[01:17.400 --> 01:23.400]  investigated for his involvement with Saifulo Saipov, the 29-year-old diversity visa immigrant
[01:23.400 --> 01:26.760]  from Uzbekistan who entered the U.S. in 2010.
[01:26.760 --> 01:30.520]  He rented a pickup truck from a Home Depot in New Jersey before crossing into Manhattan

[01:32.600 --> 01:37.280]  Camera footage recorded him around 3.04 pm Tuesday, driving onto a bike path along the
[01:37.280 --> 01:41.560]  Hudson River where he began targeting pedestrians and cyclists according to what police say

[01:44.240 --> 01:48.280]  After crashing into a school bus, he exited the truck with pellet and paintball guns shouting

[04:33.680 --> 04:36.680]  that blew out our electricity for three days here after the hurricane.
[04:36.680 --> 04:42.680]  So I do apologize for my absence, but at the moment everything is now back up and running,
[04:42.680 --> 04:47.680]  and I would like to take a quick second and say thank you very much to all of the kind people
[04:47.680 --> 04:53.680]  that contributed to make this possible for me to get at least the computer part of this back up and going
[04:53.680 --> 04:57.680]  and get me on my way to hopefully getting the other projects for this coming year,
[04:57.680 --> 05:02.680]  up and going, such as the online classes and things of that nature.

