[01:17.320 --> 01:22.520]  With the number of craft breweries in Texas exploding from 59 to more than 250 since 2011,
[01:22.520 --> 01:26.200]  it seems pressure to change these blue law era rules is brewing.
[01:26.200 --> 01:29.720]  Two beer to go bills have been submitted at the state legislators so far along with the
[01:29.720 --> 01:35.720]  craft beer lobby working with lawmakers to change the current laws.
[01:35.720 --> 01:40.120]  A BuzzFeed News article published on their website last Thursday written by Jason Leopold
[01:40.120 --> 01:44.280]  and Anthony Cormier claimed that prosecutors had evidence that President Trump told Michael
[01:44.280 --> 01:48.880]  Cohen, Trump's former attorney, to light a congress about his proposed office tower project
[01:48.880 --> 01:51.040]  in Moscow in 2016.
[01:51.040 --> 01:55.120]  The article turned out to be a huge failure in investigative journalism and yet another
[01:55.120 --> 01:58.520]  example of fake news for the sake of undermining the president.
[01:58.520 --> 02:03.000]  A statement by Robert Mueller's office on Friday said that, quote, the BuzzFeed's description
[02:03.000 --> 02:07.560]  of specific statements to the special counsel's office in characterization of documents and
[02:07.560 --> 02:11.880]  testimony obtained by the office regarding Michael Cohen's congressional testimony are
[02:11.880 --> 02:13.280]  not accurate.
[02:13.280 --> 02:17.640]  Robert Mueller is the former FBI director who is now a special counsel for the United States
[02:17.640 --> 02:22.080]  Department of Justice who has been investigating Russian interference in the 2016 United States
[02:22.080 --> 02:27.840]  election and related matters by appointment in 2017 by then Deputy Attorney General Rod
[02:27.840 --> 02:28.840]  Rosenstein.
[02:28.840 --> 02:33.360]  In response to Mueller's office, editor Ben Smith said that BuzzFeed stood by his story
[02:33.360 --> 02:36.920]  urging Mueller to, quote, make clear what he's disputing.
[02:36.920 --> 02:40.640]  Speaking to reporters on Saturday, the president said that, quote, I think that the BuzzFeed
[02:40.640 --> 02:42.800]  piece was a disgrace to our country.
[02:42.800 --> 02:47.320]  It was a disgrace to journalism and I think also the coverage by the mainstream media was
[02:47.320 --> 02:51.960]  disgraceful and I think it's going to take a long time for the mainstream media to recover

[04:07.880 --> 04:12.800]  See, I don't know how many of you will be familiar with this and if you're not then
[04:12.800 --> 04:18.000]  you'll want to read up on the gentleman a little bit and read some of his stuff.
[04:18.000 --> 04:25.480]  The individual has always had to struggle to keep from being overwhelmed by the tribe.
[04:25.480 --> 04:33.040]  If you try it you will be lonely often and sometimes frightened but no price is too high
[04:33.040 --> 04:36.520]  to pay for the privilege of owning yourself.
[04:36.520 --> 04:46.360]  Now that's a quote by Frederick Nietzsche and nowhere is that quote more in danger than
[04:46.360 --> 04:50.040]  in today's America in my opinion.
[04:50.040 --> 04:57.160]  And the reason for that is because everybody is more willing to follow the crowd to avoid
[04:57.160 --> 05:04.480]  being ridiculed or thought to be something they're not or to be called something they're
[05:04.480 --> 05:13.600]  not to avoid controversy, to avoid conflict, to appear to fit in.
[05:13.600 --> 05:23.000]  But that brings us to another quote as well, a time is coming when people will go mad and
[05:23.000 --> 05:30.000]  when they see someone who is not mad they will mock him saying, you are mad, you are
[05:30.000 --> 05:33.880]  not like us.
[05:33.880 --> 05:42.580]  That is St. Anthony the Great, folks if you can't look around and see both of these pieces
[05:42.580 --> 05:49.920]  of wisdom in play in every interaction that's going on in America today then you're not
[05:49.920 --> 05:57.680]  really looking because the world as we know it has gone completely topsy-turvy.
[05:57.680 --> 06:00.680]  Of that there is no question.
[06:00.680 --> 06:11.480]  Now you can blame it or assess it on any basis you want but the fact remains that the further
[06:11.480 --> 06:22.720]  we get from the mindset we've held for decades in this country about certain things the worse

