[05:14.640 --> 05:25.640]  She was the one that was the impetus for me putting together a motion for financial disclosure by judges.
[05:25.640 --> 05:32.640]  And based on the last show that she did, I went on the internet.
[05:32.640 --> 05:42.640]  First thing I did was looked at all the different states to find the state that articulated the most stringent requirements.
[05:42.640 --> 05:45.640]  And that turned out to be California.
[05:45.640 --> 05:59.640]  So I took the requirements for California, all of these things the judge couldn't do, and I asked for discovery of those particular things.
[05:59.640 --> 06:11.640]  Then I went on the internet and looked for the ways that the judges have been prosecuted for laundering their payoff money.
[06:11.640 --> 06:20.640]  And the primary one was with the mortgages that Janet talked about.
[06:20.640 --> 06:31.640]  And then I started digging deeper and found a number of other ways that judges have been prosecuted for laundering money.
[06:31.640 --> 06:47.640]  As a matter of fact, just before the show, Janet mentioned a judge in Ohio who was just stung for putting people in jails in private prisons that his wife was heavily invested in.
[06:47.640 --> 06:54.640]  So that's another one we will add to the list.
[06:54.640 --> 07:03.640]  I've been sending these out and we're having people filing them, and I had one guy respond so far out of New York.
[07:03.640 --> 07:08.640]  And he said when the judge looked at it, he jumped up and ran out of the room.
[07:08.640 --> 07:11.640]  Wonderful.
[07:11.640 --> 07:21.640]  If the judge doesn't have anything to worry about, then this won't bother him.
[07:21.640 --> 07:25.640]  But if he does have something to worry about, actually, that's not true.
[07:25.640 --> 07:28.640]  It will bother him anyway.
[07:28.640 --> 07:32.640]  We've talked about this before.
[07:32.640 --> 07:35.640]  Everything is political.
[07:35.640 --> 07:48.640]  And when we file this demand for financial disclosure on the part of the judge, we don't just ask for financial disclosure on part of the judge.
[07:48.640 --> 08:00.640]  We ask for financial disclosure on the part of the judge and everyone related to him within three degrees of co-sanguinity.
[08:00.640 --> 08:07.640]  Wife, wife, immediate family, brothers, sisters, first cousins.
[08:07.640 --> 08:17.640]  That's going to make him real unhappy if he has to go to his first cousins and ask for a financial statement.
[08:17.640 --> 08:27.640]  But we don't care if the judge is happy or not because we fully expect the judge to rule against us out of hand at a return anyway, so we have nothing to lose here.
[08:27.640 --> 08:41.640]  However, if we demonstrate to the judge that we are paying very close attention, then the judge is going to be much more careful.
[08:41.640 --> 08:57.640]  Even if the judge is squeaky clean, he is not going to be happy because what he's concerned about is that we will taint him by perception.
[08:57.640 --> 09:03.640]  One of Ken's four rules, perception is everything.
[09:03.640 --> 09:31.640]  So if we are asking the judge to disclose his financial dealings and asking him to disclose any behaviors that point directly at money laundering activities, it will tend to paint him with that brush whether he is guilty or not.
[09:31.640 --> 09:36.640]  In effect, it will poison his well.
[09:36.640 --> 09:42.640]  And there is nothing he can do about it but object.
[09:42.640 --> 09:45.640]  And the more he objects, the more guilty he looks.

[09:56.640 --> 10:25.640]  And I am very, very excited about this pleading that you have constructed because I think it's when it goes viral, which I'm sure it will, I think that we are now in a position of really taking the bull by the horns and addressing the core of the issue of judicial corruption, which is that judges are being paid to throw cases.

