[03:42.840 --> 03:50.960]  I did, during the week, get a couple of questions about the documentation I'm producing for
[03:50.960 --> 03:53.440]  the traffic ticket tool.
[03:53.440 --> 04:04.280]  What I do, I think, is somewhat different than Eddie's primary approach, but we are
[04:04.280 --> 04:06.720]  essentially in sync.
[04:06.720 --> 04:10.000]  I think I just started a little bit different place.
[04:10.000 --> 04:16.200]  The place I start at is jurisdiction.
[04:16.200 --> 04:23.120]  Before we get to the merits, I want to talk about who the cop is, what authority is, what
[04:23.120 --> 04:29.680]  authority had to pull me over, what authority the court has, and all those interesting little
[04:29.680 --> 04:36.480]  necessities there in law called threshold issues.
[04:36.480 --> 04:43.040]  For the most part, the way I read the code, unless you have been cited by the Department
[04:43.040 --> 04:51.760]  of Public Safety, the officer cannot get over those pesky little threshold issues.
[04:51.760 --> 04:58.400]  The first thing we start with, and this actually comes from Eddie's input, is a special appearance.
[04:58.400 --> 05:02.920]  A special appearance is a challenge to subject matter jurisdiction.
[05:02.920 --> 05:07.360]  It says that the dependent was charged with the violation of the text transportation
[05:07.360 --> 05:08.360]  code.
[05:08.360 --> 05:14.960]  Inasmuch as enforcement of the text transportation code is restricted to only certain peace officers
[05:14.960 --> 05:19.160]  who have met the requirement to the Department of Public Safety, the text administrative
[05:19.160 --> 05:25.760]  code, and the text transportation code, it may not be presumed that any particular peace
[05:25.760 --> 05:28.160]  officer has the authority to enforce.
[05:28.160 --> 05:33.360]  Therefore, in order for the complainant to meet the requirements, the fair notice is
[05:33.360 --> 05:35.600]  required by the Texas Rules Procedure.
[05:35.600 --> 05:41.560]  The complainant must stipulate under oath as to the specific authority of the arresting
[05:41.560 --> 05:42.560]  officer.
[05:42.560 --> 05:51.080]  I ask the court to take judicial notice and absent a showing of authority to it.
[05:51.080 --> 05:56.520]  We challenge the impersonal jurisdiction of the court.
[05:56.520 --> 06:03.920]  Now that's the first one, the first document that we file.
[06:03.920 --> 06:09.760]  The second one, as soon as I can get word to go to where it's supposed to, so I can
[06:09.760 --> 06:15.840]  open them, is a counterclaim.
[06:15.840 --> 06:27.200]  And the point of the counterclaim is that the police officer went to the court and gave
[06:27.200 --> 06:35.280]  the court notice that he had reason to believe that the defendant had commuted a crime.
[06:35.280 --> 06:38.480]  Okay, fair enough.
[06:38.480 --> 06:45.000]  Well, we go to the court and give him notice of the same thing, because we have reason
[06:45.000 --> 06:51.920]  to believe that the officer, if he's a municipal officer or a sheriff's deputy, did not have
[06:51.920 --> 06:55.880]  authority to enforce the transportation code.
[06:55.880 --> 07:01.520]  So therefore, when he turned his lights on and the defendant slowed down 20 miles an
[07:01.520 --> 07:07.160]  hour or moved over a lane and the officer did not pull around, the presumption must
[07:07.160 --> 07:19.120]  be that the officer was making under 545.421 Texas transportation code, because that's
[07:19.120 --> 07:22.920]  the only code that requires you to pull over and stop.
[07:22.920 --> 07:31.640]  Well, okay, I want to see his authority under Texas transportation code.
[07:31.640 --> 07:38.080]  And we've already done some research, so we can check his name or her name, against
[07:38.080 --> 07:47.080]  a list of compliments of Scott Richardson, of all of the officers in Texas that are not
[07:47.080 --> 07:53.360]  DPS officers who are authorized to enforce the transportation code, and there's only
[07:53.360 --> 07:59.080]  about 200 of them, none of them are municipal officers.
[07:59.080 --> 08:06.840]  Okay, so we have reason to believe that the officer did not have authority to enforce
[08:06.840 --> 08:14.920]  the transportation code, therefore, when he turned the lights on and didn't pull around
[08:14.920 --> 08:22.560]  me and forced me to pull over, then he was exerting or purporting to exert an authority
[08:22.560 --> 08:30.280]  he did not express to have it in the process, arrested my freedom of movement, and seized
[08:30.280 --> 08:37.080]  me for purposes of Fourth Amendment, to die and be in my right to be free from unreasonable
[08:37.080 --> 08:41.400]  search or seizure.
[08:41.400 --> 08:47.520]  That's a violation of 39.03 Texas penal code, official oppression, and that's what everybody
[08:47.520 --> 08:50.880]  in Texas should have memorized.
[08:50.880 --> 08:55.720]  A public official acting under the color or pretentious authority exerts a purport to
[08:55.720 --> 08:59.680]  exert an authority he does not expressly have and in the process denies a citizen in the
[08:59.680 --> 09:05.040]  pool of free access to or enjoyment of a right, that's the class A misdemeanor in the state
[09:05.040 --> 09:06.040]  of Texas.
[09:06.040 --> 09:17.880]  However, at the time, the officer was cloaked in the color of his uniform as a peace officer,
[09:17.880 --> 09:22.840]  but he wasn't acting in the capacity of a peace officer, he was acting in the capacity
[09:22.840 --> 09:26.240]  of a police officer.
[09:26.240 --> 09:29.000]  Texas makes a distinction between the two.
[09:29.000 --> 09:38.160]  A peace officer is authorized to enforce the penal code, not the transportation code.
[09:38.160 --> 09:45.040]  Department of Public Safety was created for the purpose of enforcing the Texas transportation
[09:45.040 --> 09:47.120]  code.
[09:47.120 --> 09:55.080]  And certain sheriff's deputies can be certified to enforce the transportation code, but haven't
[09:55.080 --> 09:57.440]  found any that are yet.
[09:57.440 --> 10:05.120]  I just got a response to an information request that I filed with the Department of Public
[10:05.120 --> 10:11.160]  Safety, I'm sorry, with the Wise County Sheriff's Department.
