[01:43.360 --> 01:46.840]  President Trump tweeted today, Wednesday, that if, quote, Russia vows to shoot down
[01:46.840 --> 01:51.200]  any and all missiles fired at Syria, get ready, Russia, because they will be coming in nice

[01:52.920 --> 01:56.480]  Going on to warn Russia that you shouldn't be partners with a gas-killing animal who
[01:56.480 --> 01:58.600]  kills his people and enjoys it.
[01:58.600 --> 02:02.640]  Many in the West, including President Trump, have been quick to conclude that this chemical
[02:02.640 --> 02:06.880]  attack must have been conducted by Assad and his forces.
[02:06.880 --> 02:11.080]  Syria and Russia, on the other hand, have given approval since yesterday for the organization
[02:11.080 --> 02:15.640]  for the prohibition of chemical weapons to investigate the sign of the chemical slaughter.
[02:15.640 --> 02:19.400]  Assad has been successful in maintaining rule and support during Syria's seven-year civil
[02:19.400 --> 02:24.000]  war, a civil war that is being fought by the government of Syria and anti-Assad Syrian
[02:24.000 --> 02:28.800]  rebels that are openly being funded by Western governments, with ISIS being one of the more
[02:28.800 --> 02:32.520]  notorious splinter groups of the American-backed Syrian rebels.
[02:32.520 --> 02:37.880]  No surprise then why Russian Foreign Minister Spokeswoman Maria Zakoba posted on Facebook
[02:37.880 --> 02:42.200]  that smart missiles should be fired at terrorists and not at a legitimate government, which
[02:42.200 --> 02:47.120]  has been fighting terrorists, or is this a trick to destroy all traces with a smart missile
[02:47.120 --> 02:54.120]  strike, and then there will be no evidence for international inspectors to look at.

[04:06.120 --> 04:09.920]  And I'll start the show with a little update.
[04:09.920 --> 04:23.600]  We are working on a questionnaire for the Securities Exchange Commission statutes, and
[04:23.600 --> 04:31.920]  you know I had helped someone a few years ago with a SEC issue, and this is where the
[04:31.920 --> 04:43.120]  SEC came in after the state had ruled that what he was doing was not selling securities,
[04:43.120 --> 04:48.840]  and but what he was doing was undermining the insurance industry.
[04:48.840 --> 04:57.720]  Actually, he wasn't selling anything he was buying, what he was doing was buying insurance
[04:57.720 --> 04:58.720]  policies.
[04:58.720 --> 05:09.200]  You see, the life insurance industry has this calculation that people buy life insurance,
[05:09.200 --> 05:11.280]  especially whole life.
[05:11.280 --> 05:18.080]  Now term insurance is not as much of a scam, but whole life insurance is totally a scam.
[05:18.080 --> 05:25.160]  The whole life insurance you pay for it's your whole life, and the calculation is, is
[05:25.160 --> 05:30.680]  that when people get old, the kids grow up, they get out on their own, the kids don't
[05:30.680 --> 05:38.200]  need, they don't need money for the kids in case they pass away, and they get their house
[05:38.200 --> 05:44.760]  paid for, they don't have the bills they once had, but they also don't have the income
[05:44.760 --> 05:51.440]  they had either, so their need for life insurance decreases, and so is their income, and the
[05:51.440 --> 05:59.160]  calculation is, is that most of these people, once they get old and their income decreases
[05:59.160 --> 06:04.760]  substantially, the first thing they'll stop paying is life insurance, and they drop the
[06:04.760 --> 06:11.160]  policy, the insurance company collects all that money, they don't have to pay anything.
[06:11.160 --> 06:17.120]  So this guy come along and started buying their insurance policy, and he would pay them
[06:17.120 --> 06:23.480]  so much a month as long as they lived, and pay the insurance premium, but when they passed
[06:23.480 --> 06:30.120]  away he would be the beneficiary, so now the life insurance companies were in a position
[06:30.120 --> 06:38.360]  where they had to pay the life insurance premium off, so they sick the SEC on them, and even
[06:38.360 --> 06:45.000]  though they had already been sued by the state of Texas, and the state of Texas in the suit
[06:45.000 --> 06:52.880]  determined that they were not selling securities, the SEC simply did not care.
[06:52.880 --> 06:57.960]  They came after him anyway, well someone brought me in and they paid me to do an evaluation,
[06:57.960 --> 07:00.400]  and I gave him one.
[07:00.400 --> 07:09.600]  There were three owners to this company, the main guy was in Waco, and one guy was in California,
[07:09.600 --> 07:14.360]  and I don't remember where their third one was, I gave him the evaluation, I sat down
[07:14.360 --> 07:20.320]  with the guy in Waco in front of his lawyer and told him his lawyer was stealing from
[07:20.320 --> 07:29.320]  him, his lawyer had already charged him $200,000 on this case, that from the look of things
[07:29.320 --> 07:35.280]  the lawyer was going to push his bill up to $2 million and then throw him under the bus,
[07:35.280 --> 07:41.840]  that what he should do immediately is file a challenge to subject matter jurisdiction
[07:41.840 --> 07:49.680]  because the matter has already been adjudicated, it is resjudicata, the SEC has no power to
[07:49.680 --> 07:52.920]  reopen this issue.
[07:52.920 --> 07:58.840]  Well his lawyer, I thought in the meeting his lawyer was going to get up and take a
[07:58.840 --> 08:07.160]  swing at me, and I certainly gave him the option, but he decided not to take it, when
[08:07.160 --> 08:14.720]  I called him a two-bit shyster, but he talked this guy out of filing a subject matter jurisdiction
[08:14.720 --> 08:20.560]  challenge, the guy in California, he filed a subject matter jurisdiction challenge and
[08:20.560 --> 08:28.080]  the SEC dropped his case immediately, they dropped the charges, the claims against him,
[08:28.080 --> 08:36.880]  this guy they took everything, they bankrupted him, anyway it still frustrates me even when
[08:36.880 --> 08:37.880]  I think about it.
[08:37.880 --> 08:43.560]  I just talked to some people at the SEC and mentioned that I was building a questionnaire
[08:43.560 --> 08:48.840]  so people could tell when they were in compliance with the law because they said well they could
[08:48.840 --> 08:54.440]  talk to a lawyer, a lawyer is a full of crap and they are for sale to you guys, and he
[08:54.440 --> 08:57.720]  said well I don't know what do you mean, I said lawyer is not going to do anything to
[08:57.720 --> 09:06.080]  annoy you and you are not going to do anything to annoy big money politics.
[09:06.080 --> 09:13.480]  So the SEC is bought and paid for and we need a way to assure compliance regardless of what
[09:13.480 --> 09:19.000]  a regulator says, because as far as I'm concerned you guys are bought and paid for and I mentioned
[09:19.000 --> 09:23.720]  the case in Waco and he knew the case as soon as I mentioned it, I couldn't remember the
[09:23.720 --> 09:29.720]  guy's name but this guy did, and he said are you saying we were bought off, I said absolutely
[09:29.720 --> 09:36.800]  we were bought off, he acted like he wanted to get upset, well I act with you, I don't
[09:36.800 --> 09:42.160]  care if you're upset or not, guys are lying thieves and we need a protection against you
[09:42.160 --> 09:50.960]  and that's what this tool is designed to do so that when the SEC comes in and starts
[09:50.960 --> 09:55.560]  saying you're violating this rule or that rule or the other, they'll have evidence,
[09:55.560 --> 09:59.920]  they'll know what the rule is because they can go through the questionnaire and sort
[09:59.920 --> 10:04.280]  it all out and have a way to go right back after them.
[10:04.280 --> 10:09.840]  So we have that one coming together and it's also for the investors that we're trying to
[10:09.840 --> 10:16.280]  seek, it's a proof of concept and it's a proof of concept in an area these guys will be very
[10:16.280 --> 10:23.320]  familiar with, in an area that for them is a very complex and mysterious area for the
[10:23.320 --> 10:28.600]  most part because most of these guys do not understand the securities laws and there's
[10:28.600 --> 10:31.520]  a good reason for that.
[10:31.520 --> 10:37.960]  The SEC laws, the way they're written are absolutely impossible for a normal human being
[10:37.960 --> 10:40.560]  to understand.
[10:40.560 --> 10:51.880]  A start out under regulation A, first paragraph refers to two other sections in the code, the
[10:51.880 --> 10:59.040]  first one of those sections refers to a third section in the code and I have to branch out
[10:59.040 --> 11:01.360]  to those sections and go through them.
[11:01.360 --> 11:10.800]  I had about 25 questions in the questionnaire before I got past the first paragraph.
[11:10.800 --> 11:16.520]  Human beings can't formulate that kind of complexity.
[11:16.520 --> 11:20.800]  I mean you can read it but there's no way you can make sense of it unless you read it
[11:20.800 --> 11:28.160]  and read it and reread it and study it and most people don't do that.
[11:28.160 --> 11:34.800]  There was a recent shutdown by the SEC of a company called Munshi and it had to do with
[11:34.800 --> 11:42.560]  food, people evaluating restaurants and they went to their lawyers, showed them their plan
[11:42.560 --> 11:48.920]  and the lawyers approved their plan, assured them that they fell within the SEC guidelines,
[11:48.920 --> 11:54.880]  they started their ICO sale the second day the SEC shut them down.
[11:54.880 --> 12:03.760]  I looked at their white paper, I am not an SEC lawyer but two paragraphs into the white
[12:03.760 --> 12:11.480]  paper it was absolutely abundantly clear that these guys what they were doing would fall
[12:11.480 --> 12:14.520]  within the SEC code.
[12:14.520 --> 12:18.280]  So what the heck was going on?
[12:18.280 --> 12:23.920]  How did they go to a lawyer and a lawyer look at this and say oh no this is a utility token,
[12:23.920 --> 12:27.920]  you don't fall within the SEC regs.
[12:27.920 --> 12:35.640]  They just don't know what's going on or they don't care.
[12:35.640 --> 12:39.120]  So you have to be able to do it yourself and we're getting this tool designed for you,

