[01:37.600 --> 01:42.080] and on Israel by Russia, either accusatory narrative without any verified evidence as
[01:42.080 --> 01:43.400] of yet.
[01:43.400 --> 01:46.880] President Trump tweeted today, Wednesday, that if, quote, Russia vows to shoot down
[01:46.880 --> 01:51.240] any and all missiles fired at Syria, get ready, Russia, because they will be coming in nice
[01:51.240 --> 01:52.960] and new and smart.
[01:52.960 --> 01:56.480] Going on to warn Russia that you shouldn't be partners with a gas-killing animal who
[01:56.480 --> 01:58.640] kills his people and enjoys it.
[01:58.640 --> 02:02.680] Many in the West, including President Trump, have been quick to conclude that this chemical
[02:02.680 --> 02:07.560] attack must have been conducted by Assad and his forces, Syria and Russia on the other
[02:07.560 --> 02:12.440] hand have given approval since yesterday for the organization for the prohibition of chemical
[02:12.440 --> 02:15.880] weapons to investigate the side of the chemical slaughter.
[02:15.880 --> 02:19.440] Assad has been successful in maintaining rule and support during Syria's seven-year civil
[02:19.440 --> 02:24.040] war, a civil war that is being fought by the government of Syria and anti-Assad Syrian
[02:24.040 --> 02:28.800] rebels that are openly being funded by Western governments, with ISIS being one of the more
[02:28.800 --> 02:32.560] notorious splinter groups of the American-backed Syrian rebels.
[02:32.560 --> 02:37.320] I was surprised then why Russian Foreign Minister Spokeswoman Maria Zakoba posted on
[02:37.320 --> 02:42.160] Facebook that smart missiles should be fired at terrorists and not at a legitimate government,
[02:42.160 --> 02:44.440] which has been fighting terrorists.
[02:44.440 --> 02:48.280] Or is this a trick to destroy all traces with a smart missile strike, and then there will
[02:48.280 --> 02:52.120] be no evidence for international inspectors to look at?

