[00:46.720 --> 00:50.640]  In recent years, yesterday Tuesday, police chiefs from three of the five biggest cities
[00:50.640 --> 00:54.800]  in the state spoke out at the Texas Capitol against the transgender bathroom bill being
[00:54.800 --> 00:59.640]  considered by the Republican legislator as discriminatory and in divergence of resources
[00:59.640 --> 01:01.280]  that won't keep people safe.
[01:01.280 --> 01:05.600]  The police chiefs were joined by public school officials, advocates for sexual assault survivors,
[01:05.600 --> 01:09.680]  representatives from the Harris County and El Paso Sheriff's offices, the Corpus Christi
[01:09.680 --> 01:12.280]  ISD chief of police and others.
[01:12.280 --> 01:17.040]  The main issue as Austin police chief Brian Manley put it, is that if, quote, a bill like
[01:17.040 --> 01:21.720]  this were to be passed, that would pull police officers' time away from combating violent
[01:21.720 --> 01:24.320]  crime into enforcing a bathroom bill.
[01:24.320 --> 01:28.920]  It makes communities less safe, since it is time not spent insuring community safety.
[01:28.920 --> 01:33.000]  The legislation which restricts bathroom use in schools and local government buildings
[01:33.000 --> 01:37.440]  by superseding and nullifying parts of local non-discrimination ordinances meant to allow
[01:37.440 --> 01:42.320]  transgender residents, which make up less than 1% of the population, the claim to use
[01:42.320 --> 01:44.320]  the public bathroom of their choice.
[01:44.320 --> 01:46.920]  The bill did pass just after midnight last night.
[01:46.920 --> 01:55.960]  The Senate voted 21 to 10, and it now goes to the House for consideration.
[01:55.960 --> 02:00.560]  An information technology staffer for former chairwoman of the Democratic National Committee,
[02:00.560 --> 02:05.240]  Representative Debbie Weisserman-Schultz, Democrat from Florida, Imran Awan, a 37-year-old,
[02:05.240 --> 02:09.560]  was arrested on Monday by FBI agents and U.S. Capitol Police at Dooling's International
[02:09.560 --> 02:12.920]  Airport while attempting to flee to Lahore, Pakistan.
[02:12.920 --> 02:16.800]  He was charged with big fraud in the U.S. District Court on Tuesday, where he pleaded
[02:16.800 --> 02:18.120]  not guilty.
[02:18.120 --> 02:22.000]  According to federal court documents, officials were accusing Awan and his wife, Hina Alvi,
[02:22.000 --> 02:27.400]  of defrauding the Congressional Federal Credit Union of $165,000 by lying on a home equity
[02:27.400 --> 02:32.120]  loan application and not listing the home that they were getting the loan for as a rental
[02:32.120 --> 02:33.120]  property.
[02:33.120 --> 02:37.480]  Awan was released and is under a high-intensity supervision program with his hearing schedule
[02:37.480 --> 02:39.080]  for the 21st of August.
[02:39.080 --> 02:43.920]  Awan's lawyer, Christopher Gohan, said that the charges are politically motivated and,
[02:43.920 --> 02:49.960]  quote, began as part of a frenzy of anti-Muslim bigotry in the literal heart of our democracy,
[02:49.960 --> 02:56.960]  the House of Representatives.

