:56.640] because you're not engaged in transportation what information are they going to give you
[35:56.640 --> 36:07.040] that facilitates your ability to file that document correct and well no that's not a correct
[36:07.760 --> 36:14.400] what information are they going to give you that they're not going to exactly so why are you
[36:14.400 --> 36:19.280] wanting to wait to get information from them that i'm not understanding the premise of your question
[36:19.280 --> 36:25.040] based upon the fact that nothing that you're waiting on from them has anything to do with
[36:25.040 --> 36:33.760] what you need to be doing right now okay so then i file to do let me ask you a question then do i
[36:33.760 --> 36:39.920] file to quash unlawful citation and complain with the clerk before i go see the judge
[36:42.080 --> 36:54.080] absolutely okay and and then you're you need to prepare written objections to the judge's refusal
[36:54.080 --> 37:00.400] to sign the orders that you need to create and make sure are attached you need to attach a
[37:00.400 --> 37:10.480] proposed order to every motion you file okay and the order basically states the same style for the
[37:10.480 --> 37:16.400] case and if you've got the seminar material there's example orders in all the pleadings
[37:16.400 --> 37:24.800] okay okay so in there you're simply saying is my motion granted or denied the judge isn't signing
[37:24.800 --> 37:32.160] those orders the judge is just ruling by voice alone and not giving you anything in writing to
[37:32.160 --> 37:40.000] use for appeal you need to object to that in writing that the judge has not ruled on your
[37:40.000 --> 37:48.560] motion and if he has ruled he or she has ruled they did not do so based upon a signed order
[37:49.200 --> 37:56.960] thus you have no order to use for the purpose of your appeal or to request a new trial showing that
[37:56.960 --> 38:03.760] the judge abused their discretion and that the judge did not base their ruling on any facts or
[38:03.760 --> 38:10.560] law relevant to the case all that needs to go into a written objection which you need to have
[38:10.560 --> 38:18.000] prepared for each motion that you file and then when the you get a thing from any part of the
[38:18.000 --> 38:24.800] court that says your motions are denied and they and yet the other party the prosecution has filed
[38:24.800 --> 38:32.720] absolutely nothing to challenge them then you have the necessity of challenging that judge on
[38:32.720 --> 38:40.000] why they were denied excuse me judge i was never served with a copy of the prosecutor's answer to
[38:40.000 --> 38:48.000] those motions so since those motions is there such an answer filed and if there isn't those motions
[38:48.000 --> 38:55.200] are unopposed if the motions are unopposed by what lawful authority are you denying the facts
[38:55.200 --> 39:03.440] and law stated in them what lawful basis are you using to say they're denied from your own
[39:03.440 --> 39:10.160] sua sponte actions when the prosecution has failed in their duty to refute one single point of law
[39:10.160 --> 39:17.600] in it why are you doing the prosecutor's job how is that fair and impartial how are you not acting
[39:17.600 --> 39:24.640] biasly when you're doing the prosecutor's job for them or on their behalf without any due process
[39:24.640 --> 39:31.600] basis for it see what i'm saying here yes you need to put that judge in the spotlight you need
[39:31.600 --> 39:40.080] to turn it up to infrared and cook their ass where they sit but the thing i keep going over is
[39:41.280 --> 39:47.520] can you not if you don't understand the procedure not if you don't understand the rules not if you
[39:47.520 --> 39:52.720] act cowardly when they say i'm going to cite you for contempt objection judge i have a right to
[39:52.720 --> 40:00.080] make the record for this case you have acted unlawfully and biasly by doing the prosecutor's
[40:00.080 --> 40:07.280] job i want that on the record let them try to cite you for contempt when that is the only thing
[40:07.280 --> 40:13.920] you're doing is putting on a vigorous defense because doing so amounts to sit down shut up and
[40:13.920 --> 40:21.680] let us convict you in silence and if you think that's not an appealable error think again
[40:21.680 --> 40:31.680] you with me yep okay it's all set up for the appeal correct you have the components to follow
[40:31.680 --> 40:39.360] through with it correct and if you don't guess what you lost that battle too get out the paycheck
[40:39.360 --> 40:47.920] get up the uh there you go appreciate it eddie yes sir now does that cover everything you wanted to
[40:47.920 --> 40:52.880] appreciate it eddie yes sir now does that cover everything you wanted to ask for the moment it
[40:52.880 --> 41:00.400] does okay well glad to help them thanks for your time yes sir thanks for calling all right next in
[41:00.400 --> 41:08.480] line is pat in texas mr pat how are you oh pretty good eddie you're doing all right i am except for
[41:08.480 --> 41:12.880] being dog tired i haven't slept in two days trying to bang my head over this computer stuff but
[41:12.880 --> 41:18.800] oh well call me later about the computer so if maybe i can help you there but you got a couple
[41:18.800 --> 41:26.720] of points on the last guy the last caller you had um when the judge does what he does like that
[41:26.720 --> 41:34.480] doesn't find anything and this happened in my case as you remember yes i removed three district court
[41:34.480 --> 41:42.960] three district court judges and the administrative judge for the district because they refuse to sign
[41:42.960 --> 41:50.480] anything we've removed for cause every last one of them yep and in case you folks are wondering
[41:50.480 --> 41:57.600] the motion that was done in is actually up on my legal blog okay pat is the person that i was
[41:57.600 --> 42:02.080] helping with that case that he's talking about i wrote the document that he's talking about along
[42:02.080 --> 42:06.880] with some that they did themselves and filed in this case and we went straight at the district
[42:06.880 --> 42:12.960] judges for criminal conspiracy against his rights by the time we were said and done they dismissed
[42:12.960 --> 42:18.800] his case with prejudice and didn't want to see him within a mile of that courthouse they still don't
[42:20.880 --> 42:28.000] that's a whole nother issue um with the stuff that's going on right now but for last week i got
[42:28.000 --> 42:34.080] something to clarify a point you had three callers about land patents uh one guy was in
[42:34.080 --> 42:38.160] arizona one guy was in colorado and i don't remember the other was in arizona as well
[42:39.200 --> 42:46.080] all right arizona all right 17 states the 17 western states for land patents fall under the
[42:46.080 --> 42:54.720] blm arizona colorado all california washington oregon and all that texas does not neither do
[42:54.720 --> 43:02.080] the original 13 states right and then a few of the other southern states that came in
[43:02.080 --> 43:09.360] after the original before texas did and this is a point that most people don't realize
[43:11.040 --> 43:19.920] in texas it is the only one that the federal government never ever had privity on any land
[43:19.920 --> 43:30.800] privity is prior uh ownership texas has never ever turned over any land to the federal government
[43:30.800 --> 43:36.160] because it became a state right what's going on down on the border is illegal right now
[43:36.160 --> 43:42.640] they're exercising imminent domain by the federal government in federal court to take land for the

[46:24.480 --> 46:36.720] all right folks we are back this is rule of law radio calling number 512-646-1984 and we
[46:36.720 --> 46:44.640] are talking with pat in texas all right pat please continue that uh eddie the issue i wanted to bring
[46:44.640 --> 46:52.720] up there had to deal with jurisdiction and this is something that most people don't realize you do
[46:52.720 --> 47:02.240] because you followed the um interstate commerce commission's uh commercial motor vehicle act all
[47:02.240 --> 47:09.360] the way back to the beginning and then the state implementations of that final little jewel amongst
[47:09.360 --> 47:15.120] the many states which we call the traffic code or other people call other things
[47:15.120 --> 47:20.240] jurisdiction is key this is where when i got picked up by the border patrol in this current
[47:20.240 --> 47:37.520] issue they're trying to use title eight section no i'll think of it a minute 5182 i think it might
[47:37.520 --> 47:49.760] it might be 5187 and it deals with ins and ins listed uh for jurisdiction granting by the state
[47:49.760 --> 47:58.960] legislature in the texaco to criminal procedures is listed in 2.112 sub paragraph a with a lot of
[47:58.960 --> 48:07.120] other federal special investigators they only have jurisdiction in very specific areas and
[48:07.120 --> 48:19.760] can only do arrests of state citizens or other citizens um for felonies very specific felonies
