[08:05.560 --> 08:14.520]  that kind of nonsense. But right now, they just get a ticket. And then you get upset at the system.
[08:14.520 --> 08:21.640]  Everybody gets mad. The police hate to write tickets. We hate to get tickets. Everybody's mad at
[08:21.640 --> 08:31.640]  everybody. Better to throw them out all together. Do it right. If you want to enforce traffic laws,
[08:32.760 --> 08:40.520]  get the public to agree to traffic laws. Right now, the public didn't agree to these traffic laws.
[08:40.520 --> 08:44.520]  Only professional drivers were subject to them, and they didn't have to agree to them.

[09:31.320 --> 09:39.320]  municipality in the state of Texas, you can't enforce the text transportation code. Period.
[09:39.320 --> 09:47.320]  Or not quite period. If you're Houston, half of a municipality of in excess of a half a
[09:47.320 --> 09:52.840]  million people in a county with over three million people that has a international port,
[09:53.880 --> 09:59.480]  then you can enforce the text transportation code with one officer.
[09:59.480 --> 10:08.360]  Any municipality around the state, there aren't very many that can actually
[10:09.160 --> 10:14.920]  enforce the Texas transportation code can only do so with one officer.
[10:16.200 --> 10:23.080]  And Mr. Craig helped me find a statute that I couldn't find a single police officer who knew
[10:23.080 --> 10:33.160]  what it was. I asked the question, when a police officer turns his lights on me from behind,
[10:34.200 --> 10:41.800]  what duty do I have to pull over and stop? None of them knew. Well,
[10:41.800 --> 10:55.080]  Eddie found it in the transportation code 545.421. Ordinarily, when you see emergency lights behind
[10:55.080 --> 11:03.400]  you, you must either move over one lane or slow down 20 miles an hour, or if there is an emergency
[11:03.400 --> 11:07.720]  on the side of the highway, a car on the side of the highway stopped, people on the highway,
[11:07.720 --> 11:17.880]  you have to move over a lane or slow down 20 miles an hour. If you're passing something on
[11:17.880 --> 11:24.600]  the highway, also if an emergency vehicle has its lights on, you have to do the same thing.
[11:24.600 --> 11:30.200]  That's it. You don't have to stop. If a police officer turns his lights on behind you and he's
[11:30.200 --> 11:37.320]  not trying to get around you, then you can presuppose that he is turning those lights on under
[11:37.320 --> 11:48.600]  545.421. And he may only do that if he is authorized to enforce the Texas Transportation Code.
[11:49.960 --> 11:58.360]  In order to be authorized to enforce the Texas Transportation Code, he must be in a municipality
[11:58.360 --> 12:04.440]  that meets a whole bunch of very strict requirements under Texas Administrative Code 4.13
[12:04.440 --> 12:16.600]  and Texas Transportation Code 644.101. Actually, 4.13 Administration Code, if you go to that one,
[12:17.240 --> 12:25.640]  it references the others that apply. And it lists these locations where a city can be
[12:26.280 --> 12:31.080]  authorized to enforce. And you've heard me read it on the air. It's absolutely insane.
