[01:36.560 --> 01:42.560]  by the United States, and on Israel by Russia, either accusatory narrative without any verified evidence as of yet.
[01:42.560 --> 01:48.560]  President Trump tweeted today Wednesday that if, quote, Russia vows to shoot down any and all missiles fired at Syria,
[01:48.560 --> 01:52.560]  get ready, Russia, because they will be coming in nice and new and smart.
[01:52.560 --> 01:57.560]  Going on to warn Russia that you shouldn't be partners with a gas-killing animal who kills his people and enjoys it.
[01:57.560 --> 02:05.560]  Many in the West, including President Trump, have been quick to conclude that this chemical attack must have been conducted by Assad and his forces.
[02:05.560 --> 02:12.560]  Syria and Russia, on the other hand, have given approval since yesterday for the Organization for the Prohibition of Chemical Weapons
[02:12.560 --> 02:14.560]  to investigate the sign of the chemical slaughter.
[02:14.560 --> 02:19.560]  Assad has been successful in maintaining rule and support during Syria's seven-year civil war,
[02:19.560 --> 02:26.560]  a civil war that is being fought by the government of Syria and anti-Assad Syrian rebels that are openly being funded by Western governments,
[02:26.560 --> 02:31.560]  with ISIS being one of the more notorious splinter groups of the American-backed Syrian rebels.
[02:31.560 --> 02:39.560]  No surprise, then, why Russian Foreign Minister Spokeswoman Maria Zakoba posted on Facebook that smart missiles should be fired at terrorists
[02:39.560 --> 02:43.560]  and not at a legitimate government, which has been fighting terrorists.
[02:43.560 --> 02:47.560]  Or is this a trick to destroy all traces with a smart missile strike?
[02:47.560 --> 02:50.560]  And then there will be no evidence for international inspectors to look at.

[04:16.080 --> 04:31.120]  On this Thursday, the 26th day of July 2018, and we are moving along on our program to
[04:31.120 --> 04:40.560]  get our electronic paralegal or electronic lawyer finance so that we can get it up and
[04:40.560 --> 04:41.560]  working.
[04:41.560 --> 04:50.320]  And in doing some research, I'm finding some really interesting things happening.
[04:50.320 --> 04:56.440]  And as I was looking through these things that are happening, I couldn't help but think
[04:56.440 --> 05:03.680]  about a lot of the people that we talked to on the web who have been concerned about
[05:03.680 --> 05:09.360]  our privacy.
[05:09.360 --> 05:17.960]  The internet has, for the most part, and current technology has pretty well eliminated privacy.
[05:17.960 --> 05:22.840]  Well, technology is changing.
[05:22.840 --> 05:31.000]  There are some protocols that are coming that, by their nature, seem inevitable.
[05:31.000 --> 05:35.400]  Way too complex for me to try to explain here.
[05:35.400 --> 05:41.760]  But they will have the effect of bringing privacy back to the web.
[05:41.760 --> 05:50.700]  They'll create a circumstance to where you can exist in cyberspace, but you can exist
[05:50.700 --> 05:52.880]  securely in cyberspace.
[05:52.880 --> 05:58.400]  Right now, companies like Google and Yahoo and a number of others are collecting massive
[05:58.400 --> 06:03.240]  amounts of data on everybody.
[06:03.240 --> 06:07.460]  And they collect that data so it's their data, and you don't have a say in what they
[06:07.460 --> 06:08.960]  do with it.
[06:08.960 --> 06:17.000]  Well, when these new technologies come along, when they get up to speed, primarily IPFS,
[06:17.000 --> 06:28.520]  IPFS will become more well-known in the next year or two, and this all has to do with blockchain
[06:28.520 --> 06:31.320]  and distributed web technologies.
[06:31.320 --> 06:34.640]  Basically, how it's going to work.
[06:34.640 --> 06:42.760]  Right now, we have a centralized web where I hook on to the internet, and I hook on through
[06:42.760 --> 06:52.400]  a server, Bluehost is, well, I'm at the internet provider is Frontier.
[06:52.400 --> 06:58.960]  Frontier provides the server, and everybody who uses their service logs on to the internet
[06:58.960 --> 07:02.240]  through their server.
[07:02.240 --> 07:08.760]  And then they connect to other servers, and all of my websites that I have built, they're
[07:08.760 --> 07:13.680]  all running on Bluehost, and Bluehost has these huge servers and used them.