[04:27.880 --> 04:30.880] I've been concerned lately
[04:30.880 --> 04:36.880] A few years ago I was traveling somewhere and I had to pull over to look up a phone number
[04:36.880 --> 04:38.880] I didn't want to do it while I was driving
[04:38.880 --> 04:46.880] And I pulled under a big light next to a closed convenience store
[04:46.880 --> 04:51.880] And I could barely see the light for the bugs flying around it
[04:51.880 --> 04:55.880] We've all had that experience
[04:55.880 --> 05:00.880] When was the last time you had that experience?
[05:00.880 --> 05:05.880] I have been noticing the bugs are gone
[05:05.880 --> 05:12.880] I just drove a thousand miles and I may have 30 bugs on my windshield
[05:12.880 --> 05:16.880] I walk around outside and I don't see any flying insects
[05:16.880 --> 05:21.880] I was on my back porch and generally we have
[05:21.880 --> 05:27.880] Yellowjackets everywhere, they're gone
[05:27.880 --> 05:30.880] All the flying insects are gone
[05:30.880 --> 05:38.880] I was just reading some research studies and the scientists are alarmed
[05:38.880 --> 05:42.880] That since the 19, this one study in Zermattie since 1989
[05:42.880 --> 05:48.880] The insect population has dropped 79%
[05:48.880 --> 05:55.880] And the rate of decreases increasing dramatically
[05:55.880 --> 06:03.880] Shades of Armageddon, insects are an integral part of the ecosystem
[06:03.880 --> 06:11.880] And it may be that carpet blanketing the landscape with insecticides
[06:11.880 --> 06:22.880] Has reached a tilting point to where the bugs are falling off
[06:22.880 --> 06:28.880] The levels are really dramatic, this is scary
[06:28.880 --> 06:34.880] I tell you I'm concerned when you just notice walking around that the insects are gone
[06:34.880 --> 06:37.880] That's going to make you nervous
[06:37.880 --> 06:43.880] Anybody who studies insects and has any idea what's going on
[06:43.880 --> 06:50.880] I'd sure like to find out because of all of the things I've heard
[06:50.880 --> 06:55.880] All kinds of horrors and terrible things happening
[06:55.880 --> 06:59.880] This is one everybody can walk outside and see
[06:59.880 --> 07:03.880] When it gets dark tonight, go outside and look up at one of the local
[07:03.880 --> 07:08.880] One of the street lights or one of your property lights
[07:08.880 --> 07:12.880] Count the number of bugs you see out there
[07:12.880 --> 07:19.880] If there are few enough that you can count them, you should be afraid
[07:19.880 --> 07:35.880] Okay, back to business, making headway on the legal litigation engine
[07:35.880 --> 07:40.880] I'm building a business plan right now
[07:40.880 --> 07:46.880] Within a week or so I should be ready to start moving for financing
[07:46.880 --> 07:49.880] A big time financing to really get this thing launched
[07:49.880 --> 07:53.880] So that part is really moving well
[07:53.880 --> 08:05.880] We have been helping someone in a traffic issue here in the county that I live in
[08:05.880 --> 08:15.880] And I'm encountering some really surprising behavior on the parts of judges and lawyers
[08:15.880 --> 08:18.880] There's some people that just had some...
[08:18.880 --> 08:24.880] The guy has an auto repair facility
[08:24.880 --> 08:29.880] His wife was on the city council, she got off the city council
[08:29.880 --> 08:33.880] She didn't vote for this city administrator's raise
[08:33.880 --> 08:36.880] She was the only one that didn't vote for the raise
[08:36.880 --> 08:45.880] And as soon as she got off city council, the city administrator started on a vendetta after them
[08:45.880 --> 08:54.880] Just recently they charged them with eight violations of the jump vehicle code
[08:54.880 --> 09:06.880] And now they're trying to collect $80,000 for eight violations of the motor vehicle code
[09:06.880 --> 09:14.880] Of the municipal code which has a maximum fee of $200 each
[09:14.880 --> 09:26.880] These guys have acted like there is no law, there is no retribution, they can do anything they want to
[09:26.880 --> 09:33.880] And the judge is absolutely upholding everything they do
[09:33.880 --> 09:37.880] And we are going after the judge
[09:37.880 --> 09:42.880] This may actually be a good opportunity
[09:42.880 --> 09:49.880] This is a brand new judge, he's just been in just a few months, he was just appointed by the governor
[09:49.880 --> 09:57.880] And totally ignoring law, he just instructed the other side to file a motion in severance
[09:57.880 --> 10:04.880] And they filed a motion in severance, well I did research on motion in severance
[10:04.880 --> 10:09.880] It is absolutely inapplicable to this case
[10:09.880 --> 10:14.880] But the judge instructed him to do it because he fully intends to grant their motion
[10:14.880 --> 10:18.880] He's granted everything that they have filed
[10:18.880 --> 10:23.880] He has denied everything that Tim has filed
[10:23.880 --> 10:28.880] And he has refused on three occasions to provide findings of fact and conclusions at law
[10:28.880 --> 10:31.880] And we filed criminal charges against him the first time
[10:31.880 --> 10:36.880] And we'll be filing criminal charges against him the next two
[10:36.880 --> 10:41.880] The next time we do it, we will file with the Texas Ranger
[10:41.880 --> 10:49.880] Trying to get a procedure worked out to where we engage everybody in this process
[10:49.880 --> 10:58.880] And get everybody in a position to where bad behavior on the part of one public official
[10:58.880 --> 11:02.880] Mushrooms out and engages everybody
[11:02.880 --> 11:08.880] I just sent out two sets of complaints, one to someone in Tyler
[11:08.880 --> 11:13.880] Another one to someone in Austin or south of Austin
[11:13.880 --> 11:20.880] Where I have a series of criminal complaints included in there against public officials
[11:20.880 --> 11:28.880] And very strategically they both have a complaint against the district attorney
[11:28.880 --> 11:35.880] And we sent them to him and they're going to send them to the local Texas Ranger
[11:35.880 --> 11:39.880] And here's the problem the Ranger has
[11:39.880 --> 11:43.880] Ron Earl, when he was the district attorney for Travis County
[11:43.880 --> 11:48.880] He's the guy that took out Tom DeLay, the speaker of the House of the United States
[11:48.880 --> 11:50.880] The House of Representatives
[11:50.880 --> 11:58.880] The second most powerful political individual in the country and a local district attorney
[11:58.880 --> 12:01.880] Takes him out illegally
[12:01.880 --> 12:06.880] Nobody ever accused Tom DeLay of a crime
[12:06.880 --> 12:09.880] But he was convicted, spent a couple years in jail
[12:09.880 --> 12:13.880] And then they made a deal and dismissed the whole thing for lack of evidence
[12:13.880 --> 12:16.880] And he was out, everything was gone
[12:16.880 --> 12:22.880] It's pretty clear to me afterward that this was all a political deal
[12:22.880 --> 12:27.880] That Tom DeLay made to keep from actually being prosecuted
[12:27.880 --> 12:31.880] He had to give up a couple years and a pellet process
[12:31.880 --> 12:35.880] Generally you don't go to jail while you're on appeal
[12:35.880 --> 12:41.880] But second highest political figure in the country goes to jail while he's on appeal
[12:41.880 --> 12:45.880] And that was clearly part of the deal that he made
[12:45.880 --> 12:48.880] When they came into the courtroom to have the trial
[12:48.880 --> 12:57.880] I walked in and handed Tom DeLay a copy of a habeas corpus I had filed on his behalf
[12:57.880 --> 12:59.880] And I gave one to Dick DeGaron
[12:59.880 --> 13:02.880] Dick DeGaron was his attorney
[13:02.880 --> 13:07.880] Dick DeGaron is really famous and he should be famous for losing
[13:07.880 --> 13:13.880] Because all these high level cases, high profile cases he takes, he seems to lose them all
[13:13.880 --> 13:18.880] And it's my opinion that he's bought and paid for by the government
[13:18.880 --> 13:21.880] And he's given them exactly what they want
[13:21.880 --> 13:24.880] But without regard to Dick DeGaron
[13:24.880 --> 13:30.880] Lost words to go over this
[13:30.880 --> 13:40.880] Okay, Ron Earl, the way he did this to Tom DeLay is he used his public integrity unit
[13:40.880 --> 13:46.880] He talked the legislature into funding a public integrity unit
[13:46.880 --> 13:51.880] A unit specifically for the purpose of investigating public officials
[13:51.880 --> 13:57.880] And during this time I filed a large number of criminal complaints against public officials
[13:57.880 --> 14:04.880] In Travis County and all of them went into the trash except one set
[14:04.880 --> 14:11.880] One set, the set against nine of the highest judges in the state
[14:11.880 --> 14:15.880] The court of criminal appeals judges, they didn't go in the trash
[14:15.880 --> 14:18.880] They went to a grand jury
[14:18.880 --> 14:30.880] But then Tom DeLay, Tom DeLay, Beckham, Ron Earl was retiring, 25 year DA and he was retiring
[14:30.880 --> 14:32.880] He was a Democrat
[14:32.880 --> 14:35.880] All nine of these judges were Republicans
[14:35.880 --> 14:37.880] I've talked about this on the show before
[14:37.880 --> 14:42.880] That was an epiphany for me
[14:42.880 --> 14:45.880] It was a learning experience
[14:45.880 --> 14:49.880] That's when the first time it was made very clear to me
[14:49.880 --> 14:54.880] That you will never win your case simply because you have the law and the facts on your side
[14:54.880 --> 14:58.880] You will win the case if you have the politics on your side
[14:58.880 --> 15:08.880] Because the filing of these complaints with the grand jury had nothing to do with the complaints
[15:08.880 --> 15:17.880] Ron Earl used my complaints as cannon fodder to try to take these nine judges out with him when he retired
[15:17.880 --> 15:20.880] It was all political
[15:20.880 --> 15:27.880] Everything's political. If we're going to win our cases, we have to understand the politics and start using the politics
[15:27.880 --> 15:31.880] And that's what I've been working on for quite a while
[15:31.880 --> 15:43.880] And right now, I'm getting in a spot to where I'm really learning how to use it
[15:43.880 --> 15:53.880] The reason I'm going to the grand jury, going to the Texas Ranger, is Ron Earl's public integrity units
[15:53.880 --> 15:58.880] After they went after the governor, Republicans got together and got rid of that public integrity unit
[15:58.880 --> 16:02.880] And moved everything to the Texas Rangers
[16:02.880 --> 16:07.880] Now, prior to this, the Texas Ranger could not investigate a complaint against a public official
[16:07.880 --> 16:12.880] Without the written permission of the Director of the Department of Public Safety himself
[16:12.880 --> 16:15.880] They kept all of this in house
[16:15.880 --> 16:23.880] When they were granted specific authority, the Director could no longer interfere with their ability to enforce
[16:23.880 --> 16:30.880] So they set up a set of protocols so that the Ranger had to ask permission from the prosecuting attorney
[16:30.880 --> 16:37.880] We're about to go to break and we'll talk about how we're using that to create a political situation for the Ranger

