[04:39.540 --> 04:44.540]  Right now, we've got those same issues right here in the great state of Texas

[04:53.540 --> 04:57.540]  Pulling us over for no reason, shooting at us and killing us for no reason

[05:00.540 --> 05:06.540]  Throwing us in jail for voicing our opinion about their behavior, about our government's behavior
[05:06.540 --> 05:11.540]  Protesting about that behavior, voting against that behavior
[05:11.540 --> 05:14.540]  Just how much further down the road are we going to have to go to realize
[05:14.540 --> 05:19.540]  That the system we have is no longer our own
[05:19.540 --> 05:26.540]  But the question that raises is if it's not ours, then who does it belong to
[05:26.540 --> 05:33.540]  Well, the one fact we do know for sure that it is that it certainly is not you and I
[05:33.540 --> 05:35.540]  That it belongs to
[05:35.540 --> 05:38.540]  Because you and I, hopefully if you're listening to this show
[05:38.540 --> 05:45.540]  Came to the conclusion long ago that we were not going to be party to something like this
[05:45.540 --> 05:49.540]  We were not going to tolerate something like this
[05:49.540 --> 05:56.540]  And yet our lack of tolerance and our desire for change has yet to reach the ground floor
[05:56.540 --> 06:06.540]  And have any impact whatsoever on the system that we supposedly created and controlled
[06:06.540 --> 06:12.540]  So the question becomes when the rule of law no longer functions
[06:12.540 --> 06:19.540]  And law itself is scorned by those that both create it and then refuse to properly
[06:19.540 --> 06:26.540]  Refuse to properly apply it or enforce it against everyone equally including themselves
[06:26.540 --> 06:29.540]  What exactly is it that we have?
[06:29.540 --> 06:37.540]  Because the rule of law at that point is a tagline. It's not a way of doing things
[06:37.540 --> 06:42.540]  It is not a truth in any way
[06:42.540 --> 06:47.540]  And the next article I do on the blog when I finally get chance to do another one
[06:47.540 --> 06:50.540]  Which is extremely hard to do with all the stuff I've got going on right now
[06:50.540 --> 06:54.540]  I've got more cases than I can handle and absolutely no time to get anything done
[06:54.540 --> 07:00.540]  And a whole bunch of local catastrophes going wrong in here right along with it
[07:00.540 --> 07:06.540]  My office chairs keep breaking, I keep getting flipped over and all that kind of good stuff
[07:06.540 --> 07:13.540]  While I'm in here trying to work and I got some replacements and they broke two days after I got them

