[01:39.440 --> 01:44.240]  by the hour, and FBI Assistant Director William Sweeney has said federal investigators have

[01:48.600 --> 01:53.400]  At a Make America Great Again rally in Mozini, Wisconsin Wednesday night, President Trump
[01:53.400 --> 01:57.640]  stated that, my highest duty as you know as president is to keep America safe.

[01:59.920 --> 02:03.040]  This is an attack on our democracy itself.

[07:55.720 --> 08:15.720]  If I seem out of sorts today, it's because I have been struggling to complete preparations on a questionnaire that where I've taken
[08:15.720 --> 08:24.720]  apart the Securities Exchange Commission codes and turned them into a questionnaire.
[08:24.720 --> 08:32.720]  When I started on the, you know, up to this time I've primarily been doing the criminal codes.
[08:32.720 --> 08:42.720]  And the criminal codes turn out to be very simple relative to some of these other things.
[08:42.720 --> 08:52.720]  The criminal codes next to the Securities Exchange Commission codes was a piece of cake.
[08:52.720 --> 08:58.720]  The SEC codes may well be the most complex I've ever looked at.
[08:58.720 --> 09:15.720]  But it turned out this questionnaire tool was uniquely effective in taking all of this complexity and hiding it.
[09:15.720 --> 09:23.720]  The user can't tell how complex the code is because all he sees is a set of questions.
[09:23.720 --> 09:30.720]  Yesterday he opens up the software and he gets a question and a yes-no answer.
[09:30.720 --> 09:32.720]  That's all he sees.
[09:32.720 --> 09:39.720]  And then he answers that and then he gets another one and he never sees how complex it is in the background.
[09:39.720 --> 09:51.720]  And it allows him to walk through a very complex and convoluted code with no difficulty whatsoever.
[09:51.720 --> 10:01.720]  I suspect that when we get this all up and working correctly, we will make the SEC crazy.
[10:01.720 --> 10:17.720]  It seems relatively clear that this code was designed in a way that is deliberately complex and convoluted.
[10:17.720 --> 10:37.720]  They deliberately designed this thing so that if a big player in the United States is supposed to be a republic and a democracy, it functions more like a fascist government.
[10:37.720 --> 10:52.720]  And fascism, that goes to a governmental entity that's primarily controlled by big money and special interest and by business.
[10:52.720 --> 10:55.720]  Big business pretty well controls the government.
[10:55.720 --> 10:58.720]  That's what a fascist government is doing.
[10:58.720 --> 11:02.720]  Well, that's exactly what's going on in the United States.
[11:02.720 --> 11:06.720]  At least the SEC codes.
[11:06.720 --> 11:19.720]  They are clearly written so that the SEC can interpret the codes pretty much any way they want to.
[11:19.720 --> 11:25.720]  Perfect example in the code is due diligence.
[11:25.720 --> 11:35.720]  When you're in the blockchain community, new area of investment,
[11:35.720 --> 11:52.720]  you hear a lot of talk about KYC, know your client, know your customer, and money laundering, anti-money laundering, how to avoid money laundering.
[11:52.720 --> 12:03.720]  You got to know your customer before you sell to them because you might be selling to someone who's laundering money for the Colombian drug cartels.
[12:03.720 --> 12:11.720]  Well, it's all a bunch of nonsense because there are easy ways of determining this.
[12:11.720 --> 12:29.720]  And what the code says in order to determine if your customer is a valid buyer, there are a lot of things that you can check.
[12:29.720 --> 12:37.720]  All you can check is income tax returns, you can check a profit loss statement.
[12:37.720 --> 12:40.720]  There's a whole list of things you can check.
[12:40.720 --> 12:46.720]  What says none of these are exclusive or exhaustive.
[12:46.720 --> 12:51.720]  These are just recommendations.
[12:51.720 --> 13:04.720]  So you can check all these things but they're merely recommendations and they are not necessarily exhaustive.
[13:04.720 --> 13:15.720]  So you can check all of these things and we may or may not accept that you have exercised sufficient due diligence.
[13:15.720 --> 13:20.720]  I went through this code and said, what in the heck is this garbage?
[13:20.720 --> 13:26.720]  Oh, you can check this and you can check that and you can check the other but it may or may not be enough.
[13:26.720 --> 13:49.720]  So what that says is, is that the SEC at the end of the day, based on this code, get to determine whether or not they think you exercised sufficient due diligence on every single person who has purchased your security.
[13:49.720 --> 14:08.720]  If they determine that even though you followed, you did everything they have listed in all of these recommendations, that they can still decide that they don't believe you did enough due diligence and they can come in and shut you down.
[14:08.720 --> 14:14.720]  It is designed to be arbitrary and capricious.
[14:14.720 --> 14:31.720]  It's designed to allow the regulators to determine at their caprice whether they think you have exercised sufficient due diligence.
[14:31.720 --> 14:45.720]  We got to fix that because anytime the regulator gets someone with deep pockets and political influence, they can come in and interpret the codes however they feel like it.
[14:45.720 --> 14:55.720]  It makes no difference what you've done, how much money you've spent, how much time you've spent, how much due diligence you have performed.
[14:55.720 --> 15:01.720]  They can decide they don't think it's enough of your toast.
[15:01.720 --> 15:08.720]  That is not the law that we agree to in our constitution.
[15:08.720 --> 15:10.720]  We're going to fix that.
[15:10.720 --> 15:14.720]  I've had to talk about this.
[15:14.720 --> 15:16.720]  This is annoying me.
[15:16.720 --> 15:23.720]  It's something I'm dealing with and I just had to blow off a little steam.

