[05:21.000 --> 05:27.080] people of Texas versus the whims of government. And folks I want to tell you
[05:27.080 --> 05:32.600] some of the comments were very good. They even said that I was spot on with the
[05:32.600 --> 05:35.920] assessments and all that and that's all that's all well and good. I'm glad
[05:35.920 --> 05:42.720] everybody thinks so. But the problem I'm finding with the thought process that
[05:42.720 --> 05:51.280] people have on most of this is they're not wanting to believe that the
[05:51.280 --> 05:57.840] government can and will do the things I'm talking about. The problem with that
[05:57.840 --> 06:08.040] thought process is is that it is provably historically delusional because
[06:08.040 --> 06:14.400] that the government has done nothing but prove time and time again it cannot be
[06:14.400 --> 06:24.120] trusted with any power it is given. None. It has abused every single power and
[06:24.120 --> 06:34.960] authority at every level since the day it was created. Why? Well one the people
[06:34.960 --> 06:43.840] do not take an active interest and action on the politics of the day. Not
[06:43.840 --> 06:50.200] anymore they don't especially. They trust those in government to do the right thing
[06:50.200 --> 06:57.520] because they're one of them they think. That may have been true at one time but
[06:57.520 --> 07:06.240] that is no longer true today. The people you have in government are the people
[07:06.240 --> 07:15.960] with the money to buy the office. If you think they bought that office to serve
[07:15.960 --> 07:27.560] you, you better think again. Nobody is going to pay more to get into a public
[07:27.560 --> 07:34.800] office than they can earn by being in that public office unless they plan to
[07:34.800 --> 07:44.120] steal all of it back a hundred times over. And once again government has
[07:44.120 --> 07:55.280] proven that that is the one thing it is most certainly willing to do. Now in that
[07:55.280 --> 08:01.120] address last week I talked about the fact that we cannot give to our public
[08:01.120 --> 08:10.680] servants a power that we ourselves do not individually possess. That should be
[08:10.680 --> 08:15.800] axiomatic in a country of rights liberties and individual freedoms. That
[08:15.800 --> 08:20.480] should be a thought that should be first and forefront on every mind every day
[08:20.480 --> 08:28.240] that how you cannot do what you're doing because I can't do what you're doing. And
[08:28.240 --> 08:39.760] if I can't do it you can't do it. That is the very idea and essence of delegated
[08:39.760 --> 08:50.040] powers. You cannot delegate to someone an authority you don't have. You cannot
[08:50.040 --> 08:58.040] delegate to someone a power you don't have. You cannot give someone permission
[08:58.040 --> 09:13.160] over your neighbor. Only yourself. So this group think idiocy that the people
[09:13.160 --> 09:22.800] voted on it therefore is completely misplaced and misinformed. I don't care
[09:22.800 --> 09:29.880] if a thousand times the number of one or a thousand times of the entire
[09:29.880 --> 09:38.480] population of Texas votes against one. If that one does not consent then you
[09:38.480 --> 09:44.480] cannot do to them what you want to do to them if you never possess the power to
[09:44.480 --> 09:56.160] do it to them individually in the first place. End of discussion. Now someone
[09:56.160 --> 10:02.520] today sent me a notice to like their Facebook page where they set up a page
[10:02.520 --> 10:07.120] because they're running for governor of Texas and that's all well and good. And
[10:07.120 --> 10:12.560] I posted the one question anyone that puts me on a page like that hey come
[10:12.560 --> 10:18.080] like my page I run it for public office. I always post the same question. If you
[10:18.080 --> 10:26.600] get the power how do you intend to use it? Nine times out of ten I get the same
[10:26.600 --> 10:31.700] answer and it's all flowery I'm gonna do so and so I'm gonna do so and so but the
[10:31.700 --> 10:37.040] problem is I look at the answer and I say is that something that that office
[10:37.040 --> 10:42.760] one has the power to do on its own without any approval or intervention from
[10:42.760 --> 10:51.800] anyone else and two is it a power that we the people actually gave them to do in
[10:51.800 --> 11:01.520] the same instance and three how does it help the people of Texas rather than
[11:01.520 --> 11:07.520] the people that lobby for the favors they get from government to line their
[11:07.520 --> 11:16.640] own pockets or for government itself. And generally the answers I get back will
[11:16.640 --> 11:24.720] violate one or more of those processes. It's just like when Trump was saying he
[11:24.720 --> 11:27.800] was going to build the wall and I don't care whether you support Trump or you
[11:27.800 --> 11:33.200] don't support Trump facts are facts and this is a fact unless he paid for it out
[11:33.200 --> 11:42.320] of his own pocket Trump has no no authority whatsoever to build a
[11:42.320 --> 11:49.640] freaking wall along the border of anything. None. That is not his job it has
[11:49.640 --> 11:55.080] never been his job and by his I mean the office of the president not just him
[11:55.080 --> 11:59.920] personally or but any of them that ever sat in that chair it's not their job
[11:59.920 --> 12:04.760] it's not one of the powers we gave them because where would they get the money