[20:22.880 --> 20:27.880] We were actually subject to a violation

[20:58.880 --> 21:06.880] It annoys me that I don't have all my questionnaires built yet because there was something in your case that I've been missing
[21:06.880 --> 21:13.880] There's been no information filed in the court
[21:13.880 --> 21:19.880] In traffic court, they can prosecute on the complaint
[21:19.880 --> 21:26.880] There's a special exemption, but that only applies to traffic court
[21:26.880 --> 21:33.880] It does not apply to anything else and they're treating everything else the same way they treat traffic court
[21:33.880 --> 21:42.880] I was going through the procedure for the local magistrate with whom I just filed a criminal complaint
[21:42.880 --> 21:51.880] Some guy stole some stuff from a property and she had no idea what to do with my complaint
[21:51.880 --> 21:58.880] Now she's kind of nervous with me because I filed criminal charges against her a number of times with the prosecutor attorney
[21:58.880 --> 22:04.880] But I never really pursued him and she knows that I'm knowledgeable
[22:04.880 --> 22:11.880] So she's concerned and I brought in a set of verified criminal affidavits and I filed it with her court
[22:11.880 --> 22:19.880] And I called her and she said she did not know what to do with them
[22:19.880 --> 22:24.880] That she asked me if I'd filed it with the local police and I said no, I'm not going to
[22:24.880 --> 22:29.880] Last time I filed criminal charges with the local police department, they threw them in a trash
[22:29.880 --> 22:32.880] So I'm not going to hear them again
[22:32.880 --> 22:37.880] Well Mr. Caltlin, you need to file these with the local police, I need to do no such thing
[22:37.880 --> 22:50.880] There's nothing in law that directs a criminal complaint to a police officer or a prosecutor attorney or anyone other than a magistrate
[22:50.880 --> 22:57.880] The law is very well structured in this regard
[22:57.880 --> 23:12.880] Magistrates everywhere the code addresses a complaint, it addresses a complaint relative to a magistrate, never a judge
[23:12.880 --> 23:23.880] And that's because the criminal complaint is the document that gives jurisdiction to the magistrate
[23:23.880 --> 23:29.880] For the purpose of holding an examining trial
[23:29.880 --> 23:38.880] Then after the magistrate holds an examining trial and makes a determination under 16.17, Texas Code of Criminal Procedure
[23:38.880 --> 23:44.880] He seal all documents had in the hearing, cause his name to be written across the ceiling envelope
[23:44.880 --> 23:55.880] For the court of jurisdiction, that's how jurisdiction moves from the magistrate to the judge
[23:55.880 --> 24:00.880] Even if the judge and magistrate are the same person
[24:00.880 --> 24:10.880] The complaint must be examined by a magistrate and a determination of probable cause made
[24:10.880 --> 24:15.880] Then the trial court has jurisdiction
[24:15.880 --> 24:22.880] The complaint must, along with a warrant, must be forwarded to the magistrate
[24:22.880 --> 24:31.880] And then the prosecuting attorney is required to create an information and file that with the court
[24:31.880 --> 24:37.880] And the prosecution is in...
[24:37.880 --> 24:42.880] Wait, you can't keep talking while I'm talking, you're getting something in the background still
[24:42.880 --> 24:49.880] Hang on, let me go here, this is my kid talking to this older chap, let me move out of here
[24:49.880 --> 24:51.880] Okay, can you hear now?
[24:51.880 --> 24:53.880] Yeah, okay
[24:53.880 --> 24:58.880] It is, the process is, the magistrate holds an examining trial
[24:58.880 --> 25:05.880] Then he issues a warrant under 16.20 and it is that warrant
[25:05.880 --> 25:12.880] It is issued based on a finding of probable cause that gives the trial court subject matter jurisdiction
[25:12.880 --> 25:19.880] Then the trial court is to secure the prosecuting attorney and have the prosecuting attorney prepare an information
[25:19.880 --> 25:27.880] The reason for an information is, is that a criminal complaint is intended to be filed by a private citizen
[25:27.880 --> 25:38.880] So it is not required to be specifically legal yet
[25:38.880 --> 25:44.880] Once a determination of probable cause is made and the case is filed with the court
[25:44.880 --> 25:50.880] Then the prosecuting attorney takes complaint and reduces it to an information
[25:50.880 --> 25:56.880] An information is a criminal complaint in proper form
[25:56.880 --> 26:00.880] And the prosecution commences based on the criminal complaint
[26:00.880 --> 26:07.880] I'm sorry, the prosecution commences based on the information
[26:07.880 --> 26:14.880] That's what the law says, that's this very specific procedure in the law
[26:14.880 --> 26:29.880] Well, in this case, the control officer filed a complaint and gave it to the trial judge and the trial judge issued a subpoena
[26:29.880 --> 26:33.880] Whoa guys, you can't get there
[26:33.880 --> 26:41.880] So we filed a, the document I sent you back was a motion to dismiss for lack of subject matter jurisdiction
[26:41.880 --> 26:47.880] I'm sorry, I did not call this a first appearance, but it is a special appearance
[26:47.880 --> 26:53.880] It's a challenge to the impersonal jurisdiction of the court
[26:53.880 --> 26:59.880] It's not exactly, it is a challenge to the subject matter jurisdiction of the court
[26:59.880 --> 27:06.880] But by way of the court's lack of personal jurisdiction over the individual
[27:06.880 --> 27:15.880] The court has general subject matter, general jurisdiction over the subject matter