[20:14.720 --> 20:18.720]  Traffic tickets, we know, and I'm going to review this quickly.
[20:18.720 --> 20:22.720]  Traffic tickets are really rits of assistance, are they not?
[20:22.720 --> 20:27.720]  Wait, you have traffic tickets are really what?
[20:27.720 --> 20:31.720]  Bills of a tanger or rits of assistance?
[20:31.720 --> 20:37.720]  Well, where did you come up with that idea?
[20:37.720 --> 20:43.720]  Well, let me explain to everybody, bills of a tanger.
[20:43.720 --> 20:50.720]  A bill of a tanger is where the government comes in and decides they don't like what you're doing
[20:50.720 --> 20:55.720]  and they punish you for it without giving you due process.
[20:55.720 --> 21:03.720]  This is Tim is on next and Tim was charged with the junk vehicles
[21:03.720 --> 21:09.720]  and they did an improper adjudication against him.
[21:09.720 --> 21:18.720]  And then the city came back and sued him to collect money based on this adjudication.
[21:18.720 --> 21:26.720]  Well, he filed a petition for Rina Mandamus to the Court of Appeals
[21:26.720 --> 21:33.720]  and the Court of Appeals ruled that the original adjudication was void.
[21:33.720 --> 21:39.720]  But they still tried to collect this fee from him based on that void adjudication.
[21:39.720 --> 21:50.720]  That means that the government came and tried to collect a fee from him without allowing him due process.
[21:50.720 --> 21:58.720]  That's an act of pains and penalties for a bill of a tanger and it is forbidden by Constitution.
[21:58.720 --> 22:03.720]  Before the Revolution, the king could decide that you were a bad guy
[22:03.720 --> 22:09.720]  and you had done something that he didn't like even if it wasn't codified into code.
[22:09.720 --> 22:15.720]  He could decide you did something he didn't like and a pun issue for doing something he didn't like
[22:15.720 --> 22:19.720]  without you ever having the opportunity to defend yourself.
[22:19.720 --> 22:21.720]  That was a bill of a tanger.
[22:21.720 --> 22:23.720]  That's forbidden.
[22:23.720 --> 22:33.720]  So, try to codes are essentially codes. They at least have the appearance of code. They're codified into law.
[22:33.720 --> 22:39.720]  You can read them and basically understand them.
[22:39.720 --> 22:52.720]  And when they prosecute you for violation of one of those codes, then that is a prosecution where you have an opportunity to come
[22:52.720 --> 22:58.720]  and defend yourself so that's not the bill of a tanger.
[22:58.720 --> 23:02.720]  Okay.
[23:02.720 --> 23:06.720]  What I'm really looking for is just a summary.
[23:06.720 --> 23:09.720]  There's, for example, four tickets.
[23:09.720 --> 23:17.720]  Sheet belt tickets, speeding tickets, stop light tickets, and stop sign ticket.
[23:17.720 --> 23:20.720]  You went through a stop sign.
[23:20.720 --> 23:27.720]  What is the best way, if you can summarize the best way to defend against each one of those,
[23:27.720 --> 23:32.720]  I'm looking for as many defenses as I can find.
[23:32.720 --> 23:40.720]  The ticket is insufficient on the streets because it doesn't mention commercial operator or private operator.
[23:40.720 --> 23:46.720]  It's also insufficient as an instrument of let's see.
[23:46.720 --> 23:51.720]  Okay. Each state is somewhat different.
[23:51.720 --> 23:56.720]  If you go to my traffic ticket website, which I haven't worked on a long time,
[23:56.720 --> 24:04.720]  it's primarily written for Texas, but most of the motions will apply in any case.
[24:04.720 --> 24:09.720]  For the most part, the traffic courts could care less about law.
[24:09.720 --> 24:14.720]  For the most part, the traffic courts are about collecting money.
[24:14.720 --> 24:17.720]  It's all about collecting money.
[24:17.720 --> 24:35.720]  So you are a pro se litigant on the average 73% of all the people who get a ticket to pay it.
[24:35.720 --> 24:39.720]  Don't come to court. They don't do anything. They just write a check.
[24:39.720 --> 24:45.720]  27% don't. Those 27% file an objection and they come to court.
[24:45.720 --> 24:55.720]  Well, the courts tend to just, they order them to come to a hearing and they send them in front of a prosecutor.
[24:55.720 --> 25:00.720]  And 99% of the people who come before the prosecutor make a deal.
[25:00.720 --> 25:09.720]  So the courts are very good at forcing people who get a ticket to just make a deal and pay the bills.
[25:09.720 --> 25:18.720]  When someone doesn't, when you're, if you're one of those 1% who actually less than 1%,
[25:18.720 --> 25:26.720]  about one tenth of a 1% who actually fights your case, they don't care.
[25:26.720 --> 25:30.720]  They don't care what the law is. They don't care what's right or wrong.
[25:30.720 --> 25:39.720]  They want you to pay the bill and this nonsense of having to hold an actual trial and go through all this due process.
[25:39.720 --> 25:43.720]  Nonsense is a waste of their time.
[25:43.720 --> 25:48.720]  They get frustrated. They get annoyed at you no matter what you file with them.
[25:48.720 --> 25:52.720]  They just blow it off. They don't care.
[25:52.720 --> 25:58.720]  Pay me the money or we're going to beat you up. That's the deal.
[25:58.720 --> 26:04.720]  So your only advantage is that you are a pro se litigant.
[26:04.720 --> 26:08.720]  You don't have a bar card. They can steal from you.
[26:08.720 --> 26:18.720]  You don't have to answer to the judge. The judge has to answer to you and they really have no way of handling you if you know how to fight them.
[26:18.720 --> 26:25.720]  So, the point you should file this, that or the other, heck it don't make any difference.
[26:25.720 --> 26:29.720]  File anything you can. File a whole stack of them.
[26:29.720 --> 26:39.720]  File a special appearance, a challenge subject matter jurisdiction, an in limiting motion, a demand for discovery,
[26:39.720 --> 26:42.720]  a preservation of rights, a mother hubbard motion.
[26:42.720 --> 26:50.720]  File a demand for an examining trial or preliminary hearing. If it's in New York, they'll call it a preliminary hearing.
[26:50.720 --> 26:54.720]  And then when they don't hold that, then file criminally against the judge.
[26:54.720 --> 26:58.720]  File a bar grievance against the lawyer every time he speaks.
[26:58.720 --> 27:04.720]  File a professional conduct complaint against the police officer.
[27:04.720 --> 27:10.720]  Whether your complaints are valid or invalid, heck it doesn't make any difference.
[27:10.720 --> 27:17.720]  They'll sting them just the same. Use the same technique they use against you.
[27:17.720 --> 27:27.720]  Their technique against you is to wear you down and make it not worth your time trying to fight these tickets.
[27:27.720 --> 27:31.720]  So, we turn that around on them.
[27:31.720 --> 27:39.720]  We throw a bunch of stuff at them to make it not economically feasible to prosecute you.
[27:39.720 --> 27:50.720]  So, first thing to do is look at all of those motions and pleadings you would file in any court case.
[27:50.720 --> 27:55.720]  File them all. And then when the judge ignores them all, then file against the judge.

