[03:48.680 --> 03:56.880]  Christi, and it's in the process of coming on shore now, so while we're up at the moment,
[03:56.880 --> 04:03.920]  we can't guarantee that we'll stay up all night, but we will do our best and hope that
[04:03.920 --> 04:07.200]  it doesn't take power out.
[04:07.200 --> 04:16.200]  Okay, I am in Tennessee at the moment, so I'm not being affected by this hurricane.
[04:16.200 --> 04:23.720]  I have been in Clarksville, Tennessee, where Olivier, who calls into the show all the time,
[04:23.720 --> 04:31.400]  had a court hearing today, and I sat in and watched the hearing.
[04:31.400 --> 04:35.960]  It was interesting, but it took me all day and I've been up since four o'clock, so if
[04:35.960 --> 04:41.200]  it gets around 10 o'clock and I sound like I'm falling asleep, don't pay any attention

[04:45.600 --> 04:58.600]  I got to look at the courts in Tennessee and I will be working on them to get this electronic

[07:00.220 --> 07:05.320]  else was intended to enforce transportation code and it seems like I'm finding this consistent

[07:08.400 --> 07:20.240]  It certainly, so far, Tennessee, Illinois and Texas, my producer is from Georgia and
[07:20.240 --> 07:27.960]  in looking at Georgia law, every, all the police are, have been authorized to enforce

[07:30.680 --> 07:36.080]  Because they want to enforce these codes, that's probably what every state needs to
[07:36.080 --> 07:42.080]  do, but they haven't done it.
[07:42.080 --> 07:48.400]  So we have all of these officers enforcing the code, they have no power to enforce.

[10:05.560 --> 10:12.000]  it's going to bounce and go retract and ride back out and maybe even get back into the
[10:12.000 --> 10:19.920]  gulf waters and reformulate and then spin around and hit Houston.
[10:19.920 --> 10:26.360]  So this thing could be a problem for Houston, this is an unusual hurricane.
[10:26.360 --> 10:36.480]  Generally, when a hurricane comes on shore, it's trapped across the gulf and then makes
[10:36.480 --> 10:43.160]  a turn with the prevailing winds and generally charges up inland, but apparently this one's
[10:43.160 --> 10:46.520]  going to linger on the coast, that could be a real problem.
[10:46.520 --> 10:52.040]  If part of it's on the coast and part of it's out in the gulf, the part in the gulf will
[10:52.040 --> 10:59.240]  keep picking up energy and moisture and bringing it around and dropping it over to Houston.

[11:01.240 --> 11:08.120]  Okay, what I was concerned about was Austin and losing power from the storm and losing

[12:04.960 --> 12:09.280]  have seen in this case, usually they're really rude, obnoxious.
[12:09.280 --> 12:17.000]  This guy was nice as he was helping me to enter evidence in my case and helping me in
[12:17.000 --> 12:18.000]  all kinds of ways.
[12:18.000 --> 12:21.800]  I'm sure everybody probably thought by the time it was over with me and this guy were
[12:21.800 --> 12:28.520]  like buddies from way back somewhere because it was a little strange even for me so I wound
[12:28.520 --> 12:36.920]  up, I took his deal because I didn't trust this judge at all and he was even encouraging
[12:36.920 --> 12:44.880]  me to go ahead, put this thing to rest and then you can swing back around on your civil
[12:44.880 --> 12:51.040]  suits and go after him that way because you are not going to get any justice in this courtroom.