[27:24.880 --> 27:37.880] And then we'll file a, I have the challenge to subject matter jurisdiction with the constitutional challenge ready to be filed, almost ready
[27:37.880 --> 27:43.880] In a prior case with Tim, we filed this challenge subject matter jurisdiction
[27:43.880 --> 27:46.880] And the prosecution never answered it
[27:46.880 --> 27:51.880] So we filed a motion for summary judgment and they never ruled on the summary judgment
[27:51.880 --> 27:57.880] They just went right to collection, too long and complex to go into all those details
[27:57.880 --> 28:03.880] But then they were dumb enough to write a second citation
[28:03.880 --> 28:08.880] And in this case, Tim has an affirmative defense
[28:08.880 --> 28:18.880] Because the vehicle at the time of the citation was legal within code and he could prove it
[28:18.880 --> 28:22.880] But we're not going to do that yet
[28:22.880 --> 28:26.880] We're going to give them the opportunity to screw everything up again
[28:26.880 --> 28:29.880] So we can come back at them
[28:29.880 --> 28:37.880] And so we're setting them up and I wanted to go through that because it's pedantic, it's detailed
[28:37.880 --> 28:39.880] But this is how we're going to beat them up
[28:39.880 --> 28:43.880] What I was saying before the break about Texas Ranger
[28:43.880 --> 28:48.880] Tim filed criminal charges against the district judge
[28:48.880 --> 28:52.880] And I'm certain he didn't see this coming
[28:52.880 --> 29:01.880] Because under Rule 297, Rule 297 and Rules of Civil Procedure says that after a ruling
[29:01.880 --> 29:08.880] If a litigant requests a finding of fact and conclusions at law
[29:08.880 --> 29:15.880] The court shall produce findings of fact and conclusions at law within 20 days
[29:15.880 --> 29:19.880] It says shall, it does not say may, might, or can if he wants to
[29:19.880 --> 29:24.880] Now, there are procedures that can happen if he doesn't do that
[29:24.880 --> 29:29.880] But the way I read the code, the judge failed to perform due to his prior to form
[29:29.880 --> 29:34.880] And processed not Tim and the fool-free access to or joined the right
[29:34.880 --> 29:39.880] And the prosecutor didn't give it to the grand jury
[29:39.880 --> 29:43.880] We have no evidence that he gave it to the grand jury
[29:43.880 --> 29:50.880] So now we're going to put together a whole group of criminal complaints and file it with the Texas Ranger
[29:50.880 --> 29:52.880] So what's the Ranger going to do?
[29:52.880 --> 29:54.880] We'll talk about that when we come back