[48:19.760 --> 48:24.560] yeah and even state law says that they are not law enforcement officers within the territorial
[48:24.560 --> 48:30.880] boundaries of texas that's correct they're not peace officers and this is key this is a very
[48:30.880 --> 48:38.560] this is a very key point if they're in a vehicle and they turn on those red and blues they are
[48:38.560 --> 48:45.600] impersonating a peace officer under the state code that's a felony right up front if there's
[48:45.600 --> 48:52.320] three of them like in my case that's a conspiracy to commit a felony it's organized criminal
[48:52.320 --> 49:01.200] activity yes sir that falls under state and federal codes title 8 section 241 and 242 deals
[49:01.200 --> 49:09.600] with conspiracy to commit felonious acts violating of rights of state citizens and that's a first
[49:09.600 --> 49:15.600] degree felony especially in my case because i'm a senior disabled senior citizen under federal
[49:15.600 --> 49:22.720] prosecutorial guidelines that's a first degree felony prosecutable by uh 25 to life first time
[49:22.720 --> 49:31.120] out each account each person involved and in this case the entire group over here probably about 50
[49:31.120 --> 49:39.840] guys but that's a whole nother story but on the state side they're not peace officers not one of
[49:39.840 --> 49:49.200] them and they all know it because they admitted it now i've had a federal prosecutor tell me
[49:50.400 --> 49:57.520] that and fbi agents tell me that the federal prosecutor released me told them to release me
[49:57.520 --> 50:04.160] within two hours of my being held by these fine folks but what they did is when they transported
[50:04.160 --> 50:15.120] me across the state demarcation boundary onto a federal reservation there was federal jurisdiction
[50:15.120 --> 50:24.480] granted at that station no state jurisdiction man act was violated that's another felonious act
[50:24.480 --> 50:34.800] so you follow where i'm going with this one oh yeah all right now communicating a deadly threat
[50:34.800 --> 50:44.000] over a telephone to someone is also a felony now when i and one of my neighbors went in to talk to
[50:44.800 --> 50:53.520] two magistrates the county attorney and the county sheriff about this little scenario the county
[50:53.520 --> 50:58.960] judge who's the chief magistrate for the county sat there and told me he had no jurisdiction
[50:59.760 --> 51:08.960] he violated 2.119 of the texas code of criminal procedures the county attorney violated 2.02
[51:09.600 --> 51:17.920] the county sheriff violated his oath of office and his bond and his oath to the governor and
[51:17.920 --> 51:26.400] he he told my wife never to call him he didn't want to know so i got a surprise for him coming
[51:27.440 --> 51:35.440] anyway um i just wanted to talk to you about that get it out a little bit it's been chewing
[51:35.440 --> 51:42.960] on the back of my brain a little bit right but uh my health is taking a major little dump
[51:42.960 --> 51:50.720] little dump if it weren't for doctors i wouldn't have any friends i gotta go back again on friday
[51:50.720 --> 52:00.480] i gotta get another mri but um call me later if you would and we'll talk about that computer
[52:00.480 --> 52:06.400]  problem um i've got a master's in system management i think i can help you a little bit
[52:07.040 --> 52:11.520] okay i'll see what i can do would tomorrow be okay because i'm not going to bang my head
[52:11.520 --> 52:16.800] with this thing anymore tonight i've been at this all day stand you're not going to bother
[52:16.800 --> 52:25.200] me if you call me tomorrow just don't call me collect or late for dinner okay yeah and
[52:26.080 --> 52:31.120] tell everybody just to relax the best thing to do is go in make friends with a with a court clerk
[52:32.160 --> 52:38.800] and when when they tell you you can't do something smile at them and just say you know you need to
[52:38.800 --> 52:45.040] start reading and yeah you can do it it's like i had district court clerks telling me
[52:45.840 --> 52:52.800] you can't do this you you don't get your bond back you don't get dismissed with prejudice on
[52:52.800 --> 52:58.320] a felony case and a bunch of other things and i told them it's never going to go to court
[52:58.880 --> 53:06.880] and yes you can get it done and when i get the filings for the three different district
[53:06.880 --> 53:14.640] court judges and the administrative original judge she kept saying you can't dismiss them
[53:14.640 --> 53:22.080] for cause and i smiled and i said yes watch it's real simple just don't lose your cool
[53:22.880 --> 53:30.000] always be polite always be nice and you'd be surprised how far that goes yep
[53:30.000 --> 53:36.080] there are certain people in the system that you need to not be nice to and then there's those that
[53:36.080 --> 53:41.520] have no control over how things are going they only have a job to do that they have
[53:41.520 --> 53:46.800] no options in no matter what they're telling you or what they think they're telling you
[53:46.800 --> 53:52.160] they're limited in their power to hurt you or help you so don't take it out on them and the
[53:52.160 --> 53:58.080] clerks are one of those the only exception to that rule being when it comes to obtaining public
[53:58.080 --> 54:03.920] records that is entirely within the clerk's duties it is what they are supposed to be trained in
[54:03.920 --> 54:08.880] knowing and doing and when they won't do their job there then you can get a little bit pissy
[54:08.880 --> 54:13.200] with them and tell them say look the law says you have to give me this the law says it's a public
[54:13.200 --> 54:19.680] record wake up and do it now again folks that's easy stuff oh yeah the stuff that pat's talking
[54:19.680 --> 54:25.280] about there there is an article on my legal blog that deals with this specific case and the
[54:25.280 --> 54:33.280] documents that i wrote and for him to file in relation to that case and including the signed
[54:33.280 --> 54:39.920] order of dismissal with prejudice okay so the fact that the clerk is saying it can't be done
[54:39.920 --> 54:46.240] we've got the signed order to prove oh yes it can be done and it was done and it also is proof
[54:46.240 --> 54:55.440] positive that when i tell you there are ways to do this and when that i'm not talking out of the
[54:55.440 --> 55:03.040] south end of my pants here okay we've done it don't tell me i don't know what i'm talking about
[55:03.040 --> 55:10.160] we've actually done it i've posted the proof to show we've done it and you'd be surprised a number
[55:10.160 --> 55:14.480]  of people that are still out there saying i don't have a clue what i'm talking about i don't have a
[55:14.480 --> 55:19.920] clue what i'm talking about i don't understand any of this and yet we have the paperwork that
[55:19.920 --> 55:25.760] shows i understood it better than the judges the prosecutors the court clerks and everybody else
[55:25.760 --> 55:32.560] involved on the opposition side because they dropped this case faster than a hot rock in hell
[55:34.800 --> 55:42.240] oh they wanted it gone they were dragging him out for over a year before we filed this paperwork
[55:42.240 --> 55:46.960] and how long did it take them two weeks tops and it was all a done deal within two weeks of us
[55:46.960 --> 55:56.080] filing these documents yeah meta uh was called to sit on the grand jury that very day um they
[55:56.080 --> 56:07.280] dismissed the the da filed the handwritten motion to dismiss and i said you're not dismissing without
[56:07.280 --> 56:16.880] prejudice and i objected to the whole thing so the final hearing was a telephone call i was at home
[56:17.440 --> 56:23.440] the da was over in del rio and and the regional administrative judge who was acting as the
[56:24.320 --> 56:32.960] court judge at that point was in curvil and uh i get everything on tape yeah well we've got a
[56:32.960 --> 56:38.400] signed order too so they can't bring it back now no matter what they do no no it's gone it's it's
[56:38.400 --> 56:44.160] buried they they want that thing so buried it's not even funny yep and the new court clerk uh
[56:44.160 --> 56:51.280] district clerk and everything that's out here now she's pretty good good friend of mine okay so
[56:52.160 --> 56:57.040] well y'all should have had meta bring up since she was sitting on the grand jury that day she
[56:57.040 --> 57:04.160] should have uh filed charges against these judges of grand jury members she can do that well i know
[57:04.160 --> 57:11.120] but they even dismissed that it was you you should have oh they got rid of the grand jury too
[57:12.880 --> 57:21.200] yeah they redid the whole thing it was a riot but uh i was sitting outside when they did it
[57:21.200 --> 57:26.480] you know how it works yeah but anyway give me a holler tomorrow and we'll work on that computer
[57:26.480 --> 57:32.960] problem okay and we'll get uh some of the other stuff done so that we can get you working again
[57:32.960 --> 57:41.120] okay okay all right thank you sir yes sir you have a good night bye-bye bye-bye all right now
