[00:00.000 --> 00:05.400] The following news flash is brought to you by The Lone Star Lowdown.
[00:05.400 --> 00:12.720] Markets for Friday, 26 May 2017 are currently trading with gold $1,266.75 an ounce, silver
[00:12.720 --> 00:21.320] $17.33 an ounce, Texas Crude $48.90 a barrel and Bitcoin is way up, sitting over $2,000
[00:21.320 --> 00:34.200] $2,214 U.S. currency. Today in History, the year 1868, the impeachment of Andrew Johnson
[00:34.200 --> 00:41.880] ends with his acquittal by one vote. Today in History.
[00:41.880 --> 00:46.680] In recent news, leaders of the Group of Seven or the United States, Canada, Britain, France,
[00:46.680 --> 00:52.840] Germany, Italy and Japan are meeting Friday today for a two-day summit in Torromina, Italy.
[00:52.840 --> 00:57.240] These powerhouses make up nearly 50% of the world economy and represent more than 60%
[00:57.240 --> 01:03.400] of net global wealth. The first summit, known in 1975 as the G6, was attended by France,
[01:03.400 --> 01:08.800] Germany, the U.S., Britain, Japan and Italy. Canada was later added to form the Group of
[01:08.800 --> 01:13.000] Seven and representatives of the European Union have been additional participants to
[01:13.000 --> 01:18.640] the summit since 1981. Focusing on the democracies and economies of non-communist countries,
[01:18.640 --> 01:23.080] Russia was first invited as a guest observer in 1997 for their pro-capitalist initiatives
[01:23.080 --> 01:27.680] at the time and joined in 1998 forming the Group of Eight, but was later kicked out in
[01:27.680 --> 01:33.120] 2014 over the annexation of Crimea. The main issue for this year's meeting, climate change
[01:33.120 --> 01:37.200] and whether the Trump administration will keep the U.S. and the Paris Climate Treaty,
[01:37.200 --> 01:42.440] the conflicts in Syria and Libya, the European refugee crisis, North Korea's missile buildup
[01:42.440 --> 01:49.200] and getting Russia to cooperate.
[01:49.200 --> 01:53.400] This last Thursday night, Federal District Judge William Orrick of San Francisco ordered
[01:53.400 --> 01:58.360] David Daliden, an anti-abortion activist and his attorneys to take down at least 11 names
[01:58.360 --> 02:02.840] in several hours of video uploaded earlier this week, which was secretly filmed at two
[02:02.840 --> 02:07.720] National Abortion Federation conferences. Judge Orrick issued an injunction last year
[02:07.720 --> 02:12.360] barring the release of the footage and names, but an attorney defending Daliden in a separate
[02:12.360 --> 02:16.440] criminal case posted the material on his website, arguing that it had already become part of
[02:16.440 --> 02:21.400] public record. Daliden is also set for a hearing on June 14th to determine whether he should
[02:21.400 --> 02:25.400] be held in contempt for the actions of his lawyer. If you recall, David's undercover
[02:25.400 --> 02:29.720] videos made national headlines two years ago when he and others posed as representatives
[02:29.720 --> 02:35.320] from a biomedical firm recording conversations with high-level officials at Planned Parenthood.
[02:35.320 --> 02:40.520] This resulted in California's Attorney General Xavier Becetta earlier this year charging Daliden
[02:40.520 --> 02:45.960] and partners with 15 felony counts of violating the privacy of health care providers by recording
[02:45.960 --> 03:11.400] confidential information without their consent. This was Brooke Rody with your lowdown for May 26, 2017.
[03:16.520 --> 03:26.520] Well, I received my remedy today. It came in a box just like the state. I accepted it for value
[03:26.520 --> 03:36.280] right away. It's not true. Not later. We are originators and the pathways seem to get
[03:36.280 --> 03:45.400] straighter every day. And I could take anything that belongs to me. Okay, we are back. Randy
[03:45.400 --> 03:51.800] Kelton with our radio. Okay, there's a real point to this story. It took a year, but I finally got
[03:51.800 --> 03:59.640] this in front of the grand jury. I got the prosecutor to give it to the grand jury. And I told
[03:59.640 --> 04:06.680] Claire Lawson-Brown who was the prosecutor headed up the grand jury. She had been blocking me for a
[04:06.680 --> 04:14.280] year. And finally she stood aside. And I told her, since 203 denies you any discretion in the
[04:14.280 --> 04:19.480] matter of a complaint against the public official, you have to give it to them. But since you had
[04:19.480 --> 04:24.680] no discretion, it's perfectly all right for you to go in there and argue against indictment.
[04:24.680 --> 04:32.120] So you get to write in on your white horse and save the day. So she gives it to them a month and a
[04:32.120 --> 04:37.080] half later. I haven't heard from them. I called and I said, Claire, what's the problem with my
[04:37.080 --> 04:43.960] complaint? It normally takes them 30 minutes. She said, Mr. Kelton, I made sure the grand jury
[04:43.960 --> 04:54.600] read your entire presentment. It was 110 pages. And I'm thinking what in the world is going
[04:54.600 --> 05:05.000] on? She's not trying to get them to know Bill. Ron Earl, that dirty rotten scoundrel,
[05:06.280 --> 05:13.400] 25-year prosecuting attorney, he's a Democrat. All 15 of these judges are Republicans.
[05:15.480 --> 05:23.480] Had nothing to do with the wider things or the rule of law. I gave Ron Earl canon
[05:23.480 --> 05:32.920] fodder he could use to try to take these judges out with him. He's a no good scoundrel. And that
[05:32.920 --> 05:41.240] was an important lesson for me. It's all political. If you can give your attorney general canon fodder
[05:41.240 --> 05:50.200] that he can use to stomp all over the Republicans and move himself toward the governorship,
[05:50.200 --> 05:56.040] good chance he'll pick it up and use it. Well, that's what he's looking for.
[05:57.080 --> 06:04.840] So think about it when you write your complaint. How can you write the complaint in a way
[06:05.640 --> 06:15.000] that's in nice flowery soundbite terms that the governor can look at and the attorney general
[06:15.000 --> 06:24.360] can look at and say, I could use this. You might get it done. It's all political at the end of the
[06:24.360 --> 06:36.600] day. Wouldn't that be sweet? I started to write these kind of things. So that's what I got to
[06:36.600 --> 06:45.320] concentrate on. Have fun with it. It should get interesting. I will. And thank you. And I'll
[06:45.320 --> 06:52.200] keep you informed of my progress. Okay. Thank you, John. Okay. Now we're going to Mark in Texas.
[06:52.200 --> 06:59.720] Hello, Mark. Hey, hi, Randy. Can you hear me well? Yes, I can. What do you have for us today?
[06:59.720 --> 07:09.000] All right. You know, we've spoken before. It's been incredibly fast as far as the passage of time.
[07:09.640 --> 07:14.920] And I'll tell you, I haven't actually gone back and attacked a void judgment
[07:15.480 --> 07:21.480] for foreclosure just yet. I'm coming up on two years. Someone that I know said I might need to
[07:21.480 --> 07:27.880] concern myself with preserving my capacity to pursue with respect to some statutes of
[07:27.880 --> 07:33.160] limitations. From what I can see, I think I'm okay for just the basic things here. But
[07:34.200 --> 07:41.080] I more or less wanted to ask you if in an action for wrongful foreclosure, where I've got something
[07:41.080 --> 07:47.800] that's most likely going to be clearly void, I haven't actually discovered it yet. But
[07:48.680 --> 07:53.800] in an action for wrongful foreclosure, what types of causes of action should somebody
[07:53.800 --> 08:01.480] actually focus on to get the greatest benefit and to do the greatest harm to criminals
[08:01.480 --> 08:05.400] that have come to a court and said they were out of death that they were known?
[08:06.680 --> 08:16.280] What do you have in the forms of form of res judicata? What has been ruled up to this point?
[08:16.280 --> 08:27.640] Well, just to remind you, in my situation, there was a complaint filed in 2013.
[08:28.280 --> 08:32.520] On the face value of the complaint, it was filed past the statute of limitations.
[08:33.480 --> 08:40.280] I attacked it. Hold on, hold on, hold on. Complaint was filed by the lender?
[08:40.280 --> 08:52.600] Oh, that's important. The original lender and I basically had a mortgage in 2006.
[08:53.240 --> 09:00.200] This original lender went out of business. They were completely out of business in 2008.
[09:00.200 --> 09:08.440] They were no longer in existence. In 2013, before the complaint was filed,
[09:08.440 --> 09:14.840] there was an assignment of mortgage that was filed signed by an employee of the servicer.
[09:14.840 --> 09:21.080] They weren't even trying to say they were a VP of MERS. MERS was on the document.
[09:21.640 --> 09:26.520] But essentially, they were noting something to the effect that the assignment is made
[09:27.240 --> 09:32.680] by the original lender through MERS to a pretender lender.
[09:32.680 --> 09:39.640] Okay. This is an interesting thing because this document is void on its face.
[09:40.200 --> 09:47.880] Okay. Did you file a quiet title based on that document?
[09:49.160 --> 09:50.360] No, I haven't done that.
[09:51.160 --> 09:57.160] Okay. That's what you want to do. You can get to fraud and wrongful foreclosure later.
[09:57.160 --> 10:09.560] Right now, you do a pawn move. If you file a quiet title action asking the court to determine the
[10:09.560 --> 10:20.040] rights of parties, you ask the court to rule that this assignment is fraudulent as the term
[10:20.040 --> 10:34.280] is defined by 51901C, the local government code. It has a special definition of fraud.
[10:35.640 --> 10:43.240] If a document is filed in the county recorder's office by someone who has nothing in the record
[10:43.240 --> 10:52.360] showing that they have the power to file a document affecting title, that document is presumed to be
[10:52.360 --> 11:02.280] fraudulent. So based on that and based on 13.001 Texas property code,
[11:03.480 --> 11:11.880] 13.001 Texas property code says, any claim against real property, not properly acknowledged or
[11:11.880 --> 11:18.280] proven and filed in the record is void as to the holder. So here's what you're saying.
[11:21.080 --> 11:30.200] You don't care who holds what. You don't care if this person who filed this assignment is the true
[11:30.200 --> 11:45.400] and bonafide holder of the mortgage and the note instrument. You only care that there is no proper
[11:45.400 --> 11:51.800] document filed in the record by the original lender while the original lender was still in
[11:51.800 --> 12:01.400] existence. Transferring the claim to a third party, therefore under 13.001 it makes no difference
[12:01.400 --> 12:09.400] who holds what. They can use it for toilet paper. You ask the court to rule specifically
[12:10.120 --> 12:19.560] on the effect of 13.001 as it applies to a holder of a claim against real property
[12:19.560 --> 12:31.240] when the holder dies. This goes to the dead guy argument. Agency does not survive death.
[12:33.240 --> 12:41.000] I got a question. Is this typically, I want to hope it is, but is this typically similar across
[12:41.000 --> 12:47.400] all states? This property is in the state of Minnesota. Oh yeah. Well every state I've looked
[12:47.400 --> 12:55.080] at so far has this statute. Slightly different wording, but it goes to the same thing. Without
[12:55.080 --> 13:03.800] this statute there is no reason to have a county recorder's office. Okay. You're going to find it.
[13:05.480 --> 13:12.520] If I go down, if you want to sell me some property, I need to be able to go to the county recorder's
[13:12.520 --> 13:21.000] office and seek out claims in there and be confident that if I don't find a claim there,
[13:22.120 --> 13:29.400] a claim can never be brought against me. Otherwise no one in their right mind would buy
[13:29.400 --> 13:38.920] property in the United States. It'd be insane to. The first registrar in the United States
[13:38.920 --> 13:47.160] was 16, I think 1637 at Plymouth. Plymouth Rock, they started dividing up property
[13:47.160 --> 13:54.120] and they set up a registry. That's how important that was. This has been in place ever since then.
[13:54.680 --> 14:03.320] Merge is trying to undermine it. So what you do is you only ask the court to rule on the
[14:03.320 --> 14:12.440] rights of the parties. Do not ask for any recovery. I filed one, I filed three of these
[14:12.440 --> 14:18.680] here in Texas and just McBride threw them all three out. Third one, I was ready for him.