[07:13.680 --> 07:20.480]  Well, if Bluehost goes down, my systems go down.
[07:20.480 --> 07:31.400]  If Bluehost and their backups get wiped out, my systems wiped out, well, IPFS is a whole
[07:31.400 --> 07:34.480]  different way of doing things.
[07:34.480 --> 07:43.320]  It's a decentralized web where everyone who has a computer hooked to the web is essentially
[07:43.320 --> 07:46.880]  a server.
[07:46.880 --> 07:53.200]  Your computer in your unused space on your hard drive, similar to what happened when
[07:53.200 --> 08:06.400]  the internet came about where large companies bought 1,800 trunk lines from Maubel originally,
[08:06.400 --> 08:12.760]  and then AT&T and others, and they essentially owned those lines.
[08:12.760 --> 08:17.040]  They would have one from here, from the United States to England.
[08:17.040 --> 08:19.640]  They didn't use it all the time.
[08:19.640 --> 08:29.760]  So the internet really came about by these people with these phone lines that they owned.
[08:29.760 --> 08:38.080]  They made an agreement that you've got this phone line to Australia, and I need one every
[08:38.080 --> 08:41.960]  once in a while, and I've got this one to England, but I don't use it all the time.
[08:41.960 --> 08:44.080]  So we'll make this deal.
[08:44.080 --> 08:49.880]  I'll take my lines, and when I'm not using them, I'll raise them to the web that other
[08:49.880 --> 08:54.880]  people can use them so that when I need lines I don't have, I can go on the web and use
[08:54.880 --> 09:01.160]  theirs, and this grew into a network of interconnected phone lines.
[09:01.160 --> 09:09.360]  This is kind of what happened when the Pentagon found that they were paying for redundant research,
[09:09.360 --> 09:12.920]  so they went to their programmers and said, guys, we need to do something.
[09:12.920 --> 09:19.640]  We need to be able to connect all of these different universities and contractors together
[09:19.640 --> 09:24.800]  so that we're not paying for the same research in more than one place, and they can all share
[09:24.800 --> 09:25.800]  data.
[09:25.800 --> 09:31.360]  So they built a network, and they hooked phone lines to all of these different places, and
[09:31.360 --> 09:35.160]  everybody went through the Pentagon's hub.
[09:35.160 --> 09:41.600]  Well, GD was doing a lot of research with the university, so they just bought a line
[09:41.600 --> 09:48.400]  to go to their university and lines to other contractors and other universities, and all
[09:48.400 --> 09:53.160]  these people started buying these lines and hooking them up, and the Pentagon said, whoa,
[09:53.160 --> 09:54.800]  whoa, hold on here.
[09:54.800 --> 09:57.840]  You guys are bypassing our hub.
[09:57.840 --> 10:02.160]  If you don't stop bypassing our hub, we'll pull our hub, and they told them, okay, pull
[10:02.160 --> 10:03.160]  your hub.
[10:03.160 --> 10:06.720]  We'll go there, because they just routed around it.
[10:06.720 --> 10:13.840]  If I wanted to get to a university I didn't have a direct link to, I would link to someone
[10:13.840 --> 10:18.080]  who did have a link to that one, and from one link to the other, we could all connect
[10:18.080 --> 10:19.080]  together.
[10:19.080 --> 10:33.120]  In that way, the network became somewhat distributed, but as it grew, people set up servers to serve
[10:33.120 --> 10:41.160]  their interests, and then made those services available when they weren't using all the
[10:41.160 --> 10:42.160]  resources.
[10:42.160 --> 10:48.160]  And then companies set up servers just for this purpose, just to provide resources for
[10:48.160 --> 10:52.760]  people who wanted a presence on the web.
[10:52.760 --> 11:00.560]  Well, the way the phone line system grew, that was a distributed network, and then it
[11:00.560 --> 11:05.280]  grew into a centralized network, which consists of centralized servers.
[11:05.280 --> 11:17.200]  Well, new technology is about to move it back to a uncentralized or distributed web, where
[11:17.200 --> 11:20.960]  now we have all of these computers with all these big hard drives that I'm sitting here
[11:20.960 --> 11:26.280]  with, four or five computers in the room I'm in, and they've just put one terabyte of
[11:26.280 --> 11:35.880]  SSBs in them, and one of them has four hard drives in it, all of them SSBs different sizes.