[20:16.160 --> 20:23.040]  judges the elected judges there are disclosures they're required to file with the state so
[20:23.040 --> 20:29.280]  the first place to go would be to request their financial disclosure from the state

[23:36.920 --> 23:44.520]  are a lot of things in the disclosure forms that the judge just gives over doesn't respond
[23:44.520 --> 23:55.080]  to all right so we get the what he's filed and then we specifically ask for all of those
[23:55.080 --> 24:02.520]  things the judge didn't respond to because i have to assume there's just had a reason
[24:02.520 --> 24:11.280]  for not responding so we get to go try to find out what that reason is now could you
[24:11.280 --> 24:16.080]  put in would you have to do like a motion to compel with a higher court to make them
[24:16.080 --> 24:23.240]  answer i mean because no depends if they don't answer then yes if you ask for it under open
[24:23.240 --> 24:33.960]  records okay let me back up and get where we're at here if you ask for the forms they
[24:33.960 --> 24:40.760]  filed in open records you'll almost certainly get that but then when you do the motion
[24:40.760 --> 24:49.080]  to for disclosure then you would if they refuse then you would appeal to the next higher court
[24:49.080 --> 24:58.360]  for a mandamus ordering them to oh that would be so much fun and it doesn't matter if there's
[24:58.360 --> 25:06.000]  anything bad in there or not it's going to poison the judge as well no matter what just
[25:06.000 --> 25:16.520]  asking this question makes it look like you believe the judge is corrupt and they really
[25:16.520 --> 25:26.760]  hate that because they fully understand that perception is everything so if you got somebody
[25:26.760 --> 25:34.040]  demanding that the judge fill in the empty spaces in the disclosure form that he was
[25:34.040 --> 25:39.840]  supposed to have filled in when he filed it now you're pointing out the fact that the
[25:39.840 --> 25:47.320]  judge did not follow the rules himself and there's nobody else to bring the judge to
[25:47.320 --> 25:55.520]  task but you and I so the judges aren't used to being brought to task for their failures
[25:55.520 --> 26:01.880]  the legislature said you're supposed to give these disclosures and the judge said heck
[26:01.880 --> 26:16.360]  with it we're not going to bother who's going to make us scott's gonna make us so no matter
[26:16.360 --> 26:23.920]  how it shakes out the judge looks bad and that's the whole point the one thing they
[26:23.920 --> 26:31.600]  can't tolerate is sunshine shining on their misdeeds well especially when they're asking
[26:31.600 --> 26:39.320]  out of bounds and you know they are and they know that they are because of all the shenanigans
[26:39.320 --> 26:44.200]  they have to pull in order to find you guilty no matter how much empirical evidence you

[53:05.400 --> 53:12.680]  questions without aid of counsel i said that for about 15 minutes she finally got her panties in
[53:12.680 --> 53:18.280]  a bunch running out of the office there screaming and hollering that i was refusing to be booked

[01:25:38.360 --> 01:25:48.360]  And it wasn't just the DPS officer or a couple of deputies. No, no, we had three border patrol agents, and we had two deputies.
[01:25:48.360 --> 01:25:53.360]  Everybody's got automatics out. Everybody's got safeties off.
[01:25:53.360 --> 01:26:13.360]  They used the standard IDF Israeli Defense Force procedures that they're being taught that were developed for use in the occupied territories that no matter what, you always pull a weapon first.
[01:26:13.360 --> 01:26:22.360]  And if you think you might be in danger, then shoot first before you say anything or before you ask any questions.
[01:26:22.360 --> 01:26:28.360]  I've trained with the Israelis. I've been in the Middle East. I spent 10 years my life in the Middle East.
[01:26:28.360 --> 01:26:35.360]  I understand how these people think and why they think this way and why they do what they do.

[01:26:37.360 --> 01:26:52.360]  And when I got stopped and I dismounted from my automobile, I have a cane I use. You've seen it.

[01:26:57.360 --> 01:27:08.360]  The border patrol agents all knew that I used it, but it didn't make any difference. I almost got shot because I had a cane in my hand.

[01:27:13.360 --> 01:27:24.360]  One thing you never do is argue with a man with a gun on the side of the road the fastest way of meeting your maker, because these idiots are just that at that point.
[01:27:24.360 --> 01:27:33.360]  They lose good common sense. They don't realize that what they have done is a felony right up front.
[01:27:33.360 --> 01:27:39.360]  Aggravated assault under the first degree felony.
[01:27:39.360 --> 01:27:43.360]  25th of July, first time out.
[01:27:43.360 --> 01:28:02.360]  Now, if you look at the federal prosecutorial guidelines for doing that particular crime against a handicapped individual, you're going to see that there is no absolute no possibility for parole.

