[06:56.680 --> 06:59.680]  How could anybody write it this way?
[06:59.680 --> 07:06.680]  Why would they write a set of code and not let police officers enforce it?
[07:06.680 --> 07:13.680]  Well, it took some work and understanding to figure out how this came about.
[07:13.680 --> 07:19.680]  This came about as a professional conduct code.
[07:19.680 --> 07:30.680]  The original transportation code and the code as it stands today is a professional conduct code, like the Bar Association standards.
[07:30.680 --> 07:42.680]  And like standards for doctors and private investigators and plumbers and electricians, it's a professional conduct code.
[07:42.680 --> 08:06.680]  The state police of most states was, like the state of Texas, was created for the singular and express purpose of enforcing the professional conduct code of the Texas Transportation Code.
[08:06.680 --> 08:17.680]  It was a professional conduct code and it was only created to enforce against people who use the highways to make a living on.
[08:17.680 --> 08:26.680]  Because it was patently legal to try to license a right.
[08:26.680 --> 08:36.680]  So they licensed the professional drivers and they put the Department of Public Safety out there enforcing the traffic laws against professional drivers.
[08:36.680 --> 08:53.680]  And it was around the time of, just after World War II, that we're getting a lot of people killed on the highway, that they began to push the states to educate drivers.
[08:53.680 --> 09:01.680]  And this is when they put in requirements that everybody have a professional license.
[09:01.680 --> 09:14.680]  It was illegal, but they can require you to have it, but they can't hold you in commerce when you're not.
[09:14.680 --> 09:24.680]  But not getting to the right to travel issue, they created the state police to enforce this code.
[09:24.680 --> 09:27.680]  And in Texas, that's exactly what they did.
[09:27.680 --> 09:46.680]  And the enacting clauses in the Texas Ministry of Code says that the Department of Public Safety shall not enforce the criminal laws except at the direction of and under the, at the request of and under the direction of local law enforcement.
[09:46.680 --> 09:59.680]  Local law enforcement were peace officers. They were trained and employed to enforce the penal code, not a professional conduct code. That was the DPS's job.
[09:59.680 --> 10:11.680]  But they did say that a county commissioners court could appoint five sheriff's deputies to enforce the transportation code.
[10:11.680 --> 10:16.680]  They had to do it on motorcycles. And it's right there in the code requires it.
[10:16.680 --> 10:28.680]  That is the only authorization in the code for anyone other than the Department of Public Safety to generally enforce the transportation code.
[10:28.680 --> 10:45.680]  Now, there is a section, Texas Administrative Code 4.13, 4.14. They are, they allow the sheriff to appoint one of those five deputies.
[10:45.680 --> 10:51.680]  Instead of a deputy, he can appoint a municipal police officer.
[10:51.680 --> 11:01.680]  But that municipal police officer can't generally enforce the code. All he can do is stop trucks and do DOT inspections.
[11:01.680 --> 11:15.680]  And at that time, he can cite for DOT violations. That is it. That is the only authorization for municipality to enforce anything having to do with transportation code.
[11:15.680 --> 11:29.680]  Well, they just started doing it. And nobody raised an objection. The city's made a lot of money and politics is all about the money.
[11:29.680 --> 11:37.680]  And so politicians are not going to raise an issue that generates revenues that politicians can spend.
[11:37.680 --> 11:54.680]  So the guys who are working for the government now, the policemen, the clerks, the local judges, things have been done this way their entire life, especially their entire professional career.
[11:54.680 --> 12:01.680]  Everybody's been doing it this way. Nobody's raised an issue. So everybody thinks it's okay.
[12:01.680 --> 12:08.680]  Well, it's not okay. It's illegal. And we've set up this site.
[12:08.680 --> 12:18.680]  The first thing we do is we address subject matter jurisdiction and the authority of the department to enforce.
[12:18.680 --> 12:27.680]  And we start out with a bunch of standard documents that you would file in any criminal case and in limited emotion.
[12:27.680 --> 12:35.680]  That's a list of all the questions they can't answer. I'm sorry. That's a list of all the questions they can't ask.
[12:35.680 --> 12:42.680]  A great emotion or discovery motion. Both of those are pretty big documents.
[12:42.680 --> 12:47.680]  We have a challenge to subject matter jurisdiction and a bunch of other documents.
[12:47.680 --> 12:57.680]  We have a document that gives notice to the court of the preservation of all your rights because the courts will presume that if you don't claim a right, you wave it.
[12:57.680 --> 13:01.680]  So we claim every one of them right up front.
[13:01.680 --> 13:13.680]  And hidden in the middle there are a couple of information requests that go to the policing agency that hired the officer who wrote the citation.
[13:13.680 --> 13:21.680]  They request authorization to enforce the Texas Transportation Code.
[13:21.680 --> 13:26.680]  Well, they have a problem because they don't have it.
[13:26.680 --> 13:36.680]  So they can't find it. And we consistently are getting response from those information requests that all say the same thing.
[13:36.680 --> 13:41.680]  We have no records responsive to your request.
[13:41.680 --> 13:46.680]  Now, when I first got those, I thought that was odd.
[13:46.680 --> 13:59.680]  But I was assuming that the information requests went to the lawyer for the city and that that lawyer for the city was also the prosecuting attorney.
[13:59.680 --> 14:02.680]  And that's not necessarily so.
[14:02.680 --> 14:08.680]  We have city attorneys if it appears and we have prosecuting attorneys.
[14:08.680 --> 14:14.680]  The city attorneys have won the skittiness and they don't really realize what they're doing.
[14:14.680 --> 14:20.680]  They look through their records and they don't find anything responsive to the question that I'm asking.
[14:20.680 --> 14:29.680]  So they tell me that what they're not realizing is they're giving me collateral estoppel.
[14:29.680 --> 14:41.680]  The city is taking the position that they have no documentation showing that their officers are authorized to enforce the Transportation Code.
[14:41.680 --> 14:46.680]  Now, I don't care if they're authorized to or not.
[14:46.680 --> 14:58.680]  Once the attorney for the city responds to a government document with a statement that says they have no documentation,
[14:58.680 --> 15:01.680]  then that goes to collateral estoppel.
[15:01.680 --> 15:05.680]  You come into a court and you take a position.
[15:05.680 --> 15:14.680]  You cannot subsequently come into court on the same fact set and take a diametrically opposed position.
[15:14.680 --> 15:17.680]  You're collateral estopped from that.
[15:17.680 --> 15:20.680]  So they're giving us collateral estoppel.
[15:20.680 --> 15:27.680]  Now, we know that the local trial courts could care less what the law is.
[15:27.680 --> 15:31.680]  They're going to do what they want to because it's about making money.
[15:31.680 --> 15:33.680]  They don't care about the law.
[15:33.680 --> 15:38.680]  So we need a political way to get at them.
[15:38.680 --> 15:45.680]  You know, all this time I've been saying how you never win your case simply because you have the law and the facts on your side.
[15:45.680 --> 15:48.680]  You win your case if you have the politics on your side.
[15:48.680 --> 15:49.680]  So we're looking at the politics.
[15:49.680 --> 15:54.680]  Where can we generate a little local politics?
[15:54.680 --> 16:04.680]  The last document in the bunch is a professional conduct complaint against the police officer.
[16:04.680 --> 16:13.680]  And when that police officer gets a professional conduct against him, he's going to go apoplectic and go to his boss and say,
[16:13.680 --> 16:14.680]  what the heck is going on here?
[16:14.680 --> 16:16.680]  You sent me out here to write these tickets.
[16:16.680 --> 16:18.680]  I did everything the way I'm supposed to.
[16:18.680 --> 16:21.680]  These guys are going to end my career with these T-clothes complaints.
[16:21.680 --> 16:22.680]  I got six of those.
[16:22.680 --> 16:23.680]  I'm history.
[16:23.680 --> 16:25.680]  You want to write those tickets?
[16:25.680 --> 16:26.680]  You go write them.

