[00:13.400 --> 00:21.200] into the tides of the alternative.
[00:21.200 --> 00:27.160] Markets for Wednesday, the 17th of May, 2017, are currently trading with gold at $1,260.87
[00:27.160 --> 00:33.960] an ounce, silver at $16.88 an ounce, Texas crude at $48.66 a barrel, and Bitcoin is sitting
[00:33.960 --> 00:43.120] a little over $1,800 at $1,808 U.S. currency.
[00:43.120 --> 00:48.440] Today in history, the year 1809, Napoleon I of France orders the annexation of the Papal
[00:48.440 --> 00:55.280] States to the French Empire, today in history.
[00:55.280 --> 00:59.940] In recent news, 27-year-old DNC staffer Seth Rich, who was mysteriously shot to death while
[00:59.940 --> 01:04.900] walking home from a bar in the early hours in July of 2016, caused a plethora of conspiracy
[01:04.900 --> 01:07.060] theories when this incident occurred.
[01:07.060 --> 01:11.080] The murder was first reported as a robbery, as per the testimony of Seth's father, but
[01:11.080 --> 01:14.920] when no items were noticeably taken, the story then morphed into the death, being a result
[01:14.920 --> 01:18.540] of a confrontation with a yet-to-be-identified assailant.
[01:18.540 --> 01:22.560] It was suspected by many researchers and talk show radio hosts that Seth Rich must have
[01:22.560 --> 01:27.800] had something to do with the DNC email leaks of last year to add fuel to the fire of suspicion.
[01:27.800 --> 01:32.520] Less than a month after Rich's death, WikiLeaks offered 20,000 for information on the murder,
[01:32.520 --> 01:37.440] along with later in September a GOP lobbyist offering up to 100,000 for information on
[01:37.440 --> 01:38.440] the murder.
[01:38.440 --> 01:42.600] Well, as of this week, Seth's case seems to have hit the chatterwaves again when on Monday,
[01:42.600 --> 01:47.720] Washington, D.C.'s Fox 5 reported that Rod Wheeler, a former D.C. homicide detective
[01:47.720 --> 01:51.720] who was a private investigator on the case, believed Rich had communicated with WikiLeaks
[01:51.720 --> 01:52.880] before his death.
[01:52.880 --> 01:58.240] Rod Wheeler did state that he was misquoted when interviewed by CNN on Tuesday, while
[01:58.240 --> 02:02.680] Fox News on the same day quoted an anonymous federal investigator who said that the FBI
[02:02.680 --> 02:07.320] investigation found that Rich had been in contact with Gavin McFadyen, whom Fox identified
[02:07.320 --> 02:14.680] as the director of WikiLeaks.
[02:14.680 --> 02:18.220] Private Chelsea Manning, formerly Bradley Manning, tweeted a photo of her feet in tennis
[02:18.220 --> 02:22.960] shoes with the caption, First Steps of Freedom, shortly after she was released Wednesday today,
[02:22.960 --> 02:27.800] having served a fraction of her 35-year sentence on 20 counts, including six Espionage Act
[02:27.800 --> 02:31.920] violations for giving classified Pentagon materials to WikiLeaks.
[02:31.920 --> 02:36.120] Former President Barack Obama granted her clemency in January before he left office.
[02:36.120 --> 02:40.500] The Army stated that Manning will be on special unpaid off-duty status with the option to
[02:40.500 --> 02:42.560] relocate and live where she wants.
[02:42.560 --> 02:48.280] A documentary entitled XY Chelsea is being created about Private Chelsea Manning, the
[02:48.280 --> 02:54.720] transgendered soldier convicted of giving classified government materials to WikiLeaks.
[02:54.720 --> 03:22.440] This was Ruth Rode with your Lowdown for May 17, 2017.
[03:54.720 --> 04:17.080] Okay, howdy, howdy, Randy Kelton, Deborah Stevens, Real Well Radio on this, the 18th
[04:17.080 --> 04:21.520] day of May 2017.
[04:21.520 --> 04:30.560] And a little update on the e-book, we're still, we don't quite have it launched yet.
[04:30.560 --> 04:38.400] We have the URL up and I have a website built, I'm adding content to it, it's a lot of what
[04:38.400 --> 04:41.440] we're doing we have to explain.
[04:41.440 --> 04:46.640] And I'm hoping that by this time next week we will actually have it merging all the docs
[04:46.640 --> 04:51.360] and have everything actually working.
[04:51.360 --> 04:58.400] So that's moving along well and also we're still running the fundraiser and things are
[04:58.400 --> 04:59.400] getting pretty dicey.
[04:59.400 --> 05:05.920] We really need some help to keep things going, we've been having some equipment issues and
[05:05.920 --> 05:10.340] it's been taking money that we're kind of running out of.
[05:10.340 --> 05:18.480] So if anybody has got a couple extra bucks, Randy's Beer Fund is sure in pitiful shape.
[05:18.480 --> 05:30.120] And also, we've got the e-book up, Dr. Graves' Jurisdictionary, if you're in an illegal
[05:30.120 --> 05:38.760] situation and you expect one to arise and you come here for legal remedy, the best thing
[05:38.760 --> 05:49.400] you can do to make what we do of more value is start with Dr. Graves' Jurisdictionary.
[05:49.400 --> 06:02.880] And if your issues have to do with traffic citations, then get Eddie's course and traffic
[06:02.880 --> 06:10.800] seminar and my e-book picks up where Jurisdictionary leaves off.
[06:10.800 --> 06:20.600] Dr. Graves, he was a inside attorney, he was a licensed attorney for 20 years or probably
[06:20.600 --> 06:22.460] longer than that.
[06:22.460 --> 06:29.840] So he treats the system from an inside perspective.
[06:29.840 --> 06:37.220] I treat the system from an outside perspective and they're quite a bit different.
[06:37.220 --> 06:40.800] The perspectives are quite a bit different, they give you a whole different way of looking
[06:40.800 --> 06:45.000] at the system and another way of dealing with the system.
[06:45.000 --> 06:47.360] They're well worth the cost.
[06:47.360 --> 06:50.920] We keep the cost very minimum so we can get them out to the most people.
[06:50.920 --> 07:01.960] So go to Logos Radio Network and check us out and see what you can use there to kind
[07:01.960 --> 07:03.680] of help us keep this thing going.
[07:03.680 --> 07:07.440] We do have a caller already going to Scott in Texas.
[07:07.440 --> 07:08.440] Hello, Scott.
[07:08.440 --> 07:09.440] Howdy, howdy.
[07:09.440 --> 07:10.440] Howdy, howdy.
[07:10.440 --> 07:14.120] What are you up to today?
[07:14.120 --> 07:18.520] Well, I'm down here just north of Houston.
[07:18.520 --> 07:28.840] I'm going to go court watch for a buddy of mine, Jody, going for a DWI hearing and emotions
[07:28.840 --> 07:29.840] hearing.
[07:29.840 --> 07:35.440] He filed a motion for discovery a good bit ago, at least two weeks ago, so he got that
[07:35.440 --> 07:36.440] in plenty of time.
[07:36.440 --> 07:43.000] So it's going to be interesting to see what kind of evidence they actually have and if
[07:43.000 --> 07:46.480] they're even going to present any or give him any.
[07:46.480 --> 07:52.880] And I'm going to be recording it with a press pass on, it also has rule of law on there
[07:52.880 --> 07:53.880] too.
[07:53.880 --> 08:00.680] And so I'm going to sit in there and video this court procedure and see how the traditional
[08:00.680 --> 08:03.200] railroad goes down here.
[08:03.200 --> 08:06.880] Well, that should be interesting.
[08:06.880 --> 08:14.920] Is this one of the courts where Jody recorded a hearing or is this a different one?
[08:14.920 --> 08:17.040] No, this is a different one.
[08:17.040 --> 08:27.800] He had got the DWI and now this is going to be the first motions hearing for the DWI.
[08:27.800 --> 08:34.800] So this is just going in there and like I say, since he has a motion for discovery,
[08:34.800 --> 08:39.080] you know, it's going to be interesting to see what they will give him.
[08:39.080 --> 08:43.760] And I just, you know, pretty much know everybody gets the traditional railroad.
[08:43.760 --> 08:49.840] So to see what tactic they come up with to deny and suppress exculpatory evidence favorable
[08:49.840 --> 08:51.960] to the accused.
[08:51.960 --> 08:55.640] That will be good, but go back and read 39.14.
[08:55.640 --> 09:02.400] There's a section in there that I haven't heard anybody speak to.
[09:02.400 --> 09:10.560] And that's the section where it requires that the prosecutor produce all of this discovery
[09:10.560 --> 09:14.520] at least 30 days before trial.
[09:14.520 --> 09:27.600] Okay, this is this, you know, I'm into bushwhack and this opens the door for bushwhack.
[09:27.600 --> 09:36.680] If there is discovery that you are aware of, for instance, in your case in Rockwall, was
[09:36.680 --> 09:38.400] that no, that wasn't your case in Rockwall.
[09:38.400 --> 09:45.040] There was a case in Glenrose, Ken Magnusson was helping a friend of ours with and they
[09:45.040 --> 09:51.940] produced a video of the original stop.
[09:51.940 --> 09:58.640] But the video was extremely poor quality and there were parts missing.
[09:58.640 --> 10:03.440] When the prosecutor came to court, he brought in a video that wasn't degraded the way
[10:03.440 --> 10:06.560] this one was.
[10:06.560 --> 10:15.040] This should have got criminal charges against the prosecutor because the prosecutor had
[10:15.040 --> 10:23.000] had produced discovery that had been tampered with as tampered with government record.
[10:23.000 --> 10:32.880] And he had a untampered copy of the audio video from the stop that he didn't produce
[10:32.880 --> 10:38.840] within the 30 day time limit before trial that should have gotten official oppression
[10:38.840 --> 10:45.000] 39.03 penal code against the prosecutor.
[10:45.000 --> 10:50.140] So make sure Jody has that in mind.
[10:50.140 --> 11:00.360] So it's all going to be how they violate Brady and the whole Brady policy issue because the
[11:00.360 --> 11:03.120] non-scopatory evidence, it don't matter.
[11:03.120 --> 11:08.200] They know it and it's just like, but tampering and altering it, that's just even more charges.
[11:08.200 --> 11:13.600] The problem is we get in all these charges and it's like I was talking about earlier.
[11:13.600 --> 11:18.640] It's like everybody was talking about take these guys to JP court and, you know, try
[11:18.640 --> 11:20.820] to get that going and then non-suit or something.
[11:20.820 --> 11:25.920] But I don't even think a JP judge will allow you to bring another judge in or an attorney.
[11:25.920 --> 11:28.040] So they're the gatekeepers of the whole thing.
[11:28.040 --> 11:34.440] If we could get before a little old JP jury and present a case about how this scoundrel
[11:34.440 --> 11:39.280] other judge is doing all this, the jury would convict them quickly.
[11:39.280 --> 11:45.120] No, no, no, that's not how that works.
[11:45.120 --> 11:52.920] Criminal complaints against public officials always go to a grand jury.
[11:52.920 --> 11:58.600] Even if they're misdemeanors, even if it's a class C, goes to a grand jury.
[11:58.600 --> 12:04.960] 2.03 code of criminal procedure, if a prosecuting attorney has it made known to him in any manner
[12:04.960 --> 12:09.680] that a public official is violating a law relating to his office, he shall reduce the
[12:09.680 --> 12:13.360] complaint to an information submitted to the grand jury.
[12:13.360 --> 12:16.720] Violated a law relating to his office.
[12:16.720 --> 12:26.840] You can't get into the JP court with a criminal case in any manner other than to get an examining
[12:26.840 --> 12:29.840] trial.
[12:29.840 --> 12:32.680] You run the routine on them if you have criminal charges.
[12:32.680 --> 12:35.300] Oh yeah, that's the thing.
[12:35.300 --> 12:41.360] You're going through this never-ending judges won't allow your case in, you know, on a criminal
[12:41.360 --> 12:42.560] charge either.
[12:42.560 --> 12:48.840] So it's around the same.
[12:48.840 --> 12:54.760] Understand if you're expecting these judges to say, oh my God, you've murdered me.
[12:54.760 --> 12:59.740] I'm going to give up my 30 year career because you filed this criminal charge against me.
[12:59.740 --> 13:01.400] They're going to fight you like a tiger.
[13:01.400 --> 13:02.400] You got to expect it.
[13:02.400 --> 13:04.900] And the system's corrupt.
[13:04.900 --> 13:10.120] The only way we're going to beat them is by stacking these suits on them.
[13:10.120 --> 13:14.600] You think your suits are just being tossed around and dismissed and you're having to
[13:14.600 --> 13:15.600] refile.
[13:15.600 --> 13:24.780] I guarantee you, every one of these suits puts a really, really big mark on their record.
[13:24.780 --> 13:29.160] They write you a ticket and that ticket goes on your record.
[13:29.160 --> 13:31.440] Same way that ticket goes on your record.
[13:31.440 --> 13:38.520] These lawsuits and criminal charges, they get logs and it's criminal charges.
[13:38.520 --> 13:41.560] Criminal charges scare everybody.
[13:41.560 --> 13:47.520] They don't think they'll get prosecuted, but the prospect is very real.
[13:47.520 --> 13:54.640] We can't stop going after them just because they keep not doing what they're supposed
[13:54.640 --> 13:55.640] to.
[13:55.640 --> 13:58.960] The idea is to keep raising the bar on them.
[13:58.960 --> 14:13.640] I get this traffic app up and working, then we expect to be bringing in a lot of people.
[14:13.640 --> 14:23.160] And as part of the ongoing process, we will sell them lawsuits.
[14:23.160 --> 14:29.640] In terms of a JP suit, I guess I better understand what you mean, but I don't think we can
[14:29.640 --> 14:30.640] get there.
[14:30.640 --> 14:38.240] A civil suit against a judge, we're starting out with a challenge subject matter jurisdiction.
[14:38.240 --> 14:40.620] The judge denies the subject matter jurisdiction.
[14:40.620 --> 14:51.300] We could file a notice of tort immediately and then the traffic issue is proceeding.