[57:41.120 --> 57:49.600] all right now oh well that just ain't gonna work out okay this thing's gonna make me do that again
[57:51.920 --> 57:56.800] all right folks i got a break coming up so i will take another caller after we get back from this
[57:56.800 --> 58:05.760] break since my website is screwing me over here on telling me i gotta log back in and it's not
[58:05.760 --> 58:13.120] letting me do that um okay well we'll have to go from there after the fact
[58:13.120 --> 58:35.920] but in any case y'all hold on and we'll be right back on the other side of this break okay

[01:01:04.640 --> 01:01:12.400] passed by parliament today in history in recent news several texas-based organizations filed a
[01:01:12.400 --> 01:01:16.960] lawsuit today requesting that a federal court stopped the state from flagging about 95 000
[01:01:16.960 --> 01:01:21.600] people as potentially illegally registered to vote the list was compiled after an 11 month
[01:01:21.600 --> 01:01:26.320] long investigation by the office of the texas secretary of state and the texas department of
[01:01:26.320 --> 01:01:31.360] public safety which sought to identify non-us citizens who were registered to vote when
[01:01:31.360 --> 01:01:37.760] obtaining a driver's license over half of the 95 000 did indeed vote it seems however further
[01:01:37.760 --> 01:01:42.720] controversy was raised when it became clear that some of the names were not in fact belonging to
[01:01:42.720 --> 01:01:47.840] those who were non-citizens and registered apparently around 25 of all latino immigrants

[01:03:39.840 --> 01:03:48.720] air oh well didn't make it but okay here we go so uh i've got one reactive and one proactive
[01:03:50.480 --> 01:03:57.600] question for you the first one is i had a trial two weeks ago that uh i lost and um
[01:03:57.600 --> 01:04:04.320] i felt like i felt like uh i wasn't given due process because as i got to the point of asking
[01:04:04.320 --> 01:04:09.360] the officer for the evidence that he had that the codes and statutes applied to me simply because
[01:04:09.360 --> 01:04:15.280] i was physically in the state of maryland the judge said i'm just going to answer a plea of
[01:04:15.280 --> 01:04:20.480] not guilty for you and then find you guilty to which i objected and asked him if he was acting
[01:04:20.480 --> 01:04:26.240] as my counsel and he told me to stop objecting and stop asking questions and he said no no no
[01:04:26.240 --> 01:04:31.680] jumping and stop asking questions and that was it that's a straight up denial of due process
[01:04:31.680 --> 01:04:35.280] he did not even allow you to put on a defense even though the defense you were putting on
[01:04:35.280 --> 01:04:41.280] wasn't going to get you anywhere fyi well i appreciate that part but uh yeah so i guess
[01:04:41.280 --> 01:04:47.120] what i'm trying to figure out is how to respond how to how to go about you file a motion for new
[01:04:47.120 --> 01:04:52.720] trial claiming that the judge spat for lack of a better word upon your right to access to the
[01:04:52.720 --> 01:04:57.760] courts and to put on a vigorous defense the judge denied you and your right to cross examine in
[01:04:57.760 --> 01:05:03.440] question the wit the state's witness and to put on any sort of defense whatsoever thus denying
[01:05:03.440 --> 01:05:12.400] you and your right to due process substantive and procedural okay all right i appreciate that
[01:05:12.400 --> 01:05:18.720] um the second one is i've got a trial coming up uh and actually i don't know what the date is
[01:05:18.720 --> 01:05:24.240] because i asked for a continuance of 60 days which they granted and so i'm waiting for um
[01:05:25.600 --> 01:05:31.600] uh i suppose what would be the warrant uh or the summons i mean the summons but my question
[01:05:31.600 --> 01:05:39.760] on that is when i got the first summit uh it was by mail and just trying to research whatever i
[01:05:39.760 --> 01:05:46.880] could i i looked up and and found to my satisfaction i guess from cornell law four
[01:05:46.880 --> 01:05:53.120] things that constitute a legal summit and that is that it's served by someone 18 years of old
[01:05:53.120 --> 01:05:56.480] 18 years old you're talking about specifically to your state right
[01:05:58.960 --> 01:06:02.400] well that's what i was i guess what i was trying to figure out is that there's a difference between
[01:06:02.400 --> 01:06:08.240] that because this i was not served this personally by someone 18 years or older who had no interest
[01:06:08.240 --> 01:06:16.160] in the um you need to read the state code not cornell law cornell may may have the same
[01:06:16.160 --> 01:06:23.440] information but you need to verify that your every state has a website where the statutes for that
[01:06:23.440 --> 01:06:29.840] state can be found now they may not actually publish it as a government website there may be
[01:06:29.840 --> 01:06:35.840] other places that are hosting it and posting it for them like lexis nexus for instance but it
[01:06:35.840 --> 01:06:44.720] still has to be the official site for your state now been into lexis nexus for maryland's codes
[01:06:44.720 --> 01:06:54.560] and transportation um i guess would that all you have to do is go to google and type maryland laws
[01:06:54.560 --> 01:07:02.320] codes and statutes and i guarantee you in the top five at the most in the top five
[01:07:02.320 --> 01:07:05.920] links you get back one of them will be the official maryland government website
[01:07:05.920 --> 01:07:15.680] okay all right and then proactive in terms of my my hearing and uh
[01:07:16.400 --> 01:07:24.160] pending trial that will come up in a couple of months um what would you i guess you would
[01:07:24.160 --> 01:07:28.720] probably recommend my looking at your towel of law well i don't know what the case is about so
[01:07:28.720 --> 01:07:36.560] i can't tell you to be looking at tau of law or murder she wrote yeah yeah the two uh citations
[01:07:36.560 --> 01:07:42.400] uh amongst the the ten that i that i received the two top were that i failed to produce my id when
[01:07:42.400 --> 01:07:47.520] it was demanded and as a result the their if they're saying you failed to produce an id or
[01:07:47.520 --> 01:07:52.880] license then the state is required to prove as an element of that offense that you were ever issued
[01:07:52.880 --> 01:08:03.600] one okay so again would that be the first motion that you would recommend that i file
[01:08:04.480 --> 01:08:07.360] and then how would i work a motion relating to what
[01:08:09.120 --> 01:08:14.160] well when you say that the burden falls on them to prove that i was ever issued a license
[01:08:14.160 --> 01:08:21.360] it must be cited as an element of the offense and proven at trial so that means that when maryland
[01:08:22.160 --> 01:08:28.000] files the criminal complaint assuming that they're created as criminal complaints in maryland and not
[01:08:28.000 --> 01:08:37.680] civil okay then maryland's criminal complaint must allege that you failed to produce a validly issued
[01:08:37.680 --> 01:08:43.280] id or driver's license and that it was issued to you on such and such date and such and such time
[01:08:43.280 --> 01:08:49.200] and you are required to have it in your possession and produce it upon demand okay and whatever other
[01:08:49.200 --> 01:08:55.680] elements the specific maryland statute and on that charge says is required to prove the offense
[01:08:56.800 --> 01:09:02.160] now remember that not every statute lists every element that may be required to be proven
[01:09:02.160 --> 01:09:07.920] i guarantee you it does not list an element that the state is required to prove that the license
[01:09:07.920 --> 01:09:12.640] was issued that will not be in there as any of the elements required to commit the offense
[01:09:13.600 --> 01:09:23.280] the state cannot claim that you failed to produce something that doesn't exist you see the caveat
[01:09:23.280 --> 01:09:28.880] that gets into there yeah but see the thing that you're talking to me about is i'm thinking to
[01:09:28.880 --> 01:09:34.320] myself but i do have a life you're kind of missing my point i don't care what you have
[01:09:35.200 --> 01:09:41.680] the question here is what do they actually have to and must attempt to prove
[01:09:45.680 --> 01:09:52.000] and the last thing in the world you want to be doing is telling them what they have to prove
[01:09:52.000 --> 01:09:59.840] is telling them what they have to prove yeah right so what you need is something demanding
[01:09:59.840 --> 01:10:06.080] a copy of the complaint against you not just the citation and if they attempt to tell you
[01:10:06.080 --> 01:10:11.760] that the citation is the complaint then you need to know what the maryland code says a valid
[01:10:11.760 --> 01:10:18.960] complaint takes the form of what information it must contain how it must read everything about it
[01:10:18.960 --> 01:10:25.440] about it how it's constructed informed everything and if that citation doesn't meet a single one of
[01:10:25.440 --> 01:10:34.720] those or even misses a single one of those it is not a valid complaint you get it i hear what
