[01:10.080 --> 01:13.640]  The unfortunate circumstances were that he left the car running and unlocked.
[01:13.640 --> 01:17.680]  Surveillance videos showed a woman approaching the car, getting inside and driving off.
[01:17.680 --> 01:22.320]  KABB reported that police later found DeVilla's car at nearby park, but Baby J and the car
[01:22.320 --> 01:23.960]  keys were no longer inside.
[01:23.960 --> 01:27.760]  Investigators believe that the occurrence wasn't a random kidnapping and suspect that
[01:27.760 --> 01:30.200]  DeVilla knew the woman in the video.
[01:30.200 --> 01:33.480]  Apparently, DeVilla's family has not been cooperating with the police either.
[01:33.480 --> 01:35.880]  However, both parents are disputing those claims.
[01:35.880 --> 01:44.560]  Police are urging anyone with information about the case to call 911 or 201-207-7635.
[01:44.560 --> 01:49.000]  The Bernie Sanders campaign did not adequately address incidents of sexual harassment, sexism
[01:49.000 --> 01:52.640]  mistreatment, and pay disparities between men and women according to some allegations
[01:52.640 --> 01:56.480]  for multiple women who worked on his 2016 presidential bid.
[01:56.480 --> 01:59.800]  These allegations came out last Wednesday in the New York Times.
[01:59.800 --> 02:03.840]  Sanders apologizing on CNN said that, quote, I am not going to sit here and tell you that

[08:13.420 --> 08:18.420]  People getting sentenced for certain kinds of crimes
[08:18.420 --> 08:20.420]  Normal average everyday people
[08:20.420 --> 08:24.420]  Versus how cops get sentenced for very serious crimes
[08:24.420 --> 08:28.420]  The comparison I made was a doctor that was getting charged for
[08:28.420 --> 08:32.420]  Possession of a controlled substance
[08:32.420 --> 08:37.420]  Because he still had the old expired prescriptions
[08:37.420 --> 08:41.420]  Of his parents who had died years before
[08:41.420 --> 08:44.420]  In some boxes he had stored in his house
[08:44.420 --> 08:47.420]  And those pills were discovered
[08:47.420 --> 08:50.420]  Because police were raiding his home
[08:50.420 --> 08:53.420]  Because of a report that he was growing marijuana
[08:53.420 --> 08:56.420]  To help his patients
[08:56.420 --> 09:03.420]  And they are sentencing this guy to 18 years for harming no one
[09:03.420 --> 09:11.420]  Meanwhile, I gave three recent stories about cops raping kids
[09:11.420 --> 09:16.420]  Who got anywhere from three years as punishment
[09:16.420 --> 09:20.420]  For repeatedly raping one cop his stepdaughter
[09:20.420 --> 09:26.420]  13 year old stepdaughter to another one in Dallas, a school resource officer
[09:26.420 --> 09:30.420]  Who raped a 14 year old girl in the bathroom
[09:30.420 --> 09:35.420]  And the only punishment he received was probation
[09:35.420 --> 09:40.420]  And the revocation of his law enforcement officer certification
[09:40.420 --> 09:43.420]  Under the promise that he would never get it reinstated
[09:43.420 --> 09:49.420]  And he would never seek to have the allegations expunged from his record
[09:49.420 --> 09:53.420]  But he wasn't convicted, he wasn't criminally charged
[09:53.420 --> 09:59.420]  And he wasn't held accountable through anything other than this probation
[09:59.420 --> 10:03.420]  And then, another one, let's see who is the other guy here
[10:03.420 --> 10:10.420]  Oh yeah, this cop admitted to a Florida state trooper
[10:10.420 --> 10:17.420]  Sexually molested his stepdaughter in a sex swing
[10:17.420 --> 10:25.420]  And a child, whether stepdaughter or one of his relatives daughters
[10:25.420 --> 10:29.420]  But in any case, forced her into a sex swing
[10:29.420 --> 10:33.420]  And repeatedly raped her over a period of time
[10:33.420 --> 10:39.420]  Because the girl was afraid to report him, she was afraid of him as a cop
[10:39.420 --> 10:44.420]  And this guy has yet to even go to court
[10:44.420 --> 10:50.420]  But odds are, he will get the same slap on the wrist that numerous other cops have gotten
[10:50.420 --> 10:56.420]  You and I commit any act even remotely criminal
[10:56.420 --> 11:03.420]  And we will get two to six times as much time in jail
[11:03.420 --> 11:11.420]  For a much lesser crime, if it should even be a crime, than a cop will
[11:11.420 --> 11:15.420]  And I'm actually wondering whether or not there needs to be statistical data
[11:15.420 --> 11:20.420]  Tracking the sentencing of law enforcement officers for crimes
[11:20.420 --> 11:26.420]  Versus every other classification of individual and occupation
[11:26.420 --> 11:30.420]  Where individuals there are being charged with those same crimes
[11:30.420 --> 11:36.420]  Just how far off kilter is the sentencing and prosecutorial guidelines for following through with this
[11:36.420 --> 11:44.420]  And as I was saying in the first segment, there is no law that grants these guys
[11:44.420 --> 11:49.420]  Any form of immunity for their acts or any other public servant immunity for their acts
[11:49.420 --> 11:54.420]  When those acts are criminal and they serve to harm members of the public
[11:54.420 --> 12:01.420]  In fact, there are laws to charge them for crimes when they do those things
[12:01.420 --> 12:05.420]  But those charges are never made
[12:05.420 --> 12:10.420]  They're never even looked at
[12:10.420 --> 12:19.420]  Immunity is something that the prosecutors and the courts cooked up to protect their guard dogs
[12:19.420 --> 12:29.420]  Because when these public officials harm any member of the public, it's just like that cartoon
[12:29.420 --> 12:37.420]  The politician runs up behind the civilian, one of the people of the public, smacks him on the back of the head
[12:37.420 --> 12:40.420]  And then turns around and runs away
[12:40.420 --> 12:50.420]  Well, the citizen gets chased, but when he catches up to the guy, the guy's hiding behind a cop thumbing his nose at the citizen
[12:50.420 --> 12:54.420]  That, ladies and gentlemen, is your justice system
[12:54.420 --> 12:59.420]  That's what it's truly designed to do
[12:59.420 --> 13:17.420]  Because haven't those same group of people set up on their high seats of power and declared that their watchdogs are not required to protect you
[13:17.420 --> 13:21.420]  Well, let me put a little bug in your ear
[13:21.420 --> 13:33.420]  If a state, municipality, or county is extorting you for taxes to pay these idiots to enforce laws
[13:33.420 --> 13:41.420]  Under the guise that those taxes are being levied to provide public protection
[13:41.420 --> 13:48.420]  And since the public itself is comprised solely and only of individuals
[13:48.420 --> 13:57.420]  How, then, is it legal to be extorted for money to provide a protection that you are now being told you are not entitled to?
[13:57.420 --> 14:03.420]  Didn't we used to charge people with racketeering and send them to prison for that crap?
[14:03.420 --> 14:17.420]  And now, because it's being done behind a uniform or badge and an official government seal, it's legal, it's lawful, it's proper, it's okay
[14:17.420 --> 14:23.420]  How did we get here is my question
[14:23.420 --> 14:35.420]  Why are we allowing them to keep us here is my other question
[14:35.420 --> 14:41.420]  A government of the people, by the people, for the people means exactly that, yes?
[14:41.420 --> 14:58.420]  But when the people have absolutely no power to hold accountable those very individuals that are responsible for what's going on that is wrong
[14:58.420 --> 15:03.420]  Then we are no longer any such thing
[15:03.420 --> 15:11.420]  No longer, and I personally have a severe problem with that
[15:11.420 --> 15:17.420]  I have a big problem with that

