[05:25.920 --> 05:32.520]  a hundred pages of documents, you file them, you go to court, the judge ignores all of
[05:32.520 --> 05:35.800]  them, denies everything.
[05:35.800 --> 05:41.840]  The next day you come in with another stack of documents, criminal complaints, judicial
[05:41.840 --> 05:50.280]  conduct complaints, bar grievances, criminal complaints against the judge, all sorts of
[05:50.280 --> 05:51.280]  emotions.
[05:51.280 --> 06:01.280]  The next day they are not going to believe it and this will shut down traffic enforcement.
[06:01.280 --> 06:08.720]  I've been looking forward to doing this for a long time but I'm scraping together the
[06:08.720 --> 06:16.120]  final minor details and it's driving me insane but I'm getting there and I hope to have
[06:16.120 --> 06:20.920]  it up within a week or so but I've been saying that every week and I know everybody's getting
[06:20.920 --> 06:24.920]  tired of hearing about it but we really are getting close.
[06:24.920 --> 06:35.160]  You have a caller, Scott from Tejas, little Scott, what have you been up to this week?
[06:35.160 --> 06:44.680]  Other than getting my house destroyed and re-leveled and basically almost put back together again,
[06:44.680 --> 06:52.480]  others and that, just working on different ways to figure out how to bring the heat to
[06:52.480 --> 07:00.320]  the judges because it's like I was talking to you, these federal judges, they just, you
[07:00.320 --> 07:06.600]  go and file a federal case or anything and the magistrate automatically assumes that even
[07:06.600 --> 07:18.560]  though you never gave them any permission to do anything, so it would be the only logical
[07:18.560 --> 07:25.360]  thing is to go after these magistrates because the federal court, they have to go through
[07:25.360 --> 07:30.080]  the appeals and they go through, I mean, you have so many hoops to jump through, it's like
[07:30.080 --> 07:31.080]  we'll shoot.
[07:31.080 --> 07:36.280]  Why don't we just go after these magistrates that are not obeying the law to start with
[07:36.280 --> 07:39.800]  and just take the heat right to them?
[07:39.800 --> 07:46.440]  That's exactly what I consider to be the best strategy.
[07:46.440 --> 07:53.520]  In order for that magistrate to have subject matter jurisdiction, in order for him to have
[07:53.520 --> 07:59.960]  venue or authority to act, you have to authorize it.
[07:59.960 --> 08:04.360]  He can only act with your written permission.
[08:04.360 --> 08:10.680]  Otherwise, he exerts or purports to exert an authority he does not express to have and
[08:10.680 --> 08:15.080]  in the process denies you the full and free access to or enjoyment right and I don't see
[08:15.080 --> 08:17.720]  how they can step around that.
[08:17.720 --> 08:27.400]  Well, what I was wanting to find out is what do you think is the best way to go about getting
[08:27.400 --> 08:32.480]  them to what I'm getting at is should we do an information request because like I say
[08:32.480 --> 08:40.520]  in my case, I had a magistrate make a ruling and the district judge upheld their ruling.
[08:40.520 --> 08:47.920]  So now, wouldn't it be prudent to file like an information request and where did the magistrate
[08:47.920 --> 08:54.280]  actually get the authority to even intervene and make a ruling to start with?
[08:54.280 --> 09:04.080]  You could do an information request for your written authorization to allow a magistrate
[09:04.080 --> 09:05.640]  to act in your case.
[09:05.640 --> 09:10.400]  There has to be a written authorization and the court will send you one.
[09:10.400 --> 09:20.560]  Every time you file a federal case, the court will send you an authorization form and whether
[09:20.560 --> 09:25.760]  you sign it or not, they will send a magistrate.
[09:25.760 --> 09:29.800]  If you tell them absolutely not, they'll still appoint a magistrate.
[09:29.800 --> 09:36.040]  So we go for the magistrates and I think that's the best strategy.
[09:36.040 --> 09:44.640]  We file a criminal complaint against the magistrate within the state and in the Fed.
[09:44.640 --> 09:48.880]  When I filed a criminal charge against Judge McBride in the Fed, I seemed to really get
[09:48.880 --> 09:55.920]  his attention because the suits he had been dismissing out of handy, my declaratory judgment
[09:55.920 --> 10:01.040]  suits, he dismissed declaratory judgment suits for failing state of claim.
[10:01.040 --> 10:08.840]  Well, after I filed criminally with him with the SAC in Dallas, he quit dismissing those.
[10:08.840 --> 10:14.240]  I never heard anything back from anybody, but he stopped dismissing those.
[10:14.240 --> 10:21.200]  We got his attention and he started filing criminal charges against these magistrate
[10:21.200 --> 10:28.040]  judges and then filed a civil action against them personally because they acted without
[10:28.040 --> 10:31.040]  subject matter jurisdiction and therefore have no immunity.
[10:31.040 --> 10:34.040]  They were not a public official at that time.
[10:34.040 --> 10:37.040]  They acted in their private capacity.
[10:37.040 --> 10:42.040]  I lost my story and I'm sticking to it.
[10:42.040 --> 10:50.040]  Now, that's the best strategy really because here's the good thing about it.
[10:50.040 --> 10:56.040]  Whatever you were wanting to sue, let's say if it was for damages on the cop for $5 million
[10:56.040 --> 11:02.040]  or something and he dismissed that suit, now technically you go for a declaratory judgment
[11:02.040 --> 11:07.040]  on how you get to make that ruling, then wouldn't you just be able to sue him for that $5 million