[11:35.880 --> 11:40.440]  I have a lot more space than I need.
[11:40.440 --> 11:50.040]  With this new technology, I can release that space to the web, and through the cryptocurrency
[11:50.040 --> 11:58.560]  protocols, I can get paid by the web for the use of my access storage.
[11:58.560 --> 12:07.240]  What this has the potential of doing is connecting everybody's computers together everywhere.
[12:07.240 --> 12:13.160]  And with the distributed technology, when I was reading about it, I was thinking about
[12:13.160 --> 12:22.080]  RAID arrays, and I finally came across one of the people talking about the IPFS protocol,
[12:22.080 --> 12:25.680]  and he equated it to a RAID array.
[12:25.680 --> 12:31.400]  Years ago, we had RAID arrays, primarily with SCSI drives instead of IDEs, the standards
[12:31.400 --> 12:39.440]  IDE and IDE went to SATA, but there was a different technology for hard drives called SCSI.
[12:39.440 --> 12:43.560]  And with SCSI, they had different protocols, so you could hook them together in ways that
[12:43.560 --> 12:46.200]  IDE drives wouldn't.
[12:46.200 --> 12:54.360]  You could put a stack of hard drives, 8, 10, 15 hard drives in one rack, and then load
[12:54.360 --> 12:57.160]  them all in a RAID.
[12:57.160 --> 13:04.240]  If one of those, and the information in the RAID array was decentralized, it was spread
[13:04.240 --> 13:09.320]  across all of the drives, so if you have this large file you're trying to pull down, and
[13:09.320 --> 13:18.520]  instead of attaching to one drive and pulling things down at its access rate speed, you
[13:18.520 --> 13:24.560]  could connect to 10 drives at once and pull the document down from 10 drives at one time,
[13:24.560 --> 13:31.880]  effectively increasing your speed on the RAID by a factor of how many drives you have.
[13:31.880 --> 13:36.120]  If one of those drives went down, you could just reach in, and for the most part, they
[13:36.120 --> 13:41.920]  could do a hot swap, that's what they called it.
[13:41.920 --> 13:47.040]  With the system running, you could shut one drive down, pull it out, plug it in, and when
[13:47.040 --> 13:55.000]  you turned it back on, the array would populate that drive and no data would be lost.
[13:55.000 --> 14:05.280]  That's sort of what the IPFS protocol will do for everybody's computers.
[14:05.280 --> 14:12.560]  We will all, essentially, everybody who chooses to participate, become part of a massive RAID
[14:12.560 --> 14:20.640]  array, so all of our information is spread all across the web, it's not in a single point.
[14:20.640 --> 14:29.720]  The crypto technology uses extremely sophisticated security.
[14:29.720 --> 14:39.960]  A lot of the processing work that goes on is about security, it's about running these
[14:39.960 --> 14:47.240]  huge algorithms to make sure that everybody who tries to access something actually has
[14:47.240 --> 14:54.760]  the right authority to access that, it will virtually eliminate hacking, not exactly but
[14:54.760 --> 14:56.520]  for the most part.
[14:56.520 --> 15:04.160]  The minor hacking we're seeing will just cease because it will just take, the programming
[15:04.160 --> 15:12.440]  and the calculations the computers would have to do would be absolutely prohibitive, and
[15:12.440 --> 15:17.760]  your data is spread everywhere, so we can't go to one place and get all of it because
[15:17.760 --> 15:25.480]  it's spread all around, like an array array, and you would have to go to all of these and
[15:25.480 --> 15:28.440]  hack all these machines to get it.
[15:28.440 --> 15:37.920]  Not only that, if you need some information and it's on computers near where you're at,
[15:37.920 --> 15:43.160]  you don't have to go find a server in Southeast Asia and make all these jumps through the
[15:43.160 --> 15:48.000]  net to pull that information down, you can pull it from your neighborhood, and that will
[15:48.000 --> 15:53.200]  make it blistering fast by today's standards.
[15:53.200 --> 16:02.960]  We are looking at a quantitative, you know, there are people who say about Apple, boy,
[16:02.960 --> 16:11.600]  if I only knew then what I knew now, well, this is then, guys, 10, 15 years from now
[16:11.600 --> 16:17.880]  everything will be in the blockchain and distributed networks.