[14:51.300 --> 14:58.120] After 60 days of filing a notice of tort, we just sue the judge in the JP court.
[14:58.120 --> 15:01.160] And then they're going to try to dismiss it and they're going to do all kind of dance
[15:01.160 --> 15:03.000] with the letter.
[15:03.000 --> 15:04.000] Who cares?
[15:04.000 --> 15:06.320] We'll set up the procedures.
[15:06.320 --> 15:11.640] When they have to fight to keep you from getting at them while they're trying to get at you,
[15:11.640 --> 15:16.280] this is going to change their policies and their practices.
[15:16.280 --> 15:25.720] Scott, would you have any problem if all of these officials acted by law?
[15:25.720 --> 15:28.240] No.
[15:28.240 --> 15:29.600] So that's what we really want.
[15:29.600 --> 15:34.000] At the end of the day, we'll get our public officials to do what the law commands them
[15:34.000 --> 15:35.000] to do.
[15:35.000 --> 15:38.900] And we're not going to have these issues.
[15:38.900 --> 15:41.400] This is how we'll get it done.
[15:41.400 --> 15:43.200] Well, that's why-
[15:43.200 --> 15:46.480] And look at all the fun you're having.
[15:46.480 --> 15:47.480] Oh, well, shoot.
[15:47.480 --> 15:52.320] Like I say, I'm going to be down here videoing it and so everybody's going to, they can go
[15:52.320 --> 15:58.600] on Snafu Radio on YouTube and I'll upload this one too and it'll be done.
[15:58.600 --> 16:02.520] And then everybody's just going to start learning how to go in here and give them the best fight
[16:02.520 --> 16:06.880] they ever seen in their life to make it totally miserable to prosecute you.
[16:06.880 --> 16:11.600] And they're going to be creating criminal charges on themselves all the way through.
[16:11.600 --> 16:17.560] There's just lawsuit after lawsuit after lawsuit if you can get them in, by all means they
[16:17.560 --> 16:21.000] need to be sued to the stone age.
[16:21.000 --> 16:22.000] Yeah.
[16:22.000 --> 16:29.000] And as we build this app, this app will grow into the electronic lawyer.
[16:29.000 --> 16:34.240] We're starting with traffic citations because there's six and a half million a year.
[16:34.240 --> 16:39.560] We've got lots of them, but we will grow into everything else and I'll kind of explain that
[16:39.560 --> 16:42.520] when we come back on the other side.
[16:42.520 --> 16:45.640] This is Randy Kelton, Debra Stevens, Rule of Law Radio.
[16:45.640 --> 16:49.040] Call in number 512-646-1984.
[16:49.040 --> 16:54.800] Give us a call and check out our Logos Radio Network for our fundraiser.
[16:54.800 --> 16:55.800] We'll be right back.
[16:55.800 --> 16:56.800] I'm going to give it to you for a gift.
[16:56.800 --> 16:57.800] Dang cookies.
[16:57.800 --> 16:58.800] Cookies?
[16:58.800 --> 16:59.800] Me love cookies.
[16:59.800 --> 17:00.800] Oh, hi, Cookie Muncher.
[17:00.800 --> 17:01.800] No, these are yucky cookies.
[17:01.800 --> 17:02.800] Cookies?
[17:02.800 --> 17:03.800] Yucky?
[17:03.800 --> 17:04.800] No, no bad cookies.
[17:04.800 --> 17:05.800] You can't eat cookies.
[17:05.800 --> 17:11.120] You can't even eat these cookies.
[17:11.120 --> 17:12.120] These are cyber cookies.
[17:12.120 --> 17:13.120] No, Cookie.
[17:13.120 --> 17:14.120] No.
[17:14.120 --> 17:16.720] They are cyber cookies and they clog up your computer.
[17:16.720 --> 17:17.720] These have apple.
[17:17.720 --> 17:18.720] Really?
[17:18.720 --> 17:20.720] Oh, that's an actual apple.
[17:20.720 --> 17:21.720] Mmm.
[17:21.720 --> 17:22.720] Yummy apple.
[17:22.720 --> 17:26.760] I'm going to throw away these yucky cookies in the trash.
[17:26.760 --> 17:32.920] I click control, shift, delete, and then scroll down to cookies and clear them.
[17:32.920 --> 17:34.480] Bye bye, yucky cookies.
[17:34.480 --> 17:40.160] Now I go to logosradionetwork.com and I click on the Amazon box on the upper right hand
[17:40.160 --> 17:46.160] side, bookmark the link, and I can go to Amazon through this link and order you some yummy
[17:46.160 --> 17:47.160] new cookies.
[17:47.160 --> 17:49.000] New cookies for me?
[17:49.000 --> 17:51.000] Consider it an early Christmas present.

[19:30.320 --> 19:31.320] Okay.
[19:31.320 --> 19:32.320] We are back.
[19:32.320 --> 19:37.480] Randy Kelton, Deborah Stevens, and Rule of Law Radio on this Thursday, the 18th day of
[19:37.480 --> 19:43.560] May, 2006-17, and we're talking to Scott in Texas.
[19:43.560 --> 19:53.200] Okay, Scott, didn't you just send in an appeal, I'm sorry, an amended pleading in a federal
[19:53.200 --> 19:54.200] case?
[19:54.200 --> 19:56.000] This is an interesting case.
[19:56.000 --> 20:11.640] Let's talk about suing the judge of the commissioner's court because he did not ensure that county
[20:11.640 --> 20:19.440] employees were properly trained so that they would conduct their activities in accordance
[20:19.440 --> 20:25.400] with standing law.
[20:25.400 --> 20:28.960] Tell us about that.
[20:28.960 --> 20:38.520] The whole denial of due process from the moment that the cop pulled me over under supposedly
[20:38.520 --> 20:46.200] the judge's orders after leaving a court case stemmed from everything from an original traffic
[20:46.200 --> 20:53.800] stop a year prior where I was stopped for making a right-hand turn without using a blinker
[20:53.800 --> 20:57.080] and a right-turn lane only.
[20:57.080 --> 21:02.640] So there was a fishing expedition the whole way, and then the judge and the municipal
[21:02.640 --> 21:05.160] court denied due process.
[21:05.160 --> 21:12.760] It got appealed up to county court, and a case that accrued from leaving court getting
[21:12.760 --> 21:19.320] charged with the same charge but just elevated to a Class B, driving with an invalid license.
[21:19.320 --> 21:29.280] And so after taking all that to the county court, everything got dismissed, and the lawsuit
[21:29.280 --> 21:37.560] is being filed on the county judge for supervisory neglect for the prosecutors not allowing excopatory
[21:37.560 --> 21:40.640] evidence into a trial even.
[21:40.640 --> 21:45.520] That was the whole premise of everything was excopatory evidence that was denied by the
[21:45.520 --> 21:46.520] prosecutors.
[21:46.520 --> 21:52.640] So they're trained, the prosecutor's supposed to train the cops in their constitutional
[21:52.640 --> 22:00.840] duties and limitations and powers by their lack of training caused an action on me.
[22:00.840 --> 22:06.240] So the county judge is the one who's supposed to maintain that the district attorney and
[22:06.240 --> 22:12.400] his office is in compliance with all the policies and procedures, Brady policy, Brady v. Maryland
[22:12.400 --> 22:18.440] is the major one, along with the Michael Morton Act of Texas.
[22:18.440 --> 22:24.000] So these policies are being violated, the county judge knew it, took it in the federal
[22:24.000 --> 22:25.000] court and-
[22:25.000 --> 22:27.520] Okay, wait, wait, hold just a second.
[22:27.520 --> 22:31.160] Let me make sure we don't have any misunderstanding here.
[22:31.160 --> 22:39.560] Michael Morton Act, Michael Morton Act is an amendment of the Brady discovery statute
[22:39.560 --> 22:47.520] and the Brady discovery statute in Texas law is Texas Code of Criminal Procedure 39.14.
[22:47.520 --> 22:51.880] So there's not a Brady and a Michael Morton, there's just, they're both in the same
[22:51.880 --> 22:52.880] one.
[22:52.880 --> 22:57.640] So if you read 39.14, you get all of that at one time.
[22:57.640 --> 22:58.640] Okay.
[22:58.640 --> 23:03.280] I'm just trying to clear up any possible, you know, go ahead.
[23:03.280 --> 23:05.280] Oh, no, no, that's good.
[23:05.280 --> 23:15.680] So anyhow, now the amended complaint is basically in on that one and so what was interesting
[23:15.680 --> 23:22.880] though was the district judge first denied it and then he decided to go ahead and reprimand
[23:22.880 --> 23:27.960] it back down to the magistrate judge and that's when they asked for an amended pleading.
[23:27.960 --> 23:33.480] And so I amended all that and got it all in on time and all the while this one on Clay
[23:33.480 --> 23:40.400] Jenkins, the county judge who's being sued for the exact same thing, supervisory neglect
[23:40.400 --> 23:48.800] set up the same way via Addison and Mesquite cops acting on their own but within the same
[23:48.800 --> 23:55.320] policies of how they violate due process and all your rights right there by even stopping
[23:55.320 --> 23:58.200] you in the beginning.
[23:58.200 --> 24:03.600] So now the one on Clay Jenkins, I'm writing the brief because they got dismissed, I appealed
[24:03.600 --> 24:08.360] it, went straight up to the Fifth Circuit in New Orleans and now they asked to write
[24:08.360 --> 24:09.360] a brief on it.
[24:09.360 --> 24:14.500] So I'm working on the brief right now, I've got probably 12 hours on the brief right now
[24:14.500 --> 24:20.240] and soon as I get that put together by the end of this coming week, I'll have that submitted
[24:20.240 --> 24:27.240] and then they have 30 days to answer and so this one has just kicked off like a time bomb.
[24:27.240 --> 24:35.320] And you sent me a copy of the suit that was tossed out, they told you to file an amended
[24:35.320 --> 24:41.260] and then this is for everybody else, Scott sent me the amended and Scott's getting better
[24:41.260 --> 24:43.500] but it has some weaknesses.
[24:43.500 --> 24:54.680] So we had a three-way conversation with Jay Goodfriend and I just climbed Scott's tree.
[24:54.680 --> 25:02.520] I would cut him no slack, no mercy and then I took a bunch of stuff from my habeas and
[25:02.520 --> 25:07.200] put it in a plea and gave it to him and he filed it, okay.
[25:07.200 --> 25:15.320] He just sent me a copy of the amended of the brief and there are some technical problems
[25:15.320 --> 25:23.600] with the brief but they're mostly technical and minor wording but clearly Scott, you got
[25:23.600 --> 25:32.080] it and went through this brief and he walked from issue to issue and he stitched the issues
[25:32.080 --> 25:33.500] together.
[25:33.500 --> 25:40.740] There were a few places in there where the connections weren't clear but I have the same
[25:40.740 --> 25:48.360] problems when I write documents because I know what all the connections are and you
[25:48.360 --> 25:53.280] just miss them, they need somebody else to read your documents and rip them apart.
[25:53.280 --> 25:57.160] Everybody who listens to the show a lot knows that I ask people all the time to read my
[25:57.160 --> 26:04.280] documents and tear them to shreds and that's because when we write stuff, we can't see
[26:04.280 --> 26:08.640] what other people see so we need somebody else to read it but I just want to tell you
[26:08.640 --> 26:10.520] this one was much better.
[26:10.520 --> 26:12.760] Thank you.
[26:12.760 --> 26:18.280] But I'm going to rip it to shreds anyway.
[26:18.280 --> 26:21.320] I appreciate it, I'm counting on it as a matter of fact.
[26:21.320 --> 26:25.280] They already ripped me to shreds on the technical issues already about sense.
[26:25.280 --> 26:30.400] I guess I just don't have the common sense.
[26:30.400 --> 26:38.480] I noticed he was using a lot of passive voice and we want to avoid passive voice if we can
[26:38.480 --> 26:40.360] but these are relatively minor.
[26:40.360 --> 26:49.480] The most important things is that you get your facts in a row, you get all the happenings
[26:49.480 --> 26:56.400] in the time they happen, that's why we do a timeline and you move your reader from one
[26:56.400 --> 27:02.000] fact to the next in a way that they can stitch together what happened.
[27:02.000 --> 27:04.480] You did that pretty good in this document.
[27:04.480 --> 27:09.960] There were a few places you jumped over but that happens when you're trying to write a
[27:09.960 --> 27:11.840] complex document.
[27:11.840 --> 27:17.120] I generally have to go over one half a dozen times before I get all the – at least get
[27:17.120 --> 27:21.560] all the pieces I can find stitched together but I never find all of them and one thing
[27:21.560 --> 27:31.020] Ken Magnussen does that I find very helpful, if you don't have someone to rip your documents
[27:31.020 --> 27:36.720] apart for you, just read them out loud.
[27:36.720 --> 27:42.040] He reads them to his cats and he says they're really a tough audience but read them out
[27:42.040 --> 27:44.040] loud.
[27:44.040 --> 27:49.400] The sound goes out your mouth and comes back your ears and you'll be surprised how often
[27:49.400 --> 27:51.920] it doesn't sound right.
[27:51.920 --> 27:55.920] It sounds okay to you when you're saying it but not when you're hearing it coming back
[27:55.920 --> 28:02.520] so if you're going to file a motion of pleading before you do, always read it first, read
[28:02.520 --> 28:03.920] it out loud.
[28:03.920 --> 28:04.920] Okay.