[10:11.160 --> 10:19.360]  That requested evidence of the appointment of five officers to enforce transportation
[10:19.360 --> 10:26.400]  code under 701.001, Texas transportation code.
[10:26.400 --> 10:31.400]  Wise County Commissioners Court has not made any authorization specifically under text
[10:31.400 --> 10:37.640]  transportation code 701.001 as far as we are aware.
[10:37.640 --> 10:42.720]  Statutory, that's collateral estoppel.
[10:42.720 --> 10:50.360]  Now I get to go into court and say this officer had no authority to enforce as stipulated
[10:50.360 --> 10:52.360]  by the Sheriff's Department.
[10:52.360 --> 10:58.440]  Therefore, his act was an act of official oppression that he committed while cloaked
[10:58.440 --> 11:07.120]  in the color of the office of a public official, but he was not acting under authority of that
[11:07.120 --> 11:12.920]  officer of the public official and therefore was impersonating a public official, that's
[11:12.920 --> 11:17.160]  a state jail felony in the state of Texas.
[11:17.160 --> 11:25.040]  But in as much as he seized me and my person and did so while prominently displaying a
[11:25.040 --> 11:33.680]  deadly weapon, first degree felony aggravated assault 2202B2A, Texas penal code, I didn't
[11:33.680 --> 11:35.240]  make it up.
[11:35.240 --> 11:38.080]  I just read the code.
[11:38.080 --> 11:44.080]  So I just filed this against the Sheriff's Deputy in Wise County recently, claiming that
[11:44.080 --> 11:45.600]  he didn't have the authority.
[11:45.600 --> 11:52.040]  Now I have a letter from the Sheriff's Department stipulating that he didn't have authority
[11:52.040 --> 11:57.640]  and that's one of the next documents that we send is an information request requesting
[11:57.640 --> 11:59.640]  authority to enforce.
[11:59.640 --> 12:06.320]  We send that to the Sheriff's Department if it is a county deputy that wrote the ticket,
[12:06.320 --> 12:09.680]  if it's a municipal police office.
[12:09.680 --> 12:18.000]  We send the authority to enforce request and we send a request for memorandum of understanding
[12:18.000 --> 12:23.560]  between the Department of Public Safety and the municipality.
[12:23.560 --> 12:27.720]  Never had one of them have that either.
[12:27.720 --> 12:34.960]  But in order for a municipal officer to enforce any portion of the Texas Transportation Code,
[12:34.960 --> 12:40.280]  they would have, the city would have to have a memorandum of understanding with the Department
[12:40.280 --> 12:47.320]  of Public Safety and even then only they could only have one officer in force and that officer
[12:47.320 --> 12:52.200]  could only do vehicle inspections.
[12:52.200 --> 12:54.280]  That's it.
[12:54.280 --> 12:58.960]  So second thing we filed is a counterclaim which includes the criminal complaint against
[12:58.960 --> 12:59.960]  the officer.
[12:59.960 --> 13:04.480]  We say to the judge, the officer came to you and accused me of a crime.
[13:04.480 --> 13:06.880]  He didn't do so in his capacity as an officer.
[13:06.880 --> 13:15.600]  He did so in his capacity as a private citizen because officers can't file criminal complaints.
[13:15.600 --> 13:20.400]  Only private citizens can file criminal complaints.
[13:20.400 --> 13:25.160]  So when he filed the complaint, he did so in his capacity as a credible person in the
[13:25.160 --> 13:26.160]  state of Texas.
[13:26.160 --> 13:32.680]  Well, I filed one in my capacity as a credible person in the state of Texas.
[13:32.680 --> 13:39.440]  Credible person defined as a person over the 18, over 18 years of age, never convicted
[13:39.440 --> 13:40.440]  of a felony.
[13:40.440 --> 13:45.120]  I am, by definition, credible.
[13:45.120 --> 13:50.240]  I once had a policeman tell me, well, Mr. Kelton, I don't believe you.
[13:50.240 --> 13:53.800]  Nobody cares what you believe.
[13:53.800 --> 14:00.640]  I am what the law says I am and you don't get to question it.
[14:00.640 --> 14:10.000]  So as a credible person, I made this complaint to the judge and I see what the judge does.
[14:10.000 --> 14:17.880]  The judge accepts and prosecutes this complaint against me without holding an examining trial.
[14:17.880 --> 14:21.800]  We'll get to that later.
[14:21.800 --> 14:26.680]  But when I make an accusation against the officer, which is much more serious than the
[14:26.680 --> 14:32.720]  one the officer made against me, the judge does nothing.
[14:32.720 --> 14:40.640]  Well, that's what I hope he does because then I come back at the judge with shielding from
[14:40.640 --> 14:43.560]  prosecution 30 to 5 people code.
[14:43.560 --> 14:48.000]  That will be in the second part of the tool.
[14:48.000 --> 14:51.200]  The first part of the tool is setting him up.
[14:51.200 --> 15:01.920]  I just went to a traffic hearing in a town I live in and judge was unbelievably dismissive
[15:01.920 --> 15:08.800]  and arrogant and a big, sit and tear little his arrogance off.
[15:08.800 --> 15:14.360]  I promised my city manager I wouldn't go after the city of Libya.
[15:14.360 --> 15:19.520]  I went after the city of Decatur and the city of Decatur called the city of Boyd and asked
[15:19.520 --> 15:25.920]  the city manager what kind of deal he had with me because they wanted the same one.
[15:25.920 --> 15:29.480]  But they're not going to get it.
[15:29.480 --> 15:39.800]  This judge, extremely arrogant and dismissive, he completely ignored law.
[15:39.800 --> 15:50.640]  So we do the first set of documents for the purpose of setting him up for the second stage.
[15:50.640 --> 15:56.320]  Everything we do at the beginning is just to set the record.
[15:56.320 --> 16:01.400]  So to get the counter claim, the court will ignore it.
[16:01.400 --> 16:05.240]  Next document, examining trial.
[16:05.240 --> 16:06.680]  We demanded examining trial.
[16:06.680 --> 16:16.000]  I just wrote an appeal for someone in a municipal court to the ordinance case and we'll talk
[16:16.000 --> 16:22.560]  about what they did and what their problem with it was as concerns in examining trial.
[16:22.560 --> 16:28.640]  They got a train coming at them and they didn't even know it was on the tracks.