[10:29.640 --> 10:32.640]  I'm sending it out to everybody who asked for it.
[10:32.640 --> 10:37.640]  I tried to, I wrote it specifically for a client that I was helping.
[10:37.640 --> 10:46.640]  And then I went back and tried to rewrite it so it's generic and it's not state specific.
[10:46.640 --> 10:50.640]  So it'll apply to state or federal or to anyone.
[10:50.640 --> 10:59.640]  If I send it to someone, all they have to do is change the court heading and sign it at the bottom and send it.
[10:59.640 --> 11:08.640]  And then we, I'm hoping to get a lot of feedback because I want to see how the judges object to it.
[11:08.640 --> 11:16.640]  And then we'll craft responses based on how the judge responds to the pleading.
[11:16.640 --> 11:24.640]  If he just ignores it, then we petition for rid of mandamus asking a higher court to order him to reveal it.
[11:24.640 --> 11:34.640]  And then we send press releases to every news outlet in his area.
[11:34.640 --> 11:42.640]  If you haven't listened to the show a long time, you won't understand how we go about what we do.
[11:42.640 --> 11:47.640]  You understand that you'll never win your case simply because you have the law and the facts on your side.
[11:47.640 --> 11:50.640]  You win your case, you have the politics on your side.
[11:50.640 --> 11:57.640]  So everything we do is about the politics and how do we take the politics and turn it against them.
[11:57.640 --> 12:04.640]  And your show last time gave me an incredible tool for that purpose.

[12:11.640 --> 12:19.640]  Oh, well, I've actually had several out since we last spoke on the air.
[12:19.640 --> 12:36.640]  One that I am very sort of excited about has to do with the United States' engagement with the United Nations 1540 Committee,
[12:36.640 --> 12:41.640]  the Security Council Weapons of Mass Destruction Committee.
[12:41.640 --> 12:56.640]  And it isn't very difficult to determine that the U.S. is lying to the 1540 Committee in the U.S.'s National Report Committee.
[12:56.640 --> 13:08.640]  All you have to do to determine this is to look at the laws that the U.S. has passed domestically about weapons and mass destruction,
[13:08.640 --> 13:16.640]  specifically chemical and biological weapons, and then look at what they've reported to the U.S.
[13:16.640 --> 13:27.640]  And one of the very interesting things here is that the U.S. doesn't really seem to want to let the U.N. know what the domestic legislation says,
[13:27.640 --> 13:36.640]  because in both the cases of the biological weapons domestic legislation,
[13:36.640 --> 13:46.640]  which was codified under Section 817 of the USA Patriot Act, and the domestic chemical weapons legislation,
[13:46.640 --> 13:51.640]  which is, I believe, Title 18, Section 229 of the U.S. Code.
[13:51.640 --> 14:03.640]  In both cases, the U.S. is giving itself and its agents a free pass to violate the law.
[14:03.640 --> 14:12.640]  Basically, what the laws are saying is that, well, these are our laws and people are not allowed to violate these except for these people.
[14:12.640 --> 14:26.640]  And when you look at the biological weapons legislation, the caveat is that this section shall not apply to any duly authorized United States governmental activity,
[14:26.640 --> 14:37.640]  which is actually shocking because the U.S. is saying, okay, we can store biological weapons, we can use biological weapons,
[14:37.640 --> 14:42.640]  we can do all these things with biological weapons.
[14:42.640 --> 14:54.640]  Now, the U.S. has gone to great lengths not to let the biological weapons convention in Geneva know about the domestic legislation.
[14:54.640 --> 15:08.640]  In fact, the U.S. has gone so far as to put on the record a law which is an old law which was amended by Section 817 of the USA Patriot Act.
[15:08.640 --> 15:16.640]  So, and there's a similar sort of problem with the chemical weapons law.
[15:16.640 --> 15:23.640]  The article I wrote is called lies, damnable lies, and downright dangerous lies.
[15:23.640 --> 15:44.640]  So, I encourage people to read this because when this level of deception gets mounted on the international stage surrounding an issue that is as life threatening as biological and chemical weapons,
[15:44.640 --> 15:54.640]  then you've got to know that there's something going on behind the scenes that is impaling these lies to be put on the record.
[15:54.640 --> 16:03.640]  So, that was sort of the big deal article that I had published recently. I did have a couple others as well.
[16:03.640 --> 16:18.640]  But this is the one that I'm, you know, kind of... Can you give us an idea of the nature of the laws that you're talking about?
[16:18.640 --> 16:23.640]  I can... The two laws having to do with biological and chemical weapons?