[28:12.720 --> 28:22.720]  What are they going to do when they start getting 2 or 3% of the people they write tickets to?
[28:22.720 --> 28:33.720]  Filing bar grievances, judicial conduct complaints, professional conduct complaints against the officer, criminal complaints with the district attorney
[28:33.720 --> 28:42.720]  and then against the district attorney for not prosecuting these guys and just making their lives miserable.
[28:42.720 --> 28:44.720]  What are they going to do?
[28:44.720 --> 28:52.720]  They're going to tell you you don't have a right to due process? Try that out guys. That becomes a federal issue.
[28:52.720 --> 29:01.720]  Didn't file against them with the local FBI. They really start giving them a problem.
[29:01.720 --> 29:09.720]  So, at the end of the day there's not one magic silver bullet.
[29:09.720 --> 29:16.720]  Stand up this way, wave your harms this way. Say this incandescentation and magically they all go away.
[29:16.720 --> 29:23.720]  There's not anything like that out there. These courts could care less what the law says.
[29:23.720 --> 29:31.720]  They're just there to collect your money. Not about the laws, about politics.
[29:31.720 --> 29:38.720]  So, turn that around on them. Go back after them.
[29:38.720 --> 29:46.720]  I know that's not as specific as you wanted to hear, John, but that's basically how we handle traffic jitters.

[29:49.720 --> 29:58.720]  Well, you did actually answer. What I had in mind was like when you go after the judge, there's different ways to go after the judge.

[34:26.720 --> 34:32.720]  I mean, more specifically than just taking these best of tasks.

[34:35.720 --> 34:44.720]  It's functional for input about a seat. If I were to go there and put in information about a seat belt ticket, would it be functional for that?
[34:44.720 --> 34:47.720]  Your traffic ticket.com website?
[34:47.720 --> 34:59.720]  Yes. Mostly these are written for Texas, but there are all of the motions and pleadings that do not mention Texas laws specifically.
[34:59.720 --> 35:25.720]  You can file, like a special appearance. Special appearance is valid in every state. Essentially, a special appearance is a challenge to the subject matter jurisdiction of the court claiming that while the court may have subject matter jurisdiction or may have jurisdiction over the subject matter,
[35:25.720 --> 35:39.720]  they don't have jurisdiction over the person. They lack in personum jurisdiction as the statutory scheme does not apply to the person.
[35:39.720 --> 35:48.720]  Then you have a mother Hubbard motion. That's one that demands all of your rights. You have a motion for speedy trial.
[35:48.720 --> 35:55.720]  A motion for preliminary hearing. Preliminary hearing is required in every state under Christine Pugh.
[35:55.720 --> 36:07.720]  The only things that probably wouldn't apply would be there's a criminal complaint against the officer, which you would have to convert to New York law.
[36:07.720 --> 36:15.720]  There is a subject matter jurisdiction challenge that's specific to Texas law.
[36:15.720 --> 36:23.720]  I'm thinking back, there's a couple others that specifically reference Texas law so they wouldn't be applicable.
[36:23.720 --> 36:38.720]  If you just look through the motions, you go to trafficticket.com website. You fill in your ticket information and then when you hit submit, it will take you to a page where you can download all these documents.
[36:38.720 --> 36:46.720]  They should all already be filled out based on your ticket information.
[36:46.720 --> 36:54.720]  Just look through them. Those that are specifically based on Texas law, you wouldn't file and you file all the rest of them.
[36:54.720 --> 37:02.720]  It doesn't matter what's in the motions. The judges are just going to blow them off. That's the idea.
[37:02.720 --> 37:12.720]  When they fail to rule on every issue in every motion, then you file against the judge.
[37:12.720 --> 37:22.720]  Bar grievances, judicial conduct complaints, criminal complaints, and just make their life a living hell.
[37:22.720 --> 37:29.720]  We'll do another show on all of the steps in going after them.
[37:29.720 --> 37:34.720]  But did you have something in mind other than that?
[37:34.720 --> 37:38.720]  Well, criminal complaints with the GA, is that the idea?
[37:38.720 --> 37:40.720]  Yeah.
[37:40.720 --> 37:57.720]  Accused the officer and the prosecuting attorney and the judge of exerting or purporting to exert an authority they didn't expressly have and in the process denied you full free access to your enjoyment of right.
[37:57.720 --> 38:06.720]  Most specifically, they failed to follow due process by doing this wrong or doing that wrong.
[38:06.720 --> 38:14.720]  And each failure to follow due process is not only a state crime, it's a federal crime.
[38:14.720 --> 38:31.720]  So then when the prosecuting attorney just blows it off, then you file against the prosecuting attorney for failing to perform his duty and enforcing law for exerting discretion when he didn't have discretion.
[38:31.720 --> 38:34.720]  What do you file it with against the DA?
[38:34.720 --> 38:50.720]  Grand jury. You file it with the, you file it at the address of the district attorney, but address the principal it's addressed to as a form of the grand jury.
[38:50.720 --> 39:09.720]  You always include a cover letter that requests that the foreman initial this document and send it back to you in the stamp self addressed envelope, or like Brett Fountain does, he includes a postcard.
[39:09.720 --> 39:13.720]  And that's the foreman to initial the postcard and send it back to it.
[39:13.720 --> 39:31.720]  When you don't get that initial by the grand jury and send back to you, then you have reasonable probable cause to believe that prosecuting attorney interfered with the public males, intercepted these complaints and secreted these government documents from the person or office it was directed to.
[39:31.720 --> 39:35.720]  And that's felony in most states.
[39:35.720 --> 39:37.720]  Then we dance.
[39:37.720 --> 39:50.720]  We don't have anything to do with a ticket anymore. It has to do with prosecutor not doing what it was required to do and gets deeper at each step.
[39:50.720 --> 40:07.720]  If I go to your website, which is traffic ticket website, I can do that. Will it give me, will it give me the paperwork like what you just said? I forgive me. This isn't medicine. I've done medicine for 59 almost 60 years.
[40:07.720 --> 40:18.720]  Okay. This is non medicine. It will when you hit the submit button, it'll take you to a page where you can download all these documents. You just click the documents and download them.
[40:18.720 --> 40:23.720]  They're already made out for the most part. All you got to do is sign them and send them.
[40:23.720 --> 40:28.720]  Do you need to fill out for a credit card or anything like that?
[40:28.720 --> 40:32.720]  No, don't charge for it. It's free.

