[04:00.920 --> 04:08.160] public officials, you're in the 11th circuit, Smith v. City of Cummings, 212, Federal 3D,
[04:08.160 --> 04:22.320] 132, so the court denied you in your right acting under the color of an official capacity.
[04:22.320 --> 04:27.160] I told the court just recently, they said no cell phones in the courtroom.

[06:47.040 --> 06:51.480] the jury has to understand this is a public duty.

[06:55.800 --> 07:02.920] This is public and the forum itself is intended to be public and then your circuit has ruled
[07:02.920 --> 07:09.920] that it is public, screws the U.S.
[07:09.920 --> 07:19.280] It talks about a public official who acts in defiance of rulings of this court, knows

[07:23.080 --> 07:28.000] If he be sane, he may not be heard to say he knows not what he does.
[07:28.000 --> 07:36.280] So you must presume that the judge knows full well that what he's doing is wrongful and
[07:36.280 --> 07:45.920] improper and he's acting with mens reyes of all people who cannot claim ignorance.

[07:49.280 --> 07:57.920] So steam, they're charging you with having a ball tire on your trailer and a chain loose.
[07:57.920 --> 08:04.800] You charge them with class A misdemeanor official oppression or official misconduct, which

[12:36.680 --> 12:43.000] They really don't want records because the judge sometimes says stupid stuff and he doesn't

[12:50.920 --> 12:59.600] I was going into a traffic court hearing and this was Austin, so it's a court of record

[14:30.080 --> 14:40.320] That sort of puts me in a bit of a predicament because I need the recorder, actually before
[14:40.320 --> 14:48.920] the motion hearing, or as it starts, and they're not going to want me to have that recording

[15:23.280 --> 15:34.040] When he denies it, then you file an interlocutory appeal on the denial or petition the Court
[15:34.040 --> 15:39.360] of Appeals for a writ of mandamus ordering him to act in accordance with the Eleventh
[15:39.360 --> 15:53.320] Circuit ruling and move the Eleventh Circuit, move the appeals court to order a stay in
[15:53.320 --> 16:01.440] the proceedings until they can rule on your appeal.
[16:01.440 --> 16:10.640] The court is not going to want to let this ruling get put in place to stop every judge
[16:10.640 --> 16:13.640] in the state.
[16:13.640 --> 16:18.440] What's going to happen is the Court of Appeals is going to go to this judge and say, unless
[16:18.440 --> 16:26.240] you want us to render a ruling that coincides with the Eleventh Circuit's ruling, you better
[16:26.240 --> 16:29.960] do something.

[21:35.160 --> 21:49.000] card toting attorneys, and so I'm thinking after my first motion on jurisdiction that
[21:49.000 --> 21:55.320] I'm going to ask for assistance of council at that point.
[21:55.320 --> 21:58.440] I think that's a good idea.
[21:58.440 --> 22:04.520] Have all the motions and pleadings in that you want before the court, before you get
[22:04.520 --> 22:05.520] the lawyer.
[22:05.520 --> 22:13.400] Once you get the lawyer, then he inherits all these motions or pleadings, and if he
[22:13.400 --> 22:18.520] tries to, you know, what I told my lawyer, he's telling me, you know, they appointed
[22:18.520 --> 22:23.720] me one when I didn't want one, but they wanted to appoint me once, so knock yourself out.
[22:23.720 --> 22:28.840] Just make sure you appoint one you really don't like, and the judge kind of laughs at
[22:28.840 --> 22:33.720] what we've got at Attorney's Wheel, you get the next one off the wheel, and so you're

[22:34.720 --> 22:41.480] So yeah, so the first thing the lawyer's telling me is this is how it's going to go.

[23:21.240 --> 23:27.320] And the lawyer went white, he just looked at me and I know what he's thinking, this
[23:27.320 --> 23:30.920] guy's going to get me disbored.
[23:30.920 --> 23:37.360] During the course of his representation of me, he told me that 20 times if he told me
[23:37.360 --> 23:45.760] that once, and I told him I've got a number of motion and pleadings before the court,
[23:45.760 --> 23:51.160] you will adequately adjudicate every element of every one of them.
[23:51.160 --> 23:58.640] You failed to adequately adjudicate a single one, I'll file a bar grievance against you.
[23:58.640 --> 24:01.240] Mr. Kelton, you would grieve me?