[07:15.540 --> 07:20.540]  Along with everything else that's going on, it's just been a circus literally
[07:20.540 --> 07:26.540]  And it feels like everything is just spiraling right around the toilet bowl rim waiting to go down with that laughter
[07:26.540 --> 07:28.540]  And that'd be the end of it
[07:28.540 --> 07:34.540]  But we will see. I swim well and I don't give up easy, so we'll see how well that goes
[07:34.540 --> 07:40.540]  Now all that being said, let's talk a little bit about the main thing that we do here
[07:40.540 --> 07:46.540]  And that is dealing with courts, especially municipal and county, or justice courts and county courts at law
[07:46.540 --> 07:50.540]  And see if we can come up with some information that we haven't seen or heard before
[07:50.540 --> 07:56.540]  There's not a lot of that, of course, and there's a lot of variances on how it can be presented to make it appear different
[07:56.540 --> 08:02.540]  Because information changes all the time and information is discovered all the time
[08:02.540 --> 08:14.540]  Well, in the process of working on this last handful of cases, I have managed, I believe, to use the statute to sew together the quilt
[08:14.540 --> 08:22.540]  That I think we can tie these guys up in, knot it real good and throw it into a lake with them in it
[08:22.540 --> 08:30.540]  And it all revolves around the administrative code and the Administrative Procedures Act
[08:30.540 --> 08:38.540]  Now this is very, very similar, if not exactly the same, to what Rod Class is doing or was doing
[08:38.540 --> 08:43.540]  Since I don't know what the current status of his cases are in North or South Carolina, one of the Carolinas
[08:43.540 --> 08:48.540]  Where he went and got a lot of administrative rulings on how things are being done
[08:48.540 --> 08:52.540]  And got the administrative judge to rule that it's not being done correctly
[08:52.540 --> 08:59.540]  And that everything you're being told about how it is being done is not the way the law intended for it to be done
[08:59.540 --> 09:07.540]  Well, as you know from this show, that is the way it is here in Texas and has been for a very, very long time
[09:07.540 --> 09:18.540]  Nobody reads the law, nobody understands the law, especially those that have been put in charge of it or even those that write it
[09:18.540 --> 09:28.540]  Now, what I have found is this, and that is that Title I and Title 37 of the Administrative Code and Title 10 for that matter
[09:28.540 --> 09:33.540]  Title I Chapter 10, which deals with the Department of Motor Vehicles
[09:33.540 --> 09:37.540]  And then of course you have the Department of Transportation in there as well
[09:37.540 --> 09:43.540]  Several of those titles in the Administrative Code are inextricably woven together
[09:43.540 --> 09:51.540]  Now if you saw one of the last articles I did do, I put up on there the actual speech by Harry S. Truman
[09:51.540 --> 10:00.540]  Regarding the federal licensing program that they voted in and put in place way back during his, before he even became a president
[10:00.540 --> 10:11.540]  During, while he was a senator, and that is the basis at the federal level for all of the state programs that do the same thing
[10:11.540 --> 10:14.540]  Which is regulate commercial and for hire traffic
[10:14.540 --> 10:22.540]  And in his speech and his discussion of the bill they passed, they make it very, very clear that that's exactly what they did
[10:22.540 --> 10:24.540]  It was meant to regulate commercial
[10:24.540 --> 10:31.540]  Even though when he talked about it in a general sense, he made it appear as if he was trying to get it to apply to everyone
[10:31.540 --> 10:38.540]  But when you read the language of the bill and he specifically discusses the bill, it is limited to commercial and for hire traffic
[10:38.540 --> 10:41.540]  Now why is that the case?
[10:41.540 --> 10:52.540]  It's the case because the people have an absolute right under the exercise of liberty to move, to be in locomotion
[10:52.540 --> 10:56.540]  To go where they will, when they will, how they will
[10:56.540 --> 10:59.540]  We were doing that before there was an America
[10:59.540 --> 11:02.540]  We were doing that before there was a constitution
[11:02.540 --> 11:08.540]  We were doing that before there was a government
[11:08.540 --> 11:16.540]  Government has no power to abridge it or take it away
[11:16.540 --> 11:27.540]  But because of language deception and fraud, not to mention abuse of force and arms to get their way
[11:27.540 --> 11:37.540]  The various states have convinced the people of those states that what they're doing is necessary and that it has always been a requirement
[11:37.540 --> 11:39.540]  That's a lie
[11:39.540 --> 11:49.540]  Their own legislative history will prove that to be a complete and total lie
[11:49.540 --> 11:58.540]  The biggest failing of our government today is to reverse the roles that the Constitution plays into whom it applies
[11:58.540 --> 12:03.540]  They have completely reversed how the Constitution works
[12:03.540 --> 12:15.540]  They have set the Constitution up through their own opinions and case rulings and the statutes they write to be a limit on the rights and abilities of the people
[12:15.540 --> 12:21.540]  Instead of the government and its offices in which they sit
[12:21.540 --> 12:33.540]  They have usurped more power to themselves through that single shift than through any other, including the 14th Amendment
[12:33.540 --> 12:49.540]  By simply reversing the people's role with their own under the limiting authority of the Constitution, they became the master and made us the servant
[12:49.540 --> 12:53.540]  It's really not any more difficult to understand than that
[12:53.540 --> 12:56.540]  That's exactly what they've done
[12:56.540 --> 13:03.540]  Proof positive of that is also in that last article where an attorney who used to be a prosecutor and now works as a defense attorney
[13:03.540 --> 13:20.540]  And the danger is not an attorney that won't defend me if this is the attitude and way he thinks because he said himself that the people's rights are what must be specifically enumerated in the Constitution
[13:20.540 --> 13:24.540]  And they are the only rights the people have
[13:24.540 --> 13:36.540]  Now that was one of the things debated during the Constitutional Convention when it came to putting a bill of rights in the Constitution to begin with
[13:36.540 --> 13:50.540]  It was argued that if left to its own devices, government would eventually turn around and say that the enumerated rights in the Constitution were actually the only rights the government could recognize for the people
[13:50.540 --> 13:58.540]  And the debate went on and on and it was very clear, no, it's not what we're going to get, it's not what we're going to do
[13:58.540 --> 14:14.540]  And look at us today because the Constitution, both state and federal, lacks the one thing that the people should have had in every Constitution to ensure that this could never be the case
[14:14.540 --> 14:21.540]  The Bill of Rights only had to be one sentence long
[14:21.540 --> 14:25.540]  It didn't have to enumerate anything
[14:25.540 --> 14:33.540]  One sentence would have solved the whole problem that we see today with the Bill of Rights
[14:33.540 --> 14:45.540]  It should very simply have read, the rights of the people are unlimited and the exercise thereof shall also be unlimited
[14:45.540 --> 15:07.540]  And shall be curtailed only to the extent that the exercise of any of those rights may not be used to harm the equal rights property or person of another
[15:07.540 --> 15:23.540]  In other words, government can't tell us what we can and cannot do about anything unless it specifically results in an injury to someone else, whether it be their equal rights, their property, or their person
[15:23.540 --> 15:38.540]  Had the Bill of Rights been limited to that single thing, government could not have reversed the role because government is never recognized in any way as the people
[15:38.540 --> 15:56.540]  So when it says the rights of the people shall be unlimited and absolute with these exceptions being they cannot exercise those rights in a way that directly harms the equal rights of another person or their property
[15:56.540 --> 16:05.540]  Government could never have reversed that role and you served that power to themselves and limited us in the process
[16:05.540 --> 16:10.540]  Now that's exactly what they're attempting to use the Bill of Rights to do
[16:10.540 --> 16:19.540]  I mean, you have cops running around the street saying no court has ruled that that is an actual right
[16:19.540 --> 16:24.540]  See the problem we're having here?
[16:24.540 --> 16:31.540]  If the courts have to decide whether or not it's a right, then it isn't a right, never was
[16:31.540 --> 16:43.540]  This is the problem with the limited few trying to decide things for the many without consulting them during the process