[01:28:06.360 --> 01:28:12.360]  And I looked at these people and I tried telling them that what you're doing is stupid.
[01:28:12.360 --> 01:28:30.360]  But it didn't make any difference. Anyway, I got stood up and handcuffed first and a little difficult for me to stand up on my own while laying face down with both of my hands handcuffed behind my back.
[01:28:30.360 --> 01:28:34.360]  So they picked me up stood me up.
[01:28:34.360 --> 01:28:42.360]  I was frisked. My wallet was taken. And I was told that they needed that.
[01:28:42.360 --> 01:28:49.360]  The officer needed that he'd get back to me at some point, pulled my keys out of my pocket.
[01:28:49.360 --> 01:28:52.360]  Told me I was not getting those back.
[01:28:52.360 --> 01:29:00.360]  And then he proceeded to pull the rest of stuff out of my pocket. Now, one of the things that I carry is a call calling.

[01:35:45.360 --> 01:35:48.360]  most of it has no sound.
[01:35:48.360 --> 01:35:57.360]  You have a recurring wind noise that goes over and over and over and over again repetitive.
[01:35:57.360 --> 01:36:01.360]  Do you master those tapes?
[01:36:01.360 --> 01:36:12.360]  I sat down on a Mac and did a oscilloscope, basically, of the sound,
[01:36:12.360 --> 01:36:16.360]  and overlaid it and overlaid it and overlaid it.
[01:36:16.360 --> 01:36:21.360]  And I had a sound engineer look at stuff.
[01:36:21.360 --> 01:36:26.360]  He couldn't find any background stuff other than the wind.
[01:36:26.360 --> 01:36:32.360]  What you can do, like with Audacity 2, you can go in and do a noise pattern.
[01:36:32.360 --> 01:36:39.360]  Take a section where there's no voice and then you do a noise print of the noise
[01:36:39.360 --> 01:36:45.360]  and then have it remove everything that looks like that and then see what's left.
[01:36:45.360 --> 01:36:49.360]  There's nothing left, there's nothing on it.
[01:36:49.360 --> 01:37:01.360]  Well, what I was trying to do is show how long that wind noise was repeating itself exactly.
[01:37:01.360 --> 01:37:03.360]  It cannot do it exactly.
[01:37:03.360 --> 01:37:14.360]  There's no way possible on this planet that your wind will be exact from one second to the next in repetition
[01:37:14.360 --> 01:37:20.360]  on any recording unless it's been dubbed.
[01:37:20.360 --> 01:37:30.360]  Now, I say this and I'll get to the reason why and how I got the recordings and stuff in a second.
[01:37:30.360 --> 01:37:32.360]  I got transported.
[01:37:32.360 --> 01:37:35.360]  My van was towed.
[01:37:35.360 --> 01:37:39.360]  They never asked me if they could tow the van.
[01:37:39.360 --> 01:37:45.360]  They have to ask for permission to remove your automobile.
[01:37:45.360 --> 01:37:52.360]  They cannot just take it as well as there's several other things.
[01:37:52.360 --> 01:37:59.360]  And I know this sounds strange, but there is statute to that.
[01:37:59.360 --> 01:38:05.360]  My master's is in system management with a specialization in international logistics.
[01:38:05.360 --> 01:38:11.360]  You were talking about where certain statutes are the same in all the states.
[01:38:11.360 --> 01:38:23.360]  1966, all the states adopted the ICC Interstate Commerce Commission's Commercial Motor Carrier Act
[01:38:23.360 --> 01:38:27.360]  and then acted in the state legislation.
[01:38:27.360 --> 01:38:38.360]  This was commented on in England by the head chancellor for the British Chancellor's Court

