[01:34.040 --> 01:38.640]  The series of events all began on Monday afternoon of last week when a homemade dud pipe bomb
[01:38.640 --> 01:43.320]  was discovered inside a package delivered to billionaire political activist George Soros.
[01:43.320 --> 01:47.760]  It took investigators less than 96 hours to locate and arrest the culprit outside an
[01:47.760 --> 01:50.880]  auto supply store in Plantation, Florida.
[01:50.880 --> 01:55.000]  Attorney General Jeff Sessions stated to the media on Friday that, quote, we will not tolerate
[01:55.000 --> 01:58.040]  such lawlessness, especially not political violence.

[02:02.200 --> 02:06.280]  the full force of the law against anyone who attempts to use threats, intimidation and

[02:12.800 --> 02:18.000]  pinpointing a fingerprint on an envelope containing the IED sent to Representative Maxine Waters,

[02:19.920 --> 02:24.360]  And that DNA found on two of the devices was a potential match to a sample previously taken
[02:24.360 --> 02:29.200]  from the perpetrator during a prior arrest in Florida, facing charges that carried decades-long

[03:51.200 --> 03:55.880]  off of poverty, in court, the policies, supporting prison economy, yeah, no one makes money when

[07:05.840 --> 07:16.960]  in prison for his tax methodologies or I guess I should say tax evasion methodologies.
[07:16.960 --> 07:29.040]  It astounds me how many people that man had following his BS and accepting it as true
[07:29.040 --> 07:40.600]  because we have verified before that Schraut's information is not based upon facts and law.
[07:40.600 --> 07:47.040]  Schraut himself was on the show according to Randy many years ago and stated very clearly
[07:47.040 --> 07:54.280]  that where he could not find support for his theories in the law, he simply made up the
[07:54.280 --> 07:57.760]  information he needed to fill in the holes.
[07:57.760 --> 08:02.440]  Folks, that is not research.
[08:02.440 --> 08:08.440]  That is not fact based information.
[08:08.440 --> 08:14.360]  I have said this repeatedly to people.
[08:14.360 --> 08:22.520]  Inferences about any given fact are limited to a single level of logical inference from

[08:25.320 --> 08:33.880]  You cannot make multiple levels of inferences based upon a single fact.
[08:33.880 --> 08:40.460]  Each inference must have a fact as its foundation and the inference that you make must be logical

[09:30.160 --> 09:35.920]  I have coined two new phrases as I came on to this show, two new terms I should say.

[09:38.960 --> 09:44.160]  The patronuts are the people that will say anything to get someone to believe they know
[09:44.160 --> 09:48.800]  what they're talking about even when you can disprove their information.
[09:48.800 --> 09:54.280]  You show them the proof of their information and then they attack you for refuting their
[09:54.280 --> 09:57.120]  supposed facts.
[09:57.120 --> 09:59.320]  That's the patronut.
[09:59.320 --> 10:07.000]  The patridiot is the person that will follow that patronut regardless of the amount of verifiable
[10:07.000 --> 10:13.200]  information and evidence contrary to what that patronut is trying to teach them to do,
[10:13.200 --> 10:18.120]  as wrong as it may be.
[10:18.120 --> 10:27.200]  People like that are the reason the phrase you can't fix stupid exists.
[10:27.200 --> 10:35.680]  And I can think of no better term to describe them than a patridiot because stupid just

[10:40.320 --> 10:48.480]  So given that, understand my frustration with people that get themselves in hot water, but
[10:48.480 --> 10:57.080]  understand even more my anger and angst when they cause someone else to be cooked right

[11:26.680 --> 11:35.480]  what you've got just to get them to listen to you.

[20:58.640 --> 21:04.960]  of an information or indictment what is the charge one other two speeding charges okay and
[21:04.960 --> 21:14.320]  they rolled them into one and uh and one other motion but went in judge ball is sitting in 12
[21:14.320 --> 21:20.320]  feet away while i'm talking to the head clerk and when i told her you know here's the motion she
[21:20.320 --> 21:27.120]  looked at when she said these are our cause numbers and i went well oh i know that um and i
[21:27.120 --> 21:32.080]  explained to her what happened she goes okay i know what you're talking about then anyway she
[21:32.080 --> 21:39.120]  entered the motions no problem and i asked her to inspect the court record and she said well
[21:39.120 --> 21:43.120]  what do you want to look at i said well i need to see if the prosecution has entered anything into
[21:43.120 --> 21:51.440]  the record she walked over to the computer looked at it no nothing's been entered and i went okay
[21:53.040 --> 21:57.680]  and of course i'm recording everything so then i asked her we're supposed to have trial
[21:57.680 --> 22:04.160]  wednesday and today i asked her you know does the judge have any days open for a motion to