[11:07.040 --> 11:09.040]  instead of the cop?
[11:09.040 --> 11:10.040]  Absolutely.
[11:10.040 --> 11:12.040]  Three times that actually.
[11:12.040 --> 11:15.040]  I don't know.
[11:15.040 --> 11:20.040]  Punitive.
[11:20.040 --> 11:26.040]  Now, most of these magistrate judges are being magistrate judges because they want to get
[11:26.040 --> 11:30.040]  appointed as federal judges.
[11:30.040 --> 11:38.040]  Well, if you're the court of appeals and you've got the president and you've got an opening
[11:38.040 --> 11:49.040]  for a federal district judge and you've got 10 magistrates who've been magistrates and
[11:49.040 --> 11:55.040]  who've worked for judges and you've got one of them that's got some criminal complaints
[11:55.040 --> 11:58.040]  against him for his actions as a magistrate.
[11:58.040 --> 12:03.040]  Well, he's going to say, well, I didn't do anything wrong.
[12:03.040 --> 12:11.040]  These criminal complaints were why they were frivolous and without merit.
[12:11.040 --> 12:20.040]  And the court's going to say what my commander in the military said when he's chastising
[12:20.040 --> 12:24.040]  me for calling the inspector general on my boss.
[12:24.040 --> 12:30.040]  He said, I have 20 line numbers here for senior master.
[12:30.040 --> 12:42.040]  I got 120, I'm sorry, for chief master and I got 120 senior masters.
[12:42.040 --> 12:46.040]  Which ones do I upgrade?
[12:46.040 --> 12:48.040]  Oh, this one.
[12:48.040 --> 12:53.040]  He had the IG called on him and these other guys didn't.
[12:53.040 --> 12:57.040]  Well, did I just call the IG on him because I was upset with him and make a frivolous
[12:57.040 --> 13:02.040]  complaint? The commander's going to say, I don't care.
[13:02.040 --> 13:10.040]  You didn't keep your troops from calling the IG and all these other guys did.
[13:10.040 --> 13:13.040]  You were in liability.
[13:13.040 --> 13:16.040]  This magistrate's judge is going to say, well, that was frivolous.
[13:16.040 --> 13:22.040]  Well, maybe it was, but these other judges managed to perform their business and not get
[13:22.040 --> 13:27.040]  this kind of complaint that makes you a greater liability than them.
[13:27.040 --> 13:30.040]  So they get picks first.
[13:30.040 --> 13:36.040]  Okay, that may not be right and it may not be fair.
[13:36.040 --> 13:42.040]  Well, life is tough to deal with it.
[13:42.040 --> 13:49.040]  In the future, conduct yourself in such a way that the person you rule against understands
[13:49.040 --> 13:55.040]  why you ruled against him, what your authority to rule against him wore us, and what his
[13:55.040 --> 13:57.040]  reasonable recourse is.
[13:57.040 --> 14:01.040]  Then he won't be so PO'd at you.
[14:01.040 --> 14:03.040]  That makes sense, Scott.
[14:03.040 --> 14:06.040]  Well, of course it's that.
[14:06.040 --> 14:13.040]  So, but yeah, that was just kind of my thinking on some of this.
[14:13.040 --> 14:19.040]  Let's just jerk some of these federal judges out of the federal court over into the state
[14:19.040 --> 14:22.040]  court and see what they think about that.
[14:22.040 --> 14:28.040]  Yeah, the rule of thumb is take the state to the fed and fed to the state.
[14:28.040 --> 14:37.040]  So this federal judge is sitting in this federal courthouse performing federal duties.
[14:37.040 --> 14:43.040]  Problem, the federal courthouse is not a federal enclave.
[14:43.040 --> 14:51.040]  If someone murders someone in a federal prison in Texas, that is a federal matter and the
[14:51.040 --> 15:00.040]  federal government will have jurisdiction over the incident.
[15:00.040 --> 15:11.040]  If someone murders someone that is not in a federal enclave, a federal enclave is a property
[15:11.040 --> 15:20.040]  that has been ceded to and full ownership and jurisdiction granted to the federal government.
[15:20.040 --> 15:27.040]  There are only two places in the state of Texas where that's been done.
[15:27.040 --> 15:30.040]  And they're both federal prisons.
[15:30.040 --> 15:40.040]  And that's so that the feds do not have to hire state securities, state guards to enforce,
[15:40.040 --> 15:42.040]  to manage the prisons.
[15:42.040 --> 15:45.040]  They can use their own federal employees.
[15:45.040 --> 15:52.040]  But if you're not in that federal enclave, it's a judge in a federal court, shoot somebody.
[15:52.040 --> 15:57.040]  He's not prosecuted in the fed, the fed does not have jurisdiction.
[15:57.040 --> 15:59.040]  The state has jurisdiction.
[15:59.040 --> 16:02.040]  The local sheriff has jurisdiction.
[16:02.040 --> 16:11.040]  When someone shot the president in Dallas, Texas, the federal agents swarmed into the place.
[16:11.040 --> 16:14.040]  And the sheriff threw him out of the place.
[16:14.040 --> 16:16.040]  And they said, well, he killed the president.
[16:16.040 --> 16:17.040]  Yes, he did.
[16:17.040 --> 16:20.040]  And that's my jurisdiction, not yours.
[16:20.040 --> 16:27.040]  They since passed laws to make it a federal crime to kill a federal judge or a president.
[16:27.040 --> 16:33.040]  Otherwise, all in the state, the judge is sitting in a building owned by the state,
[16:33.040 --> 16:35.040]  at least from the state.
[16:35.040 --> 16:40.040]  And when he performs illegal acts, he performs them in this state.
[16:40.040 --> 16:43.040]  And the county sheriff has subject to medical jurisdiction.
[16:43.040 --> 16:46.040]  So we file against him in the state.
[16:46.040 --> 16:49.040]  And the state has no love for the feds.
[16:49.040 --> 16:50.040]  OK.

