[04:27.120 --> 04:32.960]  that I was involved in today on fascist book, I mean Facebook.
[04:32.960 --> 04:40.360]  In this, the discussion was about the right to keep and bear arms, Second Amendment, etc.,
[04:40.360 --> 04:41.360]  etc.
[04:41.360 --> 04:48.480]  And, some, one of the people that was there was trying to say that regulated means that
[04:48.480 --> 04:54.480]  the government can regulate everything about a gun, and then he used a modern dictionary
[04:54.480 --> 04:57.000]  definition of the term, regulate.
[04:57.000 --> 05:05.960]  Now, this is not at all consistent with the phrase well-regulated as meant and understood
[05:05.960 --> 05:07.400]  by the Founding Fathers.
[05:07.400 --> 05:14.160]  They are completely different terms with completely different purposes.
[05:14.160 --> 05:22.040]  Anyway, that's how he defined regulated was regulation, and I told him that's not going
[05:22.040 --> 05:23.040]  to work.
[05:23.040 --> 05:29.680]  What I posted was well-regulated means well-trained, not licensed or registered.
[05:29.680 --> 05:34.800]  And then I said you're using a modern dictionary definition of regulation that is not at all
[05:34.800 --> 05:42.480]  the meaning of 1780's language of well-regulated in relation to the Bill of Rights and the
[05:42.480 --> 05:44.120]  Second Amendment.
[05:44.120 --> 05:48.360]  When the Founders wrote of a well-regulated militia, they meant the people forming the
[05:48.360 --> 05:53.520]  militias needed to be well-regulated through training and drilling in order to be effective
[05:53.520 --> 05:54.920]  in battle.
[05:54.920 --> 06:00.200]  This could only happen if citizens had unrestricted access to firearms.
[06:00.200 --> 06:05.240]  The amendment's primary justification was to prevent the United States from needing a standing
[06:05.240 --> 06:06.960]  army.
[06:06.960 --> 06:11.120]  Preventing the United States from starting a professional army, in fact, was the single
[06:11.120 --> 06:13.960]  most important goal of the Second Amendment.
[06:13.960 --> 06:21.000]  It is hard to recapture this fear today, but during the 18th century, few boogeymen were
[06:21.000 --> 06:27.680]  as scary as the standing army, an army made up for professional full-time soldiers.
[06:27.680 --> 06:35.880]  Our founding fathers and those that fought in the Revolutionary War were up against
[06:35.880 --> 06:41.680]  a permanent trained professional army in the Redcoats.
[06:41.680 --> 06:42.680]  That's all they did.
[06:42.680 --> 06:46.880]  They lived and trained to fight for King George.
[06:46.880 --> 06:53.120]  Our entire set of fighters began as militia.
[06:53.120 --> 06:58.760]  Even when they had the quote-unquote regulars, those were more like people that were very
[06:58.760 --> 07:04.160]  often sent to training, but they were still not professional soldiers.
[07:04.160 --> 07:09.240]  They were like what we do with the National Guard and the military reservists today.
[07:09.240 --> 07:14.360]  One weekend a month, you go train, you practice, you do the job that you train for in the military.
[07:14.360 --> 07:18.840]  Then when the weekend's over, you collect your pittance of a paycheck for being there
[07:18.840 --> 07:23.080]  and go home for the rest of the month.
[07:23.080 --> 07:29.000]  That's what the regulars were in that day and age here on this continent.
[07:29.000 --> 07:36.440]  In England, the Redcoats were the regulars, and it's all they did.
[07:36.440 --> 07:42.760]  The militia was meant to augment those regulars here in America to make them into a capable
[07:42.760 --> 07:49.880]  army to fight off invaders and those that wanted to take from us, including the King
[07:49.880 --> 07:52.880]  of England.
[07:52.880 --> 07:56.480]  Now to continue on.
[07:56.480 --> 08:02.520]  By the logic of the 18th century, any society with a professional army could never be truly
[08:02.520 --> 08:03.520]  free.
[08:03.520 --> 08:07.640]  The men in charge of that army could order it to attack the citizens themselves, who
[08:07.640 --> 08:12.280]  unarmed and unorganized would be unable to fight back.
[08:12.280 --> 08:19.360]  This is why a well-regulated militia was necessary to the security of a free state, to be secure
[08:19.360 --> 08:25.720]  a society needed to be able to defend itself, to be free it could not exist merely at the
[08:25.720 --> 08:29.040]  whim of a standing army and its generals.
[08:29.040 --> 08:35.240]  The only way to be both free and secure was for citizens to be armed, organized and ready
[08:35.240 --> 08:37.400]  to defend their society.
[08:37.400 --> 08:43.640]  The choice was a stark one, a standing army or a free nation.
[08:43.640 --> 08:49.640]  Now then this fellow pipes in by the name of Andrew Zimmer and I'm going to make him
[08:49.640 --> 08:57.520]  notorious today because this is liberal ignorance on the hoof right here.
[08:57.520 --> 09:05.560]  He didn't have a lot to say but it speaks volumes in what he does say.
[09:05.560 --> 09:10.880]  He goes on to say, well-trained militias still have rules about weapons, dude.
[09:10.880 --> 09:17.140]  The whole point of weapons training in basic is to prevent accidental discharges.
[09:17.140 --> 09:21.360]  You can tell this guy's never served in the military or gone through basic training, especially
[09:21.360 --> 09:23.240]  in the Marines.
[09:23.240 --> 09:29.520]  The whole point of the NRA lately is to increase the odds of accidental discharge or ejaculation.
[09:29.520 --> 09:35.080]  Now where this guy came up with this, I have no idea but here's his thought process.
[09:35.080 --> 09:39.240]  There's losing your way and then there's going from pushing from middle ground gun laws
[09:39.240 --> 09:43.760]  in 1973 to shrugging when kids are murdered in 2018.
[09:43.760 --> 09:49.360]  A bunch of bearded camel wearers in the woods scares me less than a suburban gun owner.
[09:49.360 --> 09:55.000]  In all honesty, even a paramilitary usually has a chain of command and part of staying
[09:55.000 --> 09:59.320]  off the grid is not butchering first graders.
[09:59.320 --> 10:04.080]  So much for reason and critical thinking process on his part here.

