[07:22.240 --> 07:27.400]  they wrote me a ticket, it went to JP court a couple of months later, they said it was
[07:27.400 --> 07:33.680]  a class C misdemeanor, asked me if I wanted to deal, I said no, there was no law broken,
[07:33.680 --> 07:43.600]  there was no damage done, and I guess it was March of 2017, they had called me in for a
[07:43.600 --> 07:52.720]  jury trial, but there was no jury in town for the day, they just called me in, David
[07:52.720 --> 07:58.840]  was with me, and the assistant prosecutor from Bernice says we're going to dismiss this
[07:58.840 --> 08:04.360]  case at the lower, at the JP level, and we're going to raise it to a class A misdemeanor,
[08:04.360 --> 08:16.240]  from a class C to a class A misdemeanor in county court, so they said, you know, we'll
[08:16.240 --> 08:22.440]  see you in a couple of weeks, and then actually quite a while have done by, I just heard from
[08:22.440 --> 08:32.320]  them like a month ago, they sent me a certified mail to appear for an arraignment on February
[08:32.320 --> 08:40.240]  8th of last month, and they had canceled the courtroom, they were turning everyone away,
[08:40.240 --> 08:47.240]  the courtroom was shut down, there's, I don't know why, and they rescheduled me for March
[08:47.240 --> 08:56.520]  the 1st yesterday, so it was an arraignment, David was with me, and I had already followed
[08:56.520 --> 09:02.520]  my affidavit eventually to pay my arraignment, asking for, to be appointed, you know, for
[09:02.520 --> 09:09.880]  the jury to set the punishment, to be appointed an attorney, to provide discovery, examining
[09:09.880 --> 09:20.080]  trials, everything, and also dismissal papers, I had followed those in a week before February
[09:20.080 --> 09:30.400]  8th, so yesterday, when she called me up, David came up with me, said he was my federal
[09:30.400 --> 09:35.040]  witness, and she was like, she says, what the hell is that?
[09:35.040 --> 09:43.360]  And she kicked him out of the courtroom, and proceeded to tell me that I had to fill out
[09:43.360 --> 09:55.360]  their form, their financial form, see if I am qualified for an attorney.
[09:55.360 --> 09:59.760]  She looked at it, she changed the numbers, asked me a lot of questions, how can you be
[09:59.760 --> 10:04.760]  spending X amount of money, you know, through the month on groceries, my husband and I don't
[10:04.760 --> 10:10.360]  even spend that, just remarks like that, she redes my numbers and says, you know what,
[10:10.360 --> 10:16.080]  I don't think you got $700, $800 left per month, you're in just, you know, get it very
[10:16.080 --> 10:25.200]  quickly, and it said very quickly that your application for an attorney is denied.
[10:25.200 --> 10:34.640]  You have got to the 19th of March to acquire an attorney, or you're going to be defending
[10:34.640 --> 10:37.320]  yourself.
[10:37.320 --> 10:40.040]  So that's where we're at right now.
[10:40.040 --> 10:50.680]  Okay, so I have this rule, I never interfere with someone when they're screwing up.
[10:50.680 --> 10:57.080]  And throwing David out of the courtroom I think was a bad idea, I'm looking, I was hoping

[11:04.240 --> 11:14.240]  to throw out a court, David was the wrong one, what, you know, I guess they think you're
[11:14.240 --> 11:25.920]  going to be easy to railroad, do you have discovery in the case, if this was originally
[11:25.920 --> 11:36.760]  a class C misdemeanor, and it was subsequently raised to a class A misdemeanor, there have
[11:36.760 --> 11:46.240]  to be affidavits filed in the court that would establish that it was a class A misdemeanor.
[11:46.240 --> 11:53.120]  If there are no no trespassing signs, what is charge, is it criminal trespass?
[11:53.120 --> 12:03.520]  It's not trespassing, it's criminal mischief, destruction of property, but I told them earlier
[12:03.520 --> 12:08.360]  when I first met with the JP assistant prosecutor, I said, well, there's no signs or anything,

[15:46.120 --> 15:51.240]  out there, I didn't hear her say that Faith Academy came and said, here's a lot of damages,
[15:51.240 --> 15:56.080]  they went out there seeking to see, are you sure that's all that was done, are you sure