[12:31.080 --> 12:41.560]  One of them says if you live in a county that borders two states and there is a municipality
[12:41.560 --> 12:46.760]  larger than 8,500 people, the municipality can enforce the Transportation Code. Well,
[12:46.760 --> 12:56.280]  there are only two counties in Texas that border two of the states. That's Dalam County and a county
[12:56.280 --> 13:03.880]  on the eastern border right where Louisiana and Arkansas come together. Neither one of them
[13:03.880 --> 13:11.320]  have a city of 8,500 people. These requirements are absolutely insane. So even if you're in one
[13:11.320 --> 13:19.240]  of those municipalities, the sheriff can appoint five people in the county if the county can enforce
[13:19.240 --> 13:27.560]  the code. He can appoint five people, one of which can be a municipal officer. So when you get
[13:27.560 --> 13:39.240]  stopped in Dallas, Fort Worth, Austin, Houston, San Antonio, you want to ask that cop, are you the
[13:39.240 --> 13:46.920]  one, Bubba? Are you the one officer that has authority to enforce because if you are not
[13:46.920 --> 13:55.800]  and you turn those lights on me to force me to arrest my freedom of movement, you have subjected
[13:55.800 --> 14:06.680]  to me to seizure. And if you have no power to enforce the Transportation Code, we have no
[14:06.680 --> 14:13.240]  power to force me to pull over under 545.421 to take the Transportation Code. Therefore,
[14:13.240 --> 14:20.760]  you are exerting or purporting to exerting authority you do not expressly have. And in the
[14:20.760 --> 14:29.080]  process denied me in my right to freedom from unreasonable seizure. That's a class A misdemeanor
[14:29.080 --> 14:38.680]  under 39.03 Texas Speedal Code. And also, you are impersonating a public official. Now you may
[14:38.680 --> 14:47.000]  actually be a public official. But in this case, you are not acting under the authority of a public
[14:47.000 --> 14:53.800]  official. You're acting under the color, meaning pretense of an authority as impersonating a public
[14:53.800 --> 15:01.640]  official. But the problem with that is, is you doing that while prominently displaying a deadly
[15:01.640 --> 15:10.680]  weapon. Now impersonating a public official, that's a state jail felony. First degree felony
[15:10.680 --> 15:20.120]  aggravated assault, 2202B2A. If you commit simple assaults, the turning the lights on
[15:20.120 --> 15:26.840]  can be construed as simple assault. It places you in a position of threat. If you dare ignore
[15:26.840 --> 15:31.640]  those lights, you can expect to be chased down, beat up, jerked through the window, can cussed,
[15:32.200 --> 15:37.400]  maybe shot, if not a couple of whips stomped in, thrown in jail. Clearly assault.
[15:38.680 --> 15:44.440]  Then you do that while prominently displaying a deadly weapon. That's a felony of the second
[15:44.440 --> 15:51.960]  degree, unless you are a public official, acting under the color or pretense of an official capacity,
[15:51.960 --> 15:56.440]  in which case it's a felony of the first degree. So if a policeman puts his lights on you and pulls
[15:56.440 --> 16:01.880]  you over, he don't have authority under Texas Transportation Code, first degree felony aggravated
[16:01.880 --> 16:11.800]  assault. You guys want to play hardball? Welcome to the deep end of the pool. I just put together

[20:49.800 --> 20:58.920]  the police officer gave the complaint to the court clerk because he's here prosecuting me.

[23:47.640 --> 23:54.200]  pleading, you have to anticipate the questions that will come to the mind of the reader
[23:55.960 --> 24:04.440]  and make sure you answer all those questions. Sometimes it sounds pedantic. I know sometimes
[24:04.440 --> 24:10.520]  when I'm asking people questions and they give me one of those interpretive answers,
[24:11.480 --> 24:16.520]  I kind of step on them and back them up and start picking them apart on the details.
[24:18.120 --> 24:27.800]  But the only details I care about are those details I need to be able to understand how
[24:27.800 --> 24:35.720]  all these pieces fit together. This is what we've been working on. So how is this working out for

[24:47.480 --> 24:53.720]  and that is a problem for all of us because we know everything and we tend to leave a lot of

[25:00.840 --> 25:05.800]  go in there and say, oh, well, this is an issue, this is an issue, and this is an issue when
[25:06.360 --> 25:13.640]  I tend to overlook it because I'm looking at a broader overview of things instead of being really
[25:15.400 --> 25:21.800]  pedantic is one word, but really specific. And then once you actually know these things,
[25:21.800 --> 25:30.440]  then you can address these little issues that lead up to the story because the charge that I'm
[25:30.440 --> 25:40.840]  coming in with the supervisory neglect, so how do you get the story to point to the actual county
[25:40.840 --> 25:49.160]  judge by all the actions that the officer did and then how... Okay, hold on, hold on, you left out
[25:49.160 --> 25:58.040]  an important piece of information there. Okay. Judge of the county commissioners court, not the
[25:58.040 --> 26:03.000]  court at law, not the one that sits in the trial court, but the one that sits over the county
[26:03.000 --> 26:10.120]  commissioners, that's the county judge he's going after. Right, sorry, yes, seeing that's a problem
[26:10.120 --> 26:15.000]  right there, you still got to get more specific, more specific, so yes, it's the county judge
[26:15.000 --> 26:24.920]  that I'm charging, but I have to point everything through the district attorney, the county district
[26:24.920 --> 26:33.720]  attorney, so that it can show that the county judge is negligent for the county district
[26:33.720 --> 26:42.120]  attorney's actions. Okay, you are still saying district attorneys, beat yourself around the eyes
[26:42.120 --> 26:47.080]  in the ears. What did I tell you earlier, I never wanted to come out of your mouth again?