[20:19.420 --> 20:27.420]  I want to go through some things that you need to make sure that you do whenever you are going into making your court appearances and things like that
[20:27.420 --> 20:36.420]  I've told you for years and years now, never ever leave your home without something that records audio at a minimum
[20:36.420 --> 20:40.420]  And audio and video is preferred, okay?
[20:40.420 --> 20:49.420]  Especially when you know you're on your way to deal with one of these public serpents, okay?
[20:49.420 --> 21:02.420]  You record everything, always, anytime you know you're going to or even think you're going to have to have a conversation with one of them.
[21:02.420 --> 21:04.420]  Alright?
[21:04.420 --> 21:13.420]  Now that being said, the reason we do this of course is to have a record of everything that transpired during that encounter
[21:13.420 --> 21:25.420]  And if you've paid any attention at all to the way things are being done, they love to make stuff up to cause you problems about what was said or what was done during one of these encounters
[21:25.420 --> 21:31.420]  If it gives them an opportunity to abuse you for standing up to them
[21:31.420 --> 21:35.420]  If you haven't experienced that, then bully for you
[21:35.420 --> 21:46.420]  But I guarantee you it's only a matter of time because the moment you start standing up for yourself and stop simply doing what they want the way they want it
[21:46.420 --> 21:53.420]  They're going to try to make an example of you or they're going to make things as difficult as they can for you
[21:53.420 --> 21:58.420]  So protect yourself and these are the things you need to make sure of
[21:58.420 --> 22:08.420]  Now what we're addressing here is an issue where an individual was talking about a justice of the peace court here in Texas
[22:08.420 --> 22:13.420]  Where the court clerk kept saying they couldn't answer the question that was being asked
[22:13.420 --> 22:20.420]  And they would run off and they would ask someone and then they would come back and say something to the person about what they could or couldn't do
[22:20.420 --> 22:24.420]  Or how they had to do something or whatever
[22:24.420 --> 22:33.420]  But the person that is the defendant in this case was failing to do the things necessary to protect themselves
[22:33.420 --> 22:45.420]  By getting specific answers to specific questions relating to specific facts about the abuses that this court was heaping upon them in their right of due process
[22:45.420 --> 22:52.420]  And when you fail to make that record, how do you intend to get accountability for that failure?
[22:52.420 --> 23:02.420]  How do you intend to rectify the problem on appeal when you have no evidence that you were hosed over by the trial court from the very beginning in the word go?
[23:02.420 --> 23:04.420]  How do you do it?
[23:04.420 --> 23:09.420]  It's just a simple matter of, one, recording everything
[23:09.420 --> 23:20.420]  Two, identifying the parties as often and as much as possible that are being either talked about or talked to in these situations
[23:20.420 --> 23:27.420]  And of course, asking the right questions to establish that fact pattern
[23:27.420 --> 23:34.420]  This is not a hard thing to come up with if you're actually able to think on your feet and you're thinking at all
[23:34.420 --> 23:48.420]  But when somebody tells you to do something, especially when they're a public servant, the very first thing you need to know is by what authority are they making that statement and requiring that thing to be done
[23:48.420 --> 23:56.420]  What authority are you relying on? Is this you saying I have to do this or are you getting the information from someone else higher up?
[23:56.420 --> 24:03.420]  If so, who is that someone? What is their position? What is their name?
[24:03.420 --> 24:14.420]  Okay, so let me go down a list of 10 things that I told this individual. I asked this individual if they had asked based upon the information they posted about what was occurring
[24:14.420 --> 24:20.420]  One, did you record this entire set of encounters with these people?
[24:20.420 --> 24:28.420]  Two, did you ask the clerk of the court, who I must presume you are talking about here, who is telling you these things?
[24:28.420 --> 24:35.420]  Is it the judge or the prosecutor that you keep disappearing to see and then get these answers from?
[24:35.420 --> 24:47.420]  Now that's one and two, but real quick, let me tell you what they're talking about here. Let's see. I was directed to speak with ADA after having my license used to check into the Terstal of their Kangaroo Court
[24:47.420 --> 24:58.420]  She refused the fact that I had been arrested and would need an examining trial, then told me to wait after going back and forth over the Aziz case and traffic code Chapter 543
[24:58.420 --> 25:06.420]  When the court clerk called me up, she had a paper to sign for a judge-only trial, which means a bench trial.
[25:06.420 --> 25:13.420]  I told her that I had a constitutional right to a jury by trial. I don't know why they wrote that that way, but they did.
[25:13.420 --> 25:17.420]  Besides the fact that jurisdiction has not been established.
[25:17.420 --> 25:28.420]  She says, meaning the clerk, I cannot discuss any of that jurisdiction with you as it's not my position and I can't give legal advice and so on and so forth.