[14:19.800 --> 14:26.360] I filed it in the state court, asked the court to rule on the rights of the parties
[14:26.360 --> 14:36.920] as concerns 13.001 Texas property code. The Wells Fargo immediately removed it to the
[14:36.920 --> 14:42.440] federal court. I filed a challenge to subject matter jurisdiction in the federal court under
[14:42.440 --> 14:50.200] the 2011 venue and removal clarification act, which says that while a state case can be removed
[14:50.200 --> 14:56.600] to the Fed, the Fed cannot hear the state issues. They must sever and remand. Well, there's only
[14:56.600 --> 15:03.800] one issue in its state. So that's why I filed subject matter jurisdiction. The other side
[15:03.800 --> 15:10.200] filed a rule 12b6 motion to dismiss the failure state of claim of which cover can be had.
[15:10.200 --> 15:21.720] First half, they addressed claims under Hopetita Respa, which I did not make. Second portion
[15:21.720 --> 15:28.280] of the document, they said the case should be dismissed because Wells Fargo is not the lender.
[15:30.040 --> 15:36.760] Oh, say what? I had to read that a couple of times to be sure what I was seeing.
[15:36.760 --> 15:44.840] So what do you do when the lawyer screws up? What he's thinking is Wells Fargo is the
[15:44.840 --> 15:51.640] servicer, not the lender. Right. But he's the agent for the lender. He stands in the shoes of the
[15:51.640 --> 16:03.400] lender. So immediately I filed a non-suit. Oh my goodness, I made a mistake. I thought Wells
[16:03.400 --> 16:10.440] Fargo was the boned fighting holder of the mortgage. But since they're not, I need to non-suit this
[16:10.440 --> 16:17.560] case. Now that state be, I'm just collateral on a stop ball. They can never go back and say they
[16:17.560 --> 16:23.720] are the lender. Same day I non-suited Judge Mitch Bride dismissed with prejudice for failure state
[16:23.720 --> 16:29.960] of claim on which a cover can be had. I filed criminal charges with it against him with the SAC
[16:29.960 --> 16:35.720] in Dallas. Special Agent George in Dallas and we're gonna dance. About to go to break. I'll
[16:35.720 --> 16:41.080] explain a little further when we come back, but I'm having way too much fun at Judge Mitch Bride's
[16:41.080 --> 17:00.600] expense. This is what he gets for being such a stinker. We'll be right back. Oh yeah.
[17:00.600 --> 17:08.280] Dang, Cookie. Cookie? Me love cookies. Oh, hi Cookie Munchers. No, these are yucky cookies. Cookie? Yucky? No,
[17:08.280 --> 17:14.600] no bad cookies. You can't even eat these cookies. These are cyber cookies. You can't eat? No, they
[17:14.600 --> 17:19.960] are cyber cookies and they clog up your computer. These have apples. Really? Oh, that's an actual
[17:19.960 --> 17:29.080] apple. Yummy apple. I'm going to throw away these yucky cookies in the trash. I click control, shift,
[17:29.080 --> 17:35.400] delete, and then scroll down to cookies and clear them. Bye bye yucky cookies. Now I go to

[19:12.360 --> 19:17.960] Well, don't let nothing get to you. Only the father can do it by you. But don't let
[19:17.960 --> 19:25.800] black mind people hurt you until they get behind you. You know what I mean? My friend.
[19:28.680 --> 19:35.880] Okay, we are back. Randy Kelton, rule of law radio, and we're talking to Mark in Texas. So I filed
[19:35.880 --> 19:43.880] criminal charges against McBride. And the reason I did is he dismissed my case for failure to state
[19:43.880 --> 19:51.240] a claim on which recovery can be had. It was a quiet title action. There was no recovery requested.
[19:53.080 --> 20:02.840] A quiet title action is immune from a 12B6. But he knew who I was. And I'd been saying
[20:02.840 --> 20:08.680] bad things about him. So he dismissed it was prejudiced. And now I'm going after him criminally.
[20:08.680 --> 20:18.920] Okay. So if you'll send me an email, I will send you a copy of my who's on first argument.
[20:21.000 --> 20:31.320] Okay. I got a question for you. Let's say you started out saying this might be a pawn move.
[20:31.320 --> 20:42.120] I think it might make sense. Let me explain pawn move. Okay. If you get a ruling that says,
[20:42.120 --> 20:51.480] well, yes, there is no document showing that the filer of this assignment had power to do the
[20:51.480 --> 20:59.480] assignment. Then that's collateralist. That's where as judicata. So now you can go back to
[20:59.480 --> 21:10.680] their foreclosure documents and say, these documents are void because the alleged holder
[21:11.480 --> 21:18.360] did not have standing to file the document based on the ruling in this quiet title action.
[21:20.600 --> 21:28.360] Okay. So you kind of sneak up on them. In a way, I love the idea and I think it makes
[21:28.360 --> 21:33.720] sense. We're keeping it very simple. I'm concerned that I'm probably going to have to file the quiet
[21:33.720 --> 21:39.880] title action with the same judge who essentially found for the defendant wrongfully so.
[21:41.000 --> 21:47.640] Okay. This is what I'm going to have a guest on next Thursday and she's going to talk about
[21:47.640 --> 21:53.800] how judges are getting paid by banks and other no good rotten scoundrels.
[21:53.800 --> 22:04.920] Okay. So you want to take the judge and do some discovery on his finances.
[22:05.880 --> 22:15.000] Sure. And see how many properties he owns, how many or just start requesting information about
[22:15.000 --> 22:19.640] all of the mortgages on his properties. You can check, you know, see where he's from.
[22:19.640 --> 22:26.280] Check the county records for all the counties around there. Just run his name on them to see
[22:26.280 --> 22:31.960] what you come up with or if he owns an LLC or some other shell company.
[22:33.880 --> 22:43.880] What he finds out you're digging in his records. If he's taking hush money and he's laundering
[22:43.880 --> 22:51.000] this money, he's going to want your case to go away and want you to be happy to get you
[22:51.000 --> 22:58.680] stopped looking at him. A little more politics here. Yeah, I like that idea. I want to ask you this.
[22:59.800 --> 23:08.840] In my case, there are some other cases in other states where basically they've taken judicial
[23:08.840 --> 23:13.960] notice of the fact that this organization was out of business. I never put that before the court didn't
[23:13.960 --> 23:23.240] have it at the time and which is that could wait a while. But now that I have that, I'm sure that
[23:23.240 --> 23:29.960] I can go to the court and I have a claim for wrongful foreclosure. I've got fraud because they
[23:29.960 --> 23:35.560] deliberately created an assignment that couldn't have been created and they put it before the court
[23:35.560 --> 23:40.200] and said this gave them standing to bring the suit and then the rest of it's a mess.
[23:41.000 --> 23:48.520] Okay, that was going to be my next question. Since there's already been a foreclosure,
[23:48.520 --> 23:55.400] then you can do both of these at once. Fraud, when did you discover the fraud?
[23:57.640 --> 24:01.480] I haven't officially discovered it even yet, I guess.
[24:01.480 --> 24:12.120] Perfect. So the clock is not running yet. You have a suspicion of fraud, but you don't have
[24:12.120 --> 24:19.160] actual evidence of fraud. So until you have evidence of fraud, you don't know that there's fraud.
[24:19.800 --> 24:26.440] But once you have the evidence, then the clock starts. And then there's still, I think, a five
[24:26.440 --> 24:37.400] year statute of limitations on that one. And if you do sue on this, in this issue, sue the purchaser
[24:37.400 --> 24:46.600] as well. Oh yeah, I definitely will. The purchaser is actually the party in interest, sir. I think
[24:46.600 --> 24:51.640] this would be the proper term for them. Basically, it's the pretender lender that supposedly, you
[24:51.640 --> 24:58.920] know, follows this action as a trustee for the... See if the property was subsequently sold to
[24:58.920 --> 25:06.840] someone else. Oh, it was. It was sold for $160,000. So that's not bad. If the bank bought it back,
[25:07.800 --> 25:15.400] they probably sold it again to somebody else. Whoever is in the property now, you sue.
[25:15.400 --> 25:23.400] You sue the buyer actually, okay? Yes, you sue the buyer, you sue the seller and the buyer.
[25:24.520 --> 25:26.840] Because their title insurance has to come in, right?
[25:27.800 --> 25:34.040] Well, when you sue the buyer, the buyer is going to get apoplexy and he's going to sue the seller.
[25:35.880 --> 25:41.560] So now they not only have your claim, but they also have the buyer's claim.
[25:41.560 --> 25:45.000] You just raised the ante big time.
[25:46.040 --> 25:51.480] Can I go to this buyer and tell them this is what you have to? Absolutely.
[25:52.520 --> 25:56.840] Okay, good. You can say, look, I am sorry I had to do this,
[25:58.040 --> 26:04.280] but you are a necessary party. If I don't sue you, they'll throw my suit out for failure to
[26:04.280 --> 26:08.760] include a necessary party. And the last thing I wanted to do was sue you because I know you
[26:08.760 --> 26:17.800] bought this in good faith. So help me take on the bank and let's get the bank to come to the table
[26:17.800 --> 26:25.400] and make us both a deal. That's kind of how it needs to be done in the grand scheme of it all,
[26:25.400 --> 26:33.960] right? I'm thinking poker. How do we create our best hand?
[26:33.960 --> 26:41.640] All right. But in the end, I would love to have something where they want it to be hushed and
[26:41.640 --> 26:47.880] unpublished and that would be the end of it. But I'm curious about maybe losing
[26:48.520 --> 26:55.880] capacity to sue for some other violations. And I want to ask you a few things on that real quick.
[26:55.880 --> 27:03.320] All right. So let's say I've got Teela, respite violations, all of these things. Do I have a
[27:03.320 --> 27:07.480] statute of limitations that's... Yeah, one year they're worthless.
[27:08.520 --> 27:11.560] Oh, they're worthless to me even at this point. However,
[27:13.800 --> 27:18.920] it's my position that the consumer protection laws are a deliberate scam.
[27:18.920 --> 27:26.840] Sure. They're done to dupe the public into thinking they only have one year.
[27:27.880 --> 27:35.960] Everything that's in the consumer protection laws, all the protections are in the commercial code.
[27:38.040 --> 27:43.000] So go after them under UCC instead of consumer protection.
[27:43.000 --> 27:51.960] Okay. Got it. So go after them under that. I've got awful foreclosure, fraud,
[27:53.400 --> 27:59.080] and if the judge finds against me, which they can do sometimes, even though they shouldn't,
[27:59.080 --> 28:04.920] it's right in front of them, they're in big trouble. Yeah, the judges are bought and paid
[28:04.920 --> 28:17.720] for it. And that's the problem. So if we start digging, if you actually tell them what you're
[28:17.720 --> 28:25.400] doing, that won't be near as powerful as if you do something and they have to try to figure out
[28:25.400 --> 28:34.200] what you're doing. Yeah. If they went into Williamson County, that's a county that Alex Jones will
[28:34.200 --> 28:40.680] not drive through. And I went and sat in a courtroom and I'm taking notes and this young
[28:40.680 --> 28:44.360] lawyer come over and said, sir, sir, and I looked up and I said, yes, I'm in a nice suit.
[28:45.800 --> 28:50.920] I said, yes, he said, sir, do you have a case here today? Oh, no, no, nothing like that.
[28:50.920 --> 28:57.080] I looked down and continue writing. Sir, sir, and I looked up. Yes. Do you have a civil case
[28:57.080 --> 29:01.800] in this court? Oh, no, no, nothing like that. I go back to writing. He stands here a minute.
[29:01.800 --> 29:09.800] And then sir, sir, and I look up, held up both hands with my palms out. No more questions.
[29:10.840 --> 29:18.120] And you thought I slapped him. He was stunned. I went back to writing. He stands there a little
[29:18.120 --> 29:24.120] bit little while and then he ambles off. A little later, this other guy shows up.
[29:24.120 --> 29:32.840] Older guy. Clearly he was the elected prosecutor. And I had just been across the hall looking at
[29:32.840 --> 29:37.720] Doug Bell's records. And I didn't find a criminal complaint in it. So I went to the
[29:38.440 --> 29:42.440] prosecuting attorney and put in a request for all records clear to December maintained by the
[29:42.440 --> 29:47.720] department that are specifically referenced for article 17.3. Oh, Texas go to court procedure.
