[01:50.600 --> 01:55.120]  Thirty-year-old Chiite Muslim, Dayimur Raza, was found guilty and sentenced to death on
[01:55.120 --> 02:02.640]  Saturday in an anti-terrorism Pakistani court by Judge Bashir Ahmed in the Punjab province
[02:02.640 --> 02:07.640]  for blasphemy against Muhammad, the founder of Islam, being accused of saying derogatory
[02:07.640 --> 02:13.520]  statements about the self-proclaimed prophet to his wives and others on Facebook and WhatsApp.
[02:13.520 --> 02:17.240]  Apparently this is the first documented case anyone has been given the death penalty for
[02:17.240 --> 02:20.200]  blasphemy on social media in Pakistan.
[02:20.200 --> 02:24.680]  Muhammad Shafiq Wureshi, the prosecutor in the case, stated that, quote, the forensic
[02:24.680 --> 02:29.880]  report of his mobile phone showed that he had committed blasphemy in at least 3,000 posts.
[02:29.880 --> 02:34.800]  This new protocol seems to be right in line with the Interior Minister of Pakistan who
[02:34.800 --> 02:39.040]  asked Facebook to identify people suspected of committing blasphemy so that they could
[02:39.040 --> 02:40.040]  be prosecuted.

[05:36.040 --> 05:44.040]  of the murderer continues to such a degree that there can never be remedy for their crimes.
[05:44.040 --> 05:47.040]  We are seeing that right now.
[05:47.040 --> 05:53.040]  So many people are getting killed by cops unnecessarily and the cops are walking either
[05:53.040 --> 06:02.040]  because the court refuses to allow them to be sued or charged or it won't bring them
[06:02.040 --> 06:05.040]  up on charges to begin with.
[06:05.040 --> 06:13.040]  They protect them instead, looking for any basis to do so, even when that basis would
[06:13.040 --> 06:23.040]  never be allowed to prevent one of us from defending ourselves against such a cop from
[06:23.040 --> 06:26.040]  being convicted and sent to prison.
[06:26.040 --> 06:28.040]  Think about that for a minute.
[06:28.040 --> 06:36.040]  We have a bill of rights that says we have the right to be free from unreasonable searches
[06:36.040 --> 06:38.040]  and seizures.
[06:38.040 --> 06:46.040]  Now to me, unreasonable would encompass that which is unlawful.
[06:46.040 --> 06:48.040]  Now that's just me.
[06:48.040 --> 06:57.040]  Yet we have a statute here in Texas that specifically says that you do not have the right to exercise
[06:57.040 --> 07:10.040]  your right against unreasonable searches and seizures even if that search or seizure is unlawful.
[07:10.040 --> 07:19.040]  In my book, that statute is unconstitutional on its face.
[07:19.040 --> 07:26.040]  And like everything else the state tries to feed you these days, it is a poisonous lie.
[07:26.040 --> 07:34.040]  It is poisonous because of the harm it causes to our society to be subjected to the boothills
[07:34.040 --> 07:39.040]  of those that are supposed to be serving us, not ruling us.
[07:39.040 --> 07:47.040]  It is poisonous to our society because it prohibits the rule of law by giving special protection
[07:47.040 --> 07:58.040]  and special powers to those who routinely abuse them and then seize them protected in that abuse.
[07:58.040 --> 08:06.040]  This is an ongoing state of affairs nationwide here in America today.
[08:06.040 --> 08:09.040]  And we are sitting back and letting it happen.
[08:09.040 --> 08:16.040]  We are letting the courts tell us that we must obey a law and find people guilty of violating that law
[08:16.040 --> 08:22.040]  even if the law is wrong, even if the law violates the Constitution,
[08:22.040 --> 08:34.040]  even if the law protects a crime committed by those same public servants.
[08:34.040 --> 08:46.040]  How is tyranny defined when it is illegal for the people to do it but legal for the government to do it?
[08:46.040 --> 08:52.040]  That's the very definition of tyranny.
[08:52.040 --> 09:01.040]  Now on the subject of tyranny, I was doing some cross-reference research between Texas and California
[09:01.040 --> 09:07.040]  and I was reminded of something that I've talked about before but not from the aspect I'm going to do it this evening.
[09:07.040 --> 09:14.040]  Now right now the phones are off so if you are trying to call in and you are getting a busy signal or you can't connect,
[09:14.040 --> 09:16.040]  it's not a problem with the phones.
[09:16.040 --> 09:19.040]  They're just not on yet, okay?
[09:19.040 --> 09:24.040]  So I will announce when I'm going to turn them on so you can start calling in and getting a line for questions.
[09:24.040 --> 09:30.040]  But right now I've got something you need to hear and pay attention to.
[09:30.040 --> 09:39.040]  Now some of the things that the people that I have termed patronage try to use in across the board
[09:39.040 --> 09:48.040]  regardless of what state they're in as a defense against traffic citations and so on and so forth is I don't consent.
[09:48.040 --> 09:53.040]  Now let me put a little bug in your ear, folks, especially the patronage.
[09:53.040 --> 10:05.040]  I don't consent and the way you're trying to use it will only work in those states where these things are considered civil infractions.
[10:05.040 --> 10:09.040]  You understand that?
[10:09.040 --> 10:14.040]  A civil infraction is the same thing as an administrative penalty.
[10:14.040 --> 10:25.040]  You must be under their jurisdiction from an administrative perspective in order to be someone they can levy an administrative penalty on.
[10:25.040 --> 10:33.040]  I've got a post on my blog where I helped a friend of mine with the state, I forget what the agency is here,
[10:33.040 --> 10:37.040]  that deals with irrigators and plumbers and so on and so forth.
[10:37.040 --> 10:46.040]  But in the notice that I sent to them, I made it very, very clear that this individual is not within their administrative jurisdiction
[10:46.040 --> 10:51.040]  and they have no authority to levy an administrative fine, period.
[10:51.040 --> 10:56.040]  They have no authority to do anything to him whatsoever.
[10:56.040 --> 11:02.040]  Well, in the states where these are civil infractions, that too is true.
[11:02.040 --> 11:15.040]  If you don't consent to be bound by accepting the things that would bind you to the agency, then it's not a problem to say I don't consent.