[13:20.840 --> 13:26.560]  major that I wanted to talk to was gone, he was out of his office, apparently a bunch
[13:26.560 --> 13:31.200]  of them were gone, Austin and Dallas doing something, blah, blah, blah.
[13:31.200 --> 13:37.280]  So I was going to talk to the secretary, in fact the receptionist there, the receptionist
[13:37.280 --> 13:44.680]  and DPS officer up there when I walked into the door and they were kind of being a little
[13:44.680 --> 13:49.520]  bit short and trying to run a little bit of a shotgun, you know, saying what are you here
[13:49.520 --> 13:50.520]  for?
[13:50.520 --> 13:57.280]  You know, and I told them I got criminal complaints and the DPS officer, which was a female, said
[13:57.280 --> 14:03.120]  oh well you know, you're supposed to submit those to the local police, I said yeah, I've
[14:03.120 --> 14:05.480]  already done that, that ain't working.
[14:05.480 --> 14:11.000]  So I need to speak to the ranger and the receptionist, well do you have an appointment?
[14:11.000 --> 14:16.560]  I was like I've called several times for the past two weeks and all of a sudden I can't
[14:16.560 --> 14:23.040]  get a call back from the ranger, so I guess I'll just have to speak to the secretary and
[14:23.040 --> 14:29.320]  so she says okay and then calls the secretary and so I start talking to the secretary and
[14:29.320 --> 14:35.440]  they're kind of noticing there's something a little bit weird about this and so the secretary
[14:35.440 --> 14:39.280]  I said I need you to come up here and I got criminal complaint.
[14:39.280 --> 14:45.160]  She's like hold on, I found the ranger to come up there, will this female ranger come
[14:45.160 --> 14:52.600]  up there and she's kind of asking me so what can I help you with, so I got criminal complaint
[14:52.600 --> 14:57.760]  that will, you know, you're supposed to send those, you're supposed to take those to the
[14:57.760 --> 15:01.240]  local law enforcement, I said yeah, that's not going to work.
[15:01.240 --> 15:08.440]  I said these complaints have, I'm going to have to submit these to the public integrity
[15:08.440 --> 15:09.440]  unit.
[15:09.440 --> 15:14.440]  She was like public integrity and I said yeah and she goes well who are these complaints
[15:14.440 --> 15:15.440]  on?
[15:15.440 --> 15:16.440]  I said district attorney.
[15:16.440 --> 15:24.280]  She was like oh okay and I said I'll just give you and you can take the complaints and
[15:24.280 --> 15:25.280]  then you can go follow.
[15:25.280 --> 15:29.960]  Oh no I can't take them, I was like oh yes you can't and she's like no I know I can't
[15:29.960 --> 15:35.400]  take them, these are on, this is the attorney, we're going to have a conflict of interest

[15:37.320 --> 15:42.840]  I said well you need to go get me and she rattled off this person's name and I said
[15:42.840 --> 15:48.360]  well I need to, you know, get that name and I asked her for a business card, she was like
[15:48.360 --> 15:53.280]  well I don't normally work here, I don't have a business card for this address, just
[15:53.280 --> 15:59.440]  hang on, she ran off and she came back a couple minutes later and she had an address to this
[15:59.440 --> 16:10.120]  guy, Scotty Schreiber, major Scotty Schreiber and I said okay and she said well what are
[16:10.120 --> 16:14.680]  these criminal complaints about and so I pulled them out of my pocket by the end because I've
[16:14.680 --> 16:18.800]  already, I now have them in my hand and I was trying to hand them to her, she didn't
[16:18.800 --> 16:25.120]  want to take them at first and then I said well you know these complaints are on district
[16:25.120 --> 16:30.480]  attorneys and I guess it intrigued her just enough, she says let me see it, so I handed
[16:30.480 --> 16:35.640]  it to her and I said now you got them, you can take them, you know, oh hang on, she started
[16:35.640 --> 16:40.520]  reading this for a little bit, I said well what are these about, I said denying access
[16:40.520 --> 16:48.360]  to the grand jury, there are all their faces in the room dropped, there's a music.

[21:01.800 --> 21:08.040]  All three of them's face seemed to fall, and she kind of got nervous now at this point,
[21:08.040 --> 21:13.840]  and it was yes, sir, no, sir, and everybody quit getting cocky and started being a little
[21:13.840 --> 21:21.600]  bit more defensive and very quiet now because I've got a little spiral notebook and I'm
[21:21.600 --> 21:26.280]  sitting there making notes and getting their names and writing all this stuff down right
[21:26.280 --> 21:33.280]  in front of them, and they're like, this guy's got your normal bird coming in here raising
[21:33.280 --> 21:40.080]  sand, and so I'm just sitting there and I'm not saying much at all, but I'm just asking
[21:40.080 --> 21:45.920]  real poignant questions, and exactly once she grabbed ahold of those and read them and
[21:45.920 --> 21:53.280]  then told me, oh, I can't take these because that would be a conflict of interest, I said,
[21:53.280 --> 21:54.280]  oh really?
[21:54.280 --> 22:01.320]  And she said, yeah, do you have to send them to that Scotty Shriver down there in Austin
[22:01.320 --> 22:07.760]  at the PIU unit and gave me the address and everything for that, and I thought, okay,
[22:07.760 --> 22:13.640]  so I walked on out of there and immediately came home and wrote up a criminal complaint
[22:13.640 --> 22:24.160]  on the director of the Texas Ranger, Stephen McCross, for ordering his quisling, Sergeant
[22:24.160 --> 22:33.000]  Simmons, to refuse to take a criminal complaint and follow Article 2.13 of the Texas Criminal
[22:33.000 --> 22:34.000]  Code.
[22:34.000 --> 22:37.360]  So that's the one I got set up to mail out tomorrow.
[22:37.360 --> 22:42.880]  I've been busy writing several of these things up, so I got the address, I'm going to send
[22:42.880 --> 22:49.560]  this to the major that I originally went to go see, Major Casper over there in Garland,
[22:49.560 --> 22:55.600]  and he can open this up and read a criminal complaint on his boss and see how they like.