[03:51.240 --> 03:56.240]  I'm hoping we won't have any technical issues tonight.
[03:56.240 --> 04:05.760]  Okay, I am still working on the traffic ticket program, and I did some research.
[04:05.760 --> 04:07.840]  I talked about this last night.
[04:07.840 --> 04:09.960]  I'm going to go through this again.
[04:09.960 --> 04:14.600]  I thought it was significant, what I found.
[04:14.600 --> 04:22.200]  I talked to Olivier in Tennessee, and he did some research there on who can enforce
[04:22.200 --> 04:29.520]  the transportation code, and Olivier beyond later, I'm sure, will address that.
[04:29.520 --> 04:35.320]  But according to him in Tennessee, that a municipal police officer can enforce the
[04:35.320 --> 04:41.800]  transportation code in conjunction with the investigation of an accident, and that's the
[04:41.800 --> 04:44.840]  only time.
[04:44.840 --> 04:52.360]  In Illinois, I had someone up there I was talking to, so I did some research on Illinois,
[04:52.360 --> 04:58.440]  and I was going through, I found pretty much what I needed, but I was going through the,
[04:58.440 --> 05:04.080]  in the Motor Vehicle Code for Illinois definitions.
[05:04.080 --> 05:08.160]  I came to peace officer.
[05:08.160 --> 05:16.080]  A peace officer is defined in the state of Illinois Vehicle Code as an officer authorized
[05:16.080 --> 05:21.680]  to enforce the criminal laws.
[05:21.680 --> 05:30.600]  Right under it was police officer, and that's someone who is authorized to enforce the transportation
[05:30.600 --> 05:37.880]  code, and in reading the codes, I also looked in California, and I'll get to California
[05:37.880 --> 05:41.720]  in a minute, it's somewhat different.
[05:41.720 --> 05:51.160]  All of the state police agencies were originally created for the purpose of enforcing the commercial
[05:51.160 --> 05:54.640]  transportation code.
[05:54.640 --> 05:57.960]  I was surprised to hear that.
[05:57.960 --> 06:04.200]  But when you think about it, it's not really that surprising because each county has its
[06:04.200 --> 06:12.640]  own sheriff, and that sheriff is essentially sovereign as concerns law enforcement.
[06:12.640 --> 06:19.840]  I mean, there's nobody who tells him what to do, and each county has their own sheriff
[06:19.840 --> 06:26.080]  that way, so it would seem that a state police would have a difficult time with these local
[06:26.080 --> 06:28.360]  elected officials.
[06:28.360 --> 06:35.720]  So when they created the state police, it seemed clear that they did not want to give
[06:35.720 --> 06:45.120]  the appearance of usurping or bypassing the authority of the local county sheriffs.
[06:45.120 --> 06:52.840]  So they created the state police for the singular purpose of enforcing the transportation code.
[06:52.840 --> 07:00.880]  It's that way in Texas, that way in Tennessee, that way in Illinois, and that way in California.
[07:00.880 --> 07:14.320]  In California, if you're in a municipality and a county, or a county of over 2 million,
[07:14.320 --> 07:18.400]  the municipal police can enforce.
[07:18.400 --> 07:26.040]  And then there was a couple of references, one reference to a stretch of Coast Highway
[07:26.040 --> 07:31.040]  that I believe it was Malibu Police who were authorized to enforce on this one stretch
[07:31.040 --> 07:33.240]  of highway.
[07:33.240 --> 07:38.720]  But other than that, the highway patrol, California Highway Patrol enforced.
[07:38.720 --> 07:41.880]  But there was a difference in California.
[07:41.880 --> 07:52.200]  California's specifically defined driver, and a defined driver as anyone who operates
[07:52.200 --> 08:01.000]  a motorized vehicle on the highways and the public thoroughfares in California.
[08:01.000 --> 08:10.360]  So we don't have the distinction between driver and operator, as we do here in Texas.
[08:10.360 --> 08:17.360]  In California, everybody's considered a driver, and every driver is required to have a driver's
[08:17.360 --> 08:27.080]  license, and that appears to me to be a direct constitutional, federal constitutional violation.
[08:27.080 --> 08:31.560]  But I don't think we'll get that adjudicated.
[08:31.560 --> 08:41.440]  Somehow, I suspect that no matter how much we jump up and down, rail and righteous indignation,
[08:41.440 --> 08:44.320]  that part they're not going to change.
[08:44.320 --> 08:52.720]  But so far, California's the only one that was, that defined drivers that way.
[08:52.720 --> 08:59.080]  All the rest, at least the other three that I've looked at so far, are almost identical
[08:59.080 --> 09:04.920]  to Texas, and municipal police officers are not authorized to enforce transportation
[09:04.920 --> 09:07.560]  code.
[09:07.560 --> 09:17.760]  And then when I looked at it, I was putting together the questionnaires in a presentation
[09:17.760 --> 09:23.880]  document, and something occurred to me.
[09:23.880 --> 09:36.720]  The 78-80% of all of the arrests occur as a result of a traffic stop.
[09:36.720 --> 09:46.960]  So if we shut down traffic enforcement, then the police are going to have a harder time
[09:46.960 --> 09:52.960]  enforcing a lot of these minor laws that are putting so many people in jail.
[09:52.960 --> 10:04.320]  We have, the United States contains approximately 3% of the world's population.
[10:04.320 --> 10:11.320]  We house approximately 50% of the world's population of inmates.
[10:11.320 --> 10:21.000]  Average conviction rate for all crimes across the board in the state of Texas, 99.6.
[10:21.000 --> 10:27.800]  We live in the worst police state the world has ever seen by far.
[10:27.800 --> 10:30.720]  And most of us don't even realize it.
[10:30.720 --> 10:35.720]  Because even in the worst police state, the vast majority of the people never have anything
[10:35.720 --> 10:36.720]  to do with them.
[10:36.720 --> 10:41.440]  I suspect in Nazi Germany, the vast majority of the people never had anything to do with
[10:41.440 --> 10:45.800]  the police, or the brown shirts, or the Nazis.
[10:45.800 --> 10:56.360]  They just went about their daily lives, and went to work, and went home, and had a normal
[10:56.360 --> 10:57.360]  life.
[10:57.360 --> 11:03.320]  And there's so many people, the police can't interact with all of us.
[11:03.320 --> 11:09.160]  And at the time, they didn't have the traffic laws, so the police couldn't, didn't have
[11:09.160 --> 11:13.480]  a reason to just be stopping you just to suck money out of you.
[11:13.480 --> 11:18.760]  And now, we had 6.6 million tickets written in Texas last year.
[11:18.760 --> 11:22.160]  That's almost a third of the population.
[11:22.160 --> 11:33.920]  It's about, so about 27, 28%, 6.6 million.
[11:33.920 --> 11:39.920]  And the vast majority of those were absolutely illegal.
[11:39.920 --> 11:50.480]  It appears to me that traffic is probably the best place to start toward writing this
[11:50.480 --> 11:53.000]  system.
[11:53.000 --> 11:58.920]  The documents I produce for Texas are ugly indeed.
[11:58.920 --> 12:03.720]  I charged a police officer with first degree felony aggravated assault.
[12:03.720 --> 12:08.560]  We filed a TECOS complaint against him.
[12:08.560 --> 12:14.680]  When you go to that first hearing, we'll have a number of complaints, and judicial
[12:14.680 --> 12:20.400]  conduct complaints, and grievances, and criminal charges against the clerk, and possibly the
[12:20.400 --> 12:25.520]  bailiff, if the bailiff gets involved.
[12:25.520 --> 12:30.640]  And when you go to the preliminary hearing, it's absolutely forbidden for them to hold
[12:30.640 --> 12:37.200]  the preliminary hearing the way it's the standard method of how they do it.
[12:37.200 --> 12:42.920]  Because you can't summon someone to come to court to meet with a prosecutor.
[12:42.920 --> 12:44.920]  It's illegal.
[12:44.920 --> 12:48.280]  So everything they're doing is highly illegal.
[12:48.280 --> 12:50.640]  So we're going to start pounding them.
[12:50.640 --> 13:01.360]  I'm hoping I can generate one or two Scott Richardson's or Olivier's in every county
[13:01.360 --> 13:05.880]  in Texas, and this stuff will end.
[13:05.880 --> 13:14.800]  When people begin to find out how horribly illegal the local transportation code enforcement
[13:14.800 --> 13:23.120]  is, and just a few of them start filing these complaints, and then sue with the judge and
[13:23.120 --> 13:25.120]  the prosecutor.
[13:25.120 --> 13:32.720]  I hope Kenneth calls in because he just went before a judge with these documents, and the
[13:32.720 --> 13:37.040]  judge didn't even read them and just tossed them.
[13:37.040 --> 13:45.160]  So we're going to put together a lawsuit against the judge.
[13:45.160 --> 13:47.440]  Here's the problem.
[13:47.440 --> 13:52.600]  These judges don't want to bother wasting all the time reading these documents and responding
[13:52.600 --> 13:53.600]  to them.
[13:53.600 --> 13:55.960]  So they just do whatever they want to.
[13:55.960 --> 14:05.120]  Well, the problem is, is one of those documents is a challenge to subject matter jurisdiction.
[14:05.120 --> 14:11.720]  Once subject matter jurisdiction is challenged, it must be proven.
[14:11.720 --> 14:20.000]  It may not be presumed, and there's only one time you can sue a judge.
[14:20.000 --> 14:27.720]  It's when he acts without subject matter jurisdiction.
[14:27.720 --> 14:35.160]  So we filed a challenge that interrupts his jurisdiction, and he loses jurisdiction until
[14:35.160 --> 14:37.200]  he proves it up.
[14:37.200 --> 14:40.880]  When he just bypasses it, he never proves up jurisdiction.
[14:40.880 --> 14:46.160]  So by law, he's acting outside scope and has no immunity.
[14:46.160 --> 14:53.240]  So we start suing judges for doing what they've been doing for years.
[14:53.240 --> 14:57.880]  Olivier would come on and talk about what happened in Tennessee.