[19:37.360 --> 19:47.520]  Peace, your municipal court, they can only handle classy misdemeanors.
[19:47.520 --> 19:56.640]  When you come to the court the first time, the question is, what authority does the court
[19:56.640 --> 20:00.600]  have to order someone to appear?
[20:00.600 --> 20:07.480]  In the appeal I just finished, we had someone that owns a business in a small town.
[20:07.480 --> 20:14.400]  His wife was on the city council, incurred the wrath of the city manager, got off the
[20:14.400 --> 20:19.960]  city council and immediately the city manager sent code enforcement out after her and the
[20:19.960 --> 20:20.960]  husband.
[20:20.960 --> 20:28.160]  And if I had a whole bunch of complaints on his mechanics business because he had cars
[20:28.160 --> 20:32.880]  sitting around, well that's the nature of mechanics business, do you have cars sitting
[20:32.880 --> 20:33.880]  around?
[20:33.880 --> 20:45.520]  Anyway, he got a notice of violations and this is back in April or March and he sends
[20:45.520 --> 20:52.400]  him a demand for a jury trial, but it wasn't until May that they told him that he had to
[20:52.400 --> 20:57.560]  respond or appear in court, so he filed a demand for a jury trial, but it wasn't until
[20:57.560 --> 21:03.400]  March until they actually filed a complaint, I'm sorry, it wasn't until May that they actually
[21:03.400 --> 21:04.400]  filed the complaints.
[21:04.400 --> 21:09.800]  So they filed the complaints with the magistrate and then they had a sheriff's deputy come
[21:09.800 --> 21:18.520]  out and give him a summons and he gets a summons and he goes to court and they start talking
[21:18.520 --> 21:29.040]  about all the issues and I said, whoa, wait a minute, at the time there were no motions
[21:29.040 --> 21:32.720]  filed in the record.
[21:32.720 --> 21:39.960]  So under 28.01, Texas Code of Criminal Procedure, a judge can order someone to come to court
[21:39.960 --> 21:49.720]  for the purpose of an arraignment or trial on the merits or hearings on motions and
[21:49.720 --> 21:50.720]  pleadings.
[21:50.720 --> 22:02.600]  That's it, under 26.01 and I was really surprised when I saw this one, 26.01 is the section
[22:02.600 --> 22:13.560]  on arraignments, 26.02 says an arraignment is a hearing for the purpose of determining
[22:13.560 --> 22:23.600]  the identity of the accused and taking a plea, an arraignment is done by the trial court,
[22:23.600 --> 22:29.120]  but you can't get to the trial court until something else happened and that's an examining
[22:29.120 --> 22:31.160]  trial.
[22:31.160 --> 22:40.080]  So in law, when can a magistrate order someone to come to court?
[22:40.080 --> 22:48.320]  Now if you're arrested for an on-site offense, the officer is commanded to take you directly
[22:48.320 --> 22:56.000]  to the nearest magistrate, that's one way to get to court, but if you don't get arrested
[22:56.000 --> 23:01.160]  and there's a charged file against you, how do they get you to court?
[23:01.160 --> 23:07.880]  The trial judge can't do it because under 16.17, Texas Code of Criminal Procedure, there
[23:07.880 --> 23:13.360]  has to be an order in the court finding probable cause.
[23:13.360 --> 23:23.480]  If there is no order, then the defendant has a right to dismissal and that's under the
[23:23.480 --> 23:31.320]  section of examining trial, but the power to summon is not in chapter 16, it's not in
[23:31.320 --> 23:35.840]  chapter 14, chapter 14 is arrest without a warrant.
[23:35.840 --> 23:48.920]  Chapter 15, arrest with a warrant, 15.03 says that when a magistrate, not a judge, a magistrate
[23:48.920 --> 23:54.240]  is presented with a criminal accusation.
[23:54.240 --> 24:04.040]  If he determines there's a reasonable probable cause, he may issue a warrant or a summons.
[24:04.040 --> 24:09.640]  And the warrant, if he issues a warrant, the warrant will say, arrest this person and bring
[24:09.640 --> 24:17.240]  him before me and it will say that because the magistrate already held an examining
[24:17.240 --> 24:24.200]  trial, but it was an ex parte examining trial.
[24:24.200 --> 24:33.080]  If there's a warrant issued on an original criminal accusation, the warrant, the complaint
[24:33.080 --> 24:38.360]  is presented to a magistrate, the magistrate examines into the sufficiency of the allegation
[24:38.360 --> 24:41.760]  and finds it sufficient, he'll issue a warrant.