[20:10.540 --> 20:17.540]  Alright, so as I was saying at the beginning dealing with the Administrative Procedures Act, the Administrative Code and the Transportation Code
[20:17.540 --> 20:23.540]  This is a motion I'm putting together for one of several of these cases in fact.
[20:23.540 --> 20:29.540]  I'm going to just read you a few of the paragraphs out of it so you can see exactly what it is we're talking about and how we're doing this.
[20:29.540 --> 20:50.540]  After I set up the preliminaries in the motion, table of authorities and all that good stuff and into the discussion section I have an area titled summary of plea to the court's unsubstantiated presumption of subject matter jurisdiction.
[20:50.540 --> 21:00.540]  Therefore, respondent is raising several constitutional challenges to the state's interpretation and application of the Texas Transportation Code to the general public and to respondent in particular.
[21:00.540 --> 21:14.540]  Rather than limiting such interpretation and application to its original legislative purpose, that of regulating specific classes of legal persons who use the public highways to engage in the professional occupation of transportation.
[21:14.540 --> 21:32.540]  Therefore, respondent is raising numerous constitutional questions relating to the interpretation and application of the Transportation Code as being administrative statute rules and regulations subject to Chapter 2001 Administrative Procedures Act within the Texas Government Code.
[21:32.540 --> 21:48.540]  These are constitutional questions and determinations that the City of Pick One here in after name court has no lawful and jurisdictional authority or ability to address or to make.
[21:48.540 --> 22:03.540]  Nor does the court have any lawful authority and jurisdiction to make precedential and legally binding determinations and conclusions of law relating there too or to exercise any authority by which to administer justice accordingly.
[22:03.540 --> 22:21.540]  Therefore, the court lacks subject matter jurisdiction to hear the constitutional questions and must forward this matter to the Administrative Law Judge, the ALJ, of the State Office of Administrative Hearings, the SOAH, in Austin, Texas for further proceedings.
[22:21.540 --> 22:37.540]  Then there's a section titled Additional Grounds Substantiating the Court's Lack of Subject Matter Jurisdiction. Subtitled, Officer Appears Ignorant of Requirements Relating to Statutory Interpretation and Construction as Required by Chapter 311 and 312 Texas Government Code.
[22:37.540 --> 22:56.540]  As this matter pertains to respondent, City of whatever municipal police officer has a misunderstanding, ignorance, or lack of training in regard to the proper construction and reading of Texas laws and statutes pursuant to requirements of Chapter 311,
[22:56.540 --> 23:11.540]  Code Construction Act, and Chapter 312, Construction of Laws, as codified within Texas Government Code, and has resulted an officer in the officer having potentially committed one or more criminal offenses against respondent, including but not limited to.
[23:11.540 --> 23:31.540]  And I've got, let's see, 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13 different criminal acts an officer can potentially commit by pulling you over for a transportation offense.
[23:31.540 --> 23:34.540]  And that's whether he means to or not.
[23:34.540 --> 23:45.540]  Okay. Next subsection. Officer lacks lawfully delegated authority to enforce and perform arrests relating to Texas Transportation Code offenses.
[23:45.540 --> 24:05.540]  The officer has provided no documentary evidence proving that he or she possesses any lawfully delegated authority from the Texas Department of Public Safety to enforce any provision of the Transportation Code or perform any arrest in association therewith as required by Rule 4.13, Texas Administrative Code.
[24:05.540 --> 24:18.540]  And that section is not completely finished. It will go on into the other training requirements and certificate requirements and all that stuff that none of these cops have and will never have because there are only 63 of them in the entire state.
[24:18.540 --> 24:29.540]  And there are specific geographic locations in which those 63 must work in order for even that to apply and population limits as well.
[24:29.540 --> 24:36.540]  All right. Next subsection. Officer lacked articulable probable cause for perpetrating a warrantless seizure and arrest of respondent.
[24:36.540 --> 24:49.540]  As respondent was never engaged in any professional or occupational activity relating to transportation, respondent challenges the constitutionality and legality of his or her warrantless seizure and arrest by the officer.
[24:49.540 --> 25:02.540]  As said, officer lacked any reasonable and articulable suspicion or probable cause to suspect or believe that respondent was engaged in any professional or occupational use of the highways for the purpose of engaging in transportation.
[25:02.540 --> 25:09.540]  Next subsection. Officer is ignorant of what persons are required to register.
[25:09.540 --> 25:20.540]  As this matter pertains to respondent, the officer has falsely alleged that respondent was acting within the legal capacity and class of persons regulated by the Transportation Code at the time of the alleged offense.
[25:20.540 --> 25:38.540]  Respondent denies this false allegation as respondent has at all times or was at all times acting solely in his or her private common law capacity for his or her own private business and pleasure in the free exercise and enjoyment of his or her right to liberty through locomotion upon the public right of way.