[28:04.920 --> 28:11.920] I agree, I agree totally on that and it was really ironic because you kind of sent me
[28:11.920 --> 28:19.160] one that was on that guy's case going to the I guess the Supreme Court over some title
[28:19.160 --> 28:25.680] issue but I was looking at it and I was trying to work on it through that document and trying
[28:25.680 --> 28:31.060] to use it and try to put pieces together and I could kind of get it just a little bit but
[28:31.060 --> 28:36.880] it was like I was really frustrated with it because every time a judge would do some captioning
[28:36.880 --> 28:41.000] would go crazy and it was kind of hard to kind of plug and play with some of the facts
[28:41.000 --> 28:45.240] and the stuff but I slept on it overnight and it's like the next morning it was like
[28:45.240 --> 28:50.760] there was an epiphany it was like I have this like these are the certain frames and you
[28:50.760 --> 28:55.440] just go walk down all these frames and it was getting the caption with the headings
[28:55.440 --> 29:00.040] and the heading thing actually clicked and so you write a little heading and then you
[29:00.040 --> 29:05.360] elaborate on that heading with the fact to back it up and then you just move through
[29:05.360 --> 29:10.480] your timeline like that the heading kind of once I was able to get the formatting and
[29:10.480 --> 29:15.600] just use three formatting tools everything kind of stitched itself in once I started
[29:15.600 --> 29:20.900] using it just getting the concept down of how I wanted the document to flow and how
[29:20.900 --> 29:29.560] everything time timeline wise was put together and then the similarities of both two different
[29:29.560 --> 29:35.580] municipalities acting within the same policy and I tried to fill the law.
[29:35.580 --> 29:46.160] That is what's going to help as we start working the electronic lawyer part frankly this is
[29:46.160 --> 29:50.880] something I don't think I would have ever thought of doing and that's suing the county
[29:50.880 --> 29:58.600] commissioners court directly now if you sue the prosecutor for giving legal advice or
[29:58.600 --> 30:17.240] failing.
[30:17.240 --> 30:22.240] Privacy is under attack when you give up data about yourself you'll never get it back again

[34:01.320 --> 34:06.400] we are back randy kelton deborah stevens rule of law radio and we're talking to scott and
[34:06.400 --> 34:18.960] texas and once we work out i want to see how the courts respond to this particular pleading
[34:18.960 --> 34:26.720] and we will start memorializing this thing we'll put it down into we take the pleadings
[34:26.720 --> 34:34.880] and lay them out lay out the facts that lead to it the majority of the facts that actually
[34:34.880 --> 34:40.920] lead to this particular suit aren't terribly important because they simply go to violation
[34:40.920 --> 34:48.440] to due process what i really want to see is how the other side answers what they bring
[34:48.440 --> 34:53.320] up and then we build a questionnaire and say well did they bring up this issue and this
[34:53.320 --> 34:58.680] issue we look at that issue and how do we argue that one we lay all this into our questionnaire
[34:58.680 --> 35:05.940] so that uh before long we've got everything in there and if we have a bunch of people
[35:05.940 --> 35:15.000] using the traffic app then we start we take the suit that we have built make it available
[35:15.000 --> 35:24.480] all of them we build a questionnaire so we can add in their peculiarities then we start
[35:24.480 --> 35:31.360] getting feedbacks feedback from a lot of other places and before long we will have everything
[35:31.360 --> 35:37.360] they can think of to do already covered on the front end this is really what the electronic
[35:37.360 --> 35:48.440] lawyer will will do for us so that a pro se can come in absolutely loaded for bear okay
[35:48.440 --> 35:58.480] i'm trying to unmute you there you go scott okay thank you well you know also but there's
[35:58.480 --> 36:05.620] going to just come in with a flurry of affirmative defenses and all that's merely their opinions
[36:05.620 --> 36:11.720] too and their opinions they're all lawyers given their opinions which does not rise to
[36:11.720 --> 36:17.980] the level of facts and evidence so therefore great i'm just glad to have all your questions
[36:17.980 --> 36:24.300] but as far as i'm concerned they mean nothing and we're going to court well this is this
[36:24.300 --> 36:30.980] is what we'll do with the electronic lawyer's side is that's great throw your affirmative
[36:30.980 --> 36:36.520] defenses at us then we take each of the affirmative defense and say okay how do we argue that
[36:36.520 --> 36:46.040] affirmative defense we work up an argument and then we put that in the pleading itself
[36:46.040 --> 36:54.060] we address their offer their potential affirmative defenses before they get a chance to so before
[36:54.060 --> 37:02.020] they make their argument we shoot them out of the water and we force by this method we
[37:02.020 --> 37:09.640] will force them further and further back into a legal corner because all the junk they're
[37:09.640 --> 37:18.660] throwing at the court we've already got addressed and our suits our petitions will get rather
[37:18.660 --> 37:25.100] large and pretty well all-encompassing and for those of you are thinking you know this
[37:25.100 --> 37:31.380] would really be tough if you filed these suits one of the primary pleadings that were providing
[37:31.380 --> 37:38.300] it on the front end is an objection to oral argument since you're coming before the court
[37:38.300 --> 37:46.220] as a pro se then it would be categorically unfair to allow a lawyer to come into court
[37:46.220 --> 37:56.620] and propose case law and legal arguments that may or may not be accurate truthful irrelevant
[37:56.620 --> 38:07.040] and to put a pro se in a position of having to react to improper pleadings would be without
[38:07.040 --> 38:15.980] having time to research out those pleadings would be a would be patently unfair so we're
[38:15.980 --> 38:21.260] going to start that first and ask the court to make all these rulings on the pleadings
[38:21.260 --> 38:28.300] and we're asking the court to rule on every element of the pleadings so in order to do
[38:28.300 --> 38:35.540] that I'm going back into my pleadings and everywhere I have a legal element that I need
[38:35.540 --> 38:42.380] to on output granted or denied or something under there to indicate how the judge will
[38:42.380 --> 38:50.540] rule on this element then if I get the document back and one of those are missed then I'll
[38:50.540 --> 38:57.020] judicial conduct complaint the judge for denying you and your right to petition the court for
[38:57.020 --> 39:04.580] redress agreements no more this just tossing you re ruling on one minor element and ignoring
[39:04.580 --> 39:13.420] everything else that's what they've been doing we'll get this down to an art the system itself
[39:13.420 --> 39:18.440] when we get a pleading back we go in and ask the questions that go to all these elements
[39:18.440 --> 39:22.620] do you rule on this did you rule on this did you real on this any one of those says no
[39:22.620 --> 39:30.120] BAM it spits out a judicial conduct complaint we will get their attention okay couple more
[39:30.120 --> 39:36.660] callers do you have anything else for us Scott no I'm gonna be busy in the morning so I will
[39:36.660 --> 39:43.120] let you go and y'all have a good evening okay have a good time and make sure you send me
[39:43.120 --> 39:49.820] your next copy of that document so I can go over oh don't worry you'll be in the loop
[39:49.820 --> 39:58.460] I'll be talking to you Sunday morning okay thank you Scott okay now we're going to Boris
[39:58.460 --> 40:07.300] in Texas hello Boris hey Randy how you doing I'm doing good great well okay now I talked
[40:07.300 --> 40:12.940] to you a little less than two weeks ago about the list pendants and the ex-wife and ex-husband
[40:12.940 --> 40:18.460] and I can't get them to sign off on a on a debt you remember remember that situation
[40:18.460 --> 40:25.820] yes yes yes I do that's where you bought a property the man and wife were married at
[40:25.820 --> 40:33.180] the time the wife did not object to it and you paid on the property then they got a divorce
[40:33.180 --> 40:38.660] and now the wife wants to take the property yeah well see she didn't she didn't know that
[40:38.660 --> 40:45.620] I guess that there was money coming in or whatever and I mean she didn't know about
[40:45.620 --> 40:51.100] it the remaining balance in other words while the divorce was going on so she found out
[40:51.100 --> 40:57.780] about it while the house was in escrow yeah that's it there and and so her attorney right
[40:57.780 --> 41:03.320] when we were gonna you know go ahead and close anyway without her signature her attorney
[41:03.320 --> 41:12.240] filed this list pendants on on the house and uh and uh so last weekend we someone brought
[41:12.240 --> 41:21.100] to my attention here that that uh you know in in the list pendants it shows her as the
[41:21.100 --> 41:27.820] petition you know the petitioner and him as the respondent so it says you know uh you
[41:27.820 --> 41:35.620] know it gives you know her and him a lawsuit was commenced by petitioner and then her name
[41:35.620 --> 41:43.340] well down at the bottom of the document that that her her lawyer signed it also shows that
[41:43.340 --> 41:53.180] she was the notary oops so it has so it has her name in the notary stamp with with the
[41:53.180 --> 41:59.300] notary with her notary signature and then it has her name at the top as the petitioner
[41:59.300 --> 42:06.500] with her name there and and so I think the word by is is a key thing here because it
[42:06.500 --> 42:14.060] says it was commenced by petitioner and her name and then of course we know it was stamped
[42:14.060 --> 42:22.300] and notarized by the exact same person and and so then I've been going through the you
[42:22.300 --> 42:27.660] know the the secretary of state website and I'm filling out a complaint with the secretary
[42:27.660 --> 42:38.380] of state if that does any good and in section 406 of the I guess the government code it
[42:38.380 --> 42:45.380] gives it gives these rules of conduct but it doesn't list them as as like crime offenses
[42:45.380 --> 42:54.540] so I'm also aside from submitting a complaint to the secretary of state I also want to you
[42:54.540 --> 43:01.980] know file a criminal complaint against her and maybe her attorney for allowing this on
[43:01.980 --> 43:08.320] on on the document with her signature with both of them's signature and okay but I'm
[43:08.320 --> 43:16.340] trying to okay are you familiar with 32.49 Texas penal code oh yeah we've been going
[43:16.340 --> 43:21.540] over that too and and that's that's a that's a topic that actually two weeks ago when I
[43:21.540 --> 43:26.900] called in I was I was right at the end of the four hour period and you and I talked
[43:26.900 --> 43:32.620] about that for about 10 minutes before he got cut off but yes okay well well you you

[47:05.240 --> 47:09.000] And where were we, Boris?
[47:10.600 --> 47:15.400] Well, you were about to go over and talk about 3249.
[47:15.400 --> 47:16.840] Okay, 3249, yes.
[47:17.400 --> 47:18.520] Okay, go ahead.
[47:18.520 --> 47:25.080] Okay, I want to bring up one more thing about the notarization real quick.
[47:25.880 --> 47:29.080] I showed that to an ex-husband the other day.
[47:29.800 --> 47:39.080] He typed in her, on his phone, he typed in her notary number and it brought up from the state
[47:39.080 --> 47:45.320] website that her business address is exactly the same as her attorney's address.
[47:45.320 --> 47:50.280] Yes, so we figure now that she works for her attorney as some sort of assistant.
[47:50.280 --> 47:51.560] Okay, that's it.
[47:51.560 --> 47:54.840] I don't know what that means, but we can go on to 32.49 now.
[47:56.280 --> 48:04.840] Okay, one other thing you can do, you can petition, you can file a quiet title action
[48:04.840 --> 48:12.200] against the less pendants and petition the court to remove, to have it, can't be removed,
[48:12.200 --> 48:22.440] but have something filed to render it void because it's insufficient on its face.
[48:24.360 --> 48:24.680] Yes.
[48:24.680 --> 48:28.360] Simply because of the improper notarization.
[48:30.920 --> 48:32.280] Did you bar grieve the lawyer?
[48:33.880 --> 48:39.880] I've sent her two and this one will be the topic of the third one.
[48:39.880 --> 48:42.600] Now I'm scheduling her like every 10 days.
[48:44.040 --> 48:46.360] Ooh, that's going to sting her good.
[48:47.560 --> 48:50.440] The wife may wind up getting fired over that.
[48:51.880 --> 48:57.720] Well, you know, I'm just going to go after him like a, you know, 400 pound lion and that's
[48:57.720 --> 49:03.400] what I'm doing and so she should get, she should find out about the first one right
[49:03.400 --> 49:08.680] about now because it's been right at two weeks since I sent off the first one.
[49:08.680 --> 49:15.640] I sent off the second one 12 days later and then this will, this notarization thing will
[49:15.640 --> 49:17.560] be the topic of the next one.
[49:19.720 --> 49:22.680] That will start raising the stakes on them.
[49:22.680 --> 49:27.400] Good chance her attorney is going to want this thing to go away.
[49:28.440 --> 49:29.480] Yeah, well she should.
[49:29.480 --> 49:32.360] If I'm going to be involved, she should want it to go away.
[49:32.360 --> 49:32.600] Yeah.
[49:32.600 --> 49:38.600] That her attorney is going to wonder what in the heck did she get ahold of?
[49:39.720 --> 49:42.680] Well, I've already, I've also sent a cease and desist letter.
[49:43.720 --> 49:52.920] According to 32.49, I am to allow a 21 day period for the bliss penance to be removed
[49:52.920 --> 49:58.120] before it becomes a class A misdemeanor.
[49:58.120 --> 50:04.200] And from what you and I talked about a few weeks ago is that they didn't have a good
[50:04.200 --> 50:10.520] standing for filing it anyway according to the section 32.49.
[50:10.520 --> 50:13.240] So now we're down to about 12 days on it.
[50:13.240 --> 50:18.840] So right at the end of the month, then she's due for a criminal complaint, so I'll need
[50:18.840 --> 50:26.040] to watch Scott's videos and whatever other videos to kind of figure out how to do those.
[50:26.040 --> 50:29.480] I've never done a criminal complaint before.
[50:30.360 --> 50:30.760] Yeah.
[50:30.760 --> 50:33.240] Oh, the criminal complaint's a piece of cake.
[50:35.480 --> 50:40.520] I have, well I don't have jurisdiction, jurisdiction prudence up and working, right?
[50:41.080 --> 50:48.440] If you will send me an email and ask for some examples of criminal complaints, I'll send
[50:48.440 --> 50:56.360] you some samples of some that I've produced and to give you idea how to write them.
[50:56.360 --> 50:57.400] It's pretty straightforward.
[50:57.400 --> 51:03.080] They're not very complex and yours is pretty dead bag.
[51:04.280 --> 51:10.520] You have, it's not just the one issue that they filed against your property when they
[51:10.520 --> 51:17.000] may or may not have had a claim, but the fact that the filer is the notary, that's a big
[51:17.000 --> 51:27.320] deal and this could well cost her her notary license if not more because that's a pretty
[51:27.320 --> 51:27.800] big deal.
[51:27.800 --> 51:31.480] The secretary of state is not going to be happy about that.
[51:32.520 --> 51:33.320] Okay, well good.