[11:15.040 --> 11:26.040]  But in those states like Texas, where they attempt to take what is not truly criminal and treat it as a crime, that won't work.
[11:26.040 --> 11:30.040]  It simply will not work.
[11:30.040 --> 11:32.040]  Okay?
[11:32.040 --> 11:44.040]  And the reason it won't work is that a crime by definition does not require your consent for the punishment of the offense,
[11:44.040 --> 11:56.040]  unlike an administrative penalty, where your participation can only be achieved through either fraud or knowing and willful consent.
[11:56.040 --> 12:04.040]  But here, when it's considered criminal, they don't need your consent to prosecute you for an offense.
[12:04.040 --> 12:08.040]  But what they do need is proper jurisdiction.
[12:08.040 --> 12:18.040]  What they do need is jurisdiction in all three of its forms in this case, which is personal, subject matter, and venue.
[12:18.040 --> 12:19.040]  Okay?
[12:19.040 --> 12:23.040]  Or in this, or venue, another word for that is territorial.
[12:23.040 --> 12:31.040]  You must be within the territory over which that is, that is that he has jurisdiction in order for them to have authority in that area.
[12:31.040 --> 12:33.040]  Okay?
[12:33.040 --> 12:40.040]  That's why Texas courts can't rule on Louisiana issues or Arkansas issues, even though they're bordering states.
[12:40.040 --> 12:43.040]  Okay?
[12:43.040 --> 12:52.040]  Now, the other thing you need to understand about Texas law and most state law in the form of codes is this.
[12:52.040 --> 13:00.040]  Not everything within the codes is locked to that code when it comes to definitions of terms and phrases.
[13:00.040 --> 13:03.040]  Now, the reason this is important to understand is this.
[13:03.040 --> 13:13.040]  The courts have made it clear that penal code definitions can be used across all codes in the state, even though the penal code says otherwise.
[13:13.040 --> 13:19.040]  The penal code specifically limits its definitions to that code.
[13:19.040 --> 13:23.040]  Yet the courts say they can be used anywhere in any code.
[13:23.040 --> 13:24.040]  Okay?
[13:24.040 --> 13:27.040]  Well, if that's true, then they've created a problem.
[13:27.040 --> 13:32.040]  They're not going to be able to overcome the things I'm about to show you.
[13:32.040 --> 13:37.040]  Now, the reason this is necessary to understand is this.
[13:37.040 --> 13:50.040]  Both in California and Texas, we have a phrase that is used throughout every single code, and that phrase is in this state.
[13:50.040 --> 14:12.040]  Now, if you've listened to what I've told you before about this, in this state has absolutely nothing to do with the soil of Texas or anything within the territorial borders of Texas, except under very specific set of circumstances and conditions.
[14:12.040 --> 14:16.040]  And just so you understand what that is, let me show you here.
[14:16.040 --> 14:21.040]  Now, this is out of the California code, their tax code.
[14:21.040 --> 14:41.040]  In every state, I guarantee you, I would, well, I can't guarantee you, but I would be willing to bet you that in every single state, you will find this definition in the state tax code, not in any other code, only in the tax code.
[14:41.040 --> 14:42.040]  Okay?
[14:42.040 --> 14:47.040]  Now, pay close attention here to what we're about to read.
[14:47.040 --> 14:58.040]  This is from, let me get down here to the, let's see, California tax code on this.
[14:58.040 --> 15:01.040]  Yeah, that it is, least of the problems.
[15:01.040 --> 15:18.040]  Okay, under property taxation, division one, part one, chapter one of the California tax code, subsection F, the definition of in this state.
[15:18.040 --> 15:38.040]  In this state means within the exterior limits of the state of California and includes all territory within these limits owned by or ceded to the United States of America.
[15:38.040 --> 15:41.040]  You get that?
[15:41.040 --> 15:58.040]  So in this state only includes that territory within the borders of California that are either owned by or ceded to the United States of America.
[15:58.040 --> 16:04.040]  Now, Texas' definition of this is almost identical, almost.
[16:04.040 --> 16:25.040]  Section 151.004 of the Texas tax code, in this state, in this state means within the exterior limits of Texas and includes all territory within these limits ceded to or owned by the United States.
[16:25.040 --> 16:35.040]  Now, it doesn't say United States of America like the California code does, but it says United States.
[16:35.040 --> 16:42.040]  Now that being said, I'm going to pick this up on the other side of the break so y'all hang in there and remember the phones are currently off.

[20:18.040 --> 20:22.040]  Section 130 sub-item F in this state.
[20:22.040 --> 20:30.040]  And then I read you the definition out of the Texas Tax Code for in this state, which is section 151.004.
[20:30.040 --> 20:34.040]  Now, remember, that one says the United States.
[20:34.040 --> 20:48.040]  Now, here in Texas, there are actually only, let's see, four useful definitions of state.
[20:48.040 --> 20:59.040]  And when I say useful, I mean for state in its individual defined capacity, or as a singular term, and then United States as a singular term.
[20:59.040 --> 21:04.040]  United States is defined in only one code.
[21:04.040 --> 21:05.040]  Okay?
[21:05.040 --> 21:09.040]  At least in a way that makes any sense for explaining how it's defined in the other parts of the code.
[21:09.040 --> 21:13.040]  And that is the Texas Finance Code.
[21:13.040 --> 21:26.040]  Now, in the Texas Finance Code, you're going to see that the definition of United States, and this is section 201.002 definitions, okay?
[21:26.040 --> 21:35.040]  United States means, A, when used in a geographical sense, the several states.
[21:35.040 --> 21:54.040]  The District of Columbia, Puerto Rico, Guam, American Samoa, the American Virgin Islands, the Trust Territory of the Pacific Islands, and other territories of the United States.
[21:54.040 --> 22:03.040]  And B, when used in a political sense, the federal government of the United States.
[22:03.040 --> 22:11.040]  Why is that definition of United States important to the other definitions of United States that we're going to see?
[22:11.040 --> 22:20.040]  Well, since this tells us that there are two different ways of using the term, okay, either geographically or politically.