[25:44.540 --> 25:53.540]  In this instance, the officer's complete misunderstanding and misapplication of Chapter 502, Texas Transportation Code dealing with registration folks,
[25:53.540 --> 26:09.540]  and said officer's absolute lack of lawfully delegated authority to enforce any provisions whatsoever of the Transportation Code has resulted in the officer performing a false, warrantless seizure and arrest of respondent without any articulable probable cause.
[26:09.540 --> 26:15.540]  Further, pending a conclusion by the ALJ that would require that this matter be remanded back to this court,
[26:15.540 --> 26:28.540]  respondent demands that a proper examining trial be conducted in order to have a proper determination of probable cause for the warrantless seizure and arrest of respondent and to obtain a signed order to that effect for the purpose of appeal.
[26:28.540 --> 26:48.540]  Wherefore, respondent is contesting this matter and has filed a petition under the authority of Title 43, Part 10, Chapter 206 of Chapter D, Rule 206.63 Administrative Code and Chapter 2001 Administrative Procedures Act within the Texas Government Code to demand a legal determination
[26:48.540 --> 27:05.540]  by an administrative law judge as to whether or not it is unconstitutional and unlawful for municipal police, sheriffs, deputies, constables, and Texas Department of Public Safety officers to apply Chapter 502 Transportation Code to respondent
[27:05.540 --> 27:21.540]  in his or her private common law capacity without articulable facts and probable cause to believe that respondent is a legal person acting within any legal capacity defined by Section 311.005 Sub-Item 2 of the Government Code
[27:21.540 --> 27:33.540]  and having a legal duty to register his or her private conveyance as a motor vehicle for use in transportation upon the highways under the provisions of Chapter 502 Transportation Code.
[27:33.540 --> 27:45.540]  Okay. Now, the reason 311.005 Sub-Item 2 is important is because that is the Co-Construction Act definition of person.
[27:45.540 --> 28:00.540]  In that statute, the definition of person is all legal entities, no natural person, no individual. Everything in that definition is legal entities.
[28:00.540 --> 28:17.540]  According to Chapter 311, every statute is subject to that definition unless the statute has a local definition of the same term that supersedes the one defined by Chapter 11.
[28:17.540 --> 28:28.540]  Unless the local says that the general declaration of the definition controls, which is what Chapter 311.001 is, is the general declaration.
[28:28.540 --> 28:38.540]  So this definition of person applies across every code in Texas and the Act says that everything in Chapter 311.001 applies to every code across Texas.
[28:38.540 --> 28:47.540]  Chapter 312 says exactly the same thing. Okay. So those two chapters apply everywhere.
[28:47.540 --> 29:02.540]  And wherever there's a local definition, like there is in subtitle C only, that includes individual from the penal code, the definition in Chapter 311.001 is the one that applies.
[29:02.540 --> 29:04.540]  Well, guess what, people?
[29:04.540 --> 29:15.540]  Chapter 502 does not have an individual definition for the purpose of registration of a motor vehicle in that chapter.
[29:15.540 --> 29:18.540]  It doesn't have one.
[29:18.540 --> 29:28.540]  So according to Chapter 311, the definition of person in Chapter 311.001 is the only one that applies since they are all legal entities.
[29:28.540 --> 29:43.540]  And since they remove the language from Chapter 502.001, they said the only person required to register were those registered motor vehicle, were the vehicles owned by the state.
[29:43.540 --> 29:45.540]  You can see what they did here, right?
[29:45.540 --> 29:55.540]  They removed that passage, limiting that chapter, and then they count on you not understanding these definitions so they can apply on broader than they are allowed to by law.

