[02:02.440 --> 02:06.600] attack must have been conducted by Assad and his forces.

[02:10.880 --> 02:15.680] for the Prohibition of Chemical Weapons to investigate the site of the chemical slaughter.

[04:03.680 --> 04:08.360] talk a little bit about something that I got called about today.
[04:08.360 --> 04:14.460] I have relatives that are licensed peace officers here in the state of Texas, one of which is
[04:14.460 --> 04:20.700] my cousin who called me today to ask me a question about what law I was studying that
[04:20.700 --> 04:27.500] showed that deputy sheriffs and police officers can't stop someone under the transportation
[04:27.500 --> 04:28.880] code.
[04:28.880 --> 04:34.000] So I tried to do a quick recap summary of all the things that we've discussed over the
[04:34.000 --> 04:41.780] years about why this is and what it's all about and how you verify that because he was
[04:41.780 --> 04:47.620] having an issue with the other deputy not believing the information, which of course
[04:47.620 --> 04:52.560] is standard interpretation of the law because they don't actually read it, they don't actually
[04:52.560 --> 04:55.600] understand it, and they're not actually trained on it.
[04:55.600 --> 04:59.000] And if it's not in their training, it doesn't exist.
[04:59.000 --> 05:02.920] At least that's my experience with most of them when it comes to this.
[05:02.920 --> 05:07.600] If they weren't taught it at the academy, then it's not relevant and doesn't apply even
[05:07.600 --> 05:13.520] if it is the law on the subject that they are having an issue with.
[05:13.520 --> 05:21.120] So what I'm going to do tonight is I am going to go through the various parts of the law
[05:21.120 --> 05:27.240] that you would have to look at in order to understand the concepts of what transportation
[05:27.240 --> 05:34.440] is, what it isn't, why local cops, county, and municipal are not automatically authorized
[05:34.440 --> 05:42.920] to enforce any part of it or to perform any arrest or any stops in relation to that code,
[05:42.920 --> 05:52.120] and why when they do so, they run the risk of being sued for acting without lawful authority.
[05:52.120 --> 05:57.880] Because if the law does not give them the authority they are exercising, then they are
[05:57.880 --> 06:02.040] acting beyond their legal authority.
[06:02.040 --> 06:07.360] And when a local officer who is not certified by the Department of Public Safety and whose
[06:07.360 --> 06:12.120] county or municipality does not have a reciprocity agreement, more or less is what it boils down
[06:12.120 --> 06:17.160] to, with the Department of Public Safety as to how to properly enforce the transportation
[06:17.160 --> 06:26.960] code, then they are acting unlawfully and illegally in their capacity by impersonating
[06:26.960 --> 06:34.400] a duly authorized peace officer, or in this case police officer as defined by the statutes,
[06:34.400 --> 06:39.680] that is authorized to enforce an arrest under the transportation code.
[06:39.680 --> 06:45.960] So we're going to start with the beginning steps on where this information becomes reality
[06:45.960 --> 06:52.960] and why if anyone with any brains would actually sit down and put this together, which basically
[06:52.960 --> 07:00.080] eliminates every attorney and judge in the state, not to mention the cops, 99.9% of whom
[07:00.080 --> 07:06.040] barely graduated school for the most part, or how they didn't is beyond me considering
[07:06.040 --> 07:10.600] that when you try to talk reasonably to them in real life, their brain shuts off.
[07:10.600 --> 07:14.560] I don't know if they started plugging that switch in at the academy or not, but it seems
[07:14.560 --> 07:16.320] to be the case.
[07:16.320 --> 07:21.960] Anyway, this is the details of how it all works and how you verify it.
[07:21.960 --> 07:26.640] We begin with the fact that the Texas transportation code is called the transportation code.
[07:26.640 --> 07:30.860] The legal definition of transportation being the movement of persons or property from one
[07:30.860 --> 07:33.620] place to another by a carrier.
[07:33.620 --> 07:38.360] Carrier being defined legally as someone who is engaged in the business or occupation of
[07:38.360 --> 07:45.120] transporting persons or property for compensation or hire, okay?
[07:45.120 --> 07:52.920] Operators hire operators and drivers or they contract with operators and drivers.
[07:52.920 --> 07:59.640] Operators most of the time is a business profession such as a taxi cab company for instance.
[07:59.640 --> 08:06.080] You have to have an operator's license in most cities to operate a cab business.
[08:06.080 --> 08:11.680] Now if you're part of a larger incorporated business that runs tens to hundreds of cabs
[08:11.680 --> 08:20.280] like in New York City, the yellow cab company does, then your operation is normally distinctive
[08:20.280 --> 08:24.840] and separate from your drivers, okay?
[08:24.840 --> 08:30.560] So an operator under the definition of the laws that pertains in that context is not
[08:30.560 --> 08:32.440] the same as a driver.
[08:32.440 --> 08:35.400] It is not someone in control of a motor vehicle.
[08:35.400 --> 08:42.400] It is someone who is in control of the business that owns and operates that motor vehicle,
[08:42.400 --> 08:43.780] okay?
[08:43.780 --> 08:46.460] Same thing applies to driver.
[08:46.460 --> 08:53.640] Driver is someone who is being paid by that carrier or that operator to work for them
[08:53.640 --> 08:55.180] as a driver.
[08:55.180 --> 09:00.920] They're getting paid to do the job of driving, whether it be to deliver persons, goods or
[09:00.920 --> 09:05.160] property from one point to another, okay?
[09:05.160 --> 09:10.620] That is the legal definition of transportation and how it trickles down through all the other
[09:10.620 --> 09:14.680] definitions that are applicable to the various codes.
[09:14.680 --> 09:18.460] Here in Texas it is the transportation code.
[09:18.460 --> 09:23.220] Transportation is the singular subject matter that the Texas legislature stated in the title
[09:23.220 --> 09:28.280] of the bill that created the transportation code as being the sole limiting subject to
[09:28.280 --> 09:35.960] which every statute in that code must apply and is strictly limited to in its application.
[09:35.960 --> 09:41.640] It can't go beyond anything that is not specifically transportation related.
[09:41.640 --> 09:46.880] To do so is a violation of the state constitution, okay?
[09:46.880 --> 09:49.800] Now we get into the body of the code itself.
[09:49.800 --> 09:53.760] Besides the fact that the code was unconstitutionally enacted, which I will not be getting into
[09:53.760 --> 09:59.440] in this show, if the code were presumed to be constitutional in its enactment, then this
[09:59.440 --> 10:04.320] is still proof positive that it does not apply to the general public.
[10:04.320 --> 10:10.860] In every single chapter of the Texas transportation code that deals with public safety and enforcement,
[10:10.860 --> 10:16.260] there is a definition for the term department, okay?
[10:16.260 --> 10:23.280] Every single one of those chapters defines department as the Texas Department of Public
[10:23.280 --> 10:24.280] Safety.
[10:24.280 --> 10:28.240] Now it says it in various forms, the Department of Public Safety of the state of Texas, the
