[01:07.240 --> 01:11.280]  The murder was first reported as a robbery as per the testimony of Seth's father, but
[01:11.280 --> 01:15.080]  when no items were noticeably taken, the story then morphed into the death being a result
[01:15.080 --> 01:18.720]  of a confrontation with a yet to be identified assailant.
[01:18.720 --> 01:22.680]  It was suspected by many researchers and talk show radio hosts that Seth Rich must have
[01:22.680 --> 01:27.880]  something to do with the DNC email leaks of last year to add fuel to the fire of suspicion.
[01:27.880 --> 01:32.560]  Less than a month after Rich's death, WikiLeaks offered $20,000 for information on the murder,
[01:32.560 --> 01:37.520]  along with later in September, a GOP lobbyist offering up to $100,000 for information on
[01:37.520 --> 01:38.520]  the murder.
[01:38.520 --> 01:42.760]  Well, as of this week, Seth's case seems to have hit the chatterwaves again when on Monday,
[01:42.760 --> 01:47.800]  Washington D.C.'s Fox 5 reported that Rod Wheeler, a former D.C. homicide detective
[01:47.800 --> 01:51.800]  who was a private investigator on the case, believed Rich had communicated with WikiLeaks
[01:51.800 --> 01:53.080]  before his death.
[01:53.080 --> 01:58.400]  Rod Wheeler did state that he was misquoted when interviewed by CNN on Tuesday, while
[01:58.400 --> 02:02.760]  Fox News on the same day put an anonymous federal investigator who said that the FBI
[02:02.760 --> 02:07.480]  investigation found that Rich had been in contact with Gavin McFadden, whom Fox identified
[02:07.480 --> 02:14.800]  as the director of WikiLeaks.
[02:14.800 --> 02:18.720]  Private Chelsea Manning, formerly Bradley Manning, tweeted a photo of her feet in tennis shoes
[02:18.720 --> 02:23.200]  with the caption First Steps of Freedom shortly after she was released Wednesday today, having
[02:23.200 --> 02:28.640]  served a fraction of her 35-year sentence on 20 counts, including six espionage act violations

[02:36.240 --> 02:40.640]  The Army stated that Manning will be on special unpaid off-duty status with the option to

[04:52.000 --> 04:58.960]  citations in municipal courts are all pretty consistent, the only thing that changes is
[04:58.960 --> 05:09.040]  what particular site, what particular statute they accuse you of violating.

