[01:21.960 --> 01:26.600]  their conversations, leading to the selling of fetal tissue in organs for profit scandal.
[01:26.600 --> 01:32.800]  The charge consists of 14 instances between October 2013 and July of 2015, where Daly-Eiden
[01:32.800 --> 01:36.400]  and Merritt filmed Planned Parenthood personnel without permission.
[01:36.400 --> 01:40.760]  They are facing a felony count for each person they discreetly recorded, along with an additional
[01:40.760 --> 01:44.120]  felony charge for criminal conspiracy to invade privacy.
[01:44.120 --> 01:47.760]  Mary Alice Carter, Interim Vice President of Communications for Planned Parenthood,
[01:47.760 --> 01:52.000]  the Federation of America, said in a statement Tuesday that the nationwide investigation
[01:52.000 --> 01:55.800]  have made it clear that Planned Parenthood has done nothing wrong and that only people
[01:55.800 --> 02:01.080]  who broke the law are those behind the fraudulent tapes.
[02:01.080 --> 02:06.040]  Abidemi Ajiboye, Assistant Professor at Case Western Reserve University, lead author of

[07:49.480 --> 08:01.480]  And the Texas Constitution says that any bill that is not passed in accordance with that Constitution's requirements is not valid law and has no force and effect of law.
[08:01.480 --> 08:14.480]  Now, that would mean that the state of Texas since 1995 has been perpetrating a massive fraud on the public by using a code that is absolutely unconstitutional.
[08:14.480 --> 08:22.480]  And they had to have known it was unconstitutional from the very beginning.

[16:30.480 --> 16:39.480]  But it allows them to call anything in that code an offense and use it to steal your money.
[16:39.480 --> 16:49.480]  The penal code says very clearly that a defense that is not defined by statute as an offense is not an offense.

[21:44.480 --> 22:01.480]  Okay, now what I was saying yesterday about the class is that by going through Article 3, Sexes 29-39, you find out everything that the Texas legislature is allowed to do and must do in order to enact the law.
[22:01.480 --> 22:18.480]  And the only authority given to any public body to do so is to the two houses of the legislature working together to produce law that the governor must sign or bill that the governor must sign into law.
[22:18.480 --> 22:27.480]  Okay, it's not law until it gets a signature on it or it gets a vote that puts them over the governor's veto or failure to sign.
[22:27.480 --> 22:30.480]  Then and only then does it become a law.
[22:30.480 --> 22:49.480]  Now part of what we learned in the class was exactly how the legislature has defrauded the people through the use of the courts into believing that they are being charged with an actual offense against the law here in Texas.
[22:49.480 --> 23:09.480]  There are 19 potential definitions of the term law in the combined codes of the state of Texas. Out of those 19, only 11 of them give us the singular definition law means.
[23:09.480 --> 23:21.480]  Okay, and then it gives us a definition of what law means. There is not a single one of those definitions that is constitutional, not one. Why?
[23:21.480 --> 23:42.480]  Because they say that not only is the Texas Constitution and statutes enacted by the legislature law, but so are city ordinances enacted by city councils, rules and regulations enacted by any particular bureaucratic agency at any level of government,
[23:42.480 --> 23:58.480]  school district boards, et cetera, et cetera, or special, what do they call it? I forget what the exact term is, but special needs types of agencies like the local water board and so on and so forth.
[23:58.480 --> 24:13.480]  The definitions of law in the statute encompass things that absolutely do not qualify under the Texas Constitution as valid law, including case opinions.
[24:13.480 --> 24:30.480]  This is how the attorneys got the court opinions converted into law binding upon the public by using a statutory definition that violates the Texas Constitution's prohibition on who can make law.
[24:30.480 --> 24:50.480]  Now, let me tell you why that's a big deal. It's a big deal because if the courts can interpret any statute to get any outcome they want, then the court is in essence the creator of the law, not the legislature,
[24:50.480 --> 25:00.480]  because they can take anything the legislature wrote and they can interpret it any way they want to get any result they want.
[25:00.480 --> 25:15.480]  And that's a problem when you consider the fact that right now we have the courts of Texas fraudulently converting statutory language to mean something other than what it actually means in the law.
[25:15.480 --> 25:25.480]  They ignore it as if it doesn't exist and if it's not binding upon them. It is fraud, massive, fricking fraud.
[25:25.480 --> 25:33.480]  Now, the reason I say this is a problem is because that completely alters the purpose of the courts.
[25:33.480 --> 25:44.480]  In the interpretation of law, I have long believed and despite the fact that history shows this to not be the way they've done it, that doesn't make the way they've done it right.
[25:44.480 --> 25:50.480]  Not when you consider the principles and spirit of the Constitution on individual rights.
[25:50.480 --> 26:04.480]  What the courts and the attorneys have done to our justice system is absolutely unconstitutional on its face because the courts are making law by interpretation.
[26:04.480 --> 26:19.480]  I have long argued that the courts so power to interpret is, does the plain language of the law violate a protected right or any provision of the Constitution itself?
[26:19.480 --> 26:40.480]  If it does that in its plain language, it is unconstitutional, period. That is the limit of the courts power to interpret under any Constitution because anything else is the court creating law.

