[01:42.440 --> 01:46.640]  The University of Exeter released a new study by Professor Charles Tyler, which catalogs
[01:46.640 --> 01:50.960]  how male freshwater fish in Britain are turning into females due to the chemicals released
[01:50.960 --> 01:56.120]  into the water from birth control pills, cosmetic makeup, cleaning agents, and plastics all
[01:56.120 --> 01:58.160]  being flushed down the drains.
[01:58.160 --> 02:02.920]  The study found that one-fifth of males, or 20% of the male fish population, were now
[02:02.920 --> 02:08.040]  showing feminine traits, including producing eggs, reduced sperm counts, and less aggressive

[04:39.280 --> 04:50.640]  July 10th, 2017. And we are progressing well beyond the halfway point now. And it has come
[04:50.640 --> 04:56.240]  to my attention that once again we're having a major issue with courts violating the law
[04:57.280 --> 05:02.720]  when it comes to the Public Information Act and what they're supposed to be doing.
[05:04.160 --> 05:07.840]  So what I want to do real quick is to go through one specific section of
[05:08.400 --> 05:15.840]  chapter 552 of the Texas government code. And in this section I am going to show you exactly
[05:15.840 --> 05:21.600]  what it says about what happens when these courts do something like this.
[05:23.840 --> 05:27.680]  You need to fill out a public information request to get access to your court record.
[05:28.720 --> 05:34.960]  I need to see identification before I give you access to the court record. Only the
[05:34.960 --> 05:39.680]  prosecutor can give you access to the court record and you have to sign a waiver for some
[05:39.680 --> 05:44.960]  reason and some purpose before they'll let you do that, et cetera, et cetera, et cetera.
[05:47.040 --> 05:52.960]  None of this is what the law requires them to do. What they're required to do and what
[05:52.960 --> 05:59.680]  they're doing is as different as night and day. Now let me read you something from the very top
[05:59.680 --> 06:10.560]  of the Public Information Act. 552.001 policy and construction. A, under the fundamental philosophy
[06:10.560 --> 06:16.160]  of the American constitutional form of representative government that adheres to the principle
[06:16.160 --> 06:23.120]  that government is the servant and not the master of the people, it is the policy of this state that
[06:23.120 --> 06:30.720]  each person is entitled unless otherwise expressly provided by law at all times to
[06:30.720 --> 06:36.400]  complete information about the affairs of government and the official acts of public
[06:36.400 --> 06:44.400]  officials and employees. The people in delegating authority do not give their public servants
[06:44.400 --> 06:49.680]  the right to decide what is good for the people to know and what is not good for them to know.
[06:49.680 --> 06:55.840]  The people insist on remaining informed so that they may retain control over the instruments they
[06:55.840 --> 07:02.800]  have created. The provisions of this chapter shall be liberally construed to implement this policy.
[07:03.520 --> 07:10.160]  Subsection B, this chapter shall be liberally construed in favor of granting a request for
[07:10.160 --> 07:21.760]  information. 552.002 definition of public information, media containing public information.
[07:22.560 --> 07:30.960]  A, in this chapter, public information means information that is written, produced, collected,
[07:30.960 --> 07:38.240]  assembled, or maintained under a law or ordinance or in connection with the transaction of official
[07:38.240 --> 07:45.600]  business. One, by a governmental body. Two, for a governmental body and the governmental body.
[07:46.560 --> 07:53.280]  Two, A, owns the information. Two, B, has a right of access to the information. Or two, C,
[07:54.080 --> 07:58.480]  spends or contributes public money for the purpose of writing, producing, collecting,
[07:58.480 --> 08:05.520]  assembling, or maintaining the information. Or three, by an individual officer or employee
[08:05.520 --> 08:10.000]  of a governmental body in the officer's or employee's official capacity and the information
[08:10.000 --> 08:18.480]  pertains to official business of the governmental body. A, one, information is in connection with
[08:18.480 --> 08:23.680]  the transaction of official business that the information is created by, transmitted to,
[08:23.680 --> 08:29.040]  received by, or maintained by an officer or employee of the governmental body in the
[08:29.040 --> 08:35.040]  officer's or employee's official capacity. Or a person or entity performing official business
[08:35.040 --> 08:40.080]  or a governmental function on behalf of a governmental body and pertains to official
[08:40.080 --> 08:46.400]  business of the governmental body. A, two, the definition of public information provided by
[08:46.400 --> 08:51.920]  subsection A applies to and includes any electronic communication created, transmitted,
[08:51.920 --> 08:56.320]  received, or maintained on any device if the communication is in connection with the
[08:56.320 --> 09:02.880]  transaction of official business. B, the media on which public information is recorded includes
[09:02.880 --> 09:08.640]  paper, film, a magnetic, optical, solid state, or other device that can store an electronic signal.