[06:24.640 --> 06:29.720]  Now to ease their own on how that pans out for them but I'm just saying that when you
[06:29.720 --> 06:36.980]  look at the reality of things the more liberal we become in our ways and means of dealing
[06:36.980 --> 06:45.760]  with things from our old conservative methods and means the more out of whack things become
[06:45.760 --> 06:53.400]  and there is no question that's happening, there just isn't and if you don't have a question
[06:53.400 --> 06:59.600]  about what's happening then again you're more asleep than anybody I've ever seen before
[06:59.600 --> 07:08.040]  because things are definitely not as they should be as far as people understanding people,
[07:08.040 --> 07:14.000]  caring about people, wanting to do the right thing, having morals, having ethics, caring
[07:14.000 --> 07:19.720]  about what someone other than themselves has to say or how they want to do things or how
[07:19.720 --> 07:24.400]  they want to live their life.
[07:24.400 --> 07:28.840]  Everybody thinks they have a right to force others to accept what they do and how they
[07:28.840 --> 07:34.720]  do it while decrying anything that they want to hold dear to themselves as being against
[07:34.720 --> 07:41.600]  the norm or racist or some other politically correct nomenclature about why you're wrong
[07:41.600 --> 07:47.120]  and they're right and their new way of doing things has to be to accept the norm for everybody
[07:47.120 --> 07:50.880]  or it's not good enough.
[07:50.880 --> 08:02.080]  We got a real problem and we're going to crumble under its weight real soon is my greatest
[08:02.080 --> 08:05.000]  fear.
[08:05.000 --> 08:11.400]  We have given up on trying to find what's true, what's right, what's moral, what's ethical
[08:11.400 --> 08:15.760]  and I know the question is always out there by whose ethics, by whose morals.
[08:15.760 --> 08:26.760]  The ethics and morals which I've always lived by, I don't see why they wouldn't be acceptably
[08:26.760 --> 08:33.520]  the norm for everyone no matter what your religion, what your political views, nothing.
[08:33.520 --> 08:39.400]  These are the ones that I believe every person should recognize as fundamental and true and
[08:39.400 --> 08:49.080]  that is that we all have the right to do and be anything we want especially in our privacy
[08:49.080 --> 08:57.840]  but we do not have the right to force what we want or what we do upon others whether
[08:57.840 --> 09:05.760]  it be to make them accept it, recognize it or join in it, doesn't matter.
[09:05.760 --> 09:10.280]  I can't harm you, you can't harm me, I can't tell you what to do, you can't tell me what
[09:10.280 --> 09:16.280]  to do but we have a responsibility to act morally and ethically in relation to each
[09:16.280 --> 09:23.320]  other to better our lives and not make them worse and to harm anyone else's person's
[09:23.320 --> 09:33.760]  rights or property in those actions period and we have strayed so far from that mindset
[09:33.760 --> 09:42.120]  these days it's not even funny and nowhere is that more true than in those that are employed
[09:42.120 --> 09:48.120]  as by government where they now see themselves as the ultimate authority in every regard
[09:48.120 --> 09:53.280]  to do anything that they feel they want to do and we as the people must swallow and take
[09:53.280 --> 09:56.080]  it whether we agree with it or not.
[09:56.080 --> 10:01.400]  The political power that's inherent in us now doesn't belong to us but only to them
[10:01.400 --> 10:06.800]  is the way this is turning out and the way it's being used and abused and ruled upon
[10:06.800 --> 10:11.560]  by those who have it.
[10:11.560 --> 10:19.320]  We are not long for peace in the United States of America, not unless we're just going to
[10:19.320 --> 10:27.800]  go with a whimper and let things continue to erode and blow up in our face anyway because
[10:27.800 --> 10:31.080]  then it's just a matter of just staying right where we're at and doing what we're doing
[10:31.080 --> 10:36.400]  and it'll come whether we want it or not.
[10:36.400 --> 10:40.360]  But if we are going to be free men and women, if we are going to live our lives without
[10:40.360 --> 10:47.360]  rulers and we are going to do what we were intended to do when this country was founded
[10:47.360 --> 10:52.000]  then we have a real situation brewing here and it's going to be a violent one because
[10:52.000 --> 10:59.440]  there is no way to get rid of those who have got their hands on the power in a peaceable
[10:59.440 --> 11:03.880]  fashion because it doesn't matter what you say to them, it doesn't matter how you vote
[11:03.880 --> 11:09.040]  for them because you don't control the outcome of any of it.
[11:09.040 --> 11:14.760]  Not in their minds and not in the way things are constructed to work to ensure that their
[11:14.760 --> 11:17.920]  power remains intact no matter where they are.
[11:17.920 --> 11:21.040]  Why do you think these politicians never leave politics?
[11:21.040 --> 11:26.520]  They may move from one office to another, one job to another, one section of government
[11:26.520 --> 11:32.040]  to another but they're living off of us, they are nothing but parasitic ticks in the truest
[11:32.040 --> 11:38.280]  sense of the word and they don't want to be taken off the dog so to speak.
[11:38.280 --> 11:44.560]  They don't want to be burned loose with a match or smothered with Vaseline to get them
[11:44.560 --> 11:45.560]  to let go.
[11:45.560 --> 11:50.600]  No, they want you to think that they belong there and that you couldn't function if they

[11:56.080 --> 12:04.240]  And that is where we have failed ourselves in recognizing that we don't need them to

[12:27.680 --> 12:33.040]  We always fall into the trap of there ought to be a law, there ought to be a rule, there
[12:33.040 --> 12:38.800]  ought to be someone who, as long as someone isn't me, to take responsibility for and be
[12:38.800 --> 12:50.520]  responsible for making somebody do this or somebody not do that and blah, blah, blah.
[12:50.520 --> 12:54.240]  And we thought we could improve system as white men when we came over here and conquered
[12:54.240 --> 12:56.600]  the Indians way of life, right?
[12:56.600 --> 13:00.760]  They hunted, they fished, they had a family, they enjoyed their downtime.
[13:00.760 --> 13:07.040]  Yeah, they fought and they had their own battles but they never waged a war until it was against
[13:07.040 --> 13:11.800]  us for survival.
[13:11.800 --> 13:17.640]  They had battles, they had skirmishes but they didn't have wars.
[13:17.640 --> 13:28.320]  They didn't go out of their way just to subjugate their fellow men and yet here we are in every
[13:28.320 --> 13:35.560]  single way thinking that all this is going to fix itself if we just stick our head in
[13:35.560 --> 13:45.240]  the sand long enough and look the other way and that just isn't going to happen.
[13:45.240 --> 13:50.240]  What have you done to prepare yourself out there for when things get really bad?
[13:50.240 --> 13:55.840]  And they're going to get really bad, of that I'm fairly certain.
[13:55.840 --> 14:00.880]  That's not going to change any time soon as to how that's going to play out.

[14:09.680 --> 14:13.080]  Know what seems to be thinking about that, everyone seems to be thinking that if they
[14:13.080 --> 14:19.000]  just wait long enough everything will fix itself and life will go on.

[14:24.480 --> 14:29.040]  I think we're going to have problems bigger than the 40 years in the desert if you go by
[14:29.040 --> 14:34.240]  biblical prophecy on things.