[06:58.760 --> 07:08.720]  of lawyer and get lawyers pay us to do it, it sounds pretty ambitious, and maybe it is.
[07:08.720 --> 07:15.320]  You stand back and you look at law in total, you go into the legal library and you look
[07:15.320 --> 07:21.040]  around, they have books on shelves all over the place, just books on top of books on top
[07:21.040 --> 07:29.440]  of books, and you think this is absolutely overwhelming, well that's deceptive, anyone
[07:29.440 --> 07:42.200]  out there ever played 20 questions, with 20 questions, you can get to just about anything,
[07:42.200 --> 07:50.080]  ask one question, the first question you ask will break all of the possibilities on the
[07:50.080 --> 07:59.920]  planet in half, the second question will do that again, and very quickly you begin to
[07:59.920 --> 08:08.520]  break down all the possibilities to some relatively focused areas, and that's basically the idea
[08:08.520 --> 08:15.560]  of what we're doing with this questionnaire, we're starting out with a set of documents
[08:15.560 --> 08:24.080]  that should be filed in every case, so we want to start out assuming that we get the
[08:24.080 --> 08:31.680]  client immediately as soon as something happens, most of the time that's not going to be the
[08:31.680 --> 08:37.720]  case, but for us to build the tool, we need to get people early on, because the first
[08:37.720 --> 08:44.040]  thing we want everybody to do is file those basic documents that should be filed in every
[08:44.040 --> 08:53.040]  case, a Brady motion for discovery, a speedy trial motion, a special appearance here in
[08:53.040 --> 09:01.080]  Texas, if there's any possibility that the jurisdiction will not have to, in personum
[09:01.080 --> 09:06.160]  or personal jurisdiction over you, the very first thing you have to do in the court is
[09:06.160 --> 09:14.320]  file a special appearance, if you filed anything else including a subject matter jurisdiction,
[09:14.320 --> 09:19.640]  and surprisingly this came from Craig and I'm surprised that he was actually correct
[09:19.640 --> 09:26.080]  on this, I thought you could file a challenge subject matter jurisdiction and not waive
[09:26.080 --> 09:35.680]  anything, but apparently in Texas they written it so that first thing is a special appearance,
[09:35.680 --> 09:42.880]  a special appearance for the purpose of challenging in personum jurisdiction, now you're going
[09:42.880 --> 09:50.560]  to file that, they're going to deny it, you don't care, you've got it on the record, filing
[09:50.560 --> 09:57.520]  a, the primary documents in the case is all about setting the record for appeal, so first
[09:57.520 --> 10:06.280]  is a special appearance, we filed two or three information requests, we filed discovery and
[10:06.280 --> 10:16.240]  information request and the reason we do this here is in Texas, if you are engaged in a
[10:16.240 --> 10:23.920]  criminal or civil action where you have the right to discovery, the courts want the judge
[10:23.920 --> 10:32.240]  to control discovery, so they say once you enter a case and you have discovery available
[10:32.240 --> 10:37.920]  you no longer have access to the open records act, for the purposes of information relating
[10:37.920 --> 10:45.880]  to this case, and what they're doing in classy misdemeanors is the judges are saying you
[10:45.880 --> 10:53.440]  don't have a right to discovery in a classy misdemeanor, so okay, if I had a right to
[10:53.440 --> 11:00.520]  discovery then I wouldn't have access to the open records act, so I filed discovery and
[11:00.520 --> 11:06.960]  also filed an open records act request for the same things, so if they deny it, then
[11:06.960 --> 11:12.720]  I may discovery no problem, we already got the open records request in, if I don't have
[11:12.720 --> 11:20.960]  one I absolutely have the other, so we stick them however they go, okay, so the first thing
[11:20.960 --> 11:28.760]  we filed is a special appearance in a subject matter jurisdiction challenge, Brady motion
[11:28.760 --> 11:36.160]  for discovering this, very specific things we're discovering, first thing we want to
[11:36.160 --> 11:42.880]  do is go to jurisdiction, we don't want to talk about what happened, at this point we're
[11:42.880 --> 11:48.600]  not even interested in what happened, that matter, what we're interested in is whether
[11:48.600 --> 11:58.680]  or not the officer who made the stop had the legal capacity to make the stop under the
[11:58.680 --> 12:09.680]  Texas transportation code, and if he is a municipal officer, I'll take about 500,000
[12:09.680 --> 12:16.240]  to one, calculate how many officers who got in Texas, probably at least 100,000, I'll
[12:16.240 --> 12:24.160]  take 100,000 to one, but he does not have jurisdiction to enforce if he is a municipal
[12:24.160 --> 12:36.560]  officer, municipal officers in Texas, you can have one in each municipality, and the
[12:36.560 --> 12:49.880]  municipalities that appear to have the capacity to have one are San Antonio, Austin, Dallas,
[12:49.880 --> 12:59.640]  Fort Worth, Houston, that's it, and we have a listing of all of the officers authorized
[12:59.640 --> 13:07.400]  to enforce transportation code that are not DPS officers, and we got 27 for the whole
[13:07.400 --> 13:12.880]  state of Texas, the odds are pretty good, if the officer wrote your ticket, he does
[13:12.880 --> 13:20.560]  not have legal standing or legal capacity to write that citation, so the next thing
[13:20.560 --> 13:29.320]  we file is a counter complaint, and the counter complaint is in the form of a criminal complaint
[13:29.320 --> 13:36.760]  in that we counter claim against the officer for first and foremost, the aggravated assault.
[13:36.760 --> 13:40.400]  Because he committed official oppression by stopping you when you didn't have authority,
[13:40.400 --> 13:47.400]  he was at the time impersonating a public official, and at the time of impersonating
[13:47.400 --> 13:51.960]  a public official, he was prominent in displaying a deadly weapon, first to be filing the aggravated
[13:51.960 --> 14:02.200]  assault 2202 B2A, get on the code, let the officer try to dance off ahead of that pin.
[14:02.200 --> 14:09.360]  Now we don't want the officer indicted, that's why we charge the highest level we could, but
[14:09.360 --> 14:16.440]  we want the officer to have plausible deniability because along with the counter complaint,
[14:16.440 --> 14:26.240]  we will prepare a Texas Commission on Law Enforcement complaint, T-CLOS, and that's a professional
[14:26.240 --> 14:32.200]  complaint against his professional license, that'll hurt him a lot more than the criminal
[14:32.200 --> 14:39.680]  complaint, then there's a number of other motions that we put together, we've got a
[14:39.680 --> 14:44.680]  Mother Hubbard motion, and that's a Mother Hubbard, the Mother Hubbard motion gives notice
[14:44.680 --> 14:48.800]  to the court that you don't waive any rights unless the rights are waived in court after
[14:48.800 --> 14:57.000]  full disclosure, free of coercion and in writing, and there's two or three more.
[14:57.000 --> 15:03.040]  This gets everything set up on the front end.
[15:03.040 --> 15:07.520]  That part we've got pretty well put together, and that's simple enough.
[15:07.520 --> 15:14.520]  Now we file all these documents, the information requests are going to have a 15 day time limit,
[15:14.520 --> 15:21.200]  and within 15 days you should have received a response, so when we start getting responses,
[15:21.200 --> 15:25.080]  we've got enough information requests that we pretty well know the song and dance and
[15:25.080 --> 15:30.800]  salsa down your pants that they try to pull, so we know most of the tricks and traps already,
[15:30.800 --> 15:40.360]  and we will ask them, the system will send them a notice when the 15 day time limit is
[15:40.360 --> 15:47.480]  up, or it will give them a link they can check if they receive a response, and then we'll
[15:47.480 --> 15:54.480]  ask some questions about the response that they received, and these particular responses
[15:54.480 --> 16:04.840]  they cannot answer, so the questions will go, did the jurisdiction provide you with a copy
[16:04.840 --> 16:11.400]  of the memorandum of understanding between the municipality and the Department of Public
[16:11.400 --> 16:16.320]  Safety, none of them are going to have it, they're going to say no, the system spits
[16:16.320 --> 16:22.840]  out a criminal complaint, or did they see, did the response say we have no records responsive
[16:22.840 --> 16:30.480]  to your request, if it did, now you do a happy dance, because now we've got them under collateral
[16:30.480 --> 16:34.880]  estoppel, we're about to go to break, so I'll explain collateral estoppel when I come back