[19:53.640 --> 20:05.640]  Actually, the UN Security Council passed a resolution a number of years ago, I believe it was in 2004, known as the 1540 resolution.
[20:05.640 --> 20:25.640]  And this governs the necessity of countries to report on any weapons of mass destruction activity that they have, any assistance that they're giving to other countries,
[20:25.640 --> 20:36.640]  or even non-country organizations surrounding, you know, like terrorist organizations surrounding these weapons.
[20:36.640 --> 20:47.640]  So the U.S. is bound through its signing the 1540 resolution to honestly and thoroughly report on its behavior.
[20:47.640 --> 20:56.640]  And I spent quite some time slogging through all of the national reports that the U.S. has filed with the 1540 committee.
[20:56.640 --> 21:00.640]  And I, you know, went through them very carefully.
[21:00.640 --> 21:13.640]  And the U.S. has consistently misrepresented both her domestic biological weapons laws and her domestic chemical weapons laws.
[21:13.640 --> 21:19.640]  You know, goodness knows what else she's doing that we don't know about.
[21:19.640 --> 21:33.640]  But if the attempt is so strong to lie to the world community about what our laws say, and really, I mean, nobody can fact check.
[21:33.640 --> 21:34.640]  Nobody can look up the laws.
[21:34.640 --> 21:35.640]  Not that hard.
[21:35.640 --> 21:37.640]  I'm going to read them to you in a minute.
[21:37.640 --> 21:47.640]  Then, you know, then we have a major problem, I do want to say that in the process of writing and researching this article,
[21:47.640 --> 21:56.640]  I made contact with the chairman of the U.N. Security Council 1540 committee.
[21:56.640 --> 22:09.640]  He is the ambassador from Bolivia and I sent him the article asking for his comment and they're, you know, they will not comment.
[22:09.640 --> 22:18.640]  I had originally called and spoken with his aide and, you know, very, very nice, very responsive, you know, we want to see the article.
[22:18.640 --> 22:24.640]  And as soon as I sent the article in, the iron door fell down and they wouldn't talk to me anymore.
[22:24.640 --> 22:33.640]  And I had the same reaction, essentially, from the U.S. National Contact for the 1540 committee.
[22:33.640 --> 22:46.640]  His name is Craig Cinkelstein and he is also the media and transparency contact for the 1540 committee.
[22:46.640 --> 22:57.640]  And so I sent him an email with my concerns, you know, this is what the law says and I don't see where you're even, you know, you're not even being honest about what your laws say.
[22:57.640 --> 22:59.640]  So would you please comment on this?
[22:59.640 --> 23:00.640]  I didn't hear back from him.
[23:00.640 --> 23:02.640]  So I found his phone number and called him in his office.
[23:02.640 --> 23:06.640]  He answered the phone, wanted to know who was calling.
[23:06.640 --> 23:09.640]  I said, Janet Palin and he hung up on me.
[23:09.640 --> 23:12.640]  So much for media and transparency, huh?
[23:12.640 --> 23:18.640]  So, Craig Cinkelstein, remember that name.

