[01:40.720 --> 01:46.400] The statement most likely directed towards 20-year-old James Alex Fields, Jr., of Mommy, Ohio,
[01:46.400 --> 01:50.600] who was caught on multiple cell phone cameras plowing through a crowd of protesters with

[05:44.760 --> 05:46.560] And we're going to go over some of the things
[05:46.560 --> 05:50.480] these large municipalities are doing, how they're doing it,
[05:50.480 --> 05:54.360] and what we're going to be doing about it.
[05:54.360 --> 05:56.520] Now, the first thing is, the city of Dallas,
[05:56.520 --> 06:00.040] just like the city of Austin and the city of Houston,
[06:00.040 --> 06:03.600] and most of the DPS officers, in fact,
[06:03.600 --> 06:07.360] their citations, whether they're electronic or printed,
[06:07.360 --> 06:10.440] do not comply with Texas law.
[06:10.440 --> 06:15.000] The citations are illegal on their face.
[06:15.000 --> 06:18.280] We've covered that before.
[06:18.280 --> 06:23.280] Now, I do not see any authority granted to any peace officer
[06:23.280 --> 06:26.800] anywhere, including Department of Public Safety,
[06:26.800 --> 06:30.800] to initiate a chase of a member of the public
[06:30.800 --> 06:35.440] to issue an illegal traffic citation.
[06:35.440 --> 06:38.560] Yet they are doing it.
[06:38.560 --> 06:40.520] Now, in this particular case, there
[06:40.520 --> 06:42.480] are a number of documents I'm trying
[06:42.480 --> 06:45.640] to get ready to file in this particular case.
[06:45.640 --> 06:47.960] The first one we filed today was a motion
[06:47.960 --> 06:51.440] to quash the citation and the complaint based upon the citation
[06:51.440 --> 06:54.760] because the citation is completely illegal.
[06:54.760 --> 06:57.480] The city of Dallas citations do not
[06:57.480 --> 07:01.240] meet a single one of the statutory requirements
[07:01.240 --> 07:06.880] under the transportation code for a traffic citation, not one.
[07:06.880 --> 07:09.000] OK?
[07:09.000 --> 07:13.400] The city of Dallas citations also do not
[07:13.400 --> 07:20.200] comply with 543.006B of the transportation code, where
[07:20.200 --> 07:25.520] the citation must tell the accused individual
[07:25.520 --> 07:27.920] the date and time of their appearance
[07:27.920 --> 07:32.520] and that that appearance must be before some magistrate having
[07:32.520 --> 07:34.880] jurisdiction of the offense.
[07:34.880 --> 07:39.080] The statute is very clear that is a requisite
[07:39.080 --> 07:42.040] of a traffic citation.
[07:42.040 --> 07:44.360] It has to be there.
[07:44.360 --> 07:47.520] There are at least two other provisions,
[07:47.520 --> 07:50.000] three other provisions, that state
[07:50.000 --> 07:55.560] what various statements must also appear on this citation,
[07:55.560 --> 07:59.480] what kind of typeface it must be in, et cetera, et cetera.
[07:59.480 --> 08:04.800] The Dallas citations don't meet any of those criteria, not one.
[08:04.800 --> 08:08.920] Now, on top of that, the young lady I'm helping
[08:08.920 --> 08:12.840] finally listen to me the second time she went in
[08:12.840 --> 08:17.240] and recorded the conversation that she was forced to have
[08:17.240 --> 08:18.560] with the city attorney.
[08:18.560 --> 08:20.680] Now, she didn't ask for this.
[08:20.680 --> 08:25.480] She repeatedly asked for her appearance before a magistrate
[08:25.480 --> 08:29.840] as the citation or the statute says she has to.
[08:29.840 --> 08:32.920] And the city attorney did everything possible
[08:32.920 --> 08:36.960] to block her ability to make that appearance.
[08:36.960 --> 08:41.760] While simultaneously telling her that a warrant would
