[05:53.720 --> 05:58.720]  And I am telling you that the misinformation that is out there
[05:58.720 --> 06:03.720]  and the misconceptions about what is and isn't real about the law
[06:03.720 --> 06:06.720]  are astounding to behold.
[06:06.720 --> 06:14.720]  You couldn't get a bigger rain of crap on your head if your septic tank exploded during a cleaning.
[06:14.720 --> 06:20.720]  Just really, it is ridiculous, some of the theories that are running around out there
[06:20.720 --> 06:23.720]  about how this is all set up to work.
[06:23.720 --> 06:30.720]  And when things don't go somebody's way, they go looking for a reason why.
[06:30.720 --> 06:34.720]  Now I understand that aspect of this. Believe me, I do.

[06:39.720 --> 06:44.720]  and corrupting everything it touched and decided to do something about it,

[06:47.720 --> 06:53.720]  And at each step I tried to figure out why was I not succeeding.
[06:53.720 --> 06:59.720]  And like everybody else in this arena, I looked at every possible thing that I could find,

[07:01.720 --> 07:08.720]  Now I never used any of it because it didn't make any sense to me the things they were saying.
[07:08.720 --> 07:17.720]  Number one, they could never provide any reference to valid documentation, court cases, statutes,
[07:17.720 --> 07:24.720]  or anything else to support their theory of how it works.
[07:24.720 --> 07:30.720]  So maybe a lot of things, stupid, is not one of them.
[07:30.720 --> 07:36.720]  Gullible in this particular field is not one of them.
[07:36.720 --> 07:44.720]  But these people that I've named the Patronuts and their accessories, the Patriots,
[07:44.720 --> 07:50.720]  are constantly digging holes for themselves and every one they attempt to assist so deep
[07:50.720 --> 07:55.720]  that they're going to need pipes to see the sunlight.
[07:55.720 --> 08:01.720]  It is ridiculous how when you put stuff right in front of them that shows
[08:01.720 --> 08:08.720]  that their perception or their theory or their reality or their fact is false, fabricated,
[08:08.720 --> 08:15.720]  non-existent, unsupported, idiotic, chaotic,
[08:15.720 --> 08:21.720]  and will serve no legitimate purpose beyond getting them into a mental institution,

[08:34.720 --> 08:40.720]  Now this goes to one of Randy's favorite areas to talk about, cognitive dissonance.

[10:50.720 --> 10:57.720]  So if you're going to start throwing crap at me, be prepared to get it back by the dump truck load.

[11:06.720 --> 11:15.720]  But when it comes, I will keep trying as long as possible to explain why I believe your perception of reality is wrong.
[11:15.720 --> 11:26.720]  And here's all the facts and information I have to support why I think that while the other side is doing nothing at all to support theirs.
[11:26.720 --> 11:35.720]  Because everything they put out there is demonstrably wrong or fabricated, meaning fake.

[11:37.720 --> 11:42.720]  First they disavow that the courts in the system is corrupt and law isn't what it's supposed to be.
[11:42.720 --> 11:49.720]  And then they will cite a court case to support their position, but the court case is completely fake.
[11:49.720 --> 11:52.720]  At least as far as the citation they're using from it.
[11:52.720 --> 11:58.720]  And the off chance that the case does exist, the citation that they're using will be found nowhere in it.
[11:58.720 --> 12:08.720]  It will also not match up with any of the issues in the case, nor will it have a premise even related to the issues in the case.
[12:08.720 --> 12:17.720]  Now, whether or not this is a bunch of individuals out there with nothing better to do than fabricate law that they want to see,
[12:17.720 --> 12:26.720]  or whether or not it's a government scyopt to get the masses looking at crap so they don't look at the real thing and find out what's going on.
[12:26.720 --> 12:34.720]  But whatever the reason, reason is not used to determine which it is.

[12:36.720 --> 12:44.720]  And there are conversations I've had all day, all week, all month, all year that show that.