[01:39:17.360 --> 01:39:23.360]  Like I told the magistrate, I'm not going to say anything unless I have aid of counsel.
[01:39:23.360 --> 01:39:26.360]  And she said, well, you have to do this.
[01:39:26.360 --> 01:39:32.360]  I don't have to do anything, but she refused to hold an examining trial
[01:39:32.360 --> 01:39:40.360]  or what should have been held should have been an examining trial on a warrantless arrest
[01:39:40.360 --> 01:39:47.360]  and was not done, but she did set basically bond, not bail, but bond.
[01:39:47.360 --> 01:39:52.360]  I had to post a personal record since bond.
[01:39:52.360 --> 01:39:55.360]  Okay, take a step back.
[01:39:55.360 --> 01:40:04.360]  When you first stood before the magistrate, did the magistrate have a folder in her hand
[01:40:04.360 --> 01:40:07.360]  with information about you in it?
[01:40:07.360 --> 01:40:10.360]  Already, yes.
[01:40:10.360 --> 01:40:13.360]  How did she get that?
[01:40:13.360 --> 01:40:16.360]  Ex parte communications.

[01:40:48.360 --> 01:40:55.360]  Yeah, well, she didn't and she doesn't yet, but she's going to.
[01:40:55.360 --> 01:40:59.360]  She's been in office too long.

[01:41:04.360 --> 01:41:09.360]  There's a whole series of parties involved with this.
[01:41:09.360 --> 01:41:18.360]  There's a whole series of points that have to be addressed that they have tried to short circuit by dismissing with prejudice.
[01:41:18.360 --> 01:41:23.360]  And as I explained to the court clerk, this isn't going away.
[01:41:23.360 --> 01:41:31.360]  Dismissing with prejudice, that's really in a criminal case. I've never heard of such a thing.
[01:41:31.360 --> 01:41:33.360]  It's simply dismissed.
[01:41:33.360 --> 01:41:39.360]  A dismissive prejudice is only in a criminal case.
[01:41:39.360 --> 01:41:45.360]  I mean, I mean, in a civil case and that tells the petitioner they can't refile.
[01:41:45.360 --> 01:41:52.360]  In a dismissal in a criminal case, the prosecution can only refile if there's new evidence.
[01:41:52.360 --> 01:41:59.360]  So there's no point in, it surprises me.
[01:41:59.360 --> 01:42:04.360]  Why on earth would they dismiss with prejudice?
[01:42:04.360 --> 01:42:10.360]  Let me put it this way. They want me to go away real bad.
[01:42:10.360 --> 01:42:14.360]  I have four inches of paper filed in that court.
[01:42:14.360 --> 01:42:19.360]  There's four one inch thick files.
[01:42:19.360 --> 01:42:21.360]  There's a lot of paper.
[01:42:21.360 --> 01:42:29.360]  There's been four five sheets of paper filed by the DA.
[01:42:29.360 --> 01:42:34.360]  The two statements filed by the DPS officer are not annotated.
[01:42:34.360 --> 01:42:39.360]  What was the primary and which one was the modified?
[01:42:39.360 --> 01:42:48.360]  Has it did the prosecutor answer any of your, respond to any of your motions of pleadings?
[01:42:48.360 --> 01:42:51.360]  Not one.
[01:42:51.360 --> 01:42:58.360]  I have zero orders in the file signed by anybody.
[01:42:58.360 --> 01:43:08.360]  They have not, we never, there's been three hearings, four hearings, excuse me, four hearings.
[01:43:08.360 --> 01:43:17.360]  One of them is where one, an attorney I hired decided to do a song and dance and back out of the picture real fast.
[01:43:17.360 --> 01:43:21.360]  And the judge allowed him to do it over my objections.
[01:43:21.360 --> 01:43:27.360]  And I told the judge, you don't have the authority or the jurisdiction to release that man from that contract.
[01:43:27.360 --> 01:43:31.360]  He said on the record, I'm not releasing him from this contract.
[01:43:31.360 --> 01:43:36.360]  I'm releasing him from showing up in court.
[01:43:36.360 --> 01:43:38.360]  Well, hey.
[01:43:38.360 --> 01:43:40.360]  And that was the end of the hearing.
[01:43:40.360 --> 01:43:45.360]  Okay, now you get to sue the judge personally.
[01:43:45.360 --> 01:43:47.360]  Oh, yeah.
[01:43:47.360 --> 01:43:49.360]  It doesn't matter what she said.
[01:43:49.360 --> 01:43:51.360]  It only matters what she did.
[01:43:51.360 --> 01:43:54.360]  And she interfered with a private contract.