[16:17.880 --> 16:22.400]  So if you're looking to understand where the future is going and for potential investments

[20:52.980 --> 20:53.980]  This is Tim.
[20:53.980 --> 21:02.380]  He owns an auto repair shop, his wife is on the city council, while she's on the city
[21:02.380 --> 21:08.460]  council, she didn't vote for the city manager's raise.
[21:08.460 --> 21:09.460]  She's the only one that didn't.
[21:09.460 --> 21:17.100]  As soon as she got off the city council, the city manager started this campaign against
[21:17.100 --> 21:18.100]  them.
[21:18.100 --> 21:25.300]  And it culminated with eight charges of junk vehicles, where Tim has auto repair shop
[21:25.300 --> 21:29.460]  that's been in the town for over 20 years.
[21:29.460 --> 21:32.180]  And the city adjudicated, and they screwed everything up.
[21:32.180 --> 21:41.820]  They did everything wrong, and did everything they could to bully and forced Tim into a
[21:41.820 --> 21:47.060]  position where he could not adjudicate his rights.
[21:47.060 --> 21:49.940]  And Tim never backed down.
[21:49.940 --> 21:55.820]  And finally, we filed a, Tim filed a petition for rid of mandamus.
[21:55.820 --> 22:02.500]  Now, in Texas, we were warned that a petition for rid of mandamus, they almost never get
[22:02.500 --> 22:09.820]  picked up, about 12% of them actually get heard by the court of appeals, and only about
[22:09.820 --> 22:13.900]  two of those get ruled on in favor of the Fiverr.
[22:13.900 --> 22:24.060]  Well, Tim filed pro say, and he's one of those 2%, because the court hammered them pretty
[22:24.060 --> 22:25.060]  good.
[22:25.060 --> 22:30.380]  We, Tim filed, keep saying we, because I helped him with it, but it wasn't me.
[22:30.380 --> 22:32.860]  It was Tim and Laura.
[22:32.860 --> 22:42.780]  They were terrified, and these guys were, they got claims against them up to $80,000.
[22:42.780 --> 22:51.060]  So they took what should have been a maximum of $1,600 and jacked it up to $80,000, trying
[22:51.060 --> 22:57.980]  to force him to knuckle under and crawl to him and make a deal, but he never did.
[22:57.980 --> 23:04.540]  And when the judge ruled against him out of hand at every turn, when he requested findings
[23:04.540 --> 23:10.860]  of fact for his dismissal with prejudice, the judge refused to provide him, so he filed
[23:10.860 --> 23:12.860]  criminal charges against him.
[23:12.860 --> 23:19.220]  Now what the heck, he started a book at you where you got nothing to lose, and they did
[23:19.220 --> 23:26.740]  everything they possibly could, and Tim and Laura hung in there.
[23:26.740 --> 23:33.100]  I helped him with it, but you know, I didn't have this gunpoint in me, so I wasn't under
[23:33.100 --> 23:34.100]  that stress.
[23:34.100 --> 23:38.900]  You know, I felt they're difficult, I've been there myself, so I knew how they felt,
[23:38.900 --> 23:44.100]  but they never backed out.
[23:44.100 --> 23:54.140]  And today we got the ruling, we claimed that the trial court never had subject matter jurisdiction
[23:54.140 --> 24:02.740]  because there was never a proper adjudication, I'm sorry, we claimed that the district court,
[24:02.740 --> 24:09.260]  who the city filed an action with to collect these administrative penalties, did not have
[24:09.260 --> 24:16.180]  subject matter jurisdiction because the administrative penalties were never properly adjudicated,
[24:16.180 --> 24:20.180]  and the court agreed with us wholeheartedly.
[24:20.180 --> 24:28.380]  The only thing they didn't rule on, they said the court had jurisdiction on, was the city
[24:28.380 --> 24:38.700]  claimed after the adjudication that Tim continued to violate the ordinance, even though he had
[24:38.700 --> 24:43.980]  brought all these up to code, they claimed he didn't anyway for 80 days, or 40 days or
[24:43.980 --> 24:48.580]  something, and they charged him $80,000, $1,000 a day for each one.
[24:48.580 --> 24:52.380]  So they're trying to collect $80,000 now.
[24:52.380 --> 24:56.900]  They've blown up to $1,600 on charges to $80,000.