[15:12.040 --> 15:16.120] not language in that bill that says this constitutional provision and power
[15:16.120 --> 15:25.600] right here allows us to do this I will veto that bill period. The only other
[15:25.600 --> 15:32.560] prompt, that's the only promise I can legitimately make as president and stand
[15:32.560 --> 15:38.280] on on my own two feet with no support from anyone.

[22:29.560 --> 22:36.400] updated 2.0 version of the seminar book that you have plus a new book on
[22:36.400 --> 22:45.320] procedure. So that will be the one that is basically going to, I've got the cover
[22:45.320 --> 22:50.440] for it up on my legal blog. It's the one with Bruce Lee on the cover. And it's the
[22:50.440 --> 22:53.560] Texas Traffic Court Survival Guide or Training Guide. I forget what the cover

[23:35.040 --> 23:40.040] book first. I was wondering if you maybe, if there's an outline somewhere, a
[23:40.040 --> 23:48.400] procedure, that would be a logical process to go through all this tons of stuff.
[23:48.400 --> 24:11.320] Yeah, I know I'm trying to solve that problem. There you go. Okay. Yeah, this
[24:11.320 --> 24:14.680] gets really shaky over here. I don't know why this thing keeps cutting out. I'm not
[24:14.680 --> 24:21.200] even touching it. It's cutting out. Okay. Anyway, yes and no. The outline, there is
[24:21.200 --> 24:25.880] no specific set of steps other than the folder organization that I put all the
[24:25.880 --> 24:30.400] documents in in the seminar material. Everything is in a folder that's done in
[24:30.400 --> 24:35.920] the order in which you are supposed to use it. But part of the process is that
[24:35.920 --> 24:43.120] you have to learn the code of criminal procedure. And then the process as far as
[24:43.120 --> 24:47.240] what those folders are and how to use them makes a lot more sense because you
[24:47.240 --> 24:51.880] have actually read the steps they're supposed to follow. Well, that's what the
[24:51.880 --> 24:57.200] other book I'm working on is going to do for you. I didn't have time to write that
[24:57.200 --> 25:00.440] in the first one. I only had two months to write every single thing you have in
[25:00.440 --> 25:06.680] that first one. The book and all 400 plus legal pleadings. I had all that had to
[25:06.680 --> 25:13.720] be done in two months. Okay, so I started reading the book. That's the first part.
[25:13.720 --> 25:18.560] Now the text this code then would be the next. They agreed that or should I kind
[25:18.560 --> 25:22.320] of read them kind of simultaneously? Well, you should read them simultaneously
[25:22.320 --> 25:28.960] because at the time when the book was done, which is 2009 originally, there have
[25:28.960 --> 25:33.080] been some changes to the transportation code statutes. For instance, they've
[25:33.080 --> 25:37.880] changed some of the definitions that are in the that are in the book and are
[25:37.880 --> 25:42.800] now it's completely different online and are actually renumbered differently
[25:42.800 --> 25:50.360] online. But you need to understand what it did say and what they changed it to so
[25:50.360 --> 25:55.840] that you can understand arguments such as they have unlawfully altered the
[25:55.840 --> 26:04.720] original intent of the statute through it through amendment means which they
[26:04.720 --> 26:10.480] cannot do. That's a violation of the Texas Constitution. They cannot alter the
[26:10.480 --> 26:17.520] original purpose of a statute by amendment or I guess they should I should
[26:17.520 --> 26:24.240] say they cannot alter the original enactment of a set of statutes by
[26:24.240 --> 26:31.560] statutory amendment. They all have to comply with the original passing of the
[26:31.560 --> 26:38.640] bill, okay? And in that bill, every bill in Texas has a caption or title that has
[26:38.640 --> 26:46.320] to be on the face of the bill that says what the bill's subject matter is, okay?
[26:46.320 --> 26:54.440] Well, the way they changed the definition of light truck, for example, from 2009 to
[26:54.440 --> 27:03.680] now violates the caption. Why? Because the caption specifically says that the
[27:03.680 --> 27:09.400] entire code is for the purpose of transportation, which is commerce.
[27:09.400 --> 27:17.160] Plain and simple, short and sweet, it's for commerce, okay? So they changed the
[27:17.160 --> 27:23.280] definition of light truck to actually remove the words commercial use. They
[27:23.280 --> 27:29.920] took it out of the definition. It was in there in 2009, it's not in there now. So
[27:29.920 --> 27:35.080] they have taken a statute that clearly complied with the caption and removed
[27:35.080 --> 27:40.680] terminology that now makes it appear to operate in violation of the purpose of
[27:40.680 --> 27:46.600] the caption and thus the enactment as a whole, okay? So that's why you need to
[27:46.600 --> 27:52.680] read both and keep on top of both at the same time. And the new book will address
[27:52.680 --> 27:57.040] that change, but you got to remember folks, they go into session every two
[27:57.040 --> 28:05.720] years. Any book I write on any subject is only dependable for a span of two years
[28:05.720 --> 28:12.160] if they make any alterations to anything it contains. Hence the reason you've got
[28:12.160 --> 28:18.560] to stay on top of what they do. The whole reason I made the original book in a