[08:41.760 --> 08:45.280] be issued for her arrest for failure
[08:45.280 --> 08:50.040] to appear in the court if she did not go downstairs
[08:50.040 --> 08:55.080] and enter a plea the moment she walked out of that meeting.
[08:55.080 --> 08:59.800] Now, not only is that a blatant lie and completely illegal
[08:59.800 --> 09:04.160] because there's talking about falsifying the court record
[09:04.160 --> 09:08.320] to reflect an event that they know damn good and well did not
[09:08.320 --> 09:12.440] occur and that the city attorney was responsible
[09:12.440 --> 09:18.800] for preventing the individual's appearance before the court.
[09:18.800 --> 09:21.240] But he also went so far as to tell her
[09:21.240 --> 09:24.720] that the reason the warrant of arrest would be issued
[09:24.720 --> 09:29.400] was not for failure to appear but because of her refusal
[09:29.400 --> 09:34.000] to go downstairs and enter a plea.
[09:34.000 --> 09:38.960] Every single thing was absolutely wrong
[09:38.960 --> 09:43.480] and absolutely illegal under Texas law.
[09:43.480 --> 09:46.160] Everything.
[09:46.160 --> 09:48.480] Now, I've gone out to the State Bar Association.
[09:48.480 --> 09:51.440] I've looked up this individual attorney's bar card number
[09:51.440 --> 09:54.600] and all that, and it will all be put into legal pleadings
[09:54.600 --> 09:59.960] along with the bar grievances and the grievances
[09:59.960 --> 10:04.000] to the Texas Judicial Conduct Committee
[10:04.000 --> 10:06.280] because this city attorney could not
[10:06.280 --> 10:11.840] get away with doing these things by themselves.
[10:11.840 --> 10:15.800] They have to have a helping hand in the form of the justices
[10:15.800 --> 10:17.960] of the municipal court.
[10:17.960 --> 10:19.360] They have to.
[10:19.360 --> 10:21.480] They cannot do the things they're doing
[10:21.480 --> 10:23.280] and the court not be complicit.
[10:23.280 --> 10:24.280] Why?
[10:24.280 --> 10:27.040] Because the court knows damn good and well
[10:27.040 --> 10:29.000] that the first appearance requires
[10:29.000 --> 10:32.320] them to perform a 15.17 proceeding, which
[10:32.320 --> 10:36.080] these courts know damn good and well they're not doing
[10:36.080 --> 10:39.440] because the individual goes to the window and enters a plea
[10:39.440 --> 10:41.840] and the court sees the plea.
[10:41.840 --> 10:45.920] But the court chooses to ignore the possibilities
[10:45.920 --> 10:49.920] for why a plea is the only thing they ever see.
[10:49.920 --> 10:52.920] And the reason, of course, is because the city attorney
[10:52.920 --> 10:56.240] is lying to the individuals that appear in that court,
[10:56.240 --> 11:00.200] preventing them from making their appearance before the court
[11:00.200 --> 11:03.560] and falsifying the record to coerce them
[11:03.560 --> 11:07.560] into complying with their demands.
[11:07.560 --> 11:09.840] That, ladies and gentlemen, is the justice system
[11:09.840 --> 11:12.320] you're going into.
[11:12.320 --> 11:16.840] That, ladies and gentlemen, is the prime reason I tell you,
[11:16.840 --> 11:24.880] time and time again, do not go into these appearances
[11:24.880 --> 11:29.600] without something that records audio and video.
[11:29.600 --> 11:33.600] It would also be helpful if, in the course of doing your video,
[11:33.600 --> 11:38.200] you could at least capture the faces of all the players.
[11:38.200 --> 11:40.480] But of course, you can't do that if you're going in there
[11:40.480 --> 11:43.080] half-accident by holding a cell phone in your hand