[26:43.480 --> 26:54.480]  But of course, the attorneys don't want to see it that way because this puts all the power in their hands, all of it.
[26:54.480 --> 27:08.480]  They can sit in the legislature and create any law they want and know full well that if the law doesn't cover what they want actually, then the court will construe it to do so with interpretation.
[27:08.480 --> 27:23.480]  So attorneys that shouldn't be sitting in the legislature because of the violation of the separation of powers under the State Bar Act because the State Bar members are judicial officers according to the law of the State Bar Act.
[27:23.480 --> 27:32.480]  So these attorneys are sitting in our legislature creating law to benefit themselves or their cronies.
[27:32.480 --> 27:42.480]  Okay? The courts full of attorneys and entirely controlled by attorneys, the people do not control the Justice Department of their government anymore.
[27:42.480 --> 27:47.480]  We cannot hold a single office in that department that has any power to do anything.
[27:47.480 --> 27:54.480]  That in itself is unconstitutional.
[27:54.480 --> 28:09.480]  So the attorneys play along with the attorneys in the legislature via the courts to create a law that applies however they want it to apply, whenever they want it to apply.
[28:09.480 --> 28:23.480]  And then you have the only department of government left with any sort of oversight on either of these other two departments for these actions and who holds the highest offices in that department?
[28:23.480 --> 28:25.480]  Attorneys.
[28:25.480 --> 28:27.480]  Our governor is an attorney.
[28:27.480 --> 28:30.480]  Our last few governors have been attorneys.
[28:30.480 --> 28:35.480]  Our attorney general, they've all been attorneys.
[28:35.480 --> 28:47.480]  Our entire system of government has been usurped by a single classification of people, and they use it entirely to their benefit and our detriment.
[28:47.480 --> 28:50.480]  So I'll say this again, people.
[28:50.480 --> 28:53.480]  You don't need to worry about admiralty.
[28:53.480 --> 28:55.480]  You don't need to worry about gold fringe flag.
[28:55.480 --> 28:58.480]  You don't need to worry about UCC.
[28:58.480 --> 29:04.480]  You don't need to worry about the Queen of England or the Vatican because they are not the freaking problem.
[29:04.480 --> 29:16.480]  The problem is, is that the only people that can cut the pie for the rest of us are a bunch of criminals that don't want to share.
[29:16.480 --> 29:21.480]  They have rigged the game in their favor at every turn.
[29:21.480 --> 29:25.480]  Where else could you come up with judicial immunity and have that stick?
[29:25.480 --> 29:29.480]  There is no such thing as judicial immunity in the actual law.