[19:24.280 --> 19:35.080]  about collateral estoppel, the way the enforcement of the Texas Transportation Code is set up
[19:35.080 --> 19:37.760]  in Texas.
[19:37.760 --> 19:42.480]  No municipal officers other than one can enforce it.
[19:42.480 --> 19:49.680]  Well, that was a problem for these municipalities because they had all this stuff they wanted
[19:49.680 --> 19:58.800]  to do and they needed money to do it, but they couldn't get the public to agree to their
[19:58.800 --> 20:02.160]  request for higher taxation.
[20:02.160 --> 20:08.360]  So they found that if they enforce the transportation code they could collect all these tickets.
[20:08.360 --> 20:13.120]  Last year they collected on the order of a billion dollars.
[20:13.120 --> 20:17.240]  Problem is they don't have authority to enforce this ticket, to enforce the transportation
[20:17.240 --> 20:25.160]  code, but it worked out so well for everybody and you and I and the rest of us didn't figure
[20:25.160 --> 20:29.000]  out that what they were doing was a scam.
[20:29.000 --> 20:35.200]  So these municipalities have been collecting a lot of money for a long time to the point
[20:35.200 --> 20:41.160]  that they think that what they're doing is actually legal.
[20:41.160 --> 20:47.680]  So when we start asking very pointed specific questions they don't know how to answer them
[20:47.680 --> 20:52.800]  because they just always assume they have this authority.
[20:52.800 --> 21:00.280]  So when we send these information requests out and ask for their authority under Texas
[21:00.280 --> 21:12.120]  Administrative Code 4.134, 4.14 and Texas Transportation Code 644.101, they start looking
[21:12.120 --> 21:17.000]  at the requirements and it becomes a holy mackerel moment.
[21:17.000 --> 21:20.160]  We don't have any of this stuff.
[21:20.160 --> 21:27.960]  So they assume that they're enforcing something else and this is exactly what I'm getting
[21:27.960 --> 21:29.560]  back from these lawyers.
[21:29.560 --> 21:36.320]  They're saying we have no responsive, no records responsive to your request because we do not
[21:36.320 --> 21:38.840]  enforce the Texas Transportation Code.
[21:38.840 --> 21:47.120]  Well, we just had a case recently where they sent a response back to that effect and you
[21:47.120 --> 21:51.880]  look at the complaint and it accuses a very specifically of violating a provision of Texas
[21:51.880 --> 21:52.880]  Transportation Code.
[21:52.880 --> 21:56.440]  How does that work, Bubba?
[21:56.440 --> 21:59.960]  So that goes to collateral estoppel.
[21:59.960 --> 22:09.240]  You can't come into a court or you can't take a legal position and the information request
[22:09.240 --> 22:14.560]  takes a legal position and the position they take is that they have no records responsive
[22:14.560 --> 22:18.320]  to our request as they do not enforce the Education Code.
[22:18.320 --> 22:25.720]  They cannot subsequently come back and attempt to prosecute you for violating the Texas Transportation
[22:25.720 --> 22:32.080]  Code even if they have authority to enforce it.
[22:32.080 --> 22:39.120]  As far as you are concerned, since they've taken a position with you that they do not,
[22:39.120 --> 22:44.200]  now they cannot under the doctrine of collateral estoppel.
[22:44.200 --> 22:48.800]  We've had problems with the banks saying, well, I have nothing to do with these mortgages
[22:48.800 --> 22:53.840]  and then on the other hand, they're trying to foreclose on the mortgages that goes to
[22:53.840 --> 22:55.880]  collateral estoppel.
[22:55.880 --> 23:03.200]  So we get these information requests in quickly to try to get that part of the system working
[23:03.200 --> 23:07.160]  and then you have a Brady motion.
[23:07.160 --> 23:15.760]  A 39.14 Texas Code of Criminal Procedure requires that the prosecutor provide all of the information
[23:15.760 --> 23:24.320]  required by the Brady Act by 39.14 30 days before trial.
[23:24.320 --> 23:27.800]  Now they never do that.
[23:27.800 --> 23:32.720]  That was in there when Michael Morton went to jail 20 years ago and he spent 20 years
[23:32.720 --> 23:38.240]  in prison when the prosecutor did not provide this documentation.
[23:38.240 --> 23:45.280]  What should have happened 30 days before trial or 29 days before trial?
[23:45.280 --> 23:49.160]  His lawyer should have filed criminal charges of official oppression against the prosecuting
[23:49.160 --> 23:50.160]  attorney.
[23:50.160 --> 23:54.320]  Nobody does that.
[23:54.320 --> 23:59.320]  They just say, oh my goodness, the dirty Watanscoundrel, he didn't do what he was supposed to do.
[23:59.320 --> 24:05.920]  And they forget the fact that when a public official fails to perform a duty he's required
[24:05.920 --> 24:10.600]  to perform and then the process denies you in the pull-and-free access to your enjoyment
[24:10.600 --> 24:13.360]  or right, that's a class A misdemeanor in the state of Texas.
[24:13.360 --> 24:21.800]  I was just in a municipal court last Thursday or Wednesday and told the bailiff to tell
[24:21.800 --> 24:27.360]  the judge I was going to record the proceedings and the judge said, I'm going to deny that.
[24:27.360 --> 24:29.760]  Oh, you are.
[24:29.760 --> 24:30.760]  Okay.
[24:30.760 --> 24:34.760]  So I said, Mr. Bailiff, when this hearing's over, I'm going to want you to take a criminal
[24:34.760 --> 24:38.040]  complaint against the judge for official oppression.
[24:38.040 --> 24:43.920]  And the bailiff got this confused and looked on his face, turns out it was the first time
[24:43.920 --> 24:49.680]  he was ever acting as a bailiff, and said, okay.
[24:49.680 --> 24:55.560]  And then in the process of the court hearing, the judge chastised me because I was helping
[24:55.560 --> 25:01.640]  someone else there and asked me if I was a lawyer and I told him, no, that I kept my
[25:01.640 --> 25:06.640]  hands in my own pockets and I slept at night and kept my hands in my own pockets.
[25:06.640 --> 25:12.120]  He said, well, if I wasn't a lawyer, I couldn't give legal advice and I said, of course I
[25:12.120 --> 25:13.120]  can't.
[25:13.120 --> 25:20.520]  So what I can't do is represent someone in a personal injury, I can't hold myself out
[25:20.520 --> 25:24.160]  as a lawyer and represent someone in a personal injury or property damage case.
[25:24.160 --> 25:26.880]  Other than that, I can do anything I want to.
[25:26.880 --> 25:35.960]  And then a little later in the hearing, he threatened me that I could be prosecuted.
[25:35.960 --> 25:41.800]  Well I had already quoted 38.123 to him and he should have paid attention.
[25:41.800 --> 25:51.720]  I took that second remark to me since I wasn't there before the bench as a threat.
[25:51.720 --> 25:57.600]  I stood up in the courtroom and I said, Mr. Bailiff, did you hear that?
[25:57.600 --> 26:02.560]  That judge just threatened me.