[20:35.080 --> 20:42.080]  But whenever she had to do something, she said, Mr. Renfrow, this paper is for you to sign and send it over to him.
[20:42.080 --> 20:44.080]  She knew who Rick was.
[20:44.080 --> 20:52.080]  Then when she called him up, I just got up and went up there with him and I just had him equip board and I was writing.
[20:52.080 --> 20:54.080]  And she finally got around and said, who are you?
[20:54.080 --> 20:56.080]  And I said, I'm a federal witness.
[20:56.080 --> 20:58.080]  She said, what do you need a federal witness for?
[20:58.080 --> 21:01.080]  I said, I'm not sure.
[21:01.080 --> 21:12.080]  And she said, in about that time, the girl that worked in the probation department that came over and tried to get him to sign the papers, said, Your Honor, he asked me my name and he wrote it down.

[21:17.080 --> 21:20.080]  I said, Your Honor, this is an open court.
[21:20.080 --> 21:23.080]  I'm here just to observe and that's all.

[21:26.080 --> 21:31.080]  She said, you get out of those two doors, get out of this courtroom or you're going to jail.
[21:31.080 --> 21:36.080]  In about that time, the bailiff hand grabbed me under my arm.

[21:38.080 --> 21:43.080]  Yes, aggravated assault against the judge.
[21:43.080 --> 21:45.080]  I've done exactly that.
[21:45.080 --> 21:51.080]  He wanted to start apologizing for it, but I said, just don't say anything.

[21:56.080 --> 22:06.080]  And then they proceeded to browbeat Rick, but as they were leading me out, I heard the judge say, You will sign these papers and you'll sign them now or you will not get an attorney.
[22:06.080 --> 22:13.080]  And then after I got outside, I guess he had to fill them out and she changed the numbers and then denied him.
[22:13.080 --> 22:16.080]  But he already had work all filled out and signed in the file.
[22:16.080 --> 22:21.080]  There's an affidavit of inability to pay already in there previously.
[22:21.080 --> 22:23.080]  There was a written arraignment in there previously.
[22:23.080 --> 22:25.080]  There was a discovery request previously.
[22:25.080 --> 22:31.080]  There was a demand for an attorney of the state being a class A, Mr. Maynard previously.
[22:31.080 --> 22:35.080]  All it is is a little mud on the side of his car that they took a picture of.
[22:35.080 --> 22:38.080]  And the lower court actually dismissed it.
[22:38.080 --> 22:40.080]  They never tried it.
[22:40.080 --> 22:46.080]  I showed up twice for a jury trial and I showed up with him for a jury trial and there was no cars there.
[22:46.080 --> 22:50.080]  So they had already told everybody on the defense's side, You don't have to come in tomorrow.
[22:50.080 --> 22:52.080]  We're not going to have a jury.
[22:52.080 --> 22:58.080]  But they let the diesel therapy on Rick and me and all the Rick's people made us get up there.
[22:58.080 --> 23:03.080]  And when they got in there, they said, Oh, well, this is going to be dropped and taken up in a higher court.
[23:03.080 --> 23:10.080]  And the prosecutor looked at Rick and said, We're going to raise it to a higher level charge at the upper court.
[23:10.080 --> 23:12.080]  And that's what they did.
[23:12.080 --> 23:13.080]  Changed.
[23:13.080 --> 23:14.080]  Okay.
[23:14.080 --> 23:16.080]  We need more complaints.
[23:16.080 --> 23:21.080]  We need to do less than $50 up to the level court.

[24:29.080 --> 24:35.080]  And then they definitely need to go after the prosecutor and the judge for retaliation.
[24:35.080 --> 24:41.080]  Has Rick looked at the files of this court?
[24:41.080 --> 24:46.080]  I'd like to see what the conviction rate of this court is.
[24:46.080 --> 24:58.080]  How unusual is it for someone in a JP court to plead not guilty?

[25:01.080 --> 25:11.080]  It may be more unusual than you think if they get this excited when they have to actually fight a case.
[25:11.080 --> 25:18.080]  But this has marks of retaliation all over it, and it certainly should start filing.