[10:28.240 --> 10:31.880] Texas Department of Public Safety, and blah, blah, blah, but it all boils down to it's
[10:31.880 --> 10:37.640] the same agency in every single definition of department, okay?
[10:37.640 --> 10:38.640] Same agency.
[10:38.640 --> 10:40.640] No is, no ands, no buts.
[10:40.640 --> 10:43.800] It never includes locals in those definitions.
[10:43.800 --> 10:49.320] Not once does it ever say the Department of Public Safety of the state of Texas, local
[10:49.320 --> 10:51.960] law enforcement of municipalities and counties.
[10:51.960 --> 10:53.000] Does not say that.
[10:53.000 --> 10:55.520] Anywhere.
[10:55.520 --> 11:00.440] It simply says the Texas Department of Public Safety, okay?
[11:00.440 --> 11:07.480] So by default, the Texas Department of Public Safety is the only agency in the entire transportation
[11:07.480 --> 11:13.200] code under those specific kinds of chapters, enforcement and public safety, that is authorized
[11:13.200 --> 11:18.680] as a matter of law to enforce the transportation code under those chapters.
[11:18.680 --> 11:26.040] Something else has to do with building maintenance, marking, planning and so on of roads, signs
[11:26.040 --> 11:31.280] and things of that nature which is all Department of Transportation, okay?
[11:31.280 --> 11:36.760] So in there, you have two different definitions for department depending upon what the context
[11:36.760 --> 11:39.480] and purpose of a chapter is.
[11:39.480 --> 11:45.000] It's either Department of Public Safety or it's Department of Transportation, okay?
[11:45.000 --> 11:50.480] Now there is a newly formed Department of Motor Vehicles which fall under the county
[11:50.480 --> 11:54.920] tax assessor collector side of these things, okay?
[11:54.920 --> 11:59.640] Under Department of Motor Vehicles, the only chapter that pertains to them is registration,
[11:59.640 --> 12:04.780] the actual way to perform registration, okay?
[12:04.780 --> 12:13.880] But enforcement doesn't have a specific identifying thing other than the Department of Transportation.
[12:13.880 --> 12:17.040] It doesn't identify the Department of Public Safety for the purpose of enforcement if I'm
[12:17.040 --> 12:18.040] remembering correctly.
[12:18.040 --> 12:24.280] Even if it does, it never identifies local law enforcement, never.
[12:24.280 --> 12:29.560] Now you take the fact that every single chapter dealing with enforcement and public safety
[12:29.560 --> 12:33.800] falls under the sole authority of the Department of Public Safety.
[12:33.800 --> 12:38.040] Then you go to the Texas Administrative Code and you find out that under Title 37, the
[12:38.040 --> 12:42.680] Department of Public Safety is a state administrative agency.
[12:42.680 --> 12:49.800] Administrative agency, not a law enforcement agency, an administrative agency.
[12:49.800 --> 12:56.040] Only administrative agencies appear in the administrative code, okay?
[12:56.040 --> 13:01.980] No non-administrative agencies are in the administrative code with parameters set up
[13:01.980 --> 13:05.220] for how they do their jobs.
[13:05.220 --> 13:11.520] Now under Title 37, you have the mission statement of the Department of Public Safety, okay?
[13:11.520 --> 13:14.840] Rule 1.12 to be exact.
[13:14.840 --> 13:20.360] And rule 1.12 in pertinent parts says that the mission of the Department of Public Safety
[13:20.360 --> 13:28.200] is to supervise traffic on rural highways and to supervise and regulate commercial and
[13:28.200 --> 13:29.960] for hire traffic.
[13:29.960 --> 13:31.760] You get that?
[13:31.760 --> 13:36.480] Regulate commercial and for hire traffic.
[13:36.480 --> 13:40.080] Now a little further down, it says that the Department of Public Safety is authorized
[13:40.080 --> 13:46.460] to initiate the following programs for the purpose of fulfilling their duties under their
[13:46.460 --> 13:49.000] mission statement, okay?
[13:49.000 --> 13:54.500] So regulation involves specific programs which the Department of Public Safety is authorized
[13:54.500 --> 14:00.120] to create, maintain, and watch over in every form and fashion, okay?
[14:00.120 --> 14:08.120] That is motor vehicle insurance, okay, which is financial responsibility under the statutes.
[14:08.120 --> 14:14.560] It is driver's licensing, which is also under the transportation code statutes.
[14:14.560 --> 14:17.880] Let's see.
[14:17.880 --> 14:20.680] And public safety inspection, okay?
[14:20.680 --> 14:25.680] So those are the three specific programs the administrative code authorizes the Texas Department
[14:25.680 --> 14:32.760] of Public Safety to create and oversee relating to the enforcement of the transportation code.
[14:32.760 --> 14:38.320] Public safety inspections, driver's licensing, financial responsibility.
[14:38.320 --> 14:44.660] Now remember, these programs are related to that term regulate under their mission statement.
[14:44.660 --> 14:50.160] And the only thing the Department of Public Safety is authorized to regulate is commercial
[14:50.160 --> 14:53.640] and for hire traffic, okay?
[14:53.640 --> 14:55.960] No ifs, no ands, no buts.
[14:55.960 --> 14:57.100] That's all it says.
[14:57.100 --> 14:59.320] That's all there is.
[14:59.320 --> 15:07.860] The transportation code cannot go beyond what the power of the agency is, okay?
[15:07.860 --> 15:14.720] So if that agency is given authority within the transportation code, the presumption of
[15:14.720 --> 15:26.120] law must be that the transportation code has to be fulfilled and enforced and operates
[15:26.120 --> 15:31.220] within the parameters of authority given to that administrative agency.
[15:31.220 --> 15:33.960] It can't go beyond that.
[15:33.960 --> 15:38.480] So if they're limited to commercial and for hire traffic, then the transportation code
[15:38.480 --> 15:42.720] itself to be within their purview, which we absolutely know it is because they're the
[15:42.720 --> 15:49.240] only agency given authority over that code in every one of those chapters for enforcement
[15:49.240 --> 15:55.400] and public safety, it has to be commercial, commercial and for hire traffic.
[15:55.400 --> 15:57.320] That's all there is, okay?
[15:57.320 --> 15:59.440] There's nothing else.
[15:59.440 --> 16:01.840] You won't find a law that says there's anything else.
[16:01.840 --> 16:06.320] You'll find lots of law that is worded to make it appear that it can cover something
[16:06.320 --> 16:13.120] else but nowhere will you find it definitively stated that it does so and if it did do that,
[16:13.120 --> 16:17.280] it would immediately run afoul of the delegated authority given to the Department of Public
[16:17.280 --> 16:19.400] Safety under the Texas Administrative Code.
[16:19.400 --> 16:22.400] Hence, we have a conflict if that were the case.
[16:22.400 --> 16:27.640] Hence, that is an unreasonable reading of the statute on its face because it has an
[16:27.640 --> 16:31.280] unreasonable and undesirable outcome.
[16:31.280 --> 16:37.220] It allows a regulatory code to expand the administrative power of an agency that is
[16:37.220 --> 16:41.600] strictly limited by the rules of the agency.
[16:41.600 --> 16:46.720] To see what the problem here, basically that would be the court saying that the transportation
[16:46.720 --> 16:52.480] code has authorized an administrative agency to act outside of its lawful authority granted
[16:52.480 --> 16:54.320] by the legislature, which can't happen.