[20:31.320 --> 20:35.320]  hearing coming up, which was supposed to be, you know, I thought it was going to be a trial
[20:35.320 --> 20:36.320]  or something.
[20:36.320 --> 20:42.360]  And so they bounced me over to another judge, and so I was like, okay, so I got to reset,
[20:42.360 --> 20:46.080]  so I reset mine, and then went ahead and turned in financials on him.
[20:46.080 --> 20:52.000]  So he gets a copy of it, welcome to the party, and all that good stuff.
[20:52.000 --> 20:56.480]  When you get to the first hearing with this judge, if you have...
[20:56.480 --> 20:59.480]  Oh, this will be trial with the judge.

[21:58.040 --> 22:03.200]  He said, oh yeah, I got it, and I was like, okay, great, and since he's not going to respond
[22:03.200 --> 22:09.160]  again writing, it's basically everything I started is true, and hey, judge, I'm going
[22:09.160 --> 22:14.120]  to stand on my paperwork, how come he's not answering me?
[22:14.120 --> 22:21.600]  And then, oh, I got a police script, I cobbled a bunch of stuff that I found from Eddie's
[22:21.600 --> 22:29.320]  old stuff, and some of your stuff that we've used in stuff, and put a whole...
[22:29.320 --> 22:39.400]  It's almost like 20-something pages, 22 pages of a way to interrogate the cop on the stand
[22:39.400 --> 22:48.280]  and just totally discredit the cop before everything, and by the time you get done doing
[22:48.280 --> 22:55.360]  a cross-examination of the cop on the stand with this, he will be completely thoroughly
[22:55.360 --> 22:56.360]  agitated.
[22:56.360 --> 23:02.720]  And the prosecutor is going to be pulling the tear out.
[23:02.720 --> 23:10.320]  One thing we need to do is figure out a good way of handling a prosecutor who interrupts
[23:10.320 --> 23:14.280]  your every word with an objection.

[23:15.280 --> 23:19.280]  How do we solve that?
[23:19.280 --> 23:25.880]  That's something I need to work on.

[23:26.880 --> 23:33.880]  That's a strategy of the prosecutor is to interrupt with frivolous objections.

[23:40.840 --> 23:46.240]  One of the things to do, if you have your questions written down, is when he interrupts

[23:58.200 --> 24:02.720]  This prosecutor over here keeps interrupting me on every word, so he's trying to interrupt
[24:02.720 --> 24:08.320]  the flow of my argument so that the jury won't have any idea what's going on here.
[24:08.320 --> 24:12.640]  This is a low-down, shyster, sharp practice maneuver.
[24:12.640 --> 24:22.520]  So if he's going to interrupt me, I have to re-establish context for my next question.
[24:22.520 --> 24:28.840]  Because you denied me in my right to defend my case.

[26:31.560 --> 26:38.360]  Well, that's a class A misdemeanor state of Texas, or have him arrested or try to have
[26:38.360 --> 26:43.240]  him arrested and start that fight, put him in a position where he has to look at a grand

[29:06.520 --> 29:15.280]  you ask the judge to order the arrest of the prosecutor, violating Article 2.01 Texas Code

[33:56.200 --> 34:01.360]  have been charged with violating 2.01. So, I'll have to re-vote.

[34:03.360 --> 34:11.920]  Right, I'll have to go revisit that. Yeah, that's a good thought, you know, just keeps
[34:11.920 --> 34:20.280]  being in the way at these guys from the long distance. It just never ends.
[34:20.280 --> 34:26.000]  That's the way, you know, when you're in one of these fights, it gets overbearing, and it
[34:26.000 --> 34:32.200]  gets very difficult. But once you're clear of the fight, and they don't have a claim against
[34:32.200 --> 34:38.360]  you anymore, now you can go back and short-shoot them, and there's nothing they can do. Even
[34:38.360 --> 34:45.640]  if the prosecutor is no longer a prosecutor, it's much better. Then you can move to have
[34:45.640 --> 34:51.480]  him prosecuted and file bar grievances against him. When he's not a prosecutor anymore, those
[34:51.480 --> 34:59.200]  bar grievances make a real big difference. And then, you know, they wind up going back
[34:59.200 --> 35:06.120]  to the ones that are prosecutors now and telling them what's happening to them. That's the
[35:06.120 --> 35:15.080]  plan with the traffic tool is we'll file so many criminal conduct, criminal complaints
[35:15.080 --> 35:21.080]  and professional conduct complaints that these guys won't want to have anything to do with
[35:21.080 --> 35:26.840]  this. You start filing professional conduct complaints against police officers, and they
[35:26.840 --> 35:34.760]  will find themselves another job. That's going to put them out of business. The professional
[35:34.760 --> 35:42.120]  conduct complaints, it's the same with police officers as with judges as with military personnel.
[35:42.120 --> 35:49.560]  You get marks on your chart compared to other officers who don't have marks on their chart.
[35:49.560 --> 35:56.360]  Who's going to get hired? Who's going to get promotions? The one that shows himself to
[35:56.360 --> 36:04.280]  be a professional liability? Or the one with no marks on his chart? Okay, that may not
[36:04.280 --> 36:13.760]  be right. And that may even be unfair. Well, life is tough. Deal with it. And let's give