[10:22.480 --> 10:27.000]  you with the weapons you will be issued and teach you how to care for them and shoot them
[10:27.000 --> 10:32.600]  so you can accurately hit and kill the quote unquote enemy before he kills you.

[10:38.280 --> 10:42.320]  Is that the excuse your dad used when your mother got pissed once she found out she was

[11:28.960 --> 11:33.600]  No one is shrugging because children are killed, except maybe those people in government who
[11:33.600 --> 11:38.320]  kill thousands of them daily around the globe and call it collateral damage when they do

[11:40.640 --> 11:46.040]  But you want me to give up my guns so those in that same government can eventually decide
[11:46.040 --> 11:49.960]  that they have every right to do the same thing to all of us in America too.

[11:54.720 --> 12:00.720]  However, as someone who has not arbitrarily, intentionally, or even accidentally killed
[12:00.720 --> 12:07.880]  someone with my guns or used them to commit crimes against others ever, I refuse to allow
[12:07.880 --> 12:13.680]  someone like you or the government to be the one who gets to decide that I am the one to
[12:13.680 --> 12:19.120]  be punished and left defenseless because of the acts of those who have, by trying to take,
[12:19.120 --> 12:24.480]  away my right to fight off and repel every one of you that thinks you can do so and get
[12:24.480 --> 12:26.320]  away with it.
[12:26.320 --> 12:30.920]  The people's individual right to keep and bear arms is meant to do exactly the same thing
[12:30.920 --> 12:37.320]  the arms race does between countries, establish mutually assured destruction as a means to
[12:37.320 --> 12:40.360]  avoid wars and armed conflicts.
[12:40.360 --> 12:45.920]  We the people keep and bear arms so that our own government and status idiots who support
[12:45.920 --> 12:50.680]  it by thinking and believing those in control of it have only our best interest at heart
[12:50.680 --> 12:56.080]  rather than their own have to seriously consider the likelihood of their own destruction before
[12:56.080 --> 13:01.240]  they even begin to act by attacking and enslaving us to the personal wills and desires of its
[13:01.240 --> 13:03.240]  masters.
[13:03.240 --> 13:08.040]  To do that, we have to be just as well-armed as the military and police that will be used
[13:08.040 --> 13:10.400]  to carry out such orders.

[13:17.920 --> 13:23.880]  then I need and want my guns to ensure that you take a moment of pause before you take

[13:29.320 --> 13:34.920]  or consequences when you try to decide what other rights I have that you don't like or
[13:34.920 --> 13:37.320]  think I need.
[13:37.320 --> 13:43.680]  Now, folks, you want to know how you're going to lose your guns?
[13:43.680 --> 13:48.600]  It's by being outnumbered by people with this mindset.
[13:48.600 --> 13:54.280]  You want to know why they want to take your guns so that they can feel good about themselves
[13:54.280 --> 13:59.480]  and feel safe in their own skin until they turn around and realize how defenseless they
[13:59.480 --> 14:03.800]  are now that they've been not only disarmed themselves, but everyone else that would have
[14:03.800 --> 14:13.320]  stood between them and what will surely befall them without them.
[14:13.320 --> 14:21.160]  I cannot think of a single country on this globe where the people have surrendered their
[14:21.160 --> 14:28.040]  right to bear arms and the government has not turned on them like a rabid dog and oppressed

[14:35.920 --> 14:41.440]  Now, why do you think that is?
[14:41.440 --> 14:48.560]  What limits does government think it has right now and we still have our guns?