[34:31.520 --> 34:38.000] to do this without bloodshed is to start doing what we need to do on juries, which
[34:38.000 --> 34:44.040] is nullifying everything they're doing. But in order to do that, you need an
[34:44.040 --> 34:49.600] informed jury, someone that knows the BS that's going on and knows that it's all
[34:49.600 --> 34:55.800] a lie and a misuse of authority. Until you have a jury comprised of those
[34:55.800 --> 35:01.120] individuals, it's a crap shoot. It's the one after going to find you guilty or not.
[35:01.120 --> 35:07.000] And a judge alone, forget it. He worked for the same people that's charging you.

[36:50.940 --> 36:57.600] boy, yeah, his legal counsel. Okay. For the county of the Clackamas and he had a
[36:57.600 --> 37:05.280] paralegal write up like a 10-15 page report with the on here on the top of
[37:05.280 --> 37:11.200] the heading. It's called the UTCR 5.0 Statement. And it says the
[37:11.200 --> 37:15.440] defendant's estimate of that oral argument will take approximately 30
[37:15.440 --> 37:21.200] minutes and request official reporting services. Oh, he thinks he's gonna get my
[37:21.200 --> 37:29.560] case dismissed in 30 minutes or less. I guess. It says ORCP 21A and parentheses.
[37:29.560 --> 37:35.480] It says eight. Motion to dismiss. Oregon Rules of Civil Procedure. Yeah, what about it?
[37:35.480 --> 37:39.960] It says come now. Clackamas County Sheriff's Deputy Sergeant Donald Boone and the
[37:39.960 --> 37:43.240] Clackamas County Sheriff's Office were honestly identified as the Clackamas
[37:43.240 --> 37:47.960] County Sheriff's Department. And file this motion seeking the dismissal of the
[37:47.960 --> 37:54.760] plaintiff's complaint in its entirety pursuant to ORCP 21A 8. And that it
[37:54.760 --> 38:00.080] fails to state ultimate facts sufficient to state a claim. Well, that's a state
[38:00.080 --> 38:07.320] signed 12B6. It's to be expected. They always do that. Right. Right. Well, it
[38:07.320 --> 38:10.600] goes into the body of it and I won't read it to you. Just to give you an outline
[38:10.600 --> 38:13.840] real quick what it's saying. It's saying that everything I put in there was
[38:13.840 --> 38:19.360] erroneous. I leaned on the Constitution of Oregon which they claim is has been
[38:19.360 --> 38:25.080] flawed since the beginning. Like a worthless document more or less. I'm
[38:25.080 --> 38:30.880] trying to rely on that. It said the state has relied and used codes in all
[38:30.880 --> 38:36.640] procedures since the state's inception. That's what it's claiming. It's a side
[38:36.640 --> 38:43.440] that I'm vague in my description of the complaint charges. Well, let me ask you
[38:43.440 --> 38:49.720] this. Did you find, are you suing a federal or state? Right now I guess it
[38:49.720 --> 38:52.920] would be state because I'm going through the circuit court. Well, there shouldn't
[38:52.920 --> 38:56.600] be any guesswork. Which court did you file in the state court or federal court?
[38:56.600 --> 39:04.840] I guess you could call it regional. A state court or a federal court? Well, it's
[39:04.840 --> 39:10.920] obviously going to be state. Well, then it's a state suit. Okay, so the question
[39:10.920 --> 39:17.640] here is, did you find other suits similar to yours and base your allegations
[39:17.640 --> 39:21.360] upon the point and when I say suits similar to yours, I'm talking about ones
[39:21.360 --> 39:26.800] that were actually successfully prosecuted and won. Because if you make
[39:26.800 --> 39:31.440] the same arguments that appear in one that actually made it to trial and was
[39:31.440 --> 39:38.200] won by the plaintiff, then they're going to have a hard time saying that the
[39:38.200 --> 39:42.920] complaint does not state a proper cause of action. Because you have a living
[39:42.920 --> 39:51.640] example in your hand that your case is based upon in all factual ways that
[39:51.640 --> 40:00.400] went to trial on the merits and the state lost. Right? Right. So did you do that? I
[40:00.400 --> 40:03.640] did some research and looked through and I couldn't find anything that was
[40:03.640 --> 40:08.280] exactly the same as mine, but there's others in there. But you could find where
[40:08.280 --> 40:13.480] at least the majority of the specific issues raised existed in some suit or