[25:57.080 --> 26:02.080]  The way I would want to do it is I would find out when the grand jury meets.
[26:02.080 --> 26:07.080]  Probably small county meets once a month.
[26:07.080 --> 26:09.080]  Or maybe twice a month.
[26:09.080 --> 26:11.080]  Find out when it meets.
[26:11.080 --> 26:14.080]  See if you can find out where it meets.
[26:14.080 --> 26:20.080]  And when it's meeting, go down there and hand your complaints to the bailiff.
[26:20.080 --> 26:25.080]  And the bailiff is going to go get the prosecutor.
[26:25.080 --> 26:27.080]  Almost certainly.
[26:27.080 --> 26:32.080]  And when he gives it to the prosecutor instead of the bailiff, then you file against the bailiff.
[26:32.080 --> 26:37.080]  And the prosecutor for tampering with the government document.
[26:37.080 --> 26:42.080]  They think they can do that, but the law is really clear.
[26:42.080 --> 26:46.080]  That when a complaint is made against a public official.
[26:46.080 --> 26:52.080]  When a prosecuting attorney is made known that a public official has violated the law relating to his office,
[26:52.080 --> 26:54.080]  he must give it to the grand jury.
[26:54.080 --> 26:57.080]  So when the prosecutor takes it.
[26:57.080 --> 27:05.080]  And you don't get, you always put a cover letter in there to the foreman at the grand jury.
[27:05.080 --> 27:15.080]  Asking him to initial it and send it back to you because you have problems with prosecutors hiding complaints against public officials from the grand jury.
[27:15.080 --> 27:20.080]  Ask the foreman not to sign it.
[27:20.080 --> 27:33.080]  As the prosecutor has a rubber stamp with the foreman's name on it, you want to make sure that the prosecuting attorney didn't rubber stamp the document and send it back.
[27:33.080 --> 27:42.080]  If you don't get that letter back within a week, then you come back and file criminal charges against the district attorney.
[27:42.080 --> 27:45.080]  With the grand jury, same way.
[27:45.080 --> 27:56.080]  And when the bailiff gives that one to the prosecuting attorney, then it's probably not be a good time to go to the feds.
[27:56.080 --> 28:02.080]  It's when the prosecutor secrets criminal complaints against himself from the grand jury, he just stepped in deep.
[28:02.080 --> 28:14.080]  But depending on how much you want to work the county, you can take it to the district judge and file the criminal complaint with the district judge with a petition for court of inquiry.
[28:14.080 --> 28:31.080]  Under Chapter 51, ask the court to appoint another district judge to convene a court of inquiry into the actions of the prosecution here in Burnett County.
[28:31.080 --> 28:40.080]  He just keeps cranking things up and then look at a plea and abatement in the case.
[28:40.080 --> 28:48.080]  One thing he might do is declare toward judgment.
[28:48.080 --> 29:09.080]  I'm thinking, do you have standing to ask the higher courts to overturn any rulings at the hearing because it was not a public hearing?
[29:09.080 --> 29:15.080]  You had a right to witness that hearing and you were denied that right.
[29:15.080 --> 29:20.080]  You might move to void all the rulings in the court.
[29:20.080 --> 29:25.080]  Nothing like getting a third party in there.