[20:21.680 --> 20:29.680]  Now, of course, there's lots of radio stations and radio networks that have YouTube channels, but they're not posting the archives of the talk shows.

[20:36.680 --> 20:48.680]  Copyrighted commercial music, when you use it for the purpose of bumpers, which means that's what plays after the ad, you know, for a little bit before we come back on the air
[20:48.680 --> 20:55.680]  and we start talking over the music. And again, at the end of the segment, the musical kick in right before the ad starts, it's a buffer.
[20:55.680 --> 21:05.680]  It's what they call a bumper. It's the purpose for making a transition. You have to have it in talk radio because it doesn't really work to have dead air in between ads and talking.
[21:05.680 --> 21:16.680]  So it is legally fair use under intellectual property laws, but YouTube does not recognize that.
[21:16.680 --> 21:31.680]  And it is my theory. I can't prove it, but I think it's probably a 99 percenter that they do not recognize bumpers as fair use on purpose because they're owned by Google and they want to suppress free speech.
[21:31.680 --> 21:49.680]  YouTube and Google are well known notorious to filter out certain websites and searches and for suppressing free speech and banning videos for hate speech and whatnot when it's none of a sort.
[21:49.680 --> 22:01.680]  And so what ends up happening with the bumper music when you upload talk show archives is they'll flag it for copyright violations. Sometimes they'll ban the video altogether.
[22:01.680 --> 22:08.680]  Sometimes they'll be banned in certain countries. If it happens often enough, they'll just suspend your YouTube channel.
[22:08.680 --> 22:25.680]  And so it just makes it not worth anyone's while to try to upload the archives of talk shows to YouTube. And so that turns into a major stumbling block because it's a very well known platform and we can't get the information out.
[22:25.680 --> 22:32.680]  And there are a lot of people out there that they only get their information from YouTube. There's like YouTube heads out there and all they do is watch YouTube.
[22:32.680 --> 23:00.680]  They don't get on the Internet for Internet radio or anything else. So we have been very blessed by our Lord and Savior Christ, our God, to bring someone, a listener, a dedicated listener to us who is a professional web programmer who has spent the last year and a half of all of his free time on a volunteer basis to write scripting code
[23:00.680 --> 23:12.680]  to volley back and forth with YouTube's API to automatically remove the sections of the bumper music that YouTube's bots are complaining about.
[23:12.680 --> 23:23.680]  Each video has to go back and forth, back and forth, back and forth with YouTube probably a dozen times until our scripts have completely removed all these sections.
[23:23.680 --> 23:31.680]  A lot of times they'll flag sections of the music where the hosts are talking. So we can't just remove the bumper music where there's no talking.
[23:31.680 --> 23:40.680]  Sometimes we have to remove the intros and the outros that the hosts are doing in order to get YouTube's bots to stop complaining about the copyright.
[23:40.680 --> 24:04.680]  So it is finally finished. It's finally complete. To my knowledge, we're the only talk radio network that has ever done such a thing because this is what it's taken. It's taken somebody who's a very high level, very sophisticated, top quality, top of the industry programmer to write a year and a half to write scripting code to do this.
[24:04.680 --> 24:17.680]  And so I'm super excited that we are able to get this YouTube channel up. And, you know, folks, we could have just done this without all the scripting, but then, you know, a lot of the videos may not have been available.
[24:17.680 --> 24:26.680]  And the other main problem with that is just blowing off the copyright issues is that I can't monetize the channel.
[24:26.680 --> 24:34.680]  We're already bending over backwards for our listeners to give them as much information as we can for free.
[24:34.680 --> 24:47.680]  And even like watching these YouTube videos, if it's, you know, once the channel's monetized, it's still not going to cost the listener anything, but it sure would cost us in time and effort to upload all these videos, and then we would get no return.
[24:47.680 --> 24:59.680]  And so people can download the MP3 archives already for free. They can listen to the live shows for free. We answer questions on the air for free. We're donating so much of our time and resources already.
[24:59.680 --> 25:12.680]  Folks, we have to get some return. We've got to get something back. We can't broadcast radio shows with tin cans and strings, okay, which seems like some months it's about what it's starting to come down to.
[25:12.680 --> 25:27.680]  We've been running this fundraiser since January, and I was hoping we could reach our goal within a couple of months so that I could actually have a significant amount of cash in hand to purchase equipment and do legitimate upgrades that are really necessary.
[25:27.680 --> 25:38.680]  But what's been happening is that the fundraiser funds are just kind of trickling in. And it's kind of like, I gave this example on the air the other night, say you want to buy a piece of equipment that costs $1,200.
[25:38.680 --> 25:52.680]  Well, if you have to get $100 a month and save up your money for a year, it's like you never see the money, you know, and it ends up getting spent on internet bills and electric bills and things like this.