[35:01.480 --> 35:11.480]  By using a definition of law in the statutes, now we have the problem of a violation of the enacting clause.
[35:11.480 --> 35:24.480]  Under Article 3, Section 29, the Texas Constitution requires that any law have the enacting clause at the very beginning saying by what authority that law was made.
[35:24.480 --> 35:30.480]  And the only authority in the enacting clause is being enacted by the legislature of the state of Texas.
[35:30.480 --> 35:31.480]  Okay?
[35:31.480 --> 35:35.480]  Now, no ordinance has that enacting clause.
[35:35.480 --> 35:39.480]  No regulation has that enacting clause.
[35:39.480 --> 35:46.480]  The statutes that currently exist do not have that enacting clause.
[35:46.480 --> 36:03.480]  Now, remember that since 1995, the Secretary of State no longer certifies that the statutes and the codes are in compliance with the underlying law that created it.
[36:03.480 --> 36:04.480]  Okay?
[36:04.480 --> 36:07.480]  Now, why do you think that is?
[36:07.480 --> 36:10.480]  This is exactly the reason.
[36:10.480 --> 36:24.480]  They have deviated from the original acts unconstitutionally to create alterations by statute that affect the underlying law, and the Texas Constitution forbids that too.
[36:24.480 --> 36:29.480]  They cannot alter original legislation by statutory amendment.
[36:29.480 --> 36:41.480]  They must repeal the original act and reenact it if the amendment would change anything relating to the subject of the underlying law and the purpose.
[36:41.480 --> 36:48.480]  Well, they've changed this purpose exponentially, and they're still in the process of changing the purpose.
[36:48.480 --> 37:03.480]  They have been secretly culling for decades the language of the transportation code down in both in the old Vernon's annotated civil statutes and in the revised statutes of 1995.
[37:03.480 --> 37:12.480]  They have meticulously culled through those to remove the word commercial from everything they could.
[37:12.480 --> 37:27.480]  Now, that is a direct alteration of the purpose of that statute because you are now using it to encompass a more general class than what the commercial class specifically allows.
[37:27.480 --> 37:43.480]  By removing the word commercial, you exponentially expand the potential application of that statute to an area where the legislature never enacted the law to go.
[37:43.480 --> 37:50.480]  And this one galt guy in Colorado wants to tell me I'm the one that's wrong.
[37:50.480 --> 37:57.480]  I got news for you, but if you're still listening in any way, shape, or form, I'm not wrong. You're just a crook.
[37:57.480 --> 38:03.480]  You want everybody to believe you're right. You're not. You want everybody to believe I'm wrong. I'm not.
[38:03.480 --> 38:19.480]  I can back up everything that I've just said. All you guys can do at any level is to obfuscate terminology to make it appear as if you're right when, in fact, common sense and reason says it could not work as you are stating it.
[38:19.480 --> 38:27.480]  Just couldn't. No way in hell could it work like you are attempting to state it.
[38:27.480 --> 38:30.480]  Okay.
[38:30.480 --> 38:46.480]  Everything that is going on right now in every code in every state, you look at it, you will find it is total freaking fraud. Every single thing.
[38:46.480 --> 38:54.480]  Now, if those statutes and rules and regulations and ordinance do not have an enacting clause, it's not a law.
[38:54.480 --> 39:04.480]  The statutes, if they're not certified against the original law and have been altered and they have no enacting clause, they're not valid law.
[39:04.480 --> 39:09.480]  It is that simple.
[39:09.480 --> 39:28.480]  They cannot possibly be valid law if they originated anywhere than through the legislature and it is not saved by the fact that the legislature voted on it because the legislature violated other provisions to do that vote, such as the reading and discussion rule.
[39:28.480 --> 39:35.480]  They cannot arbitrarily suspend the reading of a bill in each house of the legislature over three several days.
[39:35.480 --> 39:47.480]  There is only one way they can suspend that reading and that is through a declaration of emergency through written proclamation from the governor relating to disasters caused by enemy attack.
[39:47.480 --> 39:51.480]  That's written right in Article III, Section 62 of the Texas Constitution.
[39:51.480 --> 40:01.480]  It is the only valid method by which they must suspend any of the procedural rules in the Texas Constitution relating to the creation of law.
[40:01.480 --> 40:18.480]  There is no other place in the entire Constitution where that can happen except for Article III, Section 49A and then it applies only to appropriations bills, only to appropriations bills.
[40:18.480 --> 40:37.480]  So what they did when they enacted SB 971 supposedly was they suspended the reading rule using a fraudulent emergency clause that can only be used on an appropriations bill which SB 971 most certainly is not because it's a senate bill.
[40:37.480 --> 40:46.480]  And all bills dealing with appropriations must originate in the house, not the senate.
[40:46.480 --> 40:52.480]  It is not HB 971, it is SB 971.
[40:52.480 --> 41:11.480]  Yet they used an appropriations bill emergency clause to suspend that reading and they can't do it because Article III, Section 62 is the emergency clause that applies to general legislation and they completely ignored it as if it doesn't exist.
[41:11.480 --> 41:36.480]  Now remember, this was done in 1995, well after the fact that our legislature came under the complete control of attorneys, well after our court systems have come under the complete control of the attorneys, well after our executive department is entirely under the control of the attorneys.
[41:36.480 --> 41:41.480]  You want to understand any better why I hate attorneys as bad as I do?
[41:41.480 --> 41:51.480]  Why I would beat and kill to be in front of the line that pulls a lever that hangs every damn one of them on the gallows?
[41:51.480 --> 42:02.480]  I would fight my way to the front of that line with a ferocity like you have never seen to be the one that pulls that damn lever.
[42:02.480 --> 42:10.480]  And there would never be a more deserving public hanging to be had.
[42:10.480 --> 42:18.480]  The closest thing to it would have been Benedict Arnold.
[42:18.480 --> 42:35.480]  This is treason, this is sedition, this is massive, massive public fraud and one class of people is 100% responsible for it.
[42:35.480 --> 42:42.480]  And it ain't the Vatican, it ain't the Queen of England, it ain't any of them.
[42:42.480 --> 42:54.480]  They all live right in your neighborhood, all the scumbags responsible for where you're at, where we are at, live around you or the rest of us.
[42:54.480 --> 43:01.480]  They're not in some faraway land, they're not having to use some esoteric method of law to do what they do.
[43:01.480 --> 43:14.480]  They can create the law any way they want and control how it gets used and how we have no remedy against how they use it and how they construe it.
[43:14.480 --> 43:23.480]  Because they control the whole system, including the armed mercenaries that they use to protect themselves.
[43:23.480 --> 43:31.480]  The only choice we've got is to fight back because this system is not here to work for us.
[43:31.480 --> 43:43.480]  It is here to give us just enough relief to make it appear valid when they are on the brink of an insurrection and rebellion that would take the power out of their hands.
[43:43.480 --> 43:50.480]  Then and only then do they relinquish and let one of us win.
[43:50.480 --> 43:55.480]  If you don't believe that, all you gotta do is go read the case law and the opinion that they write.