[22:09.360 --> 22:15.760]  to the record on these cause numbers and we've never had a motion to uh those aren't allowed in
[22:15.760 --> 22:24.000]  justice court i'm sorry the clerk said this yep with judge ball sitting right there listening
[22:24.000 --> 22:30.400]  to everything and did you say well i appreciate your attempt to give me legal advice no i didn't
[22:30.400 --> 22:34.640]  think to do that but i just looked at her and i said well i don't i don't believe that's right
[22:34.640 --> 22:42.960]  but okay i didn't think i didn't even think about that part of it but you know i was sitting
[22:42.960 --> 22:51.120]  there waiting for the for judge ball to correct her and he never did it so i just left and next
[22:51.120 --> 22:57.520]  day it worked now what is judge ball is the jp of the precinct you're going into yes sir
[22:57.520 --> 23:04.240]  he's the one at the county jail okay and he was right there and said nothing to the clerk
[23:04.240 --> 23:12.000]  about the misinformation that was provided yes sir okay now you've got a reason to disqualify ball
[23:13.200 --> 23:18.640]  i that's what i typed up the very next day a disqualification motion you just reconduct
[23:18.640 --> 23:25.600]  complaint got that mailed off to the uh state commission on judicial conduct mailed it to
[23:25.600 --> 23:35.360]  judge olin underwood in uh in comro who's the head administrative judge and Wednesday i entered him
[23:35.360 --> 23:42.320]  in the court record and mailed that stuff off to where it needed to go and uh went to try to
[23:42.320 --> 23:49.520]  meet the assistant county attorney he wasn't in his office so i went Thursday morning to see him
[23:49.520 --> 23:56.320]  before work and again you know i went to got there about a little after eight i didn't have to be in
[23:56.320 --> 24:02.320]  night till 10 so i gave him here i said i got some more motion for you and he said okay and i said
[24:02.320 --> 24:06.880]  and another disqualification motion for judge ball and he was kind of in a criminal complaint
[24:06.880 --> 24:14.320]  he just kind of looked at me and i said i told him what happened i said no i asked for a motion
[24:14.320 --> 24:26.320]  hearing i asked to see the court record was told no um so uh he said well judge ball did call me
[24:26.320 --> 24:32.080]  yesterday and say we're going to have a motion hearing Wednesday before the trial irrelevant
[24:32.080 --> 24:38.240]  the judge did not correct the actions of the clerk knowing full well the clerk had provided
[24:38.240 --> 24:44.160]  you with false information detrimental to your rights the judge did nothing to correct that
[24:44.160 --> 24:49.520]  problem yeah that's what i told him i said that ship's already failed bubba you know he judge ball
[24:49.520 --> 24:55.840]  was sitting there he had a chance to correct the clerk and didn't do it and i said so there's not
[24:55.840 --> 25:03.520]  going to be a trial tomorrow but anyway friday night i got a letter from judge ball well wednesday
[25:03.520 --> 25:12.160]  night i got a letter from him he in writing he denied my motion to dismiss for lack of an
[25:12.160 --> 25:20.720]  indictment or information in writing friday i get a another i guess a summons to the court
[25:20.720 --> 25:30.720]  um that the motion to disqualify judge has been sent for hearing Wednesday the 31st at 8 30 a.m

[01:22:19.520 --> 01:22:25.520]  So when we went out to the trial or to the hearing
[01:22:25.520 --> 01:22:29.520]  The judge says, let me make sure I've got this straight
[01:22:29.520 --> 01:22:33.520]  That this is a health and safety hazard hearing
[01:22:33.520 --> 01:22:37.520]  And she said, at first she said no

[01:34:36.520 --> 01:34:39.520]  And I guess he was basing, this is another thing
[01:34:39.520 --> 01:34:42.520]  We tried to do a findings of facts and conclusions of law

[01:34:46.520 --> 01:34:49.520]  He does not have to answer those
[01:34:49.520 --> 01:34:51.520]  No, he does too
[01:34:51.520 --> 01:34:56.520]  Findings of facts and conclusions of law are not limited to criminal

[01:35:00.520 --> 01:35:06.520]  Well, we have till Friday to pay for the clerk's records

[01:41:18.520 --> 01:41:25.520]  Well, it depends on what the Texas Constitution says the term limits for the sheriff are, whether or not those limits are set by law

[01:41:31.520 --> 01:41:43.520]  If the Constitution says that the term limit is set by law, then the legislature can determine what it is, and they can set it for any length of time they desire

[01:48:22.520 --> 01:48:31.520]  So how do I, what do I do at this point to sue them? Do you have any advice on what I need?