[29:47.720 --> 29:55.320] And they sent out this prosecutor. She looked like she just got out of law school. She looked
[29:55.320 --> 30:03.160] like she was a stripper. Spike heals many. The Chicago Blackhawks stunned the hockey world by
[30:03.160 --> 30:08.200] coming out of nowhere to win the Western conference finals. Their secret weapon was a readily available
[30:08.200 --> 30:12.440] health supplement. I'm Dr. Catherine Albrecht and I'll be right back to tell you how they did it.
[30:12.440 --> 30:17.800] Google is watching you recording everything you've ever searched for and creating a massive
[30:17.800 --> 30:23.080] database of your personal information. That's creepy. But it doesn't have to be that way.

[30:45.800 --> 30:50.680] Vitamin D. When team members took a daily supplement, they caught fewer colds, recovered
[30:50.680 --> 30:55.320] faster from injuries, and their game took off. And it's not just athletes who can benefit.
[30:55.320 --> 31:00.280] Your body makes vitamin D when sunlight hits your skin, but adults who work indoors and kids who
[31:00.280 --> 31:05.080] watch a lot of TV probably don't get enough, putting them at risk for illness, bone problems,
[31:05.080 --> 31:09.960] and even heart disease. Be sure you and your kids get 10 to 15 minutes of sun exposure several
[31:09.960 --> 31:14.920] times a week or ask your doctor about a daily natural vitamin D supplement. You can learn
[31:14.920 --> 31:20.360] more about this amazing vitamin at vitamindcounsel.org. This is Dr. Catherine Albrecht,

[33:11.480 --> 33:32.760] Okay, we are back. Randy Kelton, Rule of Law Radio and we're talking to Mark in Texas.
[33:32.760 --> 33:42.760] I lost my place, Mark. It's okay. Whenever the paper music kicked in, you were talking about
[33:43.640 --> 33:48.280] being in Williamson County and you said somebody, one of the assistant computers looked like a
[33:48.280 --> 33:55.080] stripper. You're having a good time. Yeah, I was not impressed. Now, I like pre-women's
[33:55.080 --> 34:03.640] must see anybody else does, but this prosecutor come out and I was offended and she said she
[34:03.640 --> 34:13.000] didn't know what I was asking for. I said, read the code and walked out. So then I went and sat
[34:13.000 --> 34:19.880] in the courtroom. So they knew I was there for Doug Bell. And so the young kid goes away and
[34:19.880 --> 34:26.360] this older guy comes up. He said, sir, sir. And I looked up and I said, yes. Is there something I
[34:26.360 --> 34:33.400] can help you with? Now, first he said, I'd asked the bailiff for an appearance docket. He told me
[34:33.400 --> 34:38.200] where I could go get the appearance docket. I said, yeah, I know the bailiff over there told me
[34:38.200 --> 34:43.880] that. Thank you. And I looked back down at what I was writing. He stood there a minute, a sir,
[34:43.880 --> 34:49.800] sir. And I looked up. He said, is there something I can help you with? He's letting me know
[34:49.800 --> 34:59.000] he's the boss. So I said, if I need you, I will summon you. You're dismissed. I go back to writing.
[35:00.920 --> 35:09.160] So I leave there and Doug and Steve Fritz are outside and Doug said, what did you do?
[35:10.760 --> 35:15.640] I said, well, I was jerking around a little. Why? He said, oh, man, they come to me and said,
[35:15.640 --> 35:20.520] who is that out there looking at your records? Doug told them, I don't know. Man, I told you,
[35:20.520 --> 35:27.480] I had a secret clearance and now you're going to cost me my clearance. He had two prescription
[35:27.480 --> 35:33.240] drugs in an aspirin bottle. They arrested him for it. He brought the prescriptions. They're still
[35:33.240 --> 35:41.960] prosecuting. They dismissed both cases. Anything else you want? Well, can I get the judge to sign
[35:41.960 --> 35:48.280] the orders? They take him to the judge. He signs the orders. Then anything else? Well,
[35:48.280 --> 35:53.000] he was like my bond back. So they take him down to the clerk. He feels off the documents. He gets
[35:53.000 --> 36:01.000] to check the next day. He came to a seminar. I was doing a brave new books and he said,
[36:01.000 --> 36:06.760] you ever walked in a room, turn the lights on, watch the cockroaches scatter? He said,
[36:06.760 --> 36:16.440] that's what it looked like. The more corrupt they are, the more they are. I came in there and I
[36:16.440 --> 36:23.480] don't tell anybody what I'm doing. I'm being obnoxious and demanding and they're thinking who
[36:23.480 --> 36:30.440] in the heck is this guy? He knows. This guy knows. Every one of them goes and looks in their
[36:30.440 --> 36:37.640] deepest darkest. They crack it open. They look at those skeletons in there and they know that I'm
[36:37.640 --> 36:43.240] there because of their skeletons. The more corrupt they are, the more afraid they are.
[36:45.320 --> 36:49.800] That's what that was all about because I didn't give them any information at all.
[36:51.080 --> 36:55.640] When you start asking pointed questions, go ahead.
[36:55.640 --> 37:01.560] I'm saying they just figured you were going to stand up to them. Bullies don't like to be stood
[37:01.560 --> 37:09.800] up to. No, they thought I was researching something. They thought I was a fed and I'm down there doing
[37:09.800 --> 37:17.240] research and they're corrupt. They do not want me researching. If you tell them what you're doing,
[37:17.240 --> 37:23.960] it won't be near as bad as if they have to figure it out because they will always come up with
[37:23.960 --> 37:33.000] something much worse than what you're actually doing. Quiet title is a way to get at something
[37:33.000 --> 37:40.120] that's valuable to make the... No. Quiet title is a good way to get collateral to stop all
[37:41.080 --> 37:47.960] or a residue to caught against them so that now you can go back and show that the document they
[37:47.960 --> 37:55.560] relied on to do this foreclosure was void. It was declared void and therefore it was void
[37:55.560 --> 38:05.560] from its inception. Therefore, necessarily this foreclosure was also void. It's a pawn move.
[38:06.520 --> 38:08.920] They don't necessarily see it coming.
[38:08.920 --> 38:19.720] But the other thing I'm getting to is you do discovery from the judge. You want to see the
[38:19.720 --> 38:28.200] judge's finances. You particularly want to see any properties that the judge may own and mortgages
[38:28.920 --> 38:36.760] concerning those properties. And then there are other ways... I'm going to be searching for other
[38:36.760 --> 38:45.880] ways that you can launder money this way and ask questions that point toward ways people launder
[38:45.880 --> 38:53.320] money and pay off judges. We don't accuse the judge of anything. We ask him a question that
[38:53.320 --> 39:01.240] implies what we're looking for. Are you saying you want to ask him a question when you're having
[39:01.240 --> 39:07.800] a quiet title hearing or what do you mean? No, you want to do it in discovery. You want to
[39:07.800 --> 39:11.800] file discovery with the judge. You want to make sure the judge is not compromised.
[39:13.560 --> 39:17.320] So you want to see full financial disclosure from the judge.
[39:18.680 --> 39:21.880] I can just a little do that. Let's say I file a quiet title in his court.
[39:22.680 --> 39:28.200] These are discovery questions for the judge to make sure that the judge has not been compromised.
[39:28.200 --> 39:39.720] Yeah. Yeah. Okay. You understand. They're the servants. You're the master. You can do anything
[39:39.720 --> 39:48.040] you want to unless the law specifically says that you can't. And you can ask that judge anything
[39:48.040 --> 39:56.200] you want. He'll either ask her he won't and you don't care which because it's all about asking
[39:56.200 --> 40:04.120] the question. You're telling the judge that you're peeking under his carpet. You want to see what
[40:04.120 --> 40:11.400] he's swept underneath there that you're poking around in his business. Even if he's not dirty,
[40:12.600 --> 40:18.440] he's going to be afraid that you're going to find something that you can imply is dirty.
[40:18.440 --> 40:27.960] And he's going to look bad by implication. He's going to be real. Go ahead.
[40:28.920 --> 40:32.760] I'm just wondering if it gets into the county record or if there's a place where I could
[40:32.760 --> 40:37.640] look to see some really successful examples of this. This sounds like hell of a lot of fun.
[40:38.520 --> 40:44.920] Oh yeah. Well, you just start looking in the county records for this. You ask the clerk
[40:44.920 --> 40:52.920] to run a search on this judge's name. The property is in his name.
[40:55.640 --> 41:00.760] The search is the clerk is going to say, oh, sure. No problem. It's your run the search.
[41:01.400 --> 41:08.520] And as soon as you walk out, the phone's going to be ringing immediately. Some guy is in here
[41:08.520 --> 41:17.560] looking into the properties of you all. And then the judge can't say anything to you about it.
[41:17.560 --> 41:24.440] If he does, then you charge him with obstruction or official oppression.
[41:27.640 --> 41:30.760] These are public records, not his business, what you're looking at.
[41:30.760 --> 41:38.360] So you want him wondering because if he is dirty, he's going to be terrified.
[41:40.760 --> 41:47.000] And he's going to want your case fixed and gone. If he is dirty, he'll probably recuse himself
[41:47.000 --> 41:54.200] immediately. Okay. So basically the way to do it is file the quiet title action,
[41:54.200 --> 42:01.160] and perhaps simultaneously file the wrongful foreclosure. I'll do that when I can find an
[42:01.160 --> 42:05.800] attorney that gets pain and suffering and I can get somebody to educate them on how to actually do
[42:05.800 --> 42:14.280] it. And then go directly to the county. Hold on. Stop. Back up. If you're going to
[42:14.280 --> 42:19.400] file a wrongful foreclosure, do the wrongful foreclosure and quiet title together.
[42:19.400 --> 42:25.880] Okay. Yes. So since it's already been foreclosed on, you might as well do them together.
[42:27.240 --> 42:31.000] Yeah. And then start doing searches on the judges.
[42:32.200 --> 42:39.480] Present the same cases that take the additional notice of this party being dissolved
[42:39.480 --> 42:42.920] many years prior to that assignment in both steps.
[42:42.920 --> 42:50.760] Yes. Absolutely. Put that in. Now give them two opportunities to screw up rather than just one.
[42:53.800 --> 42:58.200] And I have a rule, never interfere with somebody when he's screwing up.
[42:59.560 --> 43:09.320] Yeah. Okay. This is so crazy. You know, if we were sitting across the table from
[43:09.320 --> 43:14.040] reasonable people having a simple discussion, this whole thing could have been resolved in five
[43:14.040 --> 43:21.080] minutes. Yes. It's taking years. But hey, in the end, it's hopefully going to be worth it.
[43:22.120 --> 43:29.320] Yeah. The thing to understand is it doesn't work the way they told you it did in high school.
[43:30.440 --> 43:35.560] Oh yeah. That's for sure. Once you figure out how it really works, it's okay.
[43:35.560 --> 43:40.840] Because we can work with these tools. Just as long as we know what they are.

[46:17.800 --> 46:23.080] Okay, we are back. Randy Kelton, we're on the radio and we're talking to Mark in Texas.
[46:23.080 --> 46:29.240] Okay, Mark, you think you've got some idea how to go after him?
[46:30.280 --> 46:37.800] I have a little more. This judge that actually issued this judgment, he previously had a rift
[46:37.800 --> 46:44.440] of mandamus issued against him for hearing a case without subject matter jurisdiction.
[46:45.240 --> 46:50.120] And that's kind of beautiful because whenever I have my hearing because of your suggestion,
[46:50.120 --> 46:56.200] I actually challenge subject matter jurisdiction. It was never affirmatively
[46:56.200 --> 47:01.720] quit. It was just alluded to by the other side. They said, I believe this court has jurisdiction
[47:01.720 --> 47:06.920] to hear court closures, your honor. And that was all they said. And this was being questioned,
[47:06.920 --> 47:11.160] of course, because the whole thing was about past the statute of limitations on the face
[47:11.160 --> 47:16.120] value of the complaint. And the judge had already signed my order and then overturned it.
[47:16.120 --> 47:22.760] It actually reopened the case in violation of one of the rules of civil procedure because they
[47:22.760 --> 47:29.400] didn't have a valid prima facie cause of action being that it's filed past the statute of limitations.
[47:30.040 --> 47:33.560] So I believe right there he violated my rights to due process.