[34:22.540 --> 34:30.540]  But what I'm pointing out here in the administrative code about the municipal and justice courts is this.
[34:30.540 --> 34:38.540]  Neither of them, nor do the county courts at law, for that matter, have any power to rule on a constitutional question.
[34:38.540 --> 34:49.540]  So when we go in and challenge the constitutionality of a statute or its application, there is no procedure for that in these courts
[34:49.540 --> 34:53.540]  because they have no authority to address the issue.
[34:53.540 --> 34:56.540]  And here's where it becomes a problem.
[34:56.540 --> 35:03.540]  Because they cannot address the issue, you are not allowed to raise the issue.
[35:03.540 --> 35:10.540]  And if you don't raise it, you can't appeal it.
[35:10.540 --> 35:20.540]  So the only chance you have in a court of no record is to raise it at the county court at law level, but they can't rule on it.
[35:20.540 --> 35:22.540]  So you're back to square one.
[35:22.540 --> 35:27.540]  If you can't rule on it and they don't let you raise it, how then can you raise an appellate question on it?
[35:27.540 --> 35:38.540]  Because in order to raise the question, you have to get a ruling from the court on the issue with a signed order.
[35:38.540 --> 35:45.540]  And they can't sign such an order because they have no authority to rule on the question.
[35:45.540 --> 35:53.540]  You see the garbage they have put together to prevent you from getting due process.
[35:53.540 --> 36:00.540]  This is why you can't get a constitutional argument beyond these lower courts.
[36:00.540 --> 36:05.540]  This is why they tell you the constitution doesn't apply here.
[36:05.540 --> 36:09.540]  That's an incorrect statement. That's an incorrectly worded statement.
[36:09.540 --> 36:17.540]  Poor choice of words on their part because they can't have a court unless the constitution does apply.
[36:17.540 --> 36:27.540]  Otherwise, you have no rights in that court either because the protection of the constitution wouldn't exist if it doesn't apply.
[36:27.540 --> 36:42.540]  So that's a poor choice of words. What they are really saying but can't say directly is, I have no authority to decide an issue that raises a constitutional concern.
[36:42.540 --> 36:53.540]  And because of that, I cannot allow you to raise such a concern in your case in this court.
[36:53.540 --> 37:12.540]  Okay? So what we have to do is take what I'm working on now and set this up not as a motion to dismiss but as a motion to transfer or a motion to remand or whatever to a court that would have jurisdiction to make that ruling.
[37:12.540 --> 37:34.540]  And in this particular case, since this is a transportation code issue and it's not one of the four exceptions to those issues, the only court that can decide that is the administrative court with the administrative law judge of which there is only one and that's here in Austin, Texas.
[37:34.540 --> 37:48.540]  So what they've actually set up is a system that if they played by their own rules, every person in Texas that was given a traffic ticket would have to come to Austin to file their case to fight it.
[37:48.540 --> 37:58.540]  Or they would have to come to Austin after demanding an administrative hearing to have it thrown out because they weren't engaged in transportation.
[37:58.540 --> 38:08.540]  Now, you want to talk about an interpretation of a statute producing a ridiculous result? That would be it.
[38:08.540 --> 38:16.540]  Because that would mean that venue is no longer a part of the jurisdiction relative to the transportation code.
[38:16.540 --> 38:24.540]  What a county it occurs in, what municipality it occurs in, none of that matters. Everybody's got to go to Austin.
[38:24.540 --> 38:48.540]  The only way that that actually would make sense is what is located in Austin that would have statewide reach that the people themselves are not actually a part of.
[38:48.540 --> 38:54.540]  The records for which are maintained by the Secretary of State.
[38:54.540 --> 39:10.540]  Could it possibly be registration of corporations that actually are businesses engaging in transportation, whether they be carriers, shippers, operators and drivers that work as transporters?
[39:10.540 --> 39:21.540]  You know, those company guys, their companies are actually Austin based because this is where their filing and records must take place.
[39:21.540 --> 39:31.540]  They can be located anywhere in Texas, but they must be registered here first to operate as a corporation.
[39:31.540 --> 39:40.540]  And no patronage that are listening, I am not saying they are converting us into a corporation. That is not what they're doing.
[39:40.540 --> 39:49.540]  They are committing fraud, but they're not converting us into anything.
[39:49.540 --> 40:01.540]  Okay? Because they're not just committing fraud on us, they're committing fraud on those legal entities that they actually should know how to handle this for.
[40:01.540 --> 40:06.540]  This is not a simple mistake. This is just stupid.
[40:06.540 --> 40:21.540]  This is stupidity in full bloom and has taken control over reason when they got a bar card or when they listened to someone with a bar card.
[40:21.540 --> 40:29.540]  This is massive, massive fraud.
[40:29.540 --> 40:49.540]  And if you dig deep enough, shovel hard enough, and take fewer breaks, you will find more than likely that your state is doing exactly the same thing the same way.
[40:49.540 --> 40:51.540]  Think about that.
[40:51.540 --> 41:02.540]  I'm willing to bet you it is the case. There's too many similarities across the states, too many things that don't make sense for all the same reasons across the states.
[41:02.540 --> 41:14.540]  Too many people that have the right to do what we should have always had the right to do, that the government in every state has done its best to deny ever existed. Why?
[41:14.540 --> 41:28.540]  Why would they all be playing the same tune on their little monkey grinder box if they hadn't sit down together and wrote it?
[41:28.540 --> 41:37.540]  How could they all know it so well, note for note, if they didn't collude to write the thing?
[41:37.540 --> 41:47.540]  Well, they did collude. They colluded via the National Bar Association. They colluded via the State Bar Association.
[41:47.540 --> 42:06.540]  They colluded by taking over every department of government. I am telling you people, the Antichrist is not a single person, it's a single class of persons, and we call them attorneys.
[42:06.540 --> 42:24.540]  They are the very foundation of this fraud. You cannot look at a legislative enactment and deny that because it all begins there.
[42:24.540 --> 42:37.540]  And it continues through the control of the attorneys in the courts, through the controls of the attorneys in the executive that advise the executive, and in the legislature that make the laws, it goes on and on.
[42:37.540 --> 42:48.540]  It's every facet of every department with any power to make any decision and declare how they want it done regardless of either what it says or how it should work.
[42:48.540 --> 43:08.540]  The more you choose to make stupid arguments with stupid theories that do not take into account the reality of what they're doing and the very mechanism they have written down for you to look at to see how they're doing it, the longer they get away with it, the more fearsome it becomes,