[41:27.720 --> 41:32.720]  Most people, when it comes to law, they have no clues to what to do.
[41:32.720 --> 41:37.720]  So I put together the site so you don't have to know anything.

[41:44.720 --> 41:49.720]  Because at the end of the day, it's not about the law.
[41:49.720 --> 41:54.720]  It's not about whether or not these documents are valid.
[41:54.720 --> 42:00.720]  It's about a court system that's only there to collect money.
[42:00.720 --> 42:11.720]  And you file all of these documents in order to have the prosecuting attorney read and respond to all of these documents.
[42:11.720 --> 42:20.720]  It's going to cost them money, cost them more to prosecute you than they could make in finding you.
[42:20.720 --> 42:27.720]  So they're just going to ignore all the law relating to them and just deny everything.
[42:27.720 --> 42:32.720]  The problem is, if the judge has a duty to determine the facts in accordance with the rules of evidence,
[42:32.720 --> 42:35.720]  then apply the laws that comes to him to the facts in the case.
[42:35.720 --> 42:39.720]  When he fails to do that, he denies you in due process.
[42:39.720 --> 42:43.720]  Now you've just upped the stakes on the judge.
[42:43.720 --> 42:53.720]  The judge will think that you just filed these because some jerk in Texas with a website created these documents
[42:53.720 --> 42:57.720]  so that they could harass the poor mistreated courts with.
[42:57.720 --> 43:08.720]  Well, take them a little bit to realize that you created all these documents to set the court up to do exactly what they do.
[43:08.720 --> 43:11.720]  They refuse to properly rule on your motions.
[43:11.720 --> 43:17.720]  Now you have real valid criminal complaints to make against the court
[43:17.720 --> 43:25.720]  that has nothing to do with whether or not you violated a traffic law.
[43:25.720 --> 43:30.720]  Right. We're going to know that these laws will apply to New York State.
[43:30.720 --> 43:33.720]  How am I going to tell that it's not a Texas thing?
[43:33.720 --> 43:38.720]  If it doesn't speak to Texas law.
[43:38.720 --> 43:41.720]  So if it doesn't say anything about Texas law, then I can use it.
[43:41.720 --> 43:43.720]  Absolutely.

[48:36.720 --> 48:43.720]  And we've got one council member who's the Mayor Pro Tem who always likes to come on and try to answer those things.
[48:43.720 --> 48:45.720]  And so I had posted something.
[48:45.720 --> 48:48.720]  Okay, wait, wait, you're talking about Facebook?
[48:48.720 --> 48:51.720]  Okay.
[48:51.720 --> 48:57.720]  And so he likes to get an answer and then some people will ask for it.
[48:57.720 --> 49:07.720]  Well, it got pretty heated and he was like, well, if you don't think we're doing any good, then we can just forego mediation and, you know, anyway.
[49:07.720 --> 49:14.720]  Because we're supposed to be going to mediation November 2nd, but I still haven't paid my money yet.
[49:14.720 --> 49:22.720]  The reason why I haven't is because about, I don't know, two hours later, I think I had fallen asleep, Laura had gone to Texas.
[49:22.720 --> 49:26.720]  She came back. She said, let me read something to you.
[49:26.720 --> 49:43.720]  A friend of ours who's trying to get on council, I guess had called him or messaged him and said, listen, up until now, you have not been liable for anything that has happened.
[49:43.720 --> 49:50.720]  But now that you know all the facts, you have opened yourself up to a lawsuit.
[49:50.720 --> 49:59.720]  And I don't know if this one got him or not, but he sent her back a message and said, well, I'm going to see how good your persuasion skills are.
[49:59.720 --> 50:03.720]  See if you can get him to plead no contest.
[50:03.720 --> 50:14.720]  We will drop the $80,000 judgment at District Court against him, and he'll pay an original $800 fine.
[50:14.720 --> 50:22.720]  And then we keep all of his papers in a file on record at City Hall.
[50:22.720 --> 50:29.720]  And so I thought, hey, that doesn't sound real bad, but, you know, what's the catch?
[50:29.720 --> 50:35.720]  So I basically said, yeah, sure, see what you can put together.
[50:35.720 --> 50:39.720]  Well, he's supposed to have an emergency meeting.
[50:39.720 --> 50:45.720]  He's been trying to get everybody together and have to get 72-hour notice.
[50:45.720 --> 50:48.720]  And then it's just going to be the council.
[50:48.720 --> 50:56.720]  And he's basically already got the, I keep saying basically, I tell my kids not to say that, the majority vote.
[50:56.720 --> 50:59.720]  Okay, but everybody has to be there.
[50:59.720 --> 51:14.720]  So when we do this, the question I have is, how am I going to plead no contest to a municipal judgment that was never really adjudicated,
[51:14.720 --> 51:21.720]  but the 60-day time limit is over, and then they took and sued me at Civil Court.
[51:21.720 --> 51:32.720]  Is this going to be worth the paper it's written on, or is it just going to be a contract between us to make them go away and I go away?
[51:32.720 --> 51:37.720]  It's just going to be a contract between you to make them go away and you go away.
[51:37.720 --> 51:45.720]  Well, I'm not really pleading no contest to anything, because that has to be a trial setting, doesn't it?
[51:45.720 --> 51:50.720]  No, you can plead no contest without a trial.
[51:50.720 --> 51:52.720]  And without a judge?
[51:52.720 --> 51:54.720]  Yes.
[51:54.720 --> 51:55.720]  Okay.
[51:55.720 --> 51:57.720]  And that's what they try to get you to do.
[51:57.720 --> 52:04.720]  If you get a ticket, 73% of all the people who get a ticket plead no contest.
[52:04.720 --> 52:06.720]  They just write a check and send to them.
[52:06.720 --> 52:08.720]  They don't have to enter a plea, they don't have to do anything.
[52:08.720 --> 52:10.720]  It's just over and done with.
[52:10.720 --> 52:13.720]  And that's what they're asking you to do.
[52:13.720 --> 52:21.720]  Well, Lauren brought up something that they had this Tufta deal in the district court.
[52:21.720 --> 52:28.720]  She was wondering if we should have something in there that says, hey, you dropped all of that stuff, you know, so they did.
[52:28.720 --> 52:32.720]  That's what Tufta is, that's what all that's about.
[52:32.720 --> 52:34.720]  They've agreed to drop everything.
[52:34.720 --> 52:35.720]  Yeah.
[52:35.720 --> 52:36.720]  Okay.
[52:36.720 --> 52:43.720]  If they drop the claim, then they can't talk about Tufta, they can't talk about anything.
[52:43.720 --> 52:44.720]  Right.
[52:44.720 --> 52:54.720]  And they've agreed to drop the claim as long as they're dropping their side, you drop your side, you pay in our bucks, this all goes away.
[52:54.720 --> 52:56.720]  Yeah, they say all suits.
[52:56.720 --> 52:57.720]  That's kind of it.
[52:57.720 --> 52:58.720]  All suits.
[52:58.720 --> 52:59.720]  That's okay.