[14:43.640 --> 14:46.920]  And who's going to live through it and who's not?
[14:46.920 --> 14:50.680]  Who's going to have something to show for it and who's not?
[14:50.680 --> 14:55.840]  Because I guarantee you when that time comes you're not going to be able to stand there
[14:55.840 --> 15:01.000]  and tell somebody that they're not behaving the way you want them to.
[15:01.000 --> 15:06.120]  You're not going to be able to sit up there and have somebody else able to act on your
[15:06.120 --> 15:10.520]  behalf to make somebody accept something the way you want them to accept it whether they
[15:10.520 --> 15:13.040]  agree with it or not.
[15:13.040 --> 15:19.600]  That time is coming to a close if things don't change and it's coming to a close if things
[15:19.600 --> 15:24.640]  do change because all those that are helping you with it now are going to be the first
[15:24.640 --> 15:29.560]  ones to turn on you and make you submit to them when it's all said and done because you're
[15:29.560 --> 15:37.120]  not going to be one of those that are fighting back.
[15:37.120 --> 15:42.720]  Where will you be when they finally come to take the last vestige of freedom that you

[15:46.680 --> 15:56.960]  How will you resist if you will resist or will you go peacefully into that good night?
[15:56.960 --> 16:02.040]  Because those of you that they don't have a use for, they're not going to keep you around,
[16:02.040 --> 16:04.520]  they're not going to feed you, they're not going to clothe you, they're not going to
[16:04.520 --> 16:09.120]  shelter you, they're going to get rid of you.
[16:09.120 --> 16:14.080]  We've seen what people around the world are capable of, digging trenches, shooting people
[16:14.080 --> 16:17.280]  in the back of the head and letting them fall in and covering them right back up and moving

[16:19.720 --> 16:23.920]  If you think this government or any other government on the planet is not still in a
[16:23.920 --> 16:28.120]  place where they're perfectly willing to do that, then you are sorely out of touch with

[16:32.640 --> 16:37.800]  The only thing that stopped them thus far is the fact that they don't yet control the

[20:51.640 --> 20:57.840]  Well, first off, when the law that created the DMV was enacted, what was the subject
[20:57.840 --> 21:04.800]  matter purpose the legislature said the DMV was there for?
[21:04.800 --> 21:07.280]  I'm honestly behind the able now.
[21:07.280 --> 21:10.880]  Okay, well that's the first thing you have to know because you're not going to create
[21:10.880 --> 21:15.800]  a bunch of regulatory laws without first creating the agency that's meant to regulate and control
[21:15.800 --> 21:17.800]  those laws, right?

[21:19.280 --> 21:23.120]  Because the Ohio Constitutes, you contain a single subject matter clause requirement
[21:23.120 --> 21:30.360]  for every piece of legislation that goes through the legislature?
[21:30.360 --> 21:36.240]  To be honest, you're speaking about things that I should definitely be researching.
[21:36.240 --> 21:39.080]  I haven't headed in that direction, I've just been.
[21:39.080 --> 21:42.120]  Well, you have to because how are you going?
[21:42.120 --> 21:46.560]  Okay, let me back up here for a second and let me explain to you why you're having a
[21:46.560 --> 21:54.040]  problem understanding and why your first comment is what's wrong with your perception, okay?
[21:54.040 --> 21:56.800]  And don't take this as something, I'm not meaning it that way, I'm just trying to help
[21:56.800 --> 22:03.160]  you understand how this actually plays out versus how they're telling you it works, alright?
[22:03.160 --> 22:08.640]  You have a state constitution, whatever article it is that establishes your legislature in
[22:08.640 --> 22:16.400]  your state's constitution, it says specifically how that legislature must create law, okay?

[22:18.400 --> 22:24.760]  So that's the very first thing you need to study and understand in depth and completely.
[22:24.760 --> 22:32.040]  Now once you understand how the legislature is required to create law, then you also have
[22:32.040 --> 22:38.160]  to understand what the Bill of Rights of your specific constitution says, okay?
[22:38.160 --> 22:43.640]  And you have to understand that no matter how the legislature uses its power delegated
[22:43.640 --> 22:49.360]  within the constitution to make laws, they cannot do it in a way that violates that same
[22:49.360 --> 22:54.720]  constitution's Bill of Rights, okay?
[22:54.720 --> 22:55.720]  So understand how it makes laws.
[22:55.720 --> 23:02.920]  You cannot delegate a power to them to violate the collective rights of everyone else that
[23:02.920 --> 23:08.240]  are protected by that constitution.
[23:08.240 --> 23:12.840]  That's like me and five of your neighbors voting to evict you from the home that you
[23:12.840 --> 23:23.080]  paid for five years ago in cash because we don't like the color you painted it.
[23:23.080 --> 23:28.000]  We can't give each other that power, we collectively don't have that power, doesn't matter whether
[23:28.000 --> 23:31.520]  you voted for us to have it or not, we don't have it.
[23:31.520 --> 23:32.520]  Why?
[23:32.520 --> 23:34.080]  Because you don't have it.
[23:34.080 --> 23:41.120]  You cannot give us the power that we can exercise if you never had it, okay?

[23:48.000 --> 23:51.680]  This is the question you've got to answer.