[01:48:40.520 --> 01:48:50.520]  You do whatever you'd normally do to file a lawsuit, but what you would do on top of that is additional research for when you're trying to sue a governmental entity
[01:48:50.520 --> 01:49:00.520]  Okay, you need to be ready for things that don't happen normally in a lawsuit, unless it's a medical lawsuit for personal injury, believe me
[01:49:00.520 --> 01:49:07.520]  But otherwise, suing a governmental entity is difficult at best, and you better know what to do and when to do it
[01:49:07.520 --> 01:49:21.520]  So in addition to the information on how to file and maintain a lawsuit, do specific research on how to maintain one against a governmental entity and its actors
[01:49:21.520 --> 01:49:30.520]  And as far as the California Franchise Tax Board, are they allowed to act outside of the Fair Debt Collection Act?
[01:49:30.520 --> 01:49:36.520]  No, because that's federal law governing the collection of debts, especially if those debts cross state lines
[01:49:36.520 --> 01:49:45.520]  But the fact of the matter is most reporting agencies are not located within the state in which those collections are occurring
[01:49:45.520 --> 01:49:52.520]  So that information is crossing state boundaries all the time, but no, the state of California is not exempt from Fair Debt Collection Practices Act
[01:49:52.520 --> 01:50:07.520]  Except as a governmental entity in certain aspects, which means you've got to check and see what they're trying to claim their immune is actually allowed by federal law
[01:50:07.520 --> 01:50:12.520]  Okay, so as of right now, everything's been administrative, but of course they do
[01:50:12.520 --> 01:50:25.520]  It's administrative or not, what matters is whether or not the federal act makes specific state governmental methodologies and collection practices as not relevant to the act
[01:50:25.520 --> 01:50:33.520]  That's what you've got to make sure of
[01:50:33.520 --> 01:50:36.520]  Okay
[01:50:36.520 --> 01:50:47.520]  And then do you have any advice for dealing with cities? The only remedy I had through them was to accept an administrative hearing
[01:50:47.520 --> 01:50:52.520]  That's the only kind they're empowered to make, then what's the question?
[01:50:52.520 --> 01:50:53.520]  I would have to appeal
[01:50:53.520 --> 01:50:57.520]  See, the issue here is whether or not they're providing you a due process
[01:50:57.520 --> 01:51:17.520]  If they are acting punitively against you, and the punitive action is taken through administrative means, and there is no way to appeal the administrative sanction and judgment against you through a judicial review means, then the act itself is unconstitutional
[01:51:17.520 --> 01:51:26.520]  Because that is an administrative bill of pains and penalties, which are outlawed in every state of the union
[01:51:26.520 --> 01:51:29.520]  Okay, they did offer me the appeals process
[01:51:29.520 --> 01:51:32.520]  Did you take the judicial hearing?
[01:51:32.520 --> 01:51:36.520]  No, because I didn't want the administrative hearing part
[01:51:36.520 --> 01:51:43.520]  Well, the issue here is whether or not the administrative entity had jurisdiction in the first place
[01:51:43.520 --> 01:51:46.520]  This is where we get to the issue of the California Codes
[01:51:46.520 --> 01:51:56.520]  If the California Codes do not apply to the class of person to whom they are attempting to use them, then that is a defense that needs to be raised in the administrative hearing
[01:51:56.520 --> 01:52:07.520]  That the hearing officer and the entity lack jurisdiction to pursue the action because you are not the class of person which the action applies to
[01:52:07.520 --> 01:52:09.520]  Okay
[01:52:09.520 --> 01:52:10.520]  So I should have taken it
[01:52:10.520 --> 01:52:30.520]  Yeah, and then you should have let them dig a hole they couldn't climb out of so that you could sue them for acting without jurisdiction when you did the judicial review and the judicial review had to find in your favor because you could show that the administrative process was being misapplied according to law

[01:52:35.520 --> 01:52:47.520]  But yeah, the city ordinance says it only applies to government as well, just like you'd mentioned in Austin

[01:52:53.520 --> 01:53:03.520]  You don't pick it, you object to it the whole way, you challenge its jurisdiction the whole way, but you don't simply ignore it

[01:54:15.520 --> 01:54:29.520]  So I took that, I did do that step. I appealed it with the Department of Transportation in the city, the city manager's office and the city attorney's office and made my position known