[09:09.280 --> 09:14.720]  Tape, mylar, and physical material in which information may be recorded including linen,
[09:14.720 --> 09:21.520]  silk, and vellum. C, the general forms in which the media containing public information exists
[09:21.520 --> 09:27.360]  include a book, paper, letter, document, email, internet posting, text message, instant message,
[09:27.360 --> 09:34.880]  or other electronic communication, print out, photograph, film, tape, micro fish, micro film,
[09:34.880 --> 09:40.160]  photo stat, sign recording, map and drawing, and a voice, data, or video representation held in
[09:40.160 --> 09:48.400]  computer memory. Okay? Now 552.003 dealing with definitions and we're going to only look at a
[09:48.400 --> 09:57.920]  couple of those. Governmental body one or one governmental body A means a board, commission,
[09:57.920 --> 10:04.960]  department, committee, institution, agency, or office that is within or is created by the executive
[10:04.960 --> 10:11.200]  or legislative branch of state government and that is directed by one or more elected or appointed
[10:11.200 --> 10:18.800]  members. A county commissioner's court in the state, a municipal governing body in the state,
[10:19.440 --> 10:26.000]  a deliberative body that has rulemaking or quasi judicial power and that is classified as a department,
[10:26.000 --> 10:32.880]  agency, or political subdivision of a county or municipality, a school board of trustees,
[10:32.880 --> 10:38.800]  a county board of school trustees, a county board of education, the governing board of a
[10:38.800 --> 10:44.880]  special district, the governing body of a nonprofit corporation organized under chapter 67
[10:44.880 --> 10:51.040]  water code that provides a water supply or wastewater service or both and is exempt from
[10:51.040 --> 10:58.320]  abnormal taxation under section 11.30 tax code, a local workforce development board created under
[10:58.320 --> 11:05.520]  section 2308.253, a nonprofit corporation that is eligible to receive funds under the federal
[11:05.520 --> 11:11.040]  community services block grant program that is authorized by the state to serve a geographic
[11:11.040 --> 11:16.400]  area of the state, the part, section, or portion of an organization, corporation, commission,
[11:16.400 --> 11:22.320]  committee, institution, or agency that spins or that is supported in whole or in part by public
[11:22.320 --> 11:29.520]  funds and B does not include the judiciary. So governmental body does not include the judiciary.
[11:29.520 --> 11:37.760]  We got that part, right? Now, if we go down here a little further and we go to another section,
[11:38.800 --> 11:50.000]  which is 522.022, we can read the following. Categories of public information, examples.
[11:50.800 --> 11:57.120]  A, without limiting the amount or kind of information that is public information under
[11:57.120 --> 12:02.960]  this chapter, the following categories of information are public information and not
[12:02.960 --> 12:09.920]  accepted from required disclosure unless made confidential under this chapter or other law.
[12:10.880 --> 12:19.120]  One, a completed report, audit, evaluation, or investigation made of for or by a governmental
[12:19.120 --> 12:27.280]  body except is provided by section 552.108. Two, the name, sex, ethnicity, salary,
[12:27.280 --> 12:31.040]  title, and dates of employment of each employee and officer of a governmental body.