[22:20.040 --> 22:42.040]  And we have something here in the definition of the Finance Code that says, in this state, and it says that this state means all territories seeded to are owned by the United States, then we must try to figure out, are we talking about the United States in a political sense or in a geographical sense?
[22:42.040 --> 22:50.040]  So let's see which one actually makes sense when used as applicable to this definition of in this state.
[22:50.040 --> 23:05.040]  If we are talking about all territory within the limits of Texas seeded to or owned by the United States, and we are talking about that in a geographical sense, then what the definition in 151.004 actually reads is,
[23:05.040 --> 23:34.040]  all territory within these limits seeded to or owned by the several states, the District of Columbia, Puerto Rico, Guam, American Samoa, the American Virgin Islands, the trust territory of the Pacific Islands, and other territories of the United States.
[23:34.040 --> 23:40.040]  Notice Texas isn't in there unless you put it within the several states.
[23:40.040 --> 23:49.040]  But Texas doesn't own any property, the corporate entity, the state of Texas owns property, but doesn't own the people's property.
[23:49.040 --> 23:53.040]  It doesn't really own it, it's the caretaker of it.
[23:53.040 --> 24:04.040]  So this specifically says that the property within the territory of the exterior borders of Texas must be seeded to or owned.
[24:04.040 --> 24:12.040]  So it would have to be seeded to or owned of one of those listed entities if this definition is being used in a geographical sense.
[24:12.040 --> 24:21.040]  Then if we read it with this definition being used in a political sense, this is how the definition of in this state reads.
[24:21.040 --> 24:36.040]  In this state means within the exterior limits of Texas and includes all territory within these limits seeded to or owned by the federal government of the United States.
[24:36.040 --> 24:44.040]  That is the only two possible ways to read that definition of in this state.
[24:44.040 --> 24:58.040]  Now, when you look at the other definitions of United States, as it appears within everything else, you have actually six of those other than the one in the Texas Constitution.
[24:58.040 --> 25:02.040]  There's talking about the United States military forces.
[25:02.040 --> 25:17.040]  And under the election code, it's armed forces of the United States. That's the only time United States is used in a definition in the election code.
[25:17.040 --> 25:26.040]  In the finance code, it is exactly the one that I just read you, okay?
[25:26.040 --> 25:36.040]  There's another section in Chapter 204 of the finance code where it talks about resident of the United States and it defines them.
[25:36.040 --> 25:42.040]  But it doesn't talk about the definition of United States itself.
[25:42.040 --> 25:57.040]  In the occupations code, okay, in section 55.001 definitions, it only talks about the armed forces of the United States, but not the definition of United States.
[25:57.040 --> 26:10.040]  In the water code in Chapter 17, produced in the United States is the only way United States is defined within the water code under Chapter 17.
[26:10.040 --> 26:29.040]  And under Chapter 42, in the Pekas River Compact, we see United States means the United States of America, which is not defined. The United States of America is not defined in Texas law anywhere.
[26:29.040 --> 26:38.040]  So once again, what is meant by the United States of America? If we're still talking United States, we still have only two possibilities.
[26:38.040 --> 26:49.040]  Geographical definition, which is everybody but Texas just about from the way it reads, or the political definition, the federal government of the United States.
[26:49.040 --> 26:59.040]  Texas law does not clarify which one it is talking about, the geographical or the political sense of the definition, when it uses these terms in these areas.
[26:59.040 --> 27:19.040]  But these are the only two areas where United States is singularly defined, once in sub-item 45 of the finance code, and then again under sub-item C of Article 2 of the water code under Chapter 42.
[27:19.040 --> 27:34.040]  Chapter 42, Article 2, sub-item C, United States. Now, we know that Texas is not within the definition of United States in the water code because sub-item C reads this way.
[27:34.040 --> 28:02.040]  New Mexico and Texas means the state of New Mexico and the state of Texas respectively, and on that same line defines United States means the United States of America, which can't be Texas or New Mexico, which means it also is not the other states of the union because it doesn't say several states.
[28:02.040 --> 28:12.040]  And it's specifically excluded New Mexico and Texas from that definition.
[28:12.040 --> 28:28.040]  Okay, so right there, everywhere in every Texas code where you see this state or in this state, there's a question to be asked, geographical definition, political definition.
[28:28.040 --> 28:42.040]  Well, if it's seeded to or owned by the United States, it can only be the political definition. Why? Because none of these other states are going to own property within this state.
[28:42.040 --> 29:00.040]  None of these other foreign entities are going to, of the United States are going to own property within this state. Only if they're one of the foreign entities like Puerto Rico or Guam, those are all under the possession and control of the federal government as one of its territories.
[29:00.040 --> 29:15.040]  Okay, so the federal government would still be the one in control of any land seeded to or owned by one of those entities within the borders of Texas.
[29:15.040 --> 29:21.040]  It is word, smoke, and mirrors.
[29:21.040 --> 29:27.040]  It is language, smoke, and mirrors.
[29:27.040 --> 29:37.040]  Okay, now let me explain to you why this is such an important aspect of this discussion, which I will do on the other side of the break since I hear the music.
[29:37.040 --> 29:55.040]  And I'm going to do that about once again, taking you back to the California vehicle code and showing you just three different statutes out of that code that will absolutely, or actually four, that will absolutely blow your mind that no one out there seems to be capable of understanding what they're looking at.

[33:46.040 --> 33:59.040]  Now real quick, I want you to listen to what I'm about to read you out of the California Vehicle Code. Now this is section 260, sub-item A of the California Vehicle Code.
[33:59.040 --> 34:25.040]  A commercial vehicle is a motor vehicle of a type required to be registered under this code, used or maintained for the transportation of persons for hire, compensation or profit, or designed, used or maintained primarily for the transportation of property.
[34:25.040 --> 34:46.040]  Okay, commercial motor vehicle. Sub-item B, passenger vehicles and house cars that are not used for the transportation of persons for hire, compensation or profit are not commercial vehicles.
[34:46.040 --> 35:04.040]  Got that? Not commercial vehicles. So that would mean what exactly? Well, if we read a couple other things, we will see exactly what that means.
[35:04.040 --> 35:21.040]  Let's now look at, we did 130, 1759 of the California Vehicle Code, or I'm sorry, 17459.
