[07:04.520 --> 07:17.560] $250 and $350, however, if you file a, I'm sorry, if you file a declaratory judgment
[07:17.560 --> 07:29.240] action, it only costs 15 bucks, and if you file a petition for declaratory judgment,
[07:29.240 --> 07:36.120] and that's a petition where you ask the court to rule on the rights of the parties, and
[07:36.120 --> 07:46.960] you ask for no damages of any kind, there is no official immunity from a declaratory
[07:46.960 --> 07:50.040] judgment suit.
[07:50.040 --> 07:56.960] What this will do is put the jurisdiction in a position to where they must either hire
[07:56.960 --> 08:05.800] an attorney to answer this suit, or risk no answer default, and no answer default goes
[08:05.800 --> 08:20.200] to asking the court to file an order with T-CLOS, the Licensing Commission that licenses
[08:20.200 --> 08:25.920] peace officers, to decertify the officer.
[08:25.920 --> 08:32.320] A motion to dismiss the case for lack of subject matter jurisdiction, lack of authority of
[08:32.320 --> 08:40.920] the officer to enforce, to hold an examining trial on the first degree felony aggravated
[08:40.920 --> 08:52.800] self-charges we filed against the officer, to file an order ordering the court to disgorge
[08:52.800 --> 09:01.680] all of the funds they have collected based on citations written by this officer, an order
[09:01.680 --> 09:10.320] ordering the jurisdiction to disgorge all funds based on prosecutions by any officers
[09:10.320 --> 09:21.160] engaged by the jurisdiction who are not specifically authorized to enforce the transportation code,
[09:21.160 --> 09:32.720] and a request to initiate a court of inquiry into the actions of the jurisdiction, the
[09:32.720 --> 09:38.600] actions of the prosecutors, and the judges of the jurisdiction.
[09:38.600 --> 09:45.520] Now this is a declaratory judgment, they cannot file a motion to dismiss a failed state of
[09:45.520 --> 09:51.800] claim in which court it can be had, Judge McBride found that out, because when he dismissed
[09:51.800 --> 09:57.000] my quiet title case, which was written as a declaratory judgment suit, he dismissed
[09:57.000 --> 10:01.240] it with prejudice for failure state of claim in which court it can be had, well of course
[10:01.240 --> 10:05.400] I failed a state of claim in which court it can be had, because it was a declaratory
[10:05.400 --> 10:11.760] judgment suit, there is no claim, so I immediately filed criminal charges against him with the
[10:11.760 --> 10:12.760] FBI.
[10:12.760 --> 10:19.760] Now that was a hoot, and we're still pressing that one, but from what I understand, from
[10:19.760 --> 10:24.920] what I've seen, I have a friend who's still filing the same kind of suit I was filing,
[10:24.920 --> 10:29.960] McBride is not dismissing those anymore, we got his attention.
[10:29.960 --> 10:38.000] The declaratory judgment suit will put them in court and stick them there, they'll have
[10:38.000 --> 10:45.960] to answer the suit, then you get to go to discovery, then instead of filing a challenge
[10:45.960 --> 10:51.440] subject matter jurisdiction, requesting that the court show jurisdiction and have the court
[10:51.440 --> 10:58.680] just ignore it and plow on the way they were going, now we're before a district judge,
[10:58.680 --> 11:06.040] and there before the judge as the defendant, being asked to prove up their authority to
[11:06.040 --> 11:11.760] perform the actions or to fail to perform the actions they failed to perform.
[11:11.760 --> 11:17.120] We get to go to discovery, and when they cannot prove it up in discovery, then we move for
[11:17.120 --> 11:19.360] default judgment.
[11:19.360 --> 11:25.920] We get a judgment in our favor, that's res judicata, now we come back and file the civil

[37:34.280 --> 37:42.760] state now, but this was like one rural county fighting back against the whole recent legalization
[37:42.760 --> 37:43.760] and stuff.
[37:43.760 --> 37:44.760] It seemed like so.
[37:44.760 --> 37:52.320] He really wanted to, he just pegged us for hot smoke and people, so he really wanted
[37:52.320 --> 37:59.760] to, but the point is that eventually he found a way, like we denied, yes, he could search,
[37:59.760 --> 38:07.000] we denied a search and then he extends the traffic stop in order to call a city cop ten
[38:07.000 --> 38:12.800] miles away, come with his canine unit and see canine can smell anything.
[38:12.800 --> 38:21.000] Canine fails to alert for any drugs and then the officer decides to take a couple more
[38:21.000 --> 38:25.320] swoops around the car, see if his nose can smell it and who do you know, he said he smells
[38:25.320 --> 38:31.600] the faint odor of green marijuana and so he's like, okay, now I have probable cause.
[38:31.600 --> 38:39.200] I'm going to search the car and then eventually he found my buddy's pot and apparently it
[38:39.200 --> 38:45.320] was too much to possess in a public place, even though it's under the legal limit of
[38:45.320 --> 38:50.400] the state and a lot of it passed like for personal possession, it's too much for a public
[38:50.400 --> 38:56.200] place and so they took us to jail, they also found some mushrooms anyway, he was in legal
[38:56.200 --> 39:01.120] search, they found that stuff and they took us to jail and we have a probable cause hearing
[39:01.120 --> 39:03.120] coming up pretty soon.
[39:03.120 --> 39:07.920] Okay, probable cause hearing, good.
[39:07.920 --> 39:11.920] Make it a double probable cause hearing.
[39:11.920 --> 39:16.360] What you're telling me is that the officer exerted or purported to exert an authority
[39:16.360 --> 39:21.200] and he did not expressly have it in the process, denied uniformed free access to or enjoyment
[39:21.200 --> 39:31.440] of right, the right to be free from unlawful search or seizure, that's crime in every state.
[39:31.440 --> 39:34.640] So have you filed criminal charges against the officer?