[27:05.080 --> 27:13.600]  You're going to have a municipal judge sitting here with case after case after case filing
[27:13.600 --> 27:21.720]  criminal charges against them, fines against the officer, criminal charges against the
[27:21.720 --> 27:32.000]  officer, criminal charges and bar grievances against the prosecutor, tort letter, malpractice
[27:32.000 --> 27:40.680]  suit against the prosecutor, civil actions against the municipality.
[27:40.680 --> 27:48.560]  Once we've written this suit up, all you do is click the button and it collects information

[37:46.800 --> 37:54.960]  getting thrown at me that it's collateral estoppel and resjudicator and even if it's new stuff, it's
[37:54.960 --> 38:00.400]  still bothered by that, no matter if it's because it's improperly stable. Anyway, we found out
[38:00.400 --> 38:09.120]  during one of the meetings... Wait a minute. Hold on. Hold on. I'm getting a very bad signal.

[38:30.160 --> 38:38.560]  their motion for eternity and he said, well, it seems that my daughter is babysitting for Mr.
[38:38.560 --> 38:48.000]  McGinnity's young son and McGinnity is the opposing side counsel and my son was blown away.
[38:48.560 --> 38:56.000]  So he told me about it and I said, well, that's not right. So he said no. He said he did not
[38:56.000 --> 39:03.200]  recuse himself. He just said, oh, will you guys figure out yourselves? You've come to an agreement
[39:03.200 --> 39:11.040]  on attorney's fees and then... So I filed a judicial complaint against the judge and I
[39:11.040 --> 39:18.720]  filed a bar complaint against the attorney and the attorney state ball came back and said,
[39:18.720 --> 39:25.200]  well, we're not doing anything because we don't feel the attorney did anything wrong and you
[39:25.200 --> 39:31.680]  haven't proven that the attorney and the judge spoke about your case outside of court. Well,
[39:31.680 --> 39:36.880]  no, I can't prove that. Who can? Are they going to tell me they met on the golf course? I had
[39:36.880 --> 39:43.600]  coffee together and had a little discussion or met when the daughter took the son out or whatever.
[39:44.160 --> 39:51.360]  So I'd like to know if there's a response I can file because what I've read is that if
[39:51.360 --> 39:57.520]  the general public could perceive that there would be some kind of favoritism or thing,
[39:57.520 --> 40:04.880]  then it's wrong and it's a violation of the attorney ethics. And secondly, I did file the judicial
[40:04.880 --> 40:11.520]  one against the judge using all the cannons of judicial conduct that I believe he had violated,
[40:11.520 --> 40:19.680]  including not allowing pro se attorney, pro se people or attorneys who appeared by telephone to
[40:19.680 --> 40:27.840]  get his, you know, what's the word for when they or the tentative agreement? He refuses to allow it
[40:27.840 --> 40:34.480]  if you appeared by phone. And one day I was there, my attorney appeared by phone and the clerk would
[40:34.480 --> 40:41.600]  not allow me to get it because I was represented. And he also treats people in a condescending
[40:41.600 --> 40:47.280]  manner. So that's another violation. They are investigating that because my attorney got a
[40:47.280 --> 40:56.720]  call about it yesterday. But they did say, well, you know, it's okay. The judge probably didn't
[40:56.720 --> 41:03.520]  know because that would be his wife's, you know, area of knowing. And my attorney said,
[41:03.520 --> 41:09.520]  no, I don't think so. The judge should know what his daughter is doing. But they are,
[41:09.520 --> 41:13.440]  they were interested in the fact that he wouldn't give tentatives and he wouldn't post it.
[41:13.440 --> 41:20.640]  So there was still in the process of hearing that. But how do I go back to the state bar and say,
[41:21.280 --> 41:26.240]  you're wrong that the attorney did, he did violate his ethics because he knew he was
[41:26.240 --> 41:32.320]  hiring the judge's daughter that he's litigating in front of. And to me, that's a huge violation.
[41:32.880 --> 41:39.760]  Okay, let me start out by saying, after listening to you talk, I've just fallen in love.
[41:39.760 --> 41:50.160]  You are kicking their beyonds. You are causing them more grief than you know.
[41:51.840 --> 41:56.080]  They are never going to tell you how much grief they're caught. You're causing them with your
[41:56.080 --> 42:00.880]  judicial conduct complaints and your bar grievances. Okay, as to the bar grievance,
[42:00.880 --> 42:09.600]  whatever the commission rules initially, you have the right to appeal.
[42:11.360 --> 42:18.800]  Okay. And then even after that, you can file a judicial, a bar, a
[42:20.080 --> 42:27.120]  malpractice suit against the lawyer. If you look in the cannons,
[42:27.120 --> 42:36.640]  the in this case, you were speaking to the fact that the judge must not allow even the
[42:36.640 --> 42:46.720]  impression of impropriety. And frankly, the fact that his daughter is babysitting for the
[42:46.720 --> 42:54.720]  lawyer's children is not really necessarily a problem because you have to understand
[42:54.720 --> 43:02.480]  these judges and lawyers all know each other. And for them to have no context with each other would
[43:02.480 --> 43:12.480]  be just unreasonable. With that said, who cares? He still should have recused himself.
[43:13.680 --> 43:17.760]  And that would have been a simple enough matter just to have another judge because
[43:17.760 --> 43:24.080]  you got two judges here. This judge, they all know everybody. So he's dealing with this one
[43:24.080 --> 43:28.720]  lawyer and something that's going to cause him a problem. So he recuses himself and this other
[43:28.720 --> 43:33.360]  judge just steps in and picks it up. But then when this one recuses himself, the other one picks
[43:33.360 --> 43:40.560]  it up, that's easy enough to handle. Not something that the judge should allow to become an issue.
[43:40.560 --> 43:45.920]  What they don't like is me running off to cliff at the end of the segment. Hang on,