[25:00.440 --> 25:06.920]  a warrant for your arrest based on their assertions, but it was ex parte.
[25:06.920 --> 25:11.080]  So as soon as they arrest you, they are to bring you back before the magistrate who issued
[25:11.080 --> 25:16.680]  that warrant, and now he's to hold another examining trial.
[25:16.680 --> 25:20.080]  This time with both parties present.
[25:20.080 --> 25:25.880]  14.06 requires you to be taken directly to a magistrate, 15.17 requires you to be taken
[25:25.880 --> 25:28.120]  directly to a magistrate.
[25:28.120 --> 25:32.160]  Without a warrant, with a warrant makes no difference.
[25:32.160 --> 25:38.960]  They must hold an examining trial and I'm sorry, back to 15.03.
[25:38.960 --> 25:44.520]  The judge can issue the warrant, but if he knows the person, and he knows the person

[25:51.440 --> 25:58.800]  But when he got to court, he didn't hold an examining trial, what do you call that?
[25:58.800 --> 26:04.560]  I call that official oppression, the now to do process, and the lawyer, the prosecutor

[26:13.040 --> 26:18.920]  Under the American Bar Association Standards for the Prosecutoral Function, the prosecuting
[26:18.920 --> 26:24.720]  attorney had a duty of candor to the court to give the court notice that it was in violation
[26:24.720 --> 26:27.040]  of law.
[26:27.040 --> 26:31.160]  That gets a nice bar grievance against the prosecutor, it gets a bar grievance against
[26:31.160 --> 26:36.800]  the judge because this is a court record, and it gets criminal complaints against the
[26:36.800 --> 26:42.160]  judge of official oppression.
[26:42.160 --> 26:50.600]  Okay, examining trial, next, motion in limony, and this is one specifically someone asked
[26:50.600 --> 26:57.880]  me to address, I don't need to go too deep into motion in limony, the main thing about
[26:57.880 --> 27:00.440]  a motion in limony.
[27:00.440 --> 27:11.720]  The motion in limony lists all kinds of issues and questions the prosecution cannot go to.
[27:11.720 --> 27:20.880]  You're asking the judge to order the prosecutor not to ask any questions that are in the motion
[27:20.880 --> 27:24.040]  in limony.
[27:24.040 --> 27:28.520]  I have a nice big one here, it goes to everything.
[27:28.520 --> 27:35.520]  And the one we didn't get to yet was the notice of preservation of rights, and in our notice
[27:35.520 --> 27:42.000]  of preservation of rights, we object to oral argument since we're pro se, it would be unfair
[27:42.000 --> 27:45.600]  to have oral argument with learning counsel.
[27:45.600 --> 27:53.720]  We demand speedy trial, we notice the court that we do not waive any right unless that
[27:53.720 --> 28:02.040]  right is waived in court, free of coercion, with full disclosure.
[28:02.040 --> 28:05.000]  That's all, with full disclosure.
[28:05.000 --> 28:10.960]  We also demand that the court rule on every issue brought before the court of failure
[28:10.960 --> 28:18.240]  to rule on any one of one issues will be considered a denial in your right to petition the court

[28:23.400 --> 28:31.280]  So we want the judge to rule on every issue, well this one's got a lot of issues.