[24:56.900 --> 25:05.420]  And the court ruled that the trial court would have jurisdiction to rule over that $80,000
[25:05.420 --> 25:12.980]  administrative penalty, but the $80,000 administrative penalty could only be applied after there was
[25:12.980 --> 25:19.460]  an adjudication against him, and Tim then continued to violate.
[25:19.460 --> 25:25.820]  But the court just ruled there was no adjudication against him, so there was no ground for the
[25:25.820 --> 25:31.340]  claim to begin with, so the $80,000 goes out the window.
[25:31.340 --> 25:36.260]  But not Tim's $300,000 suit against them.
[25:36.260 --> 25:41.220]  Now, okay, that's kind of where we're at.
[25:41.220 --> 25:44.100]  I hope I didn't steal all your thunder.
[25:44.100 --> 25:45.100]  No.
[25:45.100 --> 25:52.700]  It's, you know, when I'm reading it, I'm thinking to myself, they started it out saying that
[25:52.700 --> 25:58.020]  they agreed basically with every claim that the city had except for one.
[25:58.020 --> 26:00.220]  And to me, that's the most important one.

[26:22.660 --> 26:29.500]  that are a huge law firm, how is it that they can overlook something like that, that they
[26:29.500 --> 26:35.940]  did, apparently?
[26:35.940 --> 26:41.860]  We need to find out all the cities they represent and contact them.
[26:41.860 --> 26:45.140]  This law firm needs to cease to exist.
[26:45.140 --> 26:47.140]  Judgment against them.
[26:47.140 --> 26:59.780]  Well, what we're looking at is in the suit that Tim filed, he filed a constitutional
[26:59.780 --> 27:05.420]  challenge against the validity of the city ordinances in the form of a declaratory judgment
[27:05.420 --> 27:11.100]  claim against the city, and that's the only claim against the city.
[27:11.100 --> 27:19.140]  And then he filed against all of the individuals involved in their personal capacity.
[27:19.140 --> 27:25.300]  The judge threw out everything with prejudice, with no explanation, just tossed it.
[27:25.300 --> 27:29.940]  And when we asked for a finance fact and conclusions at law, he refused to provide it, so we filed
[27:29.940 --> 27:32.980]  a criminal against it.
[27:32.980 --> 27:40.020]  And when they kept sandbagging and bushwhacking Tim at every turn, and then finally they held
[27:40.020 --> 27:44.500]  a hearing without notifying him and ruled against him at the hearing, then he filed
[27:44.500 --> 27:47.000]  the mandamus.
[27:47.000 --> 27:49.380]  And that put the brakes on everything.
[27:49.380 --> 27:57.780]  And now the court has ruled that our original challenge to subject matter jurisdiction,
[27:57.780 --> 28:03.900]  claiming that the original adjudication was improper, was true.
[28:03.900 --> 28:08.700]  So now we have the judge ruling against our claims when our claims are now proven to be
[28:08.700 --> 28:12.100]  true.
[28:12.100 --> 28:19.180]  Our criminal charges against the judge now take on far more validity.
[28:19.180 --> 28:22.500]  He should have known this.
[28:22.500 --> 28:24.100]  Technically he did know this.
[28:24.100 --> 28:26.820]  He has imputed knowledge.
[28:26.820 --> 28:28.980]  He is a learned counsel.
[28:28.980 --> 28:32.300]  He cannot pretend he didn't know.
[28:32.300 --> 28:39.380]  He acted with deliberate and flagrant disregard for standing law.
[28:39.380 --> 28:46.340]  So what happens now is we file a motion for reconsideration based on the ruling of the
[28:46.340 --> 28:48.580]  court of appeals.
[28:48.580 --> 28:53.000]  We claim the original adjudication was invalid and the court of appeals agreed with us.
[28:53.000 --> 28:56.300]  So that is now rez judicata.
[28:56.300 --> 29:00.540]  That is not something this court can revisit.
[29:00.540 --> 29:08.860]  Now we ask the court to throw out everything and overturn the dismissal with prejudice.
[29:08.860 --> 29:14.460]  If he doesn't, we appeal it and it will almost certainly get overturned to outrageous.
[29:14.460 --> 29:18.940]  And when that happens, Tim gets to file an amended complaint.

[34:45.420 --> 34:53.820]  case law, Jocelyn V. Chambers, that said a judge has no discretion in properly applying
[34:53.820 --> 35:03.180]  the law to the facts failure do so as a abuse of discretion and addressable by extraordinary
[35:03.180 --> 35:04.700]  writ.