[01:10:34.720 --> 01:10:41.280] you're saying okay okay everything that they're going to do wrong begins procedurally okay
[01:10:41.280 --> 01:10:50.640] everything okay and they will always do it wrong why because they have gotten so used to being able
[01:10:50.640 --> 01:10:58.240] to take their shortcuts to separate you and your money as quickly as possible that they do it out
[01:10:58.240 --> 01:11:03.040] of hand they don't read the law they don't care what the law says they just do what they do
[01:11:03.040 --> 01:11:08.000] because it's the process that they learned even though that process may not follow law
[01:11:08.000 --> 01:11:14.960] that process may not follow law and almost always does not follow law all right so what
[01:11:14.960 --> 01:11:22.080] where would you recommend i go to look up the motion to request the new trial for the previous
[01:11:22.080 --> 01:11:29.920] well again if you can find your maryland website and go to the maryland judiciary websites most
[01:11:29.920 --> 01:11:36.080] state judicial websites have a forms collection standard forms used in all kinds of cases civil
[01:11:36.080 --> 01:11:42.800] and criminal and then you find that repository and you download example motions for whatever you need
[01:11:44.000 --> 01:11:52.880] okay okay so i'm sorry to ask another question so would i need anything else besides requesting
[01:11:52.880 --> 01:12:00.240] a new trial well you can't request a new trial until you've had one right i had one two weeks
[01:12:00.240 --> 01:12:05.920] ago that that when i was i thought you just said you were waiting on this which one are we talking
[01:12:05.920 --> 01:12:11.840] about you said there's two cases okay yes sir yes sir i'm talking back to the first one that i said
[01:12:11.840 --> 01:12:18.000] was reactionary the what is your appeal time frame how long do you have to request an appeal
[01:12:18.000 --> 01:12:26.320] or a new trial under maryland law 30 days 30 days 30 days so it's been 10 okay well the first thing
[01:12:26.320 --> 01:12:32.400] you should have to do which is very simple i would just sign a document with my name saying i hereby
[01:12:32.400 --> 01:12:39.440] uh put in my request for an appeal relating to case number blah blah blah and sign and date it
[01:12:39.440 --> 01:12:44.080] and file it now the other question there is whether or not you've got to pay an appeal bond
[01:12:44.080 --> 01:12:50.000] or whatever at the same time you file your request for the appeal dollars it's 80 for an appeal okay
[01:12:50.640 --> 01:12:59.040] so you file that for the appeal but most states texas being one of them is that the order of
[01:12:59.040 --> 01:13:05.600] procedure is you must first file the motion for new trial before you can file a motion for appeal
[01:13:07.120 --> 01:13:12.560] now that's not notice that you intend to appeal that's not the same as a motion for appeal
[01:13:14.240 --> 01:13:20.320] okay so don't confuse the two things one is the notice that i intend to appeal this decision by
[01:13:20.320 --> 01:13:27.360] the court but while you're waiting to get everything ready for that appeal you need to file the motion
[01:13:27.360 --> 01:13:33.920] for new trial and you need to state the legal basis of why you deserve a new trial and based
[01:13:33.920 --> 01:13:40.800] upon what you told me the judge did your request is very simple the judge denied me in my right to
[01:13:40.800 --> 01:13:46.960] put on a proper and vigorous defense in relation to the allegations against me the judge refused
[01:13:46.960 --> 01:13:53.200] to allow me to cross examine the witness failed to state any lawful basis for not allowing me to
[01:13:53.200 --> 01:13:59.360] question the witness then told me that he was going to enter a plea at that time of not guilty
[01:13:59.360 --> 01:14:05.920] and then he without the benefit of a jury or any finding of facts or admissible evidence
[01:14:05.920 --> 01:14:13.840] was going to convict me and find me guilty that's prejudicial on the part of the judge that is not
[01:14:13.840 --> 01:14:24.800] fair and impartial that is 100 biased those are all grounds for a new trial okay they are also
[01:14:24.800 --> 01:14:31.600] the same grounds you will file for an appeal provided of course you don't get the new trial
[01:14:34.400 --> 01:14:39.280] okay you follow you think that that's going to be i do you think that's going to be somewhere
[01:14:39.280 --> 01:14:44.720] i can look up on the maryland judiciary i cannot answer that like you're at okay i do not okay
[01:14:44.720 --> 01:14:50.720] know what every state provides to its people i know they should i know that if i looked hard
[01:14:50.720 --> 01:14:56.720] enough i eventually found where they did but i have not done it for every state including
[01:14:56.720 --> 01:15:00.880] maryland because i had a good friend who was in maryland who helped people with this stuff up
[01:15:00.880 --> 01:15:06.960] there but he passed away a couple of years ago uh and jeff is no longer available to help folks
[01:15:06.960 --> 01:15:11.760] up there in maryland with the stuff that he was doing so i never had to personally look it up
[01:15:11.760 --> 01:15:16.800] he had already done all that and had all that information and so that took a load off of me
[01:15:16.800 --> 01:15:21.680] having to do anything other than just answer general thought-provoking questions like yours
[01:15:24.480 --> 01:15:28.320] all right all right well you've given me enough to do some research on so i appreciate that
[01:15:28.320 --> 01:15:34.080] yes sir and i wish you luck thank you all right have a good one thanks for calling all right you
[01:15:34.080 --> 01:15:43.360] too all right all right now that being said next caller up is carl in oregon aka truth raider uh

[01:15:48.640 --> 01:15:58.080] with all right just a couple things real quick um i called my local court to inquire because i
[01:15:58.080 --> 01:16:02.960] haven't heard anything through the mail about if there was any action that was going to be
[01:16:02.960 --> 01:16:09.120] considered to be taken for the unlawful seizure of my property by this officer back in november
[01:16:10.320 --> 01:16:17.280] local city police officer and uh the clerk said i don't have any recollection of receiving anything
[01:16:17.280 --> 01:16:25.280] from you okay well this is what i did i recorded it and i have a copy of that complaint that's
[01:16:25.280 --> 01:16:34.320] supposed to go to the risk management and this is for the city there and it's stamped okay okay
[01:16:36.240 --> 01:16:43.920] all right so i call the lady herself the one who's in charge of risk management she says no

[01:19:38.960 --> 01:19:47.680] number 512646 1984 and we are talking to carl in oregon go ahead raider all right thank you
[01:19:48.640 --> 01:19:54.560] taking my call tonight um this is the case of obstruction of the process
[01:19:54.560 --> 01:20:02.000] by the prosay litigants here this lady is the what do you mean obstruction of due process by
[01:20:02.000 --> 01:20:05.840] the prosays you are the prosay how are you obstructing due process
[01:20:06.880 --> 01:20:11.520] affecting the uh of pro say i mean if i said that i meant myself pro se
[01:20:14.080 --> 01:20:19.520] okay so this lady is the supervisor of clerk she's a clerk supervisor and there's three
[01:20:19.520 --> 01:20:26.960] or four other clerks there and i turned my recorder on and i recorded it okay i'm filing
[01:20:26.960 --> 01:20:30.800] i want you to take this and she stamped them all time stamped them with a date and everything on
[01:20:30.800 --> 01:20:35.840] it all right let me ask you this question is the lady you're talking to in this example the same
[01:20:35.840 --> 01:20:38.640] lady that originally stamped the pleadings in the first place
[01:20:42.320 --> 01:20:47.600] i believe so yeah because i'm not asking if you believe so is it or isn't it
[01:20:47.600 --> 01:20:52.960] is it or isn't it you were the only one there when they were brought in so was this the same
[01:20:52.960 --> 01:20:59.440] lady or not the same lady this particular on this particular day yes she was the same lady for that
[01:20:59.440 --> 01:21:05.120] but i've had other clerks stamped stuff i mean before in the past i'm not talking about saying
[01:21:05.120 --> 01:21:10.880] stuff to you raider you said you had filed documents previously and that this clerk that
[01:21:10.880 --> 01:21:19.200] you were talking to said i don't recall ever getting anything from you is the person the
[01:21:19.200 --> 01:21:25.040] clerk who took them from you when you say you originally brought them in the same one that is
[01:21:25.040 --> 01:21:35.520] making this statement now yes yes absolutely okay so the only thing she's got is my motions for
[01:21:35.520 --> 01:21:41.440] dismissal and the other proper form the forms i'm supposed to file in the court but she doesn't have
[01:21:41.440 --> 01:21:47.040] my risk management complaint to the city in other words a simple tort against the city or damages
[01:21:48.720 --> 01:21:55.280] to the risk management officer that is supposed to what do you mean she doesn't have it she