[33:46.080 --> 33:54.080]  What I'm willing to do right now is, you know, David suggested yesterday and he told me this story about something that happened to him.
[33:54.080 --> 33:59.080]  He says, you know, call a few little lawyers and get like an idea, you know, around the burning area.
[33:59.080 --> 34:06.080]  You know, I called a couple in Austin to see what their fees are to take you through a power process.
[34:06.080 --> 34:16.080]  And one guy quoted me like $8,000 today, another guy quoted me $2,500 to start.
[34:16.080 --> 34:27.080]  So with that information, I was going to write, I was going to ask you how do I title this document?
[34:27.080 --> 34:30.080]  I'm going to resend my signature and say, hey, I...
[34:30.080 --> 34:41.080]  Wait, wait, wait, you can do an interlocutory appeal on the denial of your inability to pay status.
[34:41.080 --> 34:44.080]  That's interlocutory.
[34:44.080 --> 34:47.080]  So you filed that appeal and moved for an abatement.
[34:47.080 --> 34:51.080]  Their problem was prosecution.
[34:51.080 --> 34:53.080]  They have no evidence.
[34:53.080 --> 35:01.080]  And as this gets older, it gets harder to find witnesses who know or remember anything.
[35:01.080 --> 35:09.080]  And clearly you've got a complainant that's a reluctant complainant.
[35:09.080 --> 35:12.080]  The complainant didn't blow this out of proportion.
[35:12.080 --> 35:15.080]  The prosecution did.
[35:15.080 --> 35:20.080]  So you need to push him to the table.
[35:20.080 --> 35:25.080]  Put the pressure on the complainant and get him to put the pressure on the prosecutor.
[35:25.080 --> 35:39.080]  But first, right now, I'm reluctant to jump in and make suggestions until I've seen an effective timeline
[35:39.080 --> 35:45.080]  so I can walk down these and get a good idea of who did what and where.
[35:45.080 --> 35:54.080]  I do suggest that you bar grieve the prosecutor and file a judicial conduct complaint against the judge
[35:54.080 --> 36:06.080]  if for nothing else to poison her well good and get other people looking over her shoulder.
[36:06.080 --> 36:11.080]  Well, I wanted to get this letter done this weekend and get you the timeline.
[36:11.080 --> 36:18.080]  And then file mark this, I was sent my signature Monday.
[36:18.080 --> 36:20.080]  So I have another question.
[36:20.080 --> 36:22.080]  I'm due to be on the 19th.
[36:22.080 --> 36:27.080]  If I file mark it on Monday, it's two weeks old, unless there's a letter here,
[36:27.080 --> 36:30.080]  but it's two weeks old when I'm going on the 19th.
[36:30.080 --> 36:32.080]  Can she override that?
[36:32.080 --> 36:36.080]  Or is it, excuse it, three days or is there a certain time?
[36:36.080 --> 36:45.080]  Well, what you can do is give notice of an appeal of her denial of indigent status
[36:45.080 --> 36:55.080]  and move the court of appeals for an abatement of all proceedings.
[36:55.080 --> 37:02.080]  You ask them to abate the proceedings because now they're forcing you to court without counsel.
[37:02.080 --> 37:11.080]  And the higher courts absolutely do not want you forced to court without counsel.
[37:11.080 --> 37:12.080]  Even so.
[37:12.080 --> 37:15.080]  Appeals and even higher.
[37:15.080 --> 37:17.080]  Say that again.
[37:17.080 --> 37:24.080]  Even the court of appeals and even higher, those courts don't want you without counsel.
[37:24.080 --> 37:25.080]  Right.
[37:25.080 --> 37:26.080]  You know what you're saying?
[37:26.080 --> 37:28.080]  They do not want you in court without counsel.
[37:28.080 --> 37:35.080]  If you're in court without counsel, they want to be absolutely certain you're without counsel on purpose
[37:35.080 --> 37:38.080]  because that will always get overturned.
[37:38.080 --> 37:40.080]  And what might help here?
[37:40.080 --> 37:51.080]  Sounds like this court is just kind of out of control and they feel like they have no consequences for their behavior.
[37:51.080 --> 37:57.080]  You might file a complaint against them with the feds.
[37:57.080 --> 38:00.080]  Get the FBI calling down there asking questions.
[38:00.080 --> 38:06.080]  One thing that happens, the feds are very unlikely to pick up your complaint.
[38:06.080 --> 38:15.080]  But what they will always do to cover their behinds is make a call to find out what's going on.
[38:15.080 --> 38:24.080]  And when this judge's office gets a call from the FBI, you're going to have her attention.
[38:24.080 --> 38:34.080]  And then you start speaking to Rito, ongoing criminal conspiracy.
[38:34.080 --> 38:35.080]  And that's what I want to look at.
[38:35.080 --> 38:41.080]  That's why I asked the question about how many people plead not guilty in their courts.
[38:41.080 --> 38:55.080]  And you make noises as if you're coming after them for a pattern of abuse designed to deny people in due process.
[38:55.080 --> 39:00.080]  Have you been arrested on this issue?

[39:03.080 --> 39:06.080]  That is interesting.
[39:06.080 --> 39:10.080]  Have you ever had an examining trial on this issue?