[23:47.160 --> 23:51.600]  like 40, 50 pages, and then you got to make 13 copies and send it off.
[23:51.600 --> 23:53.600]  So it cost me a dog going near $100.
[23:53.600 --> 23:58.840]  Well, by the time I got done with the printer and they told me how much it cost, and then
[23:58.840 --> 24:06.280]  I was hopping mad now, so I came home and found the Texas Rangers website special unit.
[24:06.280 --> 24:13.080]  And so I sent an email to them with the criminal complaints attached, and naturally it'll generate
[24:13.080 --> 24:15.320]  an auto response.
[24:15.320 --> 24:22.400]  So now I'm writing up an information request to Major Shriver asking what magistrate he
[24:22.400 --> 24:29.160]  presented these criminal complaints that were submitted on August 22nd, since you have obviously

[27:33.720 --> 27:37.720]  I was like, oh, she's running for reelection.
[27:37.720 --> 27:42.320]  I wonder who her opponent is.
[27:42.320 --> 27:48.400]  So it was like I called and told you about it, guys, but I thought, oh man, all I need
[27:48.400 --> 27:54.880]  to do is find out all the candidates that are running and find the candidate that's running
[27:54.880 --> 28:01.480]  against her because she's an incumbent and give him a copy of these criminal complaints
[28:01.480 --> 28:09.040]  and see if he could use those as cannon fodder to go after them and hopefully, you know,
[28:09.040 --> 28:13.320]  they could unseat them from that position.
[28:13.320 --> 28:20.640]  So I found all this information out on the State Secretary website, Secretary of State
[28:20.640 --> 28:25.320]  website, and I was really shocked, especially for Dallas.
[28:25.320 --> 28:33.440]  I didn't realize that almost everybody running, so everybody in the criminal courts, JP courts
[28:33.440 --> 28:40.320]  and all this other stuff, they're running all Democrats unopposed, so they're automatically
[28:40.320 --> 28:47.960]  elected and basically 60% of the field is Republican compared to Democrats.
[28:47.960 --> 28:53.200]  So there's a lot of Democrats that are running around here, so it's going to be interesting
[28:53.200 --> 28:59.360]  to see if I can actually find some Republicans that are actually running against these people
[28:59.360 --> 29:05.440]  because I have a sneaky suspicion there's nobody running against them, and that would
[29:05.440 --> 29:06.640]  be kind of a bummer.
[29:06.640 --> 29:15.960]  So I kind of defeated that little plan, but anyhow, so the next step is just to start
[29:15.960 --> 29:21.960]  putting some of these into grand jury and probably over in Wise County and see if we

[29:28.400 --> 29:34.720]  here around election time and really cause a stink for everybody.

[34:08.800 --> 34:15.080]  it was not in his county because the judge was over in Dallas County.
[34:15.080 --> 34:20.160]  So already have a criminal complaint that could technically be wrote up against the
[34:20.160 --> 34:27.520]  foreman of the grand jury and stick it over there to Wise County and to wake him up real
[34:27.520 --> 34:29.120]  good.
[34:29.120 --> 34:33.680]  That might be the best first one you could file.
[34:33.680 --> 34:39.240]  Just go ahead and file that one and we get that into works.
[34:39.240 --> 34:43.000]  And now Wise County already knows this argument.
[34:43.000 --> 34:48.520]  They don't know who sent that to them.
[34:48.520 --> 34:57.840]  And we'll see if they can find a statute or case law which limits the grand jury to a
[34:57.840 --> 35:08.680]  specific venue because I can't and I've certainly looked for it.

[35:34.760 --> 35:40.840]  That's like the Supreme Court in Texas for criminal because Texas has two high courts.
[35:40.840 --> 35:46.400]  This is the only state I know of that has a separate high court for criminal and civil.
[35:46.400 --> 35:49.880]  Supreme does thrill, court of appeals does criminal.
[35:49.880 --> 35:55.600]  But court of appeals, court of appeals does both.
[35:55.600 --> 36:02.520]  And we're filing a petition for rid of mandamus with the court of appeals asking them to order
[36:02.520 --> 36:09.840]  the prosecuting attorney to act in accordance with article 2.03 code of criminal procedure
[36:09.840 --> 36:19.000]  which has been in law virtually unchanged since 1876.
[36:19.000 --> 36:25.440]  Not like it's something new guys and it's very clear in law what the prosecutor is to
[36:25.440 --> 36:32.720]  do in the special case of a complaint against a public official.
[36:32.720 --> 36:38.360]  And then we start filing in different counties.
[36:38.360 --> 36:44.000]  It's appropriate because you're filing against a prosecuting attorney.
[36:44.000 --> 36:49.440]  So you wouldn't want to file with a grand jury that's prosecuting attorney goes before
[36:49.440 --> 36:52.320]  on a regular basis.
[36:52.320 --> 36:57.880]  So you file with a different grand jury that doesn't know this prosecutor and then let
[36:57.880 --> 37:03.960]  them try to argue their way into some kind of venue.
[37:03.960 --> 37:06.320]  That's my story and I'm sticking to it.
[37:06.320 --> 37:07.320]  Right.
[37:07.320 --> 37:08.320]  Right.
[37:08.320 --> 37:09.320]  Well, that's all.
[37:09.320 --> 37:17.160]  Well, I got one other thing is I got an appeal for a cop that was over at Mesquite and I

[37:25.640 --> 37:31.920]  What Scott's talking about is a civil suit that he filed against these public officials.
[37:31.920 --> 37:37.720]  And as is consistent, the Court of Appeals just throws it out.
[37:37.720 --> 37:43.760]  So he's asking the Court of Appeals to reconsider in bank that he can do and then you're going
[37:43.760 --> 37:45.360]  to attach a criminal complaint.
[37:45.360 --> 37:46.360]  Go ahead.
[37:46.360 --> 37:47.360]  Yeah, exactly.
[37:47.360 --> 37:49.360]  That's where I was going next.
[37:49.360 --> 37:55.640]  I'm going to attach 24 criminal complaints that are relevant to the case so they can
[37:55.640 --> 38:00.920]  touch the tar baby and then as soon as they decide they don't want to do anything with
[38:00.920 --> 38:05.760]  the criminal complaints, file criminal complaints on all of them and send it up to the Texas
[38:05.760 --> 38:10.920]  Supreme Court and just start trapping them all as we go.
[38:10.920 --> 38:19.000]  Yeah, I suspect when we start hammering the Court of Appeals judges, they're going to
[38:19.000 --> 38:28.200]  take a lot closer look because from the district court level up, these guys are very political.
[38:28.200 --> 38:31.440]  Now not in small counties.
[38:31.440 --> 38:37.480]  The issue Scott talked to earlier is a common issue in smaller counties.
[38:37.480 --> 38:45.160]  The last district judge we had for 20 years never, ever had anybody run against them.
[38:45.160 --> 38:49.920]  It's hard to find people who want to be district judges.
[38:49.920 --> 38:57.560]  There ain't more money lawyers than to do district judges and they don't work as hard.
[38:57.560 --> 39:02.200]  So why somebody would want to be a district judge other than to get people to call him
[39:02.200 --> 39:07.560]  your honor and get the opportunity to push lawyers around, I don't know.
[39:07.560 --> 39:13.560]  It's certainly not a good financial move and it seems like that's why we get so many old
[39:13.560 --> 39:20.480]  judges because they're ready to retire in their practice and now they feel like they're
[39:20.480 --> 39:24.440]  the mentors for everybody else and now's a good time to be a judge.
[39:24.440 --> 39:30.200]  But in these smaller counties, they can't get people to run.
[39:30.200 --> 39:36.080]  It's a concern and it's been a concern for me for a long time and the judge we had prior
[39:36.080 --> 39:39.720]  to this wasn't a trial lawyer.
[39:39.720 --> 39:41.480]  He couldn't make it as a trial lawyer.
[39:41.480 --> 39:45.280]  He just did backside research and documentation.
[39:45.280 --> 39:50.040]  So we're not getting the best quality as judges.
[39:50.040 --> 39:57.880]  Anyway, go ahead, but oh, I'm sorry, what I was saying was the political, as you move
[39:57.880 --> 40:02.040]  into the bigger jurisdictions, you've got a lot more competition for the judge position.
[40:02.040 --> 40:07.080]  There's a lot more guys there to pay you off, so there's more money to be made.
[40:07.080 --> 40:15.240]  And when you move up above the trial court judge level, now there's a lot of competition
[40:15.240 --> 40:18.480]  for those places, a lot of politics going on.
[40:18.480 --> 40:24.240]  Now, when you start filing criminal charges against these judges and they know they're
[40:24.240 --> 40:31.720]  going to run for office again and good chance their opponent will drag out those criminal
[40:31.720 --> 40:38.840]  charges and wave them in front of the public, they're going to say, well, those were frivolous.
[40:38.840 --> 40:45.680]  But the public's going to say, well, it doesn't look good, guys.
[40:45.680 --> 40:52.200]  After all, perception is everything, Kim's rule.
[40:52.200 --> 40:55.400]  There's spires.
[40:55.400 --> 40:57.880]  That's the thought.
[40:57.880 --> 41:01.240]  Always where there's sparks, somewhere there's something going on.
[41:01.240 --> 41:09.960]  These guys didn't just file those frivolously, they had a reason, so it poisons their will.
[41:09.960 --> 41:17.520]  And when we start poisoning the will of the Court of Appeals judges, this stuff rolls
[41:17.520 --> 41:22.840]  downhill, not uphill, so they've got to put you back.
[41:22.840 --> 41:26.400]  Well, just to confirm what you're saying, then I'll let you go so you can get to the
[41:26.400 --> 41:27.560]  next caller.
[41:27.560 --> 41:32.560]  When you look down the list of all these people that are running, according to the Secretary
[41:32.560 --> 41:39.080]  of State, all the high positions, they all have a Republican Democrat and a Libertarian.
[41:39.080 --> 41:43.760]  But once you start going down the list, you start seeing that fade off where there's all
[41:43.760 --> 41:45.880]  of a sudden no more Libertarians.
[41:45.880 --> 41:49.560]  And then you fade off, go down a little bit further, there's no more Republicans than
[41:49.560 --> 41:54.880]  they should have straight Democrats all the way that rested down in the lower ranks.
[41:54.880 --> 41:58.000]  So that definitely confirms exactly what you're saying.
[41:58.000 --> 42:00.640]  There's more competition in the higher ranks, though.
[42:00.640 --> 42:06.640]  It will poison the will, but we'll just have to see how it rolls out.