[13:16.720 --> 13:23.720]  Now, what they attempted to do, and one of the things they do do, is regulate irrigators here in the state of Texas.
[13:23.720 --> 13:33.720]  All right? And irrigator is just a fancy single word term for someone who buries plastic pipe in the ground to run water through to water your lawn.
[13:33.720 --> 13:37.720]  Okay? For all intents and purposes, that's what they do.
[13:37.720 --> 13:44.720]  Okay? They bury pipe in the ground, they run water through it, and it sprays out in on the grass to keep it alive.
[13:44.720 --> 13:47.720]  End of discussion. Okay?
[13:47.720 --> 13:57.720]  Now, the only thing that an irrigator does that actually requires a public safety standard to do correctly,
[13:57.720 --> 14:10.720]  is to attach a backflow device from wherever the water system for the irrigation is connecting to the main water supply.
[14:10.720 --> 14:27.720]  The backflow device is there to prevent any contamination that may exist or enter into the irrigation system, and getting flushed into the main water supply that feeds the entire neighborhood.
[14:27.720 --> 14:33.720]  Okay? Now, every house has one of these at the water meter.
[14:33.720 --> 14:38.720]  Every house. They already have a backflow device put in there.
[14:38.720 --> 14:51.720]  And there has to be one put in to keep the water being flushed back into the supply going to the house just like there is to the main water system.
[14:51.720 --> 15:00.720]  Okay? Because it's still easy for contamination to enter into those underground water lines like arsenic from the soil, for example,
[15:00.720 --> 15:05.720]  and get flushed back into the home water supply if it's not installed correctly.
[15:05.720 --> 15:14.720]  So that backflow device is actually the only thing that requires the license to actually do from a health and safety standard.
[15:14.720 --> 15:20.720]  Normally plumbers are the ones that would install those. That's one of the reasons why the plumbers have to have a license as well.
[15:20.720 --> 15:22.720]  Okay?
[15:22.720 --> 15:30.720]  Now, that particular device only exists in one place, and it's at the point of connection to the main water supply.
[15:30.720 --> 15:39.720]  Everything else is just a bunch of pipe in the ground that if you wanted to, you could hook a barrel to as the water source and put in your own little pump
[15:39.720 --> 15:46.720]  if that enough pressure and squirt it directly out of a rain barrel onto your grass and never use the public water supply.
[15:46.720 --> 15:56.720]  Now, if that were the case, why would you need a license to do it at all if you were using a separate, independent water supply
[15:56.720 --> 16:01.720]  that could never touch the public water supply or the household water supply?
[16:01.720 --> 16:07.720]  The simple answer is you would not. You just wouldn't.
[16:07.720 --> 16:14.720]  So there you have in a nutshell the premise for licensing irrigators and plumbers, for the most part.
[16:14.720 --> 16:24.720]  Now, of course, plumbing being inside of the structure of your home, that has other issues that you want to make sure somebody that installs that pipe knows what the heck they're doing, of course.
[16:24.720 --> 16:27.720]  But that backflow device is the primary issue.
[16:27.720 --> 16:37.720]  Now, in addition to that particular thing, the TCEQ is the ones that issues the licenses that these people use for that occupation.
[16:37.720 --> 16:47.720]  In relation to irrigators, however, there's a particularity that irrigators in the state of Texas need to be aware of, and I'll discuss that on the other side here.