[25:43.420 --> 25:51.420]  The individual then says, I reply, no ma'am, I am not. However, I cannot consciously enter a plea, so I have not had a proper examining trial.
[25:51.420 --> 25:59.420]  She says one moment, again the clerk, and she returns again and says, if you enter a plea, you may have a trial by jury. Otherwise, you may have a trial by judge.
[25:59.420 --> 26:04.420]  Now, nowhere does Texas law say that. Absolutely nowhere.
[26:04.420 --> 26:13.420]  However, if you have not bothered to read the Code of Criminal Procedure like I've instructed this individual to do numerous times, you won't know that.
[26:13.420 --> 26:19.420]  They can say anything they want and you're clueless about whether or not it's accurate, correct, or in accordance with the rules.
[26:19.420 --> 26:33.420]  You just won't know, so you'll blow right by it like it was nothing of any importance and you wind up screwing yourself in the process, because what is happening right here is definitely a due process violation.
[26:33.420 --> 26:37.420]  But again, how would you know that if you know none of these other things?
[26:37.420 --> 26:39.420]  Okay.
[26:39.420 --> 26:52.420]  Now, I said, again, the person posting this, this is a travesty of justice and a sham, except he wrote shame upon their court and worthy of extraordinary writ and left.
[26:52.420 --> 27:03.420]  They're supposed to be naming me the court date papers that I wouldn't sign. And then he says, lawsuit? Okay. Well, let's follow through with what I was asking here. I did one and two. Now let's look at three.
[27:03.420 --> 27:09.420]  Did you respond to each of these statements with, was it the judge or the prosecutor who told you that?
[27:09.420 --> 27:14.420]  Now, these are all questions I would ask if I was standing there.
[27:14.420 --> 27:27.420]  Five, I'm sorry, four. Did you ask the clerk, is this court's policy of requiring a plea prior to an examining trial or arraignment in writing?
[27:27.420 --> 27:31.420]  Five, did you make the following demand upon the clerk?
[27:31.420 --> 27:44.420]  Can you provide me with a copy of this court's written policy on the requirement that an accused individual is required to enter a plea beforehand in order to have a right to a trial by jury?
[27:44.420 --> 28:00.420]  Six, did you ask the clerk, is this policy applicable even when no signed and verified criminal complaint has been filed with the court to properly initiate a criminal cause of action and at least preliminarily invoke the court's subject matter jurisdiction?
[28:00.420 --> 28:07.420]  Did you ask the clerk, does a signed and verified criminal complaint currently exist in the court record?
[28:07.420 --> 28:20.420]  Did you ask the clerk, number eight, does a certificate of service upon the accused exist in the court record showing that the accused was properly notified of the allegations by service of a copy of the criminal complaint?
[28:20.420 --> 28:27.420]  Number nine, did you ask the clerk, can you please provide me with a copy of each of these documents?
[28:27.420 --> 28:30.420]  Please.
[28:30.420 --> 28:35.420]  Ten, if you fail to do these things, then please explain why.
[28:35.420 --> 28:47.420]  Since it is what you have been instructed to do time and time again to cover your butt and to make a record of the due process violations that these courts engage in on a daily basis.
[28:47.420 --> 28:54.420]  And then the response I get back is anything but the response I asked for in relation to each of these things.
[28:54.420 --> 28:57.420]  They go into all these things about, well, this is what's on their website and blah, blah, blah.
[28:57.420 --> 29:00.420]  I didn't ask a damn thing about their website.
[29:00.420 --> 29:06.420]  I don't care what is on any public officials or departments' website.
[29:06.420 --> 29:10.420]  I only care about what their established policies are.
[29:10.420 --> 29:23.420]  Whether or not those policies are in writing, how that writing exists, is it in the form of a policy manual, is it an internal communication between whoever's in charge and whoever's enforcing this policy, et cetera, et cetera?
[29:23.420 --> 29:30.420]  Where and how does this policy exist and give me a copy of it?
[29:30.420 --> 29:37.420]  None of the responses addressed in you that, but suffice it to say the answer to virtually everything I asked was no.