[42:56.280 --> 43:02.040]  You know, I've sat on the show for a long time, it is the duty of the judge to determine
[43:02.040 --> 43:05.360]  the facts in accordance with the rules of evidence that apply the laws that comes to
[43:05.360 --> 43:07.880]  him to the facts in the case.
[43:07.880 --> 43:13.000]  Failure to do so is a denial of due process, and that's exactly what Jockwell and V Chambers
[43:13.000 --> 43:14.000]  says.
[43:14.000 --> 43:21.280]  It says the judge has no discretion in properly applying the law to the facts.
[43:21.280 --> 43:28.440]  Failure to do so is an abuse of discretion correctable by extraordinary writ, and that
[43:28.440 --> 43:33.520]  means habeas corpus or interlocutory appeal.
[43:33.520 --> 43:39.400]  But the way I read it, if that abuse of discretion denies a citizen full free access touring,
[43:39.400 --> 43:43.600]  so I'm going to write, well, that's defined somewhere else.
[43:43.600 --> 43:47.280]  That's defined in the People Code in the State of Texas, it's a class A misdemeanor.

[48:24.640 --> 48:25.640]  Yeah, that's what they were saying.
[48:25.640 --> 48:26.640]  There's just over 50 votes
[48:26.640 --> 48:29.640]  and somebody won by one vote.
[48:29.640 --> 48:31.640]  You had how many people show up
[48:31.640 --> 48:33.640]  at this meeting?
[48:33.640 --> 48:35.640]  40.
[48:35.640 --> 48:39.640]  I had 40 to show up on our behalf
[48:39.640 --> 48:41.640]  with printed signs
[48:41.640 --> 48:44.640]  that someone donated
[48:44.640 --> 48:47.640]  and the council members had to walk the gauntlet
[48:47.640 --> 48:49.640]  to get into the building
[48:49.640 --> 48:50.640]  of them chanting,
[48:50.640 --> 48:53.640]  drop the lawsuit,
[48:53.640 --> 48:55.640]  stop wasting our money
[48:55.640 --> 49:01.640]  and fire the administrator.
[49:01.640 --> 49:05.640]  You know, I've been telling Tim and Laura
[49:05.640 --> 49:09.640]  for a long time that things really don't work the way
[49:09.640 --> 49:13.640]  they teach you that it does in high school.
[49:13.640 --> 49:18.640]  And it doesn't work the way they show on television.
[49:18.640 --> 49:20.640]  There's a process here.
[49:20.640 --> 49:22.640]  And the first part of the process
[49:22.640 --> 49:25.640]  involves these guys coming after you
[49:25.640 --> 49:27.640]  and doing everything they can
[49:27.640 --> 49:29.640]  to wear you out
[49:29.640 --> 49:32.640]  and get you to give up and go away.
[49:32.640 --> 49:34.640]  And that is their strategy
[49:34.640 --> 49:36.640]  because they get to work
[49:36.640 --> 49:39.640]  with the government's money.
[49:39.640 --> 49:42.640]  They're not digging in their own pocket to pay for this.
[49:42.640 --> 49:45.640]  But if you can hold out
[49:45.640 --> 49:48.640]  and Tim and Laura has been wanting to go after them
[49:48.640 --> 49:50.640]  and defend themselves the whole time
[49:50.640 --> 49:52.640]  and I've asked them not to
[49:52.640 --> 49:56.640]  because anything you say in your defense
[49:56.640 --> 49:58.640]  becomes for them fair warning.
[49:58.640 --> 50:01.640]  And we have this rule, never give fair warning.
[50:01.640 --> 50:03.640]  If they're violating law,
[50:03.640 --> 50:06.640]  don't give legal advice.
[50:06.640 --> 50:09.640]  And they kept wanting to do something in their defense
[50:09.640 --> 50:11.640]  and it's natural to want to defend yourself
[50:11.640 --> 50:13.640]  because they're coming after you.
[50:13.640 --> 50:15.640]  And I kept asking them to hold off
[50:15.640 --> 50:18.640]  and they didn't want to and they were concerned
[50:18.640 --> 50:20.640]  but they did that.
[50:20.640 --> 50:23.640]  And then we reached that point in the case
[50:23.640 --> 50:27.640]  where they had done everything they could.
[50:27.640 --> 50:29.640]  They tried everything they could
[50:29.640 --> 50:32.640]  to get Tim and Laura to miss deadlines.
[50:32.640 --> 50:35.640]  They set hearings without consultation
[50:35.640 --> 50:37.640]  with the counsel on the other side
[50:37.640 --> 50:39.640]  and they set the hearings
[50:39.640 --> 50:42.640]  with the least possible amount of notice
[50:42.640 --> 50:45.640]  consistently.
[50:45.640 --> 50:47.640]  And generally you expect people
[50:47.640 --> 50:49.640]  when somebody does something improper
[50:49.640 --> 50:50.640]  to jump up and down
[50:50.640 --> 50:52.640]  and we're alien righteous indignation.
[50:52.640 --> 50:54.640]  Well, had they done that?
[50:54.640 --> 50:56.640]  The lawyers on the other side
[50:56.640 --> 50:58.640]  would just use that to paint them
[50:58.640 --> 51:01.640]  as radicals and reactionaries
[51:01.640 --> 51:05.640]  and liars and they use everything they say
[51:05.640 --> 51:07.640]  to discredit them.
[51:07.640 --> 51:09.640]  So they kept a little profile
[51:09.640 --> 51:12.640]  and then got right down
[51:12.640 --> 51:14.640]  to the last thing they could do.
[51:14.640 --> 51:16.640]  When we filed for a petition
[51:16.640 --> 51:18.640]  for Rid of Habeas Corpus,
[51:18.640 --> 51:20.640]  I'm sorry,
[51:20.640 --> 51:22.640]  we filed a petition for
[51:22.640 --> 51:25.640]  declared for a Rid of Mandamus
[51:25.640 --> 51:29.640]  and because the other side
[51:29.640 --> 51:32.640]  had acted so crappy
[51:32.640 --> 51:34.640]  the whole time
[51:34.640 --> 51:37.640]  and Tim and Laura gave them opportunity
[51:37.640 --> 51:40.640]  to screw up as much as they wanted to
[51:40.640 --> 51:43.640]  without any negative feedback
[51:43.640 --> 51:46.640]  that by the time it got to this petition
[51:46.640 --> 51:48.640]  for mandamus, it was clear
[51:48.640 --> 51:50.640]  that what these guys were doing
[51:50.640 --> 51:53.640]  was horribly improper.
[51:53.640 --> 51:56.640]  A Rid of Mandamus is only picked up
[51:56.640 --> 51:58.640]  accepted by the court of appeals
[51:58.640 --> 52:00.640]  in 12% of the cases
[52:00.640 --> 52:03.640]  and in 2% of the cases
[52:03.640 --> 52:07.640]  the courts rule in favor of the filer.
[52:07.640 --> 52:13.640]  They ruled in favor of a prosa filer.
[52:13.640 --> 52:17.640]  I can't find that this has ever happened before
[52:17.640 --> 52:19.640]  and that's because they looked at the case
[52:19.640 --> 52:21.640]  and said, you know, this is a mess,
[52:21.640 --> 52:23.640]  this is outrageous.
[52:23.640 --> 52:26.640]  So they gave a ruling
[52:26.640 --> 52:28.640]  and it looked to Tim and Laura
[52:28.640 --> 52:31.640]  as if they only got half a ruling
[52:31.640 --> 52:33.640]  in favor of the court
[52:33.640 --> 52:35.640]  only throughout half of what was there.