[24:09.840 --> 24:14.960]  them exactly what was going on and they understood, but they chose not to do anything, they just
[24:14.960 --> 24:15.960]  let it go.
[24:15.960 --> 24:21.160]  This particular fellow is coming to me saying, man, I wish I had acted sooner, another friend
[24:21.160 --> 24:26.200]  of his, a female, he came to me for advice for her a couple of years ago and I told her,
[24:26.200 --> 24:30.600]  look, she's not a subject manager of jurisdiction, they don't have agency capacity or standing
[24:30.600 --> 24:35.640]  to invoke the court's jurisdiction in this particular instance and she did and the tribes
[24:35.640 --> 24:39.000]  stopped everything and then they came back at her a few weeks later and she went right
[24:39.000 --> 24:43.960]  in and it went, yeah, it went away and she lost it, you know, but so he's seen that there
[24:43.960 --> 24:47.360]  is certain things that need to be done, now you need to understand that, he's asking me
[24:47.360 --> 24:51.560]  for anything you can do to stop this thing, I said, yeah, you should have started three
[24:51.560 --> 24:58.480]  years ago, however, he is ready, he does want to try and do something because he understands
[24:58.480 --> 25:04.480]  it, country-wide and all this is, this is sham, emerge and he gets it.
[25:04.480 --> 25:17.320]  If he's ready, he may be too late to stop the sale, but just to see, have him go down
[25:17.320 --> 25:26.960]  and do the red-folder treatment, get a red-folder, put some papers in it and when they call the
[25:26.960 --> 25:32.600]  property, you stand up and you hold the red-folder up and you tell them against the property,
[25:32.600 --> 25:39.400]  you buy the property, you buy the claim and generally, unless there's somebody there that
[25:39.400 --> 25:46.000]  specifically wants that property for a particular reason, the normal investors will run like
[25:46.000 --> 25:55.960]  rabbits and that stops it from getting sold to a third party and the bank buys it back,
[25:55.960 --> 26:04.120]  but depending, since it's American wholesale lenders, he probably don't care if a third
[26:04.120 --> 26:11.400]  party buys it, it might be a good thing because then you see American wholesale lenders and
[26:11.400 --> 26:20.440]  the third party purchaser and the third party purchaser is going to be a real unhappy camper
[26:20.440 --> 26:27.280]  and they're going to turn right around and sue the seller, you get the, you go to the
[26:27.280 --> 26:35.880]  third party purchaser and turn him to your side now, depending on the equity the guy
[26:35.880 --> 26:43.480]  has in the house. There may be some subtle ways of handling this, so I've got one now
[26:43.480 --> 26:50.240]  where we filed a quiet title action because they come to me and I said one or two days
[26:50.240 --> 26:56.280]  to put something together, so I stuck together a quiet title, filed it, that stopped them
[26:56.280 --> 27:06.200]  for a while and the court ruled against him and he didn't get back to me in time, I filed
[27:06.200 --> 27:12.040]  an appeal for him and the court ruled against the appeal and he didn't get back to me in
[27:12.040 --> 27:21.280]  time to file a motion for reconsideration. So, but anyway, it stopped immediately. They
[27:21.280 --> 27:27.840]  were trying to evict him because they already sold the property, but they sold the property
[27:27.840 --> 27:36.760]  with a $30,000 overage and the purchaser of the property came to him and offered to sell
[27:36.760 --> 27:45.440]  him the property back at what he paid for it. If he buys the property back for what
[27:45.440 --> 27:51.440]  this guy paid for it, then he still has a right to the overage, which is $30,000.
[27:51.440 --> 27:53.720]  Really? That's interesting.
[27:53.720 --> 28:00.400]  Yeah, the bank don't get to keep the overage, so he gets the overage back and then he sues
[28:00.400 --> 28:04.520]  the bank for him having to go through all this stuff. Now he's got his property back,
[28:04.520 --> 28:11.120]  he's out of money for closure, the bank's got nothing to win, they can only lose, then
[28:11.120 --> 28:17.000]  they try to bring him to table and make a deal. So, what about the disclosure statement,
[28:17.000 --> 28:21.520]  the truth in lending, all the fees? I know I've heard you discuss the, you know, figuring
[28:21.520 --> 28:22.520]  out what you want to...
[28:22.520 --> 28:28.560]  Yeah, okay, I can run an analysis on that. How long has the guy had the house?
[28:28.560 --> 28:30.560]  He closed November 2006.
[28:30.560 --> 28:35.800]  Oh my goodness, he's got 11 years of equity.
[28:35.800 --> 28:44.240]  Oh yeah, it's out in Spicewood, Texas, it's not on Lake Travis, but it does have a large
[28:44.240 --> 28:50.440]  wet weather creek and about a quarter acre pond that's 15 feet deep whenever it loads,
[28:50.440 --> 28:55.160]  and it loads up pretty fast when we get a few inches of rain. It's a piece of property
[28:55.160 --> 28:59.400]  that I think some people got their eyes on it, you know?
[28:59.400 --> 29:06.600]  Okay, even if they sell it Tuesday, there's still a lot you can do, but before I could
[29:06.600 --> 29:10.840]  really tell you anything, I need to see all of the documents that have been filed with
[29:10.840 --> 29:13.720]  the county registrar's office.
[29:13.720 --> 29:19.480]  So, on Monday, okay, Tuesday we'll do the red folder treatment, on Monday is there anything
[29:19.480 --> 29:24.760]  I can do because for me to realistically get, I can't get everything until Monday that's
[29:24.760 --> 29:30.560]  been filed in the public record, but I won't be able to get that to you until Monday sometimes,
[29:30.560 --> 29:36.080]  so is there something that we should go ahead and do, maybe initiate a counter claim against
[29:36.080 --> 29:38.080]  the attorneys that are selling it?
[29:38.080 --> 29:43.640]  No, you don't have time, just the red folder treatment's the best you can do, but you really