[47:34.760 --> 47:40.680] You definitely need to start looking at his property or records.
[47:40.680 --> 47:47.160] Well, I haven't barred any of the attorneys on the other side or this judge because I haven't
[47:47.160 --> 47:51.960] known strategically if it was good yet. It's two years after the judgment. I hope I haven't
[47:51.960 --> 48:04.120] waited too long. It doesn't matter because the bar and the state commission won't do anything
[48:04.120 --> 48:11.000] anyway. It's the insurance companies that will sting them. Sure. Well, I want to drag them
[48:11.000 --> 48:21.800] on the other side before she retires. But start looking at her records. You might go in and
[48:21.800 --> 48:34.360] go to the clerk's office and do a search for closure. Ask to see the last 20 foreclosure cases
[48:34.360 --> 48:43.640] before this court. Okay. And they're going to run to the judge and say, this guy's pulling
[48:43.640 --> 48:53.080] your past cases. And that's going to tell the judge this guy's looking for a pattern. Okay.
[48:53.080 --> 49:02.840] They're going to ask me why. Can they do that? Oh, they can do that. If I can get them to ask
[49:02.840 --> 49:13.160] me why, I dial 911 immediately. Okay. There are two questions they can ask you. Who are you?
[49:13.160 --> 49:23.400] What records do you seek? And that's this. So I deliberately craft my requests in a way that
[49:23.400 --> 49:29.640] will be unclear to them what I'm looking for. Because I want them to ask me why.
[49:31.640 --> 49:40.600] And I sting them immediately. And then we get all this nonsense out of the way about,
[49:40.600 --> 49:47.240] let's be nice guys and you're going to jerk me around and mess with me. We're not going there.
[49:48.520 --> 49:57.240] Don't screw with me. And when they think you're looking into the judge, the judge is,
[49:57.800 --> 50:04.040] he's going to be uncomfortable. Because he thinks you're looking for something to
[50:04.040 --> 50:09.080] charge him with. He's afraid you'll charge him even if he hasn't done anything wrong.
[50:09.080 --> 50:16.200] And he's still going to look bad. The right way to do this for maximum effect
[50:16.200 --> 50:21.480] would be to walk in and ask to see the last 24 closure cases before the court,
[50:21.480 --> 50:26.600] maybe even make some copies. And then you come in the next day and you look for the judge's
[50:26.600 --> 50:32.600] properties. Yeah, I suppose that's the way what you said. Yeah, I think that would be great.
[50:32.600 --> 50:40.520] Because then the judge knows you're coming at him, but you haven't said anything and he can't
[50:40.520 --> 50:46.920] say anything. If he says anything about you're looking at his properties, you ask him to disqualify
[50:46.920 --> 51:00.920] himself. If he asks you anything about what you're looking for concerning him, you consider that a
[51:00.920 --> 51:11.960] threat and obstruction under 36.06. And ask him to stand down and ask the bailiff to take a
[51:11.960 --> 51:17.480] complaint against him. And everybody's going to get real tense and this tells the judge
[51:18.120 --> 51:23.800] that I am going to be the prosa from hell. I'm not going to be nice. I'm not going to be
[51:23.800 --> 51:32.360] understanding and I'm not going to be reasonable. I'm going to give you partially all the political
[51:32.360 --> 51:41.400] grief I can. Yeah, okay. Well, that's okay. We'll have fun and keep us up to date.
[51:43.320 --> 51:51.080] All right. Thank you. Okay. Thank you, Mark. Okay, now we're going to Craig in Louisiana. Hello, Craig.
[51:51.080 --> 52:04.280] Hello, Craig. Hello. Okay. Are you on a hands-free phone, a speakerphone?
[52:07.560 --> 52:11.800] I was on a speakerphone. You didn't give me a chance to get off of it. I'm off of it now.
[52:12.840 --> 52:18.040] Okay. Good. Good. Good. Sounds much better. I knew you were either on a speakerphone or you
[52:18.040 --> 52:32.440] had your head in the toilet. Okay. I wasn't going to ask about the second one because I didn't figure
[52:32.440 --> 52:45.320] you'd admit to it anyway. Okay. What do you have for us today? Okay. I called, spoke with you a
[52:45.320 --> 52:52.840] few weeks ago and I kind of got in right at the end of the show and he said to call back.
[52:53.480 --> 52:56.440] I'm from Louisiana and I told him about a speeding ticket.
[52:59.000 --> 53:11.560] But last week, you talked about your website and so I got your advice. I went on a website
[53:11.560 --> 53:21.320] and I sent out the information about the traffic citation and admitted it. And then I got an email
[53:22.680 --> 53:40.840] from Brett and he's my programmer. Right. He wrote a real nice letter. He was an officer who
[53:40.840 --> 53:46.520] bought the ticket. He didn't sign the ticket. She just put her initials and her initials were BS.
[53:48.040 --> 53:49.560] Oh, I remember that one.
[53:52.280 --> 53:59.080] Yeah. We had a good time with that. He suggested I call you back. What's our plan on doing anyway?
[54:00.520 --> 54:05.720] And I didn't really expect to get anything out of it. I just kind of went through there just to see
[54:05.720 --> 54:13.480] if there was, I could make any suggestions, you know. The problem with the fact that you're in
[54:13.480 --> 54:26.120] Louisiana is Louisiana is a different country. Most of the states, the newer states, everything
[54:26.120 --> 54:37.800] essentially west of the 13 colonies tend to follow Spanish law. The 13 colonies follow the
[54:38.920 --> 54:49.560] older common law. They're mostly commonwealths. Louisiana, the whole other animals based on
[54:49.560 --> 55:01.160] French law. So it essentially is not like the rest of us. However, the transportation code
[55:01.800 --> 55:11.080] has been adopted from the feds. So have similar laws concerning who can enforce the transportation
[55:11.080 --> 55:21.080] code. What were you charged with? Speeding. That's what I thought you said. Have you looked up the
[55:21.080 --> 55:31.000] speeding statute in Louisiana? Yes, I did. What specifically are you asking about?
[55:31.000 --> 55:45.080] Well, in Texas, the speed limit signs establish a prima facie safe speed. However, they are not a
[55:45.080 --> 55:53.640] speed limit. You can drive as fast as you want to so long as you don't create a hazard and cause an
[55:53.640 --> 56:04.120] accident. I don't say that here in Louisiana. The way, if I remember correctly, it says that
[56:05.320 --> 56:14.200] it's regulated, the speed is regulated by posted sign markers or whatever terminology they use.
[56:14.200 --> 56:26.920] That's how they address that issue. I normally don't go to the merits.
[56:28.600 --> 56:35.400] That's because, for the most part, they can't get past jurisdiction. Have you looked at the
[56:35.400 --> 56:45.320] enabling legislation, the legislation that adopts the federal transportation code,
[56:47.400 --> 56:56.120] and who can enforce it? Because generally, transportation code being a commercial code
[56:56.120 --> 57:06.520] is generally a code-limited enforcement. Your highway patrols are all created to enforce
[57:06.520 --> 57:17.400] the transportation codes. Most states have provisions for certain county or municipal
[57:17.400 --> 57:26.920] officers to enforce, but it's very restricted. You should look at the most likely administrative
[57:26.920 --> 57:32.440] code, but you're in Louisiana. I don't know how they organize their law there.
[57:34.120 --> 57:40.120] It's a convoluted mess because I was actually looking earlier at federal
[57:40.120 --> 57:45.880] hospitals and the administrative law and criminal codes.
[57:49.720 --> 57:54.440] Quite generally, the authority to enforce is in the administrative codes.
[57:56.360 --> 58:03.880] Do a search for an authority to enforce transportation code. Louisiana, see what you get.
[58:03.880 --> 58:13.720] I can't do that here because I'll get Texas state-specific hits. If you're in Louisiana,
[58:17.720 --> 58:25.080] then see how the officers get authority to enforce. That's so far has been where there
[58:25.080 --> 58:33.960] a case he is. They can't get past jurisdiction. Hang on, go into break, Randy Kelkin, move on
[58:33.960 --> 58:39.880] radio, call in number 512-646-1984. We'll be right back.

[01:00:19.400 --> 01:00:35.320] Today in history, the year 1868, the impeachment of Andrew Johnson ends with his acquittal
[01:00:35.320 --> 01:00:45.240] by one vote. Today in history. In recent news, leaders of the Group of Seven or the United States,
[01:00:45.240 --> 01:00:50.440] Canada, Britain, France, Germany, Italy, and Japan are meeting Friday today for a two-day
[01:00:50.440 --> 01:00:55.640] summit in Torremina, Italy. These powerhouses make up nearly 50 percent of the world economy
[01:00:55.640 --> 01:01:01.160] and represent more than 60 percent of net global wealth. The first summit, known in 1975 as the
[01:01:01.160 --> 01:01:07.720] G6, was attended by France, Germany, the U.S., Britain, Japan, and Italy. Canada was later added
[01:01:07.720 --> 01:01:12.040] to form the Group of Seven and representatives of the European Union have been additional
[01:01:12.040 --> 01:01:17.720] participants to the summit since 1981. Focusing on the democracies and economies of non-communist
[01:01:17.720 --> 01:01:22.600] countries, Russia was first invited as a guest observer in 1997 for their pro-capitalist
[01:01:22.600 --> 01:01:27.160] initiatives at the time and joined in 1998 forming the Group of Eight, but was later
[01:01:27.160 --> 01:01:32.280] kicked out in 2014 over the annexation of Crimea. The main issue for this year's meeting,
[01:01:32.280 --> 01:01:36.920] climate change, and whether the Trump administration will keep the U.S. and the Paris Climate Treaty,
[01:01:36.920 --> 01:01:42.280] the conflicts in Syria and Libya, the European refugee crisis, North Korea's missile buildup,
[01:01:42.280 --> 01:01:51.640] and getting Russia to cooperate. This last Thursday night, Federal District Judge William
[01:01:51.640 --> 01:01:56.600] Orrick of San Francisco ordered David Daliden, an anti-abortion activist and his attorneys,
[01:01:56.600 --> 01:02:01.320] to take down at least 11 names in several hours of video uploaded earlier this week,
[01:02:01.320 --> 01:02:05.400] which was secretly filmed at two National Abortion Federation conferences.
[01:02:05.400 --> 01:02:09.720] Judge Orrick issued an injunction last year barring the release of the footage and names,
[01:02:09.720 --> 01:02:14.680] but an attorney defending Daliden in a separate criminal case posted the material on his website,
[01:02:14.680 --> 01:02:19.240] arguing that it had already become part of public record. Daliden is also set for a hearing on
[01:02:19.240 --> 01:02:23.800] June 14th to determine whether he should be held in contempt for the actions of his lawyer.
[01:02:23.800 --> 01:02:27.640] If you recall, David's undercover videos made national headlines two years ago,
[01:02:27.640 --> 01:02:32.440] when he and others posed as representatives from a biomedical firm recording conversations with
[01:02:32.440 --> 01:02:37.880] high-level officials at Planned Parenthood. This resulted in California's Attorney General Xavier
[01:02:37.880 --> 01:02:43.160] Becetta earlier this year charging Daliden and partners with 15 felony counts of violating
[01:02:43.160 --> 01:03:03.160] the privacy of healthcare providers by recording confidential information without their consent.
[01:03:13.320 --> 01:03:16.840] Okay, we are back.
[01:03:17.960 --> 01:03:21.320] Randy Kelton here with our radio and we're talking to Craig and Louisiana.
[01:03:22.840 --> 01:03:30.600] Okay, I'm afraid that, have you talked to Eddie Craig? He may know more about Louisiana law than me.
[01:03:33.000 --> 01:03:42.600] No, I was on hold last week on my Monday, but he had a couple of long talks there,
[01:03:42.600 --> 01:03:47.240] and I don't have to get in, so I'm just chance to talk to him, but I plan on it.
[01:03:48.680 --> 01:03:56.920] I got another question. I've heard you talked about this pre-trial conference,
[01:03:56.920 --> 01:04:02.040] and some of the parishes here in Louisiana, they do that, when you have a speed ticket,
[01:04:02.040 --> 01:04:07.800] where you go in there and they try to work and deal with you, to get you to pay,
[01:04:07.800 --> 01:04:13.720] or they'll keep it off your insurance or off the records for your insurance,
[01:04:13.720 --> 01:04:20.280] or they'll do that kind of stuff, and some of them don't.