[52:35.640 --> 52:37.640]  But I looked at it and said,
[52:37.640 --> 52:39.640]  holy mackerel,
[52:39.640 --> 52:43.640]  they threw these guys under the bus
[52:43.640 --> 52:46.640]  big time
[52:46.640 --> 52:49.640]  because the original hearing
[52:49.640 --> 52:52.640]  first thing they did
[52:52.640 --> 52:54.640]  they adulterated the original hearing
[52:54.640 --> 52:56.640]  and we found a challenge
[52:56.640 --> 52:58.640]  to subject matter jurisdiction
[52:58.640 --> 53:00.640]  and demonstrated how they adulterated
[53:00.640 --> 53:02.640]  or the judge, the other side
[53:02.640 --> 53:04.640]  failed to respond to it
[53:04.640 --> 53:07.640]  we found a motion for summary judgment
[53:07.640 --> 53:13.640]  to which Tim and Laura had a statutory right.
[53:13.640 --> 53:15.640]  The other side didn't respond to that
[53:15.640 --> 53:18.640]  and the judge refused to hear it.
[53:18.640 --> 53:20.640]  So this allowed them to go on
[53:20.640 --> 53:24.640]  to all these civil actions and everything.
[53:24.640 --> 53:27.640]  Then the court of appeals came back
[53:27.640 --> 53:32.640]  and said that Tim and Laura was right.
[53:32.640 --> 53:35.640]  The original hearing was fraudulent.
[53:35.640 --> 53:38.640]  That meant that our accusations
[53:38.640 --> 53:41.640]  of baritry against the lawyers
[53:41.640 --> 53:44.640]  was rez judicata.
[53:44.640 --> 53:48.640]  We claimed that the lawyers
[53:48.640 --> 53:53.640]  advised the city to take this action,
[53:53.640 --> 53:55.640]  set this hearing
[53:55.640 --> 53:58.640]  and then the law firm
[53:58.640 --> 54:02.640]  got to represent the city in that hearing
[54:02.640 --> 54:05.640]  and they billed the city for their time.
[54:05.640 --> 54:07.640]  The court of appeals ruled
[54:07.640 --> 54:09.640]  that the hearing was illegal
[54:09.640 --> 54:12.640]  and void on its face.
[54:12.640 --> 54:17.640]  That makes the advice of the lawyer
[54:17.640 --> 54:20.640]  to the city to hold this hearing.
[54:20.640 --> 54:22.640]  Baritry.
[54:22.640 --> 54:25.640]  Texas is the only state that has
[54:25.640 --> 54:27.640]  actual baritry laws
[54:27.640 --> 54:29.640]  making it a crime.
[54:29.640 --> 54:33.640]  In Texas, baritry is a felony.
[54:33.640 --> 54:36.640]  So the lawyers for the city
[54:36.640 --> 54:38.640]  advised their client to take this action
[54:38.640 --> 54:41.640]  that was illegal.
[54:41.640 --> 54:44.640]  The reason it was illegal
[54:44.640 --> 54:49.640]  was very highly technical.
[54:49.640 --> 54:53.640]  They were prosecuting under the criminal laws
[54:53.640 --> 54:56.640]  but they also had an administrative law
[54:56.640 --> 54:59.640]  that can be used to prosecute
[54:59.640 --> 55:02.640]  these exact same claims
[55:02.640 --> 55:05.640]  under local government code chapter 54
[55:05.640 --> 55:09.640]  and they addressed their action
[55:09.640 --> 55:11.640]  under chapter 54.
[55:11.640 --> 55:13.640]  Well, the court of appeals came back
[55:13.640 --> 55:16.640]  with something we didn't know about
[55:16.640 --> 55:21.640]  that in order to prosecute under chapter 54
[55:21.640 --> 55:29.640]  the city council had to file a special action
[55:29.640 --> 55:33.640]  in the record claiming their intention
[55:33.640 --> 55:36.640]  to prosecute under the administrative code
[55:36.640 --> 55:38.640]  and stood in the criminal code.
[55:38.640 --> 55:40.640]  Now, they had filed that
[55:40.640 --> 55:45.640]  for situations concerning condemned buildings
[55:45.640 --> 55:49.640]  but they hadn't filed that for jumped vehicles.
[55:49.640 --> 55:52.640]  So the court of criminal appeals said
[55:52.640 --> 55:54.640]  you have no standing, you can't,
[55:54.640 --> 55:57.640]  you don't have authority to do this.
[55:57.640 --> 56:01.640]  And when I saw that, holy mackerel,
[56:01.640 --> 56:04.640]  they have thrown these guys under the bus.
[56:04.640 --> 56:06.640]  Big time.
[56:06.640 --> 56:11.640]  But they weren't done with their part yet.
[56:11.640 --> 56:15.640]  Once we got to the point of filing appeal
[56:15.640 --> 56:17.640]  they had done everything they could do.
[56:17.640 --> 56:21.640]  Now it's Laura and Tim's turn.
[56:21.640 --> 56:24.640]  In all of these cases the way it goes
[56:24.640 --> 56:30.640]  you have to keep your mind together
[56:30.640 --> 56:33.640]  and keep your determination together
[56:33.640 --> 56:36.640]  while they're pulling all this garbage
[56:36.640 --> 56:38.640]  until you get to appeal.
[56:38.640 --> 56:42.640]  Once you get to appeal, now you turn on them.
[56:42.640 --> 56:45.640]  And that's the term I've been using, the worm turns.
[56:45.640 --> 56:47.640]  This worm's just been crawling along
[56:47.640 --> 56:51.640]  taking all of their abuse, now it turns.
[56:51.640 --> 56:57.640]  And in Tim's case, I will have to tell you I am impressed.
[56:57.640 --> 57:04.640]  For all the misery that has been thrown at Tim and Laura
[57:04.640 --> 57:09.640]  it's my opinion that they gained something remarkable
[57:09.640 --> 57:12.640]  that few people ever know.
[57:12.640 --> 57:17.640]  Tim and Laura's got friends and they got lots of friends.
[57:17.640 --> 57:20.640]  You never know who your friends are
[57:20.640 --> 57:23.640]  until you're in a spot.
[57:23.640 --> 57:27.640]  And in this case the city rose up
[57:27.640 --> 57:29.640]  and demonstrated to Tim and Laura,
[57:29.640 --> 57:32.640]  they didn't just raise up and complain,
[57:32.640 --> 57:34.640]  they reached in their pockets,
[57:34.640 --> 57:37.640]  they built these signs, they came out
[57:37.640 --> 57:40.640]  and stood in front of their officials
[57:40.640 --> 57:44.640]  and took personal action in their behalf.
[57:44.640 --> 57:49.640]  It's to me when I was put in jail in Cherokee County
[57:49.640 --> 57:53.640]  every day the guards would come to my cell
[57:53.640 --> 57:59.640]  and they couldn't push all the letters through the slot.
[57:59.640 --> 58:02.640]  And they treated me like I was a celebrity.
[58:02.640 --> 58:05.640]  Nobody wanted me upset at them
[58:05.640 --> 58:08.640]  because they knew this guy's got friends outside.
[58:08.640 --> 58:10.640]  You can't mess with him.
[58:10.640 --> 58:16.640]  And the city found out that Tim and Laura has friends
[58:16.640 --> 58:20.640]  and the friends are willing to stand up.
[58:20.640 --> 58:23.640]  I'm sorry, I stole your thunder there
[58:23.640 --> 58:27.640]  but this is an important part of these big cases
[58:27.640 --> 58:29.640]  where they come after you.