[20:22.780 --> 20:27.780]  She had a kitchen knife in her hand from whatever she was cooking.
[20:27.780 --> 20:31.780]  She was standing there talking to her neighbor, not being aggressive,
[20:31.780 --> 20:35.780]  not threatening anybody, just chatting with her neighbor.
[20:35.780 --> 20:42.780]  A bunch of cops show up because somebody reported a woman outdoors with a knife
[20:42.780 --> 20:49.780]  and out of the, I think the story said, six police officers total,
[20:49.780 --> 20:56.780]  one of them decided that within five seconds of shouting dropped the knife
[20:56.780 --> 21:00.780]  to shoot this woman multiple times.
[21:00.780 --> 21:03.780]  The woman had not been charged with anything, had committed no crime,
[21:03.780 --> 21:07.780]  had no complaints against her, was not acting aggressive, was threatening no one,
[21:07.780 --> 21:15.780]  was simply talking to her neighbor while holding a kitchen knife.
[21:15.780 --> 21:21.780]  And she got shot and the Supreme Court said that's okay.
[21:21.780 --> 21:32.780]  The officer is immune from civil lawsuit because he believed it was okay to shoot this woman.
[21:32.780 --> 21:38.780]  And we're still having arguments over the right to keep and bear arms.
[21:38.780 --> 21:41.780]  This is what they're resorting to people.
[21:41.780 --> 21:46.780]  The Supreme Court is taking away your rights as quickly as it can rule upon them
[21:46.780 --> 21:52.780]  and it is using any flimsy excuse it can to find the government right and you wrong
[21:52.780 --> 21:57.780]  in every case before it.
[21:57.780 --> 22:04.780]  The only time I can recall seeing the Supreme Court rule in a case is when,
[22:04.780 --> 22:11.780]  for the people, it's when it doesn't interfere with the status quo of the government
[22:11.780 --> 22:14.780]  using its enforcement arm to do what it wants.
[22:14.780 --> 22:19.780]  Sure, DC versus Heller says we have the right to keep and bear arms as individuals
[22:19.780 --> 22:22.780]  unless you point them at a government official that's trying to kill you
[22:22.780 --> 22:28.780]  and then you're guilty no matter what, which is itself a problem
[22:28.780 --> 22:32.780]  because that, ladies and gentlemen, is the whole purpose of the Second Amendment to begin with
[22:32.780 --> 22:39.780]  so that we can point our guns at government officials who were violating the Constitution
[22:39.780 --> 22:45.780]  and the rights and property of the people.
[22:45.780 --> 22:51.780]  Now, I'm sure there are many people that may hear this that say I'm telling you to go out and kill cops.
[22:51.780 --> 22:53.780]  No, I'm not.
[22:53.780 --> 22:58.780]  But I am telling you that you have every right to defend yourself even from a cop
[22:58.780 --> 23:07.780]  when that cop is doing something wrong and is trying to hurt you in the process.
[23:07.780 --> 23:16.780]  It's not true just of cops, it's true of anyone, anyone.
[23:16.780 --> 23:27.780]  But nowadays, they're the ones most likely that you will have to defend yourself from.
[23:27.780 --> 23:35.780]  And we're still having people so stupid that they are advocating the surrender
[23:35.780 --> 23:47.780]  of the only means we have to stop it and to prevent it from getting even worse.
[23:47.780 --> 23:56.780]  You can tell when the veal has surrendered itself to its pin.
[23:56.780 --> 23:58.780]  It no longer struggles to get out.
[23:58.780 --> 24:05.780]  It no longer does anything except just eat, sleep, poop, and wait.
[24:05.780 --> 24:10.780]  And that is what these gun advocates have become.

[24:17.780 --> 24:22.780]  I have no desire to be veal for any reason.
[24:22.780 --> 24:28.780]  I don't care how well you would feed me, I don't care how well you would keep my cage.
[24:28.780 --> 24:39.780]  Eventually, you're going to cut me up and eat me when it suits you.