[35:21.040 --> 35:48.040]  The acceptance by a resident of this state, of a certificate of ownership, or a certificate of registration of any motor vehicle, or any renewal thereof, issued under the provisions of this code, shall constitute the consent by the person that
[35:48.040 --> 36:15.040]  service of summons may be made upon him within or without this state. Whether or not he is then a resident of this state in any action brought in the courts of this state upon a cause of action arising in this state.
[36:15.040 --> 36:22.040]  Out of the ownership or operation of the vehicle.
[36:22.040 --> 36:27.040]  Now do you see the word games that are being played here?
[36:27.040 --> 36:39.040]  First off, since California treats these as civil infractions, they require your consent and participation to be effective upon you.
[36:39.040 --> 36:59.040]  Understand that? And you cause that effect to be applicable when you apply for a license, or you register your car, or you get a certificate of title or ownership from the state for your car.
[36:59.040 --> 37:09.040]  Now understand that they got your consent when you applied that.
[37:09.040 --> 37:38.040]  Now you go down to 17460. The acceptance or retention by a resident of this state, of a driver's license, issued pursuant to the provisions of this code, shall constitute the consent of the person that service of summons may be made upon him within
[37:38.040 --> 38:02.040]  or without this state. Whether or not he is then a resident of this state in any action brought in the courts of this state upon a cause of action arising in this state out of his operation of a motor vehicle anywhere within this state.
[38:02.040 --> 38:21.040]  Remember the definition of in this state? It only applies to those places owned by or ceded to the United States of America in California or to the United States in Texas.
[38:21.040 --> 38:42.040]  Now guess what? That is absolutely consistent with the federal law on the subject. Because the federal law is the root of all the state laws on this subject. It has to be consistent.
[38:42.040 --> 38:59.040]  This is the problem with the patronut methodology of doing things. You see it in a code in one state and you automatically assume that it will be effective in exactly the same way in every state, and that's not true.
[38:59.040 --> 39:15.040]  The information may be the same, but the procedure for using it would be different if the state uses it differently. That should be a given. Okay? California, it's not criminal. It is civil.
[39:15.040 --> 39:34.040]  Texas, it's criminal and requires you to challenge their jurisdiction to begin with because you were not acting within this state, i.e. any place ceded to or owned by the United States.
[39:34.040 --> 39:58.040]  Now here raises once again the question of geographical sense or political sense. Well, we haven't ceded to or so or have any land owned by the geographical entities that were mentioned, and as far as I know we have only very, very few places that fall within the political, the federal government.
[39:58.040 --> 40:09.040]  But if that's the only place this can be effective, then what's it doing applying to the rest of the Texas roads that don't fall within that?
[40:09.040 --> 40:33.040]  Well, once again, you have the Commerce Clause to thank for that because as long as they're moving on the highways that use federal funds to get built, then those moving in commerce fall within the jurisdiction of the federal government for interstate commerce.
[40:33.040 --> 40:42.040]  Now, interstate commerce is not within their jurisdiction and they know it.
[40:42.040 --> 40:57.040]  So they had to get a little help from the states to extend that jurisdiction in a way that they could actually make it stick, and they did that by bribing the state with federal highway funds.
[40:57.040 --> 41:05.040]  Federal money used to build the road jurisdiction on the road exists. That's simple.
[41:05.040 --> 41:20.040]  That simple. We didn't cede the roads to the federal government, but we put them within their power by using their money to help build them, money we didn't pay back.
[41:20.040 --> 41:29.040]  Okay, and therefore have not removed any federal claim to jurisdiction on those roads.
[41:29.040 --> 41:46.040]  Because those roads exist entirely within the territorial boundaries of the state and we have jurisdiction over those roads, but so do they when it comes to anything federal because of the federal funds.
[41:46.040 --> 41:53.040]  They wouldn't have if it were not for the federal funds.
[41:53.040 --> 42:10.040]  Even if someone were using that highway to transport counterfeit bills, if not for those federal funds, the feds could do nothing about it except request help from the state officials and their law enforcement,
[42:10.040 --> 42:24.040]  or get them after they have crossed into another state and thus converted their interest state into interstate commerce and counterfeiting.
[42:24.040 --> 42:35.040]  Now the feds can go after the counterfeiting, but they couldn't go after them on the highway because they wouldn't have jurisdiction there without the federal funding.
[42:35.040 --> 42:40.040]  That's straight up common sense.
[42:40.040 --> 42:43.040]  This is how you know when you've been sold out.
[42:43.040 --> 43:01.040]  When your state representatives are taking federal money for any project, they are selling out the people of the state to federal jurisdiction over anything in the future that involves the fruits of that project.
[43:01.040 --> 43:04.040]  You understand that?
[43:04.040 --> 43:10.040]  This is how the fed is getting its tentacles into everything.
[43:10.040 --> 43:25.040]  This is how the states are throwing the 10th Amendment out the window voluntarily at our expense.
[43:25.040 --> 43:28.040]  Get it?
[43:28.040 --> 43:35.040]  Now, as this applies to Texas, we've got a jurisdictional problem here.
[43:35.040 --> 43:48.040]  How do Texas courts get jurisdiction over lands ceded to or owned by one of the other states or the federal government, depending upon the political or geographical usage?

[47:05.040 --> 47:29.040]  All right, now before I went to break, I said how do courts within any of the states, Texas included, get jurisdiction of something that occurred on property that has been ceded to or owned by either one of the other entities if used in the geographical sense of United States
[47:29.040 --> 47:36.040]  or the federal government if used in the political sense of United States.
[47:36.040 --> 47:55.040]  So if in this state means ceded to or owned by the United States, and those are our only two options, how then do Texas courts get jurisdiction to hear the issues that arise?
[47:55.040 --> 48:13.040]  If everything in these codes only applies on that property, why is the state prosecuting it? How can a state court get jurisdiction over that? That's a question, isn't it?
[48:13.040 --> 48:25.040]  Jurisdiction now becomes a venue problem, not to mention a subject matter problem, not to mention a personal jurisdiction problem.
[48:25.040 --> 48:43.040]  Venue, I was not on any land ceded to or owned by any other foreign state, Guam, Puerto Rico, District of Columbia, or by the federal government. So you have no venue.