[05:43.680 --> 05:51.680]  All right, now for tonight's show there are several things I want to go over starting with a little bit of understanding
[05:51.680 --> 05:58.680]  about how our republic is supposed to work, both at the state and the federal level,
[05:58.680 --> 06:01.680]  when it comes to rights and powers.
[06:01.680 --> 06:08.680]  Now to do that, I would like to read a few paragraphs out of my friend Dave Champion's book,
[06:08.680 --> 06:13.680]  Income Tax Shattering the Miss, if you have it and you want to follow along,
[06:13.680 --> 06:20.680]  this is on page 86 starting with the second paragraph, and again full credit today for this
[06:20.680 --> 06:29.680]  because this is the best explanation of delegated powers stated in the most succinct manner
[06:29.680 --> 06:33.680]  that I've ever been able to devise even on my own.
[06:33.680 --> 06:38.680]  So I would like to read what he wrote about this so that you have an understanding
[06:38.680 --> 06:44.680]  of how this republican form of government is intended to work,
[06:44.680 --> 06:52.680]  not how it is working, but how it was intended to work through delegation of powers.
[06:52.680 --> 06:55.680]  Okay, now this is how Dave put it.
[06:55.680 --> 07:02.680]  It should be remembered that America was and still is a nation of delegated powers.
[07:02.680 --> 07:08.680]  All political power is held by the people and is delegated to their elected officials.
[07:08.680 --> 07:11.680]  That means two important things.
[07:11.680 --> 07:21.680]  First, whatever power the elected official exercises must first have resided in the people who elected him or her.
[07:21.680 --> 07:26.680]  If no such power belonged to the people who elected the office holder,
[07:26.680 --> 07:30.680]  then the office holder cannot exercise such power.
[07:30.680 --> 07:38.680]  In America, there is no such thing as an office holder exercising a power not held by the people
[07:38.680 --> 07:42.680]  and then delegated by the election process.
[07:42.680 --> 07:49.680]  Second, an elected official cannot use your delegation of authority to pass a law
[07:49.680 --> 07:57.680]  that creates some sort of business vehicle and then tell you that it is a privilege for you to utilize it.
[07:57.680 --> 08:03.680]  It is your original authority being exercised by the office holder
[08:03.680 --> 08:07.680]  that created the business vehicle in the first place.
[08:07.680 --> 08:14.680]  Now he's referring to corporations in this case you didn't know or other forms of legal entity type business.
[08:14.680 --> 08:21.680]  It is manifestly impossible for you personally or operating through your delegate
[08:21.680 --> 08:31.680]  to create something that is then to be construed as a privilege for you the author of the authority to create it to use.
[08:31.680 --> 08:39.680]  It is therefore manifestly impossible for a legislator exercising your delegated authority
[08:39.680 --> 08:47.680]  to pass laws that create corporations and then tell you that it is a privilege for you to use one.
[08:47.680 --> 08:52.680]  We should never be presumed that because we delegated authority to an office holder
[08:52.680 --> 08:59.680]  we are somehow then disenfranchised as the original source of the power the office holder exercises.
[08:59.680 --> 09:04.680]  We are never disenfranchised as the source of the legislator's power.
[09:04.680 --> 09:11.680]  We are always and at all times the author of the legislator's authority.
[09:11.680 --> 09:20.680]  Folks, that's as plain and simple as it gets. This is the authority of a delegated power.
[09:20.680 --> 09:31.680]  I cannot authorize you to do in my place what I am not authorized to do myself.
[09:31.680 --> 09:41.680]  It's illegal for me to murder someone unlawful I should say not illegal but plain out unlawful for me to murder someone.
[09:41.680 --> 09:47.680]  I cannot delegate such power to my government.
[09:47.680 --> 09:59.680]  If it is unlawful for me to tax someone then I can't delegate a power to my government to tax someone for me.
[09:59.680 --> 10:07.680]  Now that works, if I can't go to my neighbor and tell them they owe me a tax and make them pay it
[10:07.680 --> 10:15.680]  then I can't elect someone to go to my neighbor and tell them they owe me a tax and make them pay it.
[10:15.680 --> 10:30.680]  Our darsher can't create something that both of us, me, my neighbor and the person that I appoint as my agent through whatever process
[10:30.680 --> 10:42.680]  can then utilize to do that thing which I myself never had the power to do even if that entity is called government.
[10:42.680 --> 10:49.680]  It should not be any more difficult for someone to understand than that.
[10:49.680 --> 10:51.680]  It shouldn't.
[10:51.680 --> 10:56.680]  But now we come to some goings on here in Texas.
[10:56.680 --> 11:05.680]  For instance everybody knows Texas has got the longest constitution of any state, any five states in the whole damn union.