[26:48.040 --> 26:57.480]  District attorney. Okay. So the county attorney, county attorney, county attorney,
[26:57.480 --> 27:04.760]  that's the one that we have to specifically focus in on because he is, that is going to help make
[27:04.760 --> 27:12.200]  the complaint show the county judge is liable for allowing the county attorney to operate
[27:12.920 --> 27:20.040]  non-compliant or basically violate all these policies and procedures that they are,
[27:20.760 --> 27:28.840]  they have a duty to perform. Okay, let's step back a second and so that this makes sense to
[27:28.840 --> 27:36.200]  everybody else. What he's saying here is that if you sue the county attorney,
[27:37.320 --> 27:43.080]  if you sue any county official, as far as the law is concerned, it's the same as suing the county.
[27:44.600 --> 27:53.160]  So what the county officials do, place liability on the county and it's the duty of the county
[27:53.160 --> 27:58.760]  commissioners court to make sure that the officials that they write the funding for
[27:59.960 --> 28:07.160]  perform their duty in a way that doesn't generate liability. Primarily that means in a way that
[28:07.160 --> 28:15.480]  doesn't harm the public to the degree that the public can sue you. So this is a duty the county
[28:15.480 --> 28:22.680]  commissioners court has to oversee the county officials. This is where he's trying to get to,
[28:23.720 --> 28:29.080]  because this is politics. When the county commissioner, the judge of the county commissioners
[28:29.080 --> 28:37.560]  court gets sued because of the county attorney, the commissioners court is not going to be happy
[28:38.680 --> 28:43.720]  and you generate lots of politics. So this is where Scott's trying to get to,
[28:43.720 --> 28:50.680]  but how do we get there? How do we make him liable? Okay, I'll shut up now.
[28:52.680 --> 29:05.640]  Well, how we make the county judge liable is showing that the county attorney
[29:05.640 --> 29:15.480]  violated all these different types of rules, procedures, laws that they are, they have a
[29:15.480 --> 29:24.280]  duty to perform by them not performing them their duties, denying you due process, which is effectively
[29:24.280 --> 29:32.200]  what they're doing. When they deny that due process, then you have, that's when you're
[29:32.200 --> 29:40.120]  able to have a claim against the county judge. Okay, let's get a little more specific. It's not
[29:40.120 --> 29:48.840]  just the prosecutor does something stupid, but he follows a policy that causes these problems,
[29:48.840 --> 29:54.680]  but that's an improper policy. That's where we get the county judge's problem. Hang on,

[36:12.360 --> 36:22.200]  I had a motion hearing one day and a guy before me had the exact same subject matter jurisdiction
[36:22.200 --> 36:29.320]  motion as I did, which I know I got mine from rule all radio, basically, and not basically.
[36:29.320 --> 36:33.880]  That's where I got it. And everybody that's listening, if you can't buy the programs,
[36:33.880 --> 36:41.000]  just send five or 10 bucks and just chip in because this is how we take the control back
[36:41.000 --> 36:46.520]  over our government is our duty as the people to keep the government in check because the
[36:46.520 --> 36:51.640]  government will not do it. And the only way people are going to do that is to help stations
[36:51.640 --> 36:58.680]  like this and promote stations like this to keep them on the air so that more people can get educated
[36:58.680 --> 37:04.440]  because the more people that are educated, the more the courts will start to fear us instead
[37:04.440 --> 37:10.280]  of everybody fair in the court. Now back to what I was stating earlier, the guy before me had the
[37:10.280 --> 37:16.840]  exact same motion and the judge asked me, is there something going around on the internet? And I
[37:16.840 --> 37:21.640]  told Judge Penn, yes, there is. It's called rule all radio tune in.