[48:43.040 --> 49:01.040]  You have no jurisdiction over the area where this occurred. Personal jurisdiction, I was not there. Therefore, I am not subject to your personal jurisdiction because I was never in a place that would have given you jurisdiction.
[49:01.040 --> 49:26.040]  Subject matter, if this is a federal issue based upon the way the codes read and says that these are offenses that occur in this state and in this state means lands and owned or ceded to the United States, then it has to be something that is prosecuted by one of the other listed foreign entities or the federal government of the United States.
[49:26.040 --> 49:37.040]  So how do the Texas courts get jurisdiction? There is only two possible ways I can come up with.
[49:37.040 --> 50:06.040]  A. Fraud. No is, no ands, no buts. Fraud. B. They're not Texas courts. They're something else. Something we're not being told about. Something that is not obvious to the public and is being kept secret from the public.
[50:06.040 --> 50:25.040]  Those are the only two possibilities. Folks, think about it. They're either claiming a jurisdiction they do not have and using guns and authority to exercise a jurisdiction they do not have, which is fraud.
[50:25.040 --> 50:40.040]  Or they're doing it through subversive means and information, which is still fraud. Or they have jurisdiction because they're not actually Texas courts.
[50:40.040 --> 51:00.040]  If there's a third or fourth or other number of options, I would love for somebody to tell me what they are because I can't find out from everything I've read on this subject for the past few decades how that would happen.
[51:00.040 --> 51:06.040]  How would it happen?
[51:06.040 --> 51:12.040]  If you could explain that when I would love to hear it, but I'm not holding my breath.
[51:12.040 --> 51:20.040]  So that's a thought for you to go home and think about if you're on the road or to ponder over if you're already sitting in your easy chair.
[51:20.040 --> 51:34.040]  How does a Texas court get jurisdiction of these offenses when these offenses only occur in this state and in this state has absolutely nothing to do with Texas according to the definitions that we've read.
[51:34.040 --> 51:50.040]  So granted, these definitions are not in the transportation code, but like I said at the beginning, the courts have set the standard that when these codes cross reference each other, then by that very inference, the definitions of one must apply within the other.
[51:50.040 --> 51:54.040]  And the tax code is used in the transportation code numerous times.
[51:54.040 --> 52:03.040]  Registration, licensing, those are all within the tax code as well as the transportation code.
[52:03.040 --> 52:08.040]  Financial responsibilities, fines and fees, all of that.
[52:08.040 --> 52:17.040]  So the definitions of the finance code will be just as applicable to those terms of the finance code that are used in the transportation code as it would be anywhere else.
[52:17.040 --> 52:35.040]  And in this state is defined in the finance code, it's not defined in the transportation code, but it is used there every single chapter and verse of the transportation code.
[52:35.040 --> 52:59.040]  So they have created a precedent they cannot escape when it comes to the definition usage and therein lies something very dangerous to their fraud upon the public, the ability to unravel it through understanding now that we have it.
[52:59.040 --> 53:05.040]  This is getting to be more and more obvious as things go along.
[53:05.040 --> 53:28.040]  The more I pick up on this, the more obvious it stands out how this should have played out long ago, how people that are foisting this lie upon us all should already be serving prison time for so long their children have forgotten about it.
[53:28.040 --> 53:35.040]  If we do not start making these people accountable for the things they've done, this will never end.
[53:35.040 --> 53:43.040]  Everyone that comes behind them will do the same thing over and over again.
[53:43.040 --> 53:56.040]  And the thing is, is they rely entirely upon you to never ask questions and to enslave yourself for their benefit.
[53:56.040 --> 54:18.040]  And most Americans these days are more than happy to do exactly that if it will let them watch their Sunday football games, sit back and sip on their beer and prop their feet up in an easy chair that they only had to spend one whole paycheck to get and miss the rent payment on.
[54:18.040 --> 54:34.040]  Your ability to earn, to live, to be free in America is diminishing by the minute and too many of you are so apathetic you don't even realize it enough to care.
[54:34.040 --> 54:36.040]  That is a shame.
[54:36.040 --> 54:46.040]  It's our biggest failing in this country these days is everybody wants someone else to be the one responsible for making things work.
[54:46.040 --> 54:49.040]  Nobody wants to understand how the government works.
[54:49.040 --> 54:53.040]  Nobody wants to talk politics because of how it turns into a heated discussion.
[54:53.040 --> 55:02.040]  The thing is, stop talking about the politics of it and start talking about the right and wrong of it.
[55:02.040 --> 55:15.040]  What difference does it make if that person over there is good at sucking up to everybody else if what they're doing is harming them in the process?
[55:15.040 --> 55:22.040]  We need to drop politics and start looking at right and wrong.
[55:22.040 --> 55:39.040]  One of these days I'm going to give you guys the online version in a presentation and a video of what I taught my class about delegated powers and authority and why they do not work the way the government and the courts would have you believe they work,
[55:39.040 --> 55:47.040]  especially this asinine idea of they must be treated with a balance.
[55:47.040 --> 55:49.040]  That is ridiculous.
[55:49.040 --> 56:01.040]  That right there is the servant trying to raise themselves to the level of the master to do the duty the master gave them.

[01:04:51.040 --> 01:04:55.040]  And we look at everywhere else where it's got the definition of this state

[01:04:59.040 --> 01:05:05.040]  Well we just saw what in this state means in relation to United States

[01:05:06.040 --> 01:05:07.040]  Okay
[01:05:07.040 --> 01:05:12.040]  So that would mean, now this is a licensing issue you said, right?