[21:24.160 --> 21:31.640] Now, when you look through there, you will come across rule 4.13, subsection C. Under
[21:31.640 --> 21:38.280] there you will find in relation to the definition section under chapter 541 of the transportation
[21:38.280 --> 21:44.880] code where it specifically identifies a defined phrase, police officer.
[21:44.880 --> 21:52.020] In the definition under 541 of police officer, you will read that it is someone who is authorized
[21:52.020 --> 21:57.280] to arrest and enforce under the transportation code provisions.
[21:57.280 --> 22:06.000] Now, right there is proof positive that whoever does this must have a specific authority to
[22:06.000 --> 22:08.400] enforce that code.
[22:08.400 --> 22:15.720] And as we've already heard, the statutes specifically grant that authority only to the Texas Department
[22:15.720 --> 22:22.800] of Public Safety and its officers and employees, not to the local and municipal cops, not the
[22:22.800 --> 22:26.880] sheriff's deputies, not to anybody else.
[22:26.880 --> 22:27.880] Okay?
[22:27.880 --> 22:36.040] So, given that aspect, when you go and you read 4.13, subsection C, and it tells us very
[22:36.040 --> 22:42.000] clearly what the geographic location of any municipality or county must be.
[22:42.000 --> 22:47.600] It tells us what the specific population of any municipality or county must be.
[22:47.600 --> 22:52.900] It tells us exactly how the training and certification requirements for an agent of the Department
[22:52.900 --> 22:59.680] of Public Safety is obtained in order to be an enforcement officer, i.e. police officer
[22:59.680 --> 23:03.600] under the definition under 541 of the transportation code.
[23:03.600 --> 23:04.920] Okay?
[23:04.920 --> 23:13.480] So if the only persons that are actually authorized by law to enforce a transportation code are
[23:13.480 --> 23:19.860] the authorized police officers, which the Department of Public Safety is the sole ones
[23:19.860 --> 23:25.600] from the very beginning, and rule 4.13 under Title 37 of the Texas Administrative Code
[23:25.600 --> 23:30.880] tells us that the only way that any other agency can do it is to become certified by
[23:30.880 --> 23:36.800] the Department of Public Safety, and then their certification is limited strictly to
[23:36.800 --> 23:42.200] enforcement of chapter 644 of the transportation code.
[23:42.200 --> 23:44.680] You get that?
[23:44.680 --> 23:47.880] Chapter 644.
[23:47.880 --> 23:55.040] Now when you read that, chapter 644 is commercial motor vehicle inspection.
[23:55.040 --> 23:57.300] Okay?
[23:57.300 --> 24:06.500] That is the only chapter under the Texas Transportation Code that the Texas Administrative Code authorizes
[24:06.500 --> 24:11.960] local law enforcement that it becomes properly certified and trained by the Department of
[24:11.960 --> 24:14.560] Public Safety to enforce.
[24:14.560 --> 24:19.740] It's the only one, okay?
[24:19.740 --> 24:27.280] So even if the local cop does get authorized, he is not authorized to enforce the entire
[24:27.280 --> 24:29.180] transportation code.
[24:29.180 --> 24:35.600] He can enforce only one specific chapter with one specific purpose, and that is inspection
[24:35.600 --> 24:42.160] of commercial motor vehicles, chapter 644, okay?
[24:42.160 --> 24:48.860] Now as I explained to my cousin again tonight when he was asking the question, is that when