[11:05.680 --> 11:12.680]  We have a constitution that's written more like a statutory code than it is a damn constitution.
[11:12.680 --> 11:14.680]  Why?
[11:14.680 --> 11:23.680]  Constitutions weren't meant to house every possible thing that the legislature or the people could or could not do.
[11:23.680 --> 11:29.680]  And it couldn't do it anyway in relation to the people because it's not the source of what the people can or cannot do.
[11:29.680 --> 11:39.680]  Though it is the source of everything that the government can or cannot do.
[11:39.680 --> 11:50.680]  And they have done their best to flip that coin over completely where they're the ones with no limitations and the constitution limits us, the people.
[11:50.680 --> 11:53.680]  And it just doesn't work that way.
[11:53.680 --> 12:01.680]  Now I bring this up because right now there are several state constitution amendments up for vote here in Texas.
[12:01.680 --> 12:17.680]  Proposition one, two, three, four, five and six to amend the Texas constitution yet again to put in more garbage that has no business being in a constitution to begin with.
[12:17.680 --> 12:28.680]  Not only that, the things these propositions are wanting to do have some severe consequences down the road.
[12:28.680 --> 12:30.680]  They're not telling you about them now.
[12:30.680 --> 12:41.680]  They're hoping you don't rationalize and analyze and critically think about what the potential is for the abuses contained in these amendments.
[12:41.680 --> 12:45.680]  But I'm certainly going to try to tell you.
[12:45.680 --> 13:07.680]  Now, proposition one summarized basically is the constitutional amendment authorizing the legislature to provide for an exemption for add the law on taxation of part of the market value of the residents homestead of a partially disabled veteran or the surviving
[13:07.680 --> 13:16.680]  spouse of a partially disabled veteran.
[13:16.680 --> 13:39.680]  The residence or homestead or residents homestead was donated to the disabled vet by a charitable organization for less than the market value of the residents homestead and harmonizing certain related provisions of the Texas constitution.
[13:39.680 --> 13:48.680]  Folks, the Texas constitution does not authorize the taxation of our private property. It never has.
[13:48.680 --> 13:57.680]  That is a intentional misreading and misinterpretation by the courts and the legislature to steal money from the public.
[13:57.680 --> 14:07.680]  Why can't the Texas constitution do that for exactly the same reason I just read out of Dave's book?
[14:07.680 --> 14:14.680]  I cannot tax my neighbor or his property.
[14:14.680 --> 14:26.680]  So I cannot delegate the authority to my representatives to do that which I cannot do for myself.
[14:26.680 --> 14:39.680]  A simple no brainer, you would think, but obviously incomprehensible to those even without any actual brains.
[14:39.680 --> 14:46.680]  And we know this because of the blank stares you get from them when you try to explain this concept to them.
[14:46.680 --> 14:50.680]  How can I give you the power to do something that I cannot do myself?
[14:50.680 --> 14:57.680]  Because we're the government. No, you are a creature created by my authority.
[14:57.680 --> 15:01.680]  Regardless of what title you were given.
[15:01.680 --> 15:15.680]  If my authority stops it being able to take money forcibly from my neighbor, then I can't give you the power to take forcibly from my neighbor.
[15:15.680 --> 15:23.680]  Obviously that would be a very understandable thing, not to these folks.
[15:23.680 --> 15:37.680]  Now, that right there is a problem because they're trying to make it appear as if the constitution is a determining factor as to whether or not your property or that of a disabled vet or surviving spouse can be taxed.
[15:37.680 --> 15:39.680]  And it isn't.
[15:39.680 --> 15:43.680]  Never was, never could be.
[15:43.680 --> 15:55.680]  And yet here we are with a constitutional amendment that's trying to make it appear once again that they have a power to do something that we cannot possibly authorize them to do.
[15:55.680 --> 16:14.680]  Now notice also this does nothing to protect the homesteads or property of a vet or surviving spouse who purchased that property with their own hard earned labor and money.
[16:14.680 --> 16:23.680]  This only protects the property if it was donated to them by a charitable organization.
[16:23.680 --> 16:26.680]  Now how often does that happen?
[16:26.680 --> 16:35.680]  How many times has a charitable organization gone up to a disabled vet or a surviving spouse to say, hey, we've got 10 acres at a nice house.
[16:35.680 --> 16:41.680]  Would you like that donated to you?
[16:41.680 --> 16:46.680]  I've never seen it happen, not in my lifetime, not once.
[16:46.680 --> 16:49.680]  Maybe you're luckier than me, I don't know.
[16:49.680 --> 16:53.680]  Why do we need a constitutional amendment for this garbage?