[47:35.360 --> 47:42.240]  thought of. And I'm in appeal right now because this judge just, you know, rolled against me
[47:42.240 --> 47:49.840]  again, although you will be very pleased to hear that the other attorney that is, you know,
[47:49.840 --> 47:58.720]  the babysitting one, when they won the last round, and we immediately feel they put in
[47:58.720 --> 48:05.200]  for attorney's fees of $112,000. Well, the prior time they've added that to my account without
[48:05.200 --> 48:13.920]  even requesting from the court, and that's another matter, and he filed it 36 days late.
[48:14.800 --> 48:20.080]  So my attorney opposed it and put very good stuff, and he's actually originally from Texas,
[48:20.080 --> 48:26.640]  by the way, my current attorney. He was very good. And they appealed in that they said,
[48:26.640 --> 48:35.200]  well, they have excusable neglect because his mother was sick in December, even though the
[48:35.200 --> 48:40.560]  appeal, the motion should have been filed in November, and my attorney correctly said,
[48:40.560 --> 48:46.880]  I don't see what his mother being sick in November has to do with him miscalendering it
[48:46.880 --> 48:52.720]  in November. And he admits he miscalended, he didn't forget, he just miscalended it,
[48:52.720 --> 48:59.680]  and he decided that his client, the big bang, the multi-billion dollar one, should not be
[48:59.680 --> 49:07.280]  financially harmed because of their counsel's mistake. And so I should not get a windfall
[49:07.280 --> 49:14.320]  because of their mistake. But my attorney put in a very good response, and this judge who I filed
[49:14.320 --> 49:20.960]  it, complained against about a month ago, finally ruled in my favor and agreed that
[49:20.960 --> 49:28.240]  they couldn't have their legal beat. Oh, wonderful. This is what happens when you sting them.
[49:29.600 --> 49:36.160]  Yes. He didn't want you to sting him again. Okay, where I was going.
[49:36.160 --> 49:42.400]  Pointedly point out in the hearing, by the way, he did say, oh, and yes, you won the case,
[49:42.400 --> 49:47.360]  and rightfully so, but you filed late. So you had to get it a little big in.
[49:47.360 --> 49:55.760]  Oh, well, that's okay. If he lets me win, he can badmouth me a little bit, and I'll say, okay.
[49:58.080 --> 50:07.280]  You have, you got to know, face is a big deal. It's not supposed to be. But saving face is a big
[50:07.280 --> 50:14.000]  deal. You know, I keep saying you'll never win your case simply because you have the law and the
[50:14.000 --> 50:23.360]  facts on your side. To think so is naive. It is not that way now. It never has been that way since
[50:23.360 --> 50:33.120]  we have had human beings acting as judges. Now, I don't know if God created man, but if he did,
[50:33.120 --> 50:46.160]  he created us horribly flawed. We have all these weaknesses and these petty notions. Maybe they
[50:46.160 --> 50:55.440]  shouldn't exist in law. And in a perfect world, they probably wouldn't. But then, if this were a
[50:55.440 --> 51:06.000]  perfect world, that's a good chance I wouldn't be in it. So we deal with how it really works.
[51:06.000 --> 51:12.640]  And this is what primarily the show is about. We talk about law, but the real important thing
[51:12.640 --> 51:19.920]  is how it really works. And you filed a judicial conduct complaint against the judge. He is going
[51:19.920 --> 51:27.360]  to be real unhappy with you. And the first thing people think, well, they'll come back and make
[51:27.360 --> 51:37.600]  it hard for me. You got to expect the judge is going to rule against you out of hand at every
[51:37.600 --> 51:44.240]  turn without regard to the right of things or the rule of law. Now, maybe he won't do that.
[51:44.240 --> 51:52.960]  But you have to conduct yourself as if he will. And I can tell you from long experience,
[51:53.840 --> 52:02.560]  it makes no difference if that judge likes you or not. I have a judge here in Wise County,
[52:04.560 --> 52:11.520]  the district judge. Now, my daughter, she's really into local politics and stuff. She married into
[52:11.520 --> 52:21.600]  a relatively well-connected family, and her father is an embarrassment. I may be the first
[52:21.600 --> 52:28.400]  father that was ever an embarrassment to the daughter. Well, she tells me that the county judge
[52:28.400 --> 52:39.840]  doesn't like me, but he respects me. The county attorney, he likes me okay. The district attorney,
[52:39.840 --> 52:51.840]  we're good friends. The district judge hates me. Oh, gee, willikers. I only file one crummy little
[52:51.840 --> 52:58.400]  complaint against him with the attorney general for making a terroristic threat when he ordered me
[52:58.400 --> 53:03.840]  out of the courtroom or I'd be arrested. Oh, and then there was that first degree felony
[53:03.840 --> 53:11.040]  and aggravated assault charge. I just filed against him with the local grand jury. He is,
[53:12.400 --> 53:21.840]  has let his personal bias get in front of his ability to adjudicate. So I go into court and
[53:21.840 --> 53:32.560]  he will absolutely rule against me no matter what. So I set him up. I set him up to rule against me,
[53:32.560 --> 53:42.160]  and he did. And I hammered him big time. I needed an example. There's a special thing going on in
[53:42.160 --> 53:50.320]  Texas where the Travis County District Attorney, Ron Errol, got the legislature to set him up with

[54:32.400 --> 54:42.880]  cannon fodder. And he knew that I had deliberately set him up to do that so that I could file against
[54:42.880 --> 54:49.680]  him with the Texas Ranger. And the Texas Ranger give it to the district attorney so I could then
[54:49.680 --> 54:54.640]  file against the Texas Ranger and the director of the Department of Public Safety. And that's
[54:54.640 --> 55:01.040]  exactly what I did. Accused them of shielding this judge from prosecution. In a first degree felony
[55:01.040 --> 55:07.360]  case. And I filed it with the grand jury. And everybody was hopping up and down and they were
[55:07.920 --> 55:15.600]  furious at this judge, forgetting them in that position. And he knew from the start I set him
[55:15.600 --> 55:25.680]  up. I come into his court now. He won't even look at me. But he has gotten extremely careful.