[25:26.620 --> 25:31.920] code and there will be no immunity that can be attached to protect them.

[25:32.920 --> 25:35.780] One, they're acting with no lawful authority.
[25:35.780 --> 25:41.740] An officer has no discretion to violate the law or to act in a manner which the law does

[25:46.300 --> 25:52.000] He is not allowed to impersonate an officer of another agency, which is exactly what the

[25:55.980 --> 26:00.320] When they enforce the transportation code without being properly certified and authorized
[26:00.320 --> 26:05.500] by the Department of Public Safety and they do so in any manner outside of the given chapter
[26:05.500 --> 26:11.660] of 644, then they are impersonating a duly authorized officer of the Department of Public
[26:11.660 --> 26:16.520] Safety and that is a felony crime.
[26:16.520 --> 26:24.160] And if anybody puts that all together, I won't name any names here, and comes to the conclusions
[26:24.160 --> 26:32.280] that again, I won't name any names here, that are apparent from what is written, then the
[26:32.280 --> 26:39.020] issue becomes who gets taken down first?
[26:39.020 --> 26:47.140] Which cop, which town, which department, which city budget?
[26:47.140 --> 26:55.020] Because this would be not only crimes against the public through fraud, extortion, unlawful
[26:55.020 --> 27:01.220] acts by the officer, felony impersonation of an officer of a different agency, felony
[27:01.220 --> 27:08.420] assault, felony murder when they've killed someone at one of these illegal traffic stops,
[27:08.420 --> 27:17.420] felony kidnapping, okay, aggravated in every case because they're wearing a gun and they
[27:17.420 --> 27:23.500] are more than willing to use it as we all well know.
[27:23.500 --> 27:29.580] I mean it goes on and on, official oppression, abuse of official capacity, official misconduct,
[27:29.580 --> 27:35.780] lying under oath, testifying falsely in court and committing aggravated perjury by doing