[21:16.720 --> 21:29.720]  Alright, now, as I was saying, the TCEQ is responsible for the licensing of irrigators, plumbers, pretty much anybody that has anything to do with the public water supply.
[21:29.720 --> 21:51.720]  Now, that being said, the statutes both in the government code and in the occupations code and in the water code all come together in relation to how this works as far as the license goes.
[21:51.720 --> 22:01.720]  Now, I want to read you something directly out of the statutes the TCEQ uses in order to do what they do.
[22:01.720 --> 22:24.720]  Now, remember that they are attempting to go after this friend of mine that owns his irrigation business and charge him these humongous multi-thousand dollar fines per allegation per day under these statutes and their ability to assess administrative fines.
[22:24.720 --> 22:32.720]  But this is their own statute that I'm about to read to you as to how this works.
[22:32.720 --> 22:42.720]  Now, the statute in question is 1903.002 of the Texas Occupations Code.
[22:42.720 --> 22:57.720]  If you look down in subsection C, sub-item 10, and by the way, 002 is titled Exemptions, this is what you see in subsection C10.
[22:57.720 --> 23:18.720]  The licensing requirements of this chapter do not apply to 10, an owner of a business that employs an individual described by sub-chapter F of this chapter who is licensed under chapter 37 water code.
[23:18.720 --> 23:31.720]  Now, the important aspect of that is this, the owner of the irrigation business does not have to personally possess a license.
[23:31.720 --> 23:44.720]  They can have an employee that possesses a license and be perfectly legitimate under this statute and all the other rules that they're attempting to levy these fines under.
[23:44.720 --> 24:02.720]  Okay? Now, when you look at what this says, you look down in subsection D of 1903.002 and you see a person who is exempt from licensing requirements of this chapter.
[24:02.720 --> 24:20.720]  So, right there you have two sections that specifically state that there are people who are specifically exempted by statute from having to have that license even though they own and operate an irrigation business.
[24:20.720 --> 24:25.720]  Okay? Now, that is straight out of the state statutes.
[24:25.720 --> 24:33.720]  Now, let me tell you what the allegation, there's three different allegations and I'm going to tell you what they say.
[24:33.720 --> 24:40.720]  In this, they send out this report, which is called the Executive Director's Primary Report and Petition.
[24:40.720 --> 24:58.720]  Okay? And in there, it alleges that there is a TCEQ investigator who made the determination that these allegations are proper, thus the fines are proper.
[24:58.720 --> 25:10.720]  Okay? Now, in Texas, there is a legal requirement under the law, once again, within the Occupations Code. Okay?
[25:10.720 --> 25:26.720]  And that is that anyone who is conducting any sort of investigation business or activity must have an investigator's license by law to do that.
[25:26.720 --> 25:31.720]  Now, right here, this is part of the response that I wrote back.
[25:31.720 --> 25:45.720]  Further, responded demands that the investigator, who is allegedly either directly employed by or is providing contract investigative services to the TCEQ, a state administrative agency or board,
[25:45.720 --> 26:01.720]  be made to produce and provide to respondent a certified copy of his or her currently valid investigator's license as required by Texas Occupations Code, section 1702.101 and 104,
[26:01.720 --> 26:17.720]  or to provide to respondent a written affidavit of facts sworn to under penalty of perjury as to why the requirement of such license does not apply to an investigator employed by or contracted with the TCEQ.
[26:17.720 --> 26:35.720]  And if the TCEQ investigator holds no such license, why the investigator would not be subject to the criminal and administrative penalties codified in Texas Occupation Code, 1702.386,.388 and.401?
[26:35.720 --> 26:52.720]  In other words, what the TCEQ is doing is allowing someone in their employee or by contract directly violate state law for the administrative business purposes of the TCEQ,
[26:52.720 --> 26:58.720]  and they are sanctioning and promoting said violation of law.
[26:58.720 --> 27:05.720]  Now, if that is the case, nothing this investigator did could or would be legitimate.
[27:05.720 --> 27:17.720]  And on top of that, the only investigation this idiot did, whoever it is, was to read a set of records that only the TCEQ appears to have.
[27:17.720 --> 27:23.720]  Now they don't tell us what these records are, where they came from, or anything.
[27:23.720 --> 27:28.720]  They just say after review of these records, blah, blah, blah, and that was it.
[27:28.720 --> 27:31.720]  But anyway, back to the first allegation.
[27:31.720 --> 27:40.720]  That respondent failed to hold an irrigator license prior to selling, designing, consulting, installing, repairing or servicing an irrigation system.
[27:40.720 --> 27:54.720]  In violation of Texas Occupations Code, 1903.251, Texas Water Code, section 37.003 and 30, Texas Administrative Code, section 30.58.
[27:54.720 --> 28:02.720]  Specifically, respondent did not hold an irrigator license prior to installing an irrigation system.
[28:02.720 --> 28:04.720]  Okay?
[28:04.720 --> 28:08.720]  Now, this is the response to that allegation.
[28:08.720 --> 28:18.720]  Respondent points out that even if respondent were a legal person as defined by Texas Government Code, section 311.005 sub-item two,

[37:04.720 --> 37:15.720]  It's called indoctrination, indoctrination process, or is the word that they use for all the general public education, the educational system.

[38:59.720 --> 39:21.720]  Whether it's not easy to find out who the source is, but you have to go really deep down the rabbit hole, perhaps, in continuing your studies, and you'll find it's well rooted among a lot of the, as I said, the educational systems, the media operations, media matters, et cetera, have a lot to do with it.

[49:50.720 --> 49:54.720]  If they're telling you that you have to pay money before you go in there,
[49:54.720 --> 50:03.720]  have you checked to verify whether or not the appearance you're making is in a criminal venue or in a civil venue?
[50:03.720 --> 50:10.720]  Because the rules are different, the process is different, and how you do it is different.
[50:10.720 --> 50:16.720]  Uh-huh. So now, if it's a civil, what happens then?
[50:16.720 --> 50:25.720]  Well, if it's civil, then you're dealing with the civil rules of procedure and the administrative laws that govern whatever type of proceeding it is.
[50:25.720 --> 50:29.720]  If it's criminal, then you use the criminal rules, not the civil rules,
[50:29.720 --> 50:41.720]  except for where the criminal rules don't have an action relative to the case that the civil rules do, and so on and so forth.
[50:41.720 --> 50:51.720]  Now, when doing a declination of the condition, please, do you just write out,
[50:51.720 --> 50:55.720]  uh, or is it a form or a certain way of the structure, the letter, or...
[50:55.720 --> 51:01.720]  Everything you do is in a form similar to a motion or a brief in a court.
[51:01.720 --> 51:08.720]  If you do a search on the Internet for your state, whatever the state is, Pennsylvania in this case,
[51:08.720 --> 51:22.720]  uh, sample or template motion for, and whatever, and it will pull up probably all kinds of different samples of how you can write one.

[51:24.720 --> 51:31.720]  Okay, so download one that's in a format you can edit, like rich text, RTF, or a Word document, DOC,
[51:31.720 --> 51:40.720]  or an OPD, which is an open source document, for open office, and so on and so forth, or ODF, or whatever it is.