[53:00.720 --> 53:07.720]  There's nothing in there saying that you agree not to sue in the future for issues not now before the court.

[53:08.720 --> 53:09.720]  Okay.
[53:09.720 --> 53:20.720]  And they have no standing to reference a suit against the law firm.
[53:20.720 --> 53:22.720]  Yeah.
[53:22.720 --> 53:43.720]  Because the law firm is a separate entity from them, you've already accused the law firm of baritry and where your city council member or your person who is trying to get back on the council was referring to and addressing the council was the fact that
[53:43.720 --> 53:56.720]  baritry had been committed, you know, the whole time you were trying to drive a wedge between the council and their council and council.
[53:56.720 --> 54:07.720]  I got confused with my own language between a wedge between the city council and the city council's council, the city council's lawyers.
[54:07.720 --> 54:08.720]  Yeah.
[54:08.720 --> 54:11.720]  And that's exactly what you've done.
[54:11.720 --> 54:15.720]  The city's agreeing to come back and make a deal to drop everything.
[54:15.720 --> 54:24.720]  And it appears clear that the lawyers are not included in what's going on here.
[54:24.720 --> 54:25.720]  They didn't ask the lawyers.
[54:25.720 --> 54:27.720]  They're not including the lawyers.
[54:27.720 --> 54:32.720]  They're trying to get themselves out from in front of this freight train.
[54:32.720 --> 54:48.720]  And we've said in the past that this is there's a light at the end of the tunnel and does the city council understand that that light at the end of the tunnel is a freight train coming right at them.
[54:48.720 --> 54:56.720]  I think at this point they realize that that light at the end of the tunnel is a freight train coming right at them.
[54:56.720 --> 54:58.720]  And they want to derail this freight train.
[54:58.720 --> 55:00.720]  They want all this to go away.

[01:04:05.720 --> 01:04:29.720]  The one question I have is the attorneys took every time that I had ever had anything, a letter or anything written to me, even if it didn't name vehicles, but then they took every time that I'd had a vehicle that was unregistered.
[01:04:29.720 --> 01:04:49.720]  I guess people were keeping up with it how many days it was there, but I had never been cited on any of those cases, but they used them in court to try to exaggerate the fine to make it look like I was just a habitual criminal.
[01:04:49.720 --> 01:05:14.720]  If they didn't find me, I had asked Eddie on his webpage and he said that no, they can't use those things against you unless it's actual convictions and that's only for, I can't remember what he said exactly, but they used it against me in the court.
[01:05:14.720 --> 01:05:31.720]  And for that, as soon as you get the city to write you some kind of deal, then the door is open for going after these lawyers for their improper behavior big time.
[01:05:31.720 --> 01:05:44.720]  You can challenge them, you can bargree them for each one of those, and we've already talked about what bar grievances do to attorneys, then you can sue them. That goes to slander.
[01:05:44.720 --> 01:05:50.720]  They were real comfortable in doing it, so it's not like I'm the only guy they've ever done this to.

[01:06:27.720 --> 01:06:42.720]  Information requests structured in such a way that the city on receiving the information requests will look at the request and say, why is he asking for this information?

[01:06:47.720 --> 01:07:10.720]  And you want to ask your question, make your request in a way that when they ask themselves why is he asking for this kind of information, their answer will be that he's expecting to find improprieties on part of the lawyers that could reflect back on us.