[01:05:31.040 --> 01:05:35.040]  On the driver's license compacts that were being put in place
[01:05:35.040 --> 01:05:36.040]  Okay
[01:05:36.040 --> 01:05:39.040]  Now that right there makes it federal law
[01:05:39.040 --> 01:05:42.040]  That makes the adoption of the driver's license in all the states federal law
[01:05:42.040 --> 01:05:46.040]  That makes the federal law controlling on the issue of the license
[01:05:46.040 --> 01:05:50.040]  And the requirement to have it controlling on the license
[01:05:50.040 --> 01:05:56.040]  This is the reason why the definition of in this state is the way it is
[01:05:56.040 --> 01:06:01.040]  Because the federal law would only apply on federally owned property
[01:06:01.040 --> 01:06:04.040]  Or federally controlled territories
[01:06:04.040 --> 01:06:08.040]  Okay
[01:06:08.040 --> 01:06:13.040]  So that's why the definition of in this state is so important
[01:06:13.040 --> 01:06:18.040]  Because when it talks about United States, you didn't see how United States is defined

[01:06:20.040 --> 01:06:24.040]  United States, by the Texas definition, only has two possibilities

[01:06:26.040 --> 01:06:29.040]  I'm pretty sure if you look around the Colorado statutes
[01:06:29.040 --> 01:06:36.040]  You're going to find the same thing yet again, just like in this state

[01:06:38.040 --> 01:06:42.040]  Yeah, all of these state codes on this issue are federal
[01:06:42.040 --> 01:06:45.040]  Every one of them has the same compact
[01:06:45.040 --> 01:06:48.040]  Or at least most of them have the same, they're members of the same compact
[01:06:48.040 --> 01:06:49.040]  Right
[01:06:49.040 --> 01:06:50.040]  Okay
[01:06:50.040 --> 01:06:54.040]  The federal constitution forbids any state
[01:06:54.040 --> 01:07:01.040]  From entering into any contract agreement or compact with any other state of the union
[01:07:01.040 --> 01:07:04.040]  Without express congressional approval
[01:07:04.040 --> 01:07:12.040]  How can Congress give approval over that to the states except by one of the enumerated powers
[01:07:12.040 --> 01:07:20.040]  One of which is that reaches within the states and the only one is
[01:07:20.040 --> 01:07:22.040]  Interstate commerce, right?
[01:07:22.040 --> 01:07:24.040]  A commerce, yeah, I'm sorry
[01:07:24.040 --> 01:07:28.040]  Okay, so if the compact arises under interstate commerce
[01:07:28.040 --> 01:07:35.040]  Which is exactly what the driver's license schemes and the motor vehicle schemes apply to
[01:07:35.040 --> 01:07:39.040]  Where does that lead to state?
[01:07:39.040 --> 01:07:44.040]  Under the jurisdiction of the federal court, I believe is what you're saying
[01:07:44.040 --> 01:07:50.040]  Well, it leads them dealing with the federal statutes being controlling
[01:07:50.040 --> 01:07:54.040]  If the federal statutes are controlling on the subject matter
[01:07:54.040 --> 01:08:00.040]  Then the state cannot expand its application beyond that of the federal statute
[01:08:00.040 --> 01:08:06.040]  If the federal statute says it relates to commerce, which it does
[01:08:06.040 --> 01:08:12.040]  Then the state can't put it over anything that isn't commercial
[01:08:12.040 --> 01:08:20.040]  Over here, they say it's supposed to be civil for a topic and then in the next pages which you can't find anything in it
[01:08:20.040 --> 01:08:24.040]  One sentence, you have to go to 50 books to find anything, I'm sure you know that
[01:08:24.040 --> 01:08:33.040]  But it says it's civil, but then it goes into all the criminal stuff that when you read it in a different part of another book
[01:08:33.040 --> 01:08:39.040]  Well, they can't send you to jail for civil
[01:08:39.040 --> 01:08:45.040]  Right, but then they change it over when you read a different statute of 138 of driving under revocation
[01:08:45.040 --> 01:08:49.040]  Then it's criminal, so it's just unbelievable, it's just so frustrating
[01:08:49.040 --> 01:08:54.040]  Right, then what you need to do is say that these statutes conflict and remain vague and ambiguous
[01:08:54.040 --> 01:08:58.040]  Therefore an individual cannot possibly know what they're required
[01:08:58.040 --> 01:09:02.040]  But the problem is the statute only applies in this state
[01:09:02.040 --> 01:09:05.040]  In this state has a definition under the codes
[01:09:05.040 --> 01:09:08.040]  The codes say in this state means this
[01:09:08.040 --> 01:09:13.040]  This is not where I was, your rules don't apply
[01:09:13.040 --> 01:09:17.040]  Right, and of course you know they're going to say they do
[01:09:17.040 --> 01:09:23.040]  Well of course they do, but then you have the issue of raising a federal violation of a right
[01:09:23.040 --> 01:09:27.040]  Or a violation of a federally protected right, let me put it that way
[01:09:27.040 --> 01:09:32.040]  Okay, so I want to take these people to task and whatever I need to do, I don't
[01:09:32.040 --> 01:09:38.040]  Well study and get this stuff put together like I've done it for here and a few other places

[01:09:40.040 --> 01:09:47.040]  When you can prove using the same thing they're relying on that they are reading it wrong and always have

[01:46:56.880 --> 01:47:00.880]  We prosecute for criminal activities.
[01:47:00.880 --> 01:47:08.880]  I'm like, criminal activities like, you know, awesome prison men, demolishing homes underneath the imminent domain.
[01:47:08.880 --> 01:47:14.880]  And she was like, uh, what, those are civil rights, yeah?
[01:47:14.880 --> 01:47:16.880]  I said, well, I got a couple of those issues.
[01:47:16.880 --> 01:47:17.880]  Can we talk about that?
[01:47:17.880 --> 01:47:23.880]  And she said, well, she said, well, uh, go ahead.
[01:47:23.880 --> 01:47:27.880]  I told her that I've been arrested several times for the license.
[01:47:27.880 --> 01:47:28.880]  They stopped me.
[01:47:28.880 --> 01:47:30.880]  And she's like, oh, were you doing something?
[01:47:30.880 --> 01:47:33.880]  I'm like, no, they just stopped me to check my ID.
[01:47:33.880 --> 01:47:38.880]  He said, you would nothing for no speeding?
[01:47:38.880 --> 01:47:39.880]  Like, no, every time.
[01:47:39.880 --> 01:47:40.880]  One officer, six times.
[01:47:40.880 --> 01:47:42.880]  Other officers, I don't know their names.
[01:47:42.880 --> 01:47:50.880]  And, uh, I went on to tell her about, they also demolished my house underneath the imminent domain.