[01:04:21.560 --> 01:04:29.480] But I have the arrangement, they gave me this next court date, which is the pre-trial conference,
[01:04:29.480 --> 01:04:40.440] which is one of these deal-making things, and I got a file about Jurisditch,
[01:04:40.440 --> 01:04:47.720] I got a brief and an emotion that I want to file, and a question is,
[01:04:47.720 --> 01:04:54.200] should I wait till after that pre-trial conference to file that, just to see what they got,
[01:04:54.200 --> 01:04:59.560] or go in there with that and not even talk to these people?
[01:05:01.800 --> 01:05:10.040] I have no idea how to answer that. I just don't know enough about Louisiana law.
[01:05:10.040 --> 01:05:24.040] I just did a search for Arrangement Louisiana, or LA, and I got Los Angeles.
[01:05:24.040 --> 01:05:29.480] Criminal risk pre-trial Louisiana. I'm trying to find something on Arrangement,
[01:05:29.480 --> 01:05:32.600] you've heard me talk about it, you've heard me talk about how
[01:05:32.600 --> 01:05:40.520] in Texas you can only have an Arrangement in a charge punishable by imprisonment,
[01:05:42.280 --> 01:05:45.960] so legally they can't hold an Arrangement.
[01:05:48.040 --> 01:05:55.080] And you said that some of them do this and some of them don't, and that gives me a reason to
[01:05:55.080 --> 01:06:00.200] believe something else is going on. There may be a reason some of them don't do it,
[01:06:00.200 --> 01:06:05.000] and it may be that it's not allowed by law and somebody's challenged them on it.
[01:06:07.800 --> 01:06:13.480] I put like this, I've gotten a lot of speeding tickets through all these southern parishes,
[01:06:13.480 --> 01:06:19.800] and there's only one parish that goes by the book, unfortunately not the parish I live in,
[01:06:19.800 --> 01:06:24.200] but all the rest of them play these little games with you. And some of them even have
[01:06:24.200 --> 01:06:31.960] to go to court or anything, you can just go to the window and they can deal with the court.
[01:06:33.960 --> 01:06:36.360] That sounds like Louisiana.
[01:06:40.120 --> 01:06:45.560] Okay, an Arrangement in Louisiana is the first court appearance in Criminal Court Louisiana.
[01:06:45.560 --> 01:06:49.560] Prior to the Arrangement, prosecutor either filed a bill of information.
[01:06:49.560 --> 01:06:57.160] Yeah, this is some stuff by a lawyer, and I find that reading these pages by lawyers
[01:06:58.200 --> 01:07:03.400] meaningless. Yeah, I never bought it, I would even, because I'll have something different.
[01:07:04.360 --> 01:07:09.720] Yeah, they're not telling you what the law is, they're telling you what the practice is.
[01:07:12.120 --> 01:07:19.240] So I have it, unless I find a brief by a lawyer that he puts up so that other attorneys
[01:07:19.240 --> 01:07:26.680] will see his brief and hire him, then you get pretty good law. But these attorney sites where
[01:07:26.680 --> 01:07:31.720] they're trying to get you to use them, they just tell you how things are actually practiced,
[01:07:31.720 --> 01:07:37.800] they don't tell you what the law is. So I wish I could be more helpful, but Louisiana law is
[01:07:37.800 --> 01:07:49.160] something I just don't have any experience with. And we get very little call from Louisiana on law.
[01:07:49.160 --> 01:07:54.200] So I have to assume that everybody in Louisiana follows the law so nobody ever gets in trouble.
[01:07:54.200 --> 01:08:09.560] Send me an email about this, will you? It'll remind me to have a look at it,
[01:08:09.560 --> 01:08:16.440] because I am building this electronic lawyer, and I'm going to get to Louisiana.
[01:08:16.440 --> 01:08:25.080] So it's a good reason for me to look at it to kind of assess what it will take to go after
[01:08:25.080 --> 01:08:32.680] them on jurisdiction. And some of the other tools that we use, I'm building a set of documents
[01:08:33.240 --> 01:08:39.320] that you could file on the front end. So that when this lawyer calls you in for his little
[01:08:39.320 --> 01:08:44.120] conference, you don't want to talk about the conference, you want to talk about all these
[01:08:44.120 --> 01:08:50.440] documents you got filed in the court. So he looks at them and realizes how much money
[01:08:50.440 --> 01:08:56.360] it's going to cost him to try to adjudicate these, then he makes you a better deal to get
[01:08:56.360 --> 01:09:06.200] you to go away and leave them alone. Okay, just to see on now, in the future,
[01:09:06.200 --> 01:09:14.360] and I'll put this in the email, to find anything about Louisiana law, you can go to LA.gov.
[01:09:15.880 --> 01:09:22.440] And then you go to Judiciary, you can find the administrative code, the procedure, the statute,
[01:09:22.440 --> 01:09:30.520] the code, all that's in that LA.gov site. Okay, I may have a little look in that because
[01:09:30.520 --> 01:09:37.880] I know what I'm looking for, so I may be able to find it faster. Okay, see me, see me in email
[01:09:37.880 --> 01:09:45.000] and I'll have a look and send you what I find. Okay, thank you, Craig. Okay, now we're going to
[01:09:46.040 --> 01:09:50.120] John in Texas. Hello, John. Oh, give me a second.
[01:09:50.120 --> 01:10:03.400] Oh, no, another guy with his head in the hands-free phone, in the speakerphone.
[01:10:04.520 --> 01:10:11.880] Yeah, give me a second. I'm recording everything, so I can get all this done right here.
[01:10:11.880 --> 01:10:26.680] Yeah. All right. Yes, I've been arrested for failure to identify myself.
[01:10:27.560 --> 01:10:32.440] Wait, you're arrested for what? Failure to identify myself.
[01:10:33.320 --> 01:10:37.160] Oh, okay. Expired insurance and registered.
[01:10:37.160 --> 01:10:43.640] Okay, you understand that arrested for failure to identify is a contradiction of terms.
[01:10:47.400 --> 01:10:52.440] Because you can't fail to identify until you have been arrested.
[01:10:53.560 --> 01:10:57.800] Right. Okay, give us some details. How did this occur?
[01:10:57.800 --> 01:11:07.560] Well, I was heading north. Give me a second here. I was heading north. I'm like,
[01:11:09.400 --> 01:11:14.600] I was heading south, actually, and the police officer was heading north. I guess he supposedly
[01:11:14.600 --> 01:11:23.640] saw my tag. All right, so he did a return and I was making a left. I didn't even realize he was
[01:11:23.640 --> 01:11:29.240] behind me because I was not paying attention to him, but I didn't see him behind me. By the time
[01:11:29.240 --> 01:11:34.520] I got to my driveway and pulled into my driveway, he didn't really step out. I see the police officer
[01:11:34.520 --> 01:11:43.480] pull up right behind me in my driveway and walked up. I did what they say on YouTube. They locked
[01:11:43.480 --> 01:11:54.360] the door in the window about two inches open. First thing he did was ask me, like in the
[01:11:54.360 --> 01:12:03.640] registration, I told him, I didn't need to give him that information because I haven't done a crime
[01:12:03.640 --> 01:12:15.400] or anything. He started getting a little nervous. He said, I need your license and
[01:12:15.400 --> 01:12:21.240] registration. I said, well, I'm not going to give you that. He's going to have to get somebody
[01:12:21.240 --> 01:12:28.520] else out here that maybe he could understand what I'm trying to get here. So he called, I guess,
[01:12:28.520 --> 01:12:34.520] because the sergeant, you know, I told him to get the sergeant and sergeant comes and
[01:12:35.080 --> 01:12:38.680] nice guy. He started talking me through, you know, trying to, you know.
[01:12:40.440 --> 01:12:45.240] Okay, hold on. Hold on. Did they tell you why they stopped you?
[01:12:47.080 --> 01:12:51.080] Yeah, you stopped me for my insurance or my registration.
[01:12:51.080 --> 01:12:56.840] Was it expired?
[01:12:58.120 --> 01:13:07.400] Yes, it was. Oh, okay. Then technically, you were under arrest at that point.
[01:13:08.760 --> 01:13:12.600] I was under arrest at that point. Yes, you should have identified.
[01:13:12.600 --> 01:13:25.240] Okay. It's never a good idea to start an altercation with the police.
[01:13:26.120 --> 01:13:30.760] Right, right. I learned that. Listen to Eddie Craig. Yeah. I didn't know. I didn't know anything
[01:13:30.760 --> 01:13:36.920] about Eddie Craig. It just fell recently. Yeah. Bushwack is a whole lot more fun.
[01:13:36.920 --> 01:13:44.280] You're just sweet and nice and do whatever they say. And then when you go to court or when they
[01:13:44.280 --> 01:13:53.160] leave, then you file complaints against them. Yeah. Generally, when I get stopped, if a officer,
[01:13:54.680 --> 01:14:00.040] if I get two words out of that officer, I don't like I dial 911 immediately.
[01:14:00.040 --> 01:14:07.400] Get somebody out here to get him under control. And that kind of slows them down. Now,
[01:14:07.400 --> 01:14:12.920] they didn't want to fight quite so much. But if the officer is pleasant and professional,
[01:14:12.920 --> 01:14:20.920] I am pleasant and try to be reasonable with him. There are whites I don't exert
[01:14:22.440 --> 01:14:28.520] unless I feel like I need to. And to identify myself, I have no problem identifying myself.
[01:14:28.520 --> 01:14:37.240] Right. Now, that doesn't say everybody else should. It's just the fights I choose to have.
[01:14:39.720 --> 01:14:45.000] Now, I've got license on my car. I've got a driver's license. It's valid.
[01:14:46.680 --> 01:14:53.560] I understand the law on these matters. But there are fights I don't want to have.
[01:14:53.560 --> 01:15:02.200] I pick my fights real careful. And I suggest other people do that, especially
[01:15:02.920 --> 01:15:08.760] if you're not as knowledgeable in these legal matters as me or Eddie Craig,
[01:15:09.880 --> 01:15:12.680] then be more careful about the fights you pick.
[01:15:15.720 --> 01:15:22.920] And here, you might go to the court and maintain that you acted in good faith and
[01:15:22.920 --> 01:15:30.680] reliance on competent authority. That you never realized that you were under arrest.
[01:15:30.680 --> 01:15:36.280] You would never have notified that you were under arrest. If you look in the code,
[01:15:37.400 --> 01:15:42.280] you have to be arrested and you have to know that you've been arrested.
[01:15:42.280 --> 01:15:54.920] Right. I've seen it in court. I guess I was so nervous and I was going against them.
[01:15:56.840 --> 01:16:02.280] At the time that the third officer came, I guess you said I was under arrest to step out of the
[01:16:02.280 --> 01:16:09.720] car. And I guess that was the time I should have did that. Absolutely. I was so pumped up and
[01:16:09.720 --> 01:16:14.360] I didn't realize he said what he said. And they found me guilty for that.
[01:16:17.720 --> 01:16:24.520] Oh, so you've already been adjudicated. Okay. It'll be hard. You might be able to appeal it,
[01:16:25.480 --> 01:16:31.640] but just from talking to you, you don't have the background. You probably didn't get in
[01:16:32.280 --> 01:16:35.400] the facts and the law you need to be able to appeal this.
[01:16:35.400 --> 01:16:41.720] What did they, what was the end result? Did they put you in jail? Here.
[01:16:45.560 --> 01:16:46.520] Oh, wait a minute.
[01:16:49.880 --> 01:16:54.760] When they arrested you, did they take you directly to the nearest magistrate?