[35:32.780 --> 35:39.780]  Well, the only thing about these numbers, John, and I don't mean to say you're lying or anything but here's the problem.
[35:39.780 --> 35:47.780]  They say isn't proof of what they did and you got to remember just how many bodies that would actually be.
[35:47.780 --> 36:01.780]  You would have to have a humongous mass burial grave or means of disposing of that many bodies if you actually had them.
[36:01.780 --> 36:15.780]  You would have to sit down and calculate how many people per day that would have actually required in the course of using those facilities in order to be true.
[36:15.780 --> 36:28.780]  So rather than giving out these large numbers that we absolutely have no way of knowing for sure that it's true information because we were not there and we didn't keep those records.

[36:30.780 --> 36:33.780]  Well, I guess, yeah, I guess we weren't there, thank God.
[36:33.780 --> 36:34.780]  Okay.
[36:34.780 --> 36:46.780]  So my point being that even though I agree the premise here is the government took the guns, I don't think the numbers will ring true if history could be viewed clearly from the get-go as to what was actually done.
[36:46.780 --> 36:50.780]  I'm not saying a lot of people weren't killed and a lot of people didn't die.
[36:50.780 --> 37:05.780]  But those numbers, those numbers are huge for the facilities and resources that were available to dispose of the bodies at the time and place where this was supposedly done.

[37:07.780 --> 37:09.780]  Oh yeah, yeah, I got you.
[37:09.780 --> 37:21.780]  You know that in the Middle East, according to the figures that I've heard, 500,000 people, civilians, were just eliminated.
[37:21.780 --> 37:34.780]  They were murdered in the last Gulf War or the last two Gulf Wars, half a million people, and anyway, I think those numbers are probably accurate.
[37:34.780 --> 37:41.780]  Well, hang on just a second, I'll give you an example.

[37:45.780 --> 37:47.780]  All right.
[37:47.780 --> 37:55.780]  Now, these are just estimates that were given for total fatalities in World War II.
[37:55.780 --> 38:01.780]  Now this is all people, soldiers, and civilians in all the countries involved in the war.
[38:01.780 --> 38:07.780]  We've got figures ranging from 50 million to more than 80 million.
[38:07.780 --> 38:10.780]  Now that's just for World War II.
[38:10.780 --> 38:14.780]  How long did World War II wage?
[38:14.780 --> 38:15.780]  How long?
[38:15.780 --> 38:17.780]  Well 41 to 45.
[38:17.780 --> 38:18.780]  Right.
[38:18.780 --> 38:21.780]  So we're talking four years.
[38:21.780 --> 38:23.780]  All right.
[38:23.780 --> 38:30.780]  So if a total of 50 million to 80 million died and all the countries combined,
[38:30.780 --> 38:35.780]  how did 60 of them want to be in German Jews?

[40:19.780 --> 40:25.780]  The public service announcement runs and it says in 19, whatever,
[40:25.780 --> 40:29.780]  they passed a law that every household had to have a gun.
[40:29.780 --> 40:35.780]  Well, according to them, their crime rate went down 75% below the national average.
[40:35.780 --> 40:36.780]  And I believe that.
[40:36.780 --> 40:37.780]  Why?
[40:37.780 --> 40:43.780]  Because nobody in their right mind is going to break into a house and stare down the barrel of a 12 gauge.
[40:43.780 --> 40:46.780]  And I mean, you've got to be really stupid.
[40:46.780 --> 40:51.780]  You're going to pick a house that you figure nobody's going to have any guns or slingshots
[40:51.780 --> 40:54.780]  or bows and arrows or whatever you're using.
[40:54.780 --> 40:59.780]  But when it comes to guns, the Second Amendment was written for a reason.
[40:59.780 --> 41:05.780]  And if you notice, yeah, but that reason actually had nothing to do with home defense.
[41:05.780 --> 41:12.780]  It had to do with complete society defense and it wasn't against just foreigners.
[41:12.780 --> 41:16.780]  Sure, they were a concern, but they were not the concern.
[41:16.780 --> 41:27.780]  Oh, no, it was to liberty, the definition of when people fear the government, that's tyranny.
[41:27.780 --> 41:31.780]  But when the government fears the people, that's called liberty.
[41:31.780 --> 41:36.780]  And there's a reason why the Second Amendment was put right after the first one.
[41:36.780 --> 41:44.780]  Life, liberty in the pursuit of happiness, freedom of speech, freedom of religion, and freedom of the press.
[41:44.780 --> 41:50.780]  And how are you going to have that unless you have people who can back it up?
[41:50.780 --> 41:55.780]  Are you going to go charging a man who's 12 gauge aimed at your head?
[41:55.780 --> 41:57.780]  I don't think so.