[51:42.720 --> 51:50.720]  Now, be careful with the WPS, as those are WordPerfect files, and depending upon what version of Word or open office you have,

[51:58.720 --> 52:05.720]  Now, what about, uh, getting the private property back that was impounded?

[52:13.720 --> 52:20.720]  and you can sue for recovery of that after if you can get it dismissed and when.

[52:23.720 --> 52:29.720]  But if you don't do that, then they're going to keep racking up charges on you every single day until you can't afford to get it back

[52:38.720 --> 52:43.720]  Uh, yeah, I would say that's more than a given.
[52:43.720 --> 52:56.720]  So, I would have to go to trial and win to get the property back, or it's a done deal already.
[52:56.720 --> 53:00.720]  Well, I don't know. I don't know what the rules of Pennsylvania is for forfeiture of the property.
[53:00.720 --> 53:03.720]  I don't know how long you have to pick it up before they can sell it.
[53:03.720 --> 53:09.720]  Could it be 60 days? Could it be 30 days? Could it be 45 days? I don't know.

[53:12.720 --> 53:15.720]  Well, again, I don't know what the rules are in Pennsylvania for doing that.

[53:23.720 --> 53:36.720]  None of these businesses, nor of these public officials, can legally or lawfully do something unless the law authorizes them to do it.

[53:41.720 --> 53:49.720]  So, any solution you want to seek, you first need to see if there's a law that favors the outcome you already want.
[53:49.720 --> 53:52.720]  And whether or not they complied with it.

[53:56.720 --> 54:08.720]  Now all you need to do is set things up to get them to expose themselves and provide you with a good place to smack them with that hammer.

[55:22.720 --> 55:27.720]  She didn't strike him. She was just defending herself against his advance.

[55:30.720 --> 55:32.720]  There are no witnesses.
[55:32.720 --> 55:34.720]  Then it's all he said she said.
[55:34.720 --> 55:38.720]  Here's the thing about domestic violence.
[55:38.720 --> 55:46.720]  If you get accused, you better immediately levy an counter allegation against the other party.
[55:46.720 --> 55:48.720]  And you better not drop it.
[55:48.720 --> 55:50.720]  Okay.
[55:50.720 --> 56:03.720]  Because if you don't, then if you wait too long, it becomes an issue of self preservation and retaliation in the eyes of the law as far as them being willing to believe you.

[56:05.720 --> 56:17.720]  In a case of alleged domestic violence where there are no other witnesses, you need to be the first one accusing the other one of being the guilty party.
[56:17.720 --> 56:23.720]  Or you need to be the one that does it immediately upon the heels of the other one doing it.
[56:23.720 --> 56:27.720]  Now, me being me, I prefer to solve such problems without getting them involved in the first place.
[56:27.720 --> 56:35.720]  But you can't control what the other person is going to do, much less what they're going to say once they're in front of law enforcement or judge or anyone else.
[56:35.720 --> 56:45.720]  When it comes down to you or them, 99.9% of the time, you ain't going to enter into the equation the way you would like.

[56:46.720 --> 57:06.720]  So depending upon what's occurred up to this point and when it occurred, there may not be anything here short of actual physical evidence or audio or video recording that is going to give her any sort of advantage other than a jury believing it, one way or the other,

[57:15.720 --> 57:24.720]  Okay, so here's what it's been a while, it was at the end of March.
[57:24.720 --> 57:40.720]  Now, what has been done is it's been suggested by an attorney that she file a pre-trial diversion.

[57:41.720 --> 57:45.720]  A pre-trial diversion.
[57:45.720 --> 57:50.720]  But I don't think that's going to work out for her.
[57:50.720 --> 58:07.720]  I don't think she can go through a whole year and meet the requirements, which means she'll be right back where she started if she does not follow through and successfully complete the diversion.

[01:03:52.720 --> 01:03:58.720]  Well, I have a couple of questions trying to figure out how to get out of this mess.