[01:16:55.400 --> 01:16:58.200] That's what I told them. I told them. And of course, I said,
[01:16:59.960 --> 01:17:04.840] I love logos. Without the shows on this network, I'd be almost as ignorant as my friends. I'm so
[01:17:04.840 --> 01:17:09.480] addicted to the truth now that there's no going back. I need my truth fake. I'd be lost without
[01:17:09.480 --> 01:17:14.040] logos. And I really want to help keep this network on the air. I'd love to volunteer as
[01:17:14.040 --> 01:17:18.520] a show producer, but I'm a bit of a Luddite and I really don't have any money to give because I
[01:17:18.520 --> 01:17:24.360] sent it all on supplement. How can I help logos? Well, I'm glad you asked. Whenever you order
[01:17:24.360 --> 01:17:29.240] anything from Amazon, you can help logos with ordering your supplies or holiday gifts. First
[01:17:29.240 --> 01:17:36.360] thing you do is clear your cookies. Now go to logosregualnetwork.com, click on the Amazon logo
[01:17:36.360 --> 01:17:42.040] and bookmark it. Now, when you order anything from Amazon, you use that link and logos gets a
[01:17:42.040 --> 01:17:47.880] few pesos. Do I pay extra? No. Do you have to do anything different when I order? No. Can I use
[01:17:47.880 --> 01:17:53.960] my Amazon Prime? No. I mean, yes. Wow, giving without doing anything or spending any money,
[01:17:53.960 --> 01:17:59.880] this is perfect. Thank you so much. You're welcome. Happy holidays, logos.

[01:18:56.760 --> 01:19:26.040] or call 512-646-644-0. Okay, we are back. Randy Kelkin,
[01:19:26.040 --> 01:19:33.640] Rural Law Radio, and we're talking to John in Texas. Let me get him unmuted here. There we go.
[01:19:35.640 --> 01:19:44.600] Yeah, I would say you probably didn't get that one right. But it's okay. This is how we get better.
[01:19:46.280 --> 01:19:55.880] I spent my time in jail as well. But it is my, I keep people, don't fight with the policemen on
[01:19:55.880 --> 01:20:12.760] the street. I know that he could set up and set up more. Keep shutting up. Yeah. He took me directly
[01:20:12.760 --> 01:20:27.160] to jail. Okay. Now I need to ask a question. What do you want to do? I want them to replace
[01:20:27.160 --> 01:20:36.120] my windows. I guess, I don't know. I was thinking about asking charges, but I don't know if I should
[01:20:36.120 --> 01:20:46.200] do that. I don't know. I live here in Midland and the police over here are pretty. Okay. One thing
[01:20:46.200 --> 01:20:52.920] I can pretty well assure you, when you start filing charges against them, they are not going to mess
[01:20:52.920 --> 01:21:03.800] with you. Really? Because if they do, we can show you how to wind their clocks big time. Oh, okay.
[01:21:03.800 --> 01:21:11.960] Okay. When I file a complaint, I want to file a complaint early. Once I've filed the complaint,
[01:21:11.960 --> 01:21:20.040] now I've poisoned their will. Anybody says anything to me that I, in any way,
[01:21:20.040 --> 01:21:33.800] construe as a complaint, gets a 911 call. Okay. 3606, obstruction of justice and retaliation. Then it
[01:21:33.800 --> 01:21:44.200] gets real ugly for them. So that's not something you have to worry about very much. But before you
[01:21:44.200 --> 01:21:50.360] pick this fight, make sure you want to get into the fight. It takes a lot of work, a lot of study
[01:21:51.560 --> 01:22:00.120] to be able to do this. Okay. And not everybody's designed for it. Not everybody's in a position
[01:22:00.120 --> 01:22:07.160] where they can do this. Eddie and I and Deborah, we spend most of our time here looking for maybe
[01:22:07.160 --> 01:22:14.360] a half a percent of the people who are able to do this. When I first started doing the radio show,
[01:22:14.360 --> 01:22:20.600] there were a lot of these pompous jerks that would get on here and call people sheeple.
[01:22:21.800 --> 01:22:30.920] And I wanted to slap them. Guys got four kids, a mortgage, two cars. He's got debt up to his
[01:22:30.920 --> 01:22:37.640] eyeballs. He's got a job that sucks. This guy is struggling just to keep his head above water.
[01:22:37.640 --> 01:22:43.880] And you want him to put everything down and completely research the law and go fight your
[01:22:43.880 --> 01:22:51.720] fight for you. What the heck with you? So don't tell these people to go out here and do stupid
[01:22:51.720 --> 01:22:58.360] stuff. They're getting put in jail. Ralph Leonard won't call into my show anymore because last time
[01:22:58.360 --> 01:23:07.000] he called in, I crawled right down his throat. Don't you tell people this stupid trash that'll
[01:23:07.000 --> 01:23:15.240] get them thrown in jail? Well, it's true. I don't care if it is true. People can't use this. He's
[01:23:15.240 --> 01:23:21.400] saying the laws don't apply. Well, what applies, Ralph? Does the Constitution apply? No, no, the
[01:23:21.400 --> 01:23:26.200] Constitution don't apply. What applies, Ralph? Then it's Constitution laws don't apply. You
[01:23:26.200 --> 01:23:32.760] got to go to the National Register. Well, the National Register is where when a federal law is
[01:23:32.760 --> 01:23:38.520] passed, it's just added to the end of the National Register. Every law that's passed. So they're just
[01:23:38.520 --> 01:23:48.520] kind of in there scrambled. So what the legislature did is they hired these companies to go through
[01:23:48.520 --> 01:23:55.960] the code and sort them out by topics. All of the laws that go to criminal, put them in a criminal
[01:23:55.960 --> 01:24:04.520] statute book and family law and the family selects the book. And what Ralph is alluding to is the
[01:24:04.520 --> 01:24:11.080] law is not what you find in the statute book. It's what's actually written in the National Register.
[01:24:12.040 --> 01:24:17.960] But he's not explaining that where it's making sense. He's saying that the statutes don't apply.
[01:24:17.960 --> 01:24:25.640] And yes, they do apply. So long as they accurately reflect what is in the National Register.
[01:24:27.320 --> 01:24:30.200] But he's not explaining that. He's just saying they don't apply.
[01:24:31.000 --> 01:24:34.360] And he said, well, you got to go to the National Register. I said, that's really nice, Ralph,
[01:24:34.360 --> 01:24:41.480] the National Register. That's about 65,000 pages. You want to be a little more specific?
[01:24:41.480 --> 01:24:50.440] He hung up on me. I was furious. He's telling people to do things. He's telling them the law
[01:24:50.440 --> 01:24:56.280] don't apply. So when they go to court, they treat the law like it doesn't apply. They wind up in jail.
[01:24:56.280 --> 01:25:00.840] That's what I told Ralph. You know, these police, they think it applies. The judges think it applies.
[01:25:01.880 --> 01:25:07.000] And when they arrest you and throw in your jail, it's going to feel like they imply.
[01:25:07.000 --> 01:25:13.160] So don't come on here telling people that these don't apply. He hung up on me. He's never called
[01:25:13.160 --> 01:25:22.760] back and that's a good thing. Don't get put in jail. If you get charged before you go to jail,
[01:25:22.760 --> 01:25:30.120] take a deal. Don't stand on principle. You cannot fight for liberty if you're in jail.
[01:25:30.120 --> 01:25:36.840] You need to be out here while you fight. So if they're out of jail, pick the fight you're able to fight.
[01:25:37.640 --> 01:25:44.120] Oh man, I'm happy for you right now. And leave the fights to those of us who
[01:25:44.840 --> 01:25:49.560] have other reasons. I have a special reason for what I do.
[01:25:49.560 --> 01:26:00.840] A twin brother died in marones in Vietnam fighting for these rights. You try to take one of mine
[01:26:00.840 --> 01:26:07.480] and I am PO. We are going to fight. But you probably don't have that motivation.
[01:26:09.400 --> 01:26:16.040] You don't need to fight. You don't need to fight like that. So take on what you can.
[01:26:16.040 --> 01:26:25.640] But don't feel you have to fix all these problems in the world. I've got Olivier down here. He's the
[01:26:25.640 --> 01:26:35.000] next caller and he is one of us. He was able, he had the time and he had to wear with all
[01:26:35.000 --> 01:26:43.160] to pick this fight up and take it on. But not all of us have that. And we're looking for the
[01:26:43.160 --> 01:26:50.120] Olivier's who can do this. And I wouldn't ask you to unless you read it. That's why I asked you
[01:26:50.120 --> 01:27:01.400] what you want to do. Well, on the whole thing, you know, at the end he found out I had an invalid
[01:27:01.400 --> 01:27:06.760] license and that's why I didn't want to give up my own identification because I was going to go to
[01:27:06.760 --> 01:27:14.680] jail either way. I don't know what the fuss is about. Okay. Now you've got to fight if you want to
[01:27:14.680 --> 01:27:20.120] take it because they took you to jail instead of taking you to a magistrate. To a magistrate,
[01:27:20.120 --> 01:27:31.720] yeah. I told them that in court. So if you want them not to stop you again, then you might go
[01:27:31.720 --> 01:27:37.640] down and file criminal charges against the judge, I mean against the police officer and the jailers
[01:27:37.640 --> 01:27:47.880] and just file a T-close complaint. Texas Commission on Law Enforcement. It's a professional
[01:27:47.880 --> 01:27:54.680] conduct complaint and it stings them big time. You start doing all that. They see you again.
[01:27:54.680 --> 01:27:59.880] They won't want anything to do with you. Yeah. When I was mentioning all that stuff,
[01:27:59.880 --> 01:28:05.560] that judge is starting to get nervous, you know. She's like, do you arrest this person right here?
[01:28:05.560 --> 01:28:13.720] What would you do arrest this person for? You know, I had three... Sorry, go ahead.
[01:28:15.000 --> 01:28:21.560] I don't give them fair warning. The way I get them not to want to mess with me,
[01:28:21.560 --> 01:28:31.640] I went to a court last Thursday of last week and went up to the bailiff and he said,
[01:28:31.640 --> 01:28:38.360] you can't go in with your cell phone. I said, sure, I can. I'm going to record the proceedings. Oh,
[01:28:38.360 --> 01:28:42.840] you can't record in our courts. Yeah, sure can. Nothing to it. Look, I just pushed the button
[01:28:42.840 --> 01:28:48.360] and it records. No, no, no, you can't go in. So I dial 911 and ask them to send the sergeant out
[01:28:48.360 --> 01:28:58.280] to arrest him. All right. That was so much fun. They sent out this sergeant and I wanted to arrest
[01:28:58.280 --> 01:29:05.560] him because in February of this year, the Fifth Circuit passed a new ruling down
[01:29:06.920 --> 01:29:13.880] that said we can videotape or record our public officials. And he asked me if I told the
[01:29:13.880 --> 01:29:23.400] bailiff about this new ruling. Well, I'm not his lawyer. If he needs legal advice, he can call
[01:29:23.400 --> 01:29:30.200] his lawyer and I'm sure his lawyer are telling him about it, but I'm not his lawyer. And the cop
[01:29:30.200 --> 01:29:36.360] said, the sergeant they sent said, well, Mr. Kelton, you know, it's not his fault. He's just
[01:29:36.360 --> 01:29:41.160] following the court rules. If you have a complaint, you should take it to the judge.
[01:29:41.160 --> 01:29:48.920] Well, the judge didn't deny the access to the court. The bailiff did. Well, he's acting on the orders
[01:29:48.920 --> 01:29:54.600] of the judge. I said, I don't know that. I asked the court for the local rules and she didn't have
[01:29:54.600 --> 01:30:03.480] any local rules. All I know is he wouldn't let me in. Foot in mouth syndrome. We've all been there.
[01:30:03.480 --> 01:30:07.800] Whether you're on the giving end or the receiving end of a hurtful comment, words are hard to take
[01:30:07.800 --> 01:30:11.880] back. I'm Dr. Katherine Albright and I'll be back in a moment with some things that should never
[01:30:11.880 --> 01:30:17.400] roll off your tongue. Your search engine is watching you recording all your searches and
[01:30:17.400 --> 01:30:22.600] creating a massive database of your personal information. That's creepy. But it doesn't have
[01:30:22.600 --> 01:30:27.720] to be that way. Startpage.com is the world's most private search engine. Startpage doesn't
[01:30:27.720 --> 01:30:32.360] store your IP address, make a record of your searches or use tracking cookies and their third
[01:30:32.360 --> 01:30:37.960] party certified. If you don't like big brother spying on you, start over with Startpage. Great
[01:30:37.960 --> 01:30:43.320] search results and total privacy. Startpage.com, the world's most private search engine.