[01:07:14.720 --> 01:07:22.720]  And then if you, and we will be looking for consistency in this bad behavior.
[01:07:22.720 --> 01:07:35.720]  And then you send the subpoena to the mayor of each one of these cities, you want them to testify to the behavior of their law firm.
[01:07:35.720 --> 01:07:44.720]  In a lawsuit against their law firm for improper behavior while representing a city.
[01:07:44.720 --> 01:07:57.720]  Let's assume you're the mayor of a small municipality, and you get called to testify about the behavior of your law firm that you employ.
[01:07:57.720 --> 01:08:05.720]  You have to take off work, you have to go down and swear on an oath before a court to tell the truth.
[01:08:05.720 --> 01:08:08.720]  And you have to testify about the behavior of your law firm.
[01:08:08.720 --> 01:08:13.720]  How happy are you going to be with that law firm?
[01:08:13.720 --> 01:08:16.720]  The law firm works at the pleasure of the city.
[01:08:16.720 --> 01:08:21.720]  You don't have to accuse the law firm of anything concerning that city.
[01:08:21.720 --> 01:08:24.720]  They're not going to care.
[01:08:24.720 --> 01:08:32.720]  But ultimately the council is responsible for the behavior of their attorney.
[01:08:32.720 --> 01:08:35.720]  That's what it's good to say to the mayor.
[01:08:35.720 --> 01:08:41.720]  These guys think my law firm has acted inappropriately elsewhere.
[01:08:41.720 --> 01:08:46.720]  Now they're coming here to find out if they've acted inappropriately here.
[01:08:46.720 --> 01:08:50.720]  That's going to get us sued.
[01:08:50.720 --> 01:08:56.720]  Consider it, Tim, you hire a contractor.
[01:08:56.720 --> 01:09:07.720]  And after you've hired the contractor and used the contractor, somebody subpoenaes you into court to talk about the behavior of the contractor.
[01:09:07.720 --> 01:09:12.720]  How happy are you going to be with that contractor?
[01:09:12.720 --> 01:09:18.720]  It depends on the job that he's done for me.
[01:09:18.720 --> 01:09:21.720]  Is it?
[01:09:21.720 --> 01:09:25.720]  You're having to go to court and testify under oath.
[01:09:25.720 --> 01:09:38.720]  You're having to take off work, take off your normal business and go down to court and be sworn under oath and testify before a court because of your contractor.
[01:09:38.720 --> 01:09:43.720]  If it's me, I'm not going to want that to happen to me again.
[01:09:43.720 --> 01:09:49.720]  I'm going to find me another contractor that doesn't get me hauled into court.
[01:09:49.720 --> 01:10:03.720]  Well, I think ultimately it goes back to the first rattle out of the box the prosecutor takes and has me agree to an administrative hearing behind closed doors.
[01:10:03.720 --> 01:10:15.720]  And then it takes me out to the court, which is it to health and safety hazard, which ups the fine 10 times the amount possibility.
[01:10:15.720 --> 01:10:26.720]  This is information you get to air in front of all of these other cities that hire this law firm.
[01:10:26.720 --> 01:10:34.720]  Well, the judge has a law practice over in River Oaks, and I'm thinking about it.
[01:10:34.720 --> 01:10:46.720]  He's a judge in a lot of places, so he does this probably for his extra cash now, so he don't have to work in courts so much as an attorney.
[01:10:46.720 --> 01:10:52.720]  He's only doing this because he's not the sharpest knife in the drawer.
[01:10:52.720 --> 01:10:56.720]  Well, he's close to retirement.
[01:10:56.720 --> 01:11:04.720]  Yeah, but if he was the sharpest knife in the drawer, he'd have plenty of money to retire on by now.
[01:11:04.720 --> 01:11:12.720]  But he's close to retirement and he's still running around to local municipalities, grubbing for dollars.
[01:11:12.720 --> 01:11:19.720]  Yeah, I just have so many questions that I don't think anybody can answer because I've asked them so many times.
[01:11:19.720 --> 01:11:26.720]  You know, how can a judge just take and change it like that on his own?
[01:11:26.720 --> 01:11:28.720]  The criminals.
[01:11:28.720 --> 01:11:33.720]  That's the answer I get, but nobody's going to jail.
[01:11:33.720 --> 01:11:37.720]  Well, how many criminal charges have you filed against the judge to this point?

[01:11:39.720 --> 01:11:44.720]  Do you expect him to go to jail just automatically?

[01:12:25.720 --> 01:12:43.720]  My hardest part in all of this has been to stay concentrated on what I'm supposed to study so that it fills my head with stuff other than confusion because there's just, there's so many things that they did that people say they can't do that.

[01:12:46.720 --> 01:12:48.720]  So you take them one at a time.

[01:12:50.720 --> 01:13:05.720]  If you sue the lawyers and they wind up coming to the table making you an offer that you absolutely can't refuse and you get the check from them, then you sit down and decide, do I want to go after this judge now?

[01:13:06.720 --> 01:13:10.720]  And from my position, it's your duty to go after the judge.
[01:13:10.720 --> 01:13:18.720]  So you have more than two years after the fact?

[01:13:29.720 --> 01:13:43.720]  So you can't be expected to go after a judge who's still in office because he can use his power to protect himself. And this was a case out of Chicago where the feds went after a judge for 20 years of bad behavior.
[01:13:43.720 --> 01:13:59.720]  And he said, well, this exceeds statute limitations and what the Supreme said was in a public official, when he's in office, he's in a position to protect himself using the trappings of his office.
[01:13:59.720 --> 01:14:04.720]  So the clock doesn't start running until he leaves office.
[01:14:04.720 --> 01:14:06.720]  Okay.
[01:14:06.720 --> 01:14:14.720]  But well, it's almost time for the break, so you better get to your other guys. They're probably wondering what I'm going to get off here anyway, so.