[35:41.420 --> 35:46.420]  Not what are they in the United States federal government because we don't have lawful authority
[35:46.420 --> 35:50.420]  to go reach inside another country and pull somebody out through extradition.
[35:50.420 --> 35:55.420]  Not unless there is an extradition agreement between that country and ours.

[40:53.420 --> 40:58.420]  It's just you are your own worst enemy, folks.

[41:00.420 --> 41:06.420]  You are the ones that keep shooting yourselves in the foot when it comes to defending yourself in these courts.
[41:06.420 --> 41:11.420]  You're not prepared, you're not well studied, you're not well researched, you're not well spoken
[41:11.420 --> 41:16.420]  because you don't take the time and effort to become good at these things.
[41:16.420 --> 41:21.420]  When you don't do that, you're standing up there doing improv theater
[41:21.420 --> 41:24.420]  and that's really what it amounts to.
[41:24.420 --> 41:27.420]  You may as well be robbing realms at the improv.
[41:27.420 --> 41:33.420]  You might be funny, but you don't know a damn thing about what's really going on.
[41:33.420 --> 41:41.420]  And that is a problem because you're not going to laugh your way out of this.
[41:41.420 --> 41:51.420]  So that being said, the whole reason we're here is to try to find real, reliable remedy
[41:51.420 --> 41:59.420]  to the things that they do in these courts and in this system to defraud and steal from you.
[41:59.420 --> 42:04.420]  And that's what they're doing. There's no question that this is what they're doing.
[42:04.420 --> 42:13.420]  The question always is whether or not you understand what they're doing and how they are doing it.
[42:13.420 --> 42:19.420]  And the unfortunate thing is, is the majority of people out there do not.
[42:19.420 --> 42:21.420]  That's the whole reason we're here.
[42:21.420 --> 42:28.420]  It's the whole reason this show and the people on it exist and do what we do is because somebody's got to.
[42:28.420 --> 42:30.420]  We weren't doing what we were doing.
[42:30.420 --> 42:37.420]  How much would you know today about what's happening and who's doing it and how they're doing it and what to do about it?
[42:37.420 --> 42:47.420]  What other resource do you have that is providing you with this information on a weekly basis?
[42:47.420 --> 42:50.420]  Anyone out there have one?

[42:53.420 --> 42:59.420]  Because after doing this for years, I can honestly tell you I don't know of anybody else that does it.