[27:39.540 --> 27:45.460] Every single traffic stop in the state of Texas is a laundry list of felonies and high
[27:45.460 --> 27:47.560] misdemeanors.

[27:56.220 --> 28:03.220] officer or agent of the DPS, or two, it is being done against someone to whom the code
[28:03.220 --> 28:10.420] actually does not apply, which is members of the general public not engaging in transportation.
[28:10.420 --> 28:23.300] Because remember, DPS rule 1.12, their mission, regulation of commercial and for hire traffic.
[28:23.300 --> 28:31.900] That absolutely excludes the general population that is not commercial and not for hire.

[34:10.820 --> 34:13.980] The courts don't actually lie.
[34:13.980 --> 34:18.060] They abrogate and they obfuscate.
[34:18.060 --> 34:24.180] That means diminish or cover up, but they don't actually lie.
[34:24.180 --> 34:27.180] The way they do this is very simple.
[34:27.180 --> 34:37.900] They keep returning to the statutory terminology as if it is applicable without first establishing
[34:37.900 --> 34:44.300] that the code itself and the statutes under it as well as the definitions and terminology
[34:44.300 --> 34:50.380] are applicable to the specific facts and circumstances involved in the case.
[34:50.380 --> 34:57.660] An allegation that these facts are true is not synonymous with them being true and yet
[34:57.660 --> 35:06.120] the courts propagate the illusion by using the same terminology despite the lack of evidence
[35:06.120 --> 35:12.620] of jurisdictional application.
[35:12.620 --> 35:19.420] They do this because you go into court making these patronate arguments or by failing to
[35:19.420 --> 35:25.340] make the correct arguments even if you're not using a patronate argument.
[35:25.340 --> 35:30.340] By that I mean arguing the right to travel where you still use all the same terms to
[35:30.340 --> 35:32.340] describe your car and your right.
[35:32.340 --> 35:38.020] Even if you don't use the same terms, all you're talking about is your right to travel.
[35:38.020 --> 35:50.940] Well, my first question is this, show me where someone alleged and charged you with violating
[35:50.940 --> 35:54.720] your right to travel.
[35:54.720 --> 35:58.660] Did you commit an offense relating to your right to travel?
[35:58.660 --> 36:00.620] No, you did not.
[36:00.620 --> 36:03.720] That is not what they are alleging.
[36:03.720 --> 36:09.860] They are alleging that you were acting in a legal capacity that had a duty under the
[36:09.860 --> 36:18.320] commercial side of driving and operating upon the highways for business and that you failed
[36:18.320 --> 36:21.860] to comply with your duty under that persona.
[36:21.860 --> 36:26.980] Okay, see, they are not the same thing at all.
[36:26.980 --> 36:29.580] Never have been, never will be.
[36:29.580 --> 36:33.060] It is one of those illusions of law.
[36:33.060 --> 36:41.100] It is one of those things that goes to the concept of legal person, not corporation,
[36:41.100 --> 36:43.680] but simply legal person.
[36:43.680 --> 36:50.540] In this case, legal person is a legal capacity, which I've also told you about before.
[36:50.540 --> 36:52.740] That capacity has a name.
[36:52.740 --> 37:03.660] It is either carrier, driver, operator, or something of those significant definitions
[37:03.660 --> 37:08.100] that create the appearance of a duty under a regulatory code.
[37:08.100 --> 37:14.620] Now, they can also be as simple as person or individual, all right?
[37:14.620 --> 37:18.820] And they may even define it where it appears to encompass you.
[37:18.820 --> 37:23.700] Natural person, that's how they define a living man under the law, natural person.
[37:23.700 --> 37:26.300] But here's the problem.
[37:26.300 --> 37:32.380] In every single case where you find the use of natural person within the transportation
[37:32.380 --> 37:39.940] code, you are going to find, in addition to natural person, a list of legal entities.
[37:39.940 --> 37:46.120] Not just legal capacities, but legal entities, corporations, associations, blah, blah, blah.
[37:46.120 --> 37:47.380] Those are not capacities.
[37:47.380 --> 37:49.580] Those are entities.
[37:49.580 --> 37:56.800] A capacity is something that can be occupied only by a single living individual, whereas
[37:56.800 --> 38:03.320] an entity can encompass several individuals, objects, and things of that nature within
[38:03.320 --> 38:06.940] the sole category of whatever it's being called.
[38:06.940 --> 38:10.820] It's a legal entity, all right?
[38:10.820 --> 38:16.100] So when you look at that with those two distinctions, legal capacity versus legal entity, and that
[38:16.100 --> 38:23.620] legal capacity means one of somebody acting on behalf of one of these legal entities.
[38:23.620 --> 38:28.460] Now, why do we say it's someone when they said natural person, and then they use the
[38:28.460 --> 38:35.620] term individual, or they use natural person without individual, but all the rest of the
[38:35.620 --> 38:40.020] things that are in the list are legal entities?
[38:40.020 --> 38:46.860] Why do I say that these things must operate in a way where they can be related?
[38:46.860 --> 38:51.060] Well, because the rules of statutory construction require it.
[38:51.060 --> 38:55.460] When they say means or includes, the difference between the two is this.
[38:55.460 --> 38:58.060] Means is an exclusive list.
[38:58.060 --> 39:01.620] Whatever's listed is all there is and nothing else.
[39:01.620 --> 39:07.000] Includes is an expansive list, which means all the things that are here and any other
[39:07.000 --> 39:14.180] thing that can be similarly identified as belonging to the same class that everything
[39:14.180 --> 39:18.340] in this list must be a member of.
[39:18.340 --> 39:23.700] See, when they give a definition that includes something that appears conflicting with everything
[39:23.700 --> 39:30.120] else in the list, there has to be a reason and there has to be a reasonable explanation
[39:30.120 --> 39:32.620] and outcome to why that is.
[39:32.620 --> 39:39.260] It is not reasonable to say that a living person is bound by the exact same rules as
[39:39.260 --> 39:47.200] a legal entity because the person, the physical living person was not created by law and is
[39:47.200 --> 39:55.340] not subject to everything in law because that legal or that living individual has inherent
[39:55.340 --> 40:03.560] fundamental protected rights that the legal thing does not have and never will have because
[40:03.560 --> 40:11.240] it is a creation of man under man's law, whereas we are not okay.
[40:11.240 --> 40:19.760] So our rights are not limited by man's law, where man's law is, runs directly a foul of
[40:19.760 --> 40:25.680] a free enjoyment and exercise of those rights.
[40:25.680 --> 40:34.160] Now I'm trying to collect my thoughts here, so I explained this correctly from the top
[40:34.160 --> 40:36.200] down.
[40:36.200 --> 40:41.400] So when you have an individual listed with corporation association, limited liability
[40:41.400 --> 40:45.080] company and all these other legal entities, how do we reconcile one with the other?
[40:45.080 --> 40:51.240] Well, I've got an article on that specific subject up on my website or my legal blog