[37:27.080 --> 37:37.480]  This is and we are having an effect. You mentioned Jody. Scott and I, Scott had a
[37:37.480 --> 37:41.240]  hearing in Rockwall and I went to the hearing in Rockwall and this is,
[37:41.240 --> 37:48.840]  we're still having issues with recording the courts and this is after the Turner driver
[37:48.840 --> 37:56.280]  decision. So I went in there and told the bailiff to tell the judge that I intended to
[37:57.080 --> 38:02.200]  record these proceedings and he went up to the judge and just told him, don't record in this
[38:02.200 --> 38:09.000]  quarter and the bailiff come back and told me and I'm grinning real big at him. So he knows,
[38:09.000 --> 38:13.880]  he knew that I knew exactly what the judge is going to do because when he come back,
[38:13.880 --> 38:18.200]  I'm grinning at him. He got to me and he told me and I said, well, in that case,
[38:19.400 --> 38:26.760]  I want you to take my criminal complaint against the judge. Well, Scott had beat him up enough
[38:27.800 --> 38:32.280]  and dumped enough criminal complaints and bar grievances and judicial conduct complaints on
[38:32.280 --> 38:37.320]  him that these guys were really running around on their tippy toes. So the bailiff was real
[38:37.320 --> 38:42.360]  careful with me. I wrote him out the complaint, signed it in front of him, gave it to him and he
[38:42.360 --> 38:47.240]  said, well, should I show this to the judge? Oh, no, no, no, no, don't do that. It's not
[38:47.240 --> 38:51.800]  in his business. He's the one that's accused. You never give a criminal complaint that's accused.
[38:52.520 --> 39:02.120]  Oh, okay. But I'm sure as soon as I left, he showed it to the judge. And then what was this?
[39:02.120 --> 39:07.160]  Three weeks later, Jody or two weeks later that Jody went down to a court, tell them what happened
[39:07.160 --> 39:16.360]  there. Well, let's finish up with it. So the next day, I went and turned in judicial. I started
[39:16.360 --> 39:22.360]  my judicial conduct rounds and I immediately put a judicial conduct in on Judge Williams for not
[39:22.360 --> 39:28.760]  allowing filming to be done in his court. Also sent criminal complaints to the attorney general.
[39:29.480 --> 39:35.800]  And so it was about two weeks later, Jody had to go to court and he noticed some lady that was in
[39:35.800 --> 39:40.200]  a wheelchair that was, she must have been speeding there, wheelchair, got a ticket, whatever. She
[39:40.200 --> 39:47.320]  was there. He was talking to her. He sat down and then he wrote up on just a little piece of paper
[39:47.320 --> 39:51.720]  that he was going to record this proceeding called the... Wait a minute, where was this?
[39:52.760 --> 40:00.600]  This was in Polk County, just north of Houston. And so he gave that to the bailiff. The bailiff
[40:00.600 --> 40:04.760]  went and immediately trotted right up there to the judge, handed it to the judge. The judge
[40:04.760 --> 40:10.360]  looked at it and said, I have no choice but to allow him to film. Immediately called the lady
[40:10.360 --> 40:20.120]  up that he had been talking to, reset her case. And I'm not sure if he told her that he was going
[40:20.120 --> 40:27.000]  to dismiss it if everything comes out next month, but he was certainly on his toes and
[40:27.000 --> 40:32.760]  recording was now allowed after he's already submitted paperwork asking the judge for permission
[40:32.760 --> 40:38.840]  to record in his court, which was denied a couple of times. Now there's filming allowed and I was
[40:38.840 --> 40:43.720]  supposed to go down there next Friday and I'm taking my camera in there because he's got a hearing
[40:43.720 --> 40:51.080]  on a DWI case that the kind of railroaded him a little bit on. So now that the judge kind of
[40:51.080 --> 40:56.280]  got softened up a little bit, I think I'm not going to have a problem whipping out a camera
[40:56.280 --> 41:03.560]  filming anything in that courtroom. And it gets around when you sting one of them,
[41:04.360 --> 41:09.320]  you know, they have conferences, they talk to each other all the time about the things that go on
[41:09.320 --> 41:15.400]  in the courts, the problems they have, and have no doubt that your complaints to the attorney
[41:15.400 --> 41:23.320]  general almost certainly got a notice out to all of these judges. Say, guys, don't be like this,
[41:23.320 --> 41:29.080]  chump, and get criminal charges filed against you and let them know that we can start recording.