[01:21:55.280 --> 01:22:01.120] said she doesn't remember receiving it she doesn't have it but you have a copy that's stamped that
[01:22:01.120 --> 01:22:06.960] she stamped herself and i recorded her doing it yes or no will do you have a copy that is stamped
[01:22:06.960 --> 01:22:16.560] as being received by that office right yes is this lady the chief clerk yes okay then what you need
[01:22:16.560 --> 01:22:23.040] to tell her straight up is then i wish to file a complaint against you with whoever is over you
[01:22:24.160 --> 01:22:28.960] for tampering with a governmental record because you are the person who received this you're the
[01:22:28.960 --> 01:22:34.160] person to put this stamp on the copy that i have and you are the one entirely responsible for
[01:22:34.160 --> 01:22:41.280] ensuring that that record was properly maintained and sent to the proper uh person to be dealt with
[01:22:42.320 --> 01:22:46.160] so who who is your boss that i can file a complaint against you with
[01:22:47.840 --> 01:22:52.480] i think it's a judge judges her boss i'm not asking what you think raider i'm saying tell
[01:22:52.480 --> 01:22:58.720] this to her to her face and let's see how many different shades she can turn in trying to figure
[01:22:58.720 --> 01:23:06.480] out how to solve that problem it might astound you to find out that oh my goodness well oh let
[01:23:06.480 --> 01:23:14.320] me look again and suddenly she has it okay and then if she cannot produce it in a timely manner
[01:23:14.320 --> 01:23:21.200] then the complaint follows through that she intentionally lost and or destroyed your complaint
[01:23:21.200 --> 01:23:28.080] and thus tampered with an official record which is criminal conduct and thus you can bring criminal
[01:23:28.080 --> 01:23:33.680] charges against her as and make a complaint of criminal charges against her and hopefully
[01:23:33.680 --> 01:23:40.160] somebody will remove her from her job right there have been other people that i've known this as they
[01:23:40.160 --> 01:23:46.080] have a they have a reputation of losing documents conveniently well there's a there's that type of
[01:23:46.080 --> 01:23:54.560] that type of conduct is called criminal conduct and tampering with a government record conduct
[01:23:54.560 --> 01:24:01.760] okay exactly so instead of just reminiscing about oh they're prone to do that why is it someone
[01:24:01.760 --> 01:24:09.760] complaining to the proper parties about them doing that right that's what i'll do i'm just letting
[01:24:09.760 --> 01:24:14.880] you know what's going down what's happening okay well explain to me how i'm supposed to do anything
[01:24:14.880 --> 01:24:19.520] about it from where i'm at what you're dealing with just it i'm just advising what to do and
[01:24:19.520 --> 01:24:25.120] just what you what's your thoughts on that was okay well now you have them all righty and that's
[01:24:25.120 --> 01:24:31.760] all i got for tonight that's all you got you're sure yeah okay i have a they have a trial coming
[01:24:31.760 --> 01:24:35.920] up next month but i think i'm gonna go ahead and postpone that i'm gonna go ahead and have a
[01:24:35.920 --> 01:24:42.320] written notice to them telling that i want to postpone this so-called tribunal okay good luck
[01:24:42.320 --> 01:24:49.440] all right god bless brother all right have a good one have a great night bye-bye all right now we
[01:24:49.440 --> 01:24:58.640] have sean in somewhere sean where are you calling us from hey i'm calling from uh iowa from where
[01:24:59.760 --> 01:25:04.640] west de moine iowa west de moine iowa sorry you glitched there while you were saying that
[01:25:04.640 --> 01:25:09.840] and all i got was okay i'm sorry i'm sorry i got so excited that i got through because
[01:25:09.840 --> 01:25:14.080] i've been trying to get through to you for months ah your tongue got tangled around your eye teeth
[01:25:14.080 --> 01:25:17.440] and you couldn't see what you were saying yeah dude eddie you're awesome man i appreciate
[01:25:17.440 --> 01:25:25.600] everything you're doing so thanks for letting me in i do what i can man thank you so uh
[01:25:26.160 --> 01:25:30.240] go ahead with your question i'm sorry uh no i don't have one you called me remember
[01:25:31.280 --> 01:25:36.240] oh okay so so anyways uh do i got a minute to explain what's going on you got three
[01:25:36.240 --> 01:25:40.640] i got three minutes okay till i go to break and i can get you longer after that but three till
[01:25:40.640 --> 01:25:46.640] break awesome dude just being able to talk to you freaking amazing i appreciate it so anyways so
[01:25:46.640 --> 01:25:52.720] back in july 6 let me explain this as quickly as i possibly can back in july 6 i was pulled over i
[01:25:52.720 --> 01:25:59.280] was traveling on a public highway in iowa public highway 163 i was traveling back to de moine iowa
[01:25:59.280 --> 01:26:07.360] i got pulled over um for allegedly speeding i was going 74 miles per hour in a 65 mile per hour zone
[01:26:07.360 --> 01:26:14.000] i got pulled over um didn't know exactly who i was being pulled over by once i got pulled over the
[01:26:14.000 --> 01:26:19.760] officer walked up to the vehicle he asked me for all the you know the basic credentials license
[01:26:19.760 --> 01:26:26.000] registrations and insurance and i said now i need to see some identification from you so i asked him
[01:26:26.000 --> 01:26:33.120] for his identification he said so you're refusing to give me your identification i said no i need
[01:26:33.120 --> 01:26:39.680] to see some identification from you and he basically went on to say well so you're refusing
[01:26:39.680 --> 01:26:43.680] to give me your identification i said no i'm not consenting to anything i need to see some
[01:26:43.680 --> 01:26:47.920] identification from you because i don't know who you are you're pulling me over on the side of a
[01:26:47.920 --> 01:26:52.240] public highway i'm assuming that you're an iowa state patrol or department of public safety or
[01:26:52.240 --> 01:26:58.000] department of transportation instead you are an all-black uniform you look like a city police
[01:26:58.000 --> 01:27:06.720] officer for many municipality in the in the in the country and uh he he basically went on to threaten
[01:27:06.720 --> 01:27:11.040] me and it took 38 seconds from the time that he got out of his vehicle to walk up to my door to
[01:27:11.040 --> 01:27:16.000] threaten me with arrest because i did not want to give him my identification i wanted him to identify
[01:27:16.000 --> 01:27:21.280] himself and it wasn't long after that that he reached his hand into my window i had my window
[01:27:21.280 --> 01:27:26.560] down about three inches which is what i think you say to do maybe might be even less than three
[01:27:26.560 --> 01:27:34.240] inches that was far more than what he needed to reach into my car unlock my door and then try to
[01:27:34.240 --> 01:27:39.840] pull me out of the vehicle so then once he tried to pull me out of the vehicle he called in backup
[01:27:39.840 --> 01:27:45.760] backup came because i refused to get out of the vehicle backup came why do you keep calling your
[01:27:45.760 --> 01:27:54.240] car a vehicle well i was traveling in my private property is what i should be saying but i was i
[01:27:54.240 --> 01:27:58.560] was traveling in my private property he comes up on the side of my private property reaches in there
[01:28:00.080 --> 01:28:04.720] and pulls the keys of the ignition this is his i called in a deputy i believe it was either a
[01:28:04.720 --> 01:28:10.400] sheriff or a deputy he's a municipal police officer they pulled me out of the vehicle
[01:28:10.400 --> 01:28:14.880] they said that uh i'm under arrest he already signed me at the rescue because i didn't provide
[01:28:14.880 --> 01:28:20.480] my driver's license called me out of the vehicle did he ask you for a driver's license or did he
[01:28:20.480 --> 01:28:28.720] ask you for an id or your id information what did he ask you for specifically specifically he asked
[01:28:28.720 --> 01:28:36.160] me for a driver's license and insurance and um my tag for registration and i told him i said i don't
[01:28:36.160 --> 01:28:42.640] have to do that i said wait a minute why did you say i don't have to do that i i the reason i said
[01:28:42.640 --> 01:28:48.320] i don't have to do that because i did not feel safe i wanted him to identify himself before i
[01:28:48.320 --> 01:28:55.440] was going to identify who i was that that is not the way that works okay if they show up in a marked
[01:28:55.440 --> 01:29:00.320] car and they're wearing some sort of identifying insignia or something like that the court is not
[01:29:00.320 --> 01:29:06.240] going to be on your side okay right and they weren't on my side because they found me guilty
[01:29:06.240 --> 01:29:12.240] well yeah but that's that's a separate issue from what i'm trying to get to here the point is is
[01:29:12.240 --> 01:29:17.840] when an officer asked you to produce documents what are they asking you to do