[40:59.200 --> 41:04.540] When you go there and you read that, it goes into a great detail in explaining the use
[41:04.540 --> 41:11.080] of includes and including, and it will explain the breakdown of all of these things about
[41:11.080 --> 41:16.160] what happens when you take something that appears to be in conflict with a list of other
[41:16.160 --> 41:19.760] things that are listed, and I don't want to have to get into that in great detail here
[41:19.760 --> 41:26.520] because it's a complicated issue to repeat from memory because it takes some processing
[41:26.520 --> 41:29.200] to make sure that you state it correctly and not confuse somebody.
[41:29.200 --> 41:33.220] I took that time and made that effort in that article, so go find it.
[41:33.220 --> 41:39.480] It's very important to read that so that you understand why that is used and how it works.
[41:39.480 --> 41:43.800] Use and including does not mean what you think it means, and it's not used the way you think
[41:43.800 --> 41:48.440] it is used, and it most certainly is not used the way the prosecutors, defense attorneys
[41:48.440 --> 41:53.660] and courts are attempting to use it, and there's tons of law that says it's not the proper
[41:53.660 --> 41:56.400] way to use it.
[41:56.400 --> 42:00.020] So no matter what the state of Texas wants to do, the Supreme Court has already said
[42:00.020 --> 42:05.500] that is not how you use that term, and you're not going to use it that way, and that case
[42:05.500 --> 42:10.000] law is in that article, so you can read it and you can see what's going on with it.
[42:10.000 --> 42:15.520] But needless to say, what it all boils down to is that the individual or natural person
[42:15.520 --> 42:22.940] when listed with these legal entities, the only reasonable interpretation of that definition
[42:22.940 --> 42:32.060] or phrase is that the individual must be acting in some capacity for the benefit or on the
[42:32.060 --> 42:36.560] behalf of one of the listed legal entities.
[42:36.560 --> 42:41.640] It's got to be some capacity relative to them that provides them with some authority or
[42:41.640 --> 42:47.520] some benefit either acting for or on the behalf of that legal entity.
[42:47.520 --> 42:49.700] You get it?
[42:49.700 --> 42:54.080] It's just like when you read the sales tax statutes and you find that the only people
[42:54.080 --> 43:00.000] that are required by law to collect the sales tax and to pay it over are people that work
[43:00.000 --> 43:03.360] for a corporation.
[43:03.360 --> 43:07.600] Everything in the statute specifically says that this person is someone who works for
[43:07.600 --> 43:11.800] a corporation.
[43:11.800 --> 43:18.680] It doesn't mention anyone else as being liable for collecting or paying over that sales tax,
[43:18.680 --> 43:26.100] and yet they force everyone to do it despite the fact that the living individual cannot
[43:26.100 --> 43:32.200] be compelled to waive their rights against indentured servitude to work as a tax collector
[43:32.200 --> 43:36.680] for the state for nothing, which is exactly what the state is demanding every private
[43:36.680 --> 43:38.920] business does.
[43:38.920 --> 43:43.120] You will get a tax certificate, you will work as our tax collector, and you will take only
[43:43.120 --> 43:48.400] what we offer you even if we offer you nothing at all to do that work for us, and it will
[43:48.400 --> 43:53.040] be at your expense to get it all done in time and to pay it over to us.
[43:53.040 --> 43:55.080] It's not going to be our problem.