[41:59.780 --> 42:07.780]  But it's going to be a lot harder when you go to attack someone that they can defend themselves and they know how to use it.

[42:11.780 --> 42:20.780]  The first thing you do is you stick a sign in your front yard saying that your houses aren't prepared to shoot anyone attempting to break into it.

[42:21.780 --> 42:31.780]  Meanwhile, you also pin a map of your neighborhood on it with all of your liberal, we don't want guns, neighbors houses highlighted on the map that says,

[42:41.780 --> 42:45.780]  Now they'll stay away from your house to go get the ones that don't have guns.
[42:45.780 --> 42:50.780]  And of course those neighbors will come begging you later to come protect them with your gun.
[42:50.780 --> 42:59.780]  And you'll have to go, I'm sorry, but I respect your right to not have to have armed individuals invading your home.
[42:59.780 --> 43:04.780]  So I will not facilitate that by entering myself for your defense.
[43:04.780 --> 43:06.780]  You chose to be defenseless.
[43:06.780 --> 43:08.780]  That's your situation.
[43:08.780 --> 43:10.780]  They come to my house or get shot.

[46:46.780 --> 47:01.780]  Well, it's a combination. My question is this. In New York State, you see signs all over with a circle and then, you know, a line through it repeal the safe act.
[47:01.780 --> 47:27.780]  And it's my understanding that when you have a law, a rule, a code, a statute that goes against the state constitution and especially the U.S. Constitution, it is null and void at its inception and does not need to go to court to determine the unconstitutionality.
[47:27.780 --> 47:41.780]  It's unconstitutional at its inception and if any one part of that law is unconstitutional, the whole thing is unconstitutional and you don't have to repeal the safe act.
[47:41.780 --> 48:01.780]  But it's my understanding that if you were to break the law, we'll say that you defiled the safe act, which half of the sheriffs in New York State openly defied Mr. Cuomo and they said they weren't going to enforce it.
[48:01.780 --> 48:08.780]  I mean, it was one of the largest acts of civil disobedience but it really wasn't civil. It was the law.
[48:08.780 --> 48:13.780]  Okay. Well, John, hold on a sec. There's still not a question, man.
[48:13.780 --> 48:32.780]  My question is this. Well, I'm just giving you the background. The question is this. What do you say to my comment? I've heard other people say, well, you break that law and they'll arrest you and then you're going to have a tough time in court proving the law unconstitutional.
[48:32.780 --> 48:44.780]  I say the law is already unconstitutional and it doesn't need to be in court if it goes against if it contradicts the federal constitution. What do you say? Does it need to go?
[48:44.780 --> 48:56.780]  I say that's absolutely correct. I've been saying that for years. The Texas Constitution specifically says that any act that acts against any provision of the Texas Constitution is null from its inception.
[48:56.780 --> 49:05.780]  It doesn't require a court. Nothing in the Constitution says if a court decides it's unconstitutional. It says it is unconstitutional.
[49:05.780 --> 49:22.780]  End of discussion. It is null. It is void. It is not existent. However, that being said, that does not mean that they're going to do what the Constitution requires because they already aren't.
[49:22.780 --> 49:35.780]  They're still going to kill you. They're still going to convict you. They're still going to say it was your fault for resisting. They're still going to try to paint you as the criminal rather than themselves.
[49:35.780 --> 49:47.780]  This is the problem with being an individual who understands their rights versus a nation and a society that understands their rights.
[49:47.780 --> 49:53.780]  When you're outnumbered by the idiots, every act is dangerous.

[50:01.780 --> 50:12.780]  Well, like I said, here in Texas you would be absolutely right because that's written specifically into not just the Constitution but in the Bill of Rights of our Constitution.
[50:12.780 --> 50:26.780]  Oh yeah, of course. Of course. And then there's the Ninth Amendment, and if I interpret the Ninth Amendment correctly, it says that what you used to have as a right cannot be taken away tomorrow.
[50:26.780 --> 50:31.780]  In other words, if you had that right yesterday, you got it today and you're going to have it tomorrow.
[50:31.780 --> 50:40.780]  Well, if it can be taken away tomorrow by some act, then it's a privilege. It's not a right. So even that's not necessary to write down its common sense.
[50:40.780 --> 50:55.780]  But the thing is, like I said before, the constitutions of the federal and state levels, the one thing every single one of them is missing explicitly.
[50:55.780 --> 51:17.780]  I don't know whether it is by omission or design, and I say omission because at the time they were written, the people that were responsible for pinning them would never have believed that we would become the limp noodles that we have as Americans
[51:17.780 --> 51:29.780]  that don't even recognize the value of what we've had, why we have it, and what the hell we're supposed to be doing with it because we have it as far as those rights are concerned.