[01:03:59.720 --> 01:04:08.720]  Now, I did a public, I did a couple of public information requests to see if she was taken before a magistrate,
[01:04:08.720 --> 01:04:17.720]  as I've heard you've explained before, and the only thing I see is something called a magistrate's warning.
[01:04:17.720 --> 01:04:24.720]  That would be the 15.17 proceeding. Where did they do it?
[01:04:24.720 --> 01:04:35.720]  They did it at the jail. They took her to jail first. She spent 17 hours there overnight, and then met with it, and then the judge thought.
[01:04:35.720 --> 01:04:42.720]  Right, which is something they're not allowed to do. They're required to take them immediately before a magistrate.
[01:04:42.720 --> 01:04:50.720]  The cops are not supposed to have the ability to incarcerate absent a judicial order to do so. Okay?
[01:04:50.720 --> 01:04:56.720]  It's called an order of commitment. The Code of Criminal Procedure is very clear on that.
[01:04:56.720 --> 01:05:03.720]  It does not matter what jail they're taking them to, whether it be the city jail or the county jail.
[01:05:03.720 --> 01:05:15.720]  The booking officer at that jail has a duty under Texas law to demand to see the commitment order before they allow the booking of a prisoner, period.
[01:05:15.720 --> 01:05:31.720]  Because the magistrate's order is the only authority by which they can incarcerate an individual absent some state of emergency that would prevent them from diligently seeking that magistrate to get that order.
[01:05:31.720 --> 01:05:40.720]  Okay, so is this magistrate's warning the same thing as the magistrate's order?
[01:05:40.720 --> 01:05:55.720]  No, it's not. That is, the magistrate's warning is what's done after you appear before a magistrate for the purpose of 15.17 proceedings in the Code of Criminal Procedure.
[01:05:55.720 --> 01:06:04.720]  It's called a magistration by name, even though that's not what is titled or officially called, it's what they've called it. It's called the magistration.
[01:06:04.720 --> 01:06:17.720]  Okay? In there, there are very specific things they are required to do, read the individual their rights, determine whether or not English is their first language, whether or not they want and require the assistance of counsel, etc., etc.
[01:06:17.720 --> 01:06:28.720]  Alright? Then they can hold an examining trial or, well, hold an examining trial and then after that they can hold an arraignment.
[01:06:28.720 --> 01:06:44.720]  Now those can happen all consecutively right there or, but they have to happen with different judges, keep that in mind, or they can schedule each of those for different dates and times, as long as they don't do them out of order.
[01:06:44.720 --> 01:07:00.720]  Okay? Now, the issue becomes that she was held in jail for 17 hours without that order. That's false imprisonment, period.
[01:07:00.720 --> 01:07:14.720]  Okay? But that is an offense committed by all of the officers, the one that took her to jail and then the ones that put her in jail and then the ones that held her in jail. Okay?
[01:07:14.720 --> 01:07:23.720]  That will be something separate and apart from the allegations themselves against her, so one will not directly affect the other, I'm afraid.
[01:07:23.720 --> 01:07:25.720]  Alright?
[01:07:25.720 --> 01:07:27.720]  Okay.
[01:07:27.720 --> 01:07:32.720]  Alright, so there's nothing there. There's nothing there as far as that aspect of it goes.
[01:07:32.720 --> 01:07:47.720]  Now the question is, is what evidence did the magistrate in the 15.17 proceeding, did anyone do an examining trial to examine into the evidence and the sufficiency of the allegations to hold her in the first place or to even make a complaint against her?
[01:07:47.720 --> 01:07:59.720]  See, that's the other thing. The officer holding her in jail without a sworn complaint to initiate any action against her is another reason why it's illegal for them to do it.
[01:07:59.720 --> 01:08:08.720]  So that complaint is filed. There is no official allegation against her that would authorize them to incarcerate her.
[01:08:08.720 --> 01:08:15.720]  Barring, you know, certain circumstances.
[01:08:15.720 --> 01:08:19.720]  There is a complaint signed by the husband.
[01:08:19.720 --> 01:08:24.720]  When was it signed?
[01:08:24.720 --> 01:08:33.720]  I believe the very day because the police came.
[01:08:33.720 --> 01:08:48.720]  He claimed that she attacked him and he had a little scratch on his elbow and claimed that she had caused it.
[01:08:48.720 --> 01:08:49.720]  Okay.
[01:08:49.720 --> 01:08:55.720]  And I believe that, I believe that, looking for it right now.
[01:08:55.720 --> 01:09:04.720]  Well, in that regard, if she was actually defending herself, she should have had defensive wounds of her own, correct?
[01:09:04.720 --> 01:09:14.720]  Well, no, he never actually struck her. You know, she says she never actually struck him. He's just claiming that she did.
[01:09:14.720 --> 01:09:28.720]  She had picked up this oven grate that was, they were in the backyard and this oven grate was out there to be cleaned. She picked it up to use as a defensive shield. This is what she called him.
[01:09:28.720 --> 01:09:37.720]  And then he claims that she hit him with it and struck his elbow and scratched it.
[01:09:37.720 --> 01:09:38.720]  Okay.
[01:09:38.720 --> 01:09:53.720]  And this is the, this is what the whole deal is, but I've got, first of all, I've got a complaint by him signed.
[01:09:53.720 --> 01:10:11.720]  And then I have a complaint by some, some sworn complaint by somebody in the police department, I guess that's totally unrelated, not the officer that was there.
[01:10:11.720 --> 01:10:20.720]  Well, a person does not have to have firsthand knowledge to swear out a complaint, but that's also exactly why the complaint cannot be the basis of an action in and of itself.
[01:10:20.720 --> 01:10:24.720]  The complainers can be hearsay 99% of the time.
[01:10:24.720 --> 01:10:34.720]  That alone is not sufficient to begin a process of prosecution. That's always been my point about the complaint.
[01:10:34.720 --> 01:10:46.720]  It's enough to initiate an investigation into the allegation, but it's not enough to pursue a prosecution.
[01:10:46.720 --> 01:11:09.720]  So then what happened is he made the complaint, signed the complaint, and they got this investigator in the police department to, I don't know what this is, you know, it just says that there's, they claim there's sufficient evidence to charge her or something like that.