[01:04:00.000 --> 01:04:05.600]  they dismissed it without leave to amend. I tried to appeal it. They said the appeal was
[01:04:05.600 --> 01:04:16.080]  frivolous and that they believed I was not indigent, so I could not file for a fee waiver.

[01:04:58.000 --> 01:05:04.000]  rescission. And basically, my attorney now said they told you to go buy a kite is what they basically
[01:05:04.000 --> 01:05:11.120]  said in the letter. And then I didn't know about, well, obviously, Jeff Inoski wasn't out then,
[01:05:11.120 --> 01:05:18.720]  I didn't know how to take it further. So then I filed a appeal a rescission based on some advice,
[01:05:18.720 --> 01:05:29.120]  and in the March, they ignored my letter until 30 days later, and they only have 20 days. And
[01:05:29.120 --> 01:05:35.600]  then they said, well, we don't believe it. But they didn't file for declaratory judgment to say
[01:05:35.600 --> 01:05:43.840]  the loan was okay. And then, you know, eventually, I got this new attorney and he took this a little
[01:05:43.840 --> 01:05:49.760]  further, and we're trying to bring in some Hobor and different stuff. And he's written
[01:05:50.720 --> 01:05:55.920]  three amendments. But basically, they're saying I'm 11 years out of date to file the
[01:05:55.920 --> 01:06:02.000]  appeal. But even though they refuse to do the right thing under the appeal and respond in 20
[01:06:02.000 --> 01:06:08.880]  days, they refuse to do the right thing in the state rescission. Okay, here's the deal. You need
[01:06:08.880 --> 01:06:18.240]  to send me an email, and I will send you my who's on first argument. I just filed a
[01:06:19.280 --> 01:06:30.960]  certiori with the US Supreme over a deal, the second circuit out of New York.
[01:06:30.960 --> 01:06:42.320]  What we maintained was that we, okay, the Supreme Court question is,
[01:06:44.480 --> 01:06:53.840]  does the statute of limitations on rescission act as a bar, or does it act as an affirmative
[01:06:53.840 --> 01:07:03.440]  defense? And under rule eight, it very specifically states that statute of limitations is an
[01:07:03.440 --> 01:07:13.280]  affirmative defense that must be pledged. Okay, so what we're saying is it doesn't matter if it
[01:07:13.280 --> 01:07:24.480]  was out of out of time. You filed the rescission. And under the statute, the respondent had 20 days
[01:07:24.480 --> 01:07:30.000]  to initiate the rescission process, or file an opposition in the court,
[01:07:31.840 --> 01:07:39.280]  alleging the affirmative defense of statute of limitations, they failed to take that action,
[01:07:39.280 --> 01:07:45.680]  therefore they're subject to latches. They had a right, they had a right, they sat on it.
[01:07:47.200 --> 01:07:52.960]  They can't come to the court now and complain because they didn't raise opposition when they
[01:07:52.960 --> 01:07:59.840]  had an opportunity. Yes, and it wouldn't have cost them very much to file that declaration.

[01:08:41.920 --> 01:08:48.480]  very favorable to the banks. But he still... Have you ever looked at filing a complaint with the
[01:08:48.480 --> 01:08:55.040]  grand jury against these judges? I don't know how to do that. And what grand jury do I file
[01:08:55.920 --> 01:09:02.240]  do that with? Whatever jurisdiction they're setting in, in California, you have the best
[01:09:02.240 --> 01:09:10.400]  grand jury system of any state I've looked at. Your grand jury can investigate into anything
[01:09:10.400 --> 01:09:19.040]  they want to. And here's a problem that the judges have. Federal judges sitting in a federal
[01:09:19.040 --> 01:09:29.040]  courthouse. However, that federal courthouse is not a federal enclave. The federal courthouse has
[01:09:29.040 --> 01:09:35.520]  not been ceded to the federal government. Generally, the only properties ceded to the federal government
[01:09:35.520 --> 01:09:43.280]  are federal prisons. The reason for that is so that the feds can bring in their own guards and
[01:09:43.280 --> 01:09:52.400]  they don't have to use state guards. Everything else belongs to the state. So the federal judges
[01:09:52.400 --> 01:10:01.760]  are leasing that federal courthouse from the state. So if the judge pulls out a pistol and shoots
[01:10:01.760 --> 01:10:10.640]  somebody in the courtroom, he's not prosecuted in the fed. He's prosecuted in the state. That's a
[01:10:10.640 --> 01:10:16.880]  state crime. Now this case, this case I'm in right now is a state case. They tried to remove it to
[01:10:16.880 --> 01:10:21.280]  federal court, but they improperly removed it. And my attorney was successful in getting it
[01:10:21.280 --> 01:10:28.640]  remanded back, but he said federal resjudicata is harder to get round than state resjudicata.
[01:10:32.000 --> 01:10:34.240]  Oh, okay. I thought you were in the federal court. Okay.
[01:10:35.440 --> 01:10:40.800]  It was my, my interstate case was removed to the federal court, and that federal judge,