The people shall at all times have the right to hold accountable any member of any public office for violations of this Constitution or the laws of the state or anywhere where those laws are in conflict with this Constitution and those individuals attempt to enforce them regardless.

[53:05.780 --> 53:28.780]  I've been fighting the city that I lived in for the past year on ordinance violations, and I've asked questions on one of your pages. But the immunity clause you were talking about, basically, that the public officials have put in place for themselves.

[53:30.780 --> 53:41.780]  Yes. Yes. But my specific happening was that even though I was, it was eight vehicles on my property.

[54:25.780 --> 54:36.780]  This is either a code enforcement officer or one of the police department officers damaging your property so that they can use the excuse that the car is inoperable.
[54:36.780 --> 54:46.780]  The only way they can touch those cars is if they are inoperable according to the definition of under the transportation code.
[54:46.780 --> 54:49.780]  And even then they can't use them on private property, but they're doing it anyway.
[54:49.780 --> 55:02.780]  So what they do is they damage the car in such a way that not only could it not pass inspection, it would not be safe to use it upon the highway and thus is rendered inoperable.

[57:27.780 --> 57:35.780]  And then, of course, immediately the prosecutor took me and my wife to the back room to try to show us all the evidence against this and everything.
[57:35.780 --> 57:43.780]  And I said, I don't care what evidence you had, she's showing me pictures. And anyway, I said, so what do you want to do?
[57:43.780 --> 57:53.780]  And she said, well, we could have an administrative hearing. And of course, the way she said it, it sounded like they would just determine whether the vehicles were junk.
[57:53.780 --> 57:59.780]  There would be no penalty. This was just to see if it would go to trial, because that's what she said.
[57:59.780 --> 58:06.780]  Yeah, I know. An administrative hearing has nothing to do with it going to trial. They could, in fact, do you in both courts and screw you both times.