[01:11:09.720 --> 01:11:17.720]  Well, the investigator doesn't get to determine that. A judge does. The judge is the one that has to do the probable cause determination.
[01:11:17.720 --> 01:11:26.720]  The cops can simply say there's enough evidence to file a complaint for the judge to do something, for the judge to issue a warrant on.
[01:11:26.720 --> 01:11:37.720]  But the judge is the one that's required to look at that and determine whether or not there's probable cause, not the cops.
[01:11:37.720 --> 01:11:42.720]  So that was up to Sus. I think there's another complaint by the cops.
[01:11:42.720 --> 01:11:48.720]  Well, I don't know. I can't see it. So I can't tell you if that's what it really is or not.
[01:11:48.720 --> 01:11:51.720]  No, I understand. I just don't understand all those paperwork it.
[01:11:51.720 --> 01:12:04.720]  Well, that's just it. Most of them don't either. And since they can vary from department to department and city to city, it's hard to say what you're looking at is one thing or the other without looking at it directly.
[01:12:04.720 --> 01:12:09.720]  Okay, here's the one by the investigator in the department, not the cop that was on the scene.
[01:12:09.720 --> 01:12:17.720]  Says the complaint and has a name. Having personally appeared. I'm a duly sworn by me, the underside authority.
[01:12:17.720 --> 01:12:25.720]  Say it upon hope that I have good reason to believe and do believe. And I therefore charge that.
[01:12:25.720 --> 01:12:41.720]  A relative here and after referred to as defendant did then and then and they're intentionally knowingly and recklessly cause bodily injury.
[01:12:41.720 --> 01:12:44.720]  Well, that's all.
[01:12:44.720 --> 01:12:52.720]  Well, that may be, but that's a fact allegation that has to be decided by a bench trial or a jury. That's the thing.
[01:12:52.720 --> 01:13:01.720]  The defense attorney could very well plead self defense in the matter and make a case out of that if he's if he's got enough information to prove it.
[01:13:01.720 --> 01:13:09.720]  That's going to be one thing and she turns out to be 64 and 200 pounds and he turns out to be five foot one 110 pounds.
[01:13:09.720 --> 01:13:18.720]  But if those roles are reversed, you know, that's going to be a whole different matter when it comes to self defense.
[01:13:18.720 --> 01:13:23.720]  Yeah, exact opposite. He was like 240. She was like 150.
[01:13:23.720 --> 01:13:33.720]  And is there a history of this? Have they ever had this issue before? Have there ever been witnesses that saw him do something that she would have had to defend herself from, etc. etc.
[01:13:33.720 --> 01:13:34.720]  Yes, sir.
[01:13:34.720 --> 01:13:41.720]  Okay, then that's what she should take it to trial with a defense attorney for the purpose of self defense.
[01:13:41.720 --> 01:13:46.720]  It's not domestic violence when it's self defense.
[01:13:46.720 --> 01:13:56.720]  Okay, excellent. That'll be that'll be a good way to go. Here we go. I found it right here after David submitted for probable cause determination.
[01:13:56.720 --> 01:13:58.720]  Well, see, that's the thing.
[01:13:58.720 --> 01:14:05.720]  In order for a magistrate to make a determination of probable cause, the statute says there has to be an examining trial.
[01:14:05.720 --> 01:14:18.720]  If it was not present for that, it was not a valid examining trial and the judge accepted ex parte evidence and information from the other side in a criminal matter.
[01:14:18.720 --> 01:14:20.720]  And that's in violation of the rules.
[01:14:20.720 --> 01:14:30.720]  They don't do anything in Texas the way the rules require and they certainly don't do it in a way that that protects the rights of the accused.
[01:14:30.720 --> 01:14:41.720]  The only thing in Texas or that's got a worse record of doing things fairly than Texas is Congress.
[01:14:41.720 --> 01:14:43.720]  I'm stood.
[01:14:43.720 --> 01:14:52.720]  Okay, so there's really nothing to do to get now, nothing to do to get this to disappear before trial.
[01:14:52.720 --> 01:14:59.720]  What if the only way that's going to happen is if everybody drops the charges and you would have to give them a really good reason to do that.
[01:14:59.720 --> 01:15:04.720]  Because what they're looking for at the end of this is money.
[01:15:04.720 --> 01:15:09.720]  The state's going to get money out of this if they can get her convicted, period.
[01:15:09.720 --> 01:15:16.720]  The state's going to get money for every day they can keep her under a jail roof, period.
[01:15:16.720 --> 01:15:21.720]  They don't care who wins. They don't care.
[01:15:21.720 --> 01:15:26.720]  All they care about is billable time to collect federal funds.
[01:15:26.720 --> 01:15:29.720]  That's it.
[01:15:29.720 --> 01:15:33.720]  That's exactly why the cops take everybody to jail first.
[01:15:33.720 --> 01:15:44.720]  Because the more hours you're there, as long as you're there during the times of day when the jail population head count occurs, that increases or decreases the amount of money they get.
[01:15:44.720 --> 01:15:55.720]  They want as many bodies under that roof as possible twice a day.
[01:15:55.720 --> 01:15:59.720]  Now, what if we can convince the husband to drop the charge?
[01:15:59.720 --> 01:16:05.720]  That doesn't mean the state will. Even though they have no dog in this fight, that doesn't mean they will.
[01:16:05.720 --> 01:16:14.720]  Now, the only thing that that's going to do is if he doesn't testify or if he drops the charges and refuses to testify, they can't prosecute her.
[01:16:14.720 --> 01:16:17.720]  Okay? At least not with a witness.
[01:16:17.720 --> 01:16:28.720]  However, they may threaten to go after him for falsely charging her if he won't testify. That's tampering with a witness.
[01:16:28.720 --> 01:16:35.720]  And the prosecutor should go to jail for even thinking about it, much less doing it.
[01:16:35.720 --> 01:16:38.720]  But they will do it.
[01:16:38.720 --> 01:16:44.720]  Yeah, they may threaten him with jail for filing a false allegation
[01:16:44.720 --> 01:16:49.720]  and providing a false record to a police officer if he won't testify.
[01:16:49.720 --> 01:16:53.720]  It's a fabricated charge, but it's exactly what they do. That's what I keep telling you.