[01:47:50.880 --> 01:47:52.880]  And then she said, imminent domain.
[01:47:52.880 --> 01:47:56.880]  She says, Mr. Libby, how much did they pay you for your house?
[01:47:56.880 --> 01:47:58.880]  I said, how much did they pay me?
[01:47:58.880 --> 01:48:00.880]  She said, yeah, they got to pay you.
[01:48:00.880 --> 01:48:09.880]  I said, no, no, I know that, but I'm surprised that someone else realized the issue at hand.
[01:48:09.880 --> 01:48:11.880]  I'm like, they didn't pay me nothing.
[01:48:11.880 --> 01:48:12.880]  And she said, what?
[01:48:12.880 --> 01:48:13.880]  I said, exactly.
[01:48:13.880 --> 01:48:14.880]  I didn't get paid nothing.
[01:48:14.880 --> 01:48:16.880]  They took four of my cars.
[01:48:16.880 --> 01:48:17.880]  They without paperwork.
[01:48:17.880 --> 01:48:19.880]  And she's like, oh, wait, wait, wait, wait, wait.
[01:48:19.880 --> 01:48:22.880]  Next thing I know, I heard the keyboard is lit up.
[01:48:22.880 --> 01:48:24.880]  I started typing and everything.
[01:48:24.880 --> 01:48:25.880]  She's like, hold on one second.
[01:48:25.880 --> 01:48:29.880]  She pulled up all my federal lawsuits that are in court right now.
[01:48:29.880 --> 01:48:30.880]  She's like, I see.
[01:48:30.880 --> 01:48:33.880]  Yeah, you have a few of them.
[01:48:33.880 --> 01:48:35.880]  She's like, Mr. Libby, hold on.
[01:48:35.880 --> 01:48:37.880]  She got my information, my address.
[01:48:37.880 --> 01:48:40.880]  She got the report, right?
[01:48:40.880 --> 01:48:41.880]  Yeah.
[01:48:41.880 --> 01:48:46.880]  She's like, Mr. Libby, I said, yeah, this community is corrupt.
[01:48:46.880 --> 01:48:48.880]  They use the judges.
[01:48:48.880 --> 01:48:50.880]  They use all in political passion.
[01:48:50.880 --> 01:48:55.880]  She was like, Mr. Libby, can you give me your friend's name again?
[01:48:55.880 --> 01:49:03.880]  I can't get him out of jail, but we're going to investigate his case, too.
[01:49:03.880 --> 01:49:05.880]  In my head, I'm like, man, you bad.
[01:49:05.880 --> 01:49:08.880]  First, you told me no.
[01:49:08.880 --> 01:49:10.880]  Then I switched around on you.
[01:49:10.880 --> 01:49:19.880]  Then now you're asking me for my friend's information, so you can go ahead and include him in the investigation also.
[01:49:19.880 --> 01:49:23.880]  She said it's going to take a week or so, but they seem real interested.
[01:49:23.880 --> 01:49:26.880]  I was in for Troy because I wanted to get him out.
[01:49:26.880 --> 01:49:31.880]  I filed a motion for bond in the appeals court, but it seems like they're going to take long.
[01:49:31.880 --> 01:49:35.880]  He's going to be out before they even address it, so I don't want to see what.
[01:49:35.880 --> 01:49:39.880]  Well, that may be true as far as them doing anything to get him out of jail,
[01:49:39.880 --> 01:49:45.880]  but that won't stop them from the criminal side of everything if they go after people responsible for it.
[01:49:45.880 --> 01:49:49.880]  That they can still do whether he's in jail or out.
[01:49:49.880 --> 01:49:52.880]  Okay.
[01:49:52.880 --> 01:50:02.880]  Because it would have been a crime to put him there if they didn't have proper reason to do it.
[01:50:02.880 --> 01:50:06.880]  Okay.
[01:50:06.880 --> 01:50:08.880]  All right.
[01:50:08.880 --> 01:50:23.880]  Also, I got a meeting with the Senator, State Senator Green this Friday to talk about the issues at hand and to the guy that you was just talking to,
[01:50:23.880 --> 01:50:26.880]  so I want state ID, which the law should be similar.
[01:50:26.880 --> 01:50:28.880]  I'm in the same situation.
[01:50:28.880 --> 01:50:33.880]  The cops are stopping me and running my state ID.
[01:50:33.880 --> 01:50:45.880]  The statute specifically says that it's an ID only and it allows you to have a driver's license from another state in which I do, which I have.
[01:50:45.880 --> 01:50:47.880]  So you are correct.
[01:50:47.880 --> 01:50:49.880]  It isn't a statute and an ID is an ID.
[01:50:49.880 --> 01:50:51.880]  You cannot use an ID for a license.
[01:50:51.880 --> 01:50:52.880]  Right.
[01:50:52.880 --> 01:50:54.880]  I found case law for that.
[01:50:54.880 --> 01:51:10.880]  But the other issue I wanted to ask you was the indigency about the mandamus because the chief of police and the mayor are not educating the officers in our personal liberty of locomotion
[01:51:10.880 --> 01:51:15.880]  of my personal liberty, but basically I'm going to use it once.
[01:51:15.880 --> 01:51:18.880]  I'm going to use it in reference for everybody else as I get ruled on.
[01:51:18.880 --> 01:51:27.880]  The judges, I guess they're trying to play block, they deny me, they deny my indigency and then claim that I'm a vexatious litigant.
[01:51:27.880 --> 01:51:29.880]  Vexatious litigant, yeah.
[01:51:29.880 --> 01:51:31.880]  Yeah, vexatious litigant.
[01:51:31.880 --> 01:51:32.880]  I appealed it.
[01:51:32.880 --> 01:51:36.880]  Then I also filed a appeal.
[01:51:36.880 --> 01:51:43.880]  See, they use the vexatious litigant allegation to prevent you from filing indigents.
[01:51:43.880 --> 01:51:47.880]  It's so they can force you to pay money to get access to the courts.
[01:51:47.880 --> 01:51:55.880]  It doesn't matter whether you're vexatious or not, that's how they force you to put money into the pot on the table.
[01:51:55.880 --> 01:52:00.880]  It's by declaring you vexatious so you can't file indigents anymore.