[38:42.800 --> 38:49.080]  really took off and they really filled the yard. And I had some pretty good reasons at
[38:49.080 --> 38:56.600]  the time. My health was very bad. I almost died. We won't get into that.
[38:56.600 --> 39:03.520]  I lost three members of my family, all in the short course of a few months. And you
[39:03.520 --> 39:11.520]  can imagine, I didn't have a job. I lost my job. I was a real hurt and puffy. So excuse
[39:11.520 --> 39:19.920]  me, city, for not jumping, champing at the door to clean up my yard. That was the least
[39:19.920 --> 39:26.840]  of my problems. And I didn't have any heat in the house. So we put all these things
[39:26.840 --> 39:35.880]  together. The neighbors complained. So here, give me a sec. So I was hauled into court
[39:35.880 --> 39:43.200]  and told to clean up the yard. The judge or the city attorney said to me that in the process
[39:43.200 --> 39:50.360]  of the whole thing, they wanted to inspect the inside of my house. At that point, the
[39:50.360 --> 39:57.560]  city attorney said, well, we realize single family homes are exempt from mandatory inspection
[39:57.560 --> 40:03.960]  in the city. But for the greater good, for the greater good, how noble of them for the
[40:03.960 --> 40:12.320]  greater good of this senior citizen, meaning me, we would want to inspect the inside of
[40:12.320 --> 40:17.960]  the house. Now, what the city attorney was doing was his duty. He knew the judge had
[40:17.960 --> 40:24.880]  overstepped his bounds. And he was in a professional manner was warning the judge. He was on shaky
[40:24.880 --> 40:26.640]  ground for the Fourth Amendment.
[40:26.640 --> 40:37.720]  Good for him because the American Bar Association standards for the prosecutorial function command
[40:37.720 --> 40:40.760]  a prosecutor to do just exactly that.
[40:40.760 --> 40:45.920]  Exactly. I read that. New York State, I don't know if it was New York State or the federal
[40:45.920 --> 40:46.920]  laws.
[40:46.920 --> 40:55.360]  Yeah, but most of the states have adopted the American Bar Association model standards.
[40:55.360 --> 41:01.880]  They, as far as I can tell, they have not adopted the American Bar Association standards
[41:01.880 --> 41:06.200]  for the prosecutorial function, but they are still advisory.
[41:06.200 --> 41:07.200]  Yeah.
[41:07.200 --> 41:11.640]  And I have had great fun with him in court.
[41:11.640 --> 41:19.800]  Yep. So the city attorney was very smart and he did his duty so that he couldn't be reprimanded
[41:19.800 --> 41:24.920]  for that or charged with anything. Now, here's what the judge told me. The judge and I went
[41:24.920 --> 41:31.720]  to high school together, so he's known me for 50 years. He knows that I'm not a troublemaker,
[41:31.720 --> 41:34.600]  never have been, never will be.
[41:34.600 --> 41:41.080]  So the judge turns to me after the city attorney admonishes him and says, well, we understand
[41:41.080 --> 41:47.760]  that the single family homes are exempt from mandatory inspection, but to the greater good
[41:47.760 --> 41:54.240]  of the senior citizen, we should inspect the house for his safety. Well, how noble. I couldn't
[41:54.240 --> 42:00.840]  get along without them. The judge turns and says to me, it's 11 a.m. The city will inspect
[42:00.840 --> 42:07.480]  your property at 3 p.m. today. And if you don't let them in, I will send a police officer
[42:07.480 --> 42:11.600]  to arrest you and take you to jail.
[42:11.600 --> 42:16.920]  Now your comments and observations, I think I know what you're going to say and you go
[42:16.920 --> 42:17.920]  right ahead.
[42:17.920 --> 42:26.720]  If a public official exerts or purports to exert an authority he does not expressly have
[42:26.720 --> 42:30.400]  and in the process denies you in a full and free access tour and join the right that's
[42:30.400 --> 42:41.000]  a crime in every state. Also, if someone threatens you, if someone makes a threat against you
[42:41.000 --> 42:48.080]  and you believe that threat, that's simple assault. If they threaten you with someone
[42:48.080 --> 42:53.800]  who is prominently displaying a deadly weapon, that's aggravated assault and it's a felony
[42:53.800 --> 43:01.560]  in every state. In Texas, it's a first degree felony.
[43:01.560 --> 43:06.880]  We have a special statute on that issue and if you don't have it in New York, you can
[43:06.880 --> 43:19.640]  come to Texas and drag 2202B2A into New York. Every state has a statute that says that if
[43:19.640 --> 43:28.120]  you commit assault against a public official while prominently displaying a deadly weapon
[43:28.120 --> 43:38.520]  in most states, that's a first degree felony. It is in Texas as well. That's 2202B2B. B2A
[43:38.520 --> 43:44.840]  says that if a public official commits simple assault while prominently displaying a deadly
[43:44.840 --> 43:50.000]  weapon and he acts outside the scope of his authority, that's a first degree felony.

[47:03.000 --> 47:08.160]  didn't have a working boiler, but I don't think they knew that, and even if they did,
[47:08.160 --> 47:14.400]  it was none of their business. Tell me, did they violate my Fourth Amendment like I know
[47:14.400 --> 47:24.320]  they did? Absolutely. Four years later, can I sue them? No, you only generally only have
[47:24.320 --> 47:36.200]  a year, but did they send people to inspect your property? Again, what? Did they send
[47:36.200 --> 47:43.240]  someone to inspect your property? Oh yeah, they sure did. Did the person who came to
[47:43.240 --> 47:50.240]  inspect your property prominently display a deadly weapon, to have a pistol on their
[47:50.240 --> 47:56.800]  hip? No, they didn't. It was the code enforcement office. The people, they had given authority
[47:56.800 --> 48:05.360]  on Earth. Okay, generally code enforcement officers have pistols in most places. Well,
[48:05.360 --> 48:11.760]  I didn't see one. I didn't see any. You might check and see if code enforcement officers
[48:11.760 --> 48:21.360]  are armed. But since they came into your property under threat of arrest by someone
[48:21.360 --> 48:30.840]  who was armed, I would consider that to be aggravated assault. So would I, at any reason.
[48:30.840 --> 48:42.200]  That you still can file against the judge. Or really? He threatened you with a deadly
[48:42.200 --> 48:51.200]  weapon. And I'd like to look at aggravated assault in New York. Most states don't make
[48:51.200 --> 49:00.280]  it a first degree felony. Most states make it a second degree felony. But generally that's
[49:00.280 --> 49:11.040]  up to 20 years. And the only reason you allowed that code enforcement officer into your property
[49:11.040 --> 49:19.680]  was on threat of being shot by someone with a pistol. That is correct. I agree. 101 percent.
[49:19.680 --> 49:26.040]  Did the code enforcement officer, when he came into your property, issue any kind of
[49:26.040 --> 49:33.520]  citation? Well, they sent it to me in the mail, all the complaints. And then they went
[49:33.520 --> 49:38.920]  through a holy list of things that weren't even true. They said they smelled a dead animal