[34:28.680 --> 34:37.680]  Good evening, Randy. I've got a question about whether you think there's something that can be done about a judge
[34:37.680 --> 34:47.680]  who is helping the prosecutor just way too much instead of being the non-interested third party,
[34:47.680 --> 34:54.680]  even telling her what witnesses to subpoena and things like that.
[34:54.680 --> 35:03.680]  That is one thing. What kind of case, what kind, what level of case is it?
[35:03.680 --> 35:06.680]  Traffic, county, district.
[35:06.680 --> 35:15.680]  It is traffic in the Superior Court of Motion for a Jury trial.
[35:15.680 --> 35:20.680]  And so it's been moved up to the Superior Court.
[35:20.680 --> 35:26.680]  So this is an elected, higher level judge. This is not like a JP or something.
[35:26.680 --> 35:28.680]  That's correct.
[35:28.680 --> 35:34.680]  Have you barged, have you judicial conduct filed a complaint against her judicial conduct?
[35:34.680 --> 35:43.680]  I have, yes, I have barged the prosecutor probably about seven times now.
[35:43.680 --> 35:55.680]  And the judge, I have filed a motion to recuse and a judicial conduct complaint on due process violations,
[35:55.680 --> 36:01.680]  which, that leads to another question, which I'll get to later.
[36:01.680 --> 36:07.680]  There may be another reason. One of the things we had Janet Palin on recently,
[36:07.680 --> 36:13.680]  and she talked about how judges are getting paid off.
[36:13.680 --> 36:21.680]  And in listening to her, I got an idea of how to apply more pressure to the judge.
[36:21.680 --> 36:24.680]  At the end of the day, everything is political.
[36:24.680 --> 36:38.680]  So do you know whether or not the judge has a financial interest in the fines and fees that she will assess?
[36:38.680 --> 36:43.680]  I do not know. I've heard lots of stories about that, but I do not know for sure.
[36:43.680 --> 36:56.680]  You might request a complete financial accounting of the judge and the judge's children.
[36:56.680 --> 37:06.680]  That won't make the judge happy, and that will tell the judge that you're looking for dirt under her carpet or his carpet.
[37:06.680 --> 37:09.680]  Not much he can do about it. He just knows you're looking.
[37:09.680 --> 37:16.680]  Even if the judge is clean, he knows that perception is everything.
[37:16.680 --> 37:22.680]  The very fact that you ask for it points a finger at the judge.
[37:22.680 --> 37:28.680]  And the point of it is that the judge feels like a finger is being pointed at him.
[37:28.680 --> 37:34.680]  It tends to be more careful.
[37:34.680 --> 37:37.680]  That's my story and I'm sticking to it.
[37:37.680 --> 37:49.680]  In this particular case, it was a motion hearing where the prosecutor was expecting me to show up with an attorney.
[37:49.680 --> 37:58.680]  She actually told me in the hall that she was expecting all of my motions to be pretty much wiped out,
[37:58.680 --> 38:03.680]  and so she was completely unprepared when I did not show up with an attorney.
[38:03.680 --> 38:12.680]  And the judge, with her being a first year, I guess just one year out of law school,
[38:12.680 --> 38:14.680]  she didn't bring in a lot of waste.
[38:14.680 --> 38:16.680]  She didn't say one thing in the hearing.
[38:16.680 --> 38:29.680]  The judge completely carried her water for her, and I just didn't know if there was anything I could do to stop the judge from, you know...
[38:29.680 --> 38:39.680]  Absolutely, you should ask the judge to get down off that bench and come over here and sit at the prosecutor's table if you want to prosecute this case.
[38:39.680 --> 38:48.680]  But if you want to sit as a judge, then you need to stay out of the prosecutor's business.
[38:48.680 --> 38:52.680]  You can do that.
[38:52.680 --> 38:58.680]  The judges used to everybody being meek little lambs when they come into the court.
[38:58.680 --> 39:02.680]  You're not one of those meek little lambs.
[39:02.680 --> 39:06.680]  Do you have a right to certain decorum, and the judge is breaching it?
[39:06.680 --> 39:12.680]  Have you filed a complaint against her yet about that?
[39:12.680 --> 39:15.680]  Is it her or he?
[39:15.680 --> 39:21.680]  The judge is a he. The prosecutor is her.
[39:21.680 --> 39:31.680]  They all have the nose in the same trough. They're all part of the same fraternity, so the judge is trying to help her out.
[39:31.680 --> 39:35.680]  Not appropriate when your liberty is at risk.
[39:35.680 --> 39:41.680]  So this should get a serious judicial conduct complaint against the judge.
[39:41.680 --> 39:51.680]  So is it okay to file multiple judicial conduct complaints on the number of infractions?
[39:51.680 --> 39:57.680]  Absolutely, and file them separately. Don't file them all at the same time.
[39:57.680 --> 40:05.680]  You know, wait two or three days or a week if you can, but if you've got too many of them, just send one in every day.
[40:05.680 --> 40:21.680]  So that they're completely separate, make each one address one issue, specifically one occurrence that acts as a violation of a specific canon.
[40:21.680 --> 40:24.680]  And then go to the next canon or the next occurrence.
[40:24.680 --> 40:33.680]  If there's more than one violation of the same canon, then you file a second one for the next violation, but you don't run them together.
[40:33.680 --> 40:46.680]  You run them separate, so there's more complaints because the bonding agency, they care about the number of complaints, not the substance of the complaints.
[40:46.680 --> 40:54.680]  If you file seven bar grievances against this lawyer, she's not ever going to be able to be a lawyer.
[40:54.680 --> 41:01.680]  She's going to have to work with the DA's office the rest of her career.
[41:01.680 --> 41:08.680]  Somebody really threw her to the wolves when they came for you.
[41:08.680 --> 41:17.680]  Yeah, I think that was before I filed any bar grievances.
[41:17.680 --> 41:28.680]  There was a prosecutor before her, and after he left and she came on, I filed four against the guy who just left.
[41:28.680 --> 41:36.680]  It was a nice parting gift, and then the same four against her.
[41:36.680 --> 41:39.680]  That just started the ball rolling with her.
[41:39.680 --> 41:46.680]  But can you do the same thing with a motion to recuse?
[41:46.680 --> 41:55.680]  I've already filed a motion to recuse, and he passed it off to one of his colleagues to adhere it.
[41:55.680 --> 42:11.680]  And it was based on due process violation of him not hearing my motions, not allowing me to speak, just not even hearing my motions.
[42:11.680 --> 42:21.680]  Now he's coming back, and he wants to re-hear the same motions that he already ruled on.
[42:21.680 --> 42:32.680]  And to me, that almost seems like he would, by necessity, even though he did not say that he vacated his rulings, his orders,
[42:32.680 --> 42:39.680]  you would think that by necessity he would have to vacate those orders in order to re-hear them,
[42:39.680 --> 42:44.680]  because he told me he wanted to give me a proper hearing.
[42:44.680 --> 42:50.680]  And that seemed to be an admission that he didn't the first time.
[42:50.680 --> 42:52.680]  Yeah.
[42:52.680 --> 42:55.680]  That sounds like a judicial admission.
[42:55.680 --> 43:00.680]  And the fact that he's re-hearing them, somebody stuck a bee in his body.
[43:00.680 --> 43:10.680]  And a good chance we're going to have Olivier out there listening, because were you listening last Saturday?
[43:10.680 --> 43:13.680]  I don't know.
[43:13.680 --> 43:19.680]  If you weren't listening to the last hour, last Saturday, you missed it.