[01:07:10.640 --> 01:07:16.640]  and these courts count on people not having that kind of grit.
[01:07:16.640 --> 01:07:18.640]  When they got a hold of Tim and Laura,
[01:07:18.640 --> 01:07:22.640]  they got a hold of the wrong ones.
[01:07:22.640 --> 01:07:26.640]  Yeah, so what had happened was on Sunday
[01:07:26.640 --> 01:07:28.640]  my husband had a health incident
[01:07:28.640 --> 01:07:30.640]  and I told him, I said,
[01:07:30.640 --> 01:07:33.640]  we have to put this on Facebook, I'm sorry.
[01:07:33.640 --> 01:07:37.640]  I have to let them know where we're at and where we're living
[01:07:37.640 --> 01:07:40.640]  because we have a community Facebook.
[01:07:40.640 --> 01:07:43.640]  And when I posted that,
[01:07:43.640 --> 01:07:47.640]  I mean people begin to come out of the woodwork going,
[01:07:47.640 --> 01:07:52.640]  oh my lord, you didn't tell them what you posted.
[01:07:52.640 --> 01:07:55.640]  Hold on, let me tell them what you posted.
[01:07:55.640 --> 01:08:00.640]  Tim sent me an email and I opened that email
[01:08:00.640 --> 01:08:04.640]  and I was astounded at what I saw.
[01:08:04.640 --> 01:08:08.640]  I saw a page and a half of one paragraph.
[01:08:08.640 --> 01:08:10.640]  I read that page and a half.
[01:08:10.640 --> 01:08:14.640]  It was, I responded saying, what is this?
[01:08:14.640 --> 01:08:16.640]  This is a rant.
[01:08:16.640 --> 01:08:18.640]  It was disjointed.
[01:08:18.640 --> 01:08:20.640]  It was confused.
[01:08:20.640 --> 01:08:24.640]  And then Laura told me that Tim had had a grand mal seizure
[01:08:24.640 --> 01:08:29.640]  as a result of the stress of this incident.
[01:08:29.640 --> 01:08:35.640]  And then I said, holy crap, she posted that rant.
[01:08:35.640 --> 01:08:38.640]  I put on there that, no, no, I posted,
[01:08:38.640 --> 01:08:42.640]  all I posted, Randy, was I posted the prayers
[01:08:42.640 --> 01:08:46.640]  for the pixelers, no, I put an update on the pixelers.
[01:08:46.640 --> 01:08:50.640]  We need prayers that my husband had a grand mal seizure
[01:08:50.640 --> 01:08:52.640]  last night at 3 a.m.
[01:08:52.640 --> 01:08:56.640]  We were set to be depositioned on Monday.
[01:08:56.640 --> 01:08:58.640]  And my, I mean...
[01:08:58.640 --> 01:09:01.640]  Okay, this was the night before.
[01:09:01.640 --> 01:09:05.640]  This was, he sent you that the night before.
[01:09:05.640 --> 01:09:08.640]  And all I posted was that we needed prayer
[01:09:08.640 --> 01:09:11.640]  that Tim had had a seizure and that he had to be public.
[01:09:11.640 --> 01:09:14.640]  And people began to come out of the woodwork going,
[01:09:14.640 --> 01:09:16.640]  oh my God, let's pray.
[01:09:16.640 --> 01:09:18.640]  Gotta pray, gotta pray.
[01:09:18.640 --> 01:09:20.640]  Well, another lady that saw on this Facebook page
[01:09:20.640 --> 01:09:23.640]  that her friend contacted her and said,
[01:09:23.640 --> 01:09:25.640]  let me tell you something.
[01:09:25.640 --> 01:09:29.640]  Y'all can pat them, people on the back, all you want to.
[01:09:29.640 --> 01:09:32.640]  But until you step up and do something,
[01:09:32.640 --> 01:09:37.640]  you're a really crappy friend.
[01:09:37.640 --> 01:09:40.640]  And she went, oh my word.
[01:09:40.640 --> 01:09:42.640]  We gotta do something.
[01:09:42.640 --> 01:09:44.640]  So that was on Sunday.
[01:09:44.640 --> 01:09:49.640]  I get a phone call on Tuesday after four o'clock that said,
[01:09:49.640 --> 01:09:52.640]  the Wives County Messenger's written an article.
[01:09:52.640 --> 01:09:56.640]  They got it wrong, but they did write an article about your case.
[01:09:56.640 --> 01:09:59.640]  And it talked about our kissing council.
[01:09:59.640 --> 01:10:02.640]  It was labeled behind closed doors.
[01:10:02.640 --> 01:10:06.640]  The council meeting is held mostly behind executive sessions,
[01:10:06.640 --> 01:10:08.640]  something of that effect.
[01:10:08.640 --> 01:10:12.640]  There was a phone call on Tuesday that said it was after four.
[01:10:12.640 --> 01:10:16.640]  Look at this, we've created a rally.
[01:10:16.640 --> 01:10:18.640]  And they started inviting people.
[01:10:18.640 --> 01:10:24.640]  That was before the council meeting held on Wednesday night at 7 p.m.
[01:10:24.640 --> 01:10:29.640]  They called for a rally at 6.30.
[01:10:29.640 --> 01:10:36.640]  In that one 24-hour period, or 21 to 26 hours,
[01:10:36.640 --> 01:10:39.640]  people came forward to hold signs.
[01:10:39.640 --> 01:10:41.640]  And someone donated signs.
[01:10:41.640 --> 01:10:42.640]  They printed them.
[01:10:42.640 --> 01:10:43.640]  They looked very professional.
[01:10:43.640 --> 01:10:45.640]  They contacted the messenger.
[01:10:45.640 --> 01:10:47.640]  Got them there early.
[01:10:47.640 --> 01:10:49.640]  And they protested.
[01:10:49.640 --> 01:10:52.640]  And those council members had to go into that executive session
[01:10:52.640 --> 01:10:55.640]  that they called to discuss our case.
[01:10:55.640 --> 01:10:58.640]  And to discuss the firing of our administrator.
[01:10:58.640 --> 01:11:01.640]  They had to walk through the people chanting at them.
[01:11:01.640 --> 01:11:09.640]  Stop wasting our money, drop the lawsuits, fire Diane, stuff like that.
[01:11:09.640 --> 01:11:15.640]  Those were not very happy council members going through into that meeting.
[01:11:15.640 --> 01:11:19.640]  Five minutes before the meeting started, all of us went inside.
[01:11:19.640 --> 01:11:21.640]  We filled the room up.
[01:11:21.640 --> 01:11:27.640]  And I realized, Randy, how many friends we had.
[01:11:27.640 --> 01:11:32.640]  When I looked around that room and not one other person was there
[01:11:32.640 --> 01:11:38.640]  except the council member's daughter and the bailiff.
[01:11:38.640 --> 01:11:42.640]  And the rest of them were on our side.
[01:11:42.640 --> 01:11:46.640]  And they sat there while that council opened the meeting.
[01:11:46.640 --> 01:11:49.640]  And as they headed into the executive session,
[01:11:49.640 --> 01:11:55.640]  they began to chant at them again to drop the lawsuit, fire Diane,
[01:11:55.640 --> 01:11:57.640]  stop wasting our money.
[01:11:57.640 --> 01:11:59.640]  They went in the back chamber.
[01:11:59.640 --> 01:12:04.640]  They called the bailiff into the back chamber and to calm us down.
[01:12:04.640 --> 01:12:07.640]  They wanted things calm out there.
[01:12:07.640 --> 01:12:11.640]  You know, you can go outside and chant and wave your signs as you like.
[01:12:11.640 --> 01:12:14.640]  I mean, the officer was extremely kind.
[01:12:14.640 --> 01:12:21.640]  But he was being recorded also because they were doing it face to face.
[01:12:21.640 --> 01:12:25.640]  He said, you can continue recording, calm down.
[01:12:25.640 --> 01:12:28.640]  They stayed out two hours.
[01:12:28.640 --> 01:12:30.640]  And those people didn't leave.
[01:12:30.640 --> 01:12:33.640]  And they sat there until they came out.
[01:12:33.640 --> 01:12:37.640]  They voted to have another meeting to discuss the administrator.
[01:12:37.640 --> 01:12:39.640]  That's October 4th.
[01:12:39.640 --> 01:12:42.640]  And then they said when they announced that they're going to,
[01:12:42.640 --> 01:12:46.640]  they want to go to mediation with the pixelers.
[01:12:46.640 --> 01:12:51.640]  The ladies will form the rally, jumped on her feet and said,
[01:12:51.640 --> 01:12:53.640]  what on earth are you talking about?
[01:12:53.640 --> 01:12:56.640]  You're trying to get $80,000 out of these people.
[01:12:56.640 --> 01:12:58.640]  What more do you want?
[01:12:58.640 --> 01:13:01.640]  What is the exact dollar amount you're trying to get?
[01:13:01.640 --> 01:13:05.640]  And Andy Messer, the attorney says, ma'am, they can't talk to you.
[01:13:05.640 --> 01:13:07.640]  You have to, she's like, shut up.
[01:13:07.640 --> 01:13:09.640]  I'm not talking to you.
[01:13:09.640 --> 01:13:11.640]  These people, they can hear me.
[01:13:11.640 --> 01:13:13.640]  They don't have to speak.
[01:13:13.640 --> 01:13:16.640]  She said, oh, and by the way, I pay your salary.
[01:13:16.640 --> 01:13:20.640]  And I'm not planning to do that much longer.
[01:13:20.640 --> 01:13:24.640]  They just went all over these people.
[01:13:24.640 --> 01:13:28.640]  And she's holding, she said, we're going to be here next time
[01:13:28.640 --> 01:13:30.640]  with more people.
[01:13:30.640 --> 01:13:33.640]  We're going to be bigger and stronger.
[01:13:33.640 --> 01:13:37.640]  And we're not giving up until you drop this.
[01:13:37.640 --> 01:13:41.640]  And those council members barely got out the door to go home
[01:13:41.640 --> 01:13:45.640]  because the citizens were stopping them and getting their ears
[01:13:45.640 --> 01:13:47.640]  and telling them, you've got to stop this.
[01:13:47.640 --> 01:13:48.640]  We're sick of it.
[01:13:48.640 --> 01:13:50.640]  It's over.
[01:13:50.640 --> 01:13:54.640]  We want this done with, you know, so they were being,
[01:13:54.640 --> 01:13:58.640]  they weren't just patting us on the back anymore and saying,
[01:13:58.640 --> 01:14:01.640]  we're praying in little prayer hands on Facebook.
[01:14:01.640 --> 01:14:06.640]  No, these friends stepped up and said, we've had it.
[01:14:06.640 --> 01:14:12.640]  And so today has been really encouraging because we had support
[01:14:12.640 --> 01:14:16.640]  that we haven't had all these 18 months.
[01:14:16.640 --> 01:14:23.640]  Yes, and this is way beyond anything I expected.
[01:14:23.640 --> 01:14:26.640]  Well, I spent two hours talking to the messenger tonight
[01:14:26.640 --> 01:14:31.640]  and I was about three inches into the file box.
[01:14:31.640 --> 01:14:34.640]  And he, and you know, I have two of those.
[01:14:34.640 --> 01:14:39.640]  He was like, my God, when in this case did you realize
[01:14:39.640 --> 01:14:43.640]  that it was going to become bigger than a small thing
[01:14:43.640 --> 01:14:45.640]  that you thought it was going to be?
[01:14:45.640 --> 01:14:48.640]  And I said at the administrative hearing when I realized they
[01:14:48.640 --> 01:14:53.640]  stacked that board with people that had no intention
[01:14:53.640 --> 01:14:57.640]  of being fair and balanced and they had no intention
[01:14:57.640 --> 01:15:03.640]  of treating this like we deserve to be treated.
[01:15:03.640 --> 01:15:07.640]  And that man sat there as I went through the entire
[01:15:07.640 --> 01:15:10.640]  record after record after record of us trying to work
[01:15:10.640 --> 01:15:15.640]  with this council, us begging help from the administrators,
[01:15:15.640 --> 01:15:21.640]  from the mayor, from the pro tem, from everybody.
[01:15:21.640 --> 01:15:22.640]  I took him through.
[01:15:22.640 --> 01:15:25.640]  But you know what the kicker was when he got to the document
[01:15:25.640 --> 01:15:32.640]  where they said we did 5.304 million in code enforcement.
[01:15:32.640 --> 01:15:35.640]  That poor guy's eyes about bugs out of his head,
[01:15:35.640 --> 01:15:37.640]  he said you were kidding me ma'am.
[01:15:37.640 --> 01:15:38.640]  I said no sir.
[01:15:38.640 --> 01:15:41.640]  And I pulled that document out and laid it on the table.
[01:15:41.640 --> 01:15:44.640]  He just began to take pictures of those numbers.
[01:15:44.640 --> 01:15:47.640]  He said how much time did they spend to come up with
[01:15:47.640 --> 01:15:50.640]  1,000 for this one and 10,000 for this one
[01:15:50.640 --> 01:15:54.640]  and 4.9 million for this one and whatever.
[01:15:54.640 --> 01:15:59.640]  He was in shock.
[01:15:59.640 --> 01:16:03.640]  And that's what this case had become.
[01:16:03.640 --> 01:16:04.640]  So good.
[01:16:04.640 --> 01:16:10.640]  You may actually get a good article from the messenger.
[01:16:10.640 --> 01:16:14.640]  Clearly the politics has changed.
[01:16:14.640 --> 01:16:17.640]  And this is, you know, if anybody who's been listening