[01:29:20.080 --> 01:29:26.000] oh they're asking me to go against my right to remain silent that's correct so instead of saying
[01:29:26.000 --> 01:29:33.040] i don't have to do that what is the proper way to address the officer to invoke that right and to
[01:29:33.040 --> 01:29:39.600] make sure that any video recording being made shows that that is the only thing you are attempting
[01:29:39.600 --> 01:29:46.320] to do is to protect your rights hang on just a second let me take this break and then we'll get
[01:29:46.320 --> 01:29:51.920] the answer from you for that okay thank you eddie i appreciate it yep all right folks we'll be right

[01:30:55.520 --> 01:31:01.200] of 3500 people aged 30 to 65 researchers found that a quarter of those living alone took
[01:31:01.200 --> 01:31:06.800] antidepressants that's almost double the rate of those who live with spouses family or roommates
[01:31:06.800 --> 01:31:12.560] did living alone cause depression or do depression prone people simply prefer solitude both
[01:31:12.560 --> 01:31:17.760] explanations are plausible but there's one important wake-up call to all of us to reach out

[01:33:41.200 --> 01:33:45.200] hour left in the show so if you're going to give us a call and ask a question then now would be
[01:33:45.200 --> 01:33:51.680] the time to get in line all right back to sean all right sean please continue hey thanks for having
[01:33:51.680 --> 01:33:58.560] me back again so anyhow they uh i was i was told from the vehicle they uh he told me i worked for
[01:33:58.560 --> 01:34:03.680] traveling 74 miles per hour in a 65 on a public highway yeah i got all that but you still haven't
[01:34:03.680 --> 01:34:11.360] answered my question my question to you was what is the proper way to invoke your right to remain
[01:34:11.360 --> 01:34:17.520] silent in that situation so that they cannot use that against you in a court of law
[01:34:17.520 --> 01:34:24.720] well i think it would just be just to say that i am invoking my right to remain silent and i don't
[01:34:25.440 --> 01:34:29.600] wish to answer any further questions without me sharing for a minute well that's the most
[01:34:29.600 --> 01:34:34.640] simplistic way but it doesn't make people understand why you're doing it which would go
[01:34:34.640 --> 01:34:42.320] a long way to convincing a jury that you're in the right for me i predicate that statement with
[01:34:42.320 --> 01:34:48.720] the following officer can any of the information or documentation that you are requesting that i
[01:34:48.720 --> 01:34:57.360] turn over to you be used against me in a court of law exactly if it can then i must decline
[01:34:57.360 --> 01:35:01.040] to provide you with that information and invoke my right to remain silent
[01:35:02.400 --> 01:35:07.040] and i hereby request assistance of counsel if that is the case
[01:35:07.040 --> 01:35:12.640] right and the thing is even if they tell you no that can't be used against you that's a lie
[01:35:12.640 --> 01:35:22.800] it absolutely can right well it clearly was used against me because after they um after he pulled
[01:35:22.800 --> 01:35:26.800] me everything pulled me out of that vehicle and then they uh they hauled me out to jail they
[01:35:26.800 --> 01:35:32.240] arrested me um they charged me with two additional charges because they legally searched my vehicle
[01:35:32.240 --> 01:35:38.480] two additional charges because they legally searched my vehicle and uh iowa we we were
[01:35:38.480 --> 01:35:43.920] lucky enough to have a supreme court justice despite for a fourth amendment federal right
[01:35:43.920 --> 01:35:47.600] which says that you know you don't have the right to search without you know probable cause upon
[01:35:47.600 --> 01:35:52.960] other affirmations and you know he basically became the arbiter of that he said you know
[01:35:54.080 --> 01:35:58.400] yeah that the federal courts cannot create an exception to the search and seizure under the
[01:35:58.400 --> 01:36:04.400] guise of the police power to inventory a vehicle and thus be subject to a search for that purpose
[01:36:05.520 --> 01:36:10.080] right exactly yeah the federal courts have been dead wrong on that for decades
[01:36:10.880 --> 01:36:16.000] oh my gosh they've been it i can't believe that we had finally and i was you know here in iowa
[01:36:16.000 --> 01:36:21.040] we finally had a justice literally like that stood up for this like he said hey this is ridiculous
[01:36:21.040 --> 01:36:24.800] we're not going to allow like that's what he said i'm going to be the art if no one else it's a
[01:36:24.800 --> 01:36:28.720] federal course i'm going to be the arbiter with this and i'm going to be the arbiter of this
[01:36:28.720 --> 01:36:33.200] and i'm going to say that you do not have the right to search this vehicle you don't have the
[01:36:33.200 --> 01:36:38.880] right to inventory or whatever it is that you're making up to be able to seize that vehicle and
[01:36:38.880 --> 01:36:42.960] seize that person and then be able to search that vehicle without probable cause under over
[01:36:42.960 --> 01:36:49.120] affirmation they still did it anyway but the point is is that there was a that supreme court ruling
[01:36:49.120 --> 01:36:55.200] came down as the state of iowa reverse ingram and that basically said well you know you do not have
[01:36:55.200 --> 01:37:01.440] the right to search a vehicle without probable cause for reasonable suspicion under oath or
[01:37:01.440 --> 01:37:08.000] affirmation and even if you do have that i.e a warrant and you need a warrant exactly and then
[01:37:08.000 --> 01:37:12.320] so what they basically did here in iowa is they said well if we're going to pull you over and
[01:37:12.320 --> 01:37:18.560] we're going to seize your vehicle then you have the right now to provide any necessary means for
[01:37:18.560 --> 01:37:24.560] you to have that car you know basically transported to wherever you need it to be you know so things
[01:37:24.560 --> 01:37:31.040] have changed slightly drastically slightly i would say slightly but they've changed for the better
[01:37:31.040 --> 01:37:36.160] here in iowa in that sense but the difference is so they ended up having to drop those two charges
[01:37:36.160 --> 01:37:40.640] because they searched my vehicle found what they said was illegal contraband and then they ended
[01:37:40.640 --> 01:37:45.520] up having to drop those two charges well i ended up showing up for a preliminary hearing just
[01:37:45.520 --> 01:37:52.000] happened on july 6th of 2018 i had my preliminary set for july 16th of 2018 i showed up for that
[01:37:52.000 --> 01:37:58.000] preliminary hearing i went on to iowa courts online and saw that there was a dismissal
[01:37:58.000 --> 01:38:02.320] right so there's a motion to dismiss those two charges so when i showed up for that preliminary
[01:38:02.320 --> 01:38:06.400] i went to the clerk of court and i said hey we have a motion to dismiss these these charges here
[01:38:06.400 --> 01:38:12.720] is this for all the charges or is this for these these two and the clerk of court she told me her
[01:38:12.720 --> 01:38:19.360] name being kim and away said oh you're good to go where did you sign into court okay yeah you're
[01:38:19.360 --> 01:38:22.880] good to go we'll go ahead and send the rest of the paperwork in the mail for you and i said okay well
[01:38:23.680 --> 01:38:27.680] there are all charges being dismissed or just those two she said you're good to go
[01:38:27.680 --> 01:38:33.120] they're all being dismissed we'll send you the paperwork in the mail so i'm under the presumption
[01:38:33.120 --> 01:38:39.120] that all these charges are being dismissed come to find out they spend they dismiss the two charges
[01:38:39.120 --> 01:38:45.200] and then send me a another uh an order for a pre-trial conference which says in the further
[01:38:45.200 --> 01:38:50.000] and suggestions they're prosecuting me on the interference of the official acts and the speeding
[01:38:50.880 --> 01:38:55.280] so i'm at my pre-trial conference come to find out what i'm being charged with
[01:38:56.080 --> 01:39:02.320] i go down to the clerk of court i try to file a trial by jury i get denied that how are they
[01:39:02.320 --> 01:39:08.240] saying you interfered they're saying i interfered because i asked the police officer to identify
[01:39:08.240 --> 01:39:13.360] himself no supreme court has already said you cannot interfere with a public duty
[01:39:14.000 --> 01:39:20.800] by anything other than physical means i know and i even presented the case law showing that
[01:39:20.800 --> 01:39:26.720] that verbal discussion verbal dispute does not mean physical altercation i presented that on
[01:39:26.720 --> 01:39:32.560] record to the court they they didn't even look at it they don't care whether i presented that
[01:39:32.560 --> 01:39:38.400] i presented shapiro vs constant i presented marbury vs madison i presented shuttersworth
[01:39:38.400 --> 01:39:45.760] vs birmingham okay none of that has anything to do with that question well i'm talking what case law
[01:39:45.760 --> 01:39:54.560] are you saying you presented relating to the fact that verbal anything being verbally argumentative