If you were to ask an attorney, why don't you use the Eddie Craig method of fighting a traffic case where you say you're not in transportation and you object to the commercial nexus with those boards that have commercial specific definitions.
[47:24.540 --> 47:42.540]  They would tell you because that P.O. was the profit shooter from the judge. That's what they told me. Now, you could tell me, well, I don't know what they're talking about, but you're not going to ask that. But I need to ask you, Eddie, could you maybe use your imagination here and explain to me why are they giving me that?
[47:42.540 --> 48:02.540]  What are they talking about? There's no imagination required. It's the same thing it always is. Money, control, cattle shooting. They have you in an assembly line that feeds them money. Why would they disrupt that?
[48:02.540 --> 48:14.540]  You don't know what the argument is 99% of the time, and if you know the argument, you still don't know how to make it work because you don't know the rules. You don't know how to apply it. That's what they count on.
[48:14.540 --> 48:24.540]  So even when it comes to traffic tickets, they're taking money out of somebody's pocket and putting it in their own.
[48:24.540 --> 48:48.540]  It comes down to the money. It always comes down to the money. Anyone that tells you that American justice is about true fact and law is either high on something brain damaged or an attorney who is lying through his teeth and probably the first two to boot.
[48:48.540 --> 49:06.540]  Yes, 15 years. About the situation with the person jurisdiction site where you suggested because the federal constitution has the clause that says, if the state of the party, Supreme Court has official jurisdiction.
[49:06.540 --> 49:18.540]  Now, may remember I, I'm Brandy Kelton, when I asked about that for after all the years he's been involved, seemed that he never was aware of that because I asked about that. I was like, what are you supposed to do about this case?
[49:18.540 --> 49:38.540]  You're just your advantage when you're navigating the court system and file a motion to have your face dropped because the Supreme Court violated but not getting the court's original, the Supreme Court original jurisdiction and was eating their hands from you because he was stoned.
[49:38.540 --> 49:56.540]  They found that Supreme Court case from 1921, where the court seemed to have raised a match won without any explanation for why they did this. They just decided, oh, that clause just pertains to the prior clause where there was a bunch of situations and cases where the state would be a party and that only applies to those cases.
[49:56.540 --> 50:18.540]  You said, well, I don't see other courts can rule that. Well, okay, but the thing is, in practice, if we were to try that using about the court system at trial, I mean, if the courts were to say, oh, but there's kids making 21 where it says that if this only applies to those cases in the prior clause, then are you supposed to make the argument, well, I don't see other courts can rule that.
[50:18.540 --> 50:34.540]  How can you use that as a valid court argument for, I mean, you can always argue that an opinion is wrong. The problem you're going to have is if you turn out to be right, what power does it take out of their hands?
[50:34.540 --> 50:48.540]  And as long as they have the power to decide whether or not they give that power up by ruling for or against you, guess which one it's going to be?
[50:48.540 --> 50:50.540]  The one that works in their favor.
[50:50.540 --> 51:12.540]  Exactly. What, you think in 1821 that was not an attorney that was sitting there as a judge making that ruling? Do you think they had some magical insight in those days as to how to read and comprehend any better if they didn't try any harder than the ones we've got today?
[51:12.540 --> 51:24.540]  I mean, look at Abraham Lincoln. He was an attorney. He attended his own kind of law school, which was a book and became an attorney and then became president and immediately broke the law.
[51:24.540 --> 51:32.540]  The very law he swore a note to protect before he even took office and then he broke it.