[12:32.320 --> 12:37.840]  Three, information in an account, voucher, or contract relating to the receipt or expenditure
[12:37.840 --> 12:44.160]  of public or other funds by a governmental body. Four, the name of each official and the final
[12:44.160 --> 12:50.480]  record of voting on all proceedings in a governmental body. Five, all working papers,
[12:50.480 --> 12:55.920]  research material, and information used to estimate the need for or expenditure of
[12:55.920 --> 13:01.840]  public funds or taxes by a governmental body or a completion of the estimate or all completion
[13:01.840 --> 13:08.400]  of the estimate. The name, place of business, and the name of the municipality to which local
[13:08.400 --> 13:14.880]  sales and use taxes are credited, if any, for the named person of a person reporting or paying
[13:14.880 --> 13:21.840]  sales and use taxes under chapter 151 tax code. A description of an agency's central and field
[13:21.840 --> 13:26.800]  organizations including the established places at which the public may obtain information,
[13:26.800 --> 13:33.440]  submit information, or request, or obtain decisions. The employees from whom the public may obtain
[13:33.440 --> 13:40.320]  information, submit information, or request, or obtain decisions. In the case of a uniform service,
[13:40.320 --> 13:44.240]  the members from whom the public may obtain information, submit information, or request,
[13:44.240 --> 13:49.920]  or obtain decisions, and the methods by which the public may obtain, submit information,
[13:49.920 --> 13:55.760]  or request, or obtain decisions. A statement of the general course and method by which an
[13:55.760 --> 14:00.960]  agency's functions are channeled and determined, including the nature and requirements of all
[14:00.960 --> 14:07.040]  formal and informal policies and procedures. 9. A rule of procedure, a description of forms
[14:07.040 --> 14:11.280]  available or the places at which forms may be obtained and instructions relating to the scope
[14:11.280 --> 14:17.440]  and content of all papers, reports, or examinations. 10. A substantive rule of general applicability
[14:17.440 --> 14:23.440]  adopted or issued by an agency as authorized by law, and a statement of general policy or
[14:23.440 --> 14:28.960]  interpretation of general applicability formulated and adopted by an agency. 11. Each amendment,
[14:28.960 --> 14:35.120]  revision or repeal of information described by subdivisions 7 through 10. 12. Final opinions,
[14:35.120 --> 14:39.440]  including concurring and dissenting opinions, and orders issued in the adjudication of cases.
[14:40.160 --> 14:47.040]  Now see right there? 12. Final opinions, including concurring and dissenting opinions,
[14:47.600 --> 14:57.360]  and orders issued in the adjudication of cases. 13. A policy, statement, or interpretation that
[14:57.360 --> 15:03.280]  has been adopted or issued by an agency. 14. Administrative staff manuals and instructions
[15:03.280 --> 15:09.760]  to staff that affect a member of the public. 15. Information regarded as open to the public
[15:09.760 --> 15:15.920]  under an agency's policies. 16. Information that is in a bill for attorney's fees and that
[15:15.920 --> 15:23.200]  is not privileged under the attorney-client privilege. 17. Information that is also contained
[15:23.200 --> 15:31.280]  in a public court record. 18. A settlement agreement to which a governmental body is a party.
[15:32.080 --> 15:37.920]  B. A court in this state may not order a governmental body or officer for public
[15:37.920 --> 15:44.000]  information to withhold from public inspection any category of public information described by
[15:44.000 --> 15:51.120]  Section A, or to not produce the category of public information for inspection or duplication,
[15:51.120 --> 15:58.640]  unless the category of information is confidential under this chapter or other law. Okay? Now right
[15:58.640 --> 16:05.440]  there, we have three sections out of 022 that we need to pay attention to. Subsection 12,
[16:05.440 --> 16:09.520]  dealing with the final opinions and disposition of a case and all information relating to that.
[16:10.800 --> 16:18.080]  17. Information that is also contained in a public court record, which a court case file is,
[16:18.080 --> 16:26.000]  and subsection B, the fact that a court may not prevent the production of that information.