[41:30.200 --> 41:37.240]  So what we do does have an effect. Now they're certainly not going to come to Scott and say,
[41:37.240 --> 41:43.160]  Scott, you know, you really kicked our behinds and you forced us to change our procedures.
[41:44.440 --> 41:50.520]  You're never going to tell you anything like that. But they just quietly change their procedures
[41:50.520 --> 41:59.320]  so they don't have this kind of thing happen to them again. When we start unloading this traffic
[41:59.320 --> 42:09.800]  process on them, they're just going to have to shut down. This is the strategy. I'm almost
[42:09.800 --> 42:16.280]  certain just from the policeman I've talked to that the police do not like writing tickets
[42:16.280 --> 42:24.600]  any more than you like getting tickets. It's like every job has a dirty part to it that you really
[42:24.600 --> 42:31.080]  hate. Well, this is one of those jobs. All they do is get people upset at them. They want to be
[42:31.080 --> 42:35.560]  good guys. They want to go out and catch the bad guys. They don't want to be harassing the public.
[42:35.560 --> 42:40.920]  They don't want to give your kids tickets and get you upset at them because you gave your kid a ticket.
[42:40.920 --> 42:47.080]  They don't have this trouble. They got enough problems to deal with. So they don't like writing
[42:47.080 --> 42:55.640]  them. We don't like getting them. The only ones who like it are the municipalities who make all
[42:55.640 --> 43:08.200]  this money. So let's make it a little more costly for them. When we start filing criminal charges
[43:08.200 --> 43:15.080]  with the judge against the police officer, he is not going to pursue that police officer
[43:16.040 --> 43:22.760]  because if he does, he shuts down his court. But when he doesn't pursue the officer, then we pursue
[43:22.760 --> 43:32.360]  the judge with criminal charges and civil suits and judicial conduct complaints, bar grievances
[43:32.360 --> 43:40.840]  against the prosecutor. We're building this tool so that you start out just by filling in the ticket

[46:49.960 --> 46:56.760]  complaints against the officer, I don't have an axe to grind against these police officers. I know
[46:56.760 --> 47:04.040]  that's a job I could not do. So I'm filing these really, really ugly complaints. First
[47:04.040 --> 47:11.240]  degree felony aggravated assault. And the police officer is going to have apoplexy.
[47:11.240 --> 47:22.280]  Now, he's pretty sure that he won't get indicted for this, but he's not certain. Because we don't
[47:22.280 --> 47:29.560]  really trust our police anymore. Because it's smart not to. You never know when you got a real
[47:29.560 --> 47:37.560]  wacko out there. And the police don't trust the system. They trust the system less than we do.
[47:37.560 --> 47:45.800]  Because they see people getting railroaded through the system all the time. And I think about policemen.
[47:45.800 --> 47:51.720]  Policemen, they never get called on the carpet. They never get called to answer unless they do
[47:51.720 --> 47:58.920]  something really, really bad or really give the mayor's wife a ticket or something. Something
[47:58.920 --> 48:05.320]  that creates some political angst. And then when the system does come after a policeman,
[48:05.320 --> 48:12.200]  they tend to drop the sky on them. So the policemen don't think about all the stuff they get away
[48:12.200 --> 48:18.440]  with. They just see when the system comes after somebody, how badly they get screwed around
[48:18.440 --> 48:24.920]  in the system. So they think they get screwed around in the system worse than we do. They're
[48:24.920 --> 48:30.200]  more afraid of it than we are. So when you start filing against them, you're going to
[48:30.200 --> 48:37.320]  terrify these guys. And they're going to have plausible deniability to go to their boss and
[48:37.320 --> 48:44.520]  say, what in the heck is going on? I'm out here doing what you're telling me to. Now these guys
[48:44.520 --> 48:49.080]  are going to try to get me put in jail. If you want to write anymore of those tickets,
[48:49.080 --> 48:54.600]  you're going to have to go do it because I'm not going to jail for it. And we file a T-close complaint.