[50:37.000 --> 50:44.600]  or file a challenge to subject matter jurisdiction with the current court and reactivate that
[50:44.600 --> 50:57.520]  case. Well, okay. If you want to take them on, you're distanced from it. And it would
[50:57.520 --> 51:02.240]  be great to have something that somebody did four years ago come back to haunt them. Is
[51:02.240 --> 51:13.320]  that judge still the judge? Oh, yeah. Oh, wonderful. Go after him for doing that four
[51:13.320 --> 51:21.480]  years ago claim he had no subject matter jurisdiction and charged the judge with aggravated assault.
[51:21.480 --> 51:28.920]  You know what's going to happen when you charge the judge with aggravated assault. Everybody's
[51:28.920 --> 51:36.080]  going to line up to protect the judge. That's right. Nothing's going to happen. That's right.
[51:36.080 --> 51:46.800]  New York. New York surprises me sometimes. You apparently have a very good Judicial Conduct
[51:46.800 --> 52:00.320]  Commission. Oh, yeah. I read a report where they, well, not a written report. One of my
[52:00.320 --> 52:07.480]  callers was, it was calling me on what to do. And he had been in some kind of situation
[52:07.480 --> 52:13.880]  where they came after him and hadn't done anything in six months. And I told him, well,
[52:13.880 --> 52:19.160]  you know, the judge has a duty to maintain his calendar. So, they followed Judicial Conduct
[52:19.160 --> 52:24.960]  Complaint. They followed Judicial Conduct Complaint and they sanctioned the judge for not maintaining
[52:24.960 --> 52:30.560]  his calendar because they didn't get this guy in court within six months. And he later
[52:30.560 --> 52:40.960]  filed criminal complaints against the judge and the sheriff. And it was just standard
[52:40.960 --> 52:51.280]  ignorant stuff that they do. And somehow it worked for him and a judge sent the sheriff
[52:51.280 --> 52:58.760]  out to arrest the municipal judge and the sheriff. They arrested him both, put him in
[52:58.760 --> 53:08.400]  jail. New York is, appears to be better than most states or it's just more political than
[53:08.400 --> 53:19.000]  most states. But regardless of which one it is, the State Commission on Judicial Conduct
[53:19.000 --> 53:25.680]  has hammered judges. This should certainly, you can't file for four years ago, but you
[53:25.680 --> 53:29.600]  can file a challenge to subject matter jurisdiction in this case and the judge will just blow
[53:29.600 --> 53:34.080]  it off. And that's what you hope he does.
[53:34.080 --> 53:37.120]  Oh yeah, oh yeah, that's when the fun begins.
[53:37.120 --> 53:45.640]  Yeah, then you get to file criminally against the judge and I would need to look at due
[53:45.640 --> 53:59.760]  process as it exists in the New York criminal procedure code. When a complaint is filed,
[53:59.760 --> 54:08.200]  what is the procedure? And let me explain why I say that. In Texas, there essentially
[54:08.200 --> 54:17.520]  is no statutorily prescribed procedure for where you must file a complaint. There's
[54:17.520 --> 54:24.920]  nothing that tells you where you must file a complaint. But what the code does say is
[54:24.920 --> 54:34.880]  that when a magistrate receives a complaint, there are things he must do. When a prosecutor
[54:34.880 --> 54:41.120]  receives a complaint, there are things he must do. And when a police officer receives
[54:41.120 --> 54:47.160]  a complaint, there are things he must do. Since there is nothing in law that tells
[54:47.160 --> 54:55.960]  you the master of the servant, what you must do with a complaint, you can do anything you
[54:55.960 --> 55:06.120]  want to with it. And what I suggest you do is give it to some magistrate because that's
[55:06.120 --> 55:15.400]  a procedure that's been in law since 1215 AD. When the Dukes in England drug King John
[55:15.400 --> 55:21.040]  down to the River Trimps threatened to cut his head off if he didn't sign a Magna Carta.
[55:21.040 --> 55:28.400]  And in that original Magna Carta, there was a requirement that any time a person is arrested,
[55:28.400 --> 55:36.160]  he is to be taken directly to the nearest magistrate. And a complaint is to be made to
[55:36.160 --> 55:42.000]  that magistrate, and that magistrate will hold an examining trial to examine into the
[55:42.000 --> 55:50.040]  efficiency of the allegation. So magistrates are still in place for that purpose. Their
[55:50.040 --> 55:58.560]  only job is to hear criminal complaints. So you being the citizen, you can send a criminal
[55:58.560 --> 56:05.160]  complaint to anybody you want to. When you send it to a magistrate, you invoke his duty
[56:05.160 --> 56:14.400]  as a magistrate. And when he doesn't perform his duty, then you can take a complaint against
[56:14.400 --> 56:20.000]  him and file it with another magistrate. And when that magistrate doesn't do his duty,
[56:20.000 --> 56:27.480]  you can walk all the way up to the Chief Justice of the Supreme. Well, in New York it's different
[56:27.480 --> 56:32.600]  because the Supreme Court is on the lowest courts. So whoever the highest appeal court
[56:32.600 --> 56:43.760]  is in New York, all of those judges of that court are magistrates. And they have the same
[56:43.760 --> 56:51.120]  duty as a local municipal judge or JP. And when they don't act again on it, you file
[56:51.120 --> 56:55.800]  a criminal complaint with the Attorney General against the Chief Justice. In Texas, it would
[56:55.800 --> 57:01.960]  be the Chief Justice of the Supreme. I once filed criminal complaints against all judges
[57:01.960 --> 57:08.520]  of the Court of Criminal Appeals in Texas. In Texas, we have two high courts. Supreme
[57:08.520 --> 57:14.960]  handles civil, Court of Criminal Appeals handles criminal. I filed criminal charges against
[57:14.960 --> 57:23.120]  them against something that was incredibly nitpicking. I filed a habeas. They wouldn't
[57:23.120 --> 57:27.960]  accept it unless I filed a motion for a leave to file. And I said, heck with that, this is
[57:27.960 --> 57:34.960]  a habeas, the great writ. It is a writ of right. This court has no power to grant her
[57:34.960 --> 57:39.480]  deny leave. Well, they wouldn't take it without a habeas. I'm trying to get this kid out of
[57:39.480 --> 57:44.040]  jail. I'm sorry, they wouldn't take it without a motion for leave. So I filed a motion for
[57:44.040 --> 57:50.400]  leave. They denied it. I went straight to the grand jury. I got all the highest judges
[57:50.400 --> 57:56.720]  in Texas put in front of a grand jury. But it was only because the prosecuting attorney
[57:56.720 --> 58:02.280]  was not running for office again. He's a Democrat. All these judges are Republicans. And he
[58:02.280 --> 58:07.440]  used my complaint to try to take them out with him. So when you start going for these
[58:07.440 --> 58:17.760]  judges, you want to find some politics, anyone who's opposed to anyone in your line of ascension
[58:17.760 --> 58:24.120]  and gives that political opponent cannon fodder they can use against them. And whether he
[58:24.120 --> 58:28.400]  has an opponent or not, he knows he's going to have some opponents and he knows you're
[58:28.400 --> 58:35.200]  creating cannon fodder that can be used against him and he is not going to be a happy camper.