[47:31.480 --> 47:41.480]  The courts, by allowing themselves to write the law in any way they want, regardless of its language and how it's enacted by the legislature.
[47:41.480 --> 47:44.480]  Or even what the subject matter of the enactment is by the legislature.
[47:44.480 --> 47:50.480]  They give you the impression that they are attempting to comply with the law as it's written.
[47:50.480 --> 47:53.480]  That they are only allowed to interpret it certain ways.
[47:53.480 --> 48:01.480]  I've got a third court of appeals opinion on a transportation case that proves that is absolutely BS.
[48:01.480 --> 48:10.480]  They went completely off the reservation to find ways to avoid addressing the issues raised in that case.
[48:10.480 --> 48:16.480]  They even made crap up so as to avoid addressing the issues in that case.
[48:16.480 --> 48:27.480]  That's not law, that's subterfuge, that's fraud, and the third court of appeals of Texas is guilty of that fraud.
[48:27.480 --> 48:34.480]  These people are supposed to be elected, and then they make you think they do a good job so you elect them again.
[48:34.480 --> 48:36.480]  They don't do a good job.
[48:36.480 --> 48:42.480]  They will never do a good job except for themselves.
[48:42.480 --> 48:59.480]  This is almost as big a transfer of power and wealth from the people to the hands of the attorneys and their so-called elitist status as the income tax is a shift of wealth in this country.
[48:59.480 --> 49:03.480]  And it does not really matter what offense you're charged with.
[49:03.480 --> 49:06.480]  The system operates the same way.
[49:06.480 --> 49:14.480]  They're just way more loose with it at the lower levels than they are at the higher levels, but they're still plenty loose with it even then.
[49:14.480 --> 49:33.480]  I mean, how else could you come up with a United States Supreme Court case opinion that says that actual innocence of the crime for which you're convicted is not grounds to change the rules of procedure on how to appeal to get out of it?
[49:33.480 --> 49:40.480]  In fact, it's not even a way for you to get out of it according to the United States Supreme Court.
[49:40.480 --> 49:52.480]  And the guy that was convicted was wrongly convicted of murder that his brother had actually committed, and the evidence didn't surface until years later after the brother was dead that had done the crime.
[49:52.480 --> 49:58.480]  That was how they had got the DNA match that they got, okay?
[49:58.480 --> 50:17.480]  But the innocent brother was in prison on death row and got executed because the United States Supreme Court would not overturn his conviction because he had passed the statute of limitations on when he could actually appeal despite the existence of new evidence.
[50:17.480 --> 50:24.480]  Now, ain't that some crap?
[50:24.480 --> 50:29.480]  There are so many places where the courts have stepped that they should never have gone.
[50:29.480 --> 50:41.480]  So many ways they have altered the fundamental purpose of individual rights and power and government in this country, it's not even funny.
[50:41.480 --> 50:45.480]  I've said it before, so let me say it again.
[50:45.480 --> 51:02.480]  Any court interprets any law in a way that says there must be a balance between the individual right and the delegated authority, that court is dead wrong.
[51:02.480 --> 51:06.480]  And it's very easy to explain why.
[51:06.480 --> 51:10.480]  Where does the delegated power come from that they're talking about?
[51:10.480 --> 51:15.480]  It comes from the people as a whole.
[51:15.480 --> 51:25.480]  Logic dictates no one can delegate to an agent any power or authority that the principal themselves do not possess.
[51:25.480 --> 51:30.480]  For instance, it is not legal for me to murder someone.
[51:30.480 --> 51:40.480]  Therefore, I cannot delegate the task to another to murder someone for me and be relieved of the liability responsibility of doing so.
[51:40.480 --> 51:48.480]  Because I don't have the legitimate power to murder anyone in any way, even by delegation of authority.
[51:48.480 --> 51:58.480]  By a lesser token, I do not have the authority to march over to my neighbor and tell him if he wants to live in this neighborhood, he's got to pay me a tax on his property to stay here.
[51:58.480 --> 52:07.480]  And he has to pay it every year without fail or I can take his property from him through court action and foreclosure.
[52:07.480 --> 52:20.480]  I can condemn his property for failure to pay me that fee that I want to charge him and I am free to raise or lower that fee at my own whim, such as the nature of property tax.
[52:20.480 --> 52:31.480]  Now, I cannot do that as an individual. How is it possible for me to give that power to someone who is working as my agent? It isn't.
[52:31.480 --> 52:45.480]  So as you can see, there is no way to balance a delegated power against an individual right. It cannot be done.
[52:45.480 --> 52:58.480]  There are only two ways delegated powers can operate in compliance with individual rights or in direct violation of individual rights.
[52:58.480 --> 53:05.480]  Now, the violation can be legitimate. And I know that sounds odd, but it's true.
[53:05.480 --> 53:23.480]  Had I used a power I didn't have to murder someone or to get someone else to murder someone for me, then I have waived any rights I could claim to my liberty or even to my life in a capital punishment issue.
[53:23.480 --> 53:33.480]  I waived at the moment I exerted an authority I did not lawfully have to do something that I did not lawfully have the power and the right to do.
[53:33.480 --> 53:48.480]  I waived my protections of those rights and thus I deserve to be punished by whatever means the people deemed necessary to make retribution for the crowd by committee.
[53:48.480 --> 54:01.480]  How hard is that to understand? There is no balancing between individual rights and delegated powers.
[54:01.480 --> 54:20.480]  And there is no authority in a government of the people who operates by their consent to create for themselves a larger power than that which we the people ourselves possess.
[54:20.480 --> 54:26.480]  It cannot be done.
[54:26.480 --> 54:45.480]  What the government has done without our permission and consent is to convert the firecracker we gave it to celebrate the 4th of July and turned it into an atomic bomb by which to subjugate us.
[54:45.480 --> 55:02.480]  That's what they've done and we are the responsible parties for allowing it to happen by simply taking them at their word they were doing this right. They were never doing it right. They're not doing it right.
[55:02.480 --> 55:20.480]  And if you can show me somehow where that would work I'll listen but I don't think I'm going to have to listen long because you can't do it. Those are the only two ways that delegated power can work.
[55:20.480 --> 55:28.480]  It either has to comply with my individual rights or it has to violate my individual rights.
[55:28.480 --> 55:35.480]  See it's not even right that you could think that I could waive it so that you could violate my right.
[55:35.480 --> 55:47.480]  Because the government has no authority to even request that I, its master, waive my right so that it can violate me without harm.
[55:47.480 --> 56:00.480]  It's an idiotic argument. Wait, wait, wait. Are you telling me you can't really rob me unless you have my permission to do that? You really can't murder me on the side of the road unless you have my permission to do that?
[56:00.480 --> 56:10.480]  Oh, well fine. I'll waive my protection under those circumstances then. Shoot me or rob me, whichever one suits you and you'll never have any repercussions for it.
[56:10.480 --> 56:23.480]  Yeah, that makes a lot of sense, doesn't it? That is such asinine stupidity it's not even funny.
[56:23.480 --> 56:30.480]  And yet, here we are. It goes on day in and day out.
[56:30.480 --> 56:43.480]  And you would think that people would begin to see the light at the end of that tunnel by now. Because Lord knows there's getting to be enough people out there screaming about the fact that we're stuck in this damn tunnel and we need to dig our way out.
[56:43.480 --> 56:53.480]  But then again, you have those other individuals with the misleading, misconstrued, misinterpreted, misunderstood information about how this is all actually works.
[56:53.480 --> 57:02.480]  When in fact, it's just as bogus a theory as the way they're actually doing it is valid. It's completely bogus.
[57:02.480 --> 57:15.480]  Because I just showed you step by step why none of that bogus theory is required. They don't need it, people.
[57:15.480 --> 57:26.480]  They can make up anything they want under the current system as it exists. Why can't you get that through your heads?