[47:06.680 --> 47:11.680]  It sounds like someone has put a B in his bonnet.
[47:11.680 --> 47:13.680]  This is what Olivier did.
[47:13.680 --> 47:20.680]  I was getting worried about Olivier because he just would not back down.
[47:20.680 --> 47:28.680]  I accused him last Saturday of having the unmitigated call to drive around in Middle Tennessee
[47:28.680 --> 47:32.680]  while he was poor and black.
[47:32.680 --> 47:39.680]  But he didn't drive around in Middle Tennessee afraid and stupid.
[47:39.680 --> 47:45.680]  He took these guys on and he just went to court.
[47:45.680 --> 47:48.680]  And a friend of his, they prosecuted him.
[47:48.680 --> 47:52.680]  They just railroad over all of his pleadings.
[47:52.680 --> 47:54.680]  They found him guilty through him in jail.
[47:54.680 --> 47:59.680]  They were supposed to grant him bail until the appeal was up.
[47:59.680 --> 48:07.680]  But the appeal never, he served out the whole time before the appeal courts picked up the appeal.
[48:07.680 --> 48:15.680]  But Olivier went to his state representative, state senator and the FBI.
[48:15.680 --> 48:21.680]  They went into court last week and the judge came in and had a whole bunch of lawyers in there.
[48:21.680 --> 48:30.680]  And before court in front of Olivier, he told everybody that they're going to have to change their procedures.
[48:30.680 --> 48:38.680]  They're going to have to have three more hearing days to accord all of these people their due process rights.
[48:38.680 --> 48:41.680]  They're going to have to start changing procedures.
[48:41.680 --> 48:48.680]  Apparently they have been violating these procedures for the last 20 years.
[48:48.680 --> 48:57.680]  And I asked Olivier, are you familiar with the sound of eating crow?
[48:57.680 --> 49:07.680]  I was astounded that the judge would say that in front of him because that's essentially judicial admission that they've done everything wrong.
[49:07.680 --> 49:11.680]  And he's got eight or nine lawsuits against him right now.
[49:11.680 --> 49:21.680]  For the judge to make this admission in the face of those lawsuits is absolutely astounding.
[49:21.680 --> 49:29.680]  You may be able, you've got the judge to make a admission that he's done it wrong.
[49:29.680 --> 49:31.680]  You're in a similar position.
[49:31.680 --> 49:36.680]  From my perspective, that is a major admission.
[49:36.680 --> 49:46.680]  And what he's afraid of is you're going to get him to the court of appeals and they're going to clean his clock.
[49:46.680 --> 49:52.680]  You're not one of these lawyers that come in there dangling by your bar card.
[49:52.680 --> 49:58.680]  You come in there upset, angry, demanding your rights and not even letting him run over them.
[49:58.680 --> 50:04.680]  And I don't think these judges are accustomed to that.
[50:04.680 --> 50:07.680]  So this is great.
[50:07.680 --> 50:17.680]  They're a good chance you'll get a decent hearing, but at this point, I would say this is no time to let up on that judge.
[50:17.680 --> 50:22.680]  When you start bar-grieving them, forget what the law says.
[50:22.680 --> 50:28.680]  This is politics and everything is political.
[50:28.680 --> 50:34.680]  And even beyond that, perception is everything.
[50:34.680 --> 50:39.680]  So it's not just as political, it's the perception of the politics.
[50:39.680 --> 50:49.680]  When you bar-grim, when you follow judicial conduct complaint against the judge and after having removed for the bench, you've poisoned his well.
[50:49.680 --> 50:54.680]  You have publicly accused him of not giving you a fair trial.
[50:54.680 --> 51:05.680]  Now everything he does is going to be weighed in light of those accusations.
[51:05.680 --> 51:10.680]  So go look at these finances.
[51:10.680 --> 51:20.680]  That'll terrify him because even if he's clean as a whistle, perception is everything.
[51:20.680 --> 51:31.680]  It doesn't matter if he's dirty or not, if he looks like you're going to try to make him look dirty, he's really going to be concerned about that.
[51:31.680 --> 51:39.680]  And the only way to get you off his back is to get those cases dismissed.
[51:39.680 --> 51:48.680]  Yeah, I've tried to give him a few nails to hang that hat on and he's not wanting to take advantage of those.
[51:48.680 --> 51:56.680]  One of the things that he did in this last hearing was he took judicial notice.
[51:56.680 --> 52:06.680]  It was, the very first motion was a challenge to territorial jurisdiction, the subject matter jurisdiction.
[52:06.680 --> 52:21.680]  And he took judicial notice that the territory was within the county, within the state, within the United States.
[52:21.680 --> 52:33.680]  And I asked him for finding a fact in conclusions of law on that, on how he came to that, that judicial notice.
[52:33.680 --> 52:36.680]  And he refused to give it to me.
[52:36.680 --> 52:40.680]  He just said, he said he wasn't going to give it to me.
[52:40.680 --> 52:44.680]  He said that he just said it because he could.
[52:44.680 --> 52:54.680]  And the rules, one of the rules I read in Georgia says that, if I read it right, that judicial notices are supposed to be things that are undisputed.
[52:54.680 --> 53:07.680]  No, that's not, that's not, that's not exactly right. Judicial notice cannot be taken because something is undisputed.
[53:07.680 --> 53:17.680]  It can only be taken on something that cannot be disputed.
[53:17.680 --> 53:29.680]  If, if what you put in front of him is undisputable fact, he has to take judicial notice of it.
[53:29.680 --> 53:41.680]  Yeah, the, the, I think the due process violation here would be when I asked him for the evidence behind his judicial notice, which,
[53:41.680 --> 53:51.680]  and when he refused to give it to me, that specifically violated one of the rules that if someone asked him for evidence, he's supposed to give it.
[53:51.680 --> 53:52.680]  Yes.
[53:52.680 --> 53:58.680]  He has a duty to determine the facts in accordance with the rules of evidence that apply the laws that comes to him to the facts in the case.
[53:58.680 --> 54:03.680]  And you ask him for that, for those facts in that law and he refused to give it.
[54:03.680 --> 54:16.680]  On his face, it certainly looks like an arbitrary and capricious ruling and it should certainly get a judicial conduct complaint based on that.
[54:16.680 --> 54:34.680]  But also a petition to for a written mandamus to the appeals court ordering him to tell you why he rules the way he did so that you're able to prepare an appeal.
[54:34.680 --> 54:39.680]  Now they're going to tell you you don't have a right to an appeal.
[54:39.680 --> 54:42.680]  That it's up to the discretion of the appellate court.
[54:42.680 --> 54:44.680]  Well, maybe.
[54:44.680 --> 54:50.680]  You do have a right to be able to file the appeal.
[54:50.680 --> 55:00.680]  And he eliminates your ability to be able to petition for an appeal because you don't know why he ruled the way he ruled.
[55:00.680 --> 55:02.680]  Great.
[55:02.680 --> 55:08.680]  Meet for a mandamus.
[55:08.680 --> 55:18.680]  And he's not going to like it when you put this in the hands of the court of appeals and it sounds like he agreed to rehear some of these rulings because he wants to keep it out of their hands.
[55:18.680 --> 55:24.680]  So take it to their hands anyway with the mandamus.
[55:24.680 --> 55:39.680]  And in the mandamus, you can cite all these other things he's did in support of your contention that he's acting biased, arbitrary and capricious.
[55:39.680 --> 55:49.680]  So it gives you a reason to air all his dirty laundry in front of the court of appeals and he is not going to like that happening.
[55:49.680 --> 56:12.680]  If I were to file a federal criminal complaint for these due process violations, would that prevent him from going back and trying to rehear the motions and trying to correct the due process violations that he's already committed?
[56:12.680 --> 56:14.680]  No.
[56:14.680 --> 56:19.680]  However, here's his problem with that.
[56:19.680 --> 56:29.680]  When the Randall County district clerk wouldn't give me the records I asked for, I called 911 or went out and got the bailiffs and asked them to arrest her.
[56:29.680 --> 56:39.680]  And when the head bailiff wouldn't arrest her, the head security wouldn't arrest her, I called 911 to ask for an officer to come out and arrest them both.
[56:39.680 --> 56:48.680]  While I'm waiting for the officer, the clerk come out with this handful of folders and the head of the security.
[56:48.680 --> 56:54.680]  And they started to say something and I told them, stop, stop, I can't be talking to you.
[56:54.680 --> 57:05.680]  I've called 911 and I have an officer coming to take my full statement and I'll give him a full statement, but since I'm filing charges against you, it'd be inappropriate for me to have any further communication.
[57:05.680 --> 57:10.680]  So the sergeant bailiff said, well, she's got the records you asked for.
[57:10.680 --> 57:12.680]  Sorry, Bubba.
[57:12.680 --> 57:16.680]  That bail's already been rung.
[57:16.680 --> 57:19.680]  And that's your case.
[57:19.680 --> 57:21.680]  He already rung that bail.
[57:21.680 --> 57:24.680]  He can't unring it.
[57:24.680 --> 57:29.680]  All he can do is demonstrate that he did it wrong in the first instance.
[57:29.680 --> 57:33.680]  He should keep his mouth shut.
[57:33.680 --> 57:40.680]  But I think somebody has put a B in his bonnet and told him he's got trouble coming.
[57:40.680 --> 57:45.680]  You see, judges get their opinions overturned all the time.
[57:45.680 --> 57:49.680]  So that can't be it.
[57:49.680 --> 58:00.680]  Why would he come back and revisit these motions that he's already visited and tell you that he wants to make sure you have a fair hearing?
[58:00.680 --> 58:05.680]  That's an unusual admission that the first one wasn't fair.
[58:05.680 --> 58:07.680]  Why would he do that?
[58:07.680 --> 58:13.680]  What kind of political pressure has he put on this guy that you don't know about?
[58:13.680 --> 58:14.680]  Hang on.
[58:14.680 --> 58:15.680]  About to go to break.