And the thing you just said before the break about how Constitution, the courts can't raise the issue, I see you recall a couple of years ago you put up some sort of an appeal on your blog, like if you try to raise the Constitution and the judge says you cannot raise that, you're supposed to object and...
[51:58.540 --> 52:08.540]  Well, you are supposed to object if they said what I said at the beginning of the show, which is the Constitution doesn't apply here or we don't use it or it has no force here.
[52:08.540 --> 52:15.540]  Because that goes to the other part of what I said at the beginning of the show this evening, that if they're saying it doesn't apply, then it's not a valid court.
[52:15.540 --> 52:23.540]  And you have no rights in a court like that because if it doesn't apply, then neither does the Bill of Rights, neither do its protections.
[52:23.540 --> 52:36.540]  So that's what I was saying that that is a misstatement on their part, but they can't say what they have to say or should have to say, which is I can't rule on such an issue.

[01:04:26.540 --> 01:04:32.540]  Let me read this statute to you. 153.039 of the Oregon Revised Statutes.
[01:04:32.540 --> 01:04:50.540]  So, enforcement detention for violation one, an enforcement officer may arrest, may not arrest, excuse me, stop or detain a person for the commission of a violation except to the extent provided in this section in Oregon Revised Statutes 810.410.
[01:04:50.540 --> 01:05:01.540]  That's what we already read. An enforcement officer may stop and detain any person if the officer has reasonable grounds to believe that the person has committed a violation.
[01:05:01.540 --> 01:05:20.540]  An enforcement officer may stop and detain any employee, agent, or representative of a firm, corporation, or other organization if the officer has reasonable grounds to believe that the firm, corporation, and or other organization has committed a violation.
[01:05:20.540 --> 01:05:37.540]  That's the other code that's similar to that. Well, it's still consistent. It says it must operate consistently with that section or with the previously read section, which said they can't stop you or arrest you for a traffic violation.
[01:05:37.540 --> 01:05:43.540]  It specifically said traffic in the other statute, right? Yeah, it's a traffic violation.
[01:05:43.540 --> 01:06:00.540]  Okay, so consistent reading between the two means this one is backing up the other one saying even if it's a traffic violation, if it's a traffic violation, this section still does not protect you because the other section says that one is specifically exempted from arrest and seizure.
[01:06:00.540 --> 01:06:12.540]  Right, right. And my question is, what do I consider to call myself, a private individual, a man, or just by my name?
[01:06:12.540 --> 01:06:18.540]  What do you mean, what do you call yourself? Well, it says right here to detain a person.
[01:06:18.540 --> 01:06:24.540]  What is the definition of person in the statutes? That's what I have to research and find out.
[01:06:24.540 --> 01:06:39.540]  Well, you need to look because there's probably dozens. You need to find the one that is the general definition, if one exists in Oregon, that applies across all the statutes and there should be one, but there may not be one.
[01:06:39.540 --> 01:06:48.540]  And then if there is, you still need to look and see if there's one local and specific to the whatever sections they're attempting to charge you under.
[01:06:48.540 --> 01:07:00.540]  And if there isn't, then the general one will apply. And if the general one limits everything to corporate entities, then you're not a legal person as defined by law.
[01:07:00.540 --> 01:07:11.540]  And you say legal, you're not a legal person because a legal person in this case is one that exists only by law. That's a legal entity.
[01:07:11.540 --> 01:07:19.540]  So it's either an entity or a capacity that exists only by declaration of law.
[01:07:19.540 --> 01:07:36.540]  Okay. So what they're saying here, person, that tells them that they can't even stop anybody who is a commercial entity as well as somebody who is a client.
[01:07:36.540 --> 01:07:42.540]  You don't know if that's what it means until you know how they've defined it.
[01:07:42.540 --> 01:07:49.540]  Okay. You're making an argument for which you have no reference. Do not ever do that.

[01:09:10.540 --> 01:09:21.540]  Now, I told them about filing motions like a declamation to plea, not a refusal, but a declamation to plea, oh, we don't permit that.

[01:21:14.540 --> 01:21:37.540]  I was looking at the Hapiest Corpus and it was that our statutes make it a duty mandatory settle. It makes it mandatory for the judges to honor or raise Hapiest Corpus when the evidence proves that the person is restrained of their liberty.
[01:21:37.540 --> 01:21:46.540]  And restraining of liberty is a category of things which just don't include you being incarcerated.
[01:21:46.540 --> 01:21:48.540]  Right.
[01:21:48.540 --> 01:21:52.540]  It encompasses more than just incarceration.
[01:21:52.540 --> 01:22:15.540]  You can actually be walking around more or less free on a bond from a court for a pending case and you would be restricted at your liberty because while you're on bond, you are normally not allowed to leave the state or the country or to travel in certain ways that would allow you to do so in a very expedient manner once you got on board.
[01:22:15.540 --> 01:22:24.540]  So, yeah, even in those cases, you are still restricted at your liberty because you're not free to go when and where you want.
[01:22:24.540 --> 01:22:26.540]  Okay.
[01:22:26.540 --> 01:22:45.540]  I'm thinking what I mean, over here there are arresting people for traffic offenses which are misdemeanors and tend to be restrict officers for arresting, arresting for misdemeanors unless it comes after a warrant.