[33:39.880 --> 33:43.880] And the strategy here is Tim has reached the point in the case
[33:43.880 --> 33:45.880] To where things are about to turn
[33:45.880 --> 33:51.880] These guys have pulled every shyster shenanigan they could think of
[33:51.880 --> 33:58.880] Tim, you were just in a motion to recuse the judge
[33:58.880 --> 34:03.880] Before Judge Evans, the head administrative judge at the district
[34:03.880 --> 34:07.880] Now, he's not really a judge, he's administrative officer
[34:07.880 --> 34:09.880] He's called him a judge
[34:09.880 --> 34:17.880] And he was there to decide whether or not to recuse this judge in this case
[34:17.880 --> 34:25.880] And Tim, tell them what the judge said to these lawyers about sandbagging
[34:25.880 --> 34:31.880] They said, don't think you guys are going to come in here and sandbag this gentleman
[34:31.880 --> 34:36.880] Because I'm not going to have it in my court
[34:36.880 --> 34:40.880] It comes from him looking at the pleadings
[34:40.880 --> 34:44.880] And seeing what they've been doing
[34:44.880 --> 34:48.880] For the head administrative judge to say that
[34:48.880 --> 34:52.880] To the lawyers on the opposing side
[34:52.880 --> 34:58.880] Was surprising at the very least
[34:58.880 --> 35:02.880] I sat there astounded, I couldn't believe he said that
[35:02.880 --> 35:06.880] Because generally Judge Evans, especially if it's a pro se lidigan
[35:06.880 --> 35:10.880] Just blows them off without regard
[35:10.880 --> 35:15.880] And in a lot of cases we've had him receive the motion to recuse
[35:15.880 --> 35:19.880] And deny it immediately
[35:19.880 --> 35:21.880] But here he didn't
[35:21.880 --> 35:26.880] And Tim had, this was on Monday, Tuesday
[35:26.880 --> 35:29.880] Monday's holiday, this was on Tuesday
[35:29.880 --> 35:33.880] And Tim had another hearing on Thursday
[35:33.880 --> 35:45.880] And the judge in the court said that he would render his ruling late Thursday or Friday
[35:45.880 --> 35:49.880] And I thought that was very telling
[35:49.880 --> 35:52.880] Here we've got a judge that's not engaged in this
[35:52.880 --> 35:56.880] The district judge is kind of upset because we filed criminal charges
[35:56.880 --> 35:59.880] To conduct complaints against him and went right after him
[35:59.880 --> 36:05.880] And he's a brand new judge, he just got appointed by the governor
[36:05.880 --> 36:08.880] Because the previous judge died
[36:08.880 --> 36:13.880] And I don't think the fact that he died had anything to do with the fact that I filed
[36:13.880 --> 36:17.880] First we fell in aggravated assault charges against him
[36:17.880 --> 36:21.880] At least I hope it wasn't
[36:21.880 --> 36:25.880] He hated me but I didn't particularly dislike him
[36:25.880 --> 36:28.880] He didn't wish him that kind of ill
[36:28.880 --> 36:31.880] But apparently he dropped out of a heart attack
[36:31.880 --> 36:34.880] But I had filed against him
[36:34.880 --> 36:38.880] And then this judge knows that I'm working with Tim
[36:38.880 --> 36:43.880] And then now we filed against this judge
[36:43.880 --> 36:46.880] And that probably made him real unhappy
[36:46.880 --> 36:50.880] And it's probably embarrassing to him because he just got in office
[36:50.880 --> 36:54.880] And he's got somebody coming after him
[36:54.880 --> 37:01.880] And filing criminal charges for something that the judges do all the time
[37:01.880 --> 37:06.880] With absolute relative impunity
[37:06.880 --> 37:09.880] Generally they get away with anything they do
[37:09.880 --> 37:15.880] No lawyer in his right professional mind would ever consider filing the criminal complaint
[37:15.880 --> 37:20.880] Against the judge for ruling he makes in the court
[37:20.880 --> 37:25.880] And they're real quick to tell you that the judge has immunity from what he does on the court
[37:25.880 --> 37:28.880] Even he acts maliciously
[37:28.880 --> 37:34.880] Well, that immunity doesn't extend to criminal prosecution
[37:34.880 --> 37:41.880] And primary thrust of what I'm doing now in terms of crafting of remedy
[37:41.880 --> 37:50.880] Goes to let's start holding these judges criminally responsible for their bad behavior
[37:50.880 --> 38:01.880] I have the case law that says that the judge has no discretion in properly applying the law to the facts
[38:01.880 --> 38:12.880] Failure to do so is a due process violation addressable by extraordinary remedy which means mandamus
[38:12.880 --> 38:16.880] And we filed a mandamus in this case
[38:16.880 --> 38:20.880] But it is a due process violation
[38:20.880 --> 38:28.880] Well a due process violation that falls under 39.03 Texas penal code for public official
[38:28.880 --> 38:31.880] Exerts reports to exerting authority does not expressly have
[38:31.880 --> 38:35.880] Or fails to perform a duty he's required to perform it in the process
[38:35.880 --> 38:40.880] Denies a citizen in the full and free access to or enjoyment of a right
[38:40.880 --> 38:43.880] That's due process violation
[38:43.880 --> 38:47.880] And it's a crime in the state of Texas
[38:47.880 --> 38:52.880] So this sets them up the process they judge up for criminal prosecution
[38:52.880 --> 38:58.880] And depending on the behavior of other public officials in the state
[38:58.880 --> 39:04.880] It sets the state up for a RICO suit
[39:04.880 --> 39:08.880] And we're working on that RICO suit side
[39:08.880 --> 39:15.880] By filing criminal complaints against all these people with the Texas Ranger
[39:15.880 --> 39:19.880] Now we put the Ranger on the die
[39:19.880 --> 39:26.880] Now the Ranger has to according to his protocol
[39:26.880 --> 39:37.880] Go to the prosecuting attorney and ask permission to pursue investigation of these accusations
[39:37.880 --> 39:39.880] Or a problem
[39:39.880 --> 39:42.880] We got criminal complaints against the prosecuting attorney in there
[39:42.880 --> 39:45.880] So what does the prosecutor do now?
[39:45.880 --> 39:49.880] I mean what does the Texas Ranger do now?
[39:49.880 --> 39:58.880] Does he go to the accused and ask the accused if he can investigate the accused?
[39:58.880 --> 40:01.880] Talk about a double bind
[40:01.880 --> 40:09.880] I put this Ranger there once before and when he went to the district attorney
[40:09.880 --> 40:12.880] This time I didn't have complaints against the district attorney
[40:12.880 --> 40:14.880] I just have complaints against the public official
[40:14.880 --> 40:20.880] He went to the prosecuting attorney and asked the prosecuting attorney's permission to pursue prosecution
[40:20.880 --> 40:26.880] And the prosecutor refused to even address it
[40:26.880 --> 40:32.880] But I charged the Ranger and the director of the department of public safety
[40:32.880 --> 40:37.880] Who approved the protocols with criminal conspiracy to commit
[40:37.880 --> 40:45.880] And filed a jury along with the complaints against Judge Westell
[40:45.880 --> 40:47.880] We will do the same again
[40:47.880 --> 40:52.880] Except this time the prosecuting attorney will also be one of the accused
[40:52.880 --> 40:58.880] So I'm hoping that the Ranger doesn't want to get presented to another grand jury
[40:58.880 --> 41:08.880] And we just hand gave out two sets of complaints where they'll be putting two other Texas Rangers in the same position
[41:08.880 --> 41:11.880] In different locations in Texas
[41:11.880 --> 41:15.880] One of them is in Tyler in East Texas
[41:15.880 --> 41:21.880] The other one is south of Austin between Austin and San Antonio
[41:21.880 --> 41:23.880] And the third one is up here in West County
[41:23.880 --> 41:27.880] So they're kind of spread out across the state which will work out very well
[41:27.880 --> 41:34.880] And you can be relatively sure that every Ranger in the state of Texas will find out about this very quickly
[41:34.880 --> 41:40.880] I mentioned that to the district attorney and he said, yeah, they'll find out about it about 45 seconds
[41:40.880 --> 41:43.880] Everybody will get noticed
[41:43.880 --> 41:49.880] So what we're trying to do here is free up the Texas Rangers
[41:49.880 --> 41:53.880] Get them out from under the prosecuting attorney
[41:53.880 --> 41:59.880] So the Texas Rangers freely investigate allegations against public officials
[41:59.880 --> 42:02.880] Whether they do that or not
[42:02.880 --> 42:09.880] The fact that they can creates a serious problem for public officials
[42:09.880 --> 42:14.880] Because you may have one Ranger under control but you're not going to get all of them
[42:14.880 --> 42:18.880] And from what I've seen of Texas Rangers
[42:18.880 --> 42:22.880] So far they have all been proud men
[42:22.880 --> 42:29.880] They like to think that they are the elite law enforcement in the state
[42:29.880 --> 42:36.880] And I like dealing with someone who has pride and self-esteem
[42:36.880 --> 42:43.880] Because they're a lot more jealous about their reputation
[42:43.880 --> 42:50.880] So I'm hoping that this will lend extra weight to our arguments
[42:50.880 --> 42:53.880] And get these public officials
[42:53.880 --> 43:02.880] I'm hoping we'll get these other district judges not to want to wind up in the situation that Judge Brock Smith finds himself
[43:02.880 --> 43:06.880] What do you think?