[28:36.120 --> 28:43.600]  you can do all that on the punishment phase, but you can't in the trial phase.

[28:46.720 --> 28:52.960]  So it's a great motion, it'll really annoy them, especially in the matter of a classy
[28:52.960 --> 28:56.320]  misdemeanor because it's all about the money.
[28:56.320 --> 29:02.000]  They want to run you through the meal like cattle through a chute.
[29:02.000 --> 29:10.920]  They don't want to have to go through all this pesky nonsense about due process.
[29:10.920 --> 29:18.360]  And our final motion is challenge subject manager jurisdiction.

[29:20.200 --> 29:26.360]  Federal appearance is a challenge to subject manager jurisdiction, but it's a challenge
[29:26.360 --> 29:30.520]  to jurisdiction over the person.
[29:30.520 --> 29:35.680]  The subject manager jurisdiction challenge is a challenge of the authority of the court
[29:35.680 --> 29:40.520]  to enforce the statutory scheme.
[29:40.520 --> 29:45.200]  And then the last one I have in my list right now is a TECOS complaint.
[29:45.200 --> 29:50.040]  So not only do we file a criminal complaint against the officer, we file a professional

[33:44.960 --> 33:51.880]  Now the officer, since we charged him with the most outrageous thing we could think of
[33:51.880 --> 33:57.920]  or we could pull from the code, and that's first-degree felony aggravated assault, and
[33:57.920 --> 34:03.880]  we can get there because of that pistol he's got on his hip, he doesn't really expect that
[34:03.880 --> 34:08.320]  he'll be prosecuted, and we really don't want him prosecuted.
[34:08.320 --> 34:14.960]  We just try to get his attention, and what we're actually trying to do is get the judge
[34:14.960 --> 34:23.280]  not to act on our complaint, never ask a public official to do anything you actually want
[34:23.280 --> 34:28.800]  them to do, because you never ask them to do anything that the law does not command
[34:28.800 --> 34:32.800]  them to do, and when they don't, you get to whack them good.
[34:32.800 --> 34:36.760]  You get to that in the second round, this is still the first round.
[34:36.760 --> 34:45.760]  What will hurt the officer is a T-close complaint, Texas Commission on Law Enforcement, the
[34:45.760 --> 34:54.840]  governing agency that regulates, certifies and regulates police officers.
[34:54.840 --> 34:59.760]  That complaint, when T-close gets it, they're very seldom to do anything about it, they
[34:59.760 --> 35:09.840]  just toss it, kind of like the bar does, but like the bar, the officer's bond rating
[35:09.840 --> 35:16.280]  is based to a large part on complaints, or almost exclusively on the complaints that
[35:16.280 --> 35:24.600]  he gets, and he either gets complaints to the jurisdiction that he works for, or T-close
[35:24.600 --> 35:25.600]  complaints.
[35:25.600 --> 35:30.760]  Now the jurisdictions will try to bury the complaints you filed there, so I'm going to
[35:30.760 --> 35:36.920]  suggest don't waste your time, if you're going to file a complaint, file it with the T-close,
[35:36.920 --> 35:45.680]  the Texas Commission on Law Enforcement, they'll bury it too, but that goes on his record
[35:45.680 --> 35:52.440]  for purposes of insurance, you get that, that officer gets a half a dozen T-close complaints
[35:52.440 --> 36:02.240]  against him, and the whole jurisdiction's bond rating will go up, the jurisdiction will
[36:02.240 --> 36:07.560]  not be able to afford to keep him, it doesn't make any difference how good he is, it doesn't
[36:07.560 --> 36:13.120]  make any difference how qualified he is, if they have to pay more for insurance for every
[36:13.120 --> 36:22.400]  officer they have because of him, he's history, and he knows it, so when he gets the T-close
[36:22.400 --> 36:30.400]  complaint on top of the criminal complaint, he is not going to be a happy camper, and
[36:30.400 --> 36:34.720]  that's the idea, all of this stuff we've been doing to try to get these guys to follow
[36:34.720 --> 36:43.160]  law, they just ignore it, they don't care, I went into this hearing Wednesday, and I
[36:43.160 --> 36:52.760]  had already hammered this, the guy who's the judge in Boyd, the town I live in, is a prosecuting
[36:52.760 --> 37:01.000]  attorney in Decatur, the city of the county seat, and I went up to Decatur and asked the
[37:01.000 --> 37:07.640]  call the sheriff and asked him to arrest the bailiff because he wouldn't let me go in
[37:07.640 --> 37:15.600]  the courtroom with my cell phone, and I told him that I wanted to record the proceedings,
[37:15.600 --> 37:19.360]  and he blocked me from doing that, so I called the sheriff, called the local police and had
[37:19.360 --> 37:28.080]  a deputy come out, and I filled out a criminal complaint against the bailiff.
[37:28.080 --> 37:35.480]  So I went to hearing, now I've got the prosecuting attorney, now he's the judge in this case,
[37:35.480 --> 37:42.760]  and before the court started, I went up to him and I said, Your Honor, I intend to record
[37:42.760 --> 37:52.160]  these proceedings, he said, Mr. Kelton, I'm not going to allow that, oh you're not, well
[37:52.160 --> 38:00.040]  judge, I figured you would have read Turner Driver by now, and he just ignored me, well
[38:00.040 --> 38:05.600]  let's see if he ignores class A, Bs to mean official oppression when I filed it with the
[38:05.600 --> 38:11.520]  grand jury, and when I filed it with the state commission on judicial conduct, and when I
[38:11.520 --> 38:17.560]  filed it with the bar association in the form of professional conduct complaints in both
[38:17.560 --> 38:23.960]  regards, and then the guy I was there to help, he's a personal friend of mine, he files a
[38:23.960 --> 38:30.640]  set of complaints too, and bar grieves him, and judicial conduct complaint, and his wife
[38:30.640 --> 38:38.040]  files a bar grievance against him, and see how that works for him, that's just one person,
[38:38.040 --> 38:46.240]  one ticket, three bar grievances, he works for his mother's law firm, they won't be able
[38:46.240 --> 38:55.680]  to get malpractice insurance, he can't drive it up in a nice new yellow vet, I wonder how
[38:55.680 --> 39:01.200]  he's going to afford that yellow vet when he's asking people if they won't prize with
[39:01.200 --> 39:07.880]  that order, so anyway we're going to take the fight back to him, we don't ask him to
[39:07.880 --> 39:14.360]  do anything that the law does not command them to do, but all of these documents are
[39:14.360 --> 39:25.200]  for the first hearing, the first hearing is when you go to the court the way you promise
[39:25.200 --> 39:35.160]  to do when you sign the ticket, okay, when you go to that court I'm just finishing up
[39:35.160 --> 39:43.680]  a questionnaire for that hearing, and this is where I really begin to implement the electronic
[39:43.680 --> 39:51.760]  lawyer, I have been 10 years working on a set of technologies, and I've got them pretty
[39:51.760 --> 39:58.960]  well down, there's some details I'm still working out in it, but I'm really close to
[39:58.960 --> 40:05.240]  having this done, you go to that first hearing and we're making up a sheet that says this
[40:05.240 --> 40:13.200]  is what you can expect to happen, but whatever you do don't screw it up, don't give them
[40:13.200 --> 40:17.880]  legal advice, don't tell them what they're supposed to do, you're not their lawyer, they
[40:17.880 --> 40:27.440]  need a lawyer to hire one, your purpose there is to get them to do what they want to do,
[40:27.440 --> 40:34.080]  and what they're trained to do, because it's horribly illegal, so you don't want to screw
[40:34.080 --> 40:39.760]  that up, never interfere with someone when they're screwing up, so you go in there and
[40:39.760 --> 40:46.680]  the clerk is going to ask you for a plea, she's going to say how do you plead, and you're
[40:46.680 --> 40:55.280]  going to say oh, I already did that, I filed them with the court, you need to go check,
[40:55.280 --> 41:01.440]  and she's likely not to get it, I've never had one that did, and I need you to give me
[41:01.440 --> 41:10.200]  a plea, okay I'll give you a plea to the jurisdiction and special appearance, but if you can't
[41:10.200 --> 41:15.680]  remember all that stuff, just give her a plea, you don't care, don't argue with her because
[41:15.680 --> 41:25.160]  if you say anything to that clerk, that's not what she wants to hear or expects to hear,
[41:25.160 --> 41:35.040]  any deviation, any objection at all, she is trained to consider that as a threat, yeah
[41:35.040 --> 41:39.440]  it won't take much to get her to call the bailiff over and he'll come over dragging
[41:39.440 --> 41:43.760]  his knuckles, and he will let you know all the horrible stuff he's going to do to you
[41:43.760 --> 41:50.520]  if you don't shut up and do what you're told, so whether to then invoke that kind of thing,
[41:50.520 --> 41:56.760]  just go ahead and sign it, that's what we want, and when you come out, you go through
[41:56.760 --> 42:05.480]  my questionnaire, and it took about two days to put this together, it's pretty big, it's
[42:05.480 --> 42:11.840]  pretty extensive, but I've got a method for doing that, and the reason I say that is,
[42:11.840 --> 42:16.800]  no matter what happens at that hearing, I've got it in this questionnaire, there may be
[42:16.800 --> 42:21.000]  some oddball thing that can happen, but when somebody comes up with that, I'll go look
[42:21.000 --> 42:25.280]  at the questionnaire and I'll say okay, where can I ask the question that'll go to that
[42:25.280 --> 42:30.320]  issue, and I'll stitch that question in there, so if that comes up again, it's already in
[42:30.320 --> 42:39.240]  the questionnaire, this is how we build a tool that addresses everything, you go to this
[42:39.240 --> 42:44.480]  hearing, they do their little deal, you come home, the next day you send them a stack of
[42:44.480 --> 42:50.600]  documents, criminal complaint against the clerk, criminal complaint against the judge,
[42:50.600 --> 42:56.720]  judicial conduct complaint against the judge, depending on whether or not you had any issues
[42:56.720 --> 43:02.680]  with the bailiff, criminal charges against the bailiff, he goes against the bailiff,
[43:02.680 --> 43:07.320]  then you get through that hearing, and then they'll send you a notice to come to another
[43:07.320 --> 43:14.760]  hearing, that's the next questionnaire I'm going to write, was there a judge present,
[43:14.760 --> 43:21.320]  did the judge hold a hearing, were you directed to a prosecuting attorney, all of those things
[43:21.320 --> 43:27.000]  anybody's had a ticket's familiar with, and we just walk through what occurs there, and
[43:27.000 --> 43:32.720]  we create another set of complaints, you go home from that one the next day, boom, you
[43:32.720 --> 43:41.240]  hit them with another stack of documents, at the end of the day it's all about the money,
[43:41.240 --> 43:46.480]  and this will give them a whole new calculation, okay we've got a couple of calls on, we're