[13:46.840 --> 13:51.320] on lying through his teeth for the sole purpose of violating

[13:54.920 --> 13:59.880] There is no way out for this guy, none.
[13:59.880 --> 14:02.640] On top of that, another document we're filing

[14:20.280 --> 14:23.400] that judicial notices to make on top of that.

[14:24.880 --> 14:27.240] going to be directed specifically at the court
[14:27.240 --> 14:29.680] for denying motions out of hand without a rebuttal
[14:29.680 --> 14:31.600] by the prosecuting attorney.
[14:31.600 --> 14:35.240] So the court is acting suesponte on behalf of the prosecution
[14:35.240 --> 14:38.160] and biasly toward the accused.
[14:38.160 --> 14:41.720] By doing the prosecution's job for them,
[14:41.720 --> 14:43.680] they are failing to provide due process
[14:43.680 --> 14:45.320] in the form of an examining trial
[14:45.320 --> 14:47.880] on a probable cause determination.
[14:47.880 --> 14:50.840] They are neglecting to respond to jurisdictional challenges.
[14:53.680 --> 14:59.520] We are fixing to go after these people hard with the new material

[20:23.800 --> 20:31.760] would have answered. Why? I don't have all day to sit down and become your personal trainer,
[20:31.760 --> 20:39.760] like it or not. As much as I wish that's all I had to do, it isn't. The purpose of my doing
[20:39.760 --> 20:51.280] what I do is to become less of the sole resource, not the sole resource of this information.
[20:51.280 --> 20:58.440] People will not retain it if they don't learn it. They will not learn it if it's being spoon
[20:58.440 --> 21:06.120] fed to them on demand. You will learn things much better and retain them much longer by

[22:02.160 --> 22:09.160] to even speak at all. I'm not doing what I do to have somebody get their butt kicked
[22:09.160 --> 22:17.080] day in and day out because they are lazy or wish to not put in the time. I'm just not
[22:17.080 --> 22:25.360] here to do that. So, this requires that you put in some work of your own, okay? Now, again,
[22:25.360 --> 22:29.400] like I said, reading just the statutes as they are is not all of the work you've got
[22:29.400 --> 22:34.200] to do. You've got to read the rules, procedure, you've got to read the rules of evidence.
[22:34.200 --> 22:38.040] You've got to read all of that. You've got to start going back and digging into the history
[22:38.040 --> 22:43.520] so you know the subject as well as I do. I've given you all the pointers and flags you could
[22:43.520 --> 22:50.040] possibly hope to have in the legal pleadings and the resource materials in that seminar.
[22:50.040 --> 22:55.280] If you can't figure out what's going on by the information that's in that seminar, then
[22:55.280 --> 23:01.200] how in the Sam Hill do you expect to read and understand the statutory scheme that puts

[37:55.400 --> 38:07.400] A year ago, almost a year ago, I did receive a citation from the Department of Public Safety State Trooper here in Montgomery County, Texas.

[38:08.400 --> 38:14.400] They ended up yanking me out of the truck and cuffing me up, but they let me go.
[38:14.400 --> 38:17.400] They did issue a citation.
[38:17.400 --> 38:26.400] I refused to sign it, and they uncuffed me and let me go.
[38:26.400 --> 38:40.400] But I got it, I know you said something about their citations are not complying with 543.006, and I missed a portion of that.
[38:40.400 --> 38:55.400] And I know on my citation, it does have, I guess, a kind of a time and date for a parent that says, owner before Wednesday, October 12, 2016, at 10 a.m.
[38:55.400 --> 38:56.400] Yeah, but.
[38:56.400 --> 38:57.400] So.
[38:57.400 --> 38:59.400] Before who?
[38:59.400 --> 39:06.400] It said, well, it said before the Judge Honorable Grady Trey Spikes in Montgomery County, JP Court.

[39:08.400 --> 39:15.400] Well, the thing is, is most of them that are in existence do not comply with multiple provisions.
[39:15.400 --> 39:16.400] Okay.
[39:16.400 --> 39:26.400] That's just one of them where there has to be a set of instructions on the citation about where they are supposed to appear before a magistrate having jurisdiction.
[39:26.400 --> 39:27.400] Okay.
[39:27.400 --> 39:29.400] But there are several others.
[39:29.400 --> 39:32.400] Uh, let me see if I've got them in this document.
[39:32.400 --> 39:33.400] Yeah.