[20:18.400 --> 20:27.600]  we read the following. Special right of access to confidential information. A, a person or a
[20:27.600 --> 20:34.640]  person's authorized representative has a special right of access beyond the right of the general
[20:34.640 --> 20:41.360]  public to information held by a governmental body that relates to the person and that is protected
[20:41.360 --> 20:46.400]  from public disclosure by laws intended to protect that person's privacy interest. B,
[20:46.400 --> 20:52.800]  a governmental body may not deny access to information to the person or the person's
[20:52.800 --> 20:58.800]  representative to whom the information relates on the grounds that the information is considered
[20:58.800 --> 21:04.800]  confidential by privacy principles under this chapter, but may assert its grounds for denial
[21:04.800 --> 21:10.000]  of access other provisions of this chapter or other law that are not intended to protect
[21:10.000 --> 21:16.480]  the person's privacy interest. C, a release of information under subsections A and B is not
[21:16.480 --> 21:24.080]  a defense under section 552.352. D, a person who receives information under this section may disclose
[21:24.080 --> 21:28.960]  the information to others only to the extent consistent with the authorized purposes for
[21:28.960 --> 21:34.480]  which consent to release of the information was obtained. E, access to information under this
[21:34.480 --> 21:41.760]  section shall be provided in the manner prescribed by sections 552.229 and 552.307.
[21:43.120 --> 21:50.240]  Now, what that tells us point blank is that when these courts are denying you access
[21:51.120 --> 21:58.240]  to a public adjudicatory case file that they are in violation of the Public Information Act,
[21:58.240 --> 22:10.080]  which is itself a crime. If you go down in chapter 552 and you look at chapter 5 or section 552.353
[22:10.080 --> 22:18.480]  of the Public Information Act, you can see the penalty and it reads this way. Failure or refusal
[22:18.480 --> 22:24.720]  of officer for public information to provide access to or copying of public information.
[22:24.720 --> 22:32.640]  Public information. A, an officer for public information or the officer's agent commits
[22:32.640 --> 22:39.680]  an offense if, with criminal negligence, the officer or the officer's agent fails or refuses
[22:39.680 --> 22:47.600]  to give access to or to permit or provide copying of public information to a requester as provided
[22:47.600 --> 22:53.680]  by this chapter. B, it is an affirmative defense to prosecution under subsection
[22:53.680 --> 22:58.640]  A that the officer for public information reasonably believed that public access to the
[22:58.640 --> 23:04.320]  requested information was not required and that one, the officer acted in a reasonable reliance
[23:04.320 --> 23:09.280]  on a court order or a written interpretation of this chapter contained in an opinion of a court
[23:09.280 --> 23:16.160]  of record or of the attorney general issued under sub chapter G. Two, the officer requested a decision
[23:16.160 --> 23:22.080]  from the attorney general in accordance with sub chapter G and the decision is pending or three,
[23:22.080 --> 23:26.240]  not later than the 10th calendar day after the date of receipt of a decision by the attorney
[23:26.240 --> 23:30.160]  general that the information is public, the officer or the governmental body for whom the
[23:31.520 --> 23:34.960]  defendant is the officer for public information followed a petition for a
[23:34.960 --> 23:39.280]  declaratory judgment against the attorney general in the Travis County District Court seeking
[23:39.280 --> 23:45.040]  relief from compliance with the decision of the attorney general as provided by section 552.324
[23:45.040 --> 23:50.800]  in the causes pending. C, it is an affirmative defense to prosecution under subsection A that
[23:50.800 --> 23:55.520]  a person or entity has not later than 10th calendar day after the date of receipt by a governmental
[23:55.520 --> 23:59.760]  body of a decision by the attorney general that the information is public, followed a cause of
[23:59.760 --> 24:04.160]  action seeking relief from compliance with the decision of the attorney general as provided
[24:04.160 --> 24:11.120]  by section 552.325 in the causes pending. D, it is an affirmative defense to prosecution
[24:11.120 --> 24:15.760]  under subsection A that the defendant is the agent of an officer for public information
[24:15.760 --> 24:19.760]  and that the agent reasonably relied on the written instruction of the officer for public
[24:19.760 --> 24:26.080]  information not to disclose the public information requested. E, an offense under this section is
[24:26.080 --> 24:33.200]  a misdemeanor punishable by one, a fine of not more than $1,000. Two, confinement in the county
[24:33.200 --> 24:39.680]  jail for not more than six months or three, both the fine and the confinement. A violation under
[24:39.680 --> 24:46.720]  this section constitutes official misconduct. So right there folks, you have a Class B misdemeanor
[24:46.720 --> 24:54.640]  offense coupled with the official misconduct, okay, all of which they can be removed from office for.