[43:04.420 --> 43:11.420]  They talk about their understanding or lack thereof and their patronut theories and patronut information and solutions,
[43:11.420 --> 43:16.420]  which have been peed upon by the courts so many times now that I can smell it from here.
[43:16.420 --> 43:24.420]  And yet people still jump on the bandwagon and do their best to screw themselves by using it.
[43:24.420 --> 43:34.420]  It's ridiculous to me that you have not taken the time necessary to protect yourself by learning how to do it correctly.
[43:34.420 --> 43:37.420]  It's how I got to where I'm at.
[43:37.420 --> 43:38.420]  No one taught this to me.
[43:38.420 --> 43:40.420]  I had to do it by trial and error.
[43:40.420 --> 43:43.420]  I had to go through everything myself to figure it out.
[43:43.420 --> 43:54.420]  I had to make the time day and night to read this information, to take it apart, to link it to all the other information in the law that relates to it.
[43:54.420 --> 43:58.420]  I had to do all of that by myself.
[43:58.420 --> 44:12.420]  It was not until I got on this show that I was able to actually converse about what I found with someone else that had a good understanding of what I was talking about and what we could do about it.
[44:12.420 --> 44:17.420]  And even then, we tend to butt heads off and we tend to agree on some of these things.

[46:58.420 --> 47:10.420]  In recent news, Christopher DeVilla, the father of a missing baby, is behind bars for a child endangerment charge for parking his car at a San Antonio gas station last Friday night with his 8-month-old son in the back seat.
[47:10.420 --> 47:18.420]  The unfortunate circumstances were that he left the car running and unlocked. Surveillance videos showed a woman approaching the car getting inside and driving off.
[47:18.420 --> 47:24.420]  KABB reported that police later found DeVilla's car at a nearby park, but Baby J and the car keys were no longer inside.
[47:24.420 --> 47:34.420]  Investigators believe that the occurrence wasn't a random kidnapping and suspect that DeVilla knew the woman in the video. Apparently, DeVilla's family has not been cooperating with the police either.
[47:34.420 --> 47:44.420]  However, both parents are disputing those claims. Police are urging anyone with information about the case to call 911 or 201-207-7635.
[47:44.420 --> 47:56.420]  The Bernie Sanders campaign did not adequately address incidents of sexual harassment, sexist mistreatment, and paid as far as between men and women according to some allegations from multiple women who worked on his 2016 presidential bid.
[47:56.420 --> 48:10.420]  These allegations came out last Wednesday in the New York Times. Sanders apologizing on CNN said that, quote, I am not going to sit here and tell you that we did everything right in terms of human resources, in terms of addressing the needs that I'm hearing from now.

[52:17.420 --> 52:29.420]  If you're asking for monetary damage towards it, like for a conversion case, you have to put a dollar value on the property, I presume.

[52:33.420 --> 52:42.420]  Well, they have an outrageous dollar value. Well, then go right back after them for damages in relation to that dollar amount.
[52:42.420 --> 52:54.420]  Okay, this is where I got confused. If I look at, I mean, I have an original Homestead and so I look at the value they put on a Homestead exemption.

[53:09.420 --> 53:20.420]  Okay, the land patent title is the original title to a property from the Homestead Act.

[53:25.420 --> 53:40.420]  Yes. Okay, so how, if the federal government said this land cannot be taxed, which the last time I read that information for somebody, that's exactly what it said.
[53:40.420 --> 53:46.420]  The state cannot tax the property because it's not property belonging to the state.
[53:46.420 --> 53:54.420]  It is relinquished to the control of the individual whose name is on the patent and to the heirs and assigns, right?
[53:54.420 --> 53:56.420]  Yes, exactly.
[53:56.420 --> 54:03.420]  And the state has no rights or claim to that land under that, correct?
[54:03.420 --> 54:05.420]  As far as I'm concerned, yes.
[54:05.420 --> 54:11.420]  Not as far as you're concerned, it says that, does it not?
[54:11.420 --> 54:14.420]  No, it does not say that in my patent.
[54:14.420 --> 54:18.420]  No, I guarantee you it does. You're just not reading it right.

[55:10.420 --> 55:19.420]  Now, what does forever mean, only until they decide otherwise?

[55:39.420 --> 56:03.420]  So if they have no rights and claims under the patent, and that patent is a binding contract, then why was it not a violation and breach of that contract for them to attempt to do that which the contract prohibits them from doing as an element of the contract?
[56:03.420 --> 56:13.420]  Here's the thing, if that contract is between the landowner and the federal government, how did the state become an interloper third party?
[56:13.420 --> 56:17.420]  That has actually been my question. How did they bite into this?
[56:17.420 --> 56:26.420]  Does the Arizona Constitution and the Bill of Rights have a clause that says that the state may not impair the obligation of contracts?

[56:52.420 --> 57:01.420]  The original Texas Bill of Rights actually forbade any form of taxation of private property. It specifically prohibited it.

[57:08.420 --> 57:15.420]  But the problem is, is the government can't remove a portion of the Bill of Rights?
[57:15.420 --> 57:27.420]  So that right remains intact regardless of whether it's written into the Bill of Rights or not, because it was a right antecedent to the Constitution.