[39:38.400 --> 39:45.400] Yeah, the other is it does not comply with 14.06B.
[39:45.400 --> 39:52.400] Uh, nor do they comply with 601.233 or 708.105.
[39:52.400 --> 40:01.400] Those are the three other sections that it doesn't comply with 99 times out of 100.

[40:03.400 --> 40:05.400] Huh.
[40:05.400 --> 40:07.400] So here's where the case stands.
[40:07.400 --> 40:11.400] I kind of appeared without appearing, so to speak.
[40:11.400 --> 40:20.400] I showed up a day before the owner before date and I turned in a public information request with the court clerk had her date time stamp it.
[40:20.400 --> 40:29.400] And while she's retrieving that information, it was for the case of copy of all documents in the case file, which she had nothing to do physically.
[40:29.400 --> 40:31.400] It was all on her computer.
[40:31.400 --> 40:40.400] And basically it was just a copy of the citation, the trooper's version of the citation, which contained different information than mine contained.
[40:40.400 --> 40:43.400] See, there, there's a problem right there.
[40:43.400 --> 41:00.400] Whenever you go in and look at the citation copy that's in there, if it has anything on it different than the one that was given to you, immediately get a copy of it and make sure that copy is stamped as coming from that court.
[41:00.400 --> 41:04.400] Yeah, I did get it stamped as coming from that court.
[41:04.400 --> 41:11.400] You know, they searched my car without my consent, it didn't say on there, search the car.
[41:11.400 --> 41:19.400] And I refused to sign it because I said, when he handed it to me to sign, I said, what's going to happen if I don't sign it?
[41:19.400 --> 41:20.400] He said, now you don't have to sign it.
[41:20.400 --> 41:22.400] I said, okay, I'm not going to sign it.
[41:22.400 --> 41:31.400] But it said on there where my signature is supposed to be on the trooper's copy, it had, did want to sign.
[41:31.400 --> 41:39.400] I think he meant to put did not want to sign, but it ended up putting did want to sign, which right there, that's based on just the wording.
[41:39.400 --> 41:45.400] That's, that's, that's perjury, maybe aggravated perjury since this ticket is material to the case.
[41:45.400 --> 41:50.400] Well, there's actually a different thing to worry about here.
[41:50.400 --> 41:59.400] Basically, when the officer makes additional information that he's providing for the court to view outside of evidentiary testimony at trial,
[41:59.400 --> 42:02.400] that invalidates the evidence.
[42:02.400 --> 42:15.400] The fact that, for instance, there was a big case about these courts in some of these states where the officer was writing notes on the backs of the citation copies that were being turned into the court.
[42:15.400 --> 42:25.400] And these notes said things like was derogatory or disrespectful to me during the course of the stop, blah, blah, blah.
[42:25.400 --> 42:34.400] And thus those notes were being used by the judge to give those individuals prejudicial treatment before the court.
[42:34.400 --> 42:35.400] Wow.
[42:35.400 --> 42:44.400] So that right there is exactly why when the officer gives them a citation with additional information on it that was not given to you,
[42:44.400 --> 43:03.400] then you could make the allegation that the police and the courts have an unlawful communication ex parte via those excess notes on the, on the copies turned into the court that can be used prejudicially against the accused by the court.
[43:03.400 --> 43:05.400] Okay.
[43:05.400 --> 43:13.400] And see, that's exactly what a note that would say did not want to sign conveys to that judge.
[43:13.400 --> 43:17.400] Oh, this guy thought he could tell a trooper he wasn't going to sign a citation to get away with it.
[43:17.400 --> 43:21.400] We'll see about that.
[43:21.400 --> 43:26.400] Well, they ended up, I never did make a plea.
[43:26.400 --> 43:28.400] She asked me if I wanted to plea.
[43:28.400 --> 43:33.400] I said, well, as soon as I see a proper charging, that's why I'd be happy to enter a plea.
[43:33.400 --> 43:37.400] And so she says, well, we're going to schedule this for a pretrial hearing.
[43:37.400 --> 43:39.400] I said, do what you have to do.
[43:39.400 --> 43:46.400] And I left, I recorded the whole thing and never heard from him for almost a year.
[43:46.400 --> 43:51.400] And then I got a complaint sent to me, actually two complaints.