[35:05.280 --> 35:13.480]  I've written down that are in that particular injustice system, they pretty much feel like

[35:15.480 --> 35:22.400]  They're crazy out there, that's what I'm saying, they're 1950s style, you know.
[35:22.400 --> 35:31.440]  When you start using some 2017 judicial conduct complaints, bar grievances, you start pushing
[35:31.440 --> 35:38.160]  for his financials, you want to see all the real estate he owns, you want to see evidence
[35:38.160 --> 35:43.480]  of all the mortgages that he's gotten on all that real estate, you want to see any businesses
[35:43.480 --> 35:56.320]  he's associated with, any trips to any concenos that he's went to, any cash purchases he's
[35:56.320 --> 36:05.000]  made, there's a whole list of things they do to launder money and a few of them are
[36:05.000 --> 36:12.080]  specific to public officials and we will request all that information.
[36:12.080 --> 36:25.440]  The problem they have is, even if the judge is clean as a whistle, perception is everything.
[36:25.440 --> 36:33.920]  The fact that we're asking for this tells the judge we think he's taking bribes.
[36:33.920 --> 36:37.280]  That kind of taints him.
[36:37.280 --> 36:43.920]  If he gives a bad ruling, we'll maintain this because he was bribed by the banks.
[36:43.920 --> 36:53.400]  That sounds interesting, but in any case, we can stop, you can probably hold him off
[36:53.400 --> 36:55.800]  for three to five years pretty easy.
[36:55.800 --> 37:00.840]  That's what I've been telling my friend, I said, look, you put the payments, the money
[37:00.840 --> 37:05.880]  you'd be making in payments away and then four, five, six years down the road, you
[37:05.880 --> 37:09.720]  go to him, you said, let's make a deal and they'll be able to stay face, they get a little
[37:09.720 --> 37:10.720]  money.

[39:31.280 --> 39:37.480]  asking you questions, so you really never truly get to lay out your emotion on what
[39:37.480 --> 39:41.480]  you want to say to the court and get your evidence in.

[39:46.480 --> 39:51.480]  Why would you want to say anything to the judge?

[40:24.480 --> 40:30.480]  You're going into court and say oral argument is fundamentally unfair.

[41:24.480 --> 41:29.480]  If the jury rules against you, it's hard to raise an issue.
[41:29.480 --> 41:36.480]  You can raise issues about how the judge dealt with the jury, but they're more tenuous.
[41:36.480 --> 41:43.480]  When you do everything in the pleadings and refuse to do oral argument, then the judge
[41:43.480 --> 41:46.480]  is bound by your pleadings.
[41:46.480 --> 41:48.480]  And you're just there to set the record for appeal.
[41:48.480 --> 41:49.480]  You file your documentation.
[41:49.480 --> 41:58.480]  You get all your facts and law and the record is no reason to talk to this judge.
[41:58.480 --> 41:59.480]  Interesting.
[41:59.480 --> 42:09.480]  And if the judge says anything to me in court that I can take as in any way threatening,

[43:04.480 --> 43:12.480]  They set me up because I was going to a municipal court, and I wanted to make sure that there

[43:17.480 --> 43:22.480]  He set me, he pulled me over, and he said, Mr. County, you know why I stopped you.
[43:22.480 --> 43:24.480]  I said, well, I got an idea.
[43:24.480 --> 43:29.480]  He said, your license is expired, your registration is expired.
[43:29.480 --> 43:34.480]  I said, only two years, what's the problem?
[43:34.480 --> 43:40.480]  So he wrote a ticket, and when he went back to write the ticket, I called 911.

[47:12.480 --> 47:19.480]  When the complaint is filed, jurisdiction is presumed unless challenged.
[47:19.480 --> 47:22.480]  Once challenged, jurisdiction is lost.
[47:22.480 --> 47:27.480]  You don't want them to do anything to fix that.
[47:27.480 --> 47:30.480]  They don't have any jurisdiction until they prove it up.
[47:30.480 --> 47:36.480]  And the last thing you want to do is give the judge legal advice.
[47:36.480 --> 47:46.480]  If he wants legal advice, let him go to the prosecutor to tell him that if you don't prove him up jurisdiction, he can sue you.
[47:46.480 --> 47:54.480]  It's like when I pulled that hearing aid trick on the judge, if I had told him about the Americans with Disabilities Act,
[47:54.480 --> 47:56.480]  he might have turned the sound up.
[47:56.480 --> 48:01.480]  And I didn't want him to do that.
[48:01.480 --> 48:04.480]  So you got the challenge before him.
[48:04.480 --> 48:09.480]  And remember, you're setting a record for appeal.
[48:09.480 --> 48:20.480]  You might, by setting the record for appeal, there's a chance you can win in the trial court because they'll realize what you're doing.