[51:33.880 --> 51:40.520] Yeah, well in their training material, it has this one page that says the primary duty
[51:40.520 --> 51:48.360] and I'm reading that the primary duty of a notary public is to serve as a disinterested
[51:48.360 --> 51:52.680] party in authenticating the acts of a signing party.
[51:52.680 --> 51:58.200] Therefore, a notary should not have a personal interest in the transaction.
[51:58.200 --> 52:05.320] She clearly very much does note or notarize a document in which the notary has financial
[52:05.320 --> 52:07.240] or beneficial interest.
[52:07.240 --> 52:11.160] You know, so I mean that's very clearly that they do.
[52:11.160 --> 52:16.360] I just, I'm not sure how to go from that to a criminal complaint though right now.
[52:16.360 --> 52:18.040] I don't know how to pin that down.
[52:19.800 --> 52:26.120] That could be, let me think, simulating a, and now not simulating a legal government
[52:26.120 --> 52:30.760] process, tampering with a government document.
[52:30.760 --> 52:35.400] The document, the document once it's filed is a government document.
[52:35.400 --> 52:42.280] She put essentially a false statement on a government document in that she verified this
[52:42.280 --> 52:51.480] signature of a party, of a third party, when in fact she was verifying her own signature.
[52:51.480 --> 52:57.400] Okay, let me, let me recheck to make sure I've said that I've done that right, because
[52:57.400 --> 53:01.640] did she sign the less pendants or did the lawyer?
[53:03.640 --> 53:09.720] Well, both of them, well, oh, you mean did she sign it as client and a notary?
[53:09.720 --> 53:15.800] No, at the affirmation, I suspect it was signed by the lawyer.
[53:15.800 --> 53:23.800] Yes, it was.
[53:23.800 --> 53:30.360] And she verified the lawyer's signature on her document.
[53:30.360 --> 53:33.880] So, the lawyer signed in her name.
[53:33.880 --> 53:40.760] The lawyer signed in her name is also printed, like a standard thing, and then it says,
[53:40.760 --> 53:50.120] So, I'm anticipating the argument they will have.
[53:50.120 --> 53:56.440] They will argue that she didn't sign this document, and you will, before they get to
[53:56.440 --> 54:01.720] that argument, you make the argument that while the lawyer signed it, the lawyer signed
[54:01.720 --> 54:08.040] it as attorney in fact for the client, and the notary was the client.
[54:08.040 --> 54:16.120] So, it had the effect of the client signing the document, so they don't get to that argument.
[54:17.320 --> 54:26.120] Right, so then as it shows the attorney's signature, what does that mean?
[54:27.640 --> 54:30.920] That means that the attorney acted as her agent.
[54:32.040 --> 54:34.600] The attorney acted as her agent, okay.
[54:34.600 --> 54:38.040] It's as if she had done that herself.
[54:40.120 --> 54:45.080] Oh, okay, it says this, the attorney had done that herself?
[54:46.120 --> 54:51.640] No, the attorney signed as if the party had signed herself.
[54:53.080 --> 54:58.520] The attorney is the agent for the party and signed for the party.
[54:58.520 --> 55:07.960] So, it's the same as the, they probably put this in a stack of documents, and almost certainly
[55:07.960 --> 55:14.760] she did not witness the lawyer sign the document or make him swear to an oath or any of that
[55:14.760 --> 55:15.400] kind of stuff.
[55:16.760 --> 55:24.040] She works for the lawyer and she does verifications for the lawyer and he just puts a sack on
[55:24.040 --> 55:25.960] her desk and she verifies all of them.
[55:25.960 --> 55:27.480] Okay.
[55:27.480 --> 55:29.560] And they made an oops.
[55:31.160 --> 55:35.320] One of the ones on her desk was the one that should have been on somebody else's desk.
[55:37.000 --> 55:43.800] And she probably didn't realize it, she just wrote it in the book and stamped it and didn't
[55:43.800 --> 55:45.240] even know what the document was.
[55:46.360 --> 55:53.160] Well, we figured that they were in a big hurry because the people who were buying my house,
[55:53.160 --> 56:00.200] you know, they were texting her the day before, inviting her to come and pick up a check to
[56:00.200 --> 56:01.000] sign and whatever.
[56:01.000 --> 56:03.160] And we were telling her, we're going to go ahead and close anyway.
[56:03.800 --> 56:09.800] And so, that was like on a Wednesday back on the 26th of this month of April.
[56:10.360 --> 56:15.560] And we were telling her, we're going to close anyway with or without your signature.
[56:15.560 --> 56:21.000] So, what they did is they threw this together and filed on the very morning that we were
[56:21.000 --> 56:21.720] going to close.
[56:21.720 --> 56:25.320] So, it was thrown together at the last minute.
[56:25.320 --> 56:30.840] I mean, right in literally in the final hour, this was filed, literally in the final hour.
[56:31.640 --> 56:32.280] Okay.
[56:32.280 --> 56:39.800] Then they deliberately interfered with a private contract with the purpose of denying you the
[56:39.800 --> 56:41.000] benefit of the bargain.
[56:42.120 --> 56:45.320] Has your buyer backed out of the purchase?
[56:46.760 --> 56:49.640] No, no, they've actually been real supportive.
[56:49.640 --> 56:57.560] They've been very supportive of the fight that I've been giving them in the past few
[56:57.560 --> 56:58.520] weeks in particular.
[57:00.680 --> 57:01.320] So, they're okay.
[57:01.320 --> 57:01.960] Okay.
[57:01.960 --> 57:07.320] If they do back out, then you have a suit for the benefit of the bargain.
[57:07.320 --> 57:12.520] As it is, you have a suit for interfering with the private contract because they clearly
[57:12.520 --> 57:19.560] put together this lispindus to prevent you from closing on this property.
[57:19.560 --> 57:24.360] And in order to prevent you from closing on this property, they filed a fraudulent document.
[57:26.920 --> 57:27.240] Right.
[57:27.240 --> 57:33.000] Filing a document in order to interfere with a private contract.
[57:33.000 --> 57:33.320] Okay.
[57:35.160 --> 57:37.320] And that's clearly what they did.
[57:38.600 --> 57:38.920] Yeah.
[57:38.920 --> 57:44.440] So, they'll have a hard time dancing out from under this one and that's what the bar
[57:44.440 --> 57:48.200] grievance should be for because that was clearly improper.
[57:50.440 --> 58:00.200] And the lawyer had to know she didn't have a claim against this property anyway because
[58:00.200 --> 58:05.640] she was married to the husband when the husband sold the property and she didn't come to
[58:05.640 --> 58:10.040] the table and raise an objection.
[58:10.040 --> 58:13.480] Now, if the husband didn't notify her, that's between her and her husband.
[58:14.200 --> 58:14.760] No, I know.
[58:14.760 --> 58:16.920] That's not an issue you have.
[58:16.920 --> 58:19.160] So, the lawyer's wrong all the way around.
[58:19.160 --> 58:23.400] You might look at suing the lawyer for three times the value of the property just for yucks.
[58:25.240 --> 58:27.000] And here's the problem the lawyer has.
[58:29.000 --> 58:32.600] The lawyer has errors in emissions policy.
[58:33.960 --> 58:34.600] Yeah.
[58:34.600 --> 58:38.200] And the insurance carrier is going to deal with you.
[58:39.800 --> 58:41.880] They're not going to care what the lawyer says.
[58:42.920 --> 58:45.400] They're likely to, okay, hang on, about to go to break.
[58:45.400 --> 58:46.200] We'll be right back.
[58:46.200 --> 58:46.360] Yeah.
[58:50.040 --> 58:53.720] The Bible remains the most popular book in the world,
[58:53.720 --> 58:57.480] yet countless readers are frustrated because they struggle to understand it.
[58:58.200 --> 59:01.640] Some new translations try to help by simplifying the text,
[59:01.640 --> 59:05.800] but in the process can compromise the profound meaning of the scripture.

[59:09.160 --> 59:13.240] First, this new translation is extremely faithful and accurate,
[59:13.240 --> 59:17.400] but the real story is the more than 9,000 explanatory footnotes.
[59:18.040 --> 59:22.200] Difficult and profound passages are opened up in a marvelous way,

[01:00:42.920 --> 01:00:48.200] Today in history, the year 1809, Napoleon I of France orders the annexation of the
[01:00:48.200 --> 01:00:51.160] Papal States to the French Empire. Today in history.
[01:00:55.160 --> 01:00:59.560] In recent news, 27-year-old DNC staffer Seth Rich, who was mysteriously shot to
[01:00:59.560 --> 01:01:03.560] death while walking home from a bar in the early hours in July of 2016,
[01:01:03.560 --> 01:01:06.920] caused a plethora of conspiracy theories when this incident occurred.
[01:01:06.920 --> 01:01:10.920] The murder was first reported as a robbery as per the testimony of Seth's father,
[01:01:10.920 --> 01:01:14.360] but when no items were noticeably taken, the story then morphed into the death,
[01:01:14.360 --> 01:01:18.440] being a result of a confrontation with a yet-to-be-identified assailant.
[01:01:18.440 --> 01:01:22.200] It was suspected by many researchers and talk show radio hosts that Seth Rich
[01:01:22.200 --> 01:01:25.400] must have had something to do with the DNC email leaks of last year,
[01:01:25.400 --> 01:01:29.240] to add fuel to the fire of suspicion less than a month after Rich's death,
[01:01:29.240 --> 01:01:32.440] WikiLeaks offered $20,000 for information on the murder,
[01:01:32.440 --> 01:01:38.120] along with later in September a GOP lobbyist offering up to $100,000 for information on the murder.
[01:01:38.120 --> 01:01:42.520] Well, as of this week, Seth's case seems to have hit the chatterwaves again when on Monday,
[01:01:42.520 --> 01:01:48.520] Washington DC's Fox 5 reported that Rod Wheeler, a former DC homicide detective who was a private
[01:01:48.520 --> 01:01:52.920] investigator on the case, believed Rich had communicated with WikiLeaks before his death.
[01:01:52.920 --> 01:01:58.120] Rod Wheeler did state that he was misquoted when interviewed by CNN on Tuesday,
[01:01:58.120 --> 01:02:02.680] while Fox News on the same day put an anonymous federal investigator who said that the FBI
[01:02:02.680 --> 01:02:06.360] investigation found that Rich had been in contact with Gavin McFadyen,
[01:02:06.360 --> 01:02:09.240] whom Fox identified as the director of WikiLeaks.
[01:02:14.440 --> 01:02:18.920] Private Chelsea Manning, formerly Bradley Manning, tweeted a photo of her feet in tennis shoes with
[01:02:18.920 --> 01:02:23.640] the caption, first steps of freedom, shortly after she was released Wednesday today, having served a
[01:02:23.640 --> 01:02:29.080] fraction of her 35-year sentence on 20 counts, including six Espionage Act violations for giving
[01:02:29.080 --> 01:02:34.040] classified Pentagon materials to WikiLeaks. Former President Barack Obama granted her clemency in
[01:02:34.040 --> 01:02:39.240] January before he left office. The Army stated that Manning will be on special unpaid off-duty
[01:02:39.240 --> 01:02:45.800] status with the option to relocate and live where she wants. A documentary entitled XY Chelsea is
[01:02:45.800 --> 01:02:50.600] being created about Private Chelsea Manning, the transgendered soldier convicted of giving classified
[01:02:50.600 --> 01:02:58.600] government materials to WikiLeaks. This was Ruth Rohde with your Lowdown for May 17th, 2017.
[01:03:20.600 --> 01:03:50.120] Okay, we are back. Randy Kelton, Debra Stevens, Rule of Law Radio, and we're talking to
[01:03:50.120 --> 01:03:55.960] Boris in Texas. Okay, Boris, do you have anything else? It looks like you got a
[01:03:55.960 --> 01:04:04.280] pretty good claim against him. Yeah, just real quickly, you said about suing her,
[01:04:04.280 --> 01:04:12.520] what would be the, suing her for three times the amount of the home value. What was it,
[01:04:12.520 --> 01:04:19.960] what would be the basis of that? Fraud. They filed a fraudulent document for the purpose of
[01:04:19.960 --> 01:04:27.320] interfering with a private contract. Well, which, which fraud charge are you referring to? Because
[01:04:27.320 --> 01:04:35.080] there's two going on here. Well, a fraud charge on the fraudulent less pendants, the one that the
[01:04:35.080 --> 01:04:43.640] client notarized. Oh, okay. The notarization trick. Okay. Okay. Okay. Well, the, the earlier
[01:04:43.640 --> 01:04:50.200] one was, was on just the validity or the jurisdiction of the, of the whole thing as a whole.
[01:04:51.080 --> 01:04:58.840] Yeah. And also claim that she had no claim, she perpetrated a false claim against the property
[01:04:59.560 --> 01:05:04.200] when she had no claim. Her name is not in the contract anywhere. Her name is not in the contract
[01:05:04.200 --> 01:05:10.120] at all. And even the contract was initiated while they were married, but there is no reference in
[01:05:10.120 --> 01:05:15.560] any way. That doesn't, that doesn't necessarily mean that she didn't have a claim,
[01:05:17.000 --> 01:05:24.440] but her problem is she did own half the property, this community property state. However, when
[01:05:25.320 --> 01:05:32.600] couples are married, they don't both have to sign the document. If the property
[01:05:32.600 --> 01:05:40.440] is not in both their names, if it's in the husband's name and they're married and
[01:05:41.240 --> 01:05:45.400] because they're married, she has a right to half of it, but if it's in his name,
[01:05:46.280 --> 01:05:50.840] he can sell it without her signature. Yeah.
[01:05:51.880 --> 01:05:55.320] And that's between her and her husband. That's not your issue.
[01:05:57.080 --> 01:06:01.240] Before you purchase a property from someone, you don't have to go to them and say, Hey guys,
[01:06:01.240 --> 01:06:06.840] all right, are you too likely to get a divorce in the next 10 or 15 years?
[01:06:06.840 --> 01:06:10.360] Oh, I think I'd ask the next time.
[01:06:10.360 --> 01:06:11.560] Okay. Yeah.
[01:06:11.560 --> 01:06:16.280] Yeah. While I'm paying off this mortgage, because I sure don't want her coming back after me
[01:06:17.320 --> 01:06:20.120] and raising an issue. See, that would be ludicrous.