[50:28.340 --> 50:34.840] to a specific agency whose authority is limited to a specific form of regulation for a specific
[50:34.840 --> 50:41.240] purpose, none of which applies to the general public, then you cannot help but reach the
[50:41.240 --> 50:47.960] conclusion that someone is lying to you.
[50:47.960 --> 50:52.760] Or they've missed something entirely and you're still going to be the one on the hook for

[56:26.440 --> 56:32.260] the administrative option, and the court that they go into never mentions the administrative

[56:33.260 --> 56:38.580] Now, if you or I were to do this by filing suit in the federal court, they would kick
[56:38.580 --> 56:45.780] it out automatically by saying, we had failed to invoke and get all administrative remedy
[56:45.780 --> 56:47.480] in the state.
[56:47.480 --> 56:53.020] The Fed can't hear our case because we have not exhausted our administrative remedies
[56:53.020 --> 56:56.460] for them to have jurisdiction to hear the issue.
[56:56.460 --> 57:01.500] Yet here we are going into a municipal or JP court minus the administrative hearing
[57:01.500 --> 57:10.020] that we're never ever told about by an administrative agency that's required to have such a hearing.

[57:18.020 --> 57:24.400] to have an administrative hearing on the issue, administrative hearings are 100% civil, not

[57:27.260 --> 57:36.140] So how then does an issue that is initially administrative, i.e. civil in its entirety,
[57:36.140 --> 57:43.620] get converted into something that is criminal either before or after the conclusion or completely

[01:35:08.880 --> 01:35:16.320] pseudo title and no agent no no id nobody with no signature no agent name or anything so I told
[01:35:16.320 --> 01:35:21.760] myself I don't know who I'm speaking with using a pseudo title can you identify an agent who I
[01:35:21.760 --> 01:35:28.880] can properly respond to and I told him like what Randy told me to them that they um that their
[01:35:28.880 --> 01:35:34.800] notice was premature because they they said that the situation was still pending in Kentucky so I