[01:03:47.600 --> 01:04:05.600]  Well, I tell you, if you read the procedures on further down, you can tell that's almost exactly what they try to do in the traffic courts and most other minor things in municipal court and stuff like that.
[01:04:05.600 --> 01:04:28.600]  You come in, you make a plea, da, da, da. And one of the things it has also is that if, oh yeah, and there it's talking about the name as well, that they don't have to allege that it was falsely incorporated.
[01:04:28.600 --> 01:04:48.600]  Of course, yeah. And they can use any name by which it is known. They don't have to use the actual, strictly technically, the formal name that it goes by, any name it's known by.
[01:04:48.600 --> 01:05:06.600]  Yeah, but there's a problem with that story and that goes to 1707. A corporation is a legal fiction, not a living, breathing, hearing being.
[01:05:06.600 --> 01:05:17.600]  So not being a living, breathing, hearing being, it can't come into court and represent itself. It must be represented by counsel.
[01:05:17.600 --> 01:05:30.600]  So where you go before a tribunal, then it reads you your rights and one of the rights it reads you is your right to be represented by counsel.
[01:05:30.600 --> 01:05:45.600]  You can't presume that they're prosecuting you under Chapter 17A. Because under 17A, you would have no right to represent yourself. You would have to have counsel.
[01:05:45.600 --> 01:05:56.600]  Well, I've heard of occasions where like smaller corporations have been allowed to know one of their officers or somebody, not an attorney.
[01:05:56.600 --> 01:06:08.600]  That is absolutely forbidden in law. I don't know where that's ever happened, but even trusts have a lot of problems since a trust is a legal fiction.
[01:06:08.600 --> 01:06:22.600]  There are courts where the trustee tries to come in and represent the trust.
[01:06:22.600 --> 01:06:33.600]  If a corporation is convicted of an offense or if a high managerial agent is convicted of an offense committed in the conduct of the affairs of the corporation,
[01:06:33.600 --> 01:06:39.600]  you cannot notify the attorney general in writing to the conviction when it becomes final and unappealable.
[01:06:39.600 --> 01:06:51.600]  You cannot apply 17A to a general prosecution. You can't just pick and choose and slice and dice the chapter.
[01:06:51.600 --> 01:07:12.600]  You can't pick the whole chapter. And I don't see the courts notifying the attorney general when an ordinary person gets a conviction.
[01:07:12.600 --> 01:07:21.600]  The benefits of the adult probation law shall not be available to a corporation's associations.
[01:07:21.600 --> 01:07:27.600]  You can't expand this outside of 17A.
[01:07:27.600 --> 01:07:34.600]  Well, in the slicing and dicing, the kind of thing you've been complaining about what they do anyway, a good bit.
[01:07:34.600 --> 01:07:42.600]  Yeah. And I don't like it when they do it ever. So I'm not going to do it.
[01:07:42.600 --> 01:07:46.600]  It would be just as inappropriate for me to do it as it is for them.
[01:07:46.600 --> 01:07:54.600]  And I am more than happy to go after them when they try their little slicing and dicing.
[01:07:54.600 --> 01:07:58.600]  So that's not a valid argument.
[01:07:58.600 --> 01:08:04.600]  I'll give you an experience I had that also kind of goes along with that.
[01:08:04.600 --> 01:08:09.600]  It was, I think, a traffic thing in a municipal court.
[01:08:09.600 --> 01:08:24.600]  And I was doing something to kind of see about messing them up in that I sent some papers in and stated in there that I thought that that took care of the whole thing.
[01:08:24.600 --> 01:08:32.600]  But if not to let me know, they had to come to court anymore.
[01:08:32.600 --> 01:08:43.600]  But before that, I had sent a new mailing address of being to general delivery.
[01:08:43.600 --> 01:08:47.600]  Well, they won't mail to general delivery.
[01:08:47.600 --> 01:08:59.600]  And then they got in a situation of not being able to send a general delivery, but that was what address they had and they did get notice to me.
[01:08:59.600 --> 01:09:01.600]  Well, they didn't get notice to me.
[01:09:01.600 --> 01:09:16.600]  What I finally did get one time was a phone call from the clerk saying that I had been convicted and I'd never been to the court.
[01:09:16.600 --> 01:09:20.600]  Why did you move to overturn the conviction?
[01:09:20.600 --> 01:09:24.600]  Well, things have started happening with my parents.
[01:09:24.600 --> 01:09:28.600]  I needed to get back up here out of Texas around about that time.
[01:09:28.600 --> 01:09:33.600]  And so I never really got really into that then.
[01:09:33.600 --> 01:09:40.600]  But you know, that's the part of the procedure in 17A is cooperation is not there.
[01:09:40.600 --> 01:09:44.600]  Things still go forward, don't it?
[01:09:44.600 --> 01:09:49.600]  You can do it to you too.
[01:09:49.600 --> 01:09:51.600]  Well, it seems that way, yeah.
[01:09:51.600 --> 01:09:58.600]  Yeah, they can convict you in absentia if you're given ample notice and you would let not to show up.
[01:09:58.600 --> 01:10:00.600]  You can be prosecuted.
[01:10:00.600 --> 01:10:03.600]  You can be convicted in absentia.
[01:10:03.600 --> 01:10:13.600]  But only if you have made contact with the court, if you've never made any contact with the court,
[01:10:13.600 --> 01:10:21.600]  never had an examining trial, never had an arraignment, then they never accrued jurisdiction over your name.
[01:10:21.600 --> 01:10:26.600]  They can't prove that you even know that the prosecution exists.
[01:10:26.600 --> 01:10:34.600]  In that case, they can't get a conviction in absentia.
[01:10:34.600 --> 01:10:42.600]  Well, maybe we can discuss this more, but I got something else I wanted to bring up too is somebody was trying to help with some things.
[01:10:42.600 --> 01:10:52.600]  And there's a lady up here who, you know, they got a thing with the, to call it environmental court, you know, a nuisance thing with the condition of yard and stuff.
[01:10:52.600 --> 01:10:55.600]  And so I was in the city court.
[01:10:55.600 --> 01:11:05.600]  And so she was up here for it a few times and she's having problems getting it all cleared up.
[01:11:05.600 --> 01:11:14.600]  Some guys she'd got that she felt like she could afford to help clean things up. They worked once, but then she never could get a hold of them again.
[01:11:14.600 --> 01:11:32.600]  And so somebody next to last hearing suggested that they assign some of the community service people to come out and take care of these things.
[01:11:32.600 --> 01:11:35.600]  And so she had pictures and stuff for what to be done.
[01:11:35.600 --> 01:11:40.600]  Okay, she agreed to that. She'd appreciate that.
[01:11:40.600 --> 01:11:44.600]  Well, I just come down and they just cut everything away.
[01:11:44.600 --> 01:11:48.600]  They really didn't go by what the agreement was.
[01:11:48.600 --> 01:11:51.600]  So, you know, it's going by for a while.
[01:11:51.600 --> 01:11:53.600]  So I started probing into it.
[01:11:53.600 --> 01:11:56.600]  I think she should be able to get some compensation for what was done.
[01:11:56.600 --> 01:12:04.600]  She was agreed upon. And so I started to go collect records where I could see where fault lied.
[01:12:04.600 --> 01:12:14.600]  Is it supposed to be with the court for not taking care of things well or with the ones in charge of probationers?
[01:12:14.600 --> 01:12:24.600]  And so I go to the court there and I'm trying to get, you know, to look in the records of what they've got.
[01:12:24.600 --> 01:12:27.600]  There's only two pages that they've got.
[01:12:27.600 --> 01:12:31.600]  One is the original complaint from the city inspector.
[01:12:31.600 --> 01:12:47.600]  And the other is a page just like a copy of a, you know, a tri-fold piece where you see the space for the court name and then the defendant and everything and the case number and all that.
[01:12:47.600 --> 01:13:00.600]  It had a few notes written on there, which I could recognize. That was the kind of things that went on in there, but there's nothing written on this page to indicate what case it's associated with.
[01:13:00.600 --> 01:13:06.600]  And that's the only two pages they had.