[01:39:54.560 --> 01:40:02.160] cannot constitute interference every interference law that's valid requires that interference be
[01:40:02.160 --> 01:40:08.400] conducted with some form of physical resistance exactly let me let me go pull that up real quick
[01:40:08.400 --> 01:40:13.280] i got it right here you have the case right here it's an actual iver case losses can you
[01:40:13.280 --> 01:40:19.120] two seconds i'll get it i'll have it here but the point is is that's the only case law you needed to
[01:40:19.120 --> 01:40:23.200] cite in relation to that charge the rest of it had nothing to do with that shuttle works got
[01:40:23.200 --> 01:40:28.320] nothing to do with that idea nothing that's that's got nothing to do with it that all goes to other
[01:40:28.320 --> 01:40:34.320] issues has to do with the fact that you can't okay so shuttersworth has been well shapiro
[01:40:34.320 --> 01:40:40.240] says that i have the right to travel again irrelevant this was no longer an issue of
[01:40:40.240 --> 01:40:47.200] right to travel when they're charging you with interference right so citing case law that had
[01:40:47.200 --> 01:40:54.400] nothing to do with interference wasn't proper no i didn't cite case law that had to had nothing to
[01:40:54.400 --> 01:40:59.920] do with interference i'm gonna i'm grabbing you just said you did you just said you cited shapiro
[01:40:59.920 --> 01:41:06.480] and several other shuttlesworth that's my that's my ending argument i cited that again ending
[01:41:06.480 --> 01:41:14.240] argument of what charge interference right right it's irrelevant to interference which is what i
[01:41:14.240 --> 01:41:22.720] just said right right you see you're not listening i'm listening okay as i used to tell people you
[01:41:22.720 --> 01:41:28.720] are not listening to what you're hearing let me tell you this uh here eddie here i got the case
[01:41:28.720 --> 01:41:37.840] on now okay so it is so all right simply objecting or even passively failing to cooperate with law
[01:41:37.840 --> 01:41:43.760] enforcement officers does not provide arguable probable cause for arrest under iowa co-operation
[01:41:43.760 --> 01:41:49.360] iowa code provision governing interference with official acts police acts rather the statutes
[01:41:49.360 --> 01:41:55.200] requires proof that the the defendant actively interfered with a law enforcement officer mccain
[01:41:55.200 --> 01:42:04.640] verse mccauley and the iowa yeah but how does the case you're using define actively well actively
[01:42:04.640 --> 01:42:11.840] would mean some sort of no no no that's your interpretation okay where's the case that says
[01:42:11.840 --> 01:42:16.160] what actively means in in relation to how the court defines it
[01:42:18.480 --> 01:42:23.760] or i haven't looked at it well then there's a problem here you don't have continuity of case
[01:42:23.760 --> 01:42:30.960] law okay because they can sit here and make the argument that you you continuously arguing and
[01:42:30.960 --> 01:42:37.920] refusing to cooperate is actively right right so you need to find out how the court intended
[01:42:37.920 --> 01:42:47.520] actively to be defined what action constitutes actively and does that action involve verbal only
[01:42:49.840 --> 01:42:52.720] right okay how do i do that after the fact i've already been
[01:42:53.680 --> 01:42:59.840] well you appeal it of course right now you file a motion for new trial for denial of due process
[01:42:59.840 --> 01:43:06.960] and a conviction that has no basis in law you cite the judge for uh intentionally misapplying
[01:43:06.960 --> 01:43:14.720] the law to the facts okay you file the motion for new trial and you follow and then you uh when they
[01:43:14.720 --> 01:43:21.040] deny that file your motion for appeal i suggest you follow them one right after the other this
[01:43:21.040 --> 01:43:29.200] one this day this one the next day just to have your basis covered right the only problem is i
[01:43:29.200 --> 01:43:34.800]  don't have i've been you know i i i'm just like everybody else i work full time so i'm doing all
[01:43:34.800 --> 01:43:43.360] this um okay here's the problem with that statement they don't care this system is

[01:46:44.240 --> 01:46:53.680] this up here yeah so anyways i'm basically i'm i'm looking for some information on you know from
[01:46:53.680 --> 01:46:58.720] you guys on what i need to do because i went through and i out of this house they ended up
[01:46:58.720 --> 01:47:05.440] dismissing this how much time do you have in whatever in the in iowa i got they sent me february
[01:47:05.440 --> 01:47:10.480] 20th the final judgment and sentence they're sentencing me for interference with official
[01:47:10.480 --> 01:47:17.600] acts to a week in jail and a year of probation to the court okay again this was a court of record
[01:47:17.600 --> 01:47:25.040] i must presume right okay how long do you have to appeal the conviction and did you have a lawyer
[01:47:25.040 --> 01:47:29.040] i got to this friday i have until this friday i did not have a lawyer i represented myself first
[01:47:29.040 --> 01:47:36.720] day litigant okay did you sign any waivers i signed no waivers okay then they have a problem
[01:47:36.720 --> 01:47:42.800] because the supreme court of the united states has ruled that you cannot be convicted of an
[01:47:42.800 --> 01:47:49.360] incarceratable crime incarcerable crime whatever the proper terminology is if you never had
[01:47:49.360 --> 01:47:58.400] assistance of counsel well here i am okay i'm going to jail for a week they say i need to start
[01:47:58.400 --> 01:48:03.440] so right there they have a problem first thing you need to do is find that court though that court
[01:48:03.440 --> 01:48:08.240] that court case if you didn't sign any waivers did they offer you assistance of counsel
[01:48:09.280 --> 01:48:16.560] nope okay then they have a problem that's a real problem i needed what do i need to do because
[01:48:16.560 --> 01:48:21.200] the reason i'm calling you guys is because i've been fighting this on my own pro-state litigant
[01:48:21.200 --> 01:48:27.200]  and i was like i don't you know i i've i've went out i've researched i've been at the law library
[01:48:27.200 --> 01:48:32.640] i've read maranda bertieres on average here i've read shadows worth referring and i've read yeah
[01:48:32.640 --> 01:48:38.480] but you're reading all the wrong cases for the wrong argument you're looking at right to travel
[01:48:38.480 --> 01:48:45.120] stuff and there is no such thing in case law the right to travel deals with international
[01:48:45.120 --> 01:48:53.040] not state the state or interstate intrastate okay right it has to do with international travel
[01:48:53.840 --> 01:48:58.480] here within the states it is right to locomotion and personal liberty
[01:48:58.480 --> 01:49:03.920] that's it that's what you're looking for but none of that is relevant to the charge they're
[01:49:03.920 --> 01:49:08.400] trying to convict you on it's pointless to research it it's got nothing to do with it
[01:49:09.600 --> 01:49:14.400] okay you're looking up case law that says what color the sky is and they're trying to describe
[01:49:14.400 --> 01:49:19.760] the hole they're throwing you in what the hell difference does it make what color the sky is
[01:49:20.800 --> 01:49:27.200] you follow i follow that okay so you need to be finding the case law that says they can
[01:49:27.200 --> 01:49:35.040] not convict you without assistance of counsel they cannot cite you for interference without
[01:49:35.040 --> 01:49:42.080] physical interference being the case it does not support it by law and you can file the appeal to
[01:49:42.080 --> 01:49:51.120] overturn the conviction because there was no basis in law for it thus the conviction is shocking to
[01:49:51.120 --> 01:49:58.400] the conscience because it does not comply with law you were entitled to a directed verdict because
[01:49:58.400 --> 01:50:04.320] the state could not prove the necessary elements of the offense and the judge refused to abide by
[01:50:04.320 --> 01:50:10.640] the law so you need to research the cases supporting those arguments and then you need to
[01:50:10.640 --> 01:50:18.240] figure out as well before friday what the procedure in iowa is as far as what things must be done
[01:50:18.240 --> 01:50:25.360] after a trial order has been signed and how long do you have to do it for instance here in texas
[01:50:25.360 --> 01:50:33.120] you are required to file a motion for new trial after a conviction before you can file a motion
[01:50:33.120 --> 01:50:41.040] for appeal now you can file your notice of appeal anytime you want but the motion for your appeal
[01:50:41.040 --> 01:50:49.440] can only be done after you have requested a new trial via motion okay i do not
[01:50:49.440 --> 01:50:55.760] know if that is procedure in iowa but you need to find out that's the thing is i don't even know
[01:50:55.760 --> 01:51:01.520] how to find out because there's a code of criminal procedure in every state and it has to be criminal