[51:45.360 --> 51:53.360]  That's the section on the seatbelt.
[51:53.360 --> 52:01.840]  So the charge on the ticket says no seatbelt, and then when the passenger or the guest got
[52:01.840 --> 52:08.200]  out of the car, he said to the officer at the scene, he did have a seatbelt down, and
[52:08.200 --> 52:16.800]  I'll swear to that in the court of law, then the officer quickly and very obviously changed
[52:16.800 --> 52:17.800]  his tune.
[52:17.800 --> 52:21.560]  He said, well, you weren't wearing it properly.
[52:21.560 --> 52:27.560]  So now he goes from no seatbelt at all to wearing it improperly.
[52:27.560 --> 52:34.680]  Once the court comes the court date, he gets up and he tells his side of the story about
[52:34.680 --> 52:43.800]  how he parked and he was watching traffic, and he saw Mr. Smith not wearing a seatbelt
[52:43.800 --> 52:44.800]  improperly.
[52:44.800 --> 52:54.000]  Well, the defendant objected and said, your honor, the traffic charge says no seatbelt,
[52:54.000 --> 52:58.680]  and now we're going to, you weren't wearing it properly.
[52:58.680 --> 53:04.080]  That means, and I think what the point he was trying to make was, now the officer himself
[53:04.080 --> 53:06.360]  is testifying for me.
[53:06.360 --> 53:10.400]  He didn't say it that way, but that's what it boiled down to.
[53:10.400 --> 53:15.000]  So now you can't have a charge on the seatbelt ticket.
[53:15.000 --> 53:20.440]  It says you weren't wearing it at all when the cop got up and admitted in front of everybody
[53:20.440 --> 53:22.520]  he was wearing it.
[53:22.520 --> 53:24.480]  You can't do both.
[53:24.480 --> 53:25.800]  So he objected to that.
[53:25.800 --> 53:33.800]  He objected to the fact that he asked for a deposition from the court, never got it.
[53:33.800 --> 53:37.480]  The police officer had given him a deposition at the scene.
[53:37.480 --> 53:43.920]  When I read the New York State law, and according to what I think I'm reading, it doesn't say
[53:43.920 --> 53:51.240]  just because the cop gave it to you that you can't ask for it from the court.
[53:51.240 --> 53:54.520]  And when you don't get it within 30 days, it's very specific.
[53:54.520 --> 54:01.320]  It says in 30 days, if you don't get it, then the ticket must be by law dismissed.
[54:01.320 --> 54:05.680]  Well, he never got it from the court.
[54:05.680 --> 54:10.920]  And the judges just walked right past that one by saying, well, you got the deposition
[54:10.920 --> 54:12.800]  from the officer that day.
[54:12.800 --> 54:14.240]  You didn't need one from the court.
[54:14.240 --> 54:18.240]  Well, that's not what the law says as far as I can tell.
[54:18.240 --> 54:22.560]  The law doesn't say, well, just because the cop gives you one, that you can't ask for

[54:23.560 --> 54:26.360]  And if you don't get it in 30 days, then the ticket...
[54:26.360 --> 54:36.240]  Well, first off, what does the law say that particular document must be constructed from?

[55:47.280 --> 55:54.960]  So, the judge ordered the officer to produce that deposition and cause it to be, I think
[55:54.960 --> 56:03.160]  the wording is, delivered to the defendant, not just sent, whether it makes it there or

[56:07.080 --> 56:11.440]  It seems to be that it's got to be delivered to the defendant.

[01:09:52.440 --> 01:09:58.440]  The officer just testified that I was wearing a seatbelt.
[01:09:58.440 --> 01:10:03.440]  What is the use of the charging instrument in New York?
[01:10:03.440 --> 01:10:07.440]  For a traffic violation, it's a traffic ticket.
[01:10:07.440 --> 01:10:11.440]  And is the ticket signed under penalty of perjury?
[01:10:11.440 --> 01:10:13.440]  Yes.
[01:10:13.440 --> 01:10:22.440]  Okay, they cannot, and there's plenty of case law on that, they cannot charge you with one offense and convict you of a different offense.
[01:10:22.440 --> 01:10:30.440]  It should have to be this. It's the only thing you can sign up with trying to make. They're contradicting each other.
[01:10:30.440 --> 01:10:36.440]  Okay, so again, he asked for a dismissal with prejudice, not a directed verdict.

[01:11:01.440 --> 01:11:12.440]  I then told the court, the judge, since there was no real evidence against me, only an unsupported accusation by the officer, the rules of evidence weren't followed in trial court.

[01:11:14.440 --> 01:11:20.440]  Where does the rules of evidence say that the officer's testimony is not sufficient?

[01:11:22.440 --> 01:11:32.440]  Even more to the point, like here in Texas, where it says the rules of evidence don't apply in these types of cases in these types of courts.
[01:11:32.440 --> 01:11:38.440]  Well, number one, I do know this, that the rules of evidence are basically the same in any courtroom.
[01:11:38.440 --> 01:11:43.440]  No, they're not, so you don't know what you're talking about. That's not true.

[01:11:45.440 --> 01:11:54.440]  Here in Texas, the law specifically says that the rules of evidence can be ignored in justice and municipal courts in relation to these types of cases.

[01:12:01.440 --> 01:12:14.440]  And if not, where is the clause that says the officer's testimony alone, whether substantiated by other means or not, is not sufficient evidence?
[01:12:14.440 --> 01:12:20.440]  It is up to the plaintiff in any courtroom in the United States of America. I do know this.

[01:12:23.440 --> 01:12:29.440]  I'm not asking you to give me a dissertation on how plaintiffs work in any state in America when it comes to the rules of evidence.