[01:10:27.480 --> 01:10:40.480]  See, here in Texas, their own rules only limit them to 60 days. If they haven't responded within 60 days, they're in violation of their own procedural rules on how to respond to these appeals and motions on appeals, okay?
[01:10:40.480 --> 01:11:00.480]  So, when they go past those deadlines, what I did in my case that got them off the dime in a millisecond was to follow notice directly with the United States Attorney's Office in my district that I was being deprived of my due process right and access to the courts for the purpose of appeal by the appellate court itself.
[01:11:00.480 --> 01:11:09.480]  Oh, man, they sent on my appeal for a year until we filed that letter, and then less than a week, we had an answer.
[01:11:09.480 --> 01:11:18.480]  Okay, okay. Well, I'll go into the statute and see how much time they have because I got a court date.
[01:11:18.480 --> 01:11:23.480]  Well, don't just look in the statutes. Look at the rules of court.
[01:11:23.480 --> 01:11:35.480]  Get whatever the local rules of court are for whatever court you're talking about and see if they've got a rule in there as to how long they've got to respond, as well as whether or not there's a state law on how long they've got to respond.
[01:11:35.480 --> 01:11:40.480]  Because their rules can't go over what the state law says.
[01:11:40.480 --> 01:11:51.480]  Okay, okay. Because I'm going to this, I guess, hearing to show calls, I guess, the...