[01:01:42.680 --> 01:01:57.680]  The University of Exeter released a new study by Professor Charles Tyler, which catalogs how male freshwater fish in Britain are turning into females due to the chemicals released into the water from birth control pills, cosmetic makeup, cleaning agents, and plastics all being flushed down the drains.
[01:01:57.680 --> 01:02:08.680]  The study found that one-fifth of males, or 20% of the male fish population, were now showing feminine traits, including producing eggs, reduced sperm counts, and less aggressive behavior.
[01:02:08.680 --> 01:02:15.680]  Professor Tyler stated that, quote, we are showing that some of these chemicals can have much wider health effects in fish than we expected.

[01:04:26.680 --> 01:04:50.680]  Okay, so you had another question. It looks like when we're going out of thinking, what would possess that judge to actually make an admission that he had ruled improperly on your cases?
[01:04:50.680 --> 01:05:03.680]  Are you the only person in your situation before this court right now? Does this judge have a history of this kind of behavior?
[01:05:03.680 --> 01:05:22.680]  I really don't know. I know there's been some unpopular cases with him. I don't know all the details, but I don't think he gets that many traffic cases like mine. I really just don't know.
[01:05:22.680 --> 01:05:41.680]  One possible thought is when he referred this to one of his colleagues to hear the recusal motion, they initially first came back and said, oh, well, this wasn't time, lady, and your affidavit wasn't right.
[01:05:41.680 --> 01:05:58.680]  And when I sent it back for reconsideration, I quoted the rule that said when the judge referred it, he already reviewed and approved the affidavit, and it's automatically timely.
[01:05:58.680 --> 01:06:11.680]  And they also said that they went ahead and went over all my motions anyway and found them to be frivolous and all this stuff.
[01:06:11.680 --> 01:06:34.680]  And so I asked the other judge to give me finding the facts and conclusions at law on that, and that probably really hurt them because I don't know if they have to give me finding the facts and conclusions at law on all the motions,
[01:06:34.680 --> 01:06:45.680]  but they said that they reviewed them all and found them to be, you know, frivolous or invocation.
[01:06:45.680 --> 01:06:52.680]  And so I wouldn't think that they would want to go back and give me finding the facts on all those motions.
[01:06:52.680 --> 01:07:02.680]  Well, their problem is it's becoming clear to them that you're going to take them to the Court of Appeals.
[01:07:02.680 --> 01:07:13.680]  And if it's like most other states, you know, I was in Cherokee County and this judge is after me there, but he made a telling comment.
[01:07:13.680 --> 01:07:15.680]  There was a reference to the Court of Appeals.
[01:07:15.680 --> 01:07:17.680]  This is on a break.
[01:07:17.680 --> 01:07:22.680]  And he said, oh, yeah, the God's in Tyler.
[01:07:22.680 --> 01:07:32.680]  That was a telling statement indicating that he was not comfortable with them.
[01:07:32.680 --> 01:07:37.680]  And I'm betting your judge is not comfortable with him either.
[01:07:37.680 --> 01:07:47.680]  And now it's becoming clear that not only are you going to take him to the Court of Appeals, you're going to take him rough shot to the Court of Appeals.
[01:07:47.680 --> 01:07:52.680]  Lawyers, they're real careful in how they deal with judges.
[01:07:52.680 --> 01:07:56.680]  But your process, you don't have to be careful how you deal with it.
[01:07:56.680 --> 01:08:03.680]  You're not going to be bringing more cases in front of him with clients that he can screw over to get back at you.
[01:08:03.680 --> 01:08:07.680]  And you're not in there dangling by your bar card either.
[01:08:07.680 --> 01:08:11.680]  That he can take away the drop of a hat.
[01:08:11.680 --> 01:08:17.680]  So he may be getting concerned, he's got one of those process that don't lay down and roll over for him.
[01:08:17.680 --> 01:08:21.680]  So how long has this case been going on?
[01:08:21.680 --> 01:08:23.680]  Almost two and a half years.
[01:08:23.680 --> 01:08:25.680]  Two and a half years.
[01:08:25.680 --> 01:08:31.680]  They figured you would burn out and give up and you're still after them.
[01:08:31.680 --> 01:08:42.680]  So now he's probably seeing the end of the road where he's going to get this in the hands of the Court of Appeals and they are not going to be happy with him.
[01:08:42.680 --> 01:08:53.680]  Yeah, there's one other issue which could be a factor that the court reporter won't give me the audio.
[01:08:53.680 --> 01:09:02.680]  So there's no way to check to see if the transcript actually lines up with what was said.
[01:09:02.680 --> 01:09:09.680]  And I gave the judge a motion to compel his court reporter to give me the audio.
[01:09:09.680 --> 01:09:19.680]  This was back in November of last year with a notice to the court to schedule a hearing to hear this motion to compel.
[01:09:19.680 --> 01:09:25.680]  And here it is, July the 20th.
[01:09:25.680 --> 01:09:29.680]  I would think that would be a due process violation right there.
[01:09:29.680 --> 01:09:37.680]  That's a good thing to petition the Court of Appeals for a real mandamus.
[01:09:37.680 --> 01:09:47.680]  I was in court once and before it started there was a traffic court but it was Court of Record in Austin so they had a court reporter.
[01:09:47.680 --> 01:09:52.680]  And I said, Your Honor, there's something I would like to check. May I speak to the court reporter?
[01:09:52.680 --> 01:09:53.680]  He said, Certainly.
[01:09:53.680 --> 01:09:57.680]  I said, Ma'am, do you have any hearing issues?