[35:04.700 --> 35:10.540]  An extraordinary writ means writ of andamus, exactly what we addressed it with.
[35:10.540 --> 35:17.660]  However, if a judge abuses his discretion and in the process denies his full free access
[35:17.660 --> 35:28.500]  to rejoins right, well that's class A misdemeanor in Texas and we can show malicious intent.
[35:28.500 --> 35:34.220]  Because we said this was wrong, the law said this was wrong and the judge ruled that it
[35:34.220 --> 35:36.940]  was not wrong.
[35:36.940 --> 35:44.700]  In the face of law, and he's strictly forbidden to do that, it's called an abuse of discretion
[35:44.700 --> 35:49.500]  and an abuse of discretion where it denies his full free access to rejoins rights criminal
[35:49.500 --> 35:57.460]  act and the judge is going to claim that he has immunity from this suit because he was
[35:57.460 --> 36:03.780]  acting in his capacity as a judge and this is an argument that I've wanted to bring for
[36:03.780 --> 36:07.060]  a long time.
[36:07.060 --> 36:17.740]  He will claim that he was acting within scope and we will claim and I suspect the court of
[36:17.740 --> 36:26.180]  appeals left a small door open and I just feel as though they did that so that the judge
[36:26.180 --> 36:33.580]  could claim that he was acting within scope where they said that he did have jurisdiction
[36:33.580 --> 36:43.740]  to rule on the injunctive rule for injunctive relief that the city asked for so they're
[36:43.740 --> 36:52.940]  trying to blur the line so the judge is not completely without subject matter jurisdiction
[36:52.940 --> 37:03.220]  but for those acts that he committed that did not include the injunctive relief we're
[37:03.220 --> 37:11.540]  going to maintain those are not acts within scope as crimes are not within the scope of
[37:11.540 --> 37:18.460]  any public officials authority and this is the stand we take he is a public official
[37:18.460 --> 37:26.700]  granted immunity from criminal acts committed from the bench there's case law on both sides
[37:26.700 --> 37:27.700]  of that.
[37:27.700 --> 37:34.700]  One of the things they put here says the administrative penalties assessed against PICS for $8,000 in
[37:34.700 --> 37:39.100]  other words they didn't grant the city that and then after that the quotation mark says
[37:39.100 --> 37:45.180]  a writ will issue only if the district court fails to do so and then they have an 8 here
[37:45.180 --> 37:52.380]  and the 8 says we deny PICS request to sanction the city in the amount of $80,000 so are they
[37:52.380 --> 38:02.100]  saying that if the district court fails to follow procedure that there was really no
[38:02.100 --> 38:08.100]  proper administrative adjudication process then the $8,000 sanctions will be filed against
[38:08.100 --> 38:09.100]  the city?
[38:09.100 --> 38:19.340]  No they denied them and they won't revisit that I didn't expect them to that was put
[38:19.340 --> 38:29.540]  in there for its political purposes let the lawyer sweat I really didn't expect them to
[38:29.540 --> 38:37.780]  grant sanctions if you don't ask for them you certainly can't get them but we won't
[38:37.780 --> 38:44.820]  need it because this will reach the point to where either the court will overturn those
[38:44.820 --> 38:53.820]  rulings and revisit the dismissal with prejudice and then you get opportunity to file an amended
[38:53.820 --> 38:59.820]  pleading and when you file an amended pleading then you don't name the city you name each
[38:59.820 --> 39:08.540]  individual in their personal capacities and in this case when we go back with an amended
[39:08.540 --> 39:15.140]  pleading we will name the mayor he opened his mouth when he should have kept it shut
[39:15.140 --> 39:22.580]  he told the city council member that we did this in order to make an example of Tim yeah
[39:22.580 --> 39:27.020]  now Mike saying that he didn't use the word example you can't remember exactly what he
[39:27.020 --> 39:31.060]  said but it had to do with that if we don't take care of Tim the whole city is going to
[39:31.060 --> 39:36.940]  do things which is basically the same thing same thing they're doing this to Tim to
[39:36.940 --> 39:48.220]  Tim solely because Tim exercised his right to plead not guilty right well so something
[39:48.220 --> 39:57.100]  we may bring up is that the municipal judge without anything in writing to me and in apparent
[39:57.100 --> 40:05.220]  conspiracy before the court date that the administrative that the municipal judge and