[23:50.640 --> 23:57.640]  Now, interestingly enough, there's another person I like whose behavior I'd like to discuss who works for the State Department.
[23:57.640 --> 23:59.640]  And his name is Christopher Park.
[23:59.640 --> 24:13.640]  And Christopher Park is among the delegates that are assigned to represent the United States and the State Department with their meetings at the Biological Weapons Convention in Geneva the first one.
[24:13.640 --> 24:20.640]  And I have attended two of those conventions and have had contact with Chris Park.
[24:20.640 --> 24:42.640]  And it was Chris Park who initially sauntered up to me after I had discovered during the course of the convention that the U.S. had failed to report to the Biological Weapons Convention the change in the legislation which took place in
[24:42.640 --> 24:52.640]  2002 when the USA Patriot Act was passed and Section 817, you know, became law.
[24:52.640 --> 24:57.640]  Section 817 is the expansion of the Biological Weapons Statute.
[24:57.640 --> 25:13.640]  So Chris Park, I was actually at the convention for about 10 days and during the course of events there discovered that the U.S. had failed to report the change in legislation and had actually gone on the record lying to the United Nations about what our
[25:13.640 --> 25:34.640]  domestic biological weapons legislation said. So Chris sauntering up to me and said, it was an oversight. We just forgot. And this was like maybe like 10 years later, you know, after they were supposed to have let the convention know, so they forgot for 10 years.
[25:34.640 --> 25:47.640]  So it was Chris Park that I first contacted when I started to look at the 1540 filings of the United States, which is, you know, a separate organization.
[25:47.640 --> 26:04.640]  The 1540 committee is a separate organization from either the Chemical Weapons Convention or the Biological Weapons Convention. And the 1540 resolution governs all weapons of mass destruction, chemical, biological, radiological, and nuclear.
[26:04.640 --> 26:17.640]  So I contacted Chris initially and I, you know, kind of nice. Well, I don't know how nice I was. I said, hey, did you also lie at the 1540? I didn't sort of like that. I was a little more diplomatic.
[26:17.640 --> 26:29.640]  But basically I said, you guys also lie at the 1540 committee? And I got an email back and he says, oh, well, you know, we're going to check this out and get right back to you. Didn't ever get back to me.
[26:29.640 --> 26:45.640]  And based on that, I decided it was really going to be worthwhile to log through those hundreds of pages that the U.S. had filed with the 1540 committee to see, you know, what nature of lies they were telling.
[26:45.640 --> 27:08.640]  Now, I do want to stress that what I have discovered and discussed in that article are only, you know, these are paper issues. These are lies about laws. And my unfortunate suspicion is that the lies go a lot deeper than that.
[27:08.640 --> 27:17.640]  I can read what the chemical weapons law says if you're interested because it's really very shocking.
[27:17.640 --> 27:18.640]  Yes.
[27:18.640 --> 27:42.640]  So 18 U.S. Code 229 prohibited activities. So, A, it says unlawful conduct, except as provided in subsection B, it shall be unlawful for any person knowingly, one, to develop, produce, otherwise acquire, transfer directly or indirectly receive, stockpile, retain, own,
[27:42.640 --> 27:59.640]  possess or use or threaten to use any chemical weapon or to, to assist or induce in any way any person to violate paragraph one or to attempt to conspire to violate paragraph one.
[27:59.640 --> 28:01.640]  That's pretty strong stuff, right?
[28:01.640 --> 28:25.640]  Well, now we get to B, which is exempted agencies and persons. And so it says, one, in general, subsection A does not apply to the retention ownership, possession, transfer or receive of a chemical weapon by a department, agency or other entity of the United States
[28:25.640 --> 28:32.640]  or by a person described in paragraph two pending destruction of the weapon.
[28:32.640 --> 28:46.640]  Now, you know, we're getting a little wiggle room here. According to the Chemical Weapons Convention, which is the International Treaty, the U.S. is mandated with destroying all of its chemical weapons.
[28:46.640 --> 29:01.640]  And what looks to me like this exemption here is saying, well, in the process of, you know, the destruction of the weapon, the, any agency or entity of the United States can retain and possess these weapons.
[29:01.640 --> 29:18.640]  Okay, but now it starts getting really worse because exempted persons, any person, including a member of the Armed Forces of the United States, who is authorized by law or by an appropriate officer of the United States to retain,
[29:18.640 --> 29:42.640]  non-possessed, transfer or receive the chemical weapon or, and now we get into the Twilight Zone B. In an emergency situation, any otherwise non-causal person, if the person is attempting to destroy or seize the weapon.