[48:23.880 --> 48:32.880] Well, if you look at the ordinance, it says the first thing is that it has to be unregistered or uninspected or not have any place at all
[48:32.880 --> 48:45.880] Then it has the word and, so it has to have that first, and then and, it's either dismantled, discarded, or it is inoperable
[48:45.880 --> 48:58.880] And, you know, why would you jump to a conclusion that it's inoperable when it's registered and that should take it off the table for them to write it down
[48:58.880 --> 49:04.880] What you just said, you said it must have this condition and this condition and this condition
[49:04.880 --> 49:09.880] You did not say it must have this condition or this condition or this condition
[49:09.880 --> 49:11.880] And
[49:11.880 --> 49:17.880] It had to have all of them, and obviously it does not have one of those conditions
[49:17.880 --> 49:18.880] Right
[49:18.880 --> 49:31.880] So if you have two vehicles, and one of them you don't use, because you liked it and when you bought a new one, you didn't want to give it away to the dealer for next to nothing
[49:31.880 --> 49:33.880] So you decided just to keep it
[49:33.880 --> 49:41.880] You know, I've got one that's completely paid for, it runs great, and I'm considering getting a new vehicle, but if I do, I'm going to keep this one
[49:41.880 --> 49:46.880] And you have to sit there next to the house and you don't use it
[49:46.880 --> 49:52.880] Are you subject to criminal prosecution if it's licensed?
[49:52.880 --> 49:53.880] Shouldn't be
[49:53.880 --> 49:55.880] That's the condition we're going to
[49:55.880 --> 50:01.880] And we're well aware, this one absolutely is an act of retaliation
[50:01.880 --> 50:08.880] We will get to that, but we're going after them strategically
[50:08.880 --> 50:18.880] Tim, you have an affirmative defense, but you have no duty to exert that affirmative defense on the front end
[50:18.880 --> 50:22.880] You can exert that affirmative defense anytime you want to
[50:22.880 --> 50:38.880] And the time to do that is when you get the officer on the stand, get him to testify
[50:38.880 --> 50:49.880] And then when you ask him, was what are the elements of the crime, please read them to the jury
[50:49.880 --> 50:58.880] And when he reached the statute to the jury, were all of these elements present?
[50:58.880 --> 51:04.880] When you filled out that citation and swore to it under oath
[51:04.880 --> 51:07.880] Let's see if he's smart enough to figure where you're going
[51:07.880 --> 51:11.880] This is how aggravated perjury works
[51:11.880 --> 51:15.880] Aggravated perjury is only aggravated perjury
[51:15.880 --> 51:27.880] If the perjurer did not recant his testimony before the fact of the perjurious nature of the testimony becomes evident
[51:27.880 --> 51:31.880] Well, here's the confusing part of the whole thing, Randy
[51:31.880 --> 51:35.880] On the notice that he sent me about the vehicle
[51:35.880 --> 51:41.880] He notes on there that it's registered till March of 2018
[51:41.880 --> 51:45.880] And he wrote the ticket in January of 2018
[51:45.880 --> 51:51.880] Yeah, so the citation is insufficient on its face
[51:51.880 --> 51:54.880] It's invalid on its face
[51:54.880 --> 51:57.880] Why would they do that? Well, he put on that notice also
[51:57.880 --> 52:01.880] He put as per city attorney Andrew Messer
[52:01.880 --> 52:11.880] Yes, so we want to take him to the court on aggravated perjury
[52:11.880 --> 52:15.880] This is why we're not bringing the affirmative defense early
[52:15.880 --> 52:25.880] We wait until we get the officer on the stand and have him testify to these facts
[52:25.880 --> 52:35.880] You see, he filed a verified criminal affidavit and stated that he had reason to believe and did believe that you had committed this criminal act
[52:35.880 --> 52:44.880] Yet, he was at the time in procession of information indicated that you were not in violation of this act
[52:44.880 --> 52:48.880] Therefore, that filing was perjurious
[52:48.880 --> 52:58.880] And you don't want to give him an opportunity to recant his perjury until he's already perjured himself in front of a jury
[52:58.880 --> 53:07.880] And then you bring the affirmative defense and show that at the time you were charged
[53:07.880 --> 53:14.880] You did not meet the elements of the crime and then you charge the officer with aggravated perjury
[53:14.880 --> 53:20.880] You have already been put to the prosecution
[53:20.880 --> 53:26.880] You've already been forced to stand and answer and thereby you have been harmed
[53:26.880 --> 53:31.880] Now you get to sue this guy personally
[53:31.880 --> 53:34.880] We'll see how that works for him