[01:14:06.440 --> 01:14:16.440]  In this state, a deposition is further amplification and explanation of what happened the day the ticket was written.
[01:14:16.440 --> 01:14:24.440]  In other words, the ticket will say a charge on it like no seatbelt. Then the officer will, in the deposition, go on to say,
[01:14:24.440 --> 01:14:29.440]  I was parked at the intersection of blah, blah, blah. I saw the defendant go by.
[01:14:29.440 --> 01:14:39.440]  I noticed he wasn't wearing a seatbelt. He was proceeding south and I followed him. I stopped him and I saw he was not wearing a seatbelt.
[01:14:39.440 --> 01:14:49.440]  That would be a deposition. Then he signs that and I believe that is definitely under perjury as well.
[01:14:49.440 --> 01:14:54.440]  Okay. A deposition to be delivered to the defendant.
[01:14:54.440 --> 01:15:00.440]  What date was the ticket written?
[01:15:00.440 --> 01:15:06.440]  May, I'm going to say May 19th.
[01:15:06.440 --> 01:15:15.440]  2018. What, when was this deposition requested?
[01:15:15.440 --> 01:15:26.440]  Two days after that. By the time they received it, I don't know, I guess maybe three, four days had gone by.
[01:15:26.440 --> 01:15:35.440]  And how long after that was the trial?
[01:15:35.440 --> 01:15:39.440]  It was after 30 days.
[01:15:39.440 --> 01:15:42.440]  Of which you were absolutely 100% positive.
[01:15:42.440 --> 01:15:45.440]  Oh, 100% positive. It was longer than 30 days.
[01:15:45.440 --> 01:15:55.440]  Now, what is the specific language in the statute that says that the citation must be voided if that deposition is not provided?
[01:15:55.440 --> 01:16:03.440]  It says this. I could pull it up and read it to you. It was right out of the judge's own office.
[01:16:03.440 --> 01:16:06.440]  But I can tell you what it says from memory.
[01:16:06.440 --> 01:16:09.440]  No, you can't.

[01:20:34.440 --> 01:20:39.440]  This is the county that is the most corrupt in the country.

[01:21:41.440 --> 01:21:49.440]  It may have been put into writing, but all I saw was, all I witnessed was his verbal
[01:21:49.440 --> 01:21:51.440]  testimony to the judge.
[01:21:51.440 --> 01:21:55.440]  Well, if he had put it in in writing, then he could have simply said,
[01:21:55.440 --> 01:21:58.440]  Judge, if the court will notice such and such document was filed with this court,
[01:21:58.440 --> 01:22:02.440]  such and such date is such and such time that specifically quotes that the law
[01:22:02.440 --> 01:22:06.440]  requires this case to be dismissed with prejudice or that a directed verdict
[01:22:06.440 --> 01:22:13.440]  would be given at this time because the state no longer has a case.
[01:22:13.440 --> 01:22:17.440]  Now had he filed those documents in writing, that would have been all he would have had
[01:22:17.440 --> 01:22:19.440]  to say in the matter.
[01:22:19.440 --> 01:22:23.440]  And the judge, knowing that it was in writing, knowing it was filed ahead of time
[01:22:23.440 --> 01:22:26.440]  with the court, and knowing that the law was right in front of him and he couldn't
[01:22:26.440 --> 01:22:32.440]  ignore it, probably wouldn't have.
[01:22:32.440 --> 01:22:35.440]  I'll find out whether or not the defendant actually gave it to him in writing
[01:22:35.440 --> 01:22:36.440]  or not.
[01:22:36.440 --> 01:22:44.440]  Okay, now that we've gone through all of this, what is your question?
[01:22:44.440 --> 01:22:49.440]  It sounds to me like the first and the third elements are the ones that we should
[01:22:49.440 --> 01:22:54.440]  use in the appeal.

[01:37:16.440 --> 01:37:20.440]  saying for real, how you not engage the transportation, how I'm not willing to
[01:37:20.440 --> 01:37:21.440]  incriminate myself.
[01:37:21.440 --> 01:37:23.440]  So I provided that to the officer.
[01:37:23.440 --> 01:37:25.440]  He called the supervisor.
[01:37:25.440 --> 01:37:26.440]  The supervisor came.
[01:37:26.440 --> 01:37:28.440]  I tried to explain that to him.
[01:37:28.440 --> 01:37:33.440]  He wasn't trying to really see or listen to anything that I was saying for real.
[01:37:33.440 --> 01:37:34.440]  And I did record it.
[01:37:34.440 --> 01:37:35.440]  I did record everything.
[01:37:35.440 --> 01:37:37.440]  I didn't give him a name.
[01:37:37.440 --> 01:37:39.440]  Didn't give him a license.