[39:33.080 --> 39:41.080]  You can start this off very quickly with my challenge to subject matter jurisdiction.
[39:41.080 --> 39:51.080]  She was, I guess, swayed by the county attorney to swear to another one, class A.
[39:51.080 --> 39:57.080]  Prosecuting attorney cannot.
[39:57.080 --> 40:02.080]  You got the prosecuting attorney to swear out a complaint?
[40:02.080 --> 40:08.080]  Yeah, got her to a higher charge, the class A misdemeanor.
[40:08.080 --> 40:10.080]  The same deputy.
[40:10.080 --> 40:12.080]  Oh, okay, the deputy.
[40:12.080 --> 40:22.080]  Okay, the deputy did not have authority in the first instance to file the class A misdemeanor.
[40:22.080 --> 40:49.080]  And that should abate subject matter jurisdiction from the original case, but the second filing in the second complaint did the sheriff's deputy make factual statements that supported the class A misdemeanor.
[40:49.080 --> 40:55.080]  And if so, what were they?
[40:55.080 --> 41:07.080]  It was kind of a reiteration of the, I've got it here, of the class C.
[41:07.080 --> 41:27.080]  Okay, do you know what the criminal misdemeanor statute says?
[41:27.080 --> 41:33.080]  It's an information page and there's a complaint page.
[41:33.080 --> 41:37.080]  Okay, information is the one that the prosecutor put together.
[41:37.080 --> 41:41.080]  The complaint is the one from the officer.
[41:41.080 --> 42:09.080]  Yeah, so the complaint charged before making the filing this complaint on about the 25th day of September, Richard, Renfrode, defendant did then and their intentionally and knowingly damaged or destroyed tangible property to a field location and how people are in the faith academy school by driving a motor vehicle across the field without the effective consent of Amy Burcham, the owner of the property.

[42:11.080 --> 42:23.080]  She's administrative assistant and you know what that matters and did thereby cause pecuniary loss of $750 or more, but less than 2,500 to the 100.

[43:18.080 --> 43:27.080]  If he can't support that his act is one of aggravated perjury and the prosecutor almost certainly got him to do it.
[43:27.080 --> 43:31.080]  So you charge the officer with aggravated perjury.

[01:04:08.080 --> 01:04:17.080]  Now, kind of give us an idea of what your situation is so I have some background reference to work from.
[01:04:17.080 --> 01:04:33.080]  Okay, three years ago, I was arrested and charged with PC-115, which is a recording, a false document in the county records, the document being a quitclean deed.
[01:04:33.080 --> 01:04:49.080]  However, what's really going on is my house was foreclosed on, the sale was reversed, and the quitclean deed was to transfer the property from, or transfer the interest more correctly from my name to my trust.
[01:04:49.080 --> 01:05:09.080]  And I was in the process of fighting the foreclosure, fighting the eviction, and I was making headway when the court, I think the clerks down there, sent the case, the eviction case over to a judge that would do the right thing for the lawyer on the other side,
[01:05:09.080 --> 01:05:23.080]  and that judge being Socrates Peter Mnuchin. That judge had nothing to do with the eviction case, and something that's just came to light, the light finally came on in my head,
[01:05:23.080 --> 01:05:32.080]  because the house was in my name, the lawyer that filed the eviction case against me had no standing to file that case.
[01:05:32.080 --> 01:05:47.080]  Not knowing the law, however, I did object when I went to that hearing and trial and told the judge they can't file this case because they have no standing to file the case, the properties are in my name.
[01:05:47.080 --> 01:05:59.080]  And the judge went ahead and gave them a judgment and a writ of possession from me out of the house. I appealed, and like I said, then other things are going on, and then this other judge got involved.
[01:05:59.080 --> 01:06:12.080]  That judge getting involved, I then, in turn, had removed the case to federal court and informed him of that. He said he didn't care, so I named him in the federal lawsuit,
[01:06:12.080 --> 01:06:23.080]  and the federal marshals served him on New Year's Eve at the courthouse, and six weeks later, I have a swap team at the house, took me out of the house.
[01:06:23.080 --> 01:06:43.080]  So this is all, everything is stemming from retaliation, okay, and where we're at now is I get hit with those charges, and a lot of bad things have happened along the way, a lot of violations of civil rights.
[01:06:43.080 --> 01:06:59.080]  I had a heart attack, April of 2016, and the judge, with the criminal proceeding going on, demanded and threatened to have me arrested if I didn't appear.
[01:06:59.080 --> 01:07:02.080]  This was on June 1, just like five weeks after the heart attack.
[01:07:02.080 --> 01:07:10.080]  So under threat, I went into the, I appeared, and I promptly started to have another heart attack in the courtroom.
[01:07:10.080 --> 01:07:20.080]  The judge had left the bench, and that should get depraved heart assault against the judge.
[01:07:20.080 --> 01:07:30.080]  It's worse than that, Randy, because the judge had left the bench to check on some law, and we were in the courtroom waiting when I told the deputies I was having a heart attack.
[01:07:30.080 --> 01:07:43.080]  They called 9-1-1, then they told the judge, and with the ambulance and paramedics on the way, the judge came out of her office, went back on the bench and continued to prosecute me while I'm having a heart attack.
[01:07:43.080 --> 01:07:47.080]  So, you know, depraved heart assault.
[01:07:47.080 --> 01:08:08.080]  Yeah, then the latest thing that just happened, and I apologize, I'm a little upset today, didn't sleep last night, it occurred to me that my arraignment that took place 299 days after my arrest, the whole thing was a sham.
[01:08:08.080 --> 01:08:17.080]  They brought in a ringer judge, and he screamed and yelled at me, and he entered a plea of not guilty.
[01:08:17.080 --> 01:08:30.080]  I objected, he screamed and yelled, I couldn't object, and then he asked me if I waved time without telling me my rights or anything, and then when I didn't answer, he belittled and berated me.
[01:08:30.080 --> 01:08:39.080]  And then I started screaming again, so to try to shut him down, I said, I see the public defender nodding his head.
[01:08:39.080 --> 01:08:41.080]  Judge goes, time waved.
[01:08:41.080 --> 01:08:48.080]  So, I just got the transcript of that whole fiasco last night.
[01:08:48.080 --> 01:08:58.080]  The transcript's only nine pages, it was a short session, but the transcript, Randy, is full of things that did not happen.
[01:08:58.080 --> 01:09:05.080]  It has me saying that I suggest the waving time, which I did not do.
[01:09:05.080 --> 01:09:12.080]  The transcript says that I referred to the public defender as my lawyer, which I did not do.
[01:09:12.080 --> 01:09:18.080]  I've sent an email back to this court reporter saying, hey, this is...
[01:09:18.080 --> 01:09:25.080]  Wait a minute, hold on, hold on, you're right in the middle of something real sophisticated.