[21:53.680 --> 22:00.680]  That being said, let's go to Proposition 2 of what they're wanting to do now.
[22:00.680 --> 22:08.680]  The constitutional amendment establishes a lower amount for expenditures.
[22:08.680 --> 22:12.680]  Let me get a little bit more light on this because I can't hardly see it here with this.
[22:12.680 --> 22:23.680]  For expenses that can be charged to a borrower and removing certain financing expense limitations for a certain financing or for a home equity loan,
[22:23.680 --> 22:29.680]  establishing a certain authorized lenders to make a home equity loan,
[22:29.680 --> 22:33.680]  changing certain options for the refinancing of home equity loans,
[22:33.680 --> 22:37.680]  changing the threshold for an advance of a home equity line of credit,
[22:37.680 --> 22:41.680]  and allowing home equity loans on agricultural homesteads.
[22:41.680 --> 22:45.680]  Now, in this article they put in they have a what it means section.
[22:45.680 --> 22:48.680]  This is what they say this amendment actually means.
[22:48.680 --> 22:57.680]  This amendment would lower the cap on fees charged to borrowers when establishing a home equity loan from 3% to 2% of the principal of the loan.
[22:57.680 --> 23:02.680]  It would also allow home equity loans to be refinanced as non-home equity loans
[23:02.680 --> 23:06.680]  and would expand the list of entities that may administer home equity loans
[23:06.680 --> 23:13.680]  to include savings, banks, credit unions, subsidiaries of banks, and savings and loan associations.
[23:13.680 --> 23:20.680]  Now, notice that this does not say make the loan.
[23:20.680 --> 23:24.680]  It says administer the loan.
[23:24.680 --> 23:30.680]  Now, considering the things that are going on with the mortgage fraud as it is,
[23:30.680 --> 23:41.680]  what this appears to be doing is adding a lot more fingers to the pie as to who can be appointed as a false holder of your mortgage.
[23:41.680 --> 23:43.680]  That appears to me what this is doing.
[23:43.680 --> 23:48.680]  Now, as well as putting caps on something that I don't see once again,
[23:48.680 --> 23:56.680]  how the state has any power to do in relation to loans given to private people for purchases of homes.
[23:56.680 --> 24:03.680]  Now, percentage fees on any loans made to corporations, fine, they're creatures of law.
[24:03.680 --> 24:08.680]  Do what you want with them, but we are not.
[24:08.680 --> 24:13.680]  If banks are created on our authority, which they have to be,
[24:13.680 --> 24:29.680]  then how can we be charged to use the facilities of the bank by the government to purchase property on a loan?
[24:29.680 --> 24:32.680]  Again, that doesn't make any sense to me.
[24:32.680 --> 24:35.680]  I can't charge my neighbor a fee to go get a loan,
[24:35.680 --> 24:42.680]  so how can I authorize my representative to charge my neighbor a fee to go get a loan?
[24:42.680 --> 24:44.680]  Do you understand?
[24:44.680 --> 24:51.680]  So much of this stuff would take so much power out of the hands of government if it was done correctly,
[24:51.680 --> 24:52.680]  but it's not.
[24:52.680 --> 24:55.680]  It's never done correctly.
[24:55.680 --> 24:59.680]  All right, Proposition 3.
[24:59.680 --> 25:09.680]  The constitutional amendment limiting the service of certain office holders appointed by the governor and confirmed by the Senate after the expiration of the person's term of office.
[25:09.680 --> 25:11.680]  And this is what they say that means.
[25:11.680 --> 25:24.680]  Currently, according to the Texas Constitution, unsouried officials on state boards and commissions must continue to perform their office's duties after their terms have expired until successors are ready.
[25:24.680 --> 25:34.680]  This amendment would relieve officials of their positions at the end of the next regular legislative session if a replacement is not prepared beforehand.
[25:34.680 --> 25:45.680]  Now, let me give you my thoughts on the potential abuses of this particular amendment.
[25:45.680 --> 25:59.680]  What happens to these committees or positions when there is no eligible member elected official, I should say,
[25:59.680 --> 26:11.680]  to fill that position to perform that duty, does the government come to a screeching halt as far as that position or those committees are concerned?
[26:11.680 --> 26:13.680]  Absolutely not.
[26:13.680 --> 26:15.680]  What happens?
[26:15.680 --> 26:26.680]  They're filled up by a bunch of political appointees who will function in those capacities until a properly elected individual is put into office.
[26:26.680 --> 26:40.680]  Now, imagine that you stack the deck with these appointed people to get things working the way you want as the governor or some other person in government.
[26:40.680 --> 26:56.680]  And then you delay any type of reelection or election process to fill that with a permanent elected representative.
[26:56.680 --> 27:10.680]  Now, imagine that you can basically fix the government to operate under a bunch of political appointees who are beholding to those who appointed them.
[27:10.680 --> 27:13.680]  Anybody see a problem with that?
[27:13.680 --> 27:16.680]  Because I certainly see one.
[27:16.680 --> 27:24.680]  That means that the person who now controls that position isn't in there working for you and me.
[27:24.680 --> 27:28.680]  They're in there working for whoever put them there.
[27:28.680 --> 27:31.680]  Get it?