[01:12:12.400 --> 01:12:20.640]  Well, the problem is nobody does that. So I use it. Federal Judge John McBride,
[01:12:20.640 --> 01:12:32.000]  I filed a quiet title action very carefully crafted to avoid any federal jurisdiction.
[01:12:33.120 --> 01:12:38.880]  Wells Fargo immediately removed it to the Fed and filed a room 12. I filed a challenge
[01:12:38.880 --> 01:12:44.400]  to subject matter jurisdiction. Well, in that didn't file a motion to remand a file subject
[01:12:44.400 --> 01:12:50.640]  matter jurisdiction because of the 2011 Venue and Removal Clarification Act.
[01:12:52.480 --> 01:13:01.440]  That act changed 200 years of law. What it says was that we had two sets of courts
[01:13:02.880 --> 01:13:08.640]  of circuits or one group of circuits were in one way, one group were in the other. One group said
[01:13:08.640 --> 01:13:15.360]  that when a case with state and federal issues is appeal is removed to the federal court,
[01:13:16.400 --> 01:13:22.320]  the court can hear the state and the federal issues under the doctrine of judicial economy.
[01:13:22.960 --> 01:13:28.720]  The other group said, no, we can't. That's an undue preemption of state law and the state
[01:13:28.720 --> 01:13:36.480]  issues must be severed and remanded. So the legislature stepped in in 2011 and said,
[01:13:36.480 --> 01:13:47.520]  the second guys are right. The federal court cannot hear state issues. While a state case
[01:13:47.520 --> 01:13:53.760]  can be removed to the federal court, the federal court must sever and remand the state issues.
[01:13:55.360 --> 01:14:03.520]  Quiet title, strictly a state issue. Filed a quiet title action, they removed it to the federal
[01:14:03.520 --> 01:14:15.920]  court. It became a petition for declaratory judgment. So it fell under 28 USC 2001. I think
[01:14:15.920 --> 01:14:25.920]  that's the right one. It's the declaratory judgment act for the feds. In the quiet title
[01:14:25.920 --> 01:14:33.920]  action, I requested that the court make a determination of the rights of the parties.
[01:14:33.920 --> 01:14:40.880]  Declaratory judgment asked for nothing. They filed a real 12 motion to dismiss for failure
[01:14:40.880 --> 01:14:47.440]  state of claim in which recovery can be had. And in their response, they said the judge
[01:14:47.440 --> 01:14:56.720]  should dismiss the case because Wells Fargo is not the lender. Say what? Not the lender? I'd
[01:14:56.720 --> 01:15:07.760]  read that twice. They were foreclosing. So what do you do? You're non-suit, of course. So I ran
[01:15:07.760 --> 01:15:14.640]  down the court with a non-suit. And it said, oh my goodness, I have made a mistake. Bad, my bad,
[01:15:14.640 --> 01:15:20.080]  my bad. I thought since they were foreclosing that they actually had a claim against the property,
[01:15:20.080 --> 01:15:25.200]  but I must have been mistaken based on their real 12 motion. So I non-suit.
[01:15:26.720 --> 01:15:32.000]  The same day I filed a non-suit, Judge McBride dismissed with prejudice for failure state of
[01:15:32.000 --> 01:15:37.920]  claim on which recovery can be had. Of course, I failed the state of claim. Is it declaratory
[01:15:37.920 --> 01:15:44.400]  judgment suit? There are no claims. So I filed. That's their favorite wording. Failure state of
[01:15:44.400 --> 01:15:49.920]  claim for which relief can be granted. Yes, that's why I did a quiet title. There are no claims.
[01:15:50.720 --> 01:15:59.920]  It was filed to be immune from rule 12. So I went down to the, I made up a complaint,
[01:15:59.920 --> 01:16:06.560]  sent it to the Special Agent in Charge in Dallas against Judge McBride accusing him of violation
[01:16:06.560 --> 01:16:17.440]  18 U.S. Code 242. I got a call from some intake person and asked me what I wanted them to do
[01:16:17.440 --> 01:16:23.760]  with this complaint. I said, I want you to do exactly what the law commands you to do.

[01:21:13.640 --> 01:21:18.680]  And they said they would take 60 to 90 days to respond, so I got to wait that out.
[01:21:18.680 --> 01:21:23.800]  And when I get a response from them that says they have no record responsive to my request,
[01:21:23.800 --> 01:21:28.160]  then I make up a criminal complaint against the SAC.
[01:21:28.160 --> 01:21:33.840]  I maintained that he failed to perform a duty he was required to perform, and in the process
[01:21:33.840 --> 01:21:38.200]  denied me the right to the protection of the law.
[01:21:38.200 --> 01:21:43.240]  So I filed that with the U.S. Attorney.
[01:21:43.240 --> 01:21:50.040]  And the U.S. Attorney is going to sit on it and do nothing.
[01:21:50.040 --> 01:21:56.840]  I'll wait two or three weeks, then I'll file a information request for the U.S. Attorney
[01:21:56.840 --> 01:22:05.760]  for the notice that he sent, I'm sorry, I said the U.S. Attorney General, asking him

[01:22:09.560 --> 01:22:17.480]  Because I don't see anything in 28 U.S.C. 535 that exempts a U.S. Attorney from this requirement.

[01:23:46.720 --> 01:23:50.640]  a hearing deficiency, well Mr. Keldum, that's what's probably in your hearing, so I'll judge
[01:23:50.640 --> 01:23:56.560]  you, I was down in Mexico the other day and I drank too much that cheap tequila and lost
[01:23:56.560 --> 01:24:02.400]  my hearing aid, well I was lying to him, I had it in my pocket, well Mr. Keldum why
[01:24:02.400 --> 01:24:06.720]  are you telling me this, I said well do you have accommodation for the hearing impaired,

[01:36:05.600 --> 01:36:10.360]  The bailiff came back and said, the judge denied that you can't videotape the proceedings.

[01:36:14.720 --> 01:36:16.600]  criminal complaint against the judge.
[01:36:16.600 --> 01:36:23.840]  So when the meeting's over, I go, I'm writing it out while the hearing's going on, I take
[01:36:23.840 --> 01:36:29.040]  it up to the bailiff at the end and I've accused the judge of exerting an important
[01:36:29.040 --> 01:36:35.680]  drug authority he did not expressly have and he said, well, Mr. Kelton, you can't videotape,
[01:36:35.680 --> 01:36:40.720]  you can't record court proceedings, so of course I can.
[01:36:40.720 --> 01:36:48.280]  February the 27th, 2017, Turner v. Driver was ruled in the Fifth Circuit, that's two
[01:36:48.280 --> 01:36:56.600]  months before this, that guy is videotaping the police across, the Fort Worth police across
[01:36:56.600 --> 01:36:58.160]  the street.
[01:36:58.160 --> 01:37:01.520]  They come out, they harass him, tow him in the car for an hour with the windows rolled
[01:37:01.520 --> 01:37:05.840]  up and then decide to let him go, he sues him.
[01:37:05.840 --> 01:37:11.560]  Local court rules against him, granted the police officer's immunity, go to the Fifth
[01:37:11.560 --> 01:37:19.080]  Circuit, the Fifth said, they were going to grant them immunity because the right to videotape
[01:37:19.080 --> 01:37:24.800]  their public officials in the performance of their duty was not clearly defined at the
[01:37:24.800 --> 01:37:29.600]  time, but it is now.
[01:37:29.600 --> 01:37:38.040]  So this is a three month, two month old ruling, I guess it's about three months now, not quite
[01:37:38.040 --> 01:37:44.160]  three month old ruling and nobody knows it's out there yet.