[01:21:25.640 --> 01:21:32.640]  And Judge Evans always rules against pro-Sahed litigants, period.
[01:21:32.640 --> 01:21:35.640]  The state of Texas, all the judges and lawyers,
[01:21:35.640 --> 01:21:37.640]  hate pro-Sahed litigants.
[01:21:37.640 --> 01:21:40.640]  And that's because right now 25% of the cases are handled
[01:21:40.640 --> 01:21:42.640]  by pro-Sahed litigants.
[01:21:42.640 --> 01:21:44.640]  We have too many lawyers in Texas.
[01:21:44.640 --> 01:21:46.640]  They're struggling to make a living.
[01:21:46.640 --> 01:21:47.640]  And then these guys come in pro-Sahed
[01:21:47.640 --> 01:21:49.640]  and don't bother to pay lawyers.
[01:21:49.640 --> 01:21:54.640]  So they're trying to give people a reason
[01:21:54.640 --> 01:21:56.640]  not to represent themselves by ruling
[01:21:56.640 --> 01:21:59.640]  against them out of hand at every turn.
[01:21:59.640 --> 01:22:02.640]  It may not be right, but that's how it works.
[01:22:02.640 --> 01:22:05.640]  And with the head administrative judge of the district,
[01:22:05.640 --> 01:22:11.640]  put in place to screw the pro-Sahed at every turn.
[01:22:11.640 --> 01:22:13.640]  That's what he's there for.
[01:22:13.640 --> 01:22:14.640]  That's what he's been doing.
[01:22:14.640 --> 01:22:19.640]  But in this case, the lawyer made some comment
[01:22:19.640 --> 01:22:21.640]  and Judge Evans said,
[01:22:21.640 --> 01:22:23.640]  one moment, counsel,
[01:22:23.640 --> 01:22:29.640]  you are not going to sad-bag these people in my court.
[01:22:29.640 --> 01:22:34.640]  I thought, what on earth is going on?
[01:22:34.640 --> 01:22:38.640]  Judge Evans of all people,
[01:22:38.640 --> 01:22:42.640]  he looked at this and he was offended by it.
[01:22:42.640 --> 01:22:45.640]  So if you've offended the head administrative judge
[01:22:45.640 --> 01:22:47.640]  of the district to the point
[01:22:47.640 --> 01:22:49.640]  that he will step right in the middle of you
[01:22:49.640 --> 01:22:52.640]  and open court,
[01:22:52.640 --> 01:22:55.640]  this is looking bad for everybody.
[01:22:55.640 --> 01:22:57.640]  And it was right after that
[01:22:57.640 --> 01:23:01.640]  that the court of appeals granted the...
[01:23:01.640 --> 01:23:02.640]  The mandamus.
[01:23:02.640 --> 01:23:05.640]  Yeah, the petition for rid of mandamus.
[01:23:05.640 --> 01:23:09.640]  And the way the court did that,
[01:23:09.640 --> 01:23:12.640]  they did it in a kind of a circumspectual way.
[01:23:12.640 --> 01:23:15.640]  They did it in a roundabout way.
[01:23:15.640 --> 01:23:18.640]  They didn't rule against them on any of the arguments
[01:23:18.640 --> 01:23:20.640]  that we brought.
[01:23:20.640 --> 01:23:23.640]  They come with their own argument.
[01:23:23.640 --> 01:23:29.640]  And how they found that is amazing to me.
[01:23:29.640 --> 01:23:31.640]  How did they find this minor,
[01:23:31.640 --> 01:23:35.640]  tiny little thing they could rule against them on?
[01:23:35.640 --> 01:23:38.640]  They didn't want to rule on the argument
[01:23:38.640 --> 01:23:41.640]  the prose made.