[01:05:33.480 --> 01:05:40.480]  But since there's no written response, he can't come in and raise issues in court. That's a surprise.

[01:08:39.480 --> 01:08:52.480]  One of the things judge, judge did early on was he denied my challenge to subject matter jurisdiction.

[01:09:00.480 --> 01:09:09.480]  Okay, petition, if he denied it without proving it, subject matter jurisdiction is not something you can deny.

[01:09:17.480 --> 01:09:25.480]  So it's not something you can deny. You either prove up jurisdiction or you don't, and you can rule that you proved up jurisdiction.
[01:09:25.480 --> 01:09:40.480]  But if you, you can't just deny it. So you go to the court of appeals and ask the court of appeals for rid of mandamus dismissing the case for lack of subject matter jurisdiction.
[01:09:40.480 --> 01:09:52.480]  Not because they didn't actually have subject matter jurisdiction, but because they didn't prove it up.
[01:09:52.480 --> 01:10:04.480]  Okay. Is a mandamus to the appellate court, is that difficult to set up? Is the style different?

[01:10:10.480 --> 01:10:29.480]  But all you know, this is your pro say you just, you go to that court and take the case law that says that subject matter jurisdiction is threshold that it may not be presumed once challenged must be proven.

[01:10:39.480 --> 01:10:51.480]  Tell the judge what they did real briefly. And then you bring out the state all the facts that you were charged on this day you filed a challenge subject matter jurisdiction on this day.

[01:10:57.480 --> 01:11:06.480]  The judge denied the motion without considering the merits without and failed to bring any facts to prove up jurisdiction.

[01:11:18.480 --> 01:11:24.480]  Sort and sweet doesn't need to be long.
[01:11:24.480 --> 01:11:36.480]  And so, for example, my motion for finding the facts and conclusions of law is denial that it wouldn't be even worth putting that in there, would it?

[01:20:00.480 --> 01:20:08.480]  202 is called pre-litigation discovery, and this is where you believe you have a claim,
[01:20:08.480 --> 01:20:17.480]  but the proof that you need is being held by either the defendant or a third party.
[01:20:17.480 --> 01:20:27.480]  So in order to determine whether or not you have a claim, you want to depose that party rather than filing suit,
[01:20:27.480 --> 01:20:33.480]  and then after you get into court case under discovery, you find out that you didn't have a case to start with.
[01:20:33.480 --> 01:20:41.480]  So under judicial economy, every state has pre-litigation discovery statutes.
[01:20:41.480 --> 01:20:45.480]  That's my story and I'm sticking to it. Go ahead.
[01:20:45.480 --> 01:20:49.480]  Yeah, no, that's the perfect explanation, much better than I could do it.
[01:20:49.480 --> 01:20:59.480]  But anyway, so that's what everybody needs to start doing is going and asking for video deposition to these people
[01:20:59.480 --> 01:21:06.480]  and then get, you know, start with the court clerks and then move right down the code
[01:21:06.480 --> 01:21:15.480]  and walk down how they didn't, they violated, you know, just due process on each individual act of,
[01:21:15.480 --> 01:21:20.480]  did they do this according to the code, did they do that, blah, blah, blah,
[01:21:20.480 --> 01:21:28.480]  and then get this stuff on video deposition and then get these clerks to roll over on the prosecutors
[01:21:28.480 --> 01:21:34.480]  and the prosecutors do the same on judges and they'll all be just rolling around on each other.
[01:21:34.480 --> 01:21:40.480]  So if you can get that stuff on the video deposition, oh man, upload that to YouTube.
[01:21:40.480 --> 01:21:48.480]  That would be some good footage there. That's what I'm going to go for.

[01:21:55.480 --> 01:22:01.480]  That would be so intimidating for these guys, especially clerks
[01:22:01.480 --> 01:22:05.480]  because clerks are just doing what they were told to do.