[01:37:52.440 --> 01:37:53.440]  abandoned vehicle.
[01:37:53.440 --> 01:37:57.440]  And because you didn't give us a name or license, you're free to go.
[01:37:57.440 --> 01:38:00.440]  So I was one put in a 1983 lawsuit.
[01:38:00.440 --> 01:38:03.440]  And I just wanted to know if you had any advice.
[01:38:03.440 --> 01:38:08.440]  Well, the thing is, you need to first find the case law that says the cop
[01:38:08.440 --> 01:38:11.440]  should not allow the tow car unless it's for the specific purpose of
[01:38:11.440 --> 01:38:15.440]  evidence or because it's a safety hazard to the public.
[01:38:15.440 --> 01:38:20.440]  And usually when they tow cars from these traffic stops, it's retaliatory.
[01:38:20.440 --> 01:38:23.440]  It's not because they have any lawful authority or need to do it.
[01:38:23.440 --> 01:38:25.440]  It's because they're retaliating.
[01:38:25.440 --> 01:38:28.440]  If they can't get you one way, they're going to get you another.
[01:38:28.440 --> 01:38:29.440]  Okay?
[01:38:29.440 --> 01:38:30.440]  Yeah.
[01:38:30.440 --> 01:38:33.440]  So you need to find the case law on that.
[01:38:33.440 --> 01:38:36.440]  You need to make sure you understand the Maryland law that supports your
[01:38:36.440 --> 01:38:39.440]  position and how to argue it, okay?
[01:38:39.440 --> 01:38:43.440]  Because you're going to have to present that as part of the grounds for why
[01:38:43.440 --> 01:38:47.440]  your suit should not be dismissed and why the officer does not have
[01:38:47.440 --> 01:38:48.440]  qualified immunity.
[01:38:48.440 --> 01:38:52.440]  The officer is required to know the law and he's required to properly
[01:38:52.440 --> 01:38:53.440]  apply the law.
[01:38:53.440 --> 01:38:57.440]  This is not a question of a simple mistake of law, okay?
[01:38:57.440 --> 01:39:00.440]  Which is how they're going to try to spin this.
[01:39:00.440 --> 01:39:04.440]  The other thing is, is here in Texas, an officer must be specifically
[01:39:04.440 --> 01:39:08.440]  certified by the state police to enforce traffic.
[01:39:08.440 --> 01:39:11.440]  They can't do it just because they're cops.
[01:39:11.440 --> 01:39:15.440]  So you need to find out whether or not Maryland has similar statutes.
[01:39:15.440 --> 01:39:20.440]  So start looking at the administrative code for your state that has a
[01:39:20.440 --> 01:39:22.440]  chapter governing your state police department.
[01:39:22.440 --> 01:39:25.440]  Here they're called the Department of Public Safety.
[01:39:25.440 --> 01:39:28.440]  They may be state police in Maryland or they may be Department of Public
[01:39:28.440 --> 01:39:29.440]  Safety in Maryland.
[01:39:29.440 --> 01:39:34.440]  But you need to read through that and find out what is their law as far as
[01:39:34.440 --> 01:39:35.440]  their duties go.
[01:39:35.440 --> 01:39:40.440]  Here in Texas it specifically says their duty relates to commercial and
[01:39:40.440 --> 01:39:43.440]  for hire traffic when it comes to regulatory programs.
[01:39:43.440 --> 01:39:49.440]  And every regulatory program in the code is DPS when it comes to license,
[01:39:49.440 --> 01:39:54.440]  financial responsibility, and safety inspection, okay?
[01:39:54.440 --> 01:39:59.440]  So you've got to tie all those pieces together for your federal lawsuit
[01:39:59.440 --> 01:40:03.440]  to show why the officer was acting under color of law and he should have
[01:40:03.440 --> 01:40:04.440]  known better.
[01:40:04.440 --> 01:40:07.440]  If you can't do that, you're going to get the case thrown out and you're
[01:40:07.440 --> 01:40:09.440]  not going to be able to sue and get anything.
[01:40:09.440 --> 01:40:11.440]  And it's going to cost you money to file it.
[01:40:11.440 --> 01:40:13.440]  And I understand that.
[01:40:13.440 --> 01:40:15.440]  So I wanted to add one quick piece.
[01:40:15.440 --> 01:40:17.440]  I wanted to know your opinion on it.
[01:40:17.440 --> 01:40:23.440]  So the first thing I have, it says, oh, I'm just reading as quick as I can.
[01:40:23.440 --> 01:40:28.440]  It says, if you do not, based on start off, notice the declaration,
[01:40:28.440 --> 01:40:33.440]  I revoke, rescind, cancel, and void and do not consent to any power of attorney

[01:40:34.440 --> 01:40:38.440]  I declare and claim Article III court jurisdiction.
[01:40:38.440 --> 01:40:41.440]  If you do not know what this is, then verify with your supervisor if they
[01:40:41.440 --> 01:40:46.440]  wish to be responsible for your actions before making an unauthorizable legal
[01:40:46.440 --> 01:40:49.440]  determination which makes place you, your supervisor, and the Secretary of
[01:40:49.440 --> 01:40:54.440]  State and Article III impeachable felony situation which is treason.
[01:40:54.440 --> 01:40:58.440]  You are in violation of your job at open office the moment you declared an
[01:40:58.440 --> 01:41:01.440]  emergency by turning on a red light to stop me, which is a felony where there
[01:41:01.440 --> 01:41:03.440]  is no emergency.

[01:41:35.440 --> 01:41:41.440]  his lack of knowledge is not going to entitle him to any form of immunity
[01:41:41.440 --> 01:41:46.440]  because it is knowledge he is required to have and that any reasonable officer
[01:41:46.440 --> 01:41:51.440]  should know that they're required to have and should properly apply because of
[01:41:51.440 --> 01:41:53.440]  it.
[01:41:53.440 --> 01:41:57.440]  Those are the things you're going to have to be able to prove up to avoid a
[01:41:57.440 --> 01:42:01.440]  qualified immunity dismissal.
[01:42:01.440 --> 01:42:03.440]  Okay.
[01:42:03.440 --> 01:42:06.440]  Okay, because the moment you file your lawsuit, I guarantee you the very first
[01:42:06.440 --> 01:42:11.440]  thing you're going to see is a 12B6 motion to dismiss for failure state of
[01:42:11.440 --> 01:42:17.440]  claim or for some form of immunity.
[01:42:17.440 --> 01:42:19.440]  Okay.
[01:42:19.440 --> 01:42:23.440]  That's why it's important that you find out whether or not the state police
[01:42:23.440 --> 01:42:27.440]  must specifically certify a local police department or a county police
[01:42:27.440 --> 01:42:32.440]  department to enforce the law when it comes to those codes because the
[01:42:32.440 --> 01:42:39.440]  officer can't claim official or qualified immunity if his duty is not
[01:42:39.440 --> 01:42:44.440]  sanctioned by or what he did is not sanctioned by law.
[01:42:44.440 --> 01:42:49.440]  If the law didn't give him the authority to do what he was doing or give the
[01:42:49.440 --> 01:42:52.440]  appearance that he had the authority to do what he was doing, then he doesn't
[01:42:52.440 --> 01:42:58.440]  have it and his presumption of having it is absolutely irrelevant and that's
[01:42:58.440 --> 01:43:00.440]  his fault.
[01:43:00.440 --> 01:43:02.440]  See what I'm saying?
[01:43:02.440 --> 01:43:03.440]  Okay.
[01:43:03.440 --> 01:43:05.440]  Okay, so let me just, all right, so one quick thing.
[01:43:05.440 --> 01:43:09.440]  So I was going to approach it as, you know, I have a cross examination

[01:43:23.440 --> 01:43:26.440]  the elemental requirement for such an offense.