[01:14:38.080 --> 01:14:44.920]  Then you file against the judge for official oppression and then you start running the
[01:14:44.920 --> 01:14:52.640]  routine on him and then you send him a tort letter noticing the judge that he denied you
[01:14:52.640 --> 01:15:01.680]  access to the courts, that he did so outside the scope of his authority and he harmed you.
[01:15:01.680 --> 01:15:08.000]  Big time. And then you start running the routine on him. I'm not saying you'll win the civil
[01:15:08.000 --> 01:15:15.920]  suit at the end of the day, but it's great practice. They have no counter claim against
[01:15:15.920 --> 01:15:24.000]  you. And if they send an inspector out to inspect your property, then you file criminally
[01:15:24.000 --> 01:15:33.600]  against the inspector, you file criminally against the mayor or the judge for retaliation.

[01:22:30.040 --> 01:22:34.040]  Next day, I go into the local pit stop across the street from the house.
[01:22:34.040 --> 01:22:43.040]  And Bobby Jack Cruz always listens to the police calls because they had him on a radio station then.
[01:22:43.040 --> 01:22:46.040]  He said, what did you do to that cop yesterday?
[01:22:46.040 --> 01:22:49.040]  I said, I didn't do anything to him. Why?
[01:22:49.040 --> 01:22:56.040]  Well, he called in your name and said he had stopped you for 70 and a 60 and expired plates on a trader.
[01:22:56.040 --> 01:23:00.040]  Dispatcher told him, don't you dare arrest that SOB.
[01:23:00.040 --> 01:23:04.040]  You gave him back his license. You get him out of there.
[01:23:04.040 --> 01:23:08.040]  What?
[01:23:08.040 --> 01:23:14.040]  When you take him on. These guys are cowards.
[01:23:14.040 --> 01:23:20.040]  I dumped a judge one. I got a judge thrown out of office once, you know.
[01:23:20.040 --> 01:23:24.040]  Wonderful. Maybe you'll get another one thrown out.
[01:23:24.040 --> 01:23:26.040]  Yeah, I'd love to. He deserves it.
[01:23:26.040 --> 01:23:30.040]  Quickly, how did you get the judge thrown out of office?
[01:23:30.040 --> 01:23:39.040]  1982, I was going through a local town and the police there, every time I went through that town, they stopped me.
[01:23:39.040 --> 01:23:46.040]  Even though I was not breaking any vehicle and traffic law, I always drive carefully.
[01:23:46.040 --> 01:23:54.040]  Yes, I'm a human being. I can make mistakes, but every time I went through town, I was being stopped.
[01:23:54.040 --> 01:24:03.040]  Well, this one time, they got me for failure to yield. That was doubtful.
[01:24:03.040 --> 01:24:07.040]  Maybe it was. Maybe I didn't eat. Maybe I did yield. Maybe I didn't yield.
[01:24:07.040 --> 01:24:15.040]  But the point was, when I went to trial, first of all, the judge walked into the assistant district attorney's office and said,
[01:24:15.040 --> 01:24:22.040]  I quote, why do these people bother to ask for a trial when they know they're guilty?
[01:24:22.040 --> 01:24:28.040]  Unquote. And he was holding my case in his hand, referring to me.
[01:24:28.040 --> 01:24:32.040]  And everybody in the office knew he was referring to me.
[01:24:32.040 --> 01:24:37.040]  I was known to the people, some of the people in that office, and they knew he was referring to me.
[01:24:37.040 --> 01:24:43.040]  That's number one. Number two, I get to court. I'm giving my testimony and he stops me and says,
[01:24:43.040 --> 01:24:47.040]  all right, I heard enough. Thanks enough. I don't want to hear anymore.
[01:24:47.040 --> 01:24:52.040]  He got red in the face. He got mad. He lost his temper.
[01:24:52.040 --> 01:24:58.040]  I called the Judicial Conduct, the Commission on Judicial Conduct, in my area.
[01:24:58.040 --> 01:25:04.040]  And the girl answers the phone and I said, I'd like to make a complaint against a judge.
[01:25:04.040 --> 01:25:10.040]  And I started to spell his name so that they would be sure I knew who they were talking about.
[01:25:10.040 --> 01:25:16.040]  I get to four. He had like 11, 12 letters in his name, 10, 11, 12 letters in his name.
[01:25:16.040 --> 01:25:23.040]  And I get to the first four and they said, don't tell us all about him. We know all about him.
[01:25:23.040 --> 01:25:28.040]  And I said, if you know all about him, why is he still a judge?
[01:25:28.040 --> 01:25:36.040]  And she said, because good people like you start out with good intentions and then they never follow through.
[01:25:36.040 --> 01:25:42.040]  So I said to her, what's your first name? And she told, we'll say her name was Jamie.
[01:25:42.040 --> 01:25:47.040]  My name is James.
[01:25:47.040 --> 01:25:55.040]  Jamie, I am your man. We will do this together.
[01:25:55.040 --> 01:26:01.040]  And the rest is history. He was going to come up for election the next time around.
[01:26:01.040 --> 01:26:06.040]  He didn't run. He won the race.
[01:26:06.040 --> 01:26:11.040]  We got rid of them. He heard a lot of good people in this area.
[01:26:11.040 --> 01:26:15.040]  I'm telling you, Randy, I heard someone else say it.
[01:26:15.040 --> 01:26:23.040]  You know, there's more than traffic cases to come up before the judge and he screwed a lot of good people.
[01:26:23.040 --> 01:26:28.040]  He would be driving down the street, leaving all over the road, drunk as a skunk.
[01:26:28.040 --> 01:26:32.040]  A cop would stop him and say, oh, judge, how you doing? Oh, nice to see you.
[01:26:32.040 --> 01:26:39.040]  Oh, I didn't realize it was you and they let him go all the time, driving drunk habitually.
[01:26:39.040 --> 01:26:45.040]  And that man hurt a lot of good people and I was one of them.
[01:26:45.040 --> 01:26:52.040]  I let him have it and I let him have it good. He deserves that and more.
[01:26:52.040 --> 01:26:56.040]  This is our job.
[01:26:56.040 --> 01:26:59.040]  You bet it is.
[01:26:59.040 --> 01:27:05.040]  If we don't mean need many people doing this job to get the judges straightened out.