[01:52:00.880 --> 01:52:06.880]  So how can you, how can they, isn't there...
[01:52:06.880 --> 01:52:14.880]  You have to be able to show that the entire reason that they declared you that was to force you to pay to prevent you from having access to the courts.
[01:52:14.880 --> 01:52:25.880]  Because the only way they can have grounds to declare you a vexatious litigant is because your lawsuits have failed time and time again on the same issues.
[01:52:25.880 --> 01:52:29.880]  And they've always been without merit.
[01:52:29.880 --> 01:52:34.880]  Have any of your lawsuits been turned down because they're without merit?
[01:52:34.880 --> 01:52:35.880]  No.
[01:52:35.880 --> 01:52:36.880]  Exactly.
[01:52:36.880 --> 01:52:39.880]  So how did they declare you a vexatious litigant?
[01:52:39.880 --> 01:52:45.880]  I have four of them that are currently in the field court.
[01:52:45.880 --> 01:52:46.880]  Exactly.
[01:52:46.880 --> 01:52:50.880]  So how could they declare you a vexatious litigant?
[01:52:50.880 --> 01:52:53.880]  Well, we know, yeah, so...
[01:52:53.880 --> 01:53:01.880]  The only way they could have done it are the only basis on which they could have done it now based upon the fact your lawsuits have survived this missile,
[01:53:01.880 --> 01:53:12.880]  which means there has to be merit to them is that they did it to prevent you from being able to file as a pauper.
[01:53:12.880 --> 01:53:16.880]  Okay, so just continue appealing it?
[01:53:16.880 --> 01:53:17.880]  Absolutely.
[01:53:17.880 --> 01:53:26.880]  At the same time, file federal DOJ and FBI complaints against the judges for attempting to deprive you of your right to access the courts
[01:53:26.880 --> 01:53:38.880]  and to litigate your issues by declaring you a vexatious litigant with no grounds so that they could force you out of indigent status.
[01:53:38.880 --> 01:53:39.880]  Right.
[01:53:39.880 --> 01:53:45.880]  Well, vexatious litigant here does not push us out of indigent status.
[01:53:45.880 --> 01:53:46.880]  Yes, it does.
[01:53:46.880 --> 01:53:57.880]  So vexatious litigant anywhere means that you cannot file informal paupers without the express consent of the court?
[01:53:57.880 --> 01:53:59.880]  Right, right.
[01:53:59.880 --> 01:54:06.880]  Well, do you think they're going to give it to you after they declared you a vexatious litigant?
[01:54:06.880 --> 01:54:15.880]  I understand that, but if they made all those requirements, there must be a review.
[01:54:15.880 --> 01:54:18.880]  The court can't just dismiss something and there's no review over it.
[01:54:18.880 --> 01:54:21.880]  Isn't that correct?
[01:54:21.880 --> 01:54:26.880]  Well, that depends on what they dismissed it on what grounds, right?
[01:54:26.880 --> 01:54:30.880]  Right, because, um, right.
[01:54:30.880 --> 01:54:37.880]  So it isn't telling me there's not a review process for that if they say, okay, well, we would.
[01:54:37.880 --> 01:54:38.880]  Well, let's see.
[01:54:38.880 --> 01:54:45.880]  They declared you a vexatious litigant, which means without the consent of the court, you cannot file any suit in formal paupers.
[01:54:45.880 --> 01:54:51.880]  Would that not include an appeal of the ruling?
[01:54:51.880 --> 01:55:06.880]  If you must file for an appeal and you didn't file an original suit because you were in formal paupers, how are you going to get the appeal without putting money on the table?
[01:55:06.880 --> 01:55:10.880]  Now that you need the court's permission to seek the appeal.
[01:55:10.880 --> 01:55:22.880]  Well, they, I'm telling you the same, but on the appeal court, they told me they denied my application for impoverishment stating that the lower court said that I cannot file.
[01:55:22.880 --> 01:55:25.880]  They told me to file a bond for cost, right?
[01:55:25.880 --> 01:55:30.880]  A bond for cost includes $1,000, but I can't do that in the school.
[01:55:30.880 --> 01:55:31.880]  Right.
[01:55:31.880 --> 01:55:36.880]  So what would the appellate court tell you you had to file a bond to get your appeal?
[01:55:36.880 --> 01:55:43.880]  If you're trying to do informal paupers, on what grounds did they deny you informal paupers?
[01:55:43.880 --> 01:55:50.880]  Because they denied me on the grounds because of the lower court on the lower court issue.
[01:55:50.880 --> 01:55:51.880]  Which is what?
[01:55:51.880 --> 01:56:01.880]  In fact, which is whatever they ordered, they didn't state anything.
[01:56:01.880 --> 01:56:07.880]  They just said that the lower court ordered that I couldn't proceed in informal paupers and I had to appeal a bond.
[01:56:07.880 --> 01:56:18.880]  But now, in their ruling on the appeal cost, it says that they have to emotion for show cause in there.
[01:56:18.880 --> 01:56:25.880]  So before they dismiss my case for not paying the bond cost.
[01:56:25.880 --> 01:56:37.880]  So I'm figuring on that show cause, if they do give me emotion to show cause, I'll go and show my financial standings and everything and why and explain myself.
[01:56:37.880 --> 01:56:47.880]  But if they do not do it and just dismiss it out right hand, doesn't that allow me to appeal it to the Supreme Court?
[01:56:47.880 --> 01:56:49.880]  No, that's the problem.
[01:56:49.880 --> 01:56:59.880]  If they're saying you can't proceed without paying the bond, then how would you get an appeal going up the line for that?
[01:56:59.880 --> 01:57:08.880]  This is how they block you from going forward is demanding a bond you can't pay.
[01:57:08.880 --> 01:57:18.880]  So what I have to do is go research the Supreme Court cases and see how they handle it.
[01:57:18.880 --> 01:57:23.880]  Tennessee or even federal for that matter.
[01:57:23.880 --> 01:57:25.880]  How they deal with informal paupers.
[01:57:25.880 --> 01:57:26.880]  Exactly.
[01:57:26.880 --> 01:57:35.880]  And whether or not it's an appealable issue without a bond because of the denial of the informal paupers without grounds.