[01:30:43.960 --> 01:30:49.480] In social situations, there are some things you should never say. These top my list. When
[01:30:49.480 --> 01:30:54.280] does the baby do? Never say this to a woman. Imagine the embarrassment if she simply gained
[01:30:54.280 --> 01:31:00.200] a few pounds. Don't talk baby unless she brings it up. You look good for your age or you look great
[01:31:00.200 --> 01:31:05.960] after losing all that weight or indirect insults. Instead just say, you look terrific. What's your
[01:31:05.960 --> 01:31:11.320] secret? Finally, no matter how bad someone looks, never say, you look awful. That'll just make
[01:31:11.320 --> 01:31:17.000] the person feel worse. Instead say, how are things going? If they want to talk, that'll open the door.
[01:31:17.000 --> 01:31:22.680] And those are today's tips for taming your tongue. I'm Dr. Katherine Albright. More news and information
[01:31:22.680 --> 01:31:35.160] at KatherineAlbright.com. This is Building 7, a 47-story skyscraper that fell on the afternoon
[01:31:35.160 --> 01:31:40.200] of September 11. The government says that fire brought it down. However, 1,500 architects and
[01:31:40.200 --> 01:31:45.000] engineers have concluded it was a controlled demolition. Over 6,000 of my fellow service members
[01:31:45.000 --> 01:31:49.720] have given their lives. And thousands of my fellow force responders are dying. I'm not a conspiracy
[01:31:49.720 --> 01:31:53.240] theorist. I'm a structural engineer. I'm a New York City correction officer. I'm an Air Force

[01:32:07.640 --> 01:32:11.640] caused it with their chemtrails, but good luck getting them to pay for it. Okay, I might be

[01:33:00.760 --> 01:33:13.800] You are listening to the Logos Radio Network. LogosRadioNetwork.com.
[01:33:22.200 --> 01:33:28.200] Okay, we are back. Randy Kelton with low radio. But the upshot was is the
[01:33:28.200 --> 01:33:36.040] officer told me it wasn't the bailiff's fault. And I told him I knew that. I just needed him
[01:33:36.040 --> 01:33:45.560] to throw the judge under the bus for me. And that was so much fun. But in order to do that,
[01:33:45.560 --> 01:33:50.920] you have to kind of learn the law. There aren't that many laws you need to learn.
[01:33:52.120 --> 01:33:55.880] But once you got them, and once you understand them, the main thing we try to teach
[01:33:55.880 --> 01:34:06.360] in this show, the main understanding we try to impart, is that when you walk into a public
[01:34:06.360 --> 01:34:14.200] building, you are the most powerful person in the place. And that's because everybody that works
[01:34:14.200 --> 01:34:21.720] there are public servants. You, you're the master of those servants. And if one of those
[01:34:21.720 --> 01:34:28.680] servants violates one of your laws, they and they deny you in a right, that's a crime in Texas.
[01:34:30.280 --> 01:34:37.320] That bailiff not letting me in with my phone to record the proceedings. He committed a class A
[01:34:37.320 --> 01:34:45.720] misdemeanor. I'm sure he didn't realize he was doing it. Sorry, brother. Life is tough. And I
[01:34:45.720 --> 01:34:52.360] filed a complaint against the baby. Now the baby is going to be a real unhappy camper. And he's
[01:34:52.360 --> 01:35:00.680] going to want the judge to get my criminal complaint to go away. And then the judge will check the new
[01:35:00.680 --> 01:35:10.840] law and they'll have to change their policy. Never really after people use what they do against
[01:35:10.840 --> 01:35:18.520] them. And in your case, the officer arrested you and took you straight to jail. Yeah. He's going to
[01:35:18.520 --> 01:35:24.840] say he was following policy. And you're going to say, I don't care. You want problem in law.
[01:35:26.520 --> 01:35:30.840] 1406 says you're supposed to take me to nearest magistrate, not to jail.
[01:35:32.520 --> 01:35:37.240] So if you want to take that on, you can. But it'll take some study and research.
[01:35:37.240 --> 01:35:47.400] But I assure you, it is worth the time. Okay. Nobody scares me anymore.
[01:35:49.160 --> 01:35:58.600] Yeah, that's what I want. These guys, yeah. The time before they told me my vehicle was stolen.
[01:35:58.600 --> 01:36:04.840] I was like, you guys are crazy. He told me he took me to the car. They were going to my car.
[01:36:04.840 --> 01:36:08.520] And you should have asked, you should have asked them who stole it.
[01:36:09.320 --> 01:36:13.320] Yeah, I didn't know. I didn't know any better. That's why I started doing this.
[01:36:13.880 --> 01:36:19.640] You know, I started looking into what I was, you know, through some YouTube videos and
[01:36:20.840 --> 01:36:25.560] that's what got me like, well, these guys keep messing with me. I'm just going to have to push back.
[01:36:27.560 --> 01:36:32.920] Get a copy of the penal code or you can get it online and just read it.
[01:36:32.920 --> 01:36:42.280] And then the code of criminal procedure. It's a pretty fast read. And it'll read like a comic book.
[01:36:44.200 --> 01:36:48.200] You'll see these things you can charge them with and you'll be chucking and laughing,
[01:36:49.080 --> 01:36:55.400] waiting for the next time you get a shot at them. Just read through it. Don't try to understand it.
[01:36:56.360 --> 01:37:01.160] Yeah. And then go go back and read it a second time. The second time you read it,
[01:37:01.160 --> 01:37:06.920] all these pieces will start fitting together and it'll really begin to make sense to you.
[01:37:08.600 --> 01:37:11.720] You do that, you'll know the law better than the police do.
[01:37:12.600 --> 01:37:16.840] I don't know all the statutes, but all the stuff that I've been going through is
[01:37:18.680 --> 01:37:21.640] what I've been learning besides the penal code.
[01:37:21.640 --> 01:37:30.440] Like, for instance, the emergency lights come on and they found out it's not an emergency.
[01:37:31.480 --> 01:37:34.840] And they could be punished for that. Is that right? Is that true?
[01:37:35.640 --> 01:37:42.680] Well, no. There's two reasons they can turn those lights on. One is to declare an emergency.
[01:37:42.680 --> 01:37:54.280] The other one is to require that you pull over. So under under 545 points, I think it's 421,
[01:37:54.840 --> 01:37:57.560] they can do that. Okay.
[01:37:59.320 --> 01:38:05.720] Yeah. And I'm I only go after stuff that really matters. Okay. Yeah.
[01:38:05.720 --> 01:38:13.400] Yeah. When they, you know, if I get a policeman, put his hand on his gun. That gets a 911 call
[01:38:13.400 --> 01:38:20.360] immediately. Put a hand on his gun. On his gun. I consider that aggravated assault.
[01:38:21.400 --> 01:38:24.520] Right. They're, they had their hands on their club the whole time. I was like,
[01:38:25.080 --> 01:38:28.120] I know these guys, but they were going to do. I already saw it coming.
[01:38:28.120 --> 01:38:36.680] Right. Well, read the code. You need to know what the code says. Then you'll know how to handle
[01:38:36.680 --> 01:38:42.200] yourself. Just get the penal code and Code of Criminal Procedure. Read through them twice.
[01:38:42.760 --> 01:38:47.720] Then call back in and we will have a whole different conversation.
[01:38:48.360 --> 01:38:51.000] Oh, wait, but I haven't, I've just started though.
[01:38:51.000 --> 01:39:01.480] Um, these guys are, um, right now I'm going through, uh, since I was, um, told I was guilty
[01:39:01.480 --> 01:39:06.920] for this, um, for the things. And now they, they put a drug charge on them.
[01:39:08.440 --> 01:39:13.160] And I don't, I don't, I don't do drugs. I don't carry drugs. And they say they got me on film
[01:39:13.160 --> 01:39:19.160] for this. And I'm letting me go to court this Wednesday. Well, not through Wednesday, but next
[01:39:19.160 --> 01:39:29.560] week. Um, okay. Have you filed a, do you have a lawyer? I have a, um, what do you call that a
[01:39:30.360 --> 01:39:39.720] court appointed a lawyer? Okay. You need to read the law. You need to set down tonight, tomorrow
[01:39:39.720 --> 01:39:49.720] night or tomorrow, uh, Saturday. Take tomorrow and read the penal code and Code of Criminal Procedure.
[01:39:49.720 --> 01:39:56.120] Just read them. Okay. Take, take two, three hours to read them. It's well worth the time.
[01:39:57.400 --> 01:40:02.440] Then you'll better understand how to defend yourself. Right now, from talking to you,
[01:40:02.440 --> 01:40:07.960] you don't have anywhere near enough knowledge to be able to take over if you're a lawyer.
[01:40:07.960 --> 01:40:14.760] Your lawyer's going to throw you under the bus. So what you have to do is throw him under the
[01:40:14.760 --> 01:40:23.080] bus instead. And when you do, when you go after him, he's going to go to the judge and ask to be,
[01:40:23.080 --> 01:40:31.800] uh, asked to be allowed to withdraw and you go and object to it. Now you got your lawyer where
[01:40:31.800 --> 01:40:39.320] you want him. You, you might let him know that, uh, if he don't get you off this case, you're
[01:40:39.320 --> 01:40:45.080] going to bargain with him. But you need to know what the law is. You need to know what to tell
[01:40:45.080 --> 01:40:50.360] him to do. And it would take too long to go through all of that on the show. I'm about to run out of
[01:40:50.360 --> 01:40:55.960] time and I've got a couple more callers that need to get to, but read those two codes and then call
[01:40:55.960 --> 01:41:02.840] back in next week. Okay, I will. You will see. We'll have a whole different conversation.
[01:41:03.720 --> 01:41:08.520] I'm going to try to memorize them. No, no, no, no, no, no, no, don't do that. Don't do that.
[01:41:08.520 --> 01:41:13.560] Don't do that. Just, just, no, just read them. Okay. I didn't try to memorize these.
[01:41:14.760 --> 01:41:19.000] All right. No, just read them. Once you understand them, once you read them twice,
[01:41:19.720 --> 01:41:24.200] then something will happen. You'll say, wait a minute, wait, no, I know where that's at.
[01:41:24.200 --> 01:41:29.000] And you go in there and you look it up. And about the third time you've looked it up, you'll remember
[01:41:29.000 --> 01:41:36.600] it. All right. So don't try to memorize it. Just read through it. Okay. The main thing you want to do
[01:41:37.320 --> 01:41:45.000] is get a feel for how all of these laws stitched together because they all work together really
[01:41:45.000 --> 01:41:51.560] well. For the most part, have never read the penal code. So they don't understand.
[01:41:51.560 --> 01:41:57.480] You'll know it better than they do. That's when they're not going to want to pull you over anymore.
[01:41:58.520 --> 01:42:01.640] Okay. Okay. So read it. Call us back next week.
[01:42:02.760 --> 01:42:07.480] All right. I'll get to talk to you. You have your saw Monday, right?
[01:42:09.480 --> 01:42:15.800] Eddie does. I don't do a show on Monday. Okay. All right. Thank you.
[01:42:15.800 --> 01:42:21.400] Okay. Thank you, John. Okay. Now we're going to Boris in Texas. Hello, Boris.
[01:42:23.240 --> 01:42:27.320] How you doing? Hold on. Oh, there you are. Doing good. What do you have for us today?
[01:42:28.440 --> 01:42:34.440] Well, okay. I just wanted to kind of go over to things I'm working on for the upcoming week.
[01:42:35.480 --> 01:42:42.520] But I spent up until Wednesday sending a, or suing out and sending
[01:42:42.520 --> 01:42:49.000] a complaint to the Secretary of State in regards to the notary thing, you know, about the list
[01:42:49.000 --> 01:42:56.200] attendance and the notary being also the petitioner of the... Okay. Okay. Remember,
[01:42:56.200 --> 01:43:03.240] we're on a radio show and I may remember this, but listeners don't. So kind of give us a brief
[01:43:03.240 --> 01:43:10.840] synopsis so they know how to orient themselves to your situation. Yeah. I just jumped right in.