[01:38:49.040 --> 01:39:01.040]  Payed these guys off, went to Phoenix, Arizona, bought a better place for $250,000 and left all the way to the bank.

[01:40:09.040 --> 01:40:22.040]  But here's the deal. Every state has a statute that reflects what is in Texas property code 13401.
[01:40:22.040 --> 01:40:28.040]  Without this statute, there is no reason to have a county recorder's office.
[01:40:28.040 --> 01:40:35.040]  And what the statute essentially says is any claim against real property,
[01:40:35.040 --> 01:40:41.040]  not properly acknowledged or proven, acknowledged, notary, proven to witnesses,
[01:40:41.040 --> 01:40:48.040]  and filed in the county recorder's office is void as to the holder.
[01:40:48.040 --> 01:40:58.040]  So first off, we do not care who the holder of the mortgage is.
[01:40:58.040 --> 01:41:07.040]  We only care who is reflected in the public record as the holder.
[01:41:07.040 --> 01:41:29.040]  And we have a statute, and I'm sure Illinois is going to have similar statute, that says any claim against real property filed by someone who does not have authority by the public record to file that claim is construed to be fraudulent.
[01:41:29.040 --> 01:41:37.040]  So you've looked in the public record, you found the mortgage to Central Bank,
[01:41:37.040 --> 01:41:45.040]  and then Nation Star comes and attempts to foreclose.
[01:41:45.040 --> 01:42:03.040]  I would suggest your brother consider filing a amended answer or just wait until the judge, the court rules, overrules his, no, I'm sorry, I'm getting ahead of myself.
[01:42:03.040 --> 01:42:07.040]  I don't know what's in the answer, so I don't know if it's, it'll get overruled.
[01:42:07.040 --> 01:42:18.040]  I suggest that he files an amended answer. File a petition for declaratory judgment.
[01:42:18.040 --> 01:42:25.040]  A petition for declaratory judgment does not ask for any harm or damages.
[01:42:25.040 --> 01:42:38.040]  A petition for declaratory judgment asks the court to rule on the rights of the parties.
[01:42:38.040 --> 01:42:45.040]  It can't be, the biggest thing the bank is going to try to avoid is discovery.
[01:42:45.040 --> 01:42:56.040]  They want to avoid discovery at all costs, so any complaint you file, they're going to try to get it dismissed for failure to state a claim.
[01:42:56.040 --> 01:43:01.040]  A declaratory judgment cannot be dismissed for failure to state a claim.
[01:43:01.040 --> 01:43:07.040]  I had a federal judge in Fort Worth dismiss my declaratory judgment for failure to state a claim.

[01:43:12.040 --> 01:43:18.040]  Duh, the petition for declaratory judgment doesn't have a claim.
[01:43:18.040 --> 01:43:24.040]  So it doesn't fall under rule 12, and the federal lets rule 12 be six.

[01:47:52.040 --> 01:47:58.040]  He's given them a lot of grief, and I can show him how to really give them a lot of grief.

[01:48:04.040 --> 01:48:12.040]  No lawyer is going to come to some two-bit, pro-sale litigant, and offer to mediate because that's admitting that he can't beat him.