[01:06:21.560 --> 01:06:22.200] Yes.
[01:06:22.200 --> 01:06:31.400] And that's the issue she's trying to raise, that after you made the purchase in good faith,
[01:06:31.400 --> 01:06:37.320] they had personal issues, which you had no control and even no knowledge. That was their
[01:06:37.320 --> 01:06:41.720] business, not yours. And now she's trying to come back and take your property from you
[01:06:43.080 --> 01:06:45.080] because she's upset at what the husband did.
[01:06:47.320 --> 01:06:49.000] The lawyer had to know that.
[01:06:49.000 --> 01:06:51.000] Oh, yes. She knows the whole story.
[01:06:51.640 --> 01:06:55.720] So they're trying to steal your property. That's fraud.
[01:06:57.240 --> 01:07:05.880] So sue the lawyer. The wife's not going to have very deep pockets. Not necessarily.
[01:07:05.880 --> 01:07:16.280] The lawyer's going to have deep pockets. The lawyer has no power to perform an illegal act
[01:07:16.280 --> 01:07:28.280] in working for a client. They're absolutely forbidden in the Bar Association standards.
[01:07:30.360 --> 01:07:30.600] Yeah.
[01:07:31.480 --> 01:07:37.480] So he performed a legal act, a fraudulent act. So he acted on his own or her own,
[01:07:37.480 --> 01:07:43.000] if it's a male or female. So sue her or him, whatever he is.
[01:07:43.000 --> 01:07:52.760] Yeah, her. Yeah. Right. For fraud on the notarization. And OK.
[01:07:52.760 --> 01:07:55.960] No, for making a fraudulent claim against the property.
[01:07:56.760 --> 01:08:08.040] Oh, OK. Well, initially. Right. Then that's based on the 32.49 part.
[01:08:08.040 --> 01:08:22.760] Right. Well, it's not exactly based on that. It's based on Texas government code 51.903.
[01:08:24.360 --> 01:08:32.680] Oops. 51.901. Or is it 53.901? It's been too long since I quoted it. It's the last.
[01:08:32.680 --> 01:08:38.680] 51.901C. That's it.
[01:08:39.720 --> 01:08:45.560] Yes. That's exactly what it's based on. That's a special definition for fraud.
[01:08:47.160 --> 01:08:49.880] Yeah. Yeah.
[01:08:49.880 --> 01:08:56.040] And so you claim that and then sue the lawyer and get at her errors and omissions policy.
[01:08:57.640 --> 01:09:01.000] Yeah. For three times what they have the property listed for. Sure.
[01:09:01.000 --> 01:09:06.120] Yeah. And then the insurance company is likely to come to you and make a deal.
[01:09:07.480 --> 01:09:09.880] And the lawyer won't have anything to say about it.
[01:09:11.880 --> 01:09:19.000] Right. Right. OK. OK. Now, to see some sample lawsuits real quick. I'll get off the phone.
[01:09:19.000 --> 01:09:26.920] I know you have other people to see some samples of this kind. Just kind of search under
[01:09:26.920 --> 01:09:35.160] just do a malpractice suit. Malpractice real property. Malpractice real property. OK. OK.
[01:09:35.160 --> 01:09:56.440] OK. Good. I'll let you go on and I've got some homework to do on this and we'll talk again.
[01:10:05.160 --> 01:10:09.460] All right.
[01:10:35.160 --> 01:10:44.160] I will occupy my father's house till he returns
[01:10:44.160 --> 01:10:48.160] I will occupy my father's house
[01:10:48.160 --> 01:10:52.160] He has left me with the strength and wisdom
[01:10:52.160 --> 01:10:55.160] I will able my concern
[01:10:55.160 --> 01:10:59.160] I will occupy my father's house
[01:10:59.160 --> 01:11:03.160] I will occupy my father's house
[01:11:03.160 --> 01:11:06.160] till I see his face
[01:11:06.160 --> 01:11:10.160] I will occupy my father's house
[01:11:10.160 --> 01:11:14.160] I will guard these walls and fences
[01:11:14.160 --> 01:11:17.160] when he comes to take his place
[01:11:17.160 --> 01:11:21.160] I will occupy my father's house
[01:11:21.160 --> 01:11:24.160] I will occupy my father's house
[01:11:24.160 --> 01:11:27.160] He has left me with the strength and wisdom
[01:11:27.160 --> 01:11:30.160] I will occupy my father's house
[01:11:30.160 --> 01:11:35.160] I will occupy my father's house
[01:11:36.160 --> 01:11:40.160] I will occupy my father's house
[01:11:40.160 --> 01:11:47.160] I will occupy my father's house Along the loud and wicked
[01:11:47.160 --> 01:11:57.160] I will occupy my father's house To come and keep me sleepin' still true
[01:11:57.160 --> 01:12:08.160] I will occupy my father's house There are those in this world who would harm
[01:12:08.160 --> 01:12:12.160] up They will not believe me
[01:12:12.160 --> 01:12:19.160] I will occupy my father's house Cause when I occupy my father's house
[01:12:19.160 --> 01:12:27.160] There's more wind in to his hair I will occupy my father's house
[01:12:27.160 --> 01:12:31.160] I will occupy my father's house To come and keep me sleepin' still true
[01:12:31.160 --> 01:12:35.160] I will occupy my father's house There are those in this world who would harm
[01:12:35.160 --> 01:12:38.160] up To come and keep me sleepin' still true
[01:12:38.160 --> 01:12:45.160] I will occupy my father's house Cause when I occupy my father's house
[01:12:45.160 --> 01:12:50.160] There's more wind in to his hair I will occupy my father's house
[01:12:50.160 --> 01:12:57.160] I will occupy my father's house To come and keep me sleepin' still true
[01:12:57.160 --> 01:13:02.160] I will occupy my father's house There are those in this world who would harm
[01:13:02.160 --> 01:13:09.160] Okay, we are back, Randy Kelton, Rear Wall Radio, and we are going to be talking about
[01:13:33.160 --> 01:13:34.160] that.
[01:13:34.160 --> 01:13:35.160] We're having storms where I'm at.
[01:13:35.160 --> 01:13:40.400] My power dipped out and crashed my system, so it took me a minute to get back up and
[01:13:40.400 --> 01:13:41.400] online.
[01:13:41.400 --> 01:13:51.880] I apologize, Boris, but, okay, Deborah, you want to take us to the next caller, Jim from
[01:13:51.880 --> 01:13:52.880] California.
[01:13:52.880 --> 01:13:53.880] Hello, Jim.
[01:13:53.880 --> 01:13:54.880] Yeah.
[01:13:54.880 --> 01:13:55.880] Hello, Jim.
[01:13:55.880 --> 01:14:02.880] Okay, then take me to Olivier.
[01:14:02.880 --> 01:14:04.880] Hello?
[01:14:04.880 --> 01:14:08.880] Hello, Olivier.
[01:14:08.880 --> 01:14:15.880] How are you doing?
[01:14:15.880 --> 01:14:21.880] I'm doing well, I've been better.
[01:14:21.880 --> 01:14:27.880] We're having little storms here, and it knocked the power out there for a second.
[01:14:27.880 --> 01:14:32.880] Okay, what do you have for us today?
[01:14:32.880 --> 01:14:38.880] Um, okay, so this is involving Charles O'Donnell.
[01:14:38.880 --> 01:14:46.880] I'm coming to figure out that the court system is pretty much rigged and crooked,
[01:14:46.880 --> 01:14:51.880] and in order for me to do what I'm going to have to do, I'm probably going to have
[01:14:51.880 --> 01:14:57.880] to go sit down and sit down for a little while, while I have to process my case, but it was
[01:14:57.880 --> 01:15:02.880] interesting, because all the events that's been going on, all the events that's been
[01:15:02.880 --> 01:15:10.880] going on, has been leading to a few people to an inside preview view and knowledge of
[01:15:10.880 --> 01:15:11.880] what's going on.
[01:15:11.880 --> 01:15:16.880] And O'Donnell had two trials this week.
[01:15:16.880 --> 01:15:20.880] One was for a stopway.
[01:15:20.880 --> 01:15:26.880] He got charged with possession, and he used the right of welcome motion.
[01:15:26.880 --> 01:15:33.880] And the judge, I mean, I don't know what time it was, but I want to get to the fact
[01:15:33.880 --> 01:15:36.880] that, to the fact that I'm trying to make.
[01:15:36.880 --> 01:15:44.880] But the judge basically instructed the jury to ignore Troy O'Donnell's constitutional
[01:15:44.880 --> 01:15:51.880] argument, and those are not, those arguments are not law, and they should not let those
[01:15:51.880 --> 01:15:57.880] arguments inflict their verdict.
[01:15:57.880 --> 01:16:09.880] So, the next trial, the next day, we get there, he gets there, because he got locked up the
[01:16:09.880 --> 01:16:13.880] day before, so he didn't have, he just had the same shows.
[01:16:13.880 --> 01:16:23.880] I came a little late, but by the time I came, I saw the city judge that O'Donnell was
[01:16:23.880 --> 01:16:32.880] in front of, I saw his assistant, the clerks from the city court were there, the city attorney
[01:16:32.880 --> 01:16:35.880] was there, his assistant was there.
[01:16:35.880 --> 01:16:39.880] I'm sitting around like, what is going on here?
[01:16:39.880 --> 01:16:43.880] Your music's coming up.
[01:16:43.880 --> 01:16:48.880] Okay, I don't have my board up, so.

[01:17:59.880 --> 01:18:00.880] I love logos.
[01:18:00.880 --> 01:18:03.880] Without the shows on this network, I'd be almost as ignorant as my friends.
[01:18:03.880 --> 01:18:06.880] I'm so addicted to the truth now that there's no going back.
[01:18:06.880 --> 01:18:07.880] I need my truth fixed.
[01:18:07.880 --> 01:18:12.880] I'd be lost without logos, and I really want to help keep this network on the air.
[01:18:12.880 --> 01:18:16.880] I'd love to volunteer as a show producer, but I'm a bit of a Luddite, and I really don't
[01:18:16.880 --> 01:18:19.880] have any money to give because I spend it all on supplements.
[01:18:19.880 --> 01:18:21.880] How can I help logos?
[01:18:21.880 --> 01:18:23.880] Well, I'm glad you asked.
[01:18:23.880 --> 01:18:26.880] Whenever you order anything from Amazon, you can help logos.
[01:18:26.880 --> 01:18:28.880] You can order your supplies or holiday gifts.
[01:18:28.880 --> 01:18:30.880] First thing you do is clear your cookies.
[01:18:30.880 --> 01:18:34.880] Now, go to LogosRadioNetwork.com.

[01:18:37.880 --> 01:18:42.880] Now, when you order anything from Amazon, you use that link, and Logos gets a few pesos.
[01:18:42.880 --> 01:18:43.880] Do I pay extra?
[01:18:43.880 --> 01:18:44.880] No.
[01:18:44.880 --> 01:18:46.880] Do I have to do anything different when I order?
[01:18:46.880 --> 01:18:47.880] No.
[01:18:47.880 --> 01:18:48.880] Can I use my Amazon Prime?
[01:18:48.880 --> 01:18:49.880] No.
[01:18:49.880 --> 01:18:50.880] I mean, yes.
[01:18:50.880 --> 01:18:51.880] Wow.
[01:18:51.880 --> 01:18:53.880] Giving without doing anything or spending any money.
[01:18:53.880 --> 01:18:55.880] This is perfect.
[01:18:55.880 --> 01:18:56.880] Thank you so much.
[01:18:56.880 --> 01:18:57.880] You're welcome.
[01:18:57.880 --> 01:19:06.880] Happy Holidays, Logos.
[01:19:27.880 --> 01:19:49.880] Thank you.
[01:19:57.880 --> 01:20:27.000] Okay, we are back.
[01:20:27.000 --> 01:20:33.000] This is Randy Kelton, Rude Law Radio, and we're talking to Olivier in Tennessee.
[01:20:33.000 --> 01:20:34.000] Hello?
[01:20:34.000 --> 01:20:35.000] No.
[01:20:35.000 --> 01:20:36.000] Okay.
[01:20:36.000 --> 01:20:38.000] Go ahead, Olivier.
[01:20:38.000 --> 01:20:39.000] Okay.
[01:20:39.000 --> 01:20:41.000] So, where was I?
[01:20:41.000 --> 01:20:42.000] Okay.
[01:20:42.000 --> 01:20:53.200] I've seen all these people in here, so in my head, because I'm in it, and I'm so involved
[01:20:53.200 --> 01:20:57.200] in it, so I'm thinking bad thoughts.
[01:20:57.200 --> 01:20:58.200] I honestly got to say.
[01:20:58.200 --> 01:20:59.200] I'm in there.
[01:20:59.200 --> 01:21:00.200] I'm looking around.
[01:21:00.200 --> 01:21:01.200] I'm like, man, this is a shame.
[01:21:01.200 --> 01:21:07.880] So, y'all come in here to see this horse play, and then, in my head, I'm thinking, like,
[01:21:07.880 --> 01:21:10.680] you wanted to come and be amused by this horse play?
[01:21:10.680 --> 01:21:18.080] So, I'm sitting there just looking at them as the judge is giving all this bad instruction,
[01:21:18.080 --> 01:21:28.600] telling the jury that what he's saying is not law, and the city judge turned red, like,
[01:21:28.600 --> 01:21:33.360] you know, getting mad, and I know the clerks are interested, because they've been reading
[01:21:33.360 --> 01:21:38.600] all my lawsuits, and, you know, they have an inside view of what's going on, but there's
[01:21:38.600 --> 01:21:44.640] something else that's going on that I did not know, and I didn't realize until today.
[01:21:44.640 --> 01:21:54.360] I got, in the mail, a brief from one of the towing companies that the courts or the judge
[01:21:54.360 --> 01:21:55.360] dismissed.
[01:21:55.360 --> 01:22:03.000] He dismissed my case against them immediately, and I got a brief from them today from an
[01:22:03.000 --> 01:22:08.440] attorney answering the appeals court.