[01:09:57.680 --> 01:10:00.680]  And she was real smart.
[01:10:00.680 --> 01:10:01.680]  No, I don't.
[01:10:01.680 --> 01:10:04.680]  So you don't have selective hearing loss?
[01:10:04.680 --> 01:10:05.680]  No, I do not.
[01:10:05.680 --> 01:10:12.680]  Then I don't have to worry about sections when the judge says something that doesn't sound exactly appropriate.
[01:10:12.680 --> 01:10:16.680]  I don't have to worry about it disappearing from the record.
[01:10:16.680 --> 01:10:23.680]  Oh, that was so much fun.
[01:10:23.680 --> 01:10:29.680]  This is a problem and court reporters learn this.
[01:10:29.680 --> 01:10:38.680]  If they want to stay the court reporter, if the judge makes a food pod that it accidentally gets missed.
[01:10:38.680 --> 01:10:48.680]  But they make this recording to make their life easier and make sure they don't miss something important and that can certainly be used against them.
[01:10:48.680 --> 01:11:01.680]  You should use every opportunity to go to the Court of Appeals so that you waive this judge's bad behavior in front of them.
[01:11:01.680 --> 01:11:14.680]  He's not going to like it because these are the people that are looking over his shoulders, like going over his head to his boss.
[01:11:14.680 --> 01:11:18.680]  Okay, you said you had one more question.
[01:11:18.680 --> 01:11:24.680]  Yeah, it was concerning the court reporter.
[01:11:24.680 --> 01:11:30.680]  File a professional conduct complaint against the court reporter.
[01:11:30.680 --> 01:11:36.680]  We did that here and, man, did it get ugly for the court reporter.
[01:11:36.680 --> 01:11:39.680]  She had to go down to Austin to a hearing.
[01:11:39.680 --> 01:11:49.680]  And if she didn't agree with the ruling of the hearing, did she would be tried in open court criminally?
[01:11:49.680 --> 01:11:54.680]  Oh, the prosecutor was supposed to tell her to be in court.
[01:11:54.680 --> 01:12:04.680]  He said she told her and the court reporter said she didn't. And we got the two arguing with each other, trying to throw each other under the bus.
[01:12:04.680 --> 01:12:11.680]  It became a really big deal when she filed a professional conduct complaint.
[01:12:11.680 --> 01:12:16.680]  So you might look at Sting in the court reporter.
[01:12:16.680 --> 01:12:29.680]  Yeah, I've already filed one complaint with the board of court reporters on her, and so this will be a second violation, at least in Georgia.
[01:12:29.680 --> 01:12:48.680]  It says that for any tape recordings, anything that any court official or member of the court does with taxpayer money or for the court is a public record.
[01:12:48.680 --> 01:12:50.680]  Okay, question.
[01:12:50.680 --> 01:12:58.680]  In Georgia, is the Open Records Act a civil statute or a criminal statute?
[01:12:58.680 --> 01:13:03.680]  There's a criminal penalty.
[01:13:03.680 --> 01:13:13.680]  That's just like Texas. It's a criminal statute. So file against her criminally.
[01:13:13.680 --> 01:13:17.680]  But her at the same position you are.
[01:13:17.680 --> 01:13:31.680]  It does say that my remedy in the Open Records Act in Georgia, it does say that my remedy is first to go to the Attorney General and then to sue civilly.
[01:13:31.680 --> 01:13:44.680]  Okay, that's your remedy. Criminal prosecution is not your remedy. That's your duty.
[01:13:44.680 --> 01:13:48.680]  She violated the law relating to her office.
[01:13:48.680 --> 01:13:57.680]  And if the statute's a criminal statute, she committed a crime and you have a duty to give notice of the crime.
[01:13:57.680 --> 01:14:06.680]  You don't have any standing and you won't receive any remedy if she's prosecuted, as between her and the state.
[01:14:06.680 --> 01:14:13.680]  So the criminal side's not one of your remedies.
[01:14:13.680 --> 01:14:16.680]  It's the duty that you have.
[01:14:16.680 --> 01:14:21.680]  Yeah, I may be wrong on whether a criminal statute...
[01:14:21.680 --> 01:14:27.680]  Right at the end, it will say that a violation of this act is a...
[01:14:27.680 --> 01:14:36.680]  If it is a criminal statute, it will say that right at the end of the act.
[01:14:36.680 --> 01:14:53.680]  So check that out. Almost every one of them is a criminal statute. And even if it's not a criminal statute, the failure to perform a duty you're required to perform, that in the process denies the citizen pulling free access to rejoin the right, that'll work.
[01:14:53.680 --> 01:15:01.680]  That's official misconduct or official oppression, depending on the state, and it'll catch them all.
[01:15:01.680 --> 01:15:16.680]  Is it possible if I go to court again and she's there, can I object to the court and ask that she be replaced with another court reporter who is willing to do her duty?
[01:15:16.680 --> 01:15:36.680]  Yeah, that's certainly a good issue to bring up, because it's really going to sting the court reporter, because generally they're invisible when they become a part of the case, not good for them.
[01:15:36.680 --> 01:15:49.680]  Plus, the information on those recordings, I think, implicates the judge further in the due process violations, because I think it is, like you said, where she's covered.
[01:15:49.680 --> 01:15:55.680]  Yeah, she knows that. And she's trying to protect the judge so that the judge keeps her in her job.
[01:15:55.680 --> 01:16:14.680]  But if you put enough pressure on her that you look like you may get her license revoked or suspended, then she has plausible deniability for giving up the judge.
[01:16:14.680 --> 01:16:17.680]  All politics.
[01:16:17.680 --> 01:16:22.680]  Yeah, one of them will probably throw the other under the bus if enough pressure is applied.