[01:22:48.540 --> 01:22:59.540]  Okay. Then what does the, what does Tennessee case law say about an officer that ignores that statute and performs an arrest without that criteria in place?

[01:23:05.540 --> 01:23:14.540]  Right. And how many suits have you found where that was the case and they paid?
[01:23:14.540 --> 01:23:20.540]  I haven't, I haven't found, I haven't looked, I haven't went to go look this far.
[01:23:20.540 --> 01:23:32.540]  Well, you should because if you've got a statute that says they're susceptible to suit for that action, odds are somebody's used it if they're still doing it this rampantly.

If you are stopped for a traffic offense and the officer takes you to jail instead of before a magistrate, the officer has committed a crime himself that has nothing to do with the alleged crime against you.
[01:24:11.540 --> 01:24:26.540]  Okay. Not only has he illegally incarcerated you with no authority, he has not complied with his own duty under the statute to deliver you immediately before a magistrate which constitutes misconduct.
[01:24:26.540 --> 01:24:32.540]  It could also constitute kidnapping, assault, and a number of other things.
[01:24:32.540 --> 01:24:41.540]  All right. Now, when you say magistrate, do you mean the magistrate, does the magistrate have to be in an open court?
[01:24:41.540 --> 01:24:56.540]  No. He can take you to a magistrate's house at 3 a.m. and get the guy out of bed as long as he's coherent enough to sit down, listen to facts and evidence, and make a determination of probable cause. That's what he's there for.
[01:24:56.540 --> 01:25:05.540]  A magistrate can conduct court wherever he needs to, but he still has to be a proper magistrate to do it.
[01:25:05.540 --> 01:25:17.540]  He's not restricted to a location unless the location violates some other rule of law such as here in Texas where they're required to make these proceedings public.
[01:25:17.540 --> 01:25:35.540]  So when they go conduct these proceedings of arraignments and stuff in the jail cells, inside the jails, they are violating that individual's rights by conducting a secret proceeding where the public is specifically excluded.
[01:25:35.540 --> 01:25:38.540]  That's forbidden here in Texas.
[01:25:38.540 --> 01:25:39.540]  Huh?
[01:25:39.540 --> 01:25:43.540]  Which is a form of restricting liberty.
[01:25:43.540 --> 01:25:54.540]  No, that's a secret proceeding which were outlawed. They're not allowed to hold those kinds of proceedings. That's a star chamber proceeding.

[01:25:58.540 --> 01:26:07.540]  Well, they've already got you restricted at your liberty just by having you in the jail cell to have to do it. You're not going to compound that issue there by doing it that way.

[01:26:27.540 --> 01:26:46.540]  Yeah, I'm following you there, but what I'm trying to say is I read some case law where they overturned a case on habeas corporate saying that the person was restricted of their liberty because they did not have counsel at the bail hearing when they first arrested the defendant.
[01:26:46.540 --> 01:26:55.540]  Yeah, but see, that's for the purpose of bail and then they put him in a jail cell. He had no counsel, so they didn't set bail and he went to jail, right?

[01:27:27.540 --> 01:27:33.540]  Right, but see, that is the right to counsel. That's a separate right. That's what I'm trying to get you to understand.
[01:27:33.540 --> 01:27:52.540]  They're making multiple points about multiple rights violations and they may have limited the application of their overturning it to the restriction of liberty aspect of it, but I can...I guarantee if you read it a little more carefully, here's how this is going to play out when you read it.
[01:27:52.540 --> 01:28:07.540]  They raised the issue of lack of legal counsel. Because of the lack of legal counsel, his bail was either set higher than it should be, took longer than it should be, and thus reduced his access to liberty more than it should.
[01:28:07.540 --> 01:28:19.540]  Because if he had not been able to come up with the bail money, even at the higher limit, he'd have been in jail, et cetera, et cetera, without that assistance of counsel to fight for him to get that bail lowered to a point where he could actually get out.
[01:28:19.540 --> 01:28:26.540]  So they compounded their problem, but we're still talking about different rights.
[01:28:26.540 --> 01:28:32.540]  Yeah, I agree with you on a different right, but I'm just trying to tell you what I've read.
[01:28:32.540 --> 01:28:44.540]  Okay, well, I understand that part, but when they mention that, I'm willing to bet you, does it specifically say that the denial of counsel is in fact a restriction of liberty?

[01:34:58.540 --> 01:35:06.540]  If you're going to add malicious prosecution to the same series of events, then you cannot sue them twice for the same series of events.

[01:35:14.540 --> 01:35:22.540]  But in some cases, such as the false imprisonment portion, they do not rely on each other in any way.