[01:09:29.080 --> 01:09:38.080]  That hearing took place on December 8th of 2016.

[01:21:28.080 --> 01:21:43.080]  That goes to another problem. I just went and looked at the file again a few days ago, and papers that I have filed into the case are not in the file.

[01:21:47.080 --> 01:21:52.080]  Ted, stop. You have to stop doing that.
[01:21:52.080 --> 01:22:01.080]  You're going from one bad thing to another bad thing to another bad thing, and you're not making any sense.
[01:22:01.080 --> 01:22:09.080]  If they're not in there, you should have a statement showing this is when it was filed.
[01:22:09.080 --> 01:22:16.080]  Maybe right here, it's not here in the context of the overall case. We don't care what they're doing.
[01:22:16.080 --> 01:22:26.080]  We just need it organized. I understand that you expect these guys to be good guys and follow law.

[01:22:30.080 --> 01:22:34.080]  They're not going to follow law, and they're not going to do what they're supposed to.
[01:22:34.080 --> 01:22:42.080]  If they are required to give you this information, and you ask them for it, and they don't give it to you, file criminal charges against them.
[01:22:42.080 --> 01:23:00.080]  Fissure oppression or personal misconduct in California. This filing gives the district attorney every time, every single minor misstep they make, file against them, lay down a record.

[01:23:06.080 --> 01:23:19.080]  When you start filing criminal against them, they're going to get excited because everything you file lands in the record and stays there for their political opponents to pull out and use against them.
[01:23:19.080 --> 01:23:39.080]  I'm excited. We put in a claim on the county bond to $15 million, and noticed the board of supervisors, and at the next hearing on this case, the second in command of the district attorney's office was there and about eight other people.
[01:23:39.080 --> 01:23:57.080]  At least four of them were investigators, and they all had suits, but they all made sure their coats went back so we could see their guns. They all had their guns in this little courtroom, which is unheard of, unprecedented.
[01:23:57.080 --> 01:24:02.080]  Okay. Is it illegal?
[01:24:02.080 --> 01:24:04.080]  No, it's just an act of intimidation.
[01:24:04.080 --> 01:24:11.080]  They ignore it. Ignore it. No points to get you doing exactly what you're doing.
[01:24:11.080 --> 01:24:20.080]  When I see one of those guns, first thing I want to know, I see you're packing there. Tell me, is that pistol loaded?
[01:24:20.080 --> 01:24:34.080]  They'll always say, well, yes, it is. Since you've got it in here and you're showing it to me, are you fixing to pull that pistol on me? And then they know I'm setting them up, and they get real careful real fast.
[01:24:34.080 --> 01:24:40.080]  You have to stop feeling mistreated because these guys are criminals.