[01:24:21.720 --> 01:24:31.720]  The only ones that we have that you could directly question right up front is Houston because it's got a port in a relative distance to it.

[01:24:35.720 --> 01:24:47.720]  For the most part, there are only 63 local police officers in the entire state of Texas authorized to enforce the Transportation Code.

[01:24:54.720 --> 01:25:08.720]  Now, things you need to file, you need to file a motion for discovery and a public information request to the city attorney's office demanding to know the policies and procedures
[01:25:08.720 --> 01:25:26.720]  authorizing local police officers to enforce the Texas Transportation Code. What should happen is you should get back a response saying we don't authorize our officers to enforce the Transportation Code.

[01:25:31.720 --> 01:25:40.720]  Alright, then you send to the police department asking for discovery purposes and public information request services.
[01:25:40.720 --> 01:25:53.720]  The specific training records of the officer certifying him to enforce the Texas Transportation Code pursuant rule 4.13 of the Texas Administrative Code.
[01:25:53.720 --> 01:26:03.720]  Okay, now 4.13 is not the only one you need to look at. 4.14 of the Administrative Code is another one that needs to be looked at.

[01:26:10.720 --> 01:26:18.720]  A directed mission that the officer is not certified by the Department of Public Safety to do any enforcement of the Transportation Code whatsoever.

[01:36:09.720 --> 01:36:13.720]  And Texas says the same thing, only when you're lawfully detained or arrested.

[01:36:43.720 --> 01:36:52.720]  And the Bill of Rights says no person shall be subjected to searches and seizures, warrantless searches and seizures that are unreasonable.

[01:36:58.720 --> 01:37:11.720]  Right now the courts are very government gung-ho and they use the law of necessity instead of the law of restraint because of individual protections.

So we'll have a constitution class, we'll have a rights class, we'll have a law enforcement class, we'll have courtroom practice class and so on and so forth, and there will be tests.
[01:48:24.720 --> 01:48:36.720]  Okay, and what we're going to try to do is set this up in a tiered system where in order for you to participate in a higher level class, you must demonstrate your skill set at the lower level classes.

[01:48:46.720 --> 01:49:01.720]  So by using skills assessment and having you test your way up, we can keep the people at the level they need to be until they get the information down and can move up and not drag anybody else down in the process.