[01:22:11.480 --> 01:22:16.480]  and they're going to roll over on the judge and the prosecutor.
[01:22:16.480 --> 01:22:20.480]  Which is perfect and that's what you want.
[01:22:20.480 --> 01:22:25.480]  Now, I had a really smart mouth clerk in Hazel, Texas. I generally don't mess with the clerks,
[01:22:25.480 --> 01:22:31.480]  but this one was a really smart mouth, super attitude. So I asked her some records
[01:22:31.480 --> 01:22:38.480]  and she gave me a hard time about it. So I turned around and this sergeant had kind of eased up behind me
[01:22:38.480 --> 01:22:42.480]  and I said, sergeant, did you hear what she just said? Yes, Mr. Cowden, I did.
[01:22:42.480 --> 01:22:47.480]  Arrest that woman. Why can't you arrest her? Of course you can.
[01:22:47.480 --> 01:22:50.480]  Just go in there and throw the cuffs over and drag her off the jail.
[01:22:50.480 --> 01:22:55.480]  Me and the sergeant had this back and forth. All of a sudden the sergeant wasn't near his air gun
[01:22:55.480 --> 01:23:01.480]  as he started out to be. The next time I come in, there's a different clerk.
[01:23:01.480 --> 01:23:08.480]  And the judge, I was talking to the judge and he said, Mr. Carlson, can I ask you a favor?
[01:23:08.480 --> 01:23:15.480]  I said, well, sure. He was a really nice guy. I really liked Judge Hedman.
[01:23:15.480 --> 01:23:21.480]  He was a pleasant human being. He said, well, you're not mess with my clerks.
[01:23:21.480 --> 01:23:26.480]  Oh, you heard about that, huh? Heard about it. She came in my office and said,
[01:23:26.480 --> 01:23:31.480]  I don't have to put up with this crap and quit.
[01:23:31.480 --> 01:23:36.480]  Oh, well, well, that hurts my feelings.
[01:23:36.480 --> 01:23:42.480]  He said, well, she was. She was kind of difficult.
[01:23:42.480 --> 01:23:49.480]  But they're not used to suffering consequences of what they're doing to people.
[01:23:49.480 --> 01:23:56.480]  And when you charge the clerk criminally with or even imply that you're going to
[01:23:56.480 --> 01:24:07.480]  for doing what the judge told her to do for him, they're going to roll over on the judge immediately.
[01:24:07.480 --> 01:24:15.480]  Yeah, it's going to be beautiful, too. And especially, you know, what surgery charges are
[01:24:15.480 --> 01:24:22.480]  and what official oppression charges are. Do they understand what these charges are?
[01:24:22.480 --> 01:24:29.480]  And, you know, who gave you the authority not to do that? The judge will, you know,
[01:24:29.480 --> 01:24:33.480]  so you still don't have the authority to be doing that. You can violate his law.
[01:24:33.480 --> 01:24:38.480]  You do understand, oh, man, just go down a list with Lindy a question.
[01:24:38.480 --> 01:24:47.480]  And, oh, golly, it was just brutal. Especially if he just got him just balling.
[01:24:47.480 --> 01:24:53.480]  You seem to think you're going to have way too much fun with this.
[01:24:53.480 --> 01:24:55.480]  Oh, that was a goalie.
[01:24:55.480 --> 01:25:02.480]  And that's the way it ought to be. They're accustomed to putting people in these kinds of situations.
[01:25:02.480 --> 01:25:09.480]  It's good to put them back. And they get to get them in the same kind of situations
[01:25:09.480 --> 01:25:14.480]  they're putting everybody else in. I don't see anything unfair about it.
[01:25:14.480 --> 01:25:19.480]  No, it's just exposing, you know, what the actual process is.
[01:25:19.480 --> 01:25:22.480]  And, you know, that's the only way to get these things changed.
[01:25:22.480 --> 01:25:27.480]  And if it's going to change, it's going to have to start with us making it happen.
[01:25:27.480 --> 01:25:32.480]  So, you know, taking these, I mean, this is perfect because this case coming up,
[01:25:32.480 --> 01:25:36.480]  this judge railroaded the limits, not out of all these motions.
[01:25:36.480 --> 01:25:41.480]  He had a flurry of motions of everything under the sun.
[01:25:41.480 --> 01:25:46.480]  And, you know, I don't even think he really read it, but he did not.
[01:25:46.480 --> 01:25:49.480]  He at least turned to the back page to find a couple of them.
[01:25:49.480 --> 01:25:52.480]  A couple of them, you know, probably three or four.
[01:25:52.480 --> 01:25:55.480]  I got to go on. I got about five or six in there now.
[01:25:55.480 --> 01:26:01.480]  I have a few more when I step in there and then put a perfect lawsuit
[01:26:01.480 --> 01:26:07.480]  because they violated due process, you know, never taken to a magistrate.
[01:26:07.480 --> 01:26:13.480]  So, their total, that's what this whole deposition is about,
[01:26:13.480 --> 01:26:18.480]  to get them to a bid that they violated due process.
[01:26:18.480 --> 01:26:23.480]  And then that just sets them up for this 42 and just knocks them right out
[01:26:23.480 --> 01:26:27.480]  in federal court.
[01:26:27.480 --> 01:26:36.480]  Yeah, you get to ask them if the judge, when the judge first received these motions.
[01:26:36.480 --> 01:26:41.480]  It's always going to be just before they go into the courtroom.
[01:26:41.480 --> 01:26:45.480]  You get the clerk to tell him that, then he came into the courtroom
[01:26:45.480 --> 01:26:48.480]  and just handed these motions and did not read them.
[01:26:48.480 --> 01:26:54.480]  I was in a court case near McKinney,
[01:26:54.480 --> 01:27:00.480]  and I filed a challenge subject matter jurisdiction when I got there
[01:27:00.480 --> 01:27:02.480]  and the judge did not.
[01:27:02.480 --> 01:27:07.480]  I said, Your Honor, you know, he complained that I just filed it that morning.
[01:27:07.480 --> 01:27:11.480]  I said, Your Honor, did you read that motion?
[01:27:11.480 --> 01:27:14.480]  Well, Mr. Kaufman, this is over 30 pages.
[01:27:14.480 --> 01:27:18.480]  Yes, I'm aware of that, Your Honor, I wrote it.
[01:27:18.480 --> 01:27:20.480]  But did you read it?
[01:27:20.480 --> 01:27:22.480]  Ms. Calton, I don't have time to read this.

[01:28:23.480 --> 01:28:26.480]  and hang out on that while I don't know what happened there.