The week following, by the time I got all the windows fixed and everything, because that was my first priority, the Sheriff's Department found no fingerprints or anything, but the city administrator and the code enforcement officer, I got a call from my wife.
[01:04:02.780 --> 01:04:18.780]  They were at my house. I lived like five blocks away. And so she was pointing fingers to the code enforcement officer and stuff around my yard and things like that. So I went to go meet her, met her about halfway, coming back, because my wife is out there taking pictures over the phone.
[01:04:18.780 --> 01:04:29.780]  So I said, I need to speak with the code enforcement officer. Well, when they pulled up and I got out, I told the city administrator I didn't want her on my property. Yeah, I wanted to talk to code enforcement officer by himself.
[01:04:29.780 --> 01:04:42.780]  So he said he couldn't do it because that was his boss. And so, you know, she had to be there with him. So anyway, before he was over with, she called me crazy. And so I told him a story about her. I didn't really ever address her.
[01:04:42.780 --> 01:04:52.780]  And then she cussed me out and shot me in the finger and drove off. She sent me an email telling me not to contact them again. And then she filed a...
[01:04:52.780 --> 01:05:03.780]  Actually, she brought her husband down. I guess he was in the vicinity so that he could see what I looked like. She drove back onto my property, told me that she'd brought him down there, see what I looked like. He was scared to death.
[01:05:03.780 --> 01:05:07.780]  He looked like somebody had been drugged around by his nose their entire marriage, you know what I mean?
[01:05:07.780 --> 01:05:09.780]  Ah, exactly what you mean.
[01:05:09.780 --> 01:05:18.780]  Yeah, but he told me he would take care of everything, you know, but he didn't want me to give her a heart attack. I said, I don't want her on my property. You know, that's the whole thing.
[01:05:18.780 --> 01:05:29.780]  So anyway, they left and then she went and filed a false incident report against me. She wanted me arrested. And I got the CD with the whole recording and everything on it.
[01:05:29.780 --> 01:05:41.780]  Well, since all of this has been going on, of course, you know what happened at the administrative hearing. I walk in and I see two people. One's an employee and one's a crazy lady who's had it informed me since they moved out here.
[01:05:41.780 --> 01:05:51.780]  So it was a completely biased panel of three people and they fined me the $8,000. Well, I didn't pay it and within the 30 days you have to appeal, but you have to get a bond.
[01:05:51.780 --> 01:05:57.780]  So the bond was going to be $16,000. So I didn't want to do that. So we...
[01:05:57.780 --> 01:06:04.780]  Well, wait a minute. Since when can administrative panel charge you double the fine to appeal this decision?
[01:06:04.780 --> 01:06:15.780]  They can't. It's a paper that is given to you when you get the $8,000 fine. It says at the bottom, this is how they got some kind of statute.
[01:06:15.780 --> 01:06:22.780]  Yeah, but that statute comes from Chapter 45. I'm almost going to guarantee you it comes from Chapter 45.
[01:06:22.780 --> 01:06:23.780]  Yeah.
[01:06:23.780 --> 01:06:28.780]  And that is for crimes, not administrative hearings.
[01:06:28.780 --> 01:06:35.780]  Yeah, well, they did it. So here's what we did. We did a challenged subject matter jurisdiction.
[01:06:35.780 --> 01:06:44.780]  It was... Randy helped me beautifully drawn up everything and it challenged Texas law and we did a constitutional challenge also.
[01:06:44.780 --> 01:06:48.780]  And we submitted that and then the next day we got an email from city administration.
[01:06:48.780 --> 01:06:52.780]  The judge wants to know if you're going to appeal. We didn't even answer.
[01:06:52.780 --> 01:06:59.780]  So 72 days went by and we filed a challenge, our summary judgment.
[01:06:59.780 --> 01:07:04.780]  They ignored that and another month went by and then they filed against us in district court.
[01:07:04.780 --> 01:07:14.780]  And of course, they gave them summary judgment and permanent injunction here this past couple of weeks or last week.
[01:07:14.780 --> 01:07:27.780]  And then we've got to go in for... and the 23rd, we've got to go in so they can assess the administrative fees and additional fines and whatever else they want to attach to it.
[01:07:27.780 --> 01:07:29.780]  And then, of course, we're going to go to appeals.
[01:07:29.780 --> 01:07:42.780]  But in the meantime, had problems with the city administrator where when we would try to do records request, she was charging us against the rules of Freedom of Information Act.
[01:07:42.780 --> 01:07:46.780]  And so I had to get the attorney general on her about that.
[01:07:46.780 --> 01:07:52.780]  It took 10 weeks because she, I guess, didn't... she acted like she didn't receive the letter the first time.
[01:07:52.780 --> 01:07:56.780]  Of course, we received the letter so we received it but the city didn't.
[01:07:56.780 --> 01:08:02.780]  So they ruled against her but there's no teeth in it. They can't do anything to her.
[01:08:02.780 --> 01:08:04.780]  They can just tell her, hey, you're doing it wrong.
[01:08:04.780 --> 01:08:06.780]  No, that's actually incorrect.
[01:08:06.780 --> 01:08:12.780]  353 of Chapter 552 is a criminal penalty.
[01:08:12.780 --> 01:08:19.780]  It is a crime for them to do the things they do in violation of the Public Information Act.
[01:08:19.780 --> 01:08:22.780]  Okay. What is it? What was that code then?
[01:08:22.780 --> 01:08:27.780]  552.353, Texas Government Code.
[01:08:27.780 --> 01:08:29.780]  Texas Government Code. Okay. Thank you.

[01:08:30.780 --> 01:08:38.780]  And so anyway, but he said, well, you can't sue her. The guy did the attorney general's office.

[01:08:40.780 --> 01:08:44.780]  Yeah, but you can only sue her for injunctive relief. You can't sue her for damages.
[01:08:44.780 --> 01:08:50.780]  Okay. So who could I go after? Oh, it could just be criminally, right?
[01:08:50.780 --> 01:08:55.780]  You can file criminal charges against her but the AG is the one that's got to pick it up.
[01:08:55.780 --> 01:08:59.780]  Okay. So how would I go about doing that?
[01:08:59.780 --> 01:09:02.780]  Well, you just file a criminal complaint with the AG's office
[01:09:02.780 --> 01:09:05.780]  and let them tell you that you have to file it with your local county or district attorney

[01:09:07.780 --> 01:09:12.780]  But you want confirmation from them in writing that they're passing the buck.

[01:09:29.780 --> 01:09:31.780]  So him and his wife took over the shop.
[01:09:31.780 --> 01:09:40.780]  Well, in 2009, Dave Champion told me, he said, listen, just do away with your sales tax thing
[01:09:40.780 --> 01:09:43.780]  and just don't charge sales tax.
[01:09:43.780 --> 01:09:46.780]  So that's what I've been doing all this time.
[01:09:46.780 --> 01:09:50.780]  Well, she turned me into the comptroller and so I get a phone call one day
[01:09:50.780 --> 01:09:58.780]  and the lady that's a mechanic's husband, our wife, said, hey, you're getting,
[01:09:58.780 --> 01:10:01.780]  we're getting in trouble here with the comptroller.
[01:10:01.780 --> 01:10:05.780]  And so I called a friend of mine who's a high school friend.
[01:10:05.780 --> 01:10:06.780]  He's an accountant.
[01:10:06.780 --> 01:10:09.780]  He works with big corporations all over the United States.
[01:10:09.780 --> 01:10:12.780]  And so I work on his car.
[01:10:12.780 --> 01:10:15.780]  He's also had two shops, one here and one in Fort Worth.
[01:10:15.780 --> 01:10:20.780]  And so he picked it up for me and he tried to get a hold of him for like a month.
[01:10:20.780 --> 01:10:23.780]  But in the meantime, he said, go ahead and get your sales tax number.
[01:10:23.780 --> 01:10:29.780]  So we redid it both shops and started taking the sales tax.
[01:10:29.780 --> 01:10:31.780]  Ah, you shouldn't have done that.
[01:10:31.780 --> 01:10:33.780]  You shouldn't have done it.
[01:10:33.780 --> 01:10:34.780]  Here's the problem.