[01:22:08.440 --> 01:22:18.320] So, that means, because everybody in that group know what's going on, so that means
[01:22:18.320 --> 01:22:23.640] that they got that information, and all of them are on suit, still, and have to answer
[01:22:23.640 --> 01:22:28.680] in the appeals court, even though they did all that they did in the lower court.
[01:22:28.680 --> 01:22:31.640] So, I didn't realize that, so that's...
[01:22:31.640 --> 01:22:36.960] Now I'm realizing that they all came to court, because now they're realizing, wait
[01:22:36.960 --> 01:22:40.480] a minute, there must be something to what Mr. Liggett is writing.
[01:22:40.480 --> 01:22:42.360] Number one, it makes sense.
[01:22:42.360 --> 01:22:48.320] Number two, he just wrote a mandamus, and he got the mayor and the chief of police,
[01:22:48.320 --> 01:22:55.800] and now the appeals court is sending the city office paperwork telling them, you know, to
[01:22:55.800 --> 01:22:56.800] answer these...
[01:22:56.800 --> 01:22:58.040] I didn't even know.
[01:22:58.040 --> 01:23:02.800] I thought they got away with it, but apparently the appeals court is not letting them get
[01:23:02.800 --> 01:23:04.080] away with it.
[01:23:04.080 --> 01:23:09.160] And then when I talked to Lozano the other day after the trial was over, he told me,
[01:23:09.160 --> 01:23:11.800] he's like, man, this is weird.
[01:23:11.800 --> 01:23:15.120] They put me in the holding cell, and then after they put me in the holding cell, 10
[01:23:15.120 --> 01:23:21.320] minutes later, an officer came up to me and he said, hey, somebody wants to give you a
[01:23:21.320 --> 01:23:22.320] jacket.
[01:23:22.320 --> 01:23:23.320] He's like, what?
[01:23:23.320 --> 01:23:25.320] He's like, yeah, somebody wants a huge jacket, they're outside.
[01:23:25.320 --> 01:23:26.320] He's like, who?
[01:23:26.320 --> 01:23:27.320] Are they white?
[01:23:27.320 --> 01:23:29.320] He's like, yeah, they're white.
[01:23:29.320 --> 01:23:32.120] He's like, what the heck is going on?
[01:23:32.120 --> 01:23:40.160] So they brought him back out to the court, and it was the city, it was the city judge.
[01:23:40.160 --> 01:23:41.880] It was the city judge.
[01:23:41.880 --> 01:23:49.360] The city judge put, like, the jacket that I saw Lozano in, it looked like it was a $3,000
[01:23:49.360 --> 01:23:50.360] jacket.
[01:23:50.360 --> 01:23:57.400] And he told me, he put the jacket on him, he said, he gave him a big smile and a big
[01:23:57.400 --> 01:23:58.400] thumbs up.
[01:23:58.400 --> 01:24:00.400] I'm sitting here like, what?
[01:24:00.400 --> 01:24:01.400] He said, yeah.
[01:24:01.400 --> 01:24:03.680] And I'm like, man, they gave me all the confidence in the world.
[01:24:03.680 --> 01:24:09.040] He said, once that happened, I'm like, wait a minute, so that jacket that I saw you in
[01:24:09.040 --> 01:24:10.040] was his.
[01:24:10.040 --> 01:24:11.760] You're like, yeah.
[01:24:11.760 --> 01:24:14.560] So basically, he came in there in support.
[01:24:14.560 --> 01:24:19.840] I thought they came to make sure that the job got done.
[01:24:19.840 --> 01:24:24.040] So I had to hold two of the things.
[01:24:24.040 --> 01:24:30.600] I think they actually came to see, you know, this actually play out because we've done
[01:24:30.600 --> 01:24:32.240] all the legwork.
[01:24:32.240 --> 01:24:34.760] We've petitioned them properly.
[01:24:34.760 --> 01:24:41.400] They know me, you know, because I'm cutthroat with it, you know what I'm saying?
[01:24:41.400 --> 01:24:42.400] Do the same with the jail.
[01:24:42.400 --> 01:24:46.360] I'm gonna make a scene about it, and I'm gonna come in over there and make them slap paperwork
[01:24:46.360 --> 01:24:48.360] and make it loud.
[01:24:48.360 --> 01:24:51.680] I do it so bad that they call police on me after I leave.
[01:24:51.680 --> 01:24:54.720] They don't call police on me when I'm dead.
[01:24:54.720 --> 01:24:57.160] They call after I'm gone.
[01:24:57.160 --> 01:25:00.960] So now, after I talk to them, I'm like, wait a minute.
[01:25:00.960 --> 01:25:08.520] So they were all there in favor of what you were doing, and then the judge, his demeanor
[01:25:08.520 --> 01:25:14.920] was so different because the trial before, he was outright rude and everything.
[01:25:14.920 --> 01:25:21.360] This time, since everybody was in there, the city attorney walked in the door when it was
[01:25:21.360 --> 01:25:22.360] about to be over.
[01:25:22.360 --> 01:25:23.720] He was like, did I miss it?
[01:25:23.720 --> 01:25:26.680] I'm looking at him like, what?
[01:25:26.680 --> 01:25:28.480] They were supposed to have city court that day.
[01:25:28.480 --> 01:25:29.960] They closed city court.
[01:25:29.960 --> 01:25:34.940] Did they have city court Tuesday through Friday?
[01:25:34.940 --> 01:25:36.720] Only on Monday did they don't have court.
[01:25:36.720 --> 01:25:38.360] They did not have court that day.
[01:25:38.360 --> 01:25:45.960] Everybody in the city court was in Lozano's trial.
[01:25:45.960 --> 01:25:48.920] So something's going on.
[01:25:48.920 --> 01:25:57.400] I guess because the appeals court has picked up everybody that I put on suit.
[01:25:57.400 --> 01:26:03.920] So now that means the mayor is on suit from me on three different accounts.
[01:26:03.920 --> 01:26:09.160] The towing company that got picked up on that case, there was three other defendants, which
[01:26:09.160 --> 01:26:19.560] included the city, the police department, and the police officer.
[01:26:19.560 --> 01:26:24.960] So that means all of them got picked up on suit, and everybody had an answer.
[01:26:24.960 --> 01:26:30.900] So now that towing company that made me pay $120, I know they lost their money when they
[01:26:30.900 --> 01:26:36.560] had to pay this attorney to answer this appeal, which whatever answer they have is not going
[01:26:36.560 --> 01:26:42.560] to be good because you don't have the proper paperwork.
[01:26:42.560 --> 01:26:43.560] Hello?
[01:26:43.560 --> 01:26:44.560] Okay.
[01:26:44.560 --> 01:26:50.960] We are having some issues.
[01:26:50.960 --> 01:26:52.880] It looks like my internet went down again.
[01:26:52.880 --> 01:26:54.880] Olivier, are you there?
[01:26:54.880 --> 01:26:56.520] Yeah, I'm there.
[01:26:56.520 --> 01:26:57.520] Okay.
[01:26:57.520 --> 01:27:02.120] I was just yakking away to you as my internet went down and I couldn't tell.
[01:27:02.120 --> 01:27:03.120] So okay.
[01:27:03.120 --> 01:27:04.120] Where are we?
[01:27:04.120 --> 01:27:08.360] I may have to do the rest of the show on this phone.
[01:27:08.360 --> 01:27:13.840] So if my sound is not as good, it's because I'm not on my studio equipment.
[01:27:13.840 --> 01:27:14.840] Okay.
[01:27:14.840 --> 01:27:19.880] Where were we?
[01:27:19.880 --> 01:27:26.040] What was the last that you heard?
[01:27:26.040 --> 01:27:35.240] You were talking about how much nicer the judge was when this time as opposed to the
[01:27:35.240 --> 01:27:40.760] first time you were in front of him.
[01:27:40.760 --> 01:27:41.760] Right.
[01:27:41.760 --> 01:27:43.760] And okay, so...
[01:27:43.760 --> 01:27:44.760] And I came...
[01:27:44.760 --> 01:27:51.920] In the mail today, I got this brief from this towing company that was taking off suit immediately.
[01:27:51.920 --> 01:27:58.640] And so that means the appeals court here, I guess, is really doing their job and holding
[01:27:58.640 --> 01:28:02.520] everybody accountable, because I did not expect to get a brief from them.
[01:28:02.520 --> 01:28:07.080] So they had to pay a fine to answer this brief.
[01:28:07.080 --> 01:28:09.060] So since they had sent...
[01:28:09.060 --> 01:28:14.080] So that means since the appeals court communicated with them, that means they picked up all the
[01:28:14.080 --> 01:28:15.800] other suits also.
[01:28:15.800 --> 01:28:20.560] That means everybody got a notice.
[01:28:20.560 --> 01:28:21.960] Mm-hmm.
[01:28:21.960 --> 01:28:24.440] So did you look at the brief?
[01:28:24.440 --> 01:28:27.160] Yes, I did.
[01:28:27.160 --> 01:28:32.880] Did they give an indication of why they didn't respond?
[01:28:32.880 --> 01:28:33.880] They...
[01:28:33.880 --> 01:28:41.200] Well, they said that the judge correctly dismissed them off the suit.
[01:28:41.200 --> 01:28:48.120] Oh, and that was it?
[01:28:48.120 --> 01:28:53.360] I take it they have plenty of case law to support that.
[01:28:53.360 --> 01:28:55.360] Mm-hmm.
[01:28:55.360 --> 01:28:57.480] Right.
[01:28:57.480 --> 01:29:03.600] But they can't get past a sua sponte dismissal of a pro se litigant.
[01:29:03.600 --> 01:29:04.600] Okay.
[01:29:04.600 --> 01:29:08.760] So what's that going to mean?
[01:29:08.760 --> 01:29:09.760] Okay.
[01:29:09.760 --> 01:29:12.480] Well, it means...
[01:29:12.480 --> 01:29:20.040] Even if the towing company is dismissed, that doesn't necessarily hurt you, because your
[01:29:20.040 --> 01:29:22.560] claim is still the same.
[01:29:22.560 --> 01:29:24.120] Who else didn't...
[01:29:24.120 --> 01:29:28.800] Did anyone respond to the suit?
[01:29:28.800 --> 01:29:33.880] Yeah, the city of Tarzeville.
[01:29:33.880 --> 01:29:34.880] Okay.
[01:29:34.880 --> 01:29:37.880] So they're the only ones that responded.
[01:29:37.880 --> 01:29:38.880] Mm-hmm.
[01:29:38.880 --> 01:29:43.440] What were their basic, I'm sure they had some appointment of defense.
[01:29:43.440 --> 01:29:45.440] Your music is coming out.
[01:29:45.440 --> 01:29:47.440] You're about to go on break.
[01:29:47.440 --> 01:29:48.440] Okay.
[01:29:48.440 --> 01:29:49.440] Okay.
[01:29:49.440 --> 01:29:50.440] This is...
[01:29:50.440 --> 01:29:51.440] Thank you.
[01:29:51.440 --> 01:29:52.440] I'm on my phone again, so I can't see the clock.
[01:29:52.440 --> 01:29:53.440] This is Randy Kelton.
[01:29:53.440 --> 01:29:54.440] We're on radio.
[01:29:54.440 --> 01:29:55.440] We'll be right back.
[01:29:55.440 --> 01:29:56.440] Is it iPhone or iSpy?
[01:29:56.440 --> 01:30:09.080] In Germany, one man had to file a lawsuit to learn how his cell phone carrier was tracking
[01:30:09.080 --> 01:30:10.720] his every move 24-7.
[01:30:10.720 --> 01:30:16.060] I'm Dr. Catherine Albrecht, and I'll have the creepy details in a moment.
[01:30:16.060 --> 01:30:17.780] Privacy is under attack.
[01:30:17.780 --> 01:30:21.380] When you give up data about yourself, you'll never get it back again.
[01:30:21.380 --> 01:30:26.360] And once your privacy is gone, you'll find your freedoms will start to vanish too.
[01:30:26.360 --> 01:30:31.480] So protect your rights, say no to surveillance, and keep your information to yourself.
[01:30:31.480 --> 01:30:32.480] Privacy.
[01:30:32.480 --> 01:30:34.140] It's worth hanging on to.
[01:30:34.140 --> 01:30:39.760] This message is brought to you by StartPage.com, the private search engine alternative to Google,
[01:30:39.760 --> 01:30:41.500] Yahoo, and Bing.
[01:30:41.500 --> 01:30:43.180] Start over with StartPage.
[01:30:43.180 --> 01:30:48.500] Do you know how much data your cell phone company collects on you?
[01:30:48.500 --> 01:30:53.040] In Germany, Green Party politician Malte Spitz didn't, so he asked.
[01:30:53.040 --> 01:30:55.780] When his carrier objected, he sued.
[01:30:55.780 --> 01:30:58.660] Taking people's whereabouts is what phone companies do.
[01:30:58.660 --> 01:31:03.240] To route calls efficiently, they ping customers' cell phones every few seconds.
[01:31:03.240 --> 01:31:07.520] But when a court ordered Deutsche Telekom to cough up its records on Spitz, what he
[01:31:07.520 --> 01:31:09.280] learned was shocking.
[01:31:09.280 --> 01:31:15.080] In a six-month period, the company had logged his location 35,000 times, often to within
[01:31:15.080 --> 01:31:18.240] a few hundred yards of his precise location.
[01:31:18.240 --> 01:31:21.480] So the next time you turn on your cell phone, know this.
[01:31:21.480 --> 01:31:24.480] Your carrier is not only watching, it's taking notes.
[01:31:24.480 --> 01:31:31.480] I'm Dr. Catherine Albrecht for StartPage.com, the world's most private search engine.
[01:31:31.480 --> 01:31:32.480] I lost my son.
[01:31:32.480 --> 01:31:33.480] My nephew.
[01:31:33.480 --> 01:31:34.480] My uncle.
[01:31:34.480 --> 01:31:35.480] My son.
[01:31:35.480 --> 01:31:36.480] On September 11th, 2001.
[01:31:36.480 --> 01:31:39.760] Most people don't know that a third tower fell on September 11th.