[01:21:31.680 --> 01:21:40.680]  And I made it very clear in my letter I said I am not filing an amended petition. I am not paying a $60 filing fee
[01:21:40.680 --> 01:21:47.680]  because I am not in your jurisdiction and that would put me in your jurisdiction.
[01:21:47.680 --> 01:21:52.680]  You did not enter into a contract with them.
[01:21:52.680 --> 01:21:57.680]  Right. But I guess if you want to say it that way.
[01:21:57.680 --> 01:22:08.680]  What they don't tell people is if you locked into their jurisdiction and you and I know what maybe 2% of people win in tax court,
[01:22:08.680 --> 01:22:17.680]  it's a screw job. You know, you go against these people and you want to argue semantics and you want to argue,
[01:22:17.680 --> 01:22:28.680]  well, I'm owed this deduction and this rightfully I can claim. If you don't challenge jurisdiction and you're not in their jurisdiction,
[01:22:28.680 --> 01:22:34.680]  it's a mute point. You don't have to go anywhere. You just say, look, you have no jurisdiction.
[01:22:34.680 --> 01:22:43.680]  Please kindly show me my oath of office that I took. Can you please let me know where my public office desk is and address?
[01:22:43.680 --> 01:22:51.680]  I mean, I went down the line because they think that people that owe taxes, they all work for the government.
[01:22:51.680 --> 01:23:01.680]  Well, that's true. If you are a federal employee or you work in the functions of a public office, you are a United States citizen.
[01:23:01.680 --> 01:23:10.680]  You are a U.S. person. If you are an American national born in one of the 50 states or naturalized,
[01:23:10.680 --> 01:23:20.680]  you were born outside their jurisdiction. If you don't live and work in the United States, which is the district of Columbia,
[01:23:20.680 --> 01:23:22.680]  you're an American national.
[01:23:22.680 --> 01:23:32.680]  Yeah, or if you were working a place, an area that has been ceded to one of the, that has been ceded to the United States.
[01:23:32.680 --> 01:23:37.680]  Right. Right. Yeah, the federal territory, the federal zone.
[01:23:37.680 --> 01:23:42.680]  So it was really very simple.
[01:23:42.680 --> 01:23:51.680]  When you challenge jurisdiction, it's my understanding that they have to address it and they can't railroad you if you properly.
[01:23:51.680 --> 01:24:03.680]  Jurisdiction is a threshold issue. Subject matter jurisdiction is a threshold issue. It may not be presumed. It cannot be waived.
[01:24:03.680 --> 01:24:12.680]  There's a lot of these patriot guys out here that say that you can grant them jurisdiction. Well, if they don't have it, they don't have it.
[01:24:12.680 --> 01:24:19.680]  But what you can do is not challenge jurisdiction and they can act like they have it.
[01:24:19.680 --> 01:24:22.680]  Right.

[01:25:03.680 --> 01:25:17.680]  And always it seems to be the problem is if they don't understand it's all about contract and Debra is real serious on this area. And it sounds like you fully understood it was about contract.

[01:25:21.680 --> 01:25:31.680]  You can bring yourself into their jurisdiction by some of the things you can do.

[01:25:36.680 --> 01:25:47.680]  You know, it's really interesting, you know, Joe Bannister, if anybody follows tax issues and whatnot.
[01:25:47.680 --> 01:25:54.680]  They're familiar with Joe Bannister. Well, he was acquitted, but he had another issue where he went to tax court.
[01:25:54.680 --> 01:26:06.680]  And you know what he did? He filed an amended petition with a tax court and he paid the filing fee and he lost because he went right back into their jurisdiction.
[01:26:06.680 --> 01:26:12.680]  It doesn't matter. It doesn't matter the arguments, the flavorful, colorful arguments he did.
[01:26:12.680 --> 01:26:19.680]  He filed the amended petition and he paid their stupid filing fee.
[01:26:19.680 --> 01:26:31.680]  This is a familiar issue to us, but not familiar to most.
[01:26:31.680 --> 01:26:43.680]  Most people don't understand how we engage ourselves in contractual relationships and especially with a government ruling body.
[01:26:43.680 --> 01:26:54.680]  If you respond to them within the scope of their rules and regulations, you are simply ascent to their control.
[01:26:54.680 --> 01:27:01.680]  You agree to the statutory scheme, but you didn't do that.
[01:27:01.680 --> 01:27:08.680]  That's what Joe did by paying that filing fee and asking them to do something.
[01:27:08.680 --> 01:27:19.680]  It's really funny. I can read you. I mean, it's public records. You can go on and search my name and you know, but I'm not going to say my full name over here, but I'll read you the dismissal if you want to.

[01:27:59.680 --> 01:28:10.680]  In addition, the court's $60 filing fee was not paid by order dated May 26, 2017, the court directed petitioner to file a proper amended petition and pay the court's filing fee.
[01:28:10.680 --> 01:28:18.680]  On June 5, 2017, petitioner filed a letter in which he indicates that he does not intend to file a proper amended petition and pay the court's filing fee.
[01:28:18.680 --> 01:28:22.680]  Upon due consideration, it is.
[01:28:22.680 --> 01:28:39.680]  Then it goes down two lines and it is ordered in big capital letters that on the court's own motion, this case is dismissed for lack of jurisdiction on the grounds that petitioner failed to file an amended petition and pay the court's filing fee.
[01:28:39.680 --> 01:28:48.680]  That's a backwards way of saying if you don't pay, we don't have authority.
[01:28:48.680 --> 01:28:53.680]  They were accusing you of not paying but dismissed because you didn't.

[01:28:55.680 --> 01:29:11.680]  Now, what's funny is the group that helped me with this, they have thousands of clients and they hate to admit this, but they have not lost one case in tax court because they challenged jurisdiction.

[01:37:49.680 --> 01:38:00.680]  This, this was a problem that I had for a long time. I don't run into those guys too much. I don't suspect they're still out there, but they stay clear of me.

[01:38:13.680 --> 01:38:19.680]  He had come on my show and claimed he was a lawyer. Turns out he's not a lawyer.
[01:38:19.680 --> 01:38:32.680]  And then he's doing this presentation and I'm sitting there in the front row and they got cameras on and he stops right in the middle and starts promoting taking over the government.
[01:38:32.680 --> 01:38:47.680]  He said he had the two generals who were going with him and they were going to go in and, and remove the government and replace it with one they've already elected after this guy's got me on camera and he's talking high treason.
[01:38:47.680 --> 01:38:53.680]  I want out of here. He's in jail. He's in jail now.
[01:38:53.680 --> 01:39:02.680]  Yeah. One of the other writers of this book, cracking the code, he spent time in club said, you know,
[01:39:02.680 --> 01:39:09.680]  Yeah, he's in jail too. The one who wrote it. I forget his name at the moment, but he went to jail.
[01:39:09.680 --> 01:39:21.680]  Henderson. Yeah, Henderson. Yeah. So anyway, you know, I'm not here to throw stones, you know, he's probably sincere, but you can be sincerely wrong.

[01:39:31.680 --> 01:39:35.680]  Especially when I'm dealing with someone's liberty.
[01:39:35.680 --> 01:39:45.680]  It makes me nuts when I have people telling other people to do stuff that could wind up getting them in jail.
[01:39:45.680 --> 01:39:53.680]  And there was a Sam Kennedy. He's telling everybody all this stuff to do.
[01:39:53.680 --> 01:40:01.680]  And somebody said they were at one of his seminars and he was using my criminal documents in his seminar.
[01:40:01.680 --> 01:40:11.680]  He's telling people to do all this stuff and fire all these UCC ones and such. And he had never done that himself.
[01:40:11.680 --> 01:40:21.680]  He wound up getting a lot of people in trouble. And it turned out it was pretty clear that he was a government shield.
[01:40:21.680 --> 01:40:33.680]  They put out there to lead people down a garden path so they could discredit all of us. And this I am especially pleased.
[01:40:33.680 --> 01:40:37.680]  Well, it's part of a paralegal I was working with that actually helped Peter.
[01:40:37.680 --> 01:40:49.680]  And I showed her that and she did nothing but rebuff me and tell me that their thing, they don't have jurisdiction over your petition.
[01:40:49.680 --> 01:40:55.680]  They can still levy you and all this stuff. And how is this good news? And this is another crappy ruling.
[01:40:55.680 --> 01:40:59.680]  I think she totally and completely missed the whole point.
[01:40:59.680 --> 01:41:05.680]  Yes. It's a hard part to wrap your head around.
[01:41:05.680 --> 01:41:13.680]  If she's been in the field a long time, she's accustomed to doing things the way they've been doing things.
[01:41:13.680 --> 01:41:24.680]  And she has an investment in it. I have a good friend who was a captain on the sheriff's department and I only followed one set of criminal charges on him then.
[01:41:24.680 --> 01:41:34.680]  And then he was a JP and I filed a few there and then he was the president of the school board and I called the sheriff and asked him to come out and arrest all of them.
[01:41:34.680 --> 01:41:39.680]  But we were still good friends because he knew I always did everything by law.
[01:41:39.680 --> 01:41:48.680]  And it was my opinion that Mark Autry would do what he believed was right if it hair-lipped a pope.
[01:41:48.680 --> 01:42:04.680]  I sat down with him with the code and walked him through the code and showed him where on every arrest when they followed the standard procedure they committed 19 felony and misdemeanor crimes against the accused.
[01:42:04.680 --> 01:42:14.680]  And he said, Mr. Kelton, are you telling me that everything that I've done through my entire career was wrong?
[01:42:14.680 --> 01:42:20.680]  That everything everybody else in Texas is doing is wrong and you're right?