[46:46.400 --> 46:53.400] Several months prior to me actually receiving this affidavit of complaint.
[46:53.400 --> 47:15.400] And on addition to it, the judge signs it and it says, on the first day of March, it says, I hereby acknowledge that I have examined the foregoing affidavit and have determined that probable cause exists for the issuance of arrest of the above named accused.
[47:15.400 --> 47:22.400] It is therefore ordered that the clerk of the justice court precinct one, which this is an actually precinct two justice court.
[47:22.400 --> 47:29.400] I don't know why they said precinct one, shall forthwith issue a capitis for the body of the accused.
[47:29.400 --> 47:38.400] I never promised to appear in court. I actually did appear, you know, and I've got the date timestamp saying I actually appeared.
[47:38.400 --> 47:42.400] Yeah, this is what I was talking about at the beginning of the show. Here's what they've done.
[47:42.400 --> 47:48.400] They have falsified the record saying that you failed to appear originally.
[47:48.400 --> 47:55.400] Now, that's where that document that you got file stamped is going to prove them wrong, but they're going to do that.
[47:55.400 --> 48:10.400] They will falsify the record saying that they issued the warrant for failure to appear knowing full well that you did appear, but what they're doing is they're doing it in retaliation for your refusal to enter a plea and waive your rights.
[48:10.400 --> 48:14.400] None of these courts are doing this process properly.
[48:14.400 --> 48:28.400] What they're trying to do is to get you to make a general appearance and unknowingly waive your due process rights to notice probable cause determinations and examining trial and numerous other things,
[48:28.400 --> 48:40.400] like the ability to challenge the complaint and the information by getting you to enter a plea because all those rights vanish once you enter a plea.
[48:40.400 --> 48:51.400] So what they're doing is threatening people with arrest and incarceration for not entering a plea while falsifying, which is not against the law in Texas.
[48:51.400 --> 48:58.400] You can't be made to enter a plea anywhere, including Texas.
[48:58.400 --> 49:13.400] In fact, their court has very specific instructions that their only duty and authority in relation to a defendant who refuses to plea, not fails to plea, but refuses to plea, is to enter a plea of not guilty on their behalf.
[49:13.400 --> 49:21.400] But instead, what they're doing is falsifying the record saying the individual never appeared in court.
[49:21.400 --> 49:24.400] They are tampering with a governmental record.
[49:24.400 --> 49:26.400] They are tampering with a witness.
[49:26.400 --> 49:38.400] They are committing simulation of legal process and they are perpetrating fraud through official documents.
[49:38.400 --> 49:43.400] You know, I really think they just don't know what to do or how to proceed.
[49:43.400 --> 49:45.400] We don't really care.
[49:45.400 --> 49:49.400] They're the ones with the duty to know, not us.
[49:49.400 --> 49:50.400] Oh, I know.
[49:50.400 --> 49:56.400] But the fact is that it doesn't matter whether they're doing this out of ignorance or choice.
[49:56.400 --> 49:58.400] It's still illegal.
[49:58.400 --> 50:00.400] It's still criminal.
[50:00.400 --> 50:12.400] They have no ability to claim ignorance because they are the ones that made the very rules they're breaking.
[50:12.400 --> 50:16.400] So I called the court and they said there's no warrant issued for my arrest.
[50:16.400 --> 50:17.400] Right.
[50:17.400 --> 50:20.400] But you got a notice saying there was.
[50:20.400 --> 50:30.400] Well, it says, it didn't say there was, it says that is therefore ordered that the clerk shall forth with issue a capious.
[50:30.400 --> 50:32.400] So there's no evidence of a capious.
[50:32.400 --> 50:34.400] Okay, but here's the thing.
[50:34.400 --> 50:41.400] That document says that someone made a finding of probable cause and it's signed by a judge, right?
[50:41.400 --> 50:42.400] That's correct.
[50:42.400 --> 50:53.400] So either a clerk is falsifying a judge's name on a document or a judge is falsifying a document making a legal claim that isn't true.
[50:53.400 --> 51:04.400] And then they're sending it to you in the mail under the hopes that you will come in and pay the ticket or do something that will allow them to move forward.
[51:04.400 --> 51:09.400] It is a simulation of legal process.
[51:09.400 --> 51:11.400] So basically I'm not doing anything.
[51:11.400 --> 51:13.400] I'm just waiting to see what their next play is.
[51:13.400 --> 51:15.400] Oh, no, no, no, no.
[51:15.400 --> 51:16.400] Don't do that.
[51:16.400 --> 51:18.400] Okay.
[51:18.400 --> 51:25.400] What's the worst thing in the world you can wait on a wall of water to do collapse on you.