[01:42:27.000 --> 01:42:28.000]  He trusts me.

[01:42:35.000 --> 01:42:38.000]  When a bailiff knocked me down and broke my elbow,

[01:42:40.000 --> 01:42:43.000]  And that's when they figured out that I wasn't vindictive

[01:42:47.000 --> 01:42:50.000]  Yeah, it was a stupid mistake, but I wasn't going to end his career over it.

[01:43:19.000 --> 01:43:24.000]  Caught him with enough to charge him with distribution and they know building.
[01:43:24.000 --> 01:43:29.000]  Lawyer gets his bar card, has a party, drinks two months,
[01:43:29.000 --> 01:43:32.000]  having home gets popped for DUI.
[01:43:32.000 --> 01:43:34.000]  He said, I didn't want to present this guy.
[01:43:34.000 --> 01:43:36.000]  It's going to ruin his career.

[01:48:36.000 --> 01:48:44.000]  And you wait a week or so, and then you call down and ask what they did with it.
[01:48:44.000 --> 01:48:54.000]  And you ask, you want to know when they sent it to the grand jury.
[01:48:54.000 --> 01:49:02.000]  And if they don't tell you, or if you can't get them to respond to you in a week or so,
[01:49:02.000 --> 01:49:08.000]  then you take a criminal complaint against the magistrate to a county judge.
[01:49:08.000 --> 01:49:14.000]  Even if the magistrate has done exactly what he was supposed to do, you don't care.
[01:49:14.000 --> 01:49:17.000]  He will file against him anyway.
[01:49:17.000 --> 01:49:21.000]  And then file a judicial conduct complaint against him.
[01:49:21.000 --> 01:49:29.000]  If he has done what he's supposed to do, no problem, no harm, no foul.
[01:49:29.000 --> 01:49:37.000]  Filing criminal charges against someone doesn't harm anybody, even the accused.
[01:49:37.000 --> 01:49:39.000]  Because all you do is make the claim.
[01:49:39.000 --> 01:49:46.000]  You make it based on your, you have reason to believe and do believe.
[01:49:46.000 --> 01:49:48.000]  That's all you need.
[01:49:48.000 --> 01:49:54.000]  If you come to me and say, I saw my next door neighbor shoot somebody yesterday.
[01:49:54.000 --> 01:49:58.000]  I said, well, you ought to go tell the police. Oh, I can't. He knows who I am.
[01:49:58.000 --> 01:50:00.000]  And he'll come back and shoot me.
[01:50:00.000 --> 01:50:07.000]  Well, if I believe you, then I can go to the police and say, my next door neighbor saw this guy kill somebody.
[01:50:07.000 --> 01:50:10.000]  I want to file a criminal charge against him.
[01:50:10.000 --> 01:50:12.000]  And I can do that.
[01:50:12.000 --> 01:50:17.000]  And when I file that criminal charge, I am absolutely protected.
[01:50:17.000 --> 01:50:20.000]  I cannot be sued, period.
[01:50:20.000 --> 01:50:24.000]  I have the same protection as a judge has.
[01:50:24.000 --> 01:50:27.000]  So you become that protected class.
[01:50:27.000 --> 01:50:34.000]  Now, what you want to happen is, is as you're walking up the chain,
[01:50:34.000 --> 01:50:40.000]  you want one of these people to warn you, give you fair warning.
[01:50:40.000 --> 01:50:42.000]  Oh, you got to be careful.
[01:50:42.000 --> 01:50:47.000]  You know, you can get in a lot of trouble this way.
[01:50:47.000 --> 01:50:51.000]  Then you want to take the highest judge that you filed a complaint against.
[01:50:51.000 --> 01:50:54.000]  Now, I'd like to get to the district judge.
[01:50:54.000 --> 01:50:57.000]  I filed with the county judge and I told him to see me.
[01:50:57.000 --> 01:51:00.000]  Then I filed with the district judge.
[01:51:00.000 --> 01:51:06.000]  And when I raise a question about what the district judge does, then I go down there.
[01:51:06.000 --> 01:51:12.000]  The higher levels you get to, the more careful these judges are.
[01:51:12.000 --> 01:51:21.000]  If I can get that judge or someone in the courthouse to give me fair warning that I can get in trouble doing this,
[01:51:21.000 --> 01:51:24.000]  I can get a prosecutor.
[01:51:24.000 --> 01:51:31.000]  We did felony retaliation, witness tampering.
[01:51:31.000 --> 01:51:35.000]  I called 911, asked them to come out and arrest it.
[01:51:35.000 --> 01:51:44.000]  You haven't lived until you've called 911 on a police officer or a public official.

[01:55:03.000 --> 01:55:09.000]  The police and lower courts are terrified of these high-level judges.
[01:55:09.000 --> 01:55:14.000]  So you want to get a complaint against a high-level judge, and if anybody gives you any garbage at all,
[01:55:14.000 --> 01:55:23.000]  then you file a criminal charge against the district judge accusing him of sending that guy out to threaten you.
[01:55:23.000 --> 01:55:28.000]  And the judge is absolutely innocent.
[01:55:28.000 --> 01:55:31.000]  He can't say anything to you because you're protected.
[01:55:31.000 --> 01:55:34.000]  That would be felony retaliation.