[40:13.480 --> 40:20.080] other, right? Well, the closest one I found was someone was stopped in 1983 for
[40:20.080 --> 40:24.800] making an unlawful left-hand turn without using a signal and was stopped
[40:24.800 --> 40:29.160] and arrested for something that didn't have anything to do, something to do with
[40:29.160 --> 40:33.840] the possession of marijuana or something like that and he won his case. That's the
[40:33.840 --> 40:39.880] only one I know that was in 1983. Okay. Because the officer didn't have probable
[40:39.880 --> 40:44.960] cause to make the stop in the first place? Well, if this is a civil infraction in
[40:44.960 --> 40:52.240] Oregon, he didn't have probable cause then either, right? Right. So how are they, if
[40:52.240 --> 40:55.680] you made the argument against probable cause basically the same way that this
[40:55.680 --> 41:01.200] case made, how are they saying it doesn't specifically address the issue? I don't
[41:01.200 --> 41:05.160] know because I quoted that in the body of my complaint of cause of action, in the
[41:05.160 --> 41:09.040] body of the complaint. The first thing, the most powerful thing I use was
[41:09.040 --> 41:17.100] organized statute 800 chapter 810-410-3 paragraph A. A police officer shall not
[41:17.100 --> 41:22.320] arrest the person for a traffic violation and that's exactly what he
[41:22.320 --> 41:28.120] did. But he didn't tell me he was arresting me for that. At first, he
[41:28.120 --> 41:32.360] demanded ID. He said, I'm giving you my name address the date of birth. That's all
[41:32.360 --> 41:36.040] I need to provide you. Nope. You're going to give me a physical form of ID now. So
[41:36.040 --> 41:39.520] I'll give you my name and, okay, I'll give you one more chance. Give me your, give
[41:39.520 --> 41:43.360] me your ID. And I said, I'll give you my name address the date of birth. I said,
[41:43.360 --> 41:45.800] okay, go ahead, step out of the vehicle, turn around, put your hands on your back.
[41:45.800 --> 41:51.160] You're under arrest for driving while suspended. And then after that, he charged
[41:51.160 --> 41:56.200] me for failure to present. But then he didn't even make any mention any further
[41:56.200 --> 42:00.080] about the criminal charge that he was trying to charge me with driving while
[42:00.080 --> 42:15.000] suspended. Okay. Okay. But that's what I allege in the complaint. Then he didn't
[42:15.000 --> 42:20.320] show up to the trial portion of it when I, you know, did, you know, did not take
[42:20.320 --> 42:25.760] any deal or at the, at the arraignment for that particular charge, but the charge
[42:25.760 --> 42:31.000] of not presenting, failure to present. Then didn't show up to the trial. In the
[42:31.000 --> 42:37.560] case was dismissed in my favor. That's one of the, through the Poison Tree
[42:37.560 --> 42:41.200] Doctrine took over and that's when Jeopardy attached. That's when it was in my
[42:41.200 --> 42:46.160] favor to file a tort claim at that point. Then I filed a tort claim. They also
[42:46.160 --> 42:51.200] claimed that I failed to do the proper procedure on filing torts first. And I
[42:51.200 --> 42:58.320] said, no, I filed a tort first and it was rejected. Then that's, you know, a long
[42:58.320 --> 43:02.960] time in between that, finally almost at the end of the statute of limitations,
[43:02.960 --> 43:11.200] that I finally filed a lawsuit. Okay. That's where we're at right now and this is their
[43:11.200 --> 43:17.760] response. So my question is on this, uh, they sent this in a pack and then they
[43:17.760 --> 43:23.520] put a, put an envelope on the front of this, of the package here, taped an
[43:23.520 --> 43:27.000] envelope for me to send back to them or something. So I guess I have to make a
[43:27.000 --> 43:32.360] pleading to the court and then re-outline everything that I'm saying again,
[43:32.360 --> 43:37.640] rearticulate all my... Why are you operating on the idea that she did it
[43:37.640 --> 43:44.680] wrong? Well, because just because they said you did it wrong doesn't mean you
[43:44.680 --> 43:48.960] did. That's what they're supposed to try to do is to throw you off and make you
[43:48.960 --> 43:53.120] screw up by changing something. Hang on just a minute. We'll get back on the