[01:13:09.600 --> 01:13:18.600]  Oh, well, I'm trying to get to the fitting way. They're doing records here and some different things.

[01:13:29.600 --> 01:13:40.600]  Well, there was like, no really no order or anything written in there, just like they got pictures and some of the evidence and other things.
[01:13:40.600 --> 01:13:46.600]  But you can't ever really just see what was decided. There's no final order.
[01:13:46.600 --> 01:13:54.600]  They're just over a note written on that page back in with the court indicating that it was dismissed.
[01:13:54.600 --> 01:14:03.600]  And it's like nothing was actually filed in the court attorney just took stuff in there and they talked about it and then he took it back out again.

[01:20:10.600 --> 01:20:22.600]  I'm kind of impressed by that. Instead of trying to grind her in the dirt and squeeze every dime out of her, out of her, they could, like they would in Texas.
[01:20:22.600 --> 01:20:27.600]  Well, she didn't have so much to be able to get or anything.
[01:20:27.600 --> 01:20:33.600]  Texas, they don't care. They just want the money.
[01:20:33.600 --> 01:20:41.600]  They don't care about anything. There's no humanity in our courts, and we're going to see if we can't bring some of that back.

[01:21:06.600 --> 01:21:30.600]  Well, I got a kind of interesting phone call today from an assistant sheriff that was, I guess, to the chief sheriff of Kaufman County, because I turned into a T-close complaint on a cop, and he was really confused about it.
[01:21:30.600 --> 01:21:37.600]  And I said, okay, and he said, well, I don't understand.
[01:21:37.600 --> 01:21:45.600]  Whoa, whoa, hold on. First step. What business is that of his?
[01:21:45.600 --> 01:22:11.600]  Yeah, that was kind of, he was confused. And I said, well, obviously he does, the sheriff, the deputy didn't have the authority to be out there writing a traffic citation, because according to an information request that I did to Texas Department of Public Safety,
[01:22:11.600 --> 01:22:23.600]  there's no sheriff out there in Kaufman that has the authority to be out there writing a ticket. And he told me, oh, well, he's authorized and dah, dah, dah, dah, and all this other stuff.
[01:22:23.600 --> 01:22:37.600]  I said, well, according to an information request to 4.14, the Texas Administrative Code, and the reply that I got back from the Texas Department of Public Safety,
[01:22:37.600 --> 01:22:44.600]  there is no officer out there that has the authority to enforce the traffic code.
[01:22:44.600 --> 01:22:53.600]  So he was like, well, can I get a copy of that list? I said, well, you can do the information request just like I did.
[01:22:53.600 --> 01:23:17.600]  I said, you know, we're studying the code here. And as we go through the code and look at stuff, we're finding some discrepancies here. And it's pretty concerning because as a citizen, these guys are out there enforcing traffic and they don't have the authority to be out there doing that.
[01:23:17.600 --> 01:23:29.600]  So he was just, he was really kind of puzzled by the whole thing. And I thought it was kind of interesting. And I was good. I called you earlier, but I guess you're busy and you didn't answer.
[01:23:29.600 --> 01:23:34.600]  So I thought that was kind of interesting.
[01:23:34.600 --> 01:23:49.600]  That is interesting. The T-Close complaint seems to have gotten their attention. And that's the idea with T-Close because it does affect their professional career.
[01:23:49.600 --> 01:24:02.600]  So it looks like you're taking this serious. So apparently it wasn't the officer you filed against. So he's got one of his bosses or his supervisors calling you.
[01:24:02.600 --> 01:24:22.600]  And this is exactly the kind of response I want to see. You're claiming that he doesn't have authority to enforce and you filed it with T-Close. And now you got this guy's supervisors calling. They are concerned because the officer is concerned.
[01:24:22.600 --> 01:24:30.600]  Well, here it gets better. The officer no longer works there now.
[01:24:30.600 --> 01:24:34.600]  Okay, this is not the same one from Tawakani, is it?
[01:24:34.600 --> 01:24:38.600]  No, sir.
[01:24:38.600 --> 01:24:49.600]  So he's actually going to cadet school for the Texas Department of Public Safety. He seemed to, I asked him, when did he quit?
[01:24:49.600 --> 01:25:08.600]  And he said, oh, just a few weeks ago. And I was like, oh, okay. I said, well, I said, you might get another one on him, you know, because I mailed out several to some officers that seem to be violating the law here.
[01:25:08.600 --> 01:25:13.600]  And we're deeply concerned and want to kind of get this kind of straightened out.
[01:25:13.600 --> 01:25:20.600]  So, you know, whatever you want to do with it, if you want this regardless, however you want to deal with it, that's up to y'all.
[01:25:20.600 --> 01:25:32.600]  I said, but according to what we're discovering here, there's a huge problem and we would like to get this resolved.
[01:25:32.600 --> 01:25:43.600]  And I just tell you, he was just baffled beyond belief. And he's like, because he was, well, I don't understand. He's had training from the DPS.
[01:25:43.600 --> 01:25:49.600]  I said, well, then how come he's not on the list of officers that are authorized to enforce the transportation code?
[01:25:49.600 --> 01:25:54.600]  Well, I don't know about that. I said, well, I don't know what to tell you.
[01:25:54.600 --> 01:26:05.600]  But according to the information request that I got back from, he goes, where'd you get it from? I said, the Texas Department of Public Safety.
[01:26:05.600 --> 01:26:09.600]  And he was floored.
[01:26:09.600 --> 01:26:15.600]  Well, this is good. Actually, you're actually getting their attention.
[01:26:15.600 --> 01:26:26.600]  So the TECOS complaints, I was hoping they would be as effective as bar grievances and it looks like they're going to be.
[01:26:26.600 --> 01:26:29.600]  This is good news.
[01:26:29.600 --> 01:26:44.600]  Yes, this guy, he just couldn't understand it. He wanted me to send him the list and all. And I was like, well, sir, you can do the information request just like I did under chapter 4.14, the administrative code.
[01:26:44.600 --> 01:26:53.600]  And ask for the authorization of all the officers in your county that can enforce the transportation code. That's what we did. That's what I did.
[01:26:53.600 --> 01:27:02.600]  I just sent in a request to Wise County, the county I live in, over 701.001.
[01:27:02.600 --> 01:27:15.600]  Authorizes the County Commissioners Court to engage five sheriff's deputies to enforce the transportation code and they all have to do it on motorcycles.
[01:27:15.600 --> 01:27:29.600]  The Wise County Commissioners Court has not made any authorization specifically under Texas Transportation Code 701.001 as far as we are aware.
[01:27:29.600 --> 01:27:37.600]  Collateral Estoppel. So this is the kind of thing we're getting back everywhere.
[01:27:37.600 --> 01:27:42.600]  I've got one, we've got them in Highland Park.
[01:27:42.600 --> 01:27:54.600]  I've got the Decatur Texas, the city of Decatur County, the wise county. I got one saying the same thing.
[01:27:54.600 --> 01:28:07.600]  If you send one to this jurisdiction, the authority, the officer's authority to enforce, you need to send that information request.
[01:28:07.600 --> 01:28:12.600]  And you force them to admit that they don't have authority.
[01:28:12.600 --> 01:28:20.600]  And that's more authoritative than something from the DPS, it's from their own attorney.
[01:28:20.600 --> 01:28:26.600]  This is really good news. Yeah, that will go out. I'll send one of them out.
[01:28:26.600 --> 01:28:38.600]  And like I said, I said, well, you might see another one or two come rolling through because over this past week, I have mailed out probably 20 of those things.
[01:28:38.600 --> 01:28:42.600]  I was too close and that's a cop I can imagine.
[01:28:42.600 --> 01:28:50.600]  And I was going back and this one was about one that wrote a ticket to my son, you know, over in 40.
[01:28:50.600 --> 01:28:55.600]  And so I was just kind of, I had to give him some money to finish paying off that ticket.
[01:28:55.600 --> 01:29:01.600]  And I was like, I'm going to pay for this. Let's just find out what they got going on.
[01:29:01.600 --> 01:29:09.600]  And shoot, I fired up the printer and got him going and oh man, everything's been going out.
[01:29:09.600 --> 01:29:14.600]  I still have a small stack of them still to file the mail.
[01:29:14.600 --> 01:29:20.600]  I waited about a day and then I'll mail one and the next day I'll mail another one.
[01:29:20.600 --> 01:29:24.600]  And so they just come in, they just get a barrage of these things.
[01:29:24.600 --> 01:29:29.600]  They got to be looking at it and go, oh no, not another one.
[01:29:29.600 --> 01:29:34.600]  Good. This is how we'll get their attention.