[48:54.600 --> 49:04.680]  Texas, at least forget the C, Texas commission on law enforcement. That's the oversight,
[49:05.800 --> 49:14.600]  the licensing agency for police officers. Like the bar is for this, the bar association is for
[49:14.600 --> 49:20.760]  lawyers. So we file a T-close complaint against them. And it doesn't matter if the T-close
[49:20.760 --> 49:30.840]  complaints about it or not. It puts a mark on his chart that he got one. Most of them,
[49:30.840 --> 49:34.920]  they're going to throw out anyway. They're not going to discipline their own police,
[49:34.920 --> 49:39.640]  but it puts a mark on his chart. It puts a mark on his record that stays there forever.
[49:39.640 --> 49:43.800]  If he goes and tries to get a job somewhere else, first thing they're going to look at
[49:43.800 --> 49:50.680]  are the complaints filed against him. And if he's got four or five complaints, he's out of here. Well,
[49:50.680 --> 49:58.440]  we get this ticket thing going on and we'll start tainting the records of these police officers.
[49:59.640 --> 50:06.680]  Give them probable deniability so that they can go to their bosses and raise serious issues about
[50:06.680 --> 50:12.920]  being forced to write tickets when there's evidence that they don't have authority.
[50:14.360 --> 50:20.680]  We may actually, we may actually get it shut down altogether. We get enough of you folks
[50:21.800 --> 50:29.240]  to start sending these complaints in. And then we have a good amount of
[50:29.240 --> 50:38.360]  follow-through. The follow-through is what's most powerful, because once you start this thing and
[50:38.360 --> 50:46.040]  they start doing what they do, things get ugly for them really fast. Now, I know people are going
[50:46.040 --> 50:54.520]  to say, well, they can do anything they want to. Well, maybe. The problem these judges have is
[50:54.520 --> 51:01.560]  is they believe that the State Commission on Judicial Conduct only disciplines municipal and
[51:01.560 --> 51:09.560]  JP judges. They're construed, they are considered inferior court judges because they don't have to
[51:09.560 --> 51:19.560]  be lawyers. And it's their opinion that the State Commission on Judicial Conduct never disciplines
[51:19.560 --> 51:27.400]  elected judges, county judges, district judges. But they have to make it look like they're doing
[51:27.400 --> 51:35.640]  something so they tend to throw municipal judges, especially under the bus. And the problem with
[51:35.640 --> 51:42.280]  that is, is they're right. They do. That works good for us. We file judicial conducts, complaints
[51:42.280 --> 51:48.600]  that get some and it terrifies them. And if it is a court of record, and the guy's also a lawyer,
[51:48.600 --> 51:55.400]  we bar-grieve him. And we go after the prosecutor on the other side. I went to Southlake with a guy
[51:55.400 --> 52:03.160]  who's got this notice to come to court. And I went there with him and they called him up and
[52:03.160 --> 52:08.680]  they came with him in the basement. I said, wait, wait, wait, you can't go in there. I said, sure
[52:08.680 --> 52:16.520]  can. He's got a summons to be here at this hearing. And I want to watch. Oh, you can't go in there.
[52:16.520 --> 52:22.280]  That's just to meet with the prosecutor. Oh, oh, so this is not a hearing. Oh, no, no, it's just
[52:22.280 --> 52:26.280]  to meet with the prosecutor. Oh, in that case, I want you to take my criminal complaint against
[52:26.280 --> 52:34.280]  the prosecutor for state jail felonies simulating a legal process. The look on the bailiff's face
[52:34.280 --> 52:40.440]  was priceless. And he's looking around trying to find another place to be, but he can't get away.