[51:26.400 --> 51:32.400] You're much better off if you can find ways to break it apart before it gets to you, right?

[51:36.400 --> 51:46.400] And I owe this to a young lady by the name of Ms. Debra Swan who's going through her jurist doctorate training to get her degree for law and everything.
[51:46.400 --> 51:53.400] But her suggestion is actually quite sound and one I'm adopting for all the stuff that we're doing in seminar 2.0.
[51:53.400 --> 52:02.400] And that is filing written judicial notices and written objections to every single thing they do wrong.
[52:02.400 --> 52:12.400] Hell, we're going to do it for every single thing they do even partially right because partial ain't good enough when it comes to your due process rights.

[52:13.400 --> 52:24.400] So these written objections, she's got a specific format that she uses for that and I'm adopting something similar though not an exact match.
[52:24.400 --> 52:28.400] And then same thing with her form of written judicial notices.
[52:28.400 --> 52:41.400] Now, the problem here is that I already know for myself, I know how most of these documents are going to be used before they're even necessary to be used.
[52:41.400 --> 52:57.400] So I can prepare all these different kinds of objections and everything based upon what I have actually seen these courts do in an effort to make things as easy as possible on folks that need the legal argument through about the particular path this particular court chose.
[52:57.400 --> 53:07.400] So what that means for me is literally dozens of extra pieces of paper are going to have to be generated.
[53:07.400 --> 53:20.400] But people are going to have to learn how to use them in conjunction with the other pleadings because I'm not going to write a separate objection for every single motion when that one objection would apply anywhere.
[53:20.400 --> 53:34.400] So I'm going to write one folder full of written objections and I'm going to try to name them and number them and organize them so that people know to file that along with these other pleadings based upon what actually occurred in the case.
[53:34.400 --> 53:41.400] But odds are most of what I write will actually occur in the case in some form.
[53:41.400 --> 53:53.400] So while this is the current practice of the court you're in and the current practice of Austin and the current practice of Dallas and the current practice of Houston, it may not be the current practice for Rockwall.
[53:53.400 --> 53:55.400] It may not be the current practice for Round Rock.
[53:55.400 --> 53:58.400] You see what I'm saying?
[53:58.400 --> 53:59.400] Yep.
[53:59.400 --> 54:06.400] So you've got to learn to use the motions accordingly based upon what the venue you're in is actually doing.
[54:06.400 --> 54:11.400] And if I don't have one that covers what they're actually doing, then guess what?
[54:11.400 --> 54:18.400] People need to be doing a little studying on their own and writing their own document to make up for the hole that's there.

[55:14.400 --> 55:16.400] They're not there to replace thinking.

[55:20.400 --> 55:34.400] They're there to give you a framework in which to operate to apply the rules as they exist for the situation in which you find yourself so as to stand the best chance of being victorious.