[01:37:36.480 --> 01:37:48.480]  And it seems I forgot that I had did a 552 request, May 29th, 2016, and they failed to answer it.
[01:37:48.480 --> 01:37:58.480]  And I said, oh, you need to be more specific.
[01:37:58.480 --> 01:38:09.480]  And I said, no, you just need to answer what was in the request.
[01:38:09.480 --> 01:38:19.480]  And so I went back and I guess I grieved them again or something.
[01:38:19.480 --> 01:38:30.480]  And so now they wrote back that public attorney, John Thatcher, he said, well, we're trying to figure out exactly what you wanted because you didn't specify the first time.
[01:38:30.480 --> 01:38:50.480]  So we're going to charge you $255 for this information request, and it was for their authority to enforce the transportation code, which I already know that they don't have an officer that can enforce the transportation code via the Texas Department of Transportation.
[01:38:50.480 --> 01:39:01.480]  So I wrote up a criminal complaint on it so I could bar grieve him, so I immediately set out, just took him about 15 minutes to top that up.
[01:39:01.480 --> 01:39:06.480]  So talk about just going right after a bar grieve and to crud out of these people.
[01:39:06.480 --> 01:39:09.480]  I mean, it's like, yeah, you get a criminal complaint.
[01:39:09.480 --> 01:39:13.480]  It starts at $255 on something you don't even have.
[01:39:13.480 --> 01:39:20.480]  Yeah, $255.
[01:39:20.480 --> 01:39:31.480]  We have a case here in Newark, Texas, where they tried to charge, I forgot how much.
[01:39:31.480 --> 01:39:42.480]  There's quite a bit of money for some information requests, but he had these, this couple had entered a whole bunch of information requests.
[01:39:42.480 --> 01:39:51.480]  And they were calculating all of the time they spent responding to these requests.
[01:39:51.480 --> 01:40:06.480]  And he filed a complaint with the State Attorney General, and the Attorney General sent back a scathing letter wanting to know how they came by these calculations.
[01:40:06.480 --> 01:40:09.480]  How did you get these numbers?
[01:40:09.480 --> 01:40:13.480]  It was several thousand dollars they were asking for.
[01:40:13.480 --> 01:40:20.480]  And the questions from the Attorney General was real pointed.
[01:40:20.480 --> 01:40:35.480]  So the Attorney General sometimes it does respond when they're acting really outrageous, but everybody forgets that a 552 government code is not a civil statute.
[01:40:35.480 --> 01:40:40.480]  They say, well, if you know what we did, you can file a suit.
[01:40:40.480 --> 01:40:42.480]  Yeah, we can do that.
[01:40:42.480 --> 01:40:51.480]  But 552.353 says the violation of this code is official misconduct class A misdemeanor.
[01:40:51.480 --> 01:40:53.480]  It's a criminal statute.
[01:40:53.480 --> 01:40:55.480]  It's not a civil statute.
[01:40:55.480 --> 01:40:58.480]  So first thing we do is file a criminal complaint.
[01:40:58.480 --> 01:41:05.480]  I'm in Wise County, Texas, and I got a ticket.
[01:41:05.480 --> 01:41:07.480]  The policeman went back to write the ticket.
[01:41:07.480 --> 01:41:11.480]  I called 911 and asked for an officer to arrest him.
[01:41:11.480 --> 01:41:16.480]  Well, I canceled the officer to arrest him because I didn't want to sit there and wait two or three more hours.
[01:41:16.480 --> 01:41:26.480]  So I went to the Sheriff's Department when I printed out all my ticket documents and I took the complaint to the local magistrate.
[01:41:26.480 --> 01:41:37.480]  Now I'm going to, since the magistrate hasn't done anything, now I'm going to go to another magistrate and file suit against the first magistrate.
[01:41:37.480 --> 01:41:41.480]  Oh, this is criminal charges against the first magistrate.
[01:41:41.480 --> 01:41:47.480]  Oh, this is going to be so much fun.
[01:41:47.480 --> 01:41:57.480]  This is glad to see you back because he's providing me a bar grieving now for several things, so I'll appreciate him responding back a year later. I appreciate it.

[01:42:02.480 --> 01:42:06.480]  So I wonder why he responded a year later.

[01:42:24.480 --> 01:42:37.480]  And, you know, it was the standard one where several cities, you know, admitted they had no authority to enforce the transportation code, but they just didn't want to give the information up.
[01:42:37.480 --> 01:42:44.480]  And there were several cities that's doing that. They just refused to answer the copy to the request.
[01:42:44.480 --> 01:42:54.480]  And so then you just get to file more criminal charges on them, you know, because, hey, they're just sitting there violating, you know, their own code.
[01:42:54.480 --> 01:42:55.480]  So that's fine.
[01:42:55.480 --> 01:42:56.480]  Okay.
[01:42:56.480 --> 01:43:00.480]  You can say a year later I have to hammer him on this.
[01:43:00.480 --> 01:43:15.480]  I need to get a those complaint forms online. That's one of the things I've been trying to get to where you can go online and fill out a little form and it will spit you out the complaints.

[01:43:18.480 --> 01:43:21.480]  And this is one I definitely want to get done.
[01:43:21.480 --> 01:43:35.480]  And if you sue them, I want the suit. I want to see your your case law and I'll do some of my own and we'll get a standard suit put together so we can start filing suit against these guys.

[01:48:29.480 --> 01:48:39.480]  And I got temporary orders with at least some visitation, but I've seen my child this year about maybe four or five hours.
[01:48:39.480 --> 01:48:45.480]  And they have violated everything you've ever talked about in your show. You name it, they've done it.
[01:48:45.480 --> 01:48:51.480]  Ignored my motions, pleadings, everything.
[01:48:51.480 --> 01:49:01.480]  And the whole thing was supposed to be over June the 1st and I've fought them and fought them with so many things that I've pushed it to the end of next month.
[01:49:01.480 --> 01:49:05.480]  But you know, I'm out of my league.
[01:49:05.480 --> 01:49:09.480]  Have you filed against them?
[01:49:09.480 --> 01:49:25.480]  Not against the court, the judges, but I've got to get to all of them, but I do have the judges certified oath of office for all four terms that she's in.
[01:49:25.480 --> 01:49:31.480]  And I see some problems there. And of course, every constitutional right I've gots been violated.
[01:49:31.480 --> 01:49:39.480]  You need to start violating, if they violate one of your rights, that's a crime in Texas.

[01:49:41.480 --> 01:49:47.480]  What I was doing until I found your show, I didn't find your show till about three weeks ago or four.