[36:58.480 --> 37:08.720]  Now this law also, you know, goes on about making certain illegal, I'll just, I'll read
[37:08.720 --> 37:15.720]  here, additional offense, whoever knowingly possesses any biological agent, toxin or
[37:15.720 --> 37:24.440]  delivery system of a type or in a quantity that under the circumstances is not reasonably
[37:24.440 --> 37:30.640]  justified by a prophylactic protective bona fide research or other peaceful purpose shall
[37:30.640 --> 37:38.040]  be fined under this title, imprisoned, not more than 10 years or both.
[37:38.040 --> 37:46.200]  Now, you go down a little further and you hit something really strange because at the
[37:46.200 --> 37:54.840]  very, towards the very end of the law, it says under, see here, whoever knowingly violates
[37:54.840 --> 37:59.600]  this section shall be fined as provided in this title, imprisoned not more than 10 years
[37:59.600 --> 38:08.320]  or both, but the prohibition contained in this section shall not apply with respect
[38:08.320 --> 38:15.680]  to any duly authorized United States governmental activity.
[38:15.680 --> 38:25.760]  And that's what Chris Park and the, his colleagues at the State Department were so desperate
[38:25.760 --> 38:32.280]  to have the United Nations Biological Weapons Convention not know about.
[38:32.280 --> 38:40.000]  Because what this law has done is, has given free reign to the United States government
[38:40.000 --> 38:45.640]  to violate its own biological weapons law.

[41:50.880 --> 41:55.920]  by what I had to say and the next thing I knew I was interviewed by a reporter from

[41:56.920 --> 42:03.200]  So the article was published in Russian and TASS is the largest news agency in Russia
[42:03.200 --> 42:10.400]  and I had my 15 minutes of fame as the U.S. expert who was denouncing the United States

[42:12.760 --> 42:21.040]  So, you know, there's all kinds of opportunities available and I think, Randy, I don't have
[42:21.040 --> 42:27.360]  a lot of trust at this point in time with our electives, representatives, most of them,

[52:15.320 --> 52:32.040]  Okay. I don't think that's a problem. You are technically asking for sanctions against counsel, and you're telling the court that you should have a re-hearing because you were denied effective counsel.
[52:32.040 --> 52:46.440]  I mean, that's a backwards, you know, backhanded way of saying you were denied effective counsel, but asking the court to throw your lawyer in jail is pretty clear that you felt like your lawyer was ineffective.
[52:46.440 --> 52:51.800]  I don't see that. I don't see that as a problem. They'll probably get a chuckle out of that.
[52:51.800 --> 53:02.360]  Okay. So they could still affirm my petition for re-hearing, and then if they wanted to, they could just deny the 10 days in jail.
[53:02.360 --> 53:21.400]  Yeah, they'll almost certainly deny the sanctions, but this lawyer is really going to be unhappy to have the appellate court judges read that her client wants her to spend 10 days in jail.