[50:49.560 --> 50:54.840] and they're outlining the codes in the Oregon Revised Statute that I failed to
[50:54.840 --> 51:03.520] comply with those. Do any of them violate or attempt to supersede or
[51:03.520 --> 51:09.880] transplant constitutional provisions? If so, those statutes are unconstitutional
[51:09.880 --> 51:16.080] to begin with and cannot be complied with. Right, right. And I have a question
[51:16.080 --> 51:19.800] about that too. Since I served in the military and you did yourself, we are
[51:19.800 --> 51:24.800] both bound by supporting and defending the Constitution in the United States of
[51:24.800 --> 51:31.640] America. Now, when we go into court, can we present that in a fashion that they
[51:31.640 --> 51:38.000] have to, if we request and demand so, use constitutional law and common law in
[51:38.000 --> 51:43.600] our cases, can we force the courts to do so? You can't force the court to do
[51:43.600 --> 51:54.240] anything. Is there any part of that that is not clear? The only thing you can do
[51:54.240 --> 52:00.440] is object to the court not complying with the law or the Constitution. Your oath
[52:00.440 --> 52:07.680] is not a part of the Constitution. Your oath is not a law. It's personal, has
[52:07.680 --> 52:15.360] no nothing to do with them whatsoever, does it? They have their own oath they're

[01:39:21.440 --> 01:39:31.440] Technically speaking, they cannot tow your bike for any reason other than to seize it as evidence of a crime.

[01:39:35.440 --> 01:39:42.440] Or because it presents a public safety hazard by being where you left it.
[01:39:42.440 --> 01:39:51.440] Any other tow is for malicious purposes with no lawful authority behind it.

[01:41:50.440 --> 01:42:04.440] So what they do is violate your rights by retaliating against you for its free exercise and enjoyment, which is what your lawsuit needs to accuse them of doing.
[01:42:04.440 --> 01:42:23.440] Officer Kraft for Brains violated my right to liberty and the free exercise and enjoyment of that right to liberty by maliciously attacking my property and falsely imprisoning me for refusing to speak to him about a criminal issue over which I was the suspect.

[01:42:27.440 --> 01:42:28.440] Right.
[01:42:28.440 --> 01:42:39.440] Why can't we get all these people like you that know the law and can't we file something, a lawsuit?

[01:55:00.440 --> 01:55:10.440] Second, the statute specifically say that they are for commercial vehicles.