[01:12:32.480 --> 01:12:42.480]  So as soon as he did that, I got the motion to disqualify him because he was basically intimidating me because I didn't pay the fine enough.
[01:12:42.480 --> 01:12:48.480]  Yeah, he's not allowed to do that while the appellate process is still ongoing.
[01:12:48.480 --> 01:12:55.480]  Now, in certain ways they can do that in certain ways they can't.
[01:12:55.480 --> 01:13:05.480]  Okay. For instance, in certain cases they can lock you up if you've been sentenced to prison even while the appeal is ongoing.
[01:13:05.480 --> 01:13:11.480]  All right, but when it comes to a monetary only judgment, no, that they cannot do.
[01:13:11.480 --> 01:13:23.480]  Okay, because I disqualified him and the case was... I wouldn't say the case was over, but I had lost in the first appeal that I took, but I hadn't taken my appeal to the appeals court.

[01:13:24.480 --> 01:13:31.480]  So I lost in the first appeal, but my appeal to the appeals court is still waiting for approval, application to believe...

[01:13:38.480 --> 01:13:42.480]  That stops them from collecting while the appeal process is ongoing.
[01:13:42.480 --> 01:13:57.480]  Well, what I did was I... the judge, when I got him disqualified, there was another judge there and he wanted me to pay and I told him that I wasn't going to pay unless it was towards the appeal bond.
[01:13:57.480 --> 01:14:06.480]  So what I've been doing is I've been spending like $30 every two weeks for my appeal bond in the lower court.
[01:14:06.480 --> 01:14:18.480]  So I don't think that should be an issue because every time I write a check out, I write something like a little motion stating that this is for the appeal bond in this matter.
[01:14:18.480 --> 01:14:29.480]  So I don't think they'll misconstru and think that I am trying to pay the fine, but that's one thing I'm not trying to do, pay that fine.
[01:14:29.480 --> 01:14:33.480]  Yeah, well, they can't make you pay the fine because that stops the appeal.