[01:36:13.360 --> 01:36:19.600] of your right to an administrative hearing prior to the suspension? Yeah they they they they said
[01:36:19.600 --> 01:36:28.960] I could they said I could request a hearing. Did you? I did not request the hearing I responded
[01:36:28.960 --> 01:36:37.360] selling mail. Yeah but that's not that okay a response to the agency is not binding upon the
[01:36:37.360 --> 01:36:47.120] agency period okay when they offer you the opportunity to have a hearing you have to take it
[01:36:47.120 --> 01:36:51.600] because if you don't they get to act in contrary to anything that might have occurred at that
[01:36:51.600 --> 01:36:59.120] hearing because you did not seek that remedy okay. So the problem is that you now have
[01:36:59.120 --> 01:37:05.520] an administrative issue for which you did not request a hearing that you were entitled to
[01:37:05.520 --> 01:37:11.360] thus allowing the state to default you as far as Tennessee is concerned. So the thing
[01:37:11.360 --> 01:37:15.680] you're complaining about in Kentucky is exactly what you allowed the state of Tennessee to do to
[01:37:15.680 --> 01:37:28.880] you. Okay so what I'm okay but how is what I don't understand is how is that possible when.
[01:37:28.880 --> 01:37:35.840] Because it's administrative it doesn't have to be completed in the other state it's administrative
[01:37:35.840 --> 01:37:43.360] they more or less do the same thing here in Texas. Some local podunk municipal or JP court
[01:37:43.360 --> 01:37:49.200] sends an unlawful illegal notice to the department of public safety to suspend a license
[01:37:50.000 --> 01:37:58.000] citing one of two things failure to appear which they do illegally even when the person appears
[01:37:58.000 --> 01:38:03.680] because the person would not enter a plea without proper notice. Okay the other way is that the
[01:38:03.680 --> 01:38:10.880] statute says that they're required by law to submit that notice of the citation and the charges
[01:38:10.880 --> 01:38:14.000] especially if it's one of the charges for which they can suspend the license
[01:38:14.000 --> 01:38:22.160] such as no financial responsibility proof they are then by statute supposed to notify you of
[01:38:22.160 --> 01:38:28.160] your opportunity for a hearing. Now here's the problem it's exactly what I was saying at the
[01:38:28.160 --> 01:38:33.440] beginning of the show in my diatribe there is that here you're being told you have a right to
[01:38:33.440 --> 01:38:37.440] an administrative hearing over the issue of suspending your license but you're being denied
[01:38:37.440 --> 01:38:40.560] the administrative hearing over the issue for which you're appearing in the other court
[01:38:40.560 --> 01:38:42.400] that is getting your license suspended.
[01:38:46.480 --> 01:38:51.200] It's a completely bogus setup the way they're doing it it's criminal in one instance and
[01:38:51.200 --> 01:39:01.200] completely civil in another which is entirely wrong. Right because what I said even if they
[01:39:01.200 --> 01:39:07.680] because when we read the paper it was almost as if they were saying doesn't matter if they
[01:39:07.680 --> 01:39:13.200] give me administrative hearing they're still going to charge me if they find fit
[01:39:14.720 --> 01:39:20.400] on a situation that's pending out of Kentucky. Well that's why these agencies have to be sued
[01:39:20.400 --> 01:39:25.760] over these administrative statutes. The statute is unconstitutional in that it requires them to
[01:39:25.760 --> 01:39:33.120] take an action that is unlawful it violates a right of due process. An administrative hearing
[01:39:33.120 --> 01:39:38.080] by an administrative judge that is acting as a rubber stamp for the administrative agency
[01:39:38.080 --> 01:39:42.080] is not a due process representation at all.

[01:39:52.880 --> 01:39:55.200] and they always round up if you catch my drift.

[01:40:25.600 --> 01:40:33.360] of that right. I think I can make that because I put them on notice. Absolutely you can make it
[01:40:33.360 --> 01:40:38.480] and here's why these states have what's called a reciprocity agreement in the form of the driver's
[01:40:38.480 --> 01:40:43.280] license compact. Look in the state statutes I guarantee you both Kentucky and Tennessee
[01:40:43.280 --> 01:40:50.880] have a driver's license compact section in their statutes. In that agreement which they must prove
[01:40:50.880 --> 01:40:56.880] the United States congress authorized in which case the whole thing is federal anyway
[01:40:58.880 --> 01:41:06.240] under title 49 which is what I've tried to tell people all along because the the federal
[01:41:06.240 --> 01:41:12.160] constitution has a specific clause that forbids any state from entering into any agreement or
[01:41:12.160 --> 01:41:18.080] compact with any other state of the union without express consent by the United States congress.
[01:41:19.440 --> 01:41:24.640] Okay the only clause within the federal constitution that would allow congress
[01:41:24.640 --> 01:41:29.840] to reach within the state to approve such a compact or agreement is the commerce clause.
[01:41:31.280 --> 01:41:36.800] It's the only one. Okay in relation to transportation in these motor vehicles
[01:41:36.800 --> 01:41:43.280] it's the only one. So under the commerce clause which again ties all this right back to commerce

[01:41:50.160 --> 01:41:55.280] they could have gotten it is with federal approval which makes the federal laws binding over the
[01:41:55.280 --> 01:42:04.080] state laws. Get it? Right. Which now makes it a federal case issue that you can take up in
[01:42:04.080 --> 01:42:14.400] federal court as long as you plead it correctly. Gotcha. So so would that be a a uh. Title 42
[01:42:14.400 --> 01:42:21.920] lawsuit. Okay. Violation of rights under color of law state law that's in violation of controlling
[01:42:21.920 --> 01:42:33.920] federal law of the same subject. That's okay. So I will sue Tennessee. Well if you can make
[01:42:33.920 --> 01:42:39.440] the conspiracy argument by showing that either the states did not have congressional approval
[01:42:39.440 --> 01:42:46.240] to enter into that compact or by showing that the states mutually agreed to act illegally
[01:42:46.240 --> 01:42:53.600] under the compact then you can make a conspiracy argument as well. Okay. Conspiracy or criminal
[01:42:53.600 --> 01:42:59.920] collusion. Now whether or not you have a federal cause of action out of that for a civil side