[24:06.440 --> 24:12.880] They wound up dismissing my case to protect my lawyer from me.

[38:29.400 --> 38:37.600] I have a business that's licensed by the State of New Mexico, and the department that oversees
[38:37.600 --> 38:46.280] the licensing for my business requires an annual license renewal, which we do, and a
[38:46.280 --> 38:50.760] surety bond as part of that.
[38:50.760 --> 38:59.680] And the surety bond, according to the statute, has to be between the minimum of $5,000 and
[38:59.680 --> 39:08.480] a maximum of 20% of the company's total New Mexico earnings.
[39:08.480 --> 39:15.920] So there's a range in there that's certified or laid out in the statute, and in the statute
[39:15.920 --> 39:24.360] it also says that the surety bond gets to be determined by the department, but the department
[39:24.360 --> 39:31.360] has to take into account factors that pertain to the business, right, the annual income,
[39:31.360 --> 39:36.320] the number of, you know, there's a whole list of things.
[39:36.320 --> 39:44.920] And all of those things listed are items that relate to a business, not to anything else,
[39:44.920 --> 39:45.920] right, specifically.
[39:45.920 --> 39:52.280] And every business is going to have different numbers for those items.
[39:52.280 --> 39:57.160] So we've got the surety bond, and I got a letter from that department, the director
[39:57.160 --> 40:04.960] of the department, telling me that they decided to raise everybody's surety bond who gets
[40:04.960 --> 40:14.760] licensed by that department to 20% because of things that are happening around the country.
[40:14.760 --> 40:23.040] Wait a minute, who heads up the department that made this determination?
[40:23.040 --> 40:26.200] There's the secretary.
[40:26.200 --> 40:33.720] Do a request for complete financial on the secretary, the secretary's children, and any
[40:33.720 --> 40:41.240] companies the secretary has an interest in.
[40:41.240 --> 40:54.440] We have had a guest on Saturdays a week ago at Janet Palin, she's a journalist, and she's
[40:54.440 --> 41:02.640] investigating how judges launder their payoff money.
[41:02.640 --> 41:08.840] And they launder it by getting mortgages on their house to get large mortgages, and the
[41:08.840 --> 41:12.920] mortgage you paid off in six months, and then get another mortgage, and it's paid off in
[41:12.920 --> 41:14.920] six months.
[41:14.920 --> 41:19.240] And what the indication was that the judge was not paying off these mortgages, that he's
[41:19.240 --> 41:23.480] getting the mortgage and drawing the equity out of the property, somebody else is paying
[41:23.480 --> 41:29.960] it back and it launder the payoff money.
[41:29.960 --> 41:39.280] So at the end of the day, you know, something doesn't look right here, why would an agency
[41:39.280 --> 41:47.040] all of a sudden arbitrarily and capriciously demand of all of these companies a maximum
[41:47.040 --> 41:50.240] allowable bond?
[41:50.240 --> 41:56.000] It sure sounds like someone in background is profiting from that.
[41:56.000 --> 42:08.440] And you want to know if all any member of the board is invested in a company that will
[42:08.440 --> 42:24.680] profit by providing these bonds, whether they're dirty or not, perception is everything.
[42:24.680 --> 42:29.680] When you start looking into their finances, they're going to get real excited.
[42:29.680 --> 42:30.680] Excellent.
[42:30.680 --> 42:37.320] Yeah, it doesn't always matter if you find something, you just make it look like you
[42:37.320 --> 42:38.320] might.

[51:27.800 --> 51:35.000] And the general counsel basically starts off her letter to me by telling me I can't file
[51:35.000 --> 51:39.880] criminal complaints, but I'm not, I don't have jurisdiction to do it because I'm not
[51:39.880 --> 51:45.200] a law enforcement on and on and on.
[51:45.200 --> 51:53.400] And then she's waiting, wait a minute, say this, this is general counsel for who?
[51:53.400 --> 51:59.280] For the department, the entire, so she, the secretary of the department, the cabinet secretary