[27:41.680 --> 28:04.680]  The Constitutional Amendment authorizing the legislature to require a court to provide notice to the Attorney General of a challenge to the constitutionality of a state statute and authorizing the legislature to prescribe a waiting period before the court may enter a judgment holding the statute unconstitutional.
[28:04.680 --> 28:07.680]  Now, this is what they say that means.
[28:07.680 --> 28:14.680]  This amendment would require courts to notify the Attorney General of any constitutional challenges to state laws.
[28:14.680 --> 28:27.680]  It also establishes a 45-day period after notifying the Attorney General during which the court cannot judge the contested statute as unconstitutional.
[28:27.680 --> 28:33.680]  Okay, red flag, big, big, big, red flag, okay?
[28:33.680 --> 28:41.680]  First and foremost, an unconstitutional statute is not law from the very beginning.
[28:41.680 --> 28:59.680]  Two, it is a violation of the separation of powers under the Constitution for the legislature to dictate what the court can rule upon in relation to an unconstitutional statute.
[28:59.680 --> 29:08.680]  That would make the Texas Constitution, once again, self-contradicting.
[29:08.680 --> 29:18.680]  It would do that by authorizing the legislature to put a hold on the ruling of the court.
[29:18.680 --> 29:32.680]  Now, notice, this does not say what period of time it simply says that the legislature can establish a period of time.
[29:32.680 --> 29:38.680]  They could hold up a ruling on an unconstitutional statute forever.
[29:38.680 --> 29:44.680]  Not to mention the severe separation of powers problem.
[29:44.680 --> 29:53.680]  It's also a stacked deck against the person challenging the constitutionality of that statutory scheme.
[29:53.680 --> 29:55.680]  We'll get more into that on the other side.