[01:50:22.720 --> 01:50:34.720]  Super, super. I'm going to make this a real quick. I've been in the civil lawsuit that I found nearly, I want to say, about five and a half years ago.
[01:50:34.720 --> 01:50:46.720]  In this environment, I did a detailed fraud and a lot of personal data, and it was done on the behalf of my oldest daughter who was raised by my ex-wife.
[01:50:46.720 --> 01:50:52.720]  Well, after five and a half years, she has passed on because of cancer, if you will.
[01:50:52.720 --> 01:51:08.720]  And the paperwork started in the lower court there in the county of Fulls in the state of Georgia. And when I got the order that came down from the judge, the district judge there, I was speaking of jury trial number one.
[01:51:08.720 --> 01:51:28.720]  And then he denied my case and I turned around and I submitted a recommendation in Louisville, the denial asking for a 30-day, if you will. And he didn't bother to acknowledge my recommendations, so I filed for the 11th Circuit Court of Appeal,
[01:51:28.720 --> 01:51:39.720]  and my paperwork went forth and they denied my paperwork, and I'm going over this real quick, okay, if you will. But I don't want to heat up a whole lot of kinds.
[01:51:39.720 --> 01:51:53.720]  But the case, based on the 11th Circuit Court of Appeal, was saying, in so many words, you got information here, however, at the same time, we're not going to print this information for public notice.
[01:51:53.720 --> 01:52:07.720]  And the identity theft and fraud was in lieu of a corporation, and if you will, I used several discoveries when I was doing pretty much the work on my own as a proxy.
[01:52:07.720 --> 01:52:27.720]  But one of the cases that really stood out that I was really impressed with was the United States v. Mueller back in 1975, just out of Connecticut, and that's pretty much in so many words, Title 18, fraud, the incident occurring at the same place with the same people on the same day.
[01:52:27.720 --> 01:52:37.720]  And it pretty much tied by then, too, with the case that I was pursuing because there was a vehicle sold with my name without my consent, as well.
[01:52:37.720 --> 01:52:42.720]  Right. Okay.
[01:52:42.720 --> 01:52:43.720]  Okay.
[01:52:43.720 --> 01:52:44.720]  And are you pursuing this further?
[01:52:44.720 --> 01:52:45.720]  I do.

[01:52:49.720 --> 01:52:57.720]  Ed, to be honest with you, because of the loss of my daughter, it took a lot out of me. It really did.

[01:52:58.720 --> 01:53:15.720]  And for me to get as far as I did with not knowing nothing in the Louisville law, believe it or not, I, and I got to say I was really blessed because when I got started with it, I went into it on a crash course, but I ended up with the Constitution with both
[01:53:15.720 --> 01:53:34.720]  Amendment 9, Amendment 10, and Amendment 14. And I really hung on 14 because 14 was pretty much saying in so many words, you know, you just can't go after a person, you know, whether they belong this or a person's property or, you know, this individual right.

[01:53:35.720 --> 01:53:52.720]  You just can't do that. And at the same time, the information that I had right there that was before the court, whether it was the 1130 Court of Appeal or the District Court, everybody saw that the signatures on all the paperwork came from the dealership,
[01:53:52.720 --> 01:54:03.720]  along with my daughter's signature, who forged my signature, and everybody knew when it came down to the contract being signed.
[01:54:03.720 --> 01:54:16.720]  Well, a person who signed the contract in the dealership, based on the law of the land, you had to have a person there who had to have a license as a, you know, noted republic, okay?
[01:54:16.720 --> 01:54:22.720]  And that noted republic, he or she has to verify identification of the person who signed the contract.
[01:54:22.720 --> 01:54:32.720]  Right, unless they personally know them or has someone with proper identification vouching for them. Those are the three ways that they can get it done.
[01:54:32.720 --> 01:54:51.720]  Okay. And it just, it just took me for a loop. How in the, how in the fill in the blank, you're going to acknowledge me, and I'm 1800 miles away operating my business, and you're going to allow a vehicle to leave the premises of your life with a signature that you know that it's not.
[01:54:51.720 --> 01:55:01.720]  Okay. But anyway, to make a long story short, I got some of the information during the commercial break, and I'm going to be taking some baby steps and learning what I need to do.
[01:55:01.720 --> 01:55:14.720]  And if I decide to, you know, to pursue this any further, I think if I'm not mistaken, when I was reading last week, I think I got up to a year to submit some paperwork in Louis of that.
[01:55:14.720 --> 01:55:28.720]  Okay. Well, I certainly wish you luck. Are you looking for something in particular as a recommendation for it?
[01:55:28.720 --> 01:55:48.720]  Well, I, I would like to get some strong points and in Louis of me following up with this number one. And then if I have to take it any further, am I better off with requesting all the judges there was in the 11th Circuit Court, you know, of appeal versus.

[01:55:55.720 --> 01:55:58.720]  Based on the information what I read, it looked like two.
[01:55:58.720 --> 01:56:08.720]  Okay. So what you could do is file for a motion for reconsideration in bank, asking for all of the judges to be present and rule.
[01:56:08.720 --> 01:56:21.720]  Okay. Okay. Is there somewhere online where I can just do a crash course and reading and getting the right wording, if you will?

The way that I tend to research legal pleadings when it comes to ones I haven't actually done is I will try to find ones actually filed by law firms on the particular subject matter that I'm looking for like Title 18 suits or I'm sorry, Title 42 suits and things of that nature or RICO filings and see how they wrote it and how they couch the arguments.
[01:56:45.720 --> 01:56:55.720]  And then I will research case law and everything else based upon that. Then I'll do up my documentation formatted like theirs but written like mine.