[01:14:39.720 --> 01:14:51.720]  The appeal, I feel, I appealed, let me learn how to speak, to the circuit court, which is the next level, then it goes to the appellate, then to the Supreme, State Supreme.
[01:14:51.720 --> 01:14:54.720]  Okay, what was the nature of the cases?
[01:14:54.720 --> 01:14:57.720]  Mr. Mayors.
[01:14:57.720 --> 01:15:03.720]  Okay, so they were, were they originally tried in like a JP Court or a municipal court?
[01:15:03.720 --> 01:15:05.720]  No, County Court.
[01:15:05.720 --> 01:15:08.720]  Okay, so they started out in the county, okay?
[01:15:08.720 --> 01:15:11.720]  Yeah, County Court of Record.
[01:15:11.720 --> 01:15:20.720]  And while one of them was expired tags, greater than six months or excess tags, I'm in Florida.
[01:15:20.720 --> 01:15:28.720]  The guilty did not have one slip of paper saying I had expired tags or anything. No evidence whatsoever.
[01:15:28.720 --> 01:15:35.720]  But anyway, the judge fined me in both those cases.
[01:15:35.720 --> 01:15:40.720]  The fines amounted to between the two of them, $590.
[01:15:40.720 --> 01:15:44.720]  The court cost brought it up to about 1100 total.
[01:15:44.720 --> 01:15:47.720]  He said, I'll give you a year to pay.
[01:15:47.720 --> 01:15:50.720]  That year has passed.
[01:15:50.720 --> 01:15:56.720]  Now, as soon as you appeal a case, the County Court loses all jurisdiction.
[01:15:56.720 --> 01:16:01.720]  Yeah, that time to pay stops when you appeal.
[01:16:01.720 --> 01:16:02.720]  Right.
[01:16:02.720 --> 01:16:04.720]  Clock stops.
[01:16:04.720 --> 01:16:09.720]  I basically got a demand letter from the, from the clerk.
[01:16:09.720 --> 01:16:12.720]  The clerk handles the county and the circuit.
[01:16:12.720 --> 01:16:18.720]  And it's all in the same building, in the Trump building downtown.
[01:16:18.720 --> 01:16:22.720]  I got a demand letter from them saying, you know, I had a year to pay.
[01:16:22.720 --> 01:16:24.720]  It's delinquent.
[01:16:24.720 --> 01:16:28.720]  We're going to give you another 30 days for a second notice.

[01:23:57.720 --> 01:24:01.720]  They have a computer system there.
[01:24:01.720 --> 01:24:06.720]  They have a, what's it called, a CMS, a customer management system.
[01:24:06.720 --> 01:24:16.720]  And the customer management system looks in the books and they say you were fined X amount of dollars, you were given Y amount of time to pay that fine.
[01:24:16.720 --> 01:24:30.720]  It checks the accounting to see if what the balance on the fine is, if the balance on the fine is in excess of a certain amount, spit out this letter and send it to the guy.
[01:24:30.720 --> 01:24:38.720]  What they didn't have was a section that says this is an appeal so delay all actions.
[01:24:38.720 --> 01:24:44.720]  If they had it, the computer didn't read it and they sent this letter out.
[01:24:44.720 --> 01:24:48.720]  Probably nobody has any idea this letter was sent out.
[01:24:48.720 --> 01:24:50.720]  The computer did it.
[01:24:50.720 --> 01:24:52.720]  I agree.

[01:25:21.720 --> 01:25:34.720]  And in effect they exerted or purported to exert an authority they did not express they have and in the process denied you in full free access to or enjoyment of a right.

[01:25:40.720 --> 01:25:47.720]  I can't, I can't find half the things that all those nice things they have in Texas to go after them.