[01:31:39.760 --> 01:31:43.880] World Trade Center 7, a 47-story skyscraper, was not hit by a plane.
[01:31:43.880 --> 01:31:47.760] Although the official explanation is that fire brought down Building 7.
[01:31:47.760 --> 01:31:52.560] Over 1,200 architects and engineers have looked into the evidence and believe there is more
[01:31:52.560 --> 01:31:53.560] to the story.
[01:31:53.560 --> 01:31:58.840] For injustice to my son, my uncle, my nephew, my son, go to buildingwhat.org.
[01:31:58.840 --> 01:32:01.520] Why it fell, why it matters, and what you can do.
[01:32:01.520 --> 01:32:03.840] Hey, it's Danny here for Hill Country Home Improvements.
[01:32:03.840 --> 01:32:07.120] Did your home receive hail or wind damage from the recent storms?
[01:32:07.120 --> 01:32:10.800] Come on, we all know the government caused it with their chemtrails, but good luck getting
[01:32:10.800 --> 01:32:11.800] them to pay for it.
[01:32:11.800 --> 01:32:15.400] Okay, I might be kidding about the chemtrails, but I'm serious about your roof.
[01:32:15.400 --> 01:32:19.200] That's why you have insurance, and Hill Country Home Improvements can handle the claim for
[01:32:19.200 --> 01:32:21.960] you with little to no out-of-pocket expense.
[01:32:21.960 --> 01:32:26.200] And we accept Bitcoin as a multi-year A-plus member of the Better Business Bureau with
[01:32:26.200 --> 01:32:27.520] zero complaints.
[01:32:27.520 --> 01:32:31.880] You can trust Hill Country Home Improvements to handle your claim and your roof right the
[01:32:31.880 --> 01:32:32.960] first time.
[01:32:32.960 --> 01:32:41.620] Just call 512-992-8745 or go to hillcountryhomeimprovements.com, mention the crypto show and get $100 off,
[01:32:41.620 --> 01:32:46.240] and we'll donate another $100 to the Logos Radio Network to help continue this programming.
[01:32:46.240 --> 01:32:51.380] So if those out-of-town roofers come knockin', your door should be lockin'.
[01:32:51.380 --> 01:32:57.280] That's 512-992-8745 or hillcountryhomeimprovements.com.
[01:32:57.280 --> 01:32:59.640] Discounts are based on full roof replacement.
[01:32:59.640 --> 01:33:01.640] May not actually be kidding about chemtrails.
[01:33:01.640 --> 01:33:22.360] You are listening to the Logos Radio Network, LogosRadioNetwork.com.
[01:33:22.360 --> 01:33:38.320] We'll be right back to the Logos Radio Network, and we'll be right back to the Logos Radio
[01:33:38.320 --> 01:33:39.320] Network.
[01:33:39.320 --> 01:34:07.380] Okay, we
[01:34:07.380 --> 01:34:08.380] are back.
[01:34:08.380 --> 01:34:14.440] My name is Randy Kelton, the Rule of Law Radio, and we're talking to Olivier in Tennessee.
[01:34:14.440 --> 01:34:16.140] And thank you for the heads up there.
[01:34:16.140 --> 01:34:22.380] I've got the page back up, but it may go down again, so if it does, I have my cell phone.
[01:34:22.380 --> 01:34:25.260] I'll just switch over to it.
[01:34:25.260 --> 01:34:35.340] Okay, so what's your feel now, I take it that, now wait a minute.
[01:34:35.340 --> 01:34:44.260] If you just, if you already got the brief, then everybody's had this for a while.
[01:34:44.260 --> 01:34:53.260] Yeah, that's why I thought they came there to make sure the job got done at court.
[01:34:53.260 --> 01:35:01.300] But what's actually happened is because the appeal court is making everybody answer, everybody
[01:35:01.300 --> 01:35:10.780] on the inside could not resist but to come see these arguments play out in court, because
[01:35:10.780 --> 01:35:16.140] I've submitted that mandamus, and they know me and Troy are two peas in the park.
[01:35:16.140 --> 01:35:20.060] You mess with Troy, here come Oliver, you mess with Oliver, here come Troy.
[01:35:20.060 --> 01:35:23.640] Yeah, I was real pleased with Troy.
[01:35:23.640 --> 01:35:29.300] Most of the listeners doesn't know what was going on, but a couple weeks ago, Olivier
[01:35:29.300 --> 01:35:34.500] got arrested again, and Troy was all over him.
[01:35:34.500 --> 01:35:37.020] He was calling me and asking me what to do.
[01:35:37.020 --> 01:35:41.580] He went to the clerk, and the clerk wouldn't take his complaints, and I told him, take
[01:35:41.580 --> 01:35:47.980] out your cell phone, call 911, and doggone, if he didn't do it, I was real pleased with
[01:35:47.980 --> 01:35:48.980] Troy.
[01:35:48.980 --> 01:35:49.980] Right.
[01:35:49.980 --> 01:35:56.300] It'd be nice to know next time I go to jail, I got somebody like that in my corner.
[01:35:56.300 --> 01:36:02.060] And actually I do, I have Ken Magnussen.
[01:36:02.060 --> 01:36:08.460] I accuse him of being difficult, but if I get in trouble, he's difficult to people in
[01:36:08.460 --> 01:36:12.260] my benefit, so it's always nice to have one of those.
[01:36:12.260 --> 01:36:17.620] Okay, so what's the upshot?
[01:36:17.620 --> 01:36:20.020] What do you think's gonna happen now?
[01:36:20.020 --> 01:36:34.260] Well, the fact that the city judge came out there and is in support, it has to say something.
[01:36:34.260 --> 01:36:41.220] And I noticed that, now that I got the picture straight, I noticed that when the judge was
[01:36:41.220 --> 01:36:49.260] doing things that was not right, the city judge was turning red as a fire hydrant.
[01:36:49.260 --> 01:36:57.740] He was turning red as a fire hydrant, because I didn't see the transaction between the city
[01:36:57.740 --> 01:36:58.740] judge and Lozano.
[01:36:58.740 --> 01:37:05.300] I didn't see, Lozano said he treated him like his son, he walked in there, dressed him up
[01:37:05.300 --> 01:37:11.300] real nice, looked at him like, I understand what you're doing, I'm proud of you, and gave
[01:37:11.300 --> 01:37:12.300] him a big thumbs up.
[01:37:12.300 --> 01:37:13.300] I'm like, are you serious?
[01:37:13.300 --> 01:37:17.900] He said, yes, man, I'm serious, he said, I can't believe it, I don't know what is going
[01:37:17.900 --> 01:37:18.900] on.
[01:37:18.900 --> 01:37:24.660] This is good news.
[01:37:24.660 --> 01:37:27.300] This is what I try to get people to realize.
[01:37:27.300 --> 01:37:34.620] When you go after him, and Olivier, he's been through a lot here, they really come after
[01:37:34.620 --> 01:37:35.620] him.
[01:37:35.620 --> 01:37:40.920] There's very few people that we've had on the show that had the police after them as
[01:37:40.920 --> 01:37:44.980] hard as they've been after you.
[01:37:44.980 --> 01:37:49.480] And you never backed up from them, you never, never eased off on them, just stayed right
[01:37:49.480 --> 01:37:50.480] after them.
[01:37:50.480 --> 01:37:55.740] And now everything's, you've reached that point to where it's turning a corner.
[01:37:55.740 --> 01:38:04.020] Yeah, well, ever since I heard Eddie about three years ago, and he made the point that
[01:38:04.020 --> 01:38:12.180] we're still slaves, we're not free, that set off a freedom button for me.
[01:38:12.180 --> 01:38:16.380] It was like, you know what, I'm not gonna let nobody talk to me like that, you know
[01:38:16.380 --> 01:38:17.380] what I'm saying?
[01:38:17.380 --> 01:38:20.580] I'm like, Eddie, you ain't gonna talk to me like that, I'm gonna do something about it.
[01:38:20.580 --> 01:38:21.580] I was embarrassed.
[01:38:21.580 --> 01:38:22.580] I'm like, wait a minute, I'm not free?
[01:38:22.580 --> 01:38:23.580] Hold on, why?
[01:38:23.580 --> 01:38:27.380] After I understood, I'm like, okay, I'm gonna do something about it.
[01:38:27.380 --> 01:38:30.100] I don't care if it hurts, because I'm not free anyways.
[01:38:30.100 --> 01:38:36.180] So I might as well go sit in the jail cell.
[01:38:36.180 --> 01:38:39.140] How do you feel now?
[01:38:39.140 --> 01:38:44.420] This is, I got a ticket the other day, first time in a long time, I was in Dallas, North
[01:38:44.420 --> 01:38:49.740] Dallas in Highland Park, one of the ritziest areas, and they had a little speed trap where
[01:38:49.740 --> 01:38:54.100] you turn alongside the interstate on an access road.
[01:38:54.100 --> 01:38:58.460] And they had a sign there where there's no way you can see it when you're turning in,
[01:38:58.460 --> 01:39:01.460] because you're looking where you're going, you can't see the sign.
[01:39:01.460 --> 01:39:03.580] He was sitting there waiting for me.
[01:39:03.580 --> 01:39:09.700] But when the lights came on me, I looked in the rear view mirror and I thought, oh boy,
[01:39:09.700 --> 01:39:15.700] Bubba, you're gonna have yourself a good time, you don't know what you're getting into.
[01:39:15.700 --> 01:39:19.920] So I don't get that butterflies in the pit of my stomach anymore, I don't worry that
[01:39:19.920 --> 01:39:22.780] these guys are coming after me.
[01:39:22.780 --> 01:39:26.600] And go to jail, yeah, I've been thrown in jail a few times.
[01:39:26.600 --> 01:39:30.060] That's not such a big deal anymore either.
[01:39:30.060 --> 01:39:34.980] How do you feel when they come after you now?
[01:39:34.980 --> 01:39:45.380] I feel rich, I feel rich because from doing the process so many times, and it's coming
[01:39:45.380 --> 01:39:52.580] in slow, but I feel confident to know that, hey, I'll go file paperwork on you, I'll go
[01:39:52.580 --> 01:39:59.980] file paperwork on you, and plus I got people who supported me in the background with like
[01:39:59.980 --> 01:40:00.980] finances.
[01:40:00.980 --> 01:40:05.780] Or whenever I get depressed, I'm like, nah, I got your back, we was here to do this.
[01:40:05.780 --> 01:40:07.780] I'm like, okay, thanks.
[01:40:07.780 --> 01:40:14.360] So all that supportiveness in the back and realizing that once this, it has to cash out
[01:40:14.360 --> 01:40:16.340] because it's written that way.
[01:40:16.340 --> 01:40:27.540] And I'm following the script, so it feels like another check, it's another check.
[01:40:27.540 --> 01:40:35.180] How much of my liberty do you think you could afford before you get the lesson?
[01:40:35.180 --> 01:40:38.020] That's a good way to look at it.
[01:40:38.020 --> 01:40:39.980] I can't tell you how proud I am.
[01:40:39.980 --> 01:40:44.260] You know, I do this show and you're the reason I do this show.
[01:40:44.260 --> 01:40:48.820] Every once in a while we come across someone who will really take them on.
[01:40:48.820 --> 01:40:54.620] Everybody else who's listening, not everybody can do this.
[01:40:54.620 --> 01:40:58.860] I have friends who would like to be able to do more, but they got wives, they got children,
[01:40:58.860 --> 01:41:03.180] they got mortgages, they got a job they got to go to every day.
[01:41:03.180 --> 01:41:07.620] They just don't have the option of doing what they want to do.
[01:41:07.620 --> 01:41:12.540] You know what, you're right, because the cop said that the other day when we was walking
[01:41:12.540 --> 01:41:13.540] through the beeper.
[01:41:13.540 --> 01:41:15.260] You're like, man, you're out here every day.
[01:41:15.260 --> 01:41:16.900] You're like, do you have a job?
[01:41:16.900 --> 01:41:17.900] You make money?
[01:41:17.900 --> 01:41:23.300] I'm like, no, I said I'm rich, that's why I'm coming here, this is my job.
[01:41:23.300 --> 01:41:24.860] I'm doing it for you also.
[01:41:24.860 --> 01:41:32.340] You're like, man, I wish I was you.
[01:41:32.340 --> 01:41:40.900] So you know, most people have other commitments and we do the show to give them some remedy,
[01:41:40.900 --> 01:41:47.620] but I'm always hoping to find that half a percent of the population who's ready to take
[01:41:47.620 --> 01:41:50.140] these guys on.
[01:41:50.140 --> 01:42:01.220] And I have a few of these and you're one of them and this is how we'll make things change.
[01:42:01.220 --> 01:42:10.100] And when we, as I get the traffic tool put together, we're stitching together the last
[01:42:10.100 --> 01:42:16.700] pieces of it right now, turns always, you know, I'm an engineer, so I understand.
[01:42:16.700 --> 01:42:21.660] You look at putting something together and you get this great idea and I've had people
[01:42:21.660 --> 01:42:27.180] come to me with great ideas and say, oh, don't tell anybody, don't tell anybody.
[01:42:27.180 --> 01:42:30.580] And I tell them, spare me that garbage.
[01:42:30.580 --> 01:42:33.540] It's one thing to have an idea.
[01:42:33.540 --> 01:42:38.800] It's quite another thing to get that idea turned into something real because you run
[01:42:38.800 --> 01:42:44.980] into these annoying little details and there's always a million of them.
[01:42:44.980 --> 01:42:50.700] If we're struggling through the minor, the final details, well, at least the final details
[01:42:50.700 --> 01:42:59.220] we need to get the first piece up and running because what we're doing really is complex.
[01:42:59.220 --> 01:43:01.220] So we're getting the first step ready.
[01:43:01.220 --> 01:43:05.140] Once we get that step ready, I'm going to be looking for people in different states
[01:43:05.140 --> 01:43:08.120] and yours is one of them.
[01:43:08.120 --> 01:43:15.620] If we can start putting the police in front of the courts themselves every time they write
[01:43:15.620 --> 01:43:19.780] a citation, we will change everything.