[01:47:06.680 --> 01:47:13.680]  They denied me the collection due process hearing and we wanted that anyway because we knew they were going to do it.
[01:47:13.680 --> 01:47:20.680]  And they claimed, you know, all sorts of frivolous arguments and trying to impede the tax law, blah, blah, blah.
[01:47:20.680 --> 01:47:28.680]  So we went straight to tax court and said, look, you know, here's the notice of intent to levy.
[01:47:28.680 --> 01:47:37.680]  I was denied due process, yada, yada, yada, and I don't intend to pay your filing fee and I don't intend to file an amended petition.
[01:47:37.680 --> 01:47:49.680]  And here's why, because that puts you, that puts me and your jurisdiction, please be very clear that I am not submitting to your jurisdiction.
[01:47:49.680 --> 01:47:56.680]  I would like to address this matter in a, you know, timely and please provide adopt numbers so we can address this.
[01:47:56.680 --> 01:48:12.680]  Okay, now I have a concern. How does this affect the levy that the IRS was trying to bring against you?
[01:48:12.680 --> 01:48:14.680]  Because I noted all the details.
[01:48:14.680 --> 01:48:19.680]  I gave them a copy of the notice of intent to levy along with my letter.
[01:48:19.680 --> 01:48:28.680]  But you've got no ruling today. IRS doesn't need the tax court to verify their levies.
[01:48:28.680 --> 01:48:37.680]  So how does this stop the IRS from moving forward against you?
[01:48:37.680 --> 01:48:40.680]  Well, they've got no jurisdiction.
[01:48:40.680 --> 01:48:45.680]  No, the tax court had no jurisdiction.
[01:48:45.680 --> 01:48:56.680]  As far as I can tell, this had nothing to do with the IRS itself. This wasn't a ruling that you didn't fall under the authority of the IRS.
[01:48:56.680 --> 01:49:11.680]  This is just a ruling that said that this tax court didn't have jurisdiction to set in this case because you did not invoke the subject matter jurisdiction of the tax court.
[01:49:11.680 --> 01:49:19.680]  I'm going to suggest they may still be coming in. This didn't affect the IRS at all.
[01:49:19.680 --> 01:49:22.680]  Okay.
[01:49:22.680 --> 01:49:35.680]  So what's the difference between, why would the judge say dismissed lack of jurisdiction as a docket number and that docket number is tied to the...
[01:49:35.680 --> 01:49:41.680]  See, you invoked the authority of the tax court.
[01:49:41.680 --> 01:49:52.680]  I had one recently, a while back, where a guy was sued over a credit card.
[01:49:52.680 --> 01:50:03.680]  And there was an affidavit that the plaintiff in one of these suits was required to file along with the petition.
[01:50:03.680 --> 01:50:14.680]  So he filed a challenge subject matter jurisdiction of the court, claiming that the petitioner failed to properly invoke the subject matter jurisdiction of the court.
[01:50:14.680 --> 01:50:17.680]  And that's what this court is saying.
[01:50:17.680 --> 01:50:27.680]  We can't rule in this matter because you didn't meet the requirements to invoke our subject matter jurisdiction.
[01:50:27.680 --> 01:50:39.680]  Now, had the IRS initiated the action in the tax court and had they needed a tax court ruling in order to move ahead, then you would have won something.
[01:50:39.680 --> 01:50:53.680]  But in this case, since you initiated a tax court and then didn't sufficiently engage their subject matter jurisdiction, they were correct.
[01:50:53.680 --> 01:51:01.680]  But it only affected the tax court itself and they didn't rule in anything.
[01:51:01.680 --> 01:51:11.680]  I'm just concerned that the IRS will see this as an open door for them.
[01:51:11.680 --> 01:51:19.680]  I'm sure this group has more going on than this because this can't be it.

[01:54:55.680 --> 01:55:06.680]  IRS doesn't have to do that. That is Title 26. They can make internal rulings and levy and lean people's assets, and that's it.

[01:55:36.680 --> 01:55:46.680]  And then there are some situations where you can bypass tax court and file against the IRS in federal district court.
[01:55:46.680 --> 01:56:04.680]  Okay, but if you're the plaintiff, if you're the petitioner in either tax court or federal district court, you can't say, I'm bringing an issue to the court, but I'm not going to agree to your subject matter jurisdiction.

You have to agree to the subject matter jurisdiction of the court if you want to be a plaintiff, if you want to be a petitioner, if you want to bring an issue to the court as proactively, not as a defendant, but as a plaintiff or a petitioner, you have to agree to the court's jurisdiction.
[01:56:27.680 --> 01:56:48.680]  Now, that doesn't mean that you're agreeing to whatever the IRS is claiming against you. You're just agreeing to the court's jurisdiction. In other words, you're telling the court, I agree for you to hear and analyze and review what I have to say.
[01:56:48.680 --> 01:56:59.680]  I mean, otherwise, it doesn't make any sense what you're going to go to court and say court, I want you to help me. I'm the petitioner. I'm bringing an issue to you court, but I don't agree for your jurisdiction.
[01:56:59.680 --> 01:57:17.680]  That just doesn't even make any sense. Okay, and so what happens, like if you're going to be a petitioner and the court dismisses your petition or dismisses your case or whatever it's called, that does not in any way whatsoever affect the power of the IRS to enforce those liens and levies.
[01:57:17.680 --> 01:57:40.680]  Okay, that's my general understanding here. Now, if the IRS took you to court and you challenge subject matter jurisdiction of the court as a defendant and then the court dismisses the case because they don't have jurisdiction, they say, okay, we agree with you defendant, we don't have jurisdiction, then the IRS would lose because they were the petitioner.
[01:57:40.680 --> 01:57:57.680]  Okay, so that is pretty much in general what's going on here, and I have the same concerns as Randy. I don't see how what happened in tax court with you is going to stop these liens or levies that the IRS has against you. That's not going to affect it at all.