[34:33.680 --> 34:43.680]  If the constitutional amendment says that the legislature can determine a time frame, then why can't they change the 45 days to any time they want?
[34:43.680 --> 34:49.680]  You see, this is the kind of stuff that should never be in the state constitution.
[34:49.680 --> 35:07.680]  And right now, there is already a statutory requirement that when you challenge the constitutionality of any statute in Texas, you have to file a separate form with the Attorney General's office, notifying them that you're doing that.
[35:07.680 --> 35:10.680]  Why does it have to be in the Texas Constitution?
[35:10.680 --> 35:16.680]  It's already in statute.
[35:16.680 --> 35:31.680]  I'll tell you why. It's to give the government another one up on the people when we are challenging the constitutionality of this crap they enact.
[35:31.680 --> 35:40.680]  We have a right to due process and to have an unconstitutional statute immediately declared void.
[35:40.680 --> 35:53.680]  The legislature who created that statute now wants a grace period before the court can reach out and slap their hands and say, you screwed up.
[35:53.680 --> 35:56.680]  Now why would they want that grace period?
[35:56.680 --> 36:12.680]  An emergency session to attempt to correct whatever the problem supposedly is so that the court can then no longer rule on the statute being unconstitutional?
[36:12.680 --> 36:30.680]  Get it? It's to give them even more of an advantage over you and I at challenging their ineptitude and their abuse of authority.
[36:30.680 --> 36:34.680]  That's what I predict for that constitutional amendment.
[36:34.680 --> 36:36.680]  I'm going to channel Alex Jones here.
[36:36.680 --> 36:43.680]  I predicted because I think that's exactly what's going to happen.
[36:43.680 --> 36:53.680]  Proposition 5, the constitutional amendment on professional sports team charitable foundations conducting charitable raffles.
[36:53.680 --> 37:02.680]  Once again, I don't have the power to tell my neighbor he can't play poker in his living room with his buddies or at the town hall.
[37:02.680 --> 37:13.680]  If they're allowed to rent a public space for use for private purposes, they want to hold a poker tournament that's their business.
[37:13.680 --> 37:23.680]  Once again, this stuff about the state legislating morality is something I've never thought was a good idea.
[37:23.680 --> 37:25.680]  Never.
[37:25.680 --> 37:30.680]  Never, ever, ever.
[37:30.680 --> 37:32.680]  But that's what they're doing.
[37:32.680 --> 37:36.680]  Now they want to make it where you have to have X amount of permission or whatever.
[37:36.680 --> 37:37.680]  Let me see.
[37:37.680 --> 37:39.680]  Well, they say this actually means here.
[37:39.680 --> 37:41.680]  Let's see how they want to spin it for you.
[37:41.680 --> 37:49.680]  This amendment would expand the number of professional sports team based foundations able to hold charitable raffles.
[37:49.680 --> 37:59.680]  The list of eligible foundations would now include teams from the Women's National Basketball Association, Minor League Baseball and United Soccer League.
[37:59.680 --> 38:02.680]  But no one else.
[38:02.680 --> 38:11.680]  Again, there's nothing in the Texas Constitution about charitable donations, raffles or gambling.
[38:11.680 --> 38:24.680]  Why are these idiots trying to write constitutional amendments to advocate something that the Constitution does not cover to begin with?
[38:24.680 --> 38:26.680]  Explain that to me.
[38:26.680 --> 38:37.680]  How are they going to make this amendment fly when there is no provision in the Texas Constitution outlawing gambling?
[38:37.680 --> 38:39.680]  Because there isn't one, you know.
[38:39.680 --> 38:44.680]  Not unless they've snuck that in somewhere I haven't seen lately.
[38:44.680 --> 38:45.680]  Proposition 6.
[38:45.680 --> 38:47.680]  Oh, there's a 7 too.
[38:47.680 --> 38:48.680]  I miss counting.
[38:48.680 --> 39:09.680]  The ballot reads, the constitutional amendment authorizing the legislature to provide for an exemption from ad valorem taxation of all or part of the market value of the resident's homestead or the surviving spouse of a first responder who is killed or fatally injured in the line of duty.
[39:09.680 --> 39:14.680]  Once again, private property not taxable.
[39:14.680 --> 39:17.680]  Why do they need a tax exemption?
[39:17.680 --> 39:32.680]  Why also would the Constitution now operate for private individuals outside of the authority of all of the people of Texas?
[39:32.680 --> 39:43.680]  They want to give first responders surviving spouses tax breaks on property that should not be being taxed in the first place.
[39:43.680 --> 40:04.680]  But they are creating a constitutionally protected class of private individual that the rest of us must support to make up the differences in taxes they're not being made to pay is how this is going to work despite the fact that taxes shouldn't be being collected in the first place.
[40:04.680 --> 40:17.680]  They're going to use it as an excuse to raise the taxes on everyone else, just like any other welfare program, because that's what this is going to amount to.
[40:17.680 --> 40:20.680]  Okay, so keep that in mind.
[40:20.680 --> 40:22.680]  I don't have anything against first responders.
[40:22.680 --> 40:34.680]  They have every right to their private property, just like any of the rest of us do, even if we're not first responders.
[40:34.680 --> 40:46.680]  Would these people be first responders if they were an entirely volunteer service that was not getting paid again by us?
[40:46.680 --> 40:56.680]  Probably not, unless they were on a volunteer fire department in their neighborhood or a volunteer neighborhood watching their neighborhood.
[40:56.680 --> 41:03.680]  So even if they are first responders, they sure couldn't come knocking door to door and say, hey, you need to cough up money for me.
[41:03.680 --> 41:09.680]  But now we've got a constitutional amendment that says that's exactly what the state is going to be able to do on their behalf.
[41:09.680 --> 41:14.680]  Get it?
[41:14.680 --> 41:26.680]  Proposition 7, the constitutional amendment relating to legislative authority to permit credit unions and other financial institutions to award prizes by lot to promote savings.
[41:26.680 --> 41:35.680]  This amendment would allow credit unions, banks, and other financial institutions to conduct promotional activities such as raffles to encourage savings.
[41:35.680 --> 41:38.680]  You know what would encourage savings?
[41:38.680 --> 41:51.680]  Killing inflation, getting rid of fiat currency, stop stealing our livelihood after we spent years building it up.
[41:51.680 --> 41:57.680]  Through unlawful inflationary taxation that eats away at the savings we make.
[41:57.680 --> 42:04.680]  You want to encourage savings? Get the hell out of our pockets to begin with.
[42:04.680 --> 42:12.680]  That'd go a long way to encourage savings. People put up money knowing down well the government could never lay a finger on it because they're not allowed to.
[42:12.680 --> 42:19.680]  They're specifically prohibited from it and the people have the right to shoot the first tax collector to set foot on their property.
[42:19.680 --> 42:22.680]  And I guarantee you savings would increase.
[42:22.680 --> 42:30.680]  We don't need the banks trying to promote it. It would already be happening.
[42:30.680 --> 42:40.680]  But then again, common sense is not something that we put into play when we go political, is it?
[42:40.680 --> 42:46.680]  Nobody wants to say the ugly truth anymore because it's not politically correct.
[42:46.680 --> 42:55.680]  Well, that is something I will never be accused of being. It's politically correct.
[42:55.680 --> 43:00.680]  I'm not going to sugarcoat it just because it might offend you if I don't.
[43:00.680 --> 43:04.680]  I have as much right to my opinion in what I say as you do.
[43:04.680 --> 43:16.680]  The difference between me and a lot of people is I try to base my based upon the facts of what's in front of me or what is known to me rather than just my emotional composition on the subject.
[43:16.680 --> 43:25.680]  And that's how most people do their thinking is emotionally. And I don't know why that is anymore, but it's just the way it is.
[43:25.680 --> 43:36.680]  If you don't believe that, then ask them a question and watch how agitated they get when it's something they don't agree with.
[43:36.680 --> 43:47.680]  Try to get them to explain to you rationally using facts rather than emotion why they support a particular position on something. And good luck.