[39:35.640 --> 39:41.640] Okay, you know what's going to happen when you file a criminal charges against the officer?
[39:41.640 --> 39:45.840] They're not going to like it, they knew that.
[39:45.840 --> 39:53.240] And nothing, whoever you file it with is going to refuse to take it, at least that's what
[39:53.240 --> 39:54.240] we hope.
[39:54.240 --> 40:01.720] And now they gave me a public defender and I would just like drop this unbeknownst to
[40:01.720 --> 40:03.680] the public defender?
[40:03.680 --> 40:09.280] Well what, no, do not go to the public defender with this, don't even speak to the public
[40:09.280 --> 40:14.200] defender about this and if he tries to talk to you about it, do not let him talk to you
[40:14.200 --> 40:18.600] about it, tell him it's none of your business.
[40:18.600 --> 40:24.120] That's how you protect your public defender because the public defender is then going
[40:24.120 --> 40:28.920] to go to the judge and say, oh he won't talk to me about this, I don't have anything to

[40:29.920 --> 40:34.960] Now your public defender has plausible deniability.
[40:34.960 --> 40:41.720] You need to give them reason to drop your case and make you want to go away.
[40:41.720 --> 40:46.360] Normally our motion is depressed, there's a lot of case law in Oregon that says, you
[40:46.360 --> 40:50.000] know, they violate the law in order to adjust.
[40:50.000 --> 40:53.400] Good luck with that.
[40:53.400 --> 41:01.720] One of the things I keep telling people, never ever expect to win your case simply because
[41:01.720 --> 41:07.880] you have the law and the facts on your side, previous caller just referred to that.
[41:07.880 --> 41:14.960] Now it's possible that you might, but very unlikely, so don't be surprised or too terribly
[41:14.960 --> 41:21.600] disappointed when you don't because the judges tend to do whatever they want to do without
[41:21.600 --> 41:25.360] regard to the right of things or the rule of law.
[41:25.360 --> 41:29.600] You'll never win your case because you have the law and the facts on your side or you
[41:29.600 --> 41:33.040] can never expect to win.
[41:33.040 --> 41:40.640] You can only expect to win if you have the politics on your side and all politics is
[41:40.640 --> 41:41.640] local.
[41:41.640 --> 41:45.080] So this is what we're talking about here.
[41:45.080 --> 41:53.880] You file criminal charges against the officer because he claimed his nose was more sensitive
[41:53.880 --> 41:58.760] than that of a drug dog.
[41:58.760 --> 42:08.160] Now in most states, they can't hold you while they call in a drug dog, not on a terror stop.
[42:08.160 --> 42:13.800] So check Oregon law, he probably had no power to hold you and if he held you for that period
[42:13.800 --> 42:19.840] of time, that was false imprisonment and that's also an active official question or it might
[42:19.840 --> 42:23.840] be called official misconduct in Oregon.
[42:23.840 --> 42:31.920] File against him, he filed against you, he of all people, the man who's enforcing the
[42:31.920 --> 42:39.080] law should follow the law, H.G. Wells in his outline of history, on speaking to the corruption
[42:39.080 --> 42:44.520] of the popes during the dark ages, very aptly observed.
[42:44.520 --> 42:52.120] The giver of the law most owes the law allegiance, he of all beings should behave as though the
[42:52.120 --> 43:00.360] law compels him, but it is the universal failing of mankind that what we are given to administer,
[43:00.360 --> 43:04.760] we promptly presume we own.
[43:04.760 --> 43:14.320] Well it is my assertion to you that that officer, prosecutor, the judge does not own the law.