[24:56.320 --> 25:04.800]  So here we have clerks of courts, prosecutors, and lower court judges obstructing access

[25:44.160 --> 25:55.040]  agent of the judge, period. So when they break the law, the judge is breaking the law. Furthermore,
[25:55.040 --> 26:01.440]  if the judge is the one responsible for the policy they are complying with, then the judge has
[26:01.440 --> 26:08.160]  knowingly violated what the public information act clearly states they're required to do.
[26:09.040 --> 26:16.160]  And it especially says that no court can order the officer not to produce this, so they cannot
[26:16.160 --> 26:24.000]  lawfully produce a policy that would do the same thing. You see the problem here?
[26:24.000 --> 26:30.400]  There are plenty of affirmative defenses for government idiots at the bottom of this, but none
[26:30.400 --> 26:38.320]  of them would help them in this situation. When they deny you access to that record in a public
[26:38.320 --> 26:44.800]  court, they are violating the Public Information Act to the tune of a Class B jailable offense.
[26:46.800 --> 26:52.800]  What you should be doing is taking a copy of this statute in there with you and saying very
[26:52.800 --> 26:57.600]  clearly, you see right here where it says a public court record? You see right here where it says
[26:57.600 --> 27:02.720]  the adjudicatory record of the court? You see right here where it says the court cannot order you
[27:02.720 --> 27:06.720]  not to produce it? You see right here where it says that you are going to be committing a crime the
[27:06.720 --> 27:14.320]  moment you say I can't have it? And if you do say I can't have it for any reason, see that guy with
[27:14.320 --> 27:19.520]  the badge over there? I'm going to go to him with this statute and I'm going to press charges against
[27:19.520 --> 27:30.240]  you for violating this law. The first time I met Randy and went with him up to Amarillo,
[27:31.280 --> 27:35.600]  we spent the entire day doing this down at the courthouse and at the police department.

[28:31.840 --> 28:36.000]  Then the court demanded or the clerk demanded that they enter a plea
[28:36.000 --> 28:41.920]  and they did not. They declined to do that. The clerk has no authority to take a plea, none.
[28:43.600 --> 28:53.040]  Okay, the only person under Texas law that can demand a plea from an accused is a judge
[28:53.920 --> 29:01.360]  sitting in open court during an official proceeding that is written right into the
[29:01.360 --> 29:10.000]  code of criminal procedure. No one else, no prosecutor, no court clerk has any authority
[29:10.000 --> 29:16.160]  nor can they be delegated that authority to take a plea from you.
[29:18.160 --> 29:24.320]  But here's the kicker. This individual wound up getting a yellow postcard in the mail saying
[29:24.320 --> 29:30.880]  a warrant has been issued for your arrest. Now there is only two possibilities here for the
[29:30.880 --> 29:36.080]  existence of that warrant which I will cover on the other side of this break so y'all hang on
[29:36.080 --> 29:40.720]  and we'll get right back to that. On these two things though they're very important to make

[34:09.120 --> 34:16.960]  failing to enter a plea and converted something he's not even required to do by law into a crime
[34:16.960 --> 34:29.760]  or B they falsified the record and are charging him with failure to appear even though he did appear
[34:29.760 --> 34:40.720]  in full compliance with the citation. Nowhere on the citation does it or could it say that the
[34:40.720 --> 34:47.760]  individual is required to make an appearance before a magistrate and enter a plea. It doesn't say that.
[34:50.240 --> 34:58.640]  In fact in these lower courts the only time that the magistrate is authorized by law in
[34:58.640 --> 35:04.640]  a justice or municipal court to take a plea from the accused is found within chapter 45
[35:04.640 --> 35:13.600]  and it is only after the jury has been impaneled. That's chapter 45 of the code of criminal procedure.

[38:42.560 --> 38:47.360]  is it not? That's the only time an impaneled jury is sitting is in an open court.
[38:47.360 --> 39:00.640]  So you see folks right here you have proof positive that these idiots do not know the law
[39:00.640 --> 39:06.480]  that they pretend to hold you accountable to because they don't even know the ones that hold
[39:06.480 --> 39:15.440]  them accountable. And what's worse is that those that are responsible for ensuring that these laws
[39:15.440 --> 39:20.320]  have teeth and are effective refuse to enforce them against members of their own.