[01:34:35.600 --> 01:34:47.600]  he mentioned to Class C misdemeanor that they couldn't have an arraignment hearing.
[01:34:47.600 --> 01:34:54.600]  An arraignment may be had in the case of a felony or a misdemeanor punishable by imprisonment.
[01:34:54.600 --> 01:35:07.600]  This guy genuinely did not know that a Class C misdemeanor cannot have a term of imprisonment.
[01:35:07.600 --> 01:35:15.600]  He didn't know what on earth is going on.
[01:35:15.600 --> 01:35:18.600]  They have no idea what the law is.
[01:35:18.600 --> 01:35:23.600]  And when I start sticking them with the law, they want to find a hold and get into it.
[01:35:23.600 --> 01:35:27.600]  They just get away from me because they don't want to know the law.
[01:35:27.600 --> 01:35:33.600]  We need to fix that. And that's what this tool or building will do.
[01:35:33.600 --> 01:35:41.600]  When they get stung, every time they move the wrong way, they'll start getting careful.
[01:35:41.600 --> 01:35:49.600]  And I can't tell you how pleased I am to hear that this guy called you because that is so rare.

[01:36:02.600 --> 01:36:12.600]  And a lawyer is strictly forbidden by the State Bar Association from contacting you concerning the complaint.
[01:36:12.600 --> 01:36:25.600]  And I would expect there's a similar provision. I haven't gone through the provisions for the TCLOS standards.
[01:36:25.600 --> 01:36:32.600]  But when I can reach a point where I can catch up a little, I'll take the TCLOS standards and turn them into a questionnaire.
[01:36:32.600 --> 01:36:38.600]  So you can go through the standards and answer four or five questions and it'll take you right to a standard.
[01:36:38.600 --> 01:36:44.600]  So you can make these complaints in the verbiage of the standards.
[01:36:44.600 --> 01:36:56.600]  I'm going to bet there's a provision in there that would restrict the policeman from contacting you based on the TCLOS complaint.
[01:36:56.600 --> 01:37:00.600]  You didn't file with internal affairs.
[01:37:00.600 --> 01:37:05.600]  You filed with a professional oversight board.
[01:37:05.600 --> 01:37:09.600]  And for our policeman to call you.

[01:37:12.600 --> 01:37:21.600]  That, you know, he's treading really close to witness tampering, retaliation.

[01:37:30.600 --> 01:37:37.600]  Well, you got to consider, he had to know what a really fine line he was walking.

[01:37:42.600 --> 01:37:52.600]  If you call this guy, he files a complaint with a professional conduct oversight board and you call him, man, you better be careful.

[01:37:59.600 --> 01:38:06.600]  Thirty six oh six Texas penal code retaliation, it's a felony in Texas.
[01:38:06.600 --> 01:38:14.600]  So that the officer was so concerned that he would call you and risk that.

[01:38:19.600 --> 01:38:26.600]  It was really surprising now to get back to a judicial conduct because I've sent out several of those.
[01:38:26.600 --> 01:38:32.600]  I got back a letter from the judicial conduct board that was different than all the other ones.
[01:38:32.600 --> 01:38:37.600]  Normally it doesn't rise to level occasion, almost like a bar grievance, blah, blah, blah, blah, blah.
[01:38:37.600 --> 01:38:42.600]  But on this one, this one was worded a little bit different.
[01:38:42.600 --> 01:39:05.600]  And it said that even though the judge's actions may or may not have been legal, that you should still go ahead and seek other forms of remedy and maybe look for hiring an attorney to pursue that.
[01:39:05.600 --> 01:39:08.600]  I've never seen that in that letter.
[01:39:08.600 --> 01:39:13.600]  That's pretty surprising.
[01:39:13.600 --> 01:39:15.600]  I'll send you a copy.

[01:39:49.600 --> 01:39:51.600]  It was just a basically complaint.
[01:39:51.600 --> 01:40:02.600]  But it did say to go ahead and seek other remedies to basically it stated to go hire an attorney and go after them.
[01:40:02.600 --> 01:40:08.600]  I definitely want to see that because we want to collect all of these responses.
[01:40:08.600 --> 01:40:10.600]  We want to see everything they do.
[01:40:10.600 --> 01:40:25.600]  And then I'm going to build a questionnaire of a sort where I ask questions and then I'll have a text field where you can put in an explanation.
[01:40:25.600 --> 01:40:30.600]  And then we take that and merge it right into the complaint.
[01:40:30.600 --> 01:40:36.600]  Writing a formal complaint is sometimes hard for people.
[01:40:36.600 --> 01:40:42.600]  So we'll take a take our own form and ask them questions.
[01:40:42.600 --> 01:40:51.600]  And one of the things I want to get built are questionnaires for all of the professional conduct codes.