[01:51:01.520 --> 01:51:08.400] because they couldn't put you in jail if it was civil okay so a little logic here
[01:51:08.400 --> 01:51:14.400] they can't put you in jail for a civil infraction no it's a criminal infraction fees
[01:51:16.000 --> 01:51:26.000] so okay okay listen to me carefully here in texas a class c misdemeanor cannot involve incarceration
[01:51:26.000 --> 01:51:32.720] as a part of the punishment it is a fine only offense it may or may not be the case in iowa
[01:51:32.720 --> 01:51:37.840] okay that part's irrelevant the question here is whether or not it was civil or criminal
[01:51:37.840 --> 01:51:42.240] and if they're telling you they can put you in jail then it's criminal end of discussion right
[01:51:43.120 --> 01:51:48.320] so you need to be reading the rules of criminal procedure whatever they may be in whatever name
[01:51:48.320 --> 01:51:55.840] they might go by in iowa okay i've read as much as i could in criminal procedure and i still
[01:51:56.640 --> 01:52:02.400] i don't know exactly what i everything i filed you are looking for the statutes that deal with
[01:52:02.400 --> 01:52:08.080] the course of action on both sides after a conviction that's what you need to be looking up
[01:52:08.080 --> 01:52:14.240] now if you can't do that then you better go find an attorney and you better do it asap
[01:52:15.840 --> 01:52:21.360] yeah that's the worst part about it all well that's the problem you're wanting to get in
[01:52:21.360 --> 01:52:28.560] the ring with mike tyson and you don't have a clue how to box well i i thought i boxed out
[01:52:28.560 --> 01:52:35.040] pretty well but yet no again everything that you've told me so far says exactly the contrary
[01:52:36.640 --> 01:52:41.040] because you're making irrelevant arguments and you're muddying the water of your appeal
[01:52:41.040 --> 01:52:46.480] by doing that okay either is it or is it irrelevant to ask for a suppression of
[01:52:46.480 --> 01:52:51.920] evidence based on miranda bursa arizona is it irrelevant to ask for again what evidence are
[01:52:51.920 --> 01:52:57.360] you asking to be suppressed in relation to an allegation of interference if they have no
[01:52:57.360 --> 01:53:02.320] evidence that you are physically interacting with the officers to prevent them from conducting their
[01:53:02.320 --> 01:53:06.640] investigation then how is there any evidence to present what are you trying to suppress
[01:53:07.760 --> 01:53:11.600] well they're saying that the officer asked me for my id and that's part of his investigation
[01:53:11.600 --> 01:53:17.360] since i didn't apply it that's irrelevant what are the elements of the offense i don't care what
[01:53:17.360 --> 01:53:22.800] they're telling you what does the law say they have to prove what are the actual elements that
[01:53:22.800 --> 01:53:31.600] constitute the offense this is why i say you think you know how to box you do not you don't
[01:53:31.600 --> 01:53:38.240] even understand how the process works in relation to the charge and that is coming from your own
[01:53:38.240 --> 01:53:44.560] mouth everything you're telling me tells me you walked into this completely blind with your hands
[01:53:44.560 --> 01:53:52.960] tied behind your back well i would highly doubt that no everything you told me tells me that is
[01:53:52.960 --> 01:53:58.320] the case now you may have thought you were walking in there prepared but you weren't
[01:53:58.960 --> 01:54:04.800] because you didn't understand the process you didn't understand what was going to happen and
[01:54:04.800 --> 01:54:10.400] in what order and how it was going to happen everything i've learned from you and from carl
[01:54:10.400 --> 01:54:16.720] miller or anybody else they say that if you invoke your fundamental rights at the magistrate level
[01:54:16.720 --> 01:54:20.640] they will never take you seriously and they will always find you guilty that's everything that
[01:54:20.640 --> 01:54:27.440] i've learned no i've never said that i say exactly the opposite of that you invoke your rights at
[01:54:27.440 --> 01:54:32.400] every turn because it's the only way to protect them the difference is whether or not you're
[01:54:32.400 --> 01:54:38.160] doing it in a court of record or not so that it's it's preserved for the purpose of appeal
[01:54:38.160 --> 01:54:44.800] if they could sentence you to jail they had to do this in a court of record therefore everything
[01:54:44.800 --> 01:54:52.720] you did was made part of the record whether it was right or wrong and here's the problem
[01:54:53.920 --> 01:55:03.600] they will hone in on everything you did wrong to uphold the conviction rather than taking
[01:55:03.600 --> 01:55:10.880] than taking everything the other side did wrong that you did not properly address and preserve
[01:55:10.880 --> 01:55:17.600] to overturn it they're playing card tricks with you okay but this is already mentioned in there
[01:55:17.600 --> 01:55:23.040] i already asked is it lawful for an officer to reach into your window that is irrelevant
[01:55:24.560 --> 01:55:29.600] that's that's a completely irrelevant question which goes even further to my point of you didn't
[01:55:29.600 --> 01:55:35.760] know what you were doing you were asking questions that didn't address the charge against you at all
[01:55:37.440 --> 01:55:44.960] at all you had to ask the officer one question and one question only to beat the charge officer
[01:55:44.960 --> 01:55:52.000] can you please describe in your own words and in explicit detail how did i physically interfere
[01:55:52.000 --> 01:55:58.960] with your investigation that is the only question you had to ask and you would have blown their
[01:55:58.960 --> 01:56:09.440] whole case to smithereens do you understand that no i do you do now i do well no i understood that
[01:56:09.440 --> 01:56:14.400] in the beginning then why didn't you ask that question well because i'm a pro-state litigant
[01:56:14.400 --> 01:56:18.480] i'm not a professional lawyer i mean i'm not either and i just sat right here and thought it
[01:56:18.480 --> 01:56:24.400] up on the spot but it's the correct question and you're saying you did it had a few more years
[01:56:24.400 --> 01:56:29.200] you've had a few more years yeah but you're still missing the point sean you're missing the point
[01:56:29.200 --> 01:56:33.920] you're telling me you did these things and yet what you're telling me is you didn't do these
[01:56:33.920 --> 01:56:42.160] things how did you ask that specific question i have yet to hear you say how you formulated and
[01:56:42.160 --> 01:56:47.520] asked that specific question of the officer you asked him questions about everything else you
[01:56:47.520 --> 01:56:54.560] argued about everything else but you haven't said once that you ever asked that question
[01:56:56.320 --> 01:57:01.760] yeah well i might have not have asked that during the actual rest the question is like so if i filed
[01:57:01.760 --> 01:57:06.720] a suppression of evidence under miranda versus arizona as far as i read i read that entire
[01:57:06.720 --> 01:57:13.520] again suppression of what evidence you can't suppress that which doesn't exist in this case
[01:57:13.520 --> 01:57:20.960] the only evidence that they could produce would have been either testimony or video showing that
[01:57:20.960 --> 01:57:26.800] you physically interfered with the officer's investigation which did not happen right here
[01:57:26.800 --> 01:57:31.760] right they showed the video and they said that i physically interfered even after showing the video
[01:57:32.320 --> 01:57:36.720] even no you did not tell me anywhere that they said you physically interfered
[01:57:36.720 --> 01:57:42.480] ready check this out the prosecutor admitted because i will admit that he was not read his
[01:57:42.480 --> 01:57:48.560] right but the fact that the prosecution admitted and then i said so you're so he said i will
[01:57:48.560 --> 01:57:54.240] concede again that is not the question whether or not you were read your rights is not the same
[01:57:54.240 --> 01:57:59.200] question of how did i physically interfere with your investigation they're not the same thing
[01:57:59.200 --> 01:58:07.760] right okay reading you your rights is not an element of the offense against you it's a
[01:58:07.760 --> 01:58:12.640] different violation but it's got nothing to do with the charge the one that has to do with the
[01:58:12.640 --> 01:58:17.360] charge is how did i physically interfere with your ability to conduct your investigation
[01:58:18.400 --> 01:58:24.320] that was the only question you had to ask and you're the one so in my appeal is that something
[01:58:24.320 --> 01:58:28.160] of a question i could ask i would actually you didn't introduce and preserve that error
[01:58:28.160 --> 01:58:34.640] at trial record right right there's not a record you can't bring up new evidence on appeal the only
[01:58:34.640 --> 01:58:39.360] thing you can argue is that the state failed to prove the necessary elements the state never
[01:58:39.360 --> 01:58:48.160] proved physical interference okay so find the information you need or get a lawyer to do it for