[40:05.220 --> 40:09.620]  the prosecuting attorney had gotten together and determined that they were going to switch
[40:09.620 --> 40:16.700]  it from just a junk no no wait wait wait wait this happened in the courtroom that happened
[40:16.700 --> 40:21.460]  in the courtroom but what I'm saying is that you don't you don't have any indication that
[40:21.460 --> 40:28.380]  they discussed this prior they discussed it right in the courtroom in front of everybody
[40:28.380 --> 40:37.940]  on the record yeah the judge had to prod the lawyer to pick up the thread he's saying
[40:37.940 --> 40:45.780]  what was it of the health and safety hazard yeah a couple of times before the lawyer snapped
[40:45.780 --> 40:53.940]  right I read that is criminal conspiracy to commit the judge acting with the lawyer established
[40:53.940 --> 41:02.860]  a meeting of minds and that meeting of minds led to this debacle well it also makes me
[41:02.860 --> 41:12.380]  wonder you know in January they filed as per city attorney that vehicle that had been adjudicated
[41:12.380 --> 41:19.500]  previously was still sitting at the shop which is my 85 board but it was licensed remember
[41:19.500 --> 41:26.220]  it was licensed before the court case after the time limit that they had given us but
[41:26.220 --> 41:33.340]  before the actual first day preliminary hearing in the municipal court but now that this has
[41:33.340 --> 41:40.300]  happened in the appeals court has ruled against them then there never has been an adjudicated
[41:40.300 --> 41:48.660]  process so this new thing it's this new ticket gets thrown out completely well it will when
[41:48.660 --> 41:59.580]  you file an affirmative defense or when the city decides to actually do the right thing
[41:59.580 --> 42:05.340]  the city filed a complaint against him claiming that this vehicle was in continued violation
[42:05.340 --> 42:12.500]  of the junk vehicle ordinance because it was never moved but the junk vehicle ordinance
[42:12.500 --> 42:22.780]  says it must vehicle must be unlicensed and inoperable and what is the other one or and
[42:22.780 --> 42:33.260]  or inoperable or dismantled or wrecked okay it has first one licensed unlicensed yes so
[42:33.260 --> 42:39.340]  even if it was wrecked if it was licensed it didn't fall under even if it was dismantled
[42:39.340 --> 42:45.540]  if it was licensed it didn't fall under we've put this off but I need someone to go and
[42:45.540 --> 42:53.740]  do a records request to the city attorneys or to even just the city hall what determines
[42:53.740 --> 43:00.820]  a junk vehicle ordinance violation and give them no number and have them and I would suggest

[49:56.940 --> 50:04.300]  did that and find me the $8,000 it sat there for nine months we took pictures we have neighbors
[50:04.300 --> 50:11.460]  who saw it they're the ones who told me about it and so then after that they appointed him
[50:11.460 --> 50:22.620]  to council so now he's on the council and when the city council met with attorneys last
[50:22.620 --> 50:30.660]  week at the council meeting they did an executive session where they discussed our litigation
[50:30.660 --> 50:36.580]  with pickflers what it said well he got to be in on on that because see he's part of
[50:36.580 --> 50:42.900]  the case but he shouldn't have been he should have recused himself as what people are saying
[50:42.900 --> 50:48.100]  so I'm wondering how far this is going to go and what it's going to do to those people
[50:48.100 --> 50:52.620]  and it would seem that the attorneys would protect their clients but it doesn't appear
[50:52.620 --> 51:01.620]  that they have peers as though they've thrown him under the bus and from arrogance and the
[51:01.620 --> 51:06.900]  only only thing that they're going to be able to do is to sue these attorneys it's going
[51:06.900 --> 51:14.620]  to get difficult for them specifically yeah the only and in you know I can't tell my
[51:14.620 --> 51:20.100]  realize that you're you have a lot of animosity toward these people but from a third party
[51:20.100 --> 51:27.100]  perspective the three people on that administrative board they didn't know squat they're just ordinary
[51:27.100 --> 51:35.340]  citizens they don't know anything about law they acted in good faith reliance on competent
[51:35.340 --> 51:48.700]  authority being the lawyer lawyers yeah the city lawyers they actually have a valid defense
[51:48.700 --> 51:54.740]  against to suit against them personally because there's no indication that they went out of