[01:48:15.040 --> 01:48:22.040]  You would think that saving face doesn't have any place in law, but human beings are human beings, and it does.
[01:48:22.040 --> 01:48:28.040]  So you go to the court and ask the court to order mediation, and then send an offer to the bank.
[01:48:28.040 --> 01:48:39.040]  Say, I've got this lump sum of money here that I've trade you this lump sum of money for the title of that property, and we can all go home and stop fighting this case.
[01:48:39.040 --> 01:48:45.040]  Otherwise, I'll keep you in court for the next five to seven years.
[01:48:45.040 --> 01:48:49.040]  If he does that, he can win this battle.
[01:48:49.040 --> 01:48:58.040]  Unfortunately, you'll never win your case simply because you have the law and the facts on your side.
[01:48:58.040 --> 01:49:01.040]  To think so is naive.
[01:49:01.040 --> 01:49:04.040]  It is not that way now.
[01:49:04.040 --> 01:49:12.040]  It never has been that way since we have had human beings acting as judges.

[01:49:29.040 --> 01:49:40.040]  That may not seem right, but that's how it is. And in this case, the politics would go to all the money these banks are spending adjudicating these cases.

[01:49:42.040 --> 01:49:50.040]  They eventually get the property anyway, but oftentimes they spend more money in the litigation than a property's worth.

[01:49:55.040 --> 01:50:04.040]  So once we understand the politics, then we have a method to achieve remedy.

[01:52:14.040 --> 01:52:29.040]  We're going to fight in a figured court for operating an audible bill without a driver's license and it's been coming along about six months with continuances and filing paperwork and so forth.
[01:52:29.040 --> 01:52:56.040]  But the latest was a file, a motion for finding facts and conclusions of law on a statement that the judge had said in a hearing when we were arguing our first motion to dismiss and he had said that the traffic code applied to everybody so I sent a motion to finding facts and conclusions of law for him to put that in writing and he just denied it.
[01:52:56.040 --> 01:53:10.040]  So that goes against the Court's Rule 52A of the Wyoming Rule and Civil Procedure which says that the findings of facts should be in writing and the conclusions of law are also in writing separately.
[01:53:10.040 --> 01:53:12.040]  Okay, hold on, hold on.
[01:53:12.040 --> 01:53:28.040]  We have that in Texas but it doesn't say that it applies to an inferior court, a court that's not a court of record.
[01:53:28.040 --> 01:53:35.040]  Our statute says specifically mentions county and district court.
[01:53:35.040 --> 01:53:43.040]  Does your statute specify the courts this applies to?
[01:53:43.040 --> 01:53:53.040]  Well, I do know this is a court of record and it is the criminal ticket. They're criminal here in Wyoming.
[01:53:53.040 --> 01:54:06.040]  Well, look at the statute on findings of facts and conclusions of law and see if it names the courts this applies to.
[01:54:06.040 --> 01:54:27.040]  If it only applies to county and district, you can imply that since the county court made itself a court of record, then you can only appeal from a court of record based on writ of error.
[01:54:27.040 --> 01:54:36.040]  And you cannot appeal based on writ of error unless you have findings of facts and conclusions of law so you can make an argument for it.
[01:54:36.040 --> 01:54:41.040]  That's in case they claim they don't have to do it.
[01:54:41.040 --> 01:54:53.040]  However, the way I read the code, the court is required to produce findings of facts and conclusions of law.
[01:54:53.040 --> 01:55:03.040]  In Texas, it says that if the court doesn't produce findings of facts and conclusions of law, that's a denial of due process subject to extraordinary writ.
[01:55:03.040 --> 01:55:10.040]  An extraordinary writ is a writ of mandamus, a mandate from a higher court ordering them to do it.
[01:55:10.040 --> 01:55:33.040]  However, it's a requirement and if a public official fails to perform a duty, he is required to perform it in the process to not a citizen full of free access to enjoyment of right, that's also a crime in every state.
[01:55:33.040 --> 01:55:43.040]  So if the judge refuses file a criminal against him, they move to disqualify him for judicial incompetence.
[01:55:43.040 --> 01:55:49.040]  Yeah, that's what I was going to add. It's called judicial incompetence.
[01:55:49.040 --> 01:55:57.040]  Incompetence by way of extreme prejudice or judicial ignorance.
[01:55:57.040 --> 01:55:59.040]  That'll hurt his feelings.
[01:55:59.040 --> 01:56:02.040]  By way of extreme prejudice?

[01:56:47.040 --> 01:56:56.040]  Failing to determine the facts in accordance with the rules of evidence, then applying the law as it comes to him to the facts in the case.

[01:57:02.040 --> 01:57:07.040]  That's official oppression, official misconduct, where every decodes.
[01:57:07.040 --> 01:57:12.040]  Right. He did allow us to finish, but he said he already knew how he's been decided.
[01:57:12.040 --> 01:57:15.040]  So file it criminally against him.
[01:57:15.040 --> 01:57:18.040]  Let him explain his behavior to a grand jury.
[01:57:18.040 --> 01:57:26.040]  These judges, they think they are absolutely immune from any consequences of their bad behavior.
[01:57:26.040 --> 01:57:35.040]  Because they pretty well know if you're a pro se litigant, all of the courts are going to rule against you out of hand.
[01:57:35.040 --> 01:57:43.040]  And if this guy rules improperly, the court of appeals or the county court is going to uphold his ruling no matter what.
[01:57:43.040 --> 01:57:49.040]  They tell you, if you don't like my ruling, you can always appeal. And I'm saying, yeah, I can.
[01:57:49.040 --> 01:58:00.040]  I can appeal to a corrupt appellate court, another bunch of corrupt judges, or I can appeal to a grand jury to have you indict it.
[01:58:00.040 --> 01:58:10.040]  And if they deny due process, the case law says due process is the same in the state as in the fed.
[01:58:10.040 --> 01:58:17.040]  So if the judge denies you due process in the state, you can file criminally against him in the fed.
[01:58:17.040 --> 01:58:26.040]  That will get his attention. When he gets a call from the FBI wants them to tell him why they shouldn't come out and arrest him.