[56:45.400 --> 56:49.400] I said, well, go read them and then we can have an intelligent conversation.
[56:49.400 --> 56:55.400] She stormed off, came back, maybe wait until everybody else was gone and come back to your cases dismissed.
[56:55.400 --> 57:01.400] Yeah, I watched her send the deputy home.
[57:01.400 --> 57:06.400] Your cases dismissed because the witness didn't show because we tampered with the witness and made them leave.
[57:06.400 --> 57:08.400] You know she committed a felony.
[57:08.400 --> 57:17.400] Every time they do that, when they go to the damn top and say, get your ass out of here, we can't have you testify so we can dismiss this.
[57:17.400 --> 57:20.400] They are tampering with the witness.
[57:20.400 --> 57:23.400] They are denying due process.
[57:23.400 --> 57:27.400] When you catch them at that, bury them.
[57:27.400 --> 57:29.400] Get them people.
[57:29.400 --> 57:36.400] Well, if I had known how to file a Title 42 at that time, I would have done that, but it's been two years since my injury.

[01:34:22.040 --> 01:34:26.040] and find out that what you're saying is not to be found in there anywhere,

[01:36:51.040 --> 01:36:55.040] Okay, now with statutory law, the same law I'm referring to,
[01:36:55.040 --> 01:36:57.040] commercial code UCC.
[01:36:57.040 --> 01:37:04.040] Again, what is your case law or actual legal backing
[01:37:04.040 --> 01:37:06.040] to support that statement?

[01:37:37.040 --> 01:37:41.040] C, how it has one damn thing to do from A, B, C, and D
[01:37:41.040 --> 01:37:43.040] in relation to each other,
[01:37:43.040 --> 01:37:47.040] and much less how it got them from this idea to that idea
[01:37:47.040 --> 01:37:50.040] as proof of concept.
[01:37:50.040 --> 01:37:54.040] Okay, so the whole thing is really totally out of kilter.

[01:38:15.040 --> 01:38:18.040] because they're never going to give up that power
[01:38:18.040 --> 01:38:20.040] back to the people willingly.
[01:38:20.040 --> 01:38:22.040] No nation on the face of this earth
[01:38:22.040 --> 01:38:26.040] where the government has usurped a power unto itself
[01:38:26.040 --> 01:38:31.040] from the people has it ever relinquished that power back peacefully,
[01:38:31.040 --> 01:38:34.040] not once in the history of mankind.
[01:38:34.040 --> 01:38:38.040] But wasn't the law at one time in this country
[01:38:38.040 --> 01:38:40.040] based on the common law?
[01:38:40.040 --> 01:38:43.040] Well, of course, that's an ignorant question.
[01:38:43.040 --> 01:38:45.040] Of course it was.
[01:38:45.040 --> 01:38:48.040] The problem is, is how the current system
[01:38:48.040 --> 01:38:50.040] defines what the common law was
[01:38:50.040 --> 01:38:53.040] versus how the people understood it to be.
[01:38:53.040 --> 01:38:56.040] The system as we know it says the common law
[01:38:56.040 --> 01:38:59.040] was the law as decided by judges of the courts,
[01:38:59.040 --> 01:39:02.040] and that's complete BS.
[01:39:02.040 --> 01:39:05.040] The judges of the courts had nothing to do with it.
[01:39:05.040 --> 01:39:09.040] The judges of the courts were bound to the Magna Carta,
[01:39:09.040 --> 01:39:13.040] just like the king of England was bound to the Magna Carta.
[01:39:13.040 --> 01:39:15.040] Right.
[01:39:15.040 --> 01:39:19.040] And when they would not give it its proper place,
[01:39:19.040 --> 01:39:24.040] then all of the barons that worked on the land
[01:39:24.040 --> 01:39:27.040] actually control the land when it gets the king.
[01:39:27.040 --> 01:39:30.040] That's how we got the Magna Carta to begin with.
[01:39:30.040 --> 01:39:32.040] Yeah, 1215 running me, yeah.
[01:39:32.040 --> 01:39:36.040] Okay, so yes, the common law originated
[01:39:36.040 --> 01:39:40.040] with the concepts of the Magna Carta, not the judges.

[01:39:47.040 --> 01:39:51.040] that talk of free men and free will and free exercise

[01:39:56.040 --> 01:39:59.040] It's not what some judge decreed.
[01:39:59.040 --> 01:40:04.040] But that's what the current system wants you to believe it was.