[01:47:45.480 --> 01:47:56.480]  Here in Texas, 521.025 of the Texas Transportation Code says that a person who fails to produce a license on demand commits an offense, okay?
[01:47:56.480 --> 01:48:02.480]  That's the statute that says you commit an offense by not producing it on demand.
[01:48:02.480 --> 01:48:06.480]  The problem is the statute's unconstitutional in multiple ways.
[01:48:06.480 --> 01:48:14.480]  One, the entire code is unconstitutional because it was illegally enacted, unconstitutionally enacted.
[01:48:14.480 --> 01:48:24.480]  The other way it is is that it requires you to provide a law enforcement officer with evidence that he can use against you in a court of law.
[01:48:24.480 --> 01:48:29.480]  If you hand him that license and it's expired, he can charge you because of it, right?
[01:48:29.480 --> 01:48:35.480]  If you hand it to him and it's not you on the license, he can charge you with another crime, can he?
[01:48:35.480 --> 01:48:46.480]  If your birthday was yesterday and you don't have an updated license, he can charge you with an expired license, can he not?
[01:48:46.480 --> 01:48:55.480]  That information that you're producing in the form of that license is a fourth and fifth amendment violation when they get their hands on it without a valid warrant and without your consent.
[01:48:55.480 --> 01:49:03.480]  It's an illegal search and seizure and it's an illegal deprivation of your rights under color of law.
[01:49:03.480 --> 01:49:06.480]  So the officer's dead wrong on multiple fronts.
[01:49:06.480 --> 01:49:09.480]  I would not argue the contract issue with him.
[01:49:09.480 --> 01:49:11.480]  I would ask him this question.
[01:49:11.480 --> 01:49:13.480]  Officer, is it your contention?

[01:49:15.480 --> 01:49:25.480]  Officer, could a license once produced to you contain information that would potentially incriminate someone in some other crime?

[01:50:38.480 --> 01:50:45.480]  So you're saying the statute trusts my fourth and fifth amendment rights to self-preservation and not to testify against myself.

[01:51:47.480 --> 01:51:55.480]  I've been following all the steps of appealing it, trying to take it to court to fight it.
[01:51:55.480 --> 01:51:59.480]  But if they, you know, do I have to sue them?
[01:51:59.480 --> 01:52:07.480]  Well, yeah, they're going to insist you've got to pay no matter what until you make them prove it in the court of law.

[01:52:42.480 --> 01:52:47.480]  From the company that manages the toll road.

[01:53:15.480 --> 01:53:38.480]  So you send the request of that information to the state comptroller and you ask for an exact accounting on how much public funds in whatever form it may have been given or taken was used to finance the construction of that toll road.
[01:53:38.480 --> 01:53:53.480]  Don't ask the private company, ask the people who gave them your money and are required to tell you that they did so.
[01:53:53.480 --> 01:53:55.480]  You there?

[01:53:59.480 --> 01:54:09.480]  That's the only way if I take them to court and just argue the merits of not operating on the transportation code.

[01:54:14.480 --> 01:54:26.480]  If you have law in California that says all public accessible roads are open to the use of the public for their private business and pleasure, that would include toll roads, would it not?
[01:54:26.480 --> 01:54:33.480]  If public funds were used to make it and build it, then it's your road.
[01:54:33.480 --> 01:54:44.480]  The commercial drivers can't use it for their purposes without paying money, but the people can because it's their road.
[01:54:44.480 --> 01:54:50.480]  It's not the toll company's road, it's not the state's road, it's the people's road.
[01:54:50.480 --> 01:55:03.480]  The only way that a toll company could collect money from the public on a toll road legitimately is if the toll road is funded 100% privately.
[01:55:03.480 --> 01:55:19.480]  And then we have a whole other constitutional problem of whether or not the condemnation of the land upon which it is built was actually stolen through imminent domain from those who rightfully owned it in order to construct that road.

[01:55:25.480 --> 01:55:26.480]  Okay.
[01:55:26.480 --> 01:55:36.480]  Once you have that evidence, then all you have to do is start finding the information that proves that the toll roads fall under the same code as the commercial transportation, right?
[01:55:36.480 --> 01:55:41.480]  Aren't all the toll road statutes and the exact same statutes as the commercial transportation?

[01:55:42.480 --> 01:55:43.480]  Okay.

[01:55:45.480 --> 01:55:55.480]  All you do is find the statutes and they're written right there into that code in California that those codes only apply to commercial vehicles.
[01:55:55.480 --> 01:56:02.480]  Well, I thought there was a thing when they give you an infraction or a ticket, you would still have the opportunity to go.
[01:56:02.480 --> 01:56:11.480]  If the infraction is governed by the commercial statute, it can't be upon anyone but who the statute deals with.