[01:05:29.880 --> 01:05:37.880] I was, when I was doing some research for the motion I wrote for you earlier today
[01:05:37.880 --> 01:05:50.880] I did a search for hearings in municipal courts and I got a hit on the Texas Municipal League's bench book
[01:05:50.880 --> 01:06:05.880] And it listed, you know, it said that the court was authorized under 2801 to summon and accuse the court for pre-trial hearing
[01:06:05.880 --> 01:06:16.880] And it said they, in the beginning it indicated they could order them to appear to meet with counsel, meet with the prosecutor
[01:06:16.880 --> 01:06:19.880] And that was not true
[01:06:19.880 --> 01:06:30.880] Further down in the bench book, they accurately stated what the judge could order you to come to the hearing for
[01:06:30.880 --> 01:06:38.880] 28.01 lists 11 things they can order you to come to hearing for
[01:06:38.880 --> 01:06:41.880] The first one is an arraignment
[01:06:41.880 --> 01:06:50.880] An arraignment is a hearing for the purpose of determining the identity of the accused and taking the plea
[01:06:50.880 --> 01:06:58.880] You see, that's in there because you're charged with the crime, but the court's never seen you
[01:06:58.880 --> 01:07:06.880] The magistrate should have, the magistrate should have held an examining trial and he would have saw you
[01:07:06.880 --> 01:07:10.880] And he would know who you are, but the court doesn't
[01:07:10.880 --> 01:07:21.880] And even if the magistrate is the same guy who has jurisdiction as the judge, the court has to officially recognize you
[01:07:21.880 --> 01:07:28.880] Unless, unless it's a Class C misdemeanor
[01:07:28.880 --> 01:07:33.880] And in that case, they're forbidden to hold on, 26.01
[01:07:33.880 --> 01:07:42.880] An arraignment may be held in the matter of a felony or a misdemeanor punishable by imprisonment
[01:07:42.880 --> 01:07:58.880] Why on earth did the legislature see fit to put in as their first statute on arraignment a prohibition against arraignments in Class C misdemeanor cases
[01:07:58.880 --> 01:08:01.880] They went to special trouble to do that
[01:08:01.880 --> 01:08:07.880] I mean, it's not like it was 1655 or something way down at the bottom
[01:08:07.880 --> 01:08:14.880] It's a very first one before they explained what an arraignment hearing was for
[01:08:14.880 --> 01:08:16.880] They put that prohibition in
[01:08:16.880 --> 01:08:26.880] Well, they can call you for an arraignment and there are 10 other things and each one of them goes to a motion repeating filed in the court
[01:08:26.880 --> 01:08:33.880] At this point, are there any motions or pleadings filed in the court?
[01:08:33.880 --> 01:08:39.880] Just not guilty, though I'll let you know
[01:08:39.880 --> 01:08:42.880] No, not guilty is not a motion or pleadings

[01:09:43.880 --> 01:09:51.880] So I went to the pre-trial hearing, I went to that, that's when I filed my special appearance with them
[01:09:51.880 --> 01:09:55.880] Stamped it and everything else, okay, so they had it back in February
[01:09:55.880 --> 01:09:57.880] My hearing was not...
[01:09:57.880 --> 01:09:59.880] Okay, hold on, hold on
[01:09:59.880 --> 01:10:02.880] Are you talking about the current case?

[01:11:02.880 --> 01:11:07.880] When I went up there, I said, I'm not guilty, I said, first of all, I need to know what you're charging me with
[01:11:07.880 --> 01:11:14.880] And I want you to explain it to me because I'm not an attorney, and that set her off immediately
[01:11:14.880 --> 01:11:21.880] And so when I went up before the judge, the judge wanted me to explain to him special appearance
[01:11:21.880 --> 01:11:29.880] I said, well, wait a second, I said, she is an attorney and she won't explain to me what I'm being charged with
[01:11:29.880 --> 01:11:36.880] And you're an attorney and you want me to explain to you a legal document, I said, I'm not doing it
[01:11:36.880 --> 01:11:42.880] It's there, it's in plain English, you can read it, and so he said it aside
[01:11:42.880 --> 01:11:52.880] So you could tell they were flustered because the prosecutor came up behind me, you know, you're sitting in a little chair in front of the judge
[01:11:52.880 --> 01:12:00.880] She came up behind me and started objecting to different things and the judge looked at her and was just like, chill out, lady
[01:12:00.880 --> 01:12:12.880] It was unusual, but when me and Laura left, everybody had, we had everybody's attention and we walked out of there
[01:12:12.880 --> 01:12:17.880] And I felt a little better because I stayed cool the whole time, you heard everything
[01:12:17.880 --> 01:12:26.880] That's right, that's right, I heard the plea again, he did, and I kind of feel like all this time we've spent has been worth it
[01:12:26.880 --> 01:12:37.880] When I can get someone that they can walk into the court and the court pulls their shenanigans and you don't wind up dancing with them
[01:12:37.880 --> 01:12:46.880] You don't wind up getting flustered and angry and doing things that they can deal with effectively
[01:12:46.880 --> 01:12:52.880] Dad, I've done my job, I've created a monster
[01:12:52.880 --> 01:13:01.880] The Code Enforcement Officer doing this, it still, this throws me for a loop and you said, but you say that you don't understand why they do it either
[01:13:01.880 --> 01:13:10.880] Why would they do something that is obviously against the law for me? Why would they write me up? It doesn't make any sense
[01:13:10.880 --> 01:13:14.880] I don't, I've never understood it
[01:13:14.880 --> 01:13:25.880] The Code Enforcement Officer, he really doesn't, you know, he just started doing a job, why would he risk prison?
[01:13:25.880 --> 01:13:31.880] Why would he risk committing criminal acts? Does a Court Enforcement Officer wear a pistol?
[01:13:31.880 --> 01:13:38.880] He's been a, he's a marshal, he was a police officer for 38 years and caught on a phone camera
[01:13:38.880 --> 01:13:44.880] No, no, that wasn't my question, does he wear a pistol?
[01:13:44.880 --> 01:13:48.880] If he does, I don't know, I don't know, I haven't been, I haven't seen it
[01:13:48.880 --> 01:13:57.880] Okay, okay, if you haven't seen it, then you can't say he, he was prominently displaying it at the weapons, so that's, that's one step in his favor

[01:13:58.880 --> 01:14:09.880] You know, generally these guys, I've talked to a lot of Code Enforcement Officers and they're pretty well ordinary people, they don't have any access to grind

[01:14:13.880 --> 01:14:20.880] Maybe because he was a police officer for a long time and he was very familiar with testifying
[01:14:20.880 --> 01:14:24.880] I think they have courses in testifying

[01:14:41.880 --> 01:14:44.880] So we got a lot of stuff we were going to have fun with them with

[01:14:49.880 --> 01:14:55.880] And they'll tell you that they can file, the prosecutor can file a motion within 24 hours of the hearing

[01:16:27.880 --> 01:16:33.880] And I also filed charges against him with the local mayor in Mississippi
[01:16:33.880 --> 01:16:37.880] And all three of them have not responded
[01:16:37.880 --> 01:16:44.880] So I remember you and Scott have talked about mail fraud with the grand jury that the prosecutor intercepts it

[01:41:45.880 --> 01:41:55.880] And that's intended for guys like you got a big farm here and you raise a lot of grain and you got your own trucks to haul the grain to the elevator.
[01:41:55.880 --> 01:42:05.880] Well, those trucks are not in commerce because the trucks are not being paid by a customer to haul that grain.
[01:42:05.880 --> 01:42:11.880] That's you hauling your own grain and that's not in commerce.