[01:43:30.440 --> 01:43:35.440]  laws must adhere to is transportation, which is commerce.
[01:43:35.440 --> 01:43:40.440]  You have to make sure that the law in Maryland says the same thing and that
[01:43:40.440 --> 01:43:44.440]  will be in the title of the bill that was used to enact those laws.
[01:43:44.440 --> 01:43:46.440]  So you've got to do your research here.
[01:43:46.440 --> 01:43:49.440]  It's not going to be in the statutes.
[01:43:49.440 --> 01:43:54.440]  It's only going to appear in the title of the bill that created those statutes.

[01:46:49.440 --> 01:46:50.440]  Right.
[01:46:50.440 --> 01:46:55.440]  So the code you need to look at, whatever code or title is your transportation
[01:46:55.440 --> 01:46:59.440]  code, you need to find out what bill was used to enact that code as it currently
[01:46:59.440 --> 01:47:00.440]  exists.
[01:47:00.440 --> 01:47:03.440]  Then you need to go find that actual bill, legislative bill.
[01:47:03.440 --> 01:47:05.440]  Start with your Secretary of State.
[01:47:05.440 --> 01:47:10.440]  In there, you're going to need at least two things, certified copies of that
[01:47:10.440 --> 01:47:11.440]  bill.
[01:47:11.440 --> 01:47:15.440]  You're going to need a certified copy of the bill, caption or title if your
[01:47:15.440 --> 01:47:20.440]  Constitution says that every piece of legislation must have a single subject
[01:47:20.440 --> 01:47:21.440]  clause.
[01:47:21.440 --> 01:47:22.440]  Okay.
[01:47:22.440 --> 01:47:26.440]  And you're going to need the signature pages showing where that bill was signed into
[01:47:26.440 --> 01:47:27.440]  law.
[01:47:27.440 --> 01:47:28.440]  All right.
[01:47:28.440 --> 01:47:29.440]  Okay.
[01:47:29.440 --> 01:47:33.440]  Now, if there are other requirements such as a reading rule over a certain number
[01:47:33.440 --> 01:47:38.440]  of days before the bill can have the force and effective law and whether or not
[01:47:38.440 --> 01:47:42.440]  there can be an emergency suspension of such rules, you're going to need any pages
[01:47:42.440 --> 01:47:48.440]  or signatures that would have suspended that reading and a copy of the emergency clause
[01:47:48.440 --> 01:47:54.440]  was used and make sure that it's a clause that is authorized by the language of your
[01:47:54.440 --> 01:47:55.440]  Constitution.
[01:47:55.440 --> 01:47:58.440]  Because here in Texas, they're doing that all the time.
[01:47:58.440 --> 01:48:00.440]  They've been doing it since 63.
[01:48:00.440 --> 01:48:04.440]  They've been suspending the reading of laws, but they've been using a bogus
[01:48:04.440 --> 01:48:09.440]  emergency clause to do it, making every law they've enacted since then absolutely
[01:48:09.440 --> 01:48:13.440]  unconstitutional if they suspended that reading rule.
[01:48:13.440 --> 01:48:14.440]  Okay.
[01:48:14.440 --> 01:48:15.440]  All right.
[01:48:15.440 --> 01:48:19.440]  There's a lot of stuff you got to do to get your ducks in a row and get your homework
[01:48:19.440 --> 01:48:20.440]  done.
[01:48:20.440 --> 01:48:21.440]  Believe me.
[01:48:21.440 --> 01:48:22.440]  Yeah.
[01:48:22.440 --> 01:48:24.440]  That's what I need to do now.