[01:01:59.420 --> 01:02:05.420]  goes to those set of constitutions and use or not to get a declaratory judgment.
[01:02:05.420 --> 01:02:12.420]  Then when you show up at trial with something traumatic jurisdiction on the property tax,
[01:02:12.420 --> 01:02:22.420]  pull out the declaratory judgment, you'll pretty much win the case, right?

[01:02:26.420 --> 01:02:36.420]  First off, you've got to argue what their interpretation and understanding of the Constitution is because they're going to let theirs overrule yours every single time.

[01:10:13.420 --> 01:10:20.420]  because you are the one that's going to have to make the argument about whether or not that interpretation is right or wrong.
[01:10:20.420 --> 01:10:29.420]  If it goes against you in some way or helps you in some way, that is important to your case.
[01:10:29.420 --> 01:10:32.420]  The more you know about that, the better off you are.
[01:10:32.420 --> 01:10:37.420]  It's like the other thing I told him and I've told other people the exact same thing.
[01:10:37.420 --> 01:10:44.420]  I said, look, no matter how much you ask me to give you information, there's a problem here.

[01:21:29.420 --> 01:21:38.420]  But the legal pleadings all deal with the specific legal issues of how the state prosecutes those types of cases
[01:21:38.420 --> 01:21:43.420]  and things of that nature, and the rights they violate and the rules they break.
[01:21:43.420 --> 01:21:45.420]  That's what's in the seminar material.
[01:21:45.420 --> 01:21:53.420]  And once people get into it, they generally find that there are egregiously high numbers of similarities
[01:21:53.420 --> 01:21:59.420]  between how they do things adversely in Texas versus how they do them adversely in any other state,
[01:21:59.420 --> 01:22:02.420]  especially in states where there are civil infractions.
[01:22:02.420 --> 01:22:08.420]  In a state where there are civil infractions, like Washington, for instance,
[01:22:08.420 --> 01:22:14.420]  the fact that the cop arrested you to write you the ticket makes that a due process violation.
[01:22:14.420 --> 01:22:16.420]  It's false imprisonment.
[01:22:16.420 --> 01:22:22.420]  They have no probable cause to stop you for an infraction because an infraction is not criminal.
[01:22:22.420 --> 01:22:26.420]  Therefore, probable cause does not attach.
[01:22:26.420 --> 01:22:33.420]  So the seizure was completely unconstitutional unreasonably and illegal.
[01:22:33.420 --> 01:22:39.420]  And if someone raises that issue hard enough and well enough, they can make that stick.
[01:22:39.420 --> 01:22:42.420]  And many people have.
[01:22:42.420 --> 01:22:44.420]  That's on that right now.
[01:22:44.420 --> 01:22:45.420]  Okay.
[01:22:45.420 --> 01:22:50.420]  So if I'm not mistaken, I don't know if I can see.

[01:24:39.420 --> 01:24:50.420]  That is an argument that can be made about a misapplication of the law as it currently exists because that was not the intent of the law for the first 50 years it was enacted.
[01:24:50.420 --> 01:24:58.420]  Now suddenly you're using it in this manner and there has been no change that would have allowed that application to occur.
[01:24:58.420 --> 01:25:00.420]  And that's what's happening here in Seattle.
[01:25:00.420 --> 01:25:02.420]  That's what's happening everywhere.
[01:25:02.420 --> 01:25:03.420]  Okay.
[01:25:03.420 --> 01:25:15.420]  They started rewording every new version of the statute to make it appear as if it applied to things that it originally did not.
[01:25:15.420 --> 01:25:18.420]  But they cannot do it that way.
[01:25:18.420 --> 01:25:27.420]  They cannot encompass objects within a subject that are not related to the subject under which that law was originally enacted.
[01:25:27.420 --> 01:25:31.420]  It's called the single subject provision.
[01:25:31.420 --> 01:25:40.420]  So they cannot add anything into a law that falls outside of the context of that single subject.
[01:25:40.420 --> 01:25:54.420]  And that single subject is itself the actual subject matter that the individual court must have jurisdiction over in order to prosecute the case to begin with.
[01:25:54.420 --> 01:25:58.420]  Much less for anyone else to enforce it.
[01:25:58.420 --> 01:26:07.420]  Jurisdiction over any given area of law is not automatic to every given entity in government.
[01:26:07.420 --> 01:26:25.420]  And law itself generally specifies what office agency or officers have authority to act in relation to enforcement, administration, or other things relating to that law.
[01:26:25.420 --> 01:26:36.420]  And anyone that is not part of those authorized is not authorized by default and omission.
[01:26:36.420 --> 01:26:37.420]  I am here.
[01:26:37.420 --> 01:26:38.420]  I am.
[01:26:38.420 --> 01:26:42.420]  Because when I asked my talk with you, I was starting to look up stuff and started doing my research.

[01:26:46.420 --> 01:26:52.420]  They put a lien on my house for, like, a judgment for $218,000 because I had tires and a door and a tree fell over my house.