[52:40.440 --> 52:47.960]  And he said, oh, okay. But it didn't follow with the bailiff. I went down to the clerk and got the
[52:47.960 --> 52:57.640]  appearance docket. And it had 58 names on it. So I came back and gave a criminal complaint
[52:58.200 --> 53:06.680]  to the municipal judge who had pretty well set this whole thing up and charged the attorney
[53:06.680 --> 53:15.880]  with 58 counts of state jail felony simulating legal process. Oh, you talk about getting excited.
[53:17.000 --> 53:25.160]  They got really excited. Guys, we can fix this. We just need the tools to do it. And we're in
[53:25.160 --> 53:32.440]  the process of development. Okay, Scott, go ahead. I kind of cut you off there. So you
[53:32.440 --> 53:42.440]  found with the federal court and what they do. And the federal court, they wanted me to amend
[53:42.440 --> 53:50.440]  the complaint on suite, the county judge of Rockwall, David Sweet. So now I'm in the process of
[53:50.440 --> 53:56.280]  amending the complaint. Now, one thing that was really interesting that was pointed out by Jay
[53:56.280 --> 54:07.160]  was in his dissertation of what he was looking at as far as the amended complaint. All he ever
[54:07.160 --> 54:13.960]  talked about was Brady because I brought up the Brady policy, but he never mentioned once
[54:13.960 --> 54:20.840]  supervisory neglect. He was attempting to take me down a rabbit trail and get me off the supervisory
[54:20.840 --> 54:27.880]  neglect and trying to go straight to just Brady and addressing Brady, which was basically admitted
[54:27.880 --> 54:35.480]  that that was going to be really hard to prove on the county judge. So now the way it's been
[54:35.480 --> 54:43.800]  restructured is now we've pointed everything to the county attorney showing where he has failed
[54:43.800 --> 54:51.640]  in all his duty, but the county judge is the respondee superior that is supposed to make sure
[54:52.280 --> 54:59.720]  that all these offices remain compliant with the policies and laws, particularly the Brady at all
[54:59.720 --> 55:07.880]  times. The Brady was just the cause of what had occurred. It was just one of the causes. It wasn't
[55:07.880 --> 55:15.560]  the sole cause. So now it's getting everything structured back to supervisory neglect, but we
[55:15.560 --> 55:23.400]  have to show how all these violations led up to it. Who is ultimately responsible, which is the
[55:23.400 --> 55:29.560]  county attorney for ensuring compliance with the officers and their training and blah, blah, blah.
[55:30.520 --> 55:37.720]  And now the county judge is going to be solely responsible for allowing the county attorney
[55:37.720 --> 55:47.640]  to operate in his office non-compliant. And the Brady is a huge, huge deal because Brady
[55:48.840 --> 55:53.400]  specifically points to the officer's training for the lack thereof.
[55:53.960 --> 56:01.800]  Yes. And what Scott is saying here is they didn't single me out for special persecution.
[56:01.800 --> 56:09.480]  They do this to everybody. So it's not like a policeman went out there and did something stupid
[56:09.480 --> 56:15.720]  or like the prosecutor got a wild hair one day and did something dumb. The court wouldn't be
[56:15.720 --> 56:23.880]  responsible for that. People do stupid stuff. This is a policy. This is a condoned and consistent
[56:23.880 --> 56:36.520]  policy that the county judge authorized by non-interference. A willful neglect by turning
[56:36.520 --> 56:41.960]  a blind eye. That was one of the phrases that I used. And the reason I said turning a blind eye,
[56:41.960 --> 56:48.680]  I was explaining it to my son, an 18-year-old boy. And I asked him to read this and see if he could
[56:48.680 --> 56:53.400]  understand it. Well, he could kind of understand it. Some of the words are kind of big. He's not
[56:53.400 --> 56:57.960]  used to hearing these type of terms and anything. So I wanted to kind of dumb it down a little bit
[56:57.960 --> 57:05.480]  more. So even a high school senior could understand this. So when I said turning, I said basically

[01:07:58.120 --> 01:08:07.720]  had a good enough computer. But the issue that I have is that I have an automotive repair facility.
[01:08:07.720 --> 01:08:15.160]  And it was an old gas station, been in business since 1954. And I have done additions on to it.