[01:48:26.360 --> 01:48:32.360]  either the DA's lying or the Sheriff's lying. So why don't you take both of them to court and tell them to fess up?

[01:48:35.360 --> 01:48:40.360]  Okay, let me interject something here about grand juries.
[01:48:40.360 --> 01:48:50.360]  In my research on a grand jury, the legislature authorized a district judge to impanel a grand jury.
[01:48:50.360 --> 01:48:57.360]  That district judge has a statutory venue restriction.
[01:48:57.360 --> 01:49:01.360]  He's restricted in the area. He is a state judge.
[01:49:01.360 --> 01:49:10.360]  They used to ride circuit, but they got so many of them, they don't have to ride circuit anymore. So each judge has a statutory venue.
[01:49:10.360 --> 01:49:24.360]  And the judge institutes or impanels a state grand jury and a state grand jury is impaneled in each county of the state.
[01:49:24.360 --> 01:49:34.360]  But I can find nothing that limits the jurisdiction of a grand jury to a particular county.
[01:49:34.360 --> 01:49:36.360]  Nothing.
[01:49:36.360 --> 01:49:42.360]  Now, okay, I have Attorney General Opinion H500.

[01:50:01.360 --> 01:50:11.360]  A magistrate may hear any complaint, state or federal, misdemeanor or felony, anywhere in the state.
[01:50:11.360 --> 01:50:22.360]  A grand jury performs essentially the same function as a magistrate in making a determination of probable cause.
[01:50:22.360 --> 01:50:29.360]  So it's reasonable to apply H500 to a grand jury as well.
[01:50:29.360 --> 01:50:34.360]  So what that means is you can file with any grand jury in the state of Texas.

[01:51:48.360 --> 01:52:02.360]  But when they submit it up and it goes into the NICS, that's the national database for those that don't know, it's going to cause a problem down the road for anybody that's with me.
[01:52:02.360 --> 01:52:16.360]  And if I get stopped again, which I'm going to try and preclude, but that's a whole other story and will be a bridge we have to cross as we cross it.

[01:52:59.360 --> 01:53:08.360]  And when I'm sitting there looking at a Thompson, I can tell you what a Thompson looks like up close, especially if I'm within about six feet of it.

[01:55:09.360 --> 01:55:28.360]  What I want is to be reimbursed for the problems, the stress, the injury to my liberty, injury to my family, the key that we're stolen to my property.

[01:55:34.360 --> 01:55:43.360]  You're talking about either intentional infliction of emotional stress because there was no actual physical injury.

[01:55:47.360 --> 01:55:57.360]  And when you go for emotional distress in Texas, you can't claim negligence.
[01:55:57.360 --> 01:56:00.360]  You have to claim intentional.
[01:56:00.360 --> 01:56:10.360]  The problem with that is, if you claim intentional, then the officer's errors in emissions policy does not apply.
[01:56:10.360 --> 01:56:15.360]  But the only way you can get to that is by claiming intentional.
[01:56:15.360 --> 01:56:21.360]  But if you do claim intentional, then you sue the officer himself.
[01:56:21.360 --> 01:56:32.360]  And the jurisdiction is in a position to where they're going to have to come in and indemnify the officers or they can't get officers to do what they tell them to.