[47:16.680 --> 47:22.680]  Well, good. It's good to finally get a hold of you here. I've been trying to get in touch with you recently.
[47:22.680 --> 47:28.680]  I understand you're a busy guy, but I thought I'd try the radio program. I got a hold of you, so that's good.
[47:28.680 --> 47:34.680]  It's the first night I've actually been able to do the radio program in several, several weeks.
[47:34.680 --> 47:40.680]  Well, it's good to have you back. I know you've got other callers, so try to be brief, Eddie.
[47:40.680 --> 47:49.680]  But the reason I'm calling now, my dad and I were just exercising our right to travel here in Wyoming.
[47:49.680 --> 47:53.680]  We don't drive with the driver's license.
[47:53.680 --> 47:59.680]  He was stopped the other day for an infraction. I think the officer said he was going over the line.
[47:59.680 --> 48:07.680]  The county sheriff had stopped him. He'd give him a ticket for, it said, operating a motor vehicle without a driver's license.
[48:07.680 --> 48:11.680]  And then the other one was for not showing proof of insurance.
[48:11.680 --> 48:18.680]  We did continue the hearing out, trying to find out how we were going to go about fighting this.
[48:18.680 --> 48:23.680]  We've got to continue once the second time the judge did not continue it.
[48:23.680 --> 48:30.680]  So he had to go in, but he did not make a plea. He just said, look, you know, the court doesn't have jurisdiction.
[48:30.680 --> 48:36.680]  And I've got to talk to an attorney or counsel. He used to work counsel.
[48:36.680 --> 48:44.680]  And what the judge did was she said, well, I'm going to move this out through early December.
[48:44.680 --> 48:52.680]  But then she gave an unlawful order. She said, but I'm going to tell you as a condition bond, I'm not going to let you drive.
[48:52.680 --> 48:57.680]  And if you do, you'll be arrested. So he objected to that on the record.
[48:57.680 --> 49:05.680]  He said, well, I object your honor. You know, that's my unalienable right. He used some terms similar to that.
[49:05.680 --> 49:16.680]  And she said, I understand. But just so you know, if you're driving, basically caught by the wills, what they mean by that, you're going to be arrested.
[49:16.680 --> 49:29.680]  So my question is, do we send a motion to rescind that unlawful order or do I go straight in for a demand for dismissal being the fact that we weren't in transportation?
[49:29.680 --> 49:38.680]  Well, you're not going to get a dismissal of the whole case just because the judge was stupid in one decision that doesn't decide the outcome of the case.
[49:38.680 --> 49:52.680]  Now, you can go in and you can try to get the judges, you can appeal the judge's preliminary order or pretrial order, as it were, as being outside of her lawful authority to do.
[49:52.680 --> 49:59.680]  Since she is actually ordering something that is itself the issue contested in the case.
[49:59.680 --> 50:05.680]  Now, if it was a store robbery, of course, that'd be a whole lot clearer thing. I order you not to rob any more stores.
[50:05.680 --> 50:08.680]  That's the type of deal.
[50:08.680 --> 50:10.680]  Sure.
[50:10.680 --> 50:23.680]  But you can also try to seek a disqualification if you can find proper grounds to show that the judge is refusing to apply the law to the facts in the case, et cetera, et cetera.
[50:23.680 --> 50:34.680]  I don't know if I can show that yet because we've just had an initial arraignment. I did send a notice of lack of jurisdiction and I sent a notice.
[50:34.680 --> 50:45.680]  Well, the thing is, hang on, I hate to interrupt you. Let me get something out here. The thing is, is she said they were going to do something they already would be doing anyway.
[50:45.680 --> 50:56.680]  And here's the problem. Is it a crime or is it a civil infraction in Wyoming to not have a license?
[50:56.680 --> 50:58.680]  It's under the criminal code.
[50:58.680 --> 51:00.680]  You're sure?
[51:00.680 --> 51:03.680]  Yes, because they go out of the Wyoming rules criminal procedure.
[51:03.680 --> 51:16.680]  That's not relevant. That is not at all the case. That's not how it works. The same thing you just said is true in California, but they are not criminal.
[51:16.680 --> 51:26.680]  You cannot assume just because they're using a certain set of rules that the act itself is supposed to be under those rules.
[51:26.680 --> 51:34.680]  Right. And I know what you're saying. I actually believe they're civil, but they do conduct here as though they're a criminal act.
[51:34.680 --> 51:44.680]  You're not listening to me, Tyler. I'm not asking you how they conduct them. I'm asking you what the law says they are or they aren't.
[51:44.680 --> 52:01.680]  Does the law say that they are some sort of criminal misdemeanor act? Or does the law say that they are a civil infraction or just a plain infraction?
[52:01.680 --> 52:08.680]  And then is there case law that says whether an infraction is civil or criminal?
[52:08.680 --> 52:17.680]  I'm not 100% sure. Then you need to be looking. Where about that would be? Would that be in the motor vehicle code or would that be...
[52:17.680 --> 52:25.680]  I can't tell you where it will be, but I would start with the rules of procedure and see how they're defined.
[52:25.680 --> 52:43.680]  For instance, here in Texas, the criminal code and the code of criminal procedure, which is our penal code and our code of criminal procedure, two separate codes, identify what are crimes and what class of a crime something is.
[52:43.680 --> 52:49.680]  Sometimes the individual statutes do it. Sometimes they don't.
[52:49.680 --> 52:58.680]  I do know under these infractions they call it the penal code.
[52:58.680 --> 53:11.680]  I guarantee you none of these will be in the penal code. Are you telling me that in Wyoming not having a license is in the penal code? Not in the motor vehicle code?
[53:11.680 --> 53:17.680]  No, I think it may be infraction or I can't remember what term they use.
[53:17.680 --> 53:23.680]  Okay, I'm not asking about what term. I'm asking you where it is to be found.
[53:23.680 --> 53:35.680]  Is driving quote-unquote without a license an offense found in the penal code or is it an offense found in the motor vehicle code?