[01:43:10.840 --> 01:43:17.080] Okay. What the problem is here is that I've been trying to pay off a debt where
[01:43:19.560 --> 01:43:25.320] the guy that I owed money to had gone through a divorce. And now I'm having to kind of chase
[01:43:25.320 --> 01:43:32.200] around his ex-wife and him and get the signatures, you know, and get it paid off. And the problem
[01:43:32.200 --> 01:43:40.600] is, is that no one will agree with anything. And so then... Okay. Okay. Hold on. This is where he
[01:43:40.600 --> 01:43:49.800] bought a house from a married couple, but only the husband's name was on the title. So only the
[01:43:49.800 --> 01:43:54.440] husband signed it, but they're both married. They're married at the time. So only the husband
[01:43:54.440 --> 01:44:04.120] had decided. And then after he started... Nutritious food is real body armor. It builds muscle, burns
[01:44:04.120 --> 01:44:09.800] fat, improves digestion, and feeds the entire body the nutrients it needs. Did you know the U.S.
[01:44:09.800 --> 01:44:14.440] government banned the hemp plant from growing in the United States and classified it as a schedule
[01:44:14.440 --> 01:44:19.240] one drug to hide it behind the marijuana plant? People have been confused about this plan for
[01:44:19.240 --> 01:44:25.320] over 80 years, and many still don't know what hemp is. So now you know hemp is not marijuana,
[01:44:25.320 --> 01:44:31.320] and marijuana is not hemp. They are different varieties of the same species. HempUSA.org wants
[01:44:31.320 --> 01:44:36.120] the world to know these basic facts and to help people understand that hemp protein powder is

[01:46:26.120 --> 01:46:32.920] Okay, we are back. Randy Kelton of Legal101 Radio and he bought the property and was paying on it.
[01:46:32.920 --> 01:46:40.200] Then the couple gets a divorce and the wife, all of a sudden the husband is hiding the
[01:46:40.920 --> 01:46:49.320] revenue from the wife. The wife finds out about it and the wife's lawyer files a less pendants
[01:46:49.320 --> 01:46:59.320] and Boris is on Boris's property. But he's up to date on his payments. But she's upset because
[01:46:59.320 --> 01:47:05.960] she's not getting the money from the husband. But it's not Boris's problem. He's paying his mortgage.
[01:47:05.960 --> 01:47:17.640] So the lawyer by filing the less pendants has harmed Boris by interfering with the sale that
[01:47:17.640 --> 01:47:23.880] he's trying to make on the property. That's kind of where we're at. Is that substantially it? Did
[01:47:23.880 --> 01:47:30.360] I miss anything, Boris? Yeah, that's pretty much it. However, when he filed for divorce,
[01:47:30.360 --> 01:47:34.360] he told me just not to pay anymore because he didn't want half of the money going to her.
[01:47:37.320 --> 01:47:42.760] But, you know, I haven't paid on it in two and a half years, however.
[01:47:42.760 --> 01:47:49.640] Have you received a notice of default? No, no, he's never sent anything like that. He's never
[01:47:49.640 --> 01:47:55.080] tried to... Okay, well, no. The reason I asked that is you're in honor with the contractor.
[01:47:56.360 --> 01:47:59.960] Yes, that's right. You're not in default. You're not in dishonor.
[01:48:01.000 --> 01:48:09.160] That's right. That's right. Yeah, I've never received any kind of default or any kind
[01:48:09.160 --> 01:48:15.560] of notice or anything. In fact, I would love to get a bill because that would have to include
[01:48:15.560 --> 01:48:23.960] who's going to take the money. Yeah, so then, with this less pendants also then,
[01:48:24.760 --> 01:48:33.240] as you mentioned there, the ex-wife who's a petitioner in the lawsuit that that
[01:48:33.240 --> 01:48:39.800] spends out of, when they filled out the list of pendants, she went ahead and notarized it.
[01:48:41.080 --> 01:48:47.160] That's what we were talking about last time, is how she is the petitioner,
[01:48:47.160 --> 01:48:55.800] and then she is also the notary, which is bad. Then, I have filled out a complaint to the
[01:48:55.800 --> 01:49:01.640] Secretary of State, which requires to be notarized. I hope they take it seriously. It was a little
[01:49:01.640 --> 01:49:08.680] more sensitive. The Secretary of State tends to take these things pretty serious.
[01:49:09.720 --> 01:49:19.480] Okay, well, good. That's good. We had one in Colorado where I was amazed at how heavy the
[01:49:19.480 --> 01:49:31.720] Colorado Secretary of State landed on this notary. She really lambasted her. In those areas, there's
[01:49:31.720 --> 01:49:37.160] not a lot of money moving around here or so. It's not like the banks and the judges were the
[01:49:37.880 --> 01:49:45.400] banks buy off the judges. Most of these professional agencies are real good about policing their
[01:49:45.400 --> 01:49:50.840] members, unlike the bar and the judicial conduct commission, so they do good.
[01:49:52.280 --> 01:50:02.280] Okay, all right. Well, great. Well, it has the theme of the fraudulent interference with the
[01:50:03.240 --> 01:50:14.120] contract. Then, next up is a bar grievance for the attorney who you were pointing out the last
[01:50:14.120 --> 01:50:24.440] time that she's acting as kind of the agent who actually filed it. That's what we were working
[01:50:24.440 --> 01:50:31.160] on. I figured if I'm going to send a bar grievance, because with the bar grievance, they encourage you
[01:50:31.160 --> 01:50:37.720] to send supporting documents. I thought maybe I would go ahead and just include a full copy of
[01:50:37.720 --> 01:50:46.920] the Secretary of State complaint, which is also against her own assistant. Now, what I was going
[01:50:46.920 --> 01:50:57.480] to ask you though is, when the bar notifies the attorney, do they send along the whole package
[01:50:58.840 --> 01:51:05.320] with a copy of the documents that I have sent, or do they just send a letter telling them?
[01:51:05.320 --> 01:51:12.280] No, no, they send everything. They're going to ask this lawyer to respond.
[01:51:14.040 --> 01:51:19.560] Okay. This is the kind of things the bar will tend to take serious.
[01:51:21.240 --> 01:51:26.680] Okay. They're good chance they will sting this lawyer good.
[01:51:27.960 --> 01:51:33.640] Okay. Well, good. Then, I'll just put in a full copy of that complaint. I worked a long
[01:51:33.640 --> 01:51:38.040] time on that complaint. I thought I could get a little more use out of it. If I could send it in
[01:51:38.040 --> 01:51:44.440] with a bar grievance too, because it fits the bar grievance, it pertains. I mean,
[01:51:45.800 --> 01:51:55.720] they both pertain to the same incident along the April timeline there. How you talk about how
[01:51:55.720 --> 01:52:04.920] in a timeline, one event can spawn off complaints and any number of different things.
[01:52:07.080 --> 01:52:15.080] Yeah. Timeline is extremely valuable. You'll be surprised what you find. I do audits,
[01:52:16.200 --> 01:52:23.480] and I audit from a statutory perspective. What are these officials supposed to do
[01:52:23.480 --> 01:52:28.440] and what did they actually do, and what crimes did they commit in the process?
[01:52:29.160 --> 01:52:35.240] Scott Richardson, one of the earlier callers, been working on that with him, and he is really
[01:52:35.240 --> 01:52:45.800] getting it. He wrote an amended pleading based on a traffic stop and prosecution,
[01:52:45.800 --> 01:52:52.040] and he starts out, the officer stopped him under the authority, the text transportation code,
[01:52:52.040 --> 01:52:57.720] but there's no evidence he has that authority. Therefore, he violated this law, and then he
[01:52:57.720 --> 01:53:02.520] did this, and he violated this law, and he did this, and he violated this law. Just one after
[01:53:02.520 --> 01:53:06.680] the other, after the other, after the other. You'd be amazed how many you find.
[01:53:07.960 --> 01:53:14.200] Yeah. Yeah. So when the judge reads it, it's not like he said he did this one thing wrong.
[01:53:14.200 --> 01:53:23.480] He's saying he did everything wrong. It is complaint after complaint after complaint.
[01:53:23.480 --> 01:53:32.360] You know, the judge has only got so many nos in him. At the end of the day, he's a human being,
[01:53:33.640 --> 01:53:39.400] and even if he's been bought and paid for, and these are public officials, he don't want to
[01:53:39.400 --> 01:53:47.000] prosecute him. Then the judge says no to you, and no, and no, and no, and no, and no, and
[01:53:47.800 --> 01:53:57.880] they get to feeling bad. It's in our genes. I have two little, well, my wife has two little
[01:53:57.880 --> 01:54:06.520] shitsu dogs, and I'd heard about an experiment they did with monkeys where they would give them
[01:54:06.520 --> 01:54:16.200] different foodstuffs and how the monkeys, they were giving one crackers, they're giving both
[01:54:16.200 --> 01:54:23.880] crackers, and then they gave one crackers and the other one grapes. And the third day, the one they
[01:54:23.880 --> 01:54:29.240] were giving grapes refused to take the grapes until they gave one to the other monkey.
[01:54:29.240 --> 01:54:37.880] It's in our genes. I did that to my dogs. I gave, we give them carrots as treats,
[01:54:37.880 --> 01:54:46.280] and I gave one a carrot and the other a grape. Third day, the dog wouldn't take the grape
[01:54:47.560 --> 01:54:57.240] until I gave one to the other dog. Fairness is in our genes. So that judge, even though he's been
[01:54:57.240 --> 01:55:03.400] bought and paid for, he rules against you, rules against you, rules against you. You got so many
[01:55:03.400 --> 01:55:16.280] in there. Sooner or later, he's going to throw you a bone. Right. But anyway, when you, you sting
[01:55:16.280 --> 01:55:23.160] this lawyer, he's going to tell this woman, you need to do something. This guy's going to put me
[01:55:23.160 --> 01:55:34.040] out of business. He just cost me more than your salary. Yeah. Yeah. Well, I want to get the civil
[01:55:34.040 --> 01:55:43.640] side of this moving along as well as the criminal side. So I'm kind of learning about how to pursue
[01:55:43.640 --> 01:55:53.880] both of them. On the cause of action, interference, cause of action there, what I'm finding that
[01:55:53.880 --> 01:56:00.120] comes up most and seems to fit pretty well is interference with an existing contract.
[01:56:00.680 --> 01:56:08.600] And I noticed that you were, you called it interference with a private contract.
[01:56:08.600 --> 01:56:16.680] Oh, it is the same thing. It's not a public, you're not dealing with public officials.
[01:56:16.680 --> 01:56:23.720] These are two private individuals, the seller and the buyer. That's a private contract between
[01:56:23.720 --> 01:56:31.240] the two of you. Yeah. It's not existing yet. Well, you do have a sales agreement. So yeah,
[01:56:31.240 --> 01:56:41.240] you have an existing contract. Oh, okay. When it's existing, I was thinking of the contract
[01:56:41.240 --> 01:56:47.720] for deed, but there is one of a potential contract, right? That would be on the contract
[01:56:47.720 --> 01:56:55.320] for sale. I mean, the one right now, that's an escrow. Yeah, the contract for sale is the biggie
[01:56:55.320 --> 01:57:05.320] because the other party agreed to pay you this much money. If this less pendants causes you
[01:57:05.320 --> 01:57:11.560] this sale, that amount of money is the benefit of the bargain that you will have lost.
[01:57:13.720 --> 01:57:22.040] Right, right. And if they acted improperly and deliberately improperly, then you ask for punitive,
[01:57:22.040 --> 01:57:33.320] which is triple. Yeah, okay. Well, that kind of leads in, that kind of answers my question in
[01:57:33.320 --> 01:57:41.960] regards to that. Right, so the emphasis is on the contract that has it in escrow right now,
[01:57:41.960 --> 01:57:49.480] not on the contract for deed. Because when I was looking at the stuff I saw in the case
[01:57:49.480 --> 01:57:56.840] ball, they were saying really in order to win a case like this, the third party that interferes
[01:57:56.840 --> 01:58:03.080] has to be truly a third party and not someone who was kind of involved. And I thought, well,
[01:58:03.080 --> 01:58:10.600] if it's the contract for deed, she's got to say that she is not a third party, but she is the
[01:58:10.600 --> 01:58:21.560] deceased partner along the way. But if it's the salesman now. Okay, okay, this is how it works
[01:58:21.560 --> 01:58:32.520] in Texas in mortgage. You are the owner of the property. The seller has a claim against the
[01:58:32.520 --> 01:58:42.920] property. But you own it. Yeah, under Texas business and commerce code 21, I think it is.
[01:58:44.360 --> 01:58:48.440] A seller or mortgage or mortgage or