[51:54.740 --> 52:03.100]  their way to act maliciously now they may have acted to mean spirited but they were advised
[52:03.100 --> 52:09.580]  that they were acting within the scope of an authority the fact that they didn't actually
[52:09.580 --> 52:16.220]  have that authority gives them a defense they're still responsible and they would have to bring
[52:16.220 --> 52:24.780]  the defense and I'm saying this on the air and if they happen to be listening then it's
[52:24.780 --> 52:33.620]  only fair now if they did something malicious outside that scope then the gloves come on
[52:33.620 --> 52:38.300]  well the gloves come off anyway the only way they get out of this is throw the lawyer under
[52:38.300 --> 52:45.140]  the bus and for us you know always when you sue somebody you look for deep pockets oh
[52:45.140 --> 52:50.540]  these guys got they don't have deep enough pockets because when you come back it's going
[52:50.540 --> 52:58.220]  to grow a lot bigger than that original 300,000 so who has deep pockets the lawyer's malpractice

[53:04.900 --> 53:11.060]  company the bonds Texas Municipal Board or something that I was wrong on that because

[53:24.740 --> 53:30.740]  the lawyers argued in the first suit that since they were lawyers for a municipality
[53:30.740 --> 53:42.220]  that they had immunity from suit not I went to my county attorney when the chief of police
[53:42.220 --> 53:48.020]  refused to give a complaint to the prosecutor to the justice of the peace claimed that the
[53:48.020 --> 53:54.020]  county attorney told him not to I told him wait right here don't go anywhere I'll be

[01:23:07.140 --> 01:23:11.580]  is that the prosecutors want to sequester the grand juries, they want to control the grand
[01:23:11.580 --> 01:23:16.220]  juries, they want to keep the grand juries away from the public, they want to say that
[01:23:16.220 --> 01:23:21.780]  oh grand juries are private, no grand juries are not private, okay, we have the right to
[01:23:21.780 --> 01:23:28.900]  know who they are, okay, and we can find out who they are pretty easily, we can go before

[01:23:55.300 --> 01:24:00.980]  the prosecutors don't want you to do that and they try to get in the way and they won't

[01:24:38.620 --> 01:24:46.980]  allowed to read the news, read newspaper, watch TV news because they don't want the jurors
[01:24:46.980 --> 01:24:53.500]  being swayed or affected by what's going on in the media surrounding a high profile
[01:24:53.500 --> 01:25:00.900]  case, all right, that's reasonable because they only want the pettit jurors to consider
[01:25:00.900 --> 01:25:06.700]  the evidence that's being presented officially at trial, it's a totally different story with
[01:25:06.700 --> 01:25:12.220]  grand jury, they can indict and consider any information that comes to them by whatever
[01:25:12.220 --> 01:25:17.660]  means and we absolutely have every right to access them, it's just a matter of getting
[01:25:17.660 --> 01:25:26.140]  passed the prosecutor and Randy has done a lot on that regard, especially here in Austin,
[01:25:26.140 --> 01:25:32.460]  he basically got it to the point where the assistant district attorney here in Travis
[01:25:32.460 --> 01:25:36.900]  County basically just came out and said, okay, I'm not going to get in the way anymore, I'm
[01:25:36.900 --> 01:25:41.580]  not even going to try, you can go in and talk to the grand jury and so really it's just
[01:25:41.580 --> 01:25:46.220]  a matter of accessing the grand jurors that we have and grand jurors for the most part
[01:25:46.220 --> 01:25:54.540]  are reasonable people and a lot of them are volunteers, older people who may be retired
[01:25:54.540 --> 01:25:58.140]  and they want to give something back to their community, they volunteer to go on a grand
[01:25:58.140 --> 01:26:05.820]  jury, best way to change the system, go get on a grand jury yourself and know the rights,
[01:26:05.820 --> 01:26:12.820]  know your rights, this is what Hoppy Heidelberg did with the Oklahoma City bombing trial,

[01:53:21.740 --> 01:53:47.740]  He's a pretty nice guy, you know, and he was telling me in front of the judge, we'll get this discovery to you because the sheriff's department is, has sent a notice to the attorney general asking for clarification if they can, you know, if they have to turn this over or not.

[01:53:51.740 --> 01:54:00.740]  Okay, if there are, if the sheriff's department gets a, did you get notice from the sheriff's department that they did this?