[54:04.440 --> 54:13.720]  The courts will basically ignore any motions, pleadings, anything else that you file in your case.
[54:13.720 --> 54:32.120]  If you have representation, the only thing that they will accept filing from you is either a petition for rid of habeas, or excuse me, my mic, a petition for rid of habeas, or an affidavit.
[54:32.120 --> 54:42.920]  And they will basically just ignore any other documents you try to file in the case as long as you have representation.
[54:42.920 --> 55:12.520]  That's my understanding of the situation. You've got to somehow kick your lawyer to the curb, fire the person in order for you to be able to start making moves against her for sanctions, et cetera, in order to make her an adversary, an adversarial litigant.
[55:12.520 --> 55:19.960]  That's an opposed to you, almost like a co-defendant in a case that you would be suing.
[55:19.960 --> 55:42.440]  And the other thing that I want Randy to respond to, because I think we've discussed this on the air before, is that it's my research, my understanding that the Supreme Court has ruled that once you have an attorney, a representation, and decisions are made regarding how the defense
[55:42.440 --> 56:08.440]  is handled, if you lose or whatever, that you can't go back on appeal and say, my attorney was incompetent or didn't do what I wanted them to do, and I couldn't control my attorney, I couldn't control the case, it was a bad attorney,
[56:08.440 --> 56:26.920]  I want to go back and retry or have a rehearing on appeal and stuff like this and try to blame it on a bad counsel that basically from my case law research, the courts will not accept that as a reason.
[56:26.920 --> 56:36.920]  If you trust your attorney, you hire him, that's it. That's my understanding. Randy, am I correct? Do you want to respond to these things I'm saying?
[56:36.920 --> 56:50.920]  I haven't seen any law to that effect. I've seen that the courts do that. I've seen case law on that, not statutes. But the case law needs to be challenged.
[56:50.920 --> 57:12.920]  Because clearly in Jeff's case, they pick the lawyer and control the lawyer and the lawyer failed to address clearly relevant issues. This needs to be challenged. The Constitution clearly guarantees you the right to counsel of choice and to represent yourself.
[57:12.920 --> 57:36.920]  If I choose to employ counsel, that doesn't take away my right to represent myself. Now, I haven't seen, I'm sure it's out there, I haven't seen any case law that says that the hiring of a lawyer or counsel weighs my right to self-representation.
[57:36.920 --> 57:46.920]  You might move the lawyer to second chair. Okay.
[57:46.920 --> 58:02.920]  But since you're in appeal, it's kind of late to move the lawyer to second chair. Well, Randy, I don't know exactly what that means. I mean, you either have an attorney representing you as your speakerphone, as your mouthpiece in the court, or you don't.
[58:02.920 --> 58:12.920]  I mean, if you, if you can move, you can move him to second chair. So you're now, you're now lead counsel and he's only there to advise you or she's only there.
[58:12.920 --> 58:17.920]  Okay. Well, then wouldn't that make you a pro se litigant then? Essentially, yes.
[58:17.920 --> 58:37.920]  Okay. Well, then you have to file documents to that effect and become a pro se litigant. And technically that attorney would be your advisor or counsel, if you want to say, but not representing you because I know the courts will not allow you to file any documents.
[58:37.920 --> 58:42.920]  If you have representation, unless it's a habeas or an affidavit, I've seen this.

[01:01:41.920 --> 01:01:49.920]  The University of Exeter released a new study by Professor Charles Tyler which catalogs how male freshwater fish in Britain are turning into females
[01:01:49.920 --> 01:01:57.920]  due to the chemicals released into the water from birth control pills, cosmetic makeup, cleaning agents, and plastics all being flushed down the drains.
[01:01:57.920 --> 01:02:04.920]  The study found that one-fifth of males, or 20% of the male fish population, were now showing feminine traits,
[01:02:04.920 --> 01:02:08.920]  including producing eggs, reduced sperm counts, and less aggressive behavior.
[01:02:08.920 --> 01:02:15.920]  Professor Tyler stated that, quote, we are showing that some of these chemicals can have much wider health effects in fish than we expected.
[01:02:15.920 --> 01:02:21.920]  Using specially-created transgenic fish that allows us to see response to these chemicals in the bodies of the fish in real time.
[01:02:21.920 --> 01:02:27.920]  For example, we have shown that estrogens found in some plastics affect the valves in the heart.

[01:05:50.920 --> 01:06:06.920]  For the vast majority of people that don't know any lawyers, and when they get in trouble, the first lawyer they call feeds them a line and they hire the lawyer. Or Jeff, I think in your case, was this court appointed counsel?

[01:06:08.920 --> 01:06:24.920]  Yeah, see, you had no say in who your lawyer was. So then when you get a lawyer that's throwing you under the bus, now the court wants to say your lawyer can throw you under the bus if she wants to. There's nothing you can do about it.
[01:06:24.920 --> 01:06:38.920]  And then I go back and read my constitution and it says I have that these officials are required to protect my right to represent myself and my right to counsel.
[01:06:38.920 --> 01:06:53.920]  And I can't be required to waive one right to exercise another. But the courts and the lawyers have ruled if you get one of us, you have to do what we say and you're subject to what we do.

[01:06:55.920 --> 01:07:01.920]  And at this point, I don't see that you have anything to lose.