[01:40:38.640 --> 01:40:48.640]  So to rule that you can make no claim, you can't file an amended pleading and make a claim on which recovery can be had when undermined 200 years of law.

[01:48:47.640 --> 01:49:07.640]  Extensive, detailed, that walks through every violation they committed and how each of those violations stitched together one to the other to show how everything they did was patently illegal.
[01:49:07.640 --> 01:49:09.640]  I think we can get an indictment.
[01:49:09.640 --> 01:49:21.640]  Now, I don't think we'll get an indictment against the members of the administrative board because except for one of them maybe because they acted in good faith reliance on competent authority.
[01:49:21.640 --> 01:49:38.640]  This lawyer who told them what to do except we just got this from one of the administrative board members that Taylor Burton, one of the board members, when he suggested they charge $1,000 per violation.
[01:49:38.640 --> 01:49:47.640]  The lawyer advised against it and he insisted that they needed to teach him a lesson.
[01:49:47.640 --> 01:49:51.640]  So he did not follow the lawyer's advice.
[01:49:51.640 --> 01:49:59.640]  That means he doesn't have a claim of good faith reliance on competent authority.
[01:49:59.640 --> 01:50:08.640]  He could stand to fulfill any indictment along with the lawyers for acting in concert and collusion.
[01:50:08.640 --> 01:50:14.640]  This could get real ugly for him and it needs to.
[01:50:14.640 --> 01:50:18.640]  He was going against Pam, the lady that changed sides.
[01:50:18.640 --> 01:50:28.640]  She was saying it's too much money and Taylor told her we're going to go after them and make an example of them.

[01:52:52.640 --> 01:53:05.640]  But I want to discuss this letter that I received from the DA's office in response to two of my criminal complaints to the foreman of the grand jury.
[01:53:05.640 --> 01:53:19.640]  Let me just read the post off of the letter. It's only a one-page letter and it says, Dear Mr. Scarlett, I'm in receipt of your formal criminal claims against Sheriff Roy Smith and Rebecca Fleming.
[01:53:19.640 --> 01:53:24.640]  You sent to our office address to the criminal grand jury formal.
[01:53:24.640 --> 01:53:46.640]  It should be noted that the claim against Sheriff Roy Smith appears to be outside the statute of limitation. Notwithstanding, my understanding is document to you because the district attorney's office, as opposed to a private individual, is legally entitled to bring cases before the criminal grand jury.
[01:53:46.640 --> 01:53:55.640]  Oh, they have a policy, do they? Okay, this goes to petition for rhythm and damas.
[01:53:55.640 --> 01:54:03.640]  What does California, okay, let me address something else first. Statue of limitations on the sheriff.
[01:54:03.640 --> 01:54:12.640]  In Chicago a few years ago, there was a major FBI investigation of a corrupt judge.
[01:54:12.640 --> 01:54:17.640]  And for 20 years this judge had been taking bribes and screwing people left and right.
[01:54:17.640 --> 01:54:23.640]  And the FBI came after him and he claimed statute of limitations.
[01:54:23.640 --> 01:54:41.640]  And the Supreme Court said, So long as a public official is still in office, the public official is in a position to use his position in office to shield him from prosecution and therefore the clock doesn't start until he leaves office.
[01:54:41.640 --> 01:54:48.640]  So that statute of limitations is disposed with.
[01:54:48.640 --> 01:54:56.640]  The other issue that they have a policy that restricts you from the grand jury.
[01:54:56.640 --> 01:55:05.640]  Do you know what the statute says as concerns, duties of grand jurors?
[01:55:05.640 --> 01:55:33.640]  Let me tell you why I asked that question in Texas. 20.09 Texas Code of Criminal Procedure says it shall be the duty of the grand jury to investigate into all crime subject to indictment that come to their knowledge by way of any member of the grand jury, the prosecuting attorney, or any credible person.
[01:55:33.640 --> 01:55:52.640]  If I remember right, California says it shall be the duty of the grand jury to investigate into all crime subject to indictment that come to their knowledge by whatever means.
[01:55:52.640 --> 01:56:10.640]  And that reflects exactly what the Fed says. Whatever means leaves no restriction. So whoever sent you that letter gets criminal accusations for shielding from prosecution.
[01:56:10.640 --> 01:56:25.640]  Brandy, it's so much better than that. She's made an admission that she has secreted my complaints. She's made an admission that she has commented the nail that was not addressed to her.
[01:56:25.640 --> 01:56:30.640]  I'm going to make complaints to the postmaster.
[01:56:30.640 --> 01:56:43.640]  And you know what? You can tell your mom. And so if you're not going to be able to use this, mom, I forgot. Why? As what the California law says on this.
[01:56:43.640 --> 01:57:01.640]  And what's really crazy is that we included that. We included that. And like I said, there's a lot of moving parts here and I'm way over excited. I've waited, you know, to talk to you.
[01:57:01.640 --> 01:57:12.640]  So not only is it interesting that they respond to this because obviously I've struck a nerve.
[01:57:12.640 --> 01:57:18.640]  Obviously, that's what I was thinking. They actually sent you a letter. That means you stung them.
[01:57:18.640 --> 01:57:32.640]  Yeah, but Randy, what about my other criminal complaint about her brothers, the two deputy DAs that I've also submitted prior to these criminal complaints?
[01:57:32.640 --> 01:57:42.640]  I've submitted individual criminal complaints against the two deputy DAs that have been prosecuting me. I also submitted those to the California bar.
[01:57:42.640 --> 01:57:52.640]  The California bar has sent that confirmation of receipt of my complaint and assigned two case limits and said they are investigating.
[01:57:52.640 --> 01:58:04.640]  Good. Okay, one more suggestion. If you go to the FBI, the FBI agents now play secret agent because they won't tell you who they are.
[01:58:04.640 --> 01:58:19.640]  There's only one FBI agent you can identify. And that's the SAC, the SAC, the special agent in charge. You can go to the FBI website and find his name.
[01:58:19.640 --> 01:58:32.640]  So take all these complaints and send them to the SAC, S-C-A, S-A-C-A, I'm sorry.
[01:58:32.640 --> 01:58:44.640]  Get my acronyms all screwed up. Send them to the special agent in charge and address to him, to his name, not to S-C-A, S-C-A,
[01:58:44.640 --> 01:58:49.640]  but to S-A-C, but to this person.