[01:26:53.420 --> 01:26:57.420]  And that just took me out of the whole thing with the tickets and everything.
[01:26:57.420 --> 01:26:59.420]  So that's why I said, I need to call back to get your email.

[01:27:49.420 --> 01:27:59.420]  But where the criminal rules will come in is in relation to the stop the officer performed to write the ticket.
[01:27:59.420 --> 01:28:09.420]  Because the criminal rules will dictate a requirement for a seizure and a warrantless arrest to be probable cause, which he did not have.
[01:28:09.420 --> 01:28:10.420]  Exactly.
[01:28:10.420 --> 01:28:19.420]  I just got to stop the six cops, one guy got a hammer, we're going to break my window and I got upset about that time and told him once he do that, we're going to be on and popping.
[01:28:19.420 --> 01:28:22.420]  And I know I have six people out there with three sergeants.
[01:28:22.420 --> 01:28:28.420]  They didn't take my car and they have yet to arrest me because what I've learned from your stuff thus far, I've yet to be arrested.
[01:28:28.420 --> 01:28:31.420]  I've yet to get out of my car and I don't raise my window now.
[01:28:31.420 --> 01:28:33.420]  But I'm still going to court getting hammered.
[01:28:33.420 --> 01:28:35.420]  So I'm getting frustrated.
[01:28:35.420 --> 01:28:41.420]  So that's why I say I got to call and call you back and see where I go to see how to challenge that.
[01:28:41.420 --> 01:28:46.420]  Well, I gave you, how many times have I given you that list of laws for Washington?
[01:28:46.420 --> 01:28:50.420]  I got that, that PEP that I had the stuff for that.
[01:28:50.420 --> 01:28:54.420]  And I did use that one thing about that, but they can't take away my rights.
[01:28:54.420 --> 01:28:59.420]  No law statute that can make it take away my rights.
[01:28:59.420 --> 01:29:04.420]  And so they started to leave me alone and I had them dumbfounded on a couple of my stops.

[01:29:06.420 --> 01:29:08.420]  I got no plates on my car, no nothing.
[01:29:08.420 --> 01:29:13.420]  I was in the HOV lane, which I should have waited until I got some kind of plate to protect me.
[01:29:13.420 --> 01:29:18.420]  And so I stopped doing that because I could see once I go to court I'm getting hammered.
[01:29:18.420 --> 01:29:22.420]  And so that's why I said let me call you back and see if I can get something to find the right procedure.
[01:29:22.420 --> 01:29:28.420]  Because he didn't want to give me his badge number nor his name, but he wanted to get that hammer and break my window out.

[01:29:30.420 --> 01:29:35.420]  But you can't go to a gunfight with a stick if somebody's got a rifle.