[01:10:49.780 --> 01:10:55.780]  in the 35 years that he has practiced as an accountant in Texas and the United States,
[01:10:55.780 --> 01:11:01.780]  he has never had to run around like he has with this lady who's been trying to bring us down.
[01:11:01.780 --> 01:11:06.780]  And in the meantime, we got a, our Lapita, the lady that's helping run it,
[01:11:06.780 --> 01:11:14.780]  $27,000 fine with his fees and penalties and all this other stuff.
[01:11:14.780 --> 01:11:16.780]  It was terrifying to her, you know.
[01:11:16.780 --> 01:11:19.780]  And so that really upset him.
[01:11:19.780 --> 01:11:27.780]  But anyway, he finally got a call from the enforcement division supervisor who was very apologetic
[01:11:27.780 --> 01:11:33.780]  and said that actually the way that we were doing it was legal.
[01:11:33.780 --> 01:11:34.780]  Absolutely.
[01:11:34.780 --> 01:11:42.780]  And that all we had to do was to, on the last quarter, which just ended in March,
[01:11:42.780 --> 01:11:49.780]  is to put, is to pay our sales tax and put on their final and then turn in our number
[01:11:49.780 --> 01:11:53.780]  and then on the, she had the previous one.
[01:11:53.780 --> 01:11:56.780]  They were charging her for years that she wasn't even there.
[01:11:56.780 --> 01:11:57.780]  Okay.
[01:11:57.780 --> 01:12:02.780]  And so all of this, so we haven't, we're probably not going to get anything in writing
[01:12:02.780 --> 01:12:09.780]  but she said that the first quarter of the year she will send it in and with zeros on it
[01:12:09.780 --> 01:12:13.780]  and then she'll probably get a thing that says $50 late fee.
[01:12:13.780 --> 01:12:18.780]  And so when she gets that, to give it to my friend and he will get ahold of the supervisor
[01:12:18.780 --> 01:12:21.780]  and the supervisor will just zero it out on his computer.
[01:12:21.780 --> 01:12:22.780]  Okay.
[01:12:22.780 --> 01:12:26.780]  Here's what I was going to say about the sales tax.
[01:12:26.780 --> 01:12:29.780]  First off, when you actually read the statutes dealing with the sales tax,
[01:12:29.780 --> 01:12:36.780]  you will find out that the only people that are required to charge and collect the sales tax
[01:12:36.780 --> 01:12:42.780]  are out of state corporations and those who work for them in very specific positions.
[01:12:42.780 --> 01:12:43.780]  Okay.
[01:12:43.780 --> 01:12:44.780]  Yeah.
[01:12:44.780 --> 01:12:49.780]  They are the only people that are authorized by law to charge and pay over a sales tax.
[01:12:49.780 --> 01:12:50.780]  Now here's the other thing.
[01:12:50.780 --> 01:12:57.780]  If you do not charge and collect the sales tax, you are not liable to pay over a sales tax.
[01:12:57.780 --> 01:12:59.780]  And here's the third thing.
[01:12:59.780 --> 01:13:04.780]  Unless you are incorporated, which I don't recommend you do,
[01:13:04.780 --> 01:13:11.780]  how can the state of Texas compel an individual to become an indentured servant as a tax collector
[01:13:11.780 --> 01:13:19.780]  for the state who is uncompensated in any way for the service they're providing in collecting
[01:13:19.780 --> 01:13:21.780]  and paying over taxes?
[01:13:21.780 --> 01:13:26.780]  See, they are turning you into an employee of the state by giving you that sales tax permit.
[01:13:26.780 --> 01:13:30.780]  That is your license to act as a tax collector for the state.

[01:13:32.780 --> 01:13:36.780]  If you collect sales tax without that permit, now you're breaking the law.