[01:24:43.080 --> 01:24:51.080]  They're going to do this, and that whole purpose is to get you to do exactly what you're doing.
[01:24:51.080 --> 01:25:02.080]  Just start taking notes. You want everybody's name? They're all in there displaying these deadly weapons. File a professional conduct complaint against them.
[01:25:02.080 --> 01:25:08.080]  File a criminal complaint with the grand jury that they brought these guys in with guns to frighten and intimidate me.
[01:25:08.080 --> 01:25:16.080]  Let them explain why they're doing it in there with guns.
[01:25:16.080 --> 01:25:22.080]  First thing we need, give me a timeline or I can't help you.

[01:25:23.080 --> 01:25:31.080]  Do it effective. I guarantee you this will be the most valuable tool you have.
[01:25:31.080 --> 01:25:38.080]  I know it's hard. It's one of the toughest things you'll do is to put it together, but it will be worth it.

[01:26:37.080 --> 01:26:49.080]  He's doing everything he can to find a reason so he can file criminal charges against everybody he deals with, so stay away from him.
[01:26:49.080 --> 01:26:57.080]  Once they feel you that way, then they're going to want away from you. They're going to want this thing done and over with.
[01:26:57.080 --> 01:27:11.080]  The more dirty it is, the harder it is for them to maintain, and the higher up you go with these judges, the more politically motivated they are, especially if they're criminals.
[01:27:11.080 --> 01:27:19.080]  You're talking about judges in California, and I know I'm almost certain exactly how they're getting paid off.
[01:27:19.080 --> 01:27:38.080]  If you give me a good timeline, I'm going to show you where to go look. How many mortgages does each of these judges have filed in the county recorder's office?
[01:27:38.080 --> 01:27:48.080]  And how many deeds of trust have been filed against those mortgages, against those properties, and then paid off six months later?

[01:41:33.080 --> 01:41:40.080]  And they'll do the same thing every, like the bar does, because this is kind of the Fox Gardening in-house.

[01:41:44.080 --> 01:41:47.080]  But the insurance carrier won't.
[01:41:47.080 --> 01:41:58.080]  They get enough complaints against the officer, the insurance carrier, the insurance man, the agent. He's just looking for a reason to raise the premium.

[01:42:00.080 --> 01:42:08.080]  So the only way he has to gauge his level of risk for a department are the number of professional conduct complaints you get.
[01:42:08.080 --> 01:42:14.080]  If this guy is a captain, wonderful. That'll sting him good.
[01:42:14.080 --> 01:42:22.080]  You file a professional conduct complaint, and then that goes on his record forever.
[01:42:22.080 --> 01:42:25.080]  So you might want to look that up.