[01:34:44.420 --> 01:34:59.420]  I have a real problem with that. I have a real problem with the disparity of accountability and justice between those who were meant to serve us and us.
[01:34:59.420 --> 01:35:20.420]  When they take it upon themselves to abuse those that are supposed to be able to count on them and they use the power of the office we gave them to harm us, to betray us, to belittle us, to enslave us and we do nothing,
[01:35:20.420 --> 01:35:38.420]  then who are we to blame when our children and their children and everyone to follow begins to see this as normal, as how things are supposed to be.
[01:35:38.420 --> 01:35:44.420]  Everybody's all happy about what's going on over in France right now with the yellow vests and all this kind of stuff.
[01:35:44.420 --> 01:36:01.420]  But you know what? Everything that's going on over there right now is tame in comparison to how this country organized and dealt with those same sort of abuses in its origin.
[01:36:01.420 --> 01:36:15.420]  We literally not only attacked those in power, we killed and destroyed those in power to the point of going to actual war with them, a war that we eventually won at great cost.
[01:36:15.420 --> 01:36:24.420]  But it gave us the one thing we always wanted to have, liberty and freedom.
[01:36:24.420 --> 01:36:47.420]  The stuff that exists today under the guise of government and law would have been laughed at and spit upon and those responsible, tarred, feathered or hung for even beginning to believe that they had the right and the power to do any of the things they're doing now.
[01:36:47.420 --> 01:36:54.420]  There's no question that would have been the outcome.
[01:36:54.420 --> 01:37:15.420]  But all we do these days is whine, moan, groan and lament about the coulda, shoulda, wouldas and used-to-bees that we know existed but we have no idea how to put back into force.
[01:37:15.420 --> 01:37:38.420]  And yet the very means of doing that was written into a document and a set of documents so that we would not forget and that we would understand that if things really got to the point where no one listened to us anymore, then our remedy is whatever we chose to make it.
[01:37:38.420 --> 01:37:46.420]  Texas Constitution Bill of Rights is very, very specific in its language, very clear in that specific language.
[01:37:46.420 --> 01:38:15.420]  The people of Texas have the right to remove or abolish by any means we deem necessary any part of our government or any sort of government that no longer adheres to the wishes of the people as laid out in our Constitution.
[01:38:15.420 --> 01:38:39.420]  And that includes when our government decides to misinterpret and misapply how that Constitution works so that it gives them more power over us and takes away from us that which is rightfully ours in the name of government necessity.
[01:38:39.420 --> 01:39:08.420]  When they get that toehold, that is our fault because we forgive too much, too fast, and allow the encroachments to get farther and farther onto the beach and get a better toehold so that the beachhead becomes very difficult to remove farther down the line without actually having to result to a bloody civil war to get it.
[01:39:08.420 --> 01:39:25.420]  I'm telling you, folks, I would have been the first one calling for somebody to get tarred, feathered, or hung when I saw this coming if I had known everything from day one that I know now about how this was set up to work.
[01:39:25.420 --> 01:39:41.420]  Had I known and understood it for what it was and what was happening the way that I do now, I probably would not have lived as long as I had because I would have been sought out and destroyed as a descendant of the state long before now.
[01:39:41.420 --> 01:39:55.420]  My whole life was spent fighting for what I thought was right. Even when I was a little kid, I got in fights constantly in school and beat up by multiple people because I didn't like bullies and I didn't like people getting bullied.
[01:39:55.420 --> 01:40:05.420]  I didn't care if they were older than me, I didn't care if they were bigger than me, I didn't care if they outnumbered me. I would take the whipping to protect somebody else from it.
[01:40:05.420 --> 01:40:12.420]  And when I could, I delivered a whip into my own. I've been that way my whole life.
[01:40:12.420 --> 01:40:28.420]  I tried to get along and be peaceful, but my whole life has been a series of conflicts all the way through the military, the Sheriff's Department, everywhere else where when things were wrong and I spoke up about it, people wanted to come after me for it.
[01:40:28.420 --> 01:40:32.420]  And I just simply don't care.
[01:40:32.420 --> 01:40:46.420]  I know that's not a place where a lot of people are these days. You think you've got too much to lose in what you have without ever realizing what you're losing that you don't even understand and recognize.
[01:40:46.420 --> 01:40:56.420]  Because without the thing that you don't understand and recognize, the rest of it means nothing because it can be taken at any time without that other.
[01:40:56.420 --> 01:41:08.420]  And you will have no clue about how to do anything to get it back or why you even would have a right to get it back or to do something about it.
[01:41:08.420 --> 01:41:12.420]  We are our own worst enemy.
[01:41:12.420 --> 01:41:31.420]  The Soviets and the communists had it right. America will destroy itself from within because the people are too apathetic and lazy and too ignorant of their own origin and their own power to do something about it.
[01:41:31.420 --> 01:41:50.420]  And that is going to be our downfall. The unwillingness to do what needs to be done to right the wrongs that are being heaped upon us by those that we gave minimal power to,
[01:41:50.420 --> 01:42:05.420]  but who have used that power to increase it exponentially and turn us into their, for lack of a better term, ATM machine.
[01:42:05.420 --> 01:42:15.420]  They can walk up to us anytime they want, punch in some numbers and we've got to spit out whatever amount they're asking for.
[01:42:15.420 --> 01:42:25.420]  Think about that because that's where you're living and that's where you're going to remain for as long as you keep your head and buried in the sand.
[01:42:25.420 --> 01:42:44.420]  You're too lazy to do the work. You're too lazy to make the effort. You're too apathetic in your understanding and you're too unwilling to act and to seek out others who are willing to act to stop it.
[01:42:44.420 --> 01:42:53.420]  We can choose the course of action that we want to follow, but if we don't get organized and get it done, it won't matter.
[01:42:53.420 --> 01:43:00.420]  It simply won't matter because the state can cut us down like wheat when it's only a handful of us against the state.
[01:43:00.420 --> 01:43:11.420]  Until we're all standing strong together, we don't stand a chance and that's just the facts of it.
[01:43:11.420 --> 01:43:28.420]  A big part of what I do on this show is meant to get you folks out there to understand that, that our ability to stay free is completely dependent upon our ability and willingness to fight to keep it.
[01:43:28.420 --> 01:43:38.420]  How we fight, it all comes down to how willing they are to prevent us from having it.
[01:43:38.420 --> 01:43:52.420]  I'm just of the mind that at this point there is no peaceful solution to what's happening because there are too many making the rules who will not give up the power they've stolen for themselves.
[01:43:52.420 --> 01:43:55.420]  So it's returned to us rightfully.
[01:43:55.420 --> 01:44:09.420]  Not a single government on the face of this earth has ever willingly surrendered any level or amount of power that is taken from the people back to those people peacefully.
[01:44:09.420 --> 01:44:14.420]  Not one, anywhere, ever.
[01:44:14.420 --> 01:44:19.420]  That's the piece of history you better know and understand.