[01:08:15.160 --> 01:08:22.520]  And then probably about six years ago, I took the tanks out of the ground and did an official
[01:08:22.520 --> 01:08:35.560]  closure letter with the state of Texas, TNRCC. And so they built a new subdivision here in Newark.
[01:08:35.560 --> 01:08:40.600]  They sold these lots to these people that wanted to move from Southlake in different areas. And they
[01:08:40.600 --> 01:08:49.640]  built these really nice homes in this area. Well, my wife was on city council for six years here in
[01:08:49.640 --> 01:08:57.800]  Newark and saw some changes from the old Newark to what was supposed to be the new Newark. And before
[01:08:57.800 --> 01:09:06.280]  she got off, she realized that politics was pretty nasty. And so now you have everyone in the new
[01:09:06.280 --> 01:09:15.800]  subdivision, including the mayor, are on the council. And all of the employees do not live in the
[01:09:15.800 --> 01:09:22.360]  city limits of Newark. They live outside the city limits of Newark. So you have these people who
[01:09:22.360 --> 01:09:31.640]  want to change the old Newark into something like, I suppose, Southlake or Roanoke, you know.
[01:09:31.640 --> 01:09:37.720]  But anyway, I received twice now from the same code enforcement officer that they have
[01:09:37.720 --> 01:09:47.000]  citations. Not actual citations, though. I don't know what they call them. Code violations, yes.
[01:09:47.000 --> 01:09:59.160]  Notice of violation. That's my wife's helping me here. And both times I worked with him and he gave
[01:09:59.160 --> 01:10:06.120]  me extra time to what they call, I don't know if it's abating the problem, but one was a travel
[01:10:06.120 --> 01:10:12.680]  trailer and I got it moved after the 10 days that they give us. And also, one was a sign. I used to
[01:10:12.680 --> 01:10:18.120]  be a Texaco and Texaco came and took their signage out and just left me with the pole. And so I finally
[01:10:18.120 --> 01:10:25.960]  got faces put into that. Well, this time they gave me 10 vehicles that were in violation. Three of
[01:10:25.960 --> 01:10:35.800]  them were customer's vehicles. And anyway, the other ones were mine. And they called them junk
[01:10:35.800 --> 01:10:44.760]  vehicles when they're not licensed. So I worked through one of the customers and had him call
[01:10:44.760 --> 01:10:50.600]  the code enforcement officer and speak with him. And he called him back and said, don't worry about
[01:10:50.600 --> 01:10:58.200]  it. Well, he had an Alabama antique license plate, which you don't have to get new ones
[01:10:58.840 --> 01:11:04.040]  when you're registering with Alabama. So he called him back and said, hey, no big deal.
[01:11:04.040 --> 01:11:12.360]  Don't worry about it. Well, the other ones, I have an 85 and a 73, both of them board pickups.

[01:12:32.440 --> 01:12:39.960]  outside of our house and she's thinking, what is going on? So she looks outside and the city

[01:12:47.880 --> 01:12:53.880]  the department, we're out in our driveway. And so she takes a couple of pictures of them.

[01:14:34.440 --> 01:14:43.160]  of the citizens of Newark on lawyers upwards of $100,000. Man, when I said that smoke come
[01:14:43.160 --> 01:14:52.200]  out of her ears, she said, F you, Tim, F you, shot me the finger, told me I was crazy. I guess they
[01:14:52.200 --> 01:14:58.360]  have surveillance down at the sewer plant because my wife went down that road and took pictures
[01:14:58.360 --> 01:15:05.560]  of the tractor and the backhoe that they have that you can see from the road that they were
[01:15:05.560 --> 01:15:16.680]  trying to cite me for same, you know, just the same thing, yeah, as storage. So when she said that,

[01:15:22.920 --> 01:15:30.840]  Department and stated that I had threatened her and that I had cussed her out. And then she came

[01:15:37.640 --> 01:15:41.800]  drove up, I said, what is she doing out there? She does cuss me out in the left. So I'm thinking,

[01:15:46.360 --> 01:15:52.440]  window. She said, yeah, I just want Rick to see what you look like. I said, who is Rick? She screamed,