[39:24.240 --> 39:29.520]  Now let me give you one other little tidbit of information regarding this and that is most of
[39:29.520 --> 39:33.840]  these courts and other places where you're asking for copies of records and information
[39:34.880 --> 39:43.600]  are blatantly over and blatantly and illegally overcharging you for copies. Most of these places
[39:43.600 --> 39:48.880]  tell you they want a dollar a page or some BS like that for any information you're getting from them.
[39:49.520 --> 40:00.320]  This too is illegal. This is an opinion written by none other than Greg Abbott in 2013. It is
[40:00.320 --> 40:06.800]  directed at Byron Lyons the chief deputy of the Polk County Sheriff's Office. Someone emailed this
[40:06.800 --> 40:19.280]  to me and I'm going to read it to you regarding complaint of overcharges okay ml-483-574-13.
[40:19.280 --> 40:28.720]  It doesn't have an actual opinion number on it. Now dear Mr. Lyons the office of the attorney
[40:28.720 --> 40:34.080]  general received the enclosed complaint alleging the Polk County Sheriff's Office here and after
[40:34.080 --> 40:39.840]  the Sheriff's Office is overcharging for copies of public information under the Public Information
[40:39.840 --> 40:49.360]  Act i.e. the Act. Chapter 552 of the government code the complaint was assigned ID number 483574.
[40:50.720 --> 40:55.920]  The Sheriff's Office received a request for information related to the requesters incarceration.
[40:56.640 --> 41:01.520]  The Sheriff's Office provided the requester a written response stating charges in the amount
[41:01.520 --> 41:09.040]  of $30 for copies of the requested information. These stated charges were for 20 pages of paper
[41:09.040 --> 41:16.720]  at a cost of $1 each and two disquets at a cost of $5 each. The Sheriff's Office informed the
[41:16.720 --> 41:21.600]  requester these charges were approved by the Polk County Commissioner's Court here and after
[41:21.600 --> 41:27.520]  the Commissioner's Court. However the requester believes these charges do not comply with the
[41:27.520 --> 41:35.200]  Act or the cost rules promulgated by this office. Pursuant to Section 552.262 of the government
[41:35.200 --> 41:41.600]  code a governmental body other than a state agency may determine its own charges for providing copies
[41:41.600 --> 41:52.240]  of public information. Government Code Section 552.262A okay however these charges may not exceed
[41:52.240 --> 42:00.240]  25% more than the amount established by the rules of the Attorney General. IDC also
[42:01.920 --> 42:09.840]  Texas Attorney General opinion or I'm sorry Texas Administrative Code Section 70.1 and 0.12.
[42:10.560 --> 42:15.600]  The rules established by the Attorney General for providing copies of public information state.
[42:15.600 --> 42:30.800]  One the charge for standard paper copies reproduced by means of an office machine
[42:30.800 --> 42:39.360]  copier or computer printer is ten cents per page or part of a page. Each side has recorded
[42:39.360 --> 42:47.120]  information that has recorded information is considered a page. Two the charges for non-standard
[42:47.120 --> 42:57.520]  copies are a a diskette one dollar. In one Texas Administrative Code Section 70.3 1 and 2A
[42:58.320 --> 43:03.200]  thus although the Act permits the Commissioner's Court to set its own charges for providing copies
[43:03.200 --> 43:09.920]  of public information it expressly states that those costs cannot exceed 25% more than the
[43:09.920 --> 43:16.640]  cost established by this office. Accordingly the maximum the Sheriff's Office may charge for
[43:16.640 --> 43:24.160]  paper copies is 12.5 cents per page and the maximum it may charge for a diskette is one
[43:24.160 --> 43:30.800]  dollar and 25 per diskette. Within five business days after the date you receive this letter you
[43:30.800 --> 43:36.160]  must notify the requester of the updated charges. In addition the Sheriff's Office must provide
[43:36.160 --> 43:41.120]  this office with a copy of the updated charges. Upon our receipt of a copy of the updated charges
[43:41.120 --> 43:46.640]  we will close our file on this matter. All right I'll go into a quick discussion about this on

[53:26.400 --> 53:39.360]  from unreasonable searches and seizures if this is a false arrest if the arrest is unlawful or