[01:49:59.720 --> 01:50:08.720]  The statement was written as a general statement to how and what all occurred.
[01:50:08.720 --> 01:50:12.720]  The court did this.
[01:50:12.720 --> 01:50:15.720]  The prosecutor did this.
[01:50:15.720 --> 01:50:20.720]  He committed this act against me in violation of this statute.
[01:50:20.720 --> 01:50:27.720]  And I went down through all of the things and listed all of the criminal actions they committed.
[01:50:27.720 --> 01:50:33.720]  Then I went back and took a criminal complaint form and went down the affidavit.
[01:50:33.720 --> 01:50:43.720]  And when I get to the first part where I make a criminal accusation, I cut that out of the statement and drop it into the criminal complaint.
[01:50:43.720 --> 01:50:57.720]  So that when they read the statement and then they go back and read the criminal complaint, they will see what's in the criminal complaint and realize this came out of the affidavit.
[01:50:57.720 --> 01:51:02.720]  And it'll be clear where it came out of the affidavit.
[01:51:02.720 --> 01:51:08.720]  So it places the criminal accusation in the context of the story.
[01:51:08.720 --> 01:51:13.720]  So they read the story and then they read the complaint and it reinforces the story.
[01:51:13.720 --> 01:51:15.720]  And I walked down.
[01:51:15.720 --> 01:51:21.720]  You'll see how I use that to walk down all of the criminal accusations that are committed.
[01:51:21.720 --> 01:51:25.720]  I filed 35 criminal complaints in this case.
[01:51:25.720 --> 01:51:33.720]  And if you just send them 35 criminal complaints, you're just going to sound like, you know, you're just PO and you're trying to beat them up.
[01:51:33.720 --> 01:51:48.720]  But if you give them a statement that walks down chronologically each accusation, when it occurred, how it occurred, and then you write the criminal complaint based on that same statement,
[01:51:48.720 --> 01:52:00.720]  you reinforce for the grand jury or whoever's reading this, what went wrong, how it went wrong, and how this complaint is valid and in context.
[01:52:00.720 --> 01:52:02.720]  Does that make sense?
[01:52:02.720 --> 01:52:14.720]  So my question is, do I need to get this appeal reversed, you know, my everything reversed on appeal first, or do I want to file these complaints with the grand jury, federal, or state?
[01:52:14.720 --> 01:52:20.720]  I'm going to say that criminal is totally separate from civil.
[01:52:20.720 --> 01:52:21.720]  Yes.
[01:52:21.720 --> 01:52:22.720]  Okay.
[01:52:22.720 --> 01:52:29.720]  Get those criminal complaints filed because that poisons the well for all of them.
[01:52:29.720 --> 01:52:31.720]  Okay.
[01:52:31.720 --> 01:52:38.720]  I mean, I'm having trouble finding the state grand jury where they're sitting in my state.
[01:52:38.720 --> 01:52:43.720]  Finally, I can find it like walking to the federal courthouse and there's a calendar on the wall.
[01:52:43.720 --> 01:52:51.720]  For the state, though, I call around to different districts and they say it's secret and, you know, and they only, they don't hold special, they only hold special settings.
[01:52:51.720 --> 01:52:52.720]  They don't.
[01:52:52.720 --> 01:52:53.720]  Who cares?
[01:52:53.720 --> 01:52:54.720]  This is, okay.
[01:52:54.720 --> 01:53:02.720]  At the end of the day, it's not so important that you actually get in front of the grand jury.
[01:53:02.720 --> 01:53:08.720]  The most important thing is making grand jury noises.
[01:53:08.720 --> 01:53:10.720]  The general then?
[01:53:10.720 --> 01:53:21.720]  When you get in front of the grand jury, 99% of the time the prosecutor is going to talk the grand jury into not inditing when it goes to a public official.
[01:53:21.720 --> 01:53:22.720]  Yes.
[01:53:22.720 --> 01:53:31.720]  What is more powerful is not getting in front of the grand jury, but the specter of getting in front of the grand jury.
[01:53:31.720 --> 01:53:44.720]  You realize and I realize that for the most part grand juries are not going to indict public officials, especially when they have the appearance of acting within the scope of their authority.
[01:53:44.720 --> 01:53:45.720]  We know that.
[01:53:45.720 --> 01:53:49.720]  But these public officials don't necessarily know that.
[01:53:49.720 --> 01:53:59.720]  They're going to be terrified that the grand jury is going to have somebody on it that feels like they got screwed over by the legal system.
[01:53:59.720 --> 01:54:00.720]  Yep.
[01:54:00.720 --> 01:54:02.720]  And what if that happens?
[01:54:02.720 --> 01:54:05.720]  And they decide to take it out on me.
[01:54:05.720 --> 01:54:11.720]  People will tend to anticipate absolutely the worst.
[01:54:11.720 --> 01:54:19.720]  So making grand jury noises is often as good if not better than actually getting in front of the grand jury.
[01:54:19.720 --> 01:54:22.720]  I'm just having trouble being able to do that.
[01:54:22.720 --> 01:54:23.720]  I can't.
[01:54:23.720 --> 01:54:25.720]  That's even better.
[01:54:25.720 --> 01:54:36.720]  Let these guys, you send it to the address, your complaint to the grand jury and send it to the district attorney's address.
[01:54:36.720 --> 01:54:46.720]  And put your letter in there that says that we have sometimes have trouble with prosecuting attorneys shielding criminal complaints against public officials from the grand jury.
[01:54:46.720 --> 01:54:53.720]  So in order to be sure that you receive this, will you initial this document and send it back to me?
[01:54:53.720 --> 01:55:13.720]  When you don't get that document in the stamp self-addressed envelope that you included, then you have reasonable probable cause to believe that prosecuting attorney secreted your complaint from the grand jury by interfering with the U.S. mail 13.
[01:55:13.720 --> 01:55:19.720]  13, 18 U.S. Code 1341.
[01:55:19.720 --> 01:55:27.720]  So if the grand jury is sending in a different district than I send it to, will they forward it to that district?
[01:55:27.720 --> 01:55:30.720]  Well, that's a good question.
[01:55:30.720 --> 01:55:43.720]  And the question I have been raising to prosecuting attorneys is while a district judge generally impanels a grand jury,
[01:55:43.720 --> 01:55:52.720]  the district judges all now, we don't have circuit judges that ride circuits anymore, they all have venues.
[01:55:52.720 --> 01:55:58.720]  This district judge handles this location, this one handles this location, they don't travel around anymore.
[01:55:58.720 --> 01:56:02.720]  So the judges are restricted to a specific venue.
[01:56:02.720 --> 01:56:13.720]  And while they impanel a grand jury, I can find no similar venue jurisdiction on a grand jury.
[01:56:13.720 --> 01:56:15.720]  Think about that.
[01:56:15.720 --> 01:56:18.720]  The district judge is a state judge.
[01:56:18.720 --> 01:56:22.720]  He has general jurisdiction over the entire state.
[01:56:22.720 --> 01:56:30.720]  But they got so many people and so many judges, they didn't have to travel around the state anymore, so they just stayed in one place.
[01:56:30.720 --> 01:56:36.720]  That state judge impanels a state grand jury.
[01:56:36.720 --> 01:56:45.720]  There is nothing in law that I can find that restricts a grand jury to a venue.
[01:56:45.720 --> 01:56:48.720]  Okay, so then how do I get to a complaint to them?
[01:56:48.720 --> 01:56:50.720]  I can send it to any district?
[01:56:50.720 --> 01:56:53.720]  Okay, any grand jury in the state.
[01:56:53.720 --> 01:56:55.720]  But I can't find them.
[01:56:55.720 --> 01:56:57.720]  They won't give me that information.
[01:56:57.720 --> 01:57:01.720]  It doesn't matter, district attorney's office.
[01:57:01.720 --> 01:57:07.720]  You presume the district attorney's address is the grand jury address and send it there.
[01:57:07.720 --> 01:57:15.720]  The state district attorney or the county, I mean like two counties, this is like district four and then next to me is Omaha, Nebraska and that's another.
[01:57:15.720 --> 01:57:22.720]  Okay, in Nebraska, are misdemeanors subject to indictment?
[01:57:22.720 --> 01:57:25.720]  Ah, yes.
[01:57:25.720 --> 01:57:29.720]  Then a county grand jury, a county attorney is fine.
[01:57:29.720 --> 01:57:31.720]  It doesn't matter in any case.
[01:57:31.720 --> 01:57:36.720]  You send it to a county attorney, you send it to a county attorney's office address to the grand jury.
[01:57:36.720 --> 01:57:40.720]  If he doesn't forward it to the grand jury, wonderful.
[01:57:40.720 --> 01:57:41.720]  That's what you want.
[01:57:41.720 --> 01:57:45.720]  Then you charge him with obstruction.
[01:57:45.720 --> 01:57:52.720]  Separate criminal complaints separate from any issues you may have before the court has nothing to do with that.
[01:57:52.720 --> 01:58:00.720]  If he didn't maintain, he had noticed that a crime had been committed and he failed to forward the notice to the proper entity charge him.
[01:58:00.720 --> 01:58:05.720]  Now you got somebody who's essentially innocent of anything going on.
[01:58:05.720 --> 01:58:08.720]  Now he's being charged because of you guys over in that county.