[01:50:15.480 --> 01:50:25.480]  $10,000 of that up front. And I said, okay. And he said that, you know, it'd probably take 30 or more if we had to go to appeals.
[01:50:25.480 --> 01:50:31.480]  I went, okay. And then basically what we were shooting for was what I already had.
[01:50:31.480 --> 01:50:37.480]  I thought, okay, so I'm going to spend $30,000 or $40,000 and we're going to break even.
[01:50:37.480 --> 01:50:41.480]  Okay.
[01:50:41.480 --> 01:50:43.480]  Or she'll get more child support than anything else.
[01:50:43.480 --> 01:50:49.480]  And, you know, the other guy's never missed a year, never missed a single payment child support or anything else.
[01:50:49.480 --> 01:50:57.480]  But, you know, the motive is entirely different than what has been placed before the court.
[01:50:57.480 --> 01:51:17.480]  So the judge has never listened to a single thing I've said. The only time she's ever, even in hearing, mentioned anything I filed is to tell me I was frivolous and tell me I need to pay $600 worth of attorney fees for my FYI, which has not happened.
[01:51:17.480 --> 01:51:27.480]  And my retaliation to that was, well, you know what, Judge, child support is voluntary and I'm not volunteering any longer. I'm not financing this deal.
[01:51:27.480 --> 01:51:31.480]  So we've had our differences.
[01:51:31.480 --> 01:51:47.480]  Well, have you started filing against the judge for failing to perform a duty she's required to perform and in the process denying you and the pulmonary access to her enjoyment of a right.
[01:51:47.480 --> 01:51:51.480]  That's class A, Mr. Beater in Texas.
[01:51:51.480 --> 01:51:57.480]  These judges say, well, if you're not like my root and you can appeal to the court of appeals.
[01:51:57.480 --> 01:52:05.480]  And I told Judge Bob Perkins, I have a better idea. I'll appeal to the grand jury.
[01:52:05.480 --> 01:52:07.480]  Refacial oppression.
[01:52:07.480 --> 01:52:21.480]  You might, I've got, I've got all kinds of stuff on it. It's the court clerk, the bailiff, the judge, and the opposing attorney, even before the last hearing.
[01:52:21.480 --> 01:52:29.480]  After the restroom approached some people that were sitting with me and talked to them and I haven't pushed that very much.
[01:52:29.480 --> 01:52:33.480]  But I don't know what he said to them, but they wouldn't even come back the next year.
[01:52:33.480 --> 01:52:39.480]  And they may be, you know, it's witness tampering.
[01:52:39.480 --> 01:52:41.480]  Were they witnesses?
[01:52:41.480 --> 01:52:45.480]  Wait, wait, have you, have you barged with this lawyer?

[01:54:19.480 --> 01:54:23.480]  I've got a litigants hat and I've got a masters hat.
[01:54:23.480 --> 01:54:35.480]  When I go in, I'm wearing my litigants hat. When one of my public servants steps half an inch across one of my legal lines, I take off that litigants hat.
[01:54:35.480 --> 01:54:39.480]  I put on that masters hat and we fight.
[01:54:39.480 --> 01:54:49.480]  I hold them to the same law they claim to hold me to and they really, really don't like it.
[01:54:49.480 --> 01:55:03.480]  But there's not much they can do about it because once I've filed on them, if anybody says one word to me that I can in any way construe as a threat,
[01:55:03.480 --> 01:55:21.480]  then witness tampering obstruction of justice and what I like to do is go in and file a minor piddly noodle complaint with the magistrate or the police and get them not to act on it.
[01:55:21.480 --> 01:55:30.480]  And then I file a complaint against whoever I filed the first complaint with and work my way up to the district judge.
[01:55:30.480 --> 01:55:37.480]  Once I got the district judge refusing to take my complaint, then I file one against him.
[01:55:37.480 --> 01:55:53.480]  Once you filed against the district judge, if anybody says anything to you that you can in any way construe as a threat, you accuse the judge of sending them to do that.
[01:55:53.480 --> 01:56:07.480]  And when you file against the judge for retaliation and the judge didn't do anything, the judge is going to go ballistic, but not at you.
[01:56:07.480 --> 01:56:12.480]  That whoever did that, you poisoned their well.
[01:56:12.480 --> 01:56:15.480]  Same thing they try to do to you.
[01:56:15.480 --> 01:56:24.480]  So you've been in the fight for a while, sit down and write down a timeline.
[01:56:24.480 --> 01:56:31.480]  Just no explanation just on this day this happened and this happened and this happened and this happened.
[01:56:31.480 --> 01:56:33.480]  Get a timeline down.
[01:56:33.480 --> 01:56:37.480]  Once you've got the timeline down, now go back and look at it.
[01:56:37.480 --> 01:56:44.480]  And if you've been studying the law, you pretty well know what they're supposed to do.
[01:56:44.480 --> 01:56:50.480]  At any time they fail to do something they're supposed to do, mark the date they did it.
[01:56:50.480 --> 01:56:56.480]  Once you've got all these marked out, you'll have more criminal complaints against them than you can get to.
[01:56:56.480 --> 01:57:09.480]  So now you want to look at them and pick the criminal complaints you can make that tends to lend itself to a really ugly story.
[01:57:09.480 --> 01:57:14.480]  And then go back to the beginning and start filing them one at a time.
[01:57:14.480 --> 01:57:17.480]  First one, second one, third one.
[01:57:17.480 --> 01:57:30.480]  You file them with the police or sheriff's department and then you contact the nearest magistrate and ask them when they're going to hold an examining trial on this complaint.
[01:57:30.480 --> 01:57:33.480]  They're going to say, we don't know what you're talking about.
[01:57:33.480 --> 01:57:46.480]  So when you don't find a magistrate that has been presented with the complaint, then you file against the police officer for not giving it to the magistrate with the magistrate.
[01:57:46.480 --> 01:57:54.480]  And when the magistrate refuses to act on it, then you file against that magistrate with a county judge and then a district judge.
[01:57:54.480 --> 01:58:09.480]  And then you take the complaint against the district judge to the district attorney and when the district attorney refuses to act on it, then you send a complaint to the district attorney's address addressed to the grand jury.
[01:58:09.480 --> 01:58:19.480]  It's a little more complex than that, but you send the letter to the grand jury against the district attorney for not acting on your first complaint.
[01:58:19.480 --> 01:58:30.480]  Because 2.03 commands the district attorney and when he's made known that the crime has been committed by a public official, he has to give it to the grand jury, no discretion.
[01:58:30.480 --> 01:58:35.480]  Then when you file against him and he opens it, now you got it.
[01:58:35.480 --> 01:58:37.480]  Now he knows he's been set up.
[01:58:37.480 --> 01:58:38.480]  Hang on.