[01:05:54.680 --> 01:06:01.680]  Moved to strike, denied, we moved on, found the guilty.
[01:06:01.680 --> 01:06:12.680]  $50 fine, $90 for no insurance, $267 for this and $26 for that. All adds up.
[01:06:12.680 --> 01:06:18.680]  Well, let me ask you a question. Why didn't you ask the officer these two questions?
[01:06:18.680 --> 01:06:29.680]  First off, do you as an officer of the state of Florida have any authority to enforce the transportation laws of the state of Texas?

[01:08:09.680 --> 01:08:15.680]  I don't want to spend a lot of time on this because I've got some questions I don't want to take up all your time.

[01:08:17.680 --> 01:08:22.680]  The second case was obstructing traffic.
[01:08:22.680 --> 01:08:28.680]  And this one was by citation.
[01:08:28.680 --> 01:08:31.680]  It was a detective that stopped me.
[01:08:31.680 --> 01:08:36.680]  It was an officer that arrived later that wrote the ticket.

[01:08:37.680 --> 01:08:40.680]  That's a rest without warrant.
[01:08:40.680 --> 01:08:42.680]  It's not allowed in Florida.
[01:08:42.680 --> 01:08:45.680]  I'm sure it's not in Texas either.

[01:13:13.680 --> 01:13:23.680]  They allowed me to judge tempered with a witness or one of them tells them that he could not state certain issues about like a locomotion.
[01:13:23.680 --> 01:13:34.680]  The judge even told the jury not to listen to my testimony or my arguments about personal liberty and right of locomotion.
[01:13:34.680 --> 01:13:43.680]  No issues, but this is a long story.
[01:13:43.680 --> 01:14:00.680]  I've only got like 10 minutes left on the phone, but I got several issues and we'll be trying to work with Randy to expose some of these issues.
[01:14:00.680 --> 01:14:07.680]  And his main concern is getting me out underneath that fact that I had a valid Virginia license.
[01:14:07.680 --> 01:14:13.680]  But while I was in jail, I had a little chaos and I've been doing research.
[01:14:13.680 --> 01:14:18.680]  I keep on running into this personal liberty right of locomotion.
[01:14:18.680 --> 01:14:27.680]  And I'm trying to figure out am I going down the right path?
[01:14:27.680 --> 01:14:36.680]  Well, what you're arguing against is they're trying to say that you have a, this is a strict liability statute.
[01:14:36.680 --> 01:14:44.680]  Your rights have nothing to do with right or wrong if the statute says they can do A, B, or C.
[01:14:44.680 --> 01:14:55.680]  They're not even looking at the fact that the statute itself cannot be interpreted in a manner that violates a right.
[01:14:55.680 --> 01:15:01.680]  This is what they used to refer to in law as a demure issue.
[01:15:01.680 --> 01:15:09.680]  In a demure issue, even though the facts are themselves true and correct in relation to the allegation,
[01:15:09.680 --> 01:15:20.680]  they are irrelevant because the statute itself cannot be applied to the processed person or subject that it's being applied to.
[01:15:20.680 --> 01:15:25.680]  So it's completely irrelevant that all the facts are true.
[01:15:25.680 --> 01:15:26.680]  Okay?
[01:15:26.680 --> 01:15:37.680]  So what you may want to be do is argue that subject but argue it in the form of a demure if Tennessee still allows demures.

[01:16:56.680 --> 01:17:09.680]  Yeah. If they did that, if the only reason he stopped you was to check the license, then yeah, he's in direct violation of that statute.
[01:17:09.680 --> 01:17:21.680]  He stopped me saying that he knew that I had a suspended license from Tennessee, but I never got a license from Tennessee.
[01:17:21.680 --> 01:17:28.680]  Yeah, and that's the part these idiots tend to not forget.
[01:17:28.680 --> 01:17:35.680]  They cannot fabricate a license out of thin air and then suspend it in order to punish someone under it.
[01:17:35.680 --> 01:17:38.680]  That's tampering with a government record.
[01:17:38.680 --> 01:17:46.680]  That's falsifying a government record.
[01:17:46.680 --> 01:18:03.680]  So the other thing I hope you've gotten if you haven't and that you need to if you don't, you need to get a copy of the driving record that says they suspended a Tennessee license in your name even though they can't produce an application from you forever getting one.
[01:18:03.680 --> 01:18:15.680]  In fact, I would do a public information request asking for a copy of the application for a license in your name so that they have to respond saying, we don't have any such record.
[01:18:15.680 --> 01:18:22.680]  No kidding. Then how did you suspend it when it doesn't exist?
[01:18:22.680 --> 01:18:28.680]  Yeah, I'd say that's a huge appellate issue.
[01:18:28.680 --> 01:18:45.680]  Would you be able to explain to me public offense because I've been trying to, it says that they had a requirement that a warranted arrest statute, and one of them is public defense or breach of the preach, which is in one sentence. All the other ones are felicitants.
[01:18:45.680 --> 01:18:52.680]  And I can't seem to find out what a public offense is.
[01:18:52.680 --> 01:19:03.680]  Well, a breach of the piece is a public offense, okay, or where you're a threat to the public, which is something else, but it's still a breach of the piece.
[01:19:03.680 --> 01:19:18.680]  A breach of the piece is any action that is either intended to elicit violence from someone else or to instigate it among one or more persons.
[01:19:18.680 --> 01:19:24.680]  Okay, so a public offense is not me traveling in my car.

[01:28:52.680 --> 01:29:04.680]  If the state constitution says they have to have A, B, or C, then D will not do the job, and the legislature cannot create a statute that lets D do the job.