[47:25.600 --> 47:29.600] the baddest motor scooter in the building, there's only one reason you're the baddest
[47:29.600 --> 47:35.960] motor scooter in the building, it's because you're nobody, you're not a prosecutor, a
[47:35.960 --> 47:44.520] clerk, a bailiff, a judge, these guys are all public servants, they're the servants,
[47:44.520 --> 47:51.200] you're the master, when you walk into a courthouse you carry two hats with you, you generally
[47:51.200 --> 47:56.760] walk in with your litigants hat on, but if one of your public officials steps across
[47:56.760 --> 48:04.400] one of your legal lines, you take off that litigants hat, you put on the master's hat
[48:04.400 --> 48:12.680] and we fight guys, I have a rule, never ask a public official to do anything you actually
[48:12.680 --> 48:19.040] want him to do, because you never ask a public official to do anything that the law does

[48:43.640 --> 48:48.480] before notaring, you give it to the judge in the form of a verified criminal affidavit,
[48:48.480 --> 48:56.200] now you want him to hold another examining trial, one on this officer who should be there
[48:56.200 --> 49:06.120] for false imprisonment, official oppression, and does that matter if I do that before or
[49:06.120 --> 49:16.160] after this TC hearing, it's coming up like Monday, does it matter, I'm not sure the context,
[49:16.160 --> 49:24.320] does it matter legally or does it matter politically, I guess, well I mean I guess politically
[49:24.320 --> 49:29.040] because that's what we're doing this morning, right, legally it doesn't matter, politically
[49:29.040 --> 49:36.760] it matters big time, because remember my rule, never ask a judge, never ask a public official
[49:36.760 --> 49:41.200] to do anything you actually want him to do, so you're going to give this criminal complaint
[49:41.200 --> 49:45.560] to the judge and say you want him to hold an examining trial on this officer, but you
[49:45.560 --> 49:54.040] really don't want him to, you want him to refuse to, I don't work, now you take a criminal
[49:54.040 --> 49:59.640] complaint against the judge for shielding from prostitution or if you're going to an
[49:59.640 --> 50:07.960] examining trial to what they call a preliminary hearing, then you're not before a judge, you're
[50:07.960 --> 50:15.040] before a magistrate, and the only thing magistrates do is hold examining trials, examine into
[50:15.040 --> 50:20.080] the sufficiency of allegations, well he's there to hold an examining trial in the sufficiency
[50:20.080 --> 50:27.560] of the allegation against you, well you give him one against the officer, the officer is
[50:27.560 --> 50:36.440] just a chump public employee, you're the master of those employees, so when the judge fails
[50:36.440 --> 50:42.600] to take a criminal complaint from a credible person, have you ever been convicted of a
[50:42.600 --> 50:43.600] felony?
[50:43.600 --> 50:44.600] No.
[50:44.600 --> 50:47.720] Are you over 18?

[50:49.720 --> 50:58.240] You are a credible person by legal definition, so you make it known to the judge, a credible

[51:09.520 --> 51:16.000] the sufficiency of the allegation and he is sitting for that purpose at this time, so
[51:16.000 --> 51:23.680] give him something to examine into, and he's going to refuse, wonderful.
[51:23.680 --> 51:30.280] Now you file against the judge for failing to perform a duty he is required to perform
[51:30.280 --> 51:37.160] and in the process deny you any equal protection of the laws, you take that and file it with
[51:37.160 --> 51:42.520] the next higher judge, is this a felony court or misdemeanor court?
[51:42.520 --> 51:48.760] Misdemeanor, okay, you take it with whatever the felony court is, in Texas it would be
[51:48.760 --> 51:53.960] the district court, misdemeanor court would be the county court, so you take it to take
[51:53.960 --> 52:01.440] your complaint against this judge or magistrate to a district judge and ask the district judge
[52:01.440 --> 52:07.800] to have the magistrate arrested, and what do you think he's going to do?
[52:07.800 --> 52:11.880] Exactly, that's what we hope.
[52:11.880 --> 52:16.320] Now you take a complaint against this district judge and you send it to the state attorney
[52:16.320 --> 52:24.680] general, and we know what he's going to do with it, nothing, then you take a complaint
[52:24.680 --> 52:29.000] against the state attorney general and file it with the chief justice of the Supreme Court
[52:29.000 --> 52:37.200] to the state of Oregon, and we know what he's going to do with it, and then we come back
[52:37.200 --> 52:43.040] to the magistrate and file against the chief justice, now we got all of these guys tied
[52:43.040 --> 52:50.240] up in this, all these high level officials, these guys at the bottom, they're chumps,
[52:50.240 --> 52:59.720] they really, they're not so politically sensitive, but the district judge, he is, attorney general,

[01:50:26.040 --> 01:50:27.040] matter jurisdiction.
[01:50:27.040 --> 01:50:33.520] See, we maintained that the judge did not have subject matter jurisdiction.
[01:50:33.520 --> 01:50:39.400] So they said they can't come in here and counter sue when they've already said the judge doesn't

[01:53:33.560 --> 01:53:43.000] bar grieve him, but he's gone now and the governor has appointed a new district judge.
[01:53:43.000 --> 01:53:50.720] He's brand new up on the bench, but he's, he has, I have known him for many years or
[01:53:50.720 --> 01:54:00.080] kind of, and he's one of the smartest lawyers in Wise County.

[01:54:05.680 --> 01:54:12.240] When the judge that just passed away got into office, he was a stinker from the first day.