[01:42:27.880 --> 01:42:33.880] In the state of Illinois, they have what's called PM plates for permanent mounted.
[01:42:33.880 --> 01:42:44.880] If you have a vehicle that has permanent mounted equipment, you get a special plate on it and you don't fall under commercial.
[01:42:44.880 --> 01:42:53.880] This is it's like a crane that's specifically for cranes and things like that where you're not hauling product for someone else, then you're not in commerce.
[01:42:53.880 --> 01:42:56.880] So these guys, they already know.

[01:42:57.880 --> 01:43:02.880] So I just filed with DOT and I know 80 didn't like that.

[01:53:24.880 --> 01:53:29.880] You must always make it out of the mouth of the legislature or the mouth of the courts.
[01:53:29.880 --> 01:53:33.880] You'll notice that when I'm talking here and I say this guy,
[01:53:33.880 --> 01:53:39.880] he did this in violation of 39.03 code of criminal procedure and a penal code
[01:53:39.880 --> 01:53:41.880] and I quote the statute.
[01:53:41.880 --> 01:53:44.880] That's how you have to do it in court.
[01:53:44.880 --> 01:53:47.880] If I had done that, he would have dismissed the whole thing.
[01:53:47.880 --> 01:53:51.880] He told me you have to bring me the law.
[01:53:51.880 --> 01:53:54.880] Yeah, this is what the code says.
[01:53:54.880 --> 01:54:04.880] I've got a great case that says the judge has no discretion in properly applying the law to the facts.

[01:54:13.880 --> 01:54:18.880] He's required to take the law brought to him by both sides,
[01:54:18.880 --> 01:54:25.880] then apply the law to the facts that are in the case and come to a proper adjudication.
[01:54:25.880 --> 01:54:30.880] So the judge was exactly right and he was giving you good instruction.
[01:54:30.880 --> 01:54:34.880] I knew he was when he said it because I've heard you say.

[01:55:09.880 --> 01:55:20.880] On your first appearance here for traffic court, there's not even a prostitute there.
[01:55:20.880 --> 01:55:28.880] Basically, everybody except me gets up there and just sleeps guilty and he tells them to go to the clerk and find out how much court cost is.
[01:55:28.880 --> 01:55:31.880] It's just like a revolving door.
[01:55:31.880 --> 01:55:35.880] I haven't seen anybody else except me.
[01:55:35.880 --> 01:55:37.880] I haven't seen anybody else all the time.

[01:55:40.880 --> 01:55:47.880] In Texas, there were 7.1 million traffic tickets filed in 2016.
[01:55:47.880 --> 01:55:52.880] 73% paid the ticket without even ever coming to court.
[01:55:52.880 --> 01:55:57.880] 27% came to court to a first hearing made a deal with a prosecutor.
[01:55:57.880 --> 01:56:00.880] 99% of them did.
[01:56:00.880 --> 01:56:06.880] Less than four tenths of a percent of the people who get traffic tickets fight them.
[01:56:06.880 --> 01:56:10.880] Four tenths of a percent.
[01:56:10.880 --> 01:56:12.880] Yeah, I've noticed that.
[01:56:12.880 --> 01:56:16.880] Everybody who's in court, here's the thing.
[01:56:16.880 --> 01:56:23.880] When you fight them, they have no idea what to do.
[01:56:23.880 --> 01:56:27.880] Well, they're going railroads.
[01:56:27.880 --> 01:56:32.880] Well, I got tools for that.
[01:56:32.880 --> 01:56:36.880] I don't know what the number is in Tennessee, but I've read it.
[01:56:36.880 --> 01:56:38.880] Every state has it.
[01:56:38.880 --> 01:56:41.880] You have an official misconduct statute.
[01:56:41.880 --> 01:56:49.880] And it says if public official fails to perform due to his required to perform, or exerts reports to exert authority he does not expressly have,
[01:56:49.880 --> 01:56:56.880] and in the process, not as useful for access to rejoin the right, that's a crime in the state of Tennessee.
[01:56:56.880 --> 01:57:01.880] That is a reflection of the Ku Klux Klan Act, 1871.
[01:57:01.880 --> 01:57:08.880] And the Ku Klux Klan Act was passed because of the Ku Klux Klan.
[01:57:08.880 --> 01:57:11.880] And were the Ku Klux Klan out of?
[01:57:11.880 --> 01:57:13.880] Pulaski, Tennessee.
[01:57:13.880 --> 01:57:15.880] Well, this all originated in Tennessee.
[01:57:15.880 --> 01:57:17.880] Tennessee has such a statute.
[01:57:17.880 --> 01:57:26.880] And it says if they exert or purport to exert an authority they do not have, that is a catch-all.
[01:57:26.880 --> 01:57:35.880] Just about anything they do wrong, you can stick underneath that because you have a right to due process.
[01:57:35.880 --> 01:57:42.880] And if their act denies you in the foolish free access to your enjoyment right, that's generally a class A misdemeanor.
[01:57:42.880 --> 01:57:45.880] That's a pretty big deal.
[01:57:45.880 --> 01:57:49.880] So I go in there with my view invisible to our baby.
[01:57:49.880 --> 01:57:55.880] And I never ask public officials to do anything that I actually want them to do.
[01:57:55.880 --> 01:57:59.880] Because I never ask them to do anything the law doesn't command them to do.