[01:47:41.080 --> 01:47:59.080]  But a professional conduct complaint, that'll sting him good. We should write those every opportunity. And the fear is, oh, if I do that, they will single me out for a special persecution, no, they won't.
[01:47:59.080 --> 01:48:07.080]  They won't want anything to do with you. These guys are cowards. I mean, this is their livelihood.
[01:48:07.080 --> 01:48:17.080]  And if they know that they pull you over, you're going to sting them. They're not going to pull you over. They're not going to want anything to do with you.
[01:48:17.080 --> 01:48:27.080]  Because when it comes to filing professional conduct complaints, it makes no difference if they're valid or not. It stings them just the same.
[01:48:27.080 --> 01:48:43.080]  And it's their fault. They throw out the valid complaints with the invalid complaints. So the only way the insurance company has of gauging this level of risk is by the numbers, not by the validity.
[01:48:43.080 --> 01:48:45.080]  So sting them.
[01:48:45.080 --> 01:48:58.080]  Okay. Now, I have a question. Do we have a way to get that complaint directly to the insurance companies?
[01:48:58.080 --> 01:49:16.080]  Not that I know of unless you send a information request to the sheriff and request their bond holder. Because when it's a department like this, they don't call it insurance. They call it a bond.
[01:49:16.080 --> 01:49:35.080]  So or to the county, you could petition the county controller and ask the county controller to give you a list of all payments for bonds or insurance paid by the county.
[01:49:35.080 --> 01:49:41.080]  When it comes to money, they can't hide it. They can't say it's not open for public inspection.
[01:49:41.080 --> 01:49:48.080]  So if you ask for the invoices, then that will tell you who the carrier is.
[01:49:48.080 --> 01:49:55.080]  That's if you might call the controller and just ask him directly because he don't have a dog in the hot.
[01:49:55.080 --> 01:50:03.080]  So he just does the money and you ask him who he pays for bonds for the county sheriff's department.
[01:50:03.080 --> 01:50:12.080]  And he'll probably tell you there's no problem. They send it directly to them.
[01:50:12.080 --> 01:50:29.080]  But if the bonding is probably the same as malpractice insurance, malpractice insurance has a requirement in it that if anything happens that could possibly lead to litigation.
[01:50:29.080 --> 01:50:37.080]  The lawyer is required to notice their insurance carrier because if they don't, then they're not covered.
[01:50:37.080 --> 01:50:46.080]  So almost certainly the commission will notice the insurance carrier.
[01:50:46.080 --> 01:50:56.080]  Otherwise, they don't have insurance for this. This guy does something and these complaints have been filed and the insurance company hasn't been noticed and they're not going to be covered.
[01:50:56.080 --> 01:51:06.080]  So they're probably going to be careful about that, but it would be fun to send it to the insurance company anyway. Does that make sense?
[01:51:06.080 --> 01:51:23.080]  Yes, it does. Okay. The next thing on this one, do I need to go ahead and do the normal free trial filing, discovery and examining trial?
[01:51:23.080 --> 01:51:32.080]  Yes. Go to my ticket site and put in the ticket information to pull everything down.
[01:51:32.080 --> 01:51:44.080]  And they're written for Texas, but there's a lot of stuff that's standard, a Brady motion and a motion in Limone, a special appearance.
[01:51:44.080 --> 01:51:54.080]  There's a lot of kind of cool stuff in there that can be filed in any case and just dump it on them.
[01:51:54.080 --> 01:52:03.080]  You might go into the Brady motion and request their bonding, the carrier for their insurance.
[01:52:03.080 --> 01:52:18.080]  Maybe there are fair warnings that you plan to sue them and then just make it more difficult for them to try to prosecute it and give them a reason to want to dismiss the case.
[01:52:18.080 --> 01:52:19.080]  Got you.
[01:52:19.080 --> 01:52:42.080]  Then read that statute. When you read the statute, read it from the perspective of does the complaint allege all the elements of the alleged offense?
[01:52:42.080 --> 01:52:56.080]  And the first thing to attack is the sufficiency of the complaint itself and maintain that the complaint, if it didn't state all of the elements and if he's filed a bogus complaint, almost certainly doesn't.
[01:52:56.080 --> 01:53:04.080]  And maintain that the complaint is insufficient to invoke subject matter jurisdiction of the court.
[01:53:04.080 --> 01:53:14.080]  And if they don't dismiss it, then you might look at filing a declaratory judgment suit in a district court just for yucks.
[01:53:14.080 --> 01:53:16.080]  See what it costs in Georgia.
[01:53:16.080 --> 01:53:28.080]  In tenant in Texas, a regular civil action cost between $250 and $300 to file, but a declaratory judgment suit only costs $15.
[01:53:28.080 --> 01:53:42.080]  So it may be similar in Georgia because they are by their nature a smaller and relatively uncomplicated suit because you're not asking for any harm or damages.
[01:53:42.080 --> 01:53:47.080]  You're asking the court to rule on a point of law.
[01:53:47.080 --> 01:53:53.080]  Then you drag this municipal court or this is the JP court out into the district court.
[01:53:53.080 --> 01:53:57.080]  That'll be fun.
[01:53:57.080 --> 01:53:59.080]  You can say district court.
[01:53:59.080 --> 01:54:01.080]  You mean a federal district court?
[01:54:01.080 --> 01:54:02.080]  No, no, no.

[01:54:24.080 --> 01:54:35.080]  I don't remember the federal courts giving me a discount on declaratory judgment suits like the state did, but there might be my check.

[01:54:39.080 --> 01:54:48.080]  As many as I file, I should know that, but I think they charge us the full amount to file each time.
[01:54:48.080 --> 01:55:04.080]  So check the amounts, you know, if it costs the same to file a declaratory judgment suit as a civil suit, then it might be a little bit cost prohibitive.