[01:43:19.780 --> 01:43:24.820] And there's a secondary strategy behind that, and I'll explain that when we come back from
[01:43:24.820 --> 01:43:25.820] break.
[01:43:25.820 --> 01:43:32.980] This is Randy Kelton, Denver Stevens, The Root of Law Radio, call in number 512-646-1984,
[01:43:32.980 --> 01:43:37.780] and hopefully that bad weather's passed and we won't have any more outages.
[01:43:37.780 --> 01:43:46.140] And it's a good time to go to the Logos Radio Network and check out our fundraiser.
[01:43:46.140 --> 01:43:51.520] We need to, Deborah's in the background right now fixing a computer as we speak, so we need
[01:43:51.520 --> 01:43:53.820] some help to keep all this equipment up.
[01:43:53.820 --> 01:44:02.500] We'll be right back.

[01:46:22.420 --> 01:46:36.700] Okay, we are back.
[01:46:36.700 --> 01:46:45.460] Randy Kelton, Debra Stevens, Rule of Law Radio, and we're talking to Olivier in Tennessee.
[01:46:45.460 --> 01:46:52.940] One of the things that I find the most effective is, Olivier, you've got some horrible background
[01:46:52.940 --> 01:47:01.180] noise, find most effective is filing criminal complaints and professional conduct complaints
[01:47:01.180 --> 01:47:04.060] against the police.
[01:47:04.060 --> 01:47:09.620] I don't know of any policemen who like writing tickets any more than I like getting them.
[01:47:09.620 --> 01:47:18.660] It's one of the more onerous parts of their job but it's a way to make money for the jurisdiction.
[01:47:18.660 --> 01:47:22.900] So they have to spend a certain amount of time out there making the public mad at them
[01:47:22.900 --> 01:47:24.940] writing tickets.
[01:47:24.940 --> 01:47:31.680] So if we're going to get this changed, if we're going to get this fixed, then we need
[01:47:31.680 --> 01:47:34.340] their help doing it.
[01:47:34.340 --> 01:47:41.540] One good way to get their help is file criminal charges against them, accuse them of following
[01:47:41.540 --> 01:47:44.380] policy.
[01:47:44.380 --> 01:47:50.620] And when you look at the codes of any state, you will find, and this is what Olivier has
[01:47:50.620 --> 01:47:55.140] clearly found, that they don't follow law.
[01:47:55.140 --> 01:48:03.860] They follow practices and procedures that facilitate the prosecutorial purpose.
[01:48:03.860 --> 01:48:09.280] Prosecutors don't raise issues about that because all of these guys have their snouts
[01:48:09.280 --> 01:48:12.100] in the same trough.
[01:48:12.100 --> 01:48:16.600] Your lawyer is in business to make money.
[01:48:16.600 --> 01:48:19.140] He's not going to do something to cost him money.
[01:48:19.140 --> 01:48:24.940] He's going to do what makes him the most money with the least amount of work.
[01:48:24.940 --> 01:48:32.160] I mean, if you start a business and you have a part of the business where you make good
[01:48:32.160 --> 01:48:35.740] money, where are you going to spend your time?
[01:48:35.740 --> 01:48:40.820] I mean, you can't expect a lawyer to do much different.
[01:48:40.820 --> 01:48:43.300] He's going to do what makes him the most money.
[01:48:43.300 --> 01:48:44.300] Okay.
[01:48:44.300 --> 01:48:50.120] With that understood, how do we put the lawyer in a position to where it's more valuable
[01:48:50.120 --> 01:48:56.560] to him to actively adjudicate your case than to not?
[01:48:56.560 --> 01:49:03.300] How do we put a policeman in a position so that it's in his best interest to challenge
[01:49:03.300 --> 01:49:08.820] his bosses who are having him follow improper procedures?
[01:49:08.820 --> 01:49:11.780] We sting him good.
[01:49:11.780 --> 01:49:19.480] Now I'm sure the police officer doesn't like being stunned, but sorry, life is tough.
[01:49:19.480 --> 01:49:26.060] And what we want to do is give the police, the prosecutors, our lawyers, we want to give
[01:49:26.060 --> 01:49:30.020] them all plausible deniability.
[01:49:30.020 --> 01:49:36.180] So they can go to the courts and say, I don't want to have to do this, but I got a client
[01:49:36.180 --> 01:49:37.180] here.
[01:49:37.180 --> 01:49:41.060] I'm going to bust my chops if I don't.
[01:49:41.060 --> 01:49:45.840] The policeman can go to his boss and say, what in the heck is going on?
[01:49:45.840 --> 01:49:52.940] Why am I being criminally prosecuted for doing what you told me to do?
[01:49:52.940 --> 01:50:00.120] Once I get this up and running, if we can just get 1% of the people who get a ticket
[01:50:00.120 --> 01:50:10.820] every year to file these sets of documents, we will pretty well shut down traffic enforcement.
[01:50:10.820 --> 01:50:17.400] That's not that I'm against traffic enforcement, but not using the Texas Transportation Code.
[01:50:17.400 --> 01:50:21.920] We have criminal laws that are adequate.
[01:50:21.920 --> 01:50:29.660] If I get inside this 3,500 pound piece of pig iron and I push it down the highway in
[01:50:29.660 --> 01:50:36.340] a way that places other people in jeopardy, that's reckless endangerment.
[01:50:36.340 --> 01:50:42.320] And all states have criminal laws against that sort of thing.
[01:50:42.320 --> 01:50:49.020] We could be prosecuted in the criminal courts, just like all other crimes.
[01:50:49.020 --> 01:50:58.460] And if we were prosecuted in the criminal courts instead of the local JPs and municipal
[01:50:58.460 --> 01:51:03.380] courts, we would be in front of judges who were actually lawyers and actually know what
[01:51:03.380 --> 01:51:06.000] they're doing.
[01:51:06.000 --> 01:51:15.500] And we wouldn't be getting tickets every time the officer believes that we could have possibly
[01:51:15.500 --> 01:51:21.180] avoided some minor technical detail of law.
[01:51:21.180 --> 01:51:28.120] We wouldn't be getting all these tickets or police wouldn't be wasting their time chasing
[01:51:28.120 --> 01:51:29.120] tickets.
[01:51:29.120 --> 01:51:36.140] I just watched a news report recently where a guy was shot in Dallas.
[01:51:36.140 --> 01:51:42.540] Because the police were too busy out writing tickets, the paramedics got there first.
[01:51:42.540 --> 01:51:47.540] And the first paramedic on the scene, the shooter shot him two times while he's trying
[01:51:47.540 --> 01:51:50.460] to save the guy that was shot the first time.
[01:51:50.460 --> 01:51:54.620] And the police were complaining that they didn't have enough police.
[01:51:54.620 --> 01:52:01.660] Well, crime has been down across the board for all crimes for the last 20 years.
[01:52:01.660 --> 01:52:05.460] So what are you talking about you don't have enough police?
[01:52:05.460 --> 01:52:07.620] We have more police than we've ever had.
[01:52:07.620 --> 01:52:11.380] Crime is down and we don't have enough police.
[01:52:11.380 --> 01:52:15.340] What is wrong with this picture?
[01:52:15.340 --> 01:52:23.820] Wrong with this picture is you got six out of 10 out there writing tickets all day, generate
[01:52:23.820 --> 01:52:30.820] extra revenue for the jurisdiction, revenue that we want to prove in taxes.
[01:52:30.820 --> 01:52:35.860] And then we don't have enough police left to fight real crime because the jurisdictions
[01:52:35.860 --> 01:52:42.740] are using the police as a income source instead of to protect our safety.
[01:52:42.740 --> 01:52:50.980] We can get traffic in a situation such that it's not profitable for the jurisdiction.
[01:52:50.980 --> 01:52:57.180] They'll stop wasting their time on it and go back to real law enforcement and won't
[01:52:57.180 --> 01:53:00.660] need as many officers, at least.
[01:53:00.660 --> 01:53:01.660] That's my position.
[01:53:01.660 --> 01:53:02.660] That's my opinion.
[01:53:02.660 --> 01:53:05.940] That's my story and I'm sticking to it.
[01:53:05.940 --> 01:53:09.900] Oliver, are you still there?
[01:53:09.900 --> 01:53:11.900] Yes, I'm still here.
[01:53:11.900 --> 01:53:16.140] You're right because here the officers basically have their own vehicle.
[01:53:16.140 --> 01:53:17.140] They take it home.
[01:53:17.140 --> 01:53:19.140] How do you take it home?
[01:53:19.140 --> 01:53:23.980] Well, other states, they got to switch out two officers in the vehicle.
[01:53:23.980 --> 01:53:27.380] They bring in the vehicle, somebody incoming the next shift, nah, they're making money
[01:53:27.380 --> 01:53:28.380] over here.
[01:53:28.380 --> 01:53:32.740] They're getting new 2017 cars, like what is going on here?
[01:53:32.740 --> 01:53:34.060] It's a military town.
[01:53:34.060 --> 01:53:40.580] It's right in between Kentucky, yeah, it's on the border line of Kentucky and Tennessee.
[01:53:40.580 --> 01:53:45.900] The military has got both halves, Kentucky and Tennessee.
[01:53:45.900 --> 01:53:50.380] Wait a minute, where is Clarksville?
[01:53:50.380 --> 01:53:52.460] I thought you were near Jackson.
[01:53:52.460 --> 01:53:58.220] No, Clarksville is, I could literally run to Kentucky.
[01:53:58.220 --> 01:54:00.780] I'm an athlete, so you know.
[01:54:00.780 --> 01:54:11.220] Well, I was in a place, when I was in Tennessee, I was born in West Tennessee and where we
[01:54:11.220 --> 01:54:20.260] lived was right on the state line between Tennessee and Kentucky, near Mayfield, Kentucky.
[01:54:20.260 --> 01:54:28.820] Well, I'm in a similar situation, but I'm near the military base and half of the base
[01:54:28.820 --> 01:54:33.140] is on Kentucky and half of the base is on Tennessee.
[01:54:33.140 --> 01:54:46.340] Okay, well, and okay, so do you have any idea, have you done any research on traffic enforcement
[01:54:46.340 --> 01:54:48.340] in Tennessee?
[01:54:48.340 --> 01:54:57.500] Yeah, the light loss, yes, I have, I mean, yeah, since you told me so, I have.
[01:54:57.500 --> 01:54:58.500] What does it look like?
[01:54:58.500 --> 01:54:59.500] What kind of...
[01:54:59.500 --> 01:55:10.140] And no, they don't have authority, it's the state highway patrol, they do have authority,
[01:55:10.140 --> 01:55:21.620] but it's for the city, I mean, it's for certain, under certain circumstances, car accidents.
[01:55:21.620 --> 01:55:28.780] Wait a minute, they, when you say they, you mean highway patrol or municipal police?
[01:55:28.780 --> 01:55:35.540] The municipal police, the municipal police, it has to be something that calls them out
[01:55:35.540 --> 01:55:40.500] there or something that engaged them in order, like a car accident.
[01:55:40.500 --> 01:55:46.460] Now they have authority to come out there and write those state law tickets in order
[01:55:46.460 --> 01:55:50.780] to get, to protect everybody's rights.
[01:55:50.780 --> 01:55:56.180] So but they can't do general enforcement of the transportation code?
[01:55:56.180 --> 01:55:57.180] No.
[01:55:57.180 --> 01:56:02.380] Okay, that's essentially the way it is in Texas.
[01:56:02.380 --> 01:56:12.260] The Department of Public Safety was created to primarily do traffic enforcement.
[01:56:12.260 --> 01:56:18.240] They gave them some other jobs, they collect information, there's two or three other things
[01:56:18.240 --> 01:56:23.100] they do, but their primary purpose was traffic cops.
[01:56:23.100 --> 01:56:27.660] The administrative code that created the Department of Public Safety says the Department of Public
[01:56:27.660 --> 01:56:36.860] Safety shall not enforce the criminal laws except on the request of and under the direction
[01:56:36.860 --> 01:56:46.060] of local law enforcement, the police officers, as opposed to peace officers.
[01:56:46.060 --> 01:56:53.580] We have peace officers in Texas who are certified to enforce the criminal laws.
[01:56:53.580 --> 01:57:02.060] All of our DPS are certified as peace officers, but they're not employed as peace officers.
[01:57:02.060 --> 01:57:12.060] They're employed as police officers, traffic cops, glorified meter maids.
[01:57:12.060 --> 01:57:14.940] That's all they're there to do.
[01:57:14.940 --> 01:57:24.220] But since we have the DPS there to do that, the local law enforcement, peace officers,
[01:57:24.220 --> 01:57:29.940] are not authorized to enforce the transportation code, and it sounds similar in Tennessee.
[01:57:29.940 --> 01:57:34.180] I'll be interested in looking at the details.
[01:57:34.180 --> 01:57:41.580] Primarily we want to put together a set of documents that will address these codes and
[01:57:41.580 --> 01:57:45.100] put the jurisdiction on the dime.
[01:57:45.100 --> 01:57:51.300] The whole deal here is it's a money making enterprise.
[01:57:51.300 --> 01:57:57.940] So we want to take that enterprise, it's so costly for them that they don't want to do
[01:57:57.940 --> 01:57:58.940] it.
[01:57:58.940 --> 01:58:06.740] If every time a police officer writes a citation, he gets a professional conduct complaint,
[01:58:06.740 --> 01:58:07.740] a criminal complaint.
[01:58:07.740 --> 01:58:11.660] I've got a set of criminal complaints for Texas that these guys won't believe.
[01:58:11.660 --> 01:58:18.060] If we're about to go to break, I'll speak to that when we come back on the other side.
[01:58:18.060 --> 01:58:22.460] How are these cops going to react when every time they write a ticket, they get a criminal
[01:58:22.460 --> 01:58:25.700] complaint for first degree felony aggravated assault?
[01:58:25.700 --> 01:58:29.500] It won't take long to get that stuff stopped.
[01:58:29.500 --> 01:58:32.900] Hang on, Randy Kelton, Deborah Stevens, Rule of Law Radio.
[01:58:32.900 --> 01:58:38.820] I call in number 512646 1984.
[01:58:38.820 --> 01:58:50.580] We'll be right back.