[01:49:19.440 --> 01:49:24.440]  should have everything dealing with the single subject and everything the legislature is
[01:49:24.440 --> 01:49:29.440]  required to do to properly and constitutionally enact the bill into law.
[01:49:29.440 --> 01:49:35.440]  It'll tell them how that bill has to be done, how that bill must originate, what committees
[01:49:35.440 --> 01:49:41.440]  or panels it must go through, what procedural rules are required, and when and if they can
[01:49:41.440 --> 01:49:43.440]  follow those rules and under what set of conditions.
[01:49:43.440 --> 01:49:46.440]  All those are things you're going to need to know.
[01:49:46.440 --> 01:49:52.440]  So, read everything in that legislative department section of your constitution.
[01:49:52.440 --> 01:49:53.440]  Everything.
[01:49:53.440 --> 01:49:54.440]  Everything.
[01:49:54.440 --> 01:49:55.440]  Okay.
[01:49:55.440 --> 01:49:56.440]  Okay.
[01:49:56.440 --> 01:50:00.440]  So, I need to follow these motions before I go in the court?
[01:50:00.440 --> 01:50:06.440]  Well, you have to follow suit in order to go in the court to begin with if you're talking
[01:50:06.440 --> 01:50:07.440]  about suing.
[01:50:07.440 --> 01:50:10.440]  Now, if you're talking about defending the case, then absolutely you're going to have to
[01:50:10.440 --> 01:50:11.440]  put your hand.
[01:50:11.440 --> 01:50:12.440]  Okay.
[01:50:12.440 --> 01:50:13.440]  Yeah, I already filed a suit.
[01:50:13.440 --> 01:50:17.440]  So, basically print out the bills and put them in.
[01:50:17.440 --> 01:50:20.440]  Well, yeah, you're going to have to get your evidence together.
[01:50:20.440 --> 01:50:25.440]  You're going to need certified copies of all public records, which the bill is, and so
[01:50:25.440 --> 01:50:29.440]  on and so forth, but you're not going to want the entire bill, especially if it's hundreds
[01:50:29.440 --> 01:50:34.440]  or thousands of pages long, because that's going to cost you an arm and a leg.
[01:50:34.440 --> 01:50:40.440]  All you need are the relevant pages that contain the information that facilitates your suit.
[01:50:40.440 --> 01:50:45.440]  All you got to do is have the Secretary of State certify that this is the caption of this
[01:50:45.440 --> 01:50:50.440]  bill, which created this code or title of law.
[01:50:50.440 --> 01:50:51.440]  Okay.
[01:50:51.440 --> 01:50:52.440]  So, I see what you said.
[01:50:52.440 --> 01:50:58.440]  So, you said go to the Secretary of State, get a certified copy showing which bill enacted
[01:50:58.440 --> 01:50:59.440]  the transportation code.
[01:50:59.440 --> 01:51:00.440]  No, no, no.
[01:51:00.440 --> 01:51:06.440]  Find out which bill did that and what year, and then you go to them and ask for a certified
[01:51:06.440 --> 01:51:13.440]  copy of the bill caption or title, whatever your Constitution calls it, any emergency
[01:51:13.440 --> 01:51:17.440]  clause, what page that's on, you're going to need to read the bill to find out.
[01:51:17.440 --> 01:51:18.440]  Okay.
[01:51:18.440 --> 01:51:22.440]  And you're going to find out whether or not they suspended the reading rule if there is
[01:51:22.440 --> 01:51:28.440]  one, or any of the other rules they're required to do before that bill could become law.
[01:51:28.440 --> 01:51:32.440]  And if they did suspend them, what is the criteria for doing so?
[01:51:32.440 --> 01:51:37.440]  And where in that law did they do it, and did they do it properly?
[01:51:37.440 --> 01:51:42.440]  If they didn't, then you're going to want a copy of where they didn't do it properly to
[01:51:42.440 --> 01:51:47.440]  prove that it's not a valid law, and thus it's unenforceable.
[01:51:47.440 --> 01:51:48.440]  Okay.
[01:51:48.440 --> 01:51:49.440]  Okay.
[01:51:49.440 --> 01:51:52.440]  I got a lot to do.
[01:51:52.440 --> 01:51:53.440]  Yep.
[01:51:53.440 --> 01:51:58.440]  You may only get to sue the cop, but you may get to challenge certain state law in that
[01:51:58.440 --> 01:52:03.440]  code as being unconstitutional on its face under both the state and federal Constitution
[01:52:03.440 --> 01:52:04.440]  because it violates rights.
[01:52:04.440 --> 01:52:07.440]  That's the link you're going to have to make in the federal court.
[01:52:07.440 --> 01:52:11.440]  In the state court, you can just say it violates these provisions of the state Constitution.
[01:52:11.440 --> 01:52:16.440]  In federal court, you've got to say, not only does it violate these provisions of the state
[01:52:16.440 --> 01:52:21.440]  Constitution, but it creates a rights issue of rights protected by the federal government
[01:52:21.440 --> 01:52:28.440]  when I am unlawfully searched and seized under a law that's not a law.
[01:52:28.440 --> 01:52:29.440]  Okay.
[01:52:29.440 --> 01:52:30.440]  Okay.
[01:52:30.440 --> 01:52:33.440]  So I just want to make sure I got everything one more time.
[01:52:33.440 --> 01:52:36.440]  So look in the bill for the legislative part of Maryland.
[01:52:36.440 --> 01:52:42.440]  Look for the bill that speaks on the law that opened up the bill for transportation in Maryland.
[01:52:42.440 --> 01:52:44.440]  Get a certified copy of that.
[01:52:44.440 --> 01:52:49.440]  Then look for the emergency clause to see if it's still being read, and if it's not, get
[01:52:49.440 --> 01:52:52.440]  a certified copy of that and enter that in the evidence.
[01:52:52.440 --> 01:52:57.440]  Yeah, you have to read what the requirements of enacting the law are.
[01:52:57.440 --> 01:53:03.440]  Then you have to see whether or not the legislature followed every one of them.
[01:53:03.440 --> 01:53:04.440]  That's a simple way to put it.
[01:53:04.440 --> 01:53:09.440]  That's why you have to read everything in the legislative article of your Constitution
[01:53:09.440 --> 01:53:13.440]  to see what their requirements are from making the law, and then you have to look at the
[01:53:13.440 --> 01:53:18.440]  actual law they passed and see if they followed them the way they were supposed to.
[01:53:18.440 --> 01:53:19.440]  Okay.
[01:53:19.440 --> 01:53:27.440]  And they can't follow just some of them unless the Constitution says that this is optional.
[01:53:27.440 --> 01:53:33.440]  But if it says they shall do it, or they are required to do it, or they must do it, then
[01:53:33.440 --> 01:53:36.440]  it's not optional.
[01:53:36.440 --> 01:53:37.440]  Okay.
[01:53:37.440 --> 01:53:38.440]  Okay.
[01:53:38.440 --> 01:53:43.440]  And for the federal seat, would I have to look how it was followed?
[01:53:43.440 --> 01:53:49.440]  You have to show how the state violation affected the federally protected rights when the officer
[01:53:49.440 --> 01:53:55.440]  seized you, which is a fourth and fifth amendment issue, unlawful search and seizure, false
[01:53:55.440 --> 01:54:01.440]  imprisonment, the taking of your property, trying to make you to testify against yourself
[01:54:01.440 --> 01:54:06.440]  in a court of law, et cetera, et cetera.
[01:54:06.440 --> 01:54:07.440]  Okay.
[01:54:07.440 --> 01:54:11.440]  I'm looking it up right now, and I will see how it applies.
